I will meet you guys in the front sorry about that all right the city of Destin Proclamation National epilepsy Awareness Month whereas epilepsy is a brain disorder characterized by reoccurring and unprovoked seizures that can affect anyone at any age and any time whereas epilepsy is a spectrum disease comprised of many diagnoses experiences and includes a wide range of seizure types co-morbidity control seizures and outcomes vary from person to person whereas epilepsy is the fourth most common neurologist disorder and approximately 3.4 million people in the United States live with active epilepsy and whereas 426,000 Floridians live with epilepsy including 88,000 children in Florida and greater education and improved access to care is needed in schools which can be accompanied and passed through education of seizures safe School legislation Nationwide now therefore I Bobby Wagner mayor of Dustin through the city through the city of dtin do hereby Proclaim November 2024 as National epilepsy Awareness Month in the city of dtin and encourage dtin residents to act together and use our brains and to overcome the challenges to of living with epilepsies and accurately therapies to stop the seizures find cures and save lives so do I this fourth day of November 2024 to Proclaim National epilepsy day thank you all right thank you for that that was a tongue twister moving right along 1B it's going to be the Chachi Basin Alliance annual report thank you for being here all right so if you just want to hit that gray button it'll turn it red and you do not have to hold it down there you go yep the floor is yours okay great thank you all right good evening everyone my name is Kayla Wingard I am the monitoring program manager at the chak tahachi Basin Alliance and I am presenting our updates for our involvement in the program activities for the npdes program all right so before we jump into those updates just a reminder uh who CBA the chak toachi Basin Alliance is so we are a nonprofit profit working every day towards promoting swimmable fishable um sustainable waterways throughout our entire chak to Hatchi Watershed um we do this through four main program areas monitoring education restoration and research and this is a visual of what we mean when we say the chak tahachi water shed so it's a very expansive Watershed the majority of which is in Alabama um so for this project for mpds with the city of dtin we're focusing on a small portion in in terms of acreage on the southwestern part of the Watershed however in the coastal Southern portion of the Watershed is where we see the majority of development um lots of uses for economy Recreation so it makes sense that we focus a lot of our efforts down here but we do have full Watershed uh coverage through our monitoring education inititive and restoration projects okay so our partnership with the city of dtin um we are very grateful for this partnership we love to do activities in the city of dtin and reach out to this community so with the npds the uh epa's National pollution discharge elimination System Program uh it has the goals of reducing pollution um promoting good water water quality and attainment of the Clean Water Act uh water quality requirements all of which are related and aligned with each other so CBA partners with city of dest in several different areas of that program public education and Outreach public involvement and participation and pollution and prevention Good Housekeeping and we'll be going through the updates for each of those uh project areas so starting with public education and Outreach uh CBA has a year-long curriculum called grasses and classes so we are thankful to partner with Dustin middle school and we work with their fifth grade Stu fifth grade students um with our grasses and classes curriculum so this starts with an introductory lesson where students are introduced to the phenomena which is spartina Alterna Flora um are smooth core grass and in their schools they grow the grass they learn about water chemistry parameters um the benefits of smooth core grass of living shorelines uh storm water pollution all sorts of different Environmental Education topics um through a very much local place-based curriculum and at the end of the year uh the students get to prepare these plants um to be planted at a restoration site and so that's what the picture is there from this past spring students from dtin Middle School uh prepared the plants that they had grown year long to be planted at a restoration site okay and so not only do we reach out to our uh grade school age learners but they are lifelong Learners so we are reaching out to um various desting Community clubs uh most recently our science communication engagement specialist Jenna Kilpatrick um presented to the Destin forward leadership class uh just this past December or sorry September um we also in the spring uh were invited to present to the Dustin Rotary Club and upcoming we have a scheduled uh presentation to the Panhandle fly Fishers uh club that we love to work with Okay we also like to get involved with the community at events so each year annually we are involved in two major uh cleanups the Earth Bay Earth Day Beach cleanup at noro point that was April 20th um the international Coastal cleanup just happened we were stationed at June white Decker Park and that photo is from there we have staff out with educational literature we are helping uh volunteers get their supplies and get started to participate in the cleanup common items as you can see on that slide food wrappers cigarette butts plastic bags bottle caps Etc all of these end up finding their ways um into our Waters so we are uh really happy to uh partner with Dustin at those events but we also like to promote uh apps like clean swell so you don't have to wait for an event that is you know once a year twice a year you can do a cleanup anytime on your own and if you want you can record that data um to be used in Marine debris research at cleanwell okay and there are also other ways that the community can get involved outside of working with us directly in the field I naturalist is one of them we have a CBA Watershed biodiversity project that just continues growing every time we check in so we're up over 100,000 observations at this point um that's something that community members can do on