members of council are present first up we have three ceremonial items we'll start our first one with our state champion uh Lucas Crowley good evening everyone tonight we are so excited to have with us uh Lucas Crawley who is the state champion for his weight class for weightlifting and uh want to share just a few things come on come on up here Lucas so everybody can see what he has lifted like this is the guy who lifted the stuff and uh oh congratulations so he only began weightlifting last season so kind of like out of the blue he's like well I think I'm going to start weightlifting and then uh competing in the 169 pound weight class he won the state championship less than a year later roughly right but he also set the school record before he did that and uh and after recording School best and both bench press and clean and jerk list I'm not a weightlifter I don't know what these are and uh I I kind of want to ask you to demonstrate but that might be weird um so hopefully you guys know what this looks like so I'm not asking him to mime strange strange things uh but for the for a combine total of 610 PBS I can't even imagine uh but get this guys 340 lb bench press I know what that one looks like that is amazing and uh I'm just so proud that you we went up there represented oito and have brought back this Championship so congratulations we are real proud of you here in Ovito and looking forward to seeing what you do next and if you don't mind Sharon um where where are you headed next uh I'm going to FSU and I'll do Club weightlifting outstanding go to and we got an right here which is why I had to ask and I think you've got some some neighbors and family in the in the audience uh I could ask everybody to come up and get yeah get everybody in the picture here neb all neighbors all neighbors if you don't mind friends neighbors everybody so I am wearing orange today because Ovito High uh Lucas did just graduate from Ovito High School home of the lion so who here is a lion I know we've got at least four of us right yeah and in the back yeah yeah so we got four allons up here and uh exciting times [Laughter] I [Applause] congratulations next up we' got all right next up we have a presentation by helpful hands I'd like to call Mr Beldon to share a few words about this charity that has become very instrumental in Ido all right good evening tonight we are honoring and acknowledging helpful hands Incorporated for their generous donation to the city's Drew D bware scholarship program uh for those of you that do not know what this program entails uh we provide assistance to youth in the community uh for those that don't have have the necessary means to support or actually take part in our youth activities such as swim lessons summer camps uh Athletics programs Etc so tonight on a personal level I like to thank helpful hands for their generous cont contributions over the past 14 years I want to say um and if I'm not mistaken I think the city was one of their first scholarship donations in the community so with that I'd like to um thank them for their support and I'm also going to bring up the team members from helpful hands up to say a few words at this time if the founder of helpful hands Regina BRZ would join me we have our current president Brad Augustine current vice president miss Susan Haynes and also one of our one of the board members is joining us today miss Valerie deor Smith [Applause] so with that I'm going to throw this over to Brad for a few words thank you thank you very much well we we are uh it's an honor to be here and really it's it's a privilege this is um the oito parks and wreck was one of our initial Partners one of our first Community Partners and I believe it was actually one of our initial grants that helped start uh the Drew bware scholarship fund and it is amazing to us to be able to see what this fund is allowed under served kids in our community to be able to do as far as taking part and having access to these programs so it has been an absolute joy and a pleasure of ours to be able to support this amazing program uh also want to give a huge shout out to our Ovito Police Department we've been happy to be able to support their summer program as well and seeing these officers volunteer their time to form relationships camaraderie with the youth in our community and for us to play any uh small part in that we are we are thrilled I believe I was looking at the numbers and I think since 2017 we've been able to donate around $90,000 between the Ovito Parks fund and the police fund so again we are honored to do it we appreciate the support that we get uh we've got two wonderful events that are going to be this year we'd love to see you guys out at evening Under the Stars we'll be doing that in November we do that at the Winter Park library and event center and and events like that help us contribute and uh be able to support amazing programs like the Avo parks and wreck and our Avo Police Department so thank you guys we appreciate you making time for [Applause] us he just passed over a check so I just want to say from all of us on city council thank you so much the generosity it it has been tremendously felt and appreciate your partnership app and for those that aren't aware of the amount um Their donation amount today is $13,500 so thank you very much we up please [Laughter] we very rarely have attendance this amazing at our our June meetings but I'm excited for all these ceremonial items CU they're kind of what our community is all about supporting our students uh celebrating our our young athletes and all the Partnerships with our community and one of those is with the Ovito Winter Springs Regional Chamber of Commerce who uh puts on Taste of Ovito so if you guys would come on up share a little bit about what all is going on and would it be you want to like face this way do a Podium okay cool thank you so much I actually prepared some comments so um good evening mayor May Council Avita residents and guests um I'm roxan Ferguson president of of the Avo Winter Springs Regional Chamber and happy to come before you with some exciting um updates and thank yous um we have over 615 businesses now um with us this evening we have kened Dishman and Paul West who are our staff we also have board members Kathy Perry and Kristen Denny she's our foundation um secretary our website if you haven't been there you got to check it out but we have record-breaking visits over 186,000 monthly coming to our website because of the ongoing support of our city and our members um every organization has an interactive dashboard with us where they can share uh job postings hot deals events promote their business we also shared with Council um you may have seen Paul walking up and giving out the stats we really believe in Roi and it's a really great way to do it is when um we're Google enabled and our folks can find our members in addition any business our community whether they're a chamber member or not can take over our kiosk at the avito mall we believe in celebrating small business every Saturday so that's a really fun thing to do we've also celebrated 11 new businesses with ribbon cuttings um over the past few months and we really appreciate our council members attendance in welcoming these new business owners and families our 501c3 Education Foundation just celebrated its one-year anniversary and we're super happy to be awarding our first entrepreneurial Grant on Wednesday and three scholarship winners as well um to promote our foundation education and business Community we traveled to Washington DC we met with our Congressman Corey Mills and Senator Scott uh to find out what's available for education for our Future Leaders so we're excited that we're going to be able to qualify for some grants so we may be able to contribute to this to the foundation for the city as well um we are also excited to be able to host the first hobnob of the season on June 27th gives our residents a chance to meet their legislators and their future legislators so if you want to come on down the exciting part for what we're here is Taste of aeto celebrated our 30th Anniversary this year big kudos to Kenna for coordinating that endeavor the event welcomed over 2,753 visitors we featured over 150 vendors and in honor of our anniversary we partnered with