here I guess we do folks and welcome to the um planning board for Wednesday January 8 2025 and this is a reorganization of our planning board tonight um so we're going to move fairly quickly through um through the resolutions hopefully and uh we'll get this meeting going so um at this time I would ask uh the everyone here to silence their or or um turn off their cell phones and I'll open the meeting pursuing to the open public meetings law this is State for the record that adequate notice of this meeting has been provided to the public by publication by the Union County Hawk on January 2nd 2025 posting on the B website and by posting on and filing of said notice in the office of a municipal clerk this is a regular meeting of the board um this time I'd like to have a a moment of board for the publications of official notices and as the official newspaper to receive notices for the purpose of the up public meetings act for the year 20125 do want hear a nomination for that resolution I'll make a motion to accept it second I hear a second second second uh yeah all in favor I opposed one motion uh resolution carries um at that this point we'll move on to resolution pb-5 that's a resolution reopt the rules and regulations forms and procedures of the G planning board and they were sent electronically actually I have a question about this one Mr chairman I don't know is this a read-option or was it an adoption of a new version of this I think there were some minor changes that we did I think it's a motion potentially to adopt the rules and regulations as amended Circ resolution adopting the following dates as a designated meetings dates for the planning board for 2025 all meetings will be held in person at barl Hall and virtually via Zoom video beginning at 7:30 p.m. remote meeting access information will be available on the B website and there's a slight change to that uh January 28th it's January 22nd which was sent out to everyone as an amendment to that if we can keep track of the recommendations that we make during the year changes or for you know zoning changes or any other changes that we make so we have a better handle on what we're um passing on discussion items which is towards the end um on the second page says review of the final draft of developers assistant package with proposed revisions Incorporated with recommendation to the governing about possibly making some changes to our code in terms of um allowable businesses there's um some that come across uh to B Hall in terms of uh body piercing tattooing um of that nature and I just think we need to clarify it in our code um you know I I'm certainly all for allowing these businesses and I I think it we list some we don't list others I just think the code overall needs to be looked at so if with your permission if we can go ahead and and do that yeah we can um we can draft up something um along those lines and maybe present it on 22nd at that meeting yes good okay one one question Mr chairman if I through the time frame we don't but um I mean then later I've actually asked um Community Development to hold off on the ordinances that we were looking at from you before just thinking if we could do it all at once if we're adjusting the code for you know that section we can might make sense to do it all at once so we're holding off on those recommendations until this then you're you're going to look at that yeah bills we look at that okay so um Bill and Kathy will'll be uh will'll be reviewing that and drafting up a draft ordinance for that mayor to to give to the mayor yeah and that'll be presented on the 22nd that's why I think it's that's right and we' need we' need some Board of Health fees for that as well so there's a couple of things we need to take a look at yeah so you should be reviewing that as well then okay we okay great yeah you know we should look at that again because that's good for business you know sometime you know things things that are in there now or not um like a a nonuse now this was done you know 25 30 years ago there's regulations now the Board of Health is involved and it's good for business to have another business like a uh small business but there are small businesses that's up in not challenged by us we get we must to finish oh I know and yet they're all doing well so EXA so there's andus a lot of start business and and and servic so we should think about have and don't we have a limit on our restaurants 15 right yeah there 15 I don't see yeah GB CC yeah although those everybody you know's I love aboutness fa for stop for lunch I do see those people but I also any further discussion Steve yeah Steve just one point um Steve move your mic a little closer yeah I was just doing that so the developers assistant package which under Cathy's great leadership we put together she did the flowchart so applicants know step by step what the process is and we've been talking about it stops a little short of the end and letting them know that they have to emerge with a set of plans that our Consultants agree as all the changes required by the planning board in in the hearings uh might be subject to some permits at least the plans are right and those are the plans that go to granford so at the next meeting I will have something yes um based it upon your um email to me right I will put it like in the application package exactly um I have to find out you know where I'm going to put it without messing up four pages well at the end at the end close to but also looking at looking at the flowchart that's in there and putting it on a flowchart you know you know these are the steps and if you get approved but there's changes then you got to need you know then you got to do this I figure that out before the 22nd I mean my experience uh which I've shared with Kathy and Steve is that there's eventually you go through the board process there's a resolution revised plans come into the consultant and eventually the consultant tells the the board leadership this plan is right and then there's a sticker attached with signature lines for the chair and secretary which they can sign yeah uh once they're told by the consultant that that's and now we have something that can go to uh so just just as clarification then what what this process says nothing goes before the building department for to the review and the sign off is that what you're saying yes okay um and the reason I bring that up is because I I learned something new actually it was brought up by Adele to me um we we discussed a little bit of that CFO being distributed to some some you know an entity that um that maybe that we thought should not have been issued I understood now that we don't have any jurisdiction of holding up a CFO accepting life and safety is that correct Victor but I can't stop if not been that's what I'm saying yeah they're not supposed to be do because the by Bo and that building is supposed whatever all conditions thees know and that problem I have we have I constru dep right they have to work I sat down build you're not checking they you're not checking if you're not that yeah without okay Mr chairman I was gonna say those exact same words about sending a letter so yeah I'm I'm on board Victor yeah right yeah understood well this this should clarified and and by this this this kickoff of uh of this um ordinance that cath's changing um we should be able to utilize that as a basis for that letter um that generation so so it's got to cover two two different situations one building permit and the second Co may be there so it just don't know and the use has changed a billing permit should not be issued absolutely like because it has to be signed off right by the zoning officer in order to get the building permit because I know I had to do that and and we could put that piece of information in the application package so applicants know right from The Zo very good yeah we could them has no jurisdiction that's where they have a little bit of it's easier to be we