good thing though um Tim tumelty Coco Beach umu thank you for allowing me to speak I am first thing I want to talk about is um an event that's happening this weekend National KY Foundation it's having their um uh events uh surfing events and whatnot uh Saturday and Sunday and here and in this facility we're going to have the um silent auction my wife Courtney is the chair of that she's been the chair for several years and um it's a great event they in the past they've generated over $100,000 in in that particular weekend so looking forward to it um there may be some discussion another thing is there may be some discussion about uh ebikes here today um I I just asked the commission not to expand on it uh rather um put it on the agenda and speak on it when you can have more people here to give you more information regarding that issue it's a serious issue uh I see it every day we have our our athletic director's son ran into a poll probably going 25 30 m an hour he had to be airlifted to the hospital and uh yeah it was not good um we don't want to wait until somebody gets killed to make these decisions so hopefully we can get that on the agenda maybe in December or January that's all I got to say thanks thank you Jim was there any other public comment all right great they said bikes Rick Anderson 1800 Minute Men Causeway and first of all I want to thank Carolyn for all the years of service it's not going to be the same without seeing you on the on the commission You' been a commissioner almost since I got the PO Beach um and thank you um on the subject that that Tim was talking about there there was a a committee task force on ebikes that made recommendations and and those are documented there was also a a committee task force on beach Crossings with regard to Ada um accessibility and that there was a recommendation made there and neither of those recommendations and none of those uh things were ever taken up by the commission so I hope that after the first of the year when the new commission seated that we can we can at least bring them up for a discussion have a vote if if they vote it down they vote it down but I do believe that uh on behalf of the people who served on those committees I do think that they deserve to have their um their opinions at least discussed in a public for thank you Rick all anybody else all right um oh yeah uh staff reports is there any you have no staff reports right no okay uh City attorney um nothing tonight any commission reports we got one ahead I just wanted to say thank you to everybody for the farewell uh party you discussion we were asking for a high level cost benefit like is there any this Randy I guess you're stuck this is a a basically a language change to line us with the crs8 versus the cs9 and there's no additional cost to the city that's correct Randy Stevenson community development director there is no additional cost this is language bringing it into line with the federal language again the the only detriment there's no additional cost the detriment would be to the uh those who get their flood insurance through the feds it would go to a nine it would represent about a 10% increase in their dedicated to manage short-term reyolds St Str registration and enforcement staff representative Jeremy Hutcherson vice mayor recommendation discuss move to discuss can I start go um going back to the very beginning of the uh registration regulations that the city of Coco Beach was able to put on to short-term rentals to try to keep them uh not only regulated but safe for the occupants when they come to stay in those units um we've had this registration process for pretty much half dozen years and I and Wayne I hope you're listening um and I've asked for the metrics okay there's the estimate that there's like 12 to 1400 in Coco Beach and I'm like okay well how many have you registered and you know three years ago it was 100 the last I heard it was like 250 so I understand where Mr hutson's coming from and that we don't either we we don't have the Manpower or we don't have the will to go out and get these folks registered because there is the cost of the city involved with the short-term rentals so what I was hoping to see was over the years that number continued to increase at a decent pace so we could avoid have to hire one full-time equivalent in employee to just do that so you know I i' challenge the the city manager to tell us how we can improve with what we've got or I guess we're going to get you know we're going to go to a vote to add another code enforcement officer can here so I'll say this I it is by far the number one issue for residents it we have to solve it and I I'm similar I was hoping it would play out a little bit I don't think we're gaining that traction um I don't think this is going to be a full-time role for I think if we can Surge and get sort of a benchmark the city's not massively growing establish that database and then it's just a management from there so maybe it's a year I talked to Wayne potentially we do some kind of contract position do you do a stretch assignment for current staff share the load I just think it needs to be a dedicated Focus this is the number one issue for residents in my mind we it's been lingering I agree we got the note from Miss Forbes who graciously asked or she offered her time she's retired so she said listen I'll be glad to scrub the letter you know get the commission to approve whatever notification letter and then coordinate so that's the kind of scope I see is that establishing that database monitoring the the compliance and then reconciling that with the per with the homest set exemption