meetings Act was emailed to the Asbury Park Press the co-star and the new co-star on December the 7th of 2023 that a copy has been placed on the bulletin board in the burrow office and that a copy has been filed with the municipal clerk as a courtesy to the public this meeting may be attended via Zoom if for any reason the zoom portion of this meeting fails or is disconnected the inperson meeting will continue and action can and will be taken um Mr Noble excused Mr gboi excused M Mahoney excused Mr Weber I am here but I have a point of order and I'd like to say that I think this meeting is improper because of uh chapter 5 Section 8 letter c number one of our ordinances here in town that talk about special meetings says the special meetings may be called by the mayor at any time um but it goes on to say that it shall specify the not shall specify the purpose for which such a meeting is to be called no business sh shall be transacted at any we will have hyper we will have state mandates let me do that again um no business shall be transacted at any special meeting other than that specified in the request so our ordinance says that you can have a special meeting but you have to say the notice has to say me about and then that's the only thing that you can do at that meeting it seems to me improper to have a meeting with three different resolutions on the agenda about various things so that's my point of order um do we have a b attorney to determine ERS correct um I didn't see him on Zoom well and I would I guess I would suggest that we did notice the point the the agenda items um and you're interpreting it one way I interpret no no no but it says you you in the notice of the special meeting you have to say what the purpose of the special meeting is and it says no business there's only you can only have one for one reason and it also says no business shall be transa transacted at any special meeting other than the specify that specified in the request so there's like singular one thing that you can do um okay thank you councilman okay um before so um I'm going to um just make a short statement and then um I think because of a quum issue we'll probably have to shorten this meeting um ahead so thanks everybody for coming and hopefully you're having a good holiday season um I I just have a very brief statement uh I had informed the council with the request over a month ago for the need for one maybe two meetings this year to complete some important burrow business uh these items were a resolution for the disposition of artifacts for 319 Avenue our residents expect expect us to move on this uh we added a request in the current resolution for the Historical Society we're still going through some final resolution on that but we have met bis the meeting we had on December 11th with Mr shamp a couple times and we trying to work that through uh we also scheduled u a separate meeting with Council MOSI and are operating at agent last Thursday to clarify uh any issues that he had uh he did not attend um I also stated that if needed council person Mone or president council president could fill in for him uh this is important uh and both the operating agent um of the Church of and the personal church or the President should be able to move forward with their plans so we do need resolution on that um the Main Street U resolution uh we met with jcpnl last Thursday in addition I had a brief discussion with mayor Jennifer nton of Spring Lake we were at a DVP conference last Thursday uh that was also attended by uh ba DeMarco and um the followup was really with our jcpnl representative here in town Frank Luna discussion affirmed that a significant cost he's actually going to document over a million dollars per block would be incurred at the expense of all the other improvements the committee has outlined the committee did discuss the underground utilities and felt it should be deferred pending potential future funding opportunities we empowered this team to assess and recommend and I feel they did a pretty good job of that uh but I feel like they were outright dismissed um in the meeting last uh earlier this month uh we stand to lose the funding of the million four we fought for and got earlier this year and the future funding we've applied for so this is a fairly serious resolution that we have to get in place we have to actually sign the grants um that we have started the engineering work which is kind of the trigger point and we we still need to move forward on this I'm happy that we um approved four of those five grants but this one is uh it's not only important for the million four that we received but we did apply for $5 million with the hope of getting some number between $3 and5 million to complete U the work on Main Street um the third thing was demolition bids for 319 L Avenue um which came in on Friday uh on schedule we got eight bids in and a resolution has been prepared so we can proceed with that uh the people voted on this in November of 2022 and formally uh not to invest in this property and it's appropriate to move that forward um so with that um and you did take a roll call is that correct take a um we obvious ly the the next agenda items to uh vote on we do not have a forum without a forum we really can't vote on these items U so I would suggest that uh we thought Michelle was coming um I suggest that we would um uh end the meeting here in a minute but I do want to make um a point at one more point that um because we don't have a quum for this meeting uh I think we need to take these items forward uh next week uh there's an additional item to address next week something that we do every year and that is any potential Financial transfers that are necessary we'll get that direction from our CFO and the bill list um one more uh we do this every year it cleans up loose ends and sets up the financial team for success in 2025 uh just makes sense that we do that uh we do have another potential executive U session topic that that can be deferred to 25 I hope the council can see fit to promote this and move it forward uh on these important items uh but with that we do not have a quarum tonight so I think we would um I don't think we would vote would we because the votes to worst cases to draw so I appreciate everybody coming out tonight and you have public comments yeah got public comments say something do public comment what's that just do a public comment uh yeah because we don't have really agenda you want to be able to comment oh sure