commission really quickly because I know that um you know the timing of of the Tallahassee trip here with Mr certa you know we've been planning it for a while and um I I completely didn't even realize that it fell on the same evening as as one of our commission meetings so it's my apologies I I don't know if I just badly timed it um but what I will say and I think I I mentioned it before we started you know I think things have been um very positive and very fruitful here and we have a lot of support in both the Senate and the house for our Appropriations um so uh it's been very good it's been very positive having said that um I do have two more meetings this evening that that are planned um so I know again I I mentioned that I I'm likely not able to be able to stick around for the the remainder of the meeting um so in my absence I was hoping that uh we might have one of the Commissioners step up and um and uh and and volunteer to run the meeting uh in my absence if if there's anyone that would feel uh feel suited to do so I would certainly um open the floor for that Mr Mayor I'd be glad to do it if uh no other commissioner wants to step up okay I I love that you did a great job last time so I'm all in yes that would be uh Mr Mayor that would be by a simple consensus of the commission okay great well uh commissioner I I appreciate you stepping up and and again I'm I'm terribly sorry for the timing I I didn't didn't plan it the best but um again I think that I think this is going to be beneficial for all of us so um if uh if there's a consensus for commissioner Huntington to kind of take over uh and and uh run the meeting from here on out um you know I would certainly be in favor of that as well so um uh how does the commission feel I have no problem with that y I think we're all in awesome great thank you thank you Mr Mayor I'll take over from here uh thank you commissioner thank you mayor since we moved up 5D our uh presentation from chisen Architects I guess we'll proceed with that presentation [Music] now good evening my name is Matt poock president of Chisum Architects uh with me is Juan Gomez uh our project manager on this uh project we uh we did bring some slides I don't know if you all can maybe pop those up but just to give you a little bit of history on the on the project uh in 2022 The Village had uh commissioned a uh conceptual uh or master plan study for the parking at at the edbrook park um and as such there came out of that study um um several options and recommendations of which one of the recommendations was to was to redo the rways around the perimeter of the uh around the perimeter of the park to provide uh parking um formal parking areas uh around the perimeter of the park um so in doing that uh we were retained uh last year I would say toward the end of 2023 the beginning of 20 24 to uh start the process of uh preparing the documents for the for the master parking plan so what we have here in the first slide is just the m is the is an aerial view of of the park um and then the areas that are noted in red which I wish my vision was a little bit better I got new glasses but they're I think I need to take them back but uh anyway uh what we have there is um we have um parallel parking along along the uh the the South the East and the West which would be along uh 13th Street to the to the South Ninth Court uh to the East and uh 9th Avenue to the West which would be the with the top of the sheet and then um and we also have additional parking a slight area of parking along um 115th Street um near the near the playground in in volleyball courts um the scope of work also entails new um entails new sidewalks uh new we included in this package as well as a a v course uh with sex seven V course exercise areas which we'll we'll get into in a minute um water fountains at on all sides um but predominantly it's the parking you know the issue here was uh to to put as much paved parking as we could without affecting any of the um any of the existing landscaping or trees if you can go to the next slide um so what you what you're seeing here is uh you know starting at the top or the west of the sheet um the we have parking spaces uh along that perimeter I want to say there's uh I don't have the exact number the total number of parking that we're providing new and existing is 50 of which uh we are proposing um 40 new spaces with um parallel spaces um along like as I said before along the along the perimeter with um 90 degree spaces just to the Northwest along 9th Avenue which and those are going to be uh 8A accessible spaces there and then we have new sidewalks uh around the perimeter um the V the V course as part of the sidewalk as well uh and then the parking the parallel parking spaces you can go to the next I guess the next slide this um this was the uh the the site Furnishings those are the the um v v course equipment that can be selected we have seven cor seven seven stations um we haven't selected all the stations yet something that will we'll work we'll work with staff the park staff to to set that out and then we also obviously we have uh benches bike racks uh water fountains trash receptacles and also a new uh trash enclosure uh going around uh at the at the facility as well so where we are right now with with the package is we've uh we've completed the construction document package we're uh at at a point now where we are we could go to uh perit um uh I don't know we haven't discussed the procurement as to how this would be procured whether it would be you know through a bid what the bid process would be on that but we're we're at that point now where we could uh would we would be able to proceed to start the permitting process if if that's um what the village would like to do um I can cycle through the rest of the drawings if you if you can it's just to give you some more um included in here are the Civil drawings I if you if if you can just go through the next sheets and we were we uh our civil engineer in landscape architect was Miller leg you just keep going this is pretty pretty General stuff right here but just uh we have some demolition um the improvements that we're doing on the right of way we're obviously in some areas of milling and resurfacing some areas where we have new parking we have new asphalt we're basically taking the improvements to the center line of the perimeter streets and improving those areas accordingly and then what you see here is the striping we're also uh improving the drainage uh this these will all drain um either to existing drainage structures or to new drainage structures which we've the which we've uh included as part of the as part of the design package um so with that um we're open to any questions that the commission might have I'll open up the floor now for questions if anybody in the commission has questions um thank you very much for your presentation so um I just got your presentation I think couple of hours ago so I haven't gone through the whole thing clearly um and the internet doesn't seem to be working I don't know if it's yet up um I'm connected to my phone I'm trying to open but it it won't I think it's a heavy document um so if you can give us a little bit of uh background as to how we got here quickly in terms of this is phase one of three or are we in phase two in terms of costs um this something probably for the manager what's the next step and do we have the budget what's spending I guess my my my question is more on the long term of the project as well in terms of timeline so if you can help us with the history on how we got here and um what phase of many are we at right well I I to to ask you which phase you're at um we are working on two projects at the park one of them is a electrical service emergency generator project uh which I would say we we did a report for that uh which is not part of this this project so this is really a standalone parking project now it it could be it it was prepared as one entire project but certainly could be done in phases you know by Street or you know by quadrant if if the depending on what the funding sources on that are um the other uh item sorry what what do you mean it could be done the way the way the design is it sets itself up that you you it'd be best to do it all at one time because obviously I think it's get the gets the most bang for the buck but that would require the Clos of the entire park for I don't I don't think You' be looking at closing the entire park that would be something we could work out with once a contractor is selected but the idea would be that um you know the disruption to the neighbors um would be something that you know uh it' be best to get it done faster than to prolong it would uh you know would be kind of what I would recommend to get it over more quickly um from a cost perspective the initial costs um and we have not done a estimate on this but um when it was originally contemplated back in 2020 2 the cost of the parking area was approximately $220,000 and the V course was probably another 100 um I would I would venture to guess you know being that that was two two and a half years ago that you know there's a good chance could be a good 20 or 30% on top of that and that's just really a budget so I think you're probably in the 300 $360,000 range um for the doing the whole project um and as it goes to the phases I sort of defer back to the village on on that yeah we were to move forward what's the next step so so commissioner um when I got here you had asked me to look at the CIP list uh as well as um other Commissioners and this was on the C CIP list this was one of the main projects and and uh commissioner hington has t a asked me um talked to me about this one that that was a top project so I had reached out to our architect and and met with him and asked him where the project was and then asked them to come here this evening to let you know exactly they're they're they're ready for pering our next step is as as was as um the consultant just said is the next step is either to go out to bid or or appoint uh a a contractor to start I I think we could do it in phases I would I would suggest we do it in phases and and not do try to do the whole project at one time and just do you know either the West P portion of the Park first or east portion of the Park first and you know not try to do the the entire parking lot first and then the other portion to it is the electrical piece and then we could do that I think that's ready for permitting also is that correct no I believe where we are on that is uh we we uh did a study of that uh provided with a a cost estimate I didn't bring the study with us tonight but we also we we studied the re redoing the service uh adding a a generator and I think we also contemplated um solar uh solar panels was also part of that report that one I think we need correct me wrong we need to go to work we we need to go through so the extent of the contract for that one was can you can I'm sorry can you speak to the mic so for the um the electrical panel project the extent of the contract that we had with the village for that specific item was to take it into that uh report phase so essentially um you know we're at 100% and it was for for the report yeah I think the next phase on that one would be we would go to uh a formal design construction document phase I don't anticipate that taking very long to do but that would be the next phase of the of the scope of work um so when was this report finished I think October it would have been October October last so it's our chance now to start looking into how we're going to fund this and move forward to the bidding process okay yeah absolutely all right um I'll leave it that right now any other Commissioners like to you just answered a question I was going to ask I wasn't on a commission before where is the funding going to come from to do this is it going to be able to be done in this budget or probably not right it's going to have to be done in the next budget so so commissioner if it's the desire of the of this board we can you know certainly start exploring U grants that are available or look at the budget if we we need to move money around uh to do that but uh um or take it from reserves but you know I I know this project has been sitting for a very long time and you know just keep kicking the can down the road I I don't think is the best option so if if you're asking me you know direct me to find the money that's what I I'll I'll certainly try to do we direct you to do that and you'll solve it for us I mean we have a conversation also with the grand riter coming up and I think that's the whole purpose is to go with a A list of items we all need to discuss um I just wanted to understand in terms of timing a pro like this you're talking about faces just for the purpose of um and and and and understand too that $360,000 as you continueing to delay the project that cost is going to continue to rise it already cost us 30% more probably that's the estimate you're you're saying so if I could I think it um and you know I don't know you know from the phasing perspective it's if it's really a staging what you really want to do is it's one project but you want to stage in in phases so that the the park doesn't you know undergo that as one way of it you know when we tend to look at phasing we tend to look at it as its own separate little piece that the rest may not in fact you know happen immediately in in sequence with the last phase so I you know there's a I think a way of looking at it as a it could be uh if you if you have the funding to do the entire project and it's a staging uh it's a staging exercise and then if you are limited on your on your funding then you know then it becomes more of a phasing phasing uh exercise how long uh how long would this project take I you know I don't it's it's hard for me to say how long that would take because um obviously the contractor and in this in the staging but I I would say it's hard to understand because with the drainage uh concerns and once you get into that what you're really going to be looking at there um but it would seem reasonable that you know six to eight months would seem to be a reasonable time to be able to with the with the right resources you should be able to do you should be able to do it in that maybe a little bit longer if you do four stages you know that might take a little bit longer might take a year and how much of um disturbance will be for the residents that are be in that area well you know the uh the way the the way the design is is set up the most all the work is on the on the park half of the RightWay so um and then it's done in in in sections so the neighbors that are directly opposite of those rways would be limited to oneway traffic on their probably on their street could be some you know issues you know during the during the week you know when they're working during the week and you know there might be some you know stopping of traffic to let cars go by and stuff like that probably the biggest uh you know issue would be really dealing with the park when it's being used um it I went by there before I got here so it's being used at night so you have a lot of you have a lot of people there and a lot of cars there so that's probably probably the bigger issue that the neighbors probably struggle with than than the traffic issue of it as far commission did we get uh like I said I wasn't on the commission at the time uh did we get response from the residents that are in that area about this project were they okay with it were they not okay with it no I don't believe we we ever you know I think that's I think that's very important because it is going to be a disturbance for them or an incon not the word disturbance inconvenience for them and I think that that's important that I mean I like the idea I think it's great um but I I I'm concerned about you know the residents that live in that area it's going to be an inconvenience for them and I think that we need to find out what they think just a couple of really quick questions we've been talking about this for years this is uh I'm glad to see that we're coming to some kind of a conclusion here I didn't know we had gotten this far but just to just to clarify for my my sake how many additional spaces are we adding to our current parking uh well that's that's a tricky question because the parking there right now is sort of halfhazard um people are parking on the you you really can't park on the North side that Park there's no parking allow permitted on that side on which side we they Park all around the park well you know I was just there and I saw the police were telling them to move it has a sign yeah 115 Street you can't park you can't park there so on 115th I think we're planning on adding up I don't have the exact number we're adding some spaces there and then they're really what they're doing now is they're just basically parking in the sale between the street and the thing and I counted uh I counted about 75 cars there but 75 cars parked all over in every in in everywhere so I think this was really a uh a way to to formalize and provide one a better a better solution in the long term with the with the asphalt paving and taking care of how many spaces in total we have 50 50 have we have 50 spaces right now I think there's four there's 10 or 12 that are currently paved there now like legit spaces yeah what you're saying is these are going to be 50 legitimate spaces instead of parking on the S and which is I'm saying that number is probably coming up around 75 is probably where you're looking at at that number right now if you went if you went there right so so your 50 spaces and we're already parking 75 around the Swale and whatnot and you're saying you're you're you're bringing in 50 space legitimate parking space one of the issues that we had and we talked about before and I don't know if this has been addressed was the the trees in that area U there's a lot of roots uh and a lot of folks were concerned about damaging the the the roots and and and killing the trees how is that being addressed are we addressing that that's that's probably one of the reasons why we're only at 50 spaces is because we're parking we're basically parking outside the the root barrier few trees that are going to be impacted but nothing that we feel is going to that's going to need to be uh remove any trees are being removed so I could if I could add to that there was um with the civil engineers we actually did a study on um you know the original layout of how that would affect the trees and uh we met actually with with John and with um Albert regarding that to see because there was a there was three spaces in question that were kind of in that red zone if you could you know if you could call it that currently um that's what brought our our number from originally we had 52 it brought it down to 50 and we were able to in in one other instance basically uh bring two spaces together to uh not affect the trees so the point of that was to make those little adjustments that there's no kind of tree mitigation or anything along those lines so we were able to kind of avoid any of that so long story short we're we're uh place the parking to have the least the minimal impact on the existing trees and then the last question is the asphalt question right so a lot of folks were concerned about bringing in more asphalt and obviously drainage and what not you guys spoke about drainage I have no idea how you guys are going to uh address the drainage issue obviously more asphalt uh less water penetration and so how is that how is the the drainage for the most part the the we're we're taking advantage of some ex that there's existing drainage uh around the perimeter on the street so we are we are either uh matching the existing grades and then draining back into those into those uh drains um and on 115th I guess we are actually introducing a new drainage system to pick up the water uh along there so there's a combination of uh existing drains a little bit of sheet flowing and then a little bit of uh new uh put installing new drains okay I just want to say thank you for this presentation this is a project that's been long overdue uh commissioner Samaria talked about disruption of neighbors we have neighbors that here here in tenant tonight who live very close to the park and there's a disruption of haphazard parking that's happening every day there's sidewalks that are getting broken every day by parking parking because you the the people that go to the park are parking on our sidewalks and and breaking them causing the village uh litigation or legal issues and money in repairs so this is a very needed project we can talk about funding but I'm just glad that we're at this point and I'm glad that we're moving forward and I'm excited to see us move forward so thank you can I ask a question uh this is out of ignorance but if we can uh afford right now to fit within the space 75 cars we're talking about building 50 we're going to be short so um there is no way to consider parking diagonal what park what cars are currently doing does it has to be you know parallel parking as it's uh suggested and why I I think there's probably two issues I think one issue is with the diagonal parking you're they're parking over the tree roots on that so then you really can't pave that area not on the entire