we have a full Quorum all right thank you very much Todd uh our first item today as usual is the hearing minutes uh at the request of the public Improvement commission staff the acceptance of the minutes of the pic hearing held on October 24th 2024 do I hear a motion to approve the minutes I'll make a motion to approve the minutes of October 24th 2024 second all in favor any opposed or abstain so moved on to our next item public hearing continued number one on a joint petition by the city of Boston transportation department and the City of Boston Public Works Department for the making of specific repairs within the following public ways in South Boston consisting of her realignment roadway and sidewalk reconstruction as well as new and relocated pedestrian ramps traffic signal infrastructure Street lighting infrastructure hydrants driveway curve Cuts raised crosswalks protected bicycle facilities and median Islands Old Colony Avenue generally between Joseph Agri Street and Mitchel Street Dorchester Street generally between Tuckerman Street and Reverend Richard A Burke Street Mitchell Street generally at Old Colony Avenue this was new business on September 26 uh with public hearings on October 10th and October 24th as shown on a set of plans entitled city of Boston Public Works Department engineering division specific repair plan Old Colony Avenue and Dorchester Street South Boston five sheets dated November 6 2024 would the proponents please introduce themselves their affiliations give us a very briefy introduction to the project and let us know about the uh changes we've all been awaiting thank you Commissioners good morning uh John monachelli with the public works infrastructure and design team I'm joined here by the uh Consultants uh at least uh Lisa is here from VHB um we did request the continuances to better coordinate with the development specifically at 267 on that corner on the southwest of the page here um we did resolve the kind of who's doing what question which uh was the biggest question mark for us um there is one or two small details with the public works Street lighting teams uh to get their notes correct um on these plans um and I think it relates mostly to Dead ending certain conduit runs so that there isn't live feeds while the development versus our work is happening so uh we just have to get whatever the wording and and the specs are from them for that but overall I think the biggest issues have been resolved here um so um sorry uh General overview apologies um this intersection here has a a high uh history of crashes mostly vehicle to vehicle um based on the multiple Lanes of Old Colony and the connecting diagonal Corridor of dester Street um often times we have uh permissive left turns ending in vehicle to vehicle crashes and subsequently jeopardizing the the life and safety of non- vehicular users in the intersection as well um we have met with the community we've been working with these developers as I said on all three cor three and a half corners of the the intersection um and it will support our our projects moving forward on Dorchester Street spefic specifically and then hopefully in the future uh more up Old Colony as more developments kind of trigger uh trigger in so um the majority of this work is to reconstruct the sidewalks uh to relocate signal equipment and lighting to uh improve accessibility and um kind of uh reclaim areas within the intersection uh to make those turns safer and more visible for folks thank you very much John um commissioner any questions hearing none pic staff or members of the public uh we'll just ask that the uh Street lighting comments be incorporated into the final myars before the project team submits those other than that we have no you thank you Commissioners thank you all right on to our next item um so we have a series of uh six I believe public hearings uh all connected to the same project um we are going to uh read these uh one at a time since there are a number of different actions uh and I think what I would ask of the proponents is um to uh give your sort of brief project reintroduction uh once and then we'll work through each of the individual uh actions one at a time uh as we uh go through so if there are updates for example to specific repairs plans we can wait till we get to the specific repairs before diving into the details of what those updates are um but I will ask you to give just a very brief reintroduction to the project as a whole uh as we start out so with that public hearing number one on a petition by the president and fellows of Harvard College for the line and grade approval and acceptance of a highway easement for a new public way in Brighton to be known as trotting Avenue located generally east of Stadium Road from Western Avenue to a point approximately 631 ft southernly this was new business on October 10th as shown on a set of plans entitled city of Boston Public Works Department engineering division line and grade plan trotting Avenue public way Alon four sheets dated November 7th 2024 the proponents please introduce themselves their affiliations give us that brief re introduction to the project and then uh walk us through uh any uh changes as as it relates to this particular action since you're new business hearing thank you uh good morning chair Franklin Hodge pic Commissioners and members of the public my name is Shon Fitzgerald infrastructure for Harvard University's Harvard Austin Land Company I'm joined today by Chris lit from VHB who will introduce the project and any updates we've had since the new business hearing Chris I'll hand it over to you thanks everyone I want share my screen and walk through uh can can folks see that screen yes okay um so I just want to give it uh we have six petitions in front of you I will give a um an introduction of the overall project that'll um relate to all six of the petitions um and I understand we'll walk through each of the actions individually so uh this U these streets trying have Milestone Street a away are part of um phase one roadways of the ERC project Enterprise research campus uh at Harvard uh this slide here is from the 2018 framework and PDA network uh the tan box here is is phase one of that it's a 14 acre area uh in our streets uh will sit within that the names have changed since then this goes back a ways uh and there's been a lot of conversation and changes through the process but this also shows that the longer term much longer term buildout which um over time will include a connection to Cambridge Street which would be broad at grade and this is tied to the the straightening the Mass Pike project here this kind of Zooms in on the project side itself so kind of the roadways that we're we here to talk to form this uh U around the development site so this is the development site was per through the PDA process uh by tishman Spire as a developer but there's there's three building um a lab building hotel and residence building and the Harvard Conference Center is part of the project and then there's a large Greenway public open space uh that includes a shared use path in LGE L walking areas in plazas um and a key to point out on this is Harvard's District energy facility which serves their Holdings in Alon um and and it's the academic holding so it's um it includes the science and engineering center out to the West the business school uh to the north and there's there's Crossings of what multiple Crossings of Western ab and also Crossings of North Harvard to serve other portions of the campus but this is U this is the heart of it and that comes into to play later when we talk about the vertical discontinuances and the amount of infrastructure