sure like to tell about the Fletch Commission because at the last meeting that we had on December 11 uh I outlin cases where the Fletch Rel commission feels that they're owed money by the bur and I'm talking about the $3,000 yearly stien that the B provides to V commission every year and a reim payments uh made to the east control company that commission made in the bur is owes them to the commission um my email request to have a meeting with the acting Bureau administrator the commission chair and the mayor-elect of Neptune failed despite the fact that uh via email I provided every hour of of the business day that I was available Monday Tuesday Wednesday and Thursday last week it was a total of 17 hours and to be clear I did not even get ctes email back saying that the acting bur administrator was too busy wrapping up end of the year business or items or anything like that I got what I got was absolutely nothing this is a case where you know Neptune is starting to look sideways at Bradley Beach saying like can we trust them to pay their bills for this late commission that we uh we are basically working jointly on so this is pretty urgent in my book but anyway got no meeting not even a courtesy email saying I we couldn't have a meeting um regarding this meeting right now that we are in it is unfathomable to me why we are all here as you probably heard by now the three other council members were very clear to Mayor Fox that they were not attending another meeting uh after our last scheduled meeting and to be clear mayor we gave you a plaque and we wished you well that was it finished done for the year so just in case there's any doubt that the other three council members could have actually attended I am going to read their email the mayor was asking about an additional unscheduled meeting in late November this this goes back to November just before Thanksgiving to which councilman goosi said on November 13th mayor I'm not trying to be difficult here I talked to the council members and no one wants to schedule another meeting I presume is the same is true for the for our professionals also uh on November 22nd Mr goosi again said uh I will meet on Monday or Tuesday that's about a separate meeting I'm in no way Comm to a second December meeting until you explain why each of the the examples that you continue to offer can't be resolved at the December 11th council meeting then we had that regularly scheduled meeting on December 11th 3 days later the mayor asked for two special meetings in December to which Council duosi replied the Same Day quote I'm sorry mayor we continue not to listen to the council we have repeatedly stated that we do not wish to have any additional meetings any addition meetings to the 2024 calendar year unquote councilwoman Den Noble on the same day December 14 said mayor Fox I do not plan to approve or attend any further meetings in December we will cover these topics in January wishing you and your family good luck and good health in 2025 and joy councilwoman Mahoney also on December 14th said I'm not only unavailable during this most sacred time of the year as a Catholic I refuse and she made some comments about the mayor's leadership best to you and your family best to you and may your family be healthy um Mr break can he knows for a second let's just recap what I just read there were three Council people saying they're not coming to Council meetings in December so it's abundantly clear it's perfectly clear uh but on December 15th 4 days after our actual regularly schedule council meeting the mayor writes councilman thanks for your insights I recom two Mondays before the holidays and then on December 16th the mayor writes dear all quote I haven't heard that 5:00 p.m. is a problem for anyone so I will schedule two short meetings on just the same day on the 16th Council toi replied quot sorry Larry as I've told you repeatedly I'm not available for the rest of 2024 unquote uh and you know this is all so this is crazy that we're here it's crazy that Erica is not home with her family it's crazy that Michelle is Tak on after the fact I mean it's just crazy that we're here and on top of that um if you read the coaster this week you probably know that the mayor sent out an email from his mayor's account titled quote need some pressure on this Council now employing people to write letters to the editor against the council for not attending the meeting so that's where we are and um I would love to comment on some of the subjects here but I recuse myself from some of them so maybe we'll hear from the public on some of those issues thank you councilman and um the Avail I asked I also said to the council if they wanted to call in on Zoom it would be a short meeting but I don't think the business of the council for this town ends uh when somebody picks an arbitrary date for the last I don't know how many years we've had at least one additional meeting to close out Loose Ends for the year um and that's what I consider this being I don't I I just don't consider this to be uh particularly honorous we had a couple of things that we were trying to get closed out and um I think it was appropriate to get us together so we can we can agree to disagree but I think it was appropriate to um that on these particular topics um we had some people working very hard on a number of things and to get them closed out and not bring them into 2025 I thought was appropriate so but is it appropriate after people told you no to bring the staff in here that's that's the issue well you said we we disagree it's fine but that's the issue um because somebody says no it doesn't mean it's right we had topics that we had to we should be reviewing and closing out um saying no and uh for an arbitrary reason is not a reason so we we can do U some quick comments but I know people want to get home so uh are there any comments yes um I'm commenting about the artifacts bar Penny 216 brenley um I want to know have any of the artifacts been sold has there been any money exchange have they been sold no okay thank you yes only the champion 4 11 and a half Avenue um email I sent to Mayor Fox a little earlier we long language in revised resolution 2024 2016 is confusing does not reflect our discussion and is not acceptable to the Historical Society um the mayor was good enough to have a meeting with me and interim ba DeMarco on Friday um I reviewed exactly what we um Wanted for the historical society and basically uh some uh language was um suggested at that