of Tuesday November 19th we'll begin with the invocation followed by a moment of silence and then the Pledge of Allegiance dear God guide us in the way of justice and peace that we may honor one another and serve the common good amen let's have a moment of silence please join me in the pledge pledge allegiance to the can we have a roll call please mayor kusky here vice mayor sunstrom here councelor Delaney here councelor for here councelor may Town manager Kito here Town attorney beard okay uh we have the F do rep here today okay uh just to introduce this item um thank you you know tonight is a town council meeting and we conduct Town business um I grateful that vice mayor sunstrom uh saw the opportunity to invite fot here uh to give them the opportunity to present to those of us in the chambers those that are watching online either live or you know afterwards this is not intended uh to be an item open for public comment um we could take comments under citizen comments but we're going to get a presentation Council will have the opportunity ask questions and then that'll that'll end that topic again hopefully everybody's we've done this before with f doot and uh this is a venue they wouldn't otherwise have so we appreciate your coming and I'll turn it over to you all right first off I just want to say thank you for having us um thank you to the town of Jupiter also Palm Beach County for for putting out the the message of the new signal um prior to during and currently so we appreciate your help with the communication to all the community so I'm going to go ahead and get started uh first off my name is Thomas Emerson I'm with f&j engineering I'm a consultant for the Florida Department of Transportation on the project in deantown road so I'm the project administrator I run the construction for the dot on a day-to-day basis so this project is going to be State Road uh nine which is I95 Northbound offramp to eastbound Indiantown Road and also includes Indiantown Road uh from the Florida Turnpike all the way to Central Boulevard so just a little background on the project itself the the reason we're here the scope of the project so what we are doing on this on this project is widening portions of Eastbound and Westbound Indiantown Road to include additional traffic lanes and bike lanes for improved traffic flow we're also realigning the Northbound I95 offramp to Indiantown Road eastbound ramp and we're also introducing the signal uh approximately 1 and A2 miles our prime contractor mtec civil um we started construction October 30th uh approximately $18 million we currently have 619 construction days and those are calendar days consecutively um and we're anticipated to complete in summer 2025 so the overview so the project overview is basically we're going to talk about the current traffic pattern uh we want to stress that the current traffic pattern is a temporary phase and will be changed next week the phasing of this what we're in right now with the two lanes Eastbound and the two lanes coming off the ramp was going to last approximately 10 days give or take weather in the holidays we have we want to finish this obviously before the holidays and if the weather impacts us with rain we can't pave in the rain and we can't stripe in the rain but it was approximately 10 days is what we were going to be doing uh we should have stressed that a little bit more in our Outreach um the 10 days obviously would have hopefully lessened the impact to the people who are traveling in these lanes and also you know giving them some update that it it's not a permanent configuration what it is right now this is a temporary phase so prior to the construction there were two Eastbound Lanes through the I95 interchange uh as it as it approaches the uninterrupted I 95 to eastbound off ramp so that was before the signal we had two lanes eastbound we had two lanes coming off of 95 to go eastbound so with this project basically we're doing I95 southbound offramp to eastbound um we're going to add a third lane when you come southbound 95 to eastbound Indiantown Road right now you go southbound 95 to eastbound Indiantown Road and you basically merge into the two lanes that third Lane's going to continue through all the way through to Central Boulevard and then also they're going to add a fourth Lane when we travel West right when you basically pick up that third lane you go underneath the I95 ramps as soon as you pass I95 ramps you're going to open up to a fourth Lane and that fourth Lane will continue as well all the way to Central Boulevard and then uh they for the light basically there was a study conducted and the project determined the the significant traffic improvements are expected with the completion of this project the lights in the next page and the signal activation was approximately 6:00 a.m. on Thursday November 14th so that's when the issue started with the traffic in the eastbound Direction in the morning that morning that was the day we shifted traffic to the newly constructed I95 Northbound offramp to eastbound Indian Town Road and then we also began demo of the old ramp that same day uh due to high volumes of traffic on eastbound Indian toown Road the signal had to be activated to allow I95 Northbound to eastbound off uh off R traffic to turn onto Indiantown Road so once we took the traffic off of the old ramp that was free flowing and we brought it down there was no way to to leave that free flowing and allow the eastbound traffic to continue we had to turn the light on and basically and the reason why the third lane was not done is there's about a one foot difference at elevation between the old ramp with the old ramp comes down off of 95 and ties into East Bond Indian Road it's about one foot higher than the road so basically we have to demo all of that to build the third and the fourth Lane and we couldn't do that while the active traffic was on there there was no way to basically phase the traffic off and build that at the same time and that's basically the last bullet here is basically it was almost it is was impossible to build a third and the fourth Lane before the traffic signal because of this elevation difference so since the since the activation on the 14th what we've been doing is or what what current currently is out there is one lane exits I95 offramp to eastbound Indiantown Road that opens up to two lanes at the light the traffic is being manually controlled to assist with backups during peak hour morning so in the morning we're out there our crews are out there manually Shifting the light watching the traffic and trying to give more time where we believe the traffic needs to be moved so the signal is not operating on timing right now or as of this morning because additional temporary traffic devices have been added so what we did is we reached out to the county and with our partnership with the county the county provided us with um video detection cameras these cameras are installed on the Mast arms you'll see a camera up there and that camera basically shoots down and it detects the vehicles as they approach the stoplight to put them in a queue for the next traffic signal so we've added those today that should help with off peak hours right now during the peak hours in the morning we're still manually doing it because the video detection is getting the calls constantly in the morning so it's it's constantly telling hey I'm ready for a green I'm ready for a green but that's where are we're manually changing it also we with uh our partnership with the county the county has allowed us to use Donald Ross Road as an alternate to uh Indiantown Road to alleviate some of the exit traffic that's coming to Indian toown so hopefully some of the people will be able to take Donald Ross Road and either come up military or use the back roads to get off of the the Jupiter exit instead uh also we're coordinating with First Responders to make sure that everybody has access to the road and that we're not um creating a bigger issue for the First Responders all right so that's what currently happening moving forward this is what's going to be happening starting today actually we already started on some of this but moving forward we're going to finish the roadway construction for the third lane by Friday Friday so Friday we should be able to get traffic on the third lane we're also going to be working this Sunday night starting at 10 p.m. to work on the Northbound offramp to eastbound Indian toown Road uh plan there is to complete that entire ramp so what what was basically before is you had a direct exit with an option Lane off of 95 right now there's one lane we're going to open that back up to two lanes or one lane direct one lane option so you have two lanes come in 95 which will then open the three lanes at the signal and those three lanes will turn eastbound on Indiantown Road now the final configuration which is the fourth Lane in the eastbound direction we're hoping to expect that um in January 2025 um and that fourth Lane is going to start from where the I95 overpasses heading Eastbound and all this is obviously weather permitting so the picture here here is basically showing the signalized intersection and it's showing the two lanes up here going into three lanes so this is I95 Northbound to eastbound we have two we'll have two lanes coming into three lanes and there's a signal showing all three lanes turning right the fourth Lane the third lane are opening right here and this is I95 Northbound so right past Northbound it'll open up CU right underneath I95 is kind of you know we have the two lanes there we can't really build out right as soon as we get past I95 and it opens up to the green area we'll already we'll have four lanes there and if you drive there now you'll see that it's already paved we've already done as much work as we could before shifting the traffic so we've already paved those Lanes the third and the fourth lane from 95 all the way up to the point where we couldn't pave anymore which is where the old ramp came down into Indian toown Road and we had that foot elevation difference so we're already paved all the way up there so we have to basically pave through where we demoed out the old ramp and we'll be able to put traffic on there and you the overbuild section is actually at the top part of the ramp the top part of the ramp when we're coming down the ramp and the old ramp kind of veers off the super elevation it's actually at a Downs slope so we actually build that up to make it flat for the third lane to come in which is what we're going to be doing Sunday night hopefully opening on Monday morning and then the next slide is basically the entire project limits starting from where we start a millonary resurfacing which is at the turnpike entrance all the way to Central Boulevard it shows our new sidewalks our realigning our ramp with our new traffic signal our widening of the road in the eastbound direction also our widening of the bridge over the C8 Canal it shows a signal at 67th and 68th we're also going to be widening the road between 67th and 68th in the westbound Direction um and that's basically all I have for right now um is there any questions or comments could you go back to seven seven I know you said this but I just want to make sure that we're summarizing for us and the public here so you know when is the light was put activated there was only two uh Northbound right turn Lanes correct so by Sunday we're going to have the third one by Monday Morning by Monday morning right correct Sunday at 10:00 we're closing Monday 6: a.m. we have to be off the road so before 6: a.m. Monday morning and then um course we're going to have without the third lane eastbound which should be done should be done Friday Friday or be open by Saturday no should be Friday Friday okay said 11:22 11:24 so just I just wrote the dates down but then that's the reason why you couldn't do a this another reason you couldn't do the third right turn L there is no way for us to build the third and the fourth Lane while traffic was active on that ramp because that ramp when it comes in I from I95 into uh Indiantown Road eastbound the elevation difference was basically a foot higher than the existing Road and we've currently paved everything up to that ramp and you can you can see the lip it's not there anymore because we've already demoed it out but you could see the lip that we had the elevation difference between the existing Road and the eastbound Indian toown Road which we have to remove to then get traffic to go through there now when you were talking about activating the or opening up the third lane eastbound on Indian Town Road that's all the way to Central Boulevard yes okay you know from the picture here um there's actually four lanes right the fourth Lane we're hoping to open by January 2025 and I know that uh I know that further east is more time to do it I was wondering if in this area it was going to open up sooner in our plans currently there's no there's no phase for that that doesn't mean that we couldn't work with you guys to possibly Implement something different um but at this time we do not have anything planned for that we're planning to open the fourth Lane all the way through at this this point in time but that's something we could discuss well and the reason I'm asking this on behalf of the public is that you know the intersections are the bottleneck and um so anything and then they get through this area and then they're going to be stopped anyway but you could get at least get more people through to the next light so if there's something that could be done that really help this you know critical location that and that that's basically the the issue that was prior to the signal being turned on the traffic free flowed Eastbound and Northbound to eastbound off the off the I95 ramp all the way to Island Way and that's where most of the traffic started and then obviously once we we implemented the the light the traffic the queuing area between Island Way in the new light is basically what pushed back and you went from three lanes to two lanes so then um and apologize I hadn't sent this question in before but uh fiber cable to enable the traffic signalization to be remotely adjusted by Palm Beach County Traffic management control center when is theable C because this I understand this signal is not linked and can only be manually done either manual or GPS timing or video detection so we have our video detection out there but you are correct it is not synced to Palm Beach County Traffic operations at this time what what's your schedule for that so we're currently working on installing the conduit we are installing fiber but we have not installed fiber there we have the conduits in the pull box installed the fiber's just not been installed yet and we haven't gone to the backbone for this project right now the timeline for that usually we do the at the end of the project because if that's something that we don't they they don't want to install it twice so if we install that fiber and we go out there and put a um a traffic sign so you know a post-mounted sign and they put a post mount sign right through that fiber that's going to cost a lot of money to replace so the contractor usually waits till the till one of the later stages of the contract to install the fiber however that doesn't mean we can't expedite that process but at this point in time we haven't we haven't asked the contractor to expedite the fiber what we've done is we've added the video detection um for the intersection so the video detection should hopefully help with the timing of the signal it will and I appreciate that but I'd like to ask that you go back and see if if uh you can take the risk and put it in because the the best situation is if the Palm Beach County Traffic you know control center can take advantage of trying to time all the lights adjust uh now they can't so if if you and they can sync it up with the system to make it a little bit better yeah we could definitely ask Bon Beach County um we can definitely ask our contractor to expedite that work and to get that fiber installed and attached to the backbone as soon as possible that is something that we can do okay and I realize there's a risk but that that's going to make the situation as good as it can be as opposed to doing workarounds correct okay we can do that any questions a lot of my questions are answered but I'm just want to know what can we do to work with you folks to get this done as quickly as possible I think kind of so so right now back what the mayor said so we're working as fast as we can we're going to be working this weekend um Sunday night to hopefully open that ramp um the initial phasing of the project didn't show this till happening till later but we obviously because of the issue that we we have right now we're kicking that work up sooner to try and get this into final configuration there's ramp closure for Sunday night we pushed it through to make sure that we sped the work up to get that final configuration off the ramp as soon as possible same thing with the third and the fourth Lane we expedited that work already so to try and get that work done sooner to help traffic move through the intersection faster and then obviously what the mayor was saying with working with with with Palm Beach County and getting the fiber installed should help out as well um and we're just going to keep trying to work as fast as possible to alleviate the issue what's what can you put a date on when the three L the three lanes are up and running yes so the three lanes should be up and running Friday Friday November 22nd we should have three lanes this coming Friday this coming Friday and then some you said late January for the fourth Lane so I didn't say just January 2025 okay um sometime in January we will be opening that fourth Lane all the way through how can we speed that up there has to be a way I can I can talk to to my supervisors at do I can talk with the contractor I can see what we can do to speed that up we're still working we just finished the drainage in the eastbound Direction on the the east side of the c18 canal and the west of the of the c18 canal so now that the drainage is done we can go in and we can actually build the roadway once we build the roadway with the the granular material then we'll do the asphalt material once we do that then I still have to put a driveway at the west side of the canal on the c18 c18 canal for uh South Florida Water Management District I have to put guardrail right there just to protect anybody from driving off the ramp there hit the guard rail instead instead of going into the canal th those those things are are kind of the controlling items right there we can we can be in contact with the mayor we also have a counterpart that we deal with at the town with Thomas Hernandez we can be in contact with him and we can we can try and and see if we can do better on that date so you've already you've widened the bridge so the structure the bridge is the bridge is complete so the support for the road is there you just have to finish those odds at safety features l lay the gravel pavement and and it's open it up correct correct and the safety features which which includes the guard rail I have to get that guard rail in to pull that if you drive eastbound right now you'll see that the bridge is basically it is built it is built to the to the east side um sorry to the South Side when you're heading eastbound but there's a temporary concrete barrier wall that's sitting on top of the wall and it has a crash cushion attenuator at the front that attenuator is basically protecting everybody from two things one the new barrier wall doesn't have a crash Cushing on it it's going to have a guardrail transition and that guardrail transition is going to come off the bridge and it's going to wrap around the South florid Water Management District's driveway and I have to get that in to one protect the blunt end and two protect people from driving into the canal once that's in I can pull that wall and that fourth Lane is open all the way through and that's not a very sophisticated part of the project so I imagine that could get done fairly quickly all parts of the project very sophisticated but we can try and speed that up and see what we can do about opening