their own and contribute to um the uh a body of uh observations that scientists can pull from for for uh looking at the biodiversity in the region next slide okay and then we also have water quality stations so this is a map of our six water quality stations within city of Dustin limits um as you can see we have two in the Dustin Harbor one at Jo's Bayou we've got Indian Bayou and then we're have another site uh further east towards the mid Bay bridge on the next slide um this is dives into okay what do we do at each of these stations so each month CBA Chachi Basin Alliance and our volunteers that we work with goes out and we are measuring in the field parameters I know a lot of you have actually been out on the water uh doing just that but for those of you who haven't we are measuring temperature dissolved oxygen specific conductivity salinity pH and turbidity so all of those parameters we get out in the field um and we have those values but we work with University of Florida lakat program for the water samples that we take those are picked up on a quarterly basis and we get those results uh several months later but we are collecting total phosphorus total nitrogen chlorophyll a and suy dis vanishing point um which uh provides information about water Clarity so all those are collected on a monthly basis and what we're going to be looking at the results to compare to um in terms of phosphorus nitrogen and chlorophyll are the numeric nutrient criteria set forth by fdp so in the West Bay you have certain limits that you don't want your an average geometric mean your average values to yearly values to exceed um and they are different for the Middle Bay there's different criteria for East Bay all of these regions are different bodies of water with different natural characteristics so they all have a slightly different criteria so those are the limits that we are going to look at whether our results exceed or don't exceed in terms of total phosphorus nitrogen and chlorophyll okay so first with the West Bay so we have more than just our city of Dustin stations in this West Bay Region um the two on the bottom right are our Des Harbor stations you can see here however that all of our stations those included the green dots mean that they did not exceed the criteria so that is that's great so for phosphorus nitrogen and chlorophyll for 2023 the average uh values for all of those different parameters was under the numeric nutrient criteria and on the next SL oh yep already changed okay um for the Middle Bay the Okaloosa portion of the Middle Bay we see a little bit different uh story here so again total phosphorus and total nitrogen all of the stations that we have are in the clear however with chlorophyll there are three stations in that section two of which are our city of Dustin stations um over in Indian Bayou um that did exceed the criteria just for chlorophyll um so those two stations and one in the north northern portion of that segment did exceed the uh nnc for chlorophyll however the mean for the region overall which is how a water body is um characterized if it's you know attaining standards or not that region did attain the standards but those two stations did not um so that kind of tells you for the average values for that region where are we getting um those levels from okay next slide we also have uh added another year of data so 20 I'm talking about 2023 because we add a year of data at a time and since we're still in 2024 our 2023 is the most uh recent year of data but on this chart on these graphs you can see 20 2003 to 2023 um so that's 21 years of data which is pretty amazing to have um and on the left column we're looking at the West Bay so cinity up top pH in the middle and dissolved oxygen at the bottom for a visual representation of how these values are changing year to year um we are seeing a little bit of a increase in the last 10 years in salinity for both West Bay and Middle Bay um however pH and dissolved oxygen staying relatively stable next slide thank you um so this is just a screenshot of our interactive dashboard where you can zoom in look at you know a station all by itself or a different group of stations and you can also access links to our annual reports for a deeper dive into the data that we have and then the last part of our involvement with MPD is the pollution prevention program area so this includes a monofilament recycling program and just in our last reporting period so this is just the last six months we recycled over 35 miles of monofilament fishing line in Destin these are coming from five stations five monofilament b bins four of which are in the harbor and one of which is at Joe's Bayou and we do work with volunteers to um get these uh bins maintained the line measured uh sorted cleaned and shipped off to not just be out of the waterways but get recycled all right and also part of our pollution prevention is our oyster shell recycling program so we have four participating Destin restaurants from those restaurants in in the uh last 6 months we recycled 70 tons of oyster shell collected um that's five more tons than we had the the previous same period And as you can see on the left we have a huge pile if you've ever seen it in person where we process these oyster shells to then get prepared to go into living Shoreline restoration projects um and also on the right hand side you'll see one of our oyster gardeners so we have vertical oyster Gardens that we have deployed several in the Dustin Harbor and they just start as a vertical string of oyster shells with it's pretty simple uh a hole drilled through and string running throughout and as you can see like they they collect a lot of life because oyster spat prefer to settle on oyster shell out of all materials um so in the spring our oyster gardeners take what they have grown over the past year and Transplant it onto a living Shoreline at a oyster Reef that we are building okay and so that is it for our uh updates for this past period for the mpds program I'm happy to take any questions all right up first is the oyster model thank you yes I am oyster farmer um fact that's actually my first question um whenever um it comes in the springtime whenever um we start um I guess before we bring our oysters to you is there a way you can reach out to um us to see if um we can work with you to pass