and utilities running to and from this building to Ser au's campus well we have the big picture here I just did want to point out a few things the light blue on these are the sidewalks so uh sidewalks on both sides of of all these streets that we'll be talking to um there are uh the orange on these is Ada either Ada drop offs um areas or um Ada parking spaces and those will include an ATR Island on the street level Island and then ramp up onto the sidewalks um so providing better accommodations to that uh this here on trying out this is a raised Crossing this will tie into um the existing shared use path it runs West up through uh Reena path in the park and then out to North Harvard Street and then based on conversations ongoing conversations we have the project this will be a race Crossing of Milestone as well in the shade use PA that particular will connect pedestrians but also the north bound uh cycle track connection would be here um we'll as we talk through the plans we'll also talk about modifications we've made here to make this a perpendicular Pro processing as opposed to an Apex ramp and we've made some adust adjustments to make these ramps shallower 3in transition as opposed to the typical 6 or 7 in so this will be at 4% as opposed to 8% ramp we'll go through there uh and then all the the driveways through the sites there one at the hot Hotel there's one uh this is access into parking for the lab in the whole site parking is underneath the buildings uh this is loading for the lab and this is loading for the conference center all of those Crossings will have a city of Boston driveway concrete apron and all the crossings The Pedestrian and bike Crossings will be at grade um and then extending to the stealth uh so this piece here this is inum trotting longterm this will connect to Cambridge Street uh in the short term this will just be this will be maintained as a driveway that goes out to um out to Windam Street uh connecting into the existing Street uh and then following that that connection out to wind uh this is just a figure from the tishman Inspire bpda filings but just mostly really wanted to show the connectivity of the shared use path I come through this raised Crossing and then the greenway in the Shar use path that runs through here um it connects out to the cycle track and sidewalks on the east side of Milestone um and also showing that the treeh houses the conference center is a little bit pushed off the road as as compared to the other buildings and the office Labs a little bit off as well and then just wanted to thank the Boston team through this process it's been it's uh it's been a long process but it's been a good process and we've made some changes with the plans along the way that I think have led to a better design and Incorporated a lot of input that the city has had uh in advancing the project so um we would like to jump into the actual petition now so public hearing for petition one um to and open and this is for the line and grade approval for tronic Avenue as a public way um so uh again we talk a little bit about this but the the railway will have um there'll be on each side of the street this has an 8ft sidewalk and a 5 foot cycle track on both sides uh in between there will be um there will be Hardscape areas Furnishing zones uh and some pump outs along the corridor uh to provide either some planting or some additional Hardscape space um this is the Western a connection Western a is part of western a improvements are part of the Tish Inspire development project uh they are working in they actively working with the city now and recently the 75% plan have been submitted so um my understanding is their intention is to come before this board this commission uh once they have those comments from the 75% plan review so they're hoping that that is going to happen uh within the next couple of months um but that these show coordination of the connection um to the Western a and the the sidewalk level um cycle accomodations as well uh this also shows the lighting um we've worked with the city Boston lighting department this is um this is some this is consistent with the overall Austin lighting plans um that has been carried through the West nav Corridor by by Harvard including the science and engineering complex um and that includes tighter spacing with a mix of uh higher and lower levels to make sure that it really focuses on pedestrian level lighting and making sure that that's um a common and this here is the um accessible drop off spot this aligns with the entry to the residential building on this corner and the greenway sits here um so it provides good proximity to both the greenway and the residential building and then here you can see the start of the of the raised Crossing so this this here is the raised Crossing connecting out to the shared use path um and this will be the future science driver longer term but this the pike sh's path will continue out um to the West science complex and inen paath um and this brings us down there is there's some parking on the streets and then there's there mix of bump outs um as well to provide some additional landscape this here is the crossing of axle way and as we as I mentioned earlier one of the things that we discussed was was um we had work to trying to there some challenges in terms of making this a um an accade Crossing for the for the sidewalks but we were able to make comod and so that this is just the 4% drop transition through here tying back in across to the south side of AEL and then um at the end here there is room for fire apparatus to make this turn axway is just to the east here and we'll provide accommodation to Circle through um the campus Phase 1 roadways but um as part of the process we've um established that we can do that turn around just within the public right away performance of the project so that's um guess that's a description of Trav and I could turn it over to see if there's any questions or comments Commissioners questions here right none uh pic staff or members of the public uh I will take this opportunity to remind the public if you wish to ask questions or add testimony please use the raised hand function at the bottom of your screen um I believe that theic's legal council CHL may have had a comment on this one um Chung I didn't notice if you were on or not maybe not yes I am oh great hi John yeah hi um oh I I apologize and uh I don't I have a slight um technical difficulties and I just want to point that out uh I received a draft Highway easement uh for um both um Charing and Milestone which is um um uh Highway agreement and the draft appear to be okay and um I would say um I have no I no other issues other than the PSC approves uh eement uh to join um so I just want to put that on Direct record I really appreciate C legal to counil uh to work with me and U you know it's in the last few couple days a lot phone calls and I appreciate that is appeared um the Highlight even in agreement is okay thank you all right hearing nothing else Todd any uh final words on this one uh no uh the project team and their Consultants have worked really really diligently with us on this entire project and it's it's been kind of a long road to get here so uh it's worth mentioning I just really appreciate all the cooperation and coordination that they've gone through um they've done a great job but we're all set all right um yeah sharing that appreciation as well um do I hear a motion to approve public hearing number one I make a motion to approve a petition by the president and fellows of Harvard College for the lineing grade approval of tring app is read into record by the chair second all in favor I I any oppose