meeting of the Burnville burough Council this meeting is being conducted in person in the council chambers in burrow Hall and it is being broadcast Live on YouTube and on Zoom to make it as convenient as possible for residents to attend the meeting members of the public who are here in person and those attending remotely on Zoom will be given the opportunity to comment at appropriate times during the meeting in accordance with the following guidelines members of the public will be allowed to speak during the open sessions and during formal public hearings on the agenda including public hearings on ordinances comments will be limited to 3 minutes per speaker which will be monitored and enforced by the burough clerk comments containing offensive profane or indecent language or language constituting hate speech will not be permitted remote participants will be muted unless they are unmuted by the clerk and remote participants will not be able to unmute themselves the clerk will mute remote speakers at the expiration of their three minutes of a lot of time or if they make any inappropriate or offensive comments All speakers whether th in person or on Zoom shall State their name and address before making their comments speakers on Zoom shall activate their cameras so that they can be seen by members of the governing body and audience failure of the governing body to provide a live broadcast of this meeting or technological problems encountered during the course of the meeting that affect remote viewing Andor participation will not invalidate this meeting or any action taken including but not limited to the adoption of any ordinance resolution or motion all right we have a bunch of presentations tonight um we have another Eagle Scout I think this is number 11 this year so we have a proclamation for Alec Hoskins um I don't think I have to read the whole thing no uh that we will be sending to him I think that was the 11th he had 10 before that so uh congratulations to Alec Hoskins um we're skipping the Hometown Heroes because Tim couldn't be here today but um guess we'll do that in November he's still Hometown hero that's right uh Jeff Hammond is here to talk about sustainable Jersey and our silver acation many thanks to you and the green team for putting in all this work to get us a silver that's part what I want to do is is just to acknowledge everybody it's not just the green team that did all this but uh I think you you probably got the email today hope got email today it was officially recognized that we have now been elevated to the silver status yes you weree bronze right we weree bronze we bronze since the beginning and and most of the St is brought actually handed um 81% of the municipalities in the state participate in some fashion with sustainable Jersey but less than half somewhere on the order of 40% actually carried it all the way through to certification most of those are Bron as an example in Somerset County the 21 municipalities only eight are certified were obviously the smallest of of those so that in and of itself is a better our Gap but now that we actually made up to the silver level that puts us in a much more welli air um there are very few Golds and you have to be a large city like Trenton nework but um you know there just a handful of those but make a long story short what I did was I handed out just the council's aware of all the work that got into this a small grid of short one another we got okay um a grid of all uh not only the requirements but also what we achieved so you can see in the table how many categories you have to cover we did far more than is necessary how many actions we we've did and then I broke it down by categories of uh the various domains that uh make up sustainable Jersey which is not just environmental by the way they they take into account um supporting local businesses resiliency of the community Emergency Management a lot of other things that most people people may not necessarily you know think about when they think about sustainable think about environmentalism but make a long story short um a lot of hands went into this I can just have a minute because I think everybody three minutes under presentation but um got immense amount of help from the bur so and I'm sure I'm going to forget somebody and if so apologize up front but um we got a lot of help from DPW from John McDow Kathy rley uh they were instrumental burville Police Department really stepped up not just Chief but Sergeant Richard and and Captain gel as you can see from the grid a lot of these things were related to Emergency Management I got a lot of support from it cryst m um Recreation about marwick of course you never mention anything about the bur without mentioning our clerk um the U environmental commission uh chipped in not just the green team we're sort of a subset of the environmental Commission Green Team so you know Rob Wilson Johann whinger M Conover um Adrian Nowack and of course the the co-chair of the Green Team uh a great the rree I think uh got a especially carve out recognition for the amount of effort goes into the farmers market so we have M English and Pat Kennedy Grant and then the community garden uh I gotta say Ros Lee Baker really bailed me out on this one so she picked up a lot of the slack and then there were other community organizations it wasn't just all within Bernville so we partnered