around the world to get more oyster Farmers because I mean I'd love to be able to see more people do it in our Harbor because it seems like the oysters that grow in our Harbor grow a lot more rapidly than let's say in in the bay oh yeah yeah there's some pretty Dr IC difference we have gardeners all over and the harbor is doing really really well um yeah we would definitely uh be interested in you know thinking about how we can promote it better because there's a lot of uh realy in the harbor that could be taken advantage of and yeah if if we were to get more involved from the city of Destin of having a whole bunch of oyster Farmers is there a way we can potentially move those oysters to like our own living Shoreline as opposed to somewhere else I love that idea um I would have to get with our restoration uh project manager to see what the possibility of that is but okay I like that um and then I do have another question um so the armor cor of Engineers um with the um the the harbor capacity steering committee um one of the objectives was to incorporate a more robust water quality monitoring system in our Harbor um so I fig this probably a good time to bring it up um be do you have any recommendations coming from CBA and how to uh make our water mon water monitoring system more robust yeah um so there are a few different um Avenues we could look at so being expanding bacteria testing could be one um continuous monitoring stations are something that uh other estuaries are doing there's also additional parameters that you know we don't collect that we could start collecting um so there's a variety of ways we could go with that but I I would be excited to yeah work on expanding our monitoring program here okay so you mentioned bacteria um so I guess right now we have what two water sampling companies is that right um so would you be willing to grab the samples of water and maybe only have one that's in the field and drop it off to the laboratory for bacteria I guess right right so the holding times for bacteria are different than the samples that we are grabbing but we're already in the water we are uh grabbing samples for a different lab to take off I I think that's definitely a possibility that we could do that too I guess uh for Larry what do we need to do to maybe see about using some of these or working with CBA on some some of these ideas and I don't know if the frequency matches up with what you're already doing but yeah I'm not sure either yeah and we'll have some conversation and and let them know what we're um having another agency test now and see the possibility of them doing it because they are out there capturing the water and the samples already if it's just a matter of getting it somewhere in a timely manner we'd be glad to have that conversation yeah so we'll Reach Out cool right thank you sounds good Council NE bear thank you mayor and thanks John that was he asked one of the questions that I had um my other question is the monofilament that you have those stations is that monofilament in the water or is it Fishers fishermen that are like using like whatever they're finished with and then feeding it in there or is it both I mean is there a specific type of how all that has become such a large amount um it's both I mean it's a little bit of everything some of these bins that we have are extremely difficult to clean um just anybody can put their line in there but we do see I'm I'm not sure why but large spools of unused line for some reason um but yeah it's coming from different sources and it all makes it way makes its way into those bins along with a lot of trash that we have to sort out as well but right that was it thank you mayor thank you for being here your presentation was excellent it was very interesting to see where we're at in in the last 10 years where we've come from so thank you for your presentation and thanks for being here thank you thank you counil Dustin thank you mayor and I appreciate the choc Bas allowance Alliance they are a local group that's making local impact in a very important area but I would suggest as we go through our net positive environmental benefit regulations that we either give credit for donations or for oyster stations directly that are done to the Basin or we can just say a percentage of it shall go to their efforts because they are doing something here that really matters to us so I would suggest as we move forward that we look at that very closely and see what we can work out to have a little more money going toward them that's exactly what I was thinking while councilman Steven was talking about it so that's very cool all right thank you so much thank you should I you turn yes please all right moving right along public comments anyone here to speak not on anything from the public hearing good evening mayor and Council Monica Wallace DUS and water users 14 Industrial Park Lane I'm just here to update you guys on the undergrounding project I saw it's heavily on the agenda tonight I just wanted to let you all know know that Dustin water us is supportive of a very strong and purposeful project that you guys are in uh taking out as uh on Endeavor here but um as a underground utility very few underground utilities have been involved in the design and moving forward so as you're getting ready to start into construction I've already talked with staff but um one of the things we learned on the highway 98 project was that part of a successful project when you're widening a road or working on a road is getting everybody in the same room to talk about it I think back at that project we spent probably a year just planning and designing of who would go where and how would it fit together and how could we all work together and we're all utilities happy um that hasn't really happened I think a lot of the aerial stuff has been talked about but not a lot of the underground has been talked about so I just want to let you all know that and moving forward I think the city wants a successful project and I think you all can work that way to get there and I've made suggestions on maybe meetings every two weeks or something to get started and kicked off so I just want to make sure you all are aware we're happy we're here to work with you guys but um we're looking forward to a great project so than thank you for bringing that up all right