that up sooner than January 2025 these are the dates that we feel comfortable advertising to you because these are the dates that we feel that we can hit uh I don't want to give you an unrealistic date I don't want to come in here and tell you everything's going to be done tomorrow and then it's not I understand that I'm just trying trying to find options to speed this up and we will We Will and we'll be in contact with the mayor also with our counterpart that comes to our meetings Thomas and we'll make sure that if there's anything that we can do to speed this up we will because I would imagine that because of the the route one drawbridge detour a lot of people changed their driving habits and probably went around 95 came in town the other direction I mean who knows how people change their habits there's probably an extra percentage of people coming in from the West into town and we all the snowb birds coming back Seasons here it's going to be a busy season in Florida so it's it's just imperative that we wrap this up at least on that section understood we agree with that we we want to wrap it up as soon as possible but as of right now the dates that we're giving you here are the dates that we know that we can hit okay thank you m j so for um yes Mr end Amerson um thank you very much for coming and I noticed there's no PE after your name was that an oversight uh yeah I I am a PE you are a professional engineer so am I um since 1990 so there's a a lot that goes into this and I appreciate and understand that um as this was initially being rolled out I was very skeptical of a traffic light addition alleviating traffic problems clearly adding Lanes will help M can you explain to our citizens how putting a light there would help the situation because that's counterintuitive I would like to so I'm deal with the construction part of the contract so if Jeff would you be able to so Jeff is my counterpart he's the design project manager with fdot so I'll let him answer that to the design phase okay great PE as well yes thank you um all right so the signalized intersection does two functions uh first of all if it it controls the intersection to back up the main priority of this project is to regulate the offramp from 95 to make sure that that traffic does not back up onto the main line so that is the the primary objective of the project and we did analysis and figured out that the bottleneck was at uh signal at Island Way and the best way to do that was to to put another signal at Indiantown uh at the offramp to kind of meter the traffic coming from the East to make sure that the offramp had capacity and time to get off and not back up on to 95 so that was northbound traffic you're worried that Northbound traffic would back up on that sweeping long ramp right so the the intent is to make sure that the queue does not back up onto the main line had that been witnessed do you live here I I live in in Wellington a little bit further south I'd never seen that happen so I thought I think you guys were fixing a problem that really wasn't there and in doing so I'm worried that you've made this much much worse by putting the traffic light there I've not seen traffic back up onto the Interstate that's that's not been a real problem so we we've done a lot of traffic studies and it it projects into uh based on a a increase in traffic based on you know population growth and other things and for the design year which was I think at the time uh 2030 that backup was projected and so that's what we were trying to protect against I'm surprised by that because I think we all agree we're a fairly well built out City so I'm surprised you're seeing a a very large traffic projection so the the traffic light was not added to alleviate really so much the eastbound traffic you're saying it was installed to alleviate a potential future backup on the interstate yes did I get that right I think it's a horrible mistake um I I think the traffic light addition is going to create a a nightmare out there that's going to live with us forever now well in it when we did the study we did identify that it did create an impact and that's why we mitigated by adding the additional Lanes um in the eastbound Direction so instead of two lanes you'll to have four lanes All The Way to Central had you considered leaving the the existing ramp and adding the light to try to seems like what you're doing what I'd heard before is people getting off the Northbound ramp to go eastbound or then having to go uh switch lanes all the way over to the north turn onto Island Way yes and which I believe is a small percentage of the traffic if you just travel through there like all of us do every day you don't see a lot of people peeling off to go off on island you see some but I wouldn't consider it a bulk of the the traffic that's traveling through there um I think that exit ramp worked perfectly as it was before it was a great design and I have a real problem with this intuitively and in practice now it seems um do you think we're going to get back to normal fairly quickly with these additional Lanes I I think with the additional Lanes once the project is complete it it will be a better condition than than it was before was there any consideration given leaving the existing ramp and adding the light um leaving the ramp so it's that long you know High fairly High it used to be U 65 mph exit we heard earlier the super for everybody who doesn't know super elevation is the banking of a roadway so you can take it at a higher speed and keep you from flying off kind of like NASCAR see at Sebring where the roadway is banked that's why we have this one foot Li there is because that ramp was built to take it at a fairly high speed and traffic was moving off the interstate quickly this is going to back up it's it's inevitable it's going to back up but it's also immediately affecting eastbound traffic terrible the situation I think and I don't know how we got into this without a little bit more thinking about possibly leaving the existing ramp I know you've got super elevation that you would have had to taper down you'd have to somehow clean that that up so they merge in there but it it seems very counterintuitive to remove that long sweeping lane and then go to a a signalization plan it just doesn't seem like that really is the smart way to approach this um the studies though you you're showing are projection studies not not studies that would show current situations the the study was conducted based on traffic um we actually you know went out and did traffic for the entire area um the study was based on on that data I'm I'm sure you can't remember this but do you have any idea what the percentage of traffic that was peeling off to go north on Island Way was I do not know we we're changing all this around for that small amount of traffic and I think that was a mistake and I don't I don't I don't see how we get out of this now it's a DOT project it's not a Jupiter project we can't control this um but our citizens are rightfully so very IR about what's going on it has not helped us in the short term I get it that you're not fully there yet so only time will tell but I feel like we have no choice now we're going to be stuck with whatever we have and I I I just don't feel good about this it doesn't feel like it's the right approach I will say that we we coordinated with the town and the county I mean this it's we don't work in a vacuum um and this is what we came up with i i attended several of the meetings and I expressed these concerns all all the way along the way so I I appreciate you're saying you coordinated with us but we really have no say in it um these are these are DOT projects these are not within our realm to change anything and despite our protesting it it happened anyway so I I appreciate it and a lot of good things have happened with the coordination it it needed to be widened we needed sidewalks there the bridge needed to be widen and so lots of good has come out of it and it's certainly good that it's done all the way up to Central and that's a really good coordination that pulled that off where we're going to I think eventually get some money from state to help fund that that project to uh Central but in the meantime I just have grave concern about this in the long term it just doesn't feel good um again I don't see anything that we can do to get out of it now I think we're stuck with it so hopefully you know again try your very best to expedite this as much as you can M we are right now coming into where we're going to have a full whole crunch of people coming here anything that can be done what can we do to help you do it is there anything that the town can do to help expedite does so as a construction because Jeff's only in design so I hand the construction side so you're kind of done so we already kind of discussed this we're working as fast we're working as fast as we possibly can if there's anything that we can do we're going to we're going to do it try and expedite this the dates that we're we're showing here are the dates that that we know we can hit um but we're going to try and work on that January 2025 date and we're going to try and work on getting that fiber backbone installed uh sooner than the dates that are here but the dates that we're advertising are the dates that we know we can hit all materials have been purchased I'm assuming at this latest stage all shop drawings are approved material has been purchased fabricated um it's either on site or it's nearby at one of our um contractors uh warehouses uh but yes everything's been purchased everything's done please let us know if there's something the town can do we'll we'll help you in any way we can Ju Just continue with uh the public Outreach we appreciate that we try and give you guys all the information that we have and then you guys push it out so we do appreciate your help with with with pushing our information to your to the town to anybody who follows the town as well okay thank you thank you both I had one more question what time of year did you do your traffic study February okay Pig okay Peak vice mayor I have no question is this on is the mic on can you guys okay um I I have no questions at this time I think many of them were asked by um counselor for um I do want to thank you though for coming tonight to speak to our residents and for all those watching so we are very appreciative I know there's been a lot of focus on this project a lot of curiosity um you know just to to kind of with what's in people's minds and what they're seeing on the road which has been very difficult especially with 95 and the risk of accidents that's I mean I experienced that one morning but to replace that with the data to know that it's a temporary condition is helpful I'm optimistic that things will improve um but like councelor for said you know anything we can do to expedite this anything you can do to expedite this I hope you will and thank you again for coming thank you me um I so my first question is prior to the construction of the the light and the removal of this offramp 95 we used to have two lanes would exit correct onto Indian toown Road coming from 95 right are we going back to two lanes exiting from 95 yes okay Sunday night we're going to be working on that Monday morning it should be like that one lane will be dedicated off the second lane will be a uh you can make your decision if you want to go you can go Indiantown Road if not you can continue Northbound okay just and I know a lot of people here will probably when they speak if they want to give citizen comments later they're going to talk about the amount of accidents we've seen in the last few days on 995 you know I personally have run more accidents on 95 in the last two shifts than I have in the last month and a half because of this you know the one lane only one lane being dedicated to to exit so well the the one lane that's coming off the ramp right now has been in that configuration since February of 2024 so yeah but there was no light back in traffic on 95 but yes you're correct I just wanted to reiterate that we did take it down to one light in February yeah and we should be opening it up on Monday yeah it just once the light activated obviously traffic started back in the 95 we were having major issues cars were flying by these cars that were stopped going 70 miles an hour and people are trying to jump out whatever it may be holding up traffic and you know just yesterday I had two accidents in the same exact spot within three hours of each other so the the sooner you guys can get the two lanes coming off the better I appreciate you giving the update you know saying that you're going to expedite and try to get it done as quickly as possible so um I'm concerned about the eastbound traffic still even with this you know uh Lane um I'm not sure if there's an additional buffer zone that you can add to the south side of uh eastbound for emergency vehicles and I'll just give you an example as to why because I was traveling from Jupiter Farms trying to get to the hospital with a patient and the traffic was backed up so bad we ended up delivering a baby in the back of the truck because we couldn't get to the hospital in time okay so just because of the amount of traffic um so it's it's very concerning and I know a lot of the the residents that are coming from Jupiter Farms that work in the town are getting backed up you know the first day we are backed up all the way to Publix's out in the Farms yes so there's an additional buffer zone that can be added in any ways for either police or fire to get going east found to get around traffic that may be backed up at the light I don't know if it's something that can be factored in at this point but it's it's currently not in our our design or our construction plans to build anything west of the 95 ramps right now we don't have anything that's not part of the scope of this project so that would be a scope increase that would have to be something that would have to come from the dot and then we have to design it that's not something that's part of this project the choke the choke point now is 95 once we get past 95 that's why we open to four four lanes there because we have the we have the area once you're underneath 95 and over the turnpike we don't have the area right there right now for us to build anything in addition to what is already proposed to be built so what we're showing you right now is the only thing that I'm authorized to build at this time okay I don't if if something you can look into i' appreciate it cuz you know if we have an accident on 95 and traffic's backed up we have emergency lanes that we can travel on to get around the the back up traffic right um and particularly if you have a traffic light like this and traffic is stopped and it's backed up all the way up under 95 emergency vehicles aren't going to be able to travel eastbound uh they're going to be stuck in that traffic um I know we're going to try to add praic traffic preemption hopefully it'll be added to this light as well um but anytime there's an emergency area a buffer zone near a traffic light it significantly helps our responses especially in this area if we're trying to get from our residents that are west of 95 if we're trying to get them to the hospital you know in an expedited manner it would you know greatly help that we're not sitting backed up in traffic so I can talk with my supervisors and see if there's something that we can do but like I said I don't want to promise anything that we're not going to be able to do at this point in time the only thing that I'm authorized to build is what we're showing you right now but that we can discuss that with the dot um the mayor can discuss with us as well and if we're authorized to do more work we can do more work but at this point in time this is this is the only scope of project that I'm allowed to do okay thank you for the update so um again on behalf of the Town um I want to thank you for coming here tonight I realize that things have been expedited since the 14th um although we didn't get dates I know they were out further so I know that fot is doing the best that it can under the circumstances correct um and no one can change history now but obviously we're going to be in a much better situation you know a week later from when it opened having a third right turn lane off of 95 that gets clears that out and then a third right turn north eastbound Lane available to people coming from the West so uh so then if you can get the fiber Cable in and I appreciate the workarounds doing everything manually and and but that's the best of all scenarios is that uh County Traffic uh Center can adjust on the Fly i' I've I've seen them in action doing that you know further east um so thank you um and if you could get back with us on the fiber cable uh I could be contact with Thomas my my that's good thank you we'll let him know we'll keep him in the loop and he's what he's we um almost on a daily basis so he'll be aware and U I'm sure he'll be asking me and then we'll follow up with the contractor and try and get back to you as soon as possible thank you and now I want to put you on a spot which I've never done anybody before but there's a number of people that came here U concerned about this and uh where we conducted it is you gave you gave a presentation you answered and addressed every questions that we put out there um if you don't mind if there's any and hopefully residents questions were answered from hearing this U but if you don't mind standing around for extra 10 minutes or so in the outside of the council chambers so yeah I'll be here answer construction questions je Jeff will be here to answer right outside of the council chamber so I I just offer that to Residents that thought that they might have covered under citizen comments because the town does not have any jurisdiction over this um and you just heard everything that f has done and is planning to do so thank you very much thank you okay um now we're going to be moving on to Citizen comments this is a portion of the agenda for public comments for any non-agenda items and is limited to 3 minutes per speaker anyone wishing to speak at this time is asked to go to the podium and state his or her name and address for the record prior to addressing the Town Council it's our policy uh to place citizen comments on the front of the agenda uh before we move ahead with the scheduled agenda item this way residents don't have to stay for a long meeting um and then we take follow-up actions at a later time so with that I'll open up to the citizen comments first we have Joan Daly and then Susan Thomas thank you to the clerk and to our councilman Mr Mayor I've been here several times before my professional career but now I'm retired and I'm a volunteer at Jupiter Medical Center through three days a week I leave Jupiter Country Club out west and I report to the hospital I'm not paid I do a lot of work but you know what right now I can't get there when I try to pull out of Jupiter Country Club and I know there's a lot of other people here will tell you I'm not only backed up in the queue to get out of my neighborhood I can't even get on to Indian toown Road people coming from Sonata across the street they block the intersection people moving ahead are blocked by the people coming off the turnpike they block the intersection I would like to the gentleman he says he's out there queuing come stand on my corner for 10 minutes between 7:30 and 9:30 a.m. and see what it's like I finally after 10 minutes will get on I95 I will go down to Donald Cross Road and come up Military Trail and get to Jupiter hospital a year ago my husband collapsed in the shower within 8 minutes Palm Beach County fire rescue was there but they came from West on Indian toown Road past Publix how long is it's going to take for them to get there now just to my house and then put him on a stretcher and then try to get out of my development well maybe they can get on I95 in about 10 minutes after that and 20 minutes later you make to Jupiter Medical Center this is outrageous it is a safety issue as opposed to being being physically and emotionally involved in buying a home where I'm now I can't even go out to dinner had try to head out at night Head West 5 o'clock Head East 