for Crestwood Drive this is just basically a determination change from N1 I mean from N2 to N1 so um someone like to make a motion to approve the no uh the N1 uh determination for Crestwood Drive as opposed to N2 someone to second that motion all in favor I'm going to sign that he's going to do it and give it right to you before you leave while you're while we're signing this while you're going I'll just talk the sludge landfill um Justin is going out to meet with DW on site tomorrow to kind of go over the sludge of infill uh plan and options and plans so it's more of a just a a process meeting uh tomorrow and he'll give us an update on the 27th meeting um also we're just going to keep it moving under old business the 170 mil Street Justin's been going out there keeping an eye on everything he has met with the property owner on site and um without getting into too many details right now it's something like to make a motion to continue to the 127 meeting second all in favor all half was I was surprised thing and there was some I I just bought the house and I didn't know that anything about stuff like that and there was couple trees that like it was it wasn't in the best shape so I just took it on myself on account and then uh they contacted me and we resolved the thing and did everything right and we made me uh PL some yeah yeah so like my thing already well you should know what we're up against it's it's very like it's similar but it's not the same so I came just like you know to let him understand some terms and stuff like that yeah so what what's the purpose of cutting all those trees down what was it for had that one of the spot so yeah but okay I was going to stop right there here's your before right that's before and this is after that's not a couple of trees so it went from there he's not he's not here to fight yeah I know just here to just you know see how we want to make it right you know and how we can so I guess with all the damage already done right the only thing I can say is we get another engineer in here a third party engineer probably someone you probably to do something similar yes I I I Ed that lady from oh yeah yeah I know you talking about good resource she knows her process she very well knowled you know and it was for bothies work so if you guys U don't mind we can use her to so I I would ask her for proposal to or her ideas on how to rectify the situation and then come before us with a plan that she thinks would rectify the situation because what I think is all the trees that came out of the vegetated Wetlands or anything under our jurisdiction all need to be replanted around the house I get it you know it's out of our jurisdiction you have a right to cut those trees down if they're going to cause damage to your property if they're in Wetlands they'd come before us normally and say hey we want to take these trees down they have a blight or they have rot or whatever and then we'd say okay we understand and uh we'd work together on which trees could come down and which need to stay because when you go open this up um when you're barding vegetated wetlands are near wet or just regular Wetlands straight up um when you cut these trees down the wetlands dry up and that Wetlands is a filter to our drinking water and our environment and when you cut that down and it dries up we lose that we don't get it ever back we're trying to rectify that right away so unless the commission has anything else she will I think she for a week yeah well just talk to her and tell her that we need to plan out we need a planting plan to rectify the situation and then have her come before us that's pretty much what she did y y this is pretty big so if we don't like her presentation we're going to ask you to go to get somebody else we'll give you a couple options try to work with you on it go ahead make sure you keep the inform what's going on like communication what your muscle over here that's the sun okay well I was just going to say I think some of the stuff has actually been kind of moved and piled in the wetlands to yeah well I didn't want yeah so I didn't want to say go ahead and get it out of there yeah no I'm just saying that would be part of the plan no if anything so part of the plan is cleaning up to no because over there didn't yes the plan will include clean up right doesn't mean clean up now yeah don't do it don't do anything else okay so she needs to tell you where the Wetland boundaries are she needs to flag those and then she'll put it on a plan something similar to this to this she'll put on a plan a plot plan and it'll show the wetlands boundaries and then it'll show where the damage was done and then we'll go in and say okay now give us a plan to rectify the damage planting how to maintain those plants those trees till they come back up again and she'll tell us how much damage he's already caused to the wildlands all right when do you think you'll be ready to talk to us with that plan our next meeting is on the 27th yeah do you think she'll be have something or do you want to push it even farther that's okay all right if you need filed by James is it appeal Pia how do youon Appel thank you the project is located at 125 snake Pond Road Garder for proposed tree removal and is set to occur within the buffer zone of a bordering veget to Wetland why don't you come on up and talk about your project off how you doing so why don't you just talk about your project and what the plan is what you're proposing and Y why you want to get a tree down because it makes your yard unusable how many how many years have you lived at the property wind yeah have you had any expert look at these trees to see what the health is so you want them down