like to put a hold on approving August 6 minutes um I have some edits that I'd like to be put in before we send out another draft of those so with the commission's support I'd like to hold that off until the next meeting to do so certainly okay thank you um administrative discussions do we have anything to add to that Amy I have two that I would like to put in um I'd like to with yourself Tim myself and um Andrew put forth a summary of The Joint meeting for the clean lakes that we just met with um interested stakeholders I'd like to add that just to summarize and then I'd also like to do an acknowledgement for the orchard with the recent RFP that's been put out what are others that we would like to add to administrative discussions um I wanted to add a quick mention of 161 to hadai to hadwan 161 161 yep okay um a potential land use permit for Geocaching in Hartwell uh the potential land use permit for uh cross country team using Hartwell yep and that was it okay awesome so I have one two three five to add to that um let's go ahead and start to go through some of the items below the administrative discussion so that we can kind of Peck away at that I know it's a little unorthodox but request for certificate of compliance civa mte 20498 yeah this was the uh the one where the deck had to kind of be rebuilt and the shed kind of had to be rebuilt the double door um it's it's all done it's all stabilized and she did the replanting she needed to do um so it's all looking good okay great do we have a motion for for the request I'll make a motion that the commission issue a certificate of compliance for five Kiva away Mass the EP file number 20498 do we have a second second thank you Michael um Andrew would you do roll call for us please of course uh Chase Chase continued discussion enforcement order 30 Warren Street unpermitted construction of a walkway within the buffer zone and work in the rear yard Sarah Sarah before we move on where did we end up with the other CBA property the one with the turtles uh she is I think maybe even this past weekend doing the planting she needed to do the kind of regrading and pulling the sand back was done um so she's I think uh what was his name Eric Shaw was going to do it uh this past weekend assuming he got hold of the plants all right mostly low Bush Blu-ray perfect thank you um okay um so Amy if you want to do an update the Commissioners we did receive a site walk report that Amy put together um just yesterday so myself Amy and Ed and Casey and Chuck Karen met on site um this along with photographs was submitted to you all in your packet um Amy do you want to do any quick overview and Casey thank you for joining us Casey's here as well the owner and oh that's not why I have um oh I lost you again so the um uh uh I think there was General agreement on what chuck had proposed uh with some tweaks here and there which were both in the memo and Chuck actually did um redo his restoration sequencing uh based on that and I think he caught everything but you only you know you only just saw it but um I think it had everything in it right so I think we're at a point now where we would like to go ahead and let Casey start the work as soon as so there's one part that's missing Casey if you want to talk a little bit about that and that's having your second engineer kind of look at those roof drains and how that might interact with Chuck Karen's um plan as well gu um Scott uh is um been asked to put the plan together for dry Wells for the for the um the down spouts those are there were pre-existing down spouts but we put new gutter system in the house um so that's going to be part of Chuck's overall plan is to incorporate um Bri Wells we're still waiting for Scott to get back to us with the plan um I don't believe he's actually walked the site I did give him the elevation maps and anything I had from past work on 31 street though okay thank thank you um Amy are we in a position now prior to having Scott um Hayes the second engineer allow Casey the homeowner to begin some of the work um that may not interact with the downspouts and the drywall dry Wells uh yeah I think so you can just basically um do an enforcement order update allowing uh the work to proceed that was in the August 20th um sequencing from Chuck Karen um while the as you say Scott Hayes it's it's Scott Hayes from foresight who's doing the uh the sort of stormwater piece of it um while he finishes off his design I I don't think anything Scott does is going to get get in the way of the Wetland in the immediate buffer zone restoration okay and you were recently on site with us do you feel about that allowing um the homeowner to start to go forward with this process I think it makes sense given the time of year um if if he can you know find someone to to motor along there and get the seed down before October November it's probably good you know Casey the seed mix usually needs to overwinter for the Wetland seed mix anyway uh so you won't see much this year um you should see a lot of it next year and then even more the year after that in terms of what species start coming coming up okay great Ed your thoughts on that I think that makes a lot of sense and and I know Casey wants to get going with it I'm I'm perfectly fine anything he does is going to improve it so the sooner the better as far as I'm concerned so um what I'm hearing is I'd like to have the commission um accept a motion to allow um Casey to begin on the work working with Amy and Tim at the agency to understand like where the erosion controls what your sequencing is um in order to get going so if we're okay with that if someone would entertain my motion to allow an amendment to the enforcement order and then allow Casey to start work and I would I would just recommend and this might have been in Chuck's um piece of it uh I guess two things one that the office be notified before anybody starts Excavating anything out there or you know moving fill around just so we know and that um Chuck Karen be present uh as the final grades are established y exactly I I appreciate that the reminder of that so that great Casey do you just want to thing do you care about putting any date about when you might want to hear back from Scott Hayes um well I I would like to have an update at the next meeting for sure okay all right Y and it would be great if either Scott along with Casey is present and then in a perfect world chuck would be there as well so in a perfect world all three would be there okay so that' be September 10th correct um Casey while you're here and we're going to jump around a little bit let's talk about a waiver I mean not a waiver a land use permit for your cross country team so if you can tell us a little bit about the situation that's going on right now that would be helpful for the Commissioners sure that that'd be wonderful um so yes I am the cross country coach and a few weeks back I was notified by h Beth from nef that there Timber harvesting happening in proudy woods and that's our traditional training location the team meets daily for months on end in the fall and we run prdy Woods two brothers trails and so we're just looking for another place to run um the team on trail and a Heartwell land seems to be the perfect location we can meet at the track work out there the middle schoolers can walk to the track high schoolers get the bus we cross the street on Russell Street there's a there's a trail head right there that um takes you from Russell Street down to the heartwall family family land and we'd like to be able to run there uh until proud Woods is cleared again which should be second to third week of September which then at that point we'll be back to proudy Woods hopefully forever or until the next timbering years or 20 years sure so there are about 40 athletes on the team um two coaches I would absolutely remind them andure and monitor the the fact that they stay on trail um which I don't believe that's an issue at all anyhow and I do know there's concerns with um running on the boardwalks uh and you know to make sure that we don't run on the boardwalks we don't want to damage damage the boardwalks so that's my request so Casey are you able to access all the property without running on the boardwalks or you think you will have