your commentary until we have our discussion on that um in the agenda and that will be agenda item number 20 uh specifically 20 and 21 so if you will hold your commentary um from public commentary and if you make your comments for agenda item number 20 or 21 this time we have uh Jor Parker good morning everyone um a couple of weeks ago I had asked about the timers on the entrance is are they going to be on timers or not do we do we know that yet okay thank you thank you uh Mr Rich Walker good morning uh Rich Walker 1106 Michigan Avenue um very short Suite um Veterans Day was yesterday and I appreciate you sir for your service I sometimes don't appreciate our government because of their disservice however veterans should be recognized and uh a lot of them have paid the cost of it I don't know of anybody getting up and saying anything about them however thank you sir for your service thank you sir for your service as a commissioner thank you Glenda Butler good morning uh mine is regarding the um the traffic itself so we have what about 21,000 people in lyh Haven about 20,9 75 do not follow the laws they are the Speeders they are the people who don't stop at stop signs so we have a big issue some of the um excuses that I have had for people not stopping at stop signs is they don't see it or one of them said I saw it um or I can't read um so we have multiple excuses why I have been I was told previously that when there was an event that was going to be going on at kinol Park that there would be law enforcement out there has there no I was told that there was going to be linh Haven uh officers out there to monitor the park Incognito has there been no our officers are given uh leniency they give leniency or their own discretion on what it is that they consider to be breaking the law that's not right um so we either obey the law or they don't obey the law I had a police officer yesterday on Fifth Avenue in Montana who almost ran into somebody he stopped in the middle of the intersection only because he saw another car come up on on Montana so it's everybody so when we let these people get away with this now they are running stop lights these machines are deadly weapons and we have to respect them and we're not doing that and it's not just the cars it's the golf carts so something needs to be done about it thank you all right thank you right moving on to the mayor's report uh just a couple of things or maybe maybe three things one uh thank you to um those who were able to attend the regrain opening of Walmart um it was a good festive time there on uh Friday before our pre-commission meeting to uh go out and celebrate with them the uh the renovations that they been able to make to their store um so the reorganization of it now you actually have to sort of look at the signs to see where you're supposed to go as they've reorganized a lot of things in there um but also just seeing uh them as a a strong Community partner um as they've helped with disaster relief uh backpack giveaways back to school functions and so they are uh although they're an international brand I think they do a good job of trying to connect with the local uh Community as well and even talking with the store manager they have over 300 employees at that particular location and so that's impacting 300 plus lives and families um in our local community as well so um good festive time there um yesterday Veterans Day thank you to um all of our veterans for your service uh commissioner wart commissioner pebles um thank you all for your your service and for all the veterans that are are here and that are listening online um thank you for your your service I know typically um ly Haven we opt to uh join in with the county and Callaway for their uh parades I believe I was notified that the County's parade was cancelled on yesterday um due to um weather and so um we host the 4th of July and they come and join with us on that and they host um the Veterans Day and we go and join with them um on that on that as well and uh just ask that you continue to send your thoughts and prayers to uh throughout our community um we've had a couple of uh tragedies um that have occurred here recently um so just continue to pray for the families impacted uh went to a a sort of a memorial Gathering or or prayer gathering for um student at North Bay Haven um on Saturday evening and so just continue to pray for that for that family um as they work through uh those transitions of change that is my report commissioner peoples thank you mayor I've past few months have had fun going out to watch the Fall Ball um and I just wanted to say that they're doing a great job out there specifically want to say thank you for the umpires because I know uh it can be difficult for them sometimes with passionate parents and and fans and stuff they're doing a great job um there's actually an Umpire out there that that I saw that used to be the Umpire when I was like eight or nine years old um playing ball out there so that's really cool to see um shout out out to you Don and uh so good job to the umpires and Justin and your team for putting on a a great job um someone was asking me about baseball and softball and how it's doing in L Haven I was like man when I was younger we had just the linh Haven Rec Center had just been built and then K Griffin had one park now we have Kane Griffin with multiple ball fields that are full and then we have the rec center with multiple ball fields they're all full every single time I go and uh so Len Haven Sports is thriving so that's a testament to Justin and your team and city manager and staff and the umpires volunteers as coaches my daughter wants to play so we'll see if if I volunteer as a coach I don't know no promises yet but thinking about it um also