because I think that's the big piece is theone Mone so that's the high level scope I see this role I'm going to leave it up to Wayne like I said it sounded like he had some ideas we potentially could use existing resources but if we do get a dedicated person I don't think it would be a year-over-year so we have to solve it I mean it's a pain I you're you're correct that this is one of the main this and ebikes lately have been really the the main issues which are both regulated by the state but um to your point uh Jill did come up here ton of knowledge and she's passionate about it she knows she's willing to help the city and she came back a couple weeks later and said hey I haven't heard anything so I kind of took that as a right so we got to get off what I think we need to do is and we there's there's multiple people like her that have done the work that have all the the I talked to someone from actually from Canaveral just this past week that that actually is in that world and she said that she's not doing it right now but she's she said I I know all the tricks because I I I manage I help manage a multi-billion dollar uh Airbnb company and she's like I know how I know how everybody skirts the rules plays the tricks do this and that she's like I would be willing to to work with your City for free and just tell you how to you know how to navigate it so I think the one of the things is if we don't have enough uh you know staff to do it we do have people that are willing to volunteer their time but I think maybe rather than doing a full-time position because we do full-time we got to do insurance and we got to do all that stuff maybe maybe we need a maybe a part-time so that we're not we're not paying the extra insurance and stuff cost on top of that but we're also getting uh have them work with the volunteers so they're they kind of as a team and we have someone dedicated to the to the um that's the key somebody dedicated I don't know if it's a fulltime I would be okay with with a part-time dedicated I'm afraid if we do full-time once they get caught up they're or they might get you know pushed onto other stuff so I'd rather do part-time and then have them uh have them work with the people that that have a passion for it because it'll keep that part-time person on track too if they have other thing is it's not unique to Coco Beach we could certainly share resources with Canaveral or satellite or do one for the whole Beach you know we've all got the same problem I mean it's possible even like a like the airbn task force with people that know that know exactly what's going on because there's like I said there's people that are passionate they they they know what they're doing if if they if our employee got together with them on a regular basis and then they like kind of like this commission meeting they brought in all the information she took notes and then she went back or he or whatever the the person we hire goes back and then they do all the work yeah but basically she's getting he's getting fed the information and I think from the city Side getting like a a clear website you can go to in a complaint or someone that's managing that CU that's promly the questions I get is what do we do I got a Rowdy neighbor who do I email do I email maner City Link report a Airbnb or something so that you click that link and then and you say so we know exactly this is Airbnb and then we can watch them because from what I'm hearing now is they're actually going at at night after Code Enforcement is not working they'll change the the occupancy and then in the morning at 7:00 they'll change it back to 8 and at night they'll change it to 12:00 and in the morning so they know the tricks they're sneaky we need people that are that are passionate about it hear the city manager I like the idea and appreciate that it's vice mayor Hutson proposing it because it it really speaks to this is something the city's got to invest in right um and so for a for a a budget Hawk um to be proposing something it it's I appreciate it and I think he's the right person to propose that um I agree with the idea of a task force I think a number of us probably heard from folks that I'm willing to volunteer my time exactly like you're saying I think a formal task force that's empowered by uh City staff but but is Amplified by folks who are eager to be engaged even possibly profing the idea and and need to learn more about this in terms of the potential but this has been a long-standing problem it's affecting the quality of life of our residents this may be something we need to establish a standing board for and have somewhere that our residents can come on a monthly or bimonthly basis and say hey I need to see City results and so we commit to having a standing board or task force that is actively pursuing this until the problem is remedied looks like uh Becky's got a a comment on that okay and and I am very all over this I think it's it's it's a great idea my only concern is giving it a name and calling it a board or a task force and and giving them actual Powers if we had volunteers no volunteers not but it's because the Sunshine Law I mean I love the Sunshine Law it's important but it can get in the way for volunteers that you know AG they need to be able to talk to each other out of the sunshine as and as a result they can't have any powers anybody any group in the city that has powers is subject to the Sunshine Law well I I want them to assist the work I don't want them to necessarily Reach Out to anybody or do the work I just want them to make our worker make it easier on them so they get more done so yeah something