this evening with my fellow Commissioners uh anyo Lopez Mike mcateer and Emily chernak along with myself Marty McAlpine our licensing clerk Naomi LeBron uh B from our licensing department as well as sergeant Chung from the Chelsea Police Department and officer Nicole mlin from the Chelsea Police Department thank you everyone for making the time to be here this evening we do have a fairly short agenda this evening so hopefully we'll be going right through everything nice and quick to start things off uh can we get an adoption of the minutes of the October 10th 2024 chel Chelsea licensing commission and can I get a motion to approve those minutes anyo could you uh please turn on your microphone I make a I make a motion to to approve the meetings thank you and can I get a second second thank you all in favor I I moving right along um Naomi can you provide us with a Clerk's update or did you want me to run through those Communications the abcc issued a notice of let me start over the abcc issued a notice in regards to recent news about non-concessional drugging at bars and other license premises due to the increase of incidents lienes should alert employees and patrons to be vigilant and have a security plan in place it is the responsibility of the licenses to ensure safety of the employees and patrons uh all lienes must exercise close supervision of his premises as well as corporate cooperated any investigation by the police and the ABC abcc investigators the second notice um a remind reminder for compliance issues during the holiday season happy hour certain practices are prohibited Under The Liquor Control Act and commission regulations and it's available on the commission's website at ww. mass.gov [Music] abcc licenses may not offer or advertise open bar to customers for a fixed price nor offer discounted prices for drinks during a limited time except at private functions licenses hosting private functions must be aware of the commission decisions issued in May in May of 2002 um and these um notices were sent out to all license e that's it thank you very much questions from my fellow Commissioners on either of those okay perfect moving right along uh next on our agenda we have a public hearing to consider a change of manager and issuance SL transfer of stock SL new stockholder for and all kinds of alcohol beverages on premise consumption license application for L Kiosco Corporation DBA R1 Kiosco at 212 Broadway Chelsea Mass good evening thank you for the opportunity attorney Jeff turko 378 Broadway Chelsea Massachusetts for the applicant this is my client uh as well Yuri karea Montano uh Li she speaks limited English so we do if you don't have a translator available we do have okay well she does she's got a family member who's willing to translate so if you prefer your own that's fine or we can have ours yeah yeah yeah we'll let him do it okay thanks thank you sorry for the confusion no worries and sorry to bring you in here for one uh I looked at your agenda I said one item so it's all good not a problem is um the translator prepared y okay perfect okay so this is um basically a family uh family members Johan and Jose um Geraldo was selling the business to their family member their cousin and niece um Yuri um is going to be there 60 hours a week she served safe certified I provided that with the application um the name of the business the theme of the business location are all remaining the same the menu is remaining the same essentially they you know trying to run two businesses at once for the family's been too much and so they made the decision to sell it to a family member um everything's listed here there the lease currently expire is March of 25 but there's a five-year option which has been extended that's why in the in the package I reference the lease date expiring on the 25th uh March of 25 but we have exercised the option we're just waiting to finalize the detail then it'll be 2030 so uh it's pretty straightforward she does have uh experience she worked for El Kiosco that's in uh in the application she also owns her own entertainment company as well she's very excited uh to be a part of the Chelsea Community she lives in Malon but she's very excited to uh to take a first cracket own in a restaurant she understands how uh important the commission uh you know takes its role to enforce the and she looks forward to showing herself as a good good neighbor good resident and good business owner in the town in the city uh you reference that she owns an entertainment company what what type of entertainment she brings in artists for concerts inter International International artists for concerts wonderful clearly will not be bringing to a small restaurant in Broadway um so the first thing that I just want to point out is there looks to be some discrepancies in the paperwork um when you look at the various forms um so as you just stated you're looking at a change of ownership um what we advertise uh to the community was a was a change of manager um so on the different documents you have different things checked off um so you definitely want to get this so it all matches before um submitting to the abcc so on the application for a transfer of license you have marked off change of manager and issuance uh SL transfer of stock new stock uh holder however it doesn't say you did not check off on that form the change of ownership interest or the change of officers um which are noted on one of the other