empty condos and I understand that they've already problems with parties and Etc uh you know here in the township um well one of my questions I I had um one question and then uh well two questions actually I was a little bit confused I did read the ordinance um about the part with advertising uh I'm assuming people if you adopted this people could advertise on Airbnb or whatever platform they wanted is that correct I I didn't quite understand okay and then my other question is our condo community and I assume many of them have its own rules and regulations about short-term rentals and our says that um no lease less than six months um would the township ordinance take precedence over that or um I don't know I guess that's a legal question but but what's the answer to that did we know that yeah our our ordinance would would supersede oh so so even though the condo complex has its own rules and regulations the two We Rule well I mean ours would be ours would be less than so meaning if we had a greater than then the condo would would supersede ours but since ours would be less ours would only be two weeks no but the condos condo session saying they can't rent for less than six months six months so they wouldn't be up to rent six months would be the rule six months would be the rule if that's your condo rule H has Authority oh okay wanted to know okay sorry I was confused potentially your H is not impacted by this ordinance at all oh okay yeah know it wouldn't be yeah but I'm I'm still concerned I just don't think it's a good decision and I think that um you know people in other communities who have a lot of Airbnb people in an hour you know we have good proximity to the city we have you know the train right here um I'm just concerned I my answer is because the sixth month doesn't violate our two weeks so the sixth month isn't isn't in violation of our two weeks so the six month would still stand if it was the reverse if we had six months and they had four then it would be there could be an issue but because it doesn't conflict with ours it's okay and Noel Noel could I ask you a question sure so are you're aware that we reduced it to two weeks it's not what's posted on the website it's not six months it's two weeks yes it was updated on the website the revised version the reved version on the website yeah I was aware that so the people that you've spoken to who are away for down in Florida or wherever for the winter time uh they're gone from more than two weeks right so they could still rent their place under this ordinance but not their HOA isoh no no no I I understand people outside her HOA that she knows that her away in Florida um well the idea is those people are are transient if you go with Airbnb and you say that you know you can rent for two weeks um you know the two week person can go and another person come you know we rent our place in Florida so I'm I'm familiar with but you could rent for more than two weeks the the limitation is less than two weeks right so I I I think we just want to understand I think there's we just want make sure you understand that currently they can advertise and they can rent for a day if they like day after day there's no currently there's no other than your HOA and what other maybe the currently within the township there is no regulation corre yeah but I would like to see it longer than two weeks myself longer than two weeks yeah not less than two weeks no oh okay yeah she's in favor of the ordinance but you're in favor of the ordinance or you're against the ordinance she's in favor of favor of the original ORD the the way I understand it you came in with the ordinance and it said six months or something and then you discussed it last meeting and you changed it to two weeks correct yes correct okay I don't approve of the two weeks I think it should be longer you're okay six months I'm I'm okay with six months which is what your Raa which is yeah so so they're covered netherton Terrace in moris Township um I want to Echo Noel's uh concerns with the two weeks um from a different perspective not from a condo perspective but you know when people I think buy into these neighborhoods they want um a stable residential environment um and when you've got people that are able to rent out for two weeks at a time that's not necessarily what you're getting um and what I'm particularly concerned about is you read story story about corporations coming in buying up residential you know single family homes and rent them out and now if we have two week limits that they can rent them out on then you might end up living in a transient neighborhood you know not a stable neighborhood so uh I think I'm with you six six months would be okay two weeks is too short that's my opinion thank you what was your name again Kathy Shack uh Paul Geller 60 redner um also under an HOA I just learned about this yesterday at our community board meeting there was talk about it and I would Echo the same comments but a couple of other points is we're we're not really a vacation destination people don't come here a lot of people leave for the win people don't come here for the winter so it's not like you're going to rent it out for six months for people to come here and go skiing and things that's like Northern New York and Vermont New Hampshire or out west so I think the it should be equable across the town between HOA and regular Standalone residences I think it should be the same amount of time for the matters that these other people have mentioned safety security um longer term residents rather than people coming in and out um it happens in more resort areas like Las Vegas and things where people do come in and buy like 10 units in a building and they run it as a business and it's no longer a hotel or an apartment building it's their little business and I don't think that's what we want our town to be where it becomes like corporate housing or executive housing things like that and it it could turn into something that you don't want and didn't anticipate and then it's hard for you to reverse it so I think if you made it six months across the board for the whole town then people could still utilize their property in the winter if they want for that extended time but it couldn't turn into like a um what's the word like a transient turnover constant turning over like it is at the Jersey Shore in the summer that's also a resort area not here so thank you for allowing the comments thank you for your comments Lee Goldberg 10 Arrowhead Road um saw this on the agenda for tonight it was curious about just a couple of things so appreciate the time um and within the ordinance itself IT addresses things like this is meant to prevent public nuisance health and safety noise poor maintenance of the property um deao Hotel motels um boarding houses other commercial entities um has this been a problem int are there examples where there's been incidents of complaints or issues I mean is this a why I mean it's just as as a 30-year resident I mean it gets hard to know everything that's going in on in town all the time it's a big town but just curious as to what we're addressing here we did get a report from Chief Sher about um certain location one or two that there were complaints and that those were more short-term rentals for parties so there have been concerns about it but again it's not townwide it's okay so for one or two locations based on what happened at those one or two locations we're now sort of delving into new policy because of has been sustained over years was isolated I'm just trying to get a sense of why th why this why now I don't yeah earlier than there there have been a number of complaints and most of them are noise and those kinds of things we've had some more serious complaints but that the police have had to address um for the past five or six years in reference to short-term rentals that are like weekends and they became you know party houses and party destinations and large groups of people and disturbing the neighbors and things like that there not as many complaints as there used to be but there was a significant issue several