next to chickin into parking lot 7 um so everybody that's buying their big screen TV for the Super Bowl and they want to get rid of their old TV they can bring it on Saturday that's all I have mayor thank you commissioner Petco I just want to clear did you say you're buying just TV I didn't say anything about I just wanted to make sure just disposal disposal so on a little heavier note we have noticed through the um thatly Police Department a little tick up with these break-ins again and car burglaries um I saw a very disturbing video this morning from a dear friend of mine's house that is how Brazen they are with lights um security lights going on at they're trying to pry open the doors with them on um so this be on alert I I've been saying it to all my friends I happen to have three dogs at home seems like the trend is if you have a dog that barks they go onto another another house so maybe saving a dog from a shelter would be a good thing um the bail reform is still the problem I like to say that Governor Murphy although I don't think he has done enough with the bail reform because we keep locking these mostly juveniles up because of course the adults send them to all our town surrounding towns in our town including and you know it seems like in the afternoon they're out of jail but he has made some steps forward with a little harsher crimes but until there's a punishment for the crime we're going to see this so our Police Department is doing everything they can to prevent it but I ask the residents to help themselves don't leave your car running warming it up in this weather I can't tell you how many cars got stol doing that and even your keys if you could not put them in the kitchen where most of us all put our keys in the kitchen and you could maybe put them somewhere in the house you know this way they'll get heard from nutly but I just want to give or nly Police Department a shout out because last night we did apprehend one of the three suspects um of course it was a juvenile not much we could do but um the guys are on it it's a full-time job for them it is discouraging when most of the police officers stay past their time to finish all the reports and the the the criminal is out before their shift is over so if anybody wants to write to our legislators it's something that really needs to be done because it's getting old in this town and old towns thank you mayor thank you and uh I have uh one announcement on for this evening uh February's heart health month uh and in honor of heart health month this Saturday February 8th we'll be doing our annual uh stretching in yoga at the health department followed by a brisk walk through our parks and then in the afternoon uh the Jersey ax house on East Center Street is uh hosting us and we're going to have a two-hour ax throwing session so anyone who wants to come out no registration required show up to either event either Saturday at 9:00 a.m. or or ask throwing at 2 p.m. and uh come out get that heart heart rate up and pumping and uh do something good for your heart pay that pay that uh the rent to live in your own body uh we're going to go a little bit out of order this evening uh the first uh resolution that I'm going to read this evening is in honor of the four chaplain's day for those of you who don't know uh four chaplain's day is is commemorated to honor four chaplain of diverse Faith who on their way to Europe when was their transport ship was struck by a German uboat and immediately Panic set in and uh these four chaplain those that came from different backgrounds were United together and created a calming presence on the uh the the sinking ship and it it led to many lives being saved and it came to the point where uh they actually took off their life jackets to give it to soldiers uh and so the united states recognizes the the diversity of the faith that that was a common presence on that day and we have uh several uh pastors and rabbis here uh in honor of for chap wnes day and I think they they will all say a prayer this evening uh but I wanted to read the resolution first uh whereas on February 3rd 1943 at 12:55 a.m. German submarine u223 torpedoed to dor Chester off the coast of Newfoundland this blow knocked out the ship's electrical system as Darkness set in so did Panic as many men were trapped below decks in the midst of the chaos four Chaplin worked together to try and still calm and also help as many men as they could this cooperation was deemed extraordinary at the time due to the four being from such different backgrounds and beliefs whereas the men who came to be known as the four Chaplin were Methodist Minister the Reverend George L Fox Reformed Church in America minister Reverend Clark V polling reformed Rabbi Alexander D good PhD and Roman Catholic PR priest Father John P Washington whose uh whose Parish was actually right here in Carney New Jersey the four men had met while attending chaplain school at Harvard in preparation for each of their appointments as chaplain and whereas the there are numerous eyewitness accounts of the four chaplain heroism when the supply of life jackets ran out before each man had one the the Chaplin removed their own life jackets and gave them to others the Chaplin also helped as many as they could get into lifeboats whereas in 1988 Congress established February 3rd as the annual four chaplain day not only for the remarkable heroism of these four Chaplin but for the example of unity through diversity for the greater good now therefore it be resolved at the Board of Commissioners in Township of Nelly County of Asic state of New Jersey recognizes and celebrates February 3rd 2025 as the 35th annual observation of for chaplain's day so moved commissioner ravski uh on behalf of Reverend Catz at Temple hi thank you I'm a resident here in Nutley and I'm here on behalf of Rabbi Mark Katz um he gave me a few words to read uh thank you so much Daniel Jacobi and mayor Kelly for passing this resolution in addition to The Bravery of these four chaplins I am inspired by their partnership in this climate it's too easy for religious groups to