aito brewing and to create the OVO Winter Springs Chamber ale so it's our inclusion of taste of avito it's a pale blonde ale with a c Citrus Twist of Orange grapefruit and honey it can be found in over 12 cities and 15 locations throughout the State of Florida it's that good yes um yes it's featured at wineries breweries restaurants bars and package us a background uh yes uh any if you could pull that map up for me that would be must [Music] not that one the one with the subdivision plan tonight the council is it's a request to approve an amendment to a preliminary subdivision plan for the uh not that one either we'll need one more the other one uh for the Allen Square it's located on the north side of Clark Street and the west side of Allen Avenue it's a town home neighborhood and the purpose of this amendment is to designate the locations of the model homes the model home the model home sales Center as well as a temporary office which will be a trailer while they're building the um the the model home center uh city council approved the subdivision plan with its adoption of resolution number 43923 uh at its March 6 2023 meeting and uh we had for you tonight A a graphic that showed the locations of the different of the of the model homes as well as the uh temporary sales office and the uh the uh model home center uh there is a stipulation within the amended site development order that the temporary sales trailer will be removed within 60 days of of issuance of a certificate of occupancy for the model home sales office uh you can yes that's the one as you can see what they've done is up along all in Avenue up on the northeast part of the property they have they were designated see if we can get this working here we go up in this area here there will be a row of model homes as well as as a sales office down here will be along Clark Street will be another model home center and then this is the area for the temporary sales office and parking area uh there's also some parking on street parking up here uh by the model homes up in this area as well and that is solely the purpose of this amendment is to designate the model home centers uh within the subdivis within the subdivision uh it's recommended that city council adopt resolution number 4469 d24 thank you Mr C I do not have any written request guys a brief introduction actually uh Mr Harris Burns CAD is going to give the presentation tonight Deputy Mayor mayor C can you all hear me that better uh I'm my name's Harris Burns kale the vot review manager here to present all in all office Art Studio site development order file engineering and while they're getting the presentation slide up I just talk about I'll just talk about why it is that we're here today site development order file engineering 20% or below is Administrative level approval but the deviations included in this proposal are above greater than 20% and there's several deviations that that fit that qualification um partly because and when we get the presentation up we'll talk about it a little bit further but the size and the shape of the parcel um made it so that it was an obstacle for compliance and staff worked with the developer to gain compliance where possible and where impracticable minimize the deviation and provide the correct or an appropriate mitigation for those deviations thank you for the presentation thank you um so you could see the the subject parcel the location of the subject parcel uh to the right of the presentation it's located near the intersection of uh AV M Bard and Broadway which is also known as State Road 426 it's adjacent to the bike uh the bike trail and the Avo Paving Company the subject parcel is in future land use designation of office which is a transitioning uh area with uh single family residences that uh and some other non-residential uses in the area the Zoning for the property is residential Prof or yeah residential professional which allows for the office use the proposals to construct a approximately 3200 foot building including some amenities uh nine parking spaces including two of them being designated for EV charging station five bicycle spaces permeable pavers six foot pick wall and storm water facilities and so the code requires 16 parking spaces and this site is reducing them by to nine parking spaces part of that is the code requirements are Suburban in nature as far as parking goes uh the land of om code update is currently reviewing that and hopes to Min uh reduce those qual those parking requirements for certain uses including office the other part of it is that this Art Studio use the parking generation associated with is is uh less partly because of the fact that they use that space for storage of materials and they don't have the regular clientele that a normal office use would have um in Le or to compensate for the reduction in parking spaces the applicant provided three additional bike spaces uh next slide please um next one yeah because I got a bunch of animations well there's there should be well we can go back I guess we'll do it without animations that's fine I was going to talk about the uh location at the loading space which is to the left of the building immediate it's going to double as a parking space and a loading space during uh Peak business hours and regular operation it will operate as a parking space but during non- business hours um or non- peak hours it will operate as a loading space accommodating for deliveries you can see the evv parking spaces to the left of the loading space the uh brick looking parking area is the where the permeable pavers are which is mostly for storm water but it's also an added value as far as the the quality of material instead of asphalt um and then the bike spaces are located adjacent to the street next slide please um and so on the Southwest buffer which is the bottom of the presentation there's an opaque wall the code requires for office vehicular use areas to be buffered from single family residential by 30 feet and so to do that for this site it would kill the project the drive aisle will be eliminated and and so we looked for an alternative and the alternative was to provide a 10ft buffer which included the required Landscaping uh which is medium and large trees in that area um and the addition of that 6 foot opaque wall which buffers the the the uh single family residential property to the southeast or Southwest excuse me um we also had to reduce the drive a from 24 feet in width to 20 feet in width we did an autoturn analysis to ensure that Emergency Services were able to support the building and also engineering sign off on that reduction and drive a space the other uh deviations are for the amount of area that the storm water facility occupies and the in the buffer area this the code says no greater than 25% these exceed that that ratio obviously because of the size and the shape of the lot it was difficult for them to be able to provide storm water facility and this was an appropriate way it also didn't negatively impact the way that they buffered they were still able to provide um almost all the buffer requirement tree buffer required trees with the exception of one large tree in each of those buffers and then finally on the street side uh there's actually two existing oak trees along with another uh proposed planting um the trouble or the developer was unable to provide any additional trees in that area primarily because of line of sight issues in the drive aisle um next slide please and so these this is a list of the deviations that was included in your memo if you have any questions about them we can talk about them individually uh the justification we talked about that the size and the shape of this lot uh made it challenging for compliance we worked towards compliance and where compliance was impracticable we uh try to minimize that deviation provide an appropriate mitigation the list of these mitigations are below uh if you have any questions about those mitigations we could talk about them as well next slide please so next steps after this application if approved uh would be architectural design order which comes before this body on consent agenda uh prior to building permit issuance um the applicant could apply for site type two permit if approved uh next slide please so staff recommends