I do think she probably proed to pretend as if you're starting over kind of but um that way we have one complete record detail start off yeah turn your mic on not a problem my name is Bruce Conwell with cafiro law I represent the applicant Kings Cafe LLC um we came to the board last month seeking an amendment to the site plan uh to approve an outdoor seating plan where we were intending to take 10 indoor seats out of a total of 16 that were originally approved in 2019 um and move them Outdoors onto the sidewalks surrounding the ice cream parlor prior to the meeting the applicant received comments from the police department and from the fire chief um making a suggestion to uh install parking ballards at the site uh which was understandable and acceptable to the applicant uh but also the police department had also made a comment with regard to one of the parking spaces specifically the handicapped parking space and a potential safety concern where it had been observed in the past that um patrons of the ice cream parlor were backing out of the handicap parking space onto Lafayette instead of K turning in the parking lot and leaving through the exit uh and so there was a suggestion from the board engineer at to table the application and to consider this safety concern uh the applicants have done that and um we resubmitted a revised site plan taking into account Mr hur's suggestion for the possibility of doing away with that seventh parking space turning the space next to it into the a a new handicap parking space and then having our proposed outdoor seating potentially in a newly created seating area and so that's what we've done between last month's hearing and tonight's hearing as well so I think at this time I'd like to call Mr Murphy back to testify before the board and i' i' like to have him treated as an expert if that's okay want to swear you in um is your client going to testify at all Kate testified last month as to we'll swear in just just in Cas question and also swear in our board engineer so we can offer testimony to each of you swear or affirm to tell the truth the whole truth and nothing but the truth so you gu yes I do yes thank you Mr Murphy are you able to summarize the changes between the plan that was submitted in December and the plan that is being proposed this evening yes I'm pointing to the site plan that was uh uh submitted as part of this application and as Mr Conwell has stated we were here last month and a suggestion was made to move the handicap uh parking space uh towards Jackson Street and what was formerly the drop off area to have the outdoor seating in this area um as well as uh adding some other changes so the in summary the changes we've moved the handicap parking so it's still uh an 8ft drop off area and a full handicap accessible parking area we have a 10 by 18 area that's uh defined for uh public seating um we've added ballards at the front of each space as well as around the perimeter of the seating area so so that a person driving in would be unable to uh bump up onto the sidewalk area the uh parking bumpers that were at these uh three spaces that front off F Lafayette Street they've been removed but the uh parking bumpers by Jackson Street have remained um we also um say we've added some number of seats they went from 10 from last month to 24 there's a total of uh 16 in the defined parking area as well as uh eight more up against the building the uh um the tables are 2 feet in diameter um with the uh the the four seaters a little bit larger than that and um we also took away the seating that was on the Jackson side of the building so in summary we move the uh uh handal parking space over to find a a place for outdoor seating there are still the benches for the people waiting to go in we removed the SE on the Jackson side and uh added ballards around the front of the building as well as the defined uh uh seating area so that in summary that's the changes that were made right and so with those changes there are now two additional variances that would be required is that correct there's a variance that's going to be required to decrease the number of parking spaces from seven to six and also something that we'll talk about in a moment the variants um for the tables which are required to be no more than 10t from the principal building is that correct um that's accurate as well as um the sidewalk was supposed to be 5 feet it's four feet right fr the building 4T of usable area because there are 2 feet of the sidewalk area that's used for seating so effectively is only 4 ft so I'm sorry I didn't me to interrupt you you testified as to your opinion on the clearance forsus sidewalk last month would you mind uh summarizing your feelings on that variance sure the uh uh 4 feet for the sidewalk is routine if we look into the uh uh one source of information we use often is the RSI as the residential site Improvement standards for neighborhoods and for housing developments and in that requirement a 4ot sidewalk is a standard side Sidewalk width so having four feet in front of the building is uh an adequate in my mind an adequate uh walking area to gain access to and from the uh ice cream parlor thank you and you believe that a variance for the parking space is appropriate under the circumstances it is it is um there was a site plan that was granted a while back that uh allowed for seven parking spaces we were here last month we maintained the seven parking spaces in our discussion last month it was felt that for the cost of one parking space to have the defined seating area that was a reasonable tradeoff and I believe we all can agree this area of town right across moller's liquor and next to um um the dinner theater this is a walking area a beautiful park across the street this is a a big walking area in the town