to build uh you've seen the fitness center probably up in plon and of you may be familiar with it um and this is the contract purchaser of the the property that's subject to the application tonight on the corner of Woodland and Bon drive and by this application we are presenting a site plan with um a proposed building and parking lot for this um fitness center I have two witnesses to swear in okay this evening um our engineer William Gilmore he's been before the before he may want him to decide his qualifications they remember him Gilman I don't remember did you present before this board in the past I okay unless any member has objection uh well I'm sorry chair that's having sworn y we're going to do that that yep and the uh applicant please you raise your right hand please testimony you're so I'll turn it over so I have a rendering of the site the site package has minor exceptions I kind of that get to introduce you to plan is here left the page Del dve is horizontal on the page avue verticle on the page the color area represents the 1.5 AC site question um currently improved with parking lot septic system and side three access points drive and one access point maintain with Avenue there's sidewalk on the property there no side imity of of the of the site site sits on the zoning boundary line between the ra and H District side here and distri and we have Farm area here District AC district and We R districtross the street the drive is AC district and to the South AC Woodland is District so District um in the review letters there's a little bit of um discussion about if the Farmland buffer applies to the site or not we're asking for interpretation to the board that it does not that since it's a commercial against Residential that the buffer intended to protect Farmers from residence that move too close to the uh active farm and we won't have that situation here the does not interpret that way for that waiver you have to add 50 ft from the side properly the building is 68 A Little Closer on the parking lot um there is still interpretation the question as well is the 50 ft from a side yard line is that in addition to the side yard setback line can make 70 or is it 50 so there's some of the questions that we have before requested approve it as it is basically same configuration that we're propos you to remove two of the driveway from Drive um we had review from the already that sidewalk this RCT that also position driveway so that what they call quter clearance from the radius to radius ft 67 ft there was a variance for sign wer identified in h letter so that would no longer request that waiver because we need that condition now um there were some waivers as far as uh the C Calk now we were providing Calk we requesting a partial R for than there noosing a 6000t style facility for [Music] basically a gym we're providing 30 four parking spaces for 30 required two handicap spes we're also closing temporary or make space proposing again the access off the wood maintaining a lot ofing and overl Clos stor system in the form of for where the rain in the building go to the park lot AB St bed and dis charge a dist square there's a head wall on the South Side nor east side rather that that into system main that to that SW Fe along the rear of the property that goes along there which just in drainage condition um in the review letter uh had a half% sale since scanners address that now 2% s we don't need that proposing landscaping and [Music] lighting sign some Associated close so you would ask for that later there's a few wers with just the location of the parking lot basically maintaining where the parking lot is now which is 10 ft 15 ft required question about the wooded area wooded that is not main Tre maintain maintain there system as well gas is available gas line [Music] straight so um I advertised for several waivers and um varant that identifi initial review letter um and I want to go through those with you so that you can give a little bit of testimony about them and so the board will know exactly how many Vari beinged so we have a variance from desting a loading zone on the property yeah we're asking that Varian just for the general use facility there's no additional area for any come in with be more [Music] okay then we have the variance from theard buffer if that even applies which again we felt that it didn't because we're open a commercial Bill we have a variance to permit the exal sign set back of Ft or 10 ft is required then we have the design waiver Sy that sidewalks along the road we discuss [Music] that Reed and he gave testimony [Music] that noed parking lot set back from Bel to drive of 10 ft or 15 ft was required about you know how that came for existing parking now using some of it and [Music] replacing and that's given us enough room to put the desire side building F and maintain so this we're not creating this Condition it's already just in condition okay um no outside dumpster area yeah the um property doesn't uh generate on basis foran service okay and then uh you have designed two trees in the parking lot with three are required change that or yeah [Music] we're say that again yeah there's there's three based on the number of parking square foot of Pur area we needed we short one Stree parking area we're find a spot then we have asked for waiver of providing upper screen to theint residential use that's over here we are providing shade trees in this area some Landscaping um we have about uh 55 ft of green space in between Systema back of the building this area is really yard we weren't proposing anything in that area then um okay the last one is we I just have a quick question just to go back to um there was some talk about the sidewalk I know that you said you partially that can you just tell me about that yeah so the do require however [Music] provide can you also give me a clarification when I looked at I I didn't I don't remember seeing it you testified that across the rear there is mature buffer there but then in questioning there wasn't some what just is it half across the back but not all the way out to Woodland not there across the back this there are some trees here buffer L