they gave us everything we needed good morning um yeah I think everything's on the plan I don't know why I I haven't spoken to them since after the last meeting where I followed up so um emergency engineering on Tuesday they didn't call me back I called again on Thursday they finally called me back to make sure that they would be available for the meeting because we would like to close up the enforcement order and the cease and desist order tonight um and also I was assured and talked to the primary um Bill Kenny from riverhawk that they would be here also so all I can say is I've tried my hardest I've done my due diligence I was very firm especially with Prime and I did get a call at 205 to say that they would be unable to attend and I called the owner and he called and they were unable to even send a representative because he had another meeting tonight so I really don't know what to say I don't know what else to do you do so much what happens if we don't continue it what that they'd have to start all over again well well they we haven't even looked at their notice of intent yet that's been right so but they're not asking even for a continuous so this is just a close out the enforcement order well and to go over the 171 page report that we all have sitting right here that everybody is I've gotten calls from the selectman I've gotten calls from the plan board everybody wants to know what's up and this was supposed to be explained to us tonight with um the water samples that were in the water column with copper and zinc zinc yeah lead Le zc yeah right this is basically a detailed written summary of all the results we've been getting for the last couple months Soil and Water so there's nothing surprising here no but they're supposed to be here to explain it there's a lot of questions and I think the residents have a lot of questions and I think we have questions my one of my main questions was they said that the I want to know who did the grabs they from my talking to riverhawk I thought that riverhawk did the grab on the um not the soil samples but the uh storm water samples and it says in here that uh Prime storm water sample M yourself yes I did storm water sample collection and laboratory results Prime Personnel collected storm water samples so if they collected them and they were submitted to the laboratory I thought that riverhawk collected the samples and if they did not if Prime did then when is I've certainly done water testing many a time and you need a a uh chain of command chain of command thank you chain of custody yeah so um Rich assured me that he would get me a letter that pointed out who did what and I never also received I never receiv received that either so I'm at a loss what does everybody else think I don't want to restart it I'll tell you that I just table it to represent I just texted were in for Tex and you're from where I'm sorry you know what I've already gotten myself in deep water anybody that to obtain uh certificates of compliance uh for work um on the site um goes back quite a ways um you the commission may be more may have been here for some of this but so there were two um separate D numbers on the site of and and activity um the first was uh installation of cell tower uh and the second was for the creation of several wetman bogs on the property I went out um last Friday and walked the property uh just to go take a look and um so in my opinion I'd recommend the the cell tower seems fine it seems like it warrants uh receiving the certificate of compliance um I I've spoken briefly with uh Mr chistolini as well um about the second piece um which has to do with the replication so I didn't see any replication the the replication that was uh on the site plans I don't I don't think that work uh has has been done and so that um to me um would suggest that at this point uh we the commission wouldn't want to issue a certificate of a compliance until um that issue can be sorted out and um I I understand that the property um there's interest uh in selling the property and uh so that um increases Maybe I don't know if it's the urgency but I I um but I I think before uh the before the commission should be uh how can we make sure that that work uh is done and gets done and um the site plan I I have here um and all I could find really for the replication portion of that that the project is is is actually written on the site plan and it's it just involves the the vegetation that um was agreed that would be planted it's a shallow Marsh it's adjacent to another Wetland so it would seem it would be simply um Excavating to the proper elevation and then following up with the planting and then there'd be some there would be a need to have or to meet the requirements for the um you know inspect section of the growing um you know to ensure success so it's a shallow Marsh the the primary plants were high Bush blueberry uh sweet pepper bush and then a mix of seeds so um however uh whatever process it in some ways I would think you would need to come back the orders of conditions have expired it's um so there may be a need for someone to come back back and file a new um noi before the commission and I don't know uh we spoke as well Nancy I don't know if if if I'm missing anything there was something else on that paper and I don't have it I think I made you a copy and then gave you both of them maybe about that additional that page that had the additional the special yeah the special the CD whatever of the nrcs there's something about a nrcs which is um natural resource conservation service which is part of uh Department of Agriculture and it's it was supposed to be something for them to there's a plan we don't have an as built right and and um so it walking the site and again M uh Mr Chini and I spoke today um there were you know the the original plan to build some some of the bogs never came to fruition so um this the plans we have that we don't have an as built