so I don't think that the um the deficiency of parking on this site is going to make a big difference um it is tight to get in and out and that's why moving it over I thought uh made it uh advantageous to make this flow better and um I think that most of the clientele for this uh ice cream parlor be walk up traffic do you think that increasing the parking space and amending the plan from last month's plan to the current plan that we're proposing now enhances the safety of the site it it is and and the microphone I don't make that or don't agree with that uh easily um the reason for moving the parking space o over the one the handicap parking space over one was a direct result of a request from the uh fire chief that stated that backing out on the the Lafayette stre was a safety issue um so moving it over increasing the visibility forgetting the seating just moving the handicap parking space over away from the property line was in his mind an advantage um to um uh the increase of safety on the site so um in doing that now allows for seating in in the defined area I think we all can agree that in the summer time if you go inside you grab some ice cream with your uh kids you come back outside um if there are a place is a place to sit down at a table and and a chair you'll do that if not the kids May sit on the uh uh the sidewalk May sit on the the uh bumpers may walk across the street to the park across the street I think having the onsite uh seating is an advantage for pedestrian safety in this area also so this started as a result to increase the safety from the police uh uh Chief and I believe it's it's extended itself to now a place where increased safety and seating excuse me may I ask a question at this time of course um has this plan been reviewed by the uh police chief chief fasel and Chief cter from fire I did not send it to the police chief I believe we had we we have an updated uh report from the fire department and police department thank and I'll and I'll review that when I go through my report um with regard to the third variant the the requirement that tables and chairs are within 10 ft of the principal building do you think that given the circumstances and this newly created seating area and given the size of this particular lot that a variance is warranted yes I believe so what was driving the change was the moving of the parking towards Jackson Street create I'll call it a a dead area if you will and to be able to have the um um the seating in there makes good sense you come out 10 ft with um this the sidewalk being six would only allow four feet in front of the building to be used as you get maybe a half a table and two chairs this area can't be used for parking um it's already uh an impervious surface and there are benches there waiting for people to go for service so being able to utilize that area for a public seating I think makes very good sense okay I don't have any other questions for Mr Murphy at this time any board member have questions Mr you don't see any negative impact on the Zone planers Zing ordinance around the neighborhood no sir um I think that the variances are reasonable um I have some special reasons which I can produce uh in in uh favor of those variances I would like to mention that there is um one waiver required with this application and that's lighting the site lighting um there is no proposed changes in the sight lighting uh with the exception that there are ballards and I did speak with your engineer uh Mr hurles about um getting lights within the Ballard for the seating area but I went by there this evening just prior to this hearing and there is a tremendous amount of um uh building lighting that reflects onto this immediate area so uh there is a waiver but make sure that's included in our application um I believe there are some special reasons that would um allow for the granting of the variants and um very with me a second okay I believe that the special reasons would be and I'm um citing from um use variances in Cox 4055 D um let say a g i and m a is to encourage Municipal action to guide the appropriate use development of all lands in the state in a manner which would promote the public health safety and the key word there is the safety which we talked about earlier the morals and general welfare uh G which is to provide sufficient space and appropriate locations for a variety of uses and I believe that this is uh for the commercial use to meet the demands of the New Jersey citizens that's reasonable in this situation and to promote a desirable visual environment I believe in adding the seating in this area is uh a very creative development technique and it will provide provide a uh desirable visual environment and M which is the efficient use of land I believe this property really couldn't be used in much more efficient of a manner than what's being proposed here this evening so I also uh believe that it will not have a negative uh effect on the Zone plan and zoning ordinance for the reasons I just cited sorry Mr Murphy what's the uh I noticed that the hatched area has to deal with with handicap access but is that going to be striped on the on the on the asphalt or what's that going to be there it is it's it's um typical on the uh uh uh accessible parking space you have a defined drop off area it's blue stripes uh uh 4 Ines wide there there's a there's a a standard for that striping to prevent anybody from parking at in that area and because it is standard we're all used to seeing it seeing at the grocery store at any businesses we go to that is to Def find uh a drop off area so an accessible person can drive in and get out on the passenger side and have a space uh that's allows them to get dropped off also there'll be a depressed part in the uh in the sidewalk that will allow adequate