got a lot of assistance from what was said downtown burville now Main Street um rared headquarters the trails committee the Garden Club which really helped out at in our green Fair the over the April and then um special shout out to the high school Green Team most people don't know this that burville High School actually has its own green team which is very robust may be more active than we are so that's off to them uh but there was lot of support for that so I just wanted to acknowledge everybody who went into this uh and um we our certification is good for three years as you can see from the table though a number of the actions expire at the end of this year that doesn't mean we lose our certification it just means if we were to reapply we'd have to redo those and so rather then wait for three years to go by and then scramble to get everything weone our our plan is to continue uh those that are going expire at the end of 2024 we'll make sure we upgrade them and then we have a number of new projects on the docket that we hope will be a benefit to the community and we'll roll those out as as we can so thank you very much for your time I just wanted to uh give everybody a pat on the back thank you Jeff are you GNA go to the luncheon or do you know anybody that is I mean I will be there I'm supposed to get a knee replacement on Monday so depending if I'm mobile uh it can drive uh I think it's the 19th I'll be you can take the picture yeah excellent thank you so much you know uh Jeff just how many in Somerset County is anybody else silver yes yeah there are a couple silver so I think Happ um I don't know the top of my head I can send you a r report I'm just curious I bet they're all bigger than us oh everybody's bigger than us we may be the small I don't know and of course we'll have that comes out in November but we may be the smallest municipality to be silver in the state I don't know we'll have to find I'll have to find out um there aren't many municipalities with 7,000 people roughly that uh can make it that right yeah no congratulations this is really impressive uh I have another Proclamation um and this is recognizing commemorating the 79th anniversary of national disability awareness month and mainly it's uh recognizing I just want to publicly recognize the businesses in our town that employ disabled um adults and I didn't even realize we had them a jersey mice Burnsville shop Burnsville CVS and Burnsville Walgreens um all are supporters of disabled adults so um I think that's really we should give them some credit and I will send them each a copy of this Proclamation all right we have minutes to approve oh it's not on the agenda well he's is gonna be in conjunction with the Tim thing but I yeah that way we can let you go home I know my purpose here was talk about that are going to be voted on tonight um one is reference the truck roots and the other one is the overnight parking ordinance um I think we understand uh the truck route issue I don't think there's anybody in here that doesn't deal with tractor trailers these days and we we know there's too many of them but there's not a lot we can do about it um when the incident happened on Anderson Hill Road um I think I was asked to take a look back and say is there anything we do to strengthen our truck Roots I didn't find a lot and that's unfortunate because the trucks that are you know in consultation with Jack will tell you when they're traveling to and from to do business in Burnville they can pretty much use any Road in town they don't have to follow a specific rout even though we have a marked truck R those are for trucks traveling through burm and that includes M 202 Claremont Road mendum Ro those are clearly marked so um we thought about enforcement um making sure the officers are well aware of what ordinances we have on the book so they're out there looking for people that are traveling through and the other thing we talked about was signage um went around town made sure the signs were proper made sure everything um was clear to anybody driving a truck and it seems very clear to me I don't think signage is going to help I think we have plenty of it for that problem so so looking at other ordinances I came across one um that I thought least give our ordinance a little more teeth our current current ordinance um provides for penalties up to $50 for somebody who is traveling through Burnville in violation of the truck rout my recommendation was to increase those fines dramatically uh for firsttime offenders I think the range is $2,500 to $3,000 and the second offence would range between $4,000 and $5,000 so um this my opinion that if you don't give the ordinance some teeth and you don't um hit somebody hard when they're driving you through I don't think a truck driver is going to be really bothered by $50 in today's world so I suggest um providing a little more uh parure penalties for any violations any questions on that actually make sense no thank you foring it up and then the other ORD in that we've uh We've tossed that back and forth over the last um couple years is is the overnight parking ordinance just to make it clear um the overnight parking ordinance right now um currently only affects people parked on the roadways between November 15th and April 1st between specific hours of 2: a.m. and 6:00 a.m. the spirit of that ordinance that I think was