upon all the proceedings that goes on today  on these this city business it's important   especially to those that have certain  agendas that they need to have addressed   father I pray that all second place Ormond Beach sand crabs no no here and and in first place Champion  Elementary honey bears [Applause] in our Vehicle Division in  third place we have Universal [Applause] Towing second place is Cory Dr  [Applause] Pepper in first place these people   always have a blast Mid Florida Jeep [Applause]  club now in the in the toughest division to   uh judge anymore everybody's gotten so  good uh our floats division in the third   place Iron Horse Saloon hot Action Sports  Wear United Rental that was an awesome float in second place Tomoka elementary  [Applause] school and we we'll keep with   the theme of schools in first place s  St Brendan's Catholic School [Applause] and and for years we always had a problem  where how we were going to bring Santa Claus   in for the last few years we have a sponsor um  that just makes it easy for us and they build   a float and boy do they build a float uh they  win best of show this year and they're already   planning for next year they got a couple  surprises a big hand for Abaco [Applause] windows so if we can get them to to head  out to the at and we'll bring uh Becky   up and she can get present the Reich  huntermark president me okay all right great   okay so um I am Nancy Miller mayor of Daytona  Beach shores I'm also president of Florida League   of Mayors and president of Volusia League of cities  so I'm here this evening to congratulate you mayor   leslie you City Commissioner Deaton and you City  travis Sargent commissioner for your election   congratulations on winning we're glad for you  and very very happy to have you part of our   Volusia league of cities um also congratulations to  you Deputy Mayor we're very very happy to have you   with us in our mayor's ranks I do want to talk  about that mayor lesie and Deputy Mayor Tolland   attended one of our events last week a Florida  League of Mayors event we were so happy to have   you there I hope you enjoy that and uh what we  did at that event was my priority this year is   Florida um Mayors mean business so we had  several businesses up in the era what I'm   trying to do is promote small businesses through  our Chambers our businesses are a backbone of our   community so I wanted to set best practices how  we can work with them together and both mayor   Leslie and Deputy Mayor tolland were there and  I so appreciate it we will have other events   going forward so I'm hoping you can um attend  those as well and on behalf of Volusia League of   cities I am thrilled to announce that uh deputy  mayor tolland has been added to our Volusia league   of cities board of directors Lori I can't tell  you how happy we're to have you we're looking   forward to her leadership on that committee moving  it forward and I want to take this minute to thank   each and every one of you this is not an easy job  thank you very much for stepping up representing   Ormond Beach but more importantly representing  Volusia County and I'm looking forward to working   with each and every one of you thank you  for your service we greatly appreciate you thank you mayor thank you for coming  out here in this weather uh from Daytona   Beach Shores um next I'm going to call up  uh Debbie Forester Debbie where you at you are all right I'm Debbie Kruck Forester commander  in um founder Ormond strong uh Grassroots uh   veterans and military military veterans and  first responder support group I'm here to   thank everybody um in the community for their  time Talent treasury regarding our Clyde Elyse   and veterans nursing home event in our adopt a  veterans program over 120 veterans were thrilled   to receive their Christmas stockings as a result  of our community effort uh a little story when we   uh showed up there there were a lot of veterans in  the uh Lobby and I brought my um Walky um speaker   and had uh Christmas carols playing in the lobby  and then we all went around took us 3 hours to   give out all the stockings Etc and we came back  3 hours later and they were all sitting there   listening to the Christmas carols again and I  asked if they had a speaker there and they said no   so we all chipped in got them one so they got it  before Christmas so our event was when the parade   was going on here but um it's cool so they got to  listen that also I want to thank everybody um that   donated uh to our um North Carolina Caravan the  veterans Caravan so this will be our last Caravan   up to North Carolina um we everybody donated so  many things that we they needed and uh if you   didn't donate that's okay I would ask you to um  donate to like project Hilo because they give   campers to the um people that don't have homes  and everything up there and um so forth also um   I'd like to do a sister brag my brother was one  of the 3,800 Law Enforcement Officers sworn in to   protect pres number 47 um I want to thank all  law law enforcement officers and firefighters   um some of them most of them being military  veterans themselves I just want you to know   our group Ormond strong um we're with you  we'll fight for you and as long as we're   around your service and sacrifice will  never ever be forgotten thank you Ormond   strong out thank you Debbie thank [Applause]  you next I'm going to call up Patricia fanom hi I feel bad these two ladies gave you  all these nice Praises I'm praising you   too but I'm asking for something so good  evening my name is Patricia fanom and I   live in Bear Creek located on Airport Road in  Ormond Beach Bear Creek is also next to what   used to be the Riverbend Golf Course as you know  Riverbend has been closed since December of 2020   tonight I am asking you to please schedule a  workshop to discuss this property since riverbend closed in 2012 the property has not been  maintained it has actually become an eyesore   on Airport Road not only is it an eyesore Riverbend  has become a danger to the Bear Creek community   homeless camps have been set up the people living  in riverbend frequently trespass onto Bear Creek   they use our pools outdoor showers sleeping in  clubhouses and use the restrooms they harass   and frighten homeowners at Night by shining  flashlights into Windows a few months back a   dangerous fire occurred near one of the homeless  camps this fire was directly behind a few Bear   Creek Homes fortunately no one was hurt others  have turned Bear Creek into a dump people can   gain access on Airport Road and Hull Road items  such as toilets boats and other various types   of junk have been discarded onto the property  homeowners are also more than concerned about   the very high grass many fallen and dead trees  we see this as a fire hazard in light of the fire   catastrophe that is occurring in California we are  all more than fearful I understand that there are   many layers when planning the most appropriate  use of property however you need to understand   that this property has become a fire safe and  quality of life Hazard to the homeowners of Bear   Creek I'm asking you to please schedule a workshop  sooner rather than later and put together a plan   to keep us safe during this Workshop discuss  positive ways for the people of Ormond Beach to   use Riverbend again consider creating a nine-hole  golf course or open a small restaurant and create   much needed quiet walking trails thank you very  much for your time and thank you for all that you do thank thank you appreciate uh I'm  going to call now uh Denise krisky W hello my name is Denise Krisky and uh I'm glad  to meet you all I've written to maybe some of   you here several times on behalf of the Ormond  beach tennis center and uh I'm not from this   area I'm actually from New York state but I'm  here for usually three months out of the winter   time and when I come across the bridge over on  Granada you see the beautiful casement building   and then you see the beautiful tennis center and  you go down the whole road is absolutely gorgeous   you have a wonderful gem there in that Tennis  Center if it wasn't for that Tennis Center I   would go down at Port St Lucy with my husband's  family and be down there but I love the tennis   center they're so welcoming they make you  feel like you're part of the family there   and I really appreciate your support for them as  well well as Andy Romano Park which I also love   but I'm hoping that in the future that Trisha  who is very much involved in there and Denise   also that you would give her both of them your  support and helping them to continue with this   tennis Center otherwise my husband and I if had  ever closed up God forbid we wouldn't even come   here anymore cuz then I wouldn't have anything  to do but I love to play tennis so in that regard   you have a beautiful gem in that tennis center  and you don't realize what a gem you have until   it's all of a sudden gone and then you can't  get it back so my hope is is that you keep   supporting them help them to get the clay they  need and get the courts fixed up the way they   should be and continue in a wonderful tradition  that draws an awful lot of people here from all   over the country from Michigan Ohio New York  and uh but it it's really good to meet you all   I've written like five letters to you on behalf  of the tennis center so that's me thank you so   much for your time appreciate you all thank  you [Applause] Denise next up Suzanne shyer hello I'm Suzanne Shyer I'm representing  dream green Volusia on January 14th the Volusia   County Council held a special meeting to  discuss the moratorium as everyone likely   knows no motion was made however something  significant took place during the meeting   councilman Kent brought forward solutions  to stopping flooding I'm asking for the city   of Ormond uh Beach to support and work with  the county on the following which are coming   back to the council for discussion to stop  building on Wetlands to clean the canals to   purchase low-lying homes that flooded  from willing sellers working with the county to use county-owned land and not  Volusia forever for storm water storage   where it's practical to work with the  county concerning planning and storm   water for the future and how to repair it  now and no bit no mitigation banking so I   ask you to review these issues as they  pertain to Residents flooding growth   and interactions with the county in support  of councilman Kent's proposal because these   were his proposals not my personal proposals  as our elected officials and representatives   of Ormond Beach this city commission has the  authority to send a letter of recommendation   and support our councilmen so thank you all  for your consideration and for your time thank you uh Jennifer bright good evening I first would like to thank the  city for their quick response and correcting their   error and removing the data downloads from the  open finance transparency portal I look forward   to having the working links for the payroll data  restored to the site as well second I would like   to suggest that the city When It prepares its  agenda adds the expenditures and revenues if   if applicable like the county Volusia County  currently does with their agendas currently to   find this information is necessary to go through  the agenda packet which averages 1,600 Pages third   the Webster dictionary defines minutes as an  official record of proceedings of a meeting the   city currently appears to be supplying a summary  of the meetings and it's called the minutes if   we're going to use a summary we should call it as  such the data can be found on your YouTube channel   that posts the city's live recordings where  there is a closed catch and transcript of the   meetings I would like to thank my commissioner for  informing me that my questions and concerns for   several agenda items on tonight's agenda will be  addressed during this meeting as for my questions   and concerns regarding specific agenda items from  January 7th council meeting I'm still waiting   for answers I look forward to council and staff  speaking into the microphones as clearly as the   city clerk does when she reads the agenda titles  this will ensure the folks in the back of the   chambers can hear what is being said during the  entire course of the meeting thank you [Applause]   next up uh trishna Patel good evening everyone my name is  trishna Patel and if you don't if you   don't know me uh many of you sitting here  have put me as the Director of the Ormond   Beach Tennis Center um so I would like to  leave you with a few statistics because um   I I thank the commission and the city for all  of the work and the support uh for the much   needed restoration of the Ormond Beach Tennis  Center um so in 2024 we served approximately   4 to 500 people each week and in that time frame  we offered nine times more programming uh offering   clinics multiple times of the day every day  of the week um uh we serve local and seasonal   players including vacationers as you heard from  uh Denise she's just a representation of many   other people who choose Ormond Beach tennis Center  over all of the other competition that is around   us uh we also offer an after school junior program  which continues to grow at the Beachside location   and and over there we serve local area families  all the way from Palm Coast to new Smyrna beach   um we currently house three competitive greater  Volusia uh tennis teams and we also offer singles   competitive play 2025 this is projected to double  our teams are projected to double um and for that   we thank you very much for your support so that  we can offer safe playing conditions for visiting   teams and also our own communities um as it  pertains to the next phase uh we have a fast   approaching deadline which uh I believe one of my  colleagues uh Alicia has already uh spoken at the   commission and it's the racing and Rec Grant and  that deadline is January 28th uh Barbara Kelly   from racing and Rec has provided us an example  of a winning application uh which has already   been emailed and I would like to reiterate mine  or Alicia's support to the grant coordinator if   there's anything we can do to meet that deadline  that would just put more wind in our sails um as   we go through the restoration um and lastly um I  would like to take a moment to recognize all the   folks that came out not only for me but for Ormond  Beach tennis center today because they make my job   look very easy and I could not have done it  without them so thank you thank you thank you next up Becky Parker hello I'm Becky Parker I'm the executive  director of Ormond Beach Main Street um I am here   to just announce a couple of fun dates coming  up but I first want to um commend the planning   department and everybody who um worked on  the comprehensive Plan update we attended   the presentation last week and I was thoroughly  impressed by how much data had to be um presented   and gone through and surveys and um I think  throughout the process they all did a great job of   in keeping us informed the website was beautiful  and it makes it easy for me to share that with my   board members and community members um so it  was that was a really big project and I just   just wanted to say great job um secondly we have  Granada Grant Festival of the Arts coming up on   February um Saturday February 1st couple of things  in February and we're going to be blocking off New   Britain Avenue and um just lining this street  with artists and activities and um some kids   games and um food and it's just going to be  a great great day it's become one of our most   anticipated events and lastly um on February 19th  news Channel 6 will be coming to our district um   they've taken an interest in what we're doing at  Main Street and within um the Main Street the the   Ormond Beach and um historic Ormond Beach and so  they're going to broadcast live there um from 4:   to 7:00 here from Ormond Beach they're going  to have their anchors and the sports guys and   weather guys and um so it's just going  to be a fun uh afternoon from 4: to 7:   again at Grind is where they will be stationed but  um they will be here in the weeks prior telling   stories of business owners and community members  and um I'm just really proud of Ormond Beach and   I can't wait to see the light um shown on us  a little more so that's it thank you thank you Becky um next up uh Barb Moore good evening Mr Mayor and City commission my  name is Barb Moore and this is in reference   to Osceola elementary school um The Pavilion uh  replacement project and um in January 2021 the   city commission the city city commission pressed  Volusia County Schools uh not to close the the 65y   old school Osceola elementary yet it was closed  in favor of um building a new elementary and   combining with ortona and then on October 13th uh  two and a half years later a quote from the Ormond   Observer has this um and it says a school board  member Ruben Colon said the decision to close   down Osceola came because the building's condition  was no longer favorable and I can attest to that   and uh it led the school district to build a new  school meaning ortona yet for school year 2023 and   24 Tomoka Elementary Administration teachers and  students operated out of this school and currently   Osceola Elementary is occupied by Riverview Behavior  Academy in alternate education school this is an   old school that was closed against Ormond Beach City  residents and quoted as the building's condition   was no longer favorable yet we want to dump money  into a project now this just doesn't make sense   um can you tell me what the cost is and uh or  where I can find the accepting bid and I just   don't know why Volusia County Schools wouldn't be  responsible for this project rather than the Ormond   Beach residents um it just doesn't make sense that  we are footing the bill just help me to understand   that's all I just want to know why it's coming  from us maybe that's common practice I don't know   but thank you and uh one other thing the agenda  if there's any chance we can have that a week   in advance that really does help I know other  cities do it and it gives us time where we can   reach out to City commissioners and ask especially  if there's a holiday that's a short time for frame   from Friday to Tuesday okay thank you good evening  thank you [Applause] Barb all right no more cards   for public comments we're going to move on to  the approval of the minutes um the minutes of   the uh January 7 2025 commission meeting have  been sent out to the commission for review and   posted the city's website does anyone have any  corrections or changes move approval second okay all those in favor say I I I  all those oppose okay the Ayes have it we're going to move over to seven now consent  agenda um items on the consent agenda are deemed   routine and non-controversial the action proposed  is stated for each item unless a City Commissioner   removes an item from the consent agenda no  discussion on individual items will occur   and a single motion will approve all items is any  member of the commission wish to pull any items from   the consent agenda I know you Joyce did but I'm  not I okay move approval absent 7g second   7 F excuse me oh okay we got make a correction on  that then correction move approval 7 uh absent 7f second any other discussion on that no  okay may I speak um so uh first of all   just to provide clarification the city is in  partnership with um Volusia County schools for   some of the playground area you see including  the Pavilion The Pavilion uh was damaged during   Hurricane Milton and has to be repaired um but  in the meantime staff feels like we need more uh   information and there's some feedback coming  from Volusia County Schools so we still have   plenty of time to qualify for Hurricane funds so  we ask this be pulled so we have some more time to   explore that okay thank you thank you we've  approved item 7f yes you did no second okay   table I'm sorry table to table it move to  table it 7F I'm sorry second we'll bring it   back at a future meeting okay did you get all  that Susan there's a couple comments I'd like   to make on a couple of the items um on consent  Item B Florida League City's legislative platform   I just want to just reiterate that this whole  platform supports home role it's an organization   that has a strong presence in Tallahassee and  I'm pleased that our city participates in E I   want to thank Leisure Services for bringing the uh  Tennis Center back to the commission for a vote to   resurface the clay courts um I know all of us  were overwhelmed with the amount of emails and   uh Trishna, you really pulled them together well  and it does make it does make a difference when   we do get a lot of emails but um I I appreciate  that and thank you for leisure services for being   responsive for that and on P um I want to thank  staff for rejecting the bid allowing the sidewalk   banding to restart and to reconsider another  option that is less costly and still attractive   I was part of that Main Street board when they  kept talking about it and we never could kind   get it off the ground due to supply and cost so  sometimes you just have to take a step back and   and re-evaluate with open mind and idea so thank  you to staff for that that's the end of my comment   thank you, commissioner Sargent I think we had a,  card for um A for Connie Colby so yes do we need to   yeah uh Randy do we have to uh go back to public  comment on that one which item is this first 7A 7A [Music] well item on sense agend  typically get addressed by members   of the comment under the audience remarks  you can certainly provide an opportunity   uh to um resident to to address it if  you wish to go back and do that you can   do that okay we have a motion right now  though so can I still do that with the   motion no you don't have so you don't have  to vote again so you've already voted on it so the question early is if you at this  juncture whether you want to go back and   allow the individual to speak to address what  you voted on okay um we'll do that then you   have some discretion um in terms of whether  you want to do that but it won't affect the   vote um unless you want to go unwind the vote  and then come back and do it which you don't   necessarily okay all right so we'll just do that  then I'll just allow the uh speaker to come up   and then after that we'll uh we'll uh move  on so at this time can Connie Colby come up doesn't yeah well I'm not tall enough um  Connie Colby 108 Robel Lane Ormond Beach   um once again an EOC and relocation of the  police station is on the agenda tonight as   I understand it it is only to approve Phase One A  needs assessment in 2019 such a study was done by   Zev Cohen for $30,000 he is listed as a partner  with jl2 on this study it sounds like we need to   pay him twice or what happened to the last  study the project