my question not NE you done Council woman yes I am I have a quick question for St regarding Daypack because I I received two calls on on it I know John at some point you were the staff person you were the staff right at some point for the day pack I still am oh you still are are they are they meeting there was some issues what's the purpose of there is there a mission quum well we meet when there's Quorum we haven't had Quorum um I think believe within the past couple of months we've had qu maybe three or four times oh my God Mr Mayor yes sir um I attend the last dpack meeting and they have not been able to pass their minutes they haven't had a quorum there's 14 members that are available to be appointed only 11 have been appointed and it seems to like the same seven people tend to show up and so since September they haven't been able to uh accept the uh the Motions for the uh approve the minutes and so they keep meeting the Friday once a month at 3:00 the board would like to make some changes but they can't because they don't have a form to make their to make the changes and um I believe that was the discussion that that we had when we were uh at that that meeting um and I believe uh Madam clerk each council person gets three appointees on that um board from what I read that's correct okay so the three for the uh DPAC are all the appointees for that I'm reappointing that are already there but they were district one appointees one of the complaint that I received was the I guess the mission of what it used to do but that that would make sense if they haven't been able to do any action because of lack of quum can we as as a council can we reduce I we try to do that I think we we set we put procedures in place where if they miss a certain amount of meeting that they were automatically removed was it automatically removed or it's not automatically removed the chair of deac um recently we recently sent the attendance and there's been conversations with chair co-chair it it would be at their request they would vote it's been it's happened before we've removed like two people from deac because of attendance but these past couple of months we haven't been able to have quum so the board is consisted of up to 15 people but a minimum of 11 needs to show up so right now I believe we have 11 and it's 2/3 so you need eight people to have Quorum based on what we currently have and are they meeting virtually or in person no they meet in person it's required that they meet in person okay and there's there's four positions that haven't been has been filled in is it because of us or because of them the four positions that's that's on the council counil select well I mean can we reduce the number of participant on the board is my question you could but you could reduce the number on the board but I don't really think it's a matter of reducing it I think it's a matter of people making a commitment to show up well we have that problem with all boys around the city that's why I said maybe those who are interested if if the numbers lower that will help you meet Quorum if it's 15 you go down to 10 if there's not a number for 15 um but that is just just suggestion and one of and one of the suggestions that the board members had said is that they wanted to uh change the meeting back to noon time on Friday as opposed to 3:00 on Friday because 3:00 on Friday people want to get the heck out of town or they want to do whatever but they were they they had a better turnout when they were meeting at noon time on on on Fridays so that time is it that time isn't imposed imposed on them by the city they selected that time there's been multiple conversations on whether or not they would want to move the time they voted on that and decided that the 1:30 to 3:00 works best for the people that are there well we got to have the board in place to for them to decide what time they want you want to me okay thank you so much I remove approval second for the 20125 2026 plan year further authorizing the inum city manager to execute all necessary documents to effectuate said program providing for an effective date and all other purposes tab C good evening mayor city council Laura Woodley Personnel director through the city manager the item before you tonight proposes a new student loan repayment program aimed at alleviating Financial burdens on city employees and promoting economic stability the suggested benefit is designed to provide city employees with financial assistance and educational resources just some background um the average student loan debt has steadily increased placing a significant strain on borrower borrowers especially those in low to Middle income jobs potential benefits of the proposed program One Financial relief for borrowers two higher Workforce retention three encouragement of personal financial responsibility by implementing the new student loan repayment program the city can reduce the burden of student loan debt for city employees especially those that do not qualify for public service um loan forgiveness and improve the overall Financial well-being of our Workforce the financial impact for this item is $60,000 this um budget has already been budgeted for FY 2025 and we do have our representative from peanut butter on the line oh I was just getting ready to talk about them um thank you so much for the presentation Miss I have a couple of question um but I I think we'll I well let's let's listen to to if you has any presentation absolutely is everyone able to hear me all right yes we can hear you Joseph great thank you for uh for having me on tonight um looking forward to walking through things um as Laura mentioned uh really just to set the agenda what I'll walk through is just an overview of the benefit to give you an idea of how it works how peanut butter then works with the employer and what employees will see um as a part of the city so wanted to cover that to kind of elaborate and then absolutely happy to take any questions that anyone has right afterwards so that we continue on with things from there but um as you can see I just started sharing my screen now uh to give you a little bit of a background on Peanut Butter I know it's a bit of a funny name so maybe that's a question that people have uh that's a homage to college students our CEO always accredited back to time in college when that was one of the primary snacks could afford to eat so hopefully it means more when companies offer it as a benefit but overall we've been around since 2015 we serve a thousand clients Nationwide and student loan assistance is our sole Focus uh within our Solutions we have student loan repayment where uh the employer contributing straight towards employees student loans as Laura mentioned with the goal of attracting retaining Talent but also student loan resources which provides employees with the tools they need to n their student data so I want to cover that briefly for you um because really the goal behind it is to help individuals find out how to pay less you all know many Americans have student loans but a good majority just not sure how to manage them more efficiently and save so right from the start all employees would have a loan management dashboard to organize the loans all in fund place they see things like total balance estimated payoff date they have the opportunity to link as many loans here they like this is also where they can select which loan they want those contributions applied to so that way they can Target the one that maybe needs it the most whether that's high interest rate or high ex balance whatever that may be it can be done right here too from there then we take a look at each individual's loan situation that was linked and through our technology provide a curated action list to help them identify teches to save so after they get organized they take a tour of the peanut butter platform they can set up things like direct debit and targeted payments and then move into more curated tools for example we do highlight uh first off everything through government programs and pslf and if that's not a fit then we have a full refinancing marketplace with 20 plus National Community lenders allowing individuals to get quoted within minutes with no credit score po it's as simple as hit a get a quote right here and what's nice about us in all of this is We're Not A lender ourself so we never push employees to refinance because there's some sort of game for our goal is always to provide the best rate possible with as many lenders as can the same school of thought isn't taken one step further with our financial Wellness tools as there's a full learning library that provides education on front but then info on different actionable items like payment options consolidation options additional government programs and special offers and dist so always education first actionable item next and this is all dedicated right through our curated advice insites list so that's the experience that employees would see from the financial Wellness side of things um on the flip side then the contribution piece is really there to make a difference what we've seen Nationwide the average borrower has over 30,000 outstanding and is paying over $350 a month so we're talking about totals that are very burdensome on each individual and less than 10% of employers first student loan repayment so just by making a contribution it's a great way to take a life up amongst competition and Rain Town in an efficient way but right from the start uh it has an employees invited to participate in the benefit they receive a full welcome video and instructions on how to enroll details on what the employer has chose to contribute and really just a full explanation of things they have student debt will then accept that invite create their account obviously have all those resources that I just talked about then also uh link their student loans so we can confirm a these loans are student loans B they have a balance and C they're in the employees name so that way nobody ever contributes towards someone else's Loan in a home or auto loan or anything like that each month they can then track the cont utions right through our system see when they're paid and know that they're always sent straight to the loan serer so the money doesn't land in the employees pocket that goes right towards that outting balance aside from that the conditionalize how many years the companies help shave off their student de and how much toll that has already been saved if they were to make an extra payment themselves what that might look like we then provide all the employees support there by email and phone both during and after enrollment for any questions that anyone might have so that way no one has to feeli that uh in the city they can always send them our Direction and we're glad to assist and then for the uh employer side of things we provide benchmarks uh to design plans to Market insights HR Support dedicated customer success that's assigned to help each group a Communications toolkit that helps promote and announce the benefits of a variety of marketing materials there and then our control panel provides on demand reporting to quantify the impact on a regular basis each and every month to understand how much the city has helped employees save uh and understand really the difference that the benefit have made but all that cover student loan repayment uh obviously we talked about the resources piece first so I know I said a lot and talk quite a bit I will pause now and see if anyone has any questions I'm happy to F those out no we don't this is not not at this time um I think councilwoman Timothy has a question um yeah no this is great wish we had this when I was an employee um but my question is is this for all employees is it for employees who are you know who were here after 3 years um how are you guys I guess Distributing to ensure that you know maybe employees that we know that are really committed to the city are um utilizing the services yeah absolutely that's that's a great question and I know maybe Laura can um chat in about that too but essentially the city controls who is made eligible so you set your eligible population they're invited through the peanut butter system and then essentially those who have student debt will naturally enroll but what whatever criteria you want to put around that maybe you want to have a slight holding period uh so that way people can be with the city for a period of time beforehand maybe you want to cap this all of those things can be put in place um so that's really up to the city but those who then stay with the company or