too so move is approved uh the next is the notice vent for 68 Acadia Road the garden Conservation Commission will hold joint public hearing under mzl 131 section 40 Wetland protection act and city of garden ofland protect ordinance on a notice of intent filed by G engineering half of Ro C in for the construction of a single family home at 68 Acadia Road this is a continuance from 9924 and also so 923 and the applicant has requested an extension to 1125 some to make that motion make that motion someone the second that motion second all in favor I some move is approved to the 25th next on the agenda is 143 let's make that let's what's weit on that one 143 short ride 143 Colony Road The Garden of Conservation Commission will hold a joint public hearing on under NGL 131 section 40 the Wetland protection act the city of Garder no 10 followed by allpurpose storage Gardner LLC represented by Christopher guda Fieldstone land consultants for work and parcel ID x22 1316 8 through 14 and 9 through 18 at 143 col Road the project entails extension of existance storage facilities including seven storage containers four of which are located within the buffer zon of the boarding vegetated white land this is D 16664 and also has a violation enforcement order which is a continu from September 25 how you doing oh good good to see again yeah uh for the record we did make a site visit on was it Tuesday THS last Thursday last Thursday gosh uh everything looked really good out there so I I appreciate you hanging in there uh I know that you walked into some things you weren't you know aware of as we were not aware of and um you presented to us and tried to come up with a good plan to fix it to remediate replicate replant grading and um it looks really good so I just thank you for hanging in there if you could extend that to the owners yeah absolutely um and we we do appreciate it and you want to just talk about what you guys did how much you took out so the record can okay so based upon uh the sidewalk and just discussions with the contractors who were on site it's estimated about 12200 cubic yards of asphalt millings were removed from the Wetland buffer the 17700 Ft of Whitland impact was removed entirely down to Native soils was receded with the Wetland plant mix the buffer areas that were restored were planted with New England conservation mix um is there a difference between the con mix and the land mix yes um and on that restoration plan the actual species are all called out so it's about 30 different species um I talked with uh one of the employees from W plants down in Hadley yeah and um said some of that seed actually does need to freeze before it's viable um but based upon our discussions on site the plan is to have a two growing season monitoring program to ensure viability okay um and then I believe we had also talked about um securing uh the areas in some other fashion um than what has been presented on the plan so something like a split rail fence over yeah so just what people weren't there when we were talking about it when you come down the little ramp to the lower lot we're talking about he's got um almost like a silt sock around where the white lands buffer line is and for the future we're thinking about having a split rail fence or some type of designation I know a lot of areas we were putting big boulders but I think that would probably cause an issue and over time get plowed into the white land so maybe some fencing along that areas would be good maybe maybe a little plaque on there why plaque on the posts and certainly yeah um we did that something similar to that over at nature trail right yeah I think so yeah so maybe you can give them a picture of that to show them what we're looking for um but it does look good like I said appreciate what you guys have done out there picked all the trash up got the the barriers out um all those campers that didn't belong there in the first place and I removed them so I appreciate that and what else so going forward what is the plan and what's the timeline this is approved So the plan is to remove the rest of the outdoor storage that's up above in that section um so there's to be no outdoor storage of vehicles or anything associated with this it's going to be all controlled site access with individually leased lockers or units um previously what had happened was people had outdoor storage they stopped paying but whatever they had was just left there under the new ownership if once their lease is broken then the units would be empti auctioned and put up for somebody who's going to continue to pay the lease can you just hold that up and talk about where the wetlands lines are it's all been previously Disturbed so you we all aware that we're aware of that but talk about the potential plan going forward so right here this is the utility easement that comes through um there's Wetlands that come down this is pretty steep grassy slope that comes down with some shrubs that have grown in uh so this Wetland comes here and then it follows the topography and wraps around similarly over here continued on the other side of um that utility easement there's additional Wetlands um which is actually um a little bit more developed in terms of uh plant life you have actually U like Cattails and things like that that have rooted and it's very very clearly Wetlands sit over here I think you've also had some expansion of the wetlands based upon poor drainage at the site and directing storm water flows directly to the wetlands the plan going forward is to upgrade all the drainage on site to make it all closed drainage curbing to capture any storm water runoff that doesn't just exit the pavement area and then is all to be treated um in a underground chamber system here and then the rest of the storm water will go to a uh Pond that is to be created outside of the 60t buffer what's the timeline so as of right now I believe the plan would be in the spring um and we would coordinate that we're talking about if you need a we probably need a newer updated plan of what you want to do now that everything's kind of been cleaned up show what you believe now the white lands delineation lines the 30 the 60 um and just to kind of show where those two proposed areas are going that are going