right anyone else seeing none I'll close the public comments and we will go to leak and unity fiber being three that we're Contracting with to also bury theirs um the C agreement is for $ 85,86 the cry Lake agreement is for $186,400 [Music] $172 and then there is a cooperation uh and coordination agreement between um two of the other contractors GNA power um to U utilize ads uh for undergrounding theirs and it's simply an agreement that we will allow them to work together there's no charge to the city for that um so to move forward it uh there are four motions needed one for each of to those uh contracts uh three of them with money attached to them and the final one without any dollars all right with that I'll open the floor for a motion mayor I move that Council approve the Cox facility underground agreement and authorize the city manager to execute I'll second legislature from Appropriations uh if you recall last year there were seven requests made two were awarded one for a million dollar for the for prong Lake outall and one for 100,000 for the harbor grge um so we've been notified um by representative Manny's office that the time will soon be here we don't have a date yet um we've included a couple of projects that you may consider that are in the um CIP for 2026 fiscal year which These funds that are approved during this legislative cycle would be for the 2026 budget year those two would be the um shade structures and the safety netting at the um Morgan Sports Center the 65,000 for the shade project and 450 have been budgeted for The netting so we would ask for half of those um numbers to to be if that's something you would look for or otherwise we' look for direction and whatever process you would like to have to um you know put a a list of items together that we would seek funding for so um more than anything tonight looking for direction you know certainly if you would want to include those you know motion could be in order uh but more than anything just let us know what you would like staff to bring or how we'd like to address this all right first I have councilman dtin I have a hunch it's going to be stallman I do you're a mind reader we're we're on the same way Le tonight so I'm hearing you yep um representative Manny was able to get money in the budget last year for us for stallman intersection improvements the governor vetoed it but if you send it to him enough times eventually he'll get a guilty conscience I hope and not be to it so I would suggest that we include that again same appropriation that the representative was able to get in the state budget for us last year second all right I have a motion a second for stalman y um any further discussion on that uh my only comment on that is it seemed that I I was looking up a bunch of that and if we just have to approach it more from a regional impact project versus a a city one it seemed like the1 billion dollar worth of uh spending slashes the first one was localized infrastructure whether a storm water or Road Improvement so I think with it being part of the cross town and now us moving forward with the other significant missing piece I think kind of for all of us to think on it just pitching it more as a regional the beginning of a regional Point than a local street is the only thing I could come up with so with that yeah and I would point out you can't get any more Regional than the only East West quarter in Northwest Florida along the shore AB so we might want to just remind him of that yeah exactly councilman Bagby yeah I mean we can go through and I've got my list Tarpon Beach cross town connector stalman 98 intersection dredge Harbor linear Park Board walking into the bridge and Joe's byou improvements but I think we ought to take a holistic view uh and maybe not make a decision tonight but give gu guidance to the staff to say look bring us back your list of projects that and I appreciate the two that yall got us but we we can fund those I'm looking for projects that we can't fund okay and we've uh you know we've got our delegation from the county here tonight and we appreciate their attendance and we look forward to working with them on Tarpon and we've worked well with them on tdd uh related uh activities and projects not so much on uh the half cent the the other money that we could use and we probably need and probably part of that is we haven't identified and ask and we haven't gone to them and said hey can you guys help with this this this is a project that helps the county like Tarpon Beach and so I want us to put some thought as opposed to just throwing stuff up on the the wall tonight I'd like to put some thought in this and get a a list that a priority list prioritized list like we did last year and with multiple projects and then give that to the county or Identify some that we can ask the county for help and then identify some that we can ask the state for help I mean I agree with stalman I agree with the dredge of the harbor I assume that uh tor's going to bring that one back up you know the ones we didn't get let's go back and get we also be aware that the ones we did get last year particularly the million dollars we had plans we had you we had everything 50 citizens show up to the workshop yep all we got to do is fund it so it's not like well we're we conceptually think we would like to have a boardwalk under the bridge no if we have plans for the boardwalk under the bridge and we've paid for those plans and we show up in Tallahassee I think we will probably do better but that's just my inut all right I would Echo that as well all right seeing that we have the motion on the floor right now for adding the stalman uh Road intersection I'll keep it open but the stalman portion project to be added so without other further next item U what I've uh um come to know is the gift that keeps on giving the fire district boat dock um we asked the fire district if they had any interest in changing the language to um include any other municipal use uh they did not so what's before you tonight is the same lease that was presented two meetings ago for your consideration turn terms and conditions are the same um so it's um you know it's your certainly your discretion whether you want to move forward with the boat lease um or not and Kevin did you make the motion is that yeah I'll make a motion to move