stay with the city and are continuing to work are going to keep receiving those contributions and each month they're going to get their reminder that the city is helping them get out debt faster and making a difference so we actually have a program here internally I have student debt myself and I par ipate been with the company now at peanut butter for 5 years and those contributions have made such a big difference so it's been awesome to see you know it's motivated and they pay directly to the to their loan provider Lo that's correct y okay and councilwoman um we do have some parameters in place um right now we are drafting the administrative regulation and it's going to mirror our tuition reimbursement program so basically um it will be eligible you know to be for full-time employees they have to be here at least a year they have to stay at least a year and a half or they have to refund the city to contributions that's right okay okay yes sir um in the dollar amount the contribution per month would you like to share that sure thank you for that question councilman um right now we have budgeted for at least $50 per employee go ahead just just a quick follow would that be um sufficient people we have student loan because that's a that's a that's a heavy topic I like to jump at this point this is a pilot program that the city is offering and so we wanted to start off small see what the response was and be able to gauge the program accordingly we of course want to grow it in the coming years but at this point we just wanted to have a decent enough budget but to still be able to gauge and make the incremental changes that we need to make and um in um drafting the regulation and everything I think uh one year after is kind of uh little nice can we uh push it to two because you know um we want to be consistent with our other administrative RS so for tuition reimbursement it's a year and a half that they have to stay um the reason why I'm ask is like we've been complaining that uh the city of North Miami has become the training ground for uh other the mun municipalities in the county so just trying to uh you know hold that leverage so we can definitely revisit that um like I said still draf in the administrative reg right now it's in um legal so we will get back to you on that um if we're going to be able to increase those parameters thank you the since the money goes directly to the um the lender the the the servicer um how is it for tax purposes for the employee is it a taxable additional income which $50 a month $600 a year is that going to be additional income that they're going to be liable for so it's taxfree um up to certain limit per the IRS regulations um and basically like I said there's also a tuition reimbursement in place so we're going to make sure there's parameters that make sure it safeguards the employees that if they for instance in one year utilize both programs they don't go over certain amounts okay anything over I believe the IRS limit which is $5,250 would be considered taxable okay very good thank you thank you so much we trying to have a short meeting tonight um public hearing is open on the 169 of the city code on contracts awarded through the Florida sheriff's Association under contract numbers FSA 23- V 21.1 and FSA 23- EQ 21.0 through the national Cooperative sourcewell under contract numbers 10221 dsca and 06320 dbbb and through the State of Florida under contract number 25100 -23 dstc and declaring certain vehicles and Equipment as Surplus providing for an effective date and all uh the item that you have before you is requesting uh two basically action items one is your authority to issue purchase orders uh for the purchase of two jetb uh trucks which are to be used by the public works department and two passenger buses to be used by the Parks and Recreation Department uh these items are this a summer camp bus yes these uh vehicles are to be purchased uh through various uh cooperatives uh we will be looking for the best prices for each of these uh one of them is through the Florida sheriff's Association the other purchasing Cooperative is the national One Source world and also State florid Department of Management Services uh so in addition to seeking your Authority uh to purchase these vehicles staff is also requesting your Authority also uh to declare uh four vehicles that have been identified as exceeding their useful life and which obviously will be replaced by the vehicles uh before you with your Authority um this is pursuant to section 7145 of the city's code of ordinance uh which requires that the council declare that these uh Vehicles be declared Surplus no longer useful in order to be replaced um the Florida chair Association sour world and the State of Florida contracts offer a variety of equipment and services that are made available to elig eligible cities such as the city of North Miami and they offer very favorable pricing and terms uh this item was prepared in collaboration with our public works department and here with me in support of the item is the city's Public Works director Mr kth fidler and if you have any questions okay Love tab g a proposed quasi judicial resolution of the mayor and City Council of the city of North Miami Florida approving an application for a conditional use permit in substantially the attached form for the development of a three-story 16 unit apartment building with 26 ground level parking spaces on one parcel of real property located at 550 Northeast 127th Street folio number 06223 0- 0253 0 and totaling approximately 16,500 ft 0.38 acres in accordance with article 3 division 4 sections 3-4 2 through 3-47 Article 4 division 2 sections 4-22 section 4203 parentheses capital A and section 4-25 and Article 4 division 3 section 4-35 of the city of North Miami code of ordinances chapter 29 entitled Land Development regulations providing for and effective date and all other purposes tabg thank you ma'am Miss love good evening Mr mayor council through the city manager Debbie love uh development services uh what you have before you as uh read in the title and in your staff report is a request for a conditional use permit is actually in uh located in uh uh District 3 the request before you is to allocate 15 floating units from the bonus unit pool um for a project located at 550 Northeast 127th Street it's a little little less than 17,000 square ft so it's less than a half of an acre the it's currently developed with a single family home it's R2 um and it's uh low density residential in the future land use map but it is one of those four remaining applications that were in the located in the former nro it has vested this has been going through the process for quite some time time um they have completed their final DRC conditional use permit review and is now before you tonight it did go before Planning Commission in December they recommended adding some type of rooftop amenities and at first as you probably read in my staff report that would have required them to go to the board of adjustment to get a variance to go above the 35- Ft height limit um part of the delay was they went back and redesigned it so that they could add the rooftop amenities and stay at the 35t height limit that was a pretty was pretty uh tough to do and they did a good job of this particular project it is three stories 35 ft in height um it's 16 units and it will be uh green build as we require in our code um one of the comments that they made in their Loi that we've cited here is that it's an inclusive and accessible property for all abilities uh and we are trying to encourage Universal Design in all of our projects so that it it actually serves multiple type of abilities uh does have will have the enhanced storm water management and you can see there's a lot a lot of vegetation they have a very large area in the front um and that is you know designed very well with a lot of landscaping it is again as I said it is within the 35 foot height limit so kudos to the architect for reworking this product um economic impact is a little over 100 full-time and part-time jobs during the approximate two years of construction with about $7.4 million in wages anticipate most of that will be spent here in the city or within you know Miami day County itself about $250,000 annually in ADV valorum taxes and although here you'll see that that it's 250,000 for impact and permit fees with our new impact fee um ordinance that goes into effect April 14th um most likely we'll be obtaining a little bit more than that money from for the impact fees one of the conditions for this as we always know that the next step assuming you approve this this evening to move forward is to go before DRC for site plan review and come back to you uh we do have some standard conditions uh one of course is the con the maintenance construction and maintaining a 6ot wide sidewalk along 127 as well as maintaining their sustainable commitments and they have made quite a few of those so on the next steps it's all TBD depending upon the applicant when they submit the uh DRC site plan and that will be coming back to you for final site plan approval and that is the end of my presentation I know the applicant is here and they have a presentation for you I'll pull that up right now sir similar to what you have what you just um showed us no we're going to see it but okay where where's the applicant okay I have no idea it looks beautiful no I don't think we'll ask her 8671 noreast might Court elport Town Florida you got to speak in the in the mic oh yes okay tonight I would like to um present you the uh project we're proposing uh D Nami at 550 noreast 127 Street North Miami our firm designology um is an international award-winning company uh one of our projects has been entitled with um uh best residential propy Florida and received also mayor's award it takes a village dwell Nomi is specifically designed to cater to the buring demand for affordable living spaces near educational centers and employment areas this project represents a unique opport opportunity to create a vibrant and Innovative living environment that promotes Community sustainability and Modern urban living market reports forecast infield developments to increase in the coming years as the communities could be a solution to the affordable housing crisis affecting Mii day city planners see infield development as essential it's a way to end Urban spr and improve Service delivery to a growing population at lower cost in infield development has increased in popularity over several decades because it uses existing physical and social infrastructure is close to amenities and enhances local economies some governments and planners have set infield development targets to enhance the communities Miami dat County and city of North Miami are witnessing a huge growth in the number of Mega scale apartment buildings dwell Nomi residences is aiming to fill the gap between the mega siiz apartment building and single family homes by offering the advantages of Community Living Without sacrificing privacy and authenticity the smallscale infield development acts as a bridge and enacts a softer transition from the single family residential neighborhood to the highdensity urban exciting opportunity to create a modern sustainable and Community focused living environment we are confident that our design principles and Architectural features will not only meet the needs of residents but also enhance the neighborhood's overall quality of life thanks for your presence and support thank you thank you thank you thank you so much um any anyone signed up Madam clerk no okay deliberation no okay thank thank you for that presentation first and foremost the building look spectacular look gorgeous looks very very nice um thank you the the only well my particular issue and I don't know if my colleagues this is the first time I'm seen this project and and I've been saying to staff please let the at least the developers not out of respect for us because I did get like a couple of text regarding this particular project but I I really I I thought they they kind of confused the folks that the residents that was you know texting me I thought they meant the next um item but now it kind of makes sense cuz they were saying something about you know Northeast 66 um 6th Avenue and I'm like no no no it's it's busy we talking about so it's always good if you would you know at least you know come and let us know this is what you are doing so if we do get residents who have issues at least we could know in terms of you know how um how to address them but it it's a very very very nice building