good evening if you could stand with me to do the Pledge of Allegiance I pledge to the of the United States of America to the stands na indivisible and jusice for thank you if you could jum in a moment of silence thank you like to call this meeting to order the Avo city council it is April 15 2024 at approximately 6:33 all members of council are present our first uh item is a ceremonial item recognition of Ella ptic pel sorry about that if you want come [Music] up all right I see we've got Mr fosi out here so come on up if you could and we'll let you be the introducer of one of the most amazing students uh I think has ever graced the halls of AO high school thank you so thank you guys for coming to recognize uh Ella pisc for her achievement at in science research she's a member four-year member of our research program at Ovito high school and this past year she was recognized as seventh in the nation for her work training bees to pollinate non-native flowers and that work was a long time coming she individually worked with 3,000 bees and that recognition of seventh in the nation is in the United States's largest and oldest most prestigious competition that has created 20 different Nobel laurates and also earned her a $70,000 scholarship so and Ella if you could tell us kind of what the process was just so we have some clue what you were doing yeah okay so my favorite way to introduce it is that basically I trained honeybees uh and to elaborate on that a little bit more if you're familiar with the process of pavlovian conditioning so the guy who trained dogs to salivate at the sound of a bell um basically the same thing except for I was introducing the scent of the endangered Orchid pra cetta at the same time that a food reward was present to create an association between the two uh and practically what that looked like was putting a bunch of bees in straws and then taking them to uh Mr furio's classroom basically every day um to carry out that process under a fum Hood where I could safely handle the volatiles and then observing the exhibition of the prascus extension reflex which is the insect equivalent of salivating in response to the scent of the plant after conditioning isn't that remarkable guys like who would even think so on behalf of the city Vito congratulations we are proud to claim you as one of our students and please keep in touch in let us know uh what what what the next step is as as the future unfolds but I know you got family and friends out in the audience would love to get everybody up here for a big picture so any we only have two hugs currently but it could thetically be Tech to any okay so we're GNA scoot this away let's go this way and okay oh you're you're going kind of in the middle here and then this side this side come over it okay there we [Music] go congratul congratulations and one more thing I've got to got to reveal about uh Ella is that she is the 2024 Ovito high school student of the year so that's a totally separate thing but let's give her one more round of applause okay next up on our ceremoni items we have the annual comprehensive financial report for the fiscal year ended September 30th of 2023 uh thank you honorable mayor Mr chairman members of council good evening uh what you have uh before you this evening is the uh presentation of the of the uh numbers for uh the financial results results for fiscal year 2023 on the screen right now is just the basic components of the financial statement Kelly Co covered that in the previous meeting and again if you'd like to read anything uh within the report and understand it at a very high level the best uh section to read is probably the management discussion and Analysis the mdna moving on to the general fund uh I'll try to be as brief as possible uh uh last year I took a lot of time to delve into the background and and into into why we are here where we're at this year I'm just going to hit the very high levels if you if that's okay with you but looking at the general fund we had total revenues and transfers in of 43.4 million and we had a total expenditures and transfers out of 41.2 million and that netted an increase in fund balance of $299,000 or $2.1 million uh looking at this presentation right here uh if I can open this presentation right here is very difficult to read but we had adorm taxes of 188,50 uh versus a public safety cost of 8,520 we get asked the question a lot does adorm cover public cover Public Safety at one time it did here in the city it no longer does uh Public Safety cost came in for police about 9 9 million uh fire 8.3 and the difference of about 300,000 was code enforcement going on to the next slide taking a look at what were the variances from budget that uh we dealt with or that were created as a result of last fiscal year looking at the high points um this past fiscal year whoops looking at The Who let me go back looking at the high points for this for this last fiscal year the major variances were really in a couple different places FEMA hurricane recoveries we received about 986 th000 uh hurricane insurance proceeds recovers recoveries we received about 1.4 million interest income interestingly enough um we budgeted um uh 78 $8,000 the previous fiscal year we received $37,000 this year we received $916,000 so a significant in increase in investment income rounding out the total revenues total revenues came to um 30 43.4 million as we mentioned in the previous slide so we had a variance from budget of about 7 million looking at the uh expense side excuse me looking at the expense side the big variance in on the expense side is the savings that we had on salaries and benefits salaries and benefits generated an expense savings of$ 1.8 almost $2 million that money was used directly to offset uh additional expenditures that were provided and transfers out that went for various different uses of police vehicles um uh funding for Grants and a couple of other things uh in addition to that which you'll see here under non-departmental we had a significant expense for the settlement of an item that was right around $4 million and so that's what's in that other non departmental uh category so we had total expenditures of 4.9 and again we had a contribution to fund balance of 299,000 almost $2.1 million going to the next slide uh what does this look like when we compare the uh General fund to the rollovers that we had or carry forwards that we had at the end of the fiscal year we had an ending fund balance by the audit of 16.9 million we had carry forwards of 1.8 million we adopt had an adopted use of fund balance of $184,000 and we also pledged fireworks of 46,000 for a total use of fund balance of 2,44 th000 so right now we're projecting an available fund excuse me we're projecting an available fund balance of 14 million almost $15 million at the end of the fiscal year and this is before the budget amendment that's later on in the agenda that's correct okay so that's going to be an additional use of fund balance that is correct okay of approximately $300 $400,000 350,000 357,000 I believe looking at the general fund net income loss uh again we had a very good year $2.1 million uh increase um in fund balance due to the net income this gives you a history of the last 10 years of net income for the general fund looking at cash balance cash balance has grown from the previous FIS year fiscal year primarily due to income cash balance rounded out at $16.5 million at the end of this past fiscal year looking at unassigned fund balance unassigned found fund balance probably would have increased this past fiscal year but it didn't because of the payout that we had associated with that judgment so when you take a look at it as the total percentage of fund balance it actually dropped slightly from 46.4% to 42.4 5% any questions about the general fund no okay moving forward to water sewer looking at water sewer um uh revenues and and and expenditures we ended the fiscal year with uh $21.9 million in revenues against uh uses of uh expenses and transfers out of 18.2 million or we had a $3.7 million increase in a net position at the end of the fiscal year for water sewer so what create whoops so so what created that that net in sorry not behaving well so that net increase was basically comprised of a couple items we budgeted last year we had $62,000 in investment income this past year we had 1.3 almost 1.4 million in investment income in