district Commander for well a long time eight eight years and he is now moving on up to the east side and uh so he is going to introduce his replacement so we have a new District Commander out yes I want to I want to thank everybody for uh all you've put me through the last eight years I I've learned how to deal with things a lot more uh politically corre correct or you know um no I'm just joking it's been a pleasure it really has uh I've gone through I think three city managers here now at least so bunch of board members um got to watch a lot of things happen the uh the the uh town and get moving on some of the the ordinances like that we like to see go through and um you're starting to build um in a way that some think are good some think are not but uh it it's been great ride so um I just wanted to thank everybody for having me uh putting up with me over the last eight years um I'll be going to Green Acres effective the 12th and uh you're gonna have Captain Rob Sant coming here from Del re he and I have uh grown up through the agency a lot together um we were watch commanders out here together we were uh BT on SWAT so we we kind of have very similar histories coming through and he's been the commander down there for probably the last seven to eight years himself and um you're going to be in very good hands he's very similar to me except he smiles and talks more um so I think you you'll all get along very well with them so Rob say anything okay but no smiling or talking I keep a premum I'm not really a m of guy can you hear me yes right I don't know I don't like the sound on my own voice there a problem therapist so my name is r s I'm the new District Commander be serving West Lake and where else AC thank you very much quick quick quick uh brief bio 34 years serving 34 years amen and I'm only 39 for the girls in the room there so can you imagine yeah pay attention 34 years and I've loved every I was just tell the mayor they coming back into a small venue like this brings back a lot of memory when they got promoted to Lieutenant Sher called us up and the major out to my house and says serving as a new District Commander one question for for the teenager that showed up in my house anybody Miss so once I get the directions put my GPS Head West let me tell you something some of the best time my career Ser in a small town really small town demographics were a little bit different I was user custom to but being growing up in New York and having a little bit of a GI cab relatability with people after 34 years I still kind of likeing folks and I hope hope you kind of like me too after a while but I will tell you uh I learned a lot move through most of my career was operational base pack SWAT dignitaries yes I was one of those guys knuckle Dragon guys got helicopters with long ropes and I was afraid of height the whole time so I dis did seven years in West G Beach they sent me there on purpose remember I thought you from New York and all those New Yorkers are going down here the is a very wise man because he puts his people in the right places and I think now that I served and did everything I could in West der Beach and I'll share that story with you guys all another day uh he says you know what great turn stabilize this did a great job here again thank you very much giving me a very clean product to deal with work with and build them they'll move on to something else got a nice organ organizational shift and command which are good it's a fresh look right things get sale after a while so I'm here here's my portion of the meeting where we let people speak on non-agenda items do we have anyone who would like to speak Miss Jennifer Stevens my name is Jennifer Stevens and I live at 1102 Hyde Park um first of all I want to actually thank the town for the project you're doing on the pond on hide Park we're very excited about it it's looking great um we're super happy about that I would also like to thankk you for moving forward on our next door neighbors at 10:32 hide Park I know you can't comment on it but yesterday the magistrate ruled that you could move forward with foreclosure on that property um the town also asked for the option of doing a money judgment I'm just here to give you a little bit of history with what we've dealt with for the last three years we've only lived here for 3 years we moved here we were very excited about moving we have a horse farm our daughter rides we were very excited and then we kind of figured out what was going on next door um this last summer we had massive flooding it flooded half of our property because they brought in about 30 loads of dirt they don't have an FDA plan they've built a barn as you know they built a huge Arena they filled in half their Pond they have large hogs on the property um in the middle of the pond they've built a structure um where they literally just rinse out the hog poop into the pond they had five trailers until yesterday on the fence line that would play music at all hours drugs there have been multiple police cars um out there domestic violence um drugs all sorts of things that's been just horrific for us to deal with so um I really just want to uh actually as of yesterday they actually brought in more building materials so now they're building something else I know there's no permit for it um they really just I think flown in the face of the town which I I think shows complete disrespect for you all and um and it's obviously well for us too but also for the town and so if you have the choice um and your Council says you have the choice between foreclosure and a money judgment we would just encourage on behalf of myself on behalf of um the Schaefers at 1095 heart hide Park who couldn't be here tonight and on H behalf of 1162 which is um Bruce and Michael Pearson they couldn't be here tonight um to please foreclose on this property at least on the 4 and a half acres that you can so someone can take that over and get an FDA plan get get the to where it doesn't flood our property um and get it to where we don't have really bad smells and feces on the ground um and that's really why I'm here and just hopefully you'll think about that when you have the decision to vote on it I'm not sure how that process exactly works but now that the magistrate has ruled that you can foreclose I would just encourage that you take that route I I don't think this property owner is going to do anything with the money judgment I think he's just going to let it sit there and then he has no intention of ever selling his property and it'll just continue the the Judgment it's over a million dollars in fines so that's all I have thank you thank you for your comment Cynthia Taylor good evening my name is Cynthia Taylor I live at 13224 Marcel um I was here a couple months ago and kind of voiced my opinion um I don't know anything about politics and and I I don't I'm sorry I I don't really know what you guys do and how you get from point A to point B but I'm going to reiterate what I said a few few months ago I'm very worried about where this town is going you know is there is there a is there I'm an artist I mean is there a vision of of where we're going with this town do do you guys up there and I mean I felt like last time I talked and like it was like I mean we don't get to talk back which I think that would be a great thing if residents can actually get to interact with people and ask question we actually can during this time oh okay um last time I spoke was about the trees all being able to be cut down someone told me that's an AG thing you can cut every single tree which then I heard is not really necessarily true um a barn mendum or whatever it is on my street it's hideous but this building that just went up on Southern the Southern lawn and garden monstrosity someone has to say this is okay hey someone has to approve this I think it's disgusting if you go down to Davey everything in Davey has a look to it and I'm sure that's because they have some kind of Architectural Review Board that has to approve things um I don't know who approved and said that was fine but it's gross and pretty soon we're going to be like West Lake everything will just be ugly and gray and cold and modern I don't know about anybody else that's not what I want this town is very special very very very special and if we're not careful and think about each decision and check you know dot our eyes and cross our tees and make sure what's happening we're going to lose it and I don't know if I I would assume you people spend your time and whatever because you care about this town I love this town and it really pains me to see you know and I don't know the specific because of all the you know zoning and all this but I just urge you guys to be really careful about the decisions you make let's not lose something really special thank you thank you for your comment Miss Harding is it for a particular item which it which item is it please which item is it one okay uh um okay that's okay thank you those are all the comments I have comment cards okay is there anybody on Council that would like to bring anything up I would okay go fellas so I've spoken about this before and obviously I'm going to speak about it again um our our elections are every sing single year and the way it's become with the supervisor of election it's from December to March so for one quarter of the Year our town is in election mode nobody wants to move forward on things and nothing gets done because everything is nefarious because we're in election mode all the time it's very disheartening we are all neighbors and I would like this Council and POS and the future Council to please come up with a plan where we are not in an election every single year one suggestion was we go to four-year terms with to continue with the twoyear max max the two-term maximum that would put us out of the election season every single year so it's something to think about if you guys have any suggestions it would be very much appreciated and uh I just find that the stress I'm sorry my dog wouldn't participate today tonight so um I apologize for being late but um you know it we are working hard to try to bring this town forward and and every time we're in election there's always thing can't things that get kicked down the road and for the next counil to do and it's not fair to the applicants and it's not fair to this the people of this town you guys might not believe it and you're not going to like it what I'm going to say but love it and leave it alone doesn't pay our bills anymore our property values are a million dollar now for 10 2 million for 10 acres 800,000 for five so we're cleaning the town up your property values your retirement plans are in your Investments so we need to work together as a council and town folks to just stop this crazy election season every single year thank you thank you Robert something yeah that's um something I guess to talk to the town manager about do you bring up the Char Review Committee for that referendum or does council just decide to do it you may do a charart Review Committee just because there's several different options you know to go to four-year term staggered elections you know two one year skip a year three that year you know maintain threeyear terms probably should do something Community wise to get some feedback first and see how people feel about it I think that I think that all of us would benefit greatly from not having that stress over here I think phis is right community in a community of this size it really tends to get personal and that's exactly what I was thinking when the lady asked about the vision you know I'm like yeah we had a great vision the first year then election it changed the second year then another election it changed the third year so at least if you did do staggered elections even it was every you know other year you got um cohesiveness for two years continuity to to build on you know the success so so what is that is that a charter review is that some public workshops first to get public input I me what would be the way to approach that you do not have to have a charter Review Committee although the last Charter Review Committee was 2019 and I think we have to go back and take a look I think we might have put something in there how often the charter Review Committee yeah so I think it might be time so even though we might not need a charter Review Committee to address some Charter items it makes better sense to have it I think that there are some other things that have been brought up over the year that are also um worthy of consideration by a charter Review Committee I.E like Council salaries um you know um and I think that um you know it would be a good thing to re-engage the community on a topic like the you know terms of sitting Council can we put that on a future agenda then yeah we can put it on March anybody who's listening or in the audience who has any comments or any ideas uh please either send an email to me or any other council member of the Town manager and and so we can get your thoughts on record because that great some input from the community we have another person that wants to make a com I wanted to make a comment to Miss Cynthia from Marcela I wanted to reply to her regarding our vision we've all had Vision I've been here since ' 89 and I've seen great Improvement in this town and it took a lot of time and it took going through several managers to see any Improvement also there's something called planning and Zoning which you're welcome to go to if you're not happy with the way a building looks you as a resident can come stand at that Podium and go to the meetings and you could say put in your thoughts also if you don't like the building or the home your neighbor's building you could also go to that planning zoning or go to the town or go to your neighbor and make some suggestions so um I'm not sure how long you've lived here but we all have vision for this town and it's always for the betterment of lahache groves sorry you're disappointed I want to speak alsoa okay go ahead yeah um in regard to the southern land uh Southern lawn um I too was looking at that uh as I was riding by I wasn't on the council or I wasn't active uh in the uh committee that uh approved that so my thought was that's a big mural board we we could have a beautiful mural of uh things that are going on in the town um you know the the old things like the uh the silos the old fire tower that was uh by the fire station you know um it it's unlimited it's such a big area that we could create a beautiful mural there and good idea it's a big industrial wall let's try to make it pretty yeah make it make it BL make it blend in with what's around it you know we have another public comment yes mayor uh Joe ceciliano hello Joseph ciano 1530b Road good evening Council men and women um I'm so glad to hear a talk of a charter review comme waking back up again uh they were put to it was put to rest quite a while ago um and I I think to further on someone else's comment up there is is to encourage the town even if you don't volunteer for the committee itself please come and listen and give us your comments because you know there I was on the charter Review Committee I I serve on the ulc now and it would be really helpful to hear from you when we're trying to impose ideas that that that we think is for the in the town's best interest you know we it's it's this which is why it's a committee of five because it's five people with five somewhat different viewpoints and we try to get it honed down to one particular Avenue and then present it to the council for for their you know to advise them of of what we're thinking um so if you're not ready to get involved in a in a committee just yet at at least come and pay attention and please give us your comments they're super welcome and you know and it might be a little less difficult than sitting here where you can't actually have an interaction I know like right now we probably could we can but I'm just trying to reach out and and get more towns people involved I'm seeing a lot of interest in things that are happening now and not just to respond on Facebook or text out people come down here and get involved I mean this is what's so great about this town we are only like 3,000 people let's be a tight 3,000 right and a and a 3,000 that that tries to move each other forward in a positive direction keeping this town the little Bastion of rural bucolic agricultural Greenery that we moved here to enjoy that's kind of what I five to zero okay we now have a presentation from FPL good evening mayor Town Council and uh Town attorney and town staff thank you for the opportunity to be here tonight uh my name is Alon Coffer I'm external affairs manager with fla Power and Light here with my colleague Daniel turbet who's a customer account representative from our government accounts team um we wanted to come give you a quick update on some of the things that we're working on with your staff on the town um and also answer any questions you have and Danny is going to provide some details on that before he jumps into it I did want to thank you and your staff of Richard and Lexi we've had great communication with them over the past you know six months to a year kind of working on some of these issues and also want to particularly thank them during the storm events and the Hurricanes over the last year we know there was significant damage in lock satche Groves um I was at the EOC with um the county staff um and was able to speak directly with branen um as well as your team to make sure we had debris removal cruise and restoration Cruise out here um I think within almost 24 hours if not less than that to help get the uh power back up so just wanted to thank you for your continued communication as we work on these issues and with that I'm going to turn it over to Danny so he can kind of give you a little update on what's going on um with specific uh projects in the town Elon before you leave I just want to express my personal thanks to you because I know you were instrumental I know that some of us including myself were without power for quite a long period of time however in A Storm of the magnitude that we had come through the town I think that you guys did a great job of getting power back up to us very quickly and I understand you were instrumental in that so thank you I I appreciate that but I will tell you you know we're proud of a you know 9,000 you know employees strong at FP and all the crews we brought in from across the state but I appreciate the words and it's it's nice to be able to play a small role in that effort so thank you good evening guys um so uh we've been working like Elon said we working with um the Public Works folks on a lot of things around town um the I guess the first one we we'll start off with um there's been some reliability issues at the Town Hall um we've been investigating what has been the causes been mostly moment where power will Flicker and then come back on uh sometimes it'll be like a minute outage um so our team has been investigating that the cause for those alleges and um right now the determination is is a a substation issue so our team is looking into that and working on the the repairs of that um but you know other than that the the circuits that feed the um property here are in good shape but if uh the issue continues what we're going to plan on doing is installing a recording voltage monitor at the Town Hall which monitors you know how the feed for 5 to 7 days and uh that should determine that should flush out any other small issues but you know we should have this being resolved pretty quickly um the the next item that we've been working with uh the town on um uh vegetation clearing um in the last year uh I think we cleared approximately 14 miles uh in 14 mies of of of line um in the in the town this year we're scheduled to trim an additional two to three miles um of of circuits and we'll be notifying the town of the exact area the general map of where that's going to be also the residents who are um on those circuits will be notified as well uh by letter or email um and and then as well they'll also have be notified by the planners who come through and look at the vegetation determin on what needs to be trimmed um so they'll need to be contacted for Access and and you know explain what's going to be happening during the trimming um so the trimming you know that that should that we will have cleared approximately 90% of all the lines in um black Groves in last year after after this year there'll be about a year of of clearing it'll be all about 90% um if there are additional concerns by residents or um the town they can ALS they can report vegetation concerns online now through our website um and you can it it's a very easy process compared to what it used to be where you had to call 1-800 number um it's a very easy process and it triggers a a utility Arbor to come out the property speak with the homeowner explaining what they see in the field and um resolve the issue as needed so um so that's the one one thing um the next topic that we've been uh working on uh pretty diligently actually uh and and Richard and his team have been very helpful uh because they're they're out in the field doing work and they notice these things um there's some splice boxes that are uh adjacent to the roads throughout the town from our recent uh undergrounding projects um occasionally a vehicle might either Veer off or you know it's like kind of go off the road a little bit and impact that that top of that SP device box um so they've been reporting these issues to us I've been going through the local service center and um getting repairs scheduled um they have to go through locates and switching orders to to take out an old box or a damaged box and repair with a new one any box that we take out we're replacing with a traffic rated boxes um which will be a little stronger than the ones that are currently installed um that's a a process that we've worked on together to make sure that you know these these boxes will probably be either you know leaned on or or run over by vehicles in the future so we want to make sure they they're able to um the vehicles that I mean the the boxes will be installing will be able to handle um you know a certain rating a vehicle and there shouldn't be any issues from there but you know we'll be you know getting reports from uh the Public Works folks and uh making sure that they're repaired in a timely manner um and then finally the um the undergrounding project as I mentioned before um you know we we we completed uh you know most of that uh project in I think it was 2022 um there's still a couple phases left that have not been started um there's been there's a one on BR Road uh and there's one uh on the Eastern portion I think near F over to like West 25th and falam um Those portions were still um under under kind of review because we're waiting for I think there's a legal issue on B that we need to have resolved okay I don't think so we reported that that case was closed multiple times so the case was was resolved and mediated several years ago and we had reported that okay to you and your legal group okay well we'll we'll get with our Legal Group and get that there's still one one phase on the um so when are you coming back so yeah and and that's what we want to know sure uh you know what you wouldn't have to cut all those trees set off the lines if we were underground agreed agreed no it's a that's um there's still some circuits that are not underground yet that are still in lock coves on the Southeast Portion by uh well right over here off off f Road it's a different circuit but it will eventually go underground as part of our ssup that well we don't have that one on our schedule yet those those plans are are put in place year to year we get those we get that report year to year that's not on the plan this this year um but we review it every year with with our uh storm secure underground program um engineers and managers um and once we have that information we convey that to the local municipality um so the section on the East the Eastport part of town uh the fome f Road kind of quadrant um we're still in a in a bind because the the town does not have a RightWay where we can put our facility at the time and when we went through the original uh pass we were not able to get easements for uh into residents properties um we need the easan to put that to put that line in or we need a RightWay to install the lines in the boxes and Facilities so at that point we at this point we wouldn't be able to start until we have either a RightWay or an easement to put uh the boxes in or the sorry the facilities and uh and cable um but I will we'll we'll go back onto the B- Road um issue and go back to our Council I think uh I don't know if it was Monica I think so and just um to make sure like we now that we know that for sure and if it was reported i' completely you know understand that fact if there's any documentation in terms of legal descriptions of property in terms of whether it was a settlement or final legal judgment and any you know Maps or diagrams that we can provide to our Engineers um that would be you know ideal we get that I don't know if we would need to make a public records request for that or if it's something that can be facilitated through uh the town attorney and town manager but the first thing they're going to need to do is understand where the property dispute has been finalized and understand who owns what pieces of property doents have been sent to your office and we can resend them again okay yeah and if you can just make sure I'm copied on that as well and have you sent us documents of where you were unable to get asement so we can look into that um I was I was not in this role at that time but I believe at that time they were working with the do we have those no we do not okay so could so in