um that you know any of the other um colleagues any of the um mayor if I may um I did not meet with the applicant as well um I know when we had a project similar to this size that's why I thought it was Edwin's project that there was you know some oppositions the residents came out he had to go back into a couple of community meetings I know you're directly next to another um smaller building behind the red red and blue but I know that area was a area that we did have some issues but I'll defer to The District representative yes Madam Vice oh no no um quickly I did not meet with the applicant and um like uh the mayor said it's like very nice um quick design and everything uh but I don't know much about the project so I'll yell back to the district yes and so I equally did not meet with the applicant so I i' I'd like to make um a motion to table this item um so we can have an opportunity to talk through it with um my colleagues in the their own time so I'd like to make a motion to table this item please a second would that be okay with you um as the applicant ma' sorry I didn't quite understand um I'm sorry could you repeat oh she's she's asking um she she's saying that if she will give you the opportunity to meet with you know with our with us to present the project instead of voting for it tonight which may not get a favorable voting but you know kind of me with us and cuz this is she represent the district so the concerns some of the residents and all this and all that so that that step that kind of missed that step in in in in far as of meeting with with us to know what you know what concern that we have because we have projects where takes months and the communities back and forth so I think that that was her but it's it's completely up to you as as that you you could say no you want to vote now you could vote on it or you you could take the suggestion of the no so like I said I have a motion to table it I want just clarify to the next meeting second it's not a choice so it's actually she would like to um table it um in terms of the next um the next meeting so next coun just Tom I believe your project is absolutely beautiful beautiful I think it's what that neighborhood's been asking for low rise Redevelopment very good I would like to ask staff in the future when they're meeting at the uh Board of adjustments or planning that inform them that it's usually very very very good to meet with the council person at least for that that District so that we don't run into this because I'm sorry you're going to have to come back but understanding that the the elected body they need to make sure they cross their tees and Dot dots their eyes but um in the future um that that staff suggests to you to make sure we you always uh we do that and that's for for staff um so that you know projects like this don't get delayed yes and so it's beautiful thank thank you ma'am I have a motion made by vice exceeding the max maximum allowed height of 115 ft to 238 ft for a development consisting of a 24 story 238 ft residential building with a density bonus to allow for 96 units where 79 are allowed with 172 parking spaces on one parcel of real property located at 11950 North Bayshore Drive specifically identified with Miami date County folio number 06- 2228 d011 d44 n0 and totaling approximately 0.79 Acres 34,36 Square ft in accordance with article 3 division 4 sections 3-42 through 3-47 Article 4 division 2 sections 4202 4-23 parentheses capital A and 4205 of the city of North Miami code of ordinances chapter 29 entitled Land Development regulations providing for an effective date and all other purposes tab H thank you so very much well miss love you ready yes sir again U Mr Mayor and Council for the record Debbie Love development services uh through the city manager as you um before you is another request for a conditional use permit and just for a statement for the record staff does make these recommendations to every single development project that comes in the city all right so uh again this is a conditional use permit they're requesting two things um as you know the code was amended that allows additional height in the Bay Shore Zone just certain properties in the Bay Shore Zone to allow through a conditional use permit um a height bonus of up to uh 238 plus feet uh and they are also requesting 17 bonus units to be allocated from our floating unit pool uh it's for $ 11950 North Bayshore Drive as you can see this is the property location it's a little uh a little less than an acre and uh currently it's developed with a condominium this has been before you this conversation so this is nothing new it is in the Bayshore that's Bayshore Zone uh it went before Planning Commission in December and they have two recommendations uh one is that they're required to record any Community benefit agreement and I said it says cabin it should say CBA within 30 days of site plan approval and they also recommended that the city hire a community benefits program manager to manage these um these agreements the pro proposal is for a 24 story 96 unit Residential Building uh they it does have an integrated parking garage with 172 parking spaces certified Green Building uh does offer a community benefits agreement the one that's in your package the um there's a slightly modified one that will come before you um that I'm sure that the applicant will speak to to uh enhanc storm water and although in the conditional use permit agreement there's a a little bit of left over language this particular location does not require public art so we just wanted to point that out the economic impact is about 1,600 full and part-time employees during the construction period again estimated about 2 years with $60 million in wages adalum taxes is 1.5 million annually and the at the current impact fee rate the fees are uh for permit fees and impact fees is a little less than $900,000 again the conditions of the CP is uh they it does require DRC review the site plan uh assuming that they complete the finalization of their DRC review the site plan is anticipated to come before you at your febru February 11th meeting they will have to construct the typical 6ot wide sidewalk along the north bashore Drive underground all utilities um they must comply with all the conditions of the shoreline committee which is in your package uh as part of the attachment with the conditions from the shoreline committee prior to building permit approval so before um I will allow the building permit to be issued they have to provide proof that they they're in compliance with with this particular project we also want to pick up the planning commission's recommendation and we're profer that to you tonight as an addition of this CBA recorded within 30 days of site plan approval if you approve of that we'll definitely add that as a condition we think it's a it's appropriate condition so that we can have a time period to make sure that that document gets recorded they do have some sustainability commitments that they are are have committed to and as I said next UPS we anticipate it coming before you February 11th for final site plan approval and with that the applicant is here they do have a a brief presentation and Mr gassant is always brief and uh let me pull that presentation up for you sometimes he's not as brief as I am no no no no no one is we'll see tonight I may I may be able to uh beat that time that's good oh my God just you can leave it right there no you know that's fine thank you she has to recuse herself I don't have to announce it right she her accusing I to anoun just good evening patri Assan of holl the night with offices at 701 Brickle Avenue uh thank you mayor vice mayor and the council for uh being willing to entertain me I will try to keep my presentation very brief uh I'm joined this evening by my colleagues Alexandria s Romain mut and the principles of ala bore rundo onetto and ignasio Montes next slide please as this council is well aware this is a project that has been in the works for some time as part of this project we are seeking uh 19 uh 177 bonus units to develop 96 ultr luxury uh Condominiums uh these Condominiums range in square footage between 986 ft and uh up to 4,000 ft uh the price range of these Condominiums will be between $1.5 and $5 million uh as part of the project we are providing a robust Community benefits package uh there are actually some changes that I will talk about to the community benefits package later on uh that we've accommodated but I think that uh we've taken into account both the community's concerns the council's concerns to ensure that the the best of the public welfare is addressed uh this project will engage with respect to the uh General uh world class amenities that you want to anticipate for a luxury community of this caliber uh and we anticipate that this tropical luxury design will be a substantial enhancement with respect to this area next slide please uh as you all know the housing stop within the city over 80% was built before 1979 uh this project will help to provide for more resiliency more modern uh developments and more storm hardening with respect to this area that is south of Northeast 123rd Street next slide uh as you all know I'm going to go through this portion very quickly because I know this Council was uh very well aware of this uh the council was willing to uh adopt a text Amendment to the area in the bz south of Northeast 123rd Street on the east side of bore drive next slide uh this is the area that is specifically identified uh as part of that text amendment that provided for the opportunity to go up to 238 ft 10 in as part of our request today we're not seeking the Max uh we're only seeking to go to 238 ft uh we're leaving the rest uh on the table next slide and as part of this process we've been able to provide for a project that the Planning Commission found was compliant and consistent with the text amendment that was provided uh and adopted by the city and the Planning Commission was uh kind enough to unan iously adopt uh the recommendation to the city council to approve our cup that's before you this evening next slide uh this is the property's location you may be um remembering that maybe about a month ago we had another project immediately north of this project uh that sought the additional height uh we are sandwiched between the two other properties that receive the potential benefits with respect to the height uh in this area next slide uh and as as a brief uh background we wanted to provide you with a sense of the compatibility within the area you know the project to the north has been approved uh we showed that portion of the slide on the Northern portion on the right side continu condominium and then of course myor Towers to our South next slide and this is just a view of the project in context of what is already approved uh immediately to the north of us is the continuing project that has been approved and part of our project if it fits nicely into uh that uh framework that has been established respect to continuums uh approval next slide as part of this project one of the things that we wanted to to do is to curate and provide a robust Community benefits package to the city uh aside from the fact that this project in a period of 20 years will provide uh $40 million over a 20-year period we anticipate that there are substantial Community benefits that we're going to provide as part of the community benefits package that we're contemplating uh here uh as part of this project we are going to be providing um a $100,000 contribution to the police department for Glock transition ballistic Shields crime Sheen equipment uh PL power engage platform in the amount of $100,000 providing a contribution to enchanted forest for $50,000 next slide uh we're also providing a $100,000 contribution to the uh Community Transit and we're next slide providing for a $50,000 contribution to to improve 2,000 linear feet for the enhancement of the wall uh for SSI you can see on the on the left there that that's the existing wall and what we'll be doing is providing for uh clua Hedges to provide for the beautification of that area next slide we're also providing for uh enhancement on our site where we're providing um French drains that are going to help to accommodate uh the drainage on our property as it exists today that property drains onto uh North B Road drive so we will be accommodating the drainage as opposed to um creating more drainage issues onto the road next slide uh in addition to that we're providing a land that's across the street from our project uh for the conveyance of a lift