addition to that we had Capital contributions from developers of approximately 1.4 million uh this p and in addition to that an additional um increase in Impact fees and things of that nature of about 1 $150,000 so we had Capital contributions of 1.5 almost $1.6 million in addition to that we had an increase in income from operations of $700,000 so the anomaly really is the investment income the capital contributions and the operating income basically came in pretty much according to plan looking at the the uh cash balances uh cash balances uh increased significantly from the previous fiscal year would have been right on track but what's included in the water and sewer cash balances right now is a $10 million uh increase due to arpa receipts that occurred in October of 2022 in the fiscal year [Music] 2023 going on to water uh sewer net position unrestricted net position is at $ 21,45 th000 very solid very good net position any questions about water sewer very solid performance for water sewer go back to that cash balance charge yet sorry do that read we have a $30 million cash balance that's correct we have $30 million in cash in the water sewer fund but please bear in mind um approximately 10 million of that is associated with the American Rescue plan act receipts so that's a one-time bump that money is already pledged for specific projects in the water sewer fund thank you looking at storm water storm water was our challenge this past fiscal year uh we had total revenues of 2.7 million uh against uh excuse me we had total revenues of 3.1 million against total expenditures of 3.5 million so we had an operational loss or a decrease in net position of approximately 50 $350,000 in storm water um that's primarily due to the work that was done as a result of uh hurricane Ian recovery efforts our U expenditures for uh cost of sales in FIS school year 2022 was approximately 900,000 and fiscal year 2023 is a little bit over $2 million and all that extra money was in associated with the hurricane Egan recovery efforts looking at storm water cash balances you can see that they decrease slightly as a result of the investments in the hurricane Ian recovery efforts looking at uh storm water unrestricted net position you can see that it also took ahead a result as a result of those expenditures associated with hurricane Ian any questions about storm water no looking at Twin River's Golf Course uh twin Rivers's Golf Course actually had an operating income of $170,000 and they've had an operating income since they have open however this is the first time that they have had an increase in their net position uh to on on the positive side uh it's taken four or five years to get there now but they now have a positive net position of $101,000 golf course cash balances have grown over time to uh right now at the end of the fiscal year about $721,000 with those excess balances that they accumulate as you know they continue to invest in their operations and their uh and uh uh their golf course so very well-run organization any questions about the golf course no going on looking at our cash deposits with financial institutions basically what this graph presents to you is our uh cast position with specific uh institutions and or investment types at the end of fiscal year 22 which is the blue in the end of fiscal year 23 which is the green and what you'll see right here is you'll see a significant decrease in uh US Treasury obligations as you recall in my answer to Mr Slattery in the CRA meeting is we take a very close look at how invest Investments are tracking what the FED speak is doing and things of that nature we do a lot of forward-looking and what we saw with us treasuries is that we weren't get going to get the return on us treasuries or CDs uh that we would if we just stuck with overnight Investments and since our investments are extremely short term to begin with it did not make sense to go out long term because the long-term interest rates much lower than the overnight interest rates and as long as long as the FED keeps speaking in the tone that they're currently speaking in that's going to be the outcome so we're very careful our average Investments of the last year probably weighed in right right between 5 and 5.5% looking at long-term debt uh long-term debt continues to decrease uh we ended the fiscal year 2023 at 9.2 million we started at 10.4 a decrease of 1.2 million uh on the governmental activity side the business type activities was 42.5 uh at the end of 23 at the at the beginning of 22 44.6 all in we decrease total debt service by $3.5 million during fiscal year 23 and what's our our average uh um interest rate on our debt I would have to say that it varies between 1 and 3% but I can't tell you the exact average because I'd have to go back and take a look at the dollar amounts associated with each debt type I would probably say it probably is between 2.5 and three 3% roughly okay next slide uh total Citywide debt 5year outl look uh basically you can see a gradual decline this of course makes the assumption that we do not take out any additional debt between now and the next 5 years taking a look at our financial summary again solid performance for fiscal year 20223 the financial condition of the city is stable we are in constant contact with all the rating agencies that currently we currently do business with which is uh Moody and standard and pores the underlying rating for standard and por go bonds uh this year ended at a at an aa+ we started off at an AA we ended up at an aa+ after additional review the aa+ review is just one not short of AAA and for a city our size to have a rating that what we call a standalone rating that high that's not insured by another entity is extremely uh extremely just incredible so a lot of good work a lot of good decisions have been made to get us to this point and the AA plus rating is very solid the utility bonds uh have an AA uh rating uh Outlook stable from uh standard and pors as well a very solid uh senior lean Debt Service at 2.95 which increased point from 2.65 in the previous fiscal year you're going to see that go up and down from year toe depending year to year depending upon what the perform how how the utility performs with this net revenue um so overall very solid performance for this past fiscal year um and uh with that that wraps up my presentation in regard to the city if there's any additional questions any questions I'd like to uh give some special thanks to Mr Cobb and Mr uh Kelly for uh really just working with us throughout the past fiscal year to get us to where we're at and also to each of the directors because the directors are the ones that are responsible for making the financial decisions that produce the kind of results that we have presented to you this evening and with that uh Mr Matt ganu who is the uh audit um uh uh manager director in charge excuse me he got promoted this past year he will come up and make the presentation on behalf of uh peris gray thank you thank you Mr Bo and a very good job thank you good afternoon thank you for this opportunity to present the audit results uh Jerry did a thorough job kind of going over the numbers so I I'll mainly cover the audit reports and the results of the audit uh my name is Matthew G I'm an audit director with purose gray many of youall previously heard uh Helen painter she is an audit partner with purose gray presented the CRA audit moments ago um also oh we're on the gfoa side so the city participates um in the gfoa certificate of excellence award program and this requires additional disclosure requirements on behalf of the city to um put forth additional transparency above what's requ the minimum requirements it also requires the city to complete their financials in a more timely manner than what the state requires the last year's uh financial report for from the city for 2022 was submitted and did receive the award last year so congratulations for them for that and we do believe uh the 2023 as well is submitted on time and should also receive the award going forward thank you so as part of our audit engagement we actually issue various audit reports the first one I'm going to touch on is the independent auditor report and that could be found on page one of the annual comprehensive financial report um in this we issue an opinion on the financial statements of the city uh it's Management's responsibility to prepare