consent agenda counselors what are your wishes I'll offer motion to approve it second thank you we have a motion in a second any further discussion those in favor signal by saying I I that motion does carry item 2.1 is a public hearing on the proposed 2025 utility Street and Alley Improvement project thank you madam president City councilors at city council has scheduled a public hearing for the proposed 2025 utility Street and Aly Improvement project uh just some background that project was reviewed by the safety commission at their September 5th 2024 meeting and was recommended um in terms of the uh project meeting the complete streets policy and active Transportation plan for the city uh the 2025 USA project project was included in the 2025 Capital Improvement plan which was reviewed and adopted at the November 19th city council meeting in 2024 we conducted a public Outreach and informational open house on September 25th of 2024 and that was an opportunity for residents to ask preliminary questions and provide insight to City staff it would be staff's recommendation that we would go through each project location each of the five project locations and um solicit input from the public um on this project um I we conclude the staff report at this time thank you at this time the public hearing is now open we will read into the record each of the um alley and streetway improvements if you would like to be heard please come to the microphone and state your name and address for the record um before we begin Mr tadim was there any outstanding um questions letters concerns calls uh Madam president City councilors I have not received any verbal or written correspondence on the project thank you very much we'll go ahead and get started um project number one is Bridge Street from Cottonwood Street to Tower Road Project two is Lake Side village Edition number three Al think someone on lak side thank you T Anderson 37 Village Lane so that should be in Lakeside um I just had questions as to why sidewalks are being proposed for that neighborhood since it's not a throughway uh the streets are plenty wide I'm just kind of at a loss as to why we need them um I know that some of my neighbors who aren't here are not overly thrilled with the idea as well so I guess that's one concern I have um beyond that um nothing thank you Mr Anderson Madam uh president City councilors it is uh within the city code that whenever improve ments are made including uh initial kbon gutter uh being installed on the roadway that sidewalks go in at that time um Lakeside Village Edition was um part of a development plan um that was cons be constructed back in 2005 and as part of that development plan uh the project did include um sidewalks kbon gutter binous Paving Street lighting um at the complete you know for the full built out project um as per the city's active Transportation plan uh uh uh complete streets policy would be our recommendation that sidewalks be installed with within the subdivision um per the guidance we have in those design documents and the original development agreement and um plans that were um developed as part of the initial uh develop development process for the project thank you um I agree sidewalks are always they're always an issue um when they get put in but um I think as the community is continuing to grow and develop um you know it it is a um a safety issue as well and I don't know I'm I'm okay with sidewalks and as long as it was part of the original plan um I would be in favor just one question for the city engineer I think the only time we've waved that is when we did a bike trailer path instead of the sidewalk correct correct there have been instances where um we'll take the extension of North Highland Avenue that was done a couple years ago um you know in L of sidewalk on the north side of the roadway it was constructed with a binous recck trail same can be said for 20th South and 20th North we've um put trails in in Lis sidewalks but we still have that facility available for for nonmotorized traffic to use and I'm also in favor of it that's our plan is with the sidewalks I know it's always a controversial issue used to have neighborhood fights over it but they go in Mr Anderson um there's very little about the Lakeside development that looks like it as it was originally planned um most of the housing there is not housing that was originally intended for that neighborhood uh you change the zoning behind my house uh which probably makes me a little unhappy uh so that I have an echo chamber in the back and now you want to mess up my front yard too um I guess I'm a little unhappy with the way this development has been taking place uh you've lowered the value of my property I think enough and I'm just not thrilled so thank you for your comments uh president and and counselors I would like to just chime in I um I certainly hear Mr Anderson's uh comments and understand them uh personally I feel it's very important uh to provide walkability and bicycle the ability to walk and bicycle in our community especially for children um and elderly and everybody I mean um maybe a question for City Planning I mean uh Mr Anderson made a comment about changing the zoning did we really change any zoning with that development in any regards you know I mean how are you were referring to it Mr Anderson I bought the house in 2017 I moved in at the end of June and then I found out two weeks later that the zoning had been changed by the city um I was not told before I bought the house that that was the case um so yes I do have some irritation about that as far as walkability and using a bikes kids are riding in the street streets right now and they are fairly safe then traffic through that neighborhood is not through traffic um it's