station to help pump out the drainage which goes above and beyond what our storm water requirements would be uh in in addition staff uh Miss love and her team uh are requiring us to go 10% above the regular storm water requirements so in addition to what we're doing onsite we're providing for 10% Improvement and a conveyance of our property in order to provide for a pump station to address the drainage within the area we're also providing $100,000 to uh build Leman Park which is north of our project next slide uh we're making a contribution for briway uh Park canopy project bris swep uh Park canopy project in amount 100,000 next slide uh we're also making for beautification along Griffin Boulevard between Northwest 120th and 1244th um and we're providing for uh those items to be addressed between Northwest Second Avenue North uh North Miami Avenue the amount of 50,000 uh next slide uh one of the items that I did want to address is that uh it came to our uh knowledge recently that the uh pedestrian bridge renovation project project that we were anticipating being able to provide for is actually being addressed by the city and so what we're doing instead is providing for a $50,000 contribution to the city of North Miami youth Council as part of this project it's one of the uh amendments that we're making to the community benefits package at provision 9 uh and it's one of the things that I wanted to make sure I put on the record I have it on my on my copy but I want to make sure that it's something that's addressed later on next slide uh we're also making a contribution to the uh food pantry which we know helps uh address a variety of needs within the community uh in the amount of25 ,000 next slide we'll also be providing $100,000 contribution to the Nomi golden silver senior program and next slide and we'll be providing a $25,000 contribution to n FES provides for fundraising activities uh for needs for members within the community next slide in addition to all of that uh this project is going to have a substantial benefit within this area because it's going to provide for unrestricted dollars in the form of tax benefits uh as I noted earlier in the uh presentation these are going to go before $1.3 and5 million as part of the project next slide and we'll be paying for about $1.8 million in Impact fees to the city uh to the county in Mii day Public Schools this impact fee is actually going to go up because as the council knows about two weeks ago uh the council uh instituted an increase in the schedule of its impact fees so that is scheduled to go up substantially next slide um we anticipate as Debbie noted that we would have nearly 2,000 jobs during the development of the project and we anticipate that within 5 years there'll be over near nearly $8 million uh from this one project to the city in over 20 years over $40 million next slide uh but when you take into account the two projects when you take into account the continuing project and this project within a 5year time frame it's a $28 million um unrestricted dollars coming straight to this city and over 20 years we're talking about $140 million from two projects that provid for unrestricted dollars in addition to all the community benefits package that we're providing as part of this project and the final slide is we just wanted to recognize that as part of this project we are going to have over $14 million generated every year from these residents and we anticipate that they'll be having direct spending uh so I wanted to keep it as brief as I could go over the issues uh I'm here to answer any questions thank you for your time and I like to preserve some time for rebuttal thank you so much Drive um in the the documents that I uh pass to you uh do they have the is this same yes oh okay um you can see that the what is allowed by right according to D public record from the uh information system of North Miami they are they are allowed to build up to 11 floors um and 69 units that's the as put the record they are asking for bonuses in units and height those bonus are not by right is you have the discretion but we feel uh we as the community impacted we saw that there is a big risk in safety the the in in the document also the um the chapain tower have a similar situation like we could experience in mayorca Towers our building is uh 50 years old building this uh gigantic uh new building uh represent a a extra safety risk in detriment of our building in mayorca uh in addition we believe that there is no um there is a a lot of issues with congestion um that could affect uh in detriment of our community uh for that reason we oppose any um that non-required um bonus in units and um non-required um bonus in height we would support uh more commensurate project for a 16 floors even that they have only the right for 11 we will support something uh like 16 floors and um up to 74 units thank you thank you guys the order that I call and please come forward um Nancy oski orski correct and Then followed by's okay got it so she's got it thank you so go ahead Sir Robert yes Robert ovsky yes I'm a resident of maoka towers uh Este steem Council thank you for giving me the opportunity toh discuss this subject with you here today first of all congratulations very nice design I appreciate that it's a nice building which is planned uh just adjacent to our building however we are not in agreement with regard to the height uh there is mainly two two issues or I would like to raise two concern one is the infrastructure the consisting uh the the infrastructure which is in place at the moment and the second issue is uh the impact on the ex existing construction right uh andando already alluded to it um with regard to the infrastructure we are with the bay show drive we are talking about a one lane Street we are talking about uh with this buildings with this two projects actually adjacent uh to our uh to our building we're talking about hundreds of cars during rush hours in the morning one lane Street um probably 10 20 cars every minute queuing up at Northeast at 123 uh Street we should consider also the the the sequence of the of the traffic light so I'm I'm concerned about uh I'm in particular concerned about the congestion and about the existing infrastructure here and secondly as I mentioned the impact on existing Construction um a high-rise building like that requires Foundation requires a certain piling design which is definitely has a larger impact to the uh to the underground to the soil than uh six thank 16 floor building uh there is problems or there is thank you thank you thank you sir thank you so much how sugar fi um followed by how we going to have Tanya tski and Claudia Claudia Pas pasino okay good evening uh Hal shael uh 11 1930 North Bayshore Drive majorka Towers uh by the way I don't represent suies I just whatever it's worth it looks good uh the um you know I've asked you guys and women in the in emails have you guys driven through the area have you guys ever charted like the detectives chart a murder where all the traffic where's where are all the areas where the congestion is coming have you guys driven down 120 F Street during very busy hours it's really bad and that's even before you started your projects and I I just get the feeling that you guys gals women don't feel that the traffic is a congestion is an issue and it's everywhere the traffic is everywhere what do you want us to do I don't know but we're going to be burdened and I think that as a representative of us you should understand what we're going to be going through if you live in this area also the project you just approved at the Mariner Bay they were pleading poverty and I know that 45% of them are in a bad situation but the majority of that building is an investor building so the developer made you feel that that you need to help the area you're basically saved a property that is majority owned by investors and the area is being sacrificed for those people so uh so my my main thing is that I I just don't understand why there's no infrastructure what the plan is from the developers or the community or or the government to help us why why are we going to be stuck with the congestion because you I understand you guys need money for water plants for other things but what about us what about us thank you okay the person didn't show up yet Claudia pasino 13504 Northeast 23rd Place I'm opposed as you know I do not know why we need to have these Mega buildings the city is fine the way it is I do believe in fixing stuff making it better but we do not need such height as somebody mentioned we need to focus on what we already have we need to focus on the infrastructure all the streets that currently get flooded there's a lot of stuff that the city needs fixing and adding more height and we don't even know if all these buildings are going to get filled cuz I believe the gardens is already half of it it's done it's not even filled so why are we making all these Mega buildings and we're not even sure if we're going to get all these people to move in like let's focus on what we have now thank you the next the final two speakers William pel and old now on P that's basically it and then we'll be closed with that I can't see M good evening everyone um William prevel uh 12000 North Bayshore Drive as well as 11 1930 North Bayshore Drive both my Mariners and mayorca Tower and I'd like to clarify something by people have spoken earlier First mayorca Tower just received a great structural report everything is a okay and fine no problems at all in addition to that even if this building goes up next door right on top of it they are not driving piles and pounding they are doing augur piles which are screwing into the ground and bringing back the uh the material and then you drop a cage and you pour it and there's no real disruption to the neighborhood something to be relieved about um in addition to that Mariners Bay is not uh invest s mayorca is not investors it's predominantly by far majority people who live there you can tell by the cars they're there and they go home and I know these people for now 25 years uh it is these are regular residents who live there I'm strongly in favor of this project if there's any problem is that it really isn't high enough it isn't good enough for people who say why is it so big hey the city needs the money are you going to do something if I live in these two projects or anywhere in the neighborhood do I want an inferior building built do I want the least possible I want the damn best thing possible so it sustains us so it's more secure so people are paying more to city taxes so we don't have to pick up the uh the money on that we want the damn best project possible and with that I'd like to ask you once you approve it tonight I'm saying that if they should happen to come back with improvements on their proposal to please review it and hopefully accept it maybe there's a way we don't need 40% of the building looking north and south and to the neighbors maybe we can raise the street to avoid the problems because it will continue to flood the drains are not going to do it for any of the projects Al there the street needs to be raised half of the properties are already raised so everybody property is going down please consider thank you much Bill thank you so very much um that's the end of um public hearing one she didn't oh you coming okay I support support go ahead your name and no just your name and your address and you can say that mhm North by short drive M perfect I support the the project thank you awesome thank you m clerk here we go Mr attorney any rebundle I'm going to be very brief um first with respect to chaplain Towers there are thousands of buildings on the bay on the water that have not fallen down and that will not fall down Champlain was a tragedy it's a horrific iic event that occurred and it's something that will not be repeated that's something that we will not repeat that's something that would destroy somebody's reputation it would be an everybody's best interest that nothing like that ever occur and I do not anticipate and I would not be represented of I would not represent something that would I would believe would cause something so horrible and so tragic um and I think it's it's uh it's emotionally triggering to bring up something that that that's that that that is so it's so traumatic it's hard for me to get it out to think about how bad of a project and how bad of an impact it was on certain communities the second issue with respect to infrastructure the whole idea of infrastructure we've shown you in our community benefits package of what we're