few blocks that we could have walked if we needed to um welcome Mr flowers um we have a little bit of a hicup this morning um Don Holmes who was supposed to be with us um it was a holiday week and so he's he's a day behind unfortunately so he's thinking that today is Tuesday and not and not Wednesday that happens to the best of us happen to me um with that said he has asked if we can give him probably about a 30 minute um opportunity and he will zoom in with us otherwise it would be about an hour and a half and he'd have to dve it froma down so Commissioners um we can recess this meeting for about 30 minutes if if so if everyone so pleases um it's your um that's fine with me does it suit Mr flowers how is that going to work with your schedule Mr flowers well we uh I can make that happen we uh we have about 4 Ines of ice and snow but I'm in get contact with officers out the road we got everything everybody's beh at the moment we have no makeing issue so I'm good and uh we would just zoom you back in um so in about 30 30 minutes we give you a head a heads up can we use the same link now do you know okay so we'll send you one we have to send Don one as well so that Don can um zoom in they have um my understanding is um Mr flowers and Mr holes have have been talking um we won't have the actual contract in front of us but we do have a former contract in front of us that we can talk about and um and it's just really the terms of what we're trying to agree to today so if everyone is in agreement with that everyone in agreement commission just before we break since we're going to be later than we thought um I had a couple of issues that I was hoping we could um discuss before we left today and one of those would be um a letter of thanks to Pastor SCH and anybody El I was planning to do that okay could on behalf of the commission yeah um and as well you know should we consider um reimbursing and I have than in multiple times attention I was just going to make a motion so we could all again you know say that and also should we consider um reimbursing the church for the cost of the gasoline um just I'll ask yeah I'll ask right and then um also I don't know um do we have would this be a good time at the end of this meeting to talk about some dates for the Blue Ribbon commission um presentation to us because did we say we'd have a special meeting for that that's really commissioner boy's issue but I just wondered if this would be opportunity well we've got several things that we need to put on the schedule um so I think at the end we probably might bring Michael in at the end of the meeting and so we can talk about some days because I know we have a golf cart we put on hold we put several things on hold but like the um our parts we put that on hold we have to have discussion on that and you feel the Blue Ribbon is going to need a special meeting in outside regular commission meeting yes we can about we're also School Board SCH a special meeting as well so we need to have it okay so just um I know that's primary work of the day but why are they why can I ask why they're scheduling a special meeting since we haven't it hasn't been brought to us for any decision making or Direction They just they asked for date SCH board and so they're going to come here first set okay sure with that um if everybody's good with that then we can um Rec do you want to make a motion about the letter that's fine oh okay want to do that now um I moved that um a letter be sent on behalf of the entire city commission um to Pastor SCH at First Baptist Church Crescent City thanking him for uh everything he did to provide the tour for the city second please okay with that I'm gonna recess this meeting until let's say 9:15 that work there is um special commission meeting and we now have the as our City attorney Don HS Don thank you for joining us on this cold on this cold day thank you for thank you for uh tolerating my attempt to get on Zoom and my Ming anyway I'm here that's okay that's okay turn everybody off that we've had a holiday this um this week okay so with that today we are here um as we all know that we're trying to get through this city manager employment agreement with Mr flowers um I believe Mr holes you have been in discussion with Mr flowers do you want to just kind of brief us where we are um sure I mean I can um Mr flowers had uh basically sent an email to me can you hear me hear me now so he had sent an email to me indicated his uh request as to terms that would be included in the contract we've had a conversation of after after I received the request um from the perspective of my asking about the basically whether there was any room for negotiation any any of the terms I did not feel it was my place to try toess a negotiation I think it's commission for the commission to decide where they go but I wanted to make sure that when we started the negotiations with the commission that uh we were kind of at a spot where Mr flow spil he was kind of towards the the bottom of of what he would accept so without further um preface and M flow let jump in any time if I say something that that you think is not accurate of course but let me tell you what his basic terms are um he would like a base salary of 110 110,000 he would like family insurance coverage to be provided um so family uh I think speaks for as comp as compared to individual you would like either the use of a city vehicle or $750 per month in car allowance and a one time $4,000 I'm going F he would like a bank of vacation days when he walks in the door of 20 days with an agral of 20 more days per year he proposing a three-year contract with the opportunity for renewal at the end of the term um and he would like a stipulation in that contract that he could not be terminated within 90 days of CR City governing body election uh to as he States ensure stability and continuity and leadership in the event of termination without call he would like five months sance pay and um he would like a support to attend the porter City County Manager Association conference annually along with a ban at the international City County Management Association of the American Association of Municipal executive executive conference even if that's out of state so that would mean membership in those organizations and then funding is for and travel expenses um to both and does that actually state where we left off flers uh that's correct [Music] um okay commission um let's talk about it we have got um Shea it was advertised at what was the range it was up to 110 110 94 to 110 94 to 110 and um when we did our study for managers pay city managers pay um I think it came in where sheeld anywhere from 94 to 132 is that correct correct okay um so so that's where we are so we're within we're definitely within within that range was this experience exper seems to could I also add one thing that I forgot U because U us some conversation but there would be a probationary period and that term would be six months during which time there could be a termination without being required to pay the five months s mayor if I could yes okay and this is partly for Mr Holmes um it's my understanding from our Charter that we are not permitted to give a contract for a CH you broke up at the very end Mr you said you're not permitted to give a contract for a okay in our Charter it's my understanding that we are not allowed to give a contract for a specific term do you have that language well had it P because we had contracts in the past yeah and they weren't Mr Red's contract is not for a term right it's a section 3.02 um I was hoping Mr Holmes would have reviewed the request for compliance with the contract but 3.02 pointment and removal of a city manager hired by a majority voted full commission for an indefinite term subject to termination at any time upon a three fist vote of the full commission with at least 60 days notice or 60 days s pay so that's what's in our Charter um so that would basically eliminate the six month I mean the 5 month pay that that is a maximum allow by FL statute and we reduce that down to 60 days that's the net effect of that because obviously you could not stop the city manager from giving you notice of resignation uh which he could choose to do at 3 years two years one year or whatever so um you know about the although I question the viability or the continued viability of that sort of a clause in your in your Charter nonetheless if it's there it's there but U the threeyear contract actually gives you some certainty although I understand that the five month SE paper the term of that contract would be three months more than what your Charter provides for well um mayor if I could to continue with Mr HS yes um Don I don't know if you have in front of you our Charter section 3.02 it seems to say at least 60 days notice so isn't that saying that that's our minimum that aren't we allowed if that's our minimum at least 60 days notice or 60 days sance pay would that preclude us from providing more I mean I can't imagine anybody leaving but the the other thing is are we allowed to guarantee that we would not um terminate anyone within