side I know they're parking on the sidewalk but I'm talking if if this is truly a master plan and we would have to revisit the design of it which this is the opportunity 50 spaces might be short that's what we're saying maybe reconsidering the placement of the side walks themselves if we were to consider diagonal parking and again I don't know if this is a requirement this is my ignorance on the subject but if we're going to fall short and we're doing this investment wouldn't this be the opportunity to evaluate um we could certainly do that I think um and I I think we could go back and look at the initial report that was provided to us uh because there were some other options that were presented back in 2022 that we could go back and take a look at and see you know why were why were those ultimately not selected and why did we ultimately I wonder of course with considerations to the tree you guys already have it in mind if the sidewalks are broken which they are they will need replacement there might be the opportunity to place them even further in that would affect what we have in terms of the basketball again I don't know the details I'm just asking let's not fall short if we know you know we have 75 cards just one thing to consider though um and I'm not that I'm advocating for the neighbors but if I'm thinking as the neighbors um the more parking you you provide the more parking you're the more cars you're going to get so if you have 75 parking spaces you you're going to get 85 cars you're you know so there's there's a there's a maybe a bit of a psychology involved in that as well that that you know needs to be sort of fleshed out as well it's an enforcement thing as well right now the police were there when I was out there I was going to say right now you can see more than 75 cars parked on maybe on one side of the park sometimes you know there's a soccer game people that's the place to land so um I would hope that we provide the the best legally allowed spaces um with with in this project uh that we can that's all AB we'll go back and look at the report and and if you say something was already um analyzed in that sense there was a report done in 2022 okay so I'll be curious to see yeah that's a great point because if if you have if you're still having an overflow of vehicles then yeah we've made a nice designed area we're still going to be having the same issue and then we're going to have an informance issue of the same families asking where do I spend 300 some thousand doll and we're still going to have people parking horizontally and on the sidewalk and whatnot so yeah yeah but I think it as you start transitioning from a parallel parking to a diagonal to I do understand they do it now but they do it legally to have a legal official space we start to lose our Green Space of our soccer playe area we start to threaten our trees I think that this is why it was designed in the way it was yeah is to protect our Green Space protect our trees and eventually we do we would rather have a park or a parking lot yeah we have to limit it at some point and you know the more green initiative is the freebie walking providing other satellite parking areas things like that because we're we our park is only so big we can't grow it we can't make it bigger yeah so we have to balance the ecological with the you know physical structure we have yeah I just would like to see what was done and set I'm sure there is a reason why this kind of kind of came through that was at that point I wasn't there but I'm sure there was a back and fourth on this um I I I would just like to understand uh why it's not consider or has been considered that's all the other thing to consider too when you have parallel park well and he makes he raises a good point on the diagonal parking you're you're you're backing out into the street so it's a little bit more dangerous it's happening now but that's what I'm saying maybe the plans would allow for the parking to happen a little bit more in Theft which is commissioner's point on you're losing some green space I don't know that necessarily you have to maybe you move the sidewalk in again this is your guys job I just wanted to see um if that analysis was done that's it all right so for next steps um this is checked thank you very much this is wonderful news so we this stage and now the next will be to figure out where the money is coming from so about $330,000 is the estimate right 360 I would 36 yeah I would say I would be uh I think 20 I think 360 is probably the safe b i you know and I I don't you know depending if you guys you know want we you know we could always go to the you know at this point if a detailed estimates uh needed that's something we could we could take a look at as well okay but I think uh based on the information that was initially provided and sort of extrapolating from there I think that's kind of where we are right now is this the only project that you were handling in terms of plan and design like I said we were we were handling generat and the electrical yeah we're doing that and then we were handling a traffic calming project uh but that uh I don't think that anything ever that got stopped for a bit yes okay table that for now we move down to 5B our presentation from our grant writer is our grant writer here with us yes I am I'm here virtually I'm out of town excuse me sorry I couldn't be there with all right can I uh to the hi hello everybody good evening um can I heard you just heard the wish list of how much money we need yes I did we hope you have good news how are we gonna get the all right no I did um can I ask the clerk to let me share my screen please have a brief presentation I know you have a long meeting okay can you see the presentation now yes we can see Ito okay so great uh my name is Robert ran from eost Strata Services um and let me just sorry I'm not at my computer all right so ecost Strat service is who we are we've been 15 15 years in business actually January 21st was 15 years uh We've uh gotten 100 million in Grants and contracts for our clients um we specialize in Grants and government Affairs for cities and nonprofits and most of our work is grant writing compliance and we have a team of experienced staff to do this and here's our team uh myself Uma Janis grants manager Ian viia CEO Grant riter and Amy Scott who does grants compliance for us and then with history with h biscane Park just to give you a little brief history going back we started with bisc Park in 2021 and then had another contract uh in December 2023 our contract is to apply for six grand applications uh for storm water parks parking Log Cabin freebie and then we also are contracted due compliance on three grants these are results it's kind of hard to see my my apologies is very very hard to see uh it's this one I'll share with you because it changed from the first one but but in a in a nutshell uh we have about 250,000 awarded in 23 24 400,000 pending uh the next one is Brick uh building resilient communities and submitted a a notice of interest for that in August and uh need to submit it within the next month and then in April Firehouse Subs which is uh an application for aeds and police cars and then our compliance is on the freebies uh trees was was a p one resilience grants and the Log Cabin roof and you'll have the list there of all the grants I will tell you and I and uh we'll get into it because I know somebody had a uh commissioner H Huntington had a question about it uh fer app we did not apply for fer app this year had an issue at the last minute uh getting information getting all the information from the village and uh we did not apply it uh as it turned out it was also on a holiday and I don't know if that made a difference but uh it was with the previous manager by the way and then uh finally so the current compliance is with freebie there's a trianal review that were pending and uh submitted a quarterly reimbursement for review and then for the vulnerability assessment uh preparing the reimburse revisions on the reimbursement report and then for the Log Cabin roof uh preparing submit progress report and draft contract uh and the areas where we are looking at is uh storm water improvements Police Department Parks improvements and parking thank you very much if you have any questions I'd be happy to um answer them thank you for presentation Robert I will open up the floor to the commission for questions and comments I like your presentation was good just an outside question since we're talking about the projects that we have is it too late for you to try to see if we can get grants and reference to the 300,000 that we need to have with the project we just did or well well no not too late that that program does come up again in August there's two grants for that there's the fap Grant which is um2 200,00 ,000 and then there's also something called the land and water conservation fund which comes out up in October which can also and that typically has a bigger threshold it's a million dollars with a million dollar match so cities like when they have to do lights and stuff they typically wait for the Lanson water conservation fund so potentially if you applied for either one of those uh you would so it would be 25 and you could potentially get that funding in August 26 so you know the time frame okay thank you that's the 400,000 that's the 400,000 or or the million from the lwcf yeah it would be like August October I'm sorry if you can just put up the slide that you have the breakdown on an Excel sheet with the different amounts Sure hold on one second let me just okay sorry okay sorry there you go okay here you go okay so I just want to understand so in in yellow is what's pending and is it without color is what you're proposing to go next for it's either that we did not apply for or that we will apply for in the future so if if you have the fur app and transportation Alternatives in white says D DNA did not apply I'm sorry I should have have been cleared and then brick will apply um and then I don't know why that's that's twice brick and then Firehouse Subs sorry it says communities twice but it's brick and Firehouse Subs or the next one and so all the green is what we applied for and and the village received and then red is what we did not receive okay yeah I guess we are going to we're going to have a meeting with um about strategic session to think about how to face the budget for next season for the I'm sorry for the next fiscal I think this is the important question as to projects like the one we just heard that we have $360,000 where is the money come from uh the generator where do the money come from we've identified I think with the fall through of some of them my question is when when is the right timing and I don't have that timeline very clear I don't know if you you guys do um has been on and off in the CIP now so um I I thank you for for the information I think my next step is just to put this in in in consol consolidation with the projects and see how do we tackle that because that's my question to you Mr Rano Rano sorry ran Rano sorry um is you know our our projects on the pendent list how do we tackle then what's your recommendation and then obviously it's disappointed to hear that we didn't make the deadline uh for some of them and also on that point uh how do we touch base on the process so we work better in the future it can happen again so do we have to have a meeting with you I'm hoping he's part of the conversation we're going to have a further strategic planning right um at what point do we check in again to follow through as a commission as well so it doesn't happen again so that would be my propos just be part of the process identify where uh you need us to approve and move forward the needle so the approvals do happen and the timelines um you know uh I don't even know what to say I mean this unfortunately it was in in the lap of the former manager at this point nothing we can do but um the idea is that we don't get there again and um I just need to see all of this put in a spreadsheet with a timeline and then you know know we can talk about next steps I think we're just very green again unfortunately if if I could and I if I could just chime in for a second pleas yeah we can we can certainly do that and I and I'll tell you it was with the previous manager uh leading on that I have had more contact more we've had more meetings um with the new manager in the last month I think than I ever had with your old manager so you you made the right choice here he's really on top of things we're getting a lot of things that were kind of like left about you know left around and I didn't even know about it so we're tackling them and we will put together we'll we'll sit down with your list and we'll put together a calendar for you for the year of what's coming up don't worry thank you you're welcome thank you Robert for your presentation uh you know you we've discussed this a couple times I'm very upset about losing in the f app Grant but I want to move forward and I Echo commissioner amsler's sentiment that I would like you to stay in the process when we move into our strategic planning meeting hopefully the end of this month because we need you know these projects we lost a year the Year just went by and our playgrounds are going to get older there was included funds in for parking in that fep application that we not going to be able to pay for so everyone in this Village lost out on improved amenities for another year if we don't strategically plan and go forward from here so hopefully Robert you'll stay involved and be involved in our strategic plan so we can identify these projects and give clear Direction in our strategic plan meeting on what projects we want you to go after and where we want to see funds gone after so thank you for your presentation uh like I said I just want to move forward I want to see us thank you improve these amenities and let's top stop taking a step backwards and start taking a step forward thank you uh commissioner we can now go to 5A uh I think the representative uh of Senator Jones office is here sure thank you Robert again thank you so we're g to move on to 5A our uh legislative update from Senator Jones's office uh can you all hear me well okay so good evening my apologies on the late arrival um my name is Devon vrog I serve as the district legislative aid for Senator Chevon Jones and on behalf of Senator Jones uh thank you for allowing me to join you all this evening Senator wishes he could be here but he's currently in Tallahasse for a legislative session um so I will be providing today's update for you all today um current session goals for the 2025 legislative session uh we have many bills that we'll be bringing forth to the legislature some of which I will share with you today um the first bill is Senate Bill 204 uh which is Educator certifications um and training which is filed last year but was able unable to get to Finish Line this bill will require active shooter and mass casualty training as part of Education certification whether that be traditional the route excuse me the traditional route or the alternate route um and will also include the 5-year recertification um Senate Bill 20 for is not meant for our teachers to become First Responders however it is intended to equip our teachers with the tools and resources necessary to keep themselves in our students safe in the event of a horrific tragedy that we have become all too familiar with among other legislation we will be championing championing excuse me um heading into this upcoming season SE session I am bringing forward Senate Bill 206 pregnant women in custody um go ahead Senate Bill 206 pregnant women in custody so with this bill uh it's about protecting every expectant mother in custody here in Florida and their unborn children by ensuring that they receive proper care the bill is also known as aa's law in honor of the unborn child of Erica Thompson who died after jail officers refused Miss Thompson treatment and Care despite Miss Thompson's cries for help this legislation is designed to prevent these tragedies by ensuring that women like Miss Thompson have access to unnecessary treatment both for themselves and their unborn children this will give women the right to a pregnancy test within 72 hours as well as the Court's ability to Def first sentencing up to 12 weeks after the delivery of the baby we must make sure that all mothers and their children are cared for in this state we cannot allow another prev tragedy like this one to happen this bill is about providing mothers with the treatment and Care necessary to deliver their child safety excuse me safely before continuing their sentence another important bill we will be continuing to bring forward to the legislature is Senate Bill 236 Community violence task force this bill will create a task force within the Department of Law Enforcement to review system failures and causes of high high crime rates and violence in urban core areas in neighborhoods and communities the task force will help develop recommendation for Solutions programs services and strategies for improving inter agency communication between local and state governmental agencies to help facilitate the reduction of 58% of crime and violence in urban core neighborhoods and communities the last item I want to discuss as a pertaining the legislation is an array of consumer protection bills which aim to keep money in Floridian Pockets these bills have not been filed as of yet but we want to make sure you all had an opportunity to hear about them right now the first one is cancellation of Health Club contracts this bill enhances consumers rights with health Studios or known as gems um contracts by providing cancellation rights guaranteeing refunds ensuring multiple cancellation methods and providing online cancellation for online contracts this bill provides greater flexibility and protection for consumers entering gyms or health studios in their contracts it ensures that consumers have a cooling off period to reconsider their decision and are not bound by these contracts when they are no longer wanted elimination of hidden fees this bill targets deceptive advertising practices that mislead consumers it prohibits businesses from engaging in misrepresenting prices misrepresenting goods or services also misrepresenting benefits and misrepresenting Authority this bill strengthens consumer protection by clearly defining deceptive advertising practices and providing a legal framework for enforcement it aims to create create a fairer marketplace where consumers can make informed decisions based on accurate information family empowerment scholarship program this bill aims to increase transparency and accountability and family empowerment scholarships uh program by requiring participating private schools to provide detailed information to a parent before they enroll this bill ensures that parents have a clear understanding of schools offerings and expectations before enrolling their child into that school enabling them to make informed decisions it also strengthens C excuse me consumer protection by holding private schools accountable for providing accurate and comprehensive information as far as Appropriations just yesterday Governor Ronda stantis published his proposed 2025 to 2026 budget titled focus on fiscal responsibility the governor's focus on fiscal responsibility uh budget for fiscal year 2025 2026 totals $5.6 billion more than $3 billion lower than the current year budget of the total 100 excuse me 115.6 billion the General Revenue portion is 50.2 billion a 338 excuse me $ 383.51 to successfully NE negotiate over10 million of of 22 Appropriations projects across his district unfortunately the Govern Governor vetoed 13 of those 22 projects including the bis game park storm drain installation phases 1B two and three for $400,000 so far this year our office is sponsoring 11 Appropriations amounting to over $5 million and I am still revie doing quite a few of them his words from the senator the senator looks forward to working alongside his colleagues to get funding for programs that addresses the needs for our community and as always he is available to assist your community and your constituents he eagerly awaits uh excuse me he eagerly anticipates collaborating with his fellow colleagues and Community stakeholders to identify and secure funding opportunities that directly address the pressing needs of our community as always the senator remains dedicated to serving community and constituents please do not hesitate to reach out to our office if you have any more questions concerns um or request for assistance I'm here to serve you and to work collaboratively to build a stronger healthier and more prosperous Community for us all and I will also leave some handouts that I brought from our office um and some contact cards as well um do I have have any comments questions yes first off I want to say thank you for that detailed presentation uh before I open up to the rest of the commission uh please uh thank the senator for that update uh and I just hope that the senator will do this a little more regularly as the session goes on I know he's very busy this these updates are great and and it's great to hear from him and to hear how things are going up there in Tallahasse and uh thank you again for