to hear comments from the members of the public on matters other than those items on tonight's agenda agenda are there any members of the public that wish to make any comments no sir seeing oh sorry seeing none I close this part of the meeting I'm going to go by the the game plan here on onto correspondence and bills for review do we have any noie dokie all right the next uh agenda on our uh the next item on our agenda is application ba 324 and Chick-fil-A uh for completeness is there anybody here for the applicant okay that's a negative so I guess we'll hear from our professionals to go over their report and this is just for completeness for tonight so I guess Bill we go with you first thank you Mr chairman I submitted my report dat of July 3rd to the board everyone should should have a copy I in that report I found the application to be uh incomplete for eight deficiencies in required checklist items in addition to those eight deficiencies the applicant requested waivers from 16 other items I can I can go over the U the eight items of deficiency if you like specifically item number two regarding U the the actual application form they did not provide the copy of the proposed notice item 18 names of property owners within 200 fet not complete or provided because they they did not provide us with the owners in pany adjacent to the project item 24 track boundary lines are not provided item 40 dimensions of parking and loading spaces not provided item 41 widths of traffic AIS is not provided item 45 elevations of the proposed canopy are not provided item 54 sign details not provided and item 63 steep slope map not in accordance with required ordinance section 13 5.9g that's all the the actual deficiencies there's no one here from the applicant to provide us with testimony on the waiver so we can't I can't make any comments on those okay thank you Bill to be clear on that so those items of deficiency they didn't request waivers on them they just didn't provide the information provide incorrect cor correct now they may come back and and ask for those wers that's fine at this point they stand in complete great thank you anybody else have any questions professional okay okay thank you Mr chair um so I have my letter is dated July 18th I'm GNA just skip over um whatever uh Bill already covered um one thing that I had raised which I would have liked to have heard from the applicant was has to do with the tax Lots uh and numbers because it's always been uh consistently both lots that are part of Cole shopping center have been part of their application um and they're just doing it for one I understand why they're all of their work is confined to just lot one but I just wasn't sure if if perhaps for consistency sake they should include lot three right so um that's maybe a question for our attorney as well but I can we can follow up um the other additional thing I had um with item number 18 had to do with the 200 fo track B boundary um I know this is something that's come up in the past the list they have is from January of 2024 and I don't know sometimes the board is requested that you people move or I don't know you know that they get a more updated list that's something that the board can determine I mean because I guess right now we're going on a list that is eight months old right so that might be something that the board would like to request in order for it to be deemed complete and and they have to get it from pony anyway sure just say since they have to do that part they might as well get an updated list yeah okay um then I obviously put the number wrong I think or maybe I just put it out of order but the Zone districts and identification of the Zone boundaries on that cover page of the engineering plans the zones are all wrong um which is they should just clean it up because it's it's got everything around it being in the office business district complet this it well the zoning districts an identification of Zone boundaries located on joining properties so wrong then it's not will not have right right so they need to clean up that and then I think I think everything else um are you know pretty consistent you know with what Bill said there things that they requested WS on I would recommend in two instances just for um you know for the record I guess is that they they asked for a waiver from elevations and I think Bill and I both said you know that's fine the building is nothing's happening to the building but we'd like to see what this canopy is going to look like um and then uh the other thing had to do with signage because as far as I understand they're not changing any signage on the existing building but drive-throughs have a lot of signage and so I think the board may want to look at that and see where it is and what it looks like and um so that was something that they had also requested a waiver from that's item 57 oh no wait a minute sorry I took the x item 54 so I know I skipped around a little bit but out of curiosity number one Advocate has not provided a draft public notice right right so that's what um Bill had mentioned that and we do ask that they do that you know they obviously leave the date okay you sometimes they leave that open but we usually ask that they um they provide that it's pretty so obviously this has been shared with them I'm just will they you think they'll be reaching out to you between now and it's possible sometimes what happens is their attorney will reach out to the board's attorney okay depending and then he'll maybe reach out to one of us if needed I or You might who knows go but you they'll get their they'll get their determination tonight that they're in complete they already know from the reports so I assume they come back with with the revised application and address the the items we have at this point as I said I'm not prepared to make any recommendations all the way because I want to hear what the specifically is it for that they're doing the application yes the application before us is to take the drive-thru which is two lanes that converts into converges into one around the building and keep two lanes to go all the way around okay so that will allow it to be instead of zippering in right it'll go around the back and they have to come to the zoning board because they need a variance to do that it's a I believe it's a minor sight Improvement the way my understanding is I think what they came to this board initially for the application and so the zoning board retains jurisdiction they they need to get site plan minor site plan approval okay and they're coming to this board because it's a change to the original plan it it it yes I guess but it's it's just not ex I believe the ver verage it's a minor what what said the jurisdiction stays with approval D understand and it was initially a zoning board I mean not that you care this is too much information but it was because they needed a floor area ratio which is variance which is a d variance which can only be heard by the zoning board got it so that's how it started they live here all right appreciate thank you any other