years ago with the police department on one property so because of a significant issue several years ago on one property now but they're continuing I mean we they are continuing continue to get complaints and are there police reports filed with that or yes there is there is and is do we have any sense of numbers on that like 40 complaints over the last year I I don't have that information front of me don't have that information okay thank you um and then I guess my next question is you know this is a new initiative this is new policy typically you know I'm just curious is this a collective um unified uh concern on the township Committee of the township committee members was any one particular Township Committee Member is that your particular initiative or how did this what's the Genesis of this other than you know one or two incidents at a particular property over the past couple of years no and any of the committee members can jump in but I think it was more that it was an issue that came up and we were trying to look at it and decide is it something that we should consider or not um that's why last month we did want to hear what the public had to say because admittedly sometimes we have discussions but we too want to find out is it's something that we're not hearing about as much um so that was really unless any other Committee Member wants to in but should should we do it during you know discussion you want to do it now or should we close public portion and then have a discussion we still have virtual comments but I can as you're inquiring it's public knowledge that I opposeed the ordinance and gave us I gave remarks last month and I I will repeat those tonight you'll repeat those tonight later I was not aware of that what's oh okay during there'll be discussion up here there'll be a discussion amongst us okay thank you and then um in terms of looking at just neighboring communities around us in terms of Madison chadam get the local surrounding communities I'm not sure if they have similar ordinances on the books or not but in just going on Airbnb and just doing a search for the local area I mean towns like Livingston Milburn Summit Boot and Handover Harding New Vernon Bernville marown chattam Township Chester Berkeley Heights all seem to allow you know one two night rental so I'm just curious what's going on here in mors Township where it looks like some of the language and the ordinance I mean to me it seems a little uh big brothery it seems to be getting involved with you know defining what a traditional family you know looks a housekeeping unit I mean it's just straying into an area where we've never strayed before and just just generally concerned about why the need why now and again just hearing that you know one or two incidents at one property several years ago that is incorrect that's not what I said um well okay so num I said there was a number of complaints I didn't say one or two I thought I'm not putting words in your I thought I heard May time I've been here it was just more recent one or two times since in the summer there were one or two that seemed to have more incidents than any place else but Jared you that language comes from a court case which which is an exception that we have to have in this ordinance so that that language actually comes right out of right out of a court case house keeping Union so it's not we're trying to look into it just it was found there there was certain there was certain um geez I'm trying to remember which case it was but I can get it for you but there was a case and the court found that you need that kind of magic language to make it constitutional okay and then my last question is should this ordinance pass what is the uh process and procedure for enforcement so if it's at 14 days you can't rent under 14 days but someone out there says you know what I'll list it for 21 days and you know I guess write a contract and maybe the person will only stay nine days I mean what's the enforcement of something like this look like in terms of the extra work and time and attention for a problem that doesn't appear to be systemic or widespread on Township resources how do you follow up how do you enforce it zoning office will enforce it the zoning office will enforce it okay in the ordinance or the ordinance all right thank you thank you good evening hi I'm Steve Wheatley 12 nton Terrace I just had a follow-up question to what I've been hearing I mean I personally would probably go more to a year we've had a couple rental in our neighborhood we don't have the HOA deeds and all that stuff to block it they've been perfectly pretty good we had a little issue with one in our neighborhood folks uh worked worked with I think the city to help with that question I have is we started sounds like in the last meeting at 6 months and somehow dropped to 14 days what was the logic from going to six months to 14 days as opposed to four months 3 months two months I mean that's that's a it's it's not an overnight rental in a motel but it's certainly quite different from six months I frankly would be more more in line of a year um just based on our neighborhood watching people out have rented year two years at a time I understand condos maybe six months if you're vacationing if you're going to Florida for the six months or something like that but 14 days is is a huge step from six months um and I was just curious if one could explain why the township committee went from six months to 14 days kind of I won't say arbitrary but over the course of a meeting so Deputy Mayor do you want to because I know yeah I so I I made the amendment uh from the six months and we we had some discussion up here on the de and there was some concern that six months was too long and given that we currently have no ordinance right now so one night is okay uh I I felt that 6 months was too long you know it would completely preclude most people from renting at all and so we we scaled it back and we had some discussion up here about what would be appropriate and I just through our 14 days uh because I thought that was a reasonable amount of time so somebody couldn't do you know multiple short stays um it was it was a longer stay maybe maybe we should do a month I don't know but we we landed on 14 days because we all felt that 6 months was was too long as an initial starting point for the ordinance I also think that there was some discussion that if you limit it to two weeks you're taking vacations out of it because most people you know vacations are typically two weeks so I think the idea was to eliminate people coming in for vacations yeah I think the the adder I would to put to that with the number of corporations that we're bringing into the into the certainly into Morristown and into the area I would be a little bit more concerned about short-term rental for um I know when I first moved out here I was in a short-term for 78 months to get to get to a house I can't imagine having people um you know coming in for a corporate job or something trying to bounce around for two weeks so um I think the two weeks is clearly a vacation destination or something or or relatively short as six months may be too long but um I think I personally go toward six months um and see how it fits but okay yeah I also think that the concerns raised aren't raised on those corporate long-term seven eight month rental those people are coming in to live and work I think the more concern of the shorter term where they're coming in to throw a weekend party and create noise in neighborhoods it it does happen I mean you know it does have where people have people have a really nice backyard in their summer and they and they and a pool and it's happened in in some communities where they've been rented out just for the weekend they come with a bunch of people they create a lot of noise in the backyard for a pool and we thought that that's why I think the I'm not saying that you know this committee can vote however they like but I think that was the logic around short because we don't think that those mod moderate rentals would create those kind of problems of noise