like that I think we can we can make it all happen as a as opposed to I mean if we wanted to have a very small board but they'd have to understand that they wouldn't be able to talk with each other I don't want it like that I don't want it formal like that I volunteers that are willing to that are willing to feed us information that's basically all all I want I was thinking too even just with the dedicated employee whether it's part-time or full-time whatever you're going to do catching those violations probably would end up paying for that person too I would think right you know it's not like we're just pulling money just to pay we might actually make money or pay for at least pay for that person as well so so one one example would be somebody that uh in inherited a property I don't know somehow was able to maintain the homestead exemption at let's say it's all the way up to $200,000 homestead exemption property's worth 700 and it's a full-time vacation rental they have they register they lose that homestead exemption and now the the city's getting our portion of their out of rowing taxes which will go directly to 700,000 yeah and that's one of the things that you're saying that they skirting the system on that's the needle mover on the costl and I'm not trying to do this to stick it to I'm really like quality of life but that's the needle mover on the cost is level resetting the homestead or eliminating the homestead exemption so what do you guys think about part-time just I I I don't know about full-time just because like I said there's more there's more cost associated with it and then if and if we do decide in the future to to SL it back down it it it's easier to do part-time than to to get rid of a full-time position is this kind of up to the city manager like how he executes it or we well we're creating a position here so I don't know I that I would like to hear Wayne I know he's Wayne what do you think about all this um put it next I think there's a couple of other ways we might be able to hire on a contracted worker um or a part-timer I would want to do a little bit more research on an actual full-time employee but I I I do think that um we've been a little remiss in our avenues that um citizens can get their ideas and their concerns over to us and it's man manifesting itself and frustration so I definitely want to address that and just put more light on the subject and um and kind of get um a coming to get you kind of mentality and um I agree with commissioner Hutson 100% we had a good conversation this week and um so yeah I'm looking for direction and it's kind of hard to hear from here but I will rewatch the meeting and and take everyone's recommendations and concerns into uh into consideration so great I what I would propose is uh that you draft something up a job announcement for a part-time employee to do this job uh run it through your staff and uh bring it back to us on December 5th I mean we're not going to get anybody hired and in place before the beginning of the year so that would be my motion is to have you bring back to us on December 5th uh a job announcement for a part-time employee contracted employee either way I look for a second second all got a motion and a second uh public comment come on up where's your flag your Rick Anderson 1800 minman Causeway um I am involved with and I have been involved with a number of volunteer organizations and I think that the idea of relying on volunteers to any great extent is a mistake um I agree with commissioner Hutson that somebody needs to be we need one person who is laser focused on this problem maybe a maybe a six Monon or a six-month renewable contract position a consulting position not hiring a full-time employee with benefits and all the other um things that go along with that but I I I I'm am convinced that we we need a single person laser focused on it and any volunteer help or any other kind of help can report to that person yeah exactly thank you any yeah go ahead Tim Tim talty Coco Beach um thank you vice mayor uh for bringing this uh putting this on the agenda um I've talked to a lot of people about this um you can find all of the air Bean bees brv any alphabetical thing and um acronym you want on airdna.co you can find them all um the issue with the homestead um is being taken care of by our um property appraiser um The Bard County property appraiser is doing a great job with that I've talked to various Hotel years about that situation and she's she's all over it because that affects her as well and she's doing that not just for coco beach but for um every property in Bard County so she's all over that that's not my opinion that's not what's going to be the money or or or bring money to us and the money that we get from fees and whatnot can only be used um on resources that we use to find them or to find them or to get a registration fee I don't remember I was on the commission when we put this um initially put it together and I've said this at another previous meeting I think when um Jill was speaking that we need to meet more often as you said um commissioner Williams that yeah we need to this needs to happen on a regular basis because it is one of the if not the biggest it is one of the big biggest uh issues um I don't remember what the registration fee is um initial registration fee but the fine for not registering needs to be substantially more than that so when we find these people we send them a certified letter which costs us money um they get it they have to sign for it and if they don't respond within 30 days they get a fine then they get another fine it goes up and up to a certain point