Welcome uh we will call the January 23rd  2024 regular City Commission meeting for   the city of Ormond Beach to order uh I hope you  felt welcomed when you came in this evening by   our Airport Manager Steven Lichliter and Utilities  Manager Bob Pries who served as greeters uh and   I want to introduce the folks who are sitting up  in front of you uh to my right your left recording   secretary Taylor Lochert our City Clerk Susan Dauderis  Commissioner from zone one Lori Tolland good evening   everyone and welcome our zone two Commissioner  Travis Sargent good evening everyone welcome   to my left and your right our zone three  Commissioner Susan Persis welcome ladies   and gentlemen our and next is our Deputy Mayor  and zone four Commissioner Harold Briley good   evening one and welcome then we have our City  Manager Joyce Shanahan Assistant City Manager   Claire Whitley City attorney Randy Hayes and way  to my left way to your right is uh standing in   for Chief Godfrey Captain Roos and our Fire Chief  Howard Bailey for those of you uh listening online   I'm Mayor Bill Partington and at this time if you  would please silence your cell phones and rise for   the invocation given by Chaplain Sam Mercado  with Advent Health followed by the Pledge of Allegiance almighty God in this moment we pause  to say thank you for allowing us to see a new   year we gather here tonight to make decisions  for our community and ask for your guidance   and direction in these matters and we ask your  blessing on our city leaders as they make these   decisions on behalf of our community we ask  you for these things in your holy name amen amen I Pledge Allegiance to the flag of the United States of  America and to the Republic for which it   stands one nation under god indivisible  with liberty and justice for all all right we've got some exciting uh  awards and presentations tonight and we're   going to start with our HOme for the HOlidays  parade award winners I think uh the commission   talked about this last month really this has  been one of the best parades we've ever had   in the city they they seem to get better  every year Brian largely thanks to you and   your team but uh I want to recognize Brian  Daily the parade chairman and thank you mayor   he's going to present the awards okay this is uh  the 32nd annual I think it's one of our biggest   uh we had over 100 entries 40 floats and over  3,000 participants in the parade itself and we   all squeezed into that little area by by the  uh South Ormond after I announced the winners   I'd ask them to come up and go into the atrium  with us and we'll take photos but first I want   to thank our sponsors we have many Abaco Windows  Bowman painting Crunch Construction [Applause] Sports Wear and now we're  going to bring Becky Parker up   from Main Street to give away the uh  Main Street Reich Hundred Mark president's cup okay well this is probably one of our um the the most exciting and um  most well-received I think of of all   of the years and so um everyone probably  remembers Abaco Windows as um and who is   our winner of this year's grand prize Santa  the Santa Float do you guys remember are they [Applause] here congratulations thank you for  adding so much to our downtown and putting in   all the hard work and um how many hours uh  we started when we start took yeah we like   my parents knew the idea like back in August but  we like really started about a month or two before amazing this is the third time in [Applause] congratulations (Inaudible) gosh I just heard what he said all  right while those folks are uhing   out for pictures I'm going to ask our  victim Advocate Evelyn Robustini to come up hey how are you who is it all right and she brought Aretha Letha Baxter with  her and I'm going to ask our chief to come up as   well Chief Godfrey uh we're so lucky to have  Evelyn uh I always brag about her whenever she   comes up come on up Chief um I tell you I knew her  when she worked as a victim advocate for the   state attorney's office and just to tell you how  smart our police chief is uh when he saw a time   and an opportunity to bring her to Ormond Beach  Beach he made sure that that happened and we're   so lucky uh the people who live in Ormond Beach  are lucky for that and tonight we're talking   about uh human trafficking awareness which uh and  human trafficking prevention it's a tough tough   topic uh I don't if any of you have seen this  movie The Sound of Freedom just came out last   year that's hard to watch but it's a reality in  our world today despite the fact we wish we wish   it wasn't and so that's why we bring up this topic  and we try to shine a light on it Evelyn I'm going   to let you hold that while I read some of the  key components of it I'm not going to read the   whole thing uh there's a ton of information in  this Proclamation but uh human traffickers pray   on their victims by promising a life of Hope  and greater opportunity while delivering only   enslavement instead of delivering people to  better lives traffickers unjustifiably profit   from the labor and toil of their victims who they  force through violence and intimidation to work in   brothel and factories on farms and fishing vessels  in private homes and in countless Industries it   doesn't start that way it starts like this uh  paragraph says with the promise uh a life of   hope a life of greater opportunity a chance for  you to be a movie star an actress or something   wonderful but then it turns quickly into something  terrible and uh so we don't simply reflect on this   appalling reality we also pledge to do all  in our power to end the horrific practice of   human trafficking that plagues innocent victims  not only around the world but in our nation and   communities and it's a shock that it could  happen in the United States it can happen so   fast uh just in the blink of an eye whereas more  awareness and education are crucial eradicating   human trafficking in our community State and  nation and whereas human trafficking awareness   day is observed on January 11th in municipalities  across the country in order to educate the public   and raise awareness about human trafficking the  city of Ormond Beach has a strong commitment to   social justice and now therefore based on  all that uh I Bill Partington on behalf of   the entire Commission of the City of Ormond Beach  do hereby Proclaim January 2024 as National human   trafficking prevention month in the city of Ormond  Beach and reaffirm our commitment to creating a   victim service and criminal justice response that  assists victims of human trafficking and urge   our residents agencies and champions to support  efforts and action to end human trafficking