kadada here Tim Roode here Cindy here here and Scott pava here okay approval of agenda there's two items currently we're going to add an item to the agenda tonight yes um mayor i' request um item 10 CB added consider approval of resolution 2024-25 a resolution authorizing adoption of a purchase agreement motion approved with that addition second motion by councilman palava second by Council kada any any further discussion all those in favor I opposed motion carries there are no minutes public hearings we got a public hearing tonight uh for delinquent accounts I'll call to order this public hearing assessment hearing for delinquent accounts Mr Erics uh thank you mayor and members of the council uh this public hearing was um scheduled approved to be scheduled uh at the October 14th council meeting uh at that time the total amount of delinquent uh accounts to be assessed was $548 since then um we have had um one person pay their delinquent um tall weeds and grass uh invoice that that was sent out um we did not receive any written or verbal comments um the other two um Property Owners um or tenants did not pay their their total assessments so we're looking at uh assessing one parcel $251 56 and then another 41927 uh and those both are for uh delinquent Water and Sewer accounts through uh October 31st of this year uh we provided the required uh published and mailed notice to the attendants Andor property owners and this is just the public hearing the the resolution would be considered under new business which would approve the proposed assessments excuse me uh have those assessments paid with the 2025 property taxes AC crew interest at a rate of 4.9% unless uh paid within 30 days of today and then uh directing the city administrator to certify a copy the assessment role to Rice County property tax and elections director uh the fiscal impact is the amount owed to the city um which is um just under $500 I'm sorry just uh let's see just over about $650 the alternative would be to not conduct the assessment hearing and for go collection of the outstanding funds owed to the city and then includeed with the staff report is the public hearing notice proposed resolution uh 20244 5 and the um proposed assessment role there is an updated assessment role uh ex exhibit a on the uh Council table for your review okay since this is a hearing there's open up public comments anybody off the floor is your opportunity to speak okay any written or telephone calls or anything there were none okay move to close the public hearing motion my councilman palava second second my council person Fe any further discussion all those in favor I I oppose motion carries the public hearing is now closed presentation of citizens petitions and comments comments limited to 2 minutes so if you're not on the agenda now is your opportunity to speak okay nothing on the consent agenda there is no old business on to new business consider approval of resolution 2024 d45 a resolution adopting assessments for delinquent accounts Mr Ericson all right thank you mayor members of the council the public hearing was just uh held um a few minutes ago here uh the next step is to consider adoption of the the assessment or the excuse me uh the resolution which would adopt the assessments uh as I said by approving the proposed resolution solution the council is approving the proposed assessments approving assessments be paid with the 25 property taxes approving an interest rate of 4.9% uh which will acre through December 31st of 2025 unless paid within 30 days of of today and then directing the city administrator to certify a copy of the assessment role to the Rice County property tax and elections director uh the fiscal impact of the city added up here real quick is $67 83 Alternatives would be to not approve uh the proposed resolution and then attachments to the staff report are the resolution and uh proposed assessment role unless there's any questions staff would uh recommend approval of resolution 2024 d45 I just had one question that the original amount for one parcel it went up was that an additional uh um they they made a payment and um insufficient funds so we added it back in okay we approve resolution 202 24- 45 motion my councilman kadada second second my council person Fe any further discussion all those in favor I opposed motion carries consider approval of application for payment number one in the amount of $133,000 $15.74 to bjk land company for the 2024 Trail Improvement project Shani M thank you Mr Mayor members of the council um this uh first payment is related to the trail project uh the trail Improvement on Ash Street Northeast and 8th Avenue Southwest uh bkj was the contractor they started work September 20th paved the trail section by October 7th and then um a week later did some dment seing uh to restore those property so this first first pay voucher the contractor is requesting is for a majority of the work um in the amount of$ 13354 um we are tracking below the contract amount which was about $160,000 um and so um the next payment we would bring to would be next spring after um grass is growing Restorations established punch list items are completed um but at this time we are requesting payment toj of $1 13354 and that does reflect the 5% routin reduction along with a partial payment on the restoration so moved motion my councilman worin second second my coun palava any further discussion all those in favor I opposed motion carries all right on to 10 C the added item to consider a purchase agreement resolution 2024 47 Mr all right thank you mayor and members of the council um at the August 29th city council meeting the council met in close session to discuss and um the uh an offer from quick trip to purchase property from the city uh after that closed session Council came back opened the regular meeting up motion to approve the offer submitted by them uh actually today we received the uh purchase agreement for uh that that parel um so we worked on it um all day today to get it get it wrapped up um got it done here just before the the end of the day um and actually since the October 29th meeting they're also interested in purchasing um the city owns a a small well about 3,000 foot uh triangle parcel in the Southeast corner of Highway 19 and 15th Avenue which was intended for signage um so they're interested in in Pur purchasing that for um signage as well so