down because they trees drop branches which they're known to do I mean you got to understand where we coming from you're right on the bo right on the edge of a pond which those trees block the sun which means the water temperatures are somewhat consistent in that area so when you take those trees down you're actually heating the water temperatures up which creates an allergy in bacteria that's why it's important to have trees are on ponds but you're asking me to take trees down in my jurisdiction because the trees that branches come down are you the applicant no right okay just make trees are you looking to take down yeah that whole batch just so do these trees split your property line they're all on your side I mean I don't I'm not a tree expert but I happen to know one and they don't look unhealthy to me anybody have an opinion on that look good to me I mean I don't see a need just to take trees down because they're a nuisance to stuff falling down um if they have were unhealthy and had unhealthy branches that could potentially harm somebody then that would be a little different in my mind but I don't see anything wrong with these trees let me see that bigger picture you see anything David I mean no I mean so the question is [Music] whether well that's where I was going with the branches yes I was wondering maybe could prune thing I recommend you get an arborist somebody that's certified to come out there and take a look at these trees identify if they're healthy and identify what they could do pruning wise and then send what you guys come up with back to Justin we a look at it I just can't sit there and go yeah cut your trees down because every there's trees everywhere well that's why I'm saying get an arborous tree there could be a tree that could fall right now and hit somebody just walking that's why I'm saying get an arborous they may say come in and say yeah there's a rot in a blight in the tree and that that would help the cause of us allowing you to cut trees down I understand it's a safety thing but again that that could happen anywhere so um they are close this your deck right here on that okay so we'll um we'll continue this for now just to be fair but get someone to go out there and take a look there's plenty of arur around if they agree and they come back and say there we can room the heck out of these things um then than making a note about the weapons on flags TI blue flags next to it had a little site visit with a few members of the Conservation Commission um and came in to see you guys um basically it's a driveway job that's in the buffer zone and slightly into the no structure and just a little bit into the no by 10 and I think we because there were Alternatives that I presented the last time around 2020 hoping you'll do it again seem like I did have a comment about having data sheets to back up we uh uh delineation so I did have Mar Ando go out there and she did a little analys oh you just had them sitting here you might have put them away yeah go ahead I can't I I didn't specify theidea the drainages works so that you know whether it's pav or it's gravel I've got a BM on one side that was able to make that work with the same square footage house so he wouldn't be losing any house and I can if I tuck it so that it's 49 F feet from that property line and I can beat 60.2 ft from the Wetland on one of the corners and 60.5 on the other corner and we' be proposing a concrete patio in that blank space of the AL um with the driveway on the left side of the house why do you need the concrete patio I mean I mean you're in you're so close to to making it right and then you go and put a patio where it says no build we just we were I was on assumption that that was allowed is on the definition of structure your ordinance in reference to the no build Zone structure shut out includ Fen raining walls deck paes got our jurisdiction does it have to be concrete part do something else uh that's what Bo something on you know what I mean like like Crush stone or something that has some infiltration or unless you guys think of something different I mean he's done a great job I mean let's just be real on this Justin what are your thoughts on that pad I know we've done this a million times I think I think given purpose I I would say that it's I think just means standards the patio is further away than the mobile home was yeah yeah I can see the orientation why not have concrete because it's right across right in the middle of where it says no build so I'm just trying to that's that's what I mean I'm trying to come up with another way of can you do a patio in this area and then put like stepping stones in the area that's no build or something that can infate some water large cracks or breaks in the in the trail um upon the conclusion of our last held meeting we were able to meet with representatives from the consultant and the contract trctor to go walk the path to go look at potential problem areas or areas that could pose future concern where we did make note of those cacks and the consultant and contractor assured that we would um they would fix it um come spring when they're able to apply the top coat for the trail um we also marked certain areas that could both potential risk for wash outs um if left unchecked and um and under um recommendation they put a thin layer fabric over some of those problem areas in order to stable over the wet season so yeah can you let us know what's been funds have been paid or released to the work to date so we're gonna I'm G to ask for um scheduled values and what percentages are left on each one of those line items specifically payment I don't know how they broke down their payment request structure like to