uh fair presentation of the city's financials it's our responsibility as Auditors to issue an opinion based off our audit procedures that those financials are fairly presented and free of all material respects so on page one in the opinion paragraph you'll see that we've issued a clean opinion an unmodified opinion that's the highest level of assurance that we can provide to you as part of this audit engagement we also um issue a report on internal control over financial reporting and compliance that report can be found on page 154 of the of the large bound document uh just to stop you from having to turn to that there's no issues that we need to bring to your attention related to that report that we issued as well um also we also issued a report on the City's compliance with chapter Florida statute 218 415 this is the investment Florida statute uh requirements as um our audit that was performed we didn't have any issues related to compliance with that Florida statute for that Investments as well and finally the last one sorry um due to the city receiving and expending more than $750,000 in federal Awards during the current year a single audit was have to had to be performed on behalf of the city this year um and that audit really focuses more on compliance aspects of the of those specific Grant programs the city had two Grant major programs that were tested this year we issued a report on that as well and happy to report there were no material weaknesses or anything else that we had to report related to that single audit compliance testing these are just some additional estimates that are utilized by Management in the preparation of the financial statements um additional information can be found on these estimates in the separately provided communication with those charged with governance letter um th those just go to a little bit more detail on those estimates if you want to if you're curious what those estimates are that make up the financial statements uh again Jerry kind of covered a lot of the significant events and financial highlights so I don't want to go into detail on any of these um just mentioned the first one there of course the arpa that was mentioned over the course the city has received roughly $21 million in arpa fundings there still is roughly about 16.8 million as of 930 2023 um that is unearned Revenue those funds do have to be spent by the end of the 2026 year um unless any legislation changes that due date um also in the separate letter that we do provide if we did have any uh disagreements with management or any specific instances or issues that would need to bring to your attention they would be provided in that letter happy to report we do not have any issues that we need to bring to your attention um and these are just some upcoming accounting pronoun ments we've already discussed these with the finance department they are well aware of these and going to be looking into any potential effects that they may have on the city in the future years so with that I would like to just take a second just to thanks uh thank Jerry and Kelly um they they they ensure that we have a smooth audit process they're very responsive and they're really a pleasure to work with so and I'd be happy to answer any questions related to the audit process if anybody has any questions do we have any questions thank you okay next up we have the approval of the minutes for February 26 2024 work session and my name is Skyler Ramsey my address is 945 City Plaza Way Oita Florida and uh I had a few questions regarding city ordinance 1406 which is concerned with city parks uh under the section prohibitions elicit prevention of pets and city parks Beyond designated areas uh signs calling attention to this prohibition were recently added to the field at Ido in the park um and while the ordinance was approved in 2007 and I assume active it seemed to be un enforced when it moved in but then the signs were added and I was just curious what change caused the addition of the signs okay Mr Ramy this is actually public comment okay okay so if you cure fore you get three minutes to make your statements oh okay yeah uh signs seem to be working there's less dogs it's kind of a bummer that's my comment and uh also under there is a Prohibition of music playing that um so the prohibition of music playing in a manner that creates a nuisance the ordinance doesn't delineate the manner it prohibits so I feel like you may be putting out a vibe that people can't play instruments publicly um at concern of they'll get a fine for playing an instrument um yeah that's all I got thank you thank you co please stick around for the the discussion at the end if oh for sure okay okay next up I have France petruso if you get to state your name and address first excuse me good evening my name is Francis puso Jr my address is 5694 Magnolia Bloom terce and I I'm here to State um some changes that I think would help small business I own a small business I live in oito and I own a food truck and I've been applying for the Thursday night food truck event since I got my truck and I happen to be able to get it one time because I happen to catch the email that comes out for the invite for the application within five minutes of it being released the most recent one I submitted an application about 30 minutes after the release of the of the application and I was denied saying they were full Mr Beldon uh was gracious enough to give me his phone number we had a great conversation talking about Solutions I'm here for a solution and I feel that um one way not the only way not the best way but I think one way would be that if we were to put a a one day or a 24hour lead time like if you'd got this month anybody who applied the next month that wasn't here the previous month would have first and then if you did have the last R in 24 hours later you can apply and if there's still openings you can get it to me if it's filling up within 30 minutes you have enough vendors it's hard being a small business we're talking about millions of dollars here we're talking about making a couple hundred dollars on a on a Thursday night like it's a big deal to small businesses and to have more than um a an opportunity more of an opportunity to be able to do that I think it would be it would benefit a number of people not just myself but everybody involved I think it'd be much fairer system and um that's all I got great thank you thank you is there anybody else in the audience that wishes to speak tonight saying none I will close public comment we're on to the Senate agenda what is the favor of councel make a motion to approve the consent agenda as presented second I have a motion a second any discussion um on U item number six um the midyear budget um we're utilizing fund balance to to make that make everything balanced um that's in addition to the other fund balance that we just saw that we were utilizing I'm just getting concerned because we're basically Bal ing our budget with the fund balance um it is higher I mean we're at that 36% I believe it was was showing um but we need to uh to be a little bit more careful with it especially when you know and I'm I go back to this all the time um when we're you know with these filled maintenance and some of the other stuff that was basically taking up that fund balance so um it's just it's just a a note or a thought okay and I I share that concern um and grateful for staff responding so quickly I I was my knee-jerk reaction was I wanted to pull a lot of stuff off the consent agenda and they were able to address a lot of those concerns um it's not ideal using the fund balance I think that that is our emergency fund uh and we are slowly whittling away at it uh and we're not going to get another 21 22 million dollar influx from the federal government so hopefully we can figure out a way to either spend less or bring in more in future budget years and I I know we we' talked about this before we need to kind of come up with a a range for the fund balance and and maybe some set things that that happen if you get you know to you know to a the bottom of the range or once you get to the top of the range whatever that range you know whatever that top might be um I did talk to the Auditors about that um uh when I was having a discussion with them just to see you know how much fund balance is too much because we don't want to basically over tax our citizens but we do