so many days of an election I don't it sounds like our Charter doesn't allow us to block out that time I don't think it I don't see where it speaks to that I don't know Don that would be your interpretation I don't know that it speaks to well it says indefinite time well but this is a 90day so couldn't do anything for a 90day period so I'm going to reduce my uh screen I'm going to try and uh I sure it but I'm leave the process but I'm going reduce my screen and pull up your Charter for a minute so I can look at it as we talk with me while I to do this okay sure but um okay may also the items I see if we look at the contract with Mr red um I think the car allowance amount requested is isn't that $500 a month greater than um what was provided for it is Mr red okay because I'm trying to figure out some I think we need some dollar amounts on some of the items requested uh the moving stipend I don't think we did that for Mr that would be something that we would that we have but just because did it didn't do it for one he didn't request it no I said I'm trying to come up with amounts that are understand I understand in addition I'm trying to put some dollar amounts on here Don um I also um with that said and with our Charter we have been in violation of our Charter as far back as Patrick Kennedy so Patrick Kennedy's contract allowed him for 20 weeks um I believe that's the Z is Mr es did as well and so did Charles so we have been in violation so being in violation of the charter that far back at any point um do practice can you well um remember our Charter was created back many many many years ago [Music] right City commission am of the Department [Music] ciss responsib of the department and re proced for departments I think it'd be a stretch to say that that that that alters the uh the city manager 3.02 let me go back that I'm not so much worried about that I'm worried about the amount of pay that we have to yes commissioner right so how was it that we were in violation of our Charter I mean I understand Patrick Kennedy had a contract for a specific term it would be no no Patrick Kennedy was assured 20 20 hours of I mean week to pay okay but I don't think that's in our Charter our Charter sets a minimum Maxim minimum it says at least 60 days or 60 days it says at least that's a floor okay 60 days sance pay right that's a floor but it didn't give us a minimum I mean a maximum I don't see one unless EST the 20 weeks but what what I was trying to do with some of these items have a cost so um like when I said what cars did we give um Charles red I'm just trying to figure out how this is a where this cost would be higher what that cost would be um it's the salary would be higher we have to that you take that in so if you take that if you take the that's an additional $6,000 that's an additional $6,000 a month in car allowance if we were to come up to the 750 mean a year I mean yes and then um the family health insurance I know that's we were at about $1,100 a month for for the in for the employee only and if we add family Sheila probably uh dep on which plan he picks it can be anywhere from uh 2,900 up to three $3,000 a month a week I mean yes not week month sorry month a month for the for the wife and and child yes depends on which point he P so we could okay so wait let me just be clear for the individual from Mr red it was 1100 approximately right and so director is saying that could go up if we did the family coverage I know bar here here um Mr R was just for the empy no Mr R the city contrib to Mr R and Mr R 100% of his wife out of his pocket right and that that's our standard practice correct correct we we make the family available but they pay correct okay we already have in there the support to attend the conferences got that is it in conference or should I [Applause] and we P for such attendance believe the costar programs and cost of stay over n any Evar should continue one day so do we have a budget for that and that's in section s Mar down but I don't know that we could there's line item in the budget yeah there is a line item for that in the budget but travel is very expensive I don't I don't remember Charles red going to the international I mean the city read the budget and pay for so make for next should be work what we have but ours ours does not cover out of state travel ours covers basically one conference and that's that's pretty much it if you claim all your expenses but he's the city manager so that's that's a little different that's a little different so I'm I'm I'm fine with that I'm absolutely fine with that um and and so the 20 hours vacation time is that that's for 3 weeks yeah I don't know I mean if we were to bank it annually um if we were just to do we do by hours those yes we do so I I don't I'm not sure that if we were to bank him 20 hours initial I mean 20 days initially um and then he wants to approve could we not just do it annually just thank him um well I think mayor that's kind of splitting the method um I think currently we don't give an upfront vacation right so for managers I think it's more standard to give some upfront medication I think we should so I think this would be a compromise between giving all the vacation upfront um versus having vacation ACR and so you're good with so everyone is good with giving him 20 days initially and then allowing him to approve um it's wait a minute 20 days is four weeks what was the vacation that we currently pardon three weeks it's four business weeks okay so what is the vacation right now in the existing no no but what what wastal Sheila um Charles I think he was like I think it was 3.9 per week so yeah he got three hours per week of annual leave not to exceed 480 hours for annual leave and one and 1/ half hour per week for sickly not to exceed 480 hours cor annual leave will only be used in two week intervals um two weeks at a time unless more time is approved by the city commission any hours accumulated there 480 for annual leave and 480 for sick leave will not be honored and such excess hours will last at the end of each budget fisal year in addition the city manager shall receive all of their holiday and Le benefits provided to City staff 156 hours almost Mons so that's okay so the standard right now that we give is four weeks he would be banking four weeks and then acre I can't read my own writing what would acre in another four weeks so that would be two months of vacation yeah and right now we provide for um a lot a lot so Mr flowers um as part of this negotiation um would you be open to us thanking you the 20 I'm just suggesting this I want to see what he's open to because we can talk about this all we want but we have to find out what it's open to um are you open to us thanking you the 20 hours and um 20 20 days sorry I just keep my hours and days right now um the 20 days and and at the start of the fiscal year in fiscal year then you could start approving um um how are you how are you with how are you with that so that would give you the four weeks first off when you start um and then at the end of the fiscal year which would be October um beginning of the new year you could um begin approving um as required so kind of cut out under hand so you're saying start off for 20 days and then come October start acquiring at the rate of 20 days a year that what you're saying yes I'm just suggesting that's just a suggestion so that we can start these discussions yeah um all right it makes sense makes sense to it I'm just asking I'm just asking commission has to agree to that that being part of the terms okay so mayor I'm not quite clear so are we going to provide a bank every no that would be an initial Bank initial bank and in October start start Okay Okay so we've got that so we can check that off um we've got the $4,000 moving allowance um how does everyone feel about the $4,000 moving Ming allowance and most employment agreements it covers that do you you know other costs too so that seems appropriate commission is everybody pretty much okay so we'll do the 4,000 um that's the moving allowance then that takes us to let's get the salary out of the way 110,000 um so um how does everyone feel right now currently um it's it's definitely within the range and we did ask all of our applicants um if they would be bring to the salary within the range so it is was advertised um I think we also have to keep in mind Commissioners um and it's difficult because everything we do courses in the sunshine so we need our discussions but you get one and um and and we know where we are right now um so I'm I'm just throwing that out there to each and every one of us that we have to think about that that um um you know the good thing about him um Mr flowers is that not Advocate either way but that he is a city manager currently so he understands he has the experience necessary um and said that's just as part of the discussion you need to keep that to keep that in mind you know what are we looking for here well I be Mr flowers um you know choice wise I mean has the experience and my Mr flowers of course to go for $110,000 because basically he's at that level you know quite