##VIDEO ID:0gpTN_9nIJ8## >> will call Thursday October 24th 2024 meeting of Planning and Zoning Commission to we're welcome. We'll start with a pledge. Please. >> of United States of America and public for which it stands. nation under God, indivisible, with liberty and justice for all. Thank >> Any additions or deletions to the agenda that those are. All right. Very good. >> First order of business is the approval of the 9/12/2024. Minutes motion to approve second. >> All in favor. Aye. Aye oppose motion of the minutes are approved. We've got 2 items on the agenda tonight. One is on consent and I'll read that into the record. Its Genesis industrial, request A's the previously approved site plan and different previously required. Off-site improvement. 47 25 45th Street LLC is the owner Mbb Engineering or parade is the agent. I would anyone like to take of this consent and discuss it. I would like alright. Then in that case. I will ask have there been any ex parte communications about this? and will swear-in anyone who would like to speak on agenda. But vote for. >> We talked about that before we're going to We're going to want to >> Do you swear or affirm to tell the truth? The whole truth and nothing but the truth so I'm assuming that there's a sense this is on because that there's no staff presentation. >> That's correct. We don't do it. Don't have a presentation, but I'm happy to answer. >> All right. So we'll go commissioner questions since the first one is over on this side. Chip, you want to start out and anyone else on the left? >> Sure. What is the deferred off-site improvement? Thank you for the Ryan Sweeney assistant plane to own services director up Mister Chair Trip. It's the office. left turn lane. >> Into the project site. So originally on the project approved, was not faces entire project and the overall project trips the left turn threshold. >> However, they want to phase it to be able to build. Phase one, which is buildings want to first. Those first 2 buildings do not tripped the turn threshold. So I want to be able to build the site along with the first 2 buildings. And then once they get to for building number 3, they will have to build the off-site tournament. >> Is there a time frame on that deferment just prior to for building 3? one 2 and then never have to do the tournament. >> But they wanted to build buildings. 3, 4, 5, So right? I mean, yes, that's that is true. >> You know that. I guess would my issue in that respect them. >> Well, let maybe prep clarify for generally. the Turnley requirement based on number left movements into the site. The coach has a threshold buildings one into don't rip that threshold. I don't we don't have any ability to require an off-site improvement permitted. But you write a plan. That doesn't exceed that threshold. just figured out one of the goal with the 45th Street is that there's there's a larger project of a colder air pipe in the canal and the rebuilding all of 45th Street from 43rd to 58. That's a county and Peele actually DOT project. So timing wise, they may be able to work with the OT too. Building that improvement as part of that project. >> Kind timeframe. Are we looking at for DOT project? >> I believe it's in the it's in the current. 25 to 2029 work program, but I don't have the exact they got to get right away and to a number of other things. >> It's a fairly recent. Yeah. I mean, we're not talking >> Anyone else on the left. Any questions on the right? All since we've opened this and taking off consent, all open, any comments from from the public open it for comments from the public. >> Good evening, Rebecca Girl Hall and BB Engineering 18? 35 20 street Vero Beach here on behalf of the applicant. >> yes, we are looking at phasing plan and the goal is to build all 5 buildings on that site. And that has not changed. I thing is Ryan was good to point out. The timing changes with the mpo slash FDOT project. We really want look holistically and we want to encourage, I think FDOT to look holistically at that entire street. Not just a tiny portion of that that we would be putting in that left turn lane for. So it's really a I think about that. And FDOT has a great opportunity in front of them to really design a complete streets designed for that area and be a real asset to the entire community fire and be on the little bit of left turn lane that would be added in front of this property. >> That would be drainage sidewalks to yes, it's a huge factor your opinion that left turn lane will of actually going? >> Absolutely. FDOT has committed to it. There value a number of different. Design scenarios at this point in time. And yes, we could go, you know, into engineering that left turn lane in front of that section of the roadway. But literally and hold my hands up here and show you like a small section. >> Of a very, very roadway. >> And I think it just makes more sense to work with FDOT and make sure we're all going with the right design and what's going to be best for the overall length of that roadway. Not just the piece in front of this business. >> And I would like to see that, too. And I'm sure there may be some cost benefit to the owner of the property as well. Take a time it all in. I always had a problem with the required when they get the developments, the sidewalks to know where's I used to call had to build sidewalks in front of the project. >> That was relevant to the rest of the surroundings. Okay. Okay. >> Other than that, I'm happy to answer any questions about this. Thanks, Ashley. >> Thank you very much. Anyone lose the public comments