this presentation I'll open up to the rest of the commission uh first off I'd like to thank you for come in and representative uh the senator what I like to have in the future because you are doing a lot of bills is if it's possible that you can present the commission with stuff that comes up you know hearing you talk is would be better to have it in writing exactly what you know you're proposing like so you're saying you want the uh proposals in writing to you all if they can you can send it to yeah you can s it yeah that's where we know exactly what kind of bills doesn't have to be everything but it just gives like all the lists that mentioned today was a lot of stuff so would it be better to like email you all maybe beforehand yes okay and I would like if it's you know if it's possible monthly if you can do it all every a couple months but I like the idea of mail the clerk and disseminate should disseminated yeah okay where can I find her information is it online or is this over okay I'll pick it up on my way out if I may um max oh not M Mr by all by all means so if I if I could just suggest if if you just send that email to the to the Village manager and then he can disseminate to the commissioner okay you know know exactly what you're talking about because you're throwing a lot of stuff at us yeah and it can go over people's head it some of it went over my head knowing Senator Jones very well I knew it was you know good stuff that he's talking about but okay I'll make sure this report is also emailed to you a lot of politicians throw a lot of stuff and but i' like to know what's going on okay sounds good thank you again for coming out I appreciate that very much thank you very much for coming and for representing the senator with your um notes yes I was going to ask for the um virtual sort of file on this if you have something to share um and in the future I think it's good to put this things in the at and the agenda in advance and this for the manager clerk just so the the public has the opportunity to see them as well and this is a chance for them to have public comment on anything um but on my on my side thank you we have a mayor right there doing and Tallahasse whatever he can so um hopefully part of the efforts with the senator to get us the fundings that we're fighting for for drains and a lot of other projects if you heard some of of tonight so okay thank you very much thank you appreciate it thank you again you so much I'll leave these over here in the corner so you all can pick them up um reach out if you guys need anything thank you so moving down to our agenda will be 5c our presentation from our Cod Department which one again sorry 5c a presentation from code honorable mayor May Commissioners count legal council manager and the clerk members of staff and the residents it's an honor to be here to present um on our department codee compliance Department my name is dorine Grant I'm the code manager what is Code Compliance I'll answer that question by reading our mission statement veram The Code Compliance Department aims to provide services that enhance lives property and the environment by protecting the Integrity of the village neighborhoods this is accompanied by providing a resource of trained professionals that enforce zoning codes Property Maintenance codes building codes fire codes and other health and safety codes we are guided by Florida statute Title 11 chapter 162 the statute that outlines enforcement procedures and the powers of the code enforcement officers and the local government code enforcement board structure of our department we work under the direction of the village manager our department has a manager this is an augmented position meaning uh it's the temporary position that just offers uh specialized skill and expertise um in Code Enforcement until two days ago until last Friday we had a filled code supervisor we have a code compliance officer and two specialty staff one that assists the code board and another the planning and design review board the administrative and operational roles of these members of Staff the manager oversees and manages the department goals for compliance with legal and ethical requirements mitigating risks and promoting a culture of high level performance manager conducts and participates in complex inspections and cases the field supervisor is the lead field inspector he trains um officers in the field and implements policies and procedures of course our uh field inspector uh the code compliance officer issues violations um in the neighborhoods our specialty staff support the code board and they are also administrative support to the code Department the other one um the other um clerk supports the planning and design review board like I said and is also the alternate administrative support staff for the cold and the building Department we have standard guides um that are our operating procedures um we have standard operating procedures for the Code Compliance Department these are very definitive uh procedures and policies that we follow to run the department we have a field training program and a training train the trainer program for the field trainer these two programs were replicated from the city of Miami Beach we reached out to the director of the of code for the city of Miami Beach um and he supported us in putting together this program and we now use it to train our officers we have uh standard operating procedures for our code vehicles and how they are maintained so we they function well in the field we have standard operating procedures for code board meetings and we had now have standard operating procedures for planning and design review board meetings these procedures are step by step um written policies on how to run the meeting so if one clerk is not there someone else can use those guys to run a meeting with ease we have divided our village the triangle into three zones and these are the neighborhood assignments for the officers there's Zone a Zone B and Zone a Zone C Zone a starts from 15th um Street all the way to 107 from griin to 11 uh Zone B is divided in the middle of the triangle from 9 Street to 12 9th Street going the other side to Griffin is Zone C we work um into we collaborate enforcement with other agencies and other departments we work with law enforcement Village of biscan Park uh police department they assist us with uh in cases where we um we need um safety where there are safety issues we have to have PD there to assist us um offer us protection the PD Department also um assist in um violations that occur after hours or during day days that uh the Cod Department is not um in operation like weekends or public holidays the legal department um is of course the department that we depend on for interpretation of the law I know he's tired of us we reach out to him so many times we send him emails every five minutes but he is our guide uh we deal with a lot of um cases that are legal cases and we depend on the Lego Department to give us advice and guide us um in making interpretations of the law the building and zoning department we work with um to medicate building and Zoning um violations violations um for example Building without permits fences and that are in in um that are overseen by the building department by building department itself cannot issue violations so they rely on us the co- Department to issue violations so we work with the building department once violations are issued they take over because residents now have to go to them to apply for permits in order to correct those violations we work with the public works department for abatements cases that require abatements or large balk trash um violations Public Works Department helps us to either mitigate these uh violations or work with great waste our vendor to mitigate these violations we work with the Parks and Recreation our department for outreach the director of parks um manages the social media um outlets for the village so as we are moving forward in expanding our outreach program we're introducing a new outreach program we'll be working uh closely with the park director to get inform out on codes and help educate residents um on our codes and just um have open communication with the residents on what we do as a department we also work with the county Miami dat animal control services violations that um with animals when animals are aggressive and animals are out of control we call the animal control uh Department from the county they um trained um officers that deal with um these animal issues we don't directly we can issue a violation to a resident but we don't touch those animals and we don't deal directly with um we are not trained in handling animals so we have to rely on the county who have trained officers in animal control services utilities we depend on the city of North Miami the residents of this uh um village pay their utilities um to the city of North Miami how do we work with the city of North Miami when we have a abandoned buildings and there's water running we reach out to them and they will disconnect the water for us when we have a broken pipe in the village the city of Miami utilities who we would call to come and mitigate that for us Florida Power provides power to residents of village of bisc Park um again when we have an abandoned building when there's a violation with a building that's not safe we depend on Florida power to come in and disconnect that power for us so we can mitigate um that issue and keep the residents safe Miami date County EOC this is the Emergency Management uh Department of the county we work with them during emergencies like during hurricanes um at the same time and and now with the programs that we have in place when we work with Dade County we are working with FEMA in real time all the information that we enter from here in our crisis program goes directly to the EOC the EOC is able to transmit that um information to FEMA in real time now we have several U management software that we use for our programs at the moment the newest program that we have is goar goov is a government um um use software that we use for complaints inspections case Creations creation permits licenses performance uh reports and variances um we have had to transfer some of our information from the old program Open which we were using open is now a legacy program we only have old cases in um in a open G some permits some licenses and we still use The Ledger uh building permits are now being processed in in the cap program I believe this program is owned by the vendor by by the contractor cap so we use cap and bsna two programs they enter the information in um cap it goes into bsna and this is where they able to process payments and keep the records for the village granas pick agenda is a program that our clerks use to create uh board meeting agendas and minutes and minute sharing they're able to send it out to the website they're able to um also share it with the board members um through this program granas host compliance is the program that we use um it holds the database of complaints for short-term rentals this is an artificial intelligence program that we use to monitor sdrs in the village it has been very helpful um in mitigating and for us being able to see what's actually happening in the village virtually from the office uh where short-term rentals are concerned so I put together a code compliance flowchart that just quickly gives a picture of how we receive um how how we work our our our system how Code Compliance starts uh as a complaint and where we end um with the lean so complaints come in througha emails um people walking in calling um the app we get flagged down the app too right is I didn't hear that the app through the app that's correct thank you for that commissioner um so that's one way we we start a code compliance case um we that would be called a reactive um we I will call it an inspection so it's a reactive inspection why is it reactive it's because it's coming in from outside from someone outside to us there are also proactive inspections that we conduct we travel around the city um to look for violations we are literally going around to look for violations and that's the other way so we violations start reactively and proactively um so with that an inspection is conducted once we see a violation um um most of our inspections do not result into a violation we see something that will catch our attention and we go there and assess and discern and you know make sure we understand what it is most of the time we find a violation we we start with a verbal warning why do we do that we want to give uh the resident um time to comply uh an opportunity to be able to comply uh with the vi ation without getting the violation we do actually get a lot of compliances with these verbal warnings the other thing we issue is a courtesy notice if the violation is significant the verbal warning would be you have your garbage container here can you just pull it to the back if we see them there we knock on the door they open the door please pull the the garbage container we don't want to have to issue a violation for that but when a violation is a little substantial uh in nature we will issue a courtesy notice that gives them 15 to 30 days um to work on mitigating that uh violation if there's no um uh compliance then we move on we do go back let me not jump we do go back and do a inspection after the the the time we give them to comply if it's 15 days or 30 days we go back and do a reinspection at the time of reinspection if we find that the valuation has been mitigated we close the case that is compliance if not non-compliant we issue a notice of violation with a notice of violation again we give them an extra 15 to 30 days to comply depending on the type of violation some violations require that they get a permit so we have to um look at these cases on a caseby Case basis and depending on what type of violation we discern and give them time accordingly so at any time um when we give this uh notice of violation the resident can comply and give us a call and say hey I have taken care of this and we can close the case at any stage when there is no compliance we escalate the case we escalate this case after the 30 days we bring the case over to the code board to be heard before a code board the code board in turn issues fines and still gives them time to comply even after they give them fines when there's no compliance after they've been given an order of enforcement and fined we issue an Affidavit of non-compliance once we issue that not um Affidavit of non-compliance we ask the resident to come for a second hearing which is for an intent to lean with this second hearing if there is no compliance still at this stage we go ahead and file a lean on the property so so it's it's a process and it differs depending on what type of violation some violation are easier to comply with than others some are very complicated some are very time consuming so we treat these cases on a caseby casee basis some of the commonly used codes are for overgrowth and noxious vegetation improper storage of garbage recycling carts and dumpsters and trash containers properly stored inoperable vehicles uh deric vehicles and vessels boats we have um a few properties in the village of biscane Park that are grandfathered in and they can leave their boats in in the driveway um but the rest of them cannot have the boats in the driveway and we have an issue with people just leaving their boats and other watercraft in the driveway it's a violation um parking or storage of prohibited commercial vehicles in residential neighborhoods that's a violation as well that we have to deal with a lot illegal stvs I have to say these have gone down significantly we had a lot of violations in the past year I'll say from 20 2022 2023 we aggressively um implemented this new ordinance and issued a lot of violations and we have seen significant change in um illegal short-term rentals in the village discoloration of building exteriors and graffiti driveways we have a new driveway ordinance we've had a lot of violations with this people updating to the new design standards building showing visible signs of neglect and repair abandoned property and safe structures we have quite a few of those in the village now permitted hours and days of constructions we still struggle to get these contractors to start working on time we is violations when we can we are very grateful to the police department that has been very very aggressive and Vigilant in um making sure that when we are not here as code officers we only work from 9: to 5 sorry it's okay um the police department is here on the days that we are not working federal holidays uh weekends early in the morning late in the evening they are always there and when they get um um to see and and uh um a violation they do a report and we are able to issue a code violation based on the police report so we also have illegal advertising signs um mostly for real estate agent agents they have signs all over the Village um it's not the signs themselves it's the sizes of the signs that mostly are not right um we reach out to these um agents and have them post the correct signs reflection on performance in the year year in in review 2024 in 2024 um we conducted a total of 3,282 inspections we issued 268 notices of violation 618 um courtesy notices and citations now why is the number so large um for inspections and not for the notices that we issue uh some inspections that we conduct do not require us to issue a violations for example we had over 300 annual inspections that we used to conduct for uh landlord permits we also had over 35 inspections that we did annually for short-term rentals those um inspections are recorded just as inspections because we don't need to issue a violation those are inspections that we do to issue a license and that's why that number is large the other reason why that number is large is what I said before the inspections that we conduct don't always result in a violation some inspections we are able to communicate with the resident and we are able to find resolution without issuing a violation but we still record those inspections so the percentages for those that have the PowerPoint they can see the power points is there so it's 62% uh for inspections and 177% um for the open cases is it yes 17% of open cases notices of violation are at 5% is that correct citations at 12% and cases that we resolved at 4% % now the 4% that you're looking at as resolved cases that doesn't mean those were the only cases that we were able to resolve I'll explain citations come with a fine so while the violation may have been corrected meaning the garbage container may have been pulled back to the back to the back where it's supposed to be that is a compliance however if the $25 citation fee is not paid we do not close that case so those cases remain open until that citation is paid s uh citation fees paid some citation fees have stayed on the books for years some people just don't bother to pay but we will report when we're reporting we only report what we actually close we don't report the the the compliances that have a f still open moving on to reflection on performance in the past two years when you look at the numbers they are comparable um we did a lot of inspections of course in 2024 in comparison to 2023 um but the violations and what we resolved are very very similar we doubled the number of citations we issued in 2024 in comparison to what we issued in 2023 so we still have um 510 opened cases um from 2023 again these are cases that have fines on them these are not cases the total number of these cases are not cases with violations some violations have complied but are open because they have fines and maybe a lean has been filed on the property I'll quickly talk about the short-term rental program um this um ordinance was introduced I believe in 2022 [Music] um and it was the first time that uh the village of BC Park had an ordinance for short-term rentals um when we started the program there was 150 properties advertising short-term rental stay in the village um manager Diaz at the time sent out a letter to all residents to educate them about the new law inform them of what the repercussions would be and if they needed to rent out a short-term bases that they needed to apply for a license we followed that up with courtesy notices and more information about what they needed to do to apply for a license if they wanted to do this business after we did that and we saw that there was not compliance and and we could see a lot of properties still being advertised we became very aggressive we were very methodical and very aggressive in issuing these violations we issued a lot of violations and brought a lot of cases to the board but I'm happy to report that we we were very successful in bringing down these numbers and uh as of today I I I actually went into the system to look at our artificial intelligence program we have 34 licenses on the 35 licenses on the on on on the books now we only have three units that are advertising without a license and I'm going after them tomorrow so from 115 to 30 something we have 30 35 licenses that's correct so the the code um for short-term rentals again just for the residen is chapter 19 it can be found on munic code you can read about it if you're