a circle basically um we walk our dogs in the street we walk ourselves in the street um so I don't see that as a safety issue I I think the streets are plenty safe as they are the way they are um and I don't think that will change if you pave them um obviously I can't override your your rules as far as development but I would encourage you to think about doing so because I don't think it will add to our walkability or use of of that that area for getting round Mr Anderson what is your address out there so 37 Village Lane it was the first house on that end okay uh Dave schnober community development director the zoning in um Lakeside Village has not changed since it was that's not true no that I'm sorry sir that that is true no it's not I was told you had a zoning meeting two weeks after I moved in there is multif family housing that's behind his property yeah and that that was that way when the project uh or when the property was originally platted and zoned there's been no change yeah that's why I've been on the Zoning for over 10 years and we haven't Madam president Cate councilor's the original development agreement allowed for the density that is currently in that parcel behind Mr Anderson's home yeah and that was in the development agreement 24 units excuse me that is not what we were told though when we moved in we were told that the only thing that was going behind our house was Twin Homes like are located further up be by the entrance into the into the zoning area um and then we were told that the property uh limits would the proximity to the property lines would be changed and that that even is something that the developer the Builder told us was was happening so uh it wasn't until after I moved in that I found out from him that that had changed um I don't know who the who he got his information from but you know the information was not accurate thank you okay um Mr schn Brook if Mr Anderson didn't want additional clarification on that would you be able to provide that at his request okay thank you very much okay say something hi yes please come State your bney okay I live at 2311 Lake Avenue in the same subdivision okay um I can understand Mr Anderson's point on where he's at that um Village Lane is very tight for the front yards extremely tight um putting in a sidewalk on Village Lane could be detrimental to their front yards now Lake Avenue and mck Lane are a little different we have a lot more front yard to our homes I have an elderly mother that just moved here from Ohio and living with me and unfortunately I want sidewalks because then I can walk her around the neighborhood where you know streets can be uneven and she could fall but I understand where he's coming from Village Lane is very hard to put a sidewalk in those front yards uh Mr stard stadheim in regards to the sidewalks is there just a like a flat width that is given or would a would a smaller width be considered on some of these more narrow L Madam president City councilors the the uh side width is 5 ft and you know the sidewalk is all within the city's public right away um um would be placed within those limits and that's our standard for 60 foot right away would be 5 foot sidewalks okay um and again these sidewalks were part of the original plan that was that is correct put together in you said 2005 uh yes yep thank you um included within the development agreement as well so okay that's considered part of the public Improvement that were defined in the agreement okay uh Mr Scott if you are on yes I am on hi Mr Scott um is there any clarification here that you can provide um if we're able to move forward with this project or if we need to take some additional considerations uh no council president members of the council I think it's important obviously to hear from the public at a public hearing like this but ultimately how to define the scope of the project is within the council's discretion there's no uh legal impediment to the council proceeding tonight there's also no legal impediment to the council uh at some Future Point revising the scope of the project if you so chose but uh certainly you can proceed tonight to order the improvements thank you Mr Scott that being said we will continue and we'll come back to this at the end um project number three is alley block 59 south of Center Street Aly block 60 South of Center Street and then the last proposed pro project is miscellaneous concrete sidewalk and adaa um pedestrian improvements at this time Council has the option to um make a motion or provide additional comments and the mayor president and counselors um I would offer the resolution to close the and close the public hearing ordering in the 2025 utility Street and Alley Improvement project and authorize the city engineer to prepare the project plans and specifications second thank you we do have a motion in a second any additional discussion um just to say that again as Mr Scott uh stated that this um means that we'll move forward with the project but it doesn't mean that we wouldn't be able to revisit some of this evening council president councilors John nisley planner with the city of newm um so the purpose of these proposed amendments uh are to take into account uh existing property and their configurations in the grid pattern of of new Al um historically properties in this grid pattern area are smaller in size than newly platted Lots in other areas where we have i1 uh zoned uh industrial property i1 being the planned Industrial Area um so for this amendment uh what we did was we first defined uh the term grid lot and then we also defined the term grid pattern that way we could easily describe uh in the table where we adding um an additional column to the i1 standards um what types of lots we are and then we