approval of this resolution this concludes staff's presentation we're available for questions if you have any any questions I just had one clarification so you said on the storm water I didn't quite catch what you said there they're still retaining enough storm water for their project right you're talking about the buffer deviation correct that just wanted to clarify so we're still catching all the water we need to it's just a little tighter in right okay cool that's correct so let's talk about those can you go back to the mitigation page yeah all the contributions to the tree Banks is that because they couldn't place the trees or they didn't want to place the trees it was because they couldn't Place trees they they really packed the site in as far as the amount of medium and large trees that they put on the buffer in the street side to plant more would have in you know endangered the quality of the health of those species when they get into mature growth was the discussion with the landscape uh with the landscape architect the second part of it is that some of the deviations are it's not necessarily one toone relationship so for instance some of the large tree equivalent payments towards the tree Bank are for the encroachment or the amount of area of the storm facility in the buffer or a landscape island tree that wasn't provided okay so were was it a it was a wooded lot before it before it got developed so did we when when the calculation was done for the amount of trees that were required for the lot was it the the replacement trees and then on top of that the the required trees or were they were they combined um as the the the trees that were put there were were combined as replacement and the the uh required these trees that you see they're going towards the tree bank or for the mitigations itself their tree mitigation showed that they didn't have to uh contribute to the tree bank for replacement trees because of the amount of trees that they were placing on the site and the trees that they saved on site and so we go through we we look at the trees that they're preserving the trees that are removing and then come up with The Replacements and then do that math thereafter okay because I just want to make sure it's clear and that they they were calculated correctly because the the replacement trees should not they the replacement sheet trees in my opinion should go um be inclusive of the of the um required trees and not on top of it I I you know I know we've had differences of opinion on this but I really feel strongly that that you shouldn't you know add them on top of each other which causes this because they've completely filled the whole lot and yet they still got to pay over $2,000 into the tree bank because of it so but anyways all right I set my piece thank you any other questions go ahead uh I think I heard you say that the the opeg buffer is going to be for the residences on the South Southwest side of the property what about the residences on the North uh North part of the property they meet the buffer requir so they didn't reduce the buffer size in that area and they provided the plantings with the exception of one large tree in each of those buffer areas and so there wasn't a need to mitigate for with the exception of for the reduction in the large tree okay thank you you're welcome can we can we show the landscape plan again are those spaced out enough to be healthy for giant trees because they still seem really tight they they they're showing the mature growth canopy yep is what you see so that's not like as planted that's correct yeah that was one of the major considerations when we were going over the plan because we talked with the landscape architect about how we don't want to choke out the mature growth right we don't want to to install the trees just to kill them but it's like they did get creative I saw you have permeable papers on there too to kind of reduce the footprint so okay yeah they the developer did a pretty good job with the design of this good good good thank you appreciate you all right I have no written request to speak on this subject is there anybody in the audience that wish to come up and speak on it okay seeing none we'll close the public comment what is pleasure councel I make a motion to adopt resolution number 4471 d24 second I have a motion a second any discussion I just want to point out that the requirement under our code is 22 trees and the number they're planting is 16 I I saw we saw a lot of numbers but I don't know that we added them up to to specify so it's 16 trees plus $2,000 which will be used to make sure that trees are planted somewhere else in the city and I share Council remember tu's concern I'm looking at this thinking I I am very familiar with how big half an acre is and to have 16 canopy trees in a half acre that is a lot of trees and I know we're reworking Our Land Development code but I just want to say from the dis that I am I'm very open to making sure that we don't have a a code that requires planting trees that cannot grow to full size and even with this and and I want to make sure that we follow our code too so right now this is how we follow our code um but as as we have these discussions I hope the public will come and chime in and and share their thoughts on what is what is it we're after are we after shade are we after number of trees what is it we're trying to accomplish by these numbers and I also want to address uh council member poic's concern about how we count it's very confusing in my opinion how our code is written and you get different answer like I look at it and I can't tell what the answer is and if I if I come up with a different answer than he comes up with and you come up with a different answer and everybody's coming up with different answers I'm hoping that we can come up with a way to make it so in the middle of the night if somebody decides they're going to be a HomeTown small scale developer and build an art studio um in the middle of the night because they have a full-time job is something else that they can go and look at the code and say you know this is how many trees I need this is what my setback are and and just understand and lay people's terms how to do it so that's my two sense okay any other comments okay all right seeing none we'll take a vote all those in favor say I I I opposed resolution passes okay on to the next one resolution number 4473 d24 Mr Cobb will you give us a brief introduction uh thank you deputy mayor uh tonight the city council is asked to approve an interlocal agreement between simol County the school board of simol County and the municipalities within simol County relating to a the shared distribution in use of a one cents one cent local government infrastructure Sur tax which is also known as a sales tax uh this involves the fourth generation of the sales tax uh Annie if you could pull the uh thank you very much much oh wonderful uh the board of County Commissioners is considering a uh scheduling a referendum for November the 5th 2024 regarding the fourth generation uh local government sales tax uh the interlocal agreement that is before you tonight will become effective when it's approved by all parties and as well as when the if the referendum is approved in November uh this this interlocal agreement does provide for the shared distribution and the use of the sales tax re revenues and it will remain in effect for the life of the sales tax which is generally 10 years or and until all the net revenues are expended by the parties can go to the next one please can you do it I can do it all right there we go um the interlocal agreement let's see here is this the right one yes this is it this is the right one let's go back not going WR way okay Oops I messed up all right I apologize councel open the beer open the beer Annie can you pull it back up for me oh perfect thank you so much Annie my fault bad okay as we talked about the interlocal agreement does address the distribution of the sales checks revenues in the fourth generation the school district will receive 25% the county will receive 50% and then the cities will receive 25% in other words the city of avido will see a portion of of that 25% of the revenues which is based on population uh it is estimated that avido share will be around 51.5 