I know there's probably some limits from the state um but we're talking now about well over a thousand um airbnbs that we don't know about because they're they're registered or they're not registered with us but we know they're there so 1,000 times $500 for registration fee pretty sure my math is right that'd be $500,000 I don't think we're going to pay one person to do that matter of fact I don't think one person could do that there's no way one one person's only got gotten 250ish um of those registered or or 250 of the airbnbs to register and I bet a lot of them just did it on their own it takes a lot of effort and time but if we don't have the mechanism to make it um hurt a little bit in their pocket it's not going to happen and that that we need to have a conversation about that as far as um telling our city manager how to hire somebody I don't think that's within our Proby as a as a commission or your pery as a commission to do that um if he wants if he's asking for to add one more he can do it as he wishes to do it um and and that's that I personally think we could have three to five more um Code Enforcement Officers to handle this and knock it out quick and also work with probably cap canatal and Satellite Beach and any other City you know on the coast that um is having the same issues that we are thank you Tim interestingly enough it's 525 to register and 500 to operate without it so it's cheaper to operate without a license than with a license W and uh just to be clear this was this was uh not the city manager's uh proposal this is uh Jeremy Hutchinson's proposal uh any other public comment all right all right um all right so we want to go on you have another comment no I'm just at a second with him okay so one of the things and I think Tim brought up an interesting thought um us qualifying a contract for one person or something if we can only collect what the fees are and you set up a contract for with an organization that hey however many people you want to hire fine right but that our costs on say like a Cost Plus hey whatever it costs you to go find these people you get reimbursed for that with an award fee associated with everyone you find bount structure bounty we not doing Bounty H design your contract to to affect the results you want if you structure a contract where we make no money off of it it simply provides for the cost that it takes to do it you structure the contract a company will scale and accomplish the thing to make the money sooner rather than later and so what through creative contract structures while the city would make no money you could get resolution very quickly so just thinking creatively about it I think we have some options that we don't want to limit the city to and kind of see where Wayne can get creative my motion was for the city manager to come back to us with a job description for the person on December 5th so the ball is in his court whether it be you know I'm I'm saying parttime just so that we don't end up with the long-term FTE with full benefits and all the costs that are associated with that if it's and if it could always be con converted to a full-time position in the future if that's what it takes to keep these people compliant yeah we don't have to start out with full-time employee and correct me if I'm wrong a part-time is up to 30 hours a week 32 32 hours a week so that's is a benchmark yeah iess it can be it can be up to four uh 39 what I'm suggesting is I don't I don't I think to Tim to malti's point one person's not going to cover that ground you're going to get somebody that you're either being bringing on part-time or full-time you're not going to get get the effect but without even hiring a person if we if we let the city manager have the the width and I I agree with you bring something back on the fifth but let's not let's not limit it to hiring a person part-time or full-time say come with a creative proposal on the 5th to address this and it could include some type of contract structure well obvious it's obvious to me that we haven't been focusing on getting these people registered for the past three or four years because the number of registered uh vacation rentals barely moved and we are and most people know that there's over a thousand of them in existence so the challenge is go find them get them registered and bring back a with my my uh motion was bring back a job description for the near term to get started on that if 6 months from now the needle still hadn't moved and they come back and say wellit we need four or five people to do this then we'll deal with it then I don't think that's what it's going to take well I'm saying is I don't think one person I think we know now one person's not going to solve it we don't need to we have one we didn't have one person how many codes do we have in the city of Coco Beach to to enforce think besides vacation rentals a thousand I think look at Randy he's laughing there might be more than that okay the code enforcement officer doesn't just do airbnbs this person be it however much of a part-time employee 32 hours a week or whatever is as uh Rick was saying if we layer focus on doing this job that number of registered people should go up or that person doesn't continue as a part-time employee if they're not doing their job I think it's also fair to remember um there is people like Jill and others that are laser focused and more than willing to to help assist uh this employee that we would hire so it's not like you just got one person you've got multiple people at least that person could be fed the information and then they they can start sending out the the uh all