what you just read off your prior resolutions were pretty quick I just want to get I realize you can't go into Personnel matters but let me just understand that the administrator's position is now vacant being temporarily filled by Mr rako we all know but then the second one was that search servic is for a business administrator is that implying that bill is going to maybe be leaving or something to that if did I catch the names correctly through you mayor just to clarify uh Frank Alo has been appointed as the interim Township administrator that's now effective pursuant to the resolution that was just adopted uh that resolution also provides that uh Mr antones and Miss kovaleski uh will also be designated to provide support services to the interim administrator um and to be compensated for that that's the main thing so if they're putting an extra time that way the township committee can properly compensate them for their efforts um in support of Mr Alo as the interm administrator the separate action was um the hiring of a firm to assist with the recruitment of a new um Township administrator um oh I thought you said business administrator I might have which is uh I guess the term of art but specific you're a Township administrator so uh that's what the search will be for clarifies it thank you I have a number of questions I'll start with a comment with regard to the last resolution on your agenda with regard to affordable housing uh reading a little bit between the lines uh this resolution is in response to the State schedule Mr blumthal just one moment on that I was just chatting with the mayor we're waiting for special counsel Andy Bayer to dial in and he's going to give a presentation on that so if you don't mind perhaps you could hold the public comment on anything related to the affordable resolution we'll do a separate public comment before any actions taken but it might benefit the public to hear from special counsel before absolutely I was looking for him for Kendra to be here so as there's the the experts these folks are all over the state so we're happy to have them on the phone and we'll have them shortly fine yeah it's all the other stuff I have is with regard to the affordable housing resolution but I mean one thing to set the stage for it is my understanding of this and you folks probably might certainly know that the state last year put into effect a calendar and a variety of actions with th artical foring affordable housing and that set a calendar which hasn't necessarily been met and as you point out in this resolution the putting out of the numbers by DCA was missed the calendar nevertheless that calendar called for municipalities to react to that by January 31st and I take it this is your action in response to that to make sure that hell is up and on the board and doesn't get result in lawsuits and I will congratulate you on keeping up with all the chaos that's going on with that regard and keeping on top of it and so keeping the Township in the appropriate side of the rules and be I do have some other questions but we'll hold that for Andy's participation and he's indicated he's jumping on now so we should have the benefit of him shortly any other questions come on up run Ron I'm a 32 ladwood uh drive you mentioned that the uh departure of Jay was mutual agreement can you specify whether it was for disciplinary reasons or did he just find another job and he moved on on his own and if if so is there any Financial impact to the town in other words is there any Severance involved well it was a I'll let I'll let Mike uh elaborate on it yeah we can't com comment publicly here on the Personnel matter there is a resolution as I referenced uh the resolution approves a mutual agreement and release if anyone wants to file an oper request we'll review it under applicable law and anything any portions of it that are subject to release we're happy to release but it wouldn't be appropriate for us to uh provide any further detail on the de right here right now what about the question of severance same that that'll that can be addressed through the means I just stated thank you any other public comments on the agenda if not we have Andy on the line and we'll move forward with that part of the agenda uh thank you mayor Andy can you hear us Andy can you hear us hold on May talk loud Andy if I could just Tee It Up real quick for the Public's benefit um Mr blumthal made some comments earlier um these are all in reference to resolution 2025 58 which is a resolution committing to dca's fourth round affordable housing present need and prospective need numbers as modified under protest I would note that the township committee scheduled this U meeting on this date um in order to uh ascertain whether the courts would consider placing this uh deadline on hold in light of numerous issues uh that abound the fourth round uh regrettably the courts haven't done that and the township committee is now proposing to take uh the action that is set forth under the law with the resolution captioned as being under protest in light of the litigation that it remains a party to and that I'm handling um but I'll put that to the side because I think it's important for us to address the sub of what's in the resolution and to do that we have special councel Andy Bayer on the line as well as Township planner Kendra Ley who can uh both I guess in succession provide us with an overview if that works mayor absolutely thank you mayor and thank you Mike um so the uh the by way of background the state uh DCA assigned uh numbers or obligations to each municipality for both rehabilitation obligation and prospective need or new construction obligation um based on a formula which I believe Kendra will go through for the benefit of the governing body and the public the uh townships assigned present need or Rehabilitation obligation is 120 was is 129 units and its new construction or prospective need obligation is 130 three units the Department of Community Affairs allowed the municipalities including hell to look to uh analyze uh one of the factors in the calculation is a a vacant land which they relied upon or a developable land which they relied upon to establish the obligation um our planner Kendra Lily did that analysis and the land capacity factor of the calculation determining the obligation was reduced from 76% to 0.1% and that had the result of reducing the prospective me obligation from 133 units to 98 units and that is significant because that's just the affordable housing unit obligation so to get a 98 affordable housing unit you to have to you know multiply by five because it's a 20 usually a 20% set aside so by at least starting out and by reducing the obligation by 35 units that is reducing the total number of potential obligation by approximately 150 units um and the