feel and function like an island but that can't be further from the truth there's a rabbi folk tale about a group of people in a boat and once they get into deep water person begins boring a hole in their boat everyone tells him to stop but he rebuffs them saying I'm only making a hole under my own seat as the story progresses it becomes the obligation of the rest of the boat's inhabitants to prove to him that even so a hole anywhere in the boat will cause everyone to sink each group in our country has our own problems concerns and fears but we sink or float on the Merit of each of us and if one of us takes on water we all do this resolution shows what it means for the town of Nutley to get that each of our Fates are tied together we may worship different gods and practice our faiths differently but fundamentally we rely on one another for the bond of mutuality we stand in the footsteps of those Brave chaplain in whose memory we together join hands to change the world for better thank you thank you uh I'd like to call Father uh Asia Coulson From Grace Church good evening I just have a prayer I'd like to offer from our um book in the Episcopal Church Holy Women holy men celebrating the Saints um February 3rd is the day we honor these men in our church calendar as well if you would pray with me holy God you inspired the Dorchester chaplain to be models of steadfast sacrificial love in a tragic and terrifying time help us to follow their example that their courageous Ministry May Inspire chaplain and all who serve to recognize your presence in the midst of peril through our Savior Jesus Christ who lives and reigns with you and the Holy Spirit one God forever and ever amen amen thank you and from the Episcopal dicese i' like to call up Reverend Audrey hasselbrook I will keep it simple and simply say may it be so thank you and you know now more than ever there's everyone with deferring viewpoints you know but only together and through Unity will we become stronger and become a not only a better Community better Town better State uh and so there's there's a lot to be said about Unity despite our our differences uh and and these four chaplain definitely embodied that and so I want to thank the the fellow members of the clergy who came uh and to support this resolution and honor these these four individuals uh for their heroism in the face of extreme adversity so thank engo Webster uh me engl now engino Taylor LLC as Council for uh the township regarding affordable housing requirements whereas change order one is needed in the amount of $115,000 to continue these legal services for the remainder of 24 whereas the funds are available in the co trust account T2 699 9902 and the amount of $155,000 and has been certified by the Chief Financial Officer set certification being attached to this resolution and now therefore be resolved by the Board of Commissioners of the township of Nelly County of V state of New Jersey the change order number one is hereby authorized and approved in the amount of $15,000 be further resolved that this that a copy of this resolution shall be placed on filed with the clerk of the township of Nelly and a notice in mayor Kelly hi my next uh resolution is for a similar change order for English Ceno Taylor uh this uh is an amount of $53,000 uh and this relates to uh compliance procedure and general issues uh primarily related to um uh affordable housing ex me Co oah requests I'm sorry U the change of ORD is for amus $53,000 the funds are available in account 40110 EXC me 01225 and has been certified by the Chief Financial Officer and now therefore be resolved by the Board of Commissioners of the township of nalia the change order number one is hereby authorized and approved in the amount of $53,000 be further resolved a copy of this resolution be placed on file with the clerk of the township and in notice in accordance with the public contract to law of New Jersey in the form attached to here township of Nutley before the county Essex County Board of construction Board of of appeals um alleging that certain invoices were improperly charged against the uh PB nut Cliffe escrow accounts which by order of the board adopted on March 22nd 2022 resulted in the board affirming p pb nut Cliff's appeal in the amount of $127,600 31 on November 16 2021 PB nli pursued a separate and second appeal against the township before the board alleging that invoices were improperly charged against pb's uh escro accounts totaling $524 1881 in in addition to those uh that were uh part of the first appeal the township accepted the decision of the board in favor of n cliffing the first appeal less a disputed sum of $60,000 $6,850 15 and has acknowledged the second appeal and whereas the township and PB Knuck have engaged in settlement discussions regarding the first appeal and the second appeal which discussions have resulted in a stipulation resolving the difference between them and providing for a total uh escrow refund for both of the first and second appeal in the amount of $119,600 the second appeal in the total amount of 9,161 197 to PP to PB nut Cliffe which payment shall be issued from account 4 401 22625 now therefore be resolved by the Board of Commissioners of the township of n the county VI the mayor and the Township Clerk are hereby authorized to execute and attest respectively a stipulation with PB necklift Master pursuant to the eff foret conditions in a form acceptable to the township attorney and be it further resolved that the the Chief Financial Officer is hereby specialized Professional Services for one Kennedy Drive conceptual design through construction Administration for the public open space fronting chest Street whereas the anticipated term of the contract is 12 months from August 2nd 2024 through August 1st 2025 whereas DMR Architects 777 Terrace Avenue hbur Heights New Jersey has submitted a proposal indicating they will provide such services for the sum not to ex exceed $110,000 and whereas The Architects has completed and submitted a business entity disclosure certification was certifies that the said Corporation has