has been denied Federal   funding twice and even transferring $557,000  from the general fund there is um not enough   money there's no money for making this project  a reality at this time wondering if growth is   actually making it uh pay for itself while there  appears to be a need for an emergency Operation   Center consideration should be considering  the location we hear that west of 95 away   from hurricanes and flooding would be a good  place if they are west of 95 they will need to   come back under 95 to the beach area when there's  an emergency they need to bring boats and their   other equipment here that puts them trying  to go in the opposite direction of people evacuating um wherever it is it would be nice to  have a wing of the operation emergency Operation   Center as a place like a dormatory or relaxing  place when there are emergency crews that need   to remain during emergencies um and I love the  Ormond Police Department I don't have anything   against on it um as for the the um Ormond Beach  Police Department that building as I understand   it is only 24 years old um hopefully we get more  years out of building around here shouldn't have   to build a new building every 20 years if it's  maintained the building is in the right place   and architecturally enhances the area the  needs assessment does not require inclusion   of this building in the contract it probably  needs work but the work has got to be less   than $50 million for a new building um many  areas west of the city are gated community   I think they would be able to do well if they  had a substation instead of a whole new police department um well my other thought was with  this jl2 company they're out of Longwood and   probably a very good company um the contract has  in it that they get reimbursed for meals travel   mileage tolls and parking if they're over 50  miles when I checked today they were 51 miles away   um there were a lot of money numbers around  there that I didn't understand and they seem   to be over the years from 2019 onward um  I think the project probably needs to be   done but I think we need to study a  little bit more thank you thank you Connie well thank you uh commissioner Sargent for  that card I didn't see it there I have comments on   the consent okay go ahead commission Sargent  thank you Mr Mayor um just to address a couple   items on the consent um as uh Miss Colby said  item a for the police station the reason why we're   invested in this is you when we go to the state  or federal we need to have shovel ready projects   otherwise they do not fund them if we have ideas  out there ideas don't get funded we have to have   shovel ready projects which requires an investment  from the city that is why we do do it in this   fashion and um so that's why I'm okay with moving  forward with it and because we have to have it in   order to go to Tallahassee or go to DC to get um  outside funding so our residents aren't paying um   floating the whole build out of just locally um  move on to C which is the contract for um Ghyabi   Consulting and management and this is to combine  two contracts for uh annual fee of $71,000 and   the amount of money that in the um resources that  she provides her agency is we get quite a bang for   our buck on our return on investment I believe um  her helping us with that the I95 US1 interchange   which by the way is the oldest interchange on 95  it was built during the Eisenhower Administration   we're finally getting that reconstructed and  moved up on the list of priorities from   Governor Desantis so once again you kind of  have to invest in certain areas and have the   right people to help us guide us and consult us  properly uh resolution I'll go with E the tennis   courts thank you trishna and and all the tennis  players and the 50 plus emails that we received   um I think as you can see this commission has and  always will support the tennis center it's a great   asset I know that during campaign season which  is sometimes called Silly Season you heard you   know people putting out there do we want condos  or tennis courts there's no condos going there   it's going to be a tennis court so um thank you  and you know that's another great investment to   our community uh and there was some other items  in that you know the website well that one's not   on there but the website we're getting an updated  website that was part of the initiative initiative   with all the technology and everything I think  the city is very transparent with what we have   out there with our financial data that we put  out on the website are there going to be Kinks   yes servers go down links get broken thankfully  we have good professionals that get those fixed   in a timely manner uh and there's some other  items that I'm not going to address tonight um   I have emailed a resident back on these and and  quite frankly uh Mr Mayor you know there's a lot   of people that want transparency but then send an  email with blind copied people and I don't know   who I'm responding to and out of an abundance  of caution because I don't want to violate the   Sunshine Law I'm not going to respond to those  if you want to sit down and meet I'm happy to   sit down and meet but I'm not going to respond  respond um to these emails not knowing who they're   going to I just think it's improper um thank you  Mr Mayor thank you commissioner Sargent um any   other Commissioners like to discuss on this item good evening Steven spraker planing  director uh with me tonight we also have   Cara culiver who's our city landscape architect  she is the individual who drafted um these code   revisions so um this item started with a  discussion item in June of last year there   was Direction provided by a city commissioner to  update the landscape standard starting in August   there was a draft made we had two informal  meetings um in September and October we   got input from the community including design  professionals experts in the field which then   led to um discussion items with our planning  board and City commission that happened in   November and December in December we had a Land  Development code Amendment presented to to the   planning board as you heard the city clerk um Reed  there's 15 sections that are being updated and   again these are all to improve um the landscape  standards and then tonight is the city commission meeting these are the the primary sections  um we've created an appeal section for the   landscape architect we've mended definitions  the the real key is the um Amendment including   um Native species of at least 50% um staff  is recommending approval the planning board   recommend approval again Cara Culliver our city  landscape architect is available if there are   any questions does anybody have any questions  for Steven no all right thank you Steven I   do have two cards here um so for speakers  the first one I'm going to call is Melissa Lamers good evening mayor Leslie deputy mayor  Tolland and City commissioners' congratulations on   your elections and thank you for this opportunity  to speak I'm Melissa lammer co-conservation chair   for Halifax River Autobahn we've been in continual  operation in Ormond Beach for 102 years but I've   not been with them quite that long uh I have for  years we have been working to educate members of   the community about the vital role Florida native  plants play in the health of our ecosystem and   ultimately in our own health we were Partners  in regrow the loop last year and this where   we met commissioner Tolland through our monthlong  collaboration commissioner Tolland deepened her   understanding of the need for more natives in our  Landscapes and brought forth the request for this   commission to consider a review of your landscape  codes to require more Florida natives plants in a   variety of circumstances at that time I and others  spoke to the commission to lend our support since   then we've worked with commissioner Tolland director  Spraker Cara Culliver your landscape architect and   others to help draft the revised ordinance  the planning board unanimously recommended   approval as you just heard and we hope that know  it comes to your final vote you'll approve as well   um once again thank you to commissioner Tolland  to the city staff and to all who've worked so   hard on the ordinance updates and to all of you  for your community service thank you thank you Melissa uh next Suzanne Shyer hi it's Suzanne Shyer representing dream  green Volusia in 2018 I stood before the planning   board and the city commission with concern of  the car wash that is located next to the Wawa   gas station and one of the items that was  requested at that time was 85% of native   plants for the new development and there was  a consultation with Katie trip to come to that   conclusion and she was an expert then and is  still an expert now so at the time Mrs Tolland  and Mrs Schall were on the planning board and they  both paused when this was said out loud and you   may not remember that but it's true and they both  said out loud looking at each other we should   probably do this with some inquisitive looks so  back then no one knew that Mrs Tolland would be   now commissioner Tolland and Champion native  plant changes and more to the comprehensive   plan so thank you and um I'm here in support of  you voting for this thank you thank you Suzanne   at this time is uh is there a motion here for  approval discussion okay go ahead just I maybe   more of a question Steven um with this  [Music] um I continually get calls about what folks would consider dangerous trees or  problematic trees trees that potentially um   are a hazard to structures particularly homes  and um there was a case in my zone where a tree   was removed because the homeowner felt it was a  danger to their home and they took the tree out   without a permit and once it was reported that the  tree was taken out there were some you know it was   it was difficult for the homeowner to to come to  some sort of agreement with the city I think they   finally did um I recently had another one um you  know tow houses and zero lot lines where they're   taking out specimen trees because the tree poses  a danger to the structure and yet we're requiring   them to put a a tree back in the exact place  where or close by where the tree is coming out   seems somewhat silly to me because you're going to  have the same problem in the future um how can we   address that in this ordinance to at least make  it somewhat easier for our residents to be able   to to remove these hazardous trees without having  to you know plant three trees in its place it just   seems ridiculous to me um if you're want to create  a situation uh you know you're going to repeat   you're going to have a repeat situation you're  going to plant another specimen tree where one   is you know 8 ft from the property or 8 ft from  the building so so I'll take a stab and let Cara   culiver correct me wherever I go wrong so there  is a State statue that allows dangerous trees to   be removed with a letter of an arborist so that  is one path so if the homeowner didn't go under   that path they're required to mitigate for trees  that are removed and that mitigation can be trees   not necessarily same species on the lot so every  lot in the in the city of Ormond beach has a minimum   tree requirement so they can upssize those to  to help mitigate there is some ability to pay   into a tree fund but in essence every lot has  that requirement and there really isn't a way   to to wave that because that is the the character  that makes Ormond Beach and then I let and again I'm   not I'm not obviously I'm not anti- tree sure I  use the example of the tree in my house all the   time it's so 400y old oak 500y old oak that  thing fell and crushed my house and you know   know I probably my wife would love for me to  take it down tomorrow um I like the tree so   it's staying but you know um I just I I don't  want I don't want I don't want government to   become a a a roadblock for our residents when  they have these dangerous conditions um and   they feel like they can't take care of them the  situation with the the the the the one where the   arbor was not contacted I think that's correct  however and we need to let our residents know   because there I think there's a difference between  an arborist and a tree surgeon absolutely because   he was informed by the tree surgeon it was a  dangerous tree and he went on that person's advice   so maybe we need a little bit more education  on that as well because I think if you know   the average resident if a tree surgeon tells him  it's a dangerous tree they probably don't care   what an arbor says if the tree surgeon says it's  a dangerous tree they're want to determine it's   a dangerous tree so absolutely anything else Cara Culliver City Landscape architect if there's a tree that's um   threatening health safety and Welfare then we have  a mechanism or a code that says that we can take   the tree down immediately um but you know uh uh  myself or the arborist you know you will go out and   assess the tree and then if it needs to be taken  down if if it is a health safety welfare issue   then we will let them take the tree down okay  say one that poses imminent danger such as say   a healthy tree say the tree is healthy but you  could obviously tell if the tree fell it would   destroy or damage which significantly damaged  the property damaged the house um we've all seen   perfectly healthy trees come down in a hurricane  and if people want to take proactive measures to   protect their property if the tree can be deemed  by the city or whomever to be close enough to the   house uh or structure that is going to damage I  think you know and then I guess the other question   becomes do we require those folks to replace  trees for the ones being removed in that case   for a dangerous tree I mean a lot of the trees  the the specimen trees the old age trees people   don't maintain them they don't take the dead wood  out of the trees there a lot of dead Limbs and and   wood you know if that was maintained usually when  storms that falls out and then people you know   they panic and they think something's wrong with  the tree but yeah I'm more concerned about the   trees that uproot what's that I'm more about more  concerned about trees that like they they uproot   when the whole tree comes down there's you know  that's a little bit probably Beyond maintenance   m i mean it's you know this the tree will show  signs of it's declining disease you know sometimes   in heavy storms or hurricane conditions yeah it  topples I mean um yeah but um it's I don't um   sorry I lost my train of thought but um you know  if a tree if a tree is close to a structure you   know you can certainly call you know myself or  the arborist will come out and look at it it's   a healthy tree then we always require an arborist  record so if the arborist  record says you know the trees   has has to be a valid reason you know but so  we that's why we always get an arborist  record   on these old age trees specimen trees so if it's  a valid reason and the arborist  record says yes this   trees structurally uh declining it's it's it's a  hazard to the home then we allow the tree to come   down and depending you know if sometimes there is  mitigation required and sometimes there isn't we   have the mitigation specimen tree mitigation  form that determines um you know know if if   we need to put mitigation back and our code we  give credit for specimen Tree saved and then so   if you remove too many specimen trees then you're  saving you're going to have to mitigate so it's   kind of on a property by property basis thank  you okay any other questions commissioner Briley   commissioner Sargent I'll I'll make a a motion move  approval so have pushed for a while   or we have looked for for a while um and I just  wanted to make a couple comments about it um I'm   grateful for all the efforts taken to update our  landscape codes um thankful for you all commission   that you thought it was worthy to update to  make our community more resilient sustainable   and just more environmentally friendly I want  to thank staff particularly Steven spraker and   Cara culiver and Laura Etta for taking the  time to research our neighboring community   and ordinances and best practices there was a  wealth of knowledge in this planning department   and and Cara went over and up and above and beyond  doing all that research and I really appreciate   that um I'm thankful to the Core group of Resident  Advocates that helped me embrace the importance of   native plants in our landscape and how we become  more sustainable for future Generations I'm   hesitant to name names but be because I would not  want to to forget someone but the following come   to mind immediately and I believe they deserve  recognition Melissa Lamers Leslie Nixon in the   Paul Paul Society Alan Burton Nancy galdo Pam noi  Julie cypes and Suzanne shriber thank you so much   for educating me and giving me the um knowledge  to to push this initiative and thank you for the   staff for being so receptive for it um and I'm  also thankful for the um Zev Cohen and all the   other stakeholders that provided information Jake  stair is out in the audience now that provided all   the information for um at our interested parties  meetings they were very enlightening and and I'm   very appreciative of that and so together an  updated document was created and I appreciate   it and I want to say thank you thank you deputy  mayor uh commissioner Sargent thank you Mr Mayor   um commissioner Briley I understand where you're  coming from and I get it but we do have mechanisms   in place with our ordinances I think maybe what  we need to focus on is public awareness so that   our public does understand what we have but I I  don't think we need to change anything cuz what   scares me about changing it as soon as we open it  up we're going to have more disease trees than we   know about more hazardous trees and before you  know it everyone's just going to be cutting them   down to cut them down and I just don't want to  open up that flood gate I think we need to keep   keep it where it is if anything do more public  awareness whether we get something out in the   water bills more social media maybe having the um  you know any tree company that does business in   the city of Ormond maybe they need to be advised um  maybe we send them a certified letter so that we   know that they got it um something maybe a little  bit more but I don't think we need to change our   ordinances or anything I just think we need to do  more uh public awareness um Deputy Mayor is there   anything we need to change in it cuz this is your  if you're good with it good with it cuz I read it   and I just I just know native plants Tru truth be  told I I kept asking Steven can you just send me   like what we had and where we're at can you keep  it simple and then you get this stuff you know   all of this stuff and I was like okay I I got it I  went to all the meetings they unless they pull the   fast one which I'm sure they didn't everything is  just the way it needs to be you know can we always   be better of course can be more green obviously  but this is just absolutely amazing and you guys   were great to allow this project to move forward  and those guys were just amazing doing the work   Cara especially I know I mean we literally looked  at every neighboring City where they were at and   we saw where our deficiencies were and where  we can be better and so I'm appreciative of   it and maybe in 5 years if we want to look at it  again to make it even better great but right now   I am thrilled so thank you well then I Echo your  comments uh thanking staff thanking everyone that   was involved to that was quite the ordinance to  read um so with that I'm I'm good with it thank   you Mr Mayor before I call the vote I just want  to say uh you know that that presentation that   time you did was excellent I remember that um with  the native plant and all that stuff so uh um and I   understand your frustration too uh commissioner  Briley but you know um I have to agree with   commissioner Sargent on this one what just you know  the ordinances you know changing them could be   a little problematic in a lot of ways um but I'm  happy to see this it was a long you know ordinance   uh it's probably longest ordinance I've read  um but uh other than that though uh let's let's   call the vote and move on so call the REMOVAL AND TERMINATION OF DEVELOPMENT ENTITLEMENTS PERTAINING TO THE SAID PARCELS, INCLUDING THE RIGHT TO EXTEND HUNTER’S RIDGE BOULEVARD WITHIN THE SAID PARCELS; AUTHORIZING THE EXECUTION OF ALL there's actually three   related um ordinances on the agenda and staff's  going to present all three um the items would need   to be voted on separately by the city commission  um so the three items are the Fifth Amendment to   the Hunters Ridge Development of regional impact  the ordinance that was just read a zoning map   Amendment and then the last one is the issuance  of the development order before getting into the   actual items it's important to understand the  parcel the parcel is located um if you're going   left of the screen there's Shadow Crossings  Boulevard to um the south of the project is   West Granada Boulevard to the east is a Florida  Power and Light easement and then to the north   is the existing Hunter Ridge the first two Parcels  highlighted are owned by a uh trust it is part of   the Hunters Ridge Dev Regional impact and it has  existing entitlements for 50 multif family units the next two Parcels are Parcels three and four  these are owned by a church um the church has   indicated that they would like to keep parcel  four for their development and allow a contract   purchaser to pursue residential development on  partials one two and three the next area is an   FPL easement shown on the far right of the screen  that fpnl easement extends to the north and to the   south of the property the next two um are are  area six and seven those are Florida Department   of Transportation Retention Ponds not part of the  subject property but next to it and important the   next area is Old Tomoka Road that road bisects the  the property it goes from West Granada Boulevard   um and then further goes east to the property to  West Granada by Breakaway trails that is a Volusia   county roadway it's proposed to be vacated as  part of this application process that would be   a separate process with Volusia County and then the  last area is the Little Tomoka River which is on   the Northern third of the site it extends from  West Granada Boulevard further east alone the   property so the first ordinance is the Fifth  Amendment to the Hunter Ridge Development of   regional impact these two Parcels are part of  Hunter's Ridge the goal of development is to   take them out of Hunter's Ridge include them into  the little Tomoka subdivision in order to do that   they need