frankly that's just my opinion so and what was and Charles at the end of his three years he was almost Mr do have more experience he's coming to us as a city manager currently so I I'm fine with that with inflation and the experience I think that BR right we all my my one comment about that is I think that Mr flowers is great choice um we're all impressed by his experience as I am but the other part of that is I think we need to be really cognizant when we add up the other costs that we know how much we're adding to our annual budget cost well at this point um what I would rather we had in front of us but we don't so we still need to consider this is with the roll back budget we could not afford this we've been told that there's um there was an excess left over from last year but we don't know where it came from or why I checked with st because even if there's an excess and we have that we have that amount I did go over with Steve so as we go forward with the fund balance that's not reoccurring so I asked him um with some of this where would we be because we knew kind of the range of the salary um and I just wanted to make sure steeve was um in agreement that we would be um the finan we would be okay we would be okay with this is Steve here oh there he is Steve do you want to um where we are I'm sorry I didn't know I didn't see you com in chair um do you want to speak to that Steve as far as where we are from from the salary and and the benefits yeah we're still working on 're closing out the the year end um and I but we believe I believe like ,000 somewhere in there I believe it was so um it looks like we're going to you know be okay with that okay but wait minute what was the part about mayor you said the money was nonrecurring or we expect to have that those funds available in future years those are not that's not curring but every year we' had a significant amount that has um that we've been able to fund balance yes over um and above so that's why really and truly this last year we were able to do the roll back rate um because of because of that because we have been able to meet our our needs um but this we never can Bank on that so so we don't know next year what what it will be um so right so I'm just saying with the roll back rate we were very tight for funds in every Department we cut and if we're going to be increasing our salaries which is an ongoing expense we need to make sure that we can cover that and so Steve do you feel that we are able to cover this right now with the roll back rate I'm sorry the roll forward is yes I do because okay because did Steve have the additional cost that would be added to the city manager salary if we met all of Mr flowers request because it looks like and y'all correct me if I'm wrong the salary the increase to the city manager salary line would be $10,000 a year Charles was at 100,000 that right so that being an additional 10,000 um the car the full car allowance requested mayor you said that would be additional 6,000 approximately 2,000 a month for family health insurance so that would be annually 18,000 a year in addition to any increases um in travel or conference okay so that's a total of 18,000 a year and that will affect um Social Security and Medicare contributions correct cor so on the car loans we have not agreed to the car loans so that's still invation we're still discussing that but um I just want to lay out kind of the parameters of the dollars that are involved um so and um just so I'm I am fine with the salary as long as we feel that that can be provided for our budget as long as we can pay it and see he feel he feel confident yeah with the current R forward as been discussing okay um so that leaves us with a car allowance with a car allowance um or a vehicle so it's either or um we currently don't have a vehicle um and so that's that's not an option I don't know I mean 750 $5 more I mean that's actually triple it's triple triple I thought it was $6,000 $6,000 additional additional that would annual if you annualize the additional 500 the mayor figured out that comes to 6,000 a year more more more yes okay so Mr flowers how negotiable is that I mean we have two square miles um how how negotiable is is is the car allowance yeah so I to say that the things that I'm asking for are quickly becoming the industry standard um that's the first thing the second thing is U I'm pretty firm on that um I need that just for the simple fact that um not y's fault obviously but I've always been every police officer I had a sign vehicle City administrator now I have a sign V City provides me a vle um and I do a lot you know I do you two s miles but I'm go but uh running around doing things I use the city truck now but use my vehicle to you know pick up stuff supplies whatever those things to to help so not asking and Beyond these days and I understand those trips I mean anywhere but the trips black I mean they do add up there a lot and the mileage I mean it does add up and we provided the car 20 years ago to our administrator just car the next one came on so yeah we start p i that was yeah so me it hasn't got up in a long time has most the IC contract say that should have a yearly Incas anyway I mean so um yes sir said Mr Don wanted a th a month but I did come off that 250 in our conversation yes was yesterday yesterday uh so I didn't negotiate that down a little bit the car allance um I wouldn't I wouldn't expect have to go out of state for any kind of training or anything this year so I know your budget's already been set I get that so I wouldn't I mean I wouldn't start at next year um as far as any out State travel for any kind of train or anything like that sure to get what I need there um in Florida to begin with uh but U that's or if I did i' do a long expense um but this first year just to help out and um so understand I mean the salar that you offer is fair with the benefits that I'd be giv up I'd actually be Mak it less money my current job you know so I just can't do that and U and also just just the fact that U again I'm not asking for I think this extreme uh that's the normal standard candidates other you know other guys interview there were some nice guys had some good experience but I'm not looking to build my rese I'm looking to come make a difference there committed four years at least probably longer but at least four years but J's out of high school um so just let you know that um we we going do some good things you know and that's what I'm ask I'm I'm gonna ask you another thing Mr flowers um um I know that typically when you're looking for when you're looking for other employment um are are we competing right now in competition with anybody else what was the first part you kind cut out well I know typically when you're looking I know you're looking to move to Florida so I'm sure that you have probably applied elsewhere are we competing with anybody else right now I'll tell you interview three cities in the city of Florida since December something I it was the city of clock was the first and they s you were the second and selected me thank you'all very much and then I did interview right after that before we started negotiations uh with the city of Madison and they actually voted 5 as well to offer me a contract which they're not meting until Friday I let them know about you and I told that I've been up fronted that you are my first choice location um especially for my wife's work and and I I think they're probably watching Well's a nice place that I think she'd be happier in very familiar withis I know exactly how long it takes to get from there to Orlando just madon Madison probably right now actually it is so um that if we one was County Georgia to H again for the second time in two years and I let them and I talk to them but I let them know P me off because u i was after after I after we had our our meetings with you uh feel confident this is where I want to be okay thank you I just want to say one thing about the gas thing um because that's kind of where what should be discussing but but you know I've gone to two meetings in Orlando and I've actually uh asked for that money to be reimbursed for my gas and we reimbursed I think 65 cents per mile if I'm not mistaken I I think that's what we reimburse us and and just I'm just trying to put it in perspective for people that's about a 100 miles okay uh to go to and from Orlando and so it's about you know $65 every time I go and I'm just putting it into you know just easy numbers it adds up very quickly gas adds up extremely quickly quickly so I'm looking at my budget my training budget and I've already eaten into it you know you know for the gas and so um that's what we have to kind of look at it's just expensive to drive around I know the mayor isn't up um you know back and forth back and forth it does just adds up so go ahead just to be clear so is the 750 a month in Li of any reimbursement that's that's a overall figure and it's in Lo of any specific mileage reimbursement that should be except for mileage in except for it has yeah except go to the professional development okay so for regular business okay so we would