um let me find these are special conditions I'm sorry too paper okay well like I say the bottom line is um there was an order of conditions and there two right there's two I think that Mark said and uh I agree that we're fine on issuing a certificate of compliance for the cell tower the other one was very complicated it doesn't look like he's been out there like some of the things have been done so there are outstanding things I don't see how we possibly could it's where we go from here I did make cofes huh okay sorry well that's all right I thought I was losing it but I'm must I left my pen there too in a minute please we the commission speaks first um so basically looking at a 15 16y old project that the initial work got done in the remediation got abandoned just to make a quick summary yes okay yes yes um so what was the rep the the Wetland replication for did it did it pertain to the tower site no to the bars yes but the Bars were never made but but it was dug out right there was an existing bog on the property or a pond y there was some work done there was some alteration of wetlands in there I think it was approximately 11,500 Square ft of at least um that that was the number used in the noi um of replication uh of yeah of lost wetlands and the wet replication was approximately 13 another problem that I I think worries me and why uh we should look at this carefully is because there was a superceding order D gave a superseding order and then they withdrew it when we got an amended order or condition so we're actually looking at an amended order of conditions because D had already said the original didn't cover what they wanted to see um so um it's not that it can't be rectified we need to figure out how we can do it it but I don't think we can give a certificate of compliance on work that wasn't done and I think going forward we need to figure out at least an as built and if it needs to be done if things have kind of rectified themselves um I don't know Mark you said something about a pipe um and again uh this is just based on conversations I I I had with um Mr chellini I guess there's a pipe to uh to not divert but Channel water down from the the the bog one of the bogs the existing bogs down to a a pond on the property and I think there's a natural flow of water uh coming down that's that I I I don't know the whole back story of why and we will give Mr celini a chance to talk but I just wanted to have the commission weigh in first so we're issuing two certificates of compliance no well I think the recommendation is we order is one one for both no one for the tower well yeah yeah that's what I'm saying but but ultimately two yeah they need two so so do we all feel comfortable in issuing is one for the tower yes and the tower is 92 608 yes it is so can I make a motion for that sure I'll make a motion to issue a certificate of compliance for project se1 19268 at one Elliot way second any discussion is it clear that there's two lots it's there's two different numbers there two different D numbers and the lot for the cell tower is pretty much called out on the plan that's referred to in their original notice of intent it's clear that it's two standalone projects that have definitive filings that's cool okay okay uh all in favor hi all right do we have um because it's not in here and if not I would like to request from them their original project plan and a summary of what work they actually did do how much distruction we have the file right here we was done Mark has looked at it okay um I have to just step back for a minute and we have a new agent it's his second week on the job so we've been trying between the two of us that the new projects that we see that Mark takes the lead on whereas the old projects that have been hanging on for forever that I'm taking the lead on so we're kind of trying to share those responsibilities so Mark is new and he's try to come in on this but we both sat down today and looked at the file together and it just doesn't look like they can account for anything haven't been done I don't see any documentation for anything and I know that with a certificate of compliance we need at least an has built of like what's still there and if that in fact does need to be done some kind of um it was it was pretty much planting right for the replication for the replication because that was a problem D had the problem with right but that it wasn't they were filling and they weren't accounting for the amount amount of fill that they were doing okay so did you recognize any of the brush or whatever it is out there that they they were that was specked is there any of that out there um I I didn't see any any replication I I um I did walk the the pond that was there um um yeah it and I mean it's been 14 years it's been quite a while so it should look Pretty Natural now yeah um well wellons don't just grow back in on their own well no that's what I'm saying if they planted them it should be pretty well grown right yeah um okay there's BMS there's a couple BMS there's some um um construction equipment still on site that um um yeah I'm confident that I I you know yeah okay I didn't see any any you ready to hear from the applicant maybe yeah Glenn you want to come up to the microphone no I can talk loud you cannot I cannot I've already got in deep water you need to come up to the microphone my hearing so I can talk louder get everybody and you need to identify yourself I started the project and um um can you identify yourself this is Glenn crystallini how's that leville plumo I uh sat at the project and um everything was going good and uh I laid off for a while for financial reasons I wanted to finish the cell tower first because that was a contract that I had with the cell tower company and uh you know the the the bogs are like my pet peeve you know to do it I had I have animals and cows and stuff and um about 18 months ago I started getting sick so I've been