doing respect to the infrastructure within this area we're going above and beyond in each category to address infrastructure on traffic they said well you you're you're adding so much traffic really there's already Zoning for 100 dwelling units per acre in this area this is where the city has decided that if there is going to be traffic it occurs here in this area because we have the facilities to be able to address it so the idea that this project is going to address that those traffic issues does not abide by the policies and the commitments that this city has already put in place and the zoning that was well in place before we ever had the hype and so for me those two items for me I don't think have any um real uh basis in reality or fact and finally I would agree with Robert this is a very nice building uh but even better than this building is is its impact on the community going above and Beyond with respect to the community benefits package and the unrestricted dollars that this Council will have to be able to improve uh the city and I'm excited about what this talented Council will do with those dollars to improve the public goods thank you so much I am here to answer your questions okay thank you thank you so much Mr ah it it's a lot to you know get out but I see um well why you know we can start with you let's start with you you're the closest to the district and then we'll go from there go ahead there's a lot of information floating around out there I by the way city manager I mean City uh attorney um I've met with the applicant I've also met for people who have been for citizens who are for it and citizens who are against it I have received emails on both sides of it through the city email system um so just want to make sure we put that uh out there um the one of the concerns I have and one of the things I want to make sure that if this project is approved and we have two major projects going on at the exact same time that the building department that both developers work in unison with with the building department that you all if this project is approved that two years of construction two and a half three years of construction once it gets going um you're going to have to have some logistical magic taking place out there staging a crane that's going to go up 24 25 stories and you all know your business but the footprint that it's going to take up that you all if it does get approved are going to have to work in conjunction with the building department and have a plan in place by the time a site plan comes back or an understanding of what it's going to happen and that there's continuity between the two buildings of the road improvements the sidewalks the landscaping again leaving it up to the the building department to work with both uh projects if it's approved um to make sure that happens if you have Surplus land around and this is just a suggest around the pumping station that you guys are giving up the land for or a partial of it if you find the piece of land there that is not buildable that is you can't put a parking there and you can't put other things would greatfully ask you to consider making it available to to the city to do as they wish with it if it's not usable to you all um in conjunction with depending on how much of that property you leave because it's a weird piece of property where you're going to put this pumping station um I know you don't know yet who's going to put that pumping station in there whether it's the county or the city whoever it may be if there's an odd piece left please consider us um the community benefits that you're proposing is is nice thank you um but rest assure there is an impact on the community and I think that we have to plan for the city for the next 50 years not the the past 50 years and um I understand the concerns of the residents and as far as Minorca Tower goes I've gotten just as many people who are in favor of this project that live there as I have people who are against it so no particular individual speaks for the whole unless that board of directors or so forth presented us with something because I'm getting plenty of for and against within in the the uh the neighborhood what my concern will be is definitely join the construction process that we mitigate the traffic uh blocking off the roads you're going to have to replace uh take out that median just for staging and Logistics purposes that the building department staff work with you on that and then between the two developments if it's approved that you all come to a consensus again with the building department that how that street is going to be restored and I don't think I'm asking for anything that um isn't that's out of the realm of what any other construction site would be be asked to do councilman the only the only uh modification I would make is initially said prior to site plan approval I would just say prior to building permit that we have the opportunity to coordinate with the building department to ensure continuity with respect to that area to ensure that as far as the construction is going that we're addressing those comments to the satisfaction of the building department we just when you come back if you get to come back for a site plan approval is that the site plan is consistent with what the end product is is going to be and again the sto that if both projects are putting in storm drains that you guys work with the building department to make sure there Synergy is is in place that if you have to raise the road that it's all done at one time and just all those kind of uh things logistically and again that's if this project gets moves forward 10 for councilman thank thank you so much um councilman Charles oh nothing yeah yeah um just want to see uh residents um have have a right to uh object to U any development that we have in the city uh one way or the other as uh councilman burn said is going to affect their life but we as a city we have to look um to um the next 25 40 50 years um if I just take a step back in 1995 um driving around downtown Miami there are only about two um tall buildings and if you look at them now they're not even tall compared to what we have so we need to understand that the city cannot stay in the same state that was like 50 years ago as we move um ahead we need to plan we need to plan for tomorrow we need to plan for the Next Generation the project is not in my district but the project is in the city of North Miami uh and again project is facing the other side uh which I am so um jealous of Cu if you look at them and even if you take time go over just now you just go over and then you see oh they look nice so beautiful and then we are flat I think it is time for us to step up and looking at the benefits tget even it is not such of a big project but look what they offer to the city to our seniors to our Parks so we need to understand one way or the other and now if talking about now traffic is a problem it is going to be a problem tomorrow it is going to be a problem in 25 years because we just keep on expanding if we take a look at adventur North Miami Beach in every is doing it so the city of North Miami I think in all looking at all those uh municipalities we are far beyond beyond um what they doing so at this point if the project makes sense if it is doable I think we need to take a look at every aspect yes we are going to also make sure that our residents are being protected and everything uh um a project like this one it is a plus it is a win for the city it is planning the city of nor Miami of tomorrow and I think we are in the right directions the projects look good and um I'll just say thank you uh for the benefits because I'm looking at it for the side of uh of the land that you have in the project and everything so you guys are doing very good and so let's see exactly how we going to move with it because the city of North Miami we cannot sit back and think of that City 40 50 years ago we have to see the city now and where we want to go for the next 40 50 years thank you thank you councilman thank you vican thank you so much thank you for your presentation thank you for the considerate Community benefit I just want to I didn't hear and I'd like to include as you've heard traffic a lot of traffic so I'd like to know if there's a consideration for 100,000 to be put towards freebie yeah so if you look at provision three in the community benefits package that's that's specifically outlin address just wanted to make sure that it was there okay so just you know thank you thank you thank you for that and and you know as always you're Pro here um just working with the community is what you know what we want make sure that you're hearing their voices um and you you're you're working with staff and the community as best as you can absolutely again thank you for your presentation thank you thank you vice mayor and um thank you Mr Pedro for explaining this in detail to to go back with I I I believe it was um maybe it was how no Mr herberto mentioned it the issue that fundamentally um that I have with the the corridor and I mentioned this to you um but as I was meeting with some of the residents and and I kept saying to them I think we we need to well they need to engage a little bit different in terms of the folks who are opposed to it what whatever the case is but what I say to them at the beginning and what I'm going to continue to say fundamentally when we were changing the the height or the resolution that allows um it's and in Mr Alberto is right it's not is a right is is up to the the two whatever the the maximum amount that we had voted for that was the critical vote that I stood with members of the community against um and and I was the Lone person that kind of did that in terms of that moving forward we we we we we we failed we did not pass moving forward I think the residents we have to engage in a different way I cannot sit here as the mayor of the city a piece of legislation that would have kind of stop all of these the community did not come out the way they were supposed to come out whatever the case is if it was SP whatever the the detail was that they was not here but we have to recognize that with each Pro with each project we missed the mark when we had that big meeting and I and I been mentioning it with you Mr Alberto in terms of that does that mean that we every project that comes to me as the mayor because I had the a vote that did not pass that I cannot vote on it or I shouldn't vote on it and I and I don't think that would serve me the residents serve any anyone um right in terms of the project just like the last project it's a it's a beautiful project um my issue again is the height that I had but they the the applicant before kind of settled the the the height so however want to be creative what whatever the case is when I looked at the project I looked at um the different components of the project I do um understanding talk to some of the residents with concerns with traffic um but traffic is something all over the country that we we we we have to kind of address and and it's not something only in North Miami it's something that's getting um probably worse um and and this is part of The Narrative of the president sending out you know all these folks what whatever the case is which is not the case but you know that this is where we are so traffic is a problem everywhere we get that and we are working with the TPO to to to to figure out different ways because we don't have a public system public transportation system here um and but that's throughout the county so that's not that's not that my last statement before we we go on this in in in terms of the infrastructure that word is being thrown it's not a sexy word it's being thrown around out there in in terms of you know when we have new projects and and residents got to understand that the infrastructure kind of come with it they kind of built the infrastructure we are a city that's going to be 100 years old um next year so a lot of the um housing stock that we have was built 83 whatever years ago so when you have these new projects they actually help in terms of the water St you know whatever management system that that's something that I I do have to give kudos to the administration and to um Debbie's Department to make sure that we we we meet there's certain requirements that has to be met parking and all this and all that so when we come out with with the infrastructure they actually and I'm not I'm not saying I'm I'm with them but I'm just saying that some of that proposal they putting stuff up to help out with the um the water storm issue that