interested in getting a license to rent your property um it's one of the having worked in South Florida I'll tell you this this code is more lenient than what I have seen in other cities um the type of complaint complaints that we received from residents were loud parties the noise uh the obnoxious noise and um sometimes it was young people just being Rowdy smoking drinking but we took care of those uh properties there were a few properties that were just the ones that brought trouble and we were very aggressive with those properties we issued violation after violation PD helped us in mitigating this and I I'm happy to report again that we may have one and two short-term rental properties in the village that are still giving us issues but it's not like before we have managed to quiet everything down and um been very successful in running this program um I added to my slides uh a fun fact there was a property in the village of PC Park uh that was voted the most popular listing on Airbnb in the state of Florida this property I believe somewhere over there I don't remember the address but when we went there the field inspector and myself when we went there to inspect um the property when they applied for the license I myself walked in there and I was like oh my God this place is like being in Europe what is this place this is before I knew this history and then the owner of the property told us about the history of this property it's a darling place it's a beautiful place and um I was happy to to to know that there's a place like this in the village of biscane Park um they won this award uh from Airbnb because they had the most bookings in the State of Florida not it sou in the state entire state so this K Park is special so training how do we train um as code officers um the Florida Association of code enforcement has partnered with three state universities state of uh Florida State in um up north in North Florida University of Central Florida in Mid Florida and Atlantic University down here in South Florida we learn fundamentals administrative aspects legal aspects uh officer security uh you can get certified as a Cod professional and advanced Supervision in government these are the courses that they provide um and most cities most cities send their code officers to learn these are very detailed um um courses modules that um help us to understand stand chapter 162 the Florida statute on how to um do cold enforcement FEMA offers us a training in Emergency Management uh they offer the IC courses um there's IC one up to 100 these are all Emergency Management courses uh we learn Emergency Management because now we are part of uh command teams uh when there's an emergency as code officers we we support um the the police department and the firefighters in in in crisis tracking um we uh also do basic courses from the National Fire Academy so we are able to inspect for fire extinguishers and smoke detectors and and minor things like that so crisis track again um offered by the Miami date County we were privileged to be part of um the class that um was conducted in June um at the city of Bay Town of Bay Harbor um where we learned incident reporting risk assessment and identifying hazards as quickly as possible the crisis track offered by the the city uh County um is a program that when we enter information of what's happening in the village of biscan Park EOC gets it in real time at the county and FEMA gets it in real time on a federal level there are other trainings that we participate in officer safety um by um their Code Enforcement office found safety Foundation uh the American Association of Code Enforcement also offers um hes uh CER certifications in code enforcement in Code Enforcement Administration and the master uh code enforcement professional uh certification ICC the International Code Council offers us uh certification in zoning uh Property Maintenance um and the legal aspects for management for code officials legal aspects and and management for code officials uh ethics training is offered by the county uh our department was fortunate to be able to do this online we did the ethics training on video and the ethics training quiz we listen to a lot of webinars and podcasts that give us information about what's happening in Code Enforcement across the country in house training we've had the field training for professional code officers with the help of the city of Miami Beach um training of code The Code Compliance training officer training for administrative staff the Lan process all conducted and administered by the manager The Code Compliance board is a five member board that [Music] um is where the code enforcement um Department brings um cases that they are not able to resolve when we are not able to get compliance we escalate these cases to the board and the board um rules on these cases the their main role is to regulate and enforce the local ordinances uh and the codes so they are Guided by chapter 162 again and their responsibilities are to issue orders having the force of the law to to command whatever steps are necessary to bring a violation into compliance to adopt rules for the conduct of its hearing to subpoena alleged violators and witnesses to its hearings to take test testimony and the oath we are part of several professional um associations the Florida Association of Code Enforcement Southern Florida Association and several many I won't go through all of them but we we um benefit by being membership in these org organizations benefit us because they do offer training um we are part of a bigger community of other code officials and we learn from them we um are invited to um their training programs um and sometimes when we are not able to resolve uh things we are able to reach out to them and and you know we meet members who are work for different municipalities and if they have a similar issue we are able to get information and exchange information as professionals so our goals for 2025 is the introduction of a Cod compliance community outreach program uh the mayor will have to kill me we want to create the mayor's Academy I was going to say I love this and I'm hoping he's going to be part of this but I love that slice yes we'll put him on the spot so we would like to get the community and government together this would be an annual event held to educate the community on Village processes and familiarizing residents with the services that the village offers this event allows department heads to give presentations on their Department to bridge the gap of knowledge and understanding between the village Village staff and the residents we also want to introduce no your codes we started this but we just didn't follow through with it but we want to make sure this year it's out there Outreach with our the director of um Parks and Recreation he helps us with this one we send him information and he'll post it out uh to the residents one code every month um we explain it and residents have an opportunity to call us and ask us questions letters of intent we are fortunate um to have um manager childis who introduced this to us um letters of intent are preemptive letters to the public announcing proactive inspections by code officers in their neighborhoods so we are preparing these letters that will go Zone by zone or maybe half a zone at a time um so we don't overwhelm ourselves um just preempting people and proactively letting them know that we'll be out in their neighborhood and inspecting for um certain violations in that way we are giving people opportunity to comply with the violation before we even get there so thank you manager childis so we are also we will also be printing brochures and pamphlets um and our officers will will canas the community and provide written information on Village codes building permits and Zoning issues a lot of times we have complaints about people not understanding what the codes are what does this mean what does my violation why did you issue me with a violation we get questions like that and we believe that by putting information together in pictures and words um in in pamplets we can bridge that gap of knowledge again between ourselves our Serv and and what uh the residents um would um want to know from us and what the residents need to know to keep their themselves from being violated or sometimes very minor things but it's I we always get I had no idea that I I shouldn't be doing this and the last thing I wanted to talk about was the introduction of an abandoned and vacant abandoned vacant or unsafe structure registry this is something I will I think I have brought to the attention of the village attorney um we are experiencing um we have in the recent past experienced um what do we call them unsafe situations where a property unknowingly we pass in the front of a property and the property looks like it's fine it looks like somebody lives there it looks good in the front but something else is going in going on inside the property and these situations have been very very unsafe and dangerous uh situations um there has been weapons and narcotics involved and in a small place like this where people feel safe we are not completely safe so having a registry would help us as code officers to layer focus on these properties and these areas if we know that this property has issues our way of approaching enforcement is different we we are more attentive we are more aware that there's an unsafe situation here we educate our officers more and uh we just deal with these situations differently I would also like to mention that this was suggested by a concerned resident and I we are totally as a department um in agreement with this resident and I believe we will go ahead and do a registry it will help us um with enforcement and with that I invite your questions thank you Daren that was a great presentation thank you for your time here tonight and uh personally I want to say the goals for 2025 look great and I really like the uh the proactive you know reaching out to the community with the Flyers the pamphlets and the letter letters of intent to bridge that Gap as you say so thank you for open it up to the questions of the commission see what they they have couple of questions real quick thank you so much very thoughtful presentation of put forward 25 uh looks amazing who's carrying this out that was going to be my question who's putting together these programs to engage with residents and all the different bullets you explain our department is okay so you guys are going to structure structure this within yourselves to um push it out in the different Outlets that we have yes we will and we we are definitely um working under direct the direction of the manager of course okay great so that was uh my first one and then the second to the manager so I know L chano left um how do you see that restructure or at what time do you think the code deployment is going to be complete um commissioner to answer your question um that's something I'm looking at right now and be talking to Dorene about in the next couple of weeks but yeah there is going to be a restructure of that Department next month it should be we should hopefully have a yes hopefully hopefully that department right okay may not it may not look like it is now but it will have a department what do you mean it might not look like it is now well the organizational chart that was presented today it may not look like that but of course you're you're trying to see how that will look moving forward um great so thank you you put yourselves out there uh sometimes in very odd spots I know and I appreciate you and very much the police uh Department to help you guys address the concerns that you raise um so thank you for what you do and the presentation U again thank you for the presentation tonight it's really good I'm looking forward to 2025 what you do one of the things that struck me was you said there was like 500 outstanding fines that are out there my question is to you are a big amounts if they are with the resident couldn't we work with the resident to try to get a settlement and get some of it to get it out I mean because to keep on having it add up add up add up you're going to put leans on properties and you know it is the responsibility of the resident to pay their fine but if we the purpose I I believe in COD is not to make money it's to get everybody to compliance so if we can work with the resident to settle with their payments if it's not high you know high if it's small amounts and why AR we collecting those but if there a resident has a high amount why can't we make a settlement with them and try to settle it out and I think that's that's important because we're not here to make money and I the way it's sound and and I'm not saying you're doing it but it sounds like bis G Park cares about making money and that's not what I believe we're trying to do so if we can settle with the resident you know within reason I mean if they're being not smart about it or they're just being spiteful that's different but you know some residents might not be able to pay Their fines and and I think that was something that we should work on again thank you again for your presentation it's pry good and I look forward to 2025 thank you I don't like the idea that we're going to be losing you been receiving is was from Mack when he was here for a long long time and then Vero finally took over I I wouldn't even know about the meeting if it wasn't on next door and next doors become horrible I never look at it so I only saw I happened to see it I'm lucky I opened it and saw Vero has taken over to give us information but if we could get we all worked so hard to get those Village emails together and you we all did it and now nobody's getting any information so that's what I'm requesting number one um number two um when it comes to I came here really to hear about the rec Center because um one you know a truck had parked on there and it had broken the sidewalk um but once that that HCK oh what's it called not hockey um soccer came in with all those trucks everything's broken up now within a few short with a very within a short time all the sidewalks are are broken and I go by during soccer because one of my ba my grandson plays there and the trucks are parked right on the sidewalk and I was surprised because I thought the police would come by I heard they were giving fines but within I'm not lying a few weeks everything's all broken up so I'm concerned when they put in this new this new plan which I really couldn't understand at all I don't know if they're putting curbs I felt that with presentation was very limited I didn't understand any of it I didn't think there was enough information to to gather understanding of it so I would love to know about that um because we don't want to keep seeing those broken and when it comes to the Vitter course I'm just going to say boy I mean I you're gonna have a lot of broken equipment there I've seen it at every place and kids are there still playing late at night because I walk 8:30 sometimes it's 9:00 and I know the cops try to close it down but they come back so you're going to have people invite of course you're going to have to have major insurance to cover that stuff okay that's that the last thing I wanted to say was um the last thing I wanted to say was about um the the interim manager Mr child CH children or childis GIS at any rate I'm listen you got to have common sense here you can't just have intelligence common sense is if you have an experienced person that has a great reputation all around wherever he's been and he lives in the village he cares about the village and he's gonna stay pay this guy what he deserves and let's keep them I've only been here 10 years so I feel sort of stupid you know standing up here and asking for things because I'm not an old resident but I've been very involved since I've been here and I must have seen six managers at least let's get somebody with this kind of experience this kind of I want to say Integrity because you haven't seen Integrity in every manager we've had here and I I'm I just think I please use your common sense and your intelligence and and and do do the right thing thank you David Raymond 11520 Northeast 9th Avenue you get Amsler your questions about the spaces and that presentation I was and the the firm is wonderful they designed our homeless assistance centers for us when I was at the county jism is a wonderful firm but that presentation was somewhat lacking in detail um for us to pay 300,000 which by the way I don't believe for a second it cost the village I think 70,000 to do the drain and pave part of the street outside of our house for one drain and they talked about drainage sidewalks all around and we're going to have 50% less space um mostly it's soccer and festivals and things like that that we have where we don't have enough parking taking away part of the field if you want more parking is the only way to do it I'm not advocating that but that's the only way to do it to to pay all this money to have 50% less spaces unless the police are going to enforce the people who Park all over the place doesn't make a lot of sense to me anyway um on 9B Maria CRA who's one of the best public servants I've ever known nothing about Maria I'm just not sure why we're paying somebody from the past to do a job that we're paying somebody now to do there's no minutes for 2024 no and it's posted anyway that's up to you guys um the Australian pines 37 trees I don't know if that's all of them when I was on the parks and Parkway board we did a we had studies that were done to see how many trees we needed to take out we budgeted 30,000 a year and we identified the worst trees and the trees were rated I don't know if the trees are being rated again and we're going to take them all out um I understand that they're dangerous some of them aren't could be potentially but they're not now and if you're going to take out all those trees I walk again same with Amy couple of times a day one more in the afternoon those trees are full of parrots and Raptors and all kinds of wonderful creatures and if we take them out please I know that the memorandum said there was going to be money to hopefully get new trees we're going to procure some grants to pay for this I don't know if that can be done retroactively I know we want to do this with waving a bid I'm not sure why I'm not sure why we're rushing that without a plan to figure it out Public Safety understand but I I would hope that those are the worst trees and not every single one of them all at once without having some plan to put them back we've got enough concrete going in around here and enough trees lost um finally on on Amy's earlier point about M Mr childis never met him before he got here to this meeting a couple months ago I had the opportunity to sit down with him for a few minutes to talk about my favorite subject drains the next day he was in front of our house with a brain truck getting bids um the process you want to vote on today to hire a firm to spend money just hire the guy anyway thank you seen no other public comments do we have any on Zoom seeing no one the hands up so we're going to discussion Mr uh commissioner samary I know you pulled this off maybe you want to start uh thank you Mr Mayor um I have concern about this particular agenda item our first Camaro was a fantastic clerk when she was here uh the Commission in in the last budget uh denied the $30,000 to H for the clerk to hire an assistant clerk I'm just concerned Why that was done and if you look on on this report on reference to compensation for maybe it's a misprint but it says uh I'm sorry 10 hours per week for the total compensation not to se that $5,000 uh the contract shall be paid by month by weekly with my figures that comes out to over $130,000 so I have a concern about that the confidential information uh either during the term of this agreement uh will be a period of no more than 10 years there's the intention of keeping this individual for 10 years I believe this is is made to be where she would come back as our city clerk that's what I believe this was for um I don't think this person needs to be hired to do all the minutes uh when we can the clerk could have hired somebody to be an assistant clerk so I have major concerns with this I can't support this item at all thank you so commissioner hunt if I could I think uh I think Miss Camaro is on on the on the phone and I guess she can address whether she wants to come back as Village Clerk or not he's currently living up in the Panhandle and she's retired and and she was doing this as a a favor to the Village but I she has no desire to come back as a village clerk I don't know where that's coming from but I I she can address that directly hi good evening everybody can you hear me good evening good evening um hello from tah um um excuse me I'm sorry but there is a there's got to be a bad connection we can hear you okay else to do no you're cutting off maybe you want to dial back in I you yeah well nevertheless uh um commissioner I she has no desire to come back that's not what the intent was it's uh since I've got here I've been hearing concerns about our minutes and this was a an opportunity to reach out to a a former uh our former city clerk who was also a longtime resident I I don't know if some of you know her but she as was said this