forms and then on the corporate vote it notes a change of ownership interest and a change of hours which um we realize didn't re the change of hours we're going to have to file for the next for one of your upcoming meetings we recognize that um just there was nothing noting that change of hours so that was another discrepancy and the last one is on the application for the transfer of a license where you have the full application on that one uh it is just noting other um and it says sale of 100% of stock to a family member um so that one is not noting the transfer um of the license um so the the forms are just marked differently so some are saying change of manager some are saying change of ownership um and you you have the change of owner as well as the change in officers as when you're looking at at sections five and six on that application in section five we're seeing Johanna listed as the president and Treasurer and then down in section six Yuri is listed as the president and Treasurer so just making sure that everything is marked off so it all matches on all of those forms yep it's just the the notice I'm looking at the notice that was uh put in the paper it says change of manager and issuance transfer of stock new stockholder so that and that's so I'm not sure about the notice but that's the letter that I got come up I approach so this is what we're showing this is what I and then that one so this is stating check all that apply and so we didn't check off the change of officers we didn't check off the change of ownership interest so the hours are not before you tonight because we didn't we put that in and then we we didn't follow the paperwork for that so that's so it wasn't noticed we we understand that we talked about that this morning but the CH 100% change of stock uh interest in the company making her 100% owner of the company I think by definition we're changing uh that's why we listed it in there as listing her as the president treasur because Johanna and her father Jose will have no further interest in the company so which is clear when you read all of the paperwork but you just want to make sure that all of those forms are accurate correct um so they do need to get updated with everything ticked off so it matches what you are submitting I'll submit that to Naomi first in the morning perfect appreciate that thank you um outside of that questions from my fellow Commissioners Sergeant Chung questions comments from the police department I do have a couple of questions um the last time we did a compliance check at Kiosco there was um some mention of the entertainment license which we did give a verbal advisory for um I just want to remind Yuri that if there is an additional TVs added that has to be reflected on the entertainment license I believe last time that message was um provided to to Johanna um being a new owner um I would like that you know she Yuri gets privy to the rules and regulations um that's incredibly important um I reviewed the cor the Corey for Yuri she passes with flying colors so um great job with that additionally as for cogs for the address itself there's been no issues there um and every time we've entered the previous um management would always welcome Us in so it's always been a good uh relationship and or if they're not there the manager that's on scene is able to get Johanna on the phone right away and she always answers so I'm hoping that same relationship we've built over the years will transfer over to Yuri because eventually we're going to do more compliance checks and we we expect to see the same standard we're here to help we're not here to hurt you guys if you guys you know stay the course with the rules and regs take that as your Bible as your handbook because that will give you any everything and anything you need to know and I'll I'll end my commentary with a question now that Yuri is assuming ownership will you be op opting to hire for an additional manager for when you're not there because for a bar as you know a manager needs to be on duty yes she plans to be there the whole time but yes she will hire a manager just in the instance when she's not there is there going to be any other changes to the funu or the way the bar is set up because a lot of times a lot of establishments where they fail the most is camera cameras you know cameras cameras cameras and the reason why cameras are important is because it helps her and protects her as a business but also helps the police department in solving neighborhood crimes it's just being a good neighbor being a good business owner um compliant to the city of Chelsea in regards to that officer do you mean cameras inside the establishment or outside so the cameras need to cover the interior entries and exits and there were cameras there when we were present the monitor wasn't on but we did determin at the time it was functioning that monitor needs to be on and the windows need to be clear for us to be able to see through okay the answer the question though is that which is not changing anything in terms of the fisical layout it's going literally the only thing that's changing is the owner currently uh the hours a Tuesday through Sunday 3: to 11 uh will file uh probably tomorrow morning uh before noon um I have request to change the hours she'd like to be open 7 days a week 11: to 11: you do the math on that it's a lot of hours so she'll have to have somebody else coming in uh to assist her right thank you any any