want to make sure we have enough in there for for those those Rainy Day events any other comments okay so we have a motion in a second all those in favor say I I opposed okay cons agenda passes we are on to public hearings ordinance number 1742 Recreation and Parks Advisory board Mrs Ross could you read the ordinance by title only which I think I just ordinance number 1742 an ordinance of the city of oido Florida creating a Recreation and Parks Advisory Board providing for the powers processes and procedures pertaining to the board providing for a legislative findings and intent providing for implementing administrative actions providing for a savings provision codification as well as the correction of scrier Errors providing for conflict separability and an effective date great thank you Mr Cod can you give us a background uh thank you Deputy Mayor Mr Beldon went through a very extensive presentation at first reading so tonight we're just going to give you just a summary that uh this is a request to create a Recreation and Parks Advisory Board uh this ordinance will sunset the former Recreation and Parks advisory committee uh it will establish a new board as an Advisory Board much like with your land plan agency in your public Arts board and uh other boards that do provide you with recommendations uh this board will primarily concentrate on Recreation and Parks programming as far as uh maintenance Capital items help with budget uh those types of different things uh the board will consist of approximately seven members uh they will be uh all the members will be City residents and they uh they will be serving a three-year term the first members of the board will be set up in staggered terms in other words there'll be a few that'll be for one year they'll be few for two year a few for three year each of them will receive a three-year term or one year after they when they come up for Renewal then they will receive a three-year term and they will be staggered from that point on uh there if a member misses two of three scheduled meetings uh that will be considered a resignation and uh the board will meet at least quarterly however much like with the CRA the CRA is required to meet cly but sometimes we have a need to meet monthly and so we do that and this board will have that opportunity as well all all the meetings of this board will be public meetings staff recommends approval of ordinance number 1742 and it's recommended tonight that you conduct a public hearing and adopt ordinance number 174 okay so this is a public hearing we'll open it to public comments I have no written requests is there anybody here that would like to come up and speak on the subject seeing this has been a long time coming I I think the last time we we uh convened the parks and recs committee was when we were updating the master plan it was in 20062 2007 so um I'm looking forward to this reading of the ordinances or number 1742 no I'm sorry ordinance number 1743 zoning map Amendment for 82. 64 Acres from a ag agricultural to I2 industrial Mr Ross can you read the ordinance by title only an ordinance of the city of oido Florida amending the zoning map of approximately 8264 acres of land generally located approximately 601 ft east of East Broadway Street and approximately 1,821 ft west of Lockwood Boulevard from agriculture a to Industrial i-2 providing for legislative intent implementing administrative actions a savings provision scribers errors conflicts and separability and providing for an effective date thank you Mr cob can you give us a background uh yes thank you Deputy Mayor up put on your screen you'll see there's a location map of the property that shows and this is actually property was formerly owned by the city uh when when we did our comprehensive Plan update in 22 uh we changed the future land use designation of this property from uh public to Industrial and so the current future land use designation is in is is industrial uh mine if you could go to the next slide please uh the current zoning designation zoning district is agricultural now the agricultural zoning district is not compatible or not compliant with the with the future land use designation of the conference plan so the request tonight is to change the zoning to the I2 zoning District uh when you do a zoning change the first question you ask is is the new zoning District compliant with the comprehensive plan in this case yes indust I2 zoning is allowed within the industrial um future landage destination the next thing you look at is is it compatible with surrounding area which you can see what it doesn't shows the area to the north is also an industrial park but mostly you're surrounded by public uh which is our city parks a veto sports complex and uh Shane Kelly Park as well as the city's Public Works facilities are also located there part of the Public Works facilities are already zoned I to uh there is some commercial zoning which is the former Del Lorenzo property actually before it was zoned to C2 it was it it was I2 as well but it is compatible with surrounding area uh then the next question you ask is the list of permiss uses compatible and when you look look at the uses that are there uh it's it's pretty much compatible as well so tonight this is first reading and so tonight is we ask that you schedule a public hearing for May 6th 2024 at here in the council chair thank you is the applicant president would you like to say a few words okay thank you is there anyone in the audience that would care to comment on this okay seeing none we'll close public the comment what is the pleasure of council I'll make a motion to hold a public hearing um for ordinance number 1743 on May 6 2024 second all right I have a motion a second any discussion I don't think this really changes anything does it Brian that's been a a use for I don't know how many years that I can remember but it's just a clerical thing actually it's always been a concrete recycling plant up there even before the city bought it uh what they're looking at now is to be able to do to be able to take that recycled concrete and turn it into cement so that's that's the reason for it thank you can that also be done with uh i1 zoning um I'm not exactly sure if it can can or not I'd have to I'm going to have to okay but but that was the request so the request is for I2 and we can't spontaneously change it I'm just curious we can definitely look into it and see yeah one one thing that I I am a little bit like so as not to surprise anybody at the the actual public hearing I I am a little bit concerned about the things that we may not Envision happening on this property as a result of subsequent owners so I I do want to make sure that that we fully vet the potential things that could happen there and I know it is limited because it used to be a dump uh and and you can't you can't dig down like in a normal place you can't do a lot of things as you could on a on a perfectly clean piece of land um but I'm hoping for the the hearing though we could make sure to really ahead of time ensure the public is aware of the worst case scenario that could happen just so we have a really good process as we consider the I2 that regards though isn't our 2045 comp plan I2 like future land use so we've already kind of hashed that out going through our comp plan recently so it's in line directly with doing exactly that did our comp plan have the zoning map Amendment it just had the future land use which was industrial right which is an I2 it could be i1 you can you can do both uh in in the uh in the you can use both zoning districts are allowed within the comprehensive CL yeah yes M okay so the motion on the table is to schedule public hearing for Monday May 6 of 2024 all those in favor say I I opposed okay scheduled a public hearing okay we are on to resolutions first one up resolution number 4442 d24 RightWay vacate Nursery Street Mr Cobb can you provide a brief introduction yes deputy mayor uh this is a request to vacate a portion of Nursery street that is located west of uh Geneva Drive you can see there uh there there are two maps there and the reason there are two maps there is because the original request came in requesting the area that's in purple that is uh the east west rideway of Nursery Street between Lots 36 and 37 and then also a portion of a North South unnamed rideway uh that is between Lot 36 and Public Library property uh staff when