uh summary of the proposed agreement would be that they're looking at purchasing lot one block one of the willow Cree common fourth edition for the store location and then lot one block one Willer Cree common second edition for a sign location a main point of the agreement a purchase price of $290,500 earnest money of 10,000 uh close um within $180 days from approvement agree uh agreement approval uh the city's obligations are to provide a warranty deed pay for the title commitment uh half of the closing costs which uh according to them would be about $1,300 Quick Trip pays for the title insurance half the closing costs and then would they would be uh responsible for any future assessments levied uh against the property uh we need to provide them the utility plan for that development um we need to confirm uh and if not um the Planning Commission will need to to review this since we have a comprehensive plan to see if the city needs the the property anymore um originally when when the city bought that that well the parcel would be directly south of the clinic and then so that's like almost eight acres and then directly across the street from there is about a two two and a quarter acre um which we have sold we paid 270,000 for both Parcels um I believe we sold the other parcel for about 130 132,000 so um even just selling you know two and a quarter acres to to Quick Trip essentially or not essentially does more than cover the city's expenses of of purchasing that property well just to elaborate you're a little humble there but we're going to make at least $200,000 in that parsel we still have land left that's pretty good uh should be in the real estate business um let's see uh quick trip will have to pay for surveys and any updates to the surveys after the the properties platted um they need uh approvals for zoning and curb cuts um the parcel is currently Zone B3 which does list convenience stores as a conditional use um some of the approvals are um like I said curve cuts and um I specifically had them put in there that um there'll be no access to uh Connecticut connectic Drive Southeast um we'll want everything to come either from 15th Avenue or or Commerce Drive uh 45 days after receiving the title commitment uh quick trip will submit preliminary PL application um those costs are split 50/50 between the par ities uh the remaining portion of the property uh would um would have a deed restriction uh for the following or for the next 50 years um essentially protecting them so that another gas station or businesses that um sell fuel uh a charging stations for um EVS uh tobacco beer liquor soda Dairy Bakery um or other food products typically sold at a gas St or a convenience store or or grocery store um Car Wash coffee shop adult entertainment uh we're agreeing that we both have the authority to enter into the agreement um the acceptance deadline for this agreement is November 16th um it's also noted in there that neither party had a broker as far as termination uh it can be terminated on the mutual consent of the parties uh the city can terminate the agreement if Quick Trip um wrongly terminates the agreement and then Quick Trip can terminate the agreement uh if the city defaults uh the city would keep the the earnest money at $10,000 if quick chip wrongly terminated the the agreement by approving the proposed resolution uh the city is agreeing to sell the parcels according to the agreement and then authorizing the mayor and City administrator to execute the deeds and other closing documents as may be necessary uh we talked about it earlier here purchase price of uh just under $300,000 um um and those funds would be deposited into the account that uh was used to to purchase that property initially I believe we purchased it in March of 2020 um Alternatives would be to uh not approve the proposed purchase agreement or uh propose revisions uh to it and then attachments are the proposed resolution and the the purchase agreement and if there's any questions I'd be happy to answer them purchase agreement's already been reviewed by Council um it has not it's a very standard um purchase agreement we will they'll still look at it though correct yeah they were copied on right yeah they were copied on the emails correct okay great do they do they express a timeline on when they wanted to start construction ideally um they haven't said it's not going to be um well certainly this year um maybe in 25 um what they do is they get all their approvals and they get their their stores in the queue and just start to start going through them so um if one one project you know hits a roadblock or something prevents it from going um there's the possibility that we could we could slide in and and get that spot well this has been a really interesting you know I've been actually working on this for two years finally to get them to land here and and uh it's remarkable that that the due diligence they do and how they view a city you know at first you know they thought we're too small and you know we have to explain that and then the traffic count they thought was too low and we had to explain that and and then uh when I finally got him to come to town I got uh a real estate manager to come and well Joel said in we spent a half a day driving through town and they they looked at the Aesthetics of the community they looked at the housing stock primarily if the houses are nice or if they're run down or if they're you know decrepit or whatever then they're not so excited about uh coming to the town um so then the next time I got I had actually had the CEO here uh um a couple months ago and uh he was actually pretty impressed really just a genuine guy he just thought our our our town was cool and actually just for uh Community days I think it was actually cuz I think one of the uh one of the employees were going to go to the Community Days event and just kind of check it out and but they do do a lot of due diligence and and remarkably I don't know how familiar people are with quick trip but they're a great partner for the community um the the dollars they donate into the community um everything from benefits you know to parks and fundraisers and you know kind of like Ouran liquor does um and they they Pride theirself in uh clean stores and uh uh what you would call you know mature workers or or you know workers at attentative to the customers and and things like