policy of this board to conduct its meetings under the open meetings laws so as to encourage public participation whenever time permits and as part of agenda item discussions so we have one variance on the schedule for today but first let's establish a forum and when I call your name please say present John Beckley present Richard Edwards pres Ron Broman pres and Noble Hanson I am present okay so the first uh variance is uh variance hearing and approval of IA technology for minglewood homes uh parcel h13 Captain NS way Clark engineering David Mr chairman Mr chairman good afternoon uh got one comment from uh Mr Broman yes I just I just want to bring up that my grandson works for manglewood homes okay I'm sure that's not yeah Joseph oh he's awesome yeah okay so I just want people to know that I know he's a good boy I just wanted everybody to know thank you um hey uh David Clark Clark engineer on behalf of minglewood as you know Tim Smith minglewood is in the audience um so uh minglewood homes purchased this property in the process of Permitting it for development um it's 57,000 foot lot uh only 44,000 is above the Coastal Bank so under your regulations only 44,000 can be used to uh compute the number of bedrooms that are allowed so by right we could have four uh the room above the the garage can be considered a bedroom and so we labeled it as such um so we're here asking for a variance for use of IA technology uh to have five bedrooms be happy to answer any questions okay so uh it's this is a bacon lot in new construction correct and 44,8 ft Upland yes and so four bedrooms under the regular rules and adding a fifth bedroom by the use of ia uh system and anyone have questions or comments from the board pretty straightforward yep and uh awfully good location too boy par pardon me yeah sorry I was just say it's it's a very good location well it is it's surprised it's hasn't been developed the lot was created back in ' 86 or ' 84 or something like that uh been there a long time I didn't see any concerns pretty straightforward so yep and there's couple of big archers and five bedrooms and so that's pretty good I have just a question this out of interest um this the strip of land between the lot and the Oyster River is that uh chadam conservation Foundation land is that what that is no that's a panhandle for a lot off of uh that ae13 yeah but so it it belongs to a a house it's part of the same lot so it's it's a panhandle to create Frontage on the river so it's it's not it doesn't belong to the foundation it it belongs to a lot that has a house oh so this this lot does not have uh Frontage this lot does have Frontage yeah does or does not it does it does I don't understand oh so ae13 is the flood zone sorry that's not a number oh okay I is now I see where you're going all right okay and then I just out of interest um I mean the variant seems pretty straightforward but when you put a um the leeching pit or the under the driveway is there a limit as to what size vehicle can go can drive over that when you do that uh 20,000 lb per axle which is a loaded cement truck right so uh u h the h10 components that that are normally used uh outside of driveways can support a vehicle but tital 5 doesn't see it that way so yeah it's H20 loading is what yeah there required to be under a driveway okay okay are is is this a new road the captain n's way there's a on Google it doesn't really show it shows a captain Sears way this is right after Captain Sears uh so you just you're on skun Neck Road and you go to down to the end and it turns into Captain NS where the CAC is okay yeah um okay um any more comments from the board any any uh comments or input from uh somebody online and then can uh I get a motion I move to approve uh this variance with the stipulations that Judy has recommended now Judy there's I think a typo in number three of these conditions it says this Covenant and three bedroom deed restriction I keep catching you I always think I get them all for some reason I miss them okay so that means that should be five it should be five yeah okay yes okay and then a second U somebody want to second the motion I'll second it Ron will second it okay and then um maybe we can get Judy to read the conditions so um the standard condition conditions the applicant shall apply for an U wait a minute that's not the applicant should restrict the property to a maximum of five bedrooms and record this restriction on the deed at the barn County registry of deeds the applicant shall sign a covenant with the board agreeing to comply at such time as the town of jadam through its Board of Health Andor Board of Water and Sewer Commissioners directs the connection of this property to the municipal sewer when it becomes available this Covenant and deed restriction shall be recorded at the Barnesville County registry of deeds throughout its life the system shall be under an O onm agreement an OM agreement shall be for at least one Year and may be with any Mass certified operator of the appropriate grade that has received training by the company on the operation of the system effent from the system shall be monitored at least twice per year for the first two years preferably May and October the F1 shall be field tested in accordance with mass D standard conditions for secondary treatment units certified for General use dated March 20th 2015 in addition a lab test of the effent for total nitrogen to meet the performance standard of 19 milligrams per liter should be collected and analyzed by a certified lab water meeting readings are to be provided with the semiannual report if any of the field tests or lab tests fail follow-up test shall be conducted by a lab and an evaluation by the operator within 30 days after required two years testing application can be made to the bord agent for review and possible modification of the testing requirements the applicant agrees to apply a ma a minimum of 6 in of compacted top soil to all Disturbed areas the engineers shall submit an engineered ASU plan including ASU elevations with a written certification that the system system has been installed in accordance with the approved plan no alteration to the flo plan of the dwelling or engineer site plan will be allowed without further view by the board or its agent and this variance is