to be on the boardwalks boardwalker too right yeah there's two very small kind of board walkie bridges that you have to cross and there something like one's about four feet long another's 10 feet long or something but then there's one that I know is I believe it was built probably last season that seems to be about oh 75 feet long maybe something around that distance that you just unavoidable we can walk on it not run on it yes so I think that would be helpful for the yeah that would be helpful for the commissioner so just to understand this is not this is just for training not for a meat correct exactly right% so I guess I would like to ask the Commissioners in order to allow such use because it could potentially be impactful what the guidelines are that you would like for Casey to instill on the team because if there is damage we have no uh recovery for for this project if there if there is so I open this to the Commissioners for comments Casey um just like at proudy will the um the team be marking any of the trails with like arrows and like uh for branches that are sticking up in rocks no no it's it's actually the trails there very nice at Heartwell it's pretty noticeable we just follow the yellow blades for the most part of course there's a red and blue uh intersecting Trails but um do you mean like when we paint spray paint like the roots on the ground so people don't trip on them yeah no we wouldn't be doing that because we're not inviting other teams out there be something we'd be familiar with on a daily basis um and it's the trails are pretty I me there are definitely ruts and roots and rocks but it's nothing like proudy it's much clearer okay and I can attest that Casey and his athletes are very respectful of proudy woods and uh everything is pretty much undisturbed uh with the use of the property uh so I I would fully support cross country team using Heartwell yeah I I also support that because I think it's better to have a cross country team not on the roads and it's much safer I've been working in Sudbury for many years and the whole cross country team is for breast along you know our small rural roads and I think it's very dangerous I think it's a much safer place for the team to be and I think the impact is going to be minimal to be honest with you I can speak for Casey from the standpoint of he's been a scout master he's a coach and and uh you know in the service and everything Elson I have no concerns that his boys or I assume boys his people uh are going to take good care of the so so this is a Amy is so the this is a land use and so because it wasn't posted because this all just literally just happened this is not official vote however we are looking for a the comments and the support of the commission if it is still viable we'll bring this forth to the next meeting hopefully they'll be back running on there regular Turf by then but if that's not the case we would ask for a formal vote but we're kind of going out on the limb a little bit just by saying if everyone feels comfortable um and I think Casey some of the things you might hear is that maybe just make sure there's only one person on the decking at a time so that you're not impacting going down if they do have to go on any of the boardwalks any other Commissioners have any questions or where are we with support of this what do we need to address that we're in support of it I guess I guess I'm just looking if anyone does not support it or if there is a concern or any concerns that we would have the team captain kind of address just to put forward other than the fact they're doing 40 boys 40 people I don't think they're going to do any more impact on the trails than if we had um you know a husband a wife and two kids with their dog honestly okay all right so um Amy anything else that we add to this kind of conversation or narrative it'll be marked in the notes that we had this discussion for the minutes and that um while there is no vote you do have support to um tread lightly on the boardwalks l and figuratively yeah no that that sounds good and like you said we'll put it on the September 10th meeting and maybe hopefully charging stations and Steve Fusco is joining now hi everybody can you hear me we can Steve do you have your camera I do I am a teams person so I am struggling with this uh hold on there we go then we would allow you to share your screen um Steve as well so for formality if you could introduce yourself and um who you work for sure uh my name is Stephen Fusco I work for kimley horn [Music] okay if you would like to so this is the first public hearing if you'd like to go ahead and share with the commission what your project is that would be great sure so the um the project is part of uh Amazon delivery services National program um where we will be uh they're converting a parking stalls to EV um so this project is 166 stalls will be converted to Electric vehicle parking and um charging stations uh So currently the site does not have um enough power to support this um so the purpose of this project is to provide enough power to the site so that the charging stations can be utilized um tree removal is going to be necessary on the Eastern tip of the parking lot uh to run the underground power line to the site and tie um into the existing uh manhole that's out there um the proposed grades will be returned to existing and the existing drainage patterns will remain unchanged um some tream removal is proposed in the buffer area however um it will remain pervious and receded uh for the plans um with New England semi- shade grass and Forbes mix by New England Wetland plants Stephen do you have a do you have a drawing or something oh sure yeah um share screen here we go I'm a little concerned about the trees because we're already decimating the trees in that area for the water M for for the new well rather so that this poor area is getting cled okay almost there hold on bear with me I'm sorry okay um there we go so this is the area um right off the parking lot and it comes in it's hard to see on here but this is uh Taylor Road it's right on the other edge of this property line I think yeah I'm not sharing it you're sharing [Music] picture sorry hold on but Kevin also just came in so he might be able to help out with that too the screen sharing try again sorry I feel you paying with teams how's that is that one is it working now okay cool sorry okay so um the property line here on the other side that's Taylor Road right there yeah and and um this is the easement and the manhole is right up in this corner here and uh this easement essentially believe it follows it's going to follow there's a a High Ridge line here because it drops away pretty fast um down to the well and resource area um so to maintain grade and minimize impact um it'll stay up on that Ridge line um I went out there and flagged it um I believe that we're only going to be impacting uh four trees that have a dbh greater than um 6 in dbh three Red Oaks and a sweet birch um most of this Ridge line is um essentially like scrub growth um and a couple dead trees uh small dead Pines um so that's that's the extent of this disturbance area can you and I I apologize you may have stated earlier the actual square footage of disturbed area in the 0 to 50 and then the Disturbed area the 50 to 100 uh sure yeah the um it's about I think it's 2500 square fet of in the Disturbed um let me pull that up hold on when you talk about Disturbed um Steve are you talking in the 0 to 50 or 50 to 100 um I haven't written down just like give me one second um if I may add in So within the 50 Foot buffer range excuse me sir if you'd like to introduce yourself that would be great oh sorry my name is uh Kevin NASA I worked on the uh permitting for this specific site um if you guys so within the 50ft buffer range we're going to have about a 2500 foot disturbance and then within the 100 foot buffer range it's going to be about 2,800 is that 2800 so 300 more or 2800 more uh 300 more within the 50 to 100 foot buffer okay thank you so 2,800 total correct thanks Kevin yeah of course I really apologize that I was late no we we kind of jumped ahead a little bit um walk commission well actually let's let's go ahead um I I have a couple quick questions for either of you gentlemen