or abstain so moved on to public hearing number two on a petition by the president and fellows of Harvard College for the lining grade approval and the acceptance of a highway easement for a new public way in Brighton to be known as Milestone Street located generally west of solders field road from Western Avenue to a point approximately 647 ft southernly this was new business on October 10th has shown on a set of plans and titled city of Boston Public Works Department engineering division line and grade plan Milestone Street public way Altin four sheets dated November 7th 2024 for the proponents please reintroduce themselves uh and uh give us an overview of uh what is uh planned uh excuse me we'll skip the overview since we have the high level but I think please please walk us please walk us through the uh uh specifics uh of this uh particular lineing gr plan and any changes since your uh new business hearing I'm having here is some heav I'm going to stop the share and to restart it okay there for for Chris if necessary I can try to share the plans while you present or uh speak if that's helpful I also have the deck available chis if that's helpful okay me great thanks s to keep people suspects okay Milestone street is the Eastern leg of the U similar conditions on Western have working with the Tish fire team and they will be coming before the commission uh but we've coordinated this the intersection to the line including the at U the sidewalk level cycle track coming across the street here uh on this on Milestone Street on the the development is on the West Side uh these are is a 88 drop off uh and an 88 parking space on this side adjacent to the conference center uh most public of the buildings uh so there's connectivity to both the front inside entries of the building uh there's a small loading driveway here uh again with the city of Boston uh concrete apron with the sidewalk and um cycle track uh staying at grave uh right here we have um in the initial phase this was a shuttle um pickup drop off but longer term um would plan for this to be accommodate this is is designed to accommodate and then BTA bus stop as part as part of the design uh since we um it's the ongoing conversations from new business and and meetings in between and we've made accommodations to adjust the mid block procing so again this takes the Shar use path across mileston through the greenway and across Milestone to the Northbound cycle track from the sidewalks this is now set as a um as a a raised Crossing so this is a 6in raised Crossing uh that will accommodate this area um along the side we have a 7 and 1/2t sidewalk uh that does require an easement because of the the bus stop and ACC combinations we have a petition also for a a sidewalk easement as well but the sidewalk here is in total 7 and 1/2 ft the eement itself will be 5 ft so 2 and 1/2 ft will be in the right away and then there's there's also plit areas between the seasman and the the tree house Conference Center as you uh continue I should also point out on Milestone street that uh there is a new driveway proposed to connect to the NRI side the H genzyme site uh there their existing access is through a driveway here uh almost immediately adjacent to the compose Mone street so as part of the project and as part of the West hav Improvement project that dis F will be coming forward with with you uh this will be this curving will be closed off and the driveway will be relocated South um onto Milestone street again a raised Crossing of that driveway of the cycle track and 7 and 1/2t um sidewalk lighting again will be a little bit tighter spacing then the typical Boston standard um to accommodate some uh more pedestrian level lighting consistent with the Harvard Master Plan for Alon in in previous projects and then further uh South on Milestone um this again is a drop off this is at the corner of the lab building um and the South End Of The Greenway so again good connectivity with the greenway uh as well as the building parking along Milestone and we've been a couple additional modifications in Snoop business and as we've continued conversations with the city so this has has been um modified this was an apex Crossing before we've shifted it a little bit north and made it a perpendicular Crossing um to the South and then we've also uh made some accommodations uh or made some additions in terms of payment markings uh to Contin this down to the driveway this is the um District energy facility here um but to channel the axle way traffic um we've added some additional stri real striping in that area so that is um that is Milestone Street and again similar to uh trotting um we do have the ability well we we have a conect connection through a way as the of a private way we do have the ability to turn the fire Apper atus uh within the Milestone right away within the carving thank you very much Chris um do you have uh so first of all thank you for the adjustments here very felt very responsive to the comments we had at the last uh meeting so I appreciate that um one of the things that came up was sight lines uh going around this curve and you uh uh appreciate that uh the the team here shared a sight line diagram with us would you be uh open to if you have it handy can you pull that up so we can put that just on the record and in the recording uh yes uh let me figure out how to do that if not Todd I think has it handy and could pull it up slide it over this is the site distance diagram here the building does sit back on this corner there's an overhang that's about 20 ft up that it will come out further but that's outside the site sight line so this provides um about 183 ft of stopping distance uh through the line of sight in the line of sight um to to any pedestrian Crossing so this would that would that line of sight distance would accommodate uh something in the range of 25 to 30 mil hour and this would be based on the roadway geometry and the 40t Cent line radius a 15 mph um speed zone design speed excellent thank you um and you appreciate the clarification about the overhang um just one one question related to this while we have this up is are there any if you look at the space that sort of sits underneath the overhang uh and just outside of it uh at the kind of apex of that Cur Corner are there any anticipated elements that would exist there on the sidewalk you know fencing uh uh you know structures that might impede those sight lines or is it anticipated that that whole area will be left clear uh it's anticipa left left clear we will definitely check that make sure um that no obstructions are placed in that within that distance yeah that that would be great to confirm that um understanding some of this is outside the public right way but obviously keeping that area clear is uh essential for the safe functioning of the public right of way so we would appreciate uh Clarity uh a confirmation on that um Commissioners questions comments all right hearing none pic staff or members of the public uh John CH go right ahead sir um just a question uh and this may or may not be available on hand right now but could we see the the auto turn sweat paths for some of those more predictable vehicles um I appreciate you running through the sight distance and in kind of the design elements here and talking about the space that's kind of patched out for uh reservation for the the maneuverability I am a little concerned just about people cutting the corner and less so in larger Vehicles more so in the smaller ones I'm just thinking of areas of South Boston and the industrial areas that we are kind of like filling in that get more activity and more pedestrian traffic um and just