resolution as uh drafted indicates that we're also looking at um taking a vacant land adjustment which would happen through the planning process and that would reduce the obligation further um so um it's my recommendation and by I and I understand we're in you know we're in litigation challenging the statute the constitutionality of the statute but the by um by ex by at least moving forward and adopting this resolution you will retain immunity from Builders remedy litigation which is something thing the township wants to do so this way you control planning and zoning and a builder or property owner can't sue us and have look to have their property rezoned for something that's not intended for so that's um the background and I would defer to Kendra on the calculation issues thank you Andy Kendra would you like to thank you mayor chiman sure the the only thing I wanted to add to uh what Andy uh was providing was the obligation was actually is actually made up of three factors and it's the average of those three factors so people might be asking well if we reduced our land capacity Factor so low how do we still have an obligation um well that has to do with the other two factors which look at your income capacity and that really is your household income as it relates to the overall region and and then also looked at the non-residential um valuations in town as it relates to the overall rate of region so um so the factor is the average of those two items plus the land capacity factor and really the only opportunity we have to modify it uh is looking at the developable land which is the land capacity Factor so I just I wanted to add that to the um conversation that people were understanding that we're not just basing it on developable land um I do want to indicate that it is the first step in the process uh once the obligation is submitted uh hopefully there won't be objections to it if there are objection to it we'll deal with it but the next step honestly is really just putting together the housing element fair share plan which would then do a further reduction through what's known as a vacant land analysis uh to take that 98 unit to hopefully make it uh reduce it further uh but that wouldn't happen uh until after I would say in the next couple of months but definitely before 30th which is the next deadline everything excellent thank you Kendra do you guys have another minute or two if we take a couple of questions possibly yes mayor all righty come on up Ralph hi Ralph Blumenthal thank you both Andy and Kendra for the explanations most of us here are not experts in this and so any clarification you can provide is welcomed uh had a couple of questions on some of the details of what's in the the resolution in the memo not being familiar with all the details of how they Define things what is the difference between present need and perspective need and does respective need include present need or do we have to add those all together you want answer well I think either of us can answer that Kendra but go ahead you go ahead I'm in the car so I just I don't know if I background sure yep sure Ralph so present need as I indicated is is is the uh Rehabilitation obligation ation so those are not new units those are um units that are have been uh that could be characterized as not meeting all uh code standards so homeowners would be able to apply through the township for a loan or a grant to bring their home up to code and the township gets a lean on the property um for the for the which is an interest free loan um and we have money in the township affordable housing trust fund to deal with deal with that but that is not a that is not a new construction obligation prospective need is the new construction obligation so present need or Rehabilitation is our existing households and prospective need would be new construction to create new affordable housing un okay that clear helps then in uh Kendra's memo uh went through I guess those properties where you had disagreements with the state and their calculations and I was puzzled in looking at it first of all I suspect where you there were a lot of other properties in town which may be considered that aren't on this this chart so what is included here and what's not [Music] included is a uh listing of all the parcels that DCA has included in the analysis and that's what we base it upon so there may be other Parcels in the municipality um but the L the um the Housing Act is very specific as to the data that they are to use to create the developable land U list and so that's the basis that we start from and and then we Lo we looked at obviously we looked at all the lots and we're able to uh really remove the majority of them uh because they're as you see in the in the table for various different reasons either they're developable they're in easement they're they're sorry they're developed or they're in easement or they're open SPAC or preserved in some other manner so um it's really the basis is the DC G database and Ralph just to so you know they they had the PNC Art Center on that list as developable land you know what are we talking about right I meantion pond on another good development another thing that puzzled me here is the same properties on here more than once right I mean although it's one I get what you're asking but I don't think we want to be throwing all this information out right that mean yeah I mean it is I I don't understand what what it means if the same property is on multiple times and it's just you know why that is that's the way that the data came through um and that's so the gis information that was to be used for the for Housing Act is what's called land use land cover data land use land cover data comes in um it's exactly what it sounds like it's what's the type of land use so for instance if if you see several listing of parcels um there could be wooded area versus U non- wooded area versus um urban area so those if you see a couple of different listings for the same exact parcel it just means that there's a different land cover uh for that and that's the amount of acreage that they attribute to that land cover some of this is very strange yeah what we're deal withal the one that's most not our rule yeah yeah I mean the one that's most obvious to me is block 5019 lot 47.0 3 which is directly behind our house it's when the area AR area was subdivided this was all Wetlands there's a stream through the middle of it it's steep slopes it's unbuildable why you would list it three times who okay uh then more importantly just to understand the next steps Kendra already mentioned that you know you send this to the state the state will look at it and there can be a back and forth for who knows how long that will take to get an agreed upon set of numbers once there's an agreed upon set of numbers