section of job. If there are no additional questions, call for motion. motion approve. >> Motion to approve second all in favor. Aye. Aye opposed. It passes unanimously. Our second agenda item the last preserve. And this is a request for your Merit Epd Platt plan approval for the last 3 preserve multifamily track. Last report Serving LLC is the owner, stellar and incorporated agent zoning is PD plan development land use designation is Al one low density residential up to 3 units per acre proposed density is 2.1 million units per acre and the overall development. Any declaration of ex Parte communications for us. Anyone that would like to speak on this. Please get sworn in. >> Do you swear or affirm to tell the truth? The whole truth and nothing but the truth >> and offer I'm assuming there is a staff presentation. >> Yes, thank you, Mr. Cherian for the record. Ryan Sweeney assistant playing voters as director. This item is Patrick Murphy's project. But I volunteered to present on his behalf. So we do have a our 0.4 year. This is a street preserves request for the multifamily tracked slash townhome for Clinton APD Plan plan approval. the project is site is located right smack in center of the last Reapers are overall PD project. What is called the multifamily tracked. Here is an aerial and more things now to the right an aerial depicting the existing conditions of the site with the proposed site plan overlaid. And the site plan showing in total 64 units at 16 separate buildings with 4 units per building just driveway garage style parking. There's also quite a bit of additional guest parking and between the units and a single road that connects back to one of the main roads in Austria Preserve way with full access driveways of the other end. And the landscape plan because this is really sort of a multifamily site plan. The those let's get requirements apply, including some plantings vehicular used area plantings and the men and to get use area plantains. And with that staff recommends that the planning Zoning Commission approved the last troopers are PD plan. But with the conditions in including provisions, a developer of the app, control pain and cruel detailed landscape plan and lighting plan and preparations a certificate completion applicant premier buffers and common areas. Sidewalks. Thank you. A presentation. >> And know, questions from PNC on the right here. Any questions on the left? Chipper? Go ahead. I may have asked before, so I apologize, but people that the site plan in place. >> As part of the this section. The access to the recreation areas and you that pet pedestrian or in it, or is it strictly drive your car all the way around? Parker. >> Well, there's a predators it's hard to see. But there's a sidewalk that that is currently along preserve way. I guess, is >> not necessary. Now, actually, it was more of a direct line from the the spaces in between the buildings. >> Oh, yes, there is. Yes, there's a sidewalk on either side of while these lane it's kind of hard to make out. you can see my Christian. But yes, there are sidewalks on either side of the road. And so if you were to park and again, space, you could walked to one of the units without having to go on the road. >> Yeah, no, I'm not being clear. I'm sorry my fault. for the people that reside there, they would in order to access the recreation area. They would have to walk out to preserve way back to access it. There's no right there. I great there's no shortcut. >> I mean, they could probably work went in, but they probably don't want folks walking between the units. But yes, that's there's no shortcuts with its peak. >> Okay. I'm just looking at curbing sure vehicle traffic I I mean, think you're right. You're right. >> It should be a short walk and considering, I mean, the other homes considerably further away. I mean, maybe. You know, any of the nears single-family home is considerably further. >> Maybe they'll allow golf carts. It you I'm just looking cutting down the traffic. >> Its all internal for so that part it, lot Any other questions on the left here. >> I And out there. supposed to do. the rest of the development, how far along is it? >> The Al the single family is divided and >> most of the homes are built. a there into phase 5 now with the home building. >> thinking >> might be a similar develop its. >> And then you're sure years. >> a driveways, so sure that. The car is longer than the driveway is. >> That that the case I will to chime in because I don't know the exact a mentor, but typically we we do push to have at least commuter car be able to provide parked in the driveway without hanging over into the sidewalk. >> Okay. So and >> these have Rogers Parton second from the draw. >> Correct. But they also have an abundance additional parking. don't think parking parking second be an issue like it is. And some of not assigned to anyone on or equity. One union are. >> Okay. was my only concern. I ate. You know, have AI Wei. Sure car understood. >> Yes, try. And I'm sure I wanted to ask do you know if the H.O.A. documents required that the car not go over the sidewalk when they're parked there? Because I know a lot of H.O.A. documents do restrict that. This is you can't get car, can't hang over a sidewalk. But I think that, you know, mark here, your comment there might be addressed by the H.O.A. documents as well. I certainly don't know they're going think about land, but I wouldn't be surprised if just enough, >> the county had made sure that that kind of restriction was in there or not. >> And and the H.O.A. docks for the I mean, I'm