51.3 million over the 10year term of the sales tax program and we anticipate that distributions will begin on January 1st uh 2025 or sometime around there and then we will receive those contributions uh on a monthly basis and if you could do I don't want to touch it again I'm afraid um one of the unique things about this interlocal agreement that wasn't included in the third generation local interlocal agreement is that there is going to be an annual compliance audit uh as part of our annual audit that we do every year uh we will include in that an compliance audit of the use of the sales tax funds what the agreement requires is that the city's auditor would then provide an opinion letter uh stating whether or not the city has complied with the uh various regulations the agreements Florida statute and uh would show the use of the funds and then we will once once that that uh we receive the opinion letter then the city will supply that to the county and the county will have will uh publish the letter on its website uh obviously the one of the things that's been uh if we could get to the next slide thank you Annie um this this ctax is used for capital projects uh the uh Florida Statutes one of the things about the capital projects it must comply with Section 2255 of Florida Statutes as well as the exhibits within the agreement the exhibits of the agreement the school district projects are provided in exhibit a the county projects are provided in exhibit B we also call them the the larger project M major projects the city projects all of the city projects are provided in Exhibit C and then we have an exhibit D which our potential C funded projects which if you remember back in our work session back in March we talked about various projects that we had had discussions with the county about possible cost shares uh the interlocal agreement does not define those cost shares what it does say is that we will enter into inter specific interlocal agreements to address any of that with those projects to give you an idea uh the phase two uh 419 426 wiing widening the city used some of its local option sales tax to provide for enhancements into the sidewalks and the Landscaping uh in the area between 434 and K Road 419 we also used uh we had an agreement with the county regarding the ex the relocation of Geneva drought if there was something that the city felt like it was going to fall short on the project we had an agreement with the county that they would allow us to tap into a portion of their sales tax dollars uh fortunately for for us everything came in place and and so we didn't have to utilize that agreement but we have that so that is one of the things with this agreement as well we've identifi identified some projects where we feel there's County a sufficient amount of County Traffic that would uh warrant or Merit uh County participation in the project one of which is phase three of County Road 419 any if we could go on to the next one please uh this agreement also has has a language in it regarding how we will uh our allowed to amend our our list as you know we just over in the past year we've amended the list on two occasions to add projects into the third generation sales tax and so what it same process will be done we will bring before Council adoption of a resolution uh once if it is approved then the city has 30 days to submit the amendment to the county and the county will then added into the list and one of the things it also has in here is that if the State Legislature amends section 22055 of Florida Statutes then the cities the county the school district can also amend their list accordingly to to that Amendment go to the next one okay this is a picture this is a map uh we gave you a copy of this uh at the work session but one of the things that we've done right before when we received notice of okay here's what your projected um your projected uh revenues are they ask us can you pair down your list a little bit you've got a huge list can you pair it down so we did we paired it down some and on this map and I'm going to try to blow it up if I can zoom in yes if you would that would be great thank you so much there we go perfect yes we've telec coded these the items in blue are the C ones that are in the city list like in here we have the Alexandria Boulevard uh road diet we've got the roundabout uh on Alexandria for aido Boulevard we also have the a Boulevard extension and then if you can see that there number 52 that is the uh pedestrian Crossing that you know Council identified during the work session uh down here on Lockwood Boulevard we have the roundabout one of the things we looked at we have a couple of roundabout projects that we would like to do what we determined was we could do one of them within with our uh with our projected Revenue uh also up here one of the things up here too you can see the star number 50 that is the the monies that we've set aside we have about $5 million set aside for the public safety building as well as up here on Evan street we have 51 which is the fire and police training center Annie if you could pull move us up the map a little bit um perfect yes thank you so much oops I don't know what it just right there that's good okay uh up here we have uh this is the Lloyd Lane Extension one of the things that extending Lloyd Lane down from uh where it currently ends just south of uh Geneva drive down to Franklin Street one of the things that does is that all of the school children who live north of there have an opportunity to come straight down to Franklin Street we're going to that what we've proposed with that street is complete Street full with both uh pedestrian and vehicular uses uh it will that way they won't have to walk all the way down Geneva Drive to get down to Frank Street and then cross over we'll be able to bring them straight down there and that was that was a huge benefit that we saw with that one uh one of the things that we're also addressing with this list is um Magnolia and aresia along Sweetwater Creek uh looking at how Sweetwater Creek goes underneath those roadways obviously we've got one of the projects already in process but artisia was another project that we identified that was an hurricane Ian situation water was coming up over artia street so we've programmed both of those in there that's that's a street as well as a storm water project uh we also have the storm water project down here on uh Lake Jessup and over here on Mission Road we have that one as well uh those are those are the streets that um or those are the projects that we have put in oh yes and if we could go south or go down the map there's one other one that I wanted to show the council and that's fine perfect that's okay no worries here we go uh East um Chapman Road you know if you can remember when the McDonald's came in and we were look we'd had a traffic analysis done so we've programmed the funding in to do that as well and one of Annie if you could move down to the lower corner do my best go the other way there we go yeah that gray box right there this is uh this is a listing of some County projects that are in uh in B exhibit B you've got the county road 419 lot riding phase three but we also have some drainage projects on the big and econ little big and little econ Rivers as well as a lake Jessup drainage Improvement which helps us with our Sweetwater Creek what we're trying to do there so those are some County projects that are around and in the city and any one last time if you could go to the far right of the map there we go this is this is one of the ones we could not uh we couldn't really show on the map but these is the Citywide uh sidewalk improvements as well as the city-wide repay and both of those we've uh allocated funding in for that as well the items on the map that are shown in red those are the potential co-funded projects that later on we'll look at uh doing an interlocal agreement with the county we'll probably do it similar to what we do with fdot and Joint funding agreements and we will um bring those on a project by project basis uh any if you get get to the next slide and it's recommended that the public comment what is to pleasure of council I'll make a motion to adopt resolution 4473 d24 second I have a motion a second do we have any discussion uh Mr cob I just