Landscaping in this area here got it so is open to [Music] maybe I I misunderstood you earlier I I thought there was mature buffering existing cross back I actually have a question since we're on this topic so I know I had mentioned this to you previously where you have your system set the system located is that able to be relocated should a buer be recommended is a construction so we cance the the building to about 20 now there is a little bit room to move we need to be no more than 10 this SE system is more in the rear you could probably slide it mly farm and provide something from this area know take that sight line away from well okay anything else I'll bring up um just to compl with This Thread about the next door neighor here um we have we did submit um very basic architectural uh plans with this I want to say and you if you look at the elevations of the buildings what what we would be looking at is the Eastern elevation is what faces that house there um and based on the plans that you submitted um are are you going to have kind of Windows or any visibility into people's backyard from the people that are in the building so I I'll I'll note for the record that the building back there has no windows um showing so if we're worried about hearing into people's backyards um there's no parking on that side of the building so there's no reason people be walking here up there and there's no windows on the how about lighting you're going to operate 24 hours L CL yes um so our business will be open you have some lighting uh in interior of the building and front but not not a lot just enough to get yeah so no windows in the back so the lights won't affect any of the take me uh take me at 2:00 in the morning coming out on the Woodland the headlights coming out of the parking lot across the street is there a resident there I believe there is something that lines up you can go out on Del too you Del our suggest maybe we would give these any lights in this area and drive unless you're coming I think it's more more an issue of an exit 2 at night you know 2 in the morning so maybe it should be a one way only only an entrance well yeah I see headlights 2: in the morning being an issue in somebody's window that's why I ask how many people do you normally have very little May to remember that LE sometimes none yeah but you know you know people are I mean one one person that person has to live there and not they don't want to see lights topic of Lights in people's front yards um I noticed on the the Landscaping plan there's nothing shown running dely Drive which I believe it's a residential property directly across the street is that correct remember it's a long driveway Drive I think go back to the traffic that a traffic okay traffic yeah I think corn by I I think this is just open with d were there any comments received regarding head Lake Lair going out State high still on the topic of the building EXC me hate to keep interrupting you um just I know our professionals had commented on the the metal panels and please that's right so um Township hasin standard and uh um generally it's not favored to have pre metal panels or room of s for the building exterior so what was your thought process in using this this exterior I think it me personally I think it looks good um and that's what they offer me to that yeah the new the new thing yeah exactly we add windows on the front side so more windows than what is shown on the P that was submitted no oh the three windows they're already on the a door a glass door double door glass door so window since you're since you're up here I think you touched upon how many people you'd have overnight what is your expected traffic during you know during your 247 operation daily um like currently we have like probably throughout the day like 30 to 50 members possibly you know I hopefully we can row more than that now out why it's not at the same time yeah it's not the same that's it's throughout the day and how many employees do you typically have on site I'm the only employee and then my dad there okay so it's it's one so basically one person Manning the the place two two people okay oh I didn't know if you're going to split between the two look you said you have one Clayton get that location to frankville so um you know in general but now I want to just talk about the you know the legal truths for granting the variances you to take a look at what is this doing for the community this is a beneficial use to the community to have a gy community um and there people to come and exercise and you all want to have you know healthy residen toship so I would suggest that um this is the perfect space for it it's a commercial Zone and that activity is appropriate for that space um any any perceived detriment from this being there a commercial business and a commercial Zone um I think are outweighed by the benefits to the community from having it there and that would be uh the justification that we receiv for approving Varian and I will just want by one thing the review letter I think is acting is the review use Woodland Avenue as the front yard but we've used ELC drive as the front yard this is the major Road Woodland Avenue toship Road the entrance is on is facing dely drive and so any commentary that would be made to what the front yard of side yard we dely drive B of the front yard side yard to M yeah and do you have any comment on that uh so Chris uh I'll allow Bobby noted in here um that that he noted there was also front of some all we'll wait till we go over to report go you good yes sir all right good uh before I open it up to the public uh do board members have any questions uh or you want to wait to after the engineer's report um I I have a couple questions and then I'll wait until the engineers for some other um comments that I would like to see on the plan but with the no loading zone if if that um waiver is approved in the no dumpster area if that gets approved is that um just for this use so in other words what I'm saying is if the the bunker closes up and somebody else wants to use this property for some other use um do these waivers apply to the subsequent use or only this just this