up is Jeff orz real but close enough just give your name and address for the record ab and we have five minutes correct yes my name is Jeff Oriel uh resident 3 Walton Place on Glen Cove uh the reason I'm here this evening uh is in respect to the commercialization of Glen Cove with the 10 slip uh Dock at the end of it with up to 38t Yachts uh as a long-term resident of Ocean City Glen Cove was established back in 1908 with 38 small residential homes and it is the narrowest Lagoon in Ocean City uh most of the residents have very small boats it's one of the only lagoons in Ocean City where you cannot park perpendicular you can only Park parallel to your property a lot of the kids grandkids uh multigenerational on this on the street we have numerous uh community activities from float parties to dock parties to you know uh block parties throughout um and the commercialization of that is going to significantly uh hamper for that moving forward as a little bit of background or backdrop to it uh April of 23 the residents within 200 ft of 110 West 10th Street received notice uh the applicant applying for the njde approval to put in a 10 slip marinaa in conjunction with the commercial developments of the parcels we had two weeks and hire a local engineer to send a letter with reasons why this property was never a Marina and the detriment uh it would be to our community on August 24th same year lagon own owners were notified that the de the D rather had approved this project but not without condition because the approved commercial development was non-conforming to the current residential Landing use of that property the permit clearly stated in standard conditions number three on page four the committee should obtain all applicable federal state and local approvals prior to commencement of the regulated activities authorized under that permit as verified by the de ke this conditioned a permit not only to protect those that are impacted but to ensure that the approvals were obtained from all three levels of government prior to commencement of any work including zoning variant site plan approval Mercantile license and in uh you know sake of time April of 24 following year lagon residents received application from the US Army Corp of Engineers and were given a 30-day comment period numerous uh of my fellow uh residents uh as as well as other Town residents that that use our properties for their friends family uh as well uh on October 11th same year lagon owners received emails from the Army Corp saying they approved the project but also with conditions this passed October 15th a few weeks ago a huge barge pulled up finished some demo and started uh to install the marina structures these Marina structures including the pilings were already made and waiting for delivery and installation even the decking has started with the lands side of the footings within the designated setbacks uh all of our Lon owners are not sure how all this work could begin without the applicant receiving the local approval necessary um to make this work I'm sorry uh we don't not sure how this work could begin without the applicant receiving all local approvals necessary to make this residential lot conform with commercial development many lagon owners put a stop workk order to this town the zoning office replied an email that they have no jurisdiction over the authorized work yet per the de permit no authorized work is approved until all local approvals should be standard and here's the D the permit should obtain all applicable federal local and state approvals prior to commencement of regulated activities authorized under that permit and then Section 8 any non-compliance with a permit constitutes a violation of this chapter and his grants for enforcement action as well as in the appropriate case suspension or termination of this permit now once again I already talked about how uh you know our Lagoon is multigenerational uh for you for everybody there another problem it being the smallest Lagoon when there are currents and you know a lot of us have been boating since you know we were in diapers it is difficult to come into that Canal when the current's coming and it is proposed to put 10 slips with up to 38 ft yacht which that is going to make that extremely extremely dangerous so the one thing that I would ask Dorothy Michael Melissa Terry Tony Shan Keith and Dave right behind you you have the Ocean City Crest Ocean City New Jersey the greatest family resort we're putting a commercial Marina in the smallest Lagoon understanding when honoring their oath for all people amen Jonathan dice 12 Street uh I have in my hand a signed affidavit by an Ocean City resident named kathlen ryit re e i m t it was given to the uh police department in order to submit it to the Ocean City Municipal Court on this paperwork it says to the person that is filed in this affidavit please be advised that if you desire to withdraw the charges you have signed you must do so in open court all capital letters so it's a pretty big deal when you uh go ahead and you sign your name to an affidavit it's an oath it's an oath saying that what you're saying is stating is true and you will be held responsible if it it is not serious it's the backbone of our of our [Music] Republic they submitted it to the uh court and the court on this Ocean City resident the court accepted the version of what this oath this uh affidavit stated with no Witnesses and they uh ordered