want to say happy Veterans Day to all of you that have served uh commissioner work um Mr Walker Mr Ferris Mr Oxley anybody else has not served oh Mr Hines back there good to see you sir uh anybody else that served if I if if you haven't if you've served I want to know so we can talk about you know our stories and and all that so if I didn't uh say your name I apologize but I want to get to know you um you know uh I appreciate your service and uh and for all that you've done and continue to do and uh that's my report thank you commissioner perno thank you mayor um wish everybody a post happy Veterans Day um I think commissioner Vandergriff and I attended the the ceremony from Lin Haven Elementary last week and it was kind of set the tone it was very emotional very uh amazing what the what the children did that day and the parents the audience they did it outside and uh it was it was last Thursday and it was just uh it was quite an event so you think that's small potato stuff but it moves you man it was really really amazing so that just went straight into everything so um uh that that's it a hearty thank you to everybody thank you to our Our First Responders uh thank you to our city staff and uh um that's my report all right thank you commissioner Ward yes so I know it's already been said but um thank you to all veterans that made us uh great sacrifices to our country country uh to make us the best country on this planet it's uh it's a great day to remember them so I hope everyone had a great Veterans Day um for November December um I don't I normally do a time with a commissioner every month um I won't do it for November December because of the holidays however if you ever want to sit down and talk with me give me a thing I had uh I wasn't able to bring this up at the pre-commission meeting because it went kind of long but I know at the pre-commission meeting before that I had brought up about the city clerk position and I know commissioner vandagriff you said you needed some more time um wondering if the next meeting will give you enough time for us to discuss it uh at the next commission meeting we'll discuss it during pre-commission and go from there all right and that's all I had thank you all right commissioner benig I appreciate Miss Butler's um comments about speeding and not obeying the laws and I have mixed feelings because you know when this personal responsibility kick in I'm also guilty of sometimes not paying attention and maybe going over the speed limit but you know it's time for us all to take personal responsibility for obeying these laws and um being considerate of other people uh we can't legislate everything uh we do we can monitor but we can't legislate good behavior um yes I also went to the Veterans Day celebration with commissioner perno what it did for me was that it renewed My Hope in the Young Generation that hopefully they can maintain that that patriotism it was also as he stated a very moving um program um I compliment ly Haven for stepping out and doing something like that I also want to thank Mr peoples Mr wer came up and thanked Mr perno I mean Mr War but I also want to thank Mr peoples because he also is a veteran and uh I want to thank him for his service along with Mr Ward for their service and helping to protect our country that's all thank you thank you uh city manager yes any questions on the warrant list thank you so uh picky backing off of commissioner Peebles uh in our our brand tournaments uh softball baseball basketball so we started something to kind of briany Haven um and we're going to uh Justin actually started this the 444 tournaments which is 32444 that Brands our specific tournaments that are unique to um uh the city and it zip code so we're going to have um next Wednesday we plan to hold a youth 444 softball tournament on November 16th and then we're having a t a toys for tots 444 pickleball tournament November 30th at the sports complex it's $20 um our unwrap gift um for the team entry uh we're working with to toys to tots to try to get as many toys as possible then we're going to have a toys TT's um adult softball tournament December 7th at the sports complex uh we ask that J to bring uh a $10 unwrapped toy uh for team entry we also have another month left of registration but we are close to being full for the the youth volley ball that was the hit last year and uh many uh parents and youth Al like ask us to bring that back uh The Old City Hall clock has finally arrived and we're pretty excited about it actually they're working on it this week and um hopefully we will be able to hear some sounds coming from Old City Hall very very soon that's pretty exciting uh just a couple of numbers from the Fire Department chief Johnson's area there they attended 11 community events in October they went on 90 fire inspections that's 4.5 a day 165 hours of training by the department and they had a total of2 calls two of those were fires 142 were EMS calls four were hazardous materials 25 service calls nine good intent calls and 10 false alarms so thank you for doing a great job of taking care of our City Christmas tree lighting December 3rd here at chield Park at 6 from 6:00 to 8:00 p.m. Christmas Parade December 7th at 9 a.m. Winter Wonderland this Saturday November 15 from 9 to 3 p.m. we have over 140 vendors that's probably the most we've had since we've been putting on winter wonderland so please come out in attend and support the vendors that are there and we've just been dealing with lots of cod enforcement issues uh but I think that our code enforcement officers are handling those very very well in terms of the uh entrance sign yes there is a timer there but right now we do not have the internet connection we actually have to go there at night to turn