amended uh or we we let's call it lessened the setback area so those smaller Lots could be developed more easily generally speaking the location uh that's being affected by this zoning change uh would be um basically from 20th North uh to 12th North and then from the bike trail to North Broadway that's the general area where uh these zoning amendments would would affect these Lots the Planning Commission unanimously recommended approval uh of the zoning change and that's supported by your uh findings of fact that's found in your packets that concludes the staff report thank you Mr niely I'll make a motion to conduct the first consideration of ordinance number 2025-the the zoning ordinance of the new city of New Alm to provide establish a second set of development standards in the uh i1 planned Industrial zoning District second thank you we do have a motion and a second any additional discussion those in favor signal by saying I I I that motion does carry item number 4.2 also in regards to an ordinance number 202-b first consideration amendment to Temporary sign zoning regulations Mr nle all right so the purpose of this zoning amendment is to further clarify uh temporary sign regulations in the city of New Alm Z zoning ordinance so uh staff provided to the city's attorney uh City Attorney office um some proposed additions which were uh at any time no more than one temporary sign shall be displayed per business that the temporary the display of any temporary sign shall be limited to 13-day continuous period in a four uh in a four month period so once per quarter uh a temporary sign permit is good for 30 calendar calendar days from the date of issuance temporary signs are limited to 32 squ ft in surface area with a maximum of two surfaces and then no part of the sign surface uh sign face or the support structure shall exceed 8 ft in height from the ground location of the sign that provision in particular uh is for commercial and Industrial zoning districts uh temporary signage is allowed over and above typical sign limits allowed on the property uh for permanent signage and that uh the temporary sign shall be placed on the premises so not in the public right of way um and then temporary signs shall not be illuminated Planning Commission did recommend uh one change to section uh 10.5 2B and that was to incorporate uh language for a triggering mechanism to remove a temporary sign for a large residential development uh that was recently platted and that additional language uh was to say that once that last l in that development is sold the developer has 30 days to remove that temporary sign uh displaying uh that development um the Planning Commission with that addition uh unanimously recommended approval of the zoning Amendment and again that's supported by the findings of facts in your packets one question for Mr nisley is this going to affect our uh Belgium waffle signs our pancake breakfast signs are I was thinking that too I was thinking this signs on Broadway you know banners those kind of things great question technically yes great question um it all depends on the location um so generally speaking uh in the downtown area these are all commercial districts so if that sign is meets the standards of the temporary sign regulations and also can fit on that property uh it it would be allowed you know residential districts are sort of a different animal um is the temporary sign permit good for one or four one or four I'm just you know want to have that covered when we get a phone call yeah these regulations are set up for one and I I did bring that up at the Planning Commission meeting you know we have a famous corner where there's multiple ones and not trying to you know pick on that but how do we be consistent right you know so we're hearing it from John just saying one so technically they came in and got four temporary permits well the you have to look at each site individually so if a if a look that site okay if we're talking about that site in particular that's in the B1 y zoning District so they're allowed a certain amount of signage permanent signage on the property um and we'd probably take a look at at that first those signs are typically in the same location each time that they're put up y if they meet uh the signed standards or the allowances for that zoning District we'd probably say okay we're going to consider that more of permanent signage on the property would meet that requirement we're what we're trying to deal with here is more of the mobile signs that are moving in and off of sites for a grand opening for this uh you know uh sale that's happening for a short duration in time that's the idea of developing this this type of ordinance and we will have to deal with each site or complaint individually and take a look at it based on the zoning district and that property when it comes in uh to our office thank you so then can I ask what prompted this is there people complaining about the temporary signage yes okay I think there was a property that was brought up attention at the end of last year in 2024 that had like three of them quite large and you know they didn't know how to handle it they're to be consistent with our current ordinance uh I hear you is there a fee for the permit in any capacity that hasn't been determined yet okay well this is the first consideration so I guess I'd be looking for a motion make a motion to conduct the first consideration of ordinance number 2025 TBD amending section 10.5 of appendix a of the New Alm city code the zoning ordinance of the city of New Alm to update temporary Chad Aus and John Go jmg Rentals Incorporated screen scr down okay Dave schnober community development director Madame President members of the city council uh this with this particular request