they went through the evaluation and this when we have a RightWay vacation staff goes through a pretty extensive evaluation and each of the Departments take a look at it we try to determine if there's any City Utilities within the rideway we also contact utility companies to see if there are any other utilities within the rway as well uh once we finished our our assessment we we came back with a recommendation of only uh vacating the portion of Nursery Stree that is between Lots 36 and 37 the applicant has they they own Lot 36 and my understanding is they wish to build a residential structure on the property and uh this will give them the additional uh area that they need to build the uh to build the the residential building so we've recommended that we're recommending staff is recommending that we uh vacate just that East West portion of Nursery Street there my understanding is the applicant has agreed and so it's recommended that city council adopt I don't know if there is a legal way to allow a deviation of setbacks or something to make the property usable but also not give it away and retain the right to potentially connect across the street and come in the backside of the the library property because there there are discussions about relocating the library it's too small if that were to happen and Sim County were to sell that and that somehow we're redeveloped I I guess we need to then look at what's the future land use adjacent I mean it's like this whole Rabbit Hole so at this time I I do think it would be premature to let that go I think a better path forward to allow uh these guys to use the property is is something other than vacating the land and I guess that's a question for for our development services are these other paths can can you let us know if these other paths are potential potential options sure good evening um um mayor uh deputy mayor council members so this property is very challenging because it's it's very it's a small lot it's a remaining lot right that I think it was um um U had a imminent domain process at one point point so this is the remaining lot it has right now three um front edges is the entire triangle or is it just the it's the triangle below the purple area that's the that's the the lot so the lot is the triangle or the lot is the purple I thought it was the lot was the purple no the purple is the vacation right away vacation the vacation and his the initial request was the whole purple area on the left and staff agreed to the only the east and west and not the the North and South so we always can we can always deviate from setbacks so there is a process for that but this one is so challenging that even deviating you know would not give him um this lot any remaining land for you know proper development so am I understanding correctly that you are wanting to retain the potential connection to the library the south north connection yes okay that's okay I I was misunder staff presentation Deputy Mayor we skip 14 I thought there was another resolution sorry skip 14 okay I was I apologize resolution number 4446 d24 work order 24-1 197 strategic Plan update Mr cob will you provide a brief introduction uh yes Deputy Mayor I will take this one uh the uh this is a request for city council to approve a work order with the um East Central Florida Regional planning Council to uh to a to prepare a strategic plan actually to update the city's existing strategic plan and the we had a discussion with with you uh at your last um at your last meeting and the um Direction there was concern expressed about the facilitated uh the facilitated Retreat uh this process has three steps the first step is the interview survey process where they will meet with staff and counsel and to gather as much information as possible to start the preparation of this strategic plan and then in the second phase of of the um of the process our the facilitator will come in and conduct a facilitated Retreat uh Council would Express concern about an all day Retreat and having so what they've done they revised their scope to have a The Retreat let go over a period of three evenings and so they would meet with the city council over the three evenings and then meet with the staff the directors in a leadership uh training uh during one of the days and so we asked them to look at the cost the cost the change in cost was negligible I think it went from $26,000 to $330,000 uh so we recommend staff recommends that uh the city council approve the work order with the East Central CL East Central Florida planning Regional planning Council and to adopt resolution number 4446 d24 thank you Mr cob I do not have any requests to speak is there anybody in the audience that and this is a request for city council to approve a new public art program named art in the chambers and the purpose of this program is to give um different groups in the Ido community and surrounding area the opportunity to display their art here in the chambers in these two sidewalls um at the at City Hall um the idea is to contribute to disseminate you know art in the city and also to allow for the residents the opportunity to see you know the display of art of the local community um the public art board recommends um that the exhibition occurs uh every um quarter so four times a year and during um a period that will be negotiated depending on the artist um um you know agreement um the city will advertise in in the website so we'll invite you know applications and the public art board will then choose um the artist or the group of artist that will display uh will be able to display their their art here in the city um there no allowance to be paid to the artist so we are just you know allowing them to um to display here in the in the walls of city hall and then we'll also advertise in the website the scheduled exhibitions and then um also providing a bio of the artist so that people can can know you know the the local talent we have around um the area um staff recommends that City Council delegate to the city manager the approval and execution of the loan agreement because we will have to have an agreement with the artist um so that they can have uh that they can display the art here during in the period of time that we'll agreed upon um as any other public art in the city um the public art board will have to follow the guidelines of the code of ordinances in accordance to the uh appropriateness of the art to be displayed here in the city so we already have guidelines in the code of ordinances for that I would like also to recognize that we have um some um public art board members here tonight and if they can raise their hand to be recognized um and they all um approve uh the recommendation of resolution 4454 d24 unanimously staff agrees with the recommendation and I am um here to answer any questions you may have so the art will be here in the chambers they will be here on those two walls on those two walls and how often would it rotate so um the idea is to have one exhibition per quarter per quarter and the duration will depend on the on the negotiation because this can be um uh commission to an invitation to a specific artist we can reach out to colleges to schools to different groups in the in the area we discussed in the public art board that we would like maybe to start with staff and staff uh family members the same way as um the county did once or or had an annual program for that just for us to learn the process and then we would have you know open for the community to anybody that is interested could um um uh apply and then the public he board will make a list and decide who would be the next exhibition okay and Y board would be the one reviewing them and then making the selections we thought it would more be more flexible that way unless council members would like the council would like to have the the approving authority over the exhibition do City residents get priority over non- City residents we never thought about that you know it's it's it's going to be hopefully we'll have a lot of applications but we may in the beginning may be slow so we don't know okay but we never thought about limiting to only residents M okay I mean that's just a thought I mean if we're displaying the art I would think that passes okay item number 16 resolution number 4455 d24 approval of commission for a Water Co color painting and Pla to honor Joe Lee at Twin Rivers Golf Course as