we have and that water the issue that we have on the east side specifically um when it rains and all that is part of with fot um we do not control um you know that area but that's something that we are working with with every that and um the different entities that we do have partner with to to come up with a plan to actually um you know work and fix that so again Mr Pedro this was Gant this was very very nice um I don't have any issues my issue is with the height but I can't blame you with with that I mean I voted against it and I would vote against it again and that's why I tell the the the the the community you already know where I stand on that issue on on the height thing I didn't like it I don't like it but it is what it is I'm not going to be the only person up here just to vote on something that the rest of the council already um voted on whatever whatever the case I think we need to kind of forgot with that being said I say thank you um thank you ma'am Madam move forward on second I have a motion made by councilman Charles to approve thank you um thank you citizens Forum we got discussion uh discussion regarding the qualifying regarding qualifying by petition presented by councilman Pier right I'm sorry Bill give us 10 minutes I'm sorry I I skipped the item we had one of the discussion item that was taken off I you know I forgot about that I am so sorry um yes discussion councilman Charles oh yes um thank you mayor um council members uh the discussion item before you tonight is um regarding ordinance number 1512 city council candidates alternative method of qualifying by submission of petition some um resident of the great city of North Miami argued that collecting petition from a specific district is not a good representation of our population resident in my district whom I met during the course of my campaign some from present 133 134 135 and 136 I've also argued that that a sample from a specific district is not the best way to represent our city and I tend to agree now in statistics a population is defined as the entire group you want to draw conclusions about whereas a sample is is a subset of a smaller is a subset of that population therefore it is fair to say that a sub set of a sample can never represent a population according to this resident candidates for city council want to be qualified by petition should be collecting data from the city at large as opposed to a specific District yes as a council member I represent the district and all of us represent the district but above all we represent the city of North Miami George all said and I quote those who control the present control the past and those who control the past control the future it is with this sentiment I present to you mayor and esteemed colleagues this discussion item for your kind consideration item ordinance 1512 I think we need to take a deeper look into it and I did vote for it and that's the reason why I bring it in here for us to look at it and see if we can um just go ahead and fix it one thing for all and back to where we are uh where we were before this um ordinance thank you may thank you thank you thank you councilman can someone staff or is it would be the clerk give me some background or something or it would not be the clerk it would be the well no it it's it's it could be the clerk it's it's part of the that office the attor oh you madam attorney it's all yours mayor just as um from historical perspective um as councilman Charles alluded um prior to the adoption of ordinance 1512 by the mayor and city council unan unanimously on October 10th 2023 um the alternative method for qualifying as a council person meaning not paying your fee um qualifying via petition required a number of signatures through the entire city a Citywide um for the district candidates the adoption of this ordinance did change that so that for the districts it would be a percentage of signatures just from that District okay and so what councilman Charles is seeking to do is to sponsor legislation to restore it back to the old mechanism whereby signatures were collected Citywide and and and please forgive me if I've misspoken Char is that coun Charles it is okay so let me ask it's kind of interesting um conversation but so if they running in district one they would only need to get petition from district one is it how it is right now that's how it is right now okay so what's the so so it would now require them to get signatures Citywide but that would kind of one second it wouldn't be required they would have the ability to collect signatures Citywide yeah wouldn't be required it would be okay okay so it would be okay I I mean I I think what we're missing is is the mathematical problem right so it's whether you're going to require 3% it's the number of petition 3% of the city the population of the city or 3% just of the district but it shouldn't be it's a much lower Citywide yeah isn't the mayor more the mayor is Citywide that's what I'm saying this would apply to Only The Districts that that which makes sense so now you want to move that where it makes sense what create a lot of um explain um ambiguity uh if you look at it uh in term of uh What the residents are saying is that qualifying by petition before make more sense in term of a candidate and I think uh the last one to do it was uh the election before you go we have people here in this election and um you go all over the city and collecting representing the city what does that how does help mayor we are not representing the city others that help but you need you will need to go back and look at the law what we have the ordinance that we have before uhhuh what we have before because this is the first time that we uh we use it so we fixed and um it was not a it was not basically it was not a fix it was like to me more it was more and error you understand so this doesn't work for go ahead can I ask a question for the City attorney for clarification if it's 3% of the registered voters within the district will'll take district one M if we change it back to 3% of the city you're now going to the registered voters of the city which is 28 30,000 people you're now increasing it from getting 300 people in my district to now getting no you're you're no she's saying the threshold listen the way it is now yes to qualify by petition let's say in District Four you need about 270 signatures okay in District Four to qualify by petition which is good as opposed if you go back that take that 3% in the general population because look the way okay take exactly what let's say if we have 30,000 mhm registered voter in the city of North Miami and you take 3% of that you will see the difference that's 12 I'm not good exactly you will see the Gap you understand exactly you see that's what I'm saying exactly you will see why would you want that versus um how you have it because I'm I'm up the thing where the people you're going to represent you need them to to to sign your petition I I wouldn't want like somebody to go out in District 4 man and who's running in district one and get it all may I say you can still have there all of us we all have for example the number that was just used 900 people in our district so you don't you you don't have to it so I think if and the City attorney can correct me I think the intent is that it is 3% of the registered voters but you can still focus on your district and get that number or or you're not limited just your District yeah that I think I think that could be if if you're not limited I could see that you know as you know because I do see that the point where you have more people you could get more people elsewhere whatever the case Mr manager I mean Mr uh mayor I think you're getting it making it much more difficult for a candidate that doesn't have the $5,000 to to pay the filing fee they can go out there and gather 300 400 signatures whatever it is in district one two or four as opposed to having now making it much more difficult making it suppressing people who are underfunded from from running for office that they now have to go out there and collect 900 to a th000 maybe even more depending on the number of registered voters at that at that particular time you're making it much more difficult um for somebody to to run for public office which I think uh is unfair I think the way it was changed that the people of the dist you go in your District you get the couple hundred signatures if that's what you want to do or or you pay it you want to make the political process and campaigning as open and as easy to comply with that's why we had the establish of qualifying by petition so that just rich people can't pay the the $5,000 and that you can do it with leg work and knocking on the door and see if you're going to get any support whatsoever from your particular District um I I don't think it's it's fair to go back now and all of a sudden you know that we're going to raise the number of signatures way up you're you're quadrupling it four you know three four times more one one thing I'll tell you um councilman Burns as you know for the next four years I'm not going M that's the first thing so I'm not doing this to um benefits Charles per se or consumer Charles but looking at it as um as nice as you want to be but also we need to make an effort to push for more in terms of numbers that you need to qualify by petition yeah that's my issue why why why do we want more like the way it is right now it's it's in the benefit of everybody the candidate us you know you get you focus on your District my question to you is so so we won't be focusing on the district it can it can still be it won be listen listen mayor mayor you can sell Beyond The District but instead of getting 250 petitions sign which easily you can cohost some of the resident inside from for some of them I've seen it and I have examples of it and you get that 250 petitions as opposed to 800 80050 is not the same so you will get more of a of a better of a better um um um simple than what we than what we having now what we having now yes cuz I'm lost with the so what are we trying to do we trying to change where people would the intent miss miss Warren just just going back to the old system what we had before but the old system wasn't good that's why we changed it so are we going back to go ahead so it's it's raising the the total threshold amount of petitions needed to qualify oh no without that's making it harder and are we open up for if I want to assume I could say well this unfair um how does how do how would that go so this was the mechanism this was the threshold amount that was in place until the adoption of ordinance number1 does the state say with their Statute in terms of collecting petition does it can you because I know you have to do it within your District because like what he's proposing is like outside of of that area outside of your District which the benefit would be you have more people you could but the logic is you still have more people you have to get stuff to not necessarily their signatures got to be any any good so Mr Mar I have a question is yet if we get signatures from Citywide yet only the people in our registered in our district get to vote for that that council person yet what's to stop a group of people in district one from putting up a a fake candidate in District Four or District three or whatever very easily collecting or doing 800 votes signatures over there next thing you know you got two three candidates that are shills or or make believe candidates are coming from a district just because it it could be done so I mean there's a lot of crazy counc I don't think you know with with your argument they don't have to be fake it could be just a real candidate just make it easier in terms of you know manipulating I don't have any issue with with with it councilman um uh you know Charles because it doesn't really impact me but I'm really really trying to understand the the the whole I don't know councilwoman you're going to be running in two years yeah how does that how does so so they saying right now for for District Two what is the the law so she has to collect 3% of her District it's 3% of the total registered voters in in her District versus 3% of the total registered voters Citywide oh I I now I see what what what he's well wait a minute I thought I saw what what he was saying when you put the formula like that does the number increase based on the number of registered voters correct oh okay then then obviously we we going back yeah so why would I want to increase that for anybody is the question I guess well I'm not asking I'm just putting it out there