evening um by one of the residents she was an excellent person excellent worker uh she's agreed to do this for to bring us up to to date we're back backlog uh there's there are no minutes on for 2024 on the website um I was aware of that even before I came came on the village so uh it's very important that we come up to date and and come in compliance with the law and I I don't think we should should k kick this down the uh Road anymore and and she's willing to do it and she's already produced some uh some minutes that are on the on this commission for your for your approval and she's also taking the minutes for tonight's meeting and Mr manager can you clarify it says uh the total compensation not to exceed $5,000 I'm not sure where the $100,000 figure is coming from I I I have no idea what that's at that's total compensation no more than $5,000 so we have Clarity if it's doing it up to 10 years maybe I drafted the agreement okay can clarify that's yeah not sure where exactly uh commissioner sary is getting that as well um in section four of the agreement which is the compensation section it states that the contractor will be paid $40 an hour not to exceed 10 hours per week and that the total value of this contract is $55,000 so it's which is why it says for for a total compensation not to exceed $5,000 the the 10 years that I think the commissioner is referring to is in the confidentiality clause which I'm just trying to find that Clause again uh confidential information um where it says that any information that she may have access to that is deems to be confidential that she will keep that confidential for 10 years regardless of whether or not she's still under contract or not again this is this is for discussion so I mean if you that's this is not to you know I'm I'm opening up for discussion I'm going by what I'm reading so you know you can't criticize me for having my discussion I'm not criticizing anything I just got I'm trying to you would indicated earlier that it's it's a 10year agreement the the agreement there's no way this is agreement intends to be 10 years I'm I'm just trying to understand what you were interpreting so I can explain it and I uh ask a question um Mr manager uh how long do you foresee uh the need for this position and what is the the long-term solution if we we had this issue prior or and and you know I don't know how long uh she's going to be with us but what's going to happen after she's gone well I hope the purpose of bringing this the consultant on is to get get us caught up and then once we're caught up that uh the village clerk would take over those responsibilities and and and and keep us up to date as soon as soon as the uh the meeting is closed the minutes are are produced and and uh and be part of the next agenda so how did we get to this how H how do we get here that's a good question and I I don't I don't have it the answer for you because I wasn't here but I I I think that uh there was a a period of time where uh the clerk before uh Pamela had left and it it it uh fell off during that period and then it was just overwhelming and then uh there's a lack of Staffing and that's what that's what happened that's that's my guess but I I I wasn't here I really don't know so are you comfortable with uh with this this process bringing in this person uh for for a period of time and then you you comfortable going forward that we're going to be be able to keep up yes so I I was tasked with finding a solution and this is my uh response to that Sol to that that bring for you forward this solution to you and I'm confident that uh she's already produced some minutes as I already said she's producing the minutes for tonight and uh I'm I'm confident that she'll bring us up to date no I'm I'm confident in that as well I'm I'm just more concerned about once it's done that we have continuity that we're able to uh keep up and we're able so we don't find ourselves in this position again yes sir yes sir okay so so for background uh this comes to solve my issue on my item right being an issue an item on the agenda under under old business I don't know if you got to see that art but this is a solution um that the manager and I discussed there was a liability sort of in the table to look into having public records be pulled and so um I'm all in I'm very clear on the contract and I am um very very satisfied in in terms of what it the template of it provides and the type of information it does give us and I think uh for me is a goal it's a way to solve it I agree with you I'm not at all happy to spend $1 into something we already are paying for but I think the solution has to happen so that we can move forward and um again this is to prevent us getting us in bigger trouble commissioner Amsler I joined you in those concerns about our minutes and uh I couldn't agree with you more I'm glad that we've found a solution and I'm I'm happy to see that we're gonna be we have minutes here and we're going to be working towards a finished solution I'm fully com uh confident with this contract and with the manager handl of this solution and I'm just you know ready so again Mr commissioner Samaria concern with this was U the bidding process did you um is this firm that you just picked or did you put an out bidding process because we have always done in the past that we have so this is Professional Services commissioner it doesn't need to be bid okay it's within I think it's also within my threshold of spending it didn't even need to come to the commission but it's coming for the commission just for your for your your knowledge and to be transparent okay well you gave you you know you clarify my question but but that's I can support this you have any other questions from the commission I do uh so Albert so what is the uh sort of process that you see happening with the vendor of this Professional Services and what's the the takeaway is there a document a what does he produces for us is an end result of what we agreed I'm trying to understand after we meet and after we have a conversation what comes out of it so he'll have a final report that he'll make a presentation uh via Zoom uh before the commission um and then you know he he's going to call each of you uh meet with each of you before before the actual uh um uh Workshop or or strategic planning session and uh and then and then he'll also meet with staff that morning with all the directors uh prior to the strategic planning session and we meet we meet for a day and a half um I wasn't able to send you the information uh commissioner that she just but I'll get you the information so you you'll have and as I said he's a retired uh University of Florida Professor he's does this all over the State of Florida comes highly recommended the other question I had so you saw our strategic plan that we did couple years ago okay what would you say would be the key difference between this one this this is this strategic plan is just for your upcoming budget is budget base let's allocate projects there's so many from there's just so many pieces of the pie what is it what is your what is your goal for this upcoming budget so that the directors know it staff knows it uh you ask for your your grant writer to be there so they all know what what what the goals are are to achieve in the upcoming budget and so it make it a lot simpler to draft that budget and not not having a go back back and forth uh at the budget workshops and saying why was this put in here you know so that's the the purpose of this of the of the of the two days Workshop does it say in the contract in any way that we have a a production of a presentation at the end I didn't see that it was in I believe let me just pull it back up okay in the scope of work all right let me know one moment and then it's you said it's a right not just he will come and present but he will actually produce a document leave us behind yeah he'll it'll have a document so that so that I can take that document and look back at it and that would have all the finance and summary yes okay so if if I may commissioner on page nine of nine it's an attachment a which is referenced inside the agreement which is titled scope of services agement itself I I can share you want me here it is on my screen so there's a the agreement references scope of services and the scope of services are attached as as an of the agreement and there are six separate um items one is discussion with this with the manager with respect to the scope the project and Direction meet with the mayor and Village Commissioners individually via Zoom prior to Friday February 21st to discuss projects timelines final report prior to site visit the to the Village um then you have the workshop on the 21st um in the morning and then in the evening and then um you have a actually I've go to I've got to remend that because it actually I believe quick minut from wrong Mr manager but the workshop on the 21st is in only in the afternoon correct okay actually it says that so it's onsite onsite I'm sorry meetings with staff prior to the the 21st Workshop and then the workshop in the afternoon on the 21st 22nd is the full day workshop and then there's a post February Workshop submit final report meeting with manager review report and remotely attend April workshop with commission dat to be determined for development of strategy to carry out strategic 25 that's all incorporated into the agreement for the compensation $5,000 and that includes all cost that's where we see the the final finding so after the February sessions that we have April will be where we can lend it in a way okay all right thank you any other questions on the commission I just want to say that I fully support this I think this is uh something that we've needed in the past to to do a more uh thorough version of our budget and not just shoot from the hip as I think we we did last year I think our budget was could be improved in a lot of ways and I think this is a step in the right direction so I'm I'm fully ready for this Commission of the village of biscane Park Florida waving the competitive bidding procedures for two two sections um to sorry section 2 d139 of The Village's code of ordinances and improving an agreement which Joe's Landscaping and and Tree Service na Inc for the removal hauling and stump grinding of 37 Australian pines and the amount not to exceed $120,000 and no cense authorizing The Village manager to execute that agreement and to do all things necessary to effectuate this resolution and providing for an effective date thank you Mr attorney motion to move to discussion I'll make a motion for the discussion have a second second all in favor all okay so I'm opening up to the commission to the floor for discussion commissioner Samaria want to start this off okay um this is a question for the city manager with this particular one is is we used have in the past where we try to get three bids did you try to see if we can get you know the concern for $120,000 did you try to see if we can get it for a lower price yeah commissioner if you if you uh saw the cover memo if you read the cover memo the cover memo said we we saw three bids one was unresponsive and then the other one was um I think it was approximately $20,000 over over this one then if nobody else has a discussion yeah I I'll have a question so um this $12,000 is this is it a budgeted item because if I'm not mistaken I think what we used to have what like $30,000 for this right so no it's it's not a budgeted item I'll have to come back and move some money around we probably have back approximately $770,000 in that account in that line onm account uh you're you're correct commissioner in saying that only $30,000 was budgeted this year but uh um I'm confident we can move some money around within either Public Works uh Department itself or or another department to to cover this amount so here's another question that the Raymond brought up and I thought it was a very good point have we identified trees in in the stages of uh emergency whether it's critical or or are we just just going out and knocking them all out so some time ago um there was a report that the the commission shared with me that I wasn't even aware of the sfm had come in and identified the worst trees and made them a 10 a nine an eight the the one that went down on 113th was wasn't even on the list so they even they didn't even know that that was severely but never know right but the vendors here he can tell you the condition of of of these trees that they're they're in really bad shape and and the and he he was there this morning because he removed the the the uh he grinded the the uh uh tree just stump grinded and could see the interior of it was all eaten up with termites what it was how many trees are we are we there's there's 37 there's approximately 14 that's on 121st Street that we're working with the city of North Miami to share the cost in those on those trees and then also we're looking to apply we're working with our grant Rider to apply for a grant come the fall that's going to be available in the fall that will that will that uh deal with all of the Australian pines the grant the grants for all Australian pines yes so I'm saying the ones that are currently in our in the village uh will that address all of them it will address all of them the except the ones on Griffin which is the county road and then there's also some on private property that only on on the village property we're only concerned with the ones on Village property I know we had a discussion this week we uh talked about that in no way are we if we go forward with this resolution are we binding ourselves to cutting down the north Miami trees on our own that we're still going to be working with them and leaving those to last to hopefully get an agreement with them to do some cost sharing or things like that correct right the vendor knows to touch those very at the very last and I'll I'll be on a meeting with the if uh John's meeting with the public works director from North Miami now and hopefully they can come to a solution if not I'll be on talking to the north Miami city manager I'll be camped out on her her office and and getting an agreement and I will share with the commission that I reached out to commissioner Steinberg's office as well as the mayor ca's office to see if we can work with the county for bement trees I know that the county has their million trees initiative we don't technically qualify because of a tree canopy but we do we are serving a public need here to remove dangerous trees that we now have two public documents that's that state as such that they're dangerous and that's going to be a strain on our budget so maybe we you know in the greater green good we can get the uh County to help us replace the trees I haven't heard back yet but I will continue reaching out to hopefully get some assistance from the county on replacement trees what's the timeline for removal for removal of of all of the all of the trees hi hi morning Hi how are you Jo's Landscaping Tree Service how you doing I don't really have a scheduled date yet but um we get on it as soon as possible no I'm saying when did you start how long do you foresee it taking a month two months three months more or less just an idea couldn't take longer than two months maybe not even a month I don't know it all depends on how things flow but we have a good team a lot of equipment we do a lot of work in the area um and you do the stump grinding and all that stuff complete removal stump grinding hauling debris and that's all part of it yes sir okay all right so I have very similar question so on the so we have 38 in total I'm sorry 37 and how many are North Miami specifically about 14 14 John yes 14 of those North Miami then I'm hoping we can somewhere negotiate with so the our mayor had uh even assisted had had uh offered to call the mayor North Miami if that if it comes to that point so I've got that in my back pocket so okay then um that's not North Miami then the timeline was the next one not so much I'm I'm sure it takes quick I don't know in terms of your equipment and your your staff but for US based on where they are do you see this just go and do everything in couple months or would you space them you know in a way that maybe falls into even the next budget because my question on the 120 grand for this year is where is it coming from and I can understand you're saying Administration or you know public works but I would want to know where it's a lot of money so what are we giving up and commissioner to answer your question I don't think you want to delay this any further because it is it is a really a threat to our residents and uh anybody that's coming in the village that that tree on 113th could have fallen on and joke and tell you that tree could have fallen on a car could have fallen on somebody walking by with a stroller or somebody walking their dog so you know it is a hazardous and you I don't think we want where I I know and I think it's not my um objective to delay it knowing that I'm just wondering and we've waited this far um and we are in a critical point of transference of um management you know you came in a long ago we're about to go into a permanent manager position there's still things that need to be iron on different departments in terms of um a worker needed in the public work department I just want to make sure that the the key budgets for all the stuff we approv still there and I really want to understand if you're pulling from what's being sacrificed well any any any change any uh transfer of funds would have be have to be approved by this commission yeah so you'll you'll know about it I just can't do that on my own and so if we do sign this today we're not committed in any way then we move forward or we're saying yes it has to happen you're Comm you're saying that you're an agreement that the trees did come down and then I'm I'm bringing forward another another item to move those funds around yes okay all right essentially commission enter into this agreement yeah then to start the work so as far as the funding obviously if there's not enough money a specific line item yeah subsidize the project the manager will have to come back unless unless he does it inter inter I'm sorry inter Department I got it inter inside the department budget so if he moves a budget a line item within a department from one to another yes does not need to come back yes so and inform you but if he's doing it outside of departments he has to come back with a budget then yeah so that's the part that I am not totally 100% comfortable and it's just a lot of money at this stage to say it's coming from somewhere in the budget I don't know what we're giving up to be honest um on the same sense understand the urgency so is there a middle point I was thinking where we do you know part of this quoted within this budget and the other for the following fiscal and then we do two phases so we don't weighed the 120 Grand only on this fiscal could that be an alternative and again I'm I'm just trying to put it there as I see what your I see your point my feeling on it is the cost benefit analysis of the whole thing is what are we risking versus what are we gaining and like the man manager said that tree on 113 was not even on a graded on a scale as a dangerous tree and it fell and I was there that morning I saw it it took up the entire South uh Lane of 13th in probably a 50 to 60 foot section so it's terrible if if if a person would have been there we're legally liable we could you know we could be sued for this and Brad always says don't give a road map to someone to sue you we have documents that say these trees are dangerous we've discussed it at multiple meetings been discussed uh former commissioner or commissioner Gonzalez can say it's been discussed many many years so if we again I'm not against it in any way I'm just trying to again be not knowing when the money is going to come when we just finished a budget not so long ago we just raised the bar in terms of races and we're about to get into manage manager salary and all of this coming from this year's budget Administration I don't feel that comfortable of just hitting play without knowing in advance where the money comes I trust the manager he'll make the moves um I would just because we did the analysis on the budget would want to know what do we're sacrificing that's my question so that's why I'm saying maybe 60,000 we do fiscal this year uh and again you know the other half we do the following year and we take care of them faster than we've done in the past two years I can tell you if we do that um the other question I had is regarding our insurance so if we do have an issue thank God nothing happened this time around that would be covered by our insurance carrier is that how it works I don't know the uh if somebody were to file a claim um we would we would definitely reach out to our carrier yeah see whether or not it's within our liability um not I'm not sure SL yeah okay something I'd have to look at more specifically in the policy itself can I make a a suggestion uh I completely agree with you uh commissioner AMS about the money situation but perhaps what we can do um Mr manager is maybe come back to us or let us know where you're going to get that money from and then we can see you know if if we want to make those sacrifices in other