thank   you all very much Evelyn I'm going to let you say  a few words January was first declared as National   slavery and human trafficking prevention month  in 2010 and the slogan this year is we are engaged   we are focused and we are united and the Attorney  General's office she has a big fight ahead of her   and every year she holds a human trafficking  Summit and this year it was to 22nd and 23rd   January 11th is always recognized as human  trafficking awareness days and all the Advocates   throughout the State of Florida wear blue and on  January 24th tomorrow there'll be an educational   conversational titled Online Behavior Offline  Danger for Caregivers so we want moms dads their   children to go to the Piggotte Community Center in  South Daytona between 6 and 8 for an educational awareness thank you my name is my name is  Miss Baxter and I provide for survivors I   provide safe secured housing for youth survivors  between the ages of seven and 17 although this is   a a heinous crime I have a success story one of  the most recent survivors placed in my home and   if you all have the opportunity you can pull  this up it's online the um defendant's name   is Shayna Bryant she was involved in trafficking  the young lady placed in my home at the latter   part of November she reached out to her public  defender in Orlando and indicated that she needed   a speedy trial um she wanted to be home with her  family for the holidays and her wish was granted   she felt that she was going to be released from  the Orange County jail because in this life they   call it setting up a play when the trafficker  arranges for a john to have inappropriate and   deal in inappropriate activities with a child she  says I'm going to be home for the holidays cause I   only set up two plays well on December the 20th  2023 she want of course she wanted to get out she   did she got out of the Orange County Branch Jail  and she's now at the State of Florida Reception   Center because each one of those plays she set  up called her a life sentence so this is real   this is real the young lady who the young lady  who resides with me um is now attending Daytona   State College works at a local grocery store  around here and um is right in the process now   of obtaining her first apartment so um behind  these tragedies if you have diligent people   willing to see something and say something we  we can get survivor stories again if you see   something say something because this is real  with the rental market and the housing market   soaring through the roof now familial trafficking  is most prevalent so I said that to say if if my   uncle or daddy or auntie don't have the money  for the rent guess what this pretty little   girl or boy because males are trafficked as well  ends up becoming a victim so we just need to be   mindful that you know each and every situation  of course is different but if you believe it's   happening or you're suspicious there's an abuse  number to call and let the authorities take care   of it and and deal with it accordingly thank  you all for having [Applause] us get a quick picture thank you thank you don't go too far Chief I need you I  need you uh Captain Roose Captain Smith   everybody come on up if you want me take  your picture with your phone take your picture with your calling in all the troops this is a  proclamation okay so we lifted you up with   the parades and awards ceremony brought you down  a little bit with a tough subject but an important   subject human trafficking and now we're going  to lift you up again uh celebrating National   Law Enforcement Appreciation Day uh these  guys work hard deserve this this is the 18   uh whereas National Law Enforcement Appreciation  Day was established in 2015 by concerns of police   survivors to acknowledge the sacrifice and  contributions made by law enforcement officers   across the country and whereas cops concerns  of police survivors offers a national support   network for families and co-workers who have  lost a loved one in the line of duty as well as   positive recognition of officers doing good work  every single day whereas Law Enforcement Officers   rarely receive the recognition they deserve  for the challenging and selfless work they   do they're tasked with making difficult decisions  in the best interest of the law and the safety of   the communities they serve and whereas officers  are not just part of our community they are our   neighbors friends and family members they are  the ones who bravely run towards danger when   everyone else is running away and it's important  to show our appreciation for their dedication and   bravery and whereas on National Law Enforcement  Appreciation Day we come together to honor and   recognize The Bravery sacrifice and dedication  of Law Enforcement Officers now therefore I Bill   Partington along with the entire Ormond Beach  Commission do hereby Proclaim Tuesday January   9th 2024 as a day to recognize National Law  Enforcement Appreciation Day in the city of   Ormond Beach and invite all citizens to join us  in honoring and thanking law enforcement officers   who work diligently to keep the community  safe congratulations and thank you all very [Applause] much great job thank you thank you awesome audience remarks uh I've got three cards and Vicki  is going to be first help me out with that us or help me with your last name Vicki  Van Shoy. thank you you have three minutes and thank you for  coming out it might start going really fast but   I'll try thanks to everyone of service in this  room um I'm here tonight because last Thursday   my 24 pound dog was attacked by a wolf hybrid as  we were just walking down the street I am here   tonight because the mayor nor the managers have  bothered to call me back to despite my multiple   attempts to reach them this pet wolf was not on a  leash when it attacked my dog it is not vaccinated   and it lacks pet wolf credentialing if it's even  allowed to be a pet in the State of Florida the   owners were not issue citations or fines for  any of these violations and the owners get to   self quarantine a dog that can't and won't control  their own dog and who themselves act aggressively   after their dog attacked my dog my daughter was  walking the dog not me meanwhile I have to hope   that my vaccinated dog does not get sick I am not  safe walking my dog in my neighborhood I live on   Beachside around there my last ditch effort to  give her the exercise we walk her twice a day   for an hour or two um is to walk her on A1A armed  with a cane or something to ward off killer wolves   or dogs so the wolf was left to wander around  until 10 p.m. this happened last Thursday I   have a