the table this item second the table okay all right well no discussion on table so call the vote all right I don't know why we keep kicking this thing but I guess we're consistent all right thank you item 4f is regarding the employee satisfaction survey um we were asked to uh look at options to uh conduct a employee satisfaction survey and um our HR Director has done some good work there so what we found was that poco poco has a ready too option that's $5,500 and it's kind of outof the Box uh product and we don't get to customize it to any degree uh they have a $8500 option which does allow us some customization and ask some open-ended questions um then Evergreen who we have used before for for some uh um wage and salary study uh they have a customizable survey that's $8,000 they have a survey with analysis that's 12,000 and a survey with benchmarking that's 15,000 then option three that we would recommend is using Survey Monkey which will allow us to um use our own questions that does uh with a paid six $668 subscription per year provide confidentiality and the uh responses will be anonymous so there's no tying any comments back to any individual U and it allows us to completely customize for questions to include in the open end questions so as we would like to U customize to gain the data that we're looking we were asked earlier to review at the last two surveys that were conducted and they were some years apart but we did find those and it was uh the questions were either identical or very similar on both of those surveys so if you if we go to the Survey Monkey option where we would customize it we would use that as a basis for what questions we' ask uh in the new survey and kind of gauge them as what's changed over time all right appreciate that councilwoman a uh mayor I move to direct staff to conduct the 2025 all employee satisfaction survey inhouse with the paid version of Survey Monkey oh thank you for saying that oh all right motion a second any discussions oh yes Council meston and I I'm going to vote for the motion but I hope we remember a lot of times you can determine the outcome of a survey by writing the questions and so we want to stay as close to the old survey question as we can so we don't skew it one way or the other right councilman Bagby yeah I I'll vote for it uh just so we can get it started again because we we've had a little Gap here uh and we shouldn't have a gap our policy has been since about 2010 to do them every two years two years you know citizen survey two years later staff survey two years later to help us with our strategic planning so I would I look forward to the results I'm I'm not sure that would be my first choice but I I understand it does save us some money and I look forward to the results but benchmarking against PRI our own prior surveys is critical all right other than that the only thing I could think of is if it's a yearly subscription maybe we play the game of we do it the first month thank you Mr Mayor councel the next item is 4G uh regarding the boardwalk under the bridge PD and stallman intersection scope of work if you recall at the last meeting there was some discussion with the Baskerville Donovan Representatives who were here talking about the uh scope of work for the p& study and the extent um that of what that study entailed uh they performed a study based on a scope of work that was presented to them um there was a question about whether that was indeed the scope of work that Council had approved and apparently it was and so we asked them where they were in that process and the answer was we're we're really done with all of those components except U putting uh estimated costs associated with the components of that extended out to Airport Road study so we asked them what that reduction would look like uh they offered us $2,000 initially we asked for more and we ended up getting a offer of $3,126 which is 5% of that component of of the study so the decision tonight is do you want to in the scope of work and take those cost estimates out or there's probably value to having those at least in the future if we're looking at do or other funding sources that U we would probably need to go back and get those cost anyway so certainly at your discretion if if you want to leave it as it is we don't need any action um if you want to change the scope of work we'll take it we'll need a direction to take it back and ask them to re Define that scope of work and take those cost estimates out all right councilwoman AB mayor I move the council instruct city manager to work with Bakerville to produce and bring back to council an updated task order reflecting this proposed fee reduction of 3126 all right I have a motion on the floor second right I have a motion second councilman Stevens uh do you have anything else all right cilman Dustin yeah the the question about the scope of work that we entered into I was Ray was able to find the motion that uh directed the scope of work and it clearly said stallman intersection under the bridge and that was it and it uh it appears that someone changed the scope of work contrary to the policy and Direction the city council made that night we can't go back and change that I suppose so I would say going forward with the correct scope of work is the course we should pursue and I also would point out that that motion named a council lays on to the process that was me um I would like to be included in the meetings city manager whatever we have to do to that and so we can get back on track of of where we were going with it so and I will vote for the motion thank you councilman understood all right just just so I'm clear so we're basically the $3,100 reduction and as for the cost of what the cost estimate SC that's correct so the scope of services will come back with the taking out those cost estimates okay cost estimat okay so I I feel like we might be shooting ourselves in the foot here if if that's something that we would need if we're ever to go for Appropriations or grants is this part of the process of getting this done is that anything for it could be I mean you know hopefully it will yeah yeah okay so we're going to save 20 3100 bucks and then have to rebid it out or I'm just trying to I gu feel like we're my understanding retroactive I guess yeah my understand we're going to narrow it back