comments for me or any questions for the police department not at this time uh she's thankful good luck to you congratulations is there anyone from the public that would like to speak on this matter yes hi hi again um my name is Claudia Korea and um mam shair through you through the to the Commissioners um actually I know Judy for a long time and she owns multiple um businesses in the past comes from a family that knows how to manage restaurants and bars and I've been in the public sector for about 10 years and one of the most thing the things that we appreciate for most small businesses is when they come forward to support the community a good example is so I work in the city over years when we had neighborhood cleanups and she actually sent some of her friends and workers to help us out to do neighborhood cleanup so the fact that a business come to a community uh and they're aware of the importance of giv back to the community I think it should definitely be highlighted thank you thank you I appreciate that is there anyone else from the public that would like to speak on this matter seeing no one um I just want to reiterate what um Sergeant uh Chung had noted in terms of making sure that you've read those rules and regulations the only reason that you'll end up having to come back before us outside of requesting some sort of a change cheer license is if you aren't following those rules and regulations um so very very important to familiarize yourself with those and the two things that people tend to come back before us for most one of them as she mentioned is the cameras so it's having the cameras working and maintaining that video surveillance for a rolling 30 days and providing it when asked you say for 30 days 30 days yes that's that's a very important part that some people miss so please make sure you pay attention to that and if you have a problem with your cameras let the police department know immediately and again they're here to help so telling them about the problem and then just working to fix it the second issue that people tend to come before us with is not following the rules of their um their entertainment license so if you're trying to do different types of entertainment you have to look at your license and see what you are allowed to do and if you want to do other things you have to request a change to your entertainment license prior to doing them and come back before us for that approval and if you have questions on that license then you want to contact the licensing department and speak with Naomi and she can tell you what it is that you need and that way you don't have any sort of problems and you can be a nice successful business um and with it being a change in owner that also means that the amusement and entertainment license needs to be changed um because the current license would be underneath the old owner well the reason we didn't file for that is because it's a change in ownership of the corporation the corporation holds the entertainment license and so the the corporation Remains the Same she's just the new stockholder owner of the corporation and so the entertainment license was granted to lco Corporation makes sense and that's her yeah and so the abcc requires the TR us to notify with the change in ownership of the company yeah that makes the the hotels do it all the time that that makes sense to me but I'm going like I said if you you want me to do I'm going to file tomorrow to change the hours and to clarify the issue with the TV so if you want me to to do that as well I'm happy too but it's the same Corporation just a different but the application says transer it's really not but that that's like I call really see that's that's their paperwork so there they don't have any other form that you can fill and I said this isn't really just ing ownership of the company they said use the forms we have online Okay I I think as long as it says El Kiosco on that license and it doesn't have a person named then you're okay if it has a person named then just make sure you get that filed right away absolutely so that way there's there's no future issues yeah try to do it by 11:45 tomorrow morning um other questions commentary from my fellow Commissioners oh question to S CH uh regarding the the cameras when you guys checked uh this place was the camera working the cameras were working um we just couldn't tell when we walked in because that monitor to review the cameras it was just turned to off all we did was press the button turned it on and the camera was working all right and and then another thing I want to say to to you is that uh I'm very huge on on clinic and you mentioned something about clinic and Rivia I would love you to to clean up in front of your sidewalk in front of your business so because I'm I'm very huge un cleaning thank you thank you uh and then the last thing I just want to um point out I do see in the paperwork that you have your Serve Safe certification um which is wonderful it does expire in the coming year so just make sure that you renew that and make sure that all of your servers and bartenders are also certified okay thank thank you um and this may already be taken care of but also in your paperwork your uh certificate of compliance from the Department of Unemployment assistance does note that it expired on November 1st um so that may already have been taken care of but just so you are aware absolutely thank you you're very welcome um pending all of