5 o'clock at night I want to go to Jetties do you know how long it takes me to get there going through that light takes me 10 or 15 minutes it's just a shame it's a lifestyle it's the town of Jupiter I know you didn't create it but I think that there's more that these people could do out there I think they could come out and be more proactive and I think sometimes maybe I could beg my son's a policeman so I have to beg one of our officers maybe to come out one morning and just keep keep people from blocking the intersection they just come across they just sit there I can't turn out my light's green but I can't go because they can't go they've blocked the intersection just gridlocked so I could either get up at 6:30 in the morning I could volunteer later I guess but I'm still concerned about the emergencies because it is there's nowhere to go there's nowhere for that ambulance to turn and there's no way for us to solve that problem unless they get these lights functioning really well really quickly thank you Suzanne Thomas good evening and uh greetings to the mayor and the Town Council appreciate you doing your jobs here for us I am I am Suzanne Thomas I live at 17145 Bay Street I have lived in Jupiter's for 30 years a transplant from Kansas City and I've always been an animal animal Advocate and I noticed the compassion of Jupiter with the Jupiter Beach uh for the dogs and so forth even if if an animal gets lost on next door the community just lights up and works together to find the missing pet and so forth so I want to thank the town of Jupiter for on the Veterans Day of the memorial it was it was highly impactful for my husband and when I was there I said to myself perhaps we can get something that can also be a positive influence into the community and I provided a PowerPoint presentation that I had given to um copies to each of you and I propose a fabrication of a bridge which will not interfere with traffic and that is of course was would considered a rainbow bridge at squez Park I'm passionate not only about the physical but the mental health and well-being of our community and I believe that this will be a tremendous community outreach which may also soften the opinions of the community relative to the fire department being built in that general area as well yeah I got the idea from North Carolina they had a Rainbow Bridge there that was very positive uh they they lost the bridge in the in the lake in the hurricane Helen storm but you'll see pictures of the the collars and the tags and so on and and it provided um great Solace to the to that community and I think that we could benefit from that as well I also provided some prefab bridges that can be available online doesn't have to be custom made and obviously it's not actually crossing over a body of water it's just ceremonial and I also provided pictures of in the squez park uh which is by the lake portion Not underneath the banion tree but rather on the opposite side of the lake where there's already a memorial stone so I was just offering this as a suggestion and uh I also sent the PowerPoint to U Miss Christian George of the Parks and Recreation Department for consideration and I thank you for your time Wayne pner good evening Council um Wayne pner 315 Karina Drive Jupiter Florida also a resident of Jupiter Country Club um I think this person had a great idea for a temporary fix uh if we have an officer at that corner where Sonoma and Jupiter Country Club come together it backs up all the way to Publix and people get tents and if there's an officer there that can just get the traffic to flow and let one car after another go through would be a great help and it would only be temporary as we heard they're going to be opening up some lanes and the lights um I hope the ends justify the means um maybe the means should have been checked a little closer and um no offense against Andy for who I really like appointed to the Planning and Zoning when I was on Council um maybe we just have to take the pain like you go to a doctor and get a needle and and next thing you know you're better so um from a perspective as of a builder you know you will now have four lanes to stack cars where we only had two lanes before so the stacking of the cars May alleviate some of the traffic on 95 I'm hoping that's the way it's going to work and if it's timed properly it'll continue to move the traffic in a more organized fashion so people don't try to squeeze in in the lanes between each other maybe some less accident some hoping so you know it's a kind of a wait and see it's kind of like what we did with the bridge when I was on Council um everyone was against it and I'm sure in a month from now when they start opening that bridge people are going to be pretty happy so a little patience I know it's tough and some people unfortunately may have gotten injured and thank you Cam for doing what you do um sorry to see Andy not continuing his job I thank you for your service um I'm glad you're here and for the rest I really support the fire rescue the new fire rescue for the town of jup I want everybody to know that I believe I'm on the committee that um hears all the new things that they're doing and very excited about that coming through for us and I hope we continue to do that um through the election and continue to get the fire rescue uh done um i' also like to say that um since we're talking about roads I'm still a proponent of fixing the town roads that um our citizens pay taxes for their whole lives and we need to get it program together I know the excuse was if we let fix one person's Road everybody's going to come into the town and get their road fixed I think if we have a program where it's stepped as people come in they get in line we fix their roads I know we give money to improvements for land cape and things like that for HOAs so I hope the council starts to look forward down the road and start fixing people's roads thank you next we have Lori Bailey good evening um I'm Lori Bailey I live at 504 North lockah hatchee Drive in Jupiter I just have a couple of issues one of them may not be something to ask you guys but but forgive me if it's the wrong thing to do but um a couple of years ago I had um gotten in contact with I believe her name was Katherine or Kathleen morasco I think in the building department she has left employment of of the town but it was about the bench for the bus stop next to Wendy's which was apparently damaged years ago and about half of the bench was gone and the overhead protection um and the front protection and I brought that to her attention probably a couple of years ago that maybe it should be improved because people that are riding the bus are often elderly um Andor disabled can't drive whatever and she told me that the last time I met with her um that there was funding being available this year to improve that bench but I haven't seen anything so I wonder if someone can look into that perhaps and let me know if that's going to be improved so that was the number one thing the other thing is um which I don't know if it's relevant to you guys but um with all the construction here and there's a utility payment for the water payment for your water bill um and I brought that to their attention once before it's on the wrong side of the street if you're driving the Dropbox to pay your water bill is on the right hand side unless you have a passenger in the vehicle you can't reach out and put the payment in there you have to stop your car put it in neutral get out walk around and put the payment in there so I've asked why they put it on the right side it's always been on the left side for people in the past so I don't know if that's permanent or what but okay thank you thank you tenifer realit my name is Jennifer Reitz I live at 1296 Sandy run in Jupiter Farms um I'm one of the thousands of Jupiter Farmers who's now stuck in traffic every day it's usually backed up to River Ben park or the 7-Eleven um just for moms trying to get their kids to school for business owners trying operative business for people trying to have a baby um my husband who works out at Pratt and Whitney was very um unhappy when he saw the light going up kind of like counselor for said lights don't usually alleviate traffic they usually make it worse so um I originally came here for that but I'm also a local um author I wrote a book called Food Forest Revolution um there are parts of the town like right the median next to Central where you've got some really good regenerative practices going on I don't know if you're aware of that there's like a low ground cover called pral Peanut with yellow flowers um I don't know what the town's um principles are when it comes to Landscaping but there are lots of great practices like where you're planting plants like that aren't grass and medians so they don't require maintenance don't need to be watered they're nitrogen fixing they're good for pollinators so I speak in um libraries at conferences uh across the state on things like this so I don't know if there's any kind of committees or things where my input could be helpful but there are times where we're spending an inornate amount of money on plants that require uh maintenance and fertilizers and things that aren't really good for our environment when we could be selecting plants that require zero maintenance are great for local ecology so I know we can't really change the traffic situation that's why I came CU I was just tired of sitting in tons of traffic every morning but if there's any way that I can be helpful on the landscape agriculture front uh you got my name so last one we have is Linda mcdermit good evening Linda mcdermit 107 Chadwick Drive I just wanted to mention um on November 5th that voters approved amendment number five and this vote meant that the majority of property owners agreed to an annual adjust investment to apply to value of certain Homestead exemptions so this means that on the second second homestead exemption there would be adjustments each year based on inflation growth this is estimated to create an average property tax savings to about $20 per household over first five years of implementation this savings to taxpayers means less Revenue to each municipality this is estimated cost Florida $140 million annually so I really believe that we are very fortunate because the town has sufficient reserves to cover the minimal impact that it's going to make but revenues may not be flowing in as they have been with the property values we've enjoyed with the town having done long-term financial planning to utilize reserves for building a new fired department and other capital projects it's critical to know the estimated figure now so the public can be informed if it may result in any Capital project delays or increases in program or service fees or if we have to make a lost property tax value um I'm asking if the finance uh director can provide some estimates of Revenue loss to the town of Jupiter so the public can be informed um and also I'd like to ask ask for the business impact of the proposed fire assessment fees that the town plans on to finance the Jupiter Fire Department in 2026 please again I mentioned I do believe the town has done a good job with the reserves um I don't believe that we're going to feel the impact of this but like with anything that the state or any amendments sometimes the public is not really aware of the full impact of what we're saying yes or no to it may be good for their pockets but $20 I voted no for this because I'd rather see Jupiter utilize my money for the police or if it may be fire or whatever but as it was the public voted for it so I think it might be a good um thing for Scott to come up with some figures at some point time soon thank you that was the last that's it okay moving on to the minutes Council we have before us the minutes of the October 15th Town council meeting I don't see any revisions on the Das if there's none I'll take a motion to approve the minutes motion to approve second Motion in the second all in favor signify by by saying I hi motion carries unanimously moving on to item number 12 which was uh pulled uh by myself and Council May um I just pulled this item I wanted to this is an item where the Jupiter Police Department's existing rescue vehicle is 9 years old and new regulations by the Department of Defense have made the existing rescue vehicle unusable by Jupiter Police Department the new vehicle will perform all the functions of the existing vehicle and keep our office officer safe from doing operations I think the prior vehicle had actually perhaps saved one police officer's life um during one event uh the vehicle would also serve as a high water rescue vehicle during flood events during the town can rescue individuals who are in an area affected by flooding really thought was appropriate and we'll get other times to do this as well but to thank the foundation um the Jupiter uh police foundation um which was formed back in 2017 um has really shown unwavering support to our Police Department it's Community programs and and really most importantly our offic in need and so they're making a generous donation of $600,000 uh on this item and um I really would be remiss uh on behalf of my colleagues and everyone in our Police Department uh to really Express in voting to accept the donation to express uh profusely our gratitude the Jupiter police foundation support has been instrumental you know in keeping our community safe and well and so on behalf of the Town Council and the men and women of the Jupiter Police Department and I thank everyone who supports the Jupiter police foundation and its Board of Directors for their commitment to our Police Department in our town C okay yeah I just wanted to Echo you know kind of what you said I figured you were going to pull it for the same reason I just want to say thank you to the Jupiter police foundation for you know all their support of the Jupiter Police Department uh really helps to alleviate some some of our tax burden when we're supporting the police department um this vehicle is well needed I've talked to a lot of officers the other one's uh the old one is pretty outdated it's taken some shots uh literally and figuratively so um you know I appreciate you guys you know stepping up and doing this and uh donating this vehicle for the town I know uh Jay alpert's here so I just wanted to say thank you uh for all your guys' support and uh you know I really enjoy having that relationship between the town and and the police department and uh Jupiter police foundation so thank you and I don't know what if the town manager would like to add anything please do yes mayor thank you the opportunity um first of all I want to thank the Jupiter police foundation and uh interestingly I have Attorney Kevin Smith here in the audience with this and he was part of the original group um along with retired Captain Drake and uh I remember meeting in our conference room and proposing the idea and we didn't have anything and we thought it was a big to-do when we raised $10,000 and so um if you remember that and now Jay Albert the executive director has come along and taken this police foundation to a whole another level and I can't thank these gentlemen enough and all of the citizens that have contributed um because this is a this is something that many communities don't have and uh and the support that we get from the community for the Jupiter Police Department is just really quite remarkable and I promise you with 42 years in law enforcement that this vehicle that this uh Foundation is donating will save an officer's life somewhere down the road if not another Citizen's life and so I would like to as a retired police chief and city manager uh say thank you to uh Kevin and to Jay and to all the members of the board and thank you so much for this it's just really quite remarkable and it's heartwarming to see where this Foundation is today and where it's going in the future so thank you guys very much appreciate that can I just ask the foundation members that are present to and you [Applause] recognized okay I'll take a motion in a second on uh agenda item 12 motion to approve second uh emails that are public record I have a couple of experte number one in mid mid-september before the last uh scheduled hearing I walked the entirety of the site and perimeter to understand the surrounding properties on September 18th I brief briefly spoke with George gel after a chamber event breakfast suggesting that they remove the item from the that night's meeting agenda until code compliance issues could be resolved and that subsequently happened and then I've certainly received a number of uh emails as I'm sure we all have from members of the public uh the intervenor and um and also U the applicant so uh that was my expertise mayed one where I also walk the site couple of days a couple of days ago I did walk the site and it's um around the perimeter and um took a look at the uh the Water Area um I met with the applicant and in September I received a number of um emails from residents both for it and against it um and I've had a number of conversations with the intervener um received uh emails uh as well for and against and uh on November 13th I had a meeting uh with the applicant and uh Mr Gentile in his office okay so um this item and I'm going to ask the town attorney to respectfully keep me in line if I'm not following the quad which I have right here uh but we do have uh an intervener correct so we have that's my understanding okay um is that is that correct Mr sickler there's an intervenor yes matowski um submitted a request to be an intervener in the process okay um so um I'm going to ask um that all those Witnesses of the representatives or Witnesses of any parties uh that uh could give testimony at tonight's hearing to stand and be sworn in do you solemnly swear that the testimony you are about to give in this hearing is the whole truth and nothing but the truth okay uh just the next three items I'll just say so we'll proceed with the applicant presenting its uh application limited to 15 minutes time can be reserved followed up by the Planning and Zoning staff again limited to 15 minutes um can be reserved and then the intervener then can present its facts and evidence and again they'd be uh limited to 15 minutes uh uh inclusive any of any closing arguments or rebuttals with that I'll turn it over the applicant to kick off the presentation good evening Council mayor uh for the record Troy Holloway with 2gh uh we're here on behalf of the applicant and index Investment Group uh we're here tonight uh presenting to you Flagler Warf uh we're here tonight um we're seeking a use by right site plan approval to redevelop the pre-existing 2.95 acre Bells mobile home park uh with a two-story 3300 ft Waterfront Cafe uh with 1200 ft of covered outdoor dining which would be on the first floor and 2700 ft of professional office be located on the second floor uh with that we're also requesting a special exception to refurbish an existing uh refurbish reconfigure and restore the existing 50-year-old 14 slip uh boat slips there to 12 slips um as you all have walked the property you're very familiar with the location uh northeast corner of alter A1A uh at Old Jupiter Beach Road Old Jupiter Beach Road there to the south side of the property um and ab budding the canal to the north side um I'm just going to give you kind of a brief history the pictures in these uh history kind of in these slides are all pictures of the mobile home park uh back in 2016 when it was purchased by index Investment Group uh the Bell it was a Bell's mobile home park which consisted of approximately 31 mobile homes um it did have a 14 slip Marina until 2016 which at that time was purchased by the index Investment Group um at that time it was strongly suggested to them by the town to relocate the residents and clean up the property uh which they did right away in 2019 they did file for an application for an 85 bed Alf in Marina which was then later withdrawn due to the kind of negative uh uh attention here at the Town um they did have initial discussions after that was withdrawn with with Town staff to rezone this property for a residential use uh but the town staff kind of expressed their desire to keep this property as a as commercial