to be removed from the Hunter Ridge  and there's a 3046 Acres a second action is   the removal of the extension of Hunters Ridge  Boulevard where that road would go there are   substantial wetlands and the little Tomoka River so  there is um desire not to construct that extension   additionally there is no roadway to connect that  extension to West Granada Boulevard so the roadway   doesn't exist there the last item in the in the  Fifth Amendment is to remove the 50 multif family   units allowed in the development order of Hunters  Ridge whatever is approved through the issuance of   the development order would be of what these two  properties were allowed the planning board did   review this item with a little Tomoka subdivision  and recommended approval the second item is a   zoning map amendment in order to develop land  in the Suburban residential Zoning District you   have to go through a plan residential development  so this is a rezoning from Suburban residential   to plan residential development this is this is a  land use map of the property the northern portion   which includes the Little Tomoka River and the  wetlands are zoned open space conservation the   areas that that are now existing in Hunters ridge  as are proposed to be removed are medium density   residential that land use typically allows 5  to 12 units per acre and the parcels owned by   the church are are land use Suburban low density  residential just over 17 Acres that requires a   holding capacity to determine the the the amount  of residential development that can be done the   planing board recommended approval again 4 to2 of  the little Tomoka subdivision and the last item   is the issuance of the development order this is  where you see what the applicant is proposing the   subdivision is a three-step process the first step  is what you have before you tonight it's a plan   residential development this is a zoning document  so it's going to have items such as the Lots lot   sizes landscape offers and non-residential uses  open space recreational architectural standards   it's not going to have the detailed construction  drawings it's not going to have a uh storm water   plan not going to have utility plans if the  zoning document is approved that would come   next this process starts with our site plan  review committee administrative staff there's   a neighborhood meeting that's required that  happened in October the planning Board review   happen in December and then the commission is item  is before you tonight for Action if the zoning   document is approved they will go to a preliminary  plat again construction drawings where you it'll   come back for a public hearing starts with City  staff goes to planning board and then back to the   city city commission if that preliminary plat  is approved it will come back again before the   planning board and City commission as a final  plot those are the subdivision legal documents   that subdivides land so that is the process  the application is um before you on the screen   the area in green is shown as natural preservation  the northern portion which includes the Little   Tomoka River and the wetlands are to be preserved  the portion of the FPL easement on the property   is to remain in Natural Area and then there is  a green belt buffer along West Granada which   the applicant has exceeded the areas shown in pink  are the 31 residential lots there are three storm   water pollins proposed as part of development and  then to the to the left of the screen there is a   house of worship that is proposed used the house  of worship is 3,218 Ft with a 10,000 ft amenity   bu building the goal of the application is to  construct the common area improvements such as the   access um together and then each property would be  developed there would be a buffer wall along the   residential units along Granada Boulevard internal  sidewalks on both sides of the residential areas   as part of the application process the application  was required to do an environmental assessment   report reviewing the Little Tomoka River and the  associated Wetlands there are for 15.49 Acres of   wetlands on the property there's an additional  five acres of wetland buffers that are required   to buffer that Wetland the project proposes 33  Acres of impact at the entrance and then at the   storm water Pond next to the FPL easement none  of the wetlands along the little Tomoka River   are being impacted this was in your packet as  part of the site plan from Zev Cohen associate   it um it's key to note that as part of the  development standards the project has committed   to a higher standard of storm water so they're  using the 100-year stor storm versus the 25-year   storm when they get to the construction documents  again this is a zoning document it's not going to   have those items the adequate U capacity of um to  serve from some Volusia County Schools was included in   the packet there was a traffic meor memorandum  prepared the project itself did not generate   enough trips to Warrant a traffic study um what  we've heard from the neighborhood meetings are   concerns regarding traffic specifically at  Shadow Crossings Boulevard and West Granada   Boulevard there is a strong desire for a traffic  light the Department of Transportation has looked   at that in 2019 and 2021 at that time it did  not war it didn't meet the warrants in order   to allow a traffic signal these project T trips  are going to go right in right out so they will   go to that intersection and they will call cause  additional traffic another item that we heard   through the neighborhood meeting and planning  board was flooding and storm water it happened   um you know there are pictures that were in the  neighborhood meeting portion of the staff report   and there were additional correspondence that was  provided as far your packet so that definitely is   a concern again a zoning document doesn't have the  final storm water plans but that is part of the   overall process the planning board did recommend  approval with a 4-2 vote and the app an is here   to address the commission staff is available if  there are any questions uh does the commission   have questions at this time oh commissioner  Deaton thank you um I have a slew of questions   for you right I attended both the planning board  meeting the neighborhood meeting and I sat back   and listened um one of the neighbors asked  multiple times regarding a dam that I guess   a resident placed in the creek has that been  reviewed um at the planning board there was an   environmental cons consultant from the applicant  they walked the ditch and they found no Dam they   thought the dam was caused by natural occurrence  they didn't believe and I don't want to speak for   the environmental consultant at the plane board he  thought that that was a natural occurrence he want   he has walked it didn't find any observations of  of the of the dam okay thank you now we all know   there's there's a lot of flooding there we know  that during Hurricane Milton there was excessive   flooding and um you know there was great impact  on the FPL easement regarding the flooding many   people including myself did not have power for  multiple days because that was flooded um when was   the last time the creek was cleared or of debris  I don't have that information mam okay is there a   way we can get information regarding that because  I know that's probably going to contribute to the   flooding and if there's building they going to  be contents going into the creek is my concern   we can work to get to that information I don't  have that information for you tonight as the   zoning document there there are no Construction  level details in the packet okay all right thank   you commissioner Deaton um oh commissioner Briley  thank you sir um and maybe this and and you can   tell me Steven if this is I mean we maybe can  talk about this after the the applicant has has   spoken um I know that looking at this property and  looking at the the proposed site plan if you will   majority of this property at least a good portion  of this property appears to be in flood zone AE um   which to me causes a little bit of concern because  even though you have a lot of this property that's   maybe considered Upland and possibly in zone  X zone a is just almost right on top of it so   you do have a lot of wet property around what we  be buil built upon um I know that they're saying   in the staff report that the 10,000 square ft  amenity building I guess for the church would be   considered recreational area I'm not so Keen about  a subdivision getting credit for a recreation area   that they don't own um the church the church could  say you know the the the the site's not available   at certain times for recreation and I think that's  not what the intent was when we put that into the   code that subdivisions had to offer recreational  facilities for its residents uh I don't   think we saw you know we never anticipated any  restrictions except for say maybe daylight hours um when this was approved in 1991 as far  as the dri and of course it was approved   for what I think what potentially  51 medium density residential units I know that this is a Dri and I know that dris go  extend for a long period of time I don't think   that type of use would be compatible today in  that area and of course I know that's not the   what they're proposing um but I guess another  question I would have is with the 1991 dri was   it ever anticipated that a house of worship  would be approved on this type of property I   know sometimes you can put houses of worship  and residentially own areas but I don't know   if it was ever anticipated whenever the dri was  approved in 1991 right so the house of worship   actually is not in the dri property it it's on  the it's on the property south of Old Tomoka Road   okay so it's important to remember areas one and  two on the map have rights of 50 multif family   units today they can come in with a site plan  and and they they go to construction there's   no public hearing there's no platting so so  areas one and two have that right areas three   and four have separate ability to construct a  house of worship is a special exception in the   SR so even without a resoning they have the  right to go through that special exception   and then the the Suburban low density  residential on area three does have the   right either one unit per acre by right or  to go through this plan development process   so each of those Parcels four Parcels have  separate entitlements that exist today okay um I know during I guess one of the planning board  meetings or during the planning board meeting um Mrs   Mary and Connors spoke to this and she had quite  a few issues and and I always put a lot of faith   and weight into what Mrs Connor said because she  was the assistant County Manager Volusia County and   also their for former public works director and  Maryann knows what she's talking about about when   she talks about a lot of things and and a lot of  her issues or some of her issues uh related to   Traffic and you know I know that you know we were  provided this this evening from I guess it was a   resident um I'm not sure I think probably for 31  homes on Granada Boulevard you probably have enough   stacking on that left turn lane for u-turns my  concern would be during or after church services   um I don't know if there's enough stacking  that would anticipate that type of use okay   um I do see that someone has provided a list  of 14 crashes over 10 years um and I noticed   that about half these crashes were single car  incidents so a traffic signal wouldn't help   typically a single car crash and not knowing too  what these crashes are I don't know if these are   even correctable crashes if they're right angle  crashes um typically those are the only ones   that could be What FDOT considers a correctable  crash and typically to warrant a signal they   require typically about five a year so um while I  appreciate this information it doesn't really tell   me much about it just tells me there's been about  14 crashes in 10 years at the intersection so but   my concern would be um the traffic impact that a  house of worship um would create out there and of   course too I did see in the staff report that it  doesn't say I guess there's there's no anticipated   school at this time but that doesn't mean that one  couldn't be anticipated down the road especially   with the the uh amenities or the the the the  building for amenities so as a result of the   planning board meeting and that comment there is  a uh restriction under the special conditions in   the exhibit that does not allow a a child care or  private school I saw that but you know unless we   put it unless we make a condition you know or  we make it a restriction right I've I've I've   seen I've seen these things happen before  you know prise one thing and 10 years down   the road you get something else right they  would have to come back through the public   hearing process in order to amend it absolutely  thank you Mr Mayor okay uh any other questions   from the commission for Mr spraker okay uh does  the applicate want to speak on the item thank you thank good evening uh Mr Mayor Madam deputy  mayor uh members of the commission for the record   Mark wats with the law firm of Cobb Cole 231  North Woodland Boulevard to land I appreciate   the opportunity to um be here this evening and  uh the presentation that staff made as always   very thorough and appreciate your questions as  well I'll try and make sure I touch on them as   we go through um as Steven indicated in his in  his report this is a a combination of parcels   that have a variety of different existing uses  what we're proposing to do is essentially reduce   the maximum potential density from a residential  standpoint um add a use that's already a special   exception use under the existing zoning and  basically put in some other standards that   really exceed what your current standards are in  the Land Development regulations so um that's my   quick overview let me go through Point by Point  Stephen covered a lot of this so I'll I'll try and   make that fairly quick if I can learn how to drive  your new machine here do I have to point in a   certain direction or okay I got it it it it moved  so um my map's not as good as Stevens's but this   kind of gives you the breakdown between the medium  density residential the open space conservation   and the Suburban low density residential those are  your existing land uses that are already on the   property um from a zoning standpoint you've got  Suburban residential again that covers both areas   north of Tomoka u u old Tomoka road that are also  covered by the dri development order and the area   that's south of of Old Tomoka Road that's under  the Suburban residential uh zoning classification   so if you think about this from the standpoint  of what's the what's the most you can do given   the existing collection of Rights and if you look  just at your your land uses there again you don't   hardly ever see a project where you get to the  maximum on your land uses but the maximum number   of units that you could put on given the the three  different land uses is about 170 units which I   think knowing the constraints that the property  has would be a completely ridiculous result on   this property unless you're building some kind  of highrises that would be completely out of   character with the area um realistically you've  got 50 multi multifam units that are permitted on   the portion north of Old Tomoka Road and the the  Suburban residential as it sits right now um with   the acreage that's there you've got roughly 17 or  so uh residential units so you're now at about 67   residential units plus you've got the potential  for the house of worship as a special exception   if you look at the special exception requirements  that are in your code um it's very straightforward   to demonstrate compliance with those and so you  know as a lot of you are aware when you're dealing   with a special exception as long as you show  that you meet those particular conditions in   your code you're entitled to that use and that  approval so rather than you know looking at 170   which again is a completely ridiculous number for  this particular property given its characteristics   or looking at that 67 or or so that you get  units with the existing uh zoning and the uh   portion that's in the Hunters Ridge dri um we're  proposing gated uh subdivision comprised of 60 or   I'm sorry 31 Lots um and the house of worship  um now you asked about the the question about   the the community facilities we actually have  some that are in partnership with the church by   agreement so there's there will be a dedicated  recorded Covenant um when the property closes   that U permits access to that Community facility  but there is also a small pocket park within the   subdivision itself that backs up to the the Tomoka  the old Little Tomoka River par it is okay it is   so um let me get into some of those specifics so  again this is just kind of the breakdown of the   overall parcel you see you know Green is the kind  the river that's your open space conservation land   use the gray area is medium density residential  and then you've got your sub Suburban low density   residential south of Old Tomoka Road um what  we've essentially done is is make the development   footprint very Compact and and cluster that  density and intensity while at the same time not   going down to smaller Lots if you remember like  the ilv alagio project that's a little bit further   to the east it's got a lot of um patio homes  and kind of smaller Footprints this is not being   proposed as smaller Lots these lots are minimum  of 80 ft wide they're consistent with what you   see in Hunter's Ridge um home sizes would be 2500  to 3,000 square feet you know kind of as that that   you average um but I think the one of the really  key things here and given the comments about   things like um the flooding you know issues and  preserving more of the property as open space for   that storm water to either have a place to go or  to perk down 31 or 33.1% of the overall property   is what's being impacted and developed the balance  is going into open space or conservation so here's   a I think a good example of what you do when you  look at the property and sort of listen to what   it's saying as far as what's what's possible there  170 completely ridiculous that's you know why   you've got those other regulations that then come  in and kind of help tailor you know what you're   doing with the piece of property to what that  property can support um the um I already covered   most of these so um the the dog park I don't think  you got a laser on here let's see can't really see   it up there anyway so as you come in um off of  Granada and you take the right into the Gated   area for the neighborhood if you go directly  on that North Road there's a there's a pocket   park right in there on that kind of North East  intersection of that Entry Road um actually one of   the things that that came out of the neighborhood  meeting which I thought was a very good comment we   actually had that road going a little bit further  north up closer to the river in the plan that was   presented I think I've got a slide that shows  it here in a minute several of the residents   said you know give us a little bit more space um  give the river a little bit more space pull that   development footprint back to the South um so we  did we actually eliminated a culdesac that was up   there we reconfigured how the Lots were arranged  up there worked that park into that area and I   think that was a good result of the of the you  know information we received in talking with the neighborhood uh no school use is planned as  part of the house of worship at the planning   board meeting I actually um talked to Miss  Connor's prior to the planning board meeting   and committed to her that we would be on the  record at the planning board stipulate to adding   that condition her principal concern was when you  have a a house of worship that's one thing most of   your peak hour trips and everything coming out of  a house of worship are at off peak times for other   things Sunday mornings you know the rest of the  roads tend to be fairly you know fairly low volume   Wednesday evenings when you traditionally have  you know church services things of that nature   here um you know Miss Conor's concern was you  a lot of times see kind of that creep you you   see a church come in but then you have a daycare  and then you have a a preschool or a school that   gets established and so she wanted to make sure  that you know that we were addressing that and so   we stipulated and added the condition with your  staff after planning board to the develop order   um that basically says that use is not permitted  unless and until there's a signalized intersection   and so if we wanted to come back and and and add  that use we would have to come back through this   whole process to amend this development order and  remove that condition and so you would have this   basically the say on whether or not we were able  to do that once the signal were installed once the   Signal's installed then that then you could you  could you could add that's right um but one of   the other things that you've got here is do is  the regulating agency here so we do anticipate   we're going to be installing a taper or a turn  lane coming in to pro to accommodate the turns   into the subdivision and any other improvements  that do would require for the exiting movements   coming out of the subdivision or the church um and  in the event there's any extension of that turn   lane for the U-turn movements at the signal or  at the intersection where hopefully one day there   will be a signal um then we would be responsible  for um installing those improvements as well but   that's all going to be basically mandated by the  do permitting process so with regard to flooding   one of the principal things that we've tried to do  is is stay out of the floodway um see if that last   one showed it so if you if you look at kind of the  top portion where you can see the course of the   river you know kind of where the little Tomoka um  flow is it's up on that very northern part you can   see kind of the line that goes along where where  it kind of defines that channel up against the   North Boundary that's also the regulate the flow way  for the the flow coming out of the the U coming   through the little Tomoka River we have our our  principal goal has been to keep everything backing   away from that preserve that floodway now in  addition um speaking to the city and the and the   St current St John's Water Management uh District  standards you know the current development you   know standard is the 25 year storm event that's what  that's what you require by code that's what the   the district requires um given the