down to what the original uh scope of work was that the council voted on to the degree we can now they've they've they've done a lot of the work that they that was presented to them apparently by staff um so and we can have whatever conversation You' like to have with councilman we'll have you there I'll be happy to have the conversation because they did a whole lot of work that is really of no use to us and matter of fact is contrary to the policy set by the council this one in the council in the last six years so we will certainly discuss those issues with them all right cman Bagby yeah I would prefer the cost estimates be kept in but in your negotiations if you can't see uh particularly ones that are that into the Town project because hopefully we will go back when the bridge comes in or whatever and I understand those cost estimat have a shelf life and then three years later we're going to have to go redo them anyway but um I I trust you and Mr boardwalks in the harbor um we're looking into that there obviously some challenges there uh we're going to have a meeting Wednesday with um a member of the bill mckisic from the Harvard Waterway committee uh we're going to have Captain fum there uh um and a member represented from the high school and their fishing club to talk about what issues they're having and just kind of began the process of how do we get there if we can so there's some private property issues that'll have to be dealt with there's some liability issues that we know will have to be there but uh there's some conversation worthy of having so we're going to begin that process and just want to give you an update that we're moving that uh down the path and see where we can go with it um then forj was is the item U that we addressed at the beginning where we're requesting because of some absences that we know going to happen on November the 19th to reschedule the LDC Workshop to December the 3D so reschedule that Workshop from November 19th to December the 3 would be our request Dr Young thank you Brandon Bruner the project manager for f. District 3 has let us know they're in the first half of the maror Dustin Bridge PDN a public Alternatives meeting scheduled for December 3rd and meeting announcements are expected to go out later this week to elected officials and interested parties tomorrow is of course general election to find your voting Precinct you can go to our City's main Facebook page city of Destin government and we have the link on there listed for folks that can key in their address and it tells them the exact Precinct to go to Monday November 11th is Veterans Day city offices will be closed and we wish to extend of the city thank you all right uh Council mmid yeah thank you I have a few questions and comments um first Miss Monica brought up something earlier about dust and water users and undergrounding was the was the was the statement that the 98 phase has been very good with the planning in the project but she's concerned with the back roads so so miss Monica's concern with Destin water users has not been involved in the planning for undergrounding utilities like this whole time I'm not sure that's is that kind what your concern was you'll haven't been involved right so is there any particular reason um that des and water users was not involved because I think I don't know is there somebody that can answer that I cannot uh but I can who's in charge of the undergrounding project Jeff he's ra raising his hand over there yeah yeah let me feel that is there reason why are like don't they have a lot of things underground yes they they do have infrastructure underground in that area and we have reached out to our uh project management team team to include them uh that not just recently but a long time ago so I'm going to follow up to make sure that that's happening and all the uh you know dwu and others will be concern forward my concern is is that the council has talked previously in these meetings about the undergrounding project um and I know you know it's very confusing or not confusing but you know make sure we get Cox and Verizon and T-Mobile and AT&T cellular ABCDE and all these other people on the same page and they told us multiple times that they were going to make sure that all all third party all people involved and utilities and stuff were going to be included so please at the next uh meeting I want to hear why that company did not include them or why the city did not include them please um do we have is the permit been approved for the batting cage at Morgan's or are we still waiting something for that no we do not have a permit for that that is in with um the uh who is it yeah D is there anything that we can do is there funding issues for them to design it is do we have anybody over they just not want to do this particular job no we're just waiting for them to finish okay all right they hav a provided us a proposal to do the permitting and design work for that yet it's been requested several continuing service we can't use them as our continuing service contractor they have to provide a proposal is that what you're saying yeah we've asked them for a proposal to do a permit to do the design and permit work necessary is that standard practice for stuff like that yeah because this project is going to include two other projects as well so it's going to be one development order what other projects is it including the maintenance building at Morgans along with the bathrooms so we're we're kind of needing all three of those to move forward at the same time because they'll be all under one development order um I'm not sure if that's like an internal thing but we're we we put money towards a one particular item to do a project to get it done and now staff's wanting to Lum lump in multiple things that's going to delay that one item it doesn't make much sense how does that work I'm hoping all three items can move forward simultaneously okay Larry can you give us update from that company on what the holdup is and what their timeline is uh what about the playground I had some parents at Halloween asking me I know we ordered the parts I believe I couldn't there was a design recently at the county at a beautiful Park and they were kind of jealous about that one and wondering you know know what what was up with our I told him we ordered parts I just