handful of video footage showing the wolf  walking up to both owners after it attacked my   dog and the owners pet it on the head and let it  wander off down the around the neighborhood again   hours later about 9 I returned home with my dog  from the emergency vet and the wolf greeted me at   the entrance to my home six blocks away it was  like a horror movie and I was determined that   it that I was going to have to be the one to get  this dog home or whatever so we followed in the   car and it proceeded it first of all it went  after two neighbors and their dogs in I live   in a private development on A1A and and somebody  had to come out with a shovel to get rid of it um   so then it ran down the street to the pond and it  went after these three ducks that lived there so   I started honking and flashing my lights because  wolves generally try to avoid conflict with humans   it worked and I started slowly trying to get  it home and um I did manage to get it home I   had called the police dispatch was whole office  was going on and it made a last pit stop before   going home and its neighbors whose two dogs were  in the yard trying to get over the fence at after   it so I am outraged by the lack of protection in  this city regarding wild animals and bad owners   of domestic animals and for also allowing humans  to ruin beautiful creatures meant to live in the   wild or at least a sanctuary it was such a paradox  it was there trying to kill the ducks went in the   water but before that it was doing its howling  pray drive kill howl and it was just so sad and   heartbreaking to watch this wolf being treated  this way thank you Vicky next up is Tom Fitzgibbon Commissioners uh and staff my name is Tom  Fitzgibbon and I live on South St Andrews Drive   and beautiful beautiful Tomoka Oaks first of all  I want to thank the Commissioners of Ormond Beach   for your time and effort to investigate the Tomoka  Reserve development this development will have a   big impact upon the current residents of Tomoka  Oaks the trails Escondido condos Tahlequah and the   surrounding Community Tomoka Oaks is indeed a  beautiful unique property that deserves special   consideration so thank you very much secondly  on the not so nice side the traffic on my Street   South St Andrews Drive was already identified  as a problem even before the possible 600 plus   cars and trucks are added by The Tomoka Reserve  development I have been communicating for about   a year with the public works department we've  had good discussions but no progress has made   been made on slowing traffic at least 9 months ago  the public works department indicated that   South St Andrews was scheduled for installation  of speed tables the public works department knew   South St Andrews had a speeding problem and that  we have tried to fix it with a with police patrol   and a radar speed sign nothing is slowing down  the cars I have a radar gun I'm one of those old   guys with a radar gun and uh my readings indicate  that about 50% of the traffic is speeding faster   than 25 miles miles per hour the speed limit about  25% is over 45 miles per hour now the public works   department is indicating that there has been  quote contention about the installation of   speed tables end quote and they have halted the  program that is already working well on 20 plus   streets in Ormond Beach I understand people do not  like speed tables I don't like speed tables but   nothing else seems to work every single resident  that I have talked to on South St Andrews Drive   about 25 people have supported putting in speed  tables last Friday January 20th about 9:00 p.m.   I witnessed four pickup trucks roar by the front  of my house two of the trucks were side by side   on our two-lane Street on South St Andrew's Drive  racing up the street it's pretty horrifying they   blocked all traffic in other words they took  both lanes uh up and over the blind Hill at   37 South Andrews Drive they couldn't see who  was coming in the other direction no one was   killed or injured this time but several years ago  a woman Walker was killed several houses down from   us so it does happen please put speed tables  on South St Andrews and you will save injury   and death and the resulting heart heartache  thank you for your time Michelle Zurbach is next good evening I'm Michelle Zorbach from 328  River Bluff Drive I'm here tonight because I   want to continue to thank all the city staff the  Commissioners and especially the planning board   for their continued participation in what I hope  will be thoughtful evaluation of everything that   is presented by Tomoka Reserve um this takes us as  a little throwback in time Tomoka Oaks is   a community this is a community directory this  is what we used to print every year in Tomoka   Oaks all of these people listed in alphabetical  order have property rights just like the people   who purchased what is labeled on their deed  what is labeled on their plat what was labeled   on their contract and what is labeled on their  title policy as a golf course we have the same   rights that they do we have an expectation and  we're hopeful that we're going to find some type   of a compromise that will let them be members of a  community like this I saw Bill Navara here earlier   he's advertised in the back looking as handsome  as usual the inside cover says we should be   supporting our local community businesses that's  the kind of community that Tomoka Oaks is that's   the kind of community that Ormond Beach is we  need to do everything we can to preserve that I   wrote y'all a letter last February and I'm just  here for a little update I'm writing to express   my concern I'm still concerned with the ongoing  project being proposed to build an excessive we   now know it's a ridiculous number of homes on the  golf course in Tomoka Oaks as a current resident   of the area who just put a substantial remodel on  their home because this is where we're going to   stay I also worry about the traffic traffic  that is on the roads in Tomoka Oaks today I   was walking the dog with my daughter and just  as Mr Fitzgibbon has said there's not a lot of room   on our roads and I know he speaks specifically  about South St Andrews but Rio Pinar is no piece of   cake either it's a long stretch where there's a  couple of houses with young kids with big trucks   just as he spoke of today we're walking our dog  on a leash a dog off leash comes completely out   of his yard into the road and as we're trying to  keep the dog from this dog there's a car coming   both ways one was coming a little faster than the  other it could have been a not very pleasant scene   we know common sense knows every one of you has  