in and out of Dana Faber and hospital and Plymouth so I had to put things aside for a while so I'm buying I bought another place down south and um selling this one but I intend on finishing the cranberry boxs with the person that bought the property from me I left the equipment there for that I'll be coming back and forth I just about all retired now I just turned 78 so and you know lucky I'm standing here so I do intend the plan that was drawn originally by the original engineer I wasn't happy with it because what he had done he spotted this and spotted that and spotted another bog and I wanted everything in one area so we did I combined them all to make one good siiz B and I installed 1,400 ft of underground cement pipe from the cranberry bog down through my property by my house and into the pond that I have behind the house for water runoff I mean that way I wouldn't have to pump back to the pond there wouldn't be no mess being made it would be all natural water I think Joe I witnessed that I've been there for the installation absolutely so um that's all I that's all I can say I'm going to finish it off but you know I'd like to have some time to finish it I'm lucky I'm here to tell you this right and but I think the problem is that's not what's on the original plan it looked like they were like different B like I had reputable contractors I had I had a real reputable contractor working there with me his his Engineers Drew up the plan that you you will see I think it's not that plan there it's another plan that I can get it shows everything it shows the replication where where he thinks that it's going to be replicated is not it's on another area and I think it was replicated I can't remember exactly when but I I know it was replicated right but this is the plan that that's that's the plan that they came the first engineer came in with but it wouldn't have been feasible to even build that bog after we started so we need to see I'll get that's why we need an asilt if an asilt comes back that that of what's actually there yeah right but we cannot issue a certificate of compliance until we see that and make sure that everything that was in there there is accounted for and because it's not what we looked at originally that it works well I could actually it's all up l vog i could fill it in if I had to fill the whole thing in going some somebody in 5 years will try to build houses in there which I didn't want right 41 Acres I I wanted to keep it one pace that's all I got to say no I can't uh I have a copy of the original plan but by moving getting things ready to move I can't I can't find it but I I will ask one of my people that help me on the blog if they have a copy of it the elevation of the blog is perfect everything is perfect what about the the engineer you used to do the second plan the engineer that you used to do the second plan can you reach out to them to get the plan I haven't talked to him yet I didn't even know about this meeting till the other day yeah I mean I've been in and out of Dana FAA so it's it's not easy to uh the problem is you submitted a different plan and didn't when you changed your mind and decided to do something different you should have brought in an amended plan that wasn't me that was someone else but I you know but you you know my point I'll take the hit for you know but actually this bog that's there now is better than what what's on that piece of paper well before we can move if if I may before we can move any further we need a copy of that plan okay all right we should also consider the possibility that we need a certificate of compliance we need uh if you did the work in the in the Bog all of that is not valid anymore we would have to renew we need to see what's there now and go from there we can't issue a secet certificate of compliance on the plan that doesn't even show what's done so but we can to the cell tower and so that will be one step one well you've been you walked the land a while ago I off the town a few for nothing we already signed off on and they went and bought some in Bridgewater the question is it was free too can we amend the notice vent at this point it's six 15 years old they would probably need like Mark said a new a new plan Mark had we definitely need a new plan we can't we can't move forward I believe that was your recommendation right I I would think uh given the age but i' uh I'd also add that I'm I'm happy to if Mr Chini are saying that there may be I'm happy to come out with you or your representative if there was work if there was replication I'm more than happy to come out you know and take take a look but but I don't I don't even want you to go out there until we have that plan okay cuz I I want you to be able to verify what was not if that's okay that's that's fine I'm just so should we continue continue this yes yes can you get the plan we have a meeting in 2 weeks I'll try I'll try as best I can to get it all right if not we can put it off and do it in a month yeah okay but don't want us to give you a full month my insight was what I'm looking at it whether I'm there or not whether you know I have a chance somebody wants to buy the place they'll take it like it is but I promised them that I would stay with them yeah that's why I left the equipment there to finish it gotcha you at least get it to where you guys like it you know what I mean there's some cat and nine Tales that are in the trenches but that's normal you know that's replication so we need I can't remember where the replication was with the new plan I just can't until I see the plan and show it to him right then we can all walk it if you want and and get it right I I do intend on it's a big piece of property yeah I do intend I don't want i' I've had people want to buy it and buy it buy I don't want to do that not to this town we got enough problems going on now so Madam chair I'm just trying to see is the 18th is um do we want to do