probably generated over 30 years ago was in reference to snow and snow TRS and and having our operators from the road department come in in the middle of night having the roadway clean so um they they went ahead and had this ordinance which is difficult from the police department's perspective when we're enforcing that ordinance is it's very difficult in a logical sense to give somebody a ticket on November 16th for something they were allowed to do on November 14th on the same 60 Dee night so my suggestion looking at our ordinance is we already had one and that's 7- 7.3 that specifies the um overnight or parking on street when snow is accumulating that being said the ordinances are kind of redundant and I don't see my suggestion was to repeal um the overnight parking ordinance and let us just focus on the snow ordinance when obviously it's snowing and fall yeah that would include other emergencies as well um kind of freak weather events or hurricanes yeah 77.2 kind of goes for emergency so if the governor is to declare a state of emergency we can post signs and that would be under 772 but this is 773 is for snow living on the we already have that great great any questions thank you appreciate it okay back to the yeah all right John tony6 Locus drive and the borrow uh a couple weeks back there's a letter the editor of burns news a longtime resident of the bur I didn't think much about lber remarks at the time but I know that he's been had the best interest of bur for many many years uh after attending last week's Council working session I'm now tending to agree with it the council is a ton PL is working to engage with the residents you're hearing from many of us and others inputs have been memorialized to master plant but you're not listening let me use and I'm tonight's agenda just as an example on tonight's agenda is is resolution 24-22 small change order to the upgrade to upgrade the electric service of the poams in connection with the new lighting installation it was discussed at the working meeting that the service panel was upgraded to accommodate the needs of abil the B was planning for the site we didn't need to encour this $115,000 cost to get the lights to work that one decision well completely legal and within the bounds of the project think Jack called it minim CH change or something for that effect modification yeah ious modification sorry shows a disregard for one the remarks uh made by Bob Graham at last month's meeting council meeting where let out alternatives improving the existing facilities and there was a suggestion that you reassess the needs for the Pavilion previous suggestions from other residents to explore tapping into existing Water and Sewer connections at the pool which would also provide better access to the rests for the basketball and pickleball courts in other words two birds with one spone the recommendations of the recreation's master plan which prioritizes the needs for restrooms at the polo fields at the polar grounds confence and input from other residents in the surveys suggesting better coordination and agreement with schools and their facilities which included exter uh accessible bathrooms already at Middle School yes there were recommendations of the master plan for better concessions but that was across a number of facilities and not just the polar BRS Pavilions are rarely mentioned in the plan noting a single survey response that seemed to be the basis of one of the initial Pavilion designs it had everything but I have to ask you guys this and it's not really a question if an objective of improving the facilities is to one bring one day bring in tournaments to the Polo Grounds with the intent that it will provide additional Revenue opportunities for downtown businesses why are you looking to sponsor competition that will drive zero business downtown I just have like two seconds more if you're looking to build up downtown and effect change in the residential Comm commercial taxation ratios make that the focus of your actions the council has abandoned the current bids for the Pavilion but actions like this ad by this by this Administration would give anyone pause I would hope that the council do not again go around the process that has already started and continues to work and listen to concerned residents on this and other projects around town thank you thank you J anyone else I don't see anybody on there's one person online I don't see any other okay then I will close the public hearing um we're moving on to a hearing open I will open the public hearing on ordinance 2024 2006 um this I believe is going to be Ted so do we need a motion to either table or continue yes the agenda public meeting November 25 oh here yeah I need you go well can someone speak if they want to no I don't think we're not we going to continue it so right is it well you do we need to have the public hearing part or we continue read for the next time we should have public hearing okay so if anyone wants was just referencing um do that one um I move that ordinance 204-208 an ordinance refilling 77.9 of the B code which prohibits overnight parking from November 15th through April 1st be introduced by title pass on first reading published according to law and that a public hearing be scheduled for a meeting beginning at 7:00 p.m. Monday November 25th 2024 second all in favor I oppose I have a question sure what