wondering if there's a way for us to keep folks on the side of the double yellow that they're supposed to be on I apologize I don't have those turning um templates handy uh we can definitely take a take a look at that um and review that cool thank you so much uh anything else I think we're all set um I know Chong was working with the project on The Highwayman for this one also but they're in the the similar place with that all right so what I would suggest related to John's comments is that because uh you know likely any um changes that might result from that review the what path analysis are through traffic control devices more so than or striping changes more so than uh any uh physical permanent uh roadway design changes that we move ahead with this uh agenda item but that uh we take it as a followup to do to uh uh sit with uh John to review those things and if there are any adjustments made that um the uh plans the final plans would be updated to reflect those is that uh amenable to the travel in Brighton to be known as Axel way located between the southernly Terminus of trotting Avenue and the southernly Terminus of Milestone Street this was new business on October 10th as shown on a set of plans entitled city of Boston Public Work works department engineering division layout approval plan axle Way private Way open to public Altin Three Sheets dated November 7th 20124 uh with the proponents please reintroduce themselves their affiliations uh and walk us through uh any changes to these plans uh since you're a new business hearing VHB so axle way is uh intended to be laid out as a private way um connecting tring a and Stone Street um exway is more of a a service road for the ERC East West roads but it does uh Connect into the Serv the parking access uh for parking underneath uh the phase one buildings uh there's also loading on the North side for the for the lab buildings and then on the South Side there are driveways around the distributed energy facility UHA has is proposing um sherow she use for bicycles within the East West uh connection the intent there is really that um really want to encourage bices to use the the sh use path through the greenway and and the connectivity out to the both East and the West uh we also have sidewalks on on each side the north side will have a 6ot sidewalk uh and the South Side will have a 8ot sidewalk all of the crossings uh for axle way will be the sidewalk Crossings will be at grade they'll be city of Boston concrete apron um to make those great adjustments and to more that lighting will be consistent again with the Austin Albert Austin Master planning with some uh tighter spacing to allow for some additional pedestrian level lighting that's very much uh Commissioners questions comments seeing none pic proponents please reintroduce themselves and uh give us any updates on this uh proposal since your new business heing Chris with the HP on behalf of Harvard Austin Land Company uh there have been no changes with The Pedestrian easement uh this is remains a proposed 5 1/2t wide uh easement and that combined with the uh sidewalk to the uh within the right away will be a 72t sidewalk and then behind this is also closet area U offset from The Treehouse building conf Center building Commissioners questions comments all right oh uh P staff members of the public um I believe Chong has a commentary on this yeah hi um my name is Leo and I'm the legal council for the public Improvement to Commission I have been working with Harvard and his legal council uh to finalize The Pedestrian to easan I have Brighton located generally between Western Avenue and Axle way vertically beneath the grades of the roadways and sidewalks new business on October 10th is shown on a set of plans entitled city of Boston Public Works Department engineering division vertical discontinuance trotting Avenue public way Altin four sheets dated November 7th 2024 with the proponents please uh reintroduce themselves and give us uh an update on uh the vertical discontinuance that was uh first discussed at our uh uh at the new business hearing uh and just uh please also provide a little reminder for everyone on the record of why we are considering uh vertical discontinuances in this newly approved public way with VHB on behalf of Hart Alon L company um this proposed vertical discontinuance uh in the beginning of the project introduction we had pointed out the location of Harvard's District energy facilities serving their Bon Holdings um on the southern end of the project site uh that that building that facility um has a lot of infrastructure coming out of it both um chill water supply and return uh hot water supply and return uh Communications and electrical um um electrical feeds uh going out to the buildings the different campuses within Austin uh serving the site so there's a a large amount of um infrastructure harbard private infrastructure that is serving their properties and um is the business school across the street but a particular uh everything's a particular concern I guess but particular terms the science and engineering complex and um you know ongoing um studies and research there that they need to keep those buildings active so that um all these utilities are important in terms of maintaining that resilience and liability so the proposal to for the vertical discontinuances is to uh protect those utilities in those corridors um and maintain that that service to to those buildings um and also provide access to to those utilities and then we work with the city around where needed ements across it um or you we've also opened up some corridors and um this plan has has definitely changed a lot since new business and as we we appreciate um the efforts working with the city to um develop a plan that um one can really document the limits of it but to we can provide uh open areas for the city as well uh so when we came um before this this group last time in particular this this area I think was all blue um this is the future Science Drive there's infrastructure that runs all the way out here this is where the science engineering complex runs out and this Runs Out to the science engineering complex um and there's there's future step UPS here as well so um all that area south Science Drive have been blue U we've worked with the city and worked with Harvard to try to carve up some additional areas for that uh I do want to point out the the solid blue shows up very well on this in between each of these solid Blues is is a striped area as well um and what these represent are different elevations with the top of the vertical discontinuance uh the bottom remains -00 for all of them but the top varies so that um one we make sure we're below um below roadway the roadway grades uh and a little little bit of question below the roadway grades um but then also not not too deep in that uh we're getting into the utility so we're try to work with the both the longitudinal grades in the RO and the crown of the road it does uh lead to us opening up um breaking it into many segments to um effectively cat the volume of the veral discontinuance um and working with the City we've also added sections to the the plans that the B would um would indicate where harbard is requesting the vertical discontinuance and the white areas within the RightWay would be the areas that remain open um there is um yeah so uh this so this this is an addition to what was presented at new business and also Prov um additional corridors for the city to work through this um provide opportunity for future utilities so that that is the vertical discontinuance for tring Avenue thank you Chris uh appreciate that walk through and uh yes this has been