the stuff that's need to be done to enforce this stuff so I I think we can I think we can see how it works and we'll we give Wayne the the leeway to figure out how he wants to do it but I think that's the key is giving him a wide birth I think hiring one person we're limiting ourselves and we're saying you know what let's start small and we'll grow I I think the residents are past that I don't think start small and we'll adjust stuff I think we need to go significantly towards solving the problem and move aggressively I think that's what the residents are looking for but who's going to take a job let's say you hire three people or four people that you knock it out in 9 12 months and then you're out of a job that's why I'm saying don't don't look at hiring a person set a contract and have them decide how they want to approach but if you do it as hey whatever it costs you that's what day job to take a job that they're anticipating is only going to last less than a year so we're not the only location with the problem they demonstrate it here a job cross I think what the I think really what will happen if you really think about it there are people that are super passionate about this subject and they are residents and they know what they're doing they know how to use a computer they will work this job just for the sheer passion of it and there's other people that are willing to help for free because they're so passionate about it it's I don't think you're going to have to find somebody that's that needs to be incentivized to do it because we have residents now that are so incentivized to do it because they're are sick and tired of it so I I think like like you uh propose I think we put somebody in there that's a a high hour hour Min um a highh hour um um part-time job person with the laser focused a couple people that are really dedicated that's basically three people in one and and we do it that way I mean and you know we'll let Wayne kind of figure out how how he wants to work that but I think I think I I see what I know where you're getting it I like it I just we have not had one dedicated person to do this and to his point I think if you really have a person that's laser focused on it with people helping I think we can get a lot done a lot more than somebody that's doing a first reading an ordinance of the city of kooka Beach Florida adopting a new chapter 13.1 misleading advertising to the code of ordinances of the city of Koka Beach prohibiting misleading advertising with a rational Nexus to the city of coko Beach and providing for conflicts codification separability and an effective date ordinance 1694 is intended to protect the city of Koka Beach and its residents business owners and visitors to ensure that potential visitors are not lowed to the city of Koka Beach through misleading false fraudulent or deceptive advertisement and are there and are thereby made subject to unexpected and un unpleasant enforcement actions that would not occur but for misleading false fraudulent or deceptive advertisement staff representative Lauren wiy principal planner Randy Stevenson development services director recommendation adopt and I will tell you that I drafted this um uh because this has been exceedingly um effective in Anam Maria with regard to the uh regulation of vacation rentals and this it's been switched around we've had a lot of changes in Ana Maria on it and this is the final product and hopefully it'll really help I moved to approv ordinance 1694 on the the first reading second motion and a second any public comment on this any com so on that is this a a tool potential that can be used it's definitely a tool to enforce vacational meaning if they're adverti in 15 beds and it on that surface they can and it and it truly has teeth yeah if if you read it I mean we worked really hard on it over there and um this is the the final result and hopefully this will help good I was assuming it was the beach day the thing we dealt with this Summer that prompted this that oh advertisement everyone showed up at the that thank you that would apply yeah but no this is um um this is a tool that's used for vacation rentals all right uh yeah well I just want to say thank you for for being Innovative and and looking for ways to I'm to solve thank you for being duplicative yes well if I if I see something that works someplace else I'm going to bring it the highest form could you give a just from a in a lay terms what what does this enable the city to do from a resid from a okay from a very practical standpoint people get caught um you know advertising 12 residents and you're only allowed to have eight and they get because under the code enforcement you've got to give them a notice of it um so they get the notice they switch it down to eight oh I'm really sorry that was just a mistake and then two days later it goes back up to 12 and then you got to do it all over again unless you have something like this and there's a presumption under this ordinance that if you've been caught once before um the fines can start immediately you know when you do it again so it just it it prevents people from as you said you know going up and down up and down all the games and this is has been very effective I mean to me this is a tool that whatever dedicated resource we assign to this absolutely this is the first scrub I mean that's an easy let's bring it back to Second reading on December 5th please yeah yeah okay after airbnbs not only did we uh vote to add an extra dedicated Airbnb person but we also add an extra tool in our toolbx to to go after them and find them so uh this is this is a a great day for Coco