as it is within a pretty strong commercial Corridor there uh along alter A1A um then we then began a process in mid 21 uh with a larger project than this one we're presenting to you tonight with retail medical and professional office accessory residential a cafe and renovated Marina uh that project um went in front of the pnz in November 23 and received a recommendation for denial uh we then immediately met with staff in December 23 uh started talking about we had discussions on where to go with the plan and which brought us to the plan you're currently reviewing here tonight um see real quickly too that's just a shot of the marina as it was back in 2016 uh for the marina for the mobile home park uh this is the current site plan um proposed to you uh we've got a two-story Cafe office uh which is situated on the canal which will be on the uh well refurbished boat slip there uh the project would have one means of egress only into the project from old Jupiter Beach Road there to the South we had no exit on that on that driveway and then an Ingress and egress there on to altern A1A into the project uh we will be relocating two trees two large very large trees on the property um we'll be relocating an 8ot sidewalk into the property there'll be a six foot screen wall along the entire Eastern property line uh we'll also be providing for a 12ft drainage easement that would be dedicated to the town for storm water uh an outfall from on Jupiter Beach Road which has some drainage issues on it today um and the boat slips of those 12 slips those will be strictly leased out uh to the community at large it will not be uh for the restaurant use there'll be no transient docks at that Marina this is just a blow up of the office itself the yellow there that's the highlighted would be the outdoor or dining areas for for the most part they'd be situated facing the water um we've also got the building so it's oriented to engage with A1A with direct pedestrian access to the facility itself we'll be providing a historical marker um and some seating um along A1A that would give a nice view of the uh Marina and Canal um there was also a 15t utility easement that was dedicated to the town as well um the owner worked with the town and providing this easement so that the town could also so they could provide some storm water outfall from Juno Street which would is west of alternate A1A um around the marina we're going to have some up in transitional plantings um surrounding the entire Marina and as well as some rip wrap and Mangrove plantings surrounding 100% of that of the slips this property is zoned uh it is land use commercial it is zoned C2 General commercial it lies within the Center Street uh A1A Roa with a residential overlay uh or the Redevelopment overlay I'm sorry um the maximum the maximum Building height here is 60 feet we proposed only 34 foot maximum height lock coverage is 7% Max is 35 um in the parking we have 84 spaces provided 77 are required uh the architecture I think the Architects did a great job on this building it does look it looks really nice um it does provide for a full standing metal seam roof a full wraparound covered porch on the entire first floor uh it has second floor balconies a lot of Windows um decorative Tower elements some decorative lighting uh rooftop Dormers a lot of architectural treatments um they did a really nice job this is the north elevation that would be facing the marina that facing the canal and this would be that same building facing south facing the the parking area uh these are the East and West elevations uh the west elevation there on the right hand side would be facing A1A again has direct pedestrian access to the s to the sidewalk and the roadway again these are just the renderings of that building this is a rendering of the building facing south obviously this is facing the marina uh we can come back to these if you have questions I don't spend too much time on the architecture uh this is the front of the building as it sits on A1A has a very nice historic field to it uh the porch as you can see the porch is has a nice elevation there it's elevated up a few steps up which is very nice and then this would be the historical marker where they would go with some seating facing the marina itself some of the Marine environmental enhancements that this project will be making um South Flor Water Management has permitted and stated that no adverse water quality impacts are anticipated as a result of this proposed project and they also state that no benic resources or seagrasses currently exist in the area which are marine life food sources such as starfish oysters clams sea cucumbers sea grasses seag grasses Etc the Florida Department's uh state of uh division of historical resources indicates that no significant archaeological or historical resources have been recorded in this Project's area I'm sure they may find some as they get working on it uh no liver boards will be allowed with this Marina no commercial vessels no Ship Store no fueling or fish cleaning facilities or would be allowed I know we do call the marina as the code is the town code requires anything over two slips is considered a marina so I don't really consider this a marina but it's just 12 boat slips uh the dredging will take place they'll be removing four feet of silt and debris from the canal floor and and expanding the dead end turning Basin for this uh 60 foot public rideway Canal um these plans do meet all comp plant policies and provides following Marine improvements does provide for concrete p filings to encourage oyster growth provides required Shoreline buffer zone for their 100% of the Upland Edge as well of Mangrove plantings along 100% as well it does provide for uh educational and historical signage including manate and sea turtle Zone signage uh it will increase the flushing capacity uh slightly through the widening of the canal and the annual flow of the uh the pipe that the town did put in around 41 million gallons of filtered storm water and then again with the flow from the old Jupiter Beach Road piping some of the project benefits since purchasing the property in 2016 uh index Investment Group has relocated the residences provided uh removed the blighted and dilapitated homes and completely cleaned up the property uh they provided the town with an easement for the storm pipe that I mentioned uh from Old Dixie Highway uh that will be providing them an easement to Old Jupiter Beach Road we'll be relocating two trees uh the which are currently doing okay they're not surviving well we're going to move them and raise them up four to 5 feet because the uh currently the property is so low that they're getting saltwater intrusion and they're probably 50% uh Survivor right survivability right now I will provide safer pedestrian uh experience by completely removing the existing sidewalk and moving it into the property uh separating that walkway about 8 ft from A1A and and Landscaping that as well they'll be undergrounding the overhead wires along Old jupyter Beach Road refurbishing and and of course restoring and dredging out the 50-year-old plus uh area there uh the old bulkhead boat slips and Basin we'll also be Shifting the existing bulkhead and slips slightly Southward um which will remove those boat slips kind of with right now they're kind of inside of that Canal rideway so that will help get those out of that rideway which will also help with the title flushing uh the refurbished Bo slips will continue to provide water access to Jupiter residents who are not as fortunate to live on the water uh this will place we also place a historic marker near near the marina Edge to celebrate the history of this area as well as educational signage regarding the marine environment and habitat um this project will make environmental enhancements to the canal by utilizing rip wrap planting mangroves and concrete pilings to stimulate marine life and providing Upland habitat uh pomes County uh traffic has determined that this project does meet the traffic performance standards of the county uh the boat slips have current approvals from South Florida and army Corp of Engineers we requesting no variances as this project does meet all special exception in site plan review criteria and is compliant with all zoning codes and comp plan uh requirements it provides a substantial increase in aborm taxes the landscape plan also exceeds All Landscape uh code requirements um and the quality of this commercial Redevelopment will set the standard for other Parcels to follow within this Corridor which is very much needed and we also agreed to to all of the conditions of approval thank you okay uh four minutes two seconds left um staff good evening mayor members of the council um for the record my name is Martin Schneider I'm with the town planning and zoning department and I'll uh uh give a brief presentation um this item was postponed from the September 18th Town council meeting due to a code violation on the property that Code Compliance violation um was brought into compliance on October 24th uh the application is generally consistent with the comprehensive plan to ensure consistency staff recommended conditions related to living Shoreline and provision of a Marine uh storage ship plan staff finds the application compliant with the town's Land Development regulations specifically the uh Center Street North alternate A1A Redevelopment overlay area also known as AOA um contingent on the Town Council um acceptance of the north alternate A1A as the property Frontage which is consistent with properties north and south of this property and also consistent with the uh planning principles of Thea staff finds the uh that the special exception for the marina use satisfies the review criteria with the conditions of approval related to um limiting boat size and restricting commercial veh uh vessels the um Planning and Zoning commission recommended approval of the project with additional conditions um also to reduce potential impacts from the Marina and the restaurant a few of the conditions that were added based on their um recommendation was there no Liv boards at the marina they required the owner to install decorative lock gating system for the marina to prevent the transient use of the slips for the restaurant so those are meant for private um leasing or ownership uh no slip rental to non uh individuals companies or clubs and no subing of slips and it also restricted the restaurant's liquor license to a 4 cop SF s which is special uh Food Services establishment which means that the restaurant's required to um make more than 51% of profits from um the from food and non-alcoholic beverages that is to prevent it from turning into a bar and if if they wanted to do something like that they'd have to come back to uh through the process and to the council to change that just wanted to clarify a couple of um the applicant's comments the um staff did not make a recommendation that they close the park staff ex explained the Florida stat uh state regulations regarding Clos closing mobile home parks and um you know the rules required for assisting existing tenants with relocation um and the applicant also said that the request for uh special exception was to refurbish and restore the existing boat slips but it is significantly more than that um there was no documentation found approving the original slips um the marina project increases the size of the Basin through dredging and adds new seaw walls along with a margal dock um and it also adds rip wrap and living Shoreline so it is a uh it would require a full Marina special exception review and approval with that um i' complete my U presentation and any reserve any time uh for rebuttal and I can take any questions thank you okay uh the inter Viner good evening council members and mayor my name is Matt sowy I live at 109 old jupy Beach Road and I'm uh pretty much couple hundred feet away from where the proposed project is uh going to be built um I think the focus needs to be first on the rules for the special exception um very simply um it's pretty clear that you have to meet all of the requirements for a special exception and the two things that stand out um is that it can't be detrimental to the surrounding Property Owners um and it also has to be compatible um what we're talking about doing here is we're incre increasing pretty significantly the number of people who will be using this canal uh the degree of noise odor and potential nuis nuisances are also going to increase um traffic flow is going to increase um not only for cars but this is on a residential Canal so we are proposing to add uh 12 boats 40 ft um there will be people coming to look at the restaurant and this is a very quiet residential Canal so we are setting a template and setting an example with the special exception something that has never been done before um and I don't believe that we're meeting the high bar set for a special exception in leude of the fact that this will be detrimental to the residents on the canal um I have uh forwarded you a letter I believe eight of the people who live on this canal are fully opposed I do not believe other than the developer's son that you are going to have a resident who lives on this canal that is going to get up and speak to you you and say they're in support of this so it clearly has a detrimental impact in terms of what we're doing we are putting a restaurant bar in Marina with a liquor license on a residential canal with 12 boats um so I think it's going to be a significant um change to our residential canal and I also think um that it's not something that'll be uh beneficial um this will affect the property values of every home owner on this canal we will be the only canal in Jupiter with a restaurant bar and Marina on it um when a prospective buyer comes to our home and finds out that there is 12 40ft center consoles and a restaurant Barn Marine at the end of it I think they're going to either look for a different perspective location as I would have if I ever thought that this was even a chance or they're going to want a discount in lie of the fact that there's going to be a significant amount of activity up and down this canal um the next U main point um this is a small dead end Canal um there is not a significant amount of tidal flow that um is on this canal in fact as a result of the storm drain that comes from the industrial park across the street all the residents over the last 18 months have discussed the fact that water quality has uh really deteriorated pretty quickly um in addition to that we're now going to put a large parking lot and have additional storm water draining into this canal storm water drainage is not a positive it's a negative um so I think we're going to continue to compromise um what's going on in this in a very small area um we're talking about adding 12 40ft center consoles each one of those boats carries anywhere from 350 to 500 ft of GA 350 to 500 gallons of gasoline um which equates to almost 6,000 gallons of gas each boat these are half a million to million dollar center consoles that we're talking about this is not slips for the average person um rents on these could probably range anywhere from $1,500 to $3,000 a month so the average baybo Jupiter resident is not going to be putting their boat here these boats uh hold anywhere from three to five batteries um they also hold 20 gallons of blackw waterwater which they carry as a result of having a head on board um and most of those boats can discharge those and if somebody comes in from a long day and didn't do it offshore or didn't pump out someplace else they might do it right there in the canal um and that's something that can happen does happen and likely will happen additionally we're talking about almost 84 seats on the water it's a really large amount of seating outside on a residential Canal um we're talking about straws napkins cigarettes bottles if it can fly into the canal it will and it can and that is going to increase the amount of trash in the water in this um location um we've talked about noise and L the the fact that this is going to be a full liquor uh restaurant the only limitation was put on by um someone on the Planning and Zoning Board who as an afterthought said hey this this might not be a good idea to have a full liquor license um on a bar restaurant on a residential Canal but other than that it was going to be proposed as something else um each one of these boats is going to carry three to four large Outboards all those Outboards get serviced every 100 hours that service takes place on the boat there's no no misconception by me that this is not a functional Marina I get that but what happens on boats nowadays especially boats like this is the maintenance gets handles right there on the water so um a mobile service is going to come they're going to service those engines they're going to drain that oil and they're going to handle that maintenance what happens when that oil or a maintenance plan goes bad um in addition to that U fuel is delivered by truck to most residen is now and uh it's faster it's cheaper and it's convenient so understanding there's no pumps on site these boats will be F filled by a mobile fueling because that's what everybody who has a boat this size does and what happens when one of those spills takes place on the canal um additionally these are large center consoles that go very fast they go anywhere from 40 to 70 M an hour not unheard of for these boats to have tank issues or to have a crack in a tank if that ever happened these are not boats that are going to be in somebody's backyard being monitored but rather crack tank could happen and uh fuel could discharge into the builds which could then be discharged into the canal and nobody would know it until it was already happening and then God forbid sometimes when that happens a bill pump will signal on and you could actually have a fire or an explosion except now you have 12 boats 40 feet crammed in probably the tightest location I've ever seen in fact I don't think you can point to another location in Jupiter where you have this many boats this Clos God forbid one of them catches on fire they potentially all catch on fire and worse you have a restaurant there for what could be a catastrophic event at the end of a a very environmentally sensitive area and at the end of our residential canal so I think um it's a significant issue um additionally this has been an area that you all created buerton Island um and the other spoil islands that are there um were built and preserved so that people could paddle board kayak a lot of small little skips with parents and their kids fishing back in there um we're talking about putting a restaurant back there that's full liquor and alcohol and we're also talking about having 12 more boats 40 ft that don't turn very well they don't stop very well um and let's face it people go out on those boats and they go to bars and they go to sandb bars and drink and use alcohol and they have to make it down a very narrow canal and make sure that they can see and feel and hear those people but we're you guys created this area for people to use and they do um but now you're putting a commercial interest at the end of a residential canal and I could foresee if if for some God forbid somebody was hurt badly liability being um an issue for anybody who made the decision um traffic's going to increase significantly in the area um there's going to be people curious people trying to dock people dock down that Canal now and go to Dun dogs um and there's going to be people wanting to come there to see the the restaurant um at planning and zoning it was misrepresented that this is a commercial Marina that was previously located here there's never been a permit filed for a marina in this location never never been a permit approved for this location um this was not a commercial Marina I believe you all received a letter from the developer in the last few days in that letter five times it talks about a commercial Marina except there isn't a commercial Marina this was a mobile home park with a dock that ran parallel um at some point I believe some of the fishermen in the area got pushed out from Square Grouper found an area sunk 4in PVC pipes into the mud so they could create some random slips but to