not be so excellent point commissioner Burton so that's in L of travel reimbursement and let me um let me ask you this um Don both you and Mr flower so if at such time we were to come into a vehicle for the city manager um is that something that we could put in there unless such time you know the city provided um a vehicle a city man sure yes you could I mean the contract could be drafted any alternativ so the St that you provide either a vehicle or a car allow a given amount you the I do need to go back and address the Char for a second well okay go ahead okay so I agree that your Charter states that the contract is supposed to be or the employment is for an indefinite term um and your contract Mr R was for an indefinite term um that's a two-way street in that Mr R's contract appears to as your Charter and that Prov [Music] for terminated without C at any time he was receive a l cash payment 20 weeks a full five months3 a month but 20 weeks which as was pointed out is an excess of the compensation provision provided for the charter which states that either has to receive at least 60 days notice so we can receive 60 days notice and no termination pay or 90 days notice or whatever because it at least 60 days notice or the alternative 60 days so that is a clause that basically as IPR would allow termination with notice without additional comp compensation after the notice period expired um I am not able to advise anyone to incorporate or read a term that violates a charter I I agree that provision in my opinion is it's not a let's just say I don't believe it's uh a wise provision to have included in the chter but it's here and um from my perspective I I I'm just not able to advise that you violate your Charter even though I been done in the past um in terms of Remedy um you know a provision for compensation that uh violates the charter basically could be raised as a challenge uh and it could be raised in my opinion at a point in time when that scenario might arise so there might not be a challenge at this point but there should be a time in the future when a um when a termination without CA occurred and you propos to pay 20 weeks salary then there could be a challenge at that point based on the fact that term the charter now um I do think that you can interpret this so as to allow for the 60-day Seance pay um by stating that you could terminate without cuse with no notice well immediately termination immediate termination but with payment of 60 days sance pay and not viol your Charter unfortunately if you probably know your Charter like most is not easily amended you have you could propose an amendment by by ordinance um but um you would have to submit prop to vote of the electors at the next general election or a special election for that purpose um so you know it's not an easy process to your ordinance but I think that thata is one that you could find letter in the future if not now the other side of it is that since there is no contract um should you terminate at any in the future three and a half years whatever then the SE pay would be appliable since this is supp definite term unless you turn for calls so uh it's not a welcome Wrinkle in my opinion the 60 days instead of so you're talking about roughly eight weeks instead of 20 weeks in terms of termination that's I just put I'll leave my comments at that for you to to into your conversations however you might but that's an issue that I think needed to be addressed well 60 days I mean I I guess it's so you so you read it by the way I read it that that was our that was the the max that we could that we could pay correct correct okay so if we took 60 in 60 days so we would be paying them for 60 work days so that would be 12 weeks is that correct 12 weeks days or 60 calar 60 divided five but you're really paying him for it doesn't say calendar days I mean it doesn't say work say 60 days you have to give it it's plain meaning and that mean 60 days I don't believe you can interpret that to be 60 work days I think that 60 days so that would be eight weeks okay so eight weeks as opposed to 20 weeks so that's 12 weeks is there any remedy is there any remedy in that um in order to get us to that to that 20 week to that 20 we Mark that outside of outside of a yeah outside of a charter Amendment um that not it's not a little practical way but I mean so I assume if you were to terminate without cause it would be for and there's another CL that need to mention but I'll I'll say that hopefully remind myself of it in a minute but if you assume that you were going to terminate without CA it's theoretically possible that you can extend the notice period uh to eight to to 120 days which would be I guess that would be your 16 weeks right 120 roughly um and pay him for the entire time at had determination effective at the expiration of the notice period follow me it says it says at least 60 days notice so it doesn't say what the maximum would be theoretically it could get 20 week notice period with every receiving page during that period um the only thing that that of course I guess complicates is if things have reached the point where you're not happy with him or he's noty with you but he doesn't resign and then you're putting up with each other for an additional period of time whether you it doesn't say you couldn't suspend it either during that time it doesn't say that so we theoretically you could you could get them and I'm just I'm talking out loud and unfortunately because of the sunshine you have to talk you have to think out loud in the public but theoretically I guess you could Prov for a 20we notice period retaining the option of suspending him from performing his duty during that time but receiving pay during that time do you follow what I'm saying right so we would put him on right we put him on suspension with pay exactly I mean and I don't see that violat the charter although I will admit that's an imaginative interpretation of it but I don't believe it violates and in the past it appears that you violated it with at least your last city manager one before that as well we've been violating it since Patrick Kennedy came one at least and I don't have the one prior to that so thank you for clearing that up so where are we now can I can I ask one question it's possible Don just kind help that if so if you pay $110,000 a year equivalent 20 weeks be 42,000 is it prevented from just giv her flat Fe 42,000 pay you whatever 20 weeks about $42,000 so said say you [Music] know right the charter doesn't speak to if we were to do a flat Fe just that speaks to the weeks correct so would that allow says 60 days Seance pay okay and I think if you're paying more than 60 days annualized salary 110 then you're violating that provision of the charter in a pay package again I didn't write this term I'm not a fan of it but it says with at least at least that's where I got the Wile room that I expressed earlier 60 days notice and it doesn't say that that notice is without pay or either notice or 60-day service pay and I don't think you can you can interchange an amount for that 60 days that isn't commiss with the salary reduced to days well realistically if realistically if we were to put him on um if we were to um cancel his contract with us to relieve him of his duty I mean that's because obviously we want we want him out we want gone or the commission wants him gone so not that that would happen not that that would ever happen I mean hadn't happened they didn't leave so far um so with that said I mean I I I like I do like that language that you said that we would put in one um suspended suspended leave with pay for 120 days um right the theory would be that if you're giving him notice then you may not want him to act the capacity of city manager for obvious reasons I me for the same reason that corporations if they terminate someone they escort them to the gate right then and take away their access to computers and things now I'm not making any comment about Mr flow that don't interpret it that way I just say if you're talking about industry standards and practices then normally if someone's terminated without cause certainly with cause but without cause then you know there's there's not a desire to normally have them continue to function in the capacity where they theoretically might not make decisions the best interest of the body that terminated them so but I don't see anything in here that would that would prohibit as I said a notice period mandatory go your contract notice period of more than 60 days and it doesn't state in the charter that that 60-day notice period is without pay so I don't see anything in here that would directly conflict with you're saying okay you're going to um you know we're going to uh give you notice of termination of 20 weeks during that time you'll receive full p uh and but you'll be your your your authorization perform the dut of city manager will be suspended you can even also build in a Clos state that he free to seek outside employment during that time I mean I think all of those things would be obviously you can argue that that is not in the spirit of what's in