concerns we've  heard given the concerns coming into this that we   that you know staff raised wanting to make sure  that we were being extra cautious um we've actually   designed this for the 100-year event um so we've  we've designed to that additional capacity to be   retained on site um treated on site before it's  discharged into into the the little Tomoka which   is where it all currently flows currently um oh  I had a slide that showed it better the green   area is the as the flow flow way for the little  Tomoka so um again this is really U this shows you   that culdesac that's circled up there that's the  revision uh that we made after after uh the the   neighborhood meeting and essentially what we were  able to do with that shift is we we added about   75 ft of separation from where the development  will occur here and the existing neighborhood to   um Hunters Ridge to the north so it increased our  total separation really it's almost 400 feet from   the back of one of the lots that you see here in  the pink area um to to the nearest home that's in   Hunters Ridge um 325 IS about what it was when we  were um you know when we had that culdesac there and   that lot that was further to the north um let me  just make sure I've touched on everything I wanted to okay so in essence um what we're seeking is  approval of that mixed use PUD uh or PD that   will you know add a use that's currently a special  exception as a permitted use with the restrictions   that have been discussed um take the existing  permitted density um you know the things that   we could go and get a plat approval for now or  a site plan approved for now and reduce that by   about half um and do it in a gated subdivision  with larger lots and larger homes so we've got   our team we've got a group from Zev Cohen here uh  I'm sorry Zev Cohen's here um you know if you have   any questions with regard to the engineering um Vlassiter  transportation's here to respond to any questions   with regard to transportation that that I can't  handle so with that we'll pause here and ask for   any questions thank you um mayor yeah just one  question and and I apologize I'm been looking   through the the I know you're with with the single  family homes you're looking at obviously you said   larger Lots yes yes size those lots minimum is  80 ft um we were looking at 80 to 100 feet um   we've we've got some that are larger than 80 but  when we were able to kind of shrink things down   and get rid of that culdesac we set 80 as the  minimum for the for the whole Development Area   um just to give us the flexibility when we get  into plating but 80 80 ft would be the minimum and   top my I can't remember the square footage I think  it was 9500 or 9,800 Square ft for the lot sizes   so thank you commissioner Briley oh commissioner  Sargent thank you Mr Mayor um how many parking   spots is the house of worship going to have a lot  of that will ultimately um be determined by the   final design uh again we're going to have to go  through the site the the house of worship as as   Steven indicated will go through a separate site  plan process that will come back through you know   this process to get approved um right now I think  the estimate is about 50 uh total spaces um that's   would be to meet your code um some of those  with a house of worship can be on grass areas   overflow parking and things of that nature um it's  a fairly small congregation that currently owns it   um that doesn't mean it couldn't be a different  congregation down the road know it's a house of   worship it's not specific to any particular um  you know when you approve that use you're not   approving you know this Baptist Church or that  Catholic church it's just house of worship can   be there so what are the services going to be are  they having one service on Sundays are they having   Services throughout the week I'm just curious  on how this is going to flow with the traffic   that's it's very concerning out there yeah  so right now again the the church Sanctuary is   about 3,200 square F feet as planned um I think  about a hundred seats is what's anticipated   in there um their primary and and Mr Tanis Ali  was at the planning board meeting I don't know   if he's here this even I don't see him here  this evening but um it's his um church that   currently owns the property um based on what they  said at the planning board um their largest use   of the property is probably four or five times  a year around certain festivals um under the the   particular you know calendar year for that that  church what happens in 10 years when 40 gets wide   into six Lanes how's that going to affect this  project so right now we are staying outside of   the Right-of-Way so if it comes in and gets widened  then we would have to work with do to accommodate   that widening okay another concern I have is the  school concurrency and I don't know how Volusia County   Schools does this it's it's every time I look at  these it's it's amazing to me and I see that it's   only going to create eight more students but yet  we have Pathways Elementary which is at 147% the   middle school Henson is at 120% capacity and then  Mainland looks like it's at 119% but yet they're   still going to approve more to add more students  I mean it's just I know that's not your fault   it's the school board but I just look at these  numbers and it it I'm amazed how they the school   board can approve these well I I tend to agree  with you a lot of times it's hard to to know how   they come up with those numbers what we have to  do is follow the process that's there both with   the city and with the district now the important  thing to remember about that process though is   that your requirement is that we don't look at it  just now um you know if we we've looked at it now   and they've said we we have capacity we are not  vested for that capacity um if you approve this   tonight we have to come back when we go through  the plat process and we have to again Ask the   school district at that point in time do you still  have capacity and at that time it's do you have   capacity and will you reserve it for the number  of units that are being proposed sure um and so   at that point in time if they don't have capacity  uh then they can say no And they're they're fully   within their rights to say no at that point in  time and then we would have to work with them   in some some type of mitigation strategy well I  personally think we need more House of Worships   in this Community um more the better but that's  a different can we bring up the flood map I think   it's on Page in your 1683 in our in our packet  I don't know if that's I yield I yield the uh screen uh which one is this then question I'm  sorry 1468 if you want to go ahead and ask your   questions why yeah I'm fine mine will be related  to the flood as well and while he's looking maybe   you can answer the question yes you mentioned that  this property you know when we approve things that   they're supposed to retain their own water correct  does that mean none of the water will go into that   little Tomoka river no um and I can bring get Luke  up here as well I have a lot of questions about   all of that so I'll let commissioner Sargent  finish and then I'll ask mine so I I I can give   you the layman answer while he's looking for that  page um and then ask luke to respond so when you   any piece of property both receives water now and  discharges water so when when when there's a rain   event water flows onto any piece of property  and then it flows off of that property as long   as you're not in a closed Basin um this piece of  property currently has a discharge into the Little   Tomoka River when we talk about designing  to a particular storm event what we have   to demonstrate is that we're not increasing the  rate that that water leaves the property um or the   velocity with which that water the the the speed  with with which it leaves the property so when   you're looking at most designs under your current  regulations you're patterning you know the you're   designing that system and answering that question  with regard to a specific volume that's you know a   25-year storm event what we've done with regard to  this project and what we're proposing to add as a   condition to the development order is instead of  meeting that 25-year volume we're increasing the   volume that we would retain on site to to model  the 100-year storm event so Luke good evening Mr   Mayor uh commission members Luke kulich with Zev Cohen  and Associates um 300 Interchange Boulevard or   me Florida I'm the project manager with with  the Zev and team and in terms of storm water   um there are two key elements um miss Tolland that  we work towards one being the water quality and   then the other one being the quantity and uh we  will be going through permitting with the St John   of Water Management District as well as fdot for  drainage and city of Ormond beach side planning   uh so the the key thing just like Mark mentioned  is instead of the 25y year which is about a 9 and   a half inch storm event uh we will be um you know  modeling the site for a 13 plus inches of runoff   uh through the development and then capturing that  volume in our storm water ponds and making sure   that we do not discharge more than what gets  discharged currently within the pre-existing   conditions and then uh also the volume we  we have to make sure that the total total   volumes get maintained so those are the uh sort  of the key elements that go into our storm water design and uh the other thing to mention also  with stor water's Little Tomoka River being our um   discharge point it's a it's an outstanding Florida  water it comes with additional uh treatment and   quantitative measures requirements uh from the  stor water uh perspective with the St John's River   Water Management District we are also impairing  uh discharging into an impaired water body it's   impaired Tomoka river is impaired for certain  nutrients so we have to hold a lot more strong   water than your traditional strong water ponds  so we're going deputy mayor or well I think uh   commissioner Sargent wanted to ahead go back okay  so if I'm looking at this correctly almost this   entire Project's in flood zone AE is that correct  so the flood zone AE are are the areas that you're   and blue and if you go back to our plan sheet I  believe Mark you had it on there before sheet C6   okay that one there so the dark shaded areas that  you're seeing Mr Sargent are the Zone AE areas   that you know the development is impacting and uh  for for that what we'll uh what we'll be doing is   the owner will engage a flood consultant as part  of our final engineering and design process he   will model this uh this development just to see  how it impacts the adjacent flood flood elevations   and if there are any impacts um you know  compensating storage areas or additional storm   water will be provided I'm just very concerned  um that we're going to bring in a lot of fill   raise this up and then that water I know and I  know y'all do an amazing job with engineering   but water is not going to stay it's going to Flow  Away i' I've seen it I feel like and I know we're   we're basing off the 100e storm and 13 in and  but the last few years we've we've had you know   500 years rainstorms what do we have last year 23  in 24 hours um I feel like we're getting more and   more and I know that there's standards that we  have to go by I understand that but I also look   at what if we seen and it's like we're getting  more and more rainstorms here and I just feel   like when we pave this with the um parking lot  when we put these Lots raised up cuz it's going to   lots of fil that we're going to have potential  flooding issues cuz it's going to flood into the   Wetland area and then it's going to flood into  the neighborhood behind it um I just have some   serious concerns with the flooding issue but I'll  let um Deputy Mayor toen address her Commandments   and then I'll thank you and I agree with you  commissioner Sergeant on some of those issues   so I was going to ask about the flood plane Zone  as well and I was looking at your soil samples   as well the soil samples in that area indicate  that those are more Wetland type um land as well   yes ma'am because we're um mainly building within  the Uplands as as Mark and Mr Spraker mentioned we're   only impacting 33 Acres out of the 14 15 Acres  of wetlands on the side which in my opinion is   a is a great number uh so the soils are a mixture  of there are some Organics uh but um it's nothing   that you see that within a wetland area so the qu  the other question I have and I talked to a few   residents and I I have been told and I have not  personally um seen it in writing but I have you   gotten approval from St John's Water Management  I've heard that they have some violations on that   little Tomoka river right now from the um Hunters  Ridge Development and that coincides and will be   shared with this new development are you aware  that there's some violations already we just made   our St John submittal um I want to say last week  and for the purposes of uh meeting with staff in   the field um you know just making sure that all  the Wetland lines that we've delineated that they   agree on we want to get through that early on but  we have not gotten any feedback from St John's yet   the project is still under review okay well from  the standpoint of of violations this there's no   active uh Water Management District permit on this  particular project yet um so there wouldn't be any   violation here I'm not aware of any I mean  certainly there there may be some that exist   out there we did get the question at planning  board about you know cleaning out the Little   Tomoka River and who's who who's doing that and  I think that's probably one of the most popular   questions that I hear um at County Council or  at various City commission meetings that I get   to go to on a on a weekly basis who's doing what  on which canal or water body um little Tomoka is   actually a it's a creek it's a natural River we  typically don't have somebody that's cleaning   those out on a regular basis one of the things  because of what we've heard at some of the at   the neighborhood meeting because we went in search  of the dam you know that that one of the neighbors   was very concerned about several of them raised  that that particular issue um one of the things   that we're proposing as we go forward with the  Water Management District permit process is that   we propose some cleanout um of that receiving area  you know as we do the work on the overall project   because in the absence of anybody else doing it it  does give us an opportunity while we're permitting   something to do some of that work um and have  that at least be clear one of the things I think   with regard to this site with you know you see  where the ponds are located kind of to the to the   Eastern portion of the property which is also the  direction of the flow for the Little Tomoka River   so you know we're discharging at that point where  it kind of goes away from the adjacent homes in   the Hunters Ridge area as well and into the flow  that that goes further to the east would there   be any conation from the developer to eliminate  that back row of housing to allow that to be the   flood area that it's naturally is right now well  actually that area if you go back if you can so   if you look at what's shown on this map those  areas aren't in the flood plane currently um   so none of the areas where those that row of lots  that you're speaking to um are in the flood plain   the only areas that are in the actual flood plane  you see where the dark gray shaded pieces are here   yeah one of them is over in our where the storm  water Pond is in the northeast corner and then   you've got that one little area up by where the  entry road comes in those are the only existing   flood areas there the regulatory floodway um  that exists for the The Little Tomoka River   is actually all of that area to the north that  we're putting into the conservation so if you look at let me see page 1278 so if you go back to  this image um where you actually have that that   floodway for the little that's associated with the  little Tomoka River it really more corresponds with   that green shaded area um on this this particular  map and so we one of the things if you think about   the what the Hunters Ridge dri Development  order currently allows that area you can see   where little Tomoka river goes through or the  the old Tomoka road Right-of-Way kind of goes through   there now um the area between Old Tomoka Road and  that green area is where you current Curr have   the entitlements for 50 multif family units to be  constructed so we're we're asking you to eliminate   those and let us concentrate on the 31 units that  are south of that area commissioner Tolland if you look   at if for it might help 146 page 1468 that's what  I'm looking for right now 1468 1468 you can see   where the road runs through it and just to the  north of the road there that's still Upland land   there and then behind it is where the AE flood  zone is yes this is picture here so so I think   one of the specific points we've tried to make  with regard to the the layout and the design is   really to concentrate the footprint in that area  that's not AE um in the area that you see here   without a color on your aerial um so where you can  where you can see the area around that that storm   water pond that's the concentration of of where  the development footprint is here may just side   by side yes absolutely now keep in mind one of the  things that you're current zoning so again we're   we're here before you with with current rights  in hand so you have the ability to do 50 you know   multif family units you have the ability to do  let's call it 8 to 10 to well actually I'm sorry   based on the acreage 15 to 17 you know residential  units on the Suburban residential portion um you   could do that and impact the the the flood plane  and provide compensating storage all of those   things are allowed under your current code and  under the current rights that the property has um   we're really asking you to elevate the standard  reduce the density um and put a a much more   specific plan in place for this property because  those things we could we could go into a site plan   application or appli application for tomorrow U  Dey Riley oh May I'm sorry yes I am for now thanks   um I guess the question I had too and and and mark  you help me out with this maybe the the amenities   at the church and I wanted to just this kind of  maybe piggybacks off of commissioner Sargent's   question um it looked like you said roughly 50  parking spots for the church you yes me because   I saw on the staff report about 100 seats for  the church yes um the amenities portion is that   strictly is that exclusively for this subdivision  or would you see where the church might rent that   out to the community or someone else because  my question I guess would become would you   enough parking for the amenity Center and and say  say you had something going on at the same time a   church service was happening so so you you have  a standard for that kind type of community space   um under your code I think it's one space for  every 200 square feet within that common area   and we've got about a 10 there's about a 10,000  foot building that would be that community space   building um there's a number of ways that  could be approached I don't you know there   there may be and again this will ultimately be  by written agreement that's recorded as part of   the subdivision documents that come through so um  you know we typically have to record covenants and   restrictions that you see as part of the plat when  it comes forward um one of the things to speak to   your particular concern um it's possible that you  could have the church rent out a portion of that   building for something and there could be let's  say there's a multi-purpose room that's 8,000   squ ft of that 10,000 square F feet and that  there's you know kind of a smaller Club room   or lounge that's 2,000 foot um you know there  may be you know ways to address through those   restrictions that the 2,000's always available  for the for community members and the 10,000 May   or the 8,000 could be rented out as well by the  church things of that nature I would hope that   the residents would walk um over and not use  any parking but I think the the key point is   our focus is also to make sure to guarantee that  the residents have that that Community amenity as   well where they've got a lounge or something of  that nature that they can use in partnership with   the church because otherwise you have buildings  that are sitting empty and it it really makes a   lot of sense to duplicate you know kind of stack  those uses so that so that you're not building   more space you know just for the sake of having  more sh I guess what my question was if they did   you know if they did run it out to the community  and you did have people who drove out there yes   and just say it happened to coincide with a church  service yes is there enough parking I think that's   I mean we're following your code on parking so  I think that's possible with any any house of   worship so um you know I think that's calculated  into the numbers you require for parking that's   I know with 50 parking spots for the church y  and than 100 seats in the church then 10,000 ft   amenities if there's enough maret Mr Briley so we've  calculated based on the current Land Development   code the number of spaces required for the church  use for the 100 seats which is 34 and then for the   community center it's one space per 200 square fet  which is 50 parking spaces currently what you're   seeing out there's 84 total spaces that meets  the L development code theres my question thank you um any other questions cause I have three  cards here okay uh Sargent one more then   I'd like to hear from the residents can  we bring up on our packet uh page 1465 please thank you right in the center is is the  Tomoka I don't want to say River old Tomoka Riv   Old Tomoka River coming down correct coming  across laterally blue coming straight down from   the center page uh blue coming straight down yes  I don't have a point and then it stops but then it   picks up down look and it goes not sure what is  that I don't know Sargent I believe that's the   connection from the DOT's right away from uh Granada  uh there's there are um I believe 3 30in pipes   that are coming through and they get discharged  through our site and then it gets piped under the   old Tomoka Road and ultimately into the little  Tomoka River okay so in our plan on sheet pd4 uh   we show a culvert Crossing where we're proposing  the roadway to access the church site so we will   size those culverts accordingly to the current capacity  needs for that I'm just really