it off so we're working to try to get that fixed but they are they are LED lights that um last uh I think it's like 13 years or Works director clarifying that cost of installation inspection te testing and maintenance shall be born by the customer repealing all ordinance or parts of ordinances in Conflict providing for cability and providing an immediately effective date all right um is there any questions regarding this again it's just really as City attorney mentioned just us really upd to make sure we're in compliance with State Statute and the the state regulations regarding this is there any more input you have on that City attorney no I will just add that there is a cross control connection program that we will be presenting to you for adoption by resolution um once you adopt this revised ordinance future meeting all right thank you uh number 17 discussion of possible approval to authorize a city manager to sign the task order with panhan engineering and the amount of $85,000 for the aine parkway stormw improvements project good morning yes sir this is just the Aberdine uh Crossing project that was part of the stormw master plan uh from 2019 this project had been submitted for hmgp funding that did not uh qualify it was submitted for a couple of other grants that we didn't get any funding for uh we put the money in the budget this year to design this and once we have the construction cost we will bring it back hopefully in F FAL year 26 to be able to construct this is just to design and permit all right there an additional questions for Mr lot about this all right is there a motion for this motion to approve I'll second right motion by commissioner perno second by commissioner Peebles comments from the public Jody Moore on amher Street um and this does relate to item number 17 um I know that everybody up here got copies of Marco's book um Vicki and um Miss Judy additional public commentary yes [Music] sir it's not public commentary it's just a question um Bay County just passed a ctax okay and in that cerx thing it mentioned storm water it's the first time I've seen it in the ctax the original C tax which goes back 10 20 years the only thing accomplished out of that c tax was the purchase of a barbecue for the school $250,000 I want to know I would like to know is any of the C tax money that is going to be given to Bay County on the C tax going to be used for our storm water in the future don't understand now this is coming out of our pocket is any of the ctax money going to be devoted from ctax to stor water for us thank you yes sir the ctax was first approved back in 2016 for a 10-year term it was set to sunset in 2026 and as you all know I'm sure that it just recently was renewed uh for another 10year term from 2026 to 2036 and that money is for throughout Bay County for roadways storm water improvements Water and Sewer improvements sidewalks Etc uh the city has spent a number um of of dollars over the past what eight years now in half cent uh projects uh roadway Paving sidewalks um storm water projects and we will continue to do so um in the future as that money rolls in all right additional comments from the public right see man if you call the vote commissioner perno yes commissioner pebles yes commissioner Ward yes commissioner vandagriff yes may Nelson yes motion passed discussion and possible approval to purchase and install an additional census antenna base station for the city's Ami meter project to core in Maine in the amount of $2,260 yes sir and as we continue to grow our Ami meter system we will need this redundant antenna in case our initial antenna goes down or has issues and this also expands our capabilities throughout the city we are currently at approximately 3,300 radio read meters and our goal by the end of this fiscal year in September is to hit 5,000 um and then bring something to the commission for fiscal year 26 budgeting to complete our Ami meters and and be 100% on the radio read program right is there a motion for this a motion to approve second motion by commissioner peble the language in regards to like balance budget because that's something that's already required um doing particular assessments as needed um and there are some other notes that um other revisions that we notated with that um as well is everyone comfortable with those revisions right so um since this document does not have the revisions in it if we make a motion I would ask that you would includ in the motion with the revisions um that we notated um is there a motion for for this I'll motion for with the condition that the revisions are added is there a second second all right motion by commissioner pebl second by commissioner Vander gri comments from the public Mr Walker I honestly didn't listen to the meeting on Friday so I don't know what the revisions are so I would appreciate them being read out um but I do want to say that I think the finance committee is very important I never know when the meetings are but I think a lot of uh light has been Shed from this finance committee um from reading the minutes I think there's a lot that can be told by that um the mayor promised transparency when he were in for office last time and I think this is something that has uh benefited the community there's a the you know being Debbie Downer I guess but you know that it's true the city is in a lot of debt there's lawsuit coming up the Dale Coler one was pretty horrific um there's this the people need to know where their money is going and I think that that's always a good thing to be you know more open than than closed so again I'd like to hear what the revisions are but whatever brings transparency is a good thing I just stated the revisions which is the fact that this says you supposed to the committee's