not made any reportable contributions to a PO to a political or candidate Committee in the township of notle in the previous one year and that the contract will DMO Architects from making any reportable contrib contributions through the term of the contract and whereas funds are available from account 50152 299 amount of $110,000 that have been certified by the Chief Financial Officer said certification be I'm on a fixed income and you know anyway it was a quarter for 30 minutes now it's a quarter for 15 minutes and if you want us to visit the local businesses you know um give them our business you don't don't you know nickel and TR L with these these machines you know I I got to pay to go into the store and buy the product now I got to pay even more just to park there to go into said store so if you want to keep your businesses you want us to patronize those businesses you know go back reduce those parking meters again it's a quarter for 15 minutes I mean how long do you you know you take longer than that to shop I do my laundry I'm long I'm longer than 15 minutes doing my laundry so what does that mean I got to pay more for the parking meter or walk with my laundry what I mean I don't know why it was changed I mean do you have a specific zone or or Street you you or is it just all over that you're concerned about well I mean you don't patronize any of these businesses you know you don't want to pay more money just to go walk into the store than buy stuff in the store more money you know I mean what why 15 minutes for AAR it doesn't sound like a lot to you but it adds up and we just very we're very sensitive to that uh to your concern and we're always looking to promote business yeah but we at at 25 cents for a half hour when compared to the other municipalities in this area we're very low we're even low with where we are in comparison to Monclair Rutherford Bluefield Beville so it's not that we're out of the ballpark with raising that fee yeah but how much how long do we you take to go into you take longer than 15 minutes you don't want to get a ticket you're trying to do the right thing you know what's going to happen is people are going to say I don't care and they're not going to put anything in the meter then you GNA lose money that way because I've seen people walk away they don't put anything in I see them you know I observe I know so what are you what are you gaining really you know I mean just please low lower it back you know we'll take a look at that thank you and another my other concern was I understand that the chicolini B Brothers the building is gone or you're going to put some highrise there is that is that true uh we're we're currently still in negotiations on that uh Mr Bruno did you want to uh there has been proposal and and and the uh agreement is uh is for a mixed Ed type of project but it's not finalized just yet good because I think that the big mistake this is not this is not some City with high rises I don't know I think some of you here have been living here since the 70s I came here in ' 68 I seen it so I know the mom and pop stores I remember all that the quaint nutly was wonderful now it's like condos everywhere and now highrise more traffic you're going to get with that you're GNA have more B and you can't even fill up some of the business stores now how you you g to get new stores in here you can't even F some of these empty spaces now but it's the traffic and the more more people and don't you remember the 70s in Nutley I I do remember Drews you remember gers you remember all that nice did you just for the record did you specifically point to commissioner Evans about the 70s I just passed my 70th birthday so oh yes I remember walking into G being in Drews yeah what was that commissioner gers were the hardware store I would tell you but you not being as old as I am you probably wouldn't appreciate it well I don't know who was living back then when I did it was a nice quaint place to live and now it's it's so built up you used to have all these restrictions you used to keep it as a home level you know it's it's I know I'm I'm going back to the past and shouldn't right but I I I don't care we C we certainly appreciate your concerns and I can I can speak for the entire board is that we're concerned with the character of nutly and we want to make sure that we preserve that character going forward with whatever is going to be put there uh and to a lot of your concerns are our concerns as well and so that's something it's it's bad now getting through town I mean not Le still better than all the other towns I always say that but it's getting to a point now that it's starting to it's really bad I mean it's really bad the traffic and some people coming through here unsavory people you know just you know I worry about crime and the traffic and and the the cost of the parking now you know it's I'm on fixed income you know I'm retired now so I you know I gota every little bit helps you know to save so please consider this will you I mean I keep checking the meters you know it's like I'm hoping you know in a month from now that it's changed back evening seeing none uh Mr Bruno I think we have a need for another executive session mayor we do uh to discuss uh litigation uh thank you I'll entertain a motion to go into Clos executive session second whereas Section 8 of the open public meeting act chapter 231 Public Law 1975 permits the exclusion of the public for meeting in certain circumstances and whereas the public body is of the opinion that such circumstances exist and whereas a Board of Commissioners of the township of nut in the county of Essex and state of New Jersey desires to proceed to close executive session and now therefore be resolved by the Board of Commissioners the township of Nutley move into to close executive session to discuss litigation be it further resolved that at the time when such discussion may be disclosed to the public shall be when and such disclosure may be made without adversely affecting the township of nutly pending and or anticipated legal Personnel contractual matters and other