common sense and you know that the traffic study   is flawed there is absolutely no way that all of  those people are going to go out of Nova Road and   the other people that still live there are going  out Nova road to the trails is going to be a hot   mess express please please continue to question  everything that is put forth by those people   and do what is right for the citizens of Ormond  Beach thank you Michelle and we will move to uh   approval of minutes the minutes have been sent  to the Commission for review also posted to the   city's websites uh these are from December 19th  2023 second all right any additions deletions or   corrections I'm guessing not based on the deputy  mayor's moving for approval and Commissioner   Sargent's uh second of that all those in favor  say I I I oppose like sign and we'll show those   passed unanimously uh consent agenda does anyone  wish to pull anything from the consent agenda I   move approval of the consent agenda second please  call the vote Commissioner Tollan yes Commissioner   Sargent yes Commissioner Persis yes Commissioner  Briley yes Mayor Partington yes and now would be the   appropriate time if anyone wishes to uh comment on  consent agenda items Commissioner Sargent like to   uh comment on F um Officer Pearson I believe will  be retiring from Ormond Beach uh Police Department   after this uh settlement and I just think um I'd  like to say thank you to him for his service to   our country um when he served in the military  and also for his 20 almost 20 years as a Ormond   Beach police officer so I just would like to say  thank you to him that's it Mr Mayor all right thank you   sir Commissioner Persis yes I also wanted to  to mention um Officer Pearson uh he's one of   the first officers I met when I first became  a Commissioner and he was always just the best   and so nice to me and always helpful um I just um  very happy for him and um wish him the best and I   I I hope we can acknowledge him sometime here um  after he's retired I think that would be great   and the other thing I wanted to mention it's  about um let's see item let's see what item is it oh I just lost it it's the Florida League of  Cities priorities and policies um for this year   and I just think they're great and they will be  wonderful and beneficial for our city especially   with the um sovereign immunity short-term rentals  property tax protection um and some of the   others so I just wanted to mention that too that  I'm glad we're supporting it great. 7g anyone   else Commissioner Tolland I just wanted to reiterate  what Commissioner Sargent and Persis said about   um Officer Pearson um I just want to wish him  congratulations and his retirement and best   of luck Mr Mayor very nice Deputy Mayor Briley as  well and I've known Rob for many many years and uh   actually I knew Rob when Rob's dad was a community  service officer with the city then I believe Rob   became a service off Community Service Officer  with the city but uh Rob has put in many many   years with the city and uh he'll be missed good  deal thank you all and uh now we'll move on to   item 8 on the agenda this is resolutions and I'll  ask our clerk to read 8A resolution number 20   24-10 a resolution approving and authorizing the  removal of a historic tree located at 517 North   Beach Street and setting forth an effective date  this is resolution number 2024-10 read by title only   thank you uh Commission I don't have any cards  on this thank you Mr Mayor two weeks ago we had   the tornado and heavy weather coming through and  so we had to cancel the meeting um I appreciate   you all moving everything to this agenda um  a couple things were supposed to happen at   that last agenda meeting one was to recognize um  police for their law enforcement um appreciation   day and secondly we were going to recognize Susan  Dauderis for becoming a Certified Municipal Clerk and so we did have cake and do we have we did have  cake in your absence we always enjoy cake um   she will be pinned by um someone from the City  Clerk's Association so when that occasion arises   and when her pin comes in the mail then we'll  make sure that we do that I think I think it's   really important to recognize uh Susan for the  excellent work that she does for the city um to   be a Certified Municipal Clerk takes a great deal  of time and effort um you know some people go to   conferences and they wander from room to room and  they leave early not in the City Clerks you know   you have to have permission to leave 10 minutes  early or you don't get credit for that session   they have strict requirements for the number of  hours they have to be there and for the work that   they have to do and Susan you truly have excelled  and we're so very very proud of you appreciate   it and I think is Taylor working on her Certified  Municipal Clerk yes so [Applause] Susan Susan has   put together a wonderful team of employees in the  City Clerk's office she really works hard to train   them you've seen her cross trainining them up here  from time to time and I can tell you that that's a   real asset to our city to to have multiple people  trained and all with wonderful skills so thank you   for your leadership we truly appreciate that um  we also want to recognize um Pauline where did   Pauline go did she leave she out she stepped out  well Pauline is our new um PIO officer who focuses   on police and fire you um met her yesterday at the  the police station while she was taking pictures   she's a supplement to Jen and so we're really um  very proud of her she fits in like a glove she's   done great work and so Pauline if you can hear us  we say thank you and appreciation um City Manager   report I I don't have a whole lot of um issues to  discuss with you there's movies on the Halifax   on February 2nd uh I want to say it's groundhog  day but it's not it's Sing 2 um I'm happy to   answer any questions uh we have a City Manager  report in your um agenda packet so if you have   any questions uh please let me know thank you  any questions for the City Manager if not we'll   go to Assistant City Manager Claire Whitley um I'd  also just like to congratulate Susan and note that   between her and the legal department we are never  getting off track late out of line when it comes   to the Commission meeting so thank you or the any  anything thank you and good night thank you yep   and next City Attorney Randy Hayes thank you thank  you Randy and uh tonight we start Commission with   Deputy Mayor Briley thank you Mr Mayor um well  Happy New Year everyone I guess this is our our   first meeting of uh of 2024 um I do want to start  off with with one thing and I think everyone's   seen it in the