so you're looking at 166 parking stalls can you so we do have a couple new Commissioners that are with us that may not be aware of the site and all that we went through to permit this if you could tell us how many parking spots there are presently for Amazon that would be appreciated Kevin do you know how many are there I can I'm going to pull the plans up and take a look and while you're doing that I have a question and Amy you might be able to help me with this was there originally a waiver on the first permit for this no who said no no I that was Carl because we we had brought this up Sarah right when they when Amazon was first coming in fact I had brought up you know about the whole electrical vehicle because I could see the trend was heading towards that right and they said they hadn't got there yet okay I guess they're there I guess they're there now so I don't believe we had anything in there regarding that okay so I know so this site is under uh natural heritage which we'll talk about so I guess what I'm looking for is to understand of the 166 parking stalls what percentage is that taking over of all all of the Stalls and what's underneath the parking lot I just don't remember if there's a substructure underneath the lot because I'm questioning why wouldn't we ask them to permit within the actual structures of the parking lot instead of disturbing additional areas those are my questions I think so since if they need more power take get up the access road to the back part there and go up to tailor that long way around why not give up some parking spots well they need to make connection up to Taylor yes so right now um with these spots that we currently so the existing uh utility that's originally on the site is only there that could power some like lighting poles it doesn't have enough power to uh end up charging these EV uh charging stations so what we're proposing is that we're going to add like another utility that connects to an existing manhole is going to connect to our site and then it's going to um be able to power the 161 converted uh charging stations so we we need more power which is why we're proposing what we are currently I think let me jump in and try and clarify this a little bit Kevin um and maybe give you a specific piece of homework um and this fits in with what Sarah's saying I I want an Alternatives assessment for alternative ways to bring power to the site that reduce the resource area impacts and that specifically should include at a minimum bringing power in from Taylor along the existing roadway rather than coming through resource areas why why is that not an acceptable approach and my expectation is we're not going to debate that here I want a memo that describes the Alternatives that you've looked at and why those are inferior to this alternative um is it possible if I could maybe give a quick answer on that or should we just include on the memo I I just want it written down so Commissioners questions I know we've um this is uh a heritage site as well if we want to talk about tree removal they stated that there's only four trees for removal that have a DI four living trees sorry but okay so let's let's talk about trees and what we're going to do to replace those trees especially where the the the well was already challenged to try and replace the trees they were getting rid of in that space so is it possible to have uh on the drawing show the roadway to the wellsite and this access on one overview so we can see the whole thing yeah do of you have the the whole plan that show the utility box and then there was was potentially the natural heritage area and then the whole all the [Applause] spes the only ones I have are essentially just a lot um there's the edge of the national the natural heritage area believe and we pulled um Transformer there was an area that there was an overlap um and it they did they moved it over so that's it's out of that and I only the only drawings that I have are just of the L question um it doesn't expand out yeah so the so we had previous drawings the level of disturbance was in the nhes um area boundary but we didn't have to disturb that area so in the amended drawings that we ended up sending to Amy um we're well inside that area now so we're not disturbing it how did you get the current power to the building and why can't that same path be used um because it doesn't it doesn't have enough power to supply no I understand I understand what you have now doesn't have enough power but you're getting power from somewhere um and you want another line essentially so can't that other line follow the same path as your current line that this is exactly why I'm asking for that Alternatives assessment i' like what this doesn't make any sense to me and if you have to dig up the roadway to get there dig up the roadway I I don't understand the challenge yeah it's not like Taylor streets on you know recently paved can't can't dig it up uh policy you know a while and Kevin and stepen I want to be really clear here cost is a component of an Alternatives assessment but just because something is going to be marginally more expensive doesn't make it infeasible so keep that in mind when you come back with this Alternatives assessment that just saying well this is more expensive is not going to be a a sufficient justification at least in my mind for why we can't use the existing Disturbed area and we need to disturb resource areas hey do any other Commissioners have questions or or comments I think I ideally this is the first hearing so we're hoping to give um Stephen and Kevin um thoughts to bring back back to us I'd like to see the picture showing the existing power line going to the building plus as was noted um the water plan to kind of get a sense for you know the total amount of um disturbance in the area but the bigger thing is where is the current power line and why you know why can't it that space rather be used I'd like to add a couple additional requests here I think one thing that would help guide to this a lot more effectively is a a drawing or two that overlays the work you're proposing on an aerial rather than an engineer drawing to be honest I think those are a little hard for us to follow sometimes so take that overlay it on an aial where we can see where the buffer zones are and and the underlying parking and and so on would be very helpful um another one second with that chase May interject also you're talking about the Heritage lines as well correct as you're looking kind of down on this property and and that's what it's going to get to yeah we we also then would want to see on top of that the overlay of the Heritage as well as the overlay of resource areas once you get the added power to the building are you going to be tearing up the parking lot in order to get the charging stations out to these 160 uh spaces um I believe we're going to do a lot of it with borings um essentially like tunneling underneath um so we don't have to tear up the entire parking I know I had asked before is there any structure underneath the parking lot I know we have so many different sites that some have septic systems underneath is there anything yeah it looks like and I apologize cuz cuz I'm and Amy I think I told you this when I met with you out there that I'm you know relatively new to this uh project asked St what while you're on with this have you been to the site yeah I was out there last week I met Amy out there and walked and flagged it um I live right in conquered um okay so that's why I got pinged on this I just recently joined kimley horn so that's why I proba struggleing looking through this stuff um it looks like there's some infiltration basins uh underground infiltration um under the lot essentially um not a little bit by the way I I think like a third of the lot is underground infiltration that was a big part of Permitting that's yeah the first go around yeah that that would be chase part of that overlay as well yeah if you want to see it on an aerial I don't think it would be a problem to to drop um you know some some shapes on there like basically take the cad drawings drop them on the aerial and you could see where everything's kind of laid out in relationship to each other um against the entire site as opposed to like