had a quick question on on the on a um interlocal agreement like this did we have to put all that stuff in for the interlocal agreement because I mean we already have a an interlocal agreement with the current sales tax we do so we couldn't just amend it with the with the additional stuff Dr Bren new one brand new one okay that's all I and I've got a quick uh question related to the specific words of the inter local and um I had JY Duty ear earlier today or else I would have asked this before um so I see that we get 3.94% of the revenue generated and it's based on the Bieber population in 2023 I did not notice a provision in the interlocal to adjust that so if veto happens to increase disproportionately in population um I'm wondering if there is a mechanism through which we may be able to get a different amount or if if the county would be open to such a thing if there's not such provision like an annual adjustment based yeah and and it I guess we could potentially lose because I know there's some some of the smaller cities there's a lot happening right next to the SunRail station so it may put us at a more of a disadvantage so I don't know if I want to open that Pandora's box or can of worms or whatever it is but I am just curious you know what what Provisions there may be if if any I don't think um mayor I don't think there is a provision for adjustment based on the population just reviewing it again but I don't recall that there is some one there's not okay is anybody concerned about having it be locked in did we have it on the last one was locked last time no yeah it was locked in yeah okay I I I do know it was locked last time I more than likely I mean if you think about we're the third largest city we probably will be the third largest city because Altimont and Sanford are ahead of us we're getting closer to Altimont but I don't know if we'll ever overtake them and uh but uh but I it's definitely something we can ask I think it's worth asking uh because I don't want to be unfair to other cities if they somehow outpace us but also if there's a chance we could get a little additional funding why not or at least maybe a 5year review of the population project yeah that's good thought good idea but other than that I I do like that we have paired down the list to very very nuts and bolts hard to hard to object to uh infrastructure type stuff I think it's it's a solid list okay Cil I did see that we had the two roundabouts unlock but one was at uh Rivier and when was at the Lockwood old old Lockwood Boulevard how would we prioritize that or it's something we're going to we're going to need to do a traffic study to look at which one has because I know it's something that Mr White and I had a lengthy discussion about which one would be the best fit for it and knowing that we have funding for at least one of them uh we still have the old lock W one down we talked to the county about co-funding that one but uh when we looked at when we were look the county when they asked us to pair it down and we were looking at okay what could we do within our allocations we said let's just rather than specifying which which road we'll go to let's say we'll do one and then we'll we'll do the analysis to figure out which road it's the best gives us the best use okay and in general how how would we prioritize the whole list assuming the fundings there but there's not enough to go around I'm assuming well obviously one and two two is the repaving and the sidewalk programs and then um I think we will we will come in from there okay but there's there's room to adjust the priority list maybe not the list itself right okay okay um I had something oh back in the day I I recall that Kalo had a role to play in in the allocation of the funds is that still the case or is it is it now taken out of their hands that had a role in the the allocation of the gas tax okay is what they did they they reviewed the population projections and that was what went that was their role is that they would look at the gas tax so this is a different Beast it is yes that's all I had thanks to no I think staff did a really good job whittling this down to you know I agree with the mayor that it's a pretty solid list there's not much on here you could argue about that we don't need and even better I think it IT addresses a lot of the issues our residents are asking us to fix so I think it's a good compilation of projects to see over the next few years I think the list is good as well um I'm just curious have we heard anything from the county on how they plan to what's the word inform the uh the public they can't campaign for it right so they would have to inform that's my fear of this whole thing it goes up to the voters and then this is that year doesn't pass and then this is all for not they're working on it uh they're working on they have several groups that are non-governmental groups that are assisting them and uh so they'll they'll do like we did last year they'll get what information they can out they'll establish a website uh obviously as you all learned last year if anyone asks you a question about it you can tell them exactly you know what your opinion is you know obviously the statute can't violate your first amendment rights and and you know as long as we keep it on a this is what we plan to do with the money um and you know one of the things that they've also told us is to promote what we've done with the third generation sales tax because we did have quite a few successes uh with that program and that's one of the things about this this one is that when you look at the first second and third generations and the things that we've been able to do that we would not have been able to to do without the uh without the sales tax uh no I like that how how do we do that so I mean it's as far as talking about third generation you can say anything you want I mean do we do public information sessions like we've done before is that is it all because it's County it's all County I think there will be some things coming down from the county but do we do anything as a city in order to help for that because I mean it's a benefit for us as well right no I I think from our perspective if if people ask us about it then yes I believe that we we share with them the plans for for the use of the funds and I think also the county may come come and ask us there may be things that they may ask us to do as well we're obviously going to put stuff up on our website try to link to their website try to get all that information out as best we can so is there a list on our website right now that says all the projects we funded with there is on the County website yes yeah it is on the website but if you Google it you can pull up the the current interlocal agreement and the whole all all the list I know but I'm asking we're just trying to make it our website I not sure if there's a link yet there there is yes your staff is nodding but when you Google when you Google it the County website comes up and I I personally don't see any issue with leaning on the county and just keeping it a single voice for the entire County uh because we are all in a single interlocal agreement over it and that's that's just because of the way the state statute constructs how it has to be done yeah but there's nothing wrong with saying it's funded for us here so but it sounds like we do that so and and the thing is is that one of the things too you've given me a good thing for the next time that we have it one of the things that we've been doing through this whole process is the city managers the county manager the superintendent of schools we've been meeting and addressing different issues and so I will definitely bring that up is that how can our how can our city boards assist with you know as far as getting the word getting the word out to people yeah could you'd like to think the more information we can you know the better will be uh come election day and just to refresh my brain here what is the percentage we get of it I think I know the number but I don't want to see the wrong one oh it's uh it's it's like 3.9% 3.9 okay yeah 3.94 3.94% yes yep thank you I like to just say we have the possibility of getting which projected we'll receive 51.3 million I think that's a great number no that's good too but the thing