concerned about   those residents there but I'll I'll save more  comments until after I hear from the residents   thank you just just to make sure I'm clear are you  talking about going top to the top of the screen   is that the blue line that you're talking about  that kind of curves off to the left yes way I'm   North or South no that's I think that's the  discharge from the from the community into   the uh the low lying area into the Little Tomoka  River so that's a that's another drainage feature   from Hunters Ridge that comes down to the old  little little not touching that we're not imp   and then flows to the east okay thank you thank  you commissioner Sargent oh uh deputy mayor another   question with that yes so in reference to what  you were just saying the there is a culvert   underneath State Road 40 that empties into the  little Tomoka river that empties any discharge   from the south side of State Road 40 so thinking  ahead guys this is Avalon and that's going to be a   lot of impervious materials and that extra water  could possibly go under State Road 40 into the   Little Tomoka River as well is that correct or  no Commissioner Tolland as I mentioned earlier they will be   held to the same standards that we are with  the St John's of Water Management District   and especially with fdot when it comes to the  drainage permit and I understand that we we do   have standards and we have to follow them we also  know that sometimes those standards fail and we've   seen that in the county and we've seen we we're  hearing that from all our residents now and you   know even the county now is is relooking at what  we can do to avoid flooding I'm just potentially   looking down the road I think like you all are  as well maybe our standards need to be altered   a little bit and I'm not faulting you by anything  you are doing exactly what you're supposed to do   I'm just trying to be extra protective at this  point you know we to address it differently yes   ma'am I just want to give you all the comfort  level that again they their design will have   to take in into account the existing flows and  they cannot exceed those so thus ideally what   would be coming from the south development should  be matching the existing condition gotcha thank   you yeah and I think you're right I think you  are going to see that continued evolution of   some of those storm water standards the land uh  Edgewater both have adopted the 100-year storm   event as their base design standard now I think  you're going to see more and more sort of going in   the direction of changing those standards um I I  gave the the example at the planning board meeting   um I was looking at you know three different  subdivisions that were approved by the county   or well I think they were all by the county over  on the west side of the of the county one was   approved in the late mid to late 1980s um Zero  Storm water uh facilities it all drains downhill   into a lake uh the one next to it was approved  in the you know late '90s early 2000s about 60   Acres of Development Area had an acre and a half  storm water Pond um and then the site that we're   working on in the county now it's about 30 Acres  total and we've got 6 and a half acres of storm   water pond so that evolution in the standards  you know it's it's really consuming more and more   of the property because of the need to hold more  water right and that's we've designed that higher   standard here because of that reason okay thank  you uh commissioner do you some questions sorry   um of course I I still do have a lot of concerns  of the flooding as the rest of them do and you   know what we're Ormond Beach I do think that we  should raise our standards we're we're Ormond Beach   um so I I do echo that I do have a question um  is the developer local yes yeah right now the   so um we're working with Howard leftwitz he's  our client sitting here in the um he's been   developing in Volusia county for many years uh  based out of out of Winter Park um but has   done work in Deltona Deland uh Ormond um you  know throughout the years and then the home   builder that we're working with is also  local based out of New Smyrna okay thank you   okay uh I'm going to try to get some uh residents  up here to speak um first i' like to call uh Mike Strauss Mr Mayor Deputy Mayor Commissioners  thank you my name is Mike Strauss I live at five   buckthorne looking Hunters Ridge I have lived  there for 30 years now my property if you're   looking at the Zevco and diagram is directly  across the Little Tomoka River where several other   residents are I'd also ask you um under the itum  F there is a thing called correspondence received   that consists of three pages of information I  provided in multiple u pictures showing what   behind my home and the other residents it looked  like on an average day and what it looked like   with the most recent flood um my biggest concern  which is not showing in the photo that was just up   there minute ago you kept asking about the blue  line that has not been disclosed in my opinion   unless I'm overlooking something when Hunters Ridge  was designed and going forward as it was built to   the north there is I'm going to call it a ditch it  was pulled with a drag line the residual was piled   up on a bank and it runs a straight line that's  what you're seeing in the blue is a ditch that   runoff is not disclosed in this diagram and the  volume of all the water that's going going to be   brought into the little Tomoka and currently is in  addition to that that's flowing in the blue line   on this diagram from what is being considered  the little Tomoka also this line basically on   this diagram that the Cohen industry provided  indicates that it pretty much goes as this   nice little straight line nothing could be further  I provided multiple documents here there to show   that this stream makes multiple right and left  90° turns when the volume of the rain comes down   as it's recently done it does not have the  capacity to make the right and left turns   and thus floods a mass quantity of um Wetlands  Palmetto scrubs and then it then goes out right   where this proposed development is to the East  and to the west or north and south um thus showing   what is occurring in my home as other residents  right in my area there's also a place called Polo   Club um so I'm not so sure that the volume of  water is fully being disclosed to everybody and   I do have also um some photos which I not did not  previously provide of set ditch so in case anyone   questioned that and the question Miss Deaton you  would ask about has anybody ever cleaned up um   this behind this area uh as well as about the  um the dam the dam doesn't necessarily have to   be located on Hunters Ridge property this flows  underneath the power lines it goes through some   other private lands and then ultimately goes  into Breakaway trials right now Hunter Ridge is   in violation of multiple St John's water district  managements how do I know that um I pulled on my   driveway not too long ago and there's a gentleman  in my backyard he is there and he discloses to me   that he is there to give estimates to Hunter  Ridge to clean up all of the waterways in 30   years that have never been cleaned up uh Mr Strauss  can we see those photos for a second you can   we we didn't get a chance to look at them give  them to oh yeah give them to the clerk I'm sorry all right thank you uh thank you sorry I just wanted to look  at the photos here for a second at this time could I call up Art  Long longus I'm sorry legatus yeah hello my name's art legatus I live at  10 meadow Ridge View the photos on record   are actually behind my house the first photo was  from 9/29/22 after Ian uh the second uh photo was   actually just during the rainy season and the  third photo was after um Milton would put three   feet at at my deck the situation that you have is  when you look at the um subject property my house   is located here that last row of houses when  you have these storms they're going to need to   be raised to be out of the flood plane and what's  going to happen is it's going to create additional   flooding because those houses along there many of  them are underwater when we have these events so   as they raise those up also as a matter of policy  which they did not tell you is FEMA does not go   in and update the flood maps until after houses  are built as a matter of policy I was a second   house built on Little Tomoka River I was not in  a flood zone was like 10 years later before they   updated their maps that put me in a flood zone  which put me at AE so to say that they are not   in a flood zone yes they're not in a flood flood  zone yet but that water it's underwater there just   by looking at my photos you can see my house  is there and they're proposing right in there   so that is underwater additionally if you look  at um Hunter Ridge Boulevard under the original   dri that land was was to be preserved on both  sides of Hunters Ridge Boulevard uh additionally   right now at this point you've heard one point  of view right now the association Parcels of land   are being sold off but one of the developers is  Glenn furman who is actually part of Hunters Ridge   13 companies and this project to clarify the  record additionally as the properties get sold   off Hunters Ridge is basically at this point  sold out so we're waiting for the association   to be turned over to the residents the residents  right now have $1.5 million in the bank it's all   residents money I do have Paul sansky who's on the  board who will confirm that and what we're asking   is for time so we could hire our own engineers  to go ahead and give you a different point of view thank you Art okay thank you Mr  Mayor uh commissioner Briley and I don't   like to necessarily engage the public but  there was in those three photos and I'm   just for clarification to just be just for  clarification I'm just curious to see one   of those photos appears there's a large  pipe there with a gate valve at the end   just curious as to what that's for it looks like  someone can open that valve and it drains out into   that little Tomoka river oh oh that is a it's  a lift station are you talking about near the   front of the development it was like it was  in the picture I don't but it looks like it   it doesn't really have a oh oh that it doesn't  terminate that's an irrigation line because some   part part of Hunter Ridge will draw I'm sorry  you need to speak a microphone sir I'm sorry this picture okay this needs to be I'm sorry gentlemen this needs to be in the record  so someone need and speak about that is I guess this is is this something that  that belongs to to Hunter's Ridge yes yes well   just whatever you say you need to speak in the  microphone sir um this is the pond that flows   um South into the little Tomoka the pipe that  you see to my knowledge on the other side of   the road when the capacity of the coverts  gets to its maximum this is an additional   valve that can be turned on when it reaches  a breach and further let the water flow   uh Paul maybe answer the big see that's  on the third Lake on the power yeah okay well yeah I'm lost too all right  thank you next I'll call up uh Ted Rhoades all please entitled to approval we heard  that statement tonight as long as we   meet requirements we're entitled to approval  I went to the planning board last December   and one of the one of the planning board  members uh mentioned that if one has property   rights that there's an implied approval just just  because you own the property you you're entitled   to his zoning approval and I I've never seen  that written in any in anything about property   rights and in anything land SPC speculators do  not have a right to approval the community has   the right to approve whether they get zoning  approval I hope that tonight um that we can   go beyond requirements oh as long as we meet  requirements no I hope we go beyond that and   go to common sense we live in that Community we  know that that intersection is going to be much   more dangerous because we go through there  every day we know it we live there we know   that these properties are going to flood ask ask  the developer if they have m out the high water   mark for the last three hurricanes oh they meet  the requirements I I bet they haven't even done that Mr uh one member which I want to  mention on the on the planning board I   got a lot of respect for this guy uh Doom  Malon Du Malin he's the water expert he   recommended that we not approve it the other  four members I mean this guy's a water expert   they they just vetoed his  advice and voted to approve this anyway it it is my opinion that that planning  board is guilty of Public Safety malpractice and   I'm asking every one of you tonight to use your  common sense and put this project on hold let's   take a timeout and vote your conscience thank  you can by 39 seconds um sure the creek had   never been uh can you speak in the microphone  now yes the creek had I've been there 32 years   the creek had never been uh maintained or cleaned  out at all so behind my house it it's like a bowl   now so the flow is not what it was 30 years ago  and I've been there 32 years thank you thank you   all right um why we oh all right you you come  on okay sorry Mr Mayor I generally yeah in the   past we've had an opportunity to come back up and  and just speak to the comments that are also made   okay that's fine so if that's okay um just just  briefly wanted to address a couple things I think   Mr strauss's comments with regard to the Blue Line  heading north of where the little Tomoka is have   to get my pen out of my hand um that area and it  sounds like the comments that are that are really   directed there are with regard to the maintenance  of Hunter ridges Hunters ridges system their storm   water system some of the improvements that were  put in when that development was constructed it's   not something that our clients have any control  over certainly you know the appropriate mechanism   is an enforcement action by St John's if there  are conditions under their permits or under their   approvals that are not being met um I'd encourage  the city to support that um you know the only you   know I um you know often times we hear about storm  water systems that are constructed and then not   maintained by the HOAs or whoever has control  of them um that enforcement part of the of the   permitting is very important so you know again  that's off of the site that we were talking about   today um you know I'm not sure what the not being  disclosed portion of it was but that that really   is outside of the boundaries of our property we  have no control over many of those areas um with   regard to um Mr Legatus's comments about some  of the the you know the kind of storm water   areas the you raising of lots and the impact  that that can have I want to just remind you   if you go back um and I don't know I can just  use this as the example if you think about the   property that on this picture that's north of Old  Tomoka Road there currently exists the right to   come in and fill those areas that are not in  the Wetland so kind of before you get to the   green you currently have the right under existing  entitlements to fill those areas and put as many   as 50 units in there now that's the current right  and again we would have to meet your standards but   your standards include things like compensating  storage and the ability to come in and put fill   in and you know have a a pond to provide that  additional volume of storm water treatment on   site so it's theoretically possible to come in and  meet your standards and end up with those 50 units   on that North Area I think you'd probably lose  units based on the constraints of the property um   but at least that's the the current entitlement Mr  rhs spoke to entitlements I've not said one time   to you this evening that we're entitled to the  approval that we're asking you to vote on tonight   I think it makes an awful lot more sense than  the things we are entitled to I think what we are   entitled to currently and this is just looking at  you know that bundle of sticks that we talk about   when we talk about property rights what do you  have right now that you have the ability to move   forward with and build and it's that 50 units and  it's that one unit per acre of density on the on   the Suburban residential portion or that house  of worship that's a special exception those are   the things that are entitlements so again if you  look at the the things that the city has already   granted to this property it's 50 units plus the  17 units on that one unit per acre density for   the Suburban residentials here 67 units or so  give or take uh that currently are entitled that   we don't have to ask for any more permission we  just have to show compliance with your engineer   in standards and the house of worship again you  have a process but there's specific standards in   your code and if you demonstrate compliance and  there things like the front of it has to face the   arterial roadway you know you have to have the  proper amount of buffering you have to have the   proper amount of land you know Landscaping the  proper amount of parking if you can demonstrate   those standards are met you're entitled to that  improval this is under your code this is not   based on what we're standing here asking asking  for what we're asking to do is to do something   more responsible with the property to reduce  the density to cut it in half with regard to   the residential density that is currently  entitled on that property and to add that   house of worship as a as a use by R um I think  it makes a lot more sense to leave 60 whatever   the the percentage was 66 point or 66.9% of this  property outside of the development footprint and   leave it in conservation and Wetland preservation  so um I know that there's a lot of discussion now   with regard to water I know that there's a lot of  discussion with regard to the particular property   we really think this makes in the context of that  discussion the plan in front of you makes a whole   lot more sense than what the current rights are  for that property so happy to respond to any of   other questions um commissioner Sargent thank  thank you Mr Mayor um just a couple can we bring   up page uh 1465 again please so this blue line  in the center page yes the way I'm looking at   goes like this yes just goes like this now is that  a covert or a ditch or what what are we looking at   here is that an open ditch that we just saw and  so that drains to this this property and then   it looks like it just does it that it picks up  underneath this property again I think what you   see are two different things so I think you have  the the drag line ditch that was referenced by the   first Speaker coming down through through Hunter  Ridge that's part of their original drainage   system that charges to the Little Tomoka River  the small line you see coming up from the south   is actually a DOT so do also has a drainage  easement that comes across a portion of the   property that drains North also into the Little  Tomoka River so is Hunter's Ridge drain an on to   your client's property yes and they're allowed to  okay because they they have those rights they have   the right to continue discharging as I mentioned  in the very beginning to the extent property you   know accepts water now have to continue accepting  that water as you designed your foot development   and and I do believe in property rights and I do  believe that you know you buy property to develop   it to make money to build a house do whatever but  I also believe in rights of the current property   owners agreed you know I do believe that we have  to be cautious not to put something in whether   it's in our code whether you could do whatever I I  think we all have to vote on our conscience too to   know that if we approve something and then these  residents out here get flooded you know how do I   sleep at night sure knowing that potentially  we could let's work and figure a way that we   I'm just very concerned that we bring in a lot of  fill here and what happens it backs up even more   to their property line sure um so I don't know  how we divert that water away um I'm just very   concerned when you look at the pictures of how  much water is in their backyard and I know it's   not your responsibility they built that way it's  not being maintained I get it but I also don't   know how we approve another project until we fix  what's there I'm just kind of concerned there so I   think I think approving a different set of Rights  for the property is one of the first steps towards   fixing it because if you look at so looking at the  the picture that you're referencing here you know   the green area is that b the water body for the  little Tomoka the area from you know that's that's   not colored in that's just the aerial vegetated  area from that green green area to the South   where Old Tomoka Road is that's the area that has  the current entitlement to come in bring fill in   put 50 units in that's what we're getting rid  of and so you know to me the far greater impact   would be to continue to allow a condition to exist  where the rights that exist on that property are   for the area north of Old Tomoka Road to be able  to come in and fill which they can do under your   code currently designed to a 25-year storm event  which they can do under your code currently   and build 50 units that are probably 200 ft  closer to the residence in in Hunter Ridge than   where we're proposing to limit the footprint of  the development does that make sense it does and   appreciate it I'm just still very concerned of how  to vote for a project um when we're not mitigating   um the the rights of the current property owners  there I'm just a little concerned and I know it's   not your responsibility and I get that but sitting  here here having to vote on a project that could   and I go back to I have a neighbor who's lived in  his house since 1984 yep you know the house next   to them someone bought they tore it down they  brought in 26 loads of fill my guess what now my   neighbor floods they put up a concrete wall it's  great they built a code right but guess what now   the neighbor's flooding he's lived there since  1984 sure so I have a problem with i i and I get   it are doing to code y'all are doing a better  project but I'm still struggling that these res   could in have water in their house so I'm just  and I understand y'all are doing what y'all can   do well but let me let me try and characterize  this a little bit differently the first step   so so what you're what you're able to do on  a voluntary basis versus what you're able to   do on an involuntary basis right so with the  current entitlements we can come in and build   the number of units that we have current  rights to um and we demonstrate compliance   with your