represent that this was a marina that it was commercial and that we're just cleaning it up is not what's happening we are doing something that has never been done before a 12sp boat marina in a on a residential area and on a residential Canal um additionally it was represented again in letters to I think the council and to even some of the neighbors that this is of just a small little gluten-free Cafe um unfortunately I believe it's 2700 squ ft 84 chairs outside a be a bar area that you can access from the outside I believe there'll be as many seats on the inside this is not a small gluten-free Cafe um I don't know of any gluten-free Cafe where you can get a rum and Coke and a gluten-free scone all at the same time but it's been sold that way and yet that's not what it is and so I think it's been a misrepresent ation and unfortunately um I think what we're looking at doing is basically putting a th North at the end of the canal and once it's there anything can change any of the guidelines can be changed um the the developer that owned th that helped develop thousand North and is in this project I believe sold his interest in that restaurant what keeps him from selling the interest in this project and when that happens someone's going to push the limits um so I just think it's a a bad precedent to set and I don't think it's something that's going to end well for the people um in on this canal um at some point in the planning and loing meeting it it seemed like the new standard became um anything is better than a trailer park but that's not the standard it can't have a detrimental impact to the surrounding own property owners and it must be compatible it's a small residential Canal um I want to say that um the velopment um across the way that was built um harbers side is probably three or four times larger than this and they were only able to get six Boat Lifts and that's on an open water area where there's current and flow and the ability to flush we're talking about doing twice that size on on way less than half the space and a very tight residential area um and additionally what was there previously the trailer park is irrelevant and unfortunately I think the the developer lives on the street at some point I it was obvious it's no fun to say turn right at the trailer park to get to my house um and and at the same point he is a developer it was a distressed property it was an opportunity so I understand that he's obviously a very successful developer but um I don't think any of us had an any opposition to the nursing home uh the second iteration um was a significant amount of property and changes and I think the Planning and Zoning had killed that um but I think the current iteration is not something that is interested or really fits with the surrounding area um boat slip renters are not homeowners so now we're going to have 12 people who if they want to go out late and party and come down the canal loud or fast I can't talk to them I can't really address them they're not going to be as respectful um you have to be competent to own own those boats and additionally I'd say when you own on a canal you don't have any privacy so it's kind of understood it's a tradeoff but you do know your neighbors and if there's an issue you can address it with them and we're not going to have that luxury with people who are going to be renting um I think if you grant this special exception you're I think it's been said I think this is going to set the new standard in the rowa I think this is going to um point out to people that that maybe we can go bigger in this area believe Dune Dogs had a developer trying to do something there and I believe the developers are looking closely at this to see what happens um I wondered does the paint store across the water does that guy get 10 or eight or 10 slips now because there's a commercial property that's on the water there so does he now say hey he got a special exception why can't I get the 2500 a month times 10 octopus Enterprises is just east of that does he now say look I'm entitled to uh 10 or 12 boat slips on my property in order to drive revenue and how do you say to them no you can't do that because you've just granted it on that same canal and I would say um any other commercial property located on the water is going to be able to point to this exception and say the same or similar things um I think uh I've pointed out the reasons why this is detrimental and it's not compatible um we're asking the neighbors are that that this um request for the special exception is rejected for the boat slips and the marina um I think if any of you had a home on a water and most of us who are the neighbors who live here this was our dream home this is where we wanted to live and this is where we wanted to be and um and now all of a sudden we've got something being proposed that will be a one-of A- kind um special exception is not meant to mean we're going to do something special and out of the ordinary and that's never been done it means that we're going to do something that's not detrimental and compatible and that's not what's being proposed here thank you for your time okay um moving on to I guess it's item five here Mr bar and yes mayor so if there's any cross-examination of the other parties then that's permitted at this time is that within the time limits or outside of that it's outside the time limits okay so does the applicant uh the uh staff interven or have any questions uh they wish to cross-examine the witnesses of the other parties I guess really haven't had any Witnesses but uh no thanks what time do we would we rebut some of the things does that come well you have uh four minutes and two seconds left they come after after can yeah usually I think after we maybe answer ask questions from the council thank you and public comments yeah in public comment yep okay um so moving on then um I'm must to sequentially solicit questions from the counselor directed to staff the applicant or intervening party um and only those questions which are intended to discover additional facts are clarified testimonies are permitted so these are just questions uh Council for um yes this is for staff I looked online I could not find any permanent for the existing pilings or docks was that any of that permitted we also did not find any records of permits for those so so there is no Marina there now not that we know of not a legal Marina right um is there allowable fuel uh dropping at any commercial spot can you get fuel anywhere else delivered is that typical are there any towns codes that allow fuel drops we don't have any regulations I know of on that okay um the the density of the slips where did that is there uh rules that govern that no each Marina is evaluated independently so they requested that number of St I I looked myself and I couldn't find anything to to guide me on that regarding the Stephanie thurn uh Planning and Zoning regarding your question on uh fueling at the marina it is done at other marinas in the town like the Bluffs and Jupiter Yacht Club there are no you know if if the council wants to look at that as a limitation it could be added as a condition of approval okay thank you um the parking I guess this is still on staff the parking the um parking requirements that I consider parking for the slips as well yes the code is one one parking space per slip is that realistic in your experience that's what they provided um I I believe it gets more intense based on the size of the boats and this this the boat length in in that's being um that's in the conditions is about when you start transitioning from midsize boats to larger boats are there reserved spaces for the slips or is it a grab bag for parking um that would be the part of the operations of which slip you're renting but um in terms of you know the staff originally recommended a 35 ft as the max because when you start getting to a 40 foot size boat you start needing additional staff to um maintain and run the boat boat and um and then boats get bigger and you need a cabin and there there's just more to do when you have larger boats if any of you boat um you know the cut off is around you know being able to cap in your own boat and maintain it is around 30 35 ft I do live on the river and I I see these 40-footers often and they're usually half a dozen or more people on them though they're not lightly traveled there are a lot of people on these boats uh regardless of who's captain in it I I appreciate your point um staff captains crew become necessary a lot of these boats have um other means for docking so that becomes less important but I I do believe that they're going to be more than one car per boat being used out there that just seems intuitive okay um is there back to the restaurant is there an ada8 ramp going in I see steps at the front there is an 88 ramp okay um I saw an oak tree being relocated that a 4 foot diameter oak tree yes currently what's happening is because of the high high tides the brackish waterers impacting the health of the tree so um it was decided with the natural resource coordinator supervisor that the best thing for the tree and consistent with the Redevelopment overlay area is to preserve the tree and raise it up a higher um elevation in the same location is going to be relocated on the prop it's going to be moved to the benefit of the restaurant any feel for a success rate on moving a tree that large um pretty pretty well um given it's a live oak okay great all right thank you councelor may um what was the reasoning I guess for staff for when planning a zoning recommended the increase in length of the boats from 35 to 40 we I I don't recall it the applicant made a compelling argument to go a long you know what longer and they suggested the longer with and are the the way it's set up right now is the slips that are being proposed able to handle the beam of a 40ft boat yes and bigger okay um that that's all the questions I have right now thank you councelor Delany uh question for now for the applicant Troy so the Planning and Zoning commission made some six recommendations are you satisfied with those or did you have objections to any of those from the pl from the PNC yeah yes we were fine with those you were okay um and I another and so when it comes to boat fueling boat maintenance where were you guys on that you are you going to allow do you want to allow fuel trucks on the property to I honestly don't know beor if you want to come up and talk touch on the fueling of these the boats I don't think they're going to be fueled any differently than the than the 20 plus boats that are in that Canal currently today um don't know if you want to limit I mean no fueling well this is a time for questions if Mr Bjorn has an answer to the question he can come up and answer it if he doesn't then so be it because I would I would think fueling at the Docks is an issue maintenance is is an issue I I watched the P most of the pnz meting and a Gentleman get up there from he was in some sort of marine industry he was talking about lifts but these aren't lifts these are slips they are slips but they are proposing I think they do want to do lifts in on these as well um would be down the road down the road yeah get them out of the water for boats of this um of this expense they want to get them out of the water I mean it's going to be a lot of growth on those boats quickly so they're going to be scrubbing those boats every two or three weeks at least right so um yeah I mean have we so we haven't button up the idea of maintenance on the because it's easier to maintain a boat in a slip than it is on a lift so and do we want people gasing having a fuel fuel fueling up these boats on these slips there and I guess i' I'd like to hear what my colleagues have to say about that so but I I didn't have that buttoned up at planning Planning and Zoning so I'm not sure about that so okay it was not brought up okay um for St one question for staff what about um sort of the legal aspect of boat what about boat Partnerships when you have a few people private residents purchasing a boat but they're not commercial is that included and anybody have any thought on that because I know we really want to keep we don't want a u a tiki boat down there we don't want Charter guys going in and out of there Marty what are you what are your thoughts on that well there is a restriction there's no commercial right vessels and then the the boats can't in a corporation they can't be a company name what if a you have a couple guys get they buy a boat but they're like a partnership and they're LC that's that's what the um applicant had made a substitute condition but they didn't bring it up tonight so they said they were in agreement with the conditions that we have okay so that would not be allowed it have to be an individual the way okay they now I just want to cover all the bases of issues that could pop up so that's it for now vice mayor thank you um I had seen something about the clean Marina action plan can the staff or applicants speak to what the components of that plan may be or um you know there was a question of just en enforcement of some of these aspects of kind of cleaning up this canal The Mangrove plantings um I heard you know from the intervenor something about pollution so just the clean Marina action plan can you speak to that the clean Marina action plan is based on D's regulation so it's pretty well um established and it and IT addresses things like um how to clean up spills um how to properly put away your um spent line having those um they have those PVC pipes and things like that so we would we would refer to what DP normally does but if there's additional things that the council would like to add related to the environment or or specific to that we could also um we could add those as conditions and address it as part of the clean Marina um plan as well and this would mostly be monitored through code enforcement afterward that's typically how it's done I think that's it for now to my colleagues to for now is once I'm done I have one more too so you go ahead okay well let me go and then I'll I'll go okay one one last time to everybody um first the staff um this was a question that was asked uh by one of my colleagues uh but it was my understanding and you know I let the three boat owners go first because you all know better than I know on that um but um I thought uh somebody had indicated that at the planning zoning commission the length of boat was due to a definition I thought I remember reading in the minutes that it was just clarifying where the 40 foot is measured is that did I imagine that or did I read that I just wanted to well are you referring from the tip of the bowel to the very back of the motor think you asked when did about the change and I thought I read in the minutes that the change had to do with where the measurement was taken could be water line or pul tip of the pulpit the def find here what 40 ft is correct it's the overall length if you refer to page G of the resolution condition 7 a um the the maximum length is limited to no more than 40 ft in length overall at the Planning and Zoning commission um when it was originally presented it was 35 ft at the water line okay um so there is I think some of the consideration to the earlier question that was asked is that there was some recognition with the change in the way it's measured it was closer to being the same because the overall length is is more than what is at the water line yeah okay thank you that's what I I recollected um I read these things to learn I don't know what um so um just a question of app the of Staff another question of Staff um I heard both the applicant and the um intervener say something that um I think was a little bit inconsistent with my understanding and it has to do with special exceptions so I'm really just going to refer to a section of the code and ask you so um staff had determined that um and this is in your report page 20 that the special exception criteria for Marina use wasn't met but it was met uh by other uh and I'm going to I think you made use of um code section 27 177 criteria for special exceptions item um B which says should the Town Council and of course staff does that for us before you get here we get here determine that the proposed special exception use is not consistent with the criteria outline in subsection a of this section which is what you identified the council May either deny the application or require such conditions of approval as may be necessary to produce a development that is consistent with these criteria so that's The Code by which staff recommended some of these conditions correct therefore you would say that it complies by virtue of that that's correct and and then there were additional um conditions um to try to mitigate the concerns that came up from the testimony of the public hearing at the planning zoning commission uh which resulted of them adding the conditions that were reviewed by Mr Schneider earlier right okay thank you I just wanted to and and if the council finds different based on there's additional testimony that's been given tonight um and questioning that's occurring um if there are additional conditions that the council feels are necessary to meet that standard or if the standards in your opinion are not met um you can either add additional conditions or deny the request right and I just wanted to make sure the public understood that we up here and staff pay very close attention to uh you know uh special exceptions to make sure that it if we approve them they within the code thank you um just a uh one item for for the applicant um this is regard to I'm going to ask you about a potential change in a condition that I hope you're going to say yes you agreed to um um let me find the condition here so you know there was a lot of conversation collaborations about the marina in its entirety and uh there's a condition in the resolution item 7D that says any request to increase the slips to accommodate vessels of more than 40 ft requires an amendment to the development order and shall be subject to the review of the Planning and Zoning commission and approval by the Town Council and i' hope you're going to say yes but that's not a setup can we uh would the applicant U and ultimately it's our prerogative anyway but would the applicant be okay if we would say any request to change any of the obligations for Marina that has to come back to Planning and Zoning commission I mean it's pretty well vetted pretty well defined in here what you committed to do I'm sure as you stand before me there's no intention to come and ask for a change uh but just to address that um I'm just suggesting a language change and hope staff is hearing this too so would again it' go beyond increasing slips to be the criteria for Marina absolutely any change to that Marina we would definitely come back to the Town Council okay that expands the uh what has to come back to us and can't be handled at a staff level and then that great transparency for the public absolutely okay the staff understand that ask okay going back to my colleagues have follow-up questions um yes this is for staff um is a dive boat it's a commercial operation so dive boats are prohibited that'd be correct um how about Charters yeah it's still commercial operation okay so no Char private lease slips is that built into the lease do we know if this is going to be how are we going to restrict that how is that going to be I would ask that the applicant okay I would like to ask the applicant that then please there's some conditions being applied to this um can't be more than 40 no commercial activity no Charters no dive boats is this built into your lease yes it definitely will be and they they don't want that as well so it would be built into the lease no commercial boats no everything that you've mentioned would not be allowed would you be willing to uh say no fueling of boats and I have the yes thank you if if that is a condition of approval yes we would be willing to accept no fueling of the boats in this Marina that helps thank you thank you that your question um Mr Bor one second just uh Troy could you pull up the like the overview of the of the site sure and the reason I asked about the fueling um potential spills obviously but so we're sort of sort