you said just on engineering drawings um you know looking at this you know they're strategically avoiding the infiltration obviously um so yeah we can put that together uh I'm not sure we are strategically avoiding the infiltration I think that's one thing I want to understand so when when I look at drawing I think it's C11 it looks like we're in direct conflict with the infiltration so but let's get that square on that corner yeah it I got to take a look at the elevations could be potentially above it okay so I think do we do any other Commissioners have other things that we would like to add to this to-do list for the next next meeting I was curious about um one of the results of the site walk it seemed like the uh the path where the uh new lines were going to go didn't really line up with what we were seeing there and I was wondering if that's something that um could be either addressed or elaborated on U when we were there it seemed like there was a more or less straight shot getting where uh you want it to be without as many trees uh but but it was really unclear from the drawings well which case was really uh in effect yeah so when I uh when we were when I first went out there I went out there the day before and tried to mark it out I mean it was difficult to get an alignment because there's about you know 20 feet of grade change when you drop off um and so I think the first one that I had done and marked out um when I went back and looked at it again the first one was more of a straight shot and then when we went back out there and I was out there with Amy and were you out there too Michael was that yeah it was that okay you had sunglasses on I couldn't recognize um so uh you know after you came back um we I adjusted the alignment and looked at it having you guys being able to be there to see you vertically allowed me to be down there and figure out where it was and then once I saw where you were it kind of dawned on me that yeah they're following the ridg line um because that the kink in the layout is the kink in the ridg line essentially from what I can say um which also makes a ton of sense of you know that's going to be the the best way the least Disturbed have the you know um the Le least amount of impact on that and like I said there's not much uh there's very few trees there those I mean the Red Oaks are there um one of them doesn't look that healthy uh and they're kind of scrubby but I mean they're big so um you know they're substantial they should stay there but when the easement does like when the final alignment does get laid out I mean there is some room they're right on the edge they they the easement will be there I'm not 100% sure that they'll be that they wouldn't survive I mean it's electrical conduit not pipes they don't have to go down five feet um so you know I'm I'm hopeful that whatever comes out will be not that impactful to the Zone okay so just for the Commissioners um you were I would have to say very fortunate that you had an agent and a commissioner that preemptively went out to just kind of give you some guidance but so going forward I will have to just let you know that at some point there whatever the outcome or or direction of this this project there will be a an additional site walk that will be um formal once you have something um more concrete and so but I think it premature while you have the commission here for us to schedule such I would like to have you just the the questions that have been raised um at the next meeting and then we kind of go from there so obviously it's your first time in front of the commission here but that's kind of our protocol okay makes sense any other Commissioners have any kind of questions or concerns at this point there may be others later on Chase has giving you a kind of a shopping list I've got a couple other things here to maybe think about how things that we're going to want to talk about Stephen one is I'm not sure your storm water memo is complete to to be honest it looks like you still have editorial comments in there like maybe under standard one in parent synthetical it says just talk about erosion and sediment control measures looks like maybe we need to spend a little bit more time flushing some of these things out and I'm also going to push you on understanding the understand when this project is done the storm water system should be the same as it currently is but I want a lot of details about how storm water is going to be managed during the construction of this um because to the extent that the storm water is charging to Resource areas we're going to reach out into the parking lot to understand what's happening there as well it and my concerns there are are really three-fold one I I don't want to undermine the existing system because the existing system is what is preventing just charge to Resource areas two I don't want to see direct discharges to Resource areas during construction and frankly you don't have a lot of place to manage that water otherwise right and it's going to come out muddy and dirty and the third is I want to know um sort of the the equipment and things like that that we're going to have essentially what I don't want is I I want to know the sort of the construction envelope here not just the digging but where where are we going to have equipment where are we going to have stockpiles of material and along those lines similarly where where are they're going to be where is parking going to happen that isn't happening here and does that ultimately have an impact on resource areas somewhere else so all things for you to think about know that they're going to come at you down the road and to the extent that you can prep for them I think you could move this along a little faster yeah no that's that's great um you know as we develop it um would you be open to like conversations about what your preferences are in terms of you know the ens that we are looking at as we kind of go down the road and are trying to you know determine okay like these are you know maybe potential option here potential option there um you know capture some of the storm water uh get some infiltration going on or something like that I mean I think we're open to options in general I will say that we try very hard not to dictate what should be done but rather to take the options that you put in front of us and work with those perfect okay well well will this will this Electrify the entire Amazon Fleet that works out of there is that this is a complete change to electric vehicles that I do not know in terms of you know what they utilize versus what is parked there and yeah timing and stuff like that um I can't speak to that to be honest Carl I think that went back to the original question they're talking about 166 parking stalls but my question was how many parking spaces are there yeah so I think they'll bring that back to us so Kevin I know that you you um came in just a tad bit late are there any questions that you have for the commission before we sign you off uh no I think I have all the comments you guys made and um my question is when can we uh schedule another meeting or how can we go about this yep any uh September 10th is that correct when that's correct is that correct or no I'm sorry can you hear me yeah September 10th is correct yep so you would be with your permission as the applicant you would be put forth to the next meeting so which would be September 10th and Amy would then tell you what the um the allotted time slot would be at that point and and if if if I may I throw out a couple more things one it's a very steep slope uh going down and then back up again to tailor so some some very specific arose controls in there should probably be considered um how long you think it might take to do that sort of cross country portion of this and um with regard I I I think Ed brought up you know the trees if you do keep this alignment and there's four trees coming down I'm second guessing the commission here they might want to see four trees going in which I think there's room at the at the end of that parking lot you're working in so um I don't take more than four but I'm not sure how much you can get in there uh so just to be clear the ratio of trees downtop is going to be one in one or should we try