newspaper and all the news and  that relates to the fuel Farm issue Mr Mayor   good to see you on TV yesterday talking about this  subject um I'm sure as many of you know this been   an ongoing uh issue not only with the city but the  county and the state um now the state has gotten   involved there's a little bit of overreach from  Tallahassee in regards to what cities and counties   can and can't do with some legislation that's been  introduced in Tallahassee two Senate bills and two   house bills fortunately for us I think we do have  a a friend we have friends in the legislature I   think our legislative delegation will work hard  to neutralize those bills as much as they can if   not totally um but I would encourage you you know  the fight has gone from here to the county call   your Legislators let them know that you still  oppose I don't think you know I don't think we   really necessarily oppose the issues it's the  locations you don't put these things next to   55 plus residential communities you don't put  them next to recreational facilities you don't   put them next to Municipal airports in fact in  my opinion don't put them near any residential   so please you know you've you've you've let us  know you've let the County Council know remind   your Legislators that you know try to fight as as  best they can um I do want to say that yesterday   we had the opportunity to uh recog recognize and congratulate um Officer Klein as our Police   Officer of the year and our Civilian Officer of  the year Avery Randolph that was a great ceremony   over the PD thank you Chief thank you everybody  in in blue uh we certainly appreciate everything   you do we appreciate our officers and Officer of  the Year and our Civilian of the Year um one thing   I did get a phone call on and it kind of goes  hand in hand um I got a call last week about uh   some homeless folks that have taken up residence  on residency on the sidewalk and they were not   only just they were sleeping on the sidewalk but  they were blocking the entire sidewalk and I know   we've had those issues before with some of our  bus stops and some other areas parks that type   of thing I know we don't we can't really control  that Randy I guess um there's some limits on what   we can and can't do I just and I have talked  to Ann Margaret about people obstructing the   sidewalk and she has advised me that we are permitted  to um not let them do that so um and I will tell   you that OBPD does an amazing job anytime they  see that they try to offer them services and   take them anywhere that they can so that they're  homeless for a reason they're there for a reason   and so shout out to the Chief because they do  a great job 99% of the time getting those folks   off the sidewalk but Ann Margaret has advised  us that we can I don't know if she issues a   citation or what but we can move them along if  they're blocking the sidewalk thank you Joyce   and that was one phone call I had another phone  call I had was and kind of kind of while it was   the same week same issue um I guess there's folks  that are camping out Chief you may be aware of it   underneath the Sonoco Clock there at US1 Granada  so um that is private property um so uh I we can   talk with the chief about notifying um Sonoco and  they can have that um individual trespass okay   so uh we can work with the chief on that very  good and lastly um I know um about a year ago I   guess it was the the City of Jacksonville passed  a pretty strict pan handling ordinance and it's   kind of funny I witness it twice this past week uh  I went to take my dry cleaning out and you get out   there around Williamson Boulevard and Granada  and the inter interchange uh there's usually   about five different folks in five different  locations pan handling when you go out there   in the morning they're in one place you go out  there in the afternoon it's the same five people   but they've changed positions so I don't know  I didn't know Randy if if if there's possible   I know I know a lot of these pan handling  ordinances are challenged in the courts I   know Jacksonville passed one that was pretty  stringent I don't know where it sits I think   they felt it was fairly bulletproof as as far  as any legal challenges um don't know if maybe   we can look into what they have and see if we  can't maybe do something similar yeah we're   we're always looking at what other jurisdictions  uh provide um ours is pretty tight uh and it it um   is something that um we are judicious about in the  enforcement uh mechanism uh of course we always um recommend caution uh not to go too far like  some of these other jurisdictions have because   it is it it's a fine line um on some of the First  Amendment um issues and as um offensive as it is   to some people uh it's not to other people and  um you know we try to find the the balance and   I think our folks in the police department do  a great job trying to balance those out between   the panhandling and the homeless people and that  sort of thing thing and I think the general rule   that I've always provided to people through  the years is that um is it is it the conduct   or is it the person and I used a Boy Scout and  a Girl Scout example right so if what you see   wouldn't offend you if a Boy Scout or Girl  Scout does it then it shouldn't if somebody   that looks a little bit different than the  normal folks should do it so there's there's   a fine line we do try to balance that out and  we do try to um uh make not of uh some of the   restrictions in other jurisdictions and there's  some that we've looked at and we're like it's   a matter of time before they get challenge  and ultimately it it it will likely happen   so thank you Randy Mr Mayor I'm sorry that's all  I have thank you thank you uh Commissioner Tolland oh let me see there's only only three pages  tonight just kidding so first of all I do   want to say congratulations Susan I'm I'm sorry  we weren't able to just honor you singly last   time but well deserved thank you and big congrats  to Avery Randolph and Officer Kline we did go to   that ceremony yes yesterday and um it was just  so fun to see them honored I mean they're just   wonderful folks in in what they've done um I want  to thank the city for a beautiful festive holiday   season decorations events at the casements the  parade the tree lighting you we didn't really   get a chance to really mention all of that in  our city goes Leisure Services uh Stefan Robert   the whole gang Sonja everybody goes over above  and beyond to celebrate um the holidays with   our residents and I'm very grateful for that um  we did celebrate Arbor Day and um lot of native   plants and trees were planted