a summons complaint summons the state of New Jersey versus me this was signed back in 2018 1920 21 22 23 24 6 years later I'm talking about this Ocean City resident that signed a complaint against me in the Ocean City Municipal Court you want to know who this person is this Ocean City resident you could find a picture of her in the uh publication given by The Sentinel Ledger Endless Summer on page five there's a picture she is part of a group called Ocean City Financial Group and it was voted the number one best financial advisor in Ocean City New Jersey for the year 20024 I had said to you uh back on October 10th 2024 I told you about a green card that I got back from the Municipal Court stating that they got my correspondence to tell them that I will not be able to make the court date I had to take a uh one of my children to college because I didn't show up for that court date the Ocean City municipal court ordered the chief of police to order John J uh John Peter Dupont to come into my residence with cameras guns and tasers three of the officers from Ocean City came in handcuffed me so tight that I have permanent damage in my hands and now it's going up to my elbow I can hardly lift more than 40 pounds in my daily day I last week I was shoveling and because my wrists are weak now I don't even know my own body because I never I literally never had problems with my elbows and now when I pick up a heavier weight it it pulls them out remind him that he cannot operate a commercial Marina in this RL 1225 residential Zone without a use fance and by the way a sitech plan which will be planning board so let go to the planning board and Zoning zoning board both go to zoning that's going to be the zoning board so okay the D and the Army Corps of Engineers gave approval to install improvements on the waterw side of the bulkhead the city has no jurisdiction there there so we can't stop them from building um but we can stop them from operating a commercial Marina in a residential Zone if they begin to operate it we do have a call into the D because the D is the is the entity which can enforce its own permit as Mr Oriel is it read at the bottom of that page says that they will they can a violation of any of the provisions including failure to get local permits could be a violation of that permit but we have no jurisdiction to enforce it at this juncture thank you Mrs mcon because I just wanted to have everybody be city to acquire the property right next door at 844 Central Avenue the smaller building right here not the one on the corner the framework um the frame shop um and puts the funds in place in order to October now I understand there's been a delay get activating the pumps because some of the the the teams that were going to activate them are down North Carolina saving you know getting people electricity which is totally good but then there there's been some reports that the final Paving won't be done until the spring so I'm asking if because I've had a lot of calls from residents saying cu the place is a mess I mean it's going to be great when it's done but from 34th to 36th Bay Simpson Haven there's just dirt everywhere and the drains are getting overrun with uh gravel and I just like to get an update on when we are going to expect at least the initial Paving to be done to cut down on some of that so the water does flow and not in water flows in not all the the gravel and things like that a lot of residents are asking so if we could put that maybe in a Weekly Newsletter that'd be great yeah we can definitely do that thank you Dave I did I got a call too about that is there any alternative till the paving happens to maybe do some of that dirt so if maybe we can just uh I don't think so because the this the drains are raised up you know so we you know cuz we're going to raise the level of the street problems the water they're so high the water can't get in but all the rock they they put like rocks down just on either side to kind of can make it smooth but without being in the middle of the drought it is just like a dust bowl down there and I feel bad for these residents they put through put put up with this through the summer and all that but now I don't want to I just want to make sure we're not going to wait until the spring to do the initial Paving you need to have at least the the bottom code on so that the are functional so if we could just these meetings occasionally and uh it's always the same thing and of course you can't have give and take here I understand that but it seems like to me with the city just not stepping in ahead of time we're barreling to a major lawsuit where if these people are putting all this money in they are going to be fighting the the city and court if they should find not give them the permits that they're asking for just like that and I want to thank for our our update on the federals papers I had them for a while thank you my just state your name and address please yeah Joe Conway I live on seven Walton Place uh back up to gleno as well and I I hear what what the the city solicitor said about us not having any jurisdiction over what happens in the water but I guess uh I was here last week when uh there was a administrative decision on a lot to build the police substation none of you guys were involved in any discussions with that the administration decided this was what we're going to do and that that was done my question is why would this owner of this Lagoon