code then um you know you have to you  have to approve it through that staff process   we're essentially here volunteering to relinquish  half of that intensity and half of that density   and to far surpass what your code requirements  are with regard to leaving the property in its   in its natural condition sure um so when you ask  about how do you address you know the the the how   do you fix that that current problem respecting  the the property rights that are there now while   respecting the property rights of the current  residents as well to to not increase impacts   on on them I think when you've got an instance  where you have you know we've got two Property   Owners right now that are under contract with our  client Glen Fishman and then the the church sure   um they each have their individual rights we've  got them signed on to an agreement that will   cut those rights in half and increase the open  space on the property to 60 keep forgetting the   math 67% sure round round numbers um in exchange  for clustering the development on the southern   portion of the property that is the high portion  of the property um to me I think one of the best   things you could do is work with a volunteer with  a volunteer property own I think some of the   comments that were made you know if you go to  Troy Kent's uh comments at the at the meeting last   week one of the you know one of the things that he  said was work with willing sellers on properties   that have been damaged over and over again to  acquire those properties so that you don't have   recurring flooding issues sure we're not a a  seller who's sitting here with a house that's been   flooded repeatedly but we're a seller we're  a we're a property owner here or a couple of   property owners here that have current rights that  are asking you to restrict those rights and impose   higher standards on this property moving forward  sure so I mean I to me that's a step in that right   dire no I appreciate what y'all are doing but I'm  just still questioning sure so this I'm just going   to refer to it as a ditch if you will coming down  is there any way we could divert that to drain   somewhere else to open it up maybe is there  any way to any other options the ultimate or   the uh you know discharge point for Hunters Ridge  Boulevard in that region is is the Little Tomoka   River and I just want to point out that there is  no proposed improvements within the north side of   the little Tomoka River within our property or  even on the south side of it within the Wetland   areas we're preserving that entire area so we're  not hindering that drainage I just want to make   that clear true but that doesn't mean so let me  let me toss out a suggestion because I think it's   one of the things that strugling you speak in  the microphone sorry um one of the things that   and I think this is something not just Ormond but I  think a lot of different places are are struggling   with you know how do we maintain certain areas  how do we try and improve some of those existing   conditions that exist right now you don't have as  a community as a city the rights to come in and   do maintenance work on what is private property  um there's a again you've got a water body going   through this property from east to west you've got  some you know drainage improvements to the north   that discharge into it but the city doesn't  necessarily have the legal right to come in   and and do maintenance work or work with the home  owners associations that exist to do maintenance   work or add other improvements to their system you  could certainly add that as an easement right to   the development order that you have in front of  you this evening so if you're looking for that   something extra where those outfalls currently  tie into this river to provide the city or the   homeowners association or both with the ability  ility to go through and properly permit and make   some of those improvements if those would be  effective I think we'd be certainly happy to   do that Mr Mayor commission you done thank you  um commissioner Briley just a quick question and   Mr Watts you can either answer this or maybe  Steven can come up so and and and commissioner   Sargent appreciating with everything that you're  saying um you know this this kind of reminds me   just a little bit it's not the exact situation but  it's similar to the Tymber Creek Apartments that   were proposed where the the developers said they  would use the live local act if we did you know   work with them on what they wanted and this is a  situation where and and Steven you can correct   me if I'm wrong but I think as Mr Watts has has  indicated they can come in with a multif family   project of 51 units 50 units not have to come  before the planning board or the city commission   and they're Allowed by right to construct that  project so it's we can sit here tonight and deny   they're asking and get 50 units and the same  potential flooding issues or try to work with   or maybe even worse flooding issues I'm not sure  because it sounds like you can encroach further   into the Wetland area with your 50 units medium  medium density residential then you're willing   to go with the 31 single family units correct so  while I have concerns with the flooding and and   the traffic I'm also like if we say no what do you  get in return and it could be potentially worse um   Randy City attorney thank you mayor um if I can  I'll try to help uh refocus or focus on on on the   issues one of the things you don't have before  you this evening are detail construction plans   right that usually follows this so you're kind  of in infancy stages what makes this proposal   before for you this evening um unique is that  it's different than most of the projects that   you get why because two of the parcels are  currently subject to a dri the hunters Rich   dri um they are subject to specific entitlements  and conditions and those sorts of things um the   other two Parcels are not part of that dri but  uh they do have zoning and uh use rights and um   a lot of the discussions a lot of the questions  you've asked are good discussions but it really   comes um in the phase when you talk about the  details of the construction plans in terms of   the fill and the water flows and where where  it's going to go right so you're not quite   there with this yet those are really really good  questions and regardless of whether it's um the   approval of this this measure this evening  or if it's not approved um it'll have those   questions will have to be addressed as part of  whatever development application comes in as part   of the hunters Ridge development that does have  entitlement to up to 50 uh res um is it multif   family or residential multi family multif family  right and then you've got the one unit per acre   on the the other parcel so you're going to have  that regardless of whether you do anything with   this or not so one way of looking at it and I  don't want to get involved in your discussion   but just to kind of maintain the focus on what  you have is in one sense you're looking at Swap   out um a reduction in the density and the  intensity of the development storm water   traffic all that's going to be important at the  phase at which construction plans get provided   before you in order to get there if you're  interested in approving this project the way   you get there is you have three things before you  this evening an amendment to The Hunters Rich G   to remove those two Parcels that are subject to  the 50 multi-unit uh entitlements take those out   combine them through the zoning map Amendment and  the PRD development which will provide the other   entitlements and restrictions that can be included  as conditions of that PRD development order and   the planning director can speak more to that but  that's kind of the essence of what you have this   evening and then when you get into the really meat  of the of the project that's where those other   questions tend to get fa to doubt and Stephen I  don't know if you want to addressing that or not Steven Spraker planning director so that was the the  point of the three steps of the process right   now you're at a zoning document you don't have the  detailed construction drawings it will come back   before you one of the things we did with a couple  other subdivisions is we required them to have a   neighborhood meeting at the preliminary plat that's  not a code requirement but if you're interested   in in presenting the construction draw drawings to  the neighborhood that's a great way to have that   discussion at a neighborhood meeting then again  at planning board and then at City commission but   I think the City attorney summarized perfectly  where you at you're at the very first zoning   document then comes the preliminary plat and then  comes the final plat Deputy Mayor so I I just need   some clarification if we do not approve the dri  into this project then they have their own that   dri has its own ability to build out without  coming to us 50 multif family units and if you   if you listen to the applicant attorneys they  would they have have the right to do a 25-year   storm versus what they're offering in a 100-year  storm so I think what they're from what I heard   they're reducing the number of units and they're  increasing the storm water requirement at a zoning   level and would this project if we if if we  didn't approve would this project be able to   move forward who who knows I mean it's been since  1991 and no one's move forward right so I I don't   have a crystal ball but they they do have those  entitle entitlement rights and do we do we ever I   I'm trying to remember when I was on planning  I felt like we had a more detailed water St   John's Water Management they usually I I thought  I remembered they approved a project or they had   recommendations I think we're doing it backwards  you know I mean we we making a we're we've got   these three things and let's say we approve it  and we have a few neighborhood meetings and all   of that but it's it's approved and now we have  water issues and then St John's water management   comes back and says well you know um let's clean  the ditch and and the question I was going to have   for Mr Watts is the gentleman that's proposing  this project he was involved I think in the in   the hunters Ridge Project as well and probably  knows that that River has not been maintained so   it's like it hasn't been maintained for 30 years  how do we know in good faith that it's going to   be maintained for the new project as well and I  know I sound like a real bad person up here but   I've got to ask these questions given the context  of what we've experienced as a community over the   past several years I I think all of your questions  are completely reasonable Mr Fishman I think is   the gentleman you referring to yes sir he is he's  listed as as an applicant because he's the trustee   for the seller so if this moves forward and is  approved he is no longer associated with the   property because it's purchased by Mr lefkowitz  behind me here who had moved forward with the   actual development so Mr Fishman is listed in  here simply because he's the current owner of that   North piece north of Old Tomoka Road as trustee  for I don't remember the name of the the the   full trust but it's he's under contract to sell  that property and so if this moves forward with   an approval of the proposed development that's  in front of you now he would sell his interest   would no longer be involved with it whatever his  his um you know uh issues with Water Management   District or that that the association has with  the district to the north are really separate   and apart from this particular property as far as  I'm concerned at this point okay um commissioner Deaton so if this wasn't approved would he still be  proceeding with the purchase I don't know I don't   know uh it may go forward it could just end up  with the two owners that you have now between the   church and and the you know and the the trust that  owns the northern portions and the threat of 51   homes that's just what the existing entitlements  are right thank you commissioner Sargent thank   you Mr Mayor uh commissioner Briley I appreciate  your comments with the Timber Creek Apartments   I've voted my conscience cuz I didn't think it was  right for that area and right now I'm just having   a tough time knowing that we have residents that  are flooding there and we're willing to put more   fill in and flood them more I I I appreciate that  it's lower density I appreciate that we're going   lower but I have to sleep at night sure I can't  sleep at night knowing that they have water coming   in their house after we get 23 in we're approving  it to 13 in of rain I get it and I I appreciate   uh City attorney uh as well and all the comments  but I'm just I'm having a hard time knowing that   that we're not doing anything with this piece of  water that's just backing up in their property   and all it's going to do is get worse but again  nobody you know nobody standing before you asking   the questions this evening has the rights to do  anything north of the property boundary sure um so   you know as as Steven and the City attorney both  both mentioned the way your process works um and   and I can appreciate that sometimes it feels like  you're you're deciding one question or the answer   to one question before you know all the details  but let me um see if it it helps to characterize   it this way the point at which we're at now is is  we're asking the question what should we plan and   design for um and then as the City attorney and  and the planning director stated you then have a   follow-on process that gets into the details of  that design um so you know right now your zoning   says we're going to design for one unit per acre  on the SR portion of the property and 50 units   of density on the dri portions of the property  that's what your current rights are and you know   all the other rights that are you know under the  Land Development regulations with regard to to how   it develops um you know tonight we're asking the  question should it stay that should it stay that   that number of units or should it go to what we're  proposing and then we get into the detail we'd   be you know Mr Spraker referenced the couple other  projects where we've done additional neighborhood   meetings we'd be happy to stipulate to those types  of things as conditions of the development order   but the the base question is what are we going to  plan for moving forward here and then work with   you and your staff moving forward because the  process comes back through you how do we plan   it what's the technical detail look like sure  thank you Deputy Mayor yeah sorry so I don't   mind sharing with you my thoughts that I kind  of put together earlier and and maybe that will   help us make some decisions on how we want to move  forward um so I I kind of broke it down um as far   as traffic although the additional housing and a  church contributed to additional traffic I think   it's pretty solid indication that right now  a light is not warranted and um I appreciate   the information here with the crashes and all but  I'm I can sign off with the traffic at this point   um as far as the church I I've heard a lot of  discussion and residents have reached out whether   there's a need for a church at this location I  don't believe that's my scope to determine whether   we need a church or not um I also don't believe  that I should judge on how a church may practice   or their beliefs I've had residents complain about  their potential beliefs and practices um we all   have our own set of beliefs and practices and we  live in the United States where we can profess to   have freedom of religion so the church SE for me  is not a problem either density I appreciate the   fact that it did go down to 31 units um although  um from the allotted 70 or something and again   like with Timber Creek we were threatened with  that higher number and I really like you Mr   Watts but I really hate it when you tell us what  that stupid maximum is it really turns me off so   in future if you would not say that and just  be real and just say what really you could put   on there and not that number I would appreciate  that very much um and just as a note because I'm   an environmentalist now um there are five gopher  burough that have been identified on that property   and that's just for food for thought um now the  flooding um I visited the area I've walked on   the area The Hunters Ridge property I visualized  Mucky area around the stream I saw a stream   full of debris and not kept and I've we've talked  about those violations I think that's an easy fix   um I think that's a fix the HOA could do or or  the developer or a combination of and I think   that's really important um I did see a stream  that's not straight those right angles do really   mess up the flow and maybe in the the cleaning  out of the river you could that River can be   um flowing a little bit better without those  straight angles um I it did seem to me and I know   you showed me on the map that those last row it's  not Wetlands but it definitely is Mucky land and   like commissioner Sargent said there will have to  be a lot of fill in that area that is concerning   um that Culvert under State Road 40 draining  from the South Side um and there may be an   parent non-disclosed drainage ditch I I don't  know about that you know these are things you   hear um that all will take water onto that  property and fill the Little Tomoka River   and back up onto all the remaining the houses  that are all in Hunter Ridge um you know should   there be a discussion whether there should be  like a lake system on there you know um water   retained into a lake going into a lake going into  another discharged into another spot I don't know   I'm not the water expert um given the fact that  all Volusia has been experiencing flooding I've   talked about this already I'm really leery of the  proposed development the county is discussing ways   of helping residents and I think that this  project has potential to add to that problem   um now saying all of that I would be in favor of  the project if those back row of houses could be   considered eliminated um if that stream and  that river and debris would be cleaned up and   that [Music] um we could get some type of approval  or recommendation from St John's water management   and or let the HOA do their own research and  present that to us as well um and I would like   to avoid any development on the wetlands even  those little those little tiny areas so those   would be my recommendations you and I'm throwing  it out there for discussion for you guys at least   a spot to to make some discussion so we can get  this moving Mr Mayor commissioner Briley I would   concur um with with with some of that um again  I I I I think and I I appreciate commissioner   Sargent's uh sentiments regarding you know not  wanting to exacerbate flooding in the area I just   kind of come back to they have entitlements for  50 medium residential units um with a 25-year   flood plane or 25e storm uh holding capacity  by St John's um you know I do like the reduced   capacity but again I think we have to remember  what our City attorney is telling us I think   what our planning director has told us at this  point we have no plan I mean there's there's no   preliminary plan nor final plant that we would  get to vote on prior to something actually being   done so I think at this point we're just voting  if correct me if I'm wrong Randy just kind of   voting on the concept is do we want to remove two  of these Parcels from The Hunters Ridge dri and   they consider the project is is a whole um as a  PRD and then we can kind of hammer some of these   other things out as the preliminary plat and  the final plat come back to us that that that's   correct and one way of looking at it is is you  know what the the current entitlements are the   current entitlements uh in large part by virtue of  the hunters reg dri that was approved in 1991 you   can't change that it's a condition of the dri um  and that's that's what they're allowed to do and   whether they can do the maximum or not don't  know there's a lot of other factors that come   in St John's the city's own Wetland ordinance  and and and that sort of thing um this project   is an opportunity to reduce some of that to what  extent I don't I don't know the challenge in all   these things and we mentioned this earlier is you  don't have the detailed construction plans because   you don't get there until unless you agree to the  concept but you do have some numbers um that you   can discuss and that is whether you want to take  a chance on um that 50 multi-unit development on   the two Parcels in 100 Ridge plus whatever can  be allowed on the other two Parcels or whether   you want to try to manage the control of that uh  through some other PRD and if you want to do that   then we have these three steps for you to approve  this evening and that's really what you're being   asked to consider that answer your question thank  you Randy um any other discussion here okay well I   guess at that point we'll see if there's a motion  here so we have we should do it in three we have   to do it one by one so we'll have to do D first  have Susan um re yes we're going to go to uh uh   D yes and before before you do that you may want  to have some general discussion as to whether uh   you're in favor of um the proposed project as  a whole or not if you're not you need to deny   all three of these right you can't approve one  and then deny the other two they they all travel   together but they have to be print presented  separately because they just have different   legal requirements good good point yeah so I  guess we're have to commissioner Sargent until   I have further information from St John's water  management and I just I I'm a no on this on all three um I ran my campaign on a make  it Make sense mentality when it comes   to development this doesn't make sense to  me I'm a no on all three commissioner Briley I mean I do have I've have I have concerns  with the traffic and I have concerns with the   flooding I just see that this is a potentially  an opportunity to you know make something better   again because I do understand they have the  right to develop now there's nothing saying   they're going to develop the 50 medium density  residential units either but they do have that   ability right now without coming to the planning  board of this commission so can we ask ask the   developer to look at some of the he's obviously  heard the concerns you know that we have tonight   can we put this off and have you guys come back  with a more information regarding the flooding   and the issues that we're talking about I mean I  don't want to I I agree with um Mr Briley over there   you know we I understand the rights in in in