primary objective is to make sure the city has a balanced budget that's a state statute you can't submit a budget to the state without having a balanced budget and also okay will the committee continue as it is and have the addition of balancing the budget they don't have to balance the budget the budget cannot be submitted without it being balanced okay all right thank you all right additional comments yes sir the uh finance committee debt committee has been bounced around like a rubber ball in tennis game um finally settled down too and I attended one of the last meetings and I've read the perspective that you've outlined in this new revision to this finance committee and extension I noticed one thing in the meeting that I went to there was only two members present from the citizens appointed and I I questioned that because they had to make a vote they had to make decisions that deals with the finance there's only two of them there then I questioned it and I was told that two members have been added to it and they are employees one is the city manager one is the finance officer they make decisions my question is this in the new group that you have there they're on that board that make 7 + two no the five 5 + two excuse me 5 plus two and my question is this they are voting members they are employees the city manager and the finance director don't vote that y'all do vote that is my answer to the question they do not vote thank you very much no all right so um stand corrected in the previous meetings I attended the city manager and the finance director did not vote um but per this document they can vote as part because they are members of the committee so there's seven total members you have to have at least four there in order to have a quorum and so they serve as those other two that were absent all right additional comments right well I have a comment um I just want the citizens to know that each one of us appoint a citizen to serve on these committees so I would hope that there would be more than two people there next time there were actually three your new one and then the other two were there along with um Finance director and myself which made a total of five well I just wanted to make it clear that we have appointed someone as a representative from each one of us and we would hope that there'd be more than two attend next time and and with the boards the same uh Missing meetings and being removed and replaced supplies to the various boards and committees as well just like we have rules that you can miss so many excused unexcused and and be replaced so um you know and follow up with the person that you appointed to see if they are still interested in serving um as we're renewing this someone may or may not be interested in serving again for another term so you may follow up with them to see if they're still interested in serving and mayor mayor add that uh the majority of time that the U members do attend they either attend they can attend virtu virtually um and so we do give that option when they're out of town to do that as well right additional comments right s call the vote commissioner parno pees excuse me commissioner peoples yes commissioner uh Vandergriff yes commissioner perno yes uh commissioner W yes mayor Nelson yes motion passed agenda item number 20 discussion and possible approval to REM to remove the speed bumps in m Highland Commissioners perno and wart commissioner wart so after the pre-commission meeting um I did quite a bit of research on speed bumps and how other municipalities uh do traffic cing and um I actually found that what our policy has as far as the concept or the procedure is pretty similar and the vast majority of other uh municipalities with the exception of some of the the numbers and requirements and variables that I'll discuss but normally there's initiation in most municipalities I see that there's either require just one person ours requires five people I've seen some that require a certain percentage of people in that um that neighborhood um that seems to be pretty standard and then once they get that they put out uh something to measure um dat to get data as far as the traffic in that area and then once they get that data it normally goes to some type of committee or government agency such as their own traffic department or engineering department and um and the way they they look at it that can vary from municipality um for instance we have most of them look at the 85th percentile and as far as how how much over the speed they have to be before they can start looking at speed humps um there's some other ones that have like points you get so many points depending on how many miles per hour they go over the speed limit or if there's any traffic accidents that happened in the past if they're so close to a school um if there's so much volume the more volume they get the more score that they get so I've seen different variations of that and then there's a petition where once they they make the recommendation a petition goes out and whoever does the initial complaint for it uh they go out and and then that varies by municipality so that municipalities require at least 50% of the people that live there to get a petition ours requires 85% which isn't unusual um or I'm sorry 90% which isn't unusual I've seen others 85% I've seen variation in that I've seen some stipulate how many have to be for it um before they can approve approve a speed hump and then um that goes to their commission or counsel um for a decision so the steps are usually pretty similar but I was hoping to see in other municipalities if they talked about speed bumps and I only found three um U pretty much two of them said we don't do speed bumps one said well we don't do speed bumps another one