time that um really has been not reflected in this resolution at all um I I I don't think it's worth discussing tonight um I don't know mayor Fox why you are in such a rush to have this dealt with now um I had long discussions with um the president of the Long Branch Church of the president presid decide both last Friday before our meeting and also today and basically uh he's perfectly amable to wait for this to be handled properly in next Administration I don't really know what further discussion I can have with you you really haven't listened to the discussions that we've had in the past it's reflected in this resolution well I think one I explained in a note to you later but I said we can get other Tom kind of get get it resolved I don't have time tomorrow I'm sorry I have obligations let me know when you sorry let me know when you can I will okay also um I heard you just say that there'd be no money transacted on this that's not what uh James fo told me on last Friday he told me that he had written the check to the burrow for the full amount no he do not I think he's transa transacted with the operating agent uh we have not received any money nor that's not what I was told well let he told me that if there were any adjustments in the number of staying less Windows right uh that obviously he would expect to his much no any any business we've operated through the operating agent um we have not received any money the operating agent the operating agent may have but we have not so shamp just said was the check cashed did you just say how what was the dollar amount did you just say a dollar amount no I did not I don't know there is no check there he just said just said there was a check According to Jim Foley the president and what I said was the operating agent may have been working with the uh why would they send a check to the operating agent who doesn't own the artifacts because we did not deal with any of end users we dealt with the operating agent we but there are stuff we're the ones getting money it's our stuff ultimately the operating agent would turn money over to us ultimately something's fishy I conduct business yeah okay thank you yes yes NS um I'd like to thank Mr Weber for his comments um perhaps it got lost because our ordinance specifically States required by the open public meetings act the notice shall designate the purpose of the special meeting and that no other business shall be conducted one piece of business or 400 pieces of business the bottom line is the purpose of the meeting was not published for the public therefore this whole thing for usual is chaos and th of all kind of what I think it should be called um that goes with the bit in 2022 the ordinance was passed due to recycle gate any change in schedule of garbage I would say make it Water Sanitation had to be voted on by the council and that happened in 2022 and then in 2023 it did not I need a change in schedule and then in 24 the um plastic film was no longer being picked up was a pilot program ended pilot program ended way before that it needed to be voted on by the council and now we have another change coming this week that I'm here at every meeting it was never voted on by the council this is not a DPW issue this is a chaos at B Hall issue who published this in the calendar who published this on the website something is wrong here that the council is not being given the opportunity to vote on these things I so look forward to 2025 m p I'm just could you clarify what exactly you're saying hasn't been voted on change of schedule of Sanitation there's a change of schedule and sanitation yes I'm not aware of that so that out watching blow all over the street you should be aware of it thank you okay uh with that is starting take long and drag out where I think you know the burrow made its voice known when we had the referendum and that was two years ago now I think and we're still extending out from that I know there's a lot of pieces in play here and I know you have to be careful what you say because of your situation but I'd really like to see it move forward I'm disappointed that the council couldn't fit a couple more meetings in here I know it's a sacred time of year to those of us of many religions but I think we're all willing to be here and get this done and not at this time perhaps or other times could have happened I don't know where the restrictions on the meeting times are but I'm really disappointed this hasn't gone further and we haven't moved it along just for the fact that when the building is demolished does provide a revenue stream to the burrow which is extremely useful this very tendous time and the fact that we have bids on the table now for people being willing to Define what's going to happen in the Demolition and I'd like to see those at least get through so this happens and I'm disappointed the council wouldn't follow up with that this meting more if there's one scheduled for next week talk to you in private about that sure thank you thank question her Penny 26 gley couple questions um go back to the church this recent RFP which I watched be open the other day as well did the council get a copy of the RFP before it went out to B to review uh count so the the RFP was out in the public I didn't ask that question I asked you let me finish please it was out in the public domain number one number two the resolution that was passed a month a month and a half before by the Council on the elements of the demolition were followed to the T for that RFP so prior to the RFP did the council get a final approval of that no they did not but they had provided us all the elements of that in a resolution prior fine so that so you actually expect the bids to be open and you would want a council member to then immediately approve your bid that you didn't take the time to give to the council ahead of time to read you don't think that's POS no I I think what I maybe you didn't hear what I said I did hear what you said well I asked you a question did you hand them the RFP before it went out to B not when it was add no but they that's all that's the only question thank you no okay why we're closing up blue end to the year um where's the 2022 corrective action for the audit and where's the 2023 status I'm hoping to have a meeting on that Monday oh um the auditor and CFO have been diligently working on this and um unfortunately I can't control that interaction with those two but they I know for a fact I met with uh M Marco morning she said I think