part of the new public art program to be called ovo's homegrown Mr cob can you give us a brief in well never mind I guess I see who it isation mayor so again our second exciting uh program so this is a request for city council to approve the commission of watercolor from car Dam and a plaque to honor um Mr Joseph leis Lee um who who was the architect designer for the Twin Rivers Golf Course and and this would be part of a new program to be called ID's homegrown um so um last year council member Britain came to the public art board with the idea that um um the public artboard could discuss um way way to pay tribute to Mr Jolie who not only is the AR the landscaped architect for the golf course um but has you know designed um more than 200 uh golf courses around the country and um um around the world because he did some work internationally but he's and he's also an Ido resident or he was an ID born um native idian born in 192 1 so the board you know liked the idea and after you know um um some discussions decided to commission a watercolor paint from um car Dam to be displayed inside of the golf course uh clubhouse and also have a plaque the same way we did for R Lake Park displaying the watercolor you know the main you know features and with some narrative um describing the contribution of um Mr Lee um the um cost of the project was decided to not to exceed $5,000 um so the watercolor portrait um measuring 16 in by 20 in will be um the cost is $800 the plaque is the most expensive portion um and if it's going to be in bronze so we'll try to bring the cost down the one in the Round Lake Park was in aluminum so we are going to to you know research um the material to be used on the plaque and that would be uh around if it's in bronze $4,000 a frame $200 so the um board um decided that the the cost should not exceed $5,000 uh following City council's approval if you all approve um this program tonight staff will negotiate an agreement uh with Mr uh Mrs them and again the City attorney will be the one um crafting the agreement um there is a budget amendment um to be able to utilize the $5,000 from the public art uh fund um what I wanted to say is that in the discussion there was one there was the there was the idea that this would be the first um uh uh recognition of local talents in the city and they create um one public art board member gave them name of aidus homegrown as this program which I thought was very interesting so we hope that this is going to be the first of a series of future um recognition of local talent and the public art board again U recommended the approval of uh resolution 4455 d24 unanimously staff agrees with the the with the recommendation and I'm here to answer any questions you may have I good I find it interesting that the actual painting is only $800 and the plaque is 4,000 yeah I know I would have liked to see it the other way around to spend more money on the actual artwork and you know and and less on the on the plaque but um I mean I'm I'm fine with the $5,000 I just wish you know I mean you know either make it larger or you know I don't know but that's a lot of money for the plaque itself um you know and with the artwork being so less expensive any other questions okay good oh thank you I guess I I would like to speak a little bit about this uh again the the plaque I was envisioning something like what they have at uh May Fair which is a 100y old course and they kind of give a history of it uh Teresa and the and the staff looked into a couple different options uh you know a simple stone like they have at Round Lake Park for uh Martin Luther King with a just a a tribute to him and then the the water painting would go inside there's a a really nice water painting in a book that was written about Jolie and Teresa if you can put that in council's office and let folks look at that but uh he was born and raised here I think he's related to the Lee family no no kidding um designed Bay Hill Golf Course uh Twin Rivers tusco Willa uh interlock and golf course and as Theresa said 200 courses across the world so he's he's quite renowned he passed away I think in the early 2000s uh and his wife has Sub sub subsequently passed away and his stepdaughter is running an Educational Foundation in his name so I'd uh when we get this going and if we approve it uh like to invite her to come down and be part of manager's report uh thank you deputy mayor uh just want to remind you that Thursday is our volunteer board appreciation dinner at the at the cultural center I believe around is it 6 PM M Rivera 530 5:30 5:30 just want to remind you about that also next week I believe the 23rd our Mobility plan consultant Jonathan PA will be conducting his uh extraordinary circumstances workshops I believe it's on Yeah Tuesday the 23rd he's going to do two workshops he'll do one in the morning and then he'll do one in the early evening as well uh so just wanted to bring you up to date on those two items and that's all I have Deputy Mayor great thank you C attorney's report thank you Deputy Mayor I just one thing on the an update on the pace lending matter um we had talked about enacting an ordinance um creating some some disclosure requirements for the pace loans um you may already be aware that the um a bill has passed the senate senate Bill 770 I believe um yes 770 and it's passed the Senate it's waiting on the governor's signature and it would have put in place some loan disclosures and and additional safeguards to protect consumers so I I recommend that we wait and see what happens with that bill before we do anything on our own accord okay that's all I have great you thank you you well while we have you um in your report can you talk to the um people's gas oh yes um so uh at the public hearing the Council made some revisions to the agreement that we had been negotiating with people's gas for the new franchise and um in in my opinion it was it was a um uh not a significant revision um the the revision to changing the favored nation provision from Regional to Statewide people's guest has objected to that and they said they won agree to it um so we provided them with three options um they can come before the council to request that the ordinance is repealed and um and a new ordinance enacted in its place um they can appeal the decision to the Circuit Court um or they could sign the agreement as as revised by Council so we're waiting to see what they're what they're doing Mr Po on that okay thank you so that could actually take us to court for this um they they could appeal the decision to the the Circuit Court that's one possibility although I think that a much more practical um course of action for them would just be simply to at least they need to exhaust the the the the potential remedy of coming to the council and requesting the Ral before they do that I think they'd be hardpressed to to sue before exhausting that remedy first but our current our current um agreement that's that's expiring uh has a Statewide favors Nation CL Favored Nations clause in it that's correct yes so we're just asking I mean basically we asked for what we currently have and they asked for it to be longer a longer duration and we granted them the longer duration so all we're asking for is the same thing and we were able to give them the longer duration so right all right okay I'm sorry and I did I did convey that it would have at your request that we wish someone had been here present at the public hearing to answer your questions about the revisions because as you recall um no yeah they weren't here right okay anything else no thank you great thank you council member poock all right um food trucks um Mr Beldon is there a way that we can give City I going back to this whole city resident thing again if the business is licensed in the city and the the business owner is a city resident based off of sun bids or or whatever if they could have 24 if those people could have 24 hours ahead of time to register and then whatever slots are left can be taken up by non- City residents that's something we can always look at sir um I'm currently in the middle of reviewing the current procedures and possibly taking back I've spoken with a couple of council members over the holidays on drafting up an sop on this procedure so that way everyone knows what the criteria is what the details procedures are and then it would also create an opportunity of um consistency but