okay well Vice man this is just a discussion right so you bring discuss it is a discussion but we want to at least see where we are you know okay and if somebody doesn't want to do the petition they they they pay the the the the the qualifying fee but again why make it so difficult um if a 3% of the district wants to support somebody and I know people who signed the signatures had no intention whatsoever of voting for for that particular person um and and they can they could actually sign more than one one petition to qualify um I just rather myself would like to see it where it stays this way because let the most number of people who can qualify by petition and and run and be part of this whole process uh and so be it and let the people of that particular District decide if uh they're going to qualify by petition or or not uh because after all it's only the people in that particular District that are going to get to to vote for that if I make one one last point on that um like I said earlier we have to look forward and sometime in planning these kind of um policies for the city we have to look Beyond ourself looking at the last election we are the only city where each and every race went into a one of you know why you hold on mayor you have um candidates would just jump into the race because it is so easy with that 200 petitions oh hold on one second May with that 200 petitions you just qualify and move on and keep going so each and every race and of Miami just went into into um oneof so looking at it we need to make sure that we open the floor for um candidate but also you have to look at the viability of some of the candidates and then like I said this is not about chars I just got elected for 4 years with 75% of the vote I am not defending Char we have to look out for the city the city of nor when we set in policies we have to see what makes sense and what doesn't make sense because uh numbers you cannot be playing with uh playing with numbers uh yes if you just want to collect the petition from from the district let's go with that 3% and get that 3% from your district from that instead of getting 200 200 um signed petion and be qualified then you will require to get 700 let's get the let's let's put it in a way that we don't have in one one R you have like about 8 to nine um candidates because that would just put the city in that I'm looking at North Miami Beach for example you have two at the max three that in North my is like everyone is a is like just moving in there and some of them don't even campaign but it is so easy now with what we have like about 200 petitions just qualify instead of paying the 500 and plus dollars that you would have been paying for for qualif for the qualif ific so I'm just putting it there that's why I put it as a discussion item so um we look at it as U policy makers we decide exactly how we want to move and um tonight we're not going to vote on it um but I would just um kindly ask um our city atton here um what aside from the discussion tonight so where we um we go from now well hold on yes so actually I'm going to just follow up on his question and just want to just specify this would be an ordinance correct so it would come in front of us twice so the next step would be just to to draft the ordinance then to have okay that's what I wanted to clarify okay so I go ahead as somebody who just went through a campaign also just like the councilman and just like you mayor I'm more concerned about the fact we switched to the November election because we thought we were going to say have better turnout have piggyback on the county which was was great but guess what then we had the runoffs and as opposed to we should have done something in August and then the runoff in in uh uh uh November rather than a totally separate you know Standalone campaign that turned around cost us just quite a bit of money but that was more of an issue that I agree more of an issue I don't know that's something that we could change if there's five people running or 10 people running you know God bless them yeah yeah yeah yes um councilman I was with you on the piece of legislation CU I kind of understand um part of it but it's it it would not affect me but I don't see why a council person would want out more people to sign up then but then again you you you put an example about us having the um you know the folks who that's not what caused us to run off um we could if you saying uh um any legislation or you could bring in similar to Dural and other cities to eliminate runoff that that could be something that's what they did you know where you have you have only one which I don't support but I'm just saying that would be a say of you know addressing the runoff issue this one the way it it was you know it's yeah but it's a discussion so okay than but the other one I like actually wants to bring it back as an ordinance and we'll have it as an item welcome yes to it yes I would like to um to have it back in our next um council meeting as a as an ordinance yes okay thank you discussion regarding the city's noise ordinance no yes the discussion thank you um city manager and if the police chief is here on this issue also and if anybody from Neighborhood Services I through you the city manager um to have a couple questions um and the reason I'm bringing this up is because the people and the communities are misinformed on what our no noise ordinances are how they're enforced and the fact that you my my my issue is people hire off-duty police officers for their party for security for parking for traffic for whatever reason their music is blaring at 11:00 12:00 at night if they call some have allegedly got the response that well they have a permit and they have the police are on the scene and there's nothing we're going to do allegedly those are the comments we have an ordinance that says nothing past 11:00 then there was a comment that was made that said the city manager gets to override the the city Ord and we have yet to find where that power was ever instilled in the city manager that can say you can break the law and change the law that is on the books we don't believe conferring with City uh Council I mean the city attorney's office that that is not something that they're aware of we have had several events recently and one of them was right after the holidays they had an off-duty officer and keep on point mus it blaring till 11: 12 1:00 in the morning and the comment was made in the homeowner groups and so forth and it's not just uh one neighborhood is happening everywhere we had the problem one with the soccer stadium that affected solia we had other areas uh that that the noise affects the community what is the exact code who enforces it does a police officer at 11:00 at night have to have a decimal reader in his hand or her hand to tell the people to turn the music down and if they don't does the police officer get to site them or do they have to wait for Neighborhood Services to come back the next day and issue them a citation and the fact is that if somebody hires an off-duty police officer for the event is not a get at of jail free let you get to do whatever the heck you want Madam manager we had we had a discussion with you and the City attorney about that please enlighten the Community Enlighten the people who call me constantly about this the exact rules and what everybody understands it is so to be clear I do not have the authority in order to override any ordinance neither have I done that since I've been interim city manager okay you have other question through the chief um what is your understanding what Off Duty Officers at on site what are they supposed to do good evening mayor and councel Sharice SCA chief of police 700 noreast 124th Street and through the manager hiring an off duty officer does not authorize the officer to circumvent what the state statute or County ordinances or city ordinances State okay all right so they if somebody calls and complains that the music is blaring at 12:00 at night that officer has the the the right to explain to the party holder to turn the music down yes that is correct the officer has to enforce the laws that are applicable um what I will tell you is in November yes there was an isolated incident that did occur um the officer was misinformed and did indicate that he was working there and they could have the music until whatever hour it was past the 11:00 Mark I was informed about it and notified the officer that that is not the correct procedure and then we also put measures in place to make sure that it does not happen again now since that November 2024 incident I have not heard of another incident we've also done some research and I've not been able to find another incident very good thank you good evening mayor and councel through you manager through the manager uh this is my understanding of how we've been taking care of these we have a very good working relationship with the police typically when they go outside of this isolated incident as stated by the chief we go out and use their reports which they do provide for us so in this case we take him we take him through the special magistrate it's considered an irreparable and irreplaceable violation what that does is when it's sent to the special magistrate it allows for them to give a violation based on their based based on their on their decision on what type of fine they would receive okay I seen fines go for a th000 I seen to 500 and it's Bas it's based on our State statue is where they're getting that number from so when we get these complaints from the police we just follow through with the the special magistrate they've the police has been there at our hearings as well they have showed up with uh their testimony and we've had a very high high percentage of any case that goes before the board or before the special magistrate anytime that we have PD typically in code cases you won't see PD in this city it's not the first time we've done it two or three times and it does help in Prosecuting these cases one more question or actually two is it required that a police officer has a decimal reading to site the or or you all to site the individual yeah it is not required um however if you read the ordinance it does state that in order to be out of compliance it would be feed and obviously we want to have the deciel readers in order to measure that um is the officer going to go and actually be able to measure out 100 ft um they could probably try but we want to be exact especially if we're going to enforce that um particular ordinance um so we do have a couple of decibel readers that were purchased in the past for um complaints that we've received however again just being able to measure specifically when an officer arrives on the scene exactly 100 ft from where the noises coming from can be a little bit problematic um but we do have at least two of them available to us it's not required and do we have a decimal number set in the code that says you cannot exceed 0305 do we have that in our code that sets a a pitch 100 ft away through the manager yeah uh oh so sorry I I didn't I go right ahead okay in the city we use what's known as the reasonable person standard okay the reasonable person standard is quite different than let's say I broke it I broke it down into three three different cities when I when I reviewed the the agenda and I use North Miami the county and then let's say South Miami Hollywood and for lot of deal you have North Miami which is disturbing at the property line any of the neighbors okay there is a 25 ft buffer for noise sensitive areas and then you have the county which which they just amended which includes that 100 ft after 11:00 on certain days as Prima facial evidence that the violation is there and it's used when we present our cases okay then you have South Miami and Fort lale in Hollywood that actually have uh General uh cusp for the for the deciel between 55 and 65 and then South Miami being the most strict actually refer refers to asha's uh guidelines for noise so to answer your question more directly we do not have that we use the reasonable person standard thank you and then a follow up on that how about equipment coming from some of the new buildings or or businesses that the AC units their generators are so are are allow and what do we how do we address that if a generator which is squeaking or an AC is squeaking for weeks and weeks on end because I've gotten those calls also uh and getting it even on some new developments that are are just up and coming and they're already having people three block complaining that they hear certain noises how do