to plan for two in one um as like a final like when we redo the flant as many trees as we can get yeah Kevin that's going to depend on see one of my concerns here is that we're taking down trees potentially at 20 in in diameter and and I would expect a significantly greater replacement ratio when we're coming back in with something at you know a 2 and a half inch or 3 inch caliper so let's look at and the the restoration plan has got to consider what can What that particular area can accommodate but I'm going to tell you that I'm going to look for a hell of a lot more than one to one given the size of what's being taken down but I'm open to considering replanting in other portions of the site if is appropriate so I I don't know what you do with quantitatively a hell of a lot more than one to one but I I think you get the idea can I ask you kind of a random tree question since these are all just Red Oaks that are I think self-seed do you have like a preference on species or anything like that that you you like to see kind of prop we we we like Hardwoods because we don't have that many hardwoods in Littleton most of us stuff is white pine um so actually kind I kind of prefer like the red oak okay Hood that's and Native Native for sure okay there is a tree guide out there I'm not sure it's going to help you that much Stephen all all it's really going to say is plant native species but welcome to take a look at it right I'll have fun with it I like planting trees been any thought to impact to the animal life where assuming that you end up with the original plan I'm sorry can you repeat the question has there been thought to how you're going to impact the animals in the space assuming that that you end up going with the original plan I know whe where the well is going they had Turtles to be concerned with I don't know what or any if anything and the fact you're taking two four rather fairly large trees down means that you're probably impacting um squirrels birds so on and so forth um i' I'd like to see some consideration of the the population that will be impacting Amy can I ask you a question of clarity is this the area that you and I observed from the adjacent property that had the tall grasses no this is when you first go towards the parking lot it's the little visitor lot on the right okay so there's no tall grasses where we saw the grous and the nesting birds that were there I there's there's mode um they probably mow once or twice a year back there so it's kind of similar okay so Ed that might be where you come in in terms of some taller habitat that could be reestablished for nesting yeah I did see adjacent properties there were some gross that were there which I was surprised and pleased to see in the tall grasses yeah for sure okay but along your point and and I made this point in the beginning taking out four living trees is important to consider but so are the dead trees there right and the ecological impact of snags is is not to be discounted here it's a very valid point Chase I hadn't backed that into my thinking okay all right so we will we certainly um giving you all a lot to think about for 151 Taylor and we will look forward to um seeing you on September 10th um as a note of order we meet on Tuesdays so we do like to have any new documents files paperwork in by Thursday previously if you want us to speak be answering the phone either so exactly so we as Commission Chase and I will make sure that we're out of town as well okay um come on yep um let's go through um and Amy why you have chance can you move some people back over to panelist versus participant let's talk about and we don't have to do it tonight but I felt as though I wanted to put this on the violation process because we do have some new Commissioners to understand really what enforcement orders look like um um and I know through Mac they have great seminars and things like that but I feel like because of the recent kind of um um occasions that have occurred in this town I think it is important to know what that process is um I would like to try and set aside some time just as for us to talk about this so everyone knows when this happens so it's kind of like this flowchart so as you're called in at times when there's an agent we always want to make sure well we try and make sure that there's more than one signature that the agent doesn't take it all on their own responsibility that every commissioner um should really try and support the agents and so you might be called at some different time to be like hey you can you come out to the site with us so that you understand the process um do we want to talk about this now I I think Amy are we prepared to do this now or do we want to set it set aside specific time in an agenda uh up to you guys I can run through up to the enforcement order um in terms of the ticketing I think that might be a good thing to maybe involve Town Council in um they also said um and maybe even as a um executive session type thing if we want to talk about it so Chase what are your thoughts what are your thoughts on that ticketing is rare I mean I've been here for forever and I've only had to do it a couple times so but I think enforcement orders is yeah is really happens a lot do you want to come back to this and see we'll kind of plow through some of these other things and see if we have time tonight to talk about it yeah I think so that makes more sense to me but um to your point about ticketing right that I'm not sure that's something we need to worry that much about right it's ticketing is ticketing is the ultimate threat I I understand Amy you and Tim have been sort of living that as a bit of a challenge but if we get one thing right and one thing wrong I'd rather get the enforcement orders right ticketing and like Sarah said I've been here for 10 years and I've never issued a ticket until you know recently you left at all the Tim oh you're hearing that subtext aren't you funny all right not my name on there all right let's move on to some of these other ones tree policy um Chase any update on that I don't want to freak you guys out here but there are actually a couple things I wanted to talk about um I sent Kyle a text message I said you're not gonna believe this you're not here but um here's what I want to show share with you are a couple of things let's see can you you all see this yes so one thing I wanted to talk about is what I've written today is the exception so essentially where does this tree policy not apply and the exceptions that I've outlined here are places where I don't think we want it to apply but I want you to think about that and one is land and agricultural use that's a Wetlands protection act definition that's essentially let let's set that aside that would be something completely different um trees in chapter 6 or land in chapter 61 it's got a forest management plan that shouldn't apply um trees owned by the town of Littleton and within 50 ft of a roadway or um or above ground public utility right though they like different set of replanting expectations mitigation expectations there let's let's set this policy aside for those um trees under the care custody and control of the Conservation Commission the idea here is not that we wouldn't want to abide by these but we may have other ways of sort of mitigating tree impacts if we have tree impacts we can be more creative there's no point in saying this applies to us and then giving ourselves exceptions let's just say it doesn't apply we'll assume conservation Commissions in the future are working in the best interest of our conservation lands and then lastly and this one may seem a little paradoxical to you trees where threaten and endangered species are present and the the idea here is that we don't want to set a presumptive um replacement ratio in those areas because there may be specific needs and concerns unique to the threatened and endangered species so we don't want to have a blanket policy that says yeah you can do this because it it may be specific there two questions one are those categories that are written here okay with you all as exceptions and two do you have any other exceptions you think we should add I have to say I don't agree with the uh owned Litton owned uh utility ones primarily because