also opportunity for those that don't have a chance to be a part of the current or the the most previous event and then they're not going to every event or possibly um maybe come up with a higher fee for those that are attending the more regular events but yeah City residents similar to Athletics programs and the recreation parks program should have first preference and I I just heard you say higher fee I don't think we should be throwing a higher fee on people making barely any money per event anyways but I do think the issue here is rotating vendors and that's what we're trying to do is create opportunity for those and I also want to throw out with us redoing our website um I think this is a huge opportunity to put this all public where we can say this event is going to be having applications this time and then say as the events fill put it on our website publicly so you can see who's coming in and how we're rotating yeah one of the challenges one of the challenges we faced is when we advertise the events or the call for vendors um they have been at different times of the day and something that we need to work on is being consistent with the same time when it's released if someone is working a normal 247 job or Monday through Friday job and and they miss that call to vendors they miss on that miss out on the opportunity and when they see that email they scramble they're 30 minutes late and they're on to the next event so that's something we're trying to be more consistent maybe do that at 5:30 or 600 p.m. in the evening versus in the middle of day when everyone has a chance to see that that slot but I think like even even that you know we can we know who was at our last event so we should be rotating so the next people get a chance before they do I agree with all those statements yes we still oh sorry I was just saying so when would we see some of these changes I'm currently working on some drafts right now I'll run through staff and then take it back to maybe not this month next month as soon as I can I I hope it's very soon I I don't know if you remember we had discussions about this as early as 2019 and at the time you you were not in this position and there was significant push back and doing exactly what there's consensus to do right now I am really glad to hear everybody on board with the idea of making sure that our OVO residents who have a veto business licenses the there is environmental value to that there's Community value to that everything about it makes a lot of sense and we do that for all of our programs as it is so it makes sense to keep that consistent with us that's something will that will definitely be a part of it as well as all the other comments that y'all made tonight too so by May the May food truck Thursday they might already have booked those it's already booked that's that's pretty two weeks I think isn't it booked out like months in advance that that was I told at least at least a little over a month yeah so we can we don't have a lot of events in the summertime except for the food truck Thursday so my hope is to have something in place before the summer all right okay perfect thank you thank you thank you um all right the the next next item um that was brought up was uh ordin or uh city ordinance 1406 um can you is there consensus to um put that as a a future discussion item I'd like to see the music part as a discussion item and the dogs both of them yeah yeah how could we how can we have barken brew that have a ordinance that prevents us from having dogs on the field well what it is it's article it's chapter 33 three of our code of ordinances and it governs all the regulations for the conduct within parks and the what it says is a lot of times it says it unless there is a City Event so if we're having if we're having a special event like a bark and Brew then that event allows us to have the dogs on the streets and everything like that uh the I'm am assuming that the the question about the signage was about the uh no no pets on the lawn signs that aren't new uh they actually they've been up since we opened the park but somehow a bunch of them were confiscated and disappeared and so we replaced them is what happened they weren't necessarily new they've always been there um and so yes the idea was to keep the pets to the uh in the in the dog park itself but uh it's the but yes and we have when we have an event we are allowed to the the ordinance the chap 33 allows us to to allow the pets in different areas but it it's it's still okay to walk your dog on the sidewalk correct yes okay it's just on not let them run on the field all right okay and and while we're doing those two ordinances can we bring back up the open container one if I can have my expanded uh my expanded boundary that'd be great we do have a navigational Waterway out there don't we it's got I saw the swamp boats now what what about the music were you going to bring up the music yeah I was going to yeah the music yeah but but actually I'm I'm serious about the the the open container one um but people are doing it already I know I just I I mean that's the thing is people are doing it already and and yet we you know if for me we either enforce a rule or we don't we get rid of the rule and and so you know I think we need to to bring that back up especially with all the I mean the food factory is now there um you know and I I you know I think that it's something that we should be able to do around the park so we can I um Mr Kelly has has kept has kept up with all that it it's really it's a State Legislative uh it's a state statute that we have to comply with yes we do have to have a navigatable uh body of water I know that was one of the challenges we don't think solary Park will qualify but um there's a possibility that Senator Lake might qualify because we do have the paddle boats uh so but yes there is there's a statute we have to we have to meet are they both storm water ponds I I I just I don't know how we're gonna I honestly I I mean the the definition I mean we need to look back at the definition because from what I've been told the definition is pretty Broad and there's a lot of things that can be considered you know I mean something that's really small it doesn't navigable doesn't necessarily mean you can put a boat on it it it just means it's a body of water pretty much I mean it's pretty vague I don't I don't know if it's that General but uh but yes we we we we'll put it on to have it as and can I just add if we bring back 1406 can we make sure we notify the gentleman that came out tonight when that's going to be on the right I'm next up uh first off uh I was able to participate in the tour of force with uh our police officers they had uh the largest contingent of any police uh Department uh to come out for that that is actually the tour to force is a awareness ride for Fallen Law Enforcement Officers it's a 5-day ride they start in North Miami and each day they they take a leg probably around 50 miles and work their way up on this particular Friday we were from tville to Daytona Beach Shores we had 17 U members from Theo uh police department we're well represented um I think probably next probably would have been uh simal County uh the crazy thing is there is not another city municipality that participates in this um um it's just it's amazing I Know Chief you said you guys are going to work on Altimont with deputy chief Foley maybe they can do something there get get more people out there it's a great awareness it's no cost to the city because the police foundation actually picks up the uh the fee and and also the the uniforms and the travel expenses so actually the foundation actually is behind that doesn't cost the city but it's a great event uh the full day um it's it's funny uh Sheriff Chitwood from bluch County did ask we Sher Li out was U so we also head to vucha County helicopter as soon as we crossed over to County Line come up and uh take pictures of us so but it's a great event for a great cause uh so I was thank you for the invite from uh from your folks I really did did enjoy that um that's a that's a good first piece of artwork you and your bike outfit yeah yeah that yeah yeah yeah I put that right next to my head shot that was that's good so uh second thing is Mr brute again thank you for the presentations uh tonight and your finance department again uh for Life so uh that's a big event for the city city