said we don't do speed bumps and they um had an explanation of why because there's a vast difference in speed of the residential neighborhood versus how much you have to slow down to a speed bump and then there was a third one that talked about some study back in 95 um that one probably needed to have some updates to it and then um it finally hit me um I know we're talking about the pre-commission meeting and the City attorney Amy Meers have brought up because we are discussing well we don't have any procedures as far as uh how you install speed bumps or when you install speed bumps and you mentioned we would have to go under the Department of Transportation requirements and so I looked that up and actually there is a manual for that it's called the manual uniform minimum standards for design construction and maintenance for streets and highways um that we're supposed to buy by by Florida statute and chapter 15 talks about traffic calming so I went in and I I read it and when I read it there's actually a section that talks about inappropriate traffic caling treatments and under it it says speed bumps and it says speed bumps shall not be used on public streets and I think that's the answer to our question of why it's not in our traffic safety policy and procedures because it's not a viable option in the State of Florida for public streets so after looking at all that I was like well that makes total sense so with all that being said I'd like to make a motion to remove the speed bumps cuz they're not legal they could open us up to a lawsuit and I would recom with the caveat that this goes back to the traffic Comming committee for them to relook at this and come back to the commission for a recommendation that's my motion now if you notice in 21 it talks about doing an additional study so that would I know I understand that right so I guess what you're wanting us to do and I'm not disagreeing with you I'm just trying to get clarity on the motion because the second part of the motion goes into number 21 right and as I was talking about before there's I think looking at this and after comparing it to other municipalities I don't if we want to rewrite some of this I don't think there's a whole lot that we need to rewrite there might be some modifications correct I understand and I think we already have policy and procedures that we we already have that I think are sufficient we just need to follow it so my question is with your motion that goes into number 21 so then we would need to remove number 21 then cuz motion is for number 21 is to basically do another traffic study or if it's approved to do another traffic study and then they follow through on what's in the policy and bringing it to us Etc so that's what I'm asking I'm not saying your motion is wrong but just trying to get clarity because the caveat actually goes into number 21 so I I can amend my motion to remove the speed bumps and then just make my motion to the second one if that's all right yes okay so I make the motion amend my motion to remove the speed bumps right there's a motion by commissioner wart to remove the speed bumps is there a second for this second right is there uh further discussion from the commission you know several individuals came and asked for help in Mt islands with the speeding issue so when we first discussed this at the pre meting we thought we were doing something that would help the situation or to give it some time to see if it benefited the situation uh We've listened to the citizens and apparently it is not helped the situation made it worse so that's why we all agreed to readdress this now again I need to re restate my opinion about personal responsibility um it's time for the citizens of our city to take personal responsibility and follow the law um that's all I have to say on that topic all right anything commissioner pees well commissioner Vandergriff kind of just said what I was going to say so so yeah I do appreciate um everyone being willing to listen and those of you coming forward and uh you know bringing your concerns to the commission and I think this is a a good example of teamwork among the city and the and the citizens to to talk together and figure out what's best so that's all I have all right any comments from the public I know there were some that were on uh the list uh Gary Oxley morning mayor Commissioners thank you for your service uh I live in mow Highlands 14 104 in verness Road and I did send an email and I invited you all to come out and I know mayor you live there Jamie you live there to come out and drive over these things and then share your experience so those two questions I have what did you think of those speed bumps another thing I'd like to bring up is if you drive by wind Dixie the Dollar Tree do those speed bumps you roll over the speed bumps ours they set you up and slam back down I got a broken hip every time I go over that speed bump it sends a jarring jolt right through my car into my hip and I'm not the only one I know there's others with the same issue it hurts okay I have to go in and out several times a week for medical and it's just a pain every time I got to go over this I knew we need speed controls I understand I agree there have been speeders in our neighborhood so I'm not opposed to speed controls but the other concern I have we didn't get a single notification on these they just appeared I didn't get a text we didn't get an email we got back we'd been out of town for a while there it was and I hit it hard really hard and not speeding but just I didn't know they were there so I just we get texts and emails for notifications all the time City events road closures boil water notices so I would just ask that you improve this communication process you know let the