uh Chad OAS is the applicant uh John go on on behalf of GMG rentals is the owner of the property um the proposed use is uh in your in the agenda item is an indoor commercial entertainment Recreation land use that is being proposed for the property uh that business would include an ax throwing space a rage rooms and a Smash Lab um the Planning Commission recommended approval of the request with uh five uh conditions it was a unanimous vote at their January 30th meeting um an indoor commercial entertainment space is defined as an establishment providing completely enclosed Recreation or entertainment activities accessory uses may include the preparation and serving of food or the sale of equipment related to the enclosed use examples of that type of use are bowling alleys roller and ice skating rinks billiard Halls swimming pools theaters and similar amusements so it was the staff's determination that this type of use fit that particular uh definition so this type of use is allowed in the um I2 zoning district with a conditional use permit you may remember that we granted a permit for um a both an indoor and an outdoor uh commercial entertainment use with shells out on North Garden Street that was you know I don't know four or five months ago um this type of business uh would typically be permitted in uh as it's a permitted use in the B2 B3 and B4 district and it is a conditional use in the i1 um in the application the um applicant indicated that all business activities will take place within the building and will not impact the nearby area there will be no exterior modifications which U made to the building um the building is currently used for business purposes uh business parking would utilize uh the shoulder or street parking as well as parking in the rear of the property with appropriate signage and the use will provide a fun engaging place for new Al residents to enjoy themselves while providing a safe controlled space to uh d-stress um the location of uh the particular building that this would be located in is um on third North Street and that's where the main entry door is so we would anticipate that that will likely generate on street parking on third North Street um if the business was um occupying a new building the parking requirement would be approximately 10 um spaces would note on the map that's up on the screen that um Park in is was proposed at the rear of the building here's a building parking here and then at the meeting we were made aware that um they would also be using this space here so third North here valy here the um conditions that were recommended by the Planning Commission include that the um owner will pay the cost to record the permit with the uh Brown County record's office uh number two that all business activities will take place within the existing building at 1063 North Street uh number three that uses on the property shall comply with the city of New Al noise uh restriction regulations found in section 808 of the city code for the hours of operation will generally be from 3:00 p.m. to 8:00 p.m. on weekdays and 10:00 a.m. to 8:00 p.m. on Saturdays and 8:00 a.m. to 5:00 p.m. on Sundays then the fifth um uh condition was that there would be uh no exterior storage permitted on the property that's not going to happen anyway because the building takes up all of the space on the property um that um there there are a couple other items that um I wanted to note from the uh public hearing that was held and um one of those is that I think it was generally confirmed that I think most um Commissioners didn't feel that there would be a adverse noise impact um on the surrounding area um the the other is that the applicant does have insurance to cover this um additionally there will be limited food provided but it will not be um an oven or you know a place to cook food it's strictly um snack type of food and that the applicant will be constructing a new door um to this space and you have in your agenda packet um the layout um of the uh of the building and uh the new door would um uh be in the vicinity of where the uh Amazon um s uh prop or business is located within the building you said that they were possibly going to sell food and snacks like light light stuff is there any intention or in the planning of maybe alcohol down the future or anything like that or not discussed that wasn't n discussed and I guess didn't get the impression that that was something under consideration this is the um layout of the building this is third nor Street here this is the existing building right here or door excuse me so you'll take that into that space the new door would be located over here so that's really the only exterior modification that would be made um to the building and and I realize staff has looked that it just double checking we're changing to an a occupancy everything's good to go I don't want any surprises for Mr Gog that would Z bilding official council president counselors yes I've had a conversation with Chad on that that if he goes ahead with this um Venture that we would need some type of design before looking at to go through and review it because we're going to have separation and stuff to consider with that all right thank you yep I just want to add that uh you know was brought up and about the house right there and that's Mr oas's home so he's aware of the the noise so the only matters and we had one letter that was written into the record and they were they were okay with it they live on the corner um 100 North of Valley Street yeah so it's um it's be behind the building across um fourth North Street might have to buy my staff some monthly passes to that rage room but so I'll go ahead and offer a resolution to approve the conditional use permit with conditions for Chad