order to move the project forward we have to know where you had a problem so we can work on on an our end yeah and and we're happy to get you that my from what my predecessor told me at the time it was there were similar issues with the town acquiring right away in those same areas due to some Property Owners so if we don't know there's a problem with exactly yeah so I I'll be happy to Reg get that information and redistribute that out to you did you have a did you have a question I totally have a question go ahead I need to talk to whoever is the higher uper at FPL or you both equal okay so you really put us into a dilemma okay FPL puts up poll lines which we thank you you guys do a good J job taking care of us you put them up throughout the town what in the 70s and the 60s whenever and then you put more polls up and then we're going to have an underground well what you didn't do is help us get rid of the polls okay because AT&T and Comcast although you made money off them for many years leasing them your polls now you have said not ours call AT&T call Comcast well that has proven to be practically impossible they are in our roadways okay where it's a safety issue they are at the end of driveways where people can't even get in and out safely and then last week you came and took a poll out on my neighbor's property that affected nobody it wouldn't have mattered if that sucker was there for 50 years and then I saw the guys doing it I was like oh my God go over here look at this this is in the road it's in the way and they said we can't do anything it's not our poll but it was your poll and that's not fair to these people out here because you make money off of us yes we need your services we can't do without it okay but you can't just drop us dry and say AT&T count Comcast sorry there is a poll laying down in the middle of a property right now with wires hanging all over the place and I I can't get anybody to take it out fix it put it up I mean I I would like an answer to that and also one other thing there are 28 people at the end of B Road you have been given your legal department all the documentations on the lawsuit everything and now you're asking you're saying we didn't get anything from you there's a problem there all right those those 28 people people on the end of B Road and North Road constantly are calling you put their underground in you've got the paperwork you've had it for years I would say expedite that show us that you really mean you care about lockah Hatchi Groves and I'm sorry I'm getting down on you but I'm tired of these phone Poes in the way and you know what somebody hits them it's really on you I'm happy to answer the questions um and if there's a pull down that has electrical wires on it we can absolutely get some well then and I'm happy to look into it but respectfully we cannot touch somebody else's property from a legal standpoint not turn the polls over why didn't you turn them over to us and let us make money over off of AT&T and Comcast why didn't you turn those poles over to the town cuz they're in our ground and they're on private property a lot of them again if if they were polls some I'd have to look at each individual poll because at certain points yes we did have lines that were put in the 60s and 70s that you said some of those polls were originally AT&T polls they were not FPL polls so depending on what road you're on or where you're at property you know and poll ownership is different well perhaps you could assist us with these huge you know with these huge AT&T and Comcast assistance would be greatly appreciated I'm happy to you know get in contact with my counterparts at AT&T and Comcast unfortunately I am not at in a position to force another company to I understand work on those efforts but I bet you have better communication with them than we do and we would appreciate I'm happy to facilitate and express you know the comments that were received tonight to to my counterparts over there in terms of b i I will commit to going back and looking at that I will let you know that just because IL legal issues resolved there still could be similar issues with lack of right of way and easement issues um when they went through those areas the legal dispute was one of the items but there were lack of available right of way or easement opportunities in those areas and if we do not receive permission from private property owners to get those easements for both the lines and the Transformers every so usually it's every two to three properties we cannot install without legal you know opportunity to do so well now please send your people back out because you had a group right that you hired to go get easement send it back out maybe the people feel different and you know that's that would be the process with and hopefully working with you the town and Francine and others because we know that there's relationships with some of these Property Owners as well so we're trying to beautify our town and all these phone polls are crazy thank you we we could use the help on this item no oh Marge go ahead yeah I want I wanted to know um about these uh electric lines that um they may start on C- road but all of a sudden they wind up servicing a property on D Road you know how are you undergrounding those people anything on that circuit um yeah I'm not exactly familiar with the exact location but a similar location kind of like I was mentioning with the uh frro um the frro circuit begins on frro and it runs East through the properties to um uh to fome fome and yeah g and g- Road um what the team does is they find they find routes that where the under underground line is not going to be going in inaccessible areas um these these facilities uh have to be accessible to uh Vehicles so any kind of Transformer and line and and and splice box have to be in accessible areas so I'm not an engineer but I know the engineers work it so they put the facilities in accessible areas so they they feed off other accessible circuits to feed um that area we have a lot of um lines that go along easements where back in 95 when I moved here they used to be maintained um you know asphal would come in and and clear them yeah and now they're so overgrown you can't even get through them yeah no I I I'm very familiar with that um the wire the wires are constantly uh interfering with the uh surface yeah um so the the trimming on on circuits range from uh 1 to three years for the main lines these are those are lines that feed you know approximately two to 3,000 customers I believe there's one that runs along frro uh maybe one along a road or in okachobee um then there's lateral lines which are like the neighborhood lines and those are on a longer uh trim cycle and so when we come through and trim you know it's it's a great time for for residents to to take care of those trees that were getting into the lines and and and we're growing because they're aggressive the the trees in Florida grow at an aggressive rate um you could trim a palm and in three months you'll have a palm FR right back into the line um so when when our when our crews the aslon crews come through the trim you know that it's a great time for any clearing of the invasive trees the fast growing trees I'm not saying we want to clear every tree in the area but you want to clear the trees that are um you know are going to grow back into the line but I agree and and and hopefully the the triming that's coming up in in this year um it's about two to three miles and it's the circus on uh the overhead circus on B and and f and g um that will clear that line and then hopefully in the future we'll be getting that underground and we won't have that issue anymore hopefully yeah anybody else no Laura nothing Robert nothing okay thank you gentlemen very much for being here tonight thank you thank you okay so we're going to move on to a quasi judicial public hearing we're gon to hear a present how it's going to run because I know there's a lot of people here tonight that want to speak um from the public so how it's going to run is we're going to have a presentation by a representative of grown Center and they're going to present items two through six all of them straight through okay after that presentation we'll do um we'll let Council ask any questions if they have at that time and then we'll do public comments so just because we're not doing public comment first I don't want you to think that we're leaving out what you want to say we're going to allow for public comment but we're going to go ahead and let them make the presentation because perhaps some of your questions might get answered in the presentation okay M mayor since some since some of these items are quas judicial we think it's best to treat the whole thing that way so everybody gets sworn in that way we're not trying to decide who they what they spoke on so so you need to do that so we can swear on everyone so go leave so okay so anyone in the room that's planning to Pard me need to get now if you're going to testify please raise your right hand stand up so the clerk can identify you please each one of you swear or affirm and a testimony that you give tonight will be the truth the whole truth nothing but the truth I do thank you all very much we have uh we have folks online truth nothing but the truth I do I do thank you I do you're now [Laughter] married by the power vested in you this one this the right one I give it to okay Valerie you gonna read the um titles do you want me to read them first or do you want the presentations first um I guess do the presentations first we'll read the titles at the end after public the comment go ahead we'll do okay then uh good evening Madame mayor members of the council Caitlyn Forbes with the planning department I just wanted to give you a brief introduction to the four items that you'll be reviewing today and can I did remember my contact so Zoom back out great so the four moving pieces to this application are interrelated I'm going to walk you through uh the four pieces uh in an overview Manner and then I'll give you a little bit of detail about each one and then turn it to the applicant for further um information on all of the applications there's two pieces to this application that you've already heard these are two ordinances that you've reviewed on first reading the first being the comprehensive plan text Amendment the second ordinance being the master plan Amendment that's considered a rezoning um these were both heard by the Council back in December and then in January and then there's two new pieces for consideration that are resolutions and this is um the hotel site plan and the public park uh Town Commons site plan the comprehensive plan text Amendment just as a reminder this is the item that you heard back in December um there was a request to reduce the number of rooms reflected in the um special policy to 81 rooms and this of course was um the basically substitution of a hotel use for the AL use um that amendment was made and included in the package that was transmitted to the state and um for review by the all all the appropriate reviewing agencies we did not receive any objections from those review agencies there's a dozen different agencies that review text amendments at the state level um and so this is coming back for second reading of its ordinance the master plan Amendment um this is the existing master plan and then the proposed master plan this also was heard on first reading in January of course um you'll remember that this was uh specific to the locations of those improvements that were revised as part of the text Amendment so here um the Town Center Park would be located on pod G and the hotel use um that's accommodated for now in the text of that special policy would be proposed on pod TC or a portion of pod TC I should say uh being the Western half um just as a reminder there's no increase in total square footage um for the overall master plan or number of trips as part of this project it was the substitution of the AL for the hotel generally so um as part of that Master Plan Amendment first reading there are a few things that came up um in terms of discussion items and the applicant um is prepared to speak on some of the um ideas and con con that they have to address these issues one being the b-road um delineators in the right of way we did include a suggested um condition of approval um to address that item and specifically a long-term solution um to that br- road Improvement to help with the circulation at the um uh intersection with B Road um also the existing oak trees on the hotel parcel specifically the northwest corner there was a um Laurel Oak Hammock um that was discussed at length at the first meeting um the applicant did have an arborist go out um to the site and prepare a report about the conditions and the relocation potential and their team will speak to the findings of that report and lastly the Town Commons parcel size with and without Wetlands um was another item that was discussed so the hotel is the um third piece here this is a new component for consideration while it was discussed this is a first time voting on it so this is generally the hotel site plan that was provided for consideration and the elevations the north and south of the color palette um just a couple of points uh as they worked through the process and received comments the applicant did reduce the number of rooms from 95 to 81 um they also reduced the number of stories um from four stories to three stories and significantly reduced the number of waivers that were being requested um down to two waivers one one being for the size of um certain parking spaces to propose a more Standard Parking size of 9 by8 and also to allow for outdoor lighting to continue past 11 o' which is U more of a life safety issue for the hotel type of use specifically the architectural team also did propose um some minor elevation uh changes to the hotel to include um some Bahama shutters just as some additional detail um to the uh to the sides of the building and the town common site plan um that's shown here there's been some discussion about um potential design options here the applicant did throughout the course of the um process add some viewing benches adjacent to the wetlands and they've also discussed the potential to remove the um kind of three rail wooden fence around the parking area if that was preferred by the town to have more of a free flowing open space so staff recommendations there is no staff recommendation for the comprehensive plan text Amendment because that's a legislative item and staff doesn't provide recommendations on legislative items the other three being quasi staff does recommend approval of um subject to the conditions noted in the staff report um just a note for the record the applicant did request a modification to one of the um conditions here and I know the applicants prepared to speak on that more at length we can revisit this request but this was specific to um the o hammock on the Pod TC parcel where the hotel is located and for the hotel in Town Commons public park staff recommended approval again subject to the conditions noted in the staff reports so with that I'll turn it to the applicant to provide some additional detail I do believe you're going to need find out if this works all right it does good evening mayor vice mayor members of the council my name is Brian Seymour I'm the attorney for the applicant uh we have a slew of folks both here and online um uh who are going to be here to answer questions uh I'm going to try to go through this rather quickly because you've seen all of this before Caitlyn just talked about some of it um but focusing on a couple of issues but for introductory purposes U Matthew Barnes who is H the project manager with WGI is here with us uh Dan Zimmer and Diane Jenkins with uh Groves Town Center I'm now gonna admit that I'm sure I'm G to mess somebody's name up at least once tonight um it probably starts with Ral uh sangi oh I did not okay I'm going to mess somebody else up later um who is the hotel developer who you'll hear from about some of his architectural plans a little bit later uh online we have our arborists uh Jeremy chansy and Mark Williams uh landscape architect Andress uh Montero and the architect George White uh these are all the folks who put everything into this who did all the work that's the basis of some of what I'm going to say tonight and what's in the staff report what's in the justifications all the things that you've seen um because you've seen them and frankly because there are a lot of people here we're going to try to run through just the issues that uh we had with us from our last meeting there were several issues that come up uh I'm going to start with the history of a little bit of how we got here because there was a discussion at the last meeting about developers not getting everything they asked for and developers shouldn't just get what they want um that's an absolutely Fair Point um if developers got everything they want frankly I would have to go find something else to do with my time um so they definitely do not but I want to go back a little bit and talk about the circumstances that brought us here um and go back a little bit through what Caitlyn just talked about where some of those things that the developer wanted that didn't happen um and then we're going to go through the acreage issue that came up uh the tree canopy and you would ask that we go look at it and get some facts I believe mayor you you said well you want facts not just Theory not just what you think it looks like and so we have our arborists who've done that I understand that uh uh I want to say yesterday or today um the town also had an arborist to go back and look at that uh I have not spoken to that ARB but we have spoken to R Arbus and that report that they've submitt is submitted for the record and then we'll talk a little bit about the traffic control as well so this started um actually quite a while ago but there was uh a trigger point in uh April of 2023 on April 18th there was a workshop that one a little over an hour um where there had been requests to eliminate the LF um wasn't something that everybody had voted for in the first place is uh councilwoman here I'm G to go again Melia man I I told you I was going to mess somebody up I was hoping it wouldn't be somebody sitting up there that I needed to vote um actually made that point at that meeting um and so there had been requests to do something different and to look at a hotel this meeting in 2023 was the first time there was a full discussion in the public everybody here Mr Zimmer Miss Jenkins talked a lot they both stood up here together at times um and a couple of things were mentioned uh councilman uh Shore talked about the initial swap propos was TC for f not g uh and that that had been switched to G which was a much better option uh described as a win-win um 100% support thought it was a great idea um there was discussion as well about the fact that the wetlands were going to be staying there's no Mitigation Of The Wetlands it's not proposed to be changed out um that uh again you were opposed to the assisted living in the first place uh wasn't really serving the town in that sense uh and happy that you had been heard and again towards the end of the discussion councilman Shore talking about the win-win of moving the development to the South uh away from connecting Canal Road uh further from the wetlands uh and away from the uh neighbors to the north as well and so that's where this got going and then we filed the initial application um which included a four-story hotel with uh the 95 rooms you heard about there was no additional improvements uh that were presented at that point uh for B- Road there was no wayfinding signs and of course the six waivers that Caitlyn mentioned went to planning and zoning and they had some problems they like the idea they didn't like the plan so the idea of the swap made sense but the plan for the hotel was a problem and so they said you got to go back and do something came back to you you all deferred it you could have said well go ahead but you said go back and sharpen your pencil look at it again see what else you can do and that's what happened um before we became before we got to you last time and so what we have now uh as you heard is a three-story hotel which is one story reduction um a 14 room reduction in the number of rooms uh some enhancements to the architecture looking at the world Vista guidelines and again you'll see some of that when reill comes up I'm not going to try to last name again um uh traffic improvements to B Road and I'm going to show you one other that we're going to propose tonight way finding signs that in good faith the uh Groves Town Center has already put in place um and then again the reduction uh from six to two waivers uh what hasn't changed though is that there's still 23 Acres set aside as a conservation easement and buffer again that was designed from the very beginning to be where it is so that you can have the horse trails in it so you can provide the biggest buffer to the residents to the north focusing things towards Southern Boulevard for this that remains um the access to the equestrian Trail remains uh Wetlands again now are being incorporated into the Town Commons parcel something that was discussed at that Workshop um and the development limits have not changed we're we're not asking for anything more uh in square footage that was previously um requested and then of course the roadway and access points haven't changed although we're proposing maybe to cut some of that out at the end to help deal with some of the concerns about broad uh next I want to talk about the acreage so this is the swap right there was a question about what is the AC now typically you include an entire site in your acreage whatever the pot is what's ever on it you have a park and it's got a wetland you include the Wetland so we looked at this two ways about it being used it is now not an amenity it is not a piece for an Al it's something that is for the town as part of the Town Commons uh is it something you walk through ride through work through know but it is an amenity piece for that as opposed to the AL that otherwise would be there if this does not get approved tonight and so um it does blend the open space into the environmental acreage uh that was again something that came up at the workshop um and then at the workshop there's a question about the acreage so it was clarified uh Town manager actually uh gave gave the specific someone said they were the exact same acreage made sure that that was not in fact correct so she told you what the acreages are um now without consideration of the wetlands just so everybody's clear on a a sort of Apples to Apples if you will um uh the new proposed Town common site on pod G is 4.16 acres and the proposed Hotel Site is 4.62 Acres so there is a little bit of a difference with that it jumps up with the wetlands into that five plus acre uh parcel that is the where the New Town Commons will be incorporating that but if you do take that out there is a slight difference uh which happens in just the nature of the way the properties already exist um so at that meeting there was a disc question again about the value of those Wetlands as part of the Town Commons that's why they're Incorporated in there it wasn't just random it was making sure that what you said was heard and was part of that and so that's what's there now um and then at the end of that meeting based on all of this you said move forward with the proposal it was done and the changes were made and we're here before you with that reduced plan so um with that I want to move on to the question of those trees so this is the Hotel Site and you can see where those trees are and the reason for this is to make the point that these Laurel Oaks they were discussion last time of Live Oaks Arbus went out and looked these are Laurel Oaks um they take up approximately 3ars of an acre of the site on the property and when you you can see when you look at it building around them just doesn't work you can't build a building with the undulations you can't just cut it at squares so um or at Angles and so you really have issues with trying to do something and keep all of that um more to the point what you asked was are they actually valuable what's what do those trees look like that's what we asked our arborists to look at they are again online you can ask them questions this is all from them it is in their report that was submitted um but there are damage to the trees there's damage to the canopies um these are not pristine trees they do not meet Town requirements uh all of them for being preserved um certainly the town code requirements that were raised have to be met we're not arguing that what we're saying is keeping the trees is not what that means they are not the kinds of trees that are specimen trees that would be kept that meet those Town requirements so um that was what we found and and it's consistent with the plan all along because the approved site plan and Landscape plans for that site for for pod TC show nothing those trees are not maintained on the currently approved plant so when you approved the site plan for this site this is the site plan that you see on pod TC that does not maintain those trees and this is the landscape plan which again does not maintain those trees so we are not proposing that we had them maintained and now we want to take them out that is not what what's being proposed here this doesn't change that fact at all those trees they're damaged they're storm damaged they have issues um they really don't work uh the next thing uh we talked about is traffic um when Town Commons was initially approved there was a br- road agreement excuse me can I interrupt you yes ma'am at what point can we ask a question like what are you GNA do about it