granted pursuant to the town of cadams uh nitrogen loading regulations is valid from one year from the date of the Board of Health approval a permit shall be issued and work commence during that one year or the variance shall expire okay thank you um and I think we can probably take a Voice vote you're we I think we can probably take a Voice vote um to Grant this variance at um Captain n's way paral h13 um all in favor say I I all opposed hearing none opposed that variance is granted thank you Dave I've got a question when you have a SE a septic system under a driveway are there any recommendations of on whether you should allow that to be paved over or whether it should be should be stone for percolation or aration is there any kind of the the biggest concern D has is ation and so that's why they require a vent um so you could do that by putting Stone there if you wanted to or you could put a vent there no uh if you had a stone driveway they'd still require a vent okay because a stone driveway over time becomes 85% okay impervious uh okay it's only when it's new that it drains well okay thank you welcome thank you okay thank you thank you um okay so um old business um the uh Community Health needs assessment report um we'll be getting um sometime this fall Judy will probably know at our next meeting when that will be yeah I was hoping i' had it already but I'll double check and find out when it's coming and then following that report we'll have our own um Forum on Community Services when community health issues came up a lot of it involved community services so we'll have our own little Forum to talk about them with the Council of Aging um uh what's the name of the lady that does the Le Leah lacrosse lacr and somebody from the fishing Community to talk about that so and then um on September 23rd uh Karen shimazo will be here and she's going to give us a u sort of a comprehensive uh followup or report on the short-term rental regulation and what happened over the summer how it went uh the numbers um problems issues good things bad things um that'll be on September 23rd and then on that same meeting September 23rd we're going to have uh Mr failey from the DPW come and uh talk to us about the um condition of the floor in the metal building transfer station uh there have been complaints about the condition with odors and um it's been an ongoing problem and then we'll have a chance to ask him questions um and then John brought up at the last meeting that about whether we might need to have a inspection the board inspected that to follow that to get more information or not we can decide about that but it's an issue that um uh is going to be ongoing so um that will be interesting um and then the 99 Main Street short-term rental that's been a ongoing problem back and forth uh they have asked for a report of Health hearing and that'll be on September 9th so we got bunch of things for the fall um can I um just I just wanted to let the board know that um we have the the health department division um has purchased Naran um boxes I think you may have seen one out in the hallway right outside the door um I purchased three of them they were put up one here one at the fish pier and one at the community center um and then the um AIDS Kip Cod AIDS support Alliance support group is going to be keeping those stocked with Naran right now they don't have any in them um because we're going to do some training with um the town staff before we before we stock them and then I'm I'm going to also offer a community training so people um can learn you know what the product is and how to use it if and learn about where they can get it if they have a family member they're concerned about Etc so so this is an antidote treatment it's Naran so if someone is overdosing you basically spray it up their nose and it revives them okay um can save lives so it's um so who has them I mean I I guess first aid squads emergency squads yeah all the all officers all the EMTs have them in their trucks as well so but you know if they don't get there in time um say someone you know it what's the window of time one I'm not sure you know I mean if they're yeah I don't know how does the Naran box work is is the Naran right there it's it's basically a box we had them put up next to the aeds um although here we we moved it closer to the store but um it's just you open it and it's got it in it and it has Direction that's overdosing into the where the box is or you grab something from the box grab the yeah grab the Nar can out of the box and run and help the person that's all it is really um you can I can show it to you so do you break a is it like a fire alarm where you break something to open the box or anybody can just open the box any can open the box you have a way of knowing that the box has been opened the um we're working with as I said the age support group they will come by weekly and restock um why AIDS what's their connection they they've they do um quite a bit of opioid um behavioral work now um a lot of uh a lot of drug drug users um we have a history in our town of uh drug abuse over drug overdose we have had a few we had two this year that I know of and where did they occur um private residences or public places yeah private residences but um you know I could get you I'm just wondering how you connect how how do you well I mean the understanding the the the belief in the in the world for um you know is to get this stuff out into the community and the more the more it's normalized and out there people will will see that um that it's available how much would a box cost a box of Naran or the box that like an emergency treatment box that you would have post it it was I think it was about $250 right and then where it's being stocked for free by the aid support group so is the idea that if if if there's somebody on Ceder Street who is a uh chronic user of uh of Narcotics that they would come over here and take three or four vials out of the box and take them home because that's where they're going to that's not really the idea but if that happened I wouldn't have a problem with it because what's the yach the ODS of of a reaction uring here in the Comm no no I I totally get that but they idea is to get these into public spaces and normalize the the idea of them so people