presumably then there is a process where the Township will consider how do we meet this obligation how do we plan for it what properties do we want to consider as was done in round three and uh so when will that come up and how will that work and when will the public be be able to say input some things I mean there are some vacant properties that aren't on this table that should be considered and if I could yeah so I would encourage anyone who's interested including yourself to look on the DCA website because all that table reflects is what is graphically shown on GIS on the internet and DCA did whatever calculations they did um and you know I think uh if you look at it you'll see the the insanity that we're dealing with when you look at a portion of the north lot at the PNC Bank Art Center being marked off in Pink as developable for affordable housing so you know essentially right and part of the swim club is developable for affordable housing too according to the DCA so you know we're left to try and dispel that data which is what the chart represents it's nothing more than that and Ralph we we don't want to speculate to answer your question though we're not going to speculate yet because we don't even know when the state's going to come back we're going to be transparent we're going to move forward with this process as the state goes so you're definitely going to hear more about this in the coming months but we don't really have the answer some point you'll have to get down to okay we will have some obligation whatever the number is yes and somehow one then needs to start planning for how do you meet this obligation any so I mayor I'm sorry I could address at least the process question if if you want go ahead Andy the yeah as Kendra noted the the law requires the township to have a housing element and fair share plan in place by June 30th and that is the affordable housing strategy document that would have to be approved by the planning board and the township committee so in advance of that um and the if there's objections to what we're submitting to the state as to what we say the obligation is the objectors have 30 days to do that the state says I'm doubt I I am doubtful this would actually happen but under the law the state is supposed to resolve those objections by the end of March and the towns then have basically April May June to plan for the fourth round obligation as that's the stat those are the statutory deadlines thank you Andy and okay so I mean you got to know the numbers as the township committee for acquiring the grant with a special thanks to Barbara kovaleski Bob Ward and Jason wig for their assistance in organizing this program and the grant process the next we'd like to open up the floor for any public comments Pat come on up Patrick trus 56 Line Road more than two years ago a divided vote by the hell zoning board approved the faith-based dementia Center Care Center on historic Potter's Farm an iconic and beloved H down alarm Landmark cherished by all residents at the time the United Methodist Church through its nonprofit entity United Methodist communities promised to bring faith-based pastoral care to Homedale seniors living with dementia Homedale is a diverse and inclusive community that respects a wide range of religious and secular traditions and as such it is essential that hell provides healthc care services incl including dementia care in a manner that is accessible and appropriate for all residents there is no compelling need for a faith-based dementia care facility in Homedale hell has moved forward with alternate options for dementia care including Bright Bright View facility on Route 35 and the cha property at at the Vonage property these facilities will be serving home Del senior population with bright few already accepting residents and CH ha expected to begin construction soon the United Methodist Church's original project has encountered significant challenges over the past four years the church has experienced internal divisions resulting in loss of half its members a quarter of its churches and a substantial decrease in its financial support for its faith-based senior care mission the projected cost of The Enclave at Homedale estimated at 27 million in 2001 has skyrocketed during due to escalated construction costs the United Methodist Church no longer possesses the financial backing organizational capacity nor resolve to complete this project given these developments it is clear that the best course of action for Homedale is to conclude negotiations for acquisition of parter Potter's Farm via imminent domain and proceed directly to Superior Court to reclaim Potter's farm this land should be preserved as open space for the enjoyment and benefit of our hell residents thank you thank you Pat any other comments come on up Jenny Jenny Blumenthal 41 Stony Brook wrot I was perusing all the P bills payable today and spent a bunch of time with my calculator and I noted that um on uh bills payable number one there was an expense for Demco for furniture for the library of $2,247 and um I was wondering what kind of furniture did we buy I thought there was plenty of it over there there isn't the last year was the first year that we actually adopted a formal budget for the library the library since it had moved to Bell Works was always dependent on the um I forget what it was called the friends of Hell Library fund um yeah but that fell into a big hole it did it fell into a void and there were several years where requests were left unfulfilled by the library so when I took over as liaison there was about three years a back of requests that were discussed with the foundation but not fulfilled so you know just by nature of wear and tear at the library a lot of things did need to be placed so um a lot of that about half of that was just necessary Replacements at the library and then some of it was improvements that um Trish had asked for in the past that had sat so the township provid you know chair yeah they display yeah a lot of it is like chairs and desks but some of it too we have several new display cases as well so it's if if you stop by the library and look it's actually very nice um and a lot of the the broken equipment that we had either touched up or or tried to repair um we've done away with and then replaced with new okay I was just ious because I was so involved in that for a while I just want to add Joe great job with that by the way last year getting that budget up and running and moving things forward so thank you for that yeah this was actually the first time uh since the library moved that we did not make a single request to the foundation the township fulfilled everything feary so we're pretty proud of that any other further comments seeing none how about a motion move second have a good evening everybody