because those if you're working a job you're busy and you're living your life I don't think that was the issue that this committee had with the short-term rental but I don't want to speak for again I I would tend to word six months over because I've seen that work we've had plenty of people come in in our neighborhood not plenty but a number of renters over the since we've been here 30 years that have been in and six months would work we well 14 months would be a nightmare thank you thank you thank you we have one hand raised on Zoom Mr O'Reilly we have two now hi Hi how are you okay how are you good just wanted to express my uh support for Noel Robinson's questions thank you oh 50 Independence Way thank you Mr o thank you Kathy Wilson hi are you there yes go ahead um yeah Kathy Wilson 20 Beachwood um I missed a good chunk of the beginning of the meeting but it's my impression from what I have heard that I may have a little bit of a different perspective that I've heard expressed so far um I do have one question about the ordinance um itself which um had to do with the section 47-4 on permitted uses um I'm assuming maybe um uh Mr caner can answer this as I I find this language in there to be pretty confusing as I read it what it says to me is that if you if you own a property it's okay to allow people to live on in your property for less than 14 days as long as these people are your house guests right and my question there is what's to prevent someone from doing a short-term rental and simply declaring the renters to be their house guests feels like a loophole to me that you know people who um are abusing this privilege um may take advantage of I'd like to know it says without consideration so if you having somebody stay and you were calling them a guest and they weren't really a guest but you weren't charging them money that you know that would defeat probably the purpose of having a short-term rental if you weren't charging rent but it's it's the without consideration part of that ordinance so that's what the without consideration is supposed to clarify well I mean if somebody's staying with you and you're not charging them rent they're a guest and we we we can't really stop Constitution people from having guests in their house okay I I think that language needs revision and I think uh I think it should be uh revised and corrected to make it more clear um I also feel like there's like there are people in our town who have a legitimate interest in perhaps very occasionally renting their property on a short-term basis I'm thinking especially of the World Cup and the 250e anniversary coming up I can see a situation where some residents um may want to rent their property on a short-term basis and with no problems at all and I think there's a need I see a need to balance that interest with the problems that are addressed in the ordinance um this ordinance feels to me like it's too broad and it feels to me like you're sort of punishing everyone for the actions of a few um I would favor a more targeted approach one that would strike a balance between the legitimate interest some people might have in doing a short-term rental and the legitimate interest residents have to keep their home safe from noise and disruption from Neighbors and I will say also there's plenty of problems that already exist with noise and disruptions that have nothing to do with shortterm rentals so that to me is another consideration um I would encourage you to go back to the board and um consider the options that might allow you to strike a better balance between everyone's needs and interests um for example I do see a difference between condos and houses and I kind of came in partway through the answer on HOAs I can see there being a place for HOAs to regulate short-term rentals I I think that may already be the case but that's not entirely clear to me um I I I what I would like to see is I can understand a need to establish an ordinance that regulate short-term rentals but I'd like to see it more targeted um in ways that balance everybody's needs and interests um and I would encourage you to go back to the drawing board and tailor your ordinance to match more directly with the problems you're trying to address and the interests that I think it's important to preserve uh thank you that's it thank you seeing no other members of the public public wishing to speak will someone make a motion to close public comment May Che all in favor first right we have a first is there a second can I provide my comments before there's a second that's required no is there a second I'm going to Second it may I provide my comments yes thank you mayor and thank you for everyone who came out tonight uh to talk about this ordinance and thank you to everyone who's joining virtually um I'll just State again um I oppose the ordinance as introduced and as amended um I fully support hoa's rights to determine their own future in terms of the regulations on short-term leases um however knowing that we have not had anything on the books over the past decade since Airbnb has been popularized and vbo has been popularized I don't think any of our neighborhoods have become transient uh since these uh opportunities have been given to folks in my six years on the committee I've not once heard a resident approach me with concerns about short-term leasing nor have I have I received feedback from our employees on this um I'd question the amount of noise complaints that we're receiving from short-term leases versus the complaints we get for permanent residents uh if we are concerned about short-term leases then we should be working to bolster our controls of it not ban them alog together there's towns across New Jersey that have short-term lease registration requirements that take application fees they take input from the host families to know who's going to be there how many folks are going to be there and when um as we all know we're living in an affordability crisis and I think last year last week's election prove that to everyone who questioned that the American people are having trouble making ends meet people in Mars Township are having trouble make ends meet uh this crisis is hurting young people working families and fixed people on fixed incomes alike as a lifelong resident I'm troubled by the fact that folks I grew up with can't afford to live here and raise a family here anymore even if you're lucky enough to own a home in the township I know there are many families who are finding it tough to make to pay their mortgage bills or they're just stuck renting their houses because they can't afford to buy one restricting homeowners rights to offer their homes for short-term leas leases to me sends the wrong message it hurts young families it hurts working working families and it hurts those uh who are on fixed incomes we know Mars Township is not a vacation destination so why shouldn't our residents be able to offer their homes for a few days for those who are here for family members being treated at the hospital or for those who will be visiting the Red Bulls facility in our town um why shouldn't we let them be able to help pay for their mortgage their medical bills or their groceries um again I think uh I I oppose the ordinance I would oppose any controls on this right as of now I think we should be bolstering our registration or creating establishing a registration process so we know where people are actually providing short-term leases um I would include language about any lodging fees that we actually could put on um I did check previous Airbnb receipts and there are um local fees I've seen on some rece that I've been on they weren't in New Jersey but I'm wondering if we can actually get Revenue to pay for the control pay for the uh the zoning officers for this um but I think we should have a robust registration process um and I think we should do everything we can to fill the gaps in terms of enforcement um I will say this um being a young employee in the city I worked in DC um with many friends from college it was normal for us to rent out a room or two when we're away or when not all