minutes and they are hereby deemed approved so first case number cc24 446 I've spoken to the respondents attorney and they're asking that the case be postponed to the February 11th hearing next month which the town has no objection for all right and case number cc24 446 I hearby postpone and reset this for February 11th is that the date yes will there be any change in the um dates for compliance or anything as part of that postponement no okay thank you all right case number cc24 429 my name is Adam owski town of Highland Beach Code Compliance off officer and I've have been previously sworn in this is case number cc24 d429 the respondent is Ocean Pines Condominium Association Inc the property address is 3009 South Ocean Boulevard I inspected the property on October 21st 2024 the violation as cited on today's agenda is 30-1 122a domestic water pumps replaced without a permit the notice of violation was served by certified mail sent on October 21st 2024 the green card was returned signed on October 29th 2024 the respondents were given 30 days to come into compliance the permit was submitted on January 3rd 2025 the notice of hearing was served by certified mail that was sent on December 11th 2024 the green card was returned signed on December 19th 2024 prior to today's hearing I reinspected the building records on January 10th 2025 and the violation has been existing Granite tops backsplashes and replacing courts has expired the notice of violation was served by certified mail sent on November 19th 2024 the respondent was given 14 days to come into compliance the permit was issued on April 12th 2024 and expired on October 9th 2024 due to missing inspections and missing paperwork the notice of hearing Was Heard by certified mail sent on December October 8th 2024 the violation that remains as cited on today's agenda is 30-1 122a interior remodel without valid permits the notice of violation was served certified mail sent on October 9th 2024 the respondant was given 30 days to come into compliance the permit was submitted on November 20th 2024 it is currently pending under review as an electrical sub permit was required that sub permit was first applied for today the notice of hearing was served by certified mail sent on December 10th 2024 the green card was returned signed on December 17th 2024 prior to today's hearing I reinspected the building records on January 7th 2025 and the violations continue to exist I've submitted the following evidence which includes proof of service supporting documents and photographs the town recommends that the respondent be found in violation of the town code AS alleged in the notice of violation the town asked for 14 days to come into compliance or or a fine of $250 per day for each day the violation remains thereafter the town is also asking to assess prosecution costs in the amount of $250 payable within 14 days again January 31st is anyone here on behalf respondent come on up Sir so the town says you need building permits and you don't have them no I do have a plumbing permit already I have the mechanical and the holidays uh cost a lot of delay in my trying to get the electrical folks to um I gave them all the paperwork back at the beginning of December and they didn't upload it until today so I mean I've done everything that I can to move this along but again the the general contractor's application was filed just like three weeks after the the violation uh plumbing permit I have a copy of it here mechanical I have a copy here and oh it goes without saying that it's generally a good idea to file the permits before you start right well I listen I I I I I apologize it was aapse and judgment and um it was a what we call a refresh movie replacing mirrors vanities we didn't do any any um um any moving of any walls or anything like that we didn't we just replaced lighting fixtures um I didn't realize that that lesson learned it happens the city wants to give I'm sorry the town wants to give you 14 days is that a sufficient amount of time to get your permit well the last permit pending is electrical and that was uploaded today so I don't see that why that would be a problem this town let me ask the code officer to come back up for a second any reason to believe this thing won't be issued within 14 days as long as the electrical contractor submits everything properly 14 days is enough time more than enough time if I may say my experience with this s please speak into the microphone please I may say my experience with this electrical subra subcontractors I had to chase them so uh although I think I'm generally comfortable with the 14 days if have this um Mr magistrate would be kind enough to give us a little more just in case how many you need 30 I don't know I give you what's the town thing about 30 or 21 to town is requesting 21 21 days it's February 7th all right I'll give you the time in case c224 388 the find findings a fact in life I notice sufficient find the property in violation of 30-12 2A missing building permits responded has until February 7th 2025 see I got it right this time to bring the property and compliance or fine of up to $250 per day May issue hereby assess cost the amount of $250 um I think it is sufficient amount of time but it's very important that you let the city know I'm so the town know when 24480 my name is Adam osowski and I've been previous L sworn in the property address is 3212 South Ocean Boulevard 405a I inspected the building records on November 20th 2024 the violation that remain as cited on today's agenda are 30-1 122b permits B R23 d0201 reev 23-00 0224 P 23- 0191 and e23 d197 have all expired the permits have expired due to missing inspections and the contractor has not registered in the Town's new permitting system the notice of violation was served by posting on November 21st 2024 after certified mail was sent on November 20th 2024 the certified letter was returned unclaimed on December 16th 2024 the respondent was given 15 days to come into compliance the notice of hearing Was Heard by posting and certified mail sent on December 17th 2024 prior to today's hearing I reinspected the building records on January 10th 2025 and the violations continue to exist is that on all three permits correct uh yes for permits yeah I'm sorry yeah I have submitted the following evidence which includes proof of service supporting documents and photographs the town recommends that the respondent be found in violation of the town code AS alleged in the notice of violation the town ask for 14 days to come into compliance or fine of $250 per day for each day the violation remains thereafter the town is also asking to assess prosecution costs in the amount of $250 payable within 14 days is anyone here on behalf the respondent January 31st have you had any contact with them four permits is a lot to expire yes sir um I've had no contact with either the property owner or the contractor service was by posting and certified mail yes is this doable can they get four of these renewed in 14 days as long as they submit all the paperwork correctly our permit texts are pretty fast with their permits it's just a form that they need to uh submit okay case CC 24480 I make the following findings of fact in line I notice is sufficient find the property in violation codes section 30-1 122b specifically for expired permits respondent has 14 days or till January 31st 2025 to bring the property compliance or fine of $250 per day May issue assess cost amount of $250 payable within 14 days on January 31st uh case 20231 12-17 okay this is case number cc2 23-12-1 7 I am Adam MOSI town of Highland Beach code compliance officer and I've have been previously sworn in the respondents are Mara and Steven garic the property address is 2474 South Ocean Boulevard this case was last heard at the special magistrate hearing on November 12th 2024 the magistrate ruled the respondent had until December 12th 2024 to come into compliance on December 9th 2024 the respondent notified the town requesting this case be heard to request an extension SL fine reduction the permit was issued on December 20th 2024 8 days after the date set for compliance the total fine is $2,000 for the 8 Days uh the town recommends a 200 to reduce to 250 or a one day in violation do anyone here on behal responding good afternoon your honor Michael Marshall with Nelson Mullins U first off I'd like to thank staff um it really has been you know a long road we've gotten here we're in compliance I don't know if you recall but in November when we were here that day that you gave us the extension we also that day had the variants approved we submitted the application immediately I had the contract here really the 8 days was just because we were you know it was only 30 days you know it's a it's we're waiting on staff to issue the permit we appreciate the reduction to $250 I don't think that's anything anybody wants to like it's $250 not the end of the world I just want you to know that it wasn't because we would be in dilatory we were just waiting for it to be issued um that's all it was all right and in case 2023 uh 12-17 I'll reduce the fine from $2,000 to $250 so we need a payment date on this uh 30 days it's 30 days work for you February 14th February 14 2024 or it returns to the original amount thank you honor 2025 oh did I say 20 see I was doing so well you got you on that last one all right 2025 I I definitely would have put you in some trouble