happens between November 15th and when this goes hopefully passes if somebody parks on the street sow there's no snow we already have a snow ordinance that's not we just we'll just focus on that ordinance and not this not this [Music] this is um actually this ordinance was about um the discharge of hazardous substances and I believe um I just would like to hold this off I would like our GIF to review it just to make sure that we have done everything in alignment with what they require I tell you with that it's not it's in intruction I'm sorry so if we can just put that on for November and just have the GIF run run to by then um the next is the penalties and again the chief talked about Jay you want to do that one I move that ordinance 2024 d2010 increasing the penalties for violating the borrow truck RS ordinance while traveling on a street or road having a grade in excess of 5% and supplementing and amending 7even of the burough code entitled traffic the move ordinance 2024 2011 n state cing of por of verners Avenue adjacent to block 114 L1 which is outside the p roadway in which is required the construction of the affordable housing development at CCP burners Avenue to be introduced by title passing bir Reading Public supporing Law and a public scheduled for meeting at 7M Monday November 25 2024 second all favor I oppose all right um do that I move that ordinance 2024 d22 ordinance of the burrow of Burnsville in the county of Somerset New Jersey adopting amendments to the 65 marst toown Road Redevelopment plan pursuant to the local Redevelopment and Housing law be introduced by title pass on first reading published according to law and that a public meet public hearing be scheduled for a meeting beginning at 700 P.M Monday November 25th 2024 I'll second Jack want to just give us an update on what that is yes mayor this is the we previously vacated a triangle front of 63 65 I'm sorry yeah this is by this is to amend the moving on to resolutions we have 24 to 13 12 through um 242 35 um 24232 we're pulling that's going to go on to November because they have not finished for that transfer the ABC license um I believe oh I I have a comment on 24235 235 oh right um and also I just want to add 214 is it just says approving items of business from our work meeting just to be clear on that that was improving the Girl Scouts with their geocaching thing um the feeding hands food pantry to move into the Fieldhouse at plemont um the nativity scene at the pond the winters farmer winter farmers market and the holiday parade those were all included in that one resolution J want to comment on the yeah so uh in our working and um we've been talking about the library bathroom and the um uh some of the changes that had been made in in delays um and just wanted to thank uh Nancy Fran um and um our bur um John of course and then our bur uh uh engineer Tony for the meeting on Friday um what we asked was for Tony to go back and um I guess Nancy maybe better if you outline out what he was able to um get changed in the in the in the contract okay so you had asked at that meeting that we try to get him to increase over the $5,000 that he agreed to in liquidated damages Telly was able to get get 13,000 for that then there were some um things that weren't done like uh hooks on the back of doors and stools at sinks and then there was supposed to be a tankless B Feer but it wasn't tankless so that's a $2,500 difference so when you add when all that up it came to 17,500 so the 13 is liquidated and the rest is a negative change and Jack thank you also yeah thank you all right Jay satisfied with the resolution yeah I mean given what we talked about in terms of the what we have the ability to go after I think it was a a good compromise and I think again appreciated what ton after got it Chang good yeah hopefully John and thrill great thank you thank you everybody any other comments on resolutions um can I ask or just clarify on 220 the lighting so when you first talk about the lighting it's in phases and the turf was the first phase and some of the next phases that we talked about were lighting the pth I think lighting the pth was put away yeah the next the next is the parking lot there's I think um six well regardless like is it was my understanding that you need the amps for that too am I right well so initi initially there was a call for 400 amps and that was because there were a lot more lights in that they don't plan which it since you you didn't want right so um the amps that were for just the lights were not going to be enough for the parking lot and put future Pavilion um which by the way you did a bond for a couple of years ago for the Pavilion I mean a million and half dollars that you pass before I got here so that was like in the work um so um yes there was phase one and phase two phase one5 um so by spending the $155,000 now now to get that in there saves us so much like potentially up to six figur um in getting the electric there and when the Pavilion is eventually built and when the just have to off that there it's so much less expensive than to upgrade it try do it second call please yes yes yes all right mayor's report uh we had a meeting of the mayor's Wellness committee so uh we are still working on our uh two big issues which is seniors and mental health I attended uh the new New Jersey Conference of Mayors evening on the bay um which