spend hundreds of thousands of dollars to put this Lagoon up or put this Marina up without some kind of an assurance from the administration or somebody in town that he's got the approval my is that the administration will pull another end run and approve it without anybody's discussion that's the fear I have and it could happen don't smile at me like that Mr Vice President go ahead he has to speak through the chair when he speaks he's not allowed to do that he has speak through the chair can we can we have chance to respond though I I didn't mean any Mr any disrespect Mr Conway council is well aware the there was no end run with respect to the construction of the police substation Council was involved in that from the beginning I think what he's referring to is a year and a half or two years earlier someone had come to the administration with a proposal to swap land and the administration did not feel it was in the best interest of the taxpayers and that's within the administration's discretion there is no Capital project that can go forward in this town without council's participation and vote the administration can propose capital projects all day all day long but without the seven of you approving the money putting the money in place no Capital project goes anywhere so there was no end run that was a misunderstanding um by by the property by Mr Conway um with respect to any implication that the Administration has Som how approved this Marina I can categorically deny that on behalf of the administration in fact we've sent two letters to the property owner putting them on notice that that whatever construction is being done in Glen Cove is being done at the property owner's own risk we can't stop the construction but we can stop the operation and we can't overstep and the the zoning official because this is a zoning violation it's not a construction violation our construction official has no authority to issue a stop work p order on that side of the bulkhead but and our zoning official has no stop work Authority at all what she can't do is issue a Nosa violation and if anyone in town is operating a non-permitted use in without first getting a use variance that user would be treated the same way that this property owner will be treated with a notice of violation and a followup with all the tools available to the zoning official but the administration is in no way acquiescing in that construction approving that construction or in any other way participating in allowing it to occur yeah I just want to um I've been up here 17 years and I agree we don't always agree but this is something would be unprecedented I mean all this stuff I rest assur to the public that things like this they're not done with a wink and a nod there's a system the system works and it it will work and I can I can tell you with 100% that I'm sitting here and I'm guaranteeing you the system will work and I'm guaranteeing you that I will look through the system but I won't need to because the system does work uh and that's why we have a zoning and and planning board I can't explain why somebody would go ahead and do that um but it's it's got nothing to do with us um my myself personally doesn't make sense to me either but that's got nothing to do with our system our system is pure it's regulated um and that's all I can really say um I I I I understand people's feelings and why you would feel that way but this is one of the few things that's a pretty pure system as far as for William Campbell payment of claims now William Campbell was a captain I went into City Hall this is in 2020 after covid February of 2020 I delivered the first of eight criminal complaints and when when they saw me there they phoned downstairs up came Captain Campbell with two detectives there's a warrant out for your arrest I said for what $48 you need to pay the court let us go downstairs and we're going to write out something and you promis to come to court and and well I said no I said you know what see that was an offer a contract I said you know what I'm beginning to understand what they're doing to me I said I'll tell you what you bring this warrant or this uh offer to come to your court to my house knock on the door I'll answer and I won't accept it there and I turned around and walked out went downstairs guess what three of them two of them circled around click click in jail I went you know it's against the law for them to put anybody in to you cannot restrain anybody's Liberty for owing money how come they can do it they can't but you know why they can do it because every one of us in their system is dead I have a certificate of baptism that's why I stand here before you today they can't treat me like I'm dead and like they're robbing my estate I'm learning and they're in big trouble payment of claims Captain Campbell 120 Minutes in jail I said did you know you don't have an oath did you know could you please call the city solicitor to come to my jail cell she did at the end of two hours we discussed she says what do we have to do to get you to leave after coaching my children for two years establishing myself with with other children establishing myself with other parents and then all of a sudden I don't I'm not allowed to to coach anymore they voted the OCA voted like uh commodius right did you ever see Gladiator uh not allowed to coach allowed to coach not allowed to coach not allowed to please Council if you could talk to one of these