so you're going to take down this Grove of trees so I mean it's important I think for you to say here what I read in my package about what your proposal is to mitigate the damage to those I think that's something the public deserves to know so there's no question about that I'm not going to answer that question only because I'm going to let Matthew or one or one of the arborists or Landscape Architects to talk about the specifics of how the town code does have mitigation requirements one of the things we are agreeing is that that mitigation even though the code would allow there's a condition of approval that says you can't buy out the mitigation so they would have to replace the trees by pursuant to the condition of approval um but those are things that we're working through obviously and and so I'll let someone get into that detail so whoever Matthew you're probably going to end up doing it so start making sure you know the answer to that question um relative to the traffic um when this was approved in the current configuration uh a full traffic analysis was done mitigation requirements were done there was a lot done there to to what the roads looked like what the access points look like and what's going to happen to be Road the grov Town Center developer has already put over a million dollars into B Road just so everybody understands this is not as though we're coming in having done nothing asking to get something the mitigation of the traffic impacts for what's approved have been uh accomplished and accommodated for and yes there are other things that happen and we talked last time about the Public's down the street in Wellington that was closed uh that no one could go to and everybody came here and that certainly impacted uh B Road um but it it it isn't us coming in WR saying we just want something this is something that there has been over a million dollars put into already um and we're talking about more we are willing to work with the town as I said the way finding signs were not there they're there they're going to stay there if you say no tonight and we go do an Al those wayf finding signs are going to stay there that was done in good faith working with the town that was one of the directives we got at that meeting we need to work together um which means of course not everybody gets everything they want and we certainly aren't um but but we are working through that and this is just you've seen this before these are uh some examples this is where the wave finding signs are and just some examples of what they look like in addition um we are going to remind everybody uh that they can't sit in the turns and B road so uh we're we're putting in the don't block the don't block the Box notice again you saw this previously in a presentation and then we talked about the flexible uh pork chop so it's called a pork chop just because it's that weird looking Little Triangle um and again it's to uh keep people from having movements that they shouldn't be having so this limits to the legally allowed movements on B road now we did review Alternatives um we heard you when you said what about people who just drive over them and which it they're gonna in a week it will happen it it how much it will happen we don't know um we are willing to Main maintain those for a year um and we but we also looked at the question of the concrete pork chop to make that work particularly with fire You' need a mountable curb and at that point you can drive right over it and it doesn't really accomplish the same kind of thing and so we started thinking about what else we could do um and so in addition to this we can do something which I'm going to show you in a second as a proposed alternative condition B on on the ordinance um that will uh at least from our side of the road uh change the traffic pattern coming onto uh B Road and particularly that left turn and obviously no straight movement um so again couple of things on the conditions of approval uh relative there are two in the ordinance that uh we're asking for some changes uh the first is that um we just we have the one-year maintenance on the uh the flexible poles instead of the two um and then what we're going to propose for condition b instead of if at some point you ever want a pork chop we just have to go build it and we would do this upfront right now is to stop the westbound movement to B Road from our site at that intersection forcing traffic up to use Tangerine so we from what we can control we would actually control that and take that Lane out of commission and you can see it would include some striping and then some do not enter signs on either side so that you don't have those Vehicles so we're limiting the vehicle traffic going westbound um which means they wouldn't go over anything that's in the middle because they can't get there um and they would be pushed up to tangerine and obviously we'd have to make sure that wayfinding sign gets updated as well which we would do uh and so what we would ask and and we would work with the staff on the specific l language of the condition um because we were working on this till about 2 o'clock this afternoon to get the graphics see what it looked like make sure it worked um and so uh what we would propose as an alternative to condition B on uh ordinance 24-10 is a language that would require either now if that's what you would like or upon your request if you think it's necessary the installation of striping and do not and signs on the westbound uh Lane uh on the gr toown Center site and then the last is clarification language which K Caitlyn talked about relative to um the uh res the resolution condition a which relate this relates to some of the trees about how that would work so there's an order of what you have to do in this condition uh we think this makes it a little clearer it's a little more focused on um uh what's required by your code how things work within your code as well but it provides the clarity of how we have to go about this so if they can be relocated on site they get relocated on site if they can't be relocated on site they go to pod G um within the master plan site if the arborist identifies the hammock is inv viable for relocation then you have to mitigate but how you mitigate goes in there so you've got the sequence of events to do everything we can to preserve as many trees onite site and keep as many trees or replace as many trees on site as possible some of those trees we know from the arborist cannot be moved they cannot be relocated they will die right that's their expertise but we're committing to walking through that process to do as much as possible to maintain as much as is feasible and possible on the site um and so that's really the uh proposal on the condition relative to the resolution uh condition number a um and so so again we have the questions if you want more detail on that I'll ask Matthew to come up and talk about uh the trees um but again you've got four things before you you have comprehensive plan uh text Amendment and then you've got the uh PUD site plan and site plan right the two pods uh the reason that we asked to do this together is that comprehensive plan text is very definitive and very specific almost like a code on what would happen and if that comp apprehensive plan text is approved the site plans follow that directly and so we do not wanted a Sit we didn't want to present a situation where you approved a a comp plan text Amendment and then I got back up and said okay now that you've approved that you have no choice because you have to be consistent by law with your comprehensive plan and this is consistent with the comprehensive plan and so we wanted to make sure you all understood the whole picture as one when you're making your decision even though technically they become for votes we're not here to hide anything um that's why we have everybody on the line and here um so we we do ask that that we get this approval this started almost two years ago a year and a half ago uh at that meeting in 2023 uh there was concern about the AL we said okay let's see what we can do with that um we worked together over the course of that time uh we proposed something that didn't work we pull back we worked and hopefully this is a place that we've come that is a middle ground for all of us because um again not everybody gets what they wants except sometimes my kids somehow make figure out how to get me to pay for stuff I don't want um but uh this is a balance that gets you moving away from the core of the Town towards Southern Boulevard away from the wetlands uh and tying the Town Center use into the equestrian Trail providing for the opportunities that go with that the site we talked about the water the different things last time that we were here that are part of that um and so uh we do hope that it happens uh we do understand that this is your discretion that you uh you can deny the cop plan and and then the following um and we will go forward with the Al it's not the desire the desire is to do what we have here tonight um but we do understand that and we know there's a lot of consternation and concern uh we do we tried to present just so people understand this isn't just us rolling through here we've been here we're trying to work with everybody as best we can to make something that really will work um it has to work obviously for the developer as well because otherwise nothing happens but hopefully we've accommodated as best we can of course accommodated the concerns of the town uh again we're happy to answer questions if you want me to start with Matthew and the trees mayor I'm happy to call him right up does anybody have any questions for because I got a lot of tree questions so I'm gonna put Matthew on the spot but does anybody have questions for him before I go Robert does Robert yeah since my name was mentioned a couple times in that wonderful presentation um so this started it obviously went through pzb the way the process works is council members don't even get this in front of us till late in the game so when it was finally come before us I took the opportunity to go drive through the area count the dead trees because when they want to make a change is the time we have leverage to tell them you're not doing what you said you were going to do the first time they tried to make a change we made them finish the equestrian Trail and get rid of the Exotic vegetation because even they were supposed to do it right away they didn't do it and we had some leverage at that time because they wanted something was like do what you're supposed to do they did it so I said okay I know I've seen a lot of dead trees cuz I go to WWA way more than I should so let me go through and count them I think it was like 22 of these nice new oak trees that they put in in the last couple years that are dead and let me bring this to him to tell them hey you know you need to Pony up and do what you're supposed to do so that was the first time I saw this Oak Hammet and it's like wow you know that that's pretty cool because it's not just a standalone oak tree you know it's a hammock it's an ecosystem they're intertwined you know you can't reach loate them because they've all grown together there's replacement trees coming up older trees so you know that was when I made it an issue when I I first met with him and the ALF was on 4.1 Acres 180 something bed Alf it's like okay so now you got you want 4.6 for a hotel that's plenty of room for a hotel with the trees with landscaping that's a ton of room there's no reason you can't have all that on that 4.6 Acres but no they cut it in half and gave the hotel 2.2 Acres so you went from a 4.1 acre Al 180 bed to a 2.2 acre 80 something bed Hotel so I agree it's a win-win take the TC pod and build a hotel but I don't agree to cut the TC pot in half tear out every tree and pave it and reserve the other half for something else you know I just that part just came up at the end I was floored when I saw like that pod cut in half for a hotel because that was not what I envisioned maybe I had blinders on but I was like no way did I Envision that and then the justification was hey you want a restaurant yeah you know sure a restaurant but you know where was the restaurant going to go before when you're doing the AL you know there's other places I think to put the restaurant but they cut the pot in half and do the hotel so it's all pavement for parking and now reserve the other half or something else that they can sell and and make some money on um I I don't think is is the right way to do it I I think of you know 4.1 Acres the 4.1 Acres there's plenty of room on One Acres put a nice hotel um to save not going to save every tree if it's 3/4 of an acre hey if you saved half of them you know that's still a really cool mature Oak canopy I want to read something to you that comes from Mr Barnes is going to get up here and talk pretty soon WGI um where they uh want to do a rezoning and change it from the AL to the hotel and it say says uh market conditions have changed since the Pud was first contemplated in 2011 and it no longer makes economic sense to build a congregate living facility Well at the same time the demand for lodging along Southern Boulevard in the town has increased but you know here he is already threatening we're going to build the laf Al and here's the letter of justification from WGI saying hey you know there's really no market for Alf you know let's do a hotel and uh so you know I think the the all the traffic stuff definitely helps you know getting people to move to Tangerine but I I think my opinion it comes down to how are they utilizing that TC pod you have to cut that in half and put a hotel in just half and then Market the other half for something else I don't think is fair especially right now in this process we should have a complete site plan for TC pod that's what we're doing we're trading tcod for pod G so they should have a complete site plan for TC pod not cut in half and just show us a hotel plan that way I have no clue what the other half's going to be so that that's my biggest issue is acreage and the ability to save some trees you you saw that one picture you can see the trees were damaged one on the east side by the tornado knock some limbs down you can already see the grow back you know it's already six eight inches of green growth on the tree so it's not a dead tree I mean this is it's not a single tree you okay thank you Robert that's that that's the issue there so so I uh if I may and I know you have several questions about the trees so I'm only goingon to say about the trees I'm not an arborist anymore than councilman Shore is so I'm not going to get into an argument about those trees the arborist has gone out your arborist has gone out you I don't know what they've said I haven't talked to them but I'm sure they're here I think he was online as well um and that is specific to a site plan and specific to the quasa judicial question of the code and what the evidence would show on that so there is that point on that I I I do want to address the justification statement so economics is an interesting thing um the economics of this project Chang every time we reduce and add so if we reduce the number of units on a hotel and we add cost for traffic improvements or we add costs to relocate trees that we can because those are not cheap to relocate that much I do know when you have to take a live full tree and you if they're relocatable that also costs money so you have a scale that goes with that at some point the Al is still a better option I want to be clear I'm not threatening anything nothing if you believe that we will never build the Al and you would rather have the the pods vacant and you think that's what will happen that's okay I'm only saying that's what's approved I've spoken to Mr Zimmer um we've looked at excuse me when was that approved uh what year was the the approval the AL approved oh yeah it was a long time ago I'm sorry it was a long time ago can you give me a year can somebody give me a year so someone in the audience said 2011 so that sounds about right most people are nodding their heads um thank you and and look that's okay um we've spoken about it we've looked at it Miss Jenkins has looked at it um we we believe that on balance if this doesn't go we can move forward with the AL we would rather do this with the balance that we've put in place it doesn't work perfectly as to a another site plan guess what we couldn't do it can't just go build any thing so if it's not before you you get well whoever's here whenever it comes if it comes would have to look at that and approve it as well so we're only focused on what's here today um and so what's here today does meet your code it does go through that's the the requirements of Quasi judicial hearings um and I'm going to rely on the arborists for that element of it but um I will uh bring Matthew up and I you can punt if he will to the arborist if there are specific arborist questions that he can't answer is it can I just ask a question is R arist also available R arist is online so I asked late last week after we got the Arbus report from your and it's not that I don't trust you guys but your developers sorry um so I ask that our arborus go out um inde I mean I'm not I'm not trying to be nasty I just I wanted to have either confirmation or denial or or another opinion on what was going on so our first went out today yesterday yes and did an inspection also so and um he was not um at my request he did not see your report before he went out your arish report he wasn't privy to it he didn't see it he hasn't seen it since then so his um opinion is going to be totally independent of the one that you give and we'll see how they work together okay thank you great uh ma for the record Matthew Barn senior project manager with WGI um and our landscape architect Andreas is here as well I can say is to the question of how are those trees being mitigated um the landscape plan on file that's been on file with the town the whole time and is you know part of the plans that actually meets and exceeds the mitigation the both the Landscaping requirements and the mitigation requirements so we are essentially mitigating everything on site okay so hold on a second yeah mitigation can OCC occur a couple of ways okay one way mitigation can occur is I'm writing you a big fat check like the sod farm did for $200,000 and I'm going to clearcut this B baby down and I'm writing you a big fat check for $200,000 what I'm understanding from what I read of yours is that's not what you're saying you're saying there's no check involved here we're actually going to measure each one of those Laurel oak trees and we're going to say this is a six inch tree and then we're going to go out to pod G and we're gonna plant another six inch specimen tree No in fact okay so tell me tell so explain this to me and everyone so that we can understand what what's going to happen yeah there's a calculation that's done and all of the required replacement trees if you want to call them that are being planted on the Hotel Site nothing needs to be planted on pod G to make up for what it says in here in where in the conditions right the condition was written we didn't write that condition oh well I like the condition but it says if it it says it says if it it says if it can't be done on site then it goes to Podi but what I'm telling you is it can be mitigated for on site on the Hotel Site that's the plan that's on file with the town all the mitigation requirements are met on the hotel site so we don't need to go to the podg to mitigate for it I mean it was written the way it was written before we changed it was it had to be on podg and we're like wait a minute we don't need to we're meeting it on site on on the Hotel Site that's why we rewrote it the way we rewrote it quite frankly we don't think we need the condition but it's there because it was written the way it was and we changed it so that just in case as a backup it'll go to P if not for the hotel site okay so can we hear from your arist about what part of it can possibly be preserved and what part of it can be clearly you said in your report none of it can be moved but how can you take if it's all intertwined and and can't be moved because it's intertwined how can you preserve some portion of it without destroying it when you take out the part that's intertwined if that makes sense yeah so if if either Jeremy or um I forget the mark could could answer that hi Mark Williams uh it's pleasure to be here tonight thanks for having me uh I won't waste too much of your time uh the question that he's basically has been has been asked is how do you go about tree preservation you have what's called a comingled root Zone which basically means you have trees that are growing relatively close to each other they share a comingled root space in addition to overlap from canopy now when it comes to trying to preserve those as an intact block it can be done but presents challenges uh what I don't have access to and this is something that hopefully can be provided uh the actual construction plans for the building where the utilities are going uh how it's going to be staged these are things that are not provided to us as part of our Arbor report and review uh that being said typically those are things that come into the discussion when we're talking about how can you logistically preserve any Tree on a site when it's going to be an active construction site uh typically those those discussions happen at the beginning of the processor they should when they're planning you know the site plan itself how they're going to build what they're going to build will it fit uh that's where these conflicts came into play where the actual building footprint itself is sitting on top of where these trees are currently located uh so that that's a one potential problem the other problem is uh how to protect the roots and the canopy when they're going to be running potentially uh roadways Pathways construction paths how does that all get done uh it's it's a challenge uh I'll be honest I don't have all of the information to answer that how that could physically be done uh i' have to spend more time looking at the actual construction documents the layout for how they're proposing to build how they're proposing to Stage uh those are all things that you need to look at if your goal is to preserve trees I'm not talking about condition just in general uh to preserve in any tree uh you want to preserve the canopy and the root area as as much as possible because those those two things basically preserve your tree does that make sense well I I guess I'm it was a rather long and lengthy answer and I'm not sure I got my answer yes or no is it possible to preserve some portion of that tree canopy without preserving all of it possibly it it would depend on which specific tree you're talking about uh there's one that's kind of off by itself and the rest are all kind of clustered together up in I want to say the northwest corner uh that would be dependent on how much of an encroachment they're going to have to have to build their their structures um but yeah theoretically it might be possible yes okay so we know it's not so the answer to the question originally is it's not possible to move any of them because of their intertwining but it is potentially possible to preserve some of the canopy and mitigate for the rest is that accurate that's that's not entirely accurate no uh the reason why in some cases now I'll clarify that You' like no problem uh when I I wrote the report it includes a lot of different details including I spent a lot of time talking about tree condition that's an evaluation of Health structure and form for each individual in this case Laurel Oak Tree uh when you're thinking about trying to preserve trees uh you want to try to preserve trees that are in typically good condition don't have a lot of flaws or issues and aren't going to represent a potential uh maintenance headache or risk uh if they're kept on site uh this being Laurel oak trees uh they had a lot of existing problems uh I overheard storm damage being mentioned earlier that is correct uh the trees receive some significant storm damage possibly from those tornadoes we had uh quite a little while ago possibly from previous hurricanes this was a pristine site uh it hadn't really been touched by any development I I love going at sites like this uh that being said uh when you're trying to preserve trees one of the first goals should be identifying which ones are in good enough condition number one you don't want to preserve a bunch of poor quality trees trees that are falling apart have significant defects that really aren't worth preserving uh some of the trees that I'm report meet that criteria they're they're in significantly declined condition with significant defects some of the others are in the lower end of the fair condition that being said this particular specie is what's known as a short-lived species they typically last anywhere from 50 to 70 years and they start to fail and Decline and they develop what's called Heartwood Decay where they basically just collapse from the inside out a lot of these trees are approaching the sizes where and they're indicating that that's actually what they're doing they're starting to fail now so that being said are those the trees that you want to try to preserve on site that's that's the question you have to ask uh and in my experience and I've looked at thousands of this particular speci of tree uh normally the to be this this size or have this type of a defect preservation usually is not on the table okay thank you is our arist on yes he is and his name is Mr Jerry renck Mr Jerry renck renck are you there don't hear him hello Mr renck he's the second name listed up there and he is unmuted so we should be able to hear him anybody got a way to be in touch with Mr renck can somebody