of us were away to pay the rent I mean we're at histo people are getting my age are getting paid historically low amount for an incredibly High Cost of Living uh mortgage rates are skyh High student loan debt is burdening basically my entire generation and if you're lucky enough to have a house in New Jersey to say you can't rent it out for a weekend while you're away to try to pay pay the bills I mean daycare bills are a second mortgage on people so you have two working parents who then have to pay another mortgage to have daycare for their kid and we're going to tell them now you can't get another couple hundred dollars for a weekend or maybe the two weeks are our way for the summer uh to me this is just an unfair burden uh I don't think we should be getting involved in people's homes this way I think it's an overreach and I uh I urge my colleagues to support the resending this ordinance thank you any other discussion Deputy Mayor Gill H thank you um I have a number of points I'd like to make but before I forget I'll I'll start with one of Mr jy's uh final points and and thank you Mark for for your comments appreciate that um you know for the people like you mentioned that working down in TC or working here in mortown who might need a room this doesn't affect them because if they're working here they're staying for more than two weeks they can somebody can rent their home no you're you're Miss it's when they leave they rent out their own room to pay the rent so if I'm working when they leave where they leave their home if they're going for a work trip they'll rent out their room I'm not saying people are renting here to work their work's paying for that what room I'm not I'm not clear what room you're referring to a room in a home yeah that's normal that's a common so you're talking about subletting then subletting a rent it's not subet that's a shortterm lease like this is normal like people in Hoboken they go away or some people have houses in Jersey City one room is dedicated to an Airbnb to help pay the rent okay very good that's very normal and I'm not saying like that's just that's where we are right now because the cost of living is so high okay um so I have a couple points I'd like to make first you this came to us because we had recommendations from our professionals right we take usually take our recommendation from our professionals very seriously in in this municipality and we had a recommendation that recommendation then went to the legislative committee which approved the ordinance for bringing it to the township committee and it got here so it went through two levels of approvals already um so I'm not sure what happened between it getting out of legislative committee and how it got here what happened to the interpretation of what it was intended to do um but it got here for those two very important reasons it it made it through you know two two levels of uh uh of of our process here um third I wanted to point out that in moris Township is significant portion of our budget relies on Hotel taxes and airbnbs are definitely growing in popularity uh it's if you look at the trend of people staying in airbnbs it just continues to go up and it will continue to go up because in often cases they undercut the price of a hotel and so one of my concerns is that we're going to be seeing decreasing revenues from hotels if the Airbnb Trend continues and we rely on that for our budget so we might have negatively imp our budget by not taking this under control um third uh fourth uh Mr JY brought this up about applying ATT tax to short-term rentals that would balance out any loss of revenue from a hotel so if that's an opportunity to do and layer that in um then that's something we should do to alleviate my concern about lost revenues from the hotel so we can look into that and then the last thing is I have some anecdotal evidence from the trip I just came back from from La so we rented a a room and it was a studio because it was closest to where our friends were and we stayed in a house that clearly was a new newly constructed house it clearly had built three rental units in the basement there were three doors Unit A B and C our room was a studio it was just really a room there was no stove there was no dishwasher it had a refrigerator and a microwave in a toaster oven so you could sort of cook um but it wasn't a living unit per se as we might have on our books here right we don't allow accessory dwelling units in homes so they might have that same thing out in Los Angeles it wasn't technically an accessory dwelling unit because it had no stove and it had no dishwasher um but it was being rented out for a period of 10 days they had three of these units and the house was specifically built for that so it was also brought up that developers or investors are now going into the Airbnb business and Building Homes just for rental income and we have to be concerned about that and it might not be an issue now and we could wait till it's an issue or we could sort of you know wrap our hands around it right now and and try to get a hold of it um but I think all of these things are going to be growing uh in the future and putting pressure on our municipality and yeah maybe people aren't coming here for vacation but if they come here for 5 days at a time and homes are rented out like that I don't I don't think that's what our residents want and we heard tonight that people want not even want two weeks they want six months so I think we need something on the books doing nothing I don't think is is the right answer as we've heard from our residents they want more uh so what the right balance is is is it one month or two months but I don't think it's zero I ju I just don't think it's zero any any other discussion just real quickly I I I think I want to Echo what uh committee M jori had said he said it really eloquently I I'm of the same mind that he is I think that this is not a widespread problem at the moment I don't I think that this was more of a um solution to a problem that wasn't something that was over overly concerning at the moment based on how widespread this is um to commit um Jeff's U point that we need to do something resending this ordinance doesn't mean that it's dead forever what it means is that you we're going to take a good hard look at what ordinances are on the books you know what kind of nuisances are are are being um reported to the police and what we can do without stifling what a homeowner can and can't do with his or her home and I think that's really the overriding thing in my mind is is the overreach from the municipality into telling you what you can do with your homes uh but if there's something that be does become a problem U there something like this might come back in at some future date Deputy Mayor graell we we thank you for your comments um we already do tell people what they can and can't do their homes we have zoning ordinances that restrict certain things that people can and can't do and one of those restrictions is you can't have an accessory dwelling unit it's part of our zoning roles so we already are telling people what they can and cannot do and if you know if you go that way you could take it all the way to the other side of allowing people to put in stoves and dishwashers in multiple units in their houses seriously we're not talking that I I'm asking what you're talking about then because you don't want to restrict people from I don't want to restrict people from saying that you know as Mr jorie had said that they need to rent out a room that they couldn't do it for a short period of time to a border or whatnot I don't think that there's there's an issue that the town is having that's wide spread that that warrants an ordinance of of this magnitude as I said it's not to say that sometime down the road there's going to be needing a solution to a problem but right now I don't know if we're there yet and this is a little bit to say that you know who's to say I think one of the the res one of the comments today was how do you enforce this and you know the uh the answer was the zoning officer but how