guard here in the city if everybody's probably come through and at school time they'll see me out there waving anyway uh I'm still talking about these paper bricks that are on the corners of Ovito Boulevard and not OVO well oo Boulevard and Broadway and Lake Jessup and Broadway I do do two turn turns of post during the morning and both of them have the same F Falls with these paper bricks and and uh again they're pretty but they're not functional they sure aren't safe cuz they catch you when you ain't looking and they will put you down and I know from experience and I watched the lady tonight riding inner wheelchair that they're rougher than sin out there for these are not something that is functional and also the one thing that I didn't bring up my first week here was the fact that those are deep breed and they absorb the heat they bring up the heat in this afternoons and they do make it hard on you so I've seen that problem as well so I realize I'm a day late and a dollar short but uh you really need to take a real consideration about your paper bricks that you've got with on these Corners that they're not really safe they're not really functional and they sure aren't real cool on your feet in the hot summer days the cement is smoother you don't have 40 million chances of falling with that and uh that's the heat on that cement is less than the red dark red paper brick so anyway that's my story and I'm sticking to it because I'm working out there for an hour in the morning an hour in the afternoon on both corners and it's hard on the ankles knees and hips and especially if you fall on a hip okay so that's my story and I'm sticking to it thank you very much for listening and please uh get to together and do something a little bit different for what safety a vote all those in favor say I I I opposed okay next up we have item four which is resolution number 4532 -24 reg tribute at the center Lake Park standard operating procedure Mr cob can you give us a background uh yes thank you deputy mayor uh this is a request for Council to approve a standard operating procedure for the operations of the veterans tribute at Center Lake Park there's also a request to amend the 2024 2025 administrative fees to include uh a to incorporate fees regarding the operations of the veterans tribute uh this when we used to be that the veterans tribute was primarily uh funded and maintained through the friends of avido and when the prins Vito disbanded the city took over the operation the maintenance and the funding for the uh for the veterans tribute well it also took over all of the uh requests for to be have names placed on the different wall on the wall of service and so uh or the wall of honor and so the staff wanted to put together a a standard operating procedure to guide them as people are applying for uh to have their names placed on onto the wall and they also wanted to set up guidelines for the maintenance of the of the of the tribute and they wanted to establish uh a a fee for getting your name placed on it then also if we needed to replace uh the the um the the plates that are on the wall of honor and so that's what this basically that's what this operating this standard operating procedure does it set it establishes the eligibility uh for someone wanting to put their name onto the wall or put a name of a of a family member onto the wall and it it gives the staff the criteria for for uh doing that uh that's in a nutshell that's what it is uh we recommend that the council adopt resolution number 4532 d24 okay what is a pleasure of council I move we continue resolution 4332 d24 till December 2nd so we can have time to talk with the American Legion and and other people about how we might be able to make this more um uh more of an honor and less of a feat and other things all right I don't hear a second so I will take another motion make a motion to approve resolution 45 32-24 second all right I have a motion a second any discussion now we can always revise this in the future can't we so and I I I did talk with some members of the Legion right before this and and I I didn't hear any issues brought up so I'm definitely open to hearing about that in the future but for now it seems we're good I'd like to get in place now do we do we have an opportunity for public comment after the motion I would I would hope it's not really part of the the agenda but I mean do you have somebody that said they wanted to speak think so uh yes all right hi Larry Kane 492 Rochester Street Ovito Florida first vice commander of American Legion Post 243 the only thing that I have concern about is the fee for getting your name on the wall we have a lot of people that live on Social Security they're low income and it was my understanding that it it was $100 to get your name put on the on well that's a lot of money for this size of a little plaque right here so that would be my contention to maybe go back look at it again and see what's really a more reasonable fee um before it was a donation that always seemed to work but in my opinion a $25 fee is more reasonable than a $100 fee to have your name put on the tribute thank you okay is there anybody else in the audience who wish to speak okay yes sir go ahead just state your name and your address please good evening my name is Mark Clan Charles I live at 493 Lake Park Trail overo Florida I am a veteran I attend the I'm a legion of a American Legion member uh I served 21 years in the military [Music] and excuse me [Music] MH I think it's a great thing that the city has provided um has done something for the varment the sub um um Memorial at the uh uh downtown oo um and it's great