access uh into the building jumping ahead to Mr hurles he had a comment um that stated wanted a uh defined path into the uh ice cream parlor and to show that it is handicap accessible and um we would like to say that we can do that should the board uh approve this project that we like that as a condition to provide that to Mr hurles for his satisfaction I'd like to add one other comment Mr rigs you mentioned last month um the the possible need to have the HP approve the ballards um Karen I did give uh some exhibits with regard to at least the benches and the tables and chairs that the applicants intend to use they haven't selected a Ballard yet we haven't gotten that far but obviously as an additional condition of approval we would obtain HPC approval as well thanks and then since we're talking about the ballards do you mind if I ask a question about them so in the proposed revision looks like there's one Ballard per parking space around thank you around the parking spaces and then looks like there's one two three four five kind of around that seating area yes can I ask why wouldn't you put and obviously in light of kind of recent National events this has really become an attention of a lot of people you have one per spot do you think it would be advantageous to put two per spot as noted by our um Public Safety both the fire and the police chief we're not going to debate with your fire and police chief will put the two Ballard per parking space up and that's reasonable as you stated Rec in light of recent uh National events okay and then I guess then just around that seating area I'm just eyeballing it from you know the the plans do you and I'd have to defer to Mr haris on this do you think we I bring it up in my report too the spacing the spacing there needs to be adjusted and it needs to be bolstered right there it's especially closest to the driveway at Lafayette exactly yep so so really they there were two separate comments after the the proposed revision was submitted which was Mr hur's comment which again we we would certainly be willing to address that um as a condition and then also Chief coulter's uh input which is well received and if that requires uh additional ballards the applicant's not opposed to something like that okay thank you thank you Craig you want to sure I would summarize my January 2nd 2025 this is an application for amended site plan and preliminary and both preliminary and final approval with variances um if you recall just a quick summary they were approved in 2019 for 16 indoor seats um they're seeking to amend that application it came to us they were looking to move a portion of those seats are outside um after the board considered this the board and made comments and recommendations um that kind of directed them to abandon the the seating on U on the Jackson Street side move it to the front we had an opportunity to look at a site that was approved where we really focused on making sure that it was well parked and seeing how it's been operating over the last couple years we've um and especially uh being notified IED by your safety professionals um we we're figuring out a way to make this a much better safer site um and that gave us an opportunity to put seating in where one of the parking spaces formerly existed um so that you're able to capture some additional seating and the applicant is taking advantage of that okay that being said um the completeness review Mr Murphy mentioned one waiver um they asked for a waiver from providing the lighting design on the site plan I did support that um for now but it should be a condition of approval we now have outdoor seats we should make sure that they're they're lit and you have safe access from there to the front door so that should be a condition of approval and based on that I did recommend deeming it complete when they first submitted the site plan they requested one variance and that was for the sidewalk WID for accessibility uh normally they would be able to pull a uh outdoor seating permit for this if it was if they provided 5 foot clear in this case they can only provide 4 foot width clear it meets the ADA requirements but it doesn't meet your code requirements and that there's a variance required the number of parking spaces so they've increased the parking based on the plan so they're saying on the plan it says six indoor seats will remain and 24 outdoor seats with tables will be relocated to the front sidewalk area and the parking the former parking space and there's an additional two 6ot wide benches that are proposed for waiting in the side yard so those are the number of seats based on that we re-evaluate the parking there was no parking variance that was ever granted for this we they they conformed with it when we initially approved it um they so they're going from Seven spaces to six spaces and they're increasing the parking demand to 10 spaces so there's a parking space deficiency of four spaces um but that's the variance that's required for the parking and then finally there is a requirement that says you're allowed to have outdoor seating but it has to be within 10 foot of the building so the the furthest most seat is located approximately 24 ft from the building and therefore there's that's the third variance that they're requesting So based on the the safety the the betterment of the safety for the community um I I don't have any issues with any of those variances um I did ask for under my general review comments um I did ask for some additional information to be added to the plan and I'll go through those these these should all be conditions of approval under item number one I asked for the seat and table information and dimensions we have to do a review of accessibility from the parking space to the front door um we're shifting over a parking space