the charter but it doesn't directly violate and uh and and so that's that's what I'm no so let me ask you this also could we somehow or another with vacation Le um we was to receive vacation you probably know appr that he had approved that he had approved vac and the city would pay the city manager Cod payments for up to 20 weeks termination until the city manager re employ and he Church benefits employ and under R 50% v% and I don't think there's anything that in the that you doing that um now um I don't believe there is I don't there's not there probably there probably isn't so I'm just wondering if somehow or another we can build that into that just to make [Music] it um I don't know if there's any kind of it's not a retirement benefit so you federal statute would not apply uh so I mean but but the problem is you know vacation time is you say approve the week that you said that's what this contract has yeah he's going to get the initial 20 he he gets first six months for probation at the end of six months he's ining roughly 12 hours a month um a little bit more say 13 hours a month then six months he through what 78 hours of vacation time and under this first be ter without um any the without benefit so after he clear this probation per you would already accumulated about 78 hours roughly vacation time so what half that's about 35 39 hours I radius but you have that bu in there uh but that's not that's not of Mone talking about making the difference up between between 8 60 days and and 20 weeks so mean maybe you can come up with a different option than what I suggested but but I just I would not be able to advise you to direct the oh no absolutely absolutely not um we understand that so Mr flower up here one question it's a question from Mr so when we look at our provision that we've been talking about with the 60 days notice it's the simple question is it says at least 60 days notice so you're saying you don't think the at least applies to the 60 days Seance pay that the phrase it doesn't say that it says with at least 60 days noce or 60 pay doesn't say with atast or atast pay so I mean I mean again okay because I read it with the at least applying to both the 60 days notice or the 60 days s in there though I like choosing your vegetables on your side you either get salad or soup no I'm talking I'm talking about grammar um so I mean my my thought was there that there's no reason the at least would not apply to either of those things but you're saying you and mayor read the 60-day sance pay as a cap and that the at least does not apply to the 60 days seay well you know that sex construction is something that contract construction is something that I guess I've dealt with for a long time now and normally you know the rule of fund is you give you look at it and give it plain easy and you assume that if the author had intended a different meaning they would they knew how to make to make that different meaning know when I look at what I'm seeing here I say with at least 60 days notice and then doesn't say for at least 60 days it say with at least 60 days notice or 60 days service P the difference there being that theoretically this you get 60 days notice but you're still getting the benefit of the efforts of the city manager during that notice period because doesn't say that they're suspended with a 60-day service pay you're not you're not getting any any return benefit of service yes so I mean that's my interpretation if you said hey we're going to adopt a different interpretation I'm not going to tell you you can't uh adop the different interpretation of that um and only a court could really say which is the you know which is the preferred um interpretation I I that's the way I read it but again if you want the five of you wanted to look at it say well we we think they intended to do it differently then uh I'm not going to argue with your interpretation I just want to make note for public and for the record I'm looking at commission Mo's phone I'm reading the charter she has it pulled up on her phone that is what I'm reading yeah so um yeah I don't know mean look the fact that um that you look at docents all the time that AR as AR you might and you say man I think that they I think they intended to make that period comminate um but I you know if you look at that next s it also say that the city manager shall have no vested rights of office other than those specific with providing this Charter um so I mean I'm looking at it saying okay say at least 60 days notice I get that much they could have said you know or equivalent period of Serv pay or something but it says 460 days I interpret it one way but if you told me you interpreted that that to be a life period I I can't tell you that that uh that I would say that your interpretation isn't one that could be accepted by a court and if that's the case then I can't tell you that that categorically you'd be violating your Charter okay so Mr flowers um I'm G to go back to my question we have a little hiccup here um and so with the recommendation that Mr Holmes has made that we would put you on um we would include in here that if you are relieved without cause that it would we would put you on aund and what did we say 120 days notice that's month mon days you know that's a long time to work with somebody if you don't put on administrative leave so he he's gone we're going to pay him during that time for 120 weeks 12 days 12's make sure we get the language that's what I'm trying to do to make sure that he's Mr flowers understands where what Don is what what Don has um suggested Madam mayor want to take a vote before and this is a suggestion thought you might you want to take a your commission as to their interpretation of the 60-day Seance pay clause in contract in other words U might you want to take the vote as to whether they interpret the 60 days to be modified by the same verbiage quote at least that appears in front of the 60 days notice provision we can do that do we want to read that somebody want to read that appointment administrative supervisor based on the charter I can't hear you I'm sorry based on the charter so we need to also include that probably have a reading for that language so that I mean right now my question is right now you know I've told you that I've given you an interpretation I've also told you that I can't I could not guarantee you that the court would accept my interpretation if you had if you're if you had Comm interpret that differently and believe the intent was to allow for more than 60 days Seance pay then then you would not be directly violating your Charter you'd be making an interpretation in good faith my question is would you want to take a vote of your commission as to whether you interpret that provision to allow more than 60 days service P since it allows more than 60 days noce if you do then you just go ahead and do what you've done in the past which is Grant the additional time of service was done with the the contract and I guess you said p k okay so yes commissioner to be there no I'm just saying that's how I interpreted as both of them being a floor not a floor not a c that's what I interpret commissioner Deo just just said that it's her interpretation that that is a floor and not a cap for for both the time period of the dollar come okay then you can make that motion to adopt that interpretation and if all of you agree to it then you proceed on that basis at a z record and like I said at that point you're negotiating in my opinion You' made an interpretation which you consider get good faith as to the inent of the drafters of this document and you move forward without that 60 days service pay restriction okay and commissioner V you might also want to include it there based on past history of contracts I mean something to that effect not seeing as that's obviously that was Mr asb's interpretation okay so um I move that our the Pres commission adopt um the meaning or adopt the inter ation of section 3.02 on appointment and removal of the city manager the language that says uh subject determination at any time Upon A 35th vote of the full commission quote with at least 60 days notice for 60 days sance pay based on the plain the reading of the language and the past practice by past attorneys in developing uh city manager contract that the 60 days notice and the 60 days severance pay are minimum floors that we may provide uh not a cap second so we have a proper mention the second commissioner do we have any further discussion further discussion M if you do a roll call for us that was a benefit that was provided is that your family received um full medical coverage um so that is often times in Senior Management that is that we have I mean that's that's up to us whether or not we want to have that cat because once you have that in there you know suppos to leave other people yes so my only question is and I don't know this about our family insurance is is there a flat fee or do they have to be um red you know can they be can family members be denied you know because of pre-existing conditions do they so in other words there's a set rate for the