OAS John goog uh jmg rentals Incorporated uh to allow the operation of an indoor commercial entertainment Recreation land use on a property located this property is 923 North Valley Street uh the Planning Commission unanimously recommended approval with conditions of this request at their January 30th uh meeting the applicant is the current owner of three lots in this particular block and the screen shows the location of those three lots um they are in red um you will note that on this property there are two dwelling units and they they are located on lot five and lot 7 so lot six is basically empty um lot five the residence there is kind of hugging the um the north property line and so what the owner is proposing to do is to take lot six and divide it into two equal parcels and take each of those equal parcels and adjoin them to the lot that um Ada a buts so the South half of lot six would adjoin lot five and the north half of lot six would ad join um would um be combined with lot seven um staff has not been advised of any utility conflicts caused by the uh proposed um lot division uh the three conditions are that um the lot division will be effective with the filing of the resolution with the Brown County record office the second is as I just indicated that the north half of lot six will be combined with the adjoining lot seven and that's to form one parcel of property for tax and building purposes and the South half of lot six will be combined with uh lot five uh for the same reason that would conclude the uh the spring of 2024 at 10:07 uh North Minnesota Street in the amount of $33,900 at a purchase price of 158 uh, 226 so what we're trying to do here is just simply clarify that uh the total uh cost for that property um is $158,200 city engineer to sign an attachment to the purchase agreement to sell property legally ascribed as Lot 2 block 76 North Center Street to Cassandra a Koo and dilling G 6.1 deer control program summary um Madam president City councilors I'll take this item for city manager dton um within your packet uh are the results from the deer hunt in the last for 2024 um also is asking for reauthorization of the deer hunt in 2025 uh as you can see um hours were down just slightly sightings were down slightly and um one less deer than in the previous year were taken um I guess uh it is in the uh information is included within the packet I guess if there's any specific questions I can attempt to answer those um otherwise I think we're looking for authorization to reimplement the hunt again in 2025 president and counselors uh I think this is a fantastic program of ours and um I'll make a motion to accept the 2024 summary and reauthorize the 2025 special archery Replacements hi Mr city council Jeff uffman Public Works superintendent um these are the planned uh schedule equipment to be replaced in 2026 as you see in your packet um they're all on a replacement schedule except for that brine tank that would be new since we uh are getting a few trucks that have the going to have the pre-treat on so we're going to need a brine tank for storage so that's what that's all about so but otherwise yeah they're all scheduled plans and there's the money's in the 601 fund the 577 027 I just have one curious question for the street commissioner are the vehicles even that far out on the state bid that you got to put in already yes really yes I got to get the for the chryst deal the box and the plow and stuff I got to get that in by the end of February here for to get that price in otherwise it'll get pushed back again and they're having trouble with the trucks getting Allison Transmissions so if I get it in now hopefully we can get it in 2026 I'll authorize a city you need city engineer you need manager for this one okay authorize the city manager prepare specs secure bids or quotes or use State bid contracts to acquire equipment and vehicles reconstruction Project M president City councilors the 2025 surface reconstruction project was included within the 2025 CIP um today we are asking Council to set a public hearing for the project um just quick summary the project is proposed to include uh 23rd North from Broadway to Terrace Drive 11th s Street from Pain Street to Jefferson Street fifth North from Broadway to German 15th sou street from state to Washington and Summit Avenue from State Park Road to Gulf Drive uh that's the entrance kind of as you head into the country club um this project is proposed to be completed by our city forces and be happy to answer any questions but uh today we're just looking at setting that public hearing president counselors um I'll make a motion to set the date of the public hearing on the carry thank you item number 6.4 is a purchase of a DJI ofat 2 indoor tactical flight drone and accessories Je president beer members of the council Dave borker chief of police for the city of newm um in front of you I I believe I offered a fairly detailed um explanation but I I'd like to just summarize um some some key highlights is that we're asking to purchase this U DJI indoor drone um just refresh some memories um and and for the public is we're in a partnership with the fire department um this purchase actually is really promotes Public Safety um when we're able to it basically gives us an ability like when we're we're searching a certain area we can this is designed to offer indoor searches which is definitely a a tactical and a and a safety advantage um this um our overall drone program is under budget the and we would be using PSA funds so it's non-levy however um this was not included in the 2025 budget so I don't have per permission to make this purchase even though it's relatively low cost and that's what I'm I'm asking for today um we're we're I didn't have it in a 2025 