does the zoning officer know who is in what room at what time and whether there's renumeration so to another point I think that Kathy Wilson made uh we need to take a a good a better look at this and and see what the downstream ramifications would be of of any ordinance like this to see whether it's it's beneficial to the town and to the residents I would just like to say Jeff I totally agree with concerns about corporate you know private entities buying purchasing homes we are but we we do already have that in Mars Township with long-term rentals so let's make that clear too we already have private entities buying homes to rent permanently so I agree it's already happening you're saying that's yes yeah it is so I I totally agree and um but again I don't think we're at the point right clearly we need I think more public input I think clearly we need to come up with a better solution that's more comprehensive to to to come up with an agreement moving forward which is why I'm you know offering our resending the ordinance now because I don't think this should pass as is so I have one last comment okay and I'll be done that's okay thanks I'm glad we're building on each other's comments I appreciate that so just one of the thing you know when one of the reasons housing prices are so high and there are a lot of factors to it but one of the reasons housing prices are growing up is because corporations are buying up homes and it's Supply demand and there's less inventory because corporations are buying up homes if we want to say that Morris Township is off limits to corporations buying up homes this is one way to do it if we want to restrict people from corporations buying up houses in our town and starting to do this this is a great thing to have on the books to tell them go somewhere else not in our town thank you you so at this time I feel that um this ordinance was brought up it did make it here but I think the motion on the floor to resend it we've had discussion and I think at this time uh Madame clerk I would ask for a roll call jump in I I just want so so to this committee even if you voted down the motion to resend then you would still have the opportunity to vote down the ordinance when it was moved to be adopted so so you're currently voting to resend it you're not voting on the actual ordinance it may be cleaner legally to take a vote on the ordinance so the motion is on the floor though so what so then what do resend mean versus I mean I would I would prefer the governing body to to uh to to move on to have the motion to to to actually you already had the public hearing um the public hearing is closed on the ordinance I think it' be cleaner I'd like I'd like to make that goad okay I'm just throwing out another option mayor given the discussion that we've had here which I think has been very healthy and productive perhaps we just table it till December and give us all a little more time Mr Mr ravit said he wanted to think more about what the appropriate approach should be so maybe that's another option of just waiting till December so what I'd like what I'd like to do is to um put forth a u the idea that we just completely withdraw this historically and we do not know when they will come back to normal now is not the time to be approving the allocation of our precious Water Resources to another Community from the information provided me I am still not comfortable that our own water utility s C mua has the Water Resources to build out all the affordable houses housing that are going to be required in the four member communities that comprise our water utility and for members of the public uh to understand the SMC mua comprises Morse Township mors toown moris Plains and Hanover um so I'm not sure we have enough resources to for our own use let alone neighboring communities that are seeking to build out a house development on our backs I had previously suggested that we allow Harding to contract directly with pic Valley Water Commission and have our own water utility act simply as a pass through I would be agreeable to this but I am not agreeable to giving away our precious water resources that our own Community might need in the coming years in addition it is my understanding that currently SMC SMC mua on certain days takes as much as 30% of our water needs from pic Valley Water Authority this shows that they don't have water on a regular basis to supply our own member communities so I do not see how we can allow Harding to take our own water and exacerbate that issue so I am voting no on the resolution but I am also proposing an alternative that we see Harding to contract directly with the pic Valley Water Authority and then allow m C mua to act as a pass through entity so I ask the governing body to turn down this request from Harding currently as currently formulated despite the fact that Harding might take legal action against us and ask them and require them to actually go through pic Valley thank you is there any other discussion I just would like the uh public to know that when we met with the Water Authority last month or two months ago both our board members the executive director of The Water Authority as well as the board attorney for the Water Authority affirmed that they have enough water supply for the for Mars Township and its member towns which is why I'm supporting this resolution but I believe that includes the water that they get from paic Valley so it's not just from our own resources and that's my concern they can shut off the tap at any time restrict the tap at any time and we're stuck with Harding so they should be contracting directly with Bic Valley I I don't think the state of New Jersey will ever allow them to shut water off to our towns and I think using afford affordable housing projects as a way to try to not allow other towns to have our water is a very risky path yes if I might I understand the points that my colleagues are making tonight and I'm more on the side of this is a lawsuit that we're going to lose and it's not a good way to use taxpayer dollars to defend this we did have an agreement with Harding that on one particular project that we would cooperate with them on on the housing and also to the point that um about giving away our our precious water to another town if it ever gets to the point where um we're in desert like conditions we've got a bigger problem than just giving our water or you know providing water to you know fellow citizens uh that might be in a neighboring town we got a bigger municipalities required by the state of New Jersey DCA to do what's called a municipal practices inventory best practices inventory um it's also tied into the state aid that you get that you satisfactory uh perform that uh the 2024 inventory assesses each M municipality's compliance with various laws and evaluates the implementation of fiscal and operational best practices inventory answers provide taxpayers with additional means of evaluating their misali performance the inventory also identifies areas where municipalities may require further technical assistance furthering this objective the the inventory contains an unscored survey section soliciting information on a variety of topics 2024 best practices inventory uh dealt with the following areas ethics Personnel budget Financial Administration capital projects transparency procurement cyber security lead remediation shared services special Improvement districts affordable housing Redevelopment utilities and environment there were a total of 69 questions that were part of the best practices inventory 52 of those questions were scored and 17 of the questions were surveyed un unscored survey questions each municipality to get their state aid must receive a minimum score of 35 um at a total of 46.5 questions um I am pleased that we've been able to complete this survey and we came up with a score of 45.5 so we get the a almost the A+ um for that the one area that we do need to address as a municipality is back in 2023 the state legislature and signed by the governor was the elections transparency act which then created its own payto pay laws and