call Mr renck can you call him that's good so I I'd like to defer to Mr renck when we can get him online and get his opinion as well and I'm actually glad he wasn't here to hear that opinion so go ahead and no not intended at all um let me just ask one more question of you Mr Barn do you is your request to eliminate all of the Laurel Oaks or is there any potential for you to try to preserve some of that Oak Hammock no based on what uh Mr Williams just said there's no the current plan on file does not preserve any of it in place nor does it relocate those Laural Oaks anywhere else but it does provide the code required mitigation it makes up for them yeah it makes up for them so I would like to make a comment to Mr Shore's comments um it apparently he has a problem with the Hilton being on a smaller lot them splitting the lot to bring a hotel to join the Hilton so I would like I I don't understand what the problem is because since Mr Shaw has been in our town he has been quite the developer and investor in our town he has been buying properties devel he has been buying your comment he is you are developing on E you have a site plan to develop on EO he has bu my daughter house point of order he has let's talk about that then he has bought 10 acres he bought 10 acres on C Road it was fully wooded you purchased that from one of our town Elders point of order this is not about sold that property for a million with the subject has nothing to do then you bought a 5 acre property and you split it and you've done the same thing these Developers did thank you and you have taken out trees around you put in fence and you took out 8 foot of trees around 10 acres yet you have a problem with Four Oaks and you just made a ton of money on this town and reinvested somewhere else I reinvest in this town I invested only in this town yeah yeah sorry about that I'm not sure what the problem is yeah I I I will say I am getting some you know uh you know that uh you know the bandwidth or whatever note here and there sometimes I'm get we can hear you okay Jerry absolute thank you yeah now I can hi there Cherry both of them are an embarrassment stop it just act like grown-ups okay I'm sorry Mr renck renck is that your name yes could we please hear what you have to say about the Laurel Oak Grove and any possibility of preserving some of it what happened to Mr venick uh he is observing the the meeting he's not sure go ahead Jerry he's there yeah can you hear me now yes okay okay great you want me to go ahead yes please can you answer the question okay well I'm not sure if you asked a different question the last couple minutes but what I wanted to do is just give my uh uh reflection on the situation now when I went out to the site uh today my task that I was understood to uh to perform was to see if any of those Laurel oak trees were able to be relocated and uh you know typically you don't try to relocate mature older mature Laurel Oaks and most of them are pretty mature for the most part some a little bit older than others and the condition of some of the even the smaller ones little beat up from storm damage so just to as far as the potential to relocate any I would not recommend doing that really for any of those 17 oak trees um now when it comes to preservation you know usually the process as we' kind of hammered out here again is that you get a tree survey you overlay the proposed site plan and you see you know as you start to develop the site plan you don't do it after you've got a site plan as near approval stage but you start to look at where there's potential for preserving some of the trees and you know again as um I think Mark had mentioned you you know you got to take into account certainly things that don't necessarily show up on a site plan that may show up on civil engineering plans and other uh type of develop plans including underground utilities Etc so you need to take all of those items into account now you know a typical plan like this where essentially you have development that takes up you know let's just say 85% of the site and any of the green spaces essentially comprised of perimeter buffers and some parking Isles it doesn't leave you a lot of opportunity for tree preservation so that's where you get into that Quagmire but I think that you know the the plan itself you know you know I haven't seen the tree survey overlaid on a site plan to start to diagnose what can potentially what can't be and what other potential you know rather minimal site plan modifications can be made to accommodate some of the trees on site to be preserved and you know um I and I will like just to say that you know I some of the comments is as far as you know you know the Aesthetics of the trees you know trees as we know this is really the heart of our conversation here they go Way Beyond just Aesthetics it's the function value that they provide um so you know uh a lot of those trees they may not look good if if they're you know if they're concerning from a public and safety uh concern then yeah you need to take that into account when you develop your tree pres preservation plan but you you can work in to some degree a little bit of L this to your tree preservation plan um as long as again the pieces fit of the puzzle okay so are any of these trees worth preserving well I would say yes but you just have to have the space that's able to accommodate them you know and I think that's probably the bigger challenge but again I have not seen a again going back to my original point is I have not seen a tree survey overlaid on to the plan and again you know having been through this many many times you know from the public side and as a private consultant that uh you know you gotta that's the work you got to do that's where you start you know and see and then and at that point then maybe you start getting more specific about which trees are we looking at that we want to potentially Target for preservation if we don't have larger areas even on a small plan that can accommodate you know more than one or two trees at a certain point or location on the plan but uh you know overlaying the tree serve and a site plan sitting down you know examining the that minutia and if need be you go back in a field and you start you know selecting individual trees that you want to actually Target for preservation you know that that would be the real place to start anybody ever have any questions for our Aras yes okay go um in some of the the pictures Kaitlyn when you went back are those disease what what were those little comments in the with the clump of trees um so in the applicant's um presentation they did have some Snippets of what the Arbus report showed and there were a mixture of images that showed what I understand to be either disease or physical damage from storms and perhaps some other types of things that different Arbors could speak to Sure uh they probably include pictures of structural defects Deadwood things that are important to point out when you're doing a tree evaluation with photos to kind of show what comets actually mean okay one other question um these trees live approximately 50 years how old do you think these trees are at this point uh the age range I uh for their lifespan is somewhere between 50 and 70 there's typically always going to be outliers that are more or less depending on a lot of different factors uh I typically try to avoid giving approximate ages there's a way to do that through uh coring uh we didn't do that in the site uh but there's certain references you can make based on size uh Mr renck mentioned uh that the trees are mostly mature which would I would agree with that comment they are uh and that's when those other issues come into play regarding uh the heart R uh Decay I mentioned earlier and uh the fact that T it's difficult to preserve large trees uh that have those types of defects it could be done there's things like uh retrenchment pruning for mature trees but Mr Rena covered it really well when he mentioned uh making sure you have the adequate space to preserve those trees in relation to all those other things uh underground utilities construction staging etc etc that I didn't have access to and Ed he uh that's critical when you want to try to preserve any any Tree on site thank you very much all right I guess you guys are done yes okay so I guess we will open up for a public comment do we have any public comments would you do you want to hear all public comments for items two through five two through six or do you want to split out no you can go ahead and good evening again Joe ceciliano 1530b Road um wow that's a lot information so I just want to say first of all I think that um the mitigation process for trees and the like was put into or made available to Developers for exactly situations just like this and I think that this is one of the first groups that has been at least this transparent and willing to discuss with you options um but one that I didn't hear although I think Anita mentioned it to start with mayor uh Kane mentioned it to start with and that was to mitigate to to pod G and why I feel like this might be a better idea is because then we could reinvite whatever ecosystem it is that you will be essentially destroying to come back and it could be an an area that would be a conservation as opposed to a parking lot and I would like to see trees actually going up in these in mitigation and not just Palms I'm kind of over the royal palm frond falling thing and I'm a little and and all of these Palms being skinned where there's absolutely no Wildlife that's at all invited to inhabit them um and especially if you're if we're if we're having a conservation area in Podi then if you have to have a parking lot and you have to mitigate trees then by by all means sure make your buffers beautiful and Lush and dense and inviting and you know thick enough to keep sound and light away from our neighbors but put trees into Podi that makes it a conservation area and invites back our wildlife and our and other flora and far thank you thank you for your comment Miss cilian next Tom Woodward thank you I'll be brief Tom what where live uh 15348 North Road um I don't see where you guys have allowed enough room for the parking and traffic to happen and especially uh in these days when the county might use the hotel as um permanent quasi temporary uh housing for for people what they'll do with hotels or if you're making an Alf you know if we're going to have you know 50 schizophrenics and 75 drug addicts living there semi-permanently how you're going to allow for the buses and traffic that are coming through there all of a sudden the county will provide for transportation all the therapists nursing staff Etc that is concent with that I don't think that's been taken into account um and I would hope that if you are going to put a hotel in that you would codify that you not allow the county to um instill people in there that you would not want because I can tell you uh I worked for Rivier for a long time and the hotels down there or up there were not things that you'd want in this city and what the county does is they instill a lot of people you don't want it's you'd be amazed whatever that's that's all I had to say thank you for your comment sir Miss Jane Harding Jane Harding 3479 d Road I agree with that that was an excellent idea because what I'm tired of with development is the wildlife getting displaced when they built West Lake and Ard and Court where're all the wildlife a lot of it came into our neighborhood coyotes misplaced Fox Birds everything that was a great idea also I'm worried about the traffic and uh the fact that you know if he takes down the trees because they're old and so on and so forth and then if he makes another place that's a con convers conservation to create another ecosystem that would be a great idea but he he did present everything really well I I mean he did seem transparent unlike both both did not seem that way with me okay my biggest problem is the traffic I mean why can't we why do we have to rush on this why can't we make sure that all of these things are in place to this town's liking and then vote on it and then go for it I'm not against the hotel I think it's a great idea it's just let's look at every single thing I think sometimes we rush into things and then like B Road that's awful traffic lane d Road I have to back up so trucks can turn right off of Southern to get on d Road why can't we look at these roads and this traffic and put something in that's amendable to all of us and to Wildlife thank you for your comment Virginia sish Virginia Standish Loxahatchee Groves um in reviewing the agenda I have no objection to a hotel no matter if it's Boutique whatever brand it ends up being the concern this project had a traffic study done what over 10 years ago the community has changed I saw that pnz did said no to this project I also believe pnz requested or s suggested a new traffic study I think in this site overall site plan approval the developer should be providing a new traffic study conducted by an engineering firm and now is the time to do it we're in season this would give you the ultimate traffic count right now times have changed uh Crossing that intersection you're playing a game of in uh chicken trying to go from Publix to Wawa a suggest question would be that the entrance to Wawa becomes one way and the developer and the town planner figure out how to make a new development a safe exit out of that project it is unsafe and it's not a question of when we all know well we know it's I should say it is a question of when somebody's going to get killed at that that trying to play chicken getting over to Wawa trying to leave Publix most of us take the college exit right now um um I would say yes they've put out money but they continue to develop that project so traffic is a priority traffic analysis and a new traffic study is essential fair share I saw something about their fair share it's their project the problem in this county has been developers have been getting away with oh well we said this way back when and now we don't have to do it anymore but but we're building more times have changed and we're stuck with the old information if we're going to be looking at things new continuously and updating them continuously the information needs to be updated continuously and the town should have no financial burden from this development thank you sue Copo yeah Bel lower thank you Virginia that was wonderful um I'm also interested in traffic and trees but first I want to say why can't we call pork chop a triangle why did it become a pork chalk instead of a triangle fire them I don't know um anyway I I think Virginia is exactly right up that the traffic we need a good traffic flow and a good somebody to do that right uh I'm very concerned somewhat about last the last meeting where we talked about doing it by stages and let's try this and let's try that but eventually the developer is going to be out of it and he's not going to want to try anything it's we're going to be left to do all the trying so I think it needs to be close to right the first time by some proper person who decides how it works um traffic study people are expert at this I'm not you know I make computers work um the other thing is the trees I I mean I want wild wildlife but Laurel Oaks are not the greatest things to have around anyway uh I've talk to three AR about ours and we've had problems as they got older so that's always an issue and I think there are better things to do I would like to see trees replacing the trees though like somebody else said not some Palm thing somewhere but something of some good size and also somehow these things should be documented so the Vel oper is responsible for maintaining them for some period of time because they typically die I if you're not really taking care of them these don't happen easily so you have to be careful with newly planted trees so I would like to see documents saying how long the developer needs to help us with the traffic depending on how you decided doing it and how long they're responsible for the newly planted trees for mitigation because those go bad pretty easily and how big are they going to be so and there some needs to be some plan if we're going to put them in G you know how what is the plan for how they should be planted some we need some Arbor somebody to tell us how that should be done I mean I just plant them all over but that's not really the right thing to do so uh that's sort of what I have to say thank you for your comment Cassie sui on behalf of holly brazelle I'm going to read a comment from Holly Pressel she also emailed it to you and I emailed it to you um I'm writing to voice my opinion about the three-story hotel and the proposed RV park that's up up before the council for approval I'm vehemently opposed to continuing each of these projects at this time I don't believe there has been a comprehensive traffic study or any kind of independent cohesive growth planning for any of these projects traffic is at almost a standstill at the intersection of B and Southern now and you're going to approve more density to be funneled into this area I think both projects should not be allowed to proceed until all the issues are independently looked at to give the town a more disciplined way of planning for this whole area I would hope that the Town Council would have thought of this and don't understand why they're letting developers run rampant over us I say no at this time Holly Pressel 1215b Road thank you for your comment anybody else lisel Remy hi everybody Lisa Remy Vice chair of PCB and a council member-elect I iall and hopefully you all recall that pzb um did discuss the smaller parcel and um had suggested that instead of asking for smaller parking spaces perhaps they should just buy more land so yes that was a concern of pzb pzb also did ask for traffic and I know that they did an informal study from the applicant but reminder that this developer did get um a big bonus by getting to put water storm water preservation into our conservation easement I would strongly suggest that before moving forward tonight with the vote even on the second item that we get a permanent traffic control put in place coming out on the southern uh entrance way there that it become entry only and no exit from that southern Cor Corridor uh I think obviously there would need to be some internal looking at the uh the Western entrance to the Wawa to that to make that actually feasible um the signage that's in place at least the last time I was down there you couldn't see some of those signs and you didn't realize how to get out of there unless you already knew so the signage has to be a little more uh clear so and I would ask Council to defer to the town attorney on the strongest legal position to take at this stage given I think we're at about a 50% buildout on this location uh and the master plan in general thanks thank you Roy have no idea what this second piece is even going to be to me sounds like we're we're almost allowing them to double the impact to our community here by giving them in effect an extra piece of land to do something in the future with if I understand it right so I would prefer to just say you can move that development to this other piece but you can't split it in half and do something else with it so they can leave it preserve the trees whatever we want whatever is done there but don't give them double the cookie yeah thanks bye thank you for your com Sir Robert Austin hello Robert Austin 746 hide Park Road um actually I'm kind of uh glad to hear a lot of the comments are positive for the hotel although I agree with Joe had a great idea on the compromise for the trees uh for the Wildlife but uh with this town I don't need to remind the people who come here all the time this town needs a tax base we are a poor town if you go our website we have five or six openings because we can't keep employees because we don't pay well and typically towns that don't pay well you have a High turnover and you're working with people who don't know your town and once they learn how to do the trade they go to somewhere else where they pay good but I like everybody's suggestions I mean there's stuff to be worked on the the tree mitigation but uh at least we're not a bunch of people saying no don't build it at all but the traffic study is a good idea so I just want to reinforce that it should go through with some of the conditions that other people are also putting out there thank you CI sui Cassie sui um I liked a lot of the comments here but um I'm concerned with the speed the what's so fast why do we have to move so fast we have a lot of issues um their own attorney said there were other issues that you guys were concerned about and they pulled their pens and papel papers out and went back to work to change things so why can't we go back and you know make sure we have an official traffic study current because that seems to be a big issue with the traffic um make sure something's permanently put in so I was reading the section on traffic and the one section D talked about on the final closeout you know there will be a discussion with the town on Fair appropriation so what does that mean the taxpayers are going to pick up part of it and and then we're going to determine you know what's permanent so I think we need to slow down give them our ideas tell them you know let's delay this let's go back this is what we want look into and have them fix it I don't see the the the speed we have to do this at um I was concerned in fact I didn't really understand it till it was brought out the fact that they're going to divide this parcel and we're actually going to give them two um why do we have to take the trees out of the area that's a second so we can have con you know pavement so they can sell it for another commercial entity so I think that needs to be discussed if they wanted two partials they should have originally put that in the original site plan but now they want it so I think we need to go back we need to give them a list of things that we want corrected and we're not saying no we just need some things corrected we need a a study done we need um a better look at the trees and and what it's going to actually look like and um I would suggest that they don't divide this they can put their hotel you know swap for a swap but you know seems like they're getting the better deal they're getting two for one so please I urge you to slow down because we do things a little too fast and then we have to come back and have to look in the rearview mirror and we can all look at other things in this town that we said wow I wish we would have done this a little better because it's changed you know 5 years down the road so take the time we see the issues traffic's a big one a study was asked for and it wasn't done so please slow down delay this and get what you need done put them back on the drawing board and then get it done so we know what's going to be there when it's done thanks mayor um I received 16 emails with regards to um the hotel uh 19 individuals were listed in them supporting the hotel 11 of those emails were received after the deadline of noon um is it the desire of the council to receive and file all of them do you want me to list out the names before before we do that I received uh three texts against the hotel today I received 21 emails in favor of the hotel today I received 17 texts in support of the email of the hotel today and I received while we were sitting up here three additional text in favor one additional email in favor with concerns and one additional email that is against it so anybody else have anything to add St them all at the same time so I've got about 40 here in favor of of the project so um I'll to so can I have a motion to file all of them motion to receive and file second I'll I'll let you get the did you want to comment on her comment because I have a comment um oh yeah I all those in favor have a motion do I have a second yes second all in favor opposed okay passes five to zero now Laura would you like to make your comment um like it's more of a question of we are still going to talk more about traffic because I have a couple questions for the developer I didn't want to throw traffic in on top of trees and make make it more confusing so just let me know when I can ask my traffic questions go traffic girl okay here anyway Madam mayor after the traffic questions which will probably resolve those can I respond a couple of the the public comments let's stay with trees there's some trees in this related and then then we'll we'll have another round of questions up here is everybody okay with that and before I let you start B something about me receiving and filing those emails so make your comment about that so because I am a realtor I did not want to be confused that I have any realtor um interest in this project so I made sure that everybody either emailed to the clerk or the mayor so I want to make that clear and they did she got many all right go ahead respond to public in favor thank you I I'm G to try to there were a couple of of overarching comments and I'm going to go in reverse um because traffic was just mentioned just from a perspective of how traffic studies work it probably doesn't no so the we T there was a request for more traffic studies any traffic study that is done once from the time this was approved assumes all of the traffic from this as a baseline in the study so any traffic so the traffic study that was done uh the traffic analysis that was done by the Traffic Engineers in this case starts with every trip associated with this at complete buildout and then what's the difference between that and what we're asking so when the the question of uh it's the the phrase technically is proportionate fair share it's what's in the condition that that's a legal requirement that we have to pay our fair share