employees that's our our one philanthropic uh charity that we uh donate to which is the American Cancer Society so we're looking forward to that I believe it's sold out I'm not sure I believe it is yes okay um tomorrow tomorrow I think is the Ovito Women's Club no or is it Wednesday it's Wednesday Wednesday oo Women's Club philanthropic and that that's a a cool event because they they give out scholarships uh with the money they made from uh great day in the country which we support too um we got the board appreciation dinner on Thursday Brian men mention that and I think that's it I've got a Tri County meeting on Thursday and I'll report back how that goes but that's it great thank you Council M tuer so last c meeting was in Sanford um and they had rescue Outreach Mission come out and I know some of us are familiar with them but they are the SEO County's only homeless shelter in the entire County um so if we have homeless people here we bring them there um they completely fundraise their entire every year um and they had some really interesting stats that I thought I'd share with you guys so they did say the average rent semal County right now is $1,800 um that has gone up by about $700 over the past four years they say for every $100 it goes up it increases homelessness by 9% um and they also threw out some interesting stats on homelessness and how it's misconstrued sometimes to be related to drugs bad backgrounds um poverty but they said none of that has proved true and it's all 100% based on the housing market um so interesting stuff I'd love to have him come out here and talk to us and he did also mention that um he he kind of threw the ask out there because no municipality in Seal County donates anything to that um shelter which we all utilize so he was asking for10 to $5,000 for City saying that would go long way so I would like to discuss that um at Future meetings and see if we can have him come out and talk to that um the other thing is the next meeting is May 1st in oito so if you guys want to come it's in city hall right here so I know sometimes you guys like to come to the local one so that one's coming up do you have a topic um we are going to be talking about the CRA and the the downt master plan there so um if anybody else has another topic we'd like to throw out feel free so but that's all I have great bamir I am having serious second thoughts about vacating that right of way and I can't pull up the G Slayers but I'm hoping uh somebody from staff may be able to who owns the underlying rights under that land do we know because as we're talking about food trucks and affordable housing at reports I'm looking at this thinking we we essentially this guy came and he had x amount of land after the vacation he had four times x amount of land so we gave him three times as much land as he started out with if we were to reconsider that and I need to review if I can make a motion to reconsider now but I'll tell you the reasoning we we gave away 50 feet of land roughly and I think that's probably wide enough to fit in a food truck or a vegetable stand if any of you remember uh the veggie stand that used to be by sod King I went to it all the time and it's on the way to everywhere we keep talking about walkability and integrating uses and things like that this of all the places there but before he closed he actually I I was kind of working with him to to see if there were other possible places he could go and as a food truck in a ride of way actually is a possibility so now that all this is like clicking I and I I regret that I read the maps incorrectly but I'm glad because now I can make a motion to reconsider and investigate more whether the public would benefit more by retaining that land because it's a lot of land we're ask before you you make the motion though can can Mr Cobb or um [Music] Miss now I want to say gr um Miss Ross uh just talk to that because didn't doesn't he own he owned the property but the RightWay was on his property but we can still use the right of way and a legal use for a ride of way is to allow a food truck to operate in the RightWay it's an interesting idea I think I'm not sure um uh who the title holder of that segment is I'm not sure if the city had easement interest in the land in the right of way or title interest I'm sorry I I'm gonna try to find it right now well I would think that I mean if he's going to be able to build on it that he would have he would have had presumably he owns it he owns it the the right of way set for I mean that that's a critical piece of information that we should have been provided prior to taking the vote so for that reason and at least that reason I think we should reconsider to find out who does own the underlying right to that well do you do you know Miss K or Dr k sorry so [Music] um he owns the triangle he he owns the remaining of a lot right what it was in purple is right away we'll have to investigate how it was dedicated to the city so it was probably through a plat so that is City's property so how own underneath because if we own underneath and he's going to build a little house well we might as well say you're out of luck having bought this for next to nothing and we're going to build a tiny affordable house instead of you and yeah well well so right now it's not a lot it's it's right away but we could make it a lot if we own the land underneath I mean that that is a key question uh if we do not own the land then we could turn it into a food truck little Haven with a little creativity if we do own the land it's possible we could put a pocket park there or a tiny house including a a thing that can go through the middle you like a little in in my understanding and I don't know that half of that's right away would come to him right and the other half would come to the other property is that it may that that's likely the case but it's not 100% guaranteed that's why I always say it's just whatever happens happens once we vacate and no no promises no information provided to the property owner you need to go to a title company and have that assessment done through that Avenue I know with railroads have goes to the property North half goes south when well if if both slots dedicated right so it's kind of like the thing with the the py development back here so even though the city owned you know the three acres or whatever it was the underlying property was never owned by the city so the city could not have built anything there or you know it's it's another one of those whacky legal scenarios that could could offer a really interesting opportunity for this part of town so with that uh I would like to make a motion to reconsider H sorry oh I guess still my report time uh the last thing remaining that hasn't been covered is we have an amazing Public Works uh Team Member Chaz Connelly uh he made some magic happen overnight the American Legion showed up the the Marine Corps League was meeting at the Post building and the water there there was an issue with them connecting to to city water and all of a sudden they discovered that they had no water and the next morning a group of people was being bused in from one of the local retirement homes and everybody was like oh what are we going to do you know there's medical needs there's you know we just need running water and they showed up the next morning and magically everything was connected all of the the challenges that had been noted and on on a on a sheet of paper on the door that said this is why you've been disconnected they were all cured and it was Mr Connelly who made this magic happen and let this nonprofit open their doors and show Hospitality to some of our retired veterans here in the community so I want to give them a public shout out because that was super amazing it was a surprise and so thank you to Mr Connelly okay 20th 6:30 regular session on Council I have one thing for the good of the order am I legally allowed to change my vote on the vacation at this point because it's still within the same meeting I I'm not sure I'm sorry I have to if it is possible I would like to change to a no v no vote on vacating that ride of w the applicant's not here to defend himself it doesn't change anything from for the outcome but I just I want to be on the record as is thinking that we we've missed an opportunity to do something creative okay anything else for the future of the order or the order future order the