not sure if they're using the same H.O.A. docks for the entire thing. There's probably a master. >> If they wanted to make an amendment to address some feeling that they could, they could also if they're putting this. And when this comes in through the PD process that could be addressed or the H.O.A. docks there, too. But that's something that police are. I know my office reviews them, but we don't see them until a cement. The actual final plat. So I can't really say anything there that. Thing is. >> The recreation area showed in the last slide. >> Show pool >> Courts things like that. >> Is that complete yet that this aerial show the area, but that does show those improvements that, OK, those those are all We got on the left. >> All right. We'll go ahead and open this for public comment. Steve, you have anything. The ad. >> No. There Steve Mueller for the solar Mueller representing Wall Street Preserve. I don't have anything to add. Ryan did a good job explaining the project got just comment on March question. The dimensions that we have for the distance from the side wall to the garage is always at least 20 feet. So we don't have any issue car sending over unless somebody par correctly. We provide lane that will allow that to occur. >> like that. And rich. at least 20 feet like a regular parking an average car is what 18? I want So Now nowadays I'm getting smaller and smaller. >> Or or bigger and bigger making well, yeah, well, they park outside. >> doesn't matter. But a pickup trucks. >> I e I'm not that familiar with the H.O.A. documents and I quite frankly, not sure that this because this is townhomes and not single think they might propose with this plot to have their own H.O.A. documents associated with just this community. I wouldn't be surprised. >> Be part of the overall. H.O.A.. Certainly because everybody has to pay for the upkeep of the main roads in the community. But this site, I don't think it's really been decided whether or not this is part of the overall or not. It might be a sub associations. >> Any other questions for Else? It seems the only one of the audience I think we can safely close public hearing part of this. >> And call from ocean. I'll second. All in favor. I oppose has unanimously. Commissioner matters. Any commissioner matters. None that I know there's a discussion item from planning matters. So let's go ahead and do that. >> thank you. I did not prepare anything formal. I did want to have discussion. Ironically, we wanted to have this discussion a couple minutes ago. had to cancel 2 meetings in a row, which is one of the items I want to discuss So double check the by laws are and the code that established the planning Zoning Commission. And there is no mention or requirement of >> the >> interval that p**** means that historically it's been the second and 4th Thursday of every month when we have an item. But as you all know, sometimes we have multiple meetings where we don't have items. Sometimes we have back to back meetings. So just real quick, the pro that current set of is that we have the ability for applicants and for staff workload management to kind of spread that among multiple meetings. The con is that we could have a meeting for one item and then another meeting for one item. And then another meeting for one item. So the other con the moving. So the condom moving to one meeting a month is if we do have to cancel. Then they can really create a huge agenda or and also provides less flexibility to applicants. I've been doing this for almost 11 years now. I I can live with it either way, but it's really up to all of If you want to move to one meeting a month, I have a you have the ability call a special meeting. We could turn special. My question. so just to clarify, one less thing, though, obviously in the months of November and December, we only >> only have one meeting a month because the for Thursday would be Thanksgiving and typically Christmas respectively. So my recommendation, if we were to move to one meeting a month would be the second Tuesday of the month. And then if we needed to, we could do a special call for of to say to 7 Thursday and mixing together with the So we would have that ability. I guess that I can live with either way. We it'll be more predictable. If if we go to one meeting, monthly probably will have a meeting pretty much every month and and it might be slightly larger agenda, but it would be more efficient use your time and are with this. >> Gently mean longer meetings? >> it could yet absolutely. >> Them anything for. 2 weeks today for the For the second me. A second to. >> The first meeting version of the yes, yes, the meeting and the meeting in November is going to be a to a lot of items you saw. >> the >> items that you saw on the >> agenda that was supposed to be the first meeting of this month. We work. Those are public hearings. We were not able to re advertise and get them back on this being. So number of those items together with one or 2 other items are going to be on that agenda. So again, you're going experience the con of having only one meeting a month. >> And I think, you Calvin and I discussed this at the beginning and I think the the concern is we end up with if we go the one meeting we end up with a meeting with 6 agenda items right possibly. I mean, >> in the summer months, we could have one or 2 items. Where does this come from? I mean, why? I think that us, one of just said what I honestly, I'm not to U.S., but I will say, like I said in the summer and particular, yeah, I think we had 3 meetings that we canceled in a row. But