and I was really  excited about that there were actually four   tree plantings just within our city alone and um  that was a lot of fun um I do want to mention that   I had the Main Street Two Flyers put at each of  your desk these are the two big events that are   coming up you know Main Street does a tremendous  job for our um for our city um with some economic   vitality and just some good good friend building  and community building so if um I I will put a   plug in for Main Street that they are looking  for volunteers and sponsorship so I just wanted   to officially put that out there um the Regrow  the Loop initiative is still going on it's if   you re recall it's a pilot program it will be up  in the uh Spring I think April um and it we are   hoping um this collaboration with the county will  continue and it will expand through the county I   think was has been as um Mr Troy Kent would say it has  been wildly successful and so we're hoping that   it will continue in other areas of Volusia County um I  did attend by Zoom an advocacy meeting um with the   Florida League of Cities on the Live Local Act I don't  know if anybody's following all of that but looks   like they are um Florida League of Cities has broken  down the bill broken down the pieces and have   tried to address the issues that's affecting all  the cities one one bill doesn't always fit well   for all cities so they're they're hoping that we  can get a little bit more um friendly changes with   that bill shall I say um I do want to say that  February 6th is the County Council Meeting um and   they are going to be voting on the second reading  for the Moratorium for the Heavy Industrial   Development and I do plan to attend um as a  citizen and speak um at that meeting um and I do   want to ask staff and Joyce if there is a Cassen  Park update are we is it coming to us anytime soon   um Sean can speak to that thank you you and then  I have two more items and then I promise I'll be done you all love me just say that. just a very  quick update um I received 60% plans from Zevon   associates this very morning and so we're going  to digest those and try and um summarize them   and bring hope to hopefully bring you guys  a formal update of everything that including   some some chance to take a look at those to  show you when when you take a concept plan   and you make them engineered there's there's a  little bit of finessing of it making it proper   we want to show you how they were able to make it  pretty darn close to to to what we all showed you   as Concepts plans so um give us a little bit of  time to digest these 60% plans and get them to   you what they're planning on doing is taking the  plans at this point to SPRC all of our projects we   we follow the same procedures that any of our  developers would and so in doing that we have   to take it to our Site Plan Review Committee  and so these this is what we would submit to   our site plan review committee for that first  pass of comments and and then they would work   those comments into those final 100% plans so  okay we're close we have 60% plan so getting   there okay thank you all right and then um  my second to last topic is um I just want   to update you all a little bit with the Scenic  Loop folks um they've been meeting and they've   been discussing um with that that about that  creation of a Gateway Park um to the scenic   loop and you all had given us given them the  permission to go to Quality of Life and they   did do that and they were successful um uh  and receive unanimous support from them um   they have Iden there are in the process of  identifying some capital items that they'd   want to have available to the residents um they  are talking about trees, plants, kiosks for education   um they've been discussing funding sources um  they're being identified in collaborations and   partnerships with other folks um they have  met with County staff as well as looking at   for looking for funding opportunities as well um  and um I'm hoping and I and I have a request of   you all as Commissioners I'm hoping that you all  are curious enough about the project and value   our residents desire to create something special  for the community and agreed to have a workshop   so we as Commissioners can discuss all the  possibilities that we can do with that land area   so I'm asking you all now what do you think and  if you agree can we ask staff to put together a workshop a workshop to discuss that property and see   how that could fit into our plans as a city  obviously there's no number numbers involved   with it but it's something to see if you all are  really interested so this is my thought process   you know us as Commissioners we're we're we've  got this big idea we've got big issues going   on in the city with Belvedere Tomoka Oaks Avalon and  all of that well what makes our city so special   are all those little things that the residents  bring to us and if we ignore all of that little   stuff we're we're kind of losing we're losing  the battle here I think our community is really   special I think if residents care enough to try  to improve it and make it I think we at least   deserve a good discussion about that I think it's  worth discussing yeah I do too which property was   it again so it's the East side of Beach Street  opposite where 56 North Beach Street East Side   thank you the old church property okay but the  east side so it it's south of the Yacht Club   north of Bailey River so it goes Bailey River and  then there's the Historic Society little piece of   land and then there's the 56 North uh North Beach  Street and then Yacht Club so it's that little   Park um Quality of Life was very excited about  it I just think it's it's worth a discussion I   mean all it is for us at this point is an hour  of our time to discuss it before a meeting seems   like it's been a little passive park for many  many years and it's not even really a park it's   not even a park it's just dirt it's just a common  area it's just dirt and you know it's waterfront   property it's I mean I could I could talk all  about it right now but you know I think well   my feeling is it deserves a discussion and I'm  hoping you all agree I think we've talked about   it for years but we can continue to talk about  it so workshop is because I thought one time I   thought at one time there was discussion making  that like a park from just just south of the Yacht   Club all the way to Bailey yep the whole river  Historic Society owns that little piece of land in   between so there is I will I can share with you  now there is a conversation with the Scenic Loop people they've already reached out to the Historic  Society so we could