areas that you're going to be pulling some money out um because I do understand the sense of urgency here we've been we have been talking about this for years and we've been putting money in in the in the budget every year and it just rolls over because we don't do it so I would love to see it done but I think that uh for commissioner amsler's sake and for mine and for the rest of us probably is that you know we want to know where it's coming from um so I think that that that would be a way to move forward now um you know if we all can agree with to that sir and then if I if I can ask one more question um it was brought up and I know this is a sensitive issue for a lot of residents right we're still talking about trees or canopies even if it's an invasive species and it can break on someone's property I mean we know the damage it already cost um I think it also allows us for a little bit of time to see if we can mediate with some sort of organization that can comes helps and looks at the trees if they're nests you know if there we are our sanctuary a lot of people really stand behind that and I will give the opportunity for us to just double check that there's nothing we can do to address that before we move into the cutting of the trees and I don't know if that's something you guys already know of you know the Pelican harber and there're all these organizations and I'm sure if we reach to you might know them as well since you do this um and uh and just ask for the recommendations as to how do you clear that the trees you know don't have any habitat and we're not do they're doing the best we can and I don't know what that is um before we cut them down so I think it it would give us some time for for to evaluate that I'll just say I again I understand where you guys are coming from yeah I couldn't adamy disagree uh because as the manager says there's $70,000 in that line item so we're weighing $50,000 over someone's life and to me there's no question it's a matter of public safety that tree was not even on the rated scale and it randomly fell and if another one happens tomorrow and it falls in someone's house or heaven forbid Someone's Child how will we feel putting it that way let's sign now whatever that's what it is trees are randomly falling yeah it didn't it didn't even rain it didn't even rain that night it just fell my my question is what it gonna stop for more trees that are going to be falling in F you like you say we can fall without even giving the re were studied and we have a public document that says they're dangerous the State of Florida gives grants to remove these invasive dangerous crumbling trees if the State of Florida comes out tomorrow and says that live oaks are the same way I'll be up here saying we should remove them as well because they're dangerous that's not the world we live in right now the world we live in is that the Australian pines are dangerous an arbor said it years ago a second consultant has told us now the same thing and we're talking about $50,000 over someone's home someone's car someone child someone's husband wife or daughter that's not okay with me and I I I if that's the will of the commission it is what it is to me risk risk benefit I don't agree I I just don't know what I'm giving up to I mean for all this stuff I mean you know this this is a lot of money coming from the budget so I am I think I I'm okay with moving forward as let's dig a little bit uh deeper in the budget you tell us where the money is coming FR then we move ahead I'm all in for getting rid of them finally um I just want to have one check internally that we've done due diligence on where the money you know what sort of projects we might sacrifice that's my commissioner if I may I because I just need to know where how you're proceeding because I'm a little bit confused are you approving the agreement as is at this tonight or are you putting some condition on the agreement for me deferring for me it's a def yeah for me it would be a motion to to to defer for the next meeting and that by then we have a better understanding of where the money money it will be coming from where you're sacrificing for it and then I'm okay to move forward one one last question you said $70,000 I thought we was 30 but you're saying 70 from his from that from that say that the line item right now the account right now has 70,000 in it right but the but not in that line it's called from another yeah from that department from item yeah it's not yeah it's not it's not identified for tree removal it's another 40 from something else that you're pulling from here to pull to the 30 yeah I I understand yeah yeah okay and and Al that's coming from the public works budget well we also have 30,000 identified in CIP so there's 100 so now you're you're talking about $20,000 because if you look at our CIP there's a line item under Public Works that says $30,000 for invasive tree removal so now we're at a 100 and you're talking about $20,000 over Public Safety no and I that's a thing that's for you're bringing this up but I am not having that feedback from the manager and I want the manager to come forward and have the opportunity to dig it from the budget well let me let me be very clear I'm also saying that this is a life safety issue so and that I would not recommend delaying this any further this is a life safety issue and I think we need to move forward even you know within within our budget now uh start cutting down the trees that we can cut and then I'll bring back an item in March to say where I need to move the money and I'll also know at that time how much support we're going to get to from North Miami and we may not have to move any money so proven now yes March I'll have the answer about the budget and because we need to do it regardless so by then you'll know from where it's coming absolutely commissioner agree with that that's fine all I just want is visibility if it's March that we know it and we sign it today I'm okay with that it's going to happen so it's not that I'm opposing to it happening I just don't feel like signing on on something without knowing where the budget is specifically coming makes me uncomfortable but if we're going to sort that in March then let's go ahead yeah very um the other thing would be that would give us some time just to look into how we clear those tree of any existing you know Nest I don't know it sounds so like ignorant when I say this I have no idea but like it might be some living you know aspect they want to consider I think Joe could tell you that I don't think there's any habitat living in those trees well there not there I want to clear this with the especially the one that the one that came down is is probably kind of typical of the other trees Joe yeah a lot of are in pretty poor health termite rotten yeah and you're talking about the tree I I think if we have a month to just call Pelican Harbor couple of more organizations that that's what they do and we get a clearance that's it but um I'm in for that and um March let's have the budget let's have this organizations kind of check in we have a month before we get started and on what days they're talking about good evening um Commissioners we did receive from the county um a date of April 8th uh 2025 uh I I um passed out U memo to you all with some of the things that they are um asking and requiring of us um to move forward uh with the election with with the special election I'm sorry and that is basically um in order to hold it on April 8th 2025 they need about 6 weeks um to prepare the ballots and uh get everything in preparation so they're asking that um our qualifying um not run um for a long period of time so I've looked at the calendar and back out from the date um that they given me and the requirement time and our qualifying um can start uh February 20th and and on or before February uh 28th and 20th to the 28th only8 yeah I had a question about that M Clerk and maybe Brad you can jump in on this one uh section 2- 65 qualifying periods of our uh Charter uh says that qualifying period must shall con constitute a 12-day qualifying period uh but that's specifically talking about because it it lays out the 73rd day prior to the general election that's talking about the general election would that cover us for a special election or for a special election we don't have a rule on that got pull up the code give me a second you were looking where I'm sorry 03 section 2- 65 qualifying period oh you're talking about in the code yes Sor Charter sorry I said Charter I thought I heard Charter all right as as you noted as you correctly noted I mean your code does not address a special election um so we could I would take the position at this point at least that um you would have you could um your qualifying period if if you so prove it as such could um comply with the requirements of the supervisor of election so so because it doesn't address special elections we can comply with okay that's the only question I had and if you also note um I would have to give them a response um tomorrow in order to make this whole uh timeline work and one of the new things that they've implemented um as you know the supervisor of election is now a constitutional um office um they want a a 50% deposit uh before um before we would just go and they would build it so I um attached the estimate um for that special election you can um deduct that 5,000 for early voting because we don't participate um in early voting uh here um in the village so that would be a $5,000 uh deduction from the the from the bottom line and that will leave us in uh approximately uh $10,000 for the special election and that was already commissioner that's a good point is that item was budgeted so we didn't anticipate this happening but there was money in the budget I brought up one more question I have having uh participated in the last two elections the first special election uh where I ran uh we didn't have bathrooms for the voters who came to vote and we talked about it and then we it again happened in the general election and it just seems to be that that's the requirement of the supervisor elections that the bathrooms be closed have we thought of a solution for that maybe a bathroom trailer or something like that that we can rent for the day can well excuse me go ahead the person that actually one was the person that we seen at the other election and she was very upset about the bathrooms not being open and I've spoken to her recently she said the bathrooms will be opened but I mean we have to have our clerk is indicating differently the bathroom won't be because of where our election is held and the logistics of the parks director and myself we've looked at this we've tried it we we threw ideas up um we have to section that area off we cannot open that area up to the public we just don't have the ability to do that okay so then solution maybe and see I don't know if we have it in our budget to have one of those well I mean commissioner Huntington and I did speak about this um before and that's uh up to the uh manager to give me the um approval if you guys want to put out a a we want to go out and look for estimates on a porta poty or something to that effect but we can't have that that area open to to me it sounds like we have a known problem and I think we should trust the manager to come back with us with a solution next month as to what how to address this problem whether it's fiscally responsible for us to rent a bathroom trailer or what whatever he solution he comes up with but it's a problem we for the last two elections we've had and uh I think I'm confident he can find us a solution for it so the qualifying will be from the 20th to the 28th right that you can make that determination as to how long you want um the qualifying period but between the 20th and the 28th is the dates that I would need in order to meet the requirement for giving them the six week um start repeat the the dates please um Pamela what are the qualifier dates it would be February 20th start and ending on the 28th um by 5:00 P PM 28 and that is um it has to be a week no it it does not it can be two days it can be three days you know but it can't go past that 28th in order for me to meet their that's to meet the supervisor of elections deadline or April yeah I wouldn't suggest shortening yeah qual period any less than I would make the qualifying period as long as possibly can in in consideration of whatever the the supervisor also you need to come up with a um date for a runoff which has to be minimum of two to three weeks from April Pamela the qualifying period goes over a weekend I I know historically you're open on Saturday is that what you're going to do again this time I will do the same fortunately for you I'm sorry okay so it seems like uh we need to pick a date two to three weeks from April 8th two weeks from April 8th would be April 22nd does that seem fine for everyone two weeks Madam clerk would that be fine April 22nd you said yeah April 8th two weeks later would be April 22nd would be 22nd 2nd of April 22nd of April so would that be fine it's like um Easter Friday I'm trying to see like April 18th is a holiday it's good Friday um do you want to push it to the next place with a vendor to correct the history of missing minutes this is needed again not something I think any of us want to spend money on but that was already some money spent behind a public record request not met and that could potentially be an issue for us so I think the opportunity was here just to put it as a backround and why this tight is in with the efforts of the manager put a vendor in place having that said the idea of the item is to how do we don't get here again and so put some framework around this uh that would help us moving forward so this is what I'm proposing be a resolution to do um I spoke to Brad about this uh established by a resolution that all commission meetings minutes must be presented for for approval no later than 30 days after the meeting is something we don't have right now there is no deadline as to what they need to come back to us and I think this would allow us to ask the question the following meeting as to where are the minutes there it's not just whenever they come available but again forces us to check on on those as well and again it's not so much us I mean we ask this to the manager but it's an an instrument for the manager as well the second portion was about defining the minimum require information that was in the minutes this had to do with the prior IM minutes that I did pull out on the previous agenda and that's what I did that I was hoping to understand what was legally sufficient at the time and I did some research and I put together a template later on came the vendors template that we saw today they match I'm super happy with what I see so I don't need um that one moving forward we have someone that already defined us for as a professional and the third part um and I had a conversation with the manager about this was about while we bring bring ourselves to compliance make sure that the minutes are reflected not the minutes I'm sorry the commission meetings are recorded in our YouTube channel um there was one missing that you sent me but I couldn't find it in the list so for me I just wanted to make sure whatever we have um as as a live meeting public meeting that is there so that serves as a second opportunity to get data should it be requested um but the point here was how do we make this easier so um we talked about some other cities and how they're doing I don't know if you saw the examples my Miami Shores has the minutes the videos the agenda is only one place um if we can aim to that we have a vendor already that's doing part of the job so I don't know if there is an opportunity to evaluate invest in it a little bit more a lot more I don't know what that is um that was the next step for the manager just to see what could look best forward in order to centralize this so we don't have to worry about anymore everything's there and it also alleviates the request itself because then people can just download it from the website so that's it so I would ask your support and just moving forward with those resolution items that I suggested and then uh maybe the feedback from the managers as to I don't know if there is a cost associated with using a vendor is it goov no um granicus sorry if you know how much would it be to consolidate all all of that yeah so so uh so commissioner yeah we spoke spoke at length about this issue and and not just one time but numerous times and so uh the village clerk has reached out to granicus which I'm very s familiar with having used it in dur for uh 16 years while I was there eight eight years in the on the city manager's office I I like granicus I think it it has a great ability to do what we wanted it to do so she's reach reached out to them already asking them for an estimate for the upgrade so once we get that we'll go forward to see if we can't implement it this year or if we have to wait till the next budget year okay perfect yeah I definitely support this uh me and uh the manager have talked about website improvements and it's something I know he he talked identified early in his time here is that our website is out of date and there's places where we can improve so I hope to be seeing those improvements come roll out in the next coming months in the next year um my I like I said commissioner amor I joined you in this in my concern for this item uh my concerns more were setting a timeline to get us whole with what we missed from before so so I know I've talked with the manager about it and I think a commission should set a stated goal of three months to have our past year up to date within three months I think that's sets a goal set a timeline I mean we have a legal requirement to to have these posted for the ones that are pending the ones that are pending yes past so we did just approve of up to five Grands for a vendor to fix that so I would expect that with with the urgency that she took it and we already so what 56 today that it should be solv and within before the timeline so I think that is a check issue you know by then everything will be up to date I wanted to make sure that um and then probably would you be drafting this resolution that would identify the date changes meeting right okay yeah works for me all right you guys okay with it completely fine with it that's good thank you yeah yes so having completed uh old business 12a we'll be moving to 13A new business discussion item and uh Brad not to put you on the spot but I think this is kind of your item you want to introduce it yes so hopefully you all saw the amended agenda or I'm sorry memo that I believe in okay um that I I disseminated this morning um as you were noted from the original memo the reason why I held off putting pricing is we were there was one vendor that were still waiting for a response and they had until last Friday to provide their response and I didn't want to create any type of unfair um Bing process where they would have a public record where they knew what the other vendors had proposed so essentially um you give you would you as a commission had give me two directions one was to see if if these if any of the vendors who who presented were willing to reduce their fees and the second um direction that you all gave me was to see if there was an alternative um service that they any of those vendors were willing to provide with regards to doing some type of salary um compensation package evaluation to assist the Commission in determining what that what a proper compensation package should be for for a manager candidate and also to see whether or not they would assist in um developing or advising how how the BR the uh rooting brochures so I went back out I can tell you that um with the exception of Mercer which I I'll address in a second all of the vendors that presented said that their fees that they quoted were their fees and that they couldn't change those fees Mercer the Mercer group um did not change their fee which was $221,000 what um they represented to me is their fee the way it was structured was $21,000 for the recruiting service and then there was an additional $6,000 in costs and what they indic what Miss higer boan had um related to me basically is that the cost section so the 21,000 would stand firm the cost section could be reduced with only a single um imperson visit during candidates um interviews and having meetings with electeds and other stakeholders via Zoom or via phone would reduce those costs don't know exact she couldn't really tell me exactly how much much but so that may reduce it down less from 27,000 down between between 21,000 and 27,000 for for that cost um she did have um she I'll get back to that in a minute um she did so and then as far as the alternative um process or service um and I'll just summarize these for you I spoke uh there was only three firms that responded back one was um Mr Basinger's firm the other one was sgr and Mercer group so Mr Basinger's firm agreed um essentially what they said is look at their proposal phase one of their proposal that they gave originally essentially was what you're all asking for as far as the peacemeal of the salary analys compensation analysis and um and the brochure and essentially what he would do as part of that analysis and I took