superseded all of the missal pay to playay Provisions um therefore we are required to uh resend um our pay to play restrictions that are currently in our ordinance that we will certainly do um come beginning of 2025 but um as I said please to that we receive 45.5 out of possible 46.5 U with just the the one question that we have to address thank you thank you very much Mr Quinn and again um two and a half minutes nice quick report but also it's nice to see that we are our best practices we're doing a good job and appreciate all the work that the township uh does I have a question uh thank you uh so resending the payto playay ordinance is that a one-step process a two-step process do we do it go ahead tell us how do we do that by ordinance by an ordinance so we need two meetings for it yes that's why I couldn't do it now okay are we going to do it on December 4th or we're going to wait till next year we have to do it next year because you this time we'll go to standing committee reports and general commentary which will be provided by each Committee Member and we'll start with Mr janada thanks mayor first I want to congratulate mayor Donna griglia and committee and former mayor mark chy on winning your recent Township committee elections and I would want to congratulate committeeman Bud rabbits for running for moris County Commissioner although the results were not what we had hoped for it's commendable that he and his running mates Justin Strickland and Jonathan sacket have run for office and we do need to have competitive races in every election season to give voters a choice and in environmental news a big one is Drew Forest has been saved Drew University and Madison burrow have come to an agreement in selling the Drew Forest Preserve to the burrow Drew Forest is made of 51 acres and consists of the zakar bitum and heurn woods the forest provides critical water water recharge for the buried Valley aquifer which supplies portable water to 31 municipalities in addition there are 22 Acres of public trails and is an ongoing ecological study of ancient arboreal forests and I recommend people to go to the forest as I have and uh just and best to have a a guide with you to there to explain everything a 10- foot high fence helps with this in preventing deer infestation which in turn encourages undergrowth of juvenile trees which deer have been known to overc consume so and unfortunately there was a recent brush fire in October at Drew Forest there was minimal damage but there is still the danger of any future fires due to the heightened draft situation and this forest fire is in addition to the ones that have happened in Rocko Township there I think there were a couple of them and the one currently along the New York New Jersey border a firefighter had perished in that one and there are several around around the state and there's still danger a danger that more can spread around so we urge you to take vigilance in preventing these fires and cons as well as conserve water at this time of drought and I mentioned last month uh my family had commemorated Dali with the indoor lamps being lit but we did not light any firecrackers because of the fire danger and as far as my historical talk today it's about Thanksgiving as was mentioned last month we are we have entered the holiday season and the first major holiday in this season is Thanksgiving at the end of this month and Thanksgiving is a uniquely American holiday there have been celebrations of Thanksgiving throughout history where Nations or kingdoms have given thanks to God or whatever deity they worship as well as they have there have been Harvest festivals throughout the world those those of us who have grown up here have heard the pilgrim story of the Mayflower in Plymouth Massachusetts some have even visited Plymouth and seen Plymouth Rock as well as the meeting the what is the site of the meeting place and the pilgrims and Puritans didn't usually celebrate holidays for religious reasons this includes Christmas which was actually banned by Puritan leader Oliver Cromwell when he ruled over England in fact trivia here the song the world turned upside down played at the British surrender at Yorktown was composed as a protest against this band these devout Believers did have one holiday called Harvest home which is a Harvest Festival and our modern celebration of Thanksgiving is based on Harvest Home fa festivities however most Americans are not descended from flimy flower passengers or Puritans so what do we do to compensate we make Thanksgiving a uniquely American by bringing in our own Cuisines and traditions each ethnic immigrant Community adapts the holiday and puts their own spin to what is served each group adds their own ethnic foods and believe it or not even vegetarians celebrate Thanksgiving They don't serve turkey or other meats but there are many many vegetarian dishes that compensate that loss my family can speak from personal experience we used to we used to uh eat meat but then for religious reasons for for whatever reason Thursdays are meatless so what day does Thanksgiving for Thursday so we even tried the toer for for a couple of years that's the tofu turkey but all can that can be said about that is it is lit it was a literal tasteless experience this is also a time when we think of and help those in need and I would add that we should think of them at all times and not just at the holiday time so may you all have a safe and Happy Thanksgiving time with your loved ones thank you mayor thank you commit and janata and I just just want to make a point about the Drew Forest because as and we congratulated Madison on getting that done but committee and janata has been a longtime supporter of the Drew Forest going way back to the very beginning so congratulations to you too because you really were with them right at the start so to see this come to fruition is really have to make you feel good yeah thank you mayor and uh for to explain I have attended a few events and I didn't mention that the funding came from private and public funding the Public Funding was of course the township the the burrow and also from the county and the state and federal because I was Al also attended an event that was uh R hosted by uh our congresswoman Mikey Cheryl and and I had as whiy River Watershed chair I wrote a letter of support and each municipality had Al Al including Mars Township had also written letters of support in purchasing Drew far so the township also is U is commended for for supporting this thank you committee jorpy uh thank you mayor um first I want to recognize our veterans um and thank all the memorial and Veterans Day Association of Mars Town Mars Township for uh Mondays uh ceremonies and services um as folks may know we uh visit the memorials across the Township in town with the veterans in the morning um and we hear a lot of historical context to why we have these memorials where they are um it's always a incredibly powerful experience and I really grateful um and I wanted to recognize I know the township already did on social media Tony Romano our former Fire Chief and longtime resident um and um big um member of the Assumption Parish Community uh was recognized for his 50 years of service on the memorial Veterans Day Association uh for organizing these events twice a year every year uh for the past 50 years he is a uh he's a big uh he's a big person in Mars Township he's done so much for our community and I'm grateful for him and his family service um during our visits to the memorials um I talked to the American Legion as well as the members of the memorial Veterans Day Association about potentially adding MCN field as a stop for laying REITs in the future um as we know we uh dedicated MCN field after um Brian MCN who lost his life a few years ago um coming home from military training and uh I think it would be a worthwhile thing for us to do and I'm looking forward to working with them to adding that stop uh for Veterans Day next year um I do want to thank our DPW for putting the banners up um at uh here down in guiny and as well as at Speedwell this year thank