of ju opposing the restaurant and the Marine are like sort of two different entities really not related they're going to be gated off with decorative Gates so people can't access their restaurant by boat unless you're unless you lease a slip correct only if you Le a slip yet right so and I was just wondering do you want a fuel truck coming into your property at some point and where would they get the hose down so I was just wondering what were the logistics of that is that was that involved in this or no we wouldn't like a fuel truck because we don't make any money on that either so right so so so we should we make no fueling part of this application process so I don't want to harm anybody here but I also want to I know people that live on the canal probably wouldn't want fueling and boat maintenance at the Docks correct y I just want to cover all the bases so absolutely I agree 100% put no fuel put no fueling into the to the application correct you got that okay would you be willing to limit the lease to one vehicle per slip could you would you be willing to write that into the lease I don't know how we can enforce that and because we're not that's the way the site plan currently indicates at one space per slip you just write it into lease and whether they violate it or not it's up to your tenant but you could write it into the lease that they only can park one car per one one car is allowed on the property per slip how do we know that they're not going to the restaurant for example I think it's going to be very very hard to enforce it's just an Ask yeah you can put we can put it in the lease absolutely yes mayor we're kind of getting off track here what they put in their lease is what they put in their lease what you have control over is the conditions to any approval you might you already got this had discussion no Charter no dive boats no fueling of boats at the marina no boat maintenance at the Ducks so if you don't want a fuel truck to come to the property then add a condition that says no fuel trucks can come to the property there it is I'm done you're done yes yeah are we still on questions well I'm just doing one more round and then we're done with questions I'm done with questions I'm just I I have comments for deliberation at the end but vice mayor also done and I'm done um so uh moving on um FL is open for public comments limited to three minutes uh do we have public comments yes we do uh first we have Mark rodberg after Mark is Ray ni uh Richards hello my name is Mark rodberg 502 Oak Terrace I've been a uh I'm not affiliated with this project but I've been a restaurant developer for 30 years and built over a 100 restaurants in uh in Florida over the last 30 years from Key West to Tallahassee and all parts Beyond and many several of those had been Waterfront oriented and the consideration in my review of this staff's report quite thorough very thorough good job to staff and to the planners to accomplish this and get it to point of of a recommendation by the PN pnz and by the staff additionally that if you ask people to associate uh Jupiter they'd say the lighthouse and they'd say boats enough that we have one in our logo here I believe the classific application of more than two slips by your code is is defined as a marina but from what I've heard what I see uh this will be slips where private people keep their boats adjacent to Flagler Warf with elimination of any fueling and one gentleman pointed out expensive boats and they're valued by their owners and they're taking care of and they give a lot of consideration to a a vessel of that type and I I noticed she didn't have a limit on the the small boats but but they'll be not all 40ft boats we don't we don't all Drive uh mosus you know uh I I went through the landscap and there's a I think they meet or or exceed the code significantly I think a lot of thought went into this I think the architecture says Jupiter I think it's beautiful beautifully designed and well done and and I applaud uh staff's thoroughness with whoever the planners were of this project and what it's gone through I've I've spent a lot of years going back and forth with review for plan review and site review we were full full scale Developers of restaurants you know as opposed to just a construction company so I applaud the city and I support this project thank you thank you Ray Richards good evening everybody my name is Ray Richards my wife and I just recently moved to Jupiter purchased a house at 317 old Jupiter Beach Road one of the things that almost stopped us purchasing it was the lot the lot that's there now it looks terrible look at this it's beautiful I think I'd recommend if you could please approve this thing and let's get it rolling and get that street cleaned up think you're doing a fabulous job uh I live at 317 old Jupiter Beach Road I've reviewed this proposal I think they have complied with everything that you've asked of them I am totally in support of this project Wayne pner Wayne Pon 315 Karina Drive Jupiter Florida uh I used to live at 1015 Town Hall Avenue on a private Cove we had over 35 boats I had three boat lifts on my own house so talking about putting a lot of boats in a small spot lived there it was a pleasure it was great and they refueled right on my street all the time so it wasn't a big deal and there was never an accident I lived there 16 years we can't go on the wh ifs or the fear or what's going to be we have to do what's now and by saying oh they have to come back once you build this building you don't have to worry about another building 60 ft high this one's only whatever it is 24 ft high once it's on the property you don't have to worry about another Council coming in here and building a building bigger building you byy right use by W is what he's doing and use by right really allows for a bigger building I think they're doing a beautiful job I don't remember hearing anything about a bar or drinks or any of that without coming back to the council and I don't I don't perceive that would ever happen anyway it's supposed to be like a a cafe breakfast place and it's right on the water would be a beautiful addition it certainly would enhance the value of the properties there instead of having a vacant lot there's no question about that and we can't go on the wh ifs uh there was a lot of what wh ifs uh the intervenor um person had a beautiful speech I really um admire for what he he was talking about I hope in the future that he's going to like this project it's going to increase the value of his property and knowing the people that are going to run this they're very very cognizant of everybody around them they're very peaceful people and they're going to keep a clean operation it's very important to understand when you say yes to one thing you could be saying no and vice versa you say yes to this it is what it is and it won't change I think it's a beautiful project it fits architecturally being a builder for 42 years I say it's a beautiful project and I thank you for your time thank you Kent eisan my name's Ken Eisman I live at 111 Old Jupiter Beach Road I've been there 50 years um I think the restaurant's beautiful I think it's an improvement to the property but I truly believe I live on the I have a boat on the water there it's a very small tight Canal 12 more 40ft boats trying to In and Out of the Waterway and people comeing down the restaurant to see the restaurant even if they can't get in it's going to make it just impossible it's all you can do to get out one boat at a time much less two boats passing on that Waterway I think the the uh design on the 12 boat slips is twice as many as they should have and then when you start talking about one slip for a car per boat that's not even realistic you you know so where's all these cars going to be and where are all these people on the boat going to be but I know they'll be hooping and Hauling down the Waterway like the boats that used to be in the non designated Marina that was there they'd come in all hour of the night screaming yelling drinking you know we had a lot of that and it's been really nice and peaceful for a long time and I just hope that this doesn't just impact our Waterway and make it just a big party place and that's what I think because of the slips and on it with the restaurant I think the restaurant is beautiful and I think it'll really increase the property values but I think there's too many boats going in there that's all I can say thank you Lauren Hollander uh mayor vice mayor and Council thank you very much for the time effort and energy that have been put into this project um thrilled to death with the patience and tenacity of the developers to stick with these eight years and multiple um proposals of different solutions for the Improvement I know the um reference to the mobile home is not always what everybody wants to refer to but the incredible Improvement of even clearing it in 1960 it probably made sense for that mobile home park and so what we look at today is what may make sense for that will enhance the community community and I'm certain many of these homeowners will walk to that cafe and enjoy it um they may even have a place for the dogs to park them have sit and enjoy um but I just am in support of this project and think it enhances the community and will enhance the property value significantly thank you Kevin Smith thank you all for your time thank you for your public service too I'm Kevin Smith 261 Old Jupiter Beach Road the issue that I only want one that I want to focus on is whether or not the applicant has met their burden of proof that this project will not be a detriment to the residents of that canal and old juper Beach Road that's the issue and to do that you all walked it so I'm glad you did let me just give you a little picture of my little canal and my little neighborhood street we sit back there on the back I can cast a zero spook across the canal and hit my neighbor's yard that's how narrow it is two boats going opposite ways can barely do it so we have dogs we have kids all of us have kids um what's going to happen if you put 12 boat slips in a bar in a restaurant I don't this Cafe thing's nonsense you can serve all the vodkas you want in that place long as you're serving dinners so when when kids and who's running these boats you've lived on the river your whole life if these kids we see the teenagers going by on boats raising hell and hooting and hollering are they going to come down my Canal ignoring a wake zone and go down to that are the people that own the slips have teenagers that are going to go back and forth in this canal in the dark are they going to jump in my pool are they going to be drunk and steal stuff off my boat sitting on my lift you can touch the boats on both sides almost if you go by in a big boat down my Canal what is it is it a detriment to the people that live on that Canal to have this project with people who can drink it doesn't say who can run the boat the teenagers can all get together go over to Kos come back to that thing at midnight and they can throw bottles in my yard they can steal my dog they can do whatever they want are we going to have to assign police activity to this canal when people are violating the Wake zones all the time to where I've got to ask Jupiter police to put one of their boats or one of our guys on there to make sure that people are abiding by all these rules and all these limitations of captains how many times have we gone to boats to a bars in our in our beautiful Jupiter and most of the bars are facing the inter Coastal or facing the inlet to where all this noise smell garbage it it doesn't come into play for neighbors but who's to say when you get a bar how many people have dropped off people to go boozing at the Square Grouper or at the tiki or wherever just because you can't pull in there and get a slip and have somebody tie you up doesn't mean you can't drop 10 people off there to drink go back go party do whatever come back and pick them up when the place Clos closes there's so many things that we all know go on at these bars and restaurants that are fun but they're not supposed to be fun at the detriment of our little Street and I just ask you take those things into consideration paint the little picture of our little neighborhood and our one little Street whether we Jupiter needs this one more bar thousand North is gorgeous I remember since it opened I've love the place everything Mr Ford does is going to have gold on it Beau thank you Jack H board hello and thank you for the opportunity to speak on the flag the war project my name is joken Borg I live at 100 Egan fusky Street uh I've been living there for the past seven years and have been living in Jupiter for 177 years um I live directly across from the development and have seen all the various different proposals and have also been affected by the 30,000 cars that have been directed right in front of our community uh as a result of the US One Bridge construction um I also work at index uh the development company for this project together with my parents B and Maria um who also live on the same street as the project on oldj Beach Road I've also spoken to the neighbors all around me that I've lived there for decades expressing support for the project knowing what used to be there we all want something nice to be built here and the team has been very cognizant uh to taking feedback and featur nods to Jupiter's history having worked closely and supported by the lockah hatche Guild in uh for the new development the proposed uh development would certainly increase property values in the area uh being world's better than the former blighted trailer park and Commercial Fishing Marina I remember hearing police there almost on a nightly basis for domestic disputes gunshots drug overdoses as well as the numerous commercial fishing boats that would come and go multiple times a day day night at day and night leak gas and then sink occasionally the Palm Beach property appraiser website also makes note uh that uh there have been docks on the property since 1939 so there should be records available somewhere pointing to this there was uh a fire at the town of Jupiter building and I believe the 60s so it's likely that any records in regards to docks uh probably burned down with the building if that could be the case as a longtime resident of both old J Beach Road and Egan fusky Street I recognized that the proposed algae friendly concept be welcome to the community and look forward to frequenting as well as seeing the updated Marina being calmer and significantly prettier than its former use I'd like to make it known that as a person that will probably be most affected by this development uh I believe this to be the best use for the property and I'm pledging my support as a direct neighbor for the project and see as a benefit to the larger Community I look forward to envisioning my mother's dream of an allergy friendly Cafe becoming a Jupiter staple that we can all be proud of built by Jupiter locals for locals and visitors I hope you vote in favor of flag the warf and have a great rest of your evening thank you rodick nasf Rod nasf I live on 200 uh Egan fusy so right across from Matt right across from uh Smith this is a very small Canal this is a residential area we in this community enjoy our residential area you're putting a Comm commercial restaurant bar in a residential area you guys are if you guys approve it this is a very unsafe area I'm a very Avid boater and trying to get two boats down that canal in the dark is going to be dangerous there's a bunch of paddle boarders back there are going to get ran over it's going to be a mess all right first of all and and it's all these people have come up and and approved it don't live on the water they're not being affected by this restaurant I will be directly affected by this restaurant being back built back there the other thing that no one's really saying about is if you look on their site plan there's another there's a big open area that they haven't committed to so what's going to go there what more parking is going to be going over there this this thing about having one slip per boat is ridiculous I mean come on 40ft boat and you're have one car slip so where are they going to park they're going to fill up the restaurant when the restaurant when that fills up they're going to park in the street so everyone on Old J Beach Road is going to be complaining about that there's going to be cars parking on the street because there going to be no parking this has not been thought out this has not been planned properly the plan and Zone committee say one boat per slip is is ridiculous all right and if you have a 30 or 40 foot boat you're not going to have a trailer for it so where are you going to get the service done it's going to be done at the marina who's going to police this Marina saying that someone's coming to service the boat is is is Code Compliance going to come and say that so and the other issue is drainage you know in the last 18 months my Canal now is filled with oil and it's from that that spillover that you guys put in draining from the industrial park across the street now we're going to dump more oil and brackish dump dirty water into my Canal the Mullet Run this year was terrible all right because nothing's growing back there there's not enough flow back there and your guys dumping more polluted dirty water into my into my residential Canal is horrible all right you guys are putting more drainage from the from the industrial park in there it's been terrible all right there's a Sheen of oil in that water every day now especially after it rains so none of us in the community are for this who live on the water people who don't live on the water it's not to to be affected sure they may be they're probably just anything better than that than the trailer park but there can be something better than the restaurant back there and bar ramse Buckley hi good evening uh Ramsey bu for the record 153 87 86 Way north um let me start off by saying thank you for your time this evening and I'll also start by saying I am in full support of this and the main reason is when you look at these types of things the special exception it has to meet all the standards of the code um to back that up I'll just backtrack a little bit to some of my history as to why I think it does and what gives me the uh qualifications for that uh my first job out of school as a planner was actually working for Stephanie thurn and John cly here for the town of Jupiter um after I did that for quite some time I went and got a law degree and and concentrated Landes and zoning and worked at the engineering department with Del koni doing engineering inspection so I've been around the town for quite some time um most recently I worked uh for bomach County last 10 years uh last position was the executive director of planning zoning and building for the county um the last year I was there two years ago we did $2.7 billion of new construction and approvals so all these kind kinds of approvals exceptions variances I'm very very familiar as the Director executive director of County at that time going through all of these so on that is based on my professional opinion that this application does meet all those criteria um it's also evidenced by staff staff report I've reviewed that uh I've gone to the site myself um yes I know the uh some of the neighbors are concerned I get that um however we have to look at does this meet standard of the C and in my professional opinion um it does I think the other agree ments that they've made further addresses that uh and gives the town I believe some more Comfort moving forward um and with that uh I'd suggest you please approve this special exception the restaurant is a use by right but this special exception does comply with all the criteria thank you thank you Donaldson hearing well good evening council members for the record Donaldson hearing 113 Elsa Road Jupiter Florida Yacht Club States and I live on sofish Bay right around the corner here um for the record uh I am a professional planner I've lived in the town of Jupiter for 56 years and I've actually practiced land use Planning and Zoning in this town for 42 years I don't believe I'm that old but I happen to be uh this case is very very simple