it to the 11th or the 18th I guess you want two weeks or a month give me um give me a month so if it's any sooner I'll tell do with me believe Mark so so one thing that would be helpful if you can to make sure that if if the replication plan the information that's on the plans we have is is it we need some more in terms of you just want to make sure that it gets done and I so I I want to make sure yeah and it has plantings what plants are going to in there but you know it's going to be an elevation you know what what's they would be um I guess you're not really a repres you're a representative the owner in the back we have but Rich was supposed to be here tonight to address the Ani but we'll be happy to I think he's not feeling well I spoke him at the end of the night and right he's I didn't want to push him too much on on that but okay um so uh Bill Kenny from Prime engineering just an update uh for this project that's ongoing uh an enforcement action I think the last time um we spoke we had uh discussed that their had been solar remediation done in November and we are waiting to uh dispose of the soil associated with that the soil disposal is complete the um documentation for the disposal is included in a um limited removal Action Report um that I think the commission was provided with um in in the manifestor included in that as well um another thing that we did on December 11th is collected storm water samples from a couple locations and we uh we submitted those for the standard um sector N1 um nifty's multi sector General permit requirements can I just interrupt you for a minute this was another issue that I had with Rich when I called him last week is um the last time I talked to you I thought you did the grabs and you did the collection on the storm water but in the report he put Prime Personnel collected did you want me to personally do that did they or did you I mean I'm talking about the chain of command on the collections and I can't this 171 P engineering Personnel say again prime engineering Personnel collected the samples and then where did they go from there to ESS laboratory from them that's right so they have a chain there is a chain of custody I think the chain of custody might have and we should look at the lab report might have riverhawk environmental on it CU we specified which lab analysis to run on that all right yeah I'm looking at a a custody the document has the company name is riverhawk from for the um arsic or for the water samples this is for probably for both I I know I specified both what what to run this is for I think the soil samples grab aquous grab aquous well these are the December water samples okay chain of custody okay all right okay received okay okay good so they were run um for for laboratory analysis of of Select metals and other parameters that the EPA determines appropriate for um although they're not using it as an automotive Recycling yard I know that was some of the concern before is is uh you know that was um like a scrap yard type of operation or something so that's that's what we ran the samples for um zinc was detected in both samples um and I think it was aluminum was detected in one of the samples copper coer copper I'm sorry copper zinc Co okay so it's copper and and then zinc was detected um so the the EPA in their multi sector general department establishes Benchmark concentrations for monitoring for for different types of sectors so this isn't the Construction general perment it's another permit that they have for industry type of um discharges for storm water and uh they're not non- enforceable stand or they're not standards they're they're Benchmark concentration the EPA is basically established if you have concentrations of these levels corrective actions are are necessary and appropriate right so that's that's U and you have to define the EPA if you're if you're operating an active recycling facil or whatever the sector is that you're taking U enterprising and defining um steps towards addressing that um so what we recommended is is improving the storm water controls um at the facility which there basically are none I think now it's just you know sheet flow if if any from um from the parking lot which is like recycled pavement um underl by mostly granular materials very Sandy and then down to the not all silty stuff yeah it even when we did the test pits we didn't observe too much very silty material there it was pretty pretty Sandy really uh maybe the the the uh the old a B layers were a bit more silty but but the underlying C material was was pretty Sandy so it's it's um I haven't looked at the perk test rates uh for the sepic system but I would imagine it's it's very well draining soil at this site four or five minutes something like that yeah I I I wouldn't even be surprised for better but um essentially that that's you know there's not much runoff to begin with at at this site um but what what was runoff we we'd recommend combination of you know deep sum catch bases siment settling um and and then uh you know infiltration as necessary in accordance with the um Massachusetts St water standards for for all those PR and I don't know if you can answer this question and I really don't you know I don't mean to put the heavy pressure on you but that's why I wanted Prime here tonight because they we haven't even looked at their original notes of intent from like four months ago or longer yet but my question that I wanted them to answer tonight so it doesn't go on and on and on is that addressed in their original notice of intent your recommendations so I don't know if I may there they did have storm water management in the original intent what our ask of them is before we consider that noi even though it's before us is for them to review it and come before us which they were supposed to do today and discuss it with us to make sure that their existing storm water remediation plan encompasses all these recommendations