was kind of the kickoff for that particular Association uh we had the visit from the president of Paraguay on the 27th which was really quite remarkable to have uh somebody of that stature be here in Bernville so thank you Nancy for all the arrangements and and Anthony whipping that together so we had like what 4 days notice that he was coming so that was great uh we had a ribbon cutting on the 28th of September for AI which is a new um children's clothing and accessory store so if you haven't been there please check it out it's really cute I attended the feathers and Tweed fundraiser for the somerson hills Education Foundation um I met with the Farmers Market Committee and mine English trying to come up with a succession plan for the Winter Market so I think that's we're making progress um I met I attended a meeting with Robert Wood Johnson was an introduction of their new CEO and they're looking to be more active in this end of the county this was a busy ribbon cutting month uh Lily and the rose design which is on Quimby in the uh Dr chains building beautiful designed Studio if you get a chance stop in I think she's even having a um like a sip and paint event going there I saw it on Facebook so just stop in and say hi she's really talented uh then we did a ribbon cutting on the 11th for The Works w r k which is a men's salon right next to Beast 73 uh I had a meeting with Tom Blackstock about safety in town um I spoke with the chief about it lot of concern about speeding and distracted driving people not paying attention to people in crosswalks and so I'm going to make a little ad hoc committee to come up with um a safety campaign to try and get the message out for people to be more attentive uh slow down so uh so far I have Joseph avalino Tom Blackstock and Michelle hker who are going to be on that committee um I attended a board of director's meeting for the New Jersey Conference of Mayors I attended an open house for Broadway Suites if you haven't seen that on Claremont um it's in the Essex I think it's the Essex building it's a an interesting concept where each little room is its own business of um I guess there's salons facials but each is independent it's it's a great concept uh we did a RI cutting at Embassy EMS Fitness which blew me away what that does I've never seen anything like that if you haven't seen that it's um next to the movie theater is it next to where is it Su where allop Square used to be um they it's a 20 minute you know you have this suit with like electrodes in it it's a 20 minute workout it's really interesting stop in and talk to me no they're going to Mo I uh met with the third grade girl scouts because they were working on their government badge so we talked about local government and they were just adorable we had a the Somerset County Business Partnership had a networking event here at the Bernie which was great because they don't always get to this end of the county so it was very well attended and uh hopefully they'll do more out this way I attended the community and Crisis Prevention Coalition meeting which they do twice a year um they gave us the results of their surveys on what students and adults in terms of usage of drugs and what trends are coming I heard of drugs I never heard of before there's a what is it the I can't remember it's it's not it's like chewing tobacco but it's not just put put it in your mou Z I have never heard of that yeah they're pretty popular I have a son who plays college baseball so yeah they got a lot of the kids from school doing now so they're that's one of their bches we had a main street board meeting if you haven't met our new part-time executive director Joe Oswald um stop in and say hi he's usually here like two days a week I think Tuesdays and Thursdays yesterday U Recreation did trunk or treat at the pool parking lot was phenomenal really well attended just a lot of fun it was Gina was there it was I think the kids you were there with the PO fabulous as usual costume I like to do costume um tomorrow we have Jeff buer from the business Action Center coming to tour downtown and give us some input on ideas for just kind of cleaning up our downtown and different ways to enhance the businesses so that'll be good um the last thing I've gotten a couple of requests for um from our local salons about um permanent like eyebrows eyeliner those kinds of things which is kind of like tattooing but not really um we had this had come up a while ago and I think what I talked to Jack our attorney and what it's considered is an ancillary service so that as long as the salon does not change their basic main business which is a salon they will be they are allowed to do ancillary services such as the permanent eyebrows um my only concern I think that is to make sure that there and I believe the health department has to regulate that so that's the only issue is that you know they they use the proper needles that they're sanitized and all that but as long as they don't change the sign to say tattoo parlor they're good all right and that was all I had that was enough Nancy you're up um The Next Step Highland uh is underway our draft consistency review and recommendations report is been posted on the Highland website for the required 30-day comment period and then there's a public hearing on our petition for plan performance on December 12 at their meeting um the notice