about it is is that just to give you just perspective on it with the third generation we were projected to get 19 million and we ended up getting 23 so and that that had a uh recession in it as well so we we've done quite well no it just needs to pass that's yes I agree de just needs to pass yeah okay great so we're up to the vote what is um all those in favor say I I I opposed resolution passes we have no discussion items city manager report uh thank you de Deputy Mayor I only had one thing I had the pleasure of attending the Florida City County Managers Association uh annual conference last week and uh it was great to reconnect with friends that I only I only get to see every once in a while but it was also we had some outstanding sessions uh on leadership on Communications uh we addressed some of the newer uh statutes that came out of the legislature and uh so it was a really uh really good conference and I'm hoping that I'm going to be able some of the principles that I learned uh during the conference we going to be able to put them in play with uh here so I just want to let you know and um looking forward to uh as we go into the summer great City's turn report thank you Mr Deputy Mayor um just quick I'm going to be out of town tomorrow through June 14th um but I'll still be accessible to you all just um I might have some limited internet while where I'm going so I hope you're having fun yeah turn your phone off yeah thank you very much but um that's all I had was there any update on the the subject we talked about last time about the house yes I do have an update um the uh the property owner um um we received notice from the from the um the jail that he has entered into a voluntary rehabilitation program so he's going to be um in doing that till June 30th so I understand he's still in custody while he's going through that program so he's he's there until June 30th which presents um uh kind of a logistical issue where you know um we want to wait till he's back home so we can provide him the appropriate notices also I went by the property last week and it's quiet there's no one there um thank you thanks to Chief Coleman and his wonderful team they they uh have um assisted with keeping people from reoccupying the property um with and so the property is quiet there's not really a nuisance per se going on right now so if we were to file something there's not really anything to aate um so but we I've been preparing the the litigation so it's ready to go all the notices everything is ready for when he does return and we and if the nuisance does um uh start up again but as it many cases when I've asked a count city council or commission for authorization to to commence litigation sometimes it you work out a settlement um or the litigation doesn't be become necess becomes unnecessary and that's always wonderful when that happens that's happened on multiple occasions for me and um and sometimes it's just the the authorization of this of the governing body to P to sue someone that that helps you with that either that settlement negotiation or that motivation to get them to come into compliance whatever the situation is so just the fact that you've authorized it is is powerful and and of itself and very helpful in in the situation um thankfully it's not a situation that's very common in the city you all have a wonderful city um the the um the the code enforcement agenda for the special magistrate hearing is always very very short and um and especially in comparison to other municipalities it's um it's you're in really excellent shape there um so but but uh so that is the update do you do you have any questions about it um I guess not at this point so I mean we haven't really done anything more than since the last time we talked so okay thank you yes oh and I also I did I also spoke with the prosecutor's office um because I wanted to find out why his last arrest um didn't result in any charges and they were very helpful and communicated information to me that that was really helpful um good to know and there is still one open case that has yet to be adjudicated so I've made the city's position known to the state attorney as well great thank you okay on to city manager report uh Council M tuer all right I'm all right happy pride month um I did want to thank helpful hands for their generation donation that's they've done a great job supporting the city and doing it in ways that sometimes the city can't so um it's great to see them out here also congrats to Lucas Crowley I think he said he could bench press three of 380 yeah that's more three of me so that's kind of crazy um and then as far as our consent agenda today we did have a discussion a while ago to put a couple us of us on the auditing board which is kind of funny because it's our job was to audit the Auditors who are auditing the city so saying that is enjoyable but uh I just wanted to say it was a it was a really good process and we had um Miss Megan McCullum come out and help us as well and it was very smooth I would say all three of us came really well prepared and and I'm uh delighted that the end result was unanimous without just on our score points before he even showed up so it was a it was a good process um let's see is Bobby in the back here today I believe he is all right I'll give him a minute um while he's coming out here I did have another topic um it's not the most enjoyable but I want to bring it up um so I ran for Council to bring this community together and see how I could help do that and I know we all have our own reasons for sitting up here but I am in disagreement with how social media is being used as a divisive tool right now um and my understanding of Sunshine Law is that we are not allowed to communicate about anything that we could vote on outside of this chamber or public meeting and I confirm that I think we all know that so if I were to example get on Facebook and make a post that says something untrue or or misleading then no one on this council is legally around allowed to respond and that's correct I confirm that right correct that would be a violation of sun sign law correct so which is why I do not get on social media and and do that so I find it unprofessional to do this because there's not much we can do if someone lies about us or says something we don't agree with um there's also not much I can do about if anybody else does that so I just can't do much more other than say I don't agree with it and if anybody's listening and you ever have anything said that you don't agree with or see where we're coming from to call and reach out and make sure you get the right information from the source because we are not allowed to communicate that way so I just wanted to say that um I'm not sitting up here to bully people who disagree with me if you disagree with me I invite that I think it's healthy so I just wanted to point that out as well but Bobby's in here so I'll swap back to that um I just wanted to ask on M in yeah and if we bid it out for it or not yet it's out to bid it went out to bid on May 17th okay that's a Sunday is that like a 60-day bid or 30-day bid 30-day okay so cool so we'll get that so 30-day bid and then because we always worst case scenario of getting it awarded and at the construction pick it take a couple months at least to review the bid and get to the council and get it approved so it's still on schedule for a summer start in the summer start hopefully okay or early fall yeah so but it's out a bit and we're we're moving now yes ma'am okay that's all I wanted to hear thank you so much can you what about Magnolia just while we're talking about it Magnolia uh we had a design meeting the other day and it's still it'll still be the end of Summer at least before it completes design at a minimum thank you thank you that's all I have okay Madam mayor well I see we've got some oito Community News uh reporters out in the audience I want to thank you guys for uh very unbiased coverage at least unbiased in my opinion of the potential rebanding of Ovito uh I did get a lot of calls from it uh with from residents who were concerned and rather than individually dealing with bajillions of these I reposted your article and confirmed that you know Parts most parts of it were accurate I think there may have been a little bit of