didn't know if there's anything further yes all the equipment has been ordered and the design is um on the fence that is the design we're going with right and it should be completed in Spring sweet I'll let them know thank you um Mr Mayor I was informed that you're working possibly on some Triumph funding research and his research for possible Morgans and other stuff is that anything you can yeah give us more details under the sunshine here yeah absolutely um so as of now that's kind of one of a a big bucket of money that over time and go into some of the symposiums put on by FPL and others they typically are one of the speakers and there's still a large pot of money left we're one of I believe eight or nine counties that are eligible and so with that there's no um timeline as far as when they allow money to go out versus come in like a lot of these grants and proposals and things that we work on uh with the the state so it's kind of just an open revolving door so we're just trying to get a better understanding of what would make a project qualify since it's from the BP oil spill money uh it's all about kind of bolstering our economy uh in ways that aren't uh tourism related since the oil spill devastated the tourism this pot of money that got set up there by I believe Don Gates and a bunch of others um it's all about job creation sustainability and just kind of bringing new Industries to a community so yeah we're we're working around right now and trying to figure out exactly what are the parameters to make sure that we're not wasting our time on a good idea that doesn't qualify because a lot have not qualified and they're all online so you can see what has failed what has worked and so we're kind of using that as our guiding lines of like all right what do we even have in our vicinity of a city that could probably match something or alter something that maybe has been approved already would you mind sharing like early next year the year so that way we can time that up with potential budget process for whoever's here and all that 100% I was hoping to do in the visioning session since that would kind of be our very beginning goal post to the very end of the budget approval well thank you for doing that um I know for some of us I think we asked about trium funding early in our tenure and um for some reason we never really tried getting we failed the cross town and I think there's been a couple things we've gone after um citing other projects that have passed but again kind of to the the regional need versus a what may be construted as a city need um is where we've fallen and I believe in the past year or two um they've loosened the Reign a little bit in some of the things that were making this so hard to uh become attainable um but yeah so that's kind of where we're at and hopefully we can have a better idea during the visioning session of here's what we got ideas kind of like the appropriation here's kind of some my project ideas that we feel and after talking to them fit the bucket and then it'll be up to us to see if we want to go down that hole or not well thank you um and then I'll just close as a a repeat read it over here you know um thank you Mr Stevens for um sitting up tagging on i' I'd like for our consultant to either be here virtually or in person at our next meeting I I have not been impressed with him in his operation from the get-go but just kind of bite my tongue but this is when Monica came up this is probably a straw that broke the Campbell's back because you know he just seems a little oh yeah it's all under and we have nice diagrams of you know where all the power lines are going but you know if he had and you can tell him first question I'm going to ask is how many as builts have you looked at for the underground utilities not the ones he's planning on putting in but the ones that exist because he probably hasn't looked at one and that's why I say three years before we get phase one done because we're going to start hitting gas lines or old sewer lines that nobody knew or probably a sump pump or something that has been there for 80 years and oh we didn't realize that they had field lines and we found another septic tank so I'm just I I would like for him to answer uh how ready he thinks we are and inquire into the depth of his preparation with the existing underground utilities all right all right so the one thing I have under here is just a resolution uh for the US Highway 98 intersection um it is over there by uh rata way and for uh location it is um just south the left turn lane of Whole Foods and so the state um reached out to me I believe his name is Ryan um Adams and he reached out to me about two months ago and they were in talks with legendary Marina and them this is all kind of being a piggyback off of the repaving of I believe what we call Danny worle Way and a few other things and so the reason they brought this up is it got flagged under their system um since been created this leftand unsignalized left turn lane in and out uh there has been 63 instance uh 63 crashes um in the past five years which adds up to one per month uh which definitely threw a red flag under their code and and their things so um that resolution is them asking uh that is my wonderful Photoshop version of what they didn't provide me so they provided me both of them separately so I threw them together because I figured that's I'm a visual person so um so there's a leftand turn lane on both sides this new creation would make it a right hand only and redirect that Middle Lane and cut it off so I'm sorry it's a little blurry there but um this is just a resolution supporting F dots uh want to do this uh they were asking for both the city and the county just to give them the documentation for the state to um move forward it also need a public Workshop so uh nothing that's going to get done in the next 30 days because it actually needs to be 30 days out but I was just trying to move along safety on 98 per a request from fot so you need someone to make a motion yes please yeah yeah we'll have to uh make a motion to pass this resolution as a councel do you want me to make the I'll make the motion for us to pass it as a council all right and uh councilman do I have a second I'll second all right and then discussions councilman Bagby yeah I don't have enough information to support