the restaurants are used by Wright you heard a lot of noise about drainage and a lot of other things your staff and all the requirements that are required through the permanent process address every single one of those issues staff report clearly confirms that all criteria have been satisfied there's one thing that we're talking about 12 slips 12 slips it's not a marina classified by your code 12 slips and where are they located in commercial property what type of commercial property the most intensive commercial zoning District in the town of you C2 C2 across the canal C2 on the property the property owner happens to also own a piece of residential property immediately to the east of this so he's buffering buffered by himself all of this activity is pushed as close to the road as possible so there is no detrimental impact we talk about spills and this and that every single one of these boat owners that live on the water including myself on sofish Bay regularly have fuel trucks come and deliver fuel to our boats I've never had a problem I've lived there on sawfish Bay for 22 years not a single issue I have commercial boats die boats that go out four times a day two boats two times a day as well as other commercial Mariners that are behind our house there's never been a problem we've never had an issue the food yacht goes up and down that Canal once a week or so there's never been an issue these canals are bigger than the canals behind all of the dolphin streets and on the north side of Center Street there's never been an issue it's a bunch of it's a bunch of fear and noise this is clearly compatible and there's been absolutely zero competent evidence to suggest that anything would be detrimental to the residents on that on that on the canal it actually will be getting wider as a result of what the developer is going to do and the other thing that people didn't really talk about is how often do people really utilize their boats very very little maybe one boat will go out per day I've a beautiful 40ft boat that I operate by myself it's easy to do I don't have a captain I don't have people come and work on my boat I do it I take it offsite to have it serviced because you can't Service A boat like that sitting on the back of the boat you certainly couldn't do it properly so this is compatible and it's not detrimental this is a great benefit there's a great shortage shortage of marine facilities in this town you couldn't find a 40ft place to put your boat if you tried today so this is needed I suggest that you support this tonight thank you thank you William Quinn that's the last one good evening uh my name is William Quinn I live at um 1000 North US Highway 1 unit 807 um in Jupiter I've been a um a resident of Jupiter for 20 years um I appreciate the service of of all you folks up here um uh prior to my U arriving in Jupiter I also was on a a zoning board my background is professional engineering so um I appreciate the time and and effort that you all put into your your work um kind of an interesting uh highlight here um I was volunteering for my town or my neighborhood homeowners association when the original development of of the Thousand North property project came you know to light and some of my neighbors uh were opposed to the development some on really strong grounds uh they put up good arguments but at the end of the day I would say that everyone enjoys the the the new development the the commercial activity that it's brought um the open and vacant lot prior to that development taking place was a concern to me and many of my neighbors um this particular project has a lot of similarities to that I remember is years ago walking or biking past the you know the trailer park um you know it it had that same kind of element to it that you you were uncertain about what was going on there not when that property was cleared so a vacant lot on a commercial Frontage like this has has some challenges that's all I'll just say so I support this development um I I have firsthand uh experience uh as an abutter uh that that um the the um uh promises and the and the uh the effort that the developer took uh to be um uh bringing up thousand north um was delivered and then some so um thank you for your time and I I appreciate it consideration okay okay um moving on um for both the applicant and uh staff who Reserve time um if you have any rebuttal or closing arguments applicant [Music] first thank you uh just want to touch quickly on just some go through some of the points that were brought up um there's kind of been uh mentioned that this might be you know as kind of shown to us as a residential Canal this is not a residential Canal it's a 60ft canal which has a 60 foot Public Access easement and a rideway over top of that which does connect these commercial properties out to eventually inter Coastal Waterway um and also mentioned that this plan could then morph into something worse U as a tiki U Tiki or Guanabanas or who knows what as we all know this plan cannot change these conditions cannot change unless it comes comes back to the town for those approvals um the restaurant does have many conditions uh which will limit it there's no seating to take place Outdoors people can't be seated after 9:00 it can't be eating outside after 10:00 all the windows and doors must be also closed at 10 p.m. uh no outdoor live music ever outside um and as as Don Herring had mentioned as well um we have 12 slips there there's been multiple studies done by the Coast Guard um and many Boat Owners know as well that 10% of the boats are only utilized at any one time so any boat owner is only going to be using their boat 10% of the time throughout the year which is only 1.2 boats a day on average are going to be utilized so that that would be the average um and also the mention of additional traffic coming up this canal because of the restaurant people coming and going being dropped off there'll be no way for someone to get to this restaurant via the canal uh these docks will be fenced and they'll be gated for security of those vehicle of those vessels so you can't just be dropped off at the end of that peer and walk into the restaurant because it will be fenced off so that trap there's nowhere for someone to access this these docks from the canal um in addition to the the the width of this canal there are currently up that Canal 20 plus docks and 20 plus boats some of those boats at 40 ft plus and there's also a boat that's 70 foot plus up that Canal as well so it is a narrow Canal but it there's plenty of room for boats at idle speed to go back and forth in this canal so essentially those were the only points I needed to cover so thank you okay nothing from staff um so we'll begin our deliberation this is not an opportunity for any more asking any more questions uh this is intended to be deliberation among ourselves um and then you know I'll signific then I'll sequentially solicit comments or position from counselors on the application um and then after that the motion so think I can go ahead and just combine nine and 10 uh so just I'm going to just go down the road row we back and forth um and then just uh any inputs you want to give and what and then what your position is councilor May um I think it's important to note too that this canal was dug out by Henry Flagler um and having the historical marker there to uh indicate that is is important to me um you know as the canal was dug out to dug out for commercial use uh you know obviously it's changed since houses have been built there and it's you know a lot more resident itial use now but I I do want to make sure that it's noted that the canal was dug originally for commercial use so um in this property of budding alternate A1A you know being that commercial Corridor right there so I just want to be on the record noting that um I hope that there's some sort of way I know a resident brought up the concern about the the oil that he sees in the canal and stuff like that I know that there's supposed to be filters in place uh from our storm water Bas and drainage so I something I want to follow up with staff on to make sure that our filters are working correctly wherever um just to you know get an eye on that area just because even now before this is developed that's that is a concern of mine if that's taking place right now that's something I want to get with our utility staff on to make sure that our filters are working uh to make sure that it's not uh it's not causing extra detriment to the to the canal right here so um and then just I know we talked about it where I know they agreed to no fueling I just want to make sure that if we do if this does get approved that um there is an uh a condition of no fueling or maintenance SLS service of Motors would take place uh on the boats and uh there is a way for the boats to be uh serviced off site you can take them to R vit Marina wherever it may be the boats are hauled out larger boats like this are hauled out typically for service for cleaning of the of the hole and stuff like that so um I mean I'm definitely curious to see what my colleagues have to say on this um I don't have any super you know uh negative reason to deny the the marina or you know and and I do think of this as more of a slip uh situation um I'd be curious to see when the applicant comes back for the lifts if it's if you're even able to put the lifts in with how it's set up now just because I know how much more room the the lifts would take up so um but I'll be interested to see what my colleagues have to say but that's all my comments for now rce mayor um I I was really pleased with planning and zoning and their deliberation um over a number of meetings I remember this being um or you know different proposals being denied and and coming back but um I really liked and appreciated the gates and the fence thing put around that was most recently brought up that's really going to dramatically um you that will manage any situation with you know boat traffic there considerably and it can't be transient slips it can't be um drop offs I think that's a really important point and that was brought up by a Planning and Zoning member so I am grateful to them for that um I do you know see that they are widening this canal so to the extent you know they're creating space I do appreciate kind of increasing the flushing capacity City some of the environmental improvements that I saw um when visiting the site I saw no movement um of the water and I think if there's any flushing capacity you know as we've learned from other parts of town that could be an improvement um the restaurant is used by right the marina I think with the conditions added um you know I'm I'm feeling comfortable right now but I've also been grateful for my colleagues and look forward to hearing again we've heard from one boater but to hear from the other too so I only paddle and that's a really important experience um I know one resident brought up you know fish cleaning and I'm glad to see the applicant say that that's not allowed you know I imagine that would be in a lease or something you know on site um but that was something else you know considered and it's not in my experience here so you guys will have you know more relevant experience I look forward to hearing from you but those are just some of my comments I think that um I think this seems to be heading towards a approval uh and I just wanted to reflect that I think this project um and you know I don't know what the public believes but uh you know these things get handled way before Council has inputs um and uh clearly on this project has been rigorous reviews and critiques by multiple Planning and Zoning staff by Planning and Zoning commission efforts and by public inputs and as a result of that it's it's a significantly better project um so I'm grateful for those efforts everybody should take U understanding of the inputs you had to make changes um you know there has been significant s plan and project revisions and changes to resolve legitimate cons concerns um special exception use you know for the marina facil and sight plan with a private Marina restaurant with accessory outdoor seating area and office sh we got beneficial easement dedications there's restaurant use and outdoor seating restrictions I mean these are things that were addressed that I've and other projects had uh um been pretty strict on and it was all the dress ahead of time so I'm grateful for that the marina use restrictions and with the applicants agreement and hopefully my colleagues would agree that uh under seven when it gets time for motion under s uh d a uh no 7D which is the condition that anything to do with the marina conditions would have to come back to us I think that should give everybody comfort and I know the applicant doesn't have any intentions to come back but therefore we can represent in somewhat mitigate you know concerns about that um the environmental enhancements uh the Marine Stewardship plan the mango planning for living Shoreline this has got all of the best practices you know that we've wanted to have happen so I'm grateful for that historic preservation you know U this is a unique site um and uh just the fact that uh there's going to be some preservation of that and probably help even the aess of that history uh that's what we try to accomplish the 6ot wall along the east side of the property you know again mitigating you know impacts uh um and you know the Locking System prohibiting you know access to the private Marin lips I think all of those were steps taken to mitigate any chance for uh the kind of activity that other establishments on the water have had so I I don't see as I'm sitting here reading this that there would be any opportunity uh for um at least approved uh as part of this uh condition or the development order um the parking spaces right now 84 spaces are provided 77 are required for so the public knows you know our code does provide parking requirements um and if there's issues with that we can change our code but it does does provide them and all we can do is for the most part hold an applicant to the code in this case they are exceeding it and they'll be harmed if in fact they're out of uh they run out of spaces and if that happens hopefully it would be before you know the vacant lot ever gets developed and then that would be taken into account based on we know at the time and I know this is off topic but I know that uh it's been mentioned already and I just want to say for the public that this the comments about the storm water drainage which by the way does provide flushing you know that we none happens we'll take an action item on staff um to to look into that and uh as we should it's something we're very um committed to is environmentally um and U not knowing what the conditions are um perhaps it's something quick that we can do and if not it's a project we'd have to try to see that we we would handle so that's nothing to do with this applicant that was a that's a that's the town stor M utilities responsibility so I just want to make sure you've heard it up here from several of us that we take accountability for that and it's not a it's not a u anything to do with this project um so I think with that I'll move down U Bel to you counselor alany okay thank you um everybody started off with the Marine I'm going to start with the restaurant so this property or parcel and over the years we've seen it's been talked about uh two previous applications that were pretty much deemed too intense for the area for the neighborhood um I I think this this is more of a a much better fit the building's beautiful I like the way they orientate it orientated at where the length it's going I guess it's East West it engages a sidewalk which is sort of engages with the comp plan it has as the mayor said they're they're overp parked a little bit which is great um also um the other parcel for future development the parking requirements for the restaurant take up so much of not much can go so this this property with it with may come down the road diminishes the intensity of what could have been this property and you know with other with the uh assisted living home or the uh the the applicant wanted to do a larger office building in the past which everybody deemed too intense so I think if not this what so you know if we rejected this something else would come down the nut line who knows what it would be it has to be economically feasible for the applicant also um back to the marina I I I love the enhancement of the living Shoreline the rip wrap the sort of carving out a little of the property to widen the canal um I think I'd prefer to see lifts there just as a boater because you don't want your boat sitting in the water and getting all mucked up with Barnacles and slime but that's their prerogative down the road uh in regards to the fuel I had a boat that I would I docked I I the fuel truck would come to the dock and I fueled at the dock when I lived up north never spilled the drop but when I look at this I don't know where the truck would come in park run his line to the to the docks and and the the applicant said he's not interested in that anyway so you know I don't want I know fuels it's Che I don't want I never want to hurt anybody's economically so I know people that'll probably rent these slips don't live on the water I appreciate there's more access for people to get their boat in a slip that don't live on the water um and fuel's also far more expensive than the Mariners I don't want to hurt them they have to go to the Marine to get fuel but if it doesn't look like fuel docking here is in the cart so I would like to hear my comments from my I know councelor may you didn't want fueling here I'll take a pull how do you folks feel about fueling if the no fueling no service or maintenance of the engines and then uh no dumping of the Blackwater tanks from the uh yeah from the boats I think it's fair C Sun did you have a a opinion on the fueling no no okay mayor I'm going to lean towards the okay fueling no okay so I just didn't want to harm anybody's pocketbooks so but um you know I I love the environmental enhancements the and I also look at this this is almost two different entities people aren't going to be able to drop off people at the Docks to run into the restaurant and vice versa it's it's it's going to be on lock down so I I I think I'm I'm not afraid of that happening so um and I think everything we've seen on this property over the years this is the best fit so I'll be voting in favor of it I'm going to take a similar approach it's a two-phase project the the building is spectacular it's perfect fit I love the way it looks I think it's the right size it's the right use for that property I like it a lot I think the developer has shown a very good track record thousand North is a jewel of the town I like it a lot um everything about the building I'm for the marina I can't say that and I'm I don't want to goof around with us there is no existing Marina there if it wasn't permitted it's not supposed to be there and everything should get yanked up I guess so it's not an existing Marina we're we're allowing them to build a new Marina that's what we choose to do but I'm I'm not saying either way whether we should you know we'll do do that as a council but that is a very small Canal I've driven it for 34 I've had a master of vessel commercial captain's license since 1990 I've pumped hundreds of thousands of gallons of fuel into boats along the way every time you fill a boat you run the risk of at least a little fuel getting in when you fill a boat some people might have experience with a 20-footer you can sit there and hold a 20ft f filler for a 20-footer but when you're putting 500 gallons of fuel in you're not going to sit there and hold it by hand you'll put a screwdriver in you'll do various things you can do that we've learned to do over the years and you run the risk of a kickback or spit some fuel out the vent on the tank when you fill a tank it has a vent the air that's in the tank has to go somewhere so when you're filling that tank it's pushing the air out of vent and if you fill it to the last second it will spit fuel out of that vent every time so the idea that you can fill these boats over and over again and no fuel ever gets out that's not reality that's