first item on the agenda is a letter of communication from Lee piscatelli retiring from her position as senior register registered environmental health specialist the effective date of her retirement will be June 1st 2025 Lee has been serving Handover Township for 24 years may I please have a motion to accept her letter of retirement so regrets yes all in favor hi accepted her retirement next on the agenda we have the introduction of ordinance number 1-22 and 2-202 I'd like to read the titles into the record ordinance number 1 2025 an ordinance of the township Committee of the township of Handover amending and supplementing section 1254 entitled Recreation Department fees under chapter 25 of the code of the township entitled fees with the inclusion of the new 2025 fees related to various Recreation and park administration department programs and activities in the inclusion of new Resident and non-resident pool membership fees for the year 2025 B Meadow swimming pool season ordinance number 2-22 an ordinance of the township Committee of the township of hover adopting a Redevelopment plan pursuant to njsa 4812 a-7 for property located at block 581 lot 106 commonly known as 85 whiy Road and a portion of lot 103 commonly known as 100 Bear Boulevard in the whippy section of the township all set forth on the tax map of the township of Handover I'd like to stay for the record that the ordinances and their notices of introduction will be published in full in the Daily Record in accordance with law the public hearing is scheduled for February 13th at 8:00 p.m. if any member of the public would like to attend regarding to speak about those ordinances they will be given the opportunity to do so that evening mayor would you like to make any comments yeah I'd like to make a comment about two 20225 yes for all after further consideration and listening to the comments of the public this updated plan comes with some changes there's a contribution from the developer in the amount of $250,000 for certain traffic improvements to assist in facilitating this project there's special needs housing in lie of perhaps family affordable units which means the township is addressing an important need in our community and one of lesser intensity we have addressed the Hanover Township sewage Authority issues so it will not be at any cost to our taxpayers we have a commitment from both beay and the developer not to interfere with the affordable housing process so there will be no additional density or uses on this property other than what is currently proposed when we look at this overall plan versus some of the Alternatives we think Hanover Township has attempted to balance the needs of the community against the risk of sprawl and over inif 5ed development for these reasons I would like to reintroduce this ordinance with these changes with the governing body's consideration now may I have a motion to introduce ordinance numbers 1- 22025 and ordinance 2-202 show move may have a second second on roll call commitment kahill yes commment farasa hi commit man francioli Fred will the planning board have an opportunity to review site plan submission on this before final not before final the planning board looks at the Redevelopment plan just to see if it's consistent with the master plan and then it comes back to the governing body uh what happened tonight is just an introduction right for the Public's benefit then there's a public hearing at a date that uh U Miss de Georg will indicate uh will be the date of the public hearing and at that time then you if you adopt this plan then that would be basically the Zoning for that property the applicant or the develop veler would have to still go to the planning board for site plan approval public notice public would have a right to comment on the site and any concerns whether it be landscaping or you know traffic whatever it might be but that still would go forward if all this were to be approved but this is not a this will not go for site plan review until that ever happens hi committee Melo yes mayor Gallagher hi both ordinances are introduced our next order of business is the approval of resolutions number 37-22 excuse me uh Christa could you indicate the date of the final public hearing for that would that February 13th at 8:00 p.m. okay thank [Music] you I'm sorry um approval of the resolutions 37-22 through 41-22 does any Committee Member have any questions regarding any of those resolutions which one Chris um they're all 37 through 41 on the resolutions yes yeah uh 41 2025 a comment there sure um we're going to enter into a uh special service agreement with a opthalmologist uh we're excited over this particular one um we were in a position now to uh offer an Eye Care Clinic uh details still have to be resolved uh with the recreation department Etc time place date Etc uh but this will offer our senior citizens an opportunity at no cost uh for eye examination glaucoma and other types eye diseases through a uh um opthalmologist that's part of Hanover Township so we're very very pleased about this so having said that I on the resolutions everybody else okay you have a question um mayor can I just make a comment be before the governing body votes on um uh resolution uh 20 39-22 because that's an affordable housing resolution that' be okay um and and that is uh this is a mandatory step under the new affordable housing law if a governing body does not adopt a resolution applying the state's formula to its affordable housing obligation for the fourth round if it's not done by January 31st then each town that fails to comply you lose your protection from Builder remedy suits automatically uh so uh throughout the state this week and over the course of next week municipalities are all considering adopting these ordinances and what you're required to do is take the state's affordable housing number and I'm just going to talk about it its obligation your perspective fair fair housing need and compare it to the state's data if you so choose and advise if you either agree with the state's number or disagree and in this case both Blaise blancha and Robin Welsh of the burges group went through every lot of land and went through the data released by the state and one of the components is the land capacity and again this is just a calculation it doesn't mean that um this is the number for the next round that the governing body must develop but as as far as taking the step and applying the state's formula uh it went from uh looking at the same data that the state provided going from a perspective need of 544 units to 4 442 units uh for the 10-year fourth round period now again by no means does that mean that this is the end of the road this is the gross obligation but and it's applying the rules that we are all subject to unless it ever changes uh and that means that you know through the work of of both blae and Robin uh they they they were able to really identify a number of inaccuracies that are attached in a report to this resolution and so it's an important starting point to take off over 20% of the obligation and you know the next step there's there's different steps along the way vacant land adjustment things of that nature that will dramatically probably change this number but as for as far as this step's concerned if you adopt this resolution all you're saying is we computed the number and you know someone has said along the way what if we just said zero we computed the number because it's not and in the law says if you don't have a reasonable number that you could support you again will lose your uh a protection and and you'll be subject to a builder's remedy which means local zoning doesn't apply uh so there's a report attached by by uh Robin with the assistance an input from Blaze uh that supports going from the 544 to 442 and what will happen is between now and June 30th the real number I'll say there the net number will become the obligation of the township and a plan will be put forth so and just to give you the significance of the step and the way the rules work if you adopt this resolution tonight then within 48 hours that we have to file a complaint in Superior Court to say this is the resolution that was adopted to be compliant and that's what's happening across the state so I just want to make clear one this isn't the end all two you're compliant with the the laws of the state of New Jersey for affordable housing and three you did uh go through cuz some towns are finding that the numbers spot on but um there's a cogent report that's submitted by uh blae and Robin and Joe burgess's office to demonstrate why the 544 should be 442 before you even begin so that's my report thank you mayor anybody else I have a motion to approve the resolutions so move may have second all in favor I resolutions are so approved and finally we have