mischaracterization about my comments with logo tournament so I did clarify that and um if if anybody's feeling misrepresented I I do make an effort to speak only for myself in social media and I will will go look through that again and make sure that I have not attempted to speak for anybody else uh but on that note I got a call today uh from a former mayor Tom Morgan and he said do you know where that logo came from and he told me the story of when Ovito truly did need to be rebranded and it was right after he was elected mayor in the 1980s apparently there were five or six houses right in the middle of town that had boarded up Windows and they all he tells the story much better than me and I'm not retelling it well but essentially they were all sharing the same hose and whenever there was a slow Newsweek the reporters would come to Ovito and talk about uh I think it was like rural poverty was the word he used and uh as a Communications professor at UCF he thought you know really this is not the the aura we want to present for oito so he worked to make sure that the people who lived in those uh Shanty homes were relocated to livable conditions and then work with the city to ironically since we're not demolishing this house they did demolish those homes and then he worked with his students at UCF to do a a branding campaign and it cost the city pretty much nothing and somewhere along the way somebody said well you know y'all need a City seal or something what should it have and he's like how about Citrus celery a mossy oak tree and a steamboat and there we have it to this day the uh City seal that mayor Tom Morgan worked with the community to come up with when they were collectively solving a problem of people living in un ungood conditions and uh you know cleaning up the town so I thought that was a fun thing to share um and he he when he called said I'm I'm not sure what we're rebranding uh let me tell you about a time where we did need to Rebrand and U I'm sure he he will come eventually and share that with us later I also got a a text today from a a church group based out of OVO that is currently in oovo Spain and they sent me a sewer cap thing that mentions that the city of oov Spain was founded in 761 ad so I thought was just kind of a fun little tidbit to share with you guys because we're about to celebrate our 100th anniversary and then just in time for our 100th anniversary um want to give a shout out to Jose Vasquez he is an Ovo resident who is originally from OVO Spain and he has uh been working with uh the consulate here uh who who's also I think he's a professor at UCF at least a visiting Professor uh to bring aeran bag pipes a set of aeran bag pipes to Ovito so they have found a donor from Spain who is in the process of shipping 10 asterian bag pipes which are different from Scottish bag pipes uh to Ido and the band director at OVO High School Zach Ching has agreed to teach people how to play these so I'm looking forward to the possibility of these being featured uh in some of our parades and festivals around town once we figure out how to play them but I just thought it was kind of a neat thing uh all the Ovito and OVO kind of coming together as we're starting to work through what our 100th anniversary will be uh one last thing I uh wrote a letter to the supervisor of elections earlier today and I just wanted to share one statement of fact out of that so you're not caught off guard if this comes up um and and here's what it says reframed in the third person uh it is an objective fact that supervisor of elections Chris Anderson deprived oito residents of the right to vote in November 2022 by failing to put our economic incentive referendum on the ballot he essentially voted no on behalf of every resident of ovido in November 2022 taking away the citizens right to self-determination for an entire year that was wrong and putting it on the ballot in November 2023 did not make it right um my opinion is that if it had gone on the ballot when he was instructed to put it on on the ballot and if he had done his job in a professional manner as as we elected him to do we very well could have had a different outcome to that issue and I just want to make sure that my position on that I made known before but it it hasn't been spoken about from the Das since October 2022 maybe maybe even before when we discovered because we had we had advertised the city had advertised you're going to get a chance to vote on this economic incentive so residents got their absentee ballots open them up called City Hall and said hey I can't find that thing you told us about and that's how we discovered that the supervisor of elections did not do his job um so I just wanted to put that out there and I have I have have done that that's all I've got today okay councilman Paul um I had a quick question like on this agenda today all these um items that we we voted on separately um what determines them from being put on a separate resolutions versus just in the consent agenda could they have all been consent agenda items not the DV well maybe as far as probably the only I would say the only one that I really teetered on was the uh the the amendment to the site development order but when we do subdivision plans we did them under resolution so I followed the same process that we used for the subdivision plan uh because the uh Allen Avenue project the deviations I mean when we had variances this would have been one of the very few ones that you would have seen a staff recommendation of approval because there was a demonstrated hardship uh but because of there were the types of deviations and the number of deviations so we just felt like that we needed to present it to you uh the interlocal agreement no I would not have put that on the U on the uh uh consent agenda just because we needed to update you on where from the March work session so I would not have but that one definitely not but possibly the um the site development order but I just wanted to follow the same process of the original proog got it okay I was just trying to save some time such a good question yeah I think at one point Didn't we have a discussion about for from a policy perspective on our what is it the order of sop we've got an official sop I think we had something on there that says you know if it's related to development or deviations it has to go on a regular I've seen them on both yeah I have too we do I know we did to talk about them the architectural design orders which do have we put those on consent because that was direction of counsil we said look we just want to see we want to see what's going would like uh but traditionally for the when we're talking about the engineering plans we've traditionally presented those all right and um uh council member tuer I I concur with you on the the whole social media aspect of of things um it it makes it very difficult for for us if one once one council member either comments on a thread or puts a post out there the other council members cannot respond to it or it's a violation of Sunshine Law so it puts us in a very bad position so you know all of a sudden you get this stuff thrown at you or or you know council members you know other council members will make a accusation and you can't you can't defend yourself on it and so just because we're being silent doesn't mean that that we're not upset about it or or whatever it's just that we we by law cannot respond to it I think it's bad practice I think it's in bad taste but it occurs and so you know I I just think that that's uh it's something that you know that that that we can't really address and and but you know just keep it on your radar and with that said um I'm sure a lot of you I've told you guys a lot of you have heard I am not going to seek re-election in November um I'm uh um I've been here for November will be eight years I think it's long enough and I've decided that I'm going to move on to other things um so there will be an open seat so if you everybody out there if you're looking to run for Council then have at it and if you got any questions come see me so thank you for your service I know I appr thank you Bob been a pleasure Bob all these years I'm up next I don't have much uh just want to point out again the young man from uh from aita Lucas uh Crawley there he said he was