and the link documents is on our website take a look and make a comment um the county agreed to our request to pay Clon Avenue during the day in Char road at night um this is not happening until next year in their um in their plan for next year uh and even though they usually put out signs only put out signs ofing the public of the dates they'll be Paving because you asked if they can send out letter yes so they will they will hand over letters wow thanks for asking um we began our interview for recreation director today and we have additional interview this week uh and probably next week so stay tuned um Le pick up again today today and then after this round the next and follow round will begin on December 7 um as a public service announcement some people been asking about how they can listen to the agenda meetings um which are also known as work sessions and if people don't um know what that is it's essentially the time where the council gets together and actually discusses all the things that they vote on today so um it's held next door and it's an opportunity for them to sit around the table and have a good involved discussions um they occur on typically the third Monday of the month and we began in February because January is a little bit of a a strange month with the dates of our meetings but um in since February when we started holding them audio reportings of the meetings have been posted on our website the day after the meeting so anthy post those the next day so they are accessible by going to the calendar choosing the date of the meeting and then click audio you can listen to the whole meeting and then finally um you mentioned the crash and chief mentioned it um we just want to give a special thank you to all of the Personnel agencies that responded to the track vacum so if you don't mind I'll just read them no go please so um police category we obviously have Bernville um Police Department burners Township sumers County prosecutor's office suers County Sheriff's Office the New Jersey State Police um from the office of emergency management Bernville OEM Somerset County OEM and the somerset Communications office uh EMS verville Fire Company EMS menum EMS Atlantic Highlands EMS and S County EMS coordinators for fire we have Bernville F Hills Bedminster Pac westone basing Ridge suers County Fire coordinator Springfield Fire Department mbum thei which is the UI me no they're very important and the New Jersey Department of fire safety uh has met suers county has met Elizabeth fire has met un county has met H county has met and the New Jersey Department of environment protection and finally DPW our DPW and the Far Hills DPW um also did a lot of work oh they all stayed very late so we just want to thank them for L literally risking their lives during what thank God was time could have been could have been at lar um and for all their uh timeing really long day and their H thank you you what is it urban area security initiative urban area security initiative that's was was was any fuel spilled 100 there was there was some uh there were some fuel spilled um but there was 9,000 I think there was 9,000 in the truck 8700 8700 lost about 200 gallons most of it went into the car that was trapped under oh got and then they had a big has like bag I catch the rest oh and then they put up a big burn in case yes and then thank you was a job well done yes definely thank you um I need a it's 4 to 6 they're gonna set up earlier that around noon how does that correspond to the parade parade is the following Saturday we were just talking about that that maybe we should try and see if the parade could be moov back a week because it's kind of nice to have one the earlier one is kind of for the little kids and then the later one is more nice last year the tree lighting on the they wrote in this email that they would do the lighting on the 14th or the 14th if you want to coordinate it with the parade no that was me oh that was you yeah change their date um but like maybe Main Street well I'll see if they can't move it back it's good for people who can't make one for did we that's true that's a good point because I can't make one we need to move anything or do we move it last yeah um we did not we just moved the other events that we had so do we need and what were the day when did the train have to come down we have a date on that I think January 12 was the day this the first weekend after the um Orthodox Christmas 12 he mo by 12 right so the six is the Orthodox so we need a motion to approve it yes motion to approve allay from November 30th to January 12 yeah we had to make sure the water was off um and while Jack and I were on a call with RPM the company who will be building housing they talk about the house is going to have to be um demolish so order demolish it you need to have the water turned off the street um so while we were turning it off I talked to new Georgia water and I asked if they could um turn off the street and they said well we have to open road you know we just paved it but it has to be done so um uh John gave them the street opening permit but usually we charge $2,000 to and since they're doing it for us I said that ask well they actually when they they have to do it anyway to for the construction probably yeah so at that point then they can right and repair when they do the construction yeah and it might slow people