you Analise Rush as always for um organizing this program and getting the banners printed and working with our veterans it's a great um it's a great program the veterans paid tribute to all the members who have banners across town by reading their names off during the services uh on Monday uh and uh I'm hoping we continue to have more uh applications for banners in the future um I wanted to thank the township for putting out uh an email offering Street trees to Residents who uh would like to request them um I know we've in the past few years as a Township committee have budgeted a significant amount of money to replace uh the trees that we've lost from the emerald ashore replacing the ash trees across the township and now as we get to the point where uh neighborhoods that need replacement trees are dwindling we have the opportunity to replace other trees or plant trees uh uh in rights of way where neighborhoods need more shade uh so I'm appreciative of the the Township's work on that and the dpw's work to get the trees out um I think it's going to pay dividends 5 10 years from now when places that didn't have shade in the summer and are really hot are now going to have you know large trees in shade for the kids to play underneath uh in the Summers um we mentioned wildfires uh I cannot press enough to please do not burn anything outside on Sunday I was driving by a house that was the members are raking the leaves and then burning them on the side of their house right next to a field and uh this is why hundreds of firefighters are fighting fires across the state I went to Rockway a few weeks ago with Hillside to help with their um the first brush fire that they had which was Acres large and then they had a second one the following week um our fire department has gone to Madison for brush fires we responded to barany at Greystone last Friday uh to put out a fire um it's it's just please just stop burning things outside we don't need to um use propane or gas grills and uh give the volunteers and career firefighters across the state a Break um they have their hands full I've never seen so many Forest Service fire department trucks in my life down here but if you see red pickup trucks with all their equipment on they're coming to every brush fire that gets reported because they can quickly uh turn into large large fires um and lastly as um Mr janada mentioned I'd like to thank the residents for their support in this year's election I'll talk more about it in January during the saring in but congratulations to you mayor on your re-election uh it was a pleasure running with you um I feel honored to have such a great running mate uh this year and thank you again to the residents for their support and confidence in our abilities to serve them thank you thank you committee man JY committee man rabitz uh thank you mayor and for those still on Zoom or in in the audience here today thanks for sticking with us and thanks for attending uh this evening it's National politics as I like to say gets all the spotlight and it sure has gotten a lot of Spotlight in the last couple of weeks but it's what we do here locally that has the biggest impact on your lives uh I'm going to be brief tonight I I certainly want to Echo the the comments of my colleagues congratulating uh committee M jori and the May glia on their reelection I'm just welld deserved and I think they ended up getting the most votes out of of anybody ever for the uh for the for the Democratic party so kudos to you all for running a great campaign didn't work out for me as as as I had expected but um democracy you know held and this is the way it works the people the people's voices speak um I just want to real quickly say that um we for the first time we had a um a table at the trunk or tree U and the mayor and I were there the whole time until at least we ran out of candy which was actually pretty darn quick I think we lasted just over an hour we had a lot of candy it was a lot we had a lot of candy and there were just what a huge success it was and I'm hoping that we can begin to allow more more cars and you know kind of evenly um because we get so many kids that just you know just you just throngs moving in like little swarms and it was so cute to see all the all the costumes and I'm glad that the township committee had a table uh next year will hopefully last more than an hour so um I just want to uh also to say I wish you all a a wonderful and healthy and safe Thanksgiving weekend um we while we're while we're you know we leave here we just all need to collectively think about rain because we do need rain uh the conditions are really horrible and um you know don't be burning burning fires outside as Mr jorrey said had said and as always I'm I'm going to finish up with let's not marginalize or demonize those folks who have less political or economic power as some of us currently enjoy rather let's stand up and and and stand up and and and face the people that continue to profit from our division uh equal rights for all citizens doesn't diminish the rights of any other CI citizens and I will continue to say that we have more in common then should ever divide us which we'll ReDiscover when we're talking to each other and not at each other amplifying misinformation hateful or violent rhetoric is never part of any civil society and lastly let remember to to as you go through your day to be kind kind to yourselves greil uh thank you mayor uh first I'd like to start off by uh recognizing a Veterans Day I was sorry to have missed the ceremony this past Monday but I was traveling in California for a family gathering and I really do thank the veterans every year uh both publicly uh and privately and I just want everybody to know that my absence was not from an oversight or indifference but rather I am eternally grateful uh to our veterans for protecting our democracy and I always encourage everyone to uh thank a veteran not just on Veterans Day but every day uh for standing committee reports the economic development advisory committee met last night I was traveling as I just said so mayor griggle it took my place and I look forward to hearing that report on what I missed uh for police on our agenda tonight was uh we had the resignation of Officer Ridley I wanted to thank her for her service to the police department and the community and wish her well in her new position and the police standing committee is meeting this Friday to interview one candidate to fill one of the two openings we currently have in our department uh for engineering on our agenda tonight was the appointment of our Municipal engineer Jim slate to a three-year appointment uh Mr Slate has been our chief engineer for how many years Mr qu 15 24 24 wow it was way off um and he's done a fantastic job for us I know mayor grigal has a few additional words she's going to make about Mr Slate in her commentary so I'll leave that to her um also on the agenda were resolutions for uh accepting bids for the repaving of Woodland Avenue and Whitehead Road and that work will likely take place in the spring right Tim it's getting too cold now that is correct sir yeah um so we look forward to uh those infrastructure improvements and then another additional infrastructure Improvement was the resolution we had tonight for approving the Butterworth sewage treatment plant sludge pump upgrades so we are as always constantly reinvesting in our community uh for my personal commentary I would like to wish a happy dwali to all our Hindu friends and Neighbors in Mor Township and Beyond uh celebrating the holiday in particular I'd like to send my good wishes to wishes to committee man janata and his family uh for the holiday dwali is the Hindu festival of lights and is one of India's most widely celebrated holidays and I was very interested to read that around the world one about one billion people celebrate the holiday that's a lot of people celebrating today njd held a public meeting regarding the drought conditions here in New Jersey as I mentioned earlier uh as you likely have noticed we have not had rain significant rainfall in a very long time