budget um primarily because I didn't know our um we didn't have enough pilot at the time but we had one uh one of our officers did very well accelerated the I believe the learning process really um focused on it and right now as a qualified pilot so we're in the position to to move ahead we've made some some good progress with the program and I'm certainly available if there's any questions so we currently own one at least we have two drones this would be the third so we have one primary drone and then the other one you know certainly functions very well but it's more of a more of a practice drone and then this one would be the indoor Dr how big is it to be able to go indoors is a little it's it's fairly small um but it's again it's designed for the the indoor searches so like even if it first of all it's it's less likely to to basically um crash and if it if it does um if it crashes into someone for example also it's it's designed not uh not to hurt the person or not as likely it's it's it's designed for that um so there's definitely an advantage for us to do that we wouldn't go into and and do a search with a regular drone because the risk of injury it's just not engineered for that President and counselors I view this as an important asset to our Public Safety so I uh will uh move to authorize the newon police department to purchase one DJI avata 2 indoor tactical flight drone and accessories from vertex unmanned solution using funds from the public safety you thank you chief item 6.5 2025 airport apron expansion taxane extension and Airfield pavement maintenance project and aircraft fueling systems replacement project all right Mr stadheim thank you Madame President city council there's there's a lot to unpack with uh this agenda item um just some background uh previously the city council has approved uh task order 20204 um back in September of 2023 for the design and bidding services to for the apron expansion taxi line extension and Airfield pavement maintenance project um that project involves expanding the current apron to accommodate the fuel system project that that um the projects would be bid separately it also includes a taxi Lane extension for uh potent for uh future heer development and the Airfield pavement is in need of um just some Rehabilitation that's um approach a little over 10 years old uh has some U cracking that needs to some crack fill and a couple larger pavement displacements that we need to patch and repave um so in order to take advantage of a competitive bidding environment and scope of work we decided to package all those projects together with different bid schedules and Alternate uh bid options as part of the project uh delivery the other project the Airfield fueling system replacement project that project is proposed to remove the existing underground uh tanks for the 100 low lead and a or jet a type fuels both systems are kind of out in the middle of the Airfield right now in front of the terminal building and it currently requires fuel delivery trucks to enter the Airfield airspace um where airplanes and uh aircraft may be U have movements out in that area so the proposed project would separate that have an a separate access drive for the the delivery trucks and would uh construct those with above ground tanks to replace the Aged and failing um um system that's at the airport currently we have had some maintenance issues with the tanks uh in recent history that um have required the fuel system to be down for an extended period of time so in order to not have that happen again uh we feel it's necessary to move forward with this project in addition to the um Expansion Project as well um there are figures included within your packet to kind of um piece out the the different uh components of this project and also included as the uh maintenance or the uh extension expansion and maintenance project uh design report prepared by m hunt um for your review as well um these projects are in included with the 2025 CIP um the apron Expansion Project is covered with a 95 22 2 1/2 cost share that's federal state and city and the fuel system project is a 7030 cost split with the state um so these projects will be bid um with a um requirement that contractors required to hold their bids for a period um until we get the grant uh from the feds and from the state so this doesn't lock Us in until we get those grants from from the at agencies um with the FAA and mot office of Aeronautics so we would anticipate those grants coming through after the state fiscal year um hopefully and uh um we'd be able to award a contract after at that time so I'd be happy to answer any questions but uh we'd be looking for the plan specification approval and setting the bid date both of those projects be bid um back to back here in council chambers president benter and counselors uh my wife and I live in ward 3 of course and um near the airport and uh we experiened some some Aviation noise but I fully support maintaining and um improving our airport um so I think this is very important to do so and therefore I offer the resolution approving plans and specifications and ordering the advertisement for bids on both the 2025 airport apron expansion taxi Lane Extension and Airfield pavement maintenance project along with the aircraft fueling systems replacement project setting the bid opening date and authorizing staff to receive and open bids for the projects at 11:00 a.m. Wednesday March 5th 2025 and the City Hall council chambers I'll second councilman Schmidt's uh motion but um with that 95% Federal funding is that secured or is that up in the air that's we don't have a grant in hand yet okay that's what I was wondering if that was anything that's already been issued and promised but no in order to write the