probably the most complex and challenging part of this uh project uh relating to um the uh you know the development of this plan so I appreciate the work uh that's got into it and the you know the work that uh the dialogue that's happened with the city team on this uh Commissioners uh questions comments oh yes I have a few comments uh thank you um so we asked that um that pic doesn't record the vertical discontinuance until public utility bwsc obtains a satisfactory easement for pipes within Hobbit easement because we have um in the blue areas that are shown on the the map what we did was we have our own map uh there are definitely some overlaps with bwsc utilities and um the vertical discontinuance areas we we have a slide later um that uh lets us speak to the legal uh status of agreements and we're um noting that Harvard has drafted and we finalize an easement with the Boston Water SE in coordination with pic for BOS SE commission's infrastructure that runs through um areas of vertical discontinuance okay thank you and we expect that easement to be completed as part of the filing of all of these uh discontinuances is that correct yeah I think yeah the eement would accompany the vertical discontinuances which would accompany the petition for the city to accept the RS yeah got it all right Commissioners other questions comments so I I will just make one kind of for the record comment um you know this is a very unusual situation and uh one that um I think from the perspective of the city uh is uh a a condition that we generally would seek to avoid um as a an outcome when creating a new public way we believe that um having public ways that above and below ground are generally public is an essential uh aspect of the city being able to uh manage uh both uh you know the the the uh roadways the the flow of traffic and pedestrians on those streets but also to be able to provide areas of uh that can serve the public interest broadly in terms of utility access or other elements that may need to go underground and um you know creating a public a new public street that uh starts on day one with significant discontinuance underground impairs our ability to do that I think we have made as a city a decision to allow this in the case of this project given the unique circumstances associated with the district energy facility given the very unique condition in which substantial utility infrastructure was built prior to the uh layout of the public way and uh with you know I think some um changes over the years in expectations about uh what might be public what might be private uh you know I've heard different versions of that history but uh certainly I think um you know there was uh a belief on the part of uh some folks within the proponent team that uh when this original infrastructure was laid out that it would uh be sitting under a private way and therefore not subject to this whole process of discontinue it so um you know without diving too deep into the history I think the thing that is important for uh me to note here is that um this is not a precedent for future projects this is uh us uh working to make the best of a very unusual set of circumstances to ensure that uh a new stre can be created that uh substantial pre-existing utility Investments uh by uh the proponents can be protected and that we strike a reasonable balance uh to preserve the maximum utility of this public way uh for uh the city and uh the residents we represent for uh for many years to come um we certainly do not anticipate that any future public ways that are laid out will be uh in you know they will s of not be common practice to approve substantial uh pre uh predefined utility discontinuances and in general we uh take the position as the city that public ways should be public above and below ground except in a very limited set of circumstances where we Grant uh rights to utilities to occupy uh relatively defined and small spaces within those rights of way so um that's my for the record Spiel uh you we we we are not looking to replicate this condition uh in the future in other places um with that Todd uh P staff uh members of the public anyone else uh like to add anything um I will just mention due to the complexity of these vertical discontinuance plans um there is some refinement that the project does need to go through adding uh meets and Bounds descriptions and stuff like that which was you know maybe uh not necessarily the the most critical thing to show on these plans for this presentation but does need to be part of what is reported eventually um so because of that these plans are not necessarily final um and the number of sheets and the titles and all of that might be slightly updated um prior to recording so uh just for the record that's um something to keep in mind and this does we with the update based on our conversations we did add um the meets and Bounds on the line work but we do need to add the legal description U per your per our discussion so we will we will be doing that providing a legal description for each of the components yep no I know you're working on that and I'll uh work with you to to get those finalized before you run out final Myers excellent thank you going be a lot of text um all right with that do uh I hear a motion to approve public hearing number six I'll make a motion to Harvard College for the vertical discontinuance of P portions of Milestone Street public way Brighton located generally between Western Avenue and Axle way vertically beneath the grades of the roadways and sidewalks SW new business on October 10th is shown on a set of plans entitled city of Boston Public Works Department engineering division vertical discontinuance Milestone Street public way Al 5 sheets dated November 2024 petitioners please reintroduce themselves and their affiliations and uh walk us through the uh details and changes since your new business hearing Chris love with BHB on behalf of Howard aw Land Company this is a requested uh the petition for a vertical discontinuance of on Milestone Street um as discussed in the project overview Milestone street is one of the corridors um utility corridors for the district energy facility that sits just south of this site uh so there's existing utilities uh running through this Corridor uh and actually underneath Western a where there already is a vertical discontinuance uh and connecting into the business school uh so again this this point has changed a lot since new business working um closely with um with pic and very much appreciate uh patients going through the process um but again we we've broken this up into a number of segments um making sure that we're uh and again this is some hatch that may not show great on this slide uh but this hatching between the the solid blue pieces each of these are segments uh with the vertical um delineation that is underneath the level of the pavement um but over the utilities and those discontinuance areas uh so there are a number of for this particular Port Milestone Street um it does include the the challenge of some services that come off the main lines that go up to the um the Treehouse as well as the site out here um we but we make vertical accommodations to allow for passage um over it uh within the corridors particularly of the lighting and the drainage uh so the these are typical sections across each of those those breakouts uh there are areas where we drop it lower in for instance for City lighting uh and then there are Cor ERS uh in between some of that is basana sore utilities which apparently have these Ms which will these will go away when the roads are accepted by the city uh but we will continue to work with the city to