if it's near wetlands and the uh what do you call it light water isn't careful or the contractor they hire isn't careful i' I'd still like us to be aware at a minimum to be aware that they're going to be chopping up trees they're not always the most understanding when it come you know they they cut limbs out to to support their power lines they don't do it to support the tree well and I agree with that cuz look at the Foster Street down by the tree down by the train station like they would have ripped everything out if we' let them yeah okay but as I said they do have a difficulty in those areas of replanting right they would be coming for permit anyway theoretically Carl this is in your wheelhouse what are your thoughts I'm just thinking about the last one t& species maybe present is this um does this mean that we're going to ask the applicant um to do a because this is beyond just a state TNA it would be Federal TNA too I imagine the idea with that exception Carl is that we would ask them to start with a blank piece of paper right that you you couldn't presumptively assume a certain replacement ratio made sense or a certain um amount of tree removal was acceptable it's we're going to we're going to take those on a caseby casee basis is it worth saying that I mean I I was thinking about the last one do and you know I could almost look at it as cart blanch to take down as much as I want and you know hey end dangerous species are there I don't have to do anything about it well it have to comply with natural heritage although they're not going to cover every project um and there are also going to be restoration type projects where you are intentionally taking down trees um for a TNA species I'm I'm thinking more like a bat species are we going to be asking um yeah yeah I mean that was the one that really comes to my mind yeah and what I tried to capture here somewhat to your point Michael was the lack of applicability of this policy doesn't void the applicability of the wetlands protection act or town of Littleton bylaws but I I can see what you mean about like these ones seem like okay we won't enforce this this one is really saying sort of a different Paradigm right like yeah I I agree yeah like they have to be able to speak to it more clearly than they yeah you have to do more maybe yeah yeah yeah okay yeah I love the the sentiment here with this um paragraph I I would also welcome I don't know if we've been in touch with Matt Cahill at all just from a different kind of tree forestry input to see if he has something that perhaps he that we're missing that he would uh think to add in here as well we've had some contact with Matt I want to get this a lot farther along than it is before I re-engage Matt because I don't want to waste his time but that I think that's a big part of this okay super um okay so so chew on these exceptions ideas I'll try to work some of these thoughts in and I'll pull as long as everyone is good I'll I'll essentially pull this exception back out and you're gonna email that to us chase I certainly can okay great um that it this is all Redline right now and a markup of stuff even yeah anything would be great audio go um the other piece that I wanted to discuss with you are how hazardous trees might be managed and I'm proposing this language to you all and and essentially what it says is hazardous trees are still subject to some portions of the policy but not the notification and the request the notification process so take a look at this when I send it out but it it does say here in this is language that I stole from some town maybe Bedford um that hazardous trees can be removed as long as a certified arborus examines it and then here's some of the conditions you know that it's it's got to be uh up here it's got to pose an immediate and substantial threat an immediate and substantial comes from from the wetlands protection act itself they use that in the context of trees in a place or two so yeah the mention of the arborist I know that recently we've had some applicants where we've had disagreement with who they considered was an arborist uh you know basically we said it's a tree company their job wants to be taken trees down but that doesn't necessarily mean they're not arists you know so I I think we want to be careful there of um putting that in kind of says we can't tell them to go get a specific arist I think that's right and and this is in the context of trees that pose an immediate in a substantial threat right so these are ones that are like oh a storm came through and it's going to fall right over that's different than trees that you know aren't what you will notice is this doesn't say eh trees that aren't healthy right if if it's not healthy you still have sufficient time to come in and see Conservation Commission authorization prior to removal this is only for those trees where it's like oh boy they're gonna fall over right now it's a little bit more of an emergency certification all right I was thinking of uh what was the um uh the lake place that we just went to where they the wife's car had had trees fall on it twice I was thinking about that kind of thing right up on has um chase you put hazardous trees like hyphen emergency situation in the in that subject or topic area okay something like that yeah I think it's just it really just spells it out that this is an emergency situation or or or or trees are being that are being attacked by a certain um bug um I just recently was Wisconsin and they've got like I couldn't believe the uh Ash bachor they they mean they got huge problems out there all the even even those Carl I would argue that wouldn't fit under this section of hazardous trees right th those are ones that are not in a if adequately managed are not in a situation to become well they they they wind up being dead I mean they might be they may wind up being snags but they're basically dead trees there's nothing there's no leaves there's nothing on them but hopefully the homeowner like saw saw that coming so that would be under tree removal requests the next category like yeah by the way these are dying right and that perfectly reasonable justification to take them down in that point in that case right but they're not I think this is honestly one of the hardest ones because it it requires a it requires Amy to potentially you'll see in here the agent May wave the requirement like Amy if you look at and you're like oh this is we don't need an Arbus to tell me this damn thing's gonna fall down right cool great um is there an opportunity to have like and I guess we are the second opinion so if we disagree with someone is there kind of a caveat there where we can still just say no I mean it would be repetitive because it would be in every section see I I I can't figure out a scenario where if a tree met these conditions okay that I I just can't see where we would ever say no okay that that can be in the eye of the beh holder though it can be right and and that's why my hazard might be different than your hazard and that's true and and there is an expectation here that the property owner still has to photo doent the trees and meet with us after the fact and and maybe I should put in here something about like it it would be surprising if there are emergency removals of multiple trees right like but you had a m but to hold that to the same point if you had a Micro Burst yeah true and and also if you uh going back to the bugs that Wisconsin has if by some weird s c irance uh it was missed and if we didn't take down three or four trees to get rid of those bugs we'd lose seven or eight more and and we're assuming that the homeowners are going to see things but not everyone is that aware of that kind of thing so again I think we need to be careful how much we take our uh you know take it out of our hands well what I'll do then is I'll circulate some of this language that I've written and if it's okay with you I'll I imagine you'll sort of get bits and pieces of this over time and so I'll circulate these maybe we can think about these a little bit more for the next meeting I'll write some additional pieces or modify some of what Kyle has said based on what we've heard here um important point when I circulate this it's one directional right we can't