possibly make that one little   Park Contin contiguous continuous from yeah  I hate that word like a little more than two   syllables I don't say it yeah there you go  so do you are you all okay with that can would   you mind only if we use native plants yeah and  no we only want native plants okay Joyce are we   good I think I hear a consensus so we'll schedule  workshop um I don't know what date that might be   at this point but as soon as we can great thank  you thank you all I appreciate it all right my   last but not finally not least is I am officially  liking to liking you like that word I am going to   announce that I will be filing to run once again  uh for City Commissioner Zone One whether you all   like it or not um I've enjoyed working with  you all um I've enjoyed working with staff   as we continue to navigate some um pretty  tough issues that have been affecting our city   um I have the utmost respect for our residents  and I appreciate sorry I appreciate their passion   and our love for a city um so I certainly hope  that I will have the opportunity to continue to   serve that's the end of my report good night  all right congratulations and Commissioner Sargent um on the resolution 8A which was the  historic tree to be removed I'm just wondering   if if that could be handled at the staff level  the future it has to come before us I just feel   like there's a lot of wasted money on items like  this I mean the residents here with their it's   required I think by code to come before you you  can't have staff just handle okay I defer to the   City attorney but I think it's required by code um  I just feel like it's a waste and could be handled   at our staff's level if they're approving it and  for them to waste time I just I feel like it's   waste but it's not here nor there um I'll go on to  my mulch issue I've been since I've sat here I've   complained about this mulch over and over and I  know we laugh about it but when you go out here   and you drive the medians there's mulch all up and  down there that's running into our waterways and   I'm just tired of seeing it like how hard is it  to clean it up I'm just I'm at a point now where   I laugh about it but it's very frustrating like  it's not getting cleaned up we add more it runs   off into our river it just it's a waste and  we just approved 30 some thousand dollars back in October   for more mulch to wash away so I'll just leave  it at that um Riverbend Golf Course the parking   lot I'm just wondering about 3 years ago we put  up a fence on the outside of the parking lot so   we block off that area and we just let it grow  I would like to maybe see if we could possibly   move that fence towards the building clean up  that parking lot and utilize it for additional   parking for the mountain bike trails for people to  utilize because there's limited parking over there   let's utilize a resource that we have at our hand  clean it up and let our residents and maybe enjoy   some of that so I don't know if that's an option  we can look at if y'all are well staff can look   at that and report that to um on the homeless  issue that Commissioner Briley um addressed I've   been in conversation with the City Manager about  this we've cleaned up several lots I think we need   a program to identify property owners that have  vacant lots to explain the process to them that   they have to fill out a form to allow the police  department to trespass people a lot of these   people might live out of state the the person that  used to own the the lot next to the Sonoco or the   Shell station on Granada lived in Virginia they  didn't know that they had homeless camp on there   but if we could identify these property owners  and notify them ahead of time so we can get no   trespassing signs it might alleviate some of the  the issue I mean the one on Center Street over   by the nursing home you pull out of that nursing  home and you look straight in front of you and I   mean it is scary the homeless camp that's back in  there by the YMCA area I mean it is scary I mean   drive by there tomorrow I encourage you all and  just take a peek it popped up I didn't notice it   until I saw cops down there for some reason last  week so I went down to see what was going on and   it's a pretty impressive homeless camp I mean good  idea um so I don't know I just think maybe we can   identify the property owners to to help clean it  up that might be an option um and then maybe you   know on the plant issue maybe we can also start  a program where you know if you take a tree down   you plant one on the loop or something um I know  that's probably part of it but but um yeah that's   all I have that I'll say good night thank you  Commissioner and Commissioner Persis good evening   everyone um I just have a few comments about some  things that happened I guess since Christmas uh we   had Starry Starry Night early in January and it was  you know three different places The Casements and   the let's see what McDonald yeah McDonald House  and and the Ormond oh man and went from place to   place and we saw some beautiful art it was you  know we have local artists right here and they're   just awesome so I encourage you next year when  that comes please go and we did have a lot of   people but I tell you what people don't know  what they're missing it's beautiful pieces for   your homes if you're interested in that it was  really nice and we had the Martin Luther King   breakfast at the South Ormond Nova Center a   Martin Luther King day we had a lot of people   come in and get breakfast and it was a wonderful  event uh I was lucky enough to be chosen by   my husband to go to the spelling bee at Tomoka  and be the spelling be caller he wasn't able to   go so he said why don't you go you're you're the  City Commissioner that's not quite your zone but   you could go so I did and I tell you what these  kids can spell they are so smart today boys and   girls I'm just very very impressed with them  but um it was a lot of fun doing that brought   me back to my principal days and as Commissioner  Tolland said we had Arbor Day tree planting we had   beautiful native trees planted and we used to do  it remember Mayor at Ormond Elementary but I think   we filled up that whole area with beautiful oak  trees and they're they're growing and it's really   pretty right there in front of Ormond Elementary so  these other trees are going to grow and just be as   beautiful as those are so it's very exciting and  I also want to just extend my congratulations to   Jeremy Klein who is the officer of the year and  to Avery Randolph for being the citizen of the   year they represented Ormond Beach well I'm just  very proud of our Police