residents know something's going to happen in your neighborhood before it happens and you know I think we can all work together and we've had two meetings they're very good meetings we appreciate mayor that you holding those and having the discussions I think a lot of good information has been brought out but let's before we act let's at least give the citizens a notification that this is going to occur not that we can stop but at least we can be aware thank you again and thanks to all the veterans I'm proud to serve with you thank you thank you Austin Austin here yes name is Austin Andrews I live at 2000 Southerland Road in M Highlands and I just want to say I support the Commission in removal of the speed bumps I do not see that they have improved traffic flow that they have improved the speeding and I'm very much in favor of removal thank you uh kieren morning um my name is Karen zador I live on 1403 in Road good morning I never done this so bear with me uh I would like to share some information shared with me from some of the more Highland residents during the collection of uh 341 signatures regarding the current speed bumps it was brought to my attention that several residents have metal conditions that are compound by our speed bumps one residents experienced a very discomfort doing having a feeding tube others have kidneys issue with re which requires them to travel weekly to for treatment the bumps cause only more pain each time the travel travels to or from the hospital for his visit L say has several residents have chronic back pain and that increases even driving over these bumps while these while these may seem like only a few they deserve a better solution a quality of life in our neighborhood thank you right thank you Maggie 1507 done it Court yes um I'm also with you guys on removing it uh I have severe back pains and issues so when those spumps appeared like we said we've all said they just came out of nowhere we weren't aware that they were coming up we'd seen the the strips for the studies but never knew the results um so we're with you on removing them um and curious as to what the step is after they get removed how soon will they be removed and then what what do we do next do we have to go back to the drawing board to figure something else out or are we starting from scratch right thank you and Mr matol from 1507 done it Court okay not speaking all right awesome all right additional comments city manager if you call the vote mayor can I just say one thing before we do a vote I I forgot I was supposed to do this I know you had that town hall in here I don't remember what day it was but I guess I'm supposed to disclose this that I came to the town hall that the mayor had um my my plan was just to sit in the back not say anything and just observe but I did get up and say a couple things I think one of them was a question as far as uh the petition as far as how many you needed and I mentioned that 90% you had to get at least 90% of the neighborhood which was determined by the Safety Committee and um but it didn't say like how many need to say yes or or was against and then there's another question about you know HOAs we're not an HOA but how do how that complicates this whole thing and and someone had brought up well why can't we decide that and we talked about the difference between private and pro public roads so um I guess the question for the City attorney since I was there is that all I need to do is disclose that or if you're trying to cure a Sunshine Law violation yes you need to disclose the substance of the conversation and the comments that were made yes so unless I miss something but all right seeand if you call the votee commissioner Ward does that mean yeah yes commissioner perno yes commissioner peoples yes commissioner V yes mayor Nelson uh in light of what commissioner Ward just mentioned since I did host the meetings and since he attended didn't realize at the time that this would come to a vote um so I'm recusing myself from voting on this agenda item right motion passed do I need to recuse myself no okay all right moving on to agenda item number 21 discussion of possible approval to implement a new speed study in M Hollands at the beginning of 2025 commissioner perno okay um in our pre meeting we discussed um the situation and we talked about um the actual the feedback we got and uh the course of the um of of the study of the the data and the the action um was to say that the you know the speed bumps were to remain in place and we all agreed that from what we were hearing from the residents they needed to be removed so but in order to complete a study that we started is now to go to is to go back after things are removed and to go ahead and and study the traffic again to see if what was put in place deterred or cured the the the issue at hand so um our discussion was to just go ahead and get the get the speed bumps removed and now complete the study so um if I'm not if I'm if I'm not out a line um we're not exactly implementing a new speed study but we're we're completing the study by by implementing it by by going forward with more with the follow-up speed study after removal right is that correct yes so I just wanted to explain that and and so in in Mo Highlands at the beginning it says at the beginning of 2025 but um that that's just giving giving everyone that participates the amount of time and they need to to accumulate data again and so forth and it doesn't mean that we don't want to continue to hear from yall we really want to know because a lot of the emails we got were Tak out the speed bumps but put in speed humps but we're we're we're we're going to come back at at everybody with more data and then a decision will be made in the future so um and and I