grant we need to have bids so we know what the construction cost is going to be then we can write the Grant and go through that process so again that could take upwards two to three months before we get the grant back and that would be that would come back to council for consideration before we um award the contract or we can award the contract contingent on us getting the grant as well so um this will come back for your review hopefully in the near future well second and your feeling city engineer most of these reputable contractors they will will honor our bids 6 eight 10 months that's a requirement they have to acknowledge that within their bid documents yep president are we still in the discussion phase yes um I think uh engineer scheim that we have um student Pilots training there at our airport is something like that it does get used by you know the general aviation public and that does include um pilots and training from MSU man's flight program and as well as others um you know from flying cloud and I think we even have pilots from North Dakota State University in the area as well at at times I think that's great that we're assisting with uh training the next generation of uh aviators thank you we do have a motion and a second any further discussion this is a big project there's a lot going on but we want to keep everything moving forward cuz yeah we we're close director dorinson please call the role councelor Madame President members of the city council U this particular item requires uh two separate resolutions on the council's part because we're dealing with two different documents um the uh state of Minnesota acquired the airport road property in March of 2004 and this purchase was part of a highway project that was taking place at that time and one of the elements of that project was to close an existing curb cut that existed uh between the mining location uh and the highway they had a weight scale there and a curb cut and so I don't believe it was an active use at that time but nonetheless they closed it off and in turn they provided another means of access um to the Gravel Pit area and that was Airport Road and so Airport Road ran all the way from North Highland Avenue into the Gravel Pit now um at the same time we were platting residential neighborhoods on either side of Airport Road and it was decided that maybe those weren't the best land uses to have adjoining a road that is carrying um you know heavy truck traffic and so the decision was made that um uh Mr Paving and uh Excavating that they would reload locate the entry to their pit further um to the South and it would still exit on to North Highland Avenue um and then that would allow for this portion of Airport Road to be um returned for uh private use and so we uh reached an agreement with Mr shugal whereby um he would as part of these adjoining plats um plat some what are called out lots and then in combination with the airport road area he could create two new um Lots now um the state of Minnesota transferred Airport Road back to the city in September of 2013 um and the city made improvements to both Allison Avenue and Ryan Road and there were assessments against this property for those uh improvements and so the assessment per Street Frontage uh averages out at $ all of the assessments U at at a certain time and so the assessment agreement that you're being asked to approve um Mr shugal agrees to accept those assessments waves any right to appeal and agrees to pay the amount that um is identified um and the formula that we kind of um have agreed upon and is in this document is that um it'll be paid paid in full within 5 Years From the date of closing on the um Airport Road property unless there is a triggering event and the triggering events are ones that we have taken from uh the uh Dakota west and the Lakeside Village um tax forfeited lots that we had there um and so one of the triggering events would be that the entire property or one of the newly platted Lots is sold to another individual two a home is constructed and sold on one or both lots and then three a residential dwelling is occupied on one or both of the Lots now these requirements kind of get applied on a per lot basis so if only one lot is sold then we're only going to collect the assessment that is due for that one lot um if you look at the um aerial here um in the dash yellow line are the uh two lots you will note that uh there is an alley that uh will continue through the property to connect um those two other alley segments um ran road is here Allison Avenue is here and and you can see the former mining area and which now has been platted and has mov down here so the new road is goes connects with North Highland Avenue um down below there um the purchase agreement basically says that the city is no longer needs the property for a public purpose that the closing will take place 30 days after the due diligence period has expired or is waved by the owner and that the property is to be platted within one year of the closing date should note that the city manager and the finance director should be directed to sign the two documents on behalf of the city of New Alm Mr shugal has already signed the documents I assume that we would substitute the um uh city engineer for the uh city manager if that would be appr unless you want to wait till Chris gets back yeah depends on your timeline can we make the motion that it could be either one of them and then their discretion designates Chris the city manager can designate somebody to sign in his absence sure so and that's been Joe in the past yeah if if we can have the motion just to include both um either or either I suppose president and counselors um my wife and I live mere feet from this property uh We've walked and