all  of that and I certainly wouldn't want to put our   city in a bad way you know legally that we're  saying no when you have entitlements right um   but I agree it doesn't make sense right now so I'm  wondering if we can just ask you to come back with   a better plan so so I think there sorry I mean  this is the the gentleman that wants to buy the   property right yes can we ask him if he's going to  proceed with the sale if it doesn't get approved I'm Howard leitz 1315 out BTA Drive Winter Park  Florida I've probably developed something close   to 20,000 Lots in my career and I'm getting too  old to fight a whole lot okay we came with this   project I don't know year and a half two years ago  we started looking at it and we did assessment as   to what could really go on it what the zoning was  what the entitlements were and we really started   almost with 120 units it says you know you nuts  just doesn't work it's not going to make it's not   going to make sense I was even knowing before any  of the economic excuse me any of the environmental   issues were even brought to bear so you got a  certain amount of acreage what can you do with   it the we went back and did I think no less than  three different concepts and then we dropped it we   went to the sellers and we said look there's no  economics that makes sense in all this we still   do this for an economic benefit not obviously for  ourselves but we also take a great deal of pride   in doing whatever it does uh that's a benefit  to the community I'm got no modesty about saying   that from anything I've ever done we dropped it  about uh 9 months ago we went back to the sellers   uh and said look the only thing we can really see  happening with this is basically in some substance   what you see before you tonight there's been no  less than I think three presentations to staff   where we get their feedback on what the issues  are and we've redesigned and we've redesigned   and the latest redesigned which I think was after  either the third or maybe the fourth time through   was to remove that culdesac head at the top of  the community that was the last what we thought   was pragmatic request in dealing with how this whole  program should work brought we dropped it whatever   it was couple hundred feet further back from the  river we have invested I don't know something in   the neighborhood of $330,000 in environmental  assessment the latest report of which we had   at four in a meeting at 4:00 this afternoon to  understand what the mitigation probabilities   will be in dealing with the St John's riverwater  Management District we now have an understanding   in for what that is the issues that yall have I  understand totally believe me I I've heard it a   great deal more at my age I've heard it a great  deal more than the number of times y'all put   it before your other developers that's that's  come before you and all of the arguments that   my professionals have made are as legitimate and  straight and down the line as is anything else we   can be we cannot change what nature basically has  created when I listen to the three gentlemen in   the back show talk about the issues they have and  show you the pictures of their property where it's   been flooded yeah their property has flooded but  nobody goes back and says look your houses didn't   flood and that was really the original concept  that the design the original design of their   projects that yeah you're going to have periods of  time that you just can't predict you're going to   have hurricanes you're going to have time when  water's going to come up to your backyards but   the whole concept and your streets will flood okay  but the idea is to keep your properties drying and   in fact that's what happened now it's that going  to happen in the future I'm going I I can't in in   my lifespan I don't remember a hurricane I think  hurricane Donna in 1960 which was an earlier part of   my lifespan we had major major flooding across  the entire Central Florida area I I just moved   into Orlando at that point in time as a kid  in that point in time Orange County and those   areas went back and they created a whole series  of canals and dug things out and since that time   other than some very low areas that were were uh  uh constructed way back when problems got solved   the same problems are evolving all through here  I can't help what Nature has basically laid out   there what we said is what can we do to mitigate  it as far as we possibly can well the first and   most obvious thing is to move as far back from the  river and the drainage areas as we can I can't help   what flowing in from the north I didn't even know  about that until it came up for discussion tonight   the second thing we can do is say look yall  designed a 25 year why don't we design upwards   we know it's probably going to come through a lot  of the other uh uh communities around you and it I   can't imagine them coming in with something like  above a 100 year but let's say let's go from 25   to 100 Year okay what does that mean yeah we're  going to put more dirt in there okay but it also   doesn't change the fact even with more dirt we've  still got to retain the amount of drainage that   conceptually is designed for the area we can't let  drainage run off above that and now it's measured   to 100 Year rather than 25 year I don't know a  better way to do it I honest to goodness don't and   and I think your your question Mr Sargent which  what do we do to prevent this stuff from happening   ms Tolland that what can we do to make the world a better  place from development standpoint I don't know how   else to go about it we've reduced our density  in the impact of the area we've increased the   flood levels to accommodate that we volunteered  to at least look at the drainage systems along   the river and see if we can help clean that out  a little bit but I'm I'm just I'm just not sure   what else to do so if you're question to me am  I going to go forward and close this purchase of   this property for 31 Lots I mean typically I do  nothing less than 300 Odd Lots the last thing I   did was in Hunters Ridge which is 322 lots and  St under the St John's District our particular   section uh they call us periodically and say you  need to clean out this that or the other and our   association before it was turned over I went back  and cleaned out this and and the other we met   the obligations we were mandated to meet and our  association is structured after I'm gone and which   I am now gone to to meet those obligations this  is no different there's going to be obligations   put onto this property by the Water Management  District through the homeowners association which   we will create to have a mechanism for looking  after the permitted obligations that's what we   do we've done it I hate to tell you for 40 some  odd years actually it's closer to 50 years and   there not many of them that I can't look back and  say we didn't do it the right way that's all I can   tell you if y'all don't want to approve this thing  for what we put on the table the probability is   I'm just going to drop it I'll walk away from I  won't tell you how much but a significant amount   of money that we've already put into trying to get  to the point that we've gotten to if you want to   approve it we'll go ahead and continue with the  process of working as much as we can with the   district with our environmentalists and with y'all  and your staff to try to make this thing work the   way you want it to work I wouldn't close it if  I didn't have confidence that if you approve it   tonight and we move forward to the next steps of  it that we couldn't accommodate your concerns in   the next steps but there's only so much from  a practical standpoint that we can do we can   commit to we'll do the best we can that's all I  can tell you thank you commissioner Deaton you have   a question okay um all right so right now we're  you know discussing right now is either all or or   some on the ordinances here and right now uh  commissioner Sargent has indicated no for three   on all three and commissioner Deaton um I'm just  wondering if we can just put a hold on it and   put it until we talk to St John's water management  or the HOA Randy what what what can we do here so   um I mean I want want to do it the right way right  understand that I think everybody is sharing your   same concerns based on what I'm hearing to some  extent you have a bag full of apples and oranges   and you're you're trying to put them together to  make the best project that you can you have two   options you do nothing in which case the property  stay in a current state and the two Parcels that   are in Hunter Ridge will stay there and maybe at  some point uh in the future somebody will file   an application uh to develop um those part Parcels  under the existing entitlements which youve you've   heard about maybe that won't happen don't know  um and then the other Parcels on the southern   portion that are in the SLDR they have I think uh  one unit um per acre I think it is so you can add   the numbers up and you're going to get to roughly  67 or 70 versus um roughly 30 here um The Hunters   Ridge dri is subject to a completely separate  separate set of conditions and you know this well   from what we went through last year right so if if  uh through the development of Hunter Ridge and in   in in the northern portion they're not meeting  some of the flooding requirements uh Wetland   requirements St John's will make them they'll  take the enforcement action to make sure that they   clean that up that's not really anything we have  any control over um I've dealt with St John's last   year on some of the others Hunters Ridge issues  that we were having um they take their jobs very   seriously I do I do know that but they operate  separately from the city I'm just not sure what   it is from St John's um you might want to get that  could help you reach a decision point on what's   before you this this evening um gotta ultimately  it's your decision to make you know it either   stays where it's at in their current uh locations  with the current entitle so to speak or um you   know you approve something that you might be able  to manage and control a a little bit more and   that's ultimately your decision to make and that's  really the best advice I can give you I'm sorry   thanks Randy you're no help well I mean everyone  I got to agree that there's so many concerns and   so many layers and uh and I can understand the  you I've lived through it I mean I've lived   in communities where you know we we built and  property owners and all this other stuff and then   homes that didn't flood flooded and uh so I can  really appreciate all that um it's a definitely   a tough thing but like uh the City attorney said  that you know there's other issues that can go   with this um later on with the property rights for  one property and then you know what can they do   with the other properties later um well I guess  a question if I may just for Steven real quick so   let's just say let's take the Dri The Hunters Ridge  Dri Parcels out and let's just say nothing were   changed tonight the two Parcels to the South that  are Zone SLDR someone could come in just like they   could with the Hunters Ridge properties correct  and come in and do one unit per acre through   a staff approval and not have to come before  necessarily have to come before the planning   board and commission correct the the the church  could come in as a special exception for all   our port or portion of those two Parcels right so  that's one option right so that that's a special   exception and that Suburban residential someone  could take the the land and do one unit per acre   it would be more of a technical review still comes  to you as a preliminary and final plot right but   you you're just reviewing whether or not they  meet the minimum or they can do a plan residential   development for the land south of Tomoka and be back  before a neighborhood meeting plan more and City   commission those those are the options I would see  I and I guess the reason I asked that question is   I just kind of like having the idea of having more  control over what happens out there than than not   can we put the map up there that has the um the  numbers where this is where the church was this   is where the dri land I don't remember where it's  no it was like in the very beginning of Steven's presentation right there yeah so what which what  is the dri what numbers see one and two one and   two okay how many acres is that 30.4 6 30.4 6 Shawn  does the city need any water retention areas out there I think they for the same reason that they AR  developing because we would be able to BU no I'm   not saying develop but I'm just saying keep it as  it it's it's we property it's yeah that's what I'm   saying and it's it's I think you you got the the  floodway there as well which is is usually and I   believe by our code off limits to development as  well so so I'm not talking development I'm talking   re keeping it retaining As Natural for water  retention I don't believe it would hold give   us any providing any benefit benefit for water  retention above and beyond what it's already   doing and what what what it would be doing in the  plan that just presented and my my take on it is   those two Parcels would be where the least amount  of the development would actually be you just got   pretty much the one row of houses the most the  bulk of the develop would be on the southern two   Parcels is that correct Steven yeah um it's like  one row of houses just one row yeah uh Randy you   want to say something yeah yes sir thank you uh Mr  Mayor um it's having an hour a little difficulty   following the my thoughts yeah me too the thing  you need to keep in mind Parts one or two up on   the map here those are subject to development  conditions under the dri all right so that's   that's where they're at uh that's where they're at  today in a lesson until they change so um you know   if those properties stay in a dri uh they can be  developed in accordance with the dri subject to   whatever conditions might apply at the time um and  then that would come back before you right so um   I just wanted to remind you because I wasn't  sure where you're going with the weap retention   stuff so I was just hoping that maybe um we  wouldn't approve the dri and we could just   leave it maybe the city would want to purchase it  and leave it well it it is it is currently in the   okay so maybe we the city would be interested in  purchasing that portion and then they can develop   the front the front edge part of the church and  some I'm just I'm just trying to be thinking on   my feet creative up here whatever other options  we had understand but my my purpose is to make   sure that you stay within the guard rails  and the guard rails is is that you got legal   requirements okay um as it relates to amending a  dri doing a zoning map Amendment and improving   a PRD development order right so you get too far  beyond that i' got to bring you back in and kind   of refocus you and I expect that so thank you  I'm good with that commissioner Deaton can we table this well um I would think we need date certain  re so I guess my question is what would be the   purpose of tabling it well as commissioner Tolland  said you know let's hear from St John's management   but like what Randy said what what information  are we trying to get from them except for what   go ahead I'm sorry say I think I think one of  the difficulties you have so I think that you   were heading in the direction of what I was going  to ask which is what what are we looking for from   St John's because the next step in the process  is to get into the process with St John's and   develop that additional information but  I have very few clients that will spend   the money to do that on the hope that they may  have a project versus knowing that they have a   set of things that are approved that we're  now planning for I said a few minutes ago   you know the the point we are in the in the  process is what are we going to plan for and   then how do we technically plan for it and  design it so I don't think tabling it really   achieves anything because then we just get  to do another night just like this talking   about the same Project without any additional  information because we can't justify the cost   of going into full design with St John's without  knowing that you have something to design for so   that's the that's the problem we have okay  so if we're not tabling I'm still a no yeah   can I ask another question sure would your client  be interest would he be willing to eliminate that   back row yeah I think because you're only  talking about 31 units is got doesn't make sense okay so we're back to well I think it  sounds like here that's one of those either   All or Nothing um for the three items right is  that right Randy pretty much yes sir okay so um   you know we could either can we uh um vote on  all three of them or do we have to go through   each ordinance we didn't read all the other  ordinances yet okay okay so we're on D been on   D for a while here um at this point we've talked  to everybody we've had discussions we had speakers   um we just don't have any motions at this point  um but we need a motion um for an approval and   then any other discussion and we kind of you  know move on from there to the next one on 8 day move approval second call a vote um  now you have to call any other discussion   okay good um City clerk please call the  vote commissioner Tolland no commissioner   Sargent no commissioner Deaton no  commissioner Briley no mayor Leslie no all right we're going to move on to  uh e uh city clerk can you intersection of US1 and  Granada Boulevard previously it was a vehicle   sales um dealership um the dealership has gone  out of business there's a desire for Sun Bros   coffee to go into the site the site is extremely  non-conforming primarily at a lot with um so they   did the best they could in terms of meeting all  the requirements what they could not meet is the   side yard landscape plantings it' be required  12ft they can provide 3 feet which is one of the   reasons they went through the landscape waiver  they are reducing the overall um impervious area   from 95% down to 75% so there is Landscaping on  on site the second item they're seeking a waiver   for is two wall signs totaling 41 Square ft the  Land Development code would allow one sign at   10 square feet the planning board did recommend  approval of this item 6 to0 and the applicant   is here if there are any questions do any any  questions for Steven okay for transparency can   you just state exactly what can go there  if we were to vote Yes or No all the uses   in the B4 Zoning District okay so restaurants  office retail the challenge with this parcel   is a limited lot width has a lot of lot debt but  very limited lot width is currently non-conforming   right correct okay and currently it's a rundown  building it is yes uh commissioner Sargent   and it's drive-thru only correct there's no walk  up correct okay starting with   city manager Joyce Shanahan thank you Mr Mayor just  thank you Mr Mayor just a couple of items um   want to bring to your attention that um fdot is  beginning to prepare their roadway resurfacing   project from Sr A1A from Granada Boulevard to the  north city limits it's this project is similar to   the project on south of Granada Boulevard makes  a number of safety and operational enhancements   including a new 10-ft shared path on the west  side of A1A the addition of turn lanes at the   intersection of Neptune which we think we can  all appreciate it as necessary because that's   where everybody accesses the beach and a number  of rectangular rapid flashing beacon crosswalks   throughout the corridor that make for safe travel  a couple of events I want to put on your calendar   the Doug Thomas way ribbon cutting will be  held on um January 27th at 4:30 p.m. at Hall   Road this project will this program will  consist of a welcome by Robert Carolyn remarks   by various guests and speakers a speech by Doug  Thomas and the ribbon cutting all are welcome   to attend Ormond Beach Performing Arts Center  openhouse open house January 25th from 10: to 2:   a.m. 2 pm 2 am would be a real party um this event  is free and open to the public and it gives us a   chance to showcase um our redone uh Pac after the  fire and then last but not least show and tell shop   at the environmental Discovery Center um come and  enjoy um and learn about 20 native plants suitable   for for front yard planting in any neighborhood  the native plants featured by host Katie trip we'll start with commissioner Sargent thank  you Mr Mayor I will start off uh while this is   a late meeting tonight I have a lot um I received  multiple emails regarding fluoride and our water as   I'm sure probably everyone did up here um so I'll  start off with uh back in November November 22nd   2024 our state Surgeon General issued um guidance  for us to remove fluoride from our water um since   that time Sebring Florida live o Florida Winter  Haven Florida Stewart Florida Naples Florida   Florida Point Port St Lucy Lake Alfred Palm Bay  niceville Melbourne and Imokeely Florida all have decided   to remove fluoride I know commissioner Kent  started this many many years ago where he sent   certified letters to all the companies that were  providing fluoride to municipalities asking um for   a breakdown of what the chemicals were that we are  putting in our Waters he got zero responses zero   no one told us what was in this that we're putting  in our water system because that's what we've been   doing since the 50s um I think a lot has changed  since the ' 50s I think we are seeing the results   of this chemical in our water what it's doing to  our um uh our children just the long-term effects   that we are just now seen I know that we only  put in the very minimum amount but I would like   to make a motion that we immediately halt putting  fluoride in our water in the city of Ormond Beach   is there a second for that I would Mo I would  entertain a second if we were add some guidance   All Eyes down here right was there a question  for us that to go on agenda so I I think since   this is a policy directive it doesn't necessarily  need to be on an agenda because you're not really   expending any money um if um you do have a Cod e provision drives from the 50s that requires you   to put it in there so the question then is if your  desire is to no longer at for of the water um as   a kind of a policy director staff uh is it also  your desire that we bring back an amendment to the   ordinance to to eliminate that as a requirement  um now benefit to that is is that just because   it's eliminated uh doesn't necessarily mean that  you can't change your mind at some point in the   future and then put it back in right um it just  kind of takes away the Mandate so to