debate it via email but we certainly can review it and discuss at the next time we come around okay thank you for doing that awesome I I haven't looked in this in a long time but we had the discussion um a while back about the mitigation and payment in Lou and how any of that would work and I did throw out a a line to Town Council and never heard back um but I don't know if it's worth picking that back up again at some point I I'd really like to if the commission is okay with me sort of pulling on that thread a little bit and investigating the viability of payment in Li of and I will say in in acting we're looking at um double-checking with Town Council here about what does happen if we say you can't take that tree down that tree comes down right okay thank you but that's great are you all just conceptually okay with me checking with the select board to make sure they're okay with us engaging Town Council on payment and yeah absolutely we had the question the last time of what would happen to the money and I think that's part of the reason we didn't really follow up on it because of like Amy said she talked to the attorney but there was a whole discussion at that time do we have a fund what do we do with it do we give it the U uh somebody else I the name skips me we know the clean Lakes is going to need money yeah no we're not putting trees into Aquatics an aquatic tree we've been will up okay let's keep going um neog Hill Farm non-lease parcel so this is kind of a a bigger discussion [Music] um the as you drive down OG Hill and you approach the reservoir there is a lot there that is in the currently in the care custody and control of conservation through many years it's kind of slipped through the track cracks that it's not actually come into us legally beholden to that so Amy has forwarded the town meeting reports kind of a summary of the non-lease parcel I when I think what I'm asking is maybe to put this on not just as a administrative discussion but to actually have time alloted to talk about this process because it spans over 20 years and I feel as though we need to have a specific line of um guidance for this of where we've kind of left off um and the appraisal that may have to be done in terms of lots and that in order to catch back up there will be a need for legal counsel with this at some point so um with the commission's um support I would like to schedule actual time at the next meeting that we can actually have this and I would ask that everyone read the documents that have been sent tonight um to go through if that's okay absolutely that's for me and one thing I'd say uh the September 10th meeting is is shaping up to be a boond dogle um although people do tend to drop out at the last minute uh so I can definitely you know put this on as a time but we might be starting to get late but we figure that out well and yeah yeah put it on as the last maybe or let let me just see how this the rest of this stuff shakes out right now maybe we can come back to it um in while we're talking about neog the select board has recently Gone live with an RFP for lease opportunities which is on the town website if you would like to see what that is you have to enter your email address and contact information in order to even view it so they're basically looking for to see if anybody wants to lease the property but it's not the entire property it doesn't include the house and some other issues as well but that that is live and if you know of anyone that would like to be interested please feel free to send them to the website um I am hoping I have made two requests now of the select board that people that show interest in the RFI or anyone that's ever showed interest that they may be alerted to that that RFP is actually out we're still waiting for the board of Selectmen to shoot an email out to all the interested parties to let them know the timing is a challenge because most of them are farmers and they're in the middle of their harvest season so I thought that it would be nice if we could at least send them an email to let them know it's live uh um okay so let's talk about 161 to hadwan uh that is just an update this is the woman who cleared a bunch of the trees uh behind her house um but is also having the septic system redesigned so enforcement order was issued and uh she was supposed to come back in September um to let you know so she she is on track for that and we'll be back I think we said September 1st so it'll be September 10th meeting she's coming back in okay just off chance anyone was waiting for her to show up she's could you maybe send her a message to remind her photos I I I talked to her day or actually last week sometime okay great um land use for Heartwell uh land use someone wants to do um a geocache there I don't have any of the details yet I wasn't if sure if that was necessarily the kind of thing you wanted to see a uh land use permit for um well we have other geocache out there and I think we had asked for permits prior yeah I think if I call someone asked to do one and then they just kind of disappeared I think it was a bumblebee um and I'm sure there are geocaches out there that we have no idea about but it may have been prior to you coming in but I I do know that some asked before so I I would like to have them yeah I'll tell her do a land use that would be great and um even at bumblebee I I know for a fact that there ones that we don't even know about because I've been out there and people have been like off the trails and I just had a CU I'm like hey what's going on and they're like oh geoc cash yeah yeah um Tim are you still with us I see you're on I don't know if you can hear us or if you're still driving or if you're I'm yeah okay let's go ahead and start to do a summary of that joint meeting tonight um Tim do you want to try and take that on who was there and what the purpose of that was uh yeah so I mean there was a lot of people there I don't remember all of them uh I I honestly can't remember probably but it was a joint meeting so Jim Doug in on behalf of the select board and the clean Lakes called interested stakeholders of our water quality and our Lakes were there yep and and so what was being discussed is um basically the the budget that the clean Lakes committee has come up with for the next five years um and we talked about how they don't have the cell tower money going towards um what they want to do the water department is still able to give them about 70 to 80,000 a year but they focus that money towards spectacle pond because they have interest there due to the Wells or the single well that they have there um the water department kind of hinted responsibility for Long Lake towards parking wreck and conservation uh and didn't really say it directly but mwaniki towards conservation um there was talk about how CPC money for the aquatic invasive treatments um would likely uh it would have to be considered uh management if they were even to propose it but but the CPC would likely consider it maintenance since it's an ongoing uh you know it's a it's not just a one oneoff treatment it would be done every year um and how there's they didn't bring up but I wish they would have brought up was how there's kind of a gap and what CLC is requesting and what the combination of what CPC and uh the Water Department is able to uh a lot um they I talked at the last clean Lakes committee meeting which was last Tuesday I talked with them about bringing that concern up and uh what they what we've been talking about those meetings is they want to have basically a line item uh every year that can be voted on at town meeting for the Gap in funding of which I'm which which I just mentioned um it wasn't brought up at this meeting I'm not sure why um I'm not sure if we're having another one of those meetings I think we definitely need to have another one of those meetings because we only talked for about an hour and I think the clean Lakes committee members wanted to talk more um and they didn't have a chance to touch on everything Andrew do you have anything you want follow up with that or Amy uh so yeah I mean uh Tim gave a very uh good summary of the meeting uh there were members of the select board fincom and uh we were there uh myself for CPC and concom as well as