this tonight uh when I read through this I was like what what is driving this train and as you were explaining that you know my my gut feeling is Legendary Marine and what they're putting in to the east of Whole Foods and uhel yeah yeah that hotel is driving this whole con conversation and I just don't know enough I want to know from the sheriff's office is this in the top 10 intersections that have had accidents in the city of Dustin and oh by the way that left-and turn lane is in the city of Dustin so I'll have that answer for you at the next meeting I don't have thank you I appreciate that there's there is way and I appreciate the work you've done and and and taking the bull by the horns smir uh you know I I don't put a lot of weight into the social media post because most those people don't live in the city of dtin but if it if it is in the top 10 accident intersections in the city okay then we we ought to look at something if this is so some developer can get some trips you know counted not counted against him or whatever they can go someplace else I'm just no offense but I I just didn't see I haven't heard an outcry and I pass that I go through that intersection make a leftand turn at least four or five times a month because I go down to low I go to lows because it's the one closest to my house and you know it and I've never had a problem now saying that this Saturday I'll go down to get some washers or something and my little car will get T-boned but the uh no I I just don't know enough about this ask but there's some some reason all of a sudden this popped up and we have to without any discussion without any public input have to put this on our agenda and um well there's definitely not a timeline anymore their attorney I guess didn't get back with them I Ryan reached out to me me uh on the 21st and uh the attorney Roy Anderson Corp I guess they might be U related with legendary hasn't responded so I don't I don't know if they want it or not on their end um I was just Fielding an F dot no I do understand where you're coming from yeah so I I I'm going to make a substitute motion to table this until staff particularly the sheriff and our engineer has or our planning staff have time to do some analysis on this intersection and if we actually need to make this resolution I'm good with that yeah that's fine yeah nothing's going to get stopped there it's kind of what was hoping to be on that cycle of getting that done because of their delays it's off the table anyway so it'll there's no rush yeah all right I appreciate that and other than that uh even if we're all we could do it in the form of a letter or a resolution to come back at a future meeting but basically um the charter fishermen are looking to see Lighting on the Jetties on those rocks by the pass um as a first priority and secondarily they would like um ideally to also see Lighting on the markers in that area as well it's not in our jurisdiction we'd be coordinating with the Coast Guard but at least we could give support if you are willing motion that would be yes yes either for a letter of support or to bring back a resolution at counc Des second by councilman Bagby for a motion resolution for support uh seeing no discussions we'll call the vote oh Johnny's not even here and he gets his resolution no just kidding no no no no by all means there's no there's no timeline on that yeah um no no okay the next item um I have the details in the staff report this is with regard to the dtin fishing fleet versus city of dtin litigation separate action from the bird Harris case it's described in the staff report if you guys need me to get into it I will but otherwise in the interest of time in this lawsuit the city has a $100,000 diminishing insurance policy that is almost exhausted and we are looking to have you approve hiring the Warner Law Firm to continue beyond the insurance um cover crystal is also asking um to encumber $50,000 for that do you need a motion for that yes please I'll make that motion to encumber the 50,000 and to approve the engagement approve the engagement thank you all right I have a motion for that do I hear a second second but I got a question all right second by and that 50,000 is coming from which budget line item legal uh the legal services for miscellaneous law um not Council contingency yeah Council meston do I have a conflict since yes they've Tangled us into that the next part of my statement is going to be that both you and Mr Stevens um I've talked to both of you individually before the meeting and we have determined that you have conflicts and Ry has your forms for you to fill out thank you V all right this all able to get back if we go through the whole process oh you turned it off the feed Fe is are these fees that were asking if we can recoup attorney fees later for this additional cost yes not a definite scenario okay that that is not a certain scenario no um we have various hearings and such coming up and depending on how the case is disposed of would determine what happens potentially eventually to attorney's fees we have a motion for summary judgment that could dispose of the case on January 14th we have a mediation where potential settlement could be discussed of course if anything was conditionally agreed to by us it would come back to council we would discuss it and you would have to approve anything and then if all else fails in the case is not disposed of there's a trial set for May 19th um and so attorney's fees could depend on many of those things gotcha thank you for that all right I out there gave him multiple warnings he was telling us it would be done by today and it's not so I intend to file the Foreclosure complaint um this month right thank you is that it can we get uh a little bit further rather than this month because we've already gone multiple weeks weeks past what we said we were going to do right yeah I don't know the exact day but I'm working on it now um but I did not want to start going too far into drafting the legal documents if he was going to comply because that's a waste of taxpayer money paying legal fees so what we did do already was order the title work and we have reviewed that so it's ready I just have to prepare the complaint and um the list pendants and the legal documents so um I will do it as soon as I can this month thank you great last