understand um the value of having the so could you the this may make no sense at all but could somebody who knows that they have a drug issue could they self-identify or could a family member of that person self-identify in a way that could result in one of these B boxes being given to them to be posted at their home um they can have Naran you can get it at the anybody can go B purchase Naran phy substance yeah no it's available over the counter I believe I think you have to ask for but dick is saying makes sense I it's got to be a strategic reason why you would want to post some of these right I mean would if you think it would be valuable I'd be happy to have a presentation to the board to you know on this topic as part of our you know kind of moving towards the needs assessment that we did and seeing what information is out there it would be a short half an hour presentation how many times a year does our Rescue Team administer this and save people is this a routine thing or is this once in a long I I couldn't say for sure but I think you know it's it's normal enough that they carry it and all the Cruisers carry it and all the ambulances carry it in a place like hyas they're Pro probably using it every week uh you know we don't have that big a a narcotic problem chat but we certainly have it and and uh it saves lives I mean it's sort of like a clean needle program except the clean needle program is just to prevent people from getting AIDS and and hepatitis this actually saves lives you're dead you know you're dying you'll be dead in three minutes if you don't get this and if you get it you're you're It's Magic It's Magic yeah um so let me be clear could somebody come in in advance and open that box and take some n Nar can and bring it home uh because they're afraid they might need it at home later if they if they wanted to and they felt that they didn't want to you know go to a store and purchase it for reasons of feeling stigmatized or something they having someone come for a short presentation and just go over some of those issues and talk it would be interesting I would find it just to learn more no and I think I think it's important that you know I'm as you know we have the opioid funding um that I'm on the committee and we're um we're Distributing annually and I think this is an important topic so the risk the risk keeps going up because of the fenel issue right you know that that people are take using heroin or whatever and then all of a sudden they get one that somebody's added fentanyl to to kind of boost it up you take that and you're dead you can die in in a in five minutes if you have Naran come in give a yeah I'll schedule that for the um early early winter you know I I would like to personally understand this issue yeah more I have a vague but I don't have an accurate sense yeah no they they do a nice presentation Ron yeah I think it might help somebody just by watching somebody you we have in here sure you know might kick something in their brain and they say I should get some or do something if it that saves one how you know where it's available even in not through our boxes but other places it's it's readily available and we need to get that out there so okay good then Judy uh do you have uh covid uh test kits yes we do we just just received last week um I don't know like 350 of them so um anybody in the public wants to come in and and get a few we have them here at the health department I have distributed them to um the council and aging and the community center so they're out there sum up today if we wanted sure y I've been going through I've been going through mine yeah yeah yeah no we have we have a bunch of them I can you can come up and we can grab them y okay okay any anybody else old business somebody new business uh and then we have um I'll make a motion we approve the minutes of August 5th 2024 uh right I had a an addition on this uh minutes it would be second page next to the bottom paragraph just to make clear that um the issue by the abutter was whether this SAS was going to go onto the ab Butter's property he kept saying that we asked the question and I think Mr Ellis clearly stated that um there would be no extension onto the abutters property no incursion on the property no U right equipment uh on the property at all right because that was seemed to me the butters m main complaint really so I think and we address that so that if can we reflect that in the minutes yes see what I where it says um we proposed is best and better than assessable okay I did say the third row up that the paragraph that he was concerned about the property alignment claim the SAS would be will be on his property right did you want yeah but but say that clear Mr Ellis replied that there would be no recursion no incursion or extension onto the ab's property including no equipment used for the construction right and then the other thing that came out was the this was brought to us mainly because the house transferred in our nitrogen loading uh rule rules say that if you have a Cess pool in the house transfers you must upgrade to Title 5 a real estate transfer regulations said that yes okay y um and in in that first paragraph on the next page this Bo requirement to upgrade due to failed system due to transfer of property you know wasn't wasn't really a failed CES other than it was a transfer of property that that then made it administratively f you got that y okay so I have nothing else there because that may come up again hope not uh John made a motion approve do I have a second second all right and then um we can take a Voice vote to approve the minutes of a August 5th all in favor say I with those changes all in as amended uh all in favor say I I I opposed okay so those minutes are approved and uh um I think that's all I have can I ask a a question about this 99 Main Street yes this gentleman is going to come before the board at our meeting I don't it's not on the agenda so I don't really want to talk about it but yes there was a there was a right but and then but then Judy will put together a timeline of the complaint and the correspondence back and forth because I'm not quite sure what what they're going to say but so we have all that information um right as much as she can put in there for us yep so we can ask the right