Carolyn Mueller um and uh yeah so essentially there are potential buckets uh that CLC could look towards for funding certain projects uh CPC would be a little Limited in terms of the projects that we would be able to fund uh they would have to fit within uh the open space category of uh CP CPA monies um in particularly the preservation of open space which in the past we've used for invasive PL control on conservation land and most recently at uh Long Lake um so it's a viable source for some of the funding that they're looking for um I'm not certain how uh the whole Community preservation committee would feel about using it year after year but um it is certainly an option for that particular um Avenue of CLC projects uh that are kind of uh targeted over the next three years it might be helpful also for the commission we can circulate that budget that was um put forth tonight that was shared for us that um has a view out through 2029 so um Amy maybe or Tim if we can scan that in for the uh Commissioners I I found that helpful so you can see where the funding is what's projected and what's not on there as well Sarah can you give us a like an order of magnitude understanding of cost per year here is it thousands tens of thousands hundreds of thousands of dollars a year like so Amy do you have yours in front of you or left mine in in the car from yeah I left m in a car and I scroll all over but it was in the hundreds of thousands I found this on theb can you give us an order of magnet that was my phone my my my iPhone was answering your question answer yeah I it vared meeting they did at at the bottom of of each fiscal year for the five or six Lakes they were looking at um they did say you know this much is coming from example the water department but the it would be either line item or CPC or or or grants okay but we're talking hundreds of thousands of dollars a year potentially not not it does so in the it rolls so some years are high some are lower it's also based on some of the projects that are projected as well and some of the unforeseen but it is well done um so let's let's share that document because I I I think it's interesting and I think at some point we and Tim this kind of alludes to your joint meetings I think we should probably meet um and I appreciate your time on that on that committee but I think that to have a better understanding we should have a joint meeting I think yeah yeah and they definitely didn't have have uh staff time in there and for some reason D Bar didn't think there was much staff time which is not the case at all the wood Department been crazy on this yeah that went over like a lead balloon yeah yeah yeah okay um okay thank you for being there Tim and thanks for your your time on that as well um that's it for administrative discussions what would do we want to go ahead and plow through a little bit for neog what the temperature like it's almost 9 o00 what do we want to do and I will unfortunately my screen sharing being wonky so I can't throw anything up if you wanted to discuss it but has anyone had a chance to look at what Amy has passed out in terms of the summary of The non-lease parcel and where it's located and the votes that happened in 2015 is this is this land this non leas is controlled by the select board no this is this is this is what I consider our land that is down by the reservoir okay yeah yeah I I do not think that's true so we we should we should discuss that because what I can find in the record is that this this all this was taken in 2000 and this area was part of the seventh parcel which was taken for General Municipal purposes and it was not part of the self- health Grant now it's the vs are old and they're a mess so I might have some of that wrong so say that again no I'm not talking about self-help right but in 2000 purchase the town recorded the order of taking which included this this piece of it for General Municipal purposes and it and then there was another there was a meeting article eight right the 2015 one the 2015 which basically the board of Select of conservation conducted did a joint on-site inspection so they moved in seconded by the board of Select to vote to approve article 8 which basically brought it into our custody which is shall include in the lease only a portion of the Assessor's parcel so if you look at article 8 it was approved so that was the select board finance a committee all in support of eight which pulled out lot 107 but it did not transfer it no I I understand that the language got changed the original understanding with Keith was it would be transferred correct and this just say it's it's subject of further discussions right so so just so that we understand the lot that we're talking about yes is the lower lot not one of the upper Lots so it's the lower lot that everyone thinks that it's under our care custody and control which do oversee it but we want to tighten it and make sure that we actually own it did the board ever actually prepare the engineered plan that the article references no and then right a plan was developed but it was never it was never finalized and so a year ago Amy reached out to Ross Associates and based on those original plans which Ross did so we're staying with the same engineer it was going to cost us about $1,800 to get all the final work done and so what we would have to do is to try and see how we can fund that to get that done so be basically an anr subdivision and then record it it would have to go through the planning Sight board obviously need to approve it but it would go through the planning board for the subdivision it's it's definitely worth doing ultimately um and I do remember those S sidewalks back in the day and I I it's crazy because I I thought it was kind of settled too um but yeah definitely something that we should probably get going on there there's a lot of parcels like that it it it was meant to and then it just never made it across the the finish line so I guess the question is what is the priority of this and how are we going to pay for I don't know how to pay for it but I think it should be a high priority yeah it should definitely be high on our list just with everything that's going on at the orchard we just want to Ure that that's protected around trying to get rid of property I trust the selectman on this one about as far as I can throw them so Andrew CPC any funding for us to do this so in terms of CPA funding to do this you're allowed to develop plans and to to kind of set aside money for land purchases where this isn't a land purchase it's uh it's probably not eligible but my other worry with CPA funding is um if we were to go for it uh the warrant is going to be closing very soon for the October uh town meeting which would mean that we'd have to apply in the spring so we wouldn't have money available until July first of 2025 so that I think if if it stops at 1800 I think I can cough that um I had some extra money in there from Bas of species and I pawned some of that off on the library so is there any way we have a CPC authorization for a little pot of money that we could draw from is there any way we can shove it into that Andrew just put your hands over your ear for a second well yes and no but I think Andrew is gonna have to be the one that goes to on the sword yeah I I was thinking about it but I I don't think no I don't think we can quite squish in there so I guess what I would like to do for the next meeting is put this on so it's not just a discussion item that it's on the formal agenda in the hopes that we would kind of gather our thoughts and make a um motion to allocate the funds and go forward with this I think we need to talk to the select board first it's not ours yet and they're basically going to have to sign the anr but the town meeting already said that they would so I would no push back from the selectboard because of of of everything that's happened but it's still as far as I know it is still under their care and custody until it is subdivided so can I make another path can I just ask you to talk to council on this and ask them if we do need to have anything done has looked at this many times but it's a good refresher to be like hey we want to just keep going with this can we keep rolling yep I have a conference