Department I'm proud of   our fire department we have topnotch people  in both of those departments and I certainly   wish that every day could be law enforcement  appreciation day because they deserve it each   and every single day and um last but not least  I would just like to say Joe Daniels I'm glad   you're here um Mr Persis enjoyed your company  the other night I just want to extend that uh   to you out there so thank you for what you did  the other night and I hope everyone has a safe   evening and good night thank you Commissioner  and uh I I wanted to talk about Arbor Day as well   because it was probably just like the parade was  one of the best ever this Arbor Day celebrating   the 100th anniversary of uh Garden Clubs was  probably the best ever pretty cool we had three   uh different events that we went to started at  the Environmental Discovery Center uh with the   city's ceremony went over to The Casements for  a uh Ormond Beach Garden Club ceremony and then   ended up at uh Anderson Price building with the  Historical Society ceremony and pretty much the   entire Commission was there and then Commissioner  Tolland had events after that she was still going on   Arbor Day Arbor Day issues but I can tell you uh  the Garden Club folks like cake and cookies and   uh that is awesome they uh also bring an elegance  and charm to this city with their uh the things   that they do on a regular basis and most people  never know about it so at least one day a year   they get the recognition whether it's through the  Observer or the News Journal uh it gives them the   opportunity to have the light shined on them and  speaking of cake Joyce I hope when Susan's pin   gets here and we have another proper ceremony here  that we have cake prior to that there is always   room for cake awesome awesome awesome cuz yeah  anything uh efforts with our staff to increase   and improve professionalism they're already very  professional as it is but anything they can do to   improve that I'm all all for that and Susan's  really taking the bull by the horns in in that   respect so thank you Susan and congratulations uh  to you Monday morning I couldn't be there for the   the Police Recognition Ceremony so thank you  Commission for covering that I was out at the   transportation and infrastructure subcommittee  meeting for the elected uh officials Round Table   out on 92 and uh we talked about strategies  really primarily focused on transportation   looking at the East side and the West side of the  county trying to prioritize and pick the top two   or three transportation projects that'll benefit  the most number of residents and uh a strategy   to to accelerate those and I think what we have  settled on is not only working with TPO that has   to be involved in those kinds of projects from  a funding perspective and planning perspective   but also uh working with the Volusia League of  Cities who under Mayor Paritzky down in Ponce Inlet and then Mayor Miller in the Shores  have really done an incredible job ramping   up their advocacy efforts and uh identifying  those particular projects and then letting   the Volusia League of City's Advocacy Committee just  tear into it and uh move those projects forward   I think that's what we have decided to do our  next meeting will be in a month or two and uh   staff is going to come back and bring us uh  what they believe are the top issues and then   the electeds will discuss those and and take it to  the full round table so uh that that went really   well uh Temple Beth El is having a community wide  Sabbath service on Friday evening at 7:00 p.m.   uh I plan to be there to present a proclamation  uh that's at Temple Beth El uh this past Saturday   they had a dinner the women's group there and  uh dinner/fundraiser very well attended and   very very successful so um as far as the trees, Commissioner Sargent I appreciate your comments   I kind of agree with you when you read through  that information it seems like a no-brainer that   particular tree was so deteriorated and decayed  on the interior that it was almost dangerous for   it to remain there but as the City Manager  pointed out part of the reason that we are a   uh Tree City USA for the past 32 years and then  the higher level Tree City Growth award for the   last I don't know six or seven years is that  we have these codes and ordinances that just   go that extra mile to require the commission sign  off so so that's the balance uh between between   those issues and I I understand that um and we  really do pride ourselves on uh protecting the   tree canopy that we have um as far as the homeless  issue it's a constant problem uh I hear about it   frequently I know in some states some cities they  are uh essentially making it a misdemeanor to be   homeless they'll remove the person and if they're  is room at the homeless shelter they're required   to take them there uh if there's not I think they  just give them a citation and move on but uh those   are things that I think are Legislature probably  needs to look at uh the way it's been put to me   by folks is we work so hard to create a beautiful  city and then this homeless camp situation uh   if you've ever been to one it's the most filthy  disgusting vile uh living situation that you've   ever seen with human waste uh all kinds of trash  it really is uh it's a mindboggling that anybody   could live in that situation and Randy when  you talk about would you let a Boy Scout or a   Girl Scout do that absolutely not uh would you let  them push a giant shopping cart down the sidewalk   absolutely not uh would you let them sit on the  corner uh with no legs absolutely not and it's   just you know the things that you see uh these  people praying on the feelings of our residents   it's not appropriate uh I have a heart and  I'm sorry that they're in that situation but we   have tons of services in this County that we can  provide for them and I think uh we have to figure   out a way to to be kind about it and do it civilly and it's just a problem that's going to take some   thought and some management and I think there is  help coming uh from the state level so hopefully   we'll keep an eye on that and see how it goes  but um as far as Main Street goes they continue   to do wonderful things Lori thank you for your  service on that board the uh Festival of the   Arts Granada Grand on February 3rd is going to  be fantastic the Celtic Festival people come from   miles around for that on April 20th and 21st and  then I think in May they're going to have Taste   of Ormond yes which is a huge hit every year and  so we'll uh be able to enjoy that I think that's   everything I had uh Happy New Year to everybody