make sure that there Corridor for their infrastructure uh these are the this represents the kind of the funky areas where we do have those service connections so we do have uh cutouts uh to allow for City infrastructure to go above these um and these go down at least uh 6 ft these will be uh as part of the ongoing comments these will be broken up uh to provide these a separate separate areas to in order to allow us to better describe or we clearly describe the vertical um upper end of the different segments so instead of uh um instead of this being one section this is M actually multiple sections through here and that that'll be updated on the plan you in with these sections thank you very much Commissioners questions comments oh yes I just had a comment but I um I just want to say thank you for responding to the comments from the last petition uh we just want to State it again for the wreckage because it's a different petition um that we don't want the uh vertical discontinuance recorded until the public utility bwsc obtains the satisfactory easement for pipes within C easement where there's like where there's some overlap between the the protal discontinuance in our facilities thank you thank you very much I will not repeat my Spiel but I will just again for the record say that this is uh an exceptional set of circumstances that is leading to us creating a vertical discontinu set of vertical discontinuances on a newly created uh public way and not one that we wish or expect to repeat uh in future projects um for my comments in the previous uh agenda item uh Commissioners any other comments pic staff or members of the public uh I'll just mention the same point about the um plans and descriptions and everything May um be tweaked once everything is contributed many hours to this process a lot of folks were involved a lot of folks uh spent a lot of time trying to make sure that we were getting this right so just wanted to take take time to thank Boston University government Community Affairs we're here today to continue the presentation from October 24th on the streetscape improvements that will accompany our renovation of Warren Towers at 700 Commonwealth Avenue these improvements will continue be's long longstanding tradition of working collaboratively with the city of Boston to enhance public spaces and the streetscape along key corridors uh a quick description of the project constructed in 1965 Warren Towers is the largest dormatory in Boston and the second largest non-military dormatory in the US housing 1,800 graduate students undergraduate students excuse me the project site borders Commonwealth Avenue to the North cumington Mall to the South and West and hinel mall to the east the 18-story structure features three residential Towers a top a four-story Podium which includes student spaces retail storefronts and a parking garage the proposed streetcape improvements will Elevate both the campus environment and the public realm along this prominent Corridor we'd like to thank all City staff for their thoughtful review and valuable comments throughout this process and appreciate your time today I'll now turn it over to Chelsea Christensen of P engineering good morning Chelsea Christenson nich engineering um can everyone see my screen here yes okay good it's not showing me for some reason um okay just for context uh I have Warren Tower site here highlighted in red a VI Bridge To the Left Mass app bridge to the right um thank you s for the introduction um our specific repairs today include um a new race Crossing at comington mall and H Ste mall with extended Planters uh New Forest paper strip of approximately 12T wide concrete sidewalk along the length of Warren Towers as well as um new bike racks uh relocated um Street lighting and new pedestrian ramps um I did send out the updated plans to everyone there have not been any changes since new business but um this is is these are the specific repair plant that we have all seen race crossing here at comington mall 10t wide uh pedestrian ramp with the straightened um CR walks going across P Avenue um reset Planters designed to accept storm water where they can um new bike racks along uh the forest table strip resetting the street lights outside of the forest paper strip as requested um and we also did uh we are relocating the bus stop that is currently located the this area here um down further to the east of comad is the expected location of it saying with that I will open it up to any additional questions that we may themselves their affiliations give us a brief orientation to the project and let us know about any changes since your new business hearing good morning I'm Katie Cruz civil engineer with Handcock Associates here with Scott Sha of the proponent Lincoln Avenue Capital um the proposed project is located at the corner of culbert Street and Blue Hill Avenue um it's also adjacent to Wood Haven Street the project is 41 affordable housing units um the project site will in include 12 parking spaces and a curb cut off of Colbert Street since we last presented um we made some adjustments to the alignment of the three curb ramps at the corner of Blue Hill Avenue cobbert street and Wood Haven Street so that they are LED with the existing crosswalks um that that adjusted the curve line a little bit to accommodate for that um we also modified the material between the curb ramps um for the request of the disabilities commission um we've switched that to Porous concrete um other than that um other than some minor layout adjustments to accommodate the new curb line but plant have not changed all right thank you very much uh Commissioners comments questions I just wanted to thank the team um for incorporating our feedback about um the Furnishing Zone and making that a more forc material um I did have a question about the width of the driveway and whether or not um that could be narrowed due to the um small amount of parking spaces um that that exist um on site um if um in future that could um be narrowed um down to um 12 or 10 ft um with approval from the Transportation Department yes Sarah we did look at reducing the width of that driveway um and we elected not to for a couple of reasons one is that we do need that width of the aisle behind the parking spaces for cars to man in and out of those spaces um and then the other is that we we have a loading area um on the side of that driveway and just be able to accommodate that two-way traffic um we felt like that we needed that width of 20 ft right thank you I guess I would just maybe defer to Amy um on that yeah I think the question is right like hearing the internal needs right like what appears at the curve line and what appears once you are on the at the back of the sidewalk I think is is the question here right if you leave the 20 ft and the things that are all in Gray can we just reduce the size of the curb cut and The Pedestrian exposure to vehicles coming out of this drive yes understood and I think just because this is a a very small scale site and small scale project um to allow for moving trucks to pull in there um as well as trash removal um Vehicles it's just having having that 20 foot width makes that maneuver um a lot more easy to accommodate um that use right off of the curb cut um but we do appreciate that comment were this was this Dimension select based on truck turning movements yes it was oh great then can you at least Supply those as backup for this yes we can all right uh Commissioners other questions EIC staff or members of the public um I will mention that the project has gone through quite a few conversations with us specific to The Pedestrian ramps and crosswalk alignments and