know that I'm for that I'm you know I was we we definitely heard the voices of the people and we we we want to make it right so um as far as it's worded um I would go ahead and I would go ahead and move that we we proceed along this path but I'll I'll let any further discussion go before we make a motion so right any other input I know we discussed this on Friday I I think we already got policy and procedures for everything that needs to be done I think those policy and procedures just need to be followed that's what we're doing so we're going to do another study is that what you're that's the course of action right we already did the study and then you remove and and when you do a study you remove the the you you put in place the speed bumps and then you follow it back up with another study that's the that's the course of action and Bobby explained this always always occurred that's protocol does that say that in the safety policy procedures that's been the history of every time we've it it's not in the policy but it is procedure we've done in the past so it's not just to see if it corrected it's not a this thing no so then I guess commissioner W the question would be if we remove the speed bumps and following that course of action even as of this morning we still received complaints about speeding in MO Highlands then we would now be saying either as commissioner commissioner perno is say following up with another speed study or basically conducting a new speed study based on the complaints that we've received um so if we're in some sense I think as you've been asking us to do start the process back over basically starting from step one again so yes it would be step one but then again following with the commissioner per because if if the study it yes we could look at it as starting over from step one because if the study comes back and gives us whatever the data is and that's what our followup is is whatever the data says and then we go from there is that what you're saying commissioner per just start from step one you you can a new speed study is that's that's all that's all I want to see is the followup so it's it's basically what what we've done previously I mean I was at the meeting you were at the meeting is the man spoke and whenever you put speed bumps in or you you or speed humps you take them out and then you do another study that's what he's doing I guess I'm confused because I don't understand why we have this cuz what you're talking about doesn't cover it in the traffic safety policy procedure I just want to listen to the people and move but do you want to do another study or not I I don't have a problem doing another study but if I'd like to make the motion that we do another study motion by commissioner perno is there a second second um another study second by commissioner bagri is there continued discussion from the commission so starting from scratch okay so that's what I want to make sure I understand so we're doing another study so we're going to start the process from scratch and follow the traffic safety policy and procedures that are already set in place so how do you outline that what is your understanding of what's in what is your understanding of what should be done are you speaking to me no I'm sorry commissioner War so you know in the policy there's initiation so you have to have someone that initially complains about it you got to get five signatures and then you do the study which is what we're discussing and then once you do the study then it goes to the Traffic Safety Committee right they do their recommendation the recommendation whatever recommendation they do then there's a petition process so they got a whoever the initial complaint is responsible do go out and get enough petitions for the neighborhood which I believe in here says 90% if I remember right and then they come back with that petion and the recommendation comes to the city commission and then we discuss it and we either accept it or reject it that's the process good manager the commission can also direct us to do a study they they have done that in the past as as well right yeah so with that said um if there are some areas that even the city itself can initiate and then bring to the city so either way the S City uh commission can direct us to do another study before you go through the process or the city can do a study before you go through the process I don't have an issue doing another collecting more more data again I just want to make sure if we're going to collect more data are we going to follow the policy and procedures that in place that's all I'm I want to make sure once we do the study we'll bring it back to the city commission okay thank you all right any further discussion from the commission no I think that clears it up for me right any comments from the public yes ma'am morning my name is Brenda Roberts I live at 2006 Andrews Road in lowood Highlands um I'm still a little confused here about this um measurement Whenever you set in a process a new process you collect data before you implement the process and then you collect data afterwards to determine whether or not the process is effective um commissioner perno on your recommendation uh correct me if I'm wrong but it sounds like you want to collect the data after the speed bumps have been removed is that my understanding is correct that is correct that is that's the process that they have used in the past they put them in they do the study they put them in take them out and then they study you just said that yourself no no no no no you are removing the process the Improvement you are removing the Improvement and then collecting the data to be effective and I'm not sure why you would collect data after the speed bumps were removed unless