not my reality as a commercial fisherman and again a master vessel for 34 years I've got some experience in saying that um there will be some fueling issues so I'm I'm adamantly opposed to fueling I'm opposed to servicing and I don't see that as a big issue I think counselor may hit it on thee these when you've got three 300 horsepower engines on the back of a 40-ft boat you're not going to have somebody back there dropping lower units off the changing oil and stuff like that they're going to run it over to jup Marina and have it done so they don't need to be servicing boats there and every time you drop a lower unit you're going to get some oil into the river so no servicing either those things should not happen uh 12 is pretty intensive um the the usage rates that have been quoted uh 10% that might hold true for for these 40 foot parade boats um we we laugh at these boats all the time these 40-footers go by all the time no fishing poles on them so we just laugh at them when it's a parade um the commercial boats that were there before use their boats so they were probably using them more often so you may get some some reduction in usage going to these type of boats versus commercial fishermen but it's still a very narrow canal and some of you said you drove out there by boat it's a narrow Canal it's a very narrow Canal when you have boats TI it's 60 ft keep that in mind you got boats that are tied up possibly on both sides so there's you know at least 20 ft of it has now been taken up by right of use of the home owners along the canal so you've narrowed it down to a point where you almost have zero room for boats going opposite direction but that can that's not insurmountable people can back up and stop let people around um to clarify the increased Flow by the widening all that's being widened is the turnaround at the end that's not going to increase flow at all not a gallon of increased flow that just makes it easier to turn around you would have to dredge it all the way out to the sawfish Bay for it to increase flow so we're not really going to be able to increase flow increasing flow with storm water runoffs not a great thing to do but it's better than nothing and we absolutely need to figure out how we can stop fuel any type of Sheen that should not happen so anytime anybody sees sheen on the water that should be reported immediately there's something wrong that's happening so we've got I think two different issues I have no problem at all with the restaurant the proposal for the restaurant I've got some reservations about the marina I think it's too many slips and I I I think we're all in agreement now no fueling no servicing uh no pumping of anything out of the boat nobody you can't do that legally anyway you can't pump out gray water into the river that's illegal that doesn't mean people won't do it after hours because it's easier and cheaper most of these 40-footers they don't let anybody use their bathrooms if they can get away with it we don't on ours you got to go in a bucket you're not using them that's not going to it's too much of a pain it's a big issue but I I I feel for these homeowners along this canal because it's going to it's it's not a really good fit for them it's an awkward situation where we do have a commercial location at the end of a a residential Canal I you can't say this is a private Canal it is open for navigation so it's navigable but I I think 12's a little too intensive I'd like to see it a smaller number the size of the boat 35 versus 40 foot doesn't really bother me that much especially considering Mr sichler what you said at the water line these boats can easily be 5T longer when you get full length when you get up off the water so that's fairly easy I'm I'm hesitant on the marina but if if we could reduce the number I'd be more comfortable but it sounds like we're all in agreement though no fueling uh no servicing but that's basically how I feel about it all right um I'll call for a motion in a second um I could make the motion with all everything that we talked about conditions wise to hopefully appease the concerns that have been being raised tonight as that's my goal um so if and if anybody wants to offer a friendly Amendment after I go through these and thank you to the town attorney for writing everything down that we were mentioning so um basically the motion will be motion to approve based on the recommendation of the Planning and Zoning commission that was made on uh August 13 2024 along with any change to the marina conditions must be must come back to council no dumping of Blackwater tanks no Charter dive boats or commercial use of the boats no fueling of boats in the marina no boat maintenance or service at the Docks and no fuel trucks to deliver fuel to the boats in the marina second motion a second any discussion I'd support it if the applicant would be up to it but I'm not sure if they would would or not so have a motion in a second uh all in favor signify by saying I I I any opposed motion carries unanimously okay uh moving on uh to public business uh and uh authorizing a waiver of conflict for Jones Foster Law Firm I'll just give everybody a minute to exit mayor would you like me to introduce this item yeah please do I would just give it a minute to clear out here so I uh apologize for the lateness of the memo but um two of my partners have been representing Jacob wader um who has been purchasing properties in Palm Beach County and they've been representing him in that um and recently he's turned his attention to Jupiter and the 9 acre property on Indiantown Road that is a is restricted to bioscience life sciences and high technology uses that property was dedicated to the town as part of the Sonoma Isles PUD formerly the partial 19 PUD with those restrictions in the development order Mr W uh happens to be a very successful developer of bioscience uses elsewhere in the United States it was attracted to that parcel because of its proximity to scripts and MOX Plank and the other um biosciences use that uses that exist in palmach County [Music] um the town has the opportunity to sell that property uh the town manager has already obtained appraisals for the property and so the purpose of this item is to ask you for a waiver for our firm to represent uh my partner Scott McMullan to represent the town in the real estate transaction which is not uncommon for larger law firms that are involved in real a lot of real estate which is our firm uh and other firms and Mr Alexander from our firm who's in the West Palm office scotson the Jupiter office to represent the buyer Mr W in that transaction so the rules of Florida bar are such that the firm can represent both buyer and seller in the transaction provided we obtain a waiver from both buyer and seller Mr W has indicated that um he will be uh waving the conflict so the question for the council is whether you will wave the conflict OB obviously well maybe not obviously to you but real estate transactions are different from things like litigation the real estate transaction both buyer and seller are motivated to close the transaction so both buyer and sellers attorneys are motivated to work towards achieving that closing in litigation of course it's just the opposite um so in the event after the closing assuming assuming it closes uh any litigation were to develop we would not represent either party in that litigation if you do not want to wave the conflict then both buyer and seller must must retain different real estate attorneys um townwood retain another Law Firm to represent it in the real estate transaction Mr wellstead would retain another firm to represent him um it's up to the council if you choose to wave the conflict we very much appreciate it if you don't choose the way of the conflict I understand I'll begin on this one um and certainly want to make sure for transparency that uh I indicate that I've met with Mr wader several times uh just in regards to his interest and actually first in other properties in Jupiter um and um it fits into a long-term strategy we've had and um from the moment that began Mr be shared with me this potential conflict that we would have to wave so uh I was always comfortable with doing so on a real estate transaction so I'm I'm supportive of of the request uh to do that and I recognize that Mr wad are purchasing or considering acquiring property in many different jurisdictions in this County you know has has a stake with a different office in Tom's Firm West I guess the West Palm office or whatever so uh you know I can see where they wouldn't want to switch for now something happening in you know Jupiter and we wouldn't want to I wouldn't want to switch from the town attorney you know and his firm that have served us for these kind of things so I'm I'm supportive of the waiver and i' I ask if anybody else wants to either support it or comment otherwise given the caveat that if litigation were to arise afterwards that both would walk away from representation I'm comfortable with it that caveat makes all the difference and I I agree with that and um I think we discussed this a while back and I'm okay with it so I agree yeah I'm supportive you a motion or uh yes a uh motion to authorize the mayor to execute the letter um that I wrote which is on your in your materials so moved second have a motion in second all in favor signify by saying I I motion carries unanimously thank you we hope to close it as soon as possible that that property has been designated for bioscience for a significant period of time the town did have one other opportunity that fell through um this is a really good opportunity given who interested in purchasing it going to reports Town attorney that was it Town manager thank you mayor just a couple of things um we've had a a lot come at us tonight so I'm just going to summarize some of the things I think council is looking for us to follow up on just from this meeting obviously we're going to maintain close relationship with f do to follow up on the points that you're looking for and also our Communications uh Team maintains close relationship with their so we can continue to um make sure that information is getting out to our residents relating to um the Indian toown Road Project um I will follow up with uh the person this the resident that talked about presenting the PowerPoint to Kristen Chief barbar has already met with the folks from Jupiter Country Club and we will be having a police presence out there to monitor the gridlock that was reported that's already being done um we'll follow up on the um the bus stop bench and um next to Wendy's and the drop off box for the utility payment that came up earlier um I'll check on the medium plants presentation is brought up earlier and uh and also the drainage from the industrial park um we'll get on that tomorrow morning and then uh as you're where staff regularly um uh anticipates the issues and concerns and significant events that may impact the town um the uh amendment five was no exception to that so um as as Finance typically does they looked at how that Amendment could affect the town's Revenue matter of fact in October the finance department ran the numbers based upon our current values an amendment will have about a $30,000 effect on Town revenues annually so uh not that I don't think it's going to be anything significant there the other thing the Riverwalk Shoreline project yesterday the project to stabilized the shoreline along the Riverwalk began uh behind the mangr bay um project and this will uh involve the installation of rip wrap and when construction occurring the except that section of Riverwalk will be closed but the Reconstruction company will open Riverwalk to pedestrian traffic when work is not occurring so um and the work will take approximately six weeks community relations staff is using social media as we always do to um inform our residents and then finally um we have two new additions to this town hall building um and just a followup to a council has asked in the past first uh just inside the front door on the north side of the main lobby we've added a plaque recognizing the former council members who had a hand in the construction of this building those council members include councelor pner Elon Coffer Cheryl Snider as well as the former mayor Todd rrasa so we've got that accomplished also you may remember all the historic photos that hung in the old council chambers um we had those photos reframed and have created a historic display behind the building counter in our Customer Lobby if you haven't seen it you should really take a look at it and we also took the Old Town seal that looks like that one and um and we hung it that hung in the council chambers for decades in the old council chambers and that now serves as a centerpiece of that historic display in our Customer Lobby here so um really encourage you to take a look at it and I think they really well done kudos to the staff that's my report mayor thank you councelor may um just keep it short I just really wanted to S thank staff for uh everything they did to put together another amazing uh Veterans Day ceremony that we had um it was really nice to you know come and and honor our veterans and uh you know arranging for uh the speaker and everything so uh just want to say thank you to staff for that um other than that I got two hours of sleep last night so I'm ready to go home right mayor it's been a very long night so I'll keep it short but I also want to thank staff just for putting together this presentation with fot and for answering questions um I hope that did some good and alleviated some concerns and you know we'll see we'll see but I think they've made some changes and they' exped expedited some of this so I'm glad to see that counselor uh Delany um yeah thanks for staff again for the uh the great Veterans Day Memorial Day services and that's become a great tradition in Jupiter I love it I wouldn't miss it for the world and um you know this has always been a very proactive Council once in a while we get thrown Monkey Wrench in the in the gears and we have to react to you know what's going on in the last couple weeks so but proud of everybody and staff for kind of handling getting F do in here counselor's done some great jobs so um you know it feels good just trying to wrap our brains around that so and with that uh it's been it's late so that's it C four um yes I also want to thank staff both for the Veterans Day which is very personal to me my father my grandfather my uncle all veterans um thank you that's very meaningful I'm glad our town does that um to the do that was a an explosion that occurred that was an awful thing that happened overnight it seemed like and the the citizens probably don't realize how quickly we did react to it in a lot of different ways but we did and we're reacting as quickly as we can um this didn't look like a good fit I I'm on record saying I didn't like what they were going to do but we have no say in that so all we can do is facilitate finishing up as quickly as possible and hopefully that will alleviate the problem I think having an officer out there again very quick response excellent response it's all we can do as counselors and Mayors respond as these things happen um we we knew it was going to be a problem we couldn't foresee that we have a backup all the way to Publix and Jupiter Farms that's unbelievable I don't know if there's ever a precedence for that um have to have the interstate shut down I remember going out to Proud wouldn't he in 1984 Indian toown Road was two lanes and there was no I95 out there so to go from that to what we have this last week is horrific we're doing what we can if anybody thinks of anything else let us know we told the do come to us if you have any questions or we can help you as a town we will so we're doing what we can thank the staff for that thank you all thank you just three quick items number one um again I'll emphasize what everybody else said is you know that Veterans Day in Memorial Day and these kind of event staff does a great job there's a lot of setup time you know I usually go I mean I usually thank the our staff who are taking down the uh you know the setup but uh you know each time I'm hearing from we're all hearing from residents that are really touched by that event so it's it has become um you know really special so I'm grateful for staff helping to make that be the case and then you know it kind of struck me this year you know Veterans Day I think some resident in conversation with me kind of pointed this out you know our kids are in school wasn't always the case and uh you know we're doing what we can to perpetuate what Veterans Day was all about and I'm fearful that you know our youth may lose some of that but it it we're at least doing everything we can so grateful for that um small point in the minutes um I almost commented on it but I and I just want to ask you know in the interest of brevity I I've really tried not to comment unless it was absolutely required but I want to just ask that um that under the expart communications I can't Mr Barrett has advised dozens of times that we need to say when we met who we met with what we what was the context of it so in the experte communications you know that were in the minutes from October 15th I'm pretty sure I try to be consistent to say what we talked about um and uh and I don't think in the three members of council that spoke that was captured for any of them I just want to ask to be mindful um um because it's an obligation of us and I thought thought about it but would have sent you four or five words but just going forth into the future we have an obligation when who and what was discussed that's been revised so the minutes we approved the night didn't have the what was discussed but I know at least in my case I'm not suggesting it isn't in everybody else's case but I know in my case because Mr Barrett has driven it home I always try to mention that but I couldn't recollect without going back to the video you know what I said was the what when I spoke with the you know the pnz director but again that's just a generic ask and then just lastly on the I95 off ram traffic signalization um and I'm appreciative of the uh professional working relationships that staff has with the other entities um you know it's clear that something happened that wasn't properly evaluated which is not uncommon um an analysis was done after the project was done to be an improvement um but I don't believe and I don't believe staff I'm just one of representing staff here believe that it could have ever worked with restricting the Northbound off at the same time you only had two lanes so we really had predictable redlock but everybody scrambled to correct it and I'm grateful what we heard was you know by Monday you know A3 Northbound off you know uh Lane will be added in a third you know because really there's two sources of the traffic coming off I95 and coming from the West right we're going in the opposite direction but those are the two and so by Monday those two are going to be increased by 50% right so every every light change each one is going to go from two to three lanes that's going to make a big difference they should have figured out how to make that happen from day one but it we are where we are so grateful that I think the Investments that have been made with fot they're comfortable using this as a venue to communicate they don't have the Communications uh setup like we do with our uh you know with our department which does an incredible job it's clear if you look they just post something like they they they're not they get their process and they stick to it right a once a month update or whatever so uh they don't live here yeah Wellington's understand but you could hear how they were grateful and rely upon the town so in any event I just wanted to emphasize that particularly to fellow professional engineer on the Das here that uh that uh I think in fact I know a traffic engineer objected to the traffic signal being taken out but didn't have authority had his professional opinion and he was right I just want to recognize our staff and we have ours too and everybody was right so doesn't matter it's being corrected but and I thank him for that and with that the time is uh 10:13 and we'll adjourn the