that um and then one thing that we really said was really one of the most important things wherever because we showed on multiple sites in town and uh uh most important is to be uh conscientious of the neighborhood you know we we want you know that's why to go to planning zone it we want to make sure it's you know it's burned and and like Joel said there's access only away from the from the housing you know the trees all those kind of things and and they really are are up for whatever the city is is going to require or recommend um and and um they're really like I say consen the city and then furthermore so now of this parcel there's still remaining approximately two acres something like that um of which a lot of businesses like to build next to trip just cuz they're such a good neighbor um so there's anything like you could have senior housing there um you could have Hotel there kind of towards the back TOS the police station if you like uh I actually talk to uh one company that's uh Jason quick triping in other communities and um they they just love being next to them so I think my point is you know especially for the new Council and and all that there's there's certainly a future there to expand that area if you know if you guys so desire and we certainly can pass on the contact information and you guys can can track them down but um I just think after two years of work on this thing it's just remarkably satisfying to get this accomplished and and I know um you know a lot of people love quick trip and there's a lot of request in town and some people are a little concerned what's going to happen to to you know Jesse martyr cases and all that kind of stuff but but I think most people in business will find that competition makes the other businesses better you know they'll expand they'll you know compete all those kind of things so I I certainly don't think it should be looked at as a as a negative T Community I think it's it's an absolute home run and like I say they're they're great great neighbor um as we touched on on the price I mean they uh they paid the price actually maybe a fuzz above market and they didn't didn't block didn't nothing they just you know they just said they want to be here and the uh and I'll see if I can get the uh the uh Quick Trip rep maybe I get get her to come to next council meeting cuz she just she talk she lives in minac and her husband and her family and they just love lwo so much I'm thinking about moving here actually so she's H she's big on big on Lonsdale but um yeah you know I just I want to thank Joel for all your work too I mean we uh today we started at what 6:30 a.m. when I when I talked to quick trip and we just want to make sure we got it done for for tonight's meeting so so anyway and then I just you know I told what a great Council we have staff all those kind of things so yeah I do know that one thing that you know people talk about uh you know when they're when they were frequen frequenting a business they'll talk about uh uh they go to a certain business because it's locally owned it's not corporate owned or whatever but uh one of the things that I think gets forgotten is many of these corporate businesses they're they're some of the largest employers of our residents right so just because a business is a a you know corporate own business it's it's it's an asset to many people in the community not just the corporation right um you know I know that's come up you know in the past so and I I I did lay on that and they're very well aware of the new Factory that's coming to with potentially 150 employees they're pretty excited having having that right next door not you know in addition to you know scan filter and everybody else up there so they're yeah it's really a uh it's really a boom for our community you know so they consistently are in the best places to work in Minnesota in that catalog that they put out every year and they're in it just about every year right so and like I say for the next Council you know you can kind of work through the details here and all that kind of stuff but uh Joel kind of touched on that too what what they do with their buildings I think they said they're building like 35 they built 35 this year and what they do is they design all the all the facilities at the various communities and they order all the product in one time I you know I suppose it's you know savings through Mass order and all those kind of things but uh um then they'll order all the buildings all delivered and they had companies and they have their own Engineers um their own you know if there's any gas issues or mpca issues they got certainly uh their own people that deal with that they're they're uh boy from what I've seen and what they've expressed to me it's a it's a pretty we got it down to a science right right when they crack them out in 120 days 90 days I mean they're right right they get them all pretty quick so like I said I'll see if I can get her uh to come to the next maybe the end of the month or December meeting TR need to Desert everybody and pass it on so anyway I just have one last question um just out of curiosity what what fund did the purchase come out of so what what money uh what what fund is the money going in back into do you know Joel um I believe it was the uh the police station fund for the the new worked in in this I know we had a couple meetings and great to get it resolved you know abut get that in the factory going up there next year or so it's booming be busy yeah so that concludes the planned agenda on to Department reports um Shani anything else um thank you Mr Mayor members of the council we are working on the 2025 millon overlay project getting survey work done and developing plans to bring that to you um at the December meeting and then um Joe and I met today uh with the um groundwater modeling consultants for the Wellhead protection plan part one conss of kind of modeling and identifying their drinking water surface management area and so we re reviewed that plan and we'll be providing them some comments before it then goes to the process of submitt all to Department of Health and we'll be providing um the council and update as well on that and then um as far as the booster station project I had mentioned at the last meeting we're still working with the contractor pepper companies on a schedule had a couple meetings with them with with Joe as