then we had 3 meetings in a row with only one or 2 items. So. >> Well, Ryan, I understand the potential >> disadvantage and that it would be the meeting stacking up in longer meetings. >> I don't really comprehend image. Going once. I mean, in the event that you said, you know, hey, we're going once month and that's going to be the second. >> 2 stars and isn't theirs? It's Thursday. I'm right with you. With Tuesday. That you had the option of. Well, hey, that's got canceled because of the storm going to meet on the 4th. I my biggest concern is just and its its being selfish. My time is important to me. I don't mind committing 2 weeks month. But I don't want to sit in here until 11, 30. Yeah, I. >> Ryan, I I don't support one at I think for not only I had several people actually call me on this and go, hey, what's going on? Are they really going to do this new if? If you miss your deadline by a day, I am now 6 weeks out to get something interest. And I don't think that that's doing justice to the citizens of Indian River County who want to get things done in a timely fashion. And so I. I also agree with longer meetings are a possibility. I think unintended things are going to pop up like longer meetings. And if I'm the last guy on a meeting with 6 things year and I've already work 8 hours today and now I'm going until, you know, 7, 8, 9, 10 o'clock at night waiting on my staff. I've got a tired board of commissioners. I've got, you know, the last guy there, I going to pull it away to another? I think the unintended things are if it takes that much longer to get my project in and going forward, there's a lot of burden that goes along with that to person who is trying to get something done and it's a financial burden as well. I mean, you've got an extra 6 weeks of overhead. I've got 6 weeks of interest carry on a project and those kinds of things. So I e. I understand what the process is that it works. Good for that. But I I wouldn't support it as far as that goes. >> don't I don't I don't know that we need a vote because I don't think I don't I think we're in agreement. I mean, I'm against going to one. do have one cut, >> And that stretched over last 4 years. There have been number of times I've driven from Sebastian for meeting, it takes me longer to get that meeting from Sebastien come home. I do the same drive. That's a little frustrating. Takes a half an hour. >> I can talk I mean, I again, I understand that's where one item was a I didn't raise this issue don't know it yet, but it is. >> Confessed is there a way to prevent that from happening with the scheduling. >> try to we try to convince folks that have sort of more straight forward items they're the only one that's going to say, hey, we already know we have already advertised for a public hearing into east would really like to push. But I mean, we don't we know that only goes so far. So. >> Now I just want raise the issue. I have no problem either way. >> Right? get because I like you bet. I live in Sebastien and appointed by Mr. Fletcher, it is a drive down those kind of things. But thought process on this is is I knew that when I signed up and I agreed to make those commitments for that amount of time. And I don't have any problem filling that commitment that I made. So I just think we need to be here for the community and have have those meetings available for them to get their things done. I would. Yeah. I that's I've been on both sides of table here for very long period. >> Time I remember those meetings. There were 2 or 3 items and they still want 11, 11, 30 to call it and driving. You know, I live down there, 95. So I mean, the what time of the day, whether it's a 20 minute or half an hour drive anybody can drive. Get here any more than 10 minutes we next door. but doing that drive. Yeah, I understand your government. not have a minute about the drive guys that really that the driver is not an Just. >> point. we just have to make sure that the chairman slows things down at some time. >> Know you need to do is when we have a one item for a king. >> Well, yeah, I appreciate that in mind. That's a discussion for Mr. Per gonna because, hey, I have anybody? But I mean, if it's a 10 minute meeting and it's a 20 minute drive that I mean, as opposed 3 army Yeah, I've that ended way too many of those meetings to have. I. Yeah, I mean, it's not fair staff either. I mean, you guys, you I get it, get up and work the next day to that some of us get up earlier than others. >> tornado Beach takes me on task. >> You're going across the bridge what? You don't have one bridge right to get through trees well, >> So do we need a vote on this? And I've got very clear sense that we don't changes. So, you know, it. >> You don't need a vote. But if you want to do a consensus, you're fine. Whatever. know, I think we've got we've got a very consensus is staying at 2. If OK, that's fair. Thank you. >> I the only item I already mentioned is that we do. We've already highs for multiple public hearings for over in for November 14, which is the only meeting in November. So some of the items you've already seen a few of the year early homework you can read it does won't change. But then we do have some additional projects that will be added as well. >> What are we currently looking at as potential? Number 14 items, 5 items. So >> long items are sure they are all public hearings. Public hearings don't know until you have and you don't know some of those don't know whether controversial >> That's it from Any attorney matters. No attorney matters. We will adjourn this meeting anticipation