based off of the test findings and if it doesn't they need to file an amended noi before we'll consider it new PL so that cuz we're not going to consider their prior noi if it doesn't Encompass all of these recommendations to take into account the contaminated Soil and Water that we ran into so we need them here before us before we can consider an noi that encompasses all of the contamination that was found on site okay that's the next steps we can address based on all the information that was provided and thankfully now that that soil is offsite and the bill of lighting is in our hands thank you very much for giving us that um it's good to have a bow on something on this project very excited um but that that's really the big ask that we need do you need a a letter from Prime engineering that certifies that they're that they existing notice of intent addresses the the uh recommendation for stor control and we probably would need from you yes okay from from their engineer you for that would do and if not they need to submit an amended plan the changes yeah because I don't know if they the Deep sub subs and things that you ask for that's all sort of standard for the the M its storm water um standards so I I would think likely but I I I can't honestly vouch for that um right now okay like I say that's something that we would like to have to address tonight instead of going on and on and on it would have been nice to have that covered so um I really feel does anybody else have any questions because I really think we need to take questions from the audience if does everybody have any more questions I mean what did for us to close out the enforcement order what does that take just a motion and a well he's done everything we've asked right so it just automatically comes off okay yeah just like a compliance is the same okay yeah this report kind of addresses everything that we asked for but I mean I would still like to see I would like to take questions because that's why we're here tonight and put you on the spot to answer the questions so some of them that we can't because I was asked to summarize your report and I'm like I don't think so I just agreed before we open it to the floor that yeah there two completely separate issues they've we they've checked all the bullets and have now done everything that we asked them to do for the enfor for the enforcement order we have not seen the noi yet we have seen it before us but haven't considered acted upon it so they keep and it doesn't include it can't include his recommendations he didn't have them back then right we didn't have the test results it could have without knowing it we don't know maybe he already did that was my question it could be robust enough okay but it may not be we just don't know that and we're not going to take the burden of assuming that yeah so before I ask anybody if they want to come up from the audience I just want to make it really clear that everything's through the chair and everyone who wants to speak needs to come up and speak on the microphones so anybody Tim wi from one wi way the next one is I just saw the report and I have some questions um on the soil removal in the test pit where you found it how far out did you go when you found it how do we know not 5 ft in any direction 10 ft in any direction 20 ft in any direction and the test pit you found it is near is near a pond can I answer that the chair the chair sorry yes well there's not a thousand people here so I don't have to water okay all right it was it was actually like that that layer that had the um the arsic in it it was like dark like brown black type of stuff that was buried it was like like 10 in down in the in the test pit that we did there and then and then it was about probably like that that thick or so we did um I have a couple pictures during the cleanup and then um also like a good picture during the test pit where you could see that that layer was like very visually discernable but how we know it wasn't 5 ft away we well we started there and then kind of worked out from there to determine the ex did you go and I looked at the pictures like yeah I mean we could we could see it probably there's a lot of Building Material fill brought in and you didn't do any test pits where that was brought in either so I you know what I mean like there was a lot of material brought in that was really much well is it in the area where they're going to put the um Basin well I because it will be dug up again if they're going to put in the Basin they're going to have to it's just a that's in the corner it's just a little further it's further over so basically that whole area down near Donna's level and it increased in height probably 7 to 10 ft would be my guess and then the black top came on top of it they crushed that black top so there was no test pits performed in the area where all of that old building material they had stockpiled it for a while they would bring the dirt in leave it there and then when they decided to make it they pushed it all around well we agreed on the location of the test right which is where the work that was submitted is going to be done right and the buffer zone around the Wetland are in the back right I don't think we could have dug up the whole property it's outside outside it's outside of our perview yeah but I'm I'm asking the area where it was is right next to the wetlands too where he did it where they brought that level up it was all muck I used to walk the dog out there a long time ago well we did used to sink down so when he's saying he went deep and it wasn't the area that where you did them was not the area where they brought this how far down Bill where the test pits look pretty far down to 10 10t yeah we we determined that um based on the elevation of the the sort of like lowly area I think maybe between um your driveway and and like the the the flattened portion of is we figured if there were a