we're putting a new curb ramp in there to allow for wheelchairs there has to be a landing that is of specific size and make sure the slopes are met so all of that information needs to be added onto the plan as a condition of approval and that's just to demonstrate Ada accessibility is being met um number two I I sort of dovetailed into that but I'm asking for the accessible root design it's based on just kind of what I was just talking about um item number three I asked there's an old plan note on there that refers to the old number of seats we would just ask you to update that to reflect excuse me reflect what's actually proposed on the plan um item number four that we talked a a little bit about the ballers in discussion um this is where I raised um the question of Ballers and Extra Protection they've agreed to provide two Ballers per parking space so that kind of addresses the police and fire reports that we did receive we received a police department review dated 17 2025 and a fire department review dated 1725 and they both recommended that additional Ballers be provided to provide safety for those new seats so that should be a condition of approval and I believe that they've agreed to address that um item number five um I I also mentioned uh concrete parking stops if they're providing the Ballard there's no need to have the concrete parking stop so um that comment can go away so long as they're meeting the other condition item number six we talked about it in the completeness review is that they have to demonstrate adequate lighting is provided seven we've just asked for the construction details of all the improvements that they're asking for and then items number 8 through 13 are standard conditions that we have fixed to any planning board site plan uh application um number eight providing the required inspection escrow and tying the certificate of occupancy to an acceptable inspection of those improvements nine is providing any required performance guarantee if there's any required 10 is compliance with the requirements or recommendations of the fire department Police Department Public Works Department environmental commission and shry commission I believe we only have two two reviews that are pertinent in this case and I did I already discussed those 11 is conditioned on approval is conditioned on all other necessary State County local approvals 12 we we already mentioned is this area is within located within the historic district so any HPC approval of the proposed improvements need to uh provide you need to provide evidence of that and then finally should the board Grant approval the applicant is required to revise the plans to meet your conditions of approval and submit those the requisite number of sets to the board engineer for review and approval I'm happy to answer any questions the board has no any questions of Craig excuse me clarification six sure I Cano it Bas original yeah so we Grant when when we first considered this there was no outdoor seating out there so we granted a blanket waiver across for the lighting design but now it it should be provided to make sure that we have S safety issu that just H out there yeah so any other questions want to do your summary good with moving forward I just think that in conclusion I think that we've presented a mutually beneficial I'm sorry a mutually beneficial application um one that addresses a safety concern and also uh provides the applicant with the outdoor seating that they've requested um I I think other than that the site plan remains relatively similar with the exception of the change to the parking space um and our expert believes that it it increases the safety and that the variances are warranted under the circumstances okay no other questions anybody here to make a motion on the approval of the application along with theend should we open to the public I'm sorry um yeah anybody public anybody in public care to comment I didn't think so you don't want me okay public portion is closed Dennis you were going to I was going to make motion can I just phrase the motion real quick okay the motion that I recommend being made although how you vote is up to you is a motion to Grant site plan preliminary and final amended approval along with Varian is one two and three on page four of the engineer report um I believe that we have the engineers not recommended a waiver of the lighting requirement is going to require some lighting plan relating to the seating correct correct Mr herles we're waving that at this time but it's going to be required as a condition of approval is my recommendation okay so it's a it's okay you're not required to present it tonight but it will be a condition of approval to have a lighting plan acceptable to the board engineer as well as the conditions one through 13 on the on the engineers report and this may be in the report but I also had notes that you're going to add two balls per you're going to have you're going to have two Ballers per parking space and add additional Ballers around the new seating area to the satisfaction of the board engineer correct those are my notes that's a motion I recommend being made how you vote is up to you and any comments you have you can certainly make all your vote but before we make the motion and for the ballards I know we noted it but I think HBC subcommittee or or some sort that's in here of that I just R to HBC approval is always required and he acknowledged thank you though yep Den do that motion approve I also commend the applicant for being very cooperative and responsive it's a good it's a good plan it's a lot great uh no one ever wants to see a decision made to take away a parking spot but this was um serves the better interest um from a public safety standpoint so I commend you for um taking the advice of