of those traffic impacts that's how the statute calculates and requires things to be done I'm not going to go through the math I'm not an engineer that's what when there was a question about what fair share meant and the town pay maybe Francine or Glenn you can answer this question when they're we're talk when we're talking about what their Fair shares who would be the other shareholders would it be us in the town or would it be perhaps other other developments that are close by who would be who who would be the other shares who's paying the other shares yeah it's um all of the developments that put trips on the roads okay thank you so not the town all of the developments that put trips on the road correct Glenn okay so it's not at any kind of expense what be incurred by the town so correct thank you okay okay so that's that that's that's straight okay so the trees um I want I want everybody to understand because there there this was a long time ago thousands of trees have been preserved we're not just looking to clearcut we we put them in the places that made the most sense right that's why we talked about you've got the conservation using around the outside you got thousands of preserved trees um these trees don't make sense I showed you the the graphic um but there was a point about um someone and I'm not mentioning names because I couldn't write them down fast enough um but uh there was a couple folks talking about they're doubling the impact there's no doubling of anything as we stated there is not a single square foot of additional development being proposed by this not one so the square footage allowance what's already approved does not change so um this is not going toate plan that was approved in 2011 correct You' got a certain amount of square footage there and how you cut it up or plop it around on there it's still the same square footage that is correct thank you that is correct um so relative to the trees um there was a a comment about replace trees with trees not Palms we have 50 uh we exceed the mitigation requirements but there are 50 canopy trees shade trees that are on the Hotel Site um on the landscape plan um and the first I think it was the first Speaker uh talked about putting some more um trees on the the Town Center uh pod what was it pod G so I'm sure youall saw me it's a small room I walked outside with the hotel developer um and so these are laurels we can actually um put 20 Live Oaks that we would agree to put on he I'm saying we like I have anything to do with it um that that he has offered to put onto into the Town Center piece uh and we would work with your staff to determine the locations of that again this can be a condition of approval uh we have been at this for more than a year and a half so this is not fast this is not speedy um and as things happen we did make changes that was over the last four months um so uh we can craft these conditions this sometimes happens they come up with an idea we say okay we're gonna give you some trees I can't promise you owls I don't know how to make the owls work um she asked me for owls I I can't do wow sorry I love a pun she just said who I I know that's our joke so uh that that is something we could also agree to as a condition of approval um correct me if I'm wrong but doesn't your doesn't one of these conditions that we're asking you to agree to say that you're not going to get your Co until we're happy with how the traffic's going until that's been fully mitigated so not quite okay well tell tell me what it does say can't you couldn't do that you well that that would no developer in the world could ever agree to that because you can't build a building and say maybe we get a CO maybe we don't right right so you're putting millions and millions of dollars into uh the development so what we've proposed for the conditions uh relative to the traffic uh one is continuing the triangle right no besides the ones that you've already explained and you've already got what you're what I what I read here is your willingness to come back to the table before you open your doors and say is what we've done working and what can we do to make it better and what can we do to help make it better that's how I interpret this so in a sense yes but with a very specific how we can make it better okay so as I mentioned in the presentation when we looked at the concrete triangle um I I don't want to talk about food now because I'm hungry um it wouldn't do as much good anyway because you have the mountable curb so uh and I think someone talked about one way out of the Wawa so what we're proposing is that the intersection that issue right of with B Road be an in only that we take that that exit if you will and take it off the table by the striping and we would agree to either do that upfront right now or then when the or whenever the town if the town desires it to do that when asked so that's up to you on whether you would want to just have let's just start we heard some folks who asked about that we're willing to do that um you know as part of the project development uh and certainly that that would have to be in prior to co it's just less amorphous than whatever because the whatever could be in complete unknown with the one exception obviously which is um there is the condition of approval about the proportionate fair share that's not so amorphous because we know how the formulas work with the statute and so we would we do agree to to manage the proportionate fair share okay thank you of what of what we decide still needs to be done correct what the traffic engineering de demands there's a there's a a way in which the statute requires you to look at existing background trips what's there what's not Etc and how those calculations get done it's not based on we like something it's based on what the traffic engineering requirements are based on the statute La was next actually she she backed off her life Mar get to after um if you are going to put in these lovely oak trees and you really want to bring in the owls you need to bring in rabbits and mice just saying okay just write that down rabbits and mice rabbits and mice Matthew's in charge of the rabbits and mice anyway um I appreciate that this sounds like a really silly question if I wanted to send a postcard to the manager at Wawa what's the address what's your street address five6 I honestly I actually have no idea somebody I'm sure knows but and there's there's a point to this is Googling it right now I'm I can give you the address if you're looking for it okay great that and because there's a point to this 15475 Southern Boulevard is there we go so for those of you who don't have a nice fat agenda within this agenda is a report from the Palm Beach County fire rescue lockah hatchee Groves only from October 1st to December 31st 90 days there are eight accidents that specifically reference the intersection of Southern Boulevard and B- road if you comb through the rest of this report there are an additional 17 that reference any address that include 15 something Southern Boulevard and B Road okay so 23 accidents in 90 days and I I bring this up because if that's not an impetus to have a for traffic study done there now now I'm not quite sure what is I I believe that this criteria supports everything that every audience member came up and said slow down do your homework and I don't really care what your computer numbers say you need to look at real human behavior and it's only getting worse so okay part of the traffic analysis that Traffic Engineers do does consider accident data and they they look at warrant studies for things like lights and signals and how things work and what they do so there's a lot that goes into that um it isn't just the computer numbers the computer numbers are based on uh studies that are done uh there are lots of Traffic Engineers with phds who you know get their phds and they do studies and they work through these things um we all know none of it's perfect it is the best we can do with it um and I don't buy that I I I can I understand that I understand that and I do this I've done this a long time and I hear that um we we have to rely on the Traffic Engineers they've done what they do based on the engineering support they do consider things like accident data which is why you have it okay I do have but finish your thought and I have two more questions but there the fixes is a different question to an existing circumstance than what we're proposing here and that's some of why we're trying to accommodate the change in traffic pattern um at the intersection here on B Road where we can with the triangle and again just the one way in so that people don't ex don't also exit so that they move up to Tangerine those are things we can do now beautiful segue so I'm in the plaza and I need to get out so I have to head northish so I can get on Tangerine and head east is is that how this is going to work from from the Wawa talk to me about how Tangerine is going to be used so basically if you can't so what will happen is if if you're anywhere on the east side of that site okay right of the east side of the grow toown center of from the the westernmost north south connector to Tangerine okay you would be directed North to tangerine and then I assumed at that point You' be going west because what we're talking about is the B- Road intersection which is to the West so you would have to go to Tangerine to make the turn at Tangerine you would not make the turn at that point at that southern oh they're pulling it up oh yay so you're so so and and again are you going to be directing traffic within the Plaza East on Tangerine at all they there is Eastward movement on Tangerine okay is your group still speaking to the potential um RV lot of connecting your lot and their lot so that there's Ingress egress off of croad I I'm I'm not aware of any discussion with any RV owners there was there was a public meeting it's called a developer meeting and it's when proposed with applicants come and they talk about stuff and you know this is recorded it was a live meeting it's a public meeting and the applicant said yes my people are talking to solar sport people about connecting the roads so give me one second I'll go check with d and see if he's heard from them it okay thank you okay so now I understand he's back um so there can be a connect Matt mat matth you can talk about but there can be a connect tangerine's a public road so they connect to Tangerine however they want basically that's a simple answer yeah and we're required to pave C Road right from tangerine South to Southern so that's that's part of our responsibility but they can they can come Tangerine all they want that's that's a publicly accessible road so there's that is what it is yeah okay just asking the question thank you that's it mayor thank you next okay I wanted um to I wanted to know um about the um sincere and sincere uh amount of forward progress that you're sh showing the residents that you're really concerned and you're moving as fast as you can or as fast as we need you to um correct this problem with the uh Transportation on B road so as I said we will right away we will agree to the conditions that both include this alternative so that there's no exit and we will install and for the year maintain the uh triangle what are you doing with the uh the striping um going from your triangle to Southern anything are you removing the the striping there and allowing that extra Lane also yeah that's already been approved uh our contractors ready to do it they just need an approval from do to do what's called a maintenance of traffic plan because they have to when they go in and unripe it that causes some disruption in traffic so they're just waiting on the final final approval from do to be able to do that but they're mobilized and ready to do it yeah okay this um striping of uh the area behind Wawa and AutoZone when do you propose that that's going to take place and who has to approve it well that would be it's a a town we get a perit from the town to do it but I think like other conditions it said I think like the port shop said within 90 days so I'd presume that we could agree to a condition like that that within 90 days this would be um permitted and and and ready to be installed all right and this solution of um Tangerine staying just north of the island there um storm water yeah is it shown on the screen yeah yeah the island on B Road um yeah okay um that's going to remain same way yeah Tangerine Tangerine there's no way of moving that road any further North Tangerine yeah no no ma'am because it would it would give you more options for stacking up if you need to um on B- road trying to go north the trying to go north is the big issue yeah you want to go north and 10 people waiting to go south go to the Southern Boulevard you're going to be stuck in 10 cars waiting to go North to go home right right yep I well that's it Lan to go south one to go nor one one to enter okay Robert you're up next all right on page 41 of our agenda is the existing conditions of approval and it says uh in order to comply with mandatory traffic performance standards in place at the time of this approval no building permit shall be issued after December 31st 2022 and this can be extended um additional time extensions for this condition may be approved by the Palm Beach County engineer based upon approved traffic study now part of this new condition is they want to change that date from 2022 to 2029 and I don't feel like this Council that even entertain that has anybody gotten anything from the county engineer about an extension last year or so that's just clarifying Mr Shore that that's already been done so those have been extended this is just that would just meet the current extension that's with the county so the county has given you approval till 20129 correct there statutory exceptions extensions that are got that in writing somewhere you can provide that to the town that says here the County engineer says yes because the reason for that I'm assuming is your initial plan there was so much development around you and it's based on your Max Capacity or occupancy whatever whatever well the county wants to know okay here we are 10 years later what else has happened in the area that impacts traffic because at this point 10 years later it's not just all about you it's about who else built what what else changed so I wouldn't agree to that condition without uh some confirmation that the the County's involved in that I can't understand why the county wouldn't require another traffic study so to be honest with you it doesn't matter I'm I'm I'm not being flippant it really doesn't the the the statute there are statutory extensions that are allowed I'm G to maybe get it wrong but it's I think it's two either 242 or 252 um of the Florida Statutes in the Emergency Management sections that there are what are called emergency extensions of development all you have to do is send a letter in and say here's the number of days that there was an a state of emergency and here's the um uh allowance in the statute for time after that and this is the new date and the date is that date if you don't adopt it into the condition it's still that date with the county but we would like to avoid any confusion so it does match the dates of the statutory extensions um I'm sure you know Mr tvia if you wanted to go through all that could do that as well but that's the the traffic extensions and all of the development order extensions that go flow through that statutory provision yeah we went through that dog and pony show with the equestrian crossing the date kept sliding years and years because of Co or hurricane this and that finally we took it from you and did it ourselves we could get it done but um my point is wouldn't you agree that they put that deadline of 2022 as a point in time to take a step back and re-evaluate the entire area to see are things different and is maybe should we look at something else no sir no you don't think that's why they put that that is not why they put that there 2022 they that is not why they put that there why would they put 2022 because there's a there there there the ulc has particulars as to the the county ulc the unified line development code for Palm Beach County there's a whole section on traffic um and it requires you to determine a proposed buildout date and so they then track for that buildout date and they then track it against what you do and that's why they also allow for the extensions and if you get the extensions it goes it isn't just a random or this is now when we are sure we need to re-evaluate there's a whole lot of process that goes into that it's just not it's just not that simple you just basically say this sentence has no weight is what you're saying it means nothing no sir that is not what I'm saying at all okay Phyllis you have something to say so traffic caling it's this is so interesting to me because we and and you know a lot of familiar faces out there we've had vision sessions several of them this has been going on for years this particular Council Les Les mayor Kane has been kicking this can down the road for the past couple of years okay um you guys did not want a commercial overlay on okobi because Southern bouard is our commercial Corridor you guys came to the visioning you made it clear two Council P people that sit currently on this Council still tried to pass the commercial overlay although you all came in front of us and you said no commercial on okobe traffic caling okay so here we are on Southern Boulevard I'm sorry I'm tired of looking at uncompleted de um site plans that's all we have in our town Royal pal just whipped up those little stores we're all already going to the restaurants and the stores they put trees in front so yes we need to realize the mistakes we've made in the past but the commercial Corridor is on okobi Boulevard these people own this property if they want to put a restaurant next to a freaking Hilton then that's their prerogative and we're all going to benefit from it okay yes there's trees I have 20 Oaks on my two ACR 20 okay how many equestrian facilities have clearcut along with the S farm okay now we have equestrians coming in that are appreciating the trees and not clear cutting our land this is our commercial Corridor I appreciate the fact that you guys are are worried but this is this has not just come up this is the final vote what do you want you want a Hilton or you want an Alf and if the ALF goes in those trees are history anyway so please let's move this town forward our commercial Corridor is on Southern you know and and and Marge and I okay sto the commercial on okobi but we lost the TPA Grant why because that was not a benefit to commercial on okobi so you guys we're in this together it is not the North and the South here okay we're all in here together let's make the right decisions and stop looking at uncompleted site plans like we have one on okobi Boulevard there's a church on e Road it has been being built since ' 08 I don't hear anybody bitching about that so let's get it done let's move it forward okay everybody's got their comments okay so what I would like to propose right now is that we call a short recess have the developer meet with our legal counsel and iron out the conditions because some additional I conditions have kind of been added or shifted or whatever right now so the vote's going to look very different and then we will take a vote after that so how long do you gentleman think you'll need I'm sorry oh and I I I I guess I need to I'm sorry one second I just need to disclose that I did have expart communication with representatives of this this project previously as I think did every other Council I have I have um okay okay thank you all members have guys 10 minutes 10 minutes 15 minutes he says 10 let's go 15 because we'll give ourselves a little buffer and and but if we can get back quicker we will okay great thank you we'll stay sorry B within 90 days of site plan approval of Hotel use solar Sport Systems Incorporated including its successors and assigns shall design and install RightWay improvements to eliminate westbound movement on Avocado Road West of mango way the modification shall be achieved using a combination of striping and traffic control signs solar Sport Systems shall submit to the town all required materials for permitting prior to installation the town manager May extend the time allowance for an additional 30 days next can you scroll up for me L thank you um replacement for hotel condition a prior to issu issuance of a certificate of occupancy for the hotel solar sport Incorporated including its successors and assigned shall plant 20 live oak trees on pod G of the master plan a minimum of 14 feet in height and four Cal inches the location of the trees yay the location of the trees shall be coordinated with the town's arborus the installed trees should be maintained in a healthy condition as deemed acceptable by the town arborist in perpetuity by solar Sports Incorporated thank you gentlemen for hearing us well we did miss that that last one also needs to have successors in dogs contract and it's a best interest contract because um it is the lowest price any time we get quotations to pick up our tree cuttings at the site what they do is they actually go out to wherever we are trimming or trying to remove stumps and they take all of our debris away if we were to use Coastal we have to bring it to our yard and we pay the same amount so this costs us less money than using Coastal and they were the lowest proposal that we got so that's why we're putting them on as best interest and we're using them to take our debris does this mean that Co that coastal's contract is reduced because they're not picking up our vegetative debris any longer this means we save time and money by not carting our own debris to the yard to have it picked up there and then we would pay the same price if we brought it to the yard this picks it up on site to bre the additional oh I see I'm like if we cut right it's hide Park it's 161st it's any of the significant I thought that we had a contract with them that said that they were exclusive for debris pickup in our town they they allowed us to go to debris dog because we asked if they would come to our site to pick it up with a grapple truck wherever it is we're taking it down they said no we had to get it to our yard for us to get it to our yard takes us away from other work that we're doing so at the same price for debris dog to come pick it up on site is more productive and efficient um and um debris dog isn't taking the trees down we or kills are taking the trees down okay did you have a question or you well Robert's light's on first oh his was on first okay go ahead Robert yeah this is completely bypassing the purchasing system which requires you to put stuff like this out to bid this is handing somebody a 100,000 th000 contract without anybody else bidding against it that's incorrect because well where's the bid when was it advertised it didn't have to be bid what we did was quotations on it and and we're bringing it forward for best interest the reason we're bringing it forward for best interest is because we got series of quotes over time and in fact you may remember that I tried to find vegetative haulers for us and I actually had other compan is calling around to find vegetative haulers for us and this is who we were able to find that could meet or beat the coastal price and they and we ask Coastal if they would let us do this and if you choose to ask us to do something different we certainly will but the reason we put this here is because in our professional opinion based on the information that we have based on the existing contract that we have with Coastal and based on the amount of tree debris that we are generating all throughout town this was the most productive and most efficient and cost effective for the town and I would defer to Mr Gant to add anything that I need to be reminded of uh no you pretty much covered it we had contacted multiple vendors over the course of the last year to try to find the best deal and every single one of them the quotes they gave us including coals were outrageous um and debris dogs always came in at the lowest no matter who we called so that's why we didn't go through the process of wasting money and wasting Town Revenue to put something out to bid that nobody was going to bid on well that's the issue I have the process has bid it for a year you have been reaching out to people why didn't you bid it a year ago there's tons of hollers that could respond if the breed dogs the only want to respond then fine they get it I'm not saying they're a bad comfor or anything I'm just saying this requires a super majority to pass this because you're skirting the system you're saying typically it's reserved for an emergency um we are not skirting the system and I want to make sure everybody in the audience knows that because our procurement manual provides for us to take this very approach and that is why the best interest is in our manual because first of all we did want to get a vegetative huler we couldn't get anybody that would be interested in bidding on us so the fact that we have been able to negotiate this deal with debris dogs is a good thing for the town but again um it is in accordance with the purchasing manual and it is in front of you transparently to vote on if you choose to vote no and you ask us to go out and do something different we will laa I was trying to follow the math and what you said made sense but can you just please say it again for me so Coastal charges $8 per cubic yard and that's for coming and picking up whatever in front of our house and this is $11 per Cub cubic yard what's the extra Coastal take charges $8 for picking up at your house where you live what they charge the town is by container they will not pick up cut trees