if the goal of the speed bumps is to not to um slow down the traffic right then and there it's to basically would you say punish so we're removing the speed bumps because we were notified at 341 people signed a petition and asked us to remove them however we also received after those petitions individuals who asked us who who stated there are still a speeding concern so we're we're looking at two different issues so we're not we're not blending those together so it's two different issues so we did number one which was remove the speed bump so that has been done now we're doing number two so you can look at it in two different ways either a new study based on complaints or you can look at it is a followup to commissioner perel's process so there's two ways of looking at it but we're still proposing to collect data is what we're looking to do because of the situation correct correct but yet let's be clear then that we have not collected data while the speed bumps are in place to determine if those speed bumps we could not collect data because again you all have come with petitions asking us to remove the speed bumps so before collecting the data we're going to collect the data by January we were asked to remove the speed speed bumps before then which we have done so in essence the process has been circumvented for what it normally would probably be so this is not the process we said hey let's the city did not say hey let's remove the speed bumps or staff did not recommend let's remove the speed bumps and then let's go back and do the study so we're following what the citizens have requested so now we're having to adjust what would normally probably be the process I understand what you're saying we're having to adjust what would normally possibly be the process um in order to try to mitigate um citizen concern with the issue so then this new speed or the new um speeding study basically has nothing to do with the speed bumps that were already in place and going to be removed just you're just repeating it again to see if we still have a problem maybe it was just an isolated event that there were Speeders and now we've got new complaints or continued complaints that the speed bumps aren't effective corre and again it's like were the Speeders on those streets or were they on other streets that's what the study will show us so again um those thank you that's your time thank you additional [Music] comments there was another commissioner present I'm recusing myself from voting on this um motion pass right moving on to number 22 discussion about allowing alcohol at private special events uh commissioner VRI thank you I brought this to the commission um uh in the pre meeting for a discussion I had several individuals approach me about the desire for to be allowed to have alcohol at private events in the city for example one wanted to have a wedding at the Garden Center and surf champagne but they're not allowed another person wanted to have like a October Fest celebration on one of our streets and have of course October Fest would be bear and they were not allowed to do so so they asked me to bring it forward to the pre-commission meeting I did I gave them some advanced notice told them that I would be discussing it uh at the next pre-commission meeting for them to give this some consideration and Go Out Among the citizens and find out whether or not our citizens were opposed or accept would accept the this proposal um it's been discussed at length at the pre commission meeting um that if this were allowed that we would have very strict guidelines and uh we discussed with our attorney you know the liabilities and uh of course right now all we're simply doing is discussing it and um like like I said if this was to come about it would be with very strict guidelines Commissioners right is there any further discussion um yeah I think like we talked about Friday um the biggest thing is liability of the city and is it going to cost the city any money so as long as it doesn't cost the city any money doesn't um you know unnecessary liability of the city I mean mean I don't see a problem with it all right any other discussion do want to bring up that the in a a previous commission that I was part of voted to not have alcohol in our Parks yes this is not a proposal for any City activities would this be would this be private entity that would then sell tickets to the public it would be yes private so so it's private but is it private public well the specifics have not be a promoter and then they would turn sell tickets to the public thus making it a public event privately run that'd be the whole point of having something like an October Fest to draw people to linh Haven right any other discussion I guess uh my discussion would be um that I would my I'm speaking to myself here too but to go back and look at those meeting minutes from when was it like 2019 it was um to kind of see what you know people had concerns about um and also you know like you said we're just discussing it so now is anybody in the public that has for or against you know um you can look in the agenda packet that we have and there's a a proposal of an ordinance potential ordinance maybe you don't like that maybe you do like that give us some feedback it's a discussion phase I'm I'm all ears from if that's so are you right asking citizens to write an ordinance to submit to us no I'm just asking you can talk to us okay I'm encouraging you to talk to us you know so um whether that's citizens staff whatever I want to hear from everybody cuz I want to you know make sure I'm getting I don't want this to be a Sam people's making a a vote based on what Sam Peebles feels I want uh I want to know the consensus if this ever comes forward to a vote or whatever in