it right out of his proposal Gathering information from the jurisdiction from the websites and other sources have um interviews with the elected body and other key parties which are Village staff and stakeholders um determine the characteristics of an ideal candidate determine a reasonable compensation package and assist with the p and I wrote assist they they will prepare the brochure and for that was a cost of $44,000 um sgr um basically when you go on their web site they have an lack of better terms an alicart menu for these types of services um they did not quote as part of their fee a um a salary analysis but what they basically said is that their recruiters and the people that do the service have sufficient knowledge where they could sit down with the commission and you know find out what your salary ranges and compensation packages and give an idea whether or not you're going to get candidates to respond in this area based on that but they won't they're not going to necessarily do a quote unquote analysis um and what their package would include um as as I said with as far as the salary and um Consulting they would PR prepare the recruitment brochure they would provide a list to the to the Village of um ad placement recommendations so where you should place your recruiting ads they'll give you recommendations by way of a list they will draft one ad for you they'll perform one job posting and job blast on their website um and they they'll also prepare a custom designed um graphic and social media marketing um for placement in any social media that you have so they'll design it for you you upload it into whatever social media that you have they also indicated to me that if the vill and I don't know if the village does or not if the village has a LinkedIn account you could link it to their LinkedIn account which would give you also their ad their ad would go on there um and that was for a cost of $3,099 and then the Mercer group came back with a fee for um 20 $2,500 so it was and it was split up in two $1,250 payments um one upon signing the agreement was the first payment and the second would be on the completion of the BR brochure but that they would assist in creating the recruitment brochure um it would require the village to provide um Mercer with 8 to 10 photographs of the village and also the manager's description the job description um that would include a 20-minute consultation with each um elected official to determine an analysis of the position prior to the um the brochure sure development that would be a remote meeting um and and um you would have no more than four revisions of that procure part as part of that price um she had indicated to me just actually as I was in the meeting she sent me a text and she indicated to for me to please explain that she did not um quote anything for a salary any price or offer salary analysis or package analysis she said that you can get that off of a website which is wpb.org so those are the only three of of the firms that presented that come back to me that's um pretty much a summary of what they've offered what their positions are with regards to these and at this point I'm just looking for direction from the commission um whether Che this down quite frankly or or directing me to reach out to one of these firms to engage in some verion the I I think the only concern that I have oh sorry one of the concerns that I have is doing it Outsource and doing it inhouse like we did before is it the same amount of thorough um you know invest as they say investigation into a city manager is it going to be the same as doing it Out Source if we do it meaning are we going to get the same kind of uh thorough job because we have a person that's already here we need to you know I I just think we need to to do a more you know thorough job of is are we gonna get the same kind of service we do it out you know I know what I'm say out I know you're directing that to me my question I'm well you're looking at me so I don't know if you're direct you can look at me spoke no you spoke I was I'm not I think what I'm trying to find out is look I don't like to spend money to 30,000 or the 20,000 but if it gives me we we picking the right person I don't want us to make the same mistakes that we have done in the past so my question is if we do um outs you know the Outsourcing are we going to get the same kind of response if we do it in in inhouse meaning we going to get the same same job done if it's not then I rather spend the money to get it I want to get it thorough job to be sure that we get the right person yeah to me uh to me the all these proposals were nice but the amount of money to spend for this kind of search I think is a little above our means I I truly like to see the allart menu I think the um you know get having help with the brochure having help with the salary survey is a great idea um but I I really want to put this into context because our manager our current interim manager has been here for four months if he was a permanent manager we would be talking about a six- month eval right now I I weigh that and I think what would my six-month eval be I see six-month eval would be good boarding on Stellar so I if I have a good candidate here why am I searching out to see what's better I love my wife I I don't go out and and see if and see if I could find something better because I love I love what I have at home and not to be crude but I we I've heard from residents sitting here Stellar evals I've heard from employees with the communication's improved things in our in our village have improved he's only been here for four months and I understand there's sentiments we said said last week or last month about well he's a great candidate and he might move on someplace else to put it into context Manny Sid who we almost hired got another position and probably would have left we can't uh legislate for a c with a crystal ball and said what what does the future hold if we have a great candidate let's hold on to a great candidate and then we move on in the future if we're back in this place in a year two years I will definitely suggest let's call one of these firms and let's get a salary survey let's get a birth share done but if I'm searching for something that I already have I don't see see the need I have what I what what we need to move forward that's my opinion good you're good at this at this time I'm not I'm not ready to hire him as our permanent permanent city manager he was hired as our temporary c um he was hired as our temporary temporary city manager he wasn't hired as a per if he was if if you guys really thought he was going to be this great then in the beginning you should have just hir I understand but I can't there's no way I mean I done I done just to let you know to establish and kerk knows about it I I did um freedom information request on Mr ches with all of the agencies or places that he was and I have concerns about it I have concerns and I so I can't you know at this time um I have concerns he was he was terminated and denied he was termin I got papers that shows that he was terminated in in both those places and he was paid a lot of money to I just I can't I can't uh you know I'm not ready to hire him as a permit now if you want to put him puts an application in and we get other people then fine but I'm not ready to hire him as our permanent city manager at this time um sorry talking to Mario anyway um so you all know how I feel about the the uh spending $30,000 to find a candidate I think that that's ridiculous but so here's here's my thinking look the reality is that uh this Village no matter how much we want to spend whatever we want to spend will never ever ever ever ever uh be able to hold on to a top candidate because the reality is that we're not going to be able to pay what big cities pay and and if you have a great candidate they're going to be here a year two years 3 years and then they're going to move on right so and that's fine and we we've always understood that uh the questions for us to answer is you know number one is what are we looking to pay because I've heard all kinds of crazy numbers um let's just pay whatever to get whatever and that person is still going to leave in a year or two or three depending on what they get that's the first part um I don't know uh Al at all um I going to try to get to know him in the next week or so spend a little time with him you know visit with him um but I also don't think that it's smart for us to shut down any opportunities that we have with interviewing people um and opening opening it up to uh to to to folks to apply because we just don't know what's out there we don't know what we might find we may end up saying hey look you know we we got all these applications and at the end of the day um we think Al is the best candidate and that's great and and and I think that that's that's that that might be the case but I don't know that for certain at this point so I wouldn't be comfortable um giving someone that's been hired in a in a in a temporary position uh the full-time job without giving other people an opportunity uh to at least come in and and interview and and and it open and opening it up so that's how I feel about the matter um art did I I missed maybe a little bit I think I heard but um were you saying you wanna are you saying to put any of this firms to work in any way shape or form are you saying maybe alak cart are you saying not at all no no I'm I'm I'm I'm certainly open to an alak cart situation if if uh if it makes sense yeah but I don't I'm not going to bring people here from other states to travel planes and stay at hotels and feed them and that's ridiculous first of all One Thing One lesson that I've learned in the time that I've been here which I was very involved prior to be serving is that we really need to find a local candidate bringing people from other places to Miami is a huge culture shock which by the way our former manager I dissuaded him from coming here I told him I said you sure you want to come to Miami you sure you want to come do you understand the cost of living here do you understand so we need to find somebody local we need to find somebody that has roots here whether it's in state of Florida or understands the culture understands the costs there's there's a lot of that goes into living here in South Florida right and if you're from another so I don't even like the idea of bringing people from outside of the state um so that's the first thing um but yeah I'm certainly open to an alakar situation uh I just don't want to spend $30,000 to I mean we've found good candidates in the past and we'll find another one and and listen and like like Ryan said it may just be Al but I don't want to cut my arm off and not have an opportunity to see what's out there yeah so uh yeah I'm 100% on board of opening it for everybody that we you know Define on a job description to apply I don't think we need to go and jump heads you know into the current manager being I don't really know what the salary it is going to be based so I don't know if he's going to be interested on it uh that's number one we need to decide what that job description is going to look like and what the attached correct salary should be and that exercise has not been done yet uh so to that point specifically which will attract the right manager whether it's Al or not uh it's a very serious job to do none of us here are qualified to do that that is clear to me so help we need help from someone else to tell us the market price correct for what you need which I don't know if you already you been doing this for a few years I think Ryan you're the newest so far I can tell you my two years I've learned it is very particular it's not a small City with no commercials so it's less work on the contrary there's multiple hats being worn there's multiple things to attend there's an agility that you need to answer to this um with the experience of Al has been super handy because of the year we've had of someone with no experience we knew that when we hire the former manager so all those learnings I bring to the table to help me Define that at the end of the day we cannot do it ourselves so that's the bottom line for me I was Pro of going and hire in a professional Service Company I was ready to spend the 20 $30,000 for me although it's a huge budget I see the opportunity of vetting that they do by far the biggest benefit that we would take just because they are the ones that pick up the phone and know exactly who might be interested as an ENT manager working in a second position of assistant manager over here we have no contracts like this what's that you have those contacts well then what what do you there you go I didn't know that you do see so but for me having those the the the firms that we sort of interviewed that's what they're bringing to the table it's a lot of money yeah but also it's a tough position to fill in that's why we're here again so I was proud that I don't think there is Quorum on that for what I've heard that nobody wants to pay the $20,000 so my next phase will be let play all Card Services pick and choose and for me the job description needs to happen the idea of market analysis is the mass how much is enough for this position and are we ready to stand up for whatever the answer is it might be that is you know 200 Grand basic salary it's shouldn't be a portal pays 150 right um but make plus benefit so what does it mean as a compensation package we don't know that uh I can tell it doesn't it's not going to be total in 176 cuz that was 112 base salary plus benefit and you know I know that's not going to be enough for Al so we're going to enter a negotiation are we ready to move into the next phase of negotiating a higher salary I think that's going to happen uh but I would like help so I'm all in for alakar services with one of this vendors that we have in front of us is if that's what we decide um and then um I would have preferred to have the full service and the vetting from the company but I get it and then I'm open to everybody do a same process we had before open Period everybody submits and then let's define how we run down all the applicants and decide who the final uh winner is might be hopefully it is him I think the feedback has been very positive I want to see what else is there like I'm not going to just go with you know I have great feedback and I give my feedback and things that I hope it would be communication is a big one for me and I think you can pick your battles nobody's going to you know switch everything we have to do in four months so it's impossible to do but I want to see what what what else comes back for what price because we currently don't have that so that's where I stand that's good question that I don't know if you guys know the answer to but I've heard that Al is in a position of of perhaps getting another job something that you guys have heard since you brought it up I'll I'll provide Clarity on it I've had the discussion with him he was a finalist in another city paying a very l a very large amount of money and he's indicated to me that he would rather stay here if we're interested in him he's interested in us if we're interested in him that and and to the tune of he told me multiple years four years less money for a lot less money you know he's he's he's a family man children raised here he he did his his children did their Eagle Scout projects here he has invested in this community and it shows yeah uh and to provide clarity as long as we're providing Clarity it is a 150 at at elportal but they allow their manager to have a second job Yeah by contract we can't do that yeah so 150 is a lot of money when you can also have a second job yeah it's not that much if you if can't corre um so I just want to provide that Clarity that he's indicated to me that he will stay if we want him he's interested in us if we're interested yeah so I just hope the commission thinks about that as we go forward I'm in if we're if that's the consensus I'm in support of picking one of these firms with alart Allen Binger I hope I pronounce that right uh is is my would be my indication for that um but it's you know up to the commission what we decide and another thing it's we've been at this well you guys have been at this not me but you guys have been at this now for four months so we got to kind of move this thing along because I mean I it's I've never seen this thing take so long we don't even have anything in the pipeline we don't have ads running we don't we'd have nothing because the reason why it took longer is that we remember we decide that we want a firm that was the number one thing one month we said we want a higher higher intal we all agreed we had consensus then it was research about those T then negotiations then right there's three months so you know it's every meeting we we move forward and now to say we don't because they're too expensive we want to that was last meeting we said well it's too expensive what about alart and here we are so it it's it's a process to understand that $20,000 May might be a lot and um and so here we are you know so yes we need to move forward if you all agree then let justo a a vendor that is going to help us with the market salary um research the job description or uh um brochure as you yeah as you put it and let's define dat next steps in in terms of uh opening candidates uh and opening candidates and you have to form you have to form the committee I just want to let it's some of those recommendations from these firms had contemplated there is an interview process to us there is interview process with staff they need to understand what the rule entails that's time so it's not going to happen in two months I don't think and know I'm hoping it does quick but I don't think it's going to happen if you're bringing in an outside firm to develop this brochure and to do a salary survey we're until we get information from we haven't even picked a firm we haven't signed a contract this is going to take by selecting an outside firm you're delaying it minimum three months because we have to sign a contract with them we have to have meetings you're minimum three months so I'm fully on board with that just every clear in metime we have a manager that everybody seems to be happy with so I don't think it's a loose situation if anything what we're trying to do is put a process in place that is open for anybody else to come forward at the right right price because that's what we didn't do we never had applicants come forward with $176,000 we had applicants come forward for an listed opportunity for 100 grand and we selected Al and we gave him the negotiation he was searching for and that we felt comfortable with so I want if we decide it's 200 I'm making this up I'm not saying that's a number but if we decide it's more then what are the typical applicants that would show up for that budget to be fair to Al yeah I don't think it should take three months because he should have some clarity and some Assurance well that hey look I'm going to get the job or I'm not going to get the job should I continue to look should I not continue to look should I be a finalist should I get out should you know to be fair to him it really shouldn't take three months I don't I personally don't think it should have taken four months I think 2 3 months maximum from the time somebody leaves you put ads out you hire you you you interview and blah blah so now we're going to delay it again because now we're going to go into we're gonna now I'm are we going to decide on a firm at least today is that is that what we want is that what we want to do it's just that if you make them even if we tried with the firm we're going to take month just to put you at rest I don't know if you were in the meeting but when we had a negotiation with Albert we talked about time and time was in concern at the time because we knew it could take that's why we have an open-ended contract that was in a specific time for a year you were trying to go for a year at that time we said well it's going to be until we we don't need you anymore as an interim it could be that he moves to you know permanent and there's no transition issues or delays in the meantime what I'm trying to say I don't I don't think this is a rush process because we have someone capable to run the operation as he's showing um things are moving along ations are happening in terms of projects and everything we wanted to see we're just making sure we're doing due diligence with the company that we never did that before the alternative that I also wanted to bring to the table I didn't do this maybe art you were involved on the community um you know uh doing a how was it called was a was a recation they put together yeah to do the C so you don't need a taling in any necessarily they what they did is they just filters yeah yeah any of this when I'm saying it's time you have to put this all together you had to set up so in the meantime business is running there is no rush I think today we picked a company we Define with the job description they already you know we have Alternatives from the research that the attorney put together and then we ask them for the next meeting to highlight the timeline in the meantime we keep going as business uh or we can do what we did last time and put out ads and bring in people