going FSU he didn't mention he's actually going to do Roc there and he plans to serve in the military uh after he graduates so hats off to that young man for his uh for his dedication and uh obviously his his ability that's a pretty impressive benching 340 PBS I can't even imagine and also helpful hands with a great organization that uh has been a a city partner and been really supportive of us for for many many years and really appreciate everything they do within our community um so that was great as well and then of course the chamber with the taste of a veto 30 years it's hard to believe it's been 30 years on how that thing has grown and developed so it was nice to see that and Mr poock again thank you for everything you've done uh it's been a pleasure I have learned from you uh as well so you you taught me very well and uh hopefully I'm as good as role model as you are so but I have more hair anyways Council Britain uh well while we're on the subject U Miss Ross would it be a appropriate if we saw something on Facebook that we didn't like and I think Facebook has a mechanism that you could click on it and say this this was an untrue statement or something and they'll they'll remove it is that would that be appropriate not to address the not to respond to what was said but to to say that this is something that's offensive or Y that would be fine that would not run a foul of the Sunshine Law to do that um neither would it to post something on your own account in in your defense as of course if the other if somebody body responded to yours you couldn't get into a discussion there and it and it's probably best practices unless it's something you really needed to defend yourself about you could post something on your own just so as long as you're not responding and entering into a discourse that not of discussion though we all see each other's Facebook so like if I posted something and someone else did that's a conversation just semi- removed I think there's a way that you could word it to to not not that I'm looking so it's but I could help I could I could definitely help with with that um as far as how to um to to handle in a way that you could still not have to be completely silent but um but still comply with the requirements of the Sunshine Law can I can I ask for a point of clarification I'm going to read into the record what I wrote that I think has offended you and I'd like to know what you think is untrue about it I don't see your stuff so discussion for another day I'm just talking about in general if something's there is there yeah I'm not well you always have to call out a lie uh so I want to read what I wrote and and if you think something is untrue I want to right now can I finish my report absolutely yes go ahead thank you okay that's all I had for that but I wanted to uh Bobby uh it's you don't need to get up just want to tell you good job i' I'm seeing a lot of good work being done I think uh one turn lane is is complete one is almost complete and then we've got the turnl at Lockwood Mitchell hammock to do so those are good signs that uh will'll be uh you know helping the traffic uh flow a little bit better here I'd like to see something in the future on if we can adjust some of the Adaptive uh signaling there's still some left turn lanes that you can't get through them they're just too short and I don't see why they can't extend them for uh the the signal time for another 10 seconds or so but that that would be nice to to see I will share with you that the county is planning on doing a complete retiming of Mitchell hammock in the near future okay so it needs that they're aware that there's a problem out there and they need to comprehensively look at it I think they're kind of waiting on some of our projects to get done okay that's part of the timing very good that's good news and and I've said it before that uh thank you Bobby um you know infrastructure is Perpetual we we we will be doing this forever and ever maintaining our infrastructure and it's important that we keep up with it because once you get behind behind as we've seen in other cases uh you never can catch up so it's uh good that we've got some proactive folks on our staff that are that are keeping keeping their eye on the ball uh back to the uh the tree discussion um Brian would I know we had a a tree uh tree committee citizens committee uh I don't know what they called it but it was a tree committee but would it be appropriate to bring some citizen advisers back in and and look at what what we have uh in our tree codes in our Landscaping codes and make some suggestions on what we can do as far as these deviations go uh we did at one time have tree board and it was part of our uh Tree City USA program it was before we had sufficient funding to meet the criteria of Tree City you could either have the funding or you could have this board and so the in Reas the board served until we had the opportunity to build our budget and get the funding we actually if you remember we we you have you appointed a Land Development code Committee of citizens and business owners and they've been meeting regularly with the staff they're going to go through that uh one of the issues brought up as Mr Mr Pollock mentioned during the item is the is the how we count the trees and you know whether or not a mitigation tree can count toward um toward a tree requirements and so also one of the things that we did in the last in the last update was we initiated a cap as far as the number of mitigation trees that you're required to have because you could get outrageous if you've got a heavily wooded piece of land and so there is a cap of two times you're required uh so yes we are looking at it and the Land Development code committee is is tackling it so we we have a committee in place for that okay all right and then finally uh I didn't get to go to the uh the event but there's a young man named Amari Jones who is uh going to be a boxer I think he's going to the Olympic trials to try to try out the box in the Olympics but he already made it he is in he's going to Paris oh so he's in okay so uh congratulations to him I wish we could have got him up there but the the way I read the the uh the letter that he's probably gone back to training uh to the training camp so congratulations to him and good luck to him that's all I have okay all right future meeting night oh if if I could something you want to share I I would like to read this into the record just just because I'm pretty sure this is what the the issue is because I got enough calls about it I'm sure you guys did too and what I posted was a link to the Avo Community News um article and it said no I am not thrilled about the idea of spending $85,000 for a new logo and I'm not sure the idea I shared in the meeting sunk in when I mentioned logo tournament I didn't mean a precious Hometown contest where all the elementary school kids turn into designs and were forced to pick one I meant a fierce International competition through logot tournament.com or a simp similar service I have guided three logos through this process for the Ovito preservation project and the results have been spoton for 5 $500 a pop uh click over to that page to see them and thank you to Ovito Community news for helping people know that city council is excited about ovo's 100th anniversary and starting to brainstorm how to appropriately celebrate it so if that caused anybody in any consternation or the comments it did not did yeah I I didn't even see that standing I'm glad to hear that okay on the future meeting dates we got Monday June 17th uh 6 PM CRA governing board Monday June 17 6:30 regular session Monday June 24th 5:30 work session and Monday July 1st uh regular session is there anything else with the get a the order should we disclose that we have the work session next Monday which is not up on this future meeting dates that is an executive session it's not a work session but okay it's not a work session but I think we should tell the public that it is in fact happening that we are having negotiations with police and fire that day I think it's published on it is but I wish it was on this list we're not having negotiations with police and fire we're meeting with with meeting with the union attorney yes okay okay this meeting is adjourned e