speak but   if you're at the point now where you're thinking  from a policy perspective Direction staff is we   don't want you to do this then you probably should  amend your ordinance to eliminate that is require   you want me to add that to my motion uh no we can  take that as a Direction so I think that's that's   perfectly fine but if you want to make a motion  to direct staff not to add it then that's that's   good too I don't think I need to change anything  yall have Direction effective one immediately immediately it may wait till tomorrow  morning right but I will I operator and   out what the practicable time to as soon as  practicable is that is that a fair statement   to make that is perfect okay is everyone else in  agreement with this I think it's a great idea but   I think what has to what should happen as well  is there needs to be an education component and   that where will be where Miss Elston comes into  play you know why we are eliminating it and   the one thing that we have what you didn't say  um commissioner Sargent is that since the 50s   now all toothpaste is FL FL fluoridated when you  go to a dentist they do fluoride treatments so   there's just other there's other mechanisms of  getting that fluoride but I think education is   really important and I agree we could take it out  of the water yeah uh commissioner Deaton um so all   I had on my comments tonight was regarding the  before we go on um with regard to the education   requirement I don't really know it is that you  want us to say cause I'm not qualified to say those   things well I I think that everybody expects  that there's fluoride in the water now so maybe   making a statement that we will be removing it  for and then you can for the reasons that the   health department that study you could use the  the information from the the study or should I   would be removing it at the direction of the  commission that's what I would be doing okay   that's that's fine that's fine we need do we need  a call vote do we need a vote or a Voice vote or   is the direction okay probably Voice vote I would  think Randy do we need to do a voice Vote or do   a roll of you know what are we voting on now um  Mo to move for I think that would be appropriate   for purposes of Staff Direction so that they know  decisively what the policy directive is going to   be and then we can bring back a a an amendment to  the ordinance um okay second resident Miss Boyle passed   away a couple weeks go at 99 the mother of Jeff  Boyle and Janice Boyle so I just wanted to put that   out there um our website's going to be updated  soon I think Q2 will be able to watch at home   hopefully and the internet will the website will  be redesigned that we've been waiting on so that's   um looking forward to that um this past week  we attended Arbor Day we had a couple events at   the environmental Discovery Center and also at um  Rockefeller Gardens and I got to tell you the fire   department showed up I don't know where the police  department was but the fire department showed they   were Captain was there uh the chief was there but  I didn't see any officers so I don't know maybe it   was a busy day on the streets and they couldn't  attend but I just wanted to throw that out there   it was nice to see see them there um we also  attended um the Ormond Beach historic society's   49th annual meeting uh was a good lunch in and if  y'all don't know this our mayor has some lineage   that is uh connected to James Ormond I think it  was your great great great great great great   grandfather came over on the boat with him so I  think that's something that the resident should   should know um yesterday was it yesterday yes  yesterday uh commissioner deputy mayor uh Tolland   and I attended the annual Dr Martin Luther King  breakfast celebration I think all the staff was   there the police department did show up for that  the fire department and I got to tell I have to   go to B bad for the PD they're always there you  just don't always see them I know I just had to   give a shout out to the the fire department this  week um and I got to tell yall if y'all can find   the video of this young man Aiden Bond who did the  Dr Martin Luther King's I Have a Dream speech you   talk about powerful this young man I think he was  sixth grade God he was amazing I mean the whole   crowd was kind of talking when he spoke it got  quiet I mean he get got the attention of everyone   and if y'all can find that on online I highly  encourage you um to do so it was very powerful um I've had some questions about the our form  of government and I just would like to go over   just a couple things um as we're getting into new  season here our form of government in the city of   Ormond Beach is different than like Orlando Orlando  their mayor runs the city of Ormond in Ormond Beach   we have a manager form of government where our  city manager and our Charter dictates that our   city manager and our city of attorney run the  day-to-day operations of the city it in the in   the organizational chart it starts off obviously  with the citizens of Ormond Beach who elect the   city commission and the mayor and then we elect  the city manager the City attorney and the city   manager obviously elects the department  heads and it and it flows down um the city   commission we're a collective body we formulate um  formulation of the city's vision and goals policy   direction to staff and ensures the city's  Financial Health the city manager's responsibility   is the organizational leadership and delivery of  services facilitates the commission's vision and   goals effective and efficient implementation of  policies and development of the annual budget this   effective relationship which is mutual respect  Plus open communication plus trust that is why   we are so good in the city of Ormond Beach um  had a couple other little things here I wanted   to highlight sorry it's jumping around I'll just  move on so essentially we all work together as a   team up here not one person not um one you know it  takes three people to move anything in the city of   Ormond so I just wanted to put that out there um  just so everyone is aware with that being said   Mr Mayor I'm very pleased to see that you're  doing coffee with the residents it's awesome   I think it's a start for our residents to have  a place to come and and meet you and um be able   to voice their concerns but I have a couple  questions councilman Kent did this and it was   called coffee with a commissioner but he did it at  his house and it was a time where people came over   he brewed coffee he had donuts and they talked  about whatever I just have a couple questions   with coffee with the mayor it's going to be held  in a city building so I have a couple questions   for staff and like I said I think this is a great  idea I look forward to it being implemented I hope   it starts a pattern for Mayors to come but I just  want to get it all um up front and to make sure   we're not missing anything um so I don't know the  format um is if direction is being given to staff   that would be a policy thing where it would have  to be the commission so I don't know if it's going   to be an open Forum um and you can answer this in  your comments I'm just throwing things out there   and um I guess question for Randy City attorney  with this being held in a city facility and do   does it need to be properly noticed in the  paper or is it okay the way we're doing it   um I don't know the details of the copy with  the mayor um you know it really would depend   on the form and function and purpose of uh of of  a meeting um I think um generally um speaking um   I think the manager will tell you if a member  of the commission wants to use the space in   City Hall what whatever they'll they'll make that  accommodation that's that's fine sure um if it if   it's a bigger footprint so to speak and it's more  of an event and um you know policy discussions and   that might be something of a bigger discussion for  the commission to give direction and that sort of   thing so it's kind of mix bag it probably just is  going to depend on the particular circumstances   it could go either way so okay well I'm I'm just  happy that it's getting going I just want to make   sure that if we need to put anything in place  that we're just doing it proper and that it's   hopefully something that lasts for like I said  Mayors to to follow yes um so if I may in the   past each mayor commissioner has done something  a little bit different um so it's not unusual   for us to allow someone to say use the lobby of  the pac and invite people in there to um answer   questions about the Pac and show case of City  facility that's not an unusual request and so I   granted that request because we have from time  to time done that for others now if they were   going to use the stage and have 500 people that's  a entirely different thing because I can't I would   have to staff that I'd have to run the theater um  and I don't want to speak for the mayor but I can   share with you our discussion was that he would  like to Showcase various City facilities such as   the PAC or the environmental Discovery and have  coffee with the mayor at those facilities without   much of us doing anything except making sure this  facility is ready that's that's the extent of   staff's involvement sure and I'm fine with it like  I said I just want to make sure that if we need   to put anything procedurally in place that we just  do it properly and do it up front um ahead of time   um one last item I would like to give a shout  out to Officer Rick Taylor he recently worked on   three traffic fatality cases and all three were  sentenced this month and all were convicted and   will receive well we be receiving prison time  um so great job to him and his hard work so and   with that at 10:35 I'll say good night thank you  commissioner Sargent uh commissioner Deaton thank   you so the majority of my comments related to  the fluoride um the only things I wanted to add   in because you you did a great job commissioner  Sargent um I did speak with somebody at our water   treatment facility and I asked his opinion and he  said you know the sentiment of flouride's been in the   water since the 1950s when people did not go to  the dentist very often um people go to the dentist   more so two times a year now and they get their  fluoride there so I followed up with my dentist   and I asked his opinion and he said you know I  like fluoride he said with that being said I'd   be fine with it not being in our water as long as  people get their Dental treatments so um with that   being said I'm definitely in favor of that um  let's turn it to our fire department you know I   love my fire department and I'm looking forward to  your banquet this weekend um however I would love   to give a shout out to our PD you've been doing  a fabulous job with my um my homeless camps and   I just want to give you a shout out with that and  with that have a good night thank you commissioner   Deaton uh commissioner Briley thank you Mr Mayor um  just to highlight a couple events I did I do know   that commissioner Sargent touched on the uh Ormond  Beach historical society's uh annual luncheon uh   over at the Anderson Price Building various honories  and uh the Historical Society always does a good   job of keeping our Ormond Beach history alive um I  also attended the the Wilson gala and that was at   the the the Hard Rock Hotel and that was uh one of  the things that was just kind of special about the   Wilson Gala this year is they uh they honored nil  Deus who was the architect or for the actually the   sculptor rather for the Mary Bethune statue  that stands a statutory Hall in Washington DC   and what was kind of neat about that was yesterday  when they had the Congressional luncheon after the   um inauguration statutory Hall you could actually  see nilda's Statue of Mary McLeodd Bethune kind of   up promly displayed in in the hall or actually  on TV so that was kind of neat um attended the   Ormond Beach Memorial Arts Museum dinner um a they had  three honories this year actually had four honories   Susan Anderson was the Mary Jane Mcswain Garden  volunteer award recipient this year uh Linda   King was the Ormond Memorial Art Museum champion won  the Ormond Beach Memorial Art Museum Champion award   and Ray and Sherry gayy were the philanthropists  of the year so congratulations to those folks   um attended the Arbor Day celebration as as  commissioner Sargent touched on uh both at   the environmental Discovery Center and at the  the Rockefeller Gardens uh it was great to hear   of the guest speakers at both uh locations um  attended the Tiger Bay uh dinner honoring Hyatt   Brown and everything Hyatt Hyatt was actually  the uh the initial or the first founders award   winner from Tiger Bay so congratulations to to  the Browns and uh I do want to I would be remiss   if I didn't touch on uh the passing of Mrs Boyle  commissioner Boyle we uh our hearts are with you   and uh our prayers also uh our community lost  another great person uh who's been very active   and been here many many years Mr Jim Culver passed  away so I'd like to remember Mr Culver and uh with   that Mr Mayor I'll say good night thank you thank  you commissioner Briley uh deputy mayor Tolland   thank you and um I'll just go quickly on these  things so there were actually three Arbor   Day Celebrations um in addition to the two you  mentioned Garden Club of Halifax Country the one   I belong to um also planted a tree at Hope place  and it was really cool to see the city celebrate   trees um you're right Aiden at the MLK celebration  was just phenomenal um but really was more special   even than that was that all our residents  came together and celebrated Dr King and they   celebrated through prayer through dance through  music through breakfast it was well attended and   very much enjoyed and if you've never been in this  format it is absolutely amazing I felt like I went   to church um since the last commission meeting um  our city has been busy celebrating the Star Story   Night at the Museum the McDonald Stout House and  the casements the the Ormond Memorial Art Museum   Awards dinner was enjoyed that uh commissioner  Briley discussed uh City Hall um hosted the   service Academy Awards that same night I did miss  that but I'm sure it was it was amazing to see our   young people um receive their accommodations  and the historical societal annual meeting um   I did um Mayor Miller did mention that we um the  mayor and myself attended the regional Roundtable   two-day meeting um up in St Augustine area I  did attend the Volusia County elected Roundtable   a regrow the loop meeting Volusia League of cities  board meeting the YMC YMCA Gala and the civic   league annual dinner it was a very very busy  January um just to make note Florida forever   mission is to preserve important natural areas  1,335 Acres have been expanded to 9,400 acres   the preservation areas that have recently been  included are part of the Volusia conservation   Corridor um I appreciate staff looking into the  fluoride and and commissioner Sargent thank you   for um making that initiative up there I think we  all agree that that's a that's a good thing for   our citizens and I also want to end with kudos  to Troy Kent for his leadership in the county   relating to the flooding issues he was brilliant  to suggest the following ideas no more building   on Wetlands developers will not be allowed to  pay into Wetland mitigation Banks All County   and City canals must be cleaned and maintained  put in place an aggressive but realistic plan   to purchase low-lying homes and low-lying land  that consistently flood have a discussion on   placing Retention Ponds on County owned land  located near flood prone areas and speak with   the cities regarding apartment complexes of course  these are all great these are good ideas that all   are worthy of discussion and um with that I'll  say good night that's it thank you uh Deputy   toen um so it's been a long night um I won't get  into some of the things I was going to talk about   just for time reasons but I did want to thank uh  Deputy Tolland for uh reading some proclamations in   my absence um greatly appreciate it I saw the  photos look like you guys had a great time um   there is a a meeting I had last week with some  staff about the mayor's fitness challenge um you   know we're going to try to make some uh little bit  changes to make it more fun and exciting I won it   last year thank you for that we're the same age  so we're going to be competing this year though   um so uh one of the things I I we talked about  was getting the elected officials a little more   involved and uh so uh just to give you an example  I played basketball when I was younger so we're   going to like do May basketball with the mayor  so if there's anything that you you like doing   that you did when you're younger um let it let  staff know but I think it would be really kind   of fun and exciting to get the elected officials  involved um so we were really excited about it   and we're going to open it up to people that  are not just residents we're going to open up   to everybody in the community because one of the  things I brought up is that a lot of people want   to participate in things that Ormond beach does even  if they don't live here because they like feeling   like they're part of the community when they're  participating in things so I think that was a   good initiative as well I accept your challenge  and I will win again all right here we go um so   I'm really excited about that um we're going to  probably do it sometime in March um just because   you know there's a lot of things going on between  now and then um and a lot of people are already   kind of like going through some challenges right  now with the new year um but look for some updates   on that but I like everybody in the in the in  the Dais here to participate in some way I think it   be a lot of fun so you want us to give you an idea of  what we want to do yeah just something that like   you might want to do like if you like yoga and  that's your thing you know do yoga with Deputy   Mayor if you like uh you know whatever you you  know commissioner Deaton likes doing you know I mean   just just to get everybody involved because one of  the things that staff said was that they like the   people in the community like when you like that  officials get involved and do things it kind of   draws him out a little bit so we want to draw them  out we want to draw them out have some fun you   know and be health conscious Mayor Leslie would you  join me for gymnastics with a commissioner that   was what I like to do when I was a child sure I'm  not much of a gymnast but I'll try I mean so tell   me remind me though how you win is it you lose the  most BMI yes yes yeah I think that's the way it's   going to be still with the BMI I can't wait to  watch this but we're we're excited it was a great   uh conversation um I don't think anybody was in a  meeting was oh actually Claire was in that meeting um   so it was it was a lot of fun right um I mean we  we definitely had a lot of good ideas and uh we   want to get everybody involved uh Daytona Beach  has over 150 people so we want to beat them we   want to get like maybe 200 people to participate  um and then we're going to try to do some other   things for staff but uh getting their HSA um  you know money bonus stuff too at the same time   during that whole challenge thing uh so that'll  be kind of a little fun too um uh I like to thank   uh commissioner Briley for the last meeting he  mentioned uh a birthday for um a Dorothy angle M   and so uh we so Susan and I uh couldn't locate the  address but we were able to get address so what we   decided to do was we're going to just I'm going  to send her a little certificate here um for her   birthday uh just as a little little recognition  here and I'll probably put a little a little card   or a note in there but um if any of you want to  sign the card um I could leave it you know with   uh in my office somewhere maybe with Justin if  you want to sign the card too and I'll put the   card in there with the certificate just you know  recognizing her for her birthday I mean 104 that's   a that's a big deal um let's see here um as far  as coffee with the mayor goes um just want to be   a little more transparent on that cuz you know  I I appreciate you bringing that up uh is that   we I just wanted to be able to have people to go  somewhere and talk and have you know answer some   of their uh you know concerns like for example the  county is implemented these new parking uh fees   and stuff like that not a residents it's free but  we're going to have a I'm going to have a speaker   come and talk about how what that all means and  how you can still register your car um I went to   a meeting recently and the person from the county  came and spoke and a lot of people still didn't   know how to do all that stuff so we're just kind  of like helping them with some information as far   as that goes um there won't be any City business  discussed um it'll just be more about just giving   information um from other agencies that you know  were involved with things that go on here so that   that was kind of like the whole purpose and people  really like that they they like to just feel like   that they're being involved and we're giving them  information um and then like like the city manager   said that you know the Performing Arts Center  reason why I chose that is because we uh it's   it's opened again now and uh at the end of the  coffee uh the person who runs the facility is   going to offer a tour and kind of promote that a  little bit because we we did put a lot of money   into that Performing Art Center and a lot of other  people did too and it's just a way to kind of help   promote that a little bit um I am happy about the  flouride I think we all probably got flooded   with emails on that and we definitely looked at I  looked at everyone and uh it's a good step in the   right direction I mean this thing was implemented  in the 50s and we learned a lot of things from the   every as we move forward right so things we did  in the ' 50s might have made sense then but moving   into the world that we're in now it just you know  maybe doesn't make any sense so I'm really happy   that it was brought up thank you commissioner  Sargent for mentioning it um and I'm really happy   that we're going to move forward with this and  join the rest of the cities on this list here that   um that also did that and a lot of them actually  that commissioner Sargent me mentioned were from   October 24 to uh this this month I mean so that's  a lot of cities just kind of jumping on here so we   just we got on it we're we're we're with the rest  of these cities and I'm really pleased to uh to be   part of that as well um with that said though  um I'm going to adjourn the meeting thank you