family coverage that everyone gets okay and you think right now that it's approximately $22,000 a month different or I I have to go back and pull it but I believe for a family and a child it may be close to three really that's how no annually that's me I'm pretty sure you want get that from everything else so don was um Mr flowers did he have an opportunity to review um what Charles's contract was or have you talked about that or did he just send you his charms I don't know if he had a chance to see it or not I be sent to me I don't remember if it was sent to him as well probably not but um I can certainly or you front of us so what Sheila has is there's we have several options there's four options she put two of the top options so so the one is 13792 for the employee only for the employee and spouse it's 26583 for the employee and their family the entire family it's 3727 56 the other one is 11411 18 for the employee only for the spouse it's 228235 or the employee family is 3252 235 of course Sheila said that the light blue is different is it it's just a different policy different coverage okay so the preferred one by employees is the um the dark blue they should be that I think 14103 okay which comes out to the employee and family being 37 2756 is this per year per month per month yeah I me so you're talking about an employee with Family Insurance of $3,700 a month yes right so that's an additional by my calculations 2,420 a month which would exceed what per year 40 months get over 28 is 28800 approximately 28 $2900 but $229,000 annually okay so may if I could just for us to be considering with the salary increase that's 10,000 a year additional to what we're paying now the car allowance increas is an additional 6,000 so that's 16,000 a year that's a 16% increase over what we currently have allotted in our budget item line item if you add to that adding the 16,000 that would be increased in the city manager budget line if you add 29,000 to include full family coverage including the child by my calculations I'm not very good at this that would be an the total additional cost excluding um Social Security and Medicare payments to the federal government would be an additional $445,000 a year and so that's that's how much more we would be um committed to through the city manager's budget line okay um and that includes the additional salary dollars correct I and let me know if I left something out I included the $10,000 additional Sal amount since Mr red was at 100,000 the um increase in the car allowance to 7 15 month was $6,000 a year so that's 16,000 and then the mayor calculated um the annual cost of providing full family spouse plus 9,5 right so I add those together and I get $45,000 which is almost 50% well not really because we we didn't really calculate into I'm basing that on the salary not the salary plus the car allance plus Mr Red's individual insurance which was 100 which was um let me ask one more question there are no re is that not um something that's being that was requested by flow so just but I'm asking about tracking the contract is that going to be a that's eliminated I didn't see that as being eliminated but my assumption was that we my understanding was rather that we said we would use the red contract as the base to go off out I'm asking because if that wasn't going to be in there that would be a $10,000 reduction that [Music] difference increase addal 10% theual salary so up [Music] is there so let me let me ask you this Mr flowers um have you looked at coverage individual coverage for your wife and child um the that could possibly um I mean that's more than if you went out into the private Works workplace at your own insurance Sheila that's it's expensive we only had three people that well I understand why I understand why I mean that's I mean we could get insurance individually I think for $1600 for the two of us I don't for my understanding talking with um the insurance agent we have Jenny ryer um we had some employees that was out there that came in with their own insurance through one of the OB care PL or whatever but from my understanding once they found out you were working and your employee PID 80% of your insurance you could not keep that insurance I just say something Charles the city agreed to provide only him pays only for the employees only for the employees correct so so when I'm looking at all this are are we planning to pay for the whole family that's request request reest negotiations right now as to whether or not willing to do whether or not we're able to do that um so and mayor if I could I when I said it would be an additional 45,000 for that line item um I wasn't comparing Apples to Apples and I'm not the best person to do this um but I was I think I miscalculated I think it's more like 30,000 additional it'd be great if our finance director could help us with this it's somewhere between 30,000 and 40,000 um I wasn't providing um for the additional I wasn't providing for cost of Mr Red's um insurance that we pay that's what I wasn't Prov for I didn't include in Mr Red's insurance and Mr Red's salary allowance that would bring the payments for him exclusive of taxes to 115,000 that we were paying for Mr R for the insurance we backed it out I took it and I backed out his the difference and then calculated it so came out9 35 right just for the insurance insurance right but I'm saying then you add on the additional 6,000 for the car allowance and there was something else insurance right regardless it's $25,000 more than what we're paying St I mean when you're taking into account it's it's not necessarily salary it's the whole compensation package when you do I think it's more like 30 but again help I believe you correct though I believe 29,000 that insurance was the difference between family coverage and individual coverage individual coverage were R but by adding the family Mage that would be an additional 29,000 a year so I think your the addal number that you Reed and added included the correct amount for insurance that R $29,000 right okay 29 29 10 for salary 6 for allance right there 29 39 [Applause] 45 thank you Don I have no idea I could get that right 45535 okay so we've got to make a that's that's where we are right now is we've got to to decide what we want to do as far as the insurance now we we we have some options um possibly that um we cover his and then we have an allowance for him to try but Sheila you're saying that insurance companies um the affordable act as the model especially with this kind of salary not not going be able to get the care right so they just need to move on to I mean $2,400 a month for two people um that's that seems excess excess that's I abely I'm uh I'm sure there's got to be Florida Municipal Association or something that has some kind kind reduce that cost is other states so it is it is would you would you suggest instead of us trying to calculate a number and that number was 3732 would you be willing to suggest a number that the city would contribute towards your acquisition of insurance um I would have to research and see how much Insurance costs down there you know but I know what other cities in Florida are paying for the same thing I can imagine one count the other that much difference more expensive but I don't know kind of how we would that something look at down there you know help you know rce that cost end up everybody's cost negotiations are negotiations I understand that very well but you you have been referencing industry standards and i' got to tell you having served city manager neg city manager contracts I don't know the industry standard I think probably is for the employeeid interest for the employee and maybe some contribution towards family but I I don't think industry standard is to provide full cost of full family health insurance someone can tell me but it's not what I don't disagree with that I said quickly becoming you know you know it's fre coming that what if we just split the uh I think the the major cost that I hear 3727 was that the highest cost that included the family was enre we cover the 1307 but it take it up to 37 2756 which is an additional 24964 month so so what if we just split that in half and and and do exactly Don is kind of saying G give him uh I think it comes up to $1,864 towards his medical uh payment or medical benefits you see what I'm saying so pay for his well that would pay definitely for his but then whatever is left he can do whatever he can just go and look out for whatever he may find but it certainly would pay his way I was what I expected commissioner Burton to say was that we would adhere to the existing contract and pay for Mr flowers but that we would contribute toward his family well and that's kind of what I'm saying but I've kind of added it all together so in other words you know 1300 I guess would go towards the employee and then the other 500 or so that's left can use to what for whatever towards his so you're going to give him a 5 so you're $500 family family something like that and I was going to say something like 700 yeah I mean I just threw it out there as an idea so that we can