well to um kind of talk through options but really we want all the equipment um delivered to the site and guaranteed before they start work um in terms of removing a the piping and replacing that so the the um control panel was kind of the hold up because of supply chain issues and things like that so we are looking at a winter construction sometime early next year and once we get that firm schedule from the contractor um then we will update the council and provide notice to Residents thank you thank you for your word Mr Reon uh a few things reviewing applications for um our accouny position and receiving them for public works as well um obviously uh election here earlier this week um congratulations to all the winners and Cindy thanks for your your service on the Eda and Library board liquor store I'm sure I'm missing something over the years um was all the way back to Albert and ay and when when the town start 1903 that when the dinosaur um work on the city hall project and then recorded some videos promoting our trails and adopt the bench program which um we um are editing right now and get those up on our Facebook site probably next week thank you sir thank you for working again thank you for the early start today you get an adab boy for that thank you Mr Corey uh thank you Mr Mayor and council members see I just like to report in and just recognize the uh the work of the uh lawn sale election team on Tuesday they ex they it provided exceptional service Professional Service um they processed at the lawdale precinct uh 2,195 voters um I know that many of you commented before the meeting that there were people lined up uh to the road and everybody worked their hardest and did their best to get everybody in I I I was at the end of the night um the city administrator and I um we we transported both of us together to uh Rice County um government center and we were spoton with our Precinct summary um usually that check-in process takes a little bit of time but we are in and out in 10 minutes that's how efficient the team worked on uh on the election day and what was the total vote did you say uh no this is at only at the lawdale precinct this is not in including the early voting or absentee voting but uh 20 2,195 voters voted at the lawdale precinct and what was the total you know off hand I believe it was uh just over 2600 correct 10 10 almost 20% voted absentee or early your honor and aund of those votes they did not go down bot they voted Trump only really yes sir that is interesting that's a fact interesting thank you sir all right thank you Cory anything else it's Mr Mayor it was all it's been all about elections lately yeah yeah yeah Mr wormers um again I want to reiterate Corey's thank you to the election workers I mean with that many people just from my experience getting in and out as quickly as we did they were they were on their game and uh it was it was running like a top so thank you to all the volunteers um Cindy I know for the year through the years you've done it yourself you know I know you couldn't do it this year here but I'm sure you know your your Precinct that you're working ran like that as well hopefully you know it did actually yes yeah it's good to hear so again thank you to all the election workers um liquor store met on Election night um and uh we had kind of a small brief meeting um big big news there is Saturday is is the wine tasting the holiday wine tasting from 4: to 7: so go taste some wine at the liquor store it's a it's a big one and then uh first Saturday in December will be the the full liquor meeting for the or the meeting liquor tasting for for the holiday liquor um yeah other than that that's all I got okay thank you thank you for all your work sir councilman Canada planning and zoning and Parks comes up November 18th that don't have anything thank you sir council person F the Eda will be meeting in another in actually two weeks thank you councilman palava um I guess all I can say is uh obviously the uh election didn't go in my favor uh if I said I wasn't disappointed I'd be lying but only disappointed from a just it's a human thing it's the way it is am I okay with it I am because I mean the system did what it it worked the way it was supposed to um so um and I just wanted to make make sure it's clear to everybody I am not um upset or bitter or anything at all and I think over the years I've proven that uh I'm willing to work with just about anybody on anything and I'm looking forward to another challenge another another another opportunity you know whatever it may be you're not going to weaponize City Hall then then go after no no no I I keep those for myself so all right thank you thank you sir you know with that I'll just add on to that you know after 21 years I I can't tell you enough how much I love being the mayor and I just it's just something so proud of I had a great city council all all the years we never you know we don't always agree but but we always uh look out for the greater good and uh it's really remarkable uh you know back in 1985 when I first started you know just a kid it was up at the old fire hall I don't if anybody even knows where that is cian guys do but um no air conditioning you know Council meetings it was 102 degrees you know and uh but it's it's really been good and then again like Scott say congratulations to you guys hopefully you can carry the torch and there's really a lot of good things ahead of us I mean with the business the land the infrastructure is is all current and modern the tax statements I don't think are out yet but I think you're going to see a tax decrease this year at least pretty close to the same uh reserves are strong um you know it's something that sometimes uh we kind of forget is is the Tor show was passed on to me from uh Harold vka and I think Jim BR is I think mayor that's still living but uh um the city councils you know I d a little bit but I was on with Cindy's mom and her dad you know Bob Novak and Jerry smishek and and EVN and Steve there and and Dave dos and Blake and a lot of a lot of great people and like I say you know we didn't always agree but at least we uh looked out for the uh the better good of the community so I just want to give a big thank you to everybody and again just thank you for allowing me the chance to be your mayor appreciate it very much that's all I have you still got a little time right like 25