and and vict very good point absolutely correct but I guess that does then give us the ability to send a letter to DCA about that construction official I mean I know and you know talk going to result in much but that would give us that ability right is that true I hey you know we can send the letter it's you know we can at least send a letter yeah yeah in 90 days Vic anyway this is coming okay well maybe you know what I would I would ask Don to kind of chime in on this a little bit with Adele and maybe come up with a a a quality letter to send to um franford basically reminding the building inspector do his job correct correct correct okay thank you I got reappointed I'll do a letter Pi up whatever sign off on everybody and I know what this board is I know what's in there and even with that even Frank was leaving but that doesn't happen then the profession walk into building off Victor you're never going to retire been he's going to somay Steve do you have anything that you wna you want to add every okay all right very good Victor you have something that you want to bring up about Kaa and you're going to do some bed items U made reference by uh Mike St correct now the state has now using their population 80% of development M go through this with us well there was a cave at there something okay that's what I want yeah there bring we do have business but um one example is now I don't know if this is legality of this is um letting businesses for residents add a unit there a two families on and I know one particular person two and there's a small use for housing got neighbor said something deficient have parking that would Beed to could we Prejudice the ordinance to give favor to unit that unit may not have lck of parking but to let some of the businesses of North and South Avenue may not have the parking and a unit but it has to it's just an idea response response Victor I have no idea I'm gonna have to Bounce That by my staff do I feel like I've seen that I I've read an article about a a town doing that and they're they implemented this parking fee that they could do they could do that but they if they didn't have enough parking they had to um it was figured out how much and it would go back to the municipality it was sort of to offset it was like a it was a very specific parking situation different question okay you have to get a they least we have to pay AE that okay number municipalities I'm talking about there's a say there's an ex Department above Premier but say was V Space to say the hey that law to a one bedroom with unit we we can be a little requ requirements Mr chairman I I like where you headed I know you probably shocked me to say that but um you know you saw what I recommended to Mike and to the board in terms of where we could potentially put more uh housing and a lot of it is second and third floors of existing uh structures where you do have a commercial use in the first floor I have no problem with that but you're absolutely right then you went into okay look at North Avenue there there's no parking so what are you GNA do so I like the idea I like very much of of advancing a concept to allow second maybe third floor housing and doing something with the affordable housing I kind of think it' be easier if we just don't in parking or it's and I'm going to say something perhaps blastness but right you had going to the same place just don't require parking for affordable units now the nle of that as Council and the mayor know is then they're going to park two two blocks away and so now we're going to be extending our you know resid parking permit program so this is a big discussion okay yeah to suggest something I don't know whether that's free yeah I don't know whether or not you can build affordable units and then somehow not provide appropriate parking for them when you require appropriate parking for all other kinds of uses there may well be and I don't know something in the affordable housing regulations that says you can't build or designate apartments that have substandard parking and let that be your affordable units but you don't do that for everything else now maybe you are allowed to do something like that but I'm not prepared to assume that you are so I would suggest maybe that before we spread a bunch of stuff about that onto the record that we perhaps and Mike may be the person to go to it on on Vic but we we get a little more information about the requirements of those units before we say a bunch of stuff about it and along those lines this is something that we're not going to be able to accomplish um prior to our commitments coming up with this Coop this is something that we can address long term or longer term and and come back because we're not going to we're going to have to project where where possibly put our affordable units but we can change that at a later time we don't have to do this now so what I'm getting at is we need to come up with a game plan on where we're going to fit and I want you to to jump in on this after after I talk um these 80 units um the affordable units and designate the areas that they're going in because we have a a deadline that we have to meet and if we don't um the town is going to incur some some some major difficulties which we don't want to go there um so that up being up front Victor I'd like you to allude to what I just did uh about the 80 as opposed to the 79 and I think Mike mrr brought that up to you well we didn't go know the units we're thinking about the second phase of paper now wants to be residential that would off certain now we're still stuck with 6 right nowes I think life the park lot West West which is not all yeah I I feel like that this that conversation as to where we put it should be that has to be done in the later time yeah because I I know um Mike Str and I've been speaking with him and there's different things that were everybody's been I do to like put it out there because then it becomes yes that's what we're doing and that's not the case yet there is nothing set what I do want to bring to the Forefront and I thought that Michael may have spoken to you about it but I he gave me a call um a little late earlier today and uh remember last at the last meeting we agreed that we would not not approve the 80 but we' approve the 79 units um because we don't have and it's it was based on open space and it's and it was an adjustment Factor by one well speaking with Mike today he's he's he's saying after much discussion that he had with um with legals various legal aspects of various legal parties um involved in lawsuits current lawsuits and um his his um his counterparts in involved in various communities on COA that for us to expend a lot of money and time trying to justify one unit it will not pay for gar to go forward to challenge 80 versus 79 because we will be in the courts and we be caring a lot of money involved with that one unit and it just doesn't make any sense and he admits that he did the research initially and he thought it was possible but after speaking with numerous entities he said it it would definitely not to our benefit to go forward with that I'm saying that we should go forward then and approve the 80 that we we did not approve the last time and as opposed to the 79 now yes just to accept accept right does check and number onep told numbers right State people who G didn't Gras they use Highway open space railroad Depot open space might gave you that advice yeah we can move the we're talking about other areas right now downtown GB while then and I will have to Department that was Department years ago that's why we so with that I'm going to make a motion right now um to accept the DCA uh limit of 80 units affordable housing for Garwood um and go forward with sending that that um that that notification out to DCA on January 31st approving or accepting uh the GCA number of 80 I'll second that motion uh more please mayor blumenstock abstain Miss lysac I councilman Carney abstain chair