kind good so well and I think that um okay so I need a motion and we need him to find out from Mr flowers if that would even be if that that would be an option so currently Mr flowers right now we're giving you the 20 days Bank um of of annual leave um we didn't address sick leave that would be a cruded I guess on on a regular basis just like we have done in the past if that's acceptable um and then you would start approving your annual leave additional annual leave come October 1st of 2025 we've got um a $4,000 moving allowance we have a salary of $110,000 um we've worked out this 20 weeks um Seance pay should after your probationary period should we relieve you of duties without cost um and now we're at the insurance and so they're saying that we would pay for your insurance and also we've got the 10% that we have in our contract to for your um uh for your retirement retirement that is believe 1.5% more than what the employees are right now Sheila are they at the so they're at frc's that FL retirement rate at believe believe we you got 10% buil the cont salary right um so we've got that 10% so what they're proposing is to pay for your insurance that's where we are now is to pay for your insurance um and and then give you you're saying a $500 allowance for family or between 700 um and and the other caveat with that is if he is able to I think we would we have to do this because we're not going to give him $1,000 if his insurance comes in at$ 800 so it would be um up to that's what I with proof of insurance with proof of insurance yes okay I mean yeah would that work for you Mr flowers there and we did the $750 car allowance you're say up to ,000 towards family coverage is that what you're saying with your with you being covered your insurance will be paid in full and then that would give you up to $1,000 for family coverage um without the insurance Market down there that's that's the scary part um be in incentive to work on our employees insurance [Music] policy I would I'm trying to think would it cost me down here at home they do Cobra until you know until that so 18 months but I think Don I think I think like that S I can't do that so you want us to include your family yes request that and and I can and u uh so I would suggest then uh let's move on here because we spent a lot of time here I I saw two numbers for him plus his family uh two numbers that included also his son uh I saw 3727 and I saw 3252 I don't know what any of that uh really covers um so it's up to you guys again I think we need um we need to think about what this does to our overall budget and well I think as soon as we we you know we're almost there and we can say what is it going to do to our overall budget he right now he said he he doesn't like this so I guess if he doesn't like this he he won't come is that what I'm hearing Mr yeah yeah I got overall fin imp I tell you that yeah that's overall so this is a deal breaker basically so if this doesn't happen you're not here correct that's what I'm hearing yes ma'am okay so we have a decision to make now we're having a decision point I make the mo that we cover Mr flow family coverage that's part of his consent part of his compensation package I guess I'm going to have to second that but I'm not sure what the details are we have some discussion so he you just did a blanket without I mean we've got two different policies and of course he has to decide his policy um I'd like to know how much his Cobra would be because it might be um for at least for the first year could do the C family for the two of family probably expens mother pay right but he said that I think commissioner Burton asked him directly and he said that there was either we meet the requests or he doesn't come and my concerns are um Mr Holmes has said he's not sure that this is the industry standard Mr flower says it is the emerging standard um but and as well it adds considerably to our anticipated cost of what we've been paying for this budget line um and again um I would want our finance director to assure us that we have the ability to pay that cost and of course that limits that's that limits what we um can do in other areas and we just we just created a assistant city manager position that I think is an additional 20,000 well can I just to ask one more thing too if he's going to be an employee what are the Social Security and five ramifications to the city and I I'm I'm not waiting in in favor or against that my profit I'm just trying to make sure that we have all the cost factored in so uh the $110,000 [Music] salary so you got salary you've [Music] got 9,000 in car allowance you got that's 750 a month which is your full amount trying to look at your total cost 750 a month in car take you 9,000 a year the for the base salary if I'm hearing you correctly you're talking about something in the neighborhood of $3,700 ground it all for insurance which would be 44,400 a year um would be about ,000 for Year and that would all be about $1,000 more a year based on his salary to about3 your P your vation pay that would be improve obligation 50% of that on re I mean on termination membership I don't know what and then your 10% for retirement that's right I missed that one so that's another 11,000 so you're about 174 at [Music] that like that so in the so you're telling the F contribution from the city Social Security and SP is only a th000 a month uh no I think total annually increas because of incre [Music] increas 68800 all right so [Music] Bey that's the word have emplo um okay so we have we have a motion and a second it's I guess it's part of discussion we're having calculations we're having calculations let me finish this let me let me finish this up for just a second um so so really if we I think Don what I'm looking at is um 28 the heat thank you [Music] um so it's about $46,000 46 which is pretty much where we have been all 36000 um well Commissioners this is we have we have a proper motion um and a second um Neti price on our insurance get us better price than that City that's a big part of it that would be that would be a saving no guarantee only cop out there I wouldn't count on that because we're a small group Ral and your employees your you have more than 50% of your employees is over the age of 50 I don't know how much you going to be able to comp negotiate that sure we should be talking too much about that but anyway um so that's really where we are and the so the range the recommended range for this position I think the maximum was 130 110 no when the salary study gave us a range 134 right we offered 110 the salary 134 134 was 134 what was that 140 70 1405 75 to 140 um are we taking public comments well I mean we can right now we have to figure this out ourselves too something we got be willing to do Steve can I say something yes go ahead you know y'all got the best decision for City I get it and I respect that I've been in government for a long time and I pr myself being anti respons I tell you that everywhere I've been I found ways to save money for City and I don't I do any different here um just as research there's there's other way weow this insurance premium I think we can and we will but so and I'll make a priority when I get there but I'm not trying to twist your I'm not trying to persuade you to do anything that yall feel comfortable doing I I need and but just let you know that I have been very successful as a police chief getting get more done CL or find way save money same thing I'm doing now where I'm at and I'm bring the same attitude approach to that so just put that in your thoughts to you thank you and keep in mind too that if we if we make this investment in you um you're GNA be working with the budget to make sure everything works so Steve um your thoughts on this so we're looking at about $46,000 a year over let's let St I was just thinking about like DJs we've got the fund balance um I feel a little more comfortable if if the year end was done comp Jan's calculation she seemed pretty confident about it she that number been going on for several months now I feel confident in that number so you know I'm good um um okay I think with what we also have to keep in mind we go back to you know we're going to be in competition no matter where we are with other communities and so um you know we have to believe in ourselves too I know it's expensive so she your shade in your head big difference it is a big difference but you know we're also things are changing too um this time I'm going to go ahead and take public comments because I do have a motion on the table a proper motion on the table so I'll take public comment if you have um any comments please come up state your name your address if you would public comment okay Commissioners do we have any further discussion on where we are currently okay um mie I'm going to ask you to do a roll call now mayor yes um I'm I don't concern I don't know it's just what don't you know just I would feel more comfortable with knowing the fund balance um it just just seems like a lot of money okay so so what's the bottom what's all what is the bottom line so this is where we are so let