or large trunks or anything the same confusion I did this is not for our dead veget debris this is for like when the town took down all those trees at hi Park and we create this big giant pile of debris and somebody has to come in and take it so it's a different price Coastal charges 8 when they come to your house or my house and pick it up but they charge what when they come pick it they charge there's one other distinction that's not made if you put a large tree trunk out coastal's not going to take it right okay if we generate large tree trunks or we need trees stumped coastal's not not going to take it if we're taking trees down whether it's with kills or by our own Manpower on the side of the road Coastal will not pick it up we have to take it all to our yard and put it in our containers and they are willing to come do as many as five six polls a day if we bring it all to the yard if we bring it all to the yard and they do five six PS a day we will pay about the same amount that we paid debris dogs where the savings is is in the time because debris dogs go directly to where the trees came down I.E in this case let's say hide Park um or prior to this let's say6 first and they take it from there and dispose of it and that's what the 550 is so simply stated they provide an enhanced service yes they provide a service that Coastal does not provide okay if you remember when we started projects had haing stuff want keep back in yard which is 45 minute to an hour round Tri loading and unloading okay so this is a going forward brand new contract agreement for the town broad service yes ma'am there we go thank you sorry anybody else have any questions you're making a motion okay I didn't know whether it was a question or well maybe both okay never know so um I have a question is there going to be like a cap on this where you know or you guys are keeping track of what they're taking away and um so this doesn't get carried away so I'm wondering is there like a cap that you guys are putting on this as far as uh what they take away to come back to us again per perhaps and then my second question is if something better comes along which our vegetation could possibly a better deal what is the um cancellation on this contract if we found a better deal one we don't have to cancel the contract we just don't have to use it okay that's number one and number two I'm pretty sure before we pick up the phone and call debris we get a price from them do we not Mr Gant I understand about when they pick up when you send we get we get load tickets from them when they we so that's how we monitor right but do they estimate the job also when they come truck okay so we tell them we have a load of stuff and they come out and they pick it up they fill the truck up usually we're still working around the site anyways uh when they come and so they send a truck up they fill the truck up they charge us x amount of dollars they send another truck they fill it up they and so if they show up and there's not you know we obviously call them if if they've already picked everything up and their own dispatch I mean we've worked with them um over the last year so I mean our goal isn't to spend a lot with them anyways because the only thing they're doing for us is only the tree debris stuff that we're generating by doing all this drainage work around the town the trees and debris it's being removed moved trying to reestablish all this drainage throughout the town it's the only time we're ever using them everything else is done by Coastal okay thank you that's my question yeah one last this is for the attorney um just to air on the side of caution because as example um a road where I own property is used as example should I recuse from this or it's just an example no not in that case okay thank you all right yes um the trucks that are loaded um do they do grinding within our uh Town boundaries the debris dog not for us oh okay you're I mean they have grinding services and I believe they might for residents like you need something cleared you could probably call them but we do not have them because we don't have a location for them to do it at anymore okay because I've seen debris dog going into F Ro to not chobi and I was wondering are how would we know if it's our stuff that they're taking in there for that person to grind I know they take but what I my understanding is everything that we generate they take to their yard which is next to the Palm Beach International Raceway location on beine Highway Al by Pratt Whitney correct I've seen that it's it's a massive massive full of trucks haulers and screens and grinders it's big okay as long as it's not being ground in our town that's good okay can I have a motion make a motion to approve resolution 2025 d09 second I I where are we going now mayor okay we are moving all the way to seven is gone the town council meeting calling the water control I mean do I really have to do that when there's nothing on the water control move on to item number 15 I'm sorry item number 15 number 15 discussion of livestock waste franchise agreement before we start this item um we the town has a number of ordinances governing um livestock waste haulers and also how livestock waste may be on a property and additionally our Solid Waste ordinance includes a non-exclusive franchise for special waste and by the state of Florida and also by our Solid Waste contract livestock waste is considered special waste so um Mr CTS um has been working with a number of property owners and haulers that have come to us and I am going to turn it over to him to talk to you about a pilot program that's been presented to us Valerie if you could just clarify this is an item for discussion not for V it is a discussion item not a voting item that's that's not ours the I thought this item just pulling up the the item off of the material that she has and if it's not up there we can move forward do you have do you have wouldn't a power Ani it should be an aial all right let's if you can if you can find it great if not we'll we'll move forward um we are an agricultural Community a rural community and we have a number of equestrian farms and that's all great and one of the things that comes along with uh equestrian Farms is manure it that's really good and really difficult and bad to deal with depending on how it is handled uh the town has tried to pass some regulations with respect to haulers and what people can do on their property with that horse manure so that it is handled in an appropriate way um but it has been a consistent problem for the town to be dealing with we have a number of haulers in town uh that provide service not only within lockah hatche Groves but within the uh neighboring community ities as well um they uh we have some of the biggest haulers in the in the area one of the things that they run into from an economic standpoint is that the disposal sites that they can go to are limited and they are relatively far away round trips of a couple of hours and it's a couple of hours whether you're in a small truck or for a big truck hauling a whole bunch of stuff or hauling uh a relatively limited uh amount that takes them away and and they run gas prices and time and all those kind of things and that hurts their um economic margins uh there is a transfer station that is located in Wellington they um charge by the the ton or the pound um because it pounds turn into tons um it and those um load charges can be um upwards of $250 $300 there are haulers here and Mr hickey I think is g to make a presentation but I'm just giving you an outline of what's going on you can ask the economic details to him but they are looking for a more cost effective solution um which will benefit the the town uh residents who produce that manure um and need to have it disposed um and it'll benefit the the town because there will be more of a control point if you have it isolated to one location and you're able to put together uh systems and operations that don't have the manure leeching into uh the ground the groundwater uh canals those kind of things um so what they came to us um as a group and it was a loose group to begin with and it's been consolidating over the the last month was would there be a place um uh that the town would consider to have manure dropped off um and accumulated in a protected area uh and then be available for transport to Ranch where Mr hickey has an arrangement and I believe it's 850 Acres that you have available or in that range uh and what he does with that manure is he piles it up on the the King Ranch site and I think it's about a foot high it stays there for about eight months and then it is tilled into the soil and it increases the crop yield um specifically sugar um by a substantial portion um I think it's 25 to 33% but once again Mr Mr hickey can address that so it becomes a valuable um commodity or an acceptable uh product it goes back into the ground um and it produces wonderful sugar for us which we all or almost all of us like and I certainly like a lot although I shouldn't have it once it's processed I should go out and grab it from the cane so that is the concept as to where your manure or you know whatever you want to call it turns into sugar um thank you so so uh what they were looking for is a couple of sites and uh they talked we talked about uh three specific sites with them initially uh one of them was the brown land holding site at 248c uh which has um access off of Southern um but uh haulers and the property owner couldn't make an arrangement that's the same site that we used as a temporary disposal site for all of our waste after the hurricane I mean the um tornado and that seemed to work out pretty well um they they then focused on two sites um the site at 2100b um and the Tetro site at the corner of F and okobi those two sites the let me talk about 2100b first because it was the first site that came to us with a firm proposal um from Mr hickey uh that's where I would have liked to shown this up on uh the aerial but you all have in front of you um this picture that shows the 2100b site uh there is a single entrance and exit out of that site it is wide enough uh for trucks of all sizes to get in and out currently on this site uh there is a Wholesale Nursery operation among the products that they deliver to various clients um are material piles uh Rock sand soil um and in essence what we're talking about is they're adding uh another product line or proposing to add another product line um which is the manure which essentially turns into fertilizer over on the the King Ranch um maybe that's not the exact term but that's how I think of it um it's a it enhances the crop yield as you can see from the site where they are proposing to have the manure bin is in the Northeast section it would be pursuant to our agreement and the agreements that we would enter into them with them it would have to be at least 50 feet from every property line it would have to be at least 100 feet from every body of water and well head the manure bin would be Concrete in construction it would be large in the 30 feet by 50 ft size which sounds pretty big and is pretty big and uh Mr hickey will tell you that it's going to hold all the manure that they can handle but when you look at it on the site even though this property is I want to say 3.65 acres and and you see it outlined there or or where it would be it's not really that significant in comparison to the entirety of the site and you can picture at least I can picture and that means probably everybody in the world can picture um that the trucks would be able to maneuver back there and then come back around um and it wouldn't be uh out of character with the existence of the site or it wouldn't dominate the the site for that circular pattern to to take place um what we have proposed um as conditions that are associated with uh this is that these kind of operations and I'll talk about the tetos site in a minute but I just want to go through the um the the protections if you will that would be in our agreement with them would be that this would be done on a pilot BAS um so that they and the town could evaluate how well it works and whether there are problems or whether there are things that we need to address and um amend our ordinances to to correct the pilot program uh would begin as soon as they were able to get all of their approvals from d uh and get a building permit for the manure bin uh I should have noted that the manure bin would be um under a cover uh at this point in time they're discussing but they haven't finalized the idea that it would be something along the lines of a big uh tall pole barn uh that would protect the manure from getting wet the the pilot program would end on August 1st 2026 uh the town Council um could terminate the program upon 90 days notice um they would have to get all their required permits from DP which is administered through the health department they said they'd have to get a building permit uh for the manure bin um they could not begin operations until they had gotten a certificate of completion with regard to the manure bin um the location of the manure bin as I said would have to be at least 50 feet from any property line and 100 feet from any well head or body of water manure um deposited on the site would be removed from the site and sent to King Ranch within 48 Hours of the deposit of the manure while there is going to be relatively constant amounts of newer manure there the individual manure drain would only spend a relatively short time at this facility before it was transported um to the King Ranch that time frame and Mr hickey will tell you I'm going to do it within 24 hours I'm giving a little bit of grace Time for things to go wrong before they would be in violation of the agreement is the the thought process um but that time frame is significant because as the town manager indicated I think in her opening remarks is that right now um uh people are able to deposit manure on their property for 72 hours before it is spread or otherwise disposed of um the uh the the concept here is that you're going to have smaller trucks that are already in town picking up manure um bringing them to to this site and then you will have larger 18 wheel trucks uh taking it out to the King Ranch site so you're going to have the materials combined here um and where they get their savings is in the the transportation costs and the efficiency of getting their smaller trucks back out on the road to do the the pickups um we have talked about that uh the all the way that the truck the large trucks would get in and out of town would be okobe Boulevard the seminal Pratt to Southern there would be very limited um traffic of those large trucks within the town and it would be limited to okachobee and this short section um to the entrance of this on B Road the truck traffic that is doing the pickup within Town um that already exists because they are making pickups uh from the Farms that are that are here the 18 wheeel truck would um not be allowed on okachobee Boulevard between uh during peak hours um and there may be some refinement as to what is considered a peak hour um right now uh in the memo we've talked about 6:30 a.m. to 9:00 am in the morning and 4:30 P.M to to 6: PM there has been some thought that the peak hour in the afternoon um starts a little earlier there the uh operators would provide the town with uh reports on a monthly basis of all the the loads and as to when they were dropped off when they were taken to to King Ranch um the town would be paid uh a fee for each load that is dropped off that fee would be 15% of the gross proceeds received by the operator the operator is currently talking about a price per load of $100 um so the uh fee to the town uh for a hosting or franchise Arrangement would be uh um $15 per load at this point in time if the price went up um our the revenue would go up on a per load basis and obviously if the price went down Revenue would go down on a price per load um the town would be able to get its inspectors on site anytime during uh normal business hours um so that we could view the uh operations make sure that they are complying with their agreement um no manure would be allowed um on the site other than in the contained manure bin so if there was a spill it would have to be picked up put into the manure bin um as a companion um part of this we've got existing permits or non-exclusive franchise agreements with the livestock waste haulers themselves um that would allow them to deposit the materials um at this site um and everything that I'm saying I'm going to say in a very short-handed version there is a similar Proposal with respect to uh the Tetra site at5 uh 13538 okovi Boulevard but um the waste hollers themselves would have to pay a fee uh that's a $1,000 um currently one of the the things that we have in our ordinance with respect to waste Haulers is that they are limited to 20 loads um and then they pay another they can pay a fee of up to 40 loads um that it's just unrealistic um the the loads are they they take care they handle more loads than that what we are suggesting is that the way the the load limit that applies uh to them be waved if they bring um their material to this site because we know what's happening with this site and it's getting taken out of town um efficiently um and what the in the um in The Proposal that was supplied um Mr hickey anticipates that if loads were limited to lockah hatchee only the daily loads would be 10 to 20 um dropped off and he says that's the equivalent of two to four1 18 wheelers um the revenue projection that uh he had there um is um that was that was meant to be the town Revenue projection that was based on a a proposed fee of 10 10% instead of the 15% that they have uh agreed to um he has calculations there as to what would happen if uh the um site was open to loads from surrounding communities that increased es the daily loads and um extends the amount of 18 wheelers coming in and out of the site to up to 12 per day um at this point in time I think staff's recommendation uh with respect to the pilot program is that it be limited to lockah hatche Groves um so that we can get a handle on it and it focuses on this community now these proposal have come together just recently and at one point in time there was separate discussions with respect to the property at 13538 okachobee Boulevard which is the the Tetro Land Development site um they have uh D approval to store and transfer vegetative waste on their uh on their site um and there is a there is a a photograph in your package there of that site um and if they they just recently um I think it was yesterday they came together and instead of um offering uh competing packages that they felt that um they would offer their site um under Mr hickey's plan with Mr hickey operating it um in exactly the same manner that we just described uh for the 2100b site I'm not going to repeat that for you all I'm just going to point out um if you look at the the picture the location of the manure bin on this property uh would be right behind um the office building which is located in that little Oasis of uh of green um in the top half if you take a look at the site plan that is attached um you can kind of see the the building that's identified as the metal shed there is that little building there and The Dumping area would be behind yeah they have also they've included um a drawing of a manure bin not necessarily the manure bin that they would use but it would be similar construction um that you see that you see in this plan um this one how big is that property compared to the other property um the Tetro property is 3 point 3.21 Acres um so very relatively the the similar um and I think I've covered most of the points in the proposed pilot program uh the question that will be presented to you after Mr hickey's presentation is whether or not you want us to direct us to move forward um with making this thing a a reality um and uh consideration if you are favorably inclined towards the project as to whether um it should be permitted on one site or two sites and if you're going to have one site which one appears to you all to be uh the favored site so we can have that kind of Direction um as of yesterday uh Mr hickey I don't know and he'll he'll be here so I don't want to speak for him but um he uh does not know within his plan or he didn't know as of yesterday as to whether if given permission to operate to whether he would be ready and and uh able to immediately operate both sites because it would uh require the investment um of the manure bin uh and the permitting for both of those sites um but with that uh I'm gonna turn it over to to Mr hickey he's been patiently waiting all day I just want to ask the attorney I'm a generator I use a hauler is there more than a 100 in town generators do I need to recuse myself I use a hauler also that's a great question but there's more than 100 generators okay I just want to get that on record more than you know Mr hi more than 100 Mar has got go poop now good good point Robert good catch thank you you know elected officials producing manure that's a regular okay Mr hi to the Town Council and town staff thank you for taking the time to hear my concerns today I stand before you not only as a business owner but also a representative of the many haulers here providing a cruical service removing manure from horse farms across lockah hatchee and Wellington and surrounding areas for years lockah hatchee has been The Dumping Ground for manure from Wellington a problem that worsens during the busy season I have dedicated over 30 years to to the manure removal business cons consecutively working towards logical Sustainable Solutions even now I collaborate with farmers and energy consulting firms constantly seeking Innovation ways to address this issue I previously worked with us sugar for years spreading manure on their fields until politics power and money forced this option to be shut down in favor of the Wellington transfer station I initially collaborated with the owners of that facility believing we were working together to solve a problem for over a decade I have managed manure removal from the main horses show grounds sharing my expertise company resources strategies to ensure efficiency yet despite my contributions I was ultimately pushed aside disregarded like the material I removed fortunately I had built strong relations with private clients in Wellington and loah hatchee as well well as with loyal farmers who believed in me and my vision for three and a half years I was I was presented the opportunity oh excuse me fortunately I'd been strolling as well as loal farmers who believed in my vision then three and a half years ago I was presented with the opportunity to help a local manure business which led to discussions about opening a transfer station here in lockah hatchee after multiple meetings with Town staff and management we were given every indication our plan was be approved the town knew that establishing this facility was not just a business Endeavor but a longtime standing dream of mine to help improve the lives of haulers and ensure the sustainability of our industry with this understanding I invested over 350,000 in land leases equipment and preparation financed through an SBA loan my business partner also invested time and money but when things didn't go as planned we both fac significant Financial losses straining our R relationship now he's talking about Nelson Tetra now however we have chosen to come together again committing committed to solving this problem and moving the project forward I'm here today to ask for your support not just for myself but for all the local haulers who depend on this industry for years Wellington's transfer station has profited from lockah hatchee and its customers now we are simply asking for the opportunity to establish our own station and create a Level Playing Field through a chance meeting with Billy G and an incredible young welder his father Bill we formed a partnership United by a shared goal to create a fair solution for all manure haulers who have been taken advantage of for others financial gain throughout this process I've worked closely with the town staff initially there was a proposal for the town to take 25% of the gross revenue an unrealistic figure as most companies operate on a 20% profit margin after discussions we reached a more reasonable agreement of 15% furthermore I strongly believe that charging based on weight is unnecessary as manure Remains the Same material wet or dry the facility is not a storage or blending site it will be cleaned out daily we will operate only during normal business hours Andoid and avoid rush hour traffic concerns about truck traffic are unfounded as our vehicles already traveled through lockah hatchee and Wellington daily in fact this project will reduce traffic congestion instead of multiple Long Haul trips requiring one or two hours each we will consolidate loads cutting down on trucks fuel consumption labor and costs for every five trucks we consolidate into one we enhance safety improve environmental efficiency if if this pilot program is approved and proved successful we are prepared to build what you already know it is baffling to me that some would oppose this project despite its clear environmental and agricultural benefits manure is a valuable soil amendment that improves soil health I have worked with some of the largest farmers in our area and now have access to over 900 acres of land that would directly benefit from this program my collaboration with Oswaldo deeris a farmer manager 18800 acres in The Glades area has proven the effectiveness of manure in active production Fields boosting sugar cane yields from the standard three cuts to five cuts additionally I've had the privilege of working with Modesto one of the most respected soil scientists in our area his expertise