and get and get but when you put an ad the problem with the ad is that you need to advertise the salary and the position and we don't know what the salary should be we don't know what the we can put a a starting salary a figure we can put a figure in there what is our what is our starting salary now 112 112 okay so well I mean we would have to agree to a salary right but we can put we can put something in there that for me is the and it's and we can get the information that's all public information we don't need a firm to go and find manager salaries we can find that on the Google I mean we can literally the process that they would do if you saw the the recommendations is not here's a average and this is what you should do is meet with you know there's a process of interview please correct me if I'm over promising in any way yeah so uh they come they meet with staff they meet with us they ask us what are the challenges of the position this is why you had posted before you shouldn't have this actually this is how you should word it out the right applicant would go with this understanding those sort of analysis were never done it's been a copypaste of a job description that's never nailed it I mean Mario you know did great but he left we've had a few we've had a few I don't know them before but I'm saying let's not go through that so we land on the same situation we did last time so what do we change and the part of that for me is is the most important part that is the attractive portion is to that job description that is to be made what's the right price because even Ali is going to ask the question and I don't think I'm comfortable saying it should be based on some average that I did that didn't work before I tell you a because we've been paying bad we can pay 112 clearly um we know that's not the start point because we're paying 176 now all in composer but maybe the package itself needs to be evaluated with the package look at Al I'll went with don't pay me you know the benefits just put it all in one pocket it's what you have budget for so give me the money he's making more not because we're giving more than what we budgeted for we just give it to him differently and that is what a firm will help us decide so um in for let's hire today a firm move forward with the job description the money while we move you know every month closer to advertise where we are advertised we need that help that's what I think talking about and also the committee at the same time I don't know how that us working the bus start with getting you know use the firm to do what they to put a committee together you need all the data you need all the information you need all the salary you need the job descript you need all that that is the filter process that's the end yeah right but but in order for to have a committee you have to have applicants and in order to have applicants you have to put out a right and to in order to have the right applicant you have to have the right information out there so I am with you I think we need to just get started um we've gotten here so far like from 30 to 20 trying to negotiate didn't happen to here Al cart five grand and get the minimum help of least professional that we can the valid dates as we can't again I don't feel comfortable with like the average in or like public information we do have all that you know and Mario was um helpful you know when you pick up the phone what the job description he did it before it was great but we need someone to understand these specific challenging position so just I just struggle I just struggle with this whole thing because when before when Mario left here he said to me he sat with me he said all this is not rocket science I do it's not just common sense it's just logic so I I don't know why this is so complex but anyway listen just an inum guy here man y'all do what you want to do but we can try to speed this process along at least make a decision tonight that we can get to the next meeting where we already know we've made a decision and we can move forward from that meeting not leave anything in limbo tonight because it's just going to be another month and then another month and and it's not honestly I just don't feel it's fair to Al anyway so and I don't know how but but again I just want to on that point that was the negotiation with that we're not being unfair we're just paying the salary but remember he he he he he was just a finalist on another position so Al need some security for himself but but he could yeah but I'm saying just on that point we could pay 200 and he can find it to 50 next month 100 100% chances are he won't though because no the chances are he won't because once you take a job you know you commit yourself well last too long in his last two jobs me that he that he can stay around he didn't last too long in his last two job yeah but he lasted eight years as the uh V the city manager derell that's quite a long time my point here is um he was a candidate because he was searching other opportunities with this salary so and this that he you know being arrested in the history all of that I mean he's looking for a better opportunity it's negotiation he entered into into that process with that other municipality prior to us even res last man found out after so I don't know yeah he and when I did my research you look at look who the the finalist was in Mii Shores out childrenis yeah L from Remy Shores you know if if do we have a great candidate that's my point again you do write by him as as art says you don't keep mid limbo uh so I agree with trying to rush this process along not rush but move it along and at a reasonable P Pace um I'm with you I'm also with with commissioner Amsler on uh having some intention to pay the right amount because 112 doesn't work and it it might have worked for Mario once but it it didn't work the next time and I I'm not uh inclined to keep rolling the dice on uh managers that that might work and might not these Stellar up incomers sometimes are Stellar up incomers and sometimes they're not and how many times can we do that in this Village again over and over and over again before we're in fiscal trouble so to me if we if there's consensus for uh an in in interm or inside process let's find consensus to hire a firm or put it out an ad tomorrow right so let's um so Mr attorney you have the proposals there there was one in particular that talked about both redefining the rure for the job description and also the salary the salary research one of them did not include salary research well the Mercer group was that um Miss higer Boton indicated that she didn't feel it was right to charge you for salary research she said you can do that on your own on a website so so that's not that was her response correct um sgr said that they will not do trying to make sure I don't misstate it so they're not going to do a salary survey or or like full-blown analysis but they said based on their knowledge and experience of their recruiters and people in their firm they have a they have a working knowledge as to what the you know what the salary package should be yeah they can advise that um Mr Basinger had indicated that he is capable and willing to do a salary analysis A compensation package analysis col Colin B and asso um and then as you can note the sgr firm and I'm not pushing one firm over another I'm just talking about the differences in their proposals sgr will give you some Mone getting um that's part of their package their alicart package that Mr Basinger isn't doesn't give um Mr uh the the B Basinger firm was more local based is that correct B versus sgr well I mean Mr basers is based in Florida yeah I believe sgr is based their main headquarters is outside of the State of Florida yeah but they have in the state okay but Bas is this is their headquarters is here in Florida somewhere in yeah okay exactly okay and the basers uh budget request he was $4,000 and sgr was 3,9 okay and if I may while you're looking to uh the vice mayor's um comments with far as Expediting if if if you um if the suggest if you're going to move forward with this and with with one of these allart and you want to expedite this so I don't have to come back to the Commission in um in March and approve for the um you know for you to approve the agreement somebody can make a you can make a motion for um and and second and take a vote and essentially give the mayor I would say the manager but not the manager under these circumstances the mayor authority to execute the agreement um after review by the by The Village attorney and you could rank the order in which you want us to engage the two firms and we can have an agreement already in place before the next meeting that makes sense well you just give me an order of preference of firms all three of them just how many you only want two and here's the order I'll gaug one if for some reason the negotiations fall through which I don't imagine why they would um I'll be able to go to the next firm and I can I can draft an agreement that's um legally sufficient if we come to terms with the firm and then the mayor can execute the agreement on behalf of the village we don't have to come back here for your approve so we have two firms uh one for three firms um my selection would be either sgr or V Bassinger one is for $44,000 and the other one's for $33,000 what are you who do you guys inclined to what's the difference between the 4,000 because I I heard him I heard Brad saying one was that added something and one didn't do something let me read it to you because that's for me the important part so so you see the differences so okay there you go easier thank you thank you this is who it's basing here so okay and then if you go down that's the offer for okay it okay fine all right thank you it seems to me the sgr is more it's more of of a complete package because they have the review celery range and compensation package and advice as the type of candidate response prepare the brochure list of placement recommendations so they would tell us where to go and put the ad um one ad drafted perform one job posting and job last listing posting on their website and prepare all sort of the design packages to place the ad so they have a more holistic package I would say by just by reading this I can tell you right now that Co that Colin b b Binger Binger not the only one is going to take way longer to to do than sgr because he he he's he wants to there's a lot of stuff that he's looking to do before he's even able to do what he needs to do um and sgr is $1,000 cheaper so just by for me sgr uh would win simply because I think they would be quicker and they're less expensive there are not as I think the main difference though just so you consider or at least how I read it is that the first one although it takes longer it's more tailored to us uh the other one is let me just do a revisit on the job description put you the ad and and here you go the other one is I meet with you you tell me the challenges we go through your you know the we website the posting all of it so and uh to add a point to that uh Colin ba beijinger yes um is more of a Florida based company has many many manager searches in the Florida state that's why I have it SDR if I remember right was a Texas based company it's they have offices we're just talking about this in Florida but the headquarters is that of but when I look through they had not done a I think I could find not one manager search maybe it was only one in the Last 5 Years in in the State of Florida so that's very few may I want to say none but it was less than five Bellinger was like you said Florida and yeah I think it see might take a little bit longer I don't think it take hopefully not that much longer but they do they do Florida I mean he's got a lot of people in Florida I I would be inclined then to move forward with Basinger might this might I would put Bellinger first and then sgr second that's my two choices so so if we agree on on B Bas Basinger um can we can can and we agree on this tonight and we move forward with this can can we can you Brad uh tell him to you know get going gidy up um I will move as quickly as I can to to to um to to engage them and then uh get an agreement executed so that the mayor can the the mayor can execute it and then we can once the agreement signed we can move forward my my hope the reason why I mentioned that process is my hope is to um be able to do that before we meet again yeah okay that that's that's my that's my goal that's my hope d a price so I don't think he'll back out on I don't think he'll back out of the price I just think what just from experience when you start putting pen to paper and you start laying out the scope of services there's there can be misunderstandings and I just those will have to be worked out I'm not saying there will be I'm just trying to anticipate that that's a Poss the way he sounded I don't think that' be a problem it's not that is not a comment on his Integrity or anything in any way I'm just saying we're playing a game of telephone here relate things to me I'm relating them to you I'm relating to you what my understandings were based on our conversations I could have gotten it incorrect we could could have said misdated I you know until we have a pen paper and everybody signs the agreement the terms are only proposal like for example the ESS with preparation of brochure that was you know yes right that my interpretation I put his exact words but my interpretation is that he's going to prepare the BR short yeah if he turns around and says look Brad I I'm not that's not what I said I said I'll help I'll help the village do it but they're going to prepare it then I'm going to have to have a conversation with them see where that goes and if it doesn't if it doesn't pan out and he says well I want another $2,000 to do that you know that's not the direction of the commission I'm gonna say okay Mr basing I appreciate it we're gonna move on to the next rank could could could could we I think that he just thought up something that's right so we could have the two so if he for some reason changes his minding comes across then we can just go with the J second I thought that's what you all that's what I proposed or suggested yeah as a possible way to expedite the process right I thought that's what you all agreed to so if that's what you're agreeing to AG um then somebody would just make a motion and I'm not trying to no I'm not trying to stifle your discussion but just to get you to I reached out to a couple of firms that perform that work and essentially I'll tell you the the process is anywhere from 7 to 10 months for approval of a service Mark um it's $2,000 per application so you'd have one application for each um the cost is in it's uh $395 in an hourly rate for preparing any memorandums that the Trademark Office may require as far as part of the um process and there's also a trademark um search process that has to take place and that's at $395 an hour per motto and per the um the logo they can't depending they can't really tell me exactly how long that would take said usually it's about two to three hours but depending on you know the the commonality of the service Mark or the motto yeah it could take longer when they do the search they have to make sure somebody else hasn't already service Mark which The Village logo I doubt very much anybody's service but when you have images inside of it that they have to search that as well okay so I'm just letting you all know that and that was not in the agenda right no it's not I just I finally had the information so I just wanted to let you know thank you all right oh so [Music] missing now the reports we're ready for your reports that was the last item stand 10 minutes is uh commissioner hon going to join he's coming he didn't leave uh good evening Commissioners um as you're aware the mayor in Tallahassee with our state lobbyist David cert attempting to get some funding from our some of our projects I was able to jump on a call this afternoon with the mayor and our lobbyists while they were meeting with Senator pey uh this discussion Center on converting septic tank to sewer in biscane park that project is estimated to cost 60 to70 million uh during the month of January 2025 The Village manager's office issued six ltc's for various issues events that occurred during the month of January the first LTC was issued on January 9th that provided information with respect to a meeting that the mayor and police chief had with commissioner Steinberg on January 10th an LTC was issued with respect to the fair failure of the Australian pine um tree located on 113th Street which we talked about earlier this evening an LTC was issued on January 10th that dealt with an elderly abuse case also an LTC was issue respect to a missing person police investigation on January 17th and on uh January 31 an LTC was issued respect to a DUI crash involving U minor damage to a police vehicle uh the mayor myself and our state lobbyist met with Senator Jones uh discussed funding projects for the legislative session the senator was on a bright Line train to Orlando so we had that meeting was conducted via Zoom uh during that meeting we requested the senator or representative who appeared this evening to attend our our meeting and so you um he would provide further information on the legislative upcoming legislative session on January 15 a legislative Workshop occurred with respect to miss C Park initiatives for this upcoming session our state lobbyist David scera is working on obtain sponsors for requests for funding and we will be providing weekly reports during the session during the month of January I had a a meeting with Ray's Construction concerning their numerous construction prog projects located in the village we spoke about time restrictions for construction the Restriction of construction vehicles being parked on the medium I intend to have further discussions with them about improving the mediums and rs around their projects uh the v v Village attorney and I attended a meeting with the state of Florida in our V uh debris removal contract with respect to Hurricane Irma we are having negotiations with the state uh concerning money Ed for debris removal that are not covered by FEMA in the State uh we'll keep you informed about this matter I attended a meeting with &t about bringing fiber optics through our village buildings and what the cost would be some follow-up meetings will be will be held I also met with waste disposal contractor with respect to picking up large debris piles and establishing a procedure so that piles are removed timely uh the finance department will be attending the March Village commission meeting to discuss an item that I will be placing on the agenda for consider ation by The Village commission with respect to an amendment to their contract the amendment had been improved by the former Village manager and needs the approval of the village commission I will also be asking the Parks and Recreation Department to make a department report at the March meeting our Parks and Recreation director U made his presentation before CIT board uh concerning our freebie use within the village uh Issa did a great job and received many compliments from the board to concerning his presentation I wish to thank thank him for his hard work and we'll ask to incorporate some of that presentation to this March during the march uh Village commission meeting the PBA has signing ceremony for their Collective bargain agreement here at the Log Cabin uh Representatives came out to sign the agreement along with the mayor the PBA spoke about continuing working with the village Administration on fostering strong bonds and support for for their PBA members uh finally the mayor commissioner Amsler and I attended the Miami day County mayor leine kava's annual state of the county address that occurred at the historic Miami Senior High School the event was well attended and I had a chance to learn more about M day County's Initiative for the upcoming year thank you very much that's the my report real quick question um is any update on the be house I haven't heard a thing in a while so I I don't know where where with that yes so they we we took them to the unsafe Str board I I reported about that at the last at the last commission meeting during my report uh they were giving I believe 90 days dorine to um get a get a permit or and secure the building uh they're still in the in the process of uh appearing before the planning make an application for their uh for for a permit to rehabit um and there're ALS in the process of putting a fence around around the property correct the fence permit was approved at the pnd meeting last night okay great offense perence so they'll be reviewing the other plans in the future I had a question on the pending work for Public Works how's that coming along the search or it's not going to happen we had the position opening or approve at least on the budget for a second worker at Public Works and last Mee we discussed about you guys were going to meet and talk about that position yeah so John John and I are me are had a couple meetings and uh uh looking at that position and how what the qualifications are and you know and just and now whether uh we're going to have to put a hold on that position now to for the funds for the for the trees or