me go over this again he's going to get $750 a month for car allowance unless and I would like that caveat I mean somebody so as we come as we have yes as we have a motion um unless we come up with a car um he would get an initial 20 days annually leave yes and then he would start acing additional hours um and October 1st yes he's going to get a $4,000 moving um which moving expense his salary we're looking at $110,000 his we're looking at a 20 we s pay should we release him after six months of employment um for no cause and going and we're not going there we haven't so far thankfully and we're looking at compensating both are paying for both he and his family which is a wife and child for their health benefits um annually and and how much is that total cost so total cost with that is in in 40 about $46,000 more than than really what we have um been compensating in the past um a large part of insurance and a large part of that in 29,000 of that is insurance is is Insurance um I don't have a problem with I mean I feel like compensation package is a compensation package and sometimes a compensation package is worth more than salary um if we can afford it so that's where we are that's your agreement too Mr flowers did you go through all of that cover everything that cover everything plus a 10% I can't hear him we can't hear you I think I heard you okay and you're that's that meets your terms with a 10% in um investment into your retirement um the the only other thing that we haven't talked about which is in Charles Red's contract is 35 miles um living um but it does stay within putam County um and so unless unless there was a majority vote and you needed um something outside outside of that it's kind of like um it's in here so 35 it's 35 miles so so before we go forward is there anything else that you that you need to add to this Mr FL so so you said you said uh 30 said 35 miles manager shall reside within 35 miles from the city of Crescent City within puon County unless this requirement is weighed by a majority of the city commission I know that you're looking for a strong golf program I understand that I've had a golfer and and that's important especially when you're looking at scholarships so I would ask if flag flag would be okay uh that's that's flber County so that would be flber County and if you yes okay count you just have to remove the pon County we have to remove the pon County so You' be able to live in Flagler because 35 miles will reach all the way s Augustin all the way to Flagler Beach so that that covers all flag count well why don't we just take the within miles from the city that's pretty simple and our scho um is that is that okay with Mr flowers count yeah5 radius that's okay with the understanding that the manager agrees to be available to the city commission and all department heads on a 247 basis absolutely during storms you know unfortunately family is they're on their own I've been there with public I'm I've always been on my with storms too um so they can come here yes so just um using my smartphone um just for comparison purposes I looked up the budget I think this is M yes this is Madison Florida their general fund revenues for 2223 were 4.2 million that's quite a bit greater than ours their total operating revenue for that year including their Enterprise funds um was 11 11 that's what they that included their Enterprise they have four Enterprises I believe gas water I'm saying their budget is much greater is greater true just throwing that out so we have a motion and what was in our motion that we currently have on the table was it was so that's a single that's a single motion um do you want do we want to go forward with that single motion or do you want to withdraw your motion and put everything into one Mo I think it so discuss okay so what what's your pleasure if somebody would I'll entertain a new motion pleas needs to include all of the conditions for this all the conditions that we have that we have gone over say I I would like to make a motion that we approve the employment agreement with rain flowers um specifying the all all of the points that the mayor just mentioned would you like for me to repeat that back to you so you made a motion for the um items that have been discussed the $750 a car allowance the 20 days the annual leave bank with an approval the beginning on October 1st um of additional Ann annual Le day the $4,000 moving expense the $110,000 salary the 20 week severance pay should after six months of employment after his um probationary period we renew him without cause the um and the additional payment for his um family for insurance to be covered under [Music] insurance and using the Charles red contract as the base contract for everything except um removing the provision of Witham contract as the base for everything else removing putam County for the residency requirements all that I'll second so we have a motion in a second um Don do you have all that I think I do um I um I've got it not were going along and I think I've got in all 750 car 20day vacation bank with 20 4,000 moving expense 11,000 salary 20 week Serv P 6 month Pro insurance for Family Health Insurance his 10% contribution toward his retirement and requirement of location restriction put him already is City yes um and should and should we approve this um should we approve this Mr flowers do you have a start date yes and that be uh we uh I think still March 1 okay he's going to need to so don if you make sure that you include that that will probably be included in here I believe it was it was in Charles also so you so we would do that beginning on March 1st um you can I don't know that would be part of the negotiation Steve yes ma'am can you make this happen if if it's approved can you make it answer yes yeah I'm little concerned about try to make it work I think the insurance of course is a big hicup for us right now flowers and so I don't know what we can do but we do need to find that and keep in mind that that's not a compensation that's a um that's a reimbursement that would be our or a payment for but it wouldn't be compensation okay correct correct okay if there's any other discussion I don't have okay or ask Melanie first and commission Burton I commissioner I commissioner hi commissioner Deo hi your monitors hi so approved congratulations it's been painful and we apologize welcome to the sunshine of Florida so in the sunshine everything is public and everything is out in the open um unfortunately these negotiations as painful as they can be they have to be done um in the public side and so I know that would be um I feel um I'm I'm excited about you um coming on board I'm sure my fellow Commissioners otherwise that would not have voted in the affirmative um are also excited about you and um what you're going to bring to Cent city so we welcome you with open arms we hope you're accepting of this contract I know Don's G finalize the details with you um and anything else commissioners well I just yes hopefully we will not have to do this in future um but if we do I think we need to be better prepared with all of our financial information and um well I think we just need to be better prepared particularly with our financial information um and I know that we talked about setting some dates before we left we will um let me see if Michael is is available I'm running pleasure of commission I I can speak to the BRC they have discussed 27th of February suggesting that as a date for a special meeting wait of February February 27 yes okay I am not here um was there was there a particular reason for um just because it would give us time after our regular meeting to be able to digest the information that they finished in the report you done that week or I'm Gone the 27 from the 27th on so 26th I was going to say 25th or the 25th 26 is church night that's right 25th I live with everyone how does that look with everybody schedule commissioner Burton 27th this this month yeah February next month next month 25th Tuesday yes at what time um probably 6 [Music] 6m that's secondary I was to say sorry misses first I know out okay um so so we want to do it on the 25th it's a no it's a special meeting special meeting for the BRC to present their findings to you well I was thinking that somehow the findings would be presented a little earlier than that yeah you'll get the report perer so you'll have it two weeks earlier that's why you space okay okay so it's everybody in agreement with the 21st which 25th which is a Tuesday at 6:m for a special meeting for the BRC at this time I guess so okay we have an opportunity when we come into our regular session in February if we need to adjust that dat can right now let's go try get on our calendars everyone's that that's fine and any other workshops we can hold off until um such time that Mr flers comes on board and has an opportunity to um take a look at things to take a look at things and get aboard Maybe was going to verify it but anyway um so that was maybe a week ago um so hopefully he's doing something about understanding one one just in case it comes across the board through anybody