thing for City to honor uh the men and women who serve this country and um and just as was said before I believe the $100 fee is um a bit much for a lot of people uh and I they agree that $25 would be much better for everyone and um you know I think this I think again at the end of this is a way to honor those who served um and then honor the the price that they pay for the country thank you great thank you so anybody else in the audience okay we'll close public comment Mr Beldon would you mind kind of expanding a little bit on on the fees and how we came up with the fees good evening honorable mayor City Council Members um after doing some research on other veterans tributes in the community in the state there's fees all over the place there's strict donations there's also um minimal contributions 55 $25 all the way up to 00 to $250 so doing our research we were trying to be comparable to other tributes and we thought $100 was adequate for this case um we also said the eligibility requirements but we included the fees for this tribute as part of the fee schedule so that fee can be adjusted in the future it could also be adjusted through this process if deemed necessary by city council members but that's the reason why we were just looking for a comparable fee to other tributes so there there wasn't any the the the basis behind it was just trying to be comparable to everybody else we were trying to find a means to offset the maintenance and the the cost of the name plates um a lot of the cost is when there's a change to a name plate there's a further cost because now you're removing one little plate you have to replace that entire section okay not just one individual name um also there's repair cars that are needed for this future uh replacement down the road once that once that Monument needs correction or totally revisement when when we run out of space for names we have to totally redo that whole the whole section so we're we're trying to find that funding source but also you know look at a at a at a feasible process and being prudent for the city to cover those costs as well and you were saying I think when we were talking at the tribute uh on Veterans Day you were saying that the the the foundation I guess was was sinking we're having some erosion issues um near the stairs and as you're going down towards the stage area as well as up on top and you're seen some constructional um damage to the actual tribute itself it's separating where the marble meets the actual structure itself and we're currently doing a study with u one of our Consultants under contract to find out what the root of that issue is coming from we just did some booring samples last week um we're waiting for those results to come in and once the findings come back that'll determine what the corrective measures are for the soil and then from there we'll have to go forward a little bit further to find out what the corrective measures are for the actual Monument itself from a construction basis okay and we also I think we talked about also the U the Relay for Life Golf Tournament we were actually going to use some funding from that event to previously took that to you that um some proceeds from the Gulf tournament will go in towards the restricted fund for preure use for maintenance construction or replacement down the road at at any given time and there's funds available from the friends of OVO when they when they uh sunshin yes sir the existing funds were carry forward into our account with the city right now into that restricted account okay so we if we choose to use any of those funds it's through a request through Finance um and then over that threshold we would take it back to city council if it deemed necessary um but we will apply those through a budget amendment I do see like I see what you're saying as as far as the validity behind it but I also um hear what our veterans are saying too I don't want to price someone out of being honored on our wall so I am open to I guess looking further into this and maybe seeing if we can make it a little more friendly so we're not leaving people out based on our fee cost we can adjust the fees I'm not sure if that can be approved tonight with the idea that the fee could be reduced if that's a consensus of council um but staff is open to it we really are concerned about the eligibility we want to make sure that those citizens of AO and actually in this case we included the mailing addresses of avido can be a part of this history going forward um and they and they've served and you know and possibly include their family members just like we've done in the past right now in the existing structure there is no ties to a veto whatsoever anybody from the entire country can apply to be on this wall and that will fill up pretty quickly as we're seeing right now as we speak one one of the things I noticed on the criteria is that if you have an Ovito mailing address it's okay but not if you have chilota or Geneva and I think that's something I don't know if we want to Hash that out now or if it would be something we'd want to ponder between now and and December I I don't have a problem with the way it is right now that you live in the city or there's a relation to the city uh to a resident um I mean I I think that's what we should do I mean I'm not looking to change everything and again it's not a whole lot of space right now we got to figure out as we go down the road how we keep adding these people okay and it can always be adjusted in the future especially if we redesign it there could be a different process involved if you want to you make amends to it Brian can we amend the uh the