inspired to me inspired me to reach out to more farmers and I have known both him and Aussie for over 30 years my passion for the industry was sparked when I first saw the massive tractors and spreaders he used machines designed for real large scale agricultur impact I didn't start my career as a manure hauler until I was 42 I worked two jobs one as a private duty nurse one of my patients was a well-known farmer and through that connection I built relationships based on trust not just as a nurse but as someone dedicated to supporting the agricultural Community farmer Farmers understand the benefit we provide healthier soils reduce fertilizer cost and increase crops yields most people don't realize that haulers are financially strained by the current system when we have when we use other facilities we must pay daily for a to get rid of the manure for a small company handling 75 to 100 loads per week that translates to 10 to 15,000 in dumping fees before we even process as our own billing this finan this financial burden has made it increasingly difficult for haulers to survive our lockah hatchee facility will help by offering weekly billing allowing haulers to manage their expenses more effectively we plan to charge $100 per truckload $5 per yard making it fair and affordable so today I ask you please support us the independent haulers the small business owners the hardworking members of this community too often the good not good guys finish last but today I hope that with your support we can finally come out on top we take some public comment okay oh um oh was it you okay um those of you that don't know Justin Justin where do you lay your head at night I live off of sea Road 22nd Road North loah hatchee so he's also a resident in this town as are several of our manure haulers most of the manure haulers were here tonight but they left because it got so late um exactly um to be honest with you guys this has been a dream of mine for years not just for the farmers but for also for us haulers as a company it I lost a dear friend in a bad accident many years ago in the truck in the canal and he died and ever since it's haunted me at night time trying to sleep so for me this is a lot more personal than you realize if I can take more trucks off the road and put it to one it saves a lot of time and could save more lives um taking it from lockah hatche only I don't think would be feasible because we need Wellington too if the Town only wants to make money off the residents from lockah hatchee don't get me wrong they will but it wouldn't be as much as we could generate if we were allowed to take from both communities and surrounding areas um that being said all I want is a chance Laura you have a question thank you for coming and sharing your story um where is King Ranch they have a farm out past Highway 27 past South Bay and and then one in Indiantown and then I have more Farms out past Clon that want it okay are you part of the site that's in Palm Beach point across the canal in Wellington there's a a manure Refuge site that there there's a dum station there I am not okay do do you use that site for I do I have I try not to because it it it's expensive they charge by the ton okay and they are also so in some kind of litigation and you know again this is only what I've heard from other folks they they have D approvals but that it's not on Agland and it's a it it's a whole lot of yeah you know it so what so your proposal is to increase your business Revenue by having a transfer station in our town not just mine but all the other haulers basically this will help us instead of taking it there and paying by the ton I'm charging a flat fee so it'll be quite a bit cheaper not just for you guys as the horse people but for the haulers as well and instead of like two hours to an hour and a half to go to Solid Waste or we could go to Wellington but like I said then it's $200 load plus the fuel plus the labor right you know what I mean it adds up fast oh yes it does um so right now most of us haulers are in between 3 and 350 a load if we try to go higher obviously everybody complains and squaws and we lose accounts to the people in Wellington more or less that can beat our prices because they have their own transfer station gotcha next questions are for the attorney doesn't this proposal violate like a handful of our ordinances in our ulc how do we what's what's the story there well this this is the discussion tonight so if you give direction that you want to move forward then we'll dive into it and you know come back at hopefully your next meeting if you want it done quickly with any proposed changes whether it's the ordinances regulations whatever needs to be done as Jeff said this has been coming in as recently as this afternoon this has been kind of a moving Target so uh initially I think we talked about going forward tonight but I think we realized that a discussion is the way to go and then and um if you are supportive of the concept of a transfer station in in the town then we probably would need to change some of our ordinances okay last question I don't know who this would be addressed by so your proposed route in and out of town is okachobee to seminal to Southern what's the penalty for a driver who just shoots across okachobee and goes down B Road I wouldn't let him for one I mean all if they work for me they know and I I don't own my own 18 wheelers I have a company that will work for me and um basically they follow my rules doesn't okay with within within within an agree an agreement we would there would be penalties for such action and it would be um it would be costly for them and potentially cost them the ability to do it as it continues okay trust me I'll be there to watch them all right thank you how many how many haulers do you represent how many are in your um whatever your group your little Network Brothers git um Immaculate ways uh Wellington hauling and myself okay so far and then there's few little ones that would you be able to pass since this will save you a little bit of money and as you said the price of these loads has gotten really exorbitantly high because of the per pound thing in rainy season is a possible price reduction to our residence something that we would that might be in consider might be on the table well members I got to pay the town 15% I I understand I'm and then I have you know don't get me wrong it depends on if I can take it from Wellington as well because I also have to put in the slabs in the building Fair answer just asking yeah um uh I think my next question is for you guys um will something like this make make it easier for us to monitor regulate identify places where this illegal stockpiling is happening throughout Town absolutely and the reason for that is that we can redirect um the hauling and The Dumping to the approved sites if they're approved so that would be one thing second thing is that um the reporting and the monitoring would happen and we have somebody to hold accountable and Mr hickey assures us that he will have everybody do the required reporting um and then lastly I think you heard Mr Kurt say that um we would wave load requirements um so what do people do to try to get out of load requirements they try to get under the radar right but we say if you wave the load requirement and go to that site you're good so you don't have to worry about you know hitting your load requirement our current load requirement is 20 loads and for anybody who has horses 20 loads is not a lot you know so if every hauler can only collect 20 loads in a year where's the rest of it going we're setting ourselves up for a problem yeah so that's why yeah so that's why it would be best for a to be able to go to a regulated site where we know that we have regulated and um overseen haulers okay and I have one more question for you um so there's two proposed sites let's just say we we were going to entertain this I I I mean I'm just speaking for myself now I wouldn't entertain opening two right away I would only entertain opening one as a pilot um which one would be the preferred site for you um they're both great sites I know both people personally um I like the gues I think their site would be better um nothing against Mr trro but we've had some differences before and um I think his site would be great too that being said if you did approve both it would it's it's kind of a catch 22 because it would instead of everything going to one it could go to two it would still be coming to me in the end in the in the long run at The Farms but um me and Jeff had spoken about it and um it's really up to you in the town okay I just want to help me in the hall I just didn't know whether you had like a preference for one or further along a negotiation with one or whatever I just thought I'd throw that out there yeah okay there there is one point I want to mention to you before you go and that is that um the GU site operates a nursery um and livestock waste is organic material that is allowed at a nursery so I think that you know if we're picking a pilot site it's easier to get over that hurdle to it would be easier to get over a certain hurdle where's the nursery I'm looking at the aerial well we actually have someone here here yeah aiel can you show me where the plants are the Nur yeah also Jeff and Richard and several other staff members went out to the site to make sure okay so they're INR INR trees okay yeah yeah I um thank you you know we generated you called on me right I did call you yeah we generate it so I think it makes sense that we take care of it um the pilot I would put a shorter time on it and um I would do both sites because you don't know what's going to happen at either site I mean the owner of the site may say this ain't working for me you know I mean it ain't just all about money you know it's it's an opportunity but it's something different and that's why I think we're calling it a pilot and giving it a time to evaluate it and understand it and see the effects and uh yeah in the future you know I think it could be opened up more than our town but I do believe we need to take care of our town I think this is we generate a lot of poop yeah amen just real quickly with respect to the the time frame the the reason for the time frame is so that we could get an entire season in and have an opportunity to evaluate it um we're by the time everything gets worked out and he's able to uh to begin operations it's going to be the end of season the end of season and so want pick up next season next season and we and we get a whole uh whole concept as to how how everything works and and that was the reason for the dates and then uh with August 1 uh that's uh a potential for a transition to uh something else before the next season occurs well I'm hoping after that the town will see that we did the right thing and you made money off it and it was good for for everybody involved the hallers and the town so okay I don't I'm sorry but I don't recall I think it's philis Marge Laura but that's how we're go okay um so in 2012 we had a huge issue with manure because the hor show manure was coming here and there was a property on F road that had a mount he got paid to dump all that manure there and I'm sure that was the only mountain in our town I think it's our manure our responsibility I agree with Robert that I believe being it's a pilot program and even the owners of these properties are going to be new at this and these are going to be people that are new at working together that I believe that that's a better idea because one not only are is one place not going to get all the manure traffic so the manure traffic will be lessened divided between two places but I believe that you know if one fails we have the other so um and it may encourage both to work it out and keep it moving um I don't think our town is ever gonna have less manure I think our town is full of poop and it's G to keep coming um our we have a lot of vacant land and it's seems like Polo by the way has discovered lcks of Hatchy Groves and they normally have about 40 stalls so uh we have a huge Farm that's being built out off North Road at the moment and I believe they're going to have 80 stalls and they've got 60 Acres so um I'm really glad now I could tell you Justin will follow through because since 2012 or whenever you started doing this Justin was part of the videos the following the trucks and when they were not doing the right thing he was up there butts okay and he has been communicating with lahache to stop the dumping throughout town this is something he has I can honestly testify as being on this day since 2018 that he has chronically tried to get a transfer station in this town so I'm hoping that the equestrians this will trickle down and benefit you I'm not sure if we'll get a discount right away but if this works out we might have a later on it'll help everything from going up right and also it might stop the spreading we have a few folks in this town that have large commercial horse farms and they're leasing properties from their neighbors and spreading manure well Jeff brought up an interesting point and asked me if I would take it from private farms and I said yes if they bring it to me I would be open to taking it from them so obviously they have a cost issue but um hopefully we could stop with the pH phosphorus being dumped into our aquifer and uh just have them send it out to the sugar canes sugar loves it yes um I've had some calls from people uh concerning the smell associated with the stock of this in the uh the bins what's your experience um how far when it's wet obviously it smells more that's why we're going to keep it covered and on a slab okay um my goal is to clean it out most best most days the best I can don't get me wrong some days in season when it's busy there might be a few loads left but they'd be gone by the next day as far as flies I'm working with somebody now on something where there'll be no FES We can spray stuff around that won't let the flies really live or produce so um i' I've tried to cover all the bases how do you um prepare your bins so that the uh concrete I guess doesn't absorb uh the smell even when you empty it um well it's really porse and being that I'm going to be using heavy equipment I have to get commercial grade concrete so nothing will go through thr it okay all right um uh I believe that two sites eventually you know maybe not not to be I think two would be a good idea just because instead of all the trucks going to one I could tell like the big companies like me and Salvador and some of the other guys hey send half your loads to this one and half your loads to this one so neither one of them would be overloaded at any time well and and I believe that both sites are going to present its own problems of getting off of the property because okobi is so crowded wise I agree um I don't know whether you can have uh a regulation where you have somebody out there with a stop sign well that's why I agreed with the town that we wouldn't have the big trucks or little trucks coming in during the rush hour periods we would stay out of the way so you think it'll take care of itself just by and then like you said if there is a problem I have no problem hey let this truck pull out with a sign but I don't think it'll come to that okay um is there a less of a price for horse owners I think that question was asked already yeah because then they wouldn't be paying us haulers to show up with a loader in the dump truck if they load it in their own truck or dump trailer and bring it to us then they just have to pay to fee to get rid of it not us and how would you control unexpected uh people arriving with loads of manure I put it in my records and charge them and you make money and I send it out to the farm you don't think the volume would be I've done this before okay so I've had transfer station I had one in Wellington before the one that you all know about um you know so this isn't nothing new to me and the and the commercial haulers would have to have a an agreement with the town okay so they they do still have to come here and get their permit to haul yes it be a frch now I don't know if a private farm would have to do that but no yeah okay and um I'm I'm glad to see something like this finally coming I know Bill La had talked about it for years and years and years and you know he he had um another type of system uh that seem to be uh you know beneficial to the and don't get me wrong if something else comes up where a company builds a plant let's say like there's somebody here in the audience that wants to speak if they build a plant they're going to need the material and one thing about us if we can control the material we can help send it to their plant too besides the sugar cane Farms because I don't think right now anybody can build a plant that can keep up with the volume that season can produce right I I believe the uh process that Mr louder was talking about was more of a a liquid type thing with oh Anor robic digest made yeah exactly all right thank you thank you okay before before Laura before you go I need a motion to expend make a motion to extend the meeting Laura I okay so for staff um based on what we say tonight you digest more nouns and verbs and then bring it forward to resolution in March we can do that I think it's I I just want to make it clear and stated that the decision for this will be by whomever replaces Robert and I on the de so I just I think it's almost kind of unfair for us to say yes or no to proceed with discussion but that's you know if it's still discussion it's discussion that's one thing if it's resolution that's another so it's on the agenda tonight for discussion obviously it's a big item to discuss there are a couple of ways that we can go because we've done it before this is a pilot program which means that we're going to build rules that address how it should be um and we can enter into or you can direct us into prepare franchise agreements to be worked out and negotiated with the um hollers and the sites and we can work in tandem with our attorneys and their attorneys and bring them back based on the council giving us direction to proceed um and that would be entirely up to you all if you wanted to um you know have it ratified or rediscussed um I think it's only fair to whomever takes seats to and four to have their input before anything is official or more staff time is spent on this so um we already know who one of those right Council people is because it was unopposed and it would certainly be wonderful to sit down and discuss this with that person and I will tell you why not because I want to give Mr hickey any more props but she and I worked a lot on trying to tackle the holler issues in town and with Mr hickey's help I think we did um do pretty good to you know improve it so I agree with you on the other position I don't think we have any idea so I'd be willing to meet with each of those folks but you know I will do us we all will do as directed by Council yeah I I don't think we can wait another month to have another discussion because it's like the time of seasons ticking I mean I think the general consensus that I'm hearing here is that this is a good idea so I think that staff should move forward with the stuff but that we're not voting on it till March and that at that time those new council members would have the opportunity to give their input and and then effectively their discussion before a vote happens basically is is what I'm saying but I think to start ironing it out I don't think there's anything wrong with starting to iron it out but just direct step to wait an entire month before taking any action kind of gets rid of some prime poop time so it's what third 1830 and today's what the 2 so it's another 46 days pretty much half of season is gone I agree with Anita of course but I just I you know again it's I I just want to make sure that whomever takes these seats has input um I mean because I'm flat out against it so but you know again it just it's it's a group decision yeah okay thank you got it you're welcome I think there's another is there someone else that wanted to speak from the project Robert did you have a and we also have public comment we need to do Francine help me understand yes the franchise agreement because you mentioned with haulers with is this going to be a single point person single company that we have this franchise agreement with um kind of like we have with Coastal and then it's up to them to make it happen or this would be a non-exclusive it's non-exclusive so that means that we would have one with Mr hickey to operate you know the sites and then each of the haulers for instance he mentioned Salman which I know almost everybody uses um Salman would do a franchise and um let's see who else is in town git would do a franchise but they wouldn't be they would be their franchise would be just the same as their holler regist ation would be we would be using a franchise as the term to do the holler registration the Flor registration yeah well see the registration stations keep track of the loads and hickey's gonna pay us right the corre franchise fee correct that's my question a s Point person that yes Mr hickey and his staff or people on site would be doing the load tickets and then according to those regist ations that we have now which we would convert to franchise agreements um there's a Load Ticket reconciliation that shows they took it to Mr hickey he would be running it just like Solid Waste Authority are almost like Mr balisimo but by load not by pound all right did you have something to add to the discussion before we have public comment what I'm like would like to present is a New Concept that's very Innovative that has nothing to do with sort of the hauling aspect of it but a concept that might be an interesting thing for the future okay so um I can present now or you can open it to the public whatever you prefer um why don't we let if you don't mind let's go let's start with the legal matter of this presentation Town attorney Town staff Town Council this was put in as a discussion item number 15 on the February 4th 4 2025 agenda it reads discussion on livestock waste franchise agreement no documentation was provided to the public prior to this meeting at the town meeting there is a handout titled subject pilot program for livestock waste Transit operation at 2100b Road I put to you that you have not publicly noticed this properly you labeled it a discussion you have had a presentation I question to you whether this was done legally second the properties involved are Residential Properties 2100 B- Road for decades has operated what could be known as a light industrial property I'd love to tour their nursery tomorrow I've lived there in that area for decades I stopped in once oh maybe 20 years ago asked to buy look at some plants oh we don't have anything right now so definitely want to see the nursery they're not Bonafide AEG the other property came before pnz let's talk about your IV RV pilot program how many years has that been under review and in process let's talk about health and safety of the semi trucks on okachobee that all of us are having to drive by illegally Mr hickey says he lives on SE Road there's also a go truck now on sea Road a big semi-tractor trailer rig on a residential property how many of these people are going to say hey we can do this in lockah hatti grov and have our rigs sitting in lockah hatchee groves there are existing properties here that have and haulers who are piling manure on their property what has the town done about this you're not really providing Solutions the people here who are clapping yes they're in the industry these are their properties I don't think they're going to be honest with you about what they're doing so it will be up to the public to monitor this project but I really don't think you should have even been discussing it and having a full-blown illegal presentation without proper notice now you're probably going to cover yourselves and do it you know put it out there so people can come to you but this was totally inappropriate just for the record the law requires that the council publish that we publish I a council agenda which we did this was a discussion item and the reason that it was a discussion item was for transparency and the whole purpose of a discussion item is to get input from the council and from the public lisel Ry lisel Remy I I would like to Echo uh Virginia's concern about the public notice of this quote discussion and yes a lot of these people here I mean they they do a pretty shall I say shitty job unfortunately but uh that's that's part of the industry um and we appreciate that they do it um unfortunately the locations that have been uh put forward tonight are locations particularly B- Road north of which I am a resident uh the traffic concern I have of truck showing up it's uh not an easy property to get in and out of we're going to see a lot of uh traffic issues being able to access the the Northbound side of B- Road when that becomes a problem um I I think that the this being up for a discussion item and the town manager's explanation of of why this was being allowed tonight for quote public input when the majority of the people sitting in this room are actually industry people at this point is a bit of a of a misdirection so thank you next Denise Dita hi I'm reading a comment for Denise Dita on C Road she votes absolutely no for any more newer station Trans transer station on B Road that's her comment you can go into yours okay now I have my comment um Deja Vu first of all have we even looked at any of the neighbors to make sure there's no well heads or body of water yes we did and you actually talk to the neighbor to the North or did you actually see one cuz he has a nursery right there and he Waters his Nursery but just throwing it out there Mr Curts if you wish to answer that um to the north