over 40 days now and Counting and residents are asked to conserve water by taking shorter showers only running the washing machine or dryer when they are full and turning off the water when they brush their teeth so we all need to do our part to conserve our precious Water Resources um and lastly and I hope I'm not stealing this from you mayor uh December 1st is the first day of our winter Farmers Market uh that is run by Gro green there will be a ribbon cutting at 9:30 and I encourage all our residents to come out not just on December 1st but but every Sunday to support the farmers market in our town and uh make some purchases from the vendors so I hope to see everybody over by the train station thank you thank you Deputy Mayor and welcome back from California on my updates I did attend the economic develop uh development advisory committee meeting last night we had a presentation by Paul ferm from the Unitarian fellowship and um everyone in the township is invited to attend their ribbon cutting ceremony on their newly updated building it's November 17th uh it's a 10:00 Mass if you want to attend and then at 11:30 there's a ribbon cutting it's located at 21 Norm Heights Road Paul and Helen firm have been longtime supporters and were instrumental in the improvements made to the Unitarian Fellowship edac is also creating an Innovative initiative to create an edac web page to encourage more businesses to the township they will be creating business tool kits and data analysis to ATT track companies to our area working closely with the New Jersey Economic Development Authority Eda also has a substantial grant funding program so they're exploring that the senior citizen citizens advisory committee continues to have program events the most recent one though was actually held by our own health department on Medicare the attendance has been very high and our seniors are really appreciative of all of our efforts to educate and provide them with all the resources they need on the transportation advisor advisory committee chair Andy Feldman and I had a call with Jim diamond from creative outdoor on Revenue generating cost-free Transit stop benches to look into the possibility if that would be something the township should consider we'll continue to look into that and see if we feel that it would be effective in the long run our complete and green streets community group will be meeting to work alongside the county with their local action plan to continue to address safety concerns improve Mobility the environment and the overall quality of the township we do want to congratulate Jim slate on receiving first place for our Southgate reconstru reconstruction project from the New Jersey Society of M Municipal engineers and that will be prevented presented to him next week at the New Jersey League of municipalities we thank Bernie Sanger for submitting the project to the awards program so it's a very well-deserved recognition the New Jersey League of municipalities meets next week it gives us all the opportunity to attend many sessions on all aspects of municipal government and the issues we all face I do want to have a shout out though to our DPW for doing s an incredibly good job on the leaf collection because there were so many leaves that came down faster and Furious this year because of the drought they were out there and even though it took a little bit longer they've done a great job I want to thank you for your support on electing committee men JY and me back to the township committee it was actually a pleasure to run with committeeman jorie and I always say this about the two of us because we're co-generation co-generation I'm the oldest member on the committee and Mark is the youngest but we seem to have a really good relationship there so it's uh really appreciate that Fair elections are so important and locally and nationally the results indicate the will of the people we will continue to provide you with the results that benefit the township and your experience here it has been an honor to serve as your mayor and I can't believe the year has gone by so quickly I look forward to serving three more years on the township committee and sharing in Arrowhead Road um one question and just a few comments um the special meeting that's on did I hear that was going to be on December 4th um what is the topic of that is that a public meeting or I'm assuming it is public meeting for the ordinance that was introduced for the ordinance that was introduced tonight correct relating to the marketplace to the marketplace thank you for tying that's appreciate it um and just a few comments um as you had the debate and Dialogue on the the the short-term rental um serving on the zoning board I was just thinking about it while I was sitting out here because again I just saw this on the agenda earlier today so it's a pretty new topic for me to ruminate in my mind as I put together my thought processes on it but um on the zoning board we'll often see applications where people are building a lot of living space and things um either above their garages or in a carriage house um and we do place restrictions on them from their ability to rent those out so I'm not sure depending on which way this goes down the road a bit whether that would then remove that um restriction from them or um whether that would override it so just any there's another factor and angle that I hadn't thought about until I was just sitting in the audience so you may want to take that into consideration as you uh debate and Dialogue on the topic um on the topic of leaf collection I know there's many residents on my street houre had Road um who are grateful to the town of Floren Park we did get an extra leaf pickup uh two weekends ago there's half of the neighborhood is having sewers put in right now I'm not sure um if that was intentional or the crews were confused as to what town they were in but we did get an extra Leaf pick up and there's a lot of Leafs up in there um some we'll let the mayor know yeah I mean for 30 years they always made the left turn I mean you know there's some things you just think you'll never see and uh so it was it was uh much welcomed by the local residents um and then just lastly want to just thank uh the entire Township committee for um the debate and dialogue um on the topic with the short-term rentals earlier this evening it's uh it's just um grateful for that because it's it's it's rare to see that kind of debate and dialogue in terms of um issues over the years and just appreciate your um openness in having those debate and dialogues um based on you know public input and just uh the transparency of it also thank you very much thank you Mr Mr Goldberg we're glad that um the public comes out so that we do get that kind of feedback feedback it helps us as we continue to have these discussions and we need to look into further details on how to come up with a better solution if and if and when it is needed so thank you Mr O'Reilly Jim I don't know if your hand has been up or are you do you go ahead uh yeah doesn't matter whether you see me I guess uh the ordinance regard the short-term rental that you ascended correct what is the status of it and why was it different from just voting it down is it still alive in some way or is it the same consequences as if you had roted it down uh the introduction was rescinded so as if it was never introduced oh so so it's no longer it's no longer it was voted down oh okay same effect thank you one minor point on resolution or ordinance for introduction 2724 uh you refer to lot numbers but I don't uh for the public to understand where this could be it might be helpful although I understand there may be some cases where you can't give street names or Street intersections or addresses to have a reference to the uh address or adjacent streets I realized not all Lots may have an address Jason Jason streets but could you have had one here we could did we put the name of the project in the ordinance sir yeah you did yes Marsh Marketplace right right I was wondering if that was supposed to identify the location yes sir Jim it's the