filling it probably be to like that level or so U which was about like 9 or 10 yeah we just didn't do it right in the right in the area where it was fairly low yeah do you know what I mean we did it um where the test pits were but my other my question really was how far did you go up and you said it was just color it was IR regular it wasn't it wasn't like 10 ft by 10 ft but it it might have been like in in a portion it was probably you know it extended down to probably like less than one foot and then got wider in an area the likely deposit scenario for this is probably like truck backed up dump some dirt and it got leveled out or something like that but instead historical is that historical to the site or historical to just historical dirt yeah historical hisorical it was definitely um you know before the the the material that was on top of it you know the there was a Sandy layer on top and then the the asphalt layer above that and it's hard to tell I think um exactly what the date was sometimes we could tell if we see bottles and and and other stuff like that but we didn't see any of that in this field material um yeah I just want to make sure that arsonic and another question is on the bill of Laden why does it have a zero cost zero cost I don't know that doesn't sound right to me they don't take it for free no definitely not I don't know how do we find that answer the receipt in there says zero cost 11 tons zero cost we can get the receipt and the owner direct it so I I do you know what I mean you're talking chain of custody I mean it should have a cost associated with getting rid of we have a chain of custody that takes it out of the state to New York um but the owner trucked it himself in the chain of custody there's a receipt from from the scale house in for zero cost and my question is did they take it for zero cost I I don't know I didn't pay the bill or but they wouldn't take it right we can agree it wouldn't be free no I I would I mean it's it's probably like 100 bucks per T usually is is all right so here's the other thing it was a question it was why cost hold it a minute is it in our purview how much it costs we have a chain of custody where it went and it got there and it's all legal I just don't know if move to the storm water samples when you have a lot of copper and zinc and it's in the storm water it's also in the groundwater in town as well does it end up in the aquer and who tests the aquafer like it's if it's been there versus historical and this problem is causing it and you Google that information of heavy zinc and copper it comes from metals and tires and all the stuff that's sitting right on top of it right now that hasn't been that has no licenses to be there so the the if it's causing it you're talking remediation by catching it and treating it and treating it and not getting rid of it but how do we know that it hasn't gone any further than just the storm water not to stir the PT okay please bob L these are water qual for this the right what's that a water a 401 Water Quality will be when it gets to the point of the end the notice of intent there will be another layer of protections on what's happening there well because we got doners all her West she couldn't make it tonight because of a furnace boat that'll be part of the water quality testing we do when we consider the next phase of the pro but I I just yeah I just want to make sure that that's addressed because I mean I'm not a scientist but I just figure water comes down it's got minerals in it and then that's got to get somewhere right it's either and it's going to get into the that's the unfortunate part about tonight is we don't have the engineer here to address those questions that are that's why I wanted him here tonight to address those next questions that are coming in the nextage it just makes common sense right it's you know we have this stuff the stuff sitting there as of today old washing machines and 18 wheelers and sh shipping containers and whatever else is in lady that comes no she has a well she has a well that'd be an easy way to check she didn't tie in but that's a cost to her do you know what I mean why should there be a cost to her when this has been operating like a junkyard with no license well if she wants recourse she probably have to you know what I'm saying like right now if we've identified a very high one of them had a real high level which was at the zinc or the copper I mean according to the Baseline yeah it was like 200 or something I mean I'm not a a scientist I don't keep in mind I said before go ahead it's a water quality standard but it varies this is New England you drive all all through New England and take various water samples from the soil from ground water you're going to get different uh results that's inherent in I understand that well but there was if you look up where the stuff comes from it's not natural it comes from junk being left on top of the dirt and rain water hitting it and then it dissipating in the ground me as my guess is how it got there but there can be uh contaminants like like to organic carbon and things like that that uh are tra in the the very low uh below the cover and that leeches out so you can take a sample in in here and you'd have one set of results go next door you're going to have something totally different I'm just I'm just asking I mean it's just there's a big it's it's a lot higher than let Bob finish please so you know just you're aware that you know you don't want to get taken you want to know where the samples are collected like we've heard tonight and that's the reason why you can't look at uh sample uh concentrations without considering what the change is going to be throughout the site okay so should have more have been done then well I think you looking at it these samples they're very very low well what is I mean I don't know I'm not a scientist if that's it says 20 and it's 200 I mean that doesn't say