is a leachy farm um and our understanding is that the uh property owner and the property owner has spoken to them about this issue Mr bre Dr bre yes Mr Mr Good Jr is here okay he can confirm that's okay um but this was a no before and I agree with the other PE the other comments coming up you didn't have any public notice you had first of all two different items listed on the subject nobody knew about this there wasn't anything at 3:30 on this subject so the public can't even weigh in they just posted it on Facebook for people and they're like wow had no idea so I think it's disingenuous for you to make anything until the new Council comes on and then bring it back and have the discussion and move forward with paperwork or whatever but it's kind of like like you know approving something in the 11th hour so I would say you know wait till the new Council gets in whoever those are going to be okay we received another public comment from Sophia uh and she ask that I read it into the record on her behalf and she writes our town code reads that the community was created with the intention of self-determination to have the authority NE necessary to provide adequate and efficient Municipal services to its residents the first section of the code already acknowledges the towns close to the Agricultural and equestrian Industries waste removal is a municipal service and for an equestrian Community equestrian wa waste should also be included as a municipal priority and handled efficiently and affordably today the town's equestrian Community is on the mercy of Wellington companies and haulers due to lack of infrastructure to support the equestrian community in lockah hatchee today the agriculture in Bel Glade is worth one tenth of an agriculture acre in lahache groves what protects our community from Big developers tearing everything but simultaneously maintains and values our land are our horses without the infrastructure to support the equest and Community horses will leave land will decrease value and developers will seize and our peaceful land will become large buildings we should allow and encourage local businesses to operate in ways that favors our community welfare and future let's support lockah hatche Groves growth thank you thank you that's all for this item okay well we're at an inass aren't we thought we had clear Direction at the beginning but we don't seem to have clear Direction now would you like to give your presentation uh I think based on the just previous discussion this presentation is probably a bit premature okay um it's an Innovative product that we can take the manure waste and make renewable energy biochar and other products but I think based on what's Happening Here I think it's probably a little premature to discuss that right now okay yeah um motion to extend second all in favor I okay well I would say we're you want to do a consensus say Mar Robert you're you're feeling and Laura's definitely feeling like we shouldn't do this Robert you're feeling like we should wait to make any move in until the new council is in is that what I heard or or am I misinterpreting what you said no I said I think we need to take care of it and I think you need to start with two of them oh okay I agree so you think they should start taking a look at it at least and come forward with something for discuss for discussion and and that's properly noticed and all of that and the attorney needs to look at the ulc and land use and all that stuff so the instruction is to move forward but not take any action is that what here well we can't take any we need to move forward with to bring back forward with all the background stuff we need all the legal interpretations all notic and make sure and for goodness sake make sure the meeting's noticed with proper backup Jeff you're gonna have to do it a little faster next time okay does that make sense when when I get when I get the information I give it to you okay weeks for next do you have a consensus okay so as I understand the consensus just so everybody's clear clear the concept and these particular sites are acceptable and what you want to see is you want to see the the details Concepts acceptable and then we need to iron things out from there I didn't hear anybody say that but they couldn't work out a deal okay I have one question um being Miss ly's concerned with bad would they be able to have access off of okobi do they have that ability we can certainly talk to them about changing their access but yeah their access is off B Road I think you do have a small driveway off okobi no no well maybe you could look in and see if that could be a possibility okay oh know it's a question yeah you're right it's too close to the corner yeah you need more than 400 feet okay I think we covered that we going to number 16 and is this just in here for informational for us so that we can have a discussion about it next time this item went to RAC um and RAC is working on providing detailed input on this and also on the multi-purpose trails and we wanted to make sure that Council had it um so that we could be looking that you all and reca could be looking at it in tandem simultaneous all right so unless somebody has something compell say about it we can we can wait for our discussion oh we got some missing items in here what's missing page 396 the service level one and two roads falsom is it's missing and um it's identified on the map colorcoded as service level two I think yeah it's red which is level two so I'm not sure if it's supposed to be level one but it's not in the list of roadway classifications I always thought it was a one because it connect well even though it doesn't go directly to Southern it goes to Crestwood but I don't know that's missing it would be a county or state rug I was gonna say Bam's a county rug yes it is it's a county road is Beach County Road no it's not yes it is north of okobi it's a County Road not North not north of Ok Okay specified and then uh you're missing on this map West D and West B roads they're not on either of these maps on page 407 and [Music] 408 these Maps were generated as part of the classification system that's located in your comprehensive plan that's where these that's where these came from so that's where we copy same thing with the servos levels that are listed in here those came from yeah I didn't generate them they're in your existing compreh CL and um I mean since it came for rech I understand some of the comments now with some shs in there anybody else have anything that they were prepared to say now or they'd rather have time to digest this digestion I'm up for digestion too okay uh do we need to talk about the informational items or they're just here no we don't need to okay so then I'm ready for Town and staff comments Town manager I think it's important to put items on the agenda for discussion and in fact the equation that we've been following for the last year and we tried to do earlier than last year but we really got it organized this year our formula is discussion first reading second reading in many cases we've had discussion discussion discussion um but as much discussion as we need to have we need to have and when that discussion happens in public whether there's detailed backup provided if we have it or whether there is no backup provided the public discourse is always the most important thing that staff and elected officials can do with or without the audience here so um I am not going to stop putting items on the agenda even when we don't have the backup I would like to have when the issue is something that has a Time sensitivity and Council can always say we're not ready to discuss this and if you give us different direction we will follow that direction but we are trying to be as transparent as possible and I just want to make make sure that I said that because that formula has been working for us I do agree we have had some pilot programs that have not worked out well you know um and we have rushed into I think in some cases we have rushed into ordinances um that were not ready to be adopted just so that we could have something adopted I don't know whether six of one or half a dozen of another is better but I think constantly trying and moving forward and taking action is the best that we can all do so I just wanted to make sure we said that on the record second of all I was very disappointed with fpnl tonight because we worked very very hard to get um the um mediation for B Road North and we had that in Octo we had that I'm sorry in August of 2023 and it was provided to fpnl after we received it from our special Council so I was really disappointed with them tonight and it wasn't reflective of the positive relationship that we've had with them um ongoing recently and through the storm I also want to make everybody aware that we have a couple of meetings next week ulc has a meeting on Monday night and they are finalizing I believe the rural Vista guidelines um and then those will be coming back to the new Council additionally on Tuesday night we have a required um public input meeting on our multi-purpose Trails because we're applying for two grants we're applying for the TPA Grant again the transportation Alternatives Grant um we have a phone call with the county on Thursday to discuss it we're hoping that they would be our lap agency again our application will be abbreviated because prices have come up and um we are also applying we are also applying to the um State's Trails grant program so we have red gak engaged with us on that and there's a public meeting on Tuesday the 11th for public input and then on Wednesday night of next week there is um a PCB workshop and it was requested by the applicant um which is Bo Bo has not completed the full application process through the internal review so there is not a final document ready to go or product for voting ready to go to PCB but because they want to get PCB input as they have been trying to get you know the various Community input and so on that's why we said well you can have a PCB workshop and invite the public to come and speak there we have received um confirmation from three of the five PCB members that they will be in attendance and it's a non voting meeting so can we get somebody close the door that is the 12th and I know it's late and you don't want to hear a whole lot more I just wanted to make sure you knew about those meetings um in case you wanted to attend um and then finally um as we do have um one council person that has run unapposed um it seems like it would be reasonable to go ahead um you know and um for the town to pay for her to go to Palm Beach County days but I didn't want to do that without asking Council about it the p County days is are March 4th and 5th I believe and um the seating of the council is not obviously until March 18th so we need some direction on that it seems reasonable to me council member expressed an interest in going they have that's why I'm asking but I didn't even though it's within my spending Authority I didn't know what the you know sentiment was about the official seating on the 18th or not they're not even elected till March 11th so they're not an elected official they should not be paid or their trip to Tallahassee to be with the elected officials to meet with other elected officials no okay that's why I'm bringing it here to they'll have three years to go to Tallahasse I mean that uh it make sense to me that's my opinion no matter who it is I mean it just they're not elected yet why would town taxpayers okay pay we he your opinion Laura you had something to say I agree with what Robert saying um council member El Ry has been there before um she'll have plenty of opportunity to you know hang with all the Palm Beach people at other events you know and then she'll develop her own relationship with um Mr Pitman and ra so I say no okay phis you have an opinion or not um I'm I'm just gonna go with Lauren Robert at this point March I can see that um Lisa would bring a lot of um skills back with her a lot of connections that I'm sure she would would make um knowing how uh she had performed in the past so I would be in agreement to her going I I want to clar um the basically the only reason why I would be a no is because we have picked our budget to the Bone and um the town folks would be paying for a non-council member to be going on it would be an expense to the town I would say if she wants to go and pick up her own tab maybe yeah I because she was very good in Tallahasse and I enjoyed I enjoyed spending time with her and me was an asset it not to cut you off flat out the only reason why I'm not going to Tallahassee is because I'm no longer going to be be a council member you know so would somebody jump in my grave that fast I you know I didn't want to waste the town's money yeah you know I mean I could kind of see both sides of the coin I can see I can see what you guys are saying I can also see the benefit of she is going to be the council person she's the council El so establishing relationships you know getting them started 10 days before they officially start I mean I can see both sides of it but I'm not committed either way but it sounds like the consensus is no but it sounds like there's some room for if no the town won't pay her away but there I guess there's some room for if she wants to go because she is we've we have had private citizens go before yeah but you're the voice you are the we you're the there's still other Council people going I'm just saying we have had private citizens go before and the one year I went there were several private citizens that went so if she wants to go as a citizen or a council elect remember that oh yeah open to who went oh you but they took themselves they took them we paid for no I thought you with usxp the bill is what I said right cor so I think the consensus is no the tax should okay Town attorney anything to say um well I I guess this is the last official meeting of council members Shaw and danowski and so I would say it's been a pleasure working with the both of you and uh you know I hope you don't disappear I don't think either one of you will and look forward to seeing you in the future thank you Glen I would definitely Echo that and I think that we got a lot accomplished in these few years thank you we did Mr Gant short and sweet her oh she comes after after him exactly sure you see me behind the screen got you um just wanted to update on Hyde Park you know we're going through there and as we go through you know we don't you know all the residents seem to be happy with the progress that we're making um a lot of them as you heard one of the residents here tonight they're quite excited to see the final product um you know a lot of them have commented that you know they've actually they didn't think they would like it initially but they're actually like wow this is going to be really nice when it's all said and done uh we've already started you know cleaning out the pond um started clearing the banks removed all the all the stumps except for one which we're working on that one um we've started our way down towards the f Road um Canal so hopefully our plan is in the next within the next 30 days we'll have the majority of the groundwork done so we start moving on to other projects um throughout the town because as you we all know there's a list um you know now this will restore the drainage for all of these residents um because you know some of the horror stories I've heard from the residents of Hyde Park of rainy season their in their yards turn into lakes um so hopefully you know when we're done this will re alleviate that for for the residents of this neighborhood does that go down to the canal yeah goes to the afro canal and what's interesting is we talked to the today actually we we were speaking to the resident who live he he owns the property that's at the f Road Canal and he's been sort of maintaining that little ditch behind his property and he thought that prop that ditch was just his he was because it was so overgrown he was completely unaware that that ditch tied to hide Park and tied to that pond and all that stuff in there he had absolutely no idea because it was so overgrown and so the drainage goes behind it goes collecting Canal properties no well it goes between so if you go down High Park you have the pond and then if you go as you go around the circle and now it's clear you can clearly see that there's drove it tonight um if you look down there that goes from the East End of Hyde Park and goes straight to the f Road Canal and there's a straight path through those I see one pipe and it was coming north south yeah that's well so there's when it's done there's going to be three pipes so the one you saw that goes north south is there there'll be another one that goes east west across High Park and then as you go as you go down the road and it it goes to the right um there's another pipe that'll go in across right now we have it filled in U because we have to be able to track back and forth to remove all the trees and the debris and all the other stuff through there uh but when that's done there'll be another pipe that runs across that west side of the road seem very narrow yeah that'll all be fixed when it's done right now it's all stud okay okay Valerie thank you uh just to Echo um in my short period of time working here I've enjoyed working with both council members sha and danowski and um thank you for your support in my position as the town clerk um just a reminder that the town council meeting of March 4th has been rescheduled to March 18th um on March 18 is where we'll have the outgoing and incoming swearing ceremony uh and again reminder that election day is March 11th thank you thank you okay council member comments Phils for starting with you tonight um watching the news I guess now that our president lives on Palm Beach um there's a at least one municipality that is uh organizing ing a meeting to my knowledge with Palm Beach count uh the airport and I believe faac in Palm Beach County it's regarding they're complaining about the air traffic and um we've had residents in these Chambers on many occasions certain times of the year and certain years I haven't noticed it so much lately but it um about the air tra traffic because we are a direct route on Southern Boulevard and it seems that they just stay on Southern Boulevard and or they're flying over lock Hatchy Groves so I was hoping that you could find out when that meeting was and that we could go to represent Lo it is in February it's this month okay and uh we could send somebody to represent loah hatchee Grove so the other municip ality that's having a problem air traffic is not directed over us again on a regular basis we realize they have to spread it out but you know out to the north of us there's a lot of vacant land out there and uh I I'm I get it Southern Boulevard is like the direct path but um there's an increase in the military oh that's true because of the president as well yeah yeah so I just thought maybe we should be represented in that meeting that it yes thank you Miss mski nine years sure has gone by fast uh three years on the water Control District and six years in seat two and uh it's been a pleasure it's been education it's been a little bit of set your hair on fire every now and then but you know that's just part of the gig um I have to say that in like the last two years year and a half you know there's the mix of people on staff has just made such advancements for this town and for the residents and you know opening doors and trying to get things done for people and AC listening and you know applying Solutions didn't realize that when they take take you somewhere is a sheriff sending Bill to these guys when take him to the jail or no but ambulance rides c m yeah yeah well they booted everybody they took over Monopoly of it you didn't have no your insurance is supposed to pay insurance paid half of it they hit me up for the other half and I pay a lot of money for insurance but anyhow I um yeah dma write it off as a loss right but uh you're still alive what do you mean yeah I know I was paying by the mile I might have went to Paul West that's all take me to Welling to uh TPA Grant something I wanted to talk about tonight but one's unable to is that a new rule tonight the Americans sign these grants um people need to understand the difference between an appropriation and a grant you know there's many many differences the TPA Grant is a fixed amount period anything over and above that amount the town pays for it you know unlike you know we're a rural community so we get an appropriation from the state that say they give us a million for storm water in the past we had to show a matching million that okay you give us a million here's our million well when you're a Roy you don't have to show that matching you know that you had the money to to spend alongside their money so uh TPA Grant did not have Community Support um at the time that it was like take it or take it or leave it you know there was other money or other priorities to spend the money on you know and Paving was the biggie obviously now we've paved almost the whole grid $30 stes so you know whether this this grant I encourage people to is it next Tuesday what time is the meeting for the grant um I believe that the meeting for what time is it is it 6: PM I think it's 6 PM yeah are you gonna be posting anything for the review on the website or something or is just um I think it is posted on the website okay yeah awesome please pay attention to it understand if you support it come out and support it if you don't come out and express your views because that was one of the uh items in the Grant application that um you kind of might have been true one year like we talked earlier you know seats change priorities change Visions change but you know when it came time to get the money and obviously Co just totally whacked out the prices I mean it was it was unbelievable to change compared to the the budget so now it's a fresh budget it should be good I don't know if they're going to give us all of it or not but uh if if you choose to learn it understand it but understand that it's not just because you're a rural community the TPA pays a fixed amount based on the day you apply and the day they say this is how much we're going to give you for the project so it's not a freebie um yeah the way the consent agenda hand is handled is embarrassing it's totally transparent I need make a motion to extend the meeting second I I hope the next people that come on you treat them a little bit different a little bit more respect and allow them to discuss items on consent um that you the public comment is not even there so it's it's just wild that uh that attitude is here that you know don't don't even listen to any kind of feedback on it so but like Laura said six years what a Learning lesson you know highs lows and everything in between I believe God put me here back then it was a Code Enforcement issue and that's how I ended up here I think that may be how Phil it up here you know just one of those things that you know I never strive to be you know on Counsel or be a mayor and it just happens and uh but uh it it was uh a lot of met a lot of great people and uh really really proud of the things that we've got done because we really just became a town that year that neita was on Council first time and they merged The District in a town so before that it was two completely different entities that were elected two completely different ways with the proxies and everything so that was the first year we my opinion became a town we've really come a long long way since then so really really uh thankful for the opportunity and that's it thank you I am here okay um I enjoyed looking at the future agenda lists and seeing how many people do how many things I mean it's Jeff you better not go to bed too early you have a lot of stuff on on that list um uh the manure uh hauling um is going on on a-road I I mentioned it during u a meeting with h Jeff and friend so the big 18 wheelers that there they're um taking the manure out of garbage trucks and putting into the 18 wheelers they're chewing up the road as they try to turn in and out of the property that they're they're using to load their manure so having a controlled site I welcome I welcome it um the other thing that um I'm concerned about is that um since 2016 um there has been no consideration of raising the stien attx or whatever we get uh for showing up and the amount of work and the number of meetings that were expected to attend um I would like uh an exploration of uh an ordinance to raise the salary for um the mayor who you have so many extra things now the grants and everything else that you're signing uh in addition to all doesn't take all in addition to all of the um the reading uh to the kids uh the meetings with um other officials and so forth so um I would would like to have the staff come back and see what the uh Fair cost of living uh assessment for Council Members should be okay that it that's it okay I think we probably covered that with the chart of review let the chart of review people decide whether that should be part of that um so I just want to say thank you because a lot of the decisions we make up here are very difficult decisions um and as usual the town is usually split pretty much 5050 is what I see but I just want to thank the people who took the time to text and email me today um to really help me uh make the decisions that I made tonight um and you know there was overwhelming support for the hotel over the assisted living facility so that made that a pretty easy decision um and I fully recognize that this town is governed by the people who live in the town um and that we are just their proxies we're just here because they elected us to represent their wishes and uh I'm proud to be in a position to be able to do that for the citizens