we does our noise ordinance address those kind of issues correct we do have a section of the code that does address but it doesn't address it via decel readers it does it via the reasonable person standard okay um just wanted to answer one or more of your questions you asked where are we getting the um ordinance from and so it's the County ordinance which is 21-28 and then the city ordinance um that I conferred with legal is 12-15 okay so think against okay discuss thank you thank you sir thank you managers thank you so much mayor if you would give me a point of privilege please I'd like to um I'd like to uh kind of change the subject if you don't mind so first of all I'd like to thank this body for oh no nothing to do with you thank you thank you um I'd like to thank this body um for allowing me to serve as the vice mayor councilwoman Cassandra Timothy as the next vice mayor oh you heard okay can we I will second up what what wait what just happened I have a motion made by vice mayor estimate Irvin to uh put in the record tonight that the issue on the hide in B zone is not settled yet there is a h a case in court uh that is challenging the text Amendment and I don't know if the mayor can hear but but but but we we just got a bad news then there is there is a case that is challenging the text Amendment then that's not settle then that mean that this approval for the conditional use permit today is also based on that uh supposedly or presumably irregular text Amendment and then that's the the issue is not settled yet thank you thank you thank you thank you so much sir thank you and I'm sorry about that we we just got newed a member of our community passed um so we just it's it's just shocking to us um it is go ahead I'm sorry here uh William pratel 12,000 North Bay Shore and 11930 North Bay Shore uh wanted to thank the council for your insights and for for uh holding up this last project that last uh you're showing that we need to have a project like this with the additional jobs with the additional income with the additional Prestige and the additional value to the neighborhood and top of that you all know that the bigger better projects are more sustainable they're less likely to be taken down in a short period of time so thank you for that uh on a slightly different note um this last week or so eight days um has been rather different in the course of our country and I'm bringing here to our city of North Miami to the good people of North Miami uh as things have changed back in the early 60s 61 62 63 whatever it was uh John F Kennedy visited Germany it's said ISB Berliner which is I am a donut but we know that he actually meant I Am with You German people and the way U the term Mexicans is so disparagingly used uh it's almost time where all of us North Miami should say hb9 Mexican because that's what it's coming down to there's a tsunami on the horizon things are if you you may not be watching TV as much as I or have it on in the background it's not a happy time time and we live in probably one of the most vulnerable communities due to our wonderful diversity and our wonderful other characteristics and we are very vulnerable and I hope that uh my message tonight is I hope that our city stays tight stays strong stays together and uh does not yield does not get confused do not fall for whatever is coming do not yield to it uh we really need to voted on I personally feel is a vanity thing is an ego thing but hey but how come it's okay to change that even though it was set forward for 50 years but um so that you guys can change no problem but other things you guys are like no we cannot change so now you guys want to change in regards to how you vote I mean the signature so that is okay to change even though for years it was a certain way but not the vice thing so there are certain things that I as a resident sit down like you guys are contradicting each other so you guys bring up Dural all these other cities so let's bring up Miami Shores their salaries are Council I believe only gets a dollar a year so again you can't pick and choose you can't bring the good parts but uh other parts in Miami and then not bring up here so that's I just want to be straight out flat with you guys no disrespect even though like I said some things might be rude the harsh truth because I've had discussions with other people people text me all the time I'll be honest I'm going to chat call know me neighbors and they're like and I get private text too and I'm like I don't feel like I intimidate people I don't know maybe because I raised my voice regards to the signatures for the various districts I want to give you a little background on how we got there uh we went to districts I think in 19 94 95 something like that if I if I recall and one of the big huers and cry in in the city was from the west side that they had no representation and usually what it was was it was Sans sui Keystone they were the power and I thought of here in 1970s so most of the people came out of the east side I can only remember maybe two candidates up to that point coming out of the West Side so that's when we went to District elections so now let's just fast forward just to last year uh when we did the census and we added more we try to balance it all out and I just want to give you food for thought now you're going to bring this ordinance back next week or the next council meeting and I understand councilman Charles's point about having a multitude of candidates in there six seven eight candidates in there with only 300 uh signatures on it could dilute the vote but then again if it's only 3% why don't we I don't know if we can do it legitimately or legally uh under the Voting Rights Act but suppose we did the petition and we raised it to 5% in that district oh Jesus would that balance it out no you know what I'm saying right now what you want to do right now the way it is if I'm not mistaken it's 3% of the vote within the district so councilman Charles I guess it would be about 300 people in your District so suppose you raised that the 5% wouldn't that kind of balance it out I know what you're saying you want to have more people collectively sign those signatures but if I can't vote in your District why should I sign a petition that's that's my CL or if just give me another 10 seconds like if we want to put a shield over there say I want to knock you out so I get everybody on the east side to sign up and we put a bunch of candidates up there we've seen this happen not that it happened here that I can remember but I really would hope give it a lot of thought on that there might be another way to solve this thank you thank you thank you je thank you sir how are you good evening Brian Jinx 860 Northeast 122nd Street councilman Charles started off with a quote and I'd like to start off with one myself it's from tip O'Neal All politics is local and you know I'm very disturbed for the councilman from District 4 to bring this even to the table a councilman who had the biggest political machine behind him over $85,000 in his War chest doesn't even show up for his District 4 debate with the other candidates and he uses a statement like it would help us get better better candidates that's unacceptable this is the United States of America the Constitution Declaration of Independence every citizen has a right to run for office there's no good candidate there's no bad candidate the one who makes a good candidate or bad candidate is the voter who goes and votes them out of office I don't understand why would someone in District 4 sign something for a district one candidate just I don't know where that's coming from there's I think there's an ulterior motive my second point tonight is the noise ordinance something has to be done I live on 122nd Street jazz on Friday last month I never hear one PE over there this know me Festival you guys are getting ready to throw will be shaking my house until midnight I welcome anybody to come by and sit on my porch and listen to what's happening there you should come out I called the police I called the police on one incident over there basically one over he says they have a permit they can basically do anything they want uh in that regard there the decimal reading I had actually a conference with my councilwoman this gentleman here and somebody else the decimal reader things don't even work nobody's trained to use them etc etc was found out there so councilman Burns very good i' like for you guys to get a little more deeper into this thank you thank you thank you so much public hearing is closed on the item and thank you vice mayor but Brian just to address the last comment cuz anytime I hear know me Fest my my head my hair just kind of raised you should you that's what I'm saying I don't have nothing that's right you should come out Brian that is one Festival that we do in that Festival right now we have a waiting list of your fellow residents who cannot pay their water bill that's the only thing it's not a party that's the only thing that we do in every that we raised for it um sir um goes into a fund that helps hundreds of residents it was I guess last year the funds run out and we we have a little group of people calling so in majority of the people that comes are from you know different places um you know to help out and they know it's it's a party with a purpose I don't know how much we have raised over the years but I think we we over at least a million and right now in the fund according to the manager we don't have nothing so we got to wait so we got residents right now who are waiting for after February for them to get some type of um um assistance and we have never gotten past 11 um there maybe one or two maybe once or twice we could have been maybe five or 10 minutes over huh remember sweet Mickey no that wasn't us yeah that was that was not the the Norman something else yes yeah and we we get a lot of noise art um complaints I get them from district one and but that's a contained area by FIU and and it's a time frame and we trying to work with the vendors trying to see what we could do um but yeah but thank you for the invitation and I will attend but my but actually I attend every year just sitting on my front porch on 120 but Mr Mayor last point on with the noises my concern is for the health and well-being of maybe young children that are there I know I'm going over my time forgive me you have to realize inside your ear once it is damaged know the ear has actually little hairs in there and once your hearing gets damaged with a loud noise it never repairs itself is just to continue with deterioration so with noise excess my main concern is obviously my peace and serenity also the safety of the people who were there thank you I will go this year you going to buy me a beer if I go you would be you would be my special yes thank Claudia quickly yes ma'am I will check my receipt when the last time I came to City Hall to pay my water bill it was Big Bill and I asked the person I about the um program you guys have to help she told me that thing did not exist I'm like wait I thought there was something I if I go downstairs and I look at the people I'll tell who it was that Angela looking at it right there no CU I was literally told that I'll check the receipt and then I told my people on know me neighbors they actually looked up the the link and all this and then another noi neighbor said that when her mom also went they were told well she should sell the house if she can't afford the water bill so this is I don't know how long that was for her but I know I personally will look at the date that I PID the water bill went downstairs and I was so no no assistant existed Angela please but because because they have an application there are people some residents I don't want to put it that does double double dip because they they they really really have the hard time the ones with kids and and seniors but m r has you yeah I don't think I think we yeah she will get down to the bottom of it who's the employee that's that's some bad information we don't have money now but we do have the program been exist for how many years we passed the ordinance I mean guys we've been years yeah we've been helping trust me the the list is 18th at the Galvin Center uh you'll be getting emails and flyers and City announcements coming but save the date for that it's the latest update of condo laws that are affecting so many people in South Florida it's it's open to everybody but it is limited to 150 uh people we will have an RSVP um link set up by the end of the week so if you know people on your condo boards and so forth it'll