use I would it would only apply for this use okay come back have to come back in front the Zoning for use change and and then at that point they would have jurisdiction because now you're bringing a tractor trailer in and a in and that's so as long as the uh the testimony for for the type of building uh other waivers okay I have a question that the backyard I guess by septic how close is the house to that property there a house back there I mean house front right sorry there is a house right [Music] behind in the car behind that they have it appears they have Woods right behind that they have like some mature trees behind their actual house but their side yard yeah but their side yard is wide open to to see into [Music] the just follows that okay who will uh anybody else question all right the uh at this time we'll open it up to the public and then we'll go over our Engineers report north is it my misinterpretation that is also Z Highway commercial as presing that here yeah Del Drive the First 200t on other side R Highway commercial so even though using it f I'm not sure where you're getting the 200 ft but actually on the that it identifies there 365 ft so it's an additional benici um well I know we've discussed these these before um and I think you generally know what my opinion on it is but just I you know uh recall the board's um attention to an application that was here on Dollar General where the board already made a determination that these buffers are not technical the one comment I did want to touch upon um is a circulation plan for the the fire truck circulation have you guys developed a plan yet for that do you have one available to show for we we can okay now I this this is with in your revision which I don't think we've gotten the copy of yet that's correct okay um when you do provide that um should through the ethicus be approved you provided of larg scale sets so we can see it um separately getting back to the the question of whether or not the entrance/exit on Woodland would be a one way how would that impact set circulation um that's that's kind of curios um you they can negotiate either way oh I'm not worried about them traveling Direction I'm just talking about their ability to actually you know not be driving the landscaping and Stu of that [Music] nature um since since I know we spoke about it previously but did did you agree to address all of our comments in here and you was providing the the same to our office I have no further questions at this time um Bobby I think uh we should touch upon the the question about the buffer uh I believe it there an apply also in this particular case Bob pull your would not uh really be applicable as the ordinance stands current uh to date um there was a question um brought up by one of the members um Mr Trav Leone uh because there was a ordinance passed in 2020 uh which was after uh the the ordinance that we have now um which which um and you know encouraged uh agricultural Farm use in every Zone um but our our ordinances have not U changed to accommodate that um if it were to apply here it would only apply for 50 book offer um but again as the ordinance stands right now it doesn't technically apply given the the UN zoning that we're in thank you good all right oh you anything else uh I have nothing else to thank you all right okay back to the board um like to kind tree we want um I would like we have a tree we have a tree expert here so everybody turns to noon first shot I agree with with Jake I I would like to see a tree line on Woodland and along the back uh property L as well no no the back the back lot right so so that the the neighbor's property is know he's blocked out and then uh then from the driveway to delce there's nothing something there pull out though you're not going to be able to see alling traffic when you're pulling out of there that's what we have on Main and FL they couldn't plant that stuff you could have some lo you could have some load growing trouble you have something yeah I I think the question the question I have gets back to the septic are you able to relocate the septic over there I know the wells supposed over there can that all be reconfigured move the well around um this is the area set system here other wells in the area this is really spot the the reason I'm asking is we've had this discussion previously um I don't know if you guys recall it was two years ago now there's an application that was going to put in trees um adjacent to the to their septic but they couldn't meet the setback requirements set forth by the county and I think a fence was was recommended what is the what is it is the 10 10 ft 10t so so you so you would have the tree line stop before the septic field and then put a fence the question I'm I have is the the adjacent well is in the front yard you said I believe so yeah so you can't basically rotate that field 90° to sit behind there because you have mature trees there and then there's solution would be provide scen something that something something something protect that house to buffer that house and then we decided we um do we want to see that uh that driveway to Woodland be an exit only or I'm sorry an entrance only yeah I I mean I think we're getting out I don't think there's that much traffic think it's going to be there yeah know I mean you can probably talk to people not to actually out there at night time or whatever know it's still in the morning but I just don't think the you know he says there's 40 to 50 60 people a day that's the day yeah and I think I bet you what's your highest usage time morning early morning uh traic I don't think there's much benefit got parking Fs in the front unless you if you go there to come out of there and head down towards the center of town center of Frank bille you're screwed no matter what ex you come going set up maybe sign no no exit from 6:00 p.m. to 6:00 [Music] a.m. yeah [Music] compromised exit what time did you Rec 600 p.m. to 6:00 a.m. what I to doesn't exist be fine with what though I'm sorry yeah we got enough of that we don't really need we' both been doing this way too long that neighborh uh they would have they would have had to be it