low that says well it sends it in here but it's it's kind of confusing the way it's wored uh I can well it on this chart they gave us for the one of the samples was copper the the general consensus is above 4.8 is a problem they have a six and that wasn't that one that was like 200 the zinc was 40 and they're in the states um thing is 37 that was the highest variability yeah um but my yeah my question is but then you're saying when he comes with a notice intent there is going to be a water sample taken from the water table we will do we will do water quality testing will be not we will do as part of the project water quality testing will be done that is appropriate to the size and scope of the project it won't be from the whole entire property it will be what's relevant to the location of the property we haven't reviewed in full the actual notice of intent yet so we can't speak really informed about what that's going to look like yet um because right now we're just trying to close out the assist I'm just trying to get an answer do you know what I mean you guys got the report and yeah we have the report that's based off of the samples that we collected and what we asked for we asked for sampling in those eight different locations trying to take into account the different places on site I mean correct the property has been used as kind of a junkyard but if if you do remember a couple meetings ago some of the original samples we had concerns about we asked them to do additional samples and they did and we were happy with those results um some of them like we mentioned were expected standard deviations if you have an apple farm you're going to have a ton of extra arsenic you never know what the prior owners you know did or composted in the back that could have had natural organic impacts so we're not going to you know we could sit here uh wondering a million reasons it it could have happened um but they have given us and we're comfortable with the answers and the the mild deviations are are nothing in any way concerning about the the zinc and the copper um any one of us would could test our our wells and we would come up with levels that would be uh especially if your water tastes really good and is really cold the deeper it is the more sediment it probably crafts up your pipes too anytime you have to you know shut the water off and if it's l you know it's got rust it's got iron and it's got manganese in it and it'll turn my hair green yeah no but I mean you know we were talking about all the stuff that was in all the vehicles and you know what I mean leaking leeching into the ground and you know everything that's within the scope of the Conservation Commission to address that the notice of intent we will take up in the coming meetings when we can get more information on the storm water uh remediation plan and all that's going to be according to your recommendations with the Deep sump sub whatever you say it yeah deep some catch Bas just basically the the bottom of the catch Basin is usually like four feet below the outlet pipe uh so so it'll catch the sement and then gives gives um a location to basically maintain the catch basins as well so you so they keep pumping them they keep cleaning them yeah yeah you inspect at least quarterly usually and then and then pump as necessary when the when the um sediment level gets closer to to the bottom of the P so there'll be a maintenance plan there should be yeah in accordance with the Massachusetts storm water standards yep so that probably wasn't in the original I wouldn't be surprised if it is in the original because um it's like every Town it seems like requires yeah and it's it's a bummer to have to keep on coming back for for more approvals and reviews and stuff so the storm water now is going so you're taking the steps trying to make sure that storm water is collected in a place and treated so that that all of these minor they're not major things as is that your recommendation yeah most likely these these concentration just a result of of there being sediment in in the actual sample you know just just like a little bit cloudy of of a sample and it's hard to collect uh from from like a low-lying area hard to collect a really pure non- turbid sample so likely likely just what happened there and and why those were detected it's impossible to to say anything definitively from an environmental testing perspective without actually having data so so from my perspective um I always say it's you know kind of not potentially not likely something might not be likely but it's it's hard to be super definitive without actual them from an actual scientific so and so this is just one phase now we're going to move on to the next phase of notice of intent and how they're going to account for yeah taking care of the storm water that that would be good so so I if it's all right um with the group I can I can ask um Rich to to prepare a a letter or you know review the plan in accordance with with these or in light of these data in in accordance with the the state storm water standards does Lakeville have any additional storm water bylaws that that I should recommend they check in on or is it just the state standards John I don't know it's just the state yeah okay have anything special I don't they so no they might I don't rich rich will probably know if there is something on a local basis at least and and and um I'll just ask him to to to review in light of this data and render an opinion on that when uh at that point would it be possible to get on the agenda for for the notice of inent if it if it's acceptable to the group he hasn't asked we didn't get a continuance request he needs to do that tomorrow I ask for it to be continued to our next meeting which will be February the 11th February 11th so that's when we would like to see something before then from a letter of you know if he needs a upgrade on his uh an amended am plan or let us saying