all of that um we met with uh infrastructure and Designs Consultants a few days ago regarding the crossbox and ramps specifically um they worked on it a lot um I don't know if any of the commission members have commentary that they'd like to add regarding all of that but um thought it was worth mentioning no I think the only thing about flag and and Todd Flags us everywhere right it comes up is that we have some other stuff happening on bluea lab and to make sure that the timing and uh what shows up when um is all well coordinated with that effort um so I know that that's right like we're going to approve this but um we just want to make sure that you're uh constantly a part of the ongoing app discussion okay I think there's a little bit of minor discussion regarding some of the ramps and the crossb alignment on the kind of opposite side of Blue Hill a um the project team I'm happy to continue that conversation with you and we can you know tweak what's shown on these plans um based on that conversation after this hearing if that's all right with the commission yep it's that uh good with everyone concerns yeah and I'd also just like to extend my appreciation for the changes that we do see here um I think aligning or just resetting the curb this is a much better shape and the crosswalks and their ramps are looking much better in general so just thank you to the team for your responsiveness on that um and I'll just second U Todd's comment that I think yeah just that Far Side ramp that goes from the median to the other side of blue hilab is still has a weird alignment um but that's a relatively minor thing at this point um this is much improved indeed thank you thank you for that all right hearing nothing else to hear a motion to approve public specific repairs on a petition by downtown Boston business improvement district the proponents please introduce themselves their affiliations and uh talk to us about what you are proposing to put in Downtown Crossing all thank you Chief good morning and thank you Mr chairman members of the commission I'm Michael Nichols president of the downtown bid and on behalf of my colleague Kelsey prik and I we delighted to be with you today to share plans for a new set of distinctive holiday decorations for the shopping district in Downtown Crossing we've appreciated our detailed oriented conversations with many of the city officials on the line um and thank Todd and Ashley for all your help uh in fully understanding the requirements for ensuring that this activation can be a safe and successful component of the fabric of downtown this year and in years to come we have engaged the professional support of Niche engineering on this proposal and so I'd like to turn it over to uh Ryan Gordon for our formal presentation on behalf of the downtown bid but thank you all for your consideration all right good morning to the commission and everyone uh my name is Ryan Gordon project manager with nich engineering um and as Michael said we are proposing uh specific repairs to Washington Street Winter Street Summer Street and Franklin Street for the installation of 12 statues they are to be installed annually from mid November through the end of December the statue bases are 55 ft uh 55 in wide by 17 in high set on uh steel plates with four anchor bolts uh each statue is about 16 ft tall and the bid has been coordinating directly with Boston Street lighting for power sources to each statue um to to city of Boston street lights the locations that we are proposing provide a minimum of 5T clear uh pedestrian path of travel and when the statues are not inst salv um there will be uh flat headed anchors inst Sal where the bolts are so that uh flat flush sidewalk conditions are provided um so I'm going to walk through each location and if you have any questions please let me know so the first location is uh next to the modern theater uh 515 Washington Street and we have an X at each location that shows the approximate location uh each statue is set about 5 to 10 ft off of the nearest light pole the second location is at 500 Washington Street outside of the witer museum the Third location is at 449 467 Washington Street outside of uh forever the old Forever 21 in Snipes and we are using the Furnishing Zone as much as possible to get that um statue B to not U you know get into the The Pedestrian path to travel the fourth location is on Winter Street and Winter Street here is mainly open for pedestrian travel the curb is flush and uh you know most of the street is Brick the next four locations are spaced throughout Summer Street Plaza you can see the four here the next location is outside of 399 Washington Street that's across from Old Navy the next two are in Chopper Plaza and they are spaced apart um so providing that minimum five 5T around and the last location is outside of 343 Washington Street and just to show you again here's an image of each of the statues from facing and profile view and our specific repairs plans has uh you know a detail of the base the anchor bolt and you know a rough detail of the you know minimum 5 foot path to travel so I'm happy to answer any questions that you have uh thank you very much um these are uh very cool to see uh and very excited for the 16t statuary uh downtown um couple of questions uh so first these are uh powered and illuminated correct correct and the power feed is coming from the city street light lighting system correct and so just to confirm will all of those power feeds happen underground uh I will let Kelsey or Michael speak to this yeah yeah and and I think all cases are all but perhaps the ones that are on the stage um at the steps next to Millennium Tower the other 10 that would actually emanate out of the head um at at the 16t level um and reach the straight pole the straight light pole of that height got it yeah when your statue is that tall you can actually just Bridge uh to get there that's fair um okay uh and I uh my understanding is that you have uh reviewed this plan with the city street lighting Division and that they have signed off on all the details of the power arrangements and that there is a uh understanding about uh who is responsible for wiring for maintenance for addressing any uh you know power supply issues that may occur while the statues are installed is that correct yes okay um and uh related sort of to the street lighting aspect of this it looks like from the details some of these uh base locations are positioned over uh some underground infrastructure potentially some Street lighting conduit and I guess I'm just interested in sort of hearing this group's thoughts on how we would address any maintenance issues that might arise in the future uh with related to underground infrastructure beneath these bases what the expectations are for uh how these bases can be removed or uh uh reset and uh What uh your what the opponent's understanding is of who will have the responsibility for reinstallation if for example we need to remove a base in order to repair a conduit that's uh underneath so I'll add um you know we Niche engineering looked at the locations of uh the existing utilities that are in the sidewalks um you know we understand that um utility companies um and you know especially Boston Water and Sewer utilities uh we need to maintain access to those when needed um that the statues are removable because they'll be you know bolted into the ground um and I guess I'll let Michael speak too you know if um you know any coordination needed to to ensure that that happens if any of the utility companies uh need access to to their facilities we didn't place any of those statues over any um you know structures any you know