to be constructed that almost fall outside of those zones now correct um so in addition to that we can show the split rail fence and have construction details for how those are to be installed yeah um so I guess just to kind of review what we had looked at too because portions of the buffer that were restored we had previously proposed additional plantings in there and I think it would still be a good idea to self those areas with larger Nursery stock okay I like that um and we've targeted pollinator and uh fru and species for those now there's going be a lot of sun there though right doesn't get much shap morning son that's it it depends which side you're on there's some shading okay good all right so you're going to come back before us when do you want to continue this how long time can we go the next meeting would be that'd and then um because this slot is part of a larger subdivision the applicant should con that a stor management plan those proposed being constructed with the overall development um if there's no storm War management plan for the deel can should demonstrate that for on these laws meets the Massachusetts St water standards I got a question is this question just look at or we have to sign on the same way uh that's for Vie yeah I have the okay yeah so I believe you guys have a St water plan already out there we do I remember doing that we do have you uh had any logs you can share with the applicability followed by Matt Marl environmental Consulting on behalf of Mark null the proposed project is located at 572 Betty Spring Road and is for the installation of utility poles with a portion of the work occurring within River Front area how are you today good how are you good card um here guys have some C all right the white points of the trouble make sure they were made up pretty nice so think all right thanks guys so hopefully this will be really pretty simple um I had extra copies made of the rendering that I put in um essentially it is an RDA for the placement of a telephone pole within the very outer skirts of the River Front um the reason for the RDA is because a telephone pole is basically a one- day job um it's on the side of the road the river is actually across the street on Betty spring so 572 Betty spring owned by Mr null Mr null lives at 572 Betty spring there is a lot right next to it that has a gravel drive it's getting partially grown over that goes up to the lot there a telephone pole that's going to be out of jurisdiction that goes up top and one on the bottom going in and then the wire will connect to the telephone pole that's already existing across the street this is for a new electrical service this is for a new electrical service to the lot okay who owns the polls um it will be National Grid both of them both of them okay so they'll do the install they'll do the install they're basically they were just waiting for you know commission approval so I went out I assessed the area did the RDA um did an analysis of the riverfront I mean the telephone poll essentially is going to wind up taking maybe less than 1% of the riverfront so that's basically it one day job if you want some maros protection we can National br they usually do it anyway yeah now there PO on that side of the road too already there no there may be but this particular pole cuz I really PID attention to that there's a pole existing across the street with a with a perennial stream is so they're going to connect to that pole put two new poles here okay in fact I believe when we were out we saw the existing po right from what I saw all the poles Ser serving that area on that other side the whole way so this would just be Crossing it to accommodate this there's no other way to get power to the law I think we talked about this the last time not from the looks of what I see out there and knowing how National gri would Operate Now CU in order to do everything there is above ground in order to do anything underground they'd actually have to go under the road which means they'd have to get either the city or do involved or both yeah um it would be a monument and actually would be create a lot more work in the right paring more it would be closer to the brook yeah I think we ever had something like no we've talked about this one a while ago yeah yeah yeah I mean you know it is in the repairing Zone even though it's just on the outskirts of the repairing zone so it is within your jurisdiction so there should be at least the determination just to memorialize the work so that you guys have a record of it they're going to they're going to drill all right uh thank you uh the next one is a request for Project Extension for D60 0622 which is Kings are solar Drive solar project anybody here to represent yes on how you doing your name is get up Al for kick so you guys took this over from Fred right correct yeah so um Fred typically develops projects we we have a relationship with him we're based in Allon Massachusetts um purearts owns and operates about 275 megawatt megawatt hours of project so we have um upwards of 80 um either operating or in development and um we're we're local buers so we we own and operate over the lifetime of the projects and fredly develops them to start and then we would purchase them um and we've done that uh with him in the past so we have a relationship with Fred and we've since acquired it um and you may you may received the letter um I submitted I believe it was two weeks ago or it was last week um basically just describing right now the projects in study there's not a whole lot to report on anything no work's been done out there um it sits with National Grid under review at the moment um there's a group study and given the large number of projects in the group area um it's a pretty detailed review um and I believe I quoted since November 2022 it's been under review to be approved by the dpu the the previous group study this project is waiting for the next group study to queue up uh and for that reason we've just been sitting in the queue waiting for National gr to review um and we we can't interconnect the project or really proceed without knowing what the costs are um that National Good Will repres us and that's why we're here today to uh extend given the expiration dates coming up in December 2024 for so my question was um our side of it I don't remember kage being on our do in our documents I thought it was who Fred represented so do we need to get new paperwork going I I believe so I think we just need a new applicant name on the next extension if I understand correctly yeah I think we I think I've done that what's what's the time framea for time frame uh so so it's basically comes down to when National Group finishes so the dpu has been reviewing the previous group study for about two years now they could come any day it's very hard to tell when they're going to predict what they're going to do next um but say they were to approve it tomorrow it could be the same process all over again with our group study which could easily take two three years you know plus so um so have you read the filing previously the application yeah yeah I've seen the pre we have copies of the prev too I know we had some a lot of stuff in there about cleanup you recall all that yeah get a lot of work for us already cleaning it but there was more agreements on some of that area yep yes I think we've we've investigated that with uh a firm GC that we've looked we worked with in the past so um everything would be in compliance with all all clean up and before we begin any work we have I want to say 70 megawatts worth the projects on landfills and Brownfield so it's kind of our specialty and there's there's demand for it in the state cuz you're not really going to be able to do anything else with the land so we a lot of experience with that yeah yeah now do you want the one on M Street the one on Mill Street uh no no this would be our first in town but we have uh nearby towns we have one in uh a I guess is someone did that one on Hill Street yeah where's the one in a um it's uh I can't think of the address off the top of my head I apologize um yeah AEL sh Shirley there and um another development in Westminster uh off of Spring Street uh that hasn't been built yet but a lot of focus in this area y yeah so you're looking for an extension I I mean I think we house is outside jurisdiction from the nearby Pond um and any that was done after the development process has been outside of our jurisdiction um so they're just looking to see if if the lot can be released from theing you're in favor with of the certificate um support from what I observed um I don't think there would be anything that would complicated if the commission were to accept did you drive by there I did drive okay what were the conditions that needed to be cuz there's language on there about replication on the on one of the Lots I don't know if it's that lot yeah I don't know if it's that lot though but it's not clear it isn't that did you see anything at all on our fil I didn't know yeah I didn't seemen looking for that specific yeah something that old too was very was a brook right behind it was it no not not not Brook okay Pond Pond yeah be 99 yeah yeah I only asked because there's a few things on that document for 30 years one of them was replication yeah four motion I'll make that motion second all favor we've already voted on it CU there was an emergency but want to make sure we get any update on it uh Bieber J has been removed thing and they're monitoring for you know they track yeah keep going does it either be a deceiver or do not you can't really put one there um I think we'll have to talk with the DP and the board of Heth about longterm um solutions to that cu this particular breach there wasn't removal of the AC all thing so there is the chance that eventually it might look back back yeah all right next on the agenda is the enforcement order on the sludge lenfield Justin can you kind of give us a rundown on that one second so you guys see this uh yep I got a C thank you I never see the side if you guys get it or not so yeah I run public so a few weeks ago um I got contacted by the director our DPW state that they received a letter from a DP inspector um out of out of their central office um indicating that there was um a complaint of a sent deposition um on the outlet of their stor Mar system and um upon learning of this they notified me forwarded the letter and we went out to conduct a site visit um mirroring that there was one self deposition a couple years beforehand um this one was a lot lesser in size um but it's still occurred due to over inundation and age of the bmps that were already in place um DP had advised the agent that the best course of action was to write an enforcement order in the context of a work order to make sure that we act quickly and effectively to make sure that it gets clean up as of today the sediment has been removed the check dams have been replaced the soil has been cleaned and um it was written on the enforcement order that um any major maintenance towards the outlet or major modifications should be run by us or long-term CLI should be run by us in order to evaluate for so who maintains it right now um I it's theola and they don't have representative here well I think they should be so I want them to come before us and talk about it and and figure out like what's the maintenance plans been that's been done and how they answered this I know that you sent some stuff out to us but they should coming before us does everybody agree with that and I agree they I checked my records from before I mean I have pictures in 2020 of the same thing happening in the same spot too yeah so what's the deal yeah so that's why they should be here I have pictur the same place yeah big S I thought it was down a little bit more but like what's the deal yeah I mean what's causing it I go ahead I mean it's lack of Maintenance it's yeah it's potentially lack of lack of constant change that could be that could be a Christ yeah yeah we at least for now the action is the potential this and I I can also make the action to talk with um both DPW I should be able to get repr presentation from all if we have questions well I think we put it on hold until they come out in the 25th yeah yeah I did too I I agree I mean they haven't been in front of us in a while and it's happening in the same spot and we just want to make sure the maintenance is done it could be something else something else could happen we don't know but we'd like a full explanation of it and um representation should have already been here they should not show so I mean why do they feel that they don't have to be here when they have an a force mot I mean Ken's driving an hour and 20 minutes to get here one way for 13 minutes in front of us so let's put this on hold until the 25th of what I wanted I want them to fix it and if we stop work they can't fix it that's what we did with Ken completely fixed I know they cleaned it up let me see it what does it say on there yeah it's the green lighting for the work or for a c what was allowed to be done under that is the repair is allow the light repair measures and the um and the corrective action to remove the actual silk stuff like anything that's you know restorative or anything that's more take more than clean up more than cleanup should be brought to us so nothing's been done so far no main done since the last time well ask so erosion controls have been replaced the sil that was deposited outside has been removed and the check dams have been also repaired and the and the Swale has also been cleaned the Swale that comes before the outlet so a lot a lot of that has already been done I think we should meet with them again before we do anything I I agree with you d s confus and why we need to sign off what stop yeah well that saying the biggest question the restoration plan shall be filed with the issuance with the issuing authority on number 4 1028 so where's where's their plan have from the last time well they made a they said an attached page but this this says the violation information the findings but this is on them right then the order Associated priers were work to adhere to recommendations of the D by utilizing least impactful methods such as the use of hand tools should be used in the removal of sediment see I don't I don't know what I'm saying yeah tell want to talk to about replacement of the old silk fence and erosion control measur shall occur within spone water Sr in the area impa of impact Associated parties well the other Associated parties right who wrote this I did you wrote that for them I wrote that for them to to do what they had to do yeah for DP recommendation yeah I know as for the DP recommendation and it also mirrors the past enforcement order that was done it's did informally um yeah was really worthwhile yeah what's your biggest takeaway uh some towns are more proactive than we are I'm right cuz usually we get the opposite yeah where you were one of the most active in the state no I know that I know that uh no I mean like going out and holding birthdays and garlic P garlic mustard ping and and uh other different things okay yeah we used to do a lot of that and we had we used to do all kind of plantings uh somebody um maybe uh has uh regulation for what any landscaper in the town can use plants that any landscaper can use in the town even out of the biodiversity goals who was presented by mass Aon and they kind of talked about how to look at long-term um Restorations projects and also some of having a open thought discussion as to some of the hurdles that communities or applicants largely see when they're dealing with those types of projects you know and I think some of the most common ones are um consistency um capacity and funding and you know sometimes even the even the permits I mean you know as we've seen a lot of permits you know some some of them can be daunting and so are some of the time ons with the applying for them and lining them up with uh with some you know potential grants that you might actually be going for in order to help fund important projects so oh great did term he used was the corporation was inactive it's it's a carcinogen yeah yeah and it was found in four of the monitoring Wells and my P which is called sw4 surface water number four 1,200 ft from the property uh the Board of Health is started to address this issue um but uh I I thought I heard mentioned that the concom was was notified or somehow spoken to or have you heard anything on this yes I have you have who someone notified you not personally they notified the mail and I I notified him the auctions the most potent chemical made by man yeah it's a real problem it moves fast through the ground uh I've requested that I've sent a long couple of emails copy D people basically asking that they hire a licensi professional to really look at this thing can see how much is there too well and to develop a contamination pattern uh you know if it's 1,200 ft from the property and this stuff moves through soil very quickly um that they should be doing you know exhausted testing right now the sludge landfill has three test monitoring locations they don't test for one for dioxy I said why don't you have them do that they test whatever the state is I have not been vertified so so I just wanted to make sure where sounds like some of you are well it's all un official want people unofficial through one some need I think they of that ancient AR David what was it used for well by auction to kill weeds like agent orange no this is a different this is actually a different it's it's not dioxin it's diox all right so what was it used for gy uh well it's used in a lot of cleaning chemicals all right so the factories used it then well I'm not sure how much the factories used it but it it it literally could be flushed down your your sinks and your toilets because it's used in a lot of cleaning agents all right so when this thing popped up uh the first question I asked the coom is where is this coming from where is it coming from what's the source of the is it a liner leak at the bottom is it a cal leak at the top they're not even sure it's on they're not sure so right now they're trying to investigate it um I get concerned when when you know we got an enforcement order for material silt material from the Sledge landfill because I asked the question could this be come from the Sledge landfill don't know you don't know don't know so uh just want to make you aware of it it's already been discussed at three Board of Health meetings it's in their minutes it's in their video recordings including tonight's meeting uh they're going to continue to get more information from DP well it's di chain everything I said is on