over any manhole covers or or anything like that so they were placed intentionally to avoid those that's right Ryan Ryan landed where I would have started which is that I think the sighting was um uh selected to factor in the the minimal likelihood of um conflict with the underground Utilities in the event that there is a conflict however the bid would be responsible for removal and reinstallation of the sculptures as appropriate got it and that includes the bases um so in the event that a base was removed during a utility uh construction that the responsibility for reinstalling would be born by the bid that's right so entirely um to be responsible by the bid the the sculptures themselves for what it's worth come in three pieces so they are not a sort of single fixed unit um it making the installation sort of um relatively straightforward and easy all right I appreciate that and you know we can memorialize that in the uh the LMI um the other thing I would just ask is that um we have a you know we established some procedures for the city to Conta uh the bid if there are you know for example emergency utility work that's needed uh that we just have a way an established way to get in touch with you we're sort of we have all those protocols in place for the traditional utilities and uh but this is this is something new so um we'll just want to make sure that's close at hand um my last question relates to the plates that will be permanently installed in the street and the surface treatment of those plates um concern would be around creating slipping hazards during wet or icy conditions uh if there's not a sufficiently anti-p treatment on the top surface of those uh understanding they're mostly in the Furnishing Zone um Downtown Crossing as we all know it's very porous for pedestrians and people walk through the Furnishing Zone uh as a on a regular basis so uh can you just speak to the materials and uh what is going to be done to ensure that they do not create a hazard Ryan I'm able to speak to some of the elements but I'd say it it's our understanding that the the rounded base on which you so to see it in the upper right of the image there that the feet stand on occupy the vast majority of the square footage of the under of the metal plate that sits underneath that base and so I think the likelihood of even sort of the amount of sort of square footage for someone to be able to step on it is is so minimal as to perhaps not be a slipping Hazard um we certainly can explore for the amount of the metal that does remain exposed uh treating it you know with an appropriate U sliit proof material maybe I'm maybe I'm misunderstanding the plan but but is the there's a square per the the detail there what appears to be a square metal plate on which the rounded base will be installed and um agree the concern is less about when that rounded base is installed but is that square metal plate intended to remain when the statues are not installed no no okay it would be removed in the in the other 11 months of got it okay so so the the the bolt that attaches or the bolts that attach that metal plate to the sidewalk will be filled in with some kind of temporary cover that is flushed to the sidewalk and there will not remain any beyond that there will not be any visible structure on the sidewalk when the statue is removed okay got it I think I misunderstood um I sort of under the impression that the metal plate would have remain but I think that that clarifies and that's um that's helpful uh it it is something I I just would um you know think about as a uh you know we we've occasionally had issues with City infrastructure where um During the period of installation or deinstallation elements have been left in the right of way that have proved to be hazardous um where the whereas the final condition of uh the plate the round base and the statue does not necessarily pose a slipping Hazard I'm not sure what the installation timeline might be or in a circumstance where let's say one of the statues was damaged and the statue had to be temporarily removed but the the plate was left in place so I would just want to think through how if there's any additional treatments or protocols that we would want to establish for how the site will be uh ured how we sure that the site stays safe if for whatever reason the it is not in its sort of fully installed condition for some period of time that could be uh you know placing a traffic cone on it and just having that as an established practice or uh in some or in some other way making sure that it's safe but um we we have had some issues recently with newly installed infrastructure um having some uh unfavorable uh conditions for pedestrians in wet weather and I just want to avoid even a temporary situation where um you know where somebody slips and Falls as a result of that so um you know I don't I don't want to prescribe a very specific course of action here but would ask that uh for your next hearing you just come with a plan uh that you can articulate to us uh around that we'll commit to that and we we appreciate the prompt thank you uh Commissioners other questions comments my my computer froze up I apologize if this was covered but in the event is a vandalism such as graffiti um I presume you all have the capability to uh remove it and and keep the um keep the structures clean that's right we we'll commit to that thank you um we received a separate application for other winter temporary art in this location so I think we should also just take a moment to make sure that we're not uh stacking our winter art um a great problem for um Downtown Crossing they have but yeah no just making sure that they're uh compatible yeah thank you Amy that was us as well so we we um yeah no I figured um but as we talk about where that's going to fall uh right like I just want to make sure that we're um well coordinated right I just wanted to flag that that so at least in terms of deinstall of these and install of subsequent winter art that's something that we would sequence to ensure that there isn't direct conflict here um but we certainly commit to ort of any aggregated review that you think makes sense um the the winter art that you're referring to has become a it's now a second hopefully annual um set of installations but the locations of those change each year and I think we'll certainly in this year and in future years um plan for those with an understanding that the sculptures would be coming back each year and the car with the satellite crashed into it is also you that's us okay good yep nope I'll just make sure that we're all um together we appreciate that thank you Commissioners other questions comments do I staff or members of the public uh I would just ask that the bid reach out to Public Works operations team to make sure that they're aware of these and that these aren't going to pose any issues as far as snow plowing or anything like that absolutely absolutely we had noted to Jamie's point we had noted in the public art application but perhaps not in this application that the bid maintains snow removal abilities and so if any of our infrastructure causes hardship to Public Works in that area that we would fill in the Gap and and be responsible for that so we will relay that to them Tod thank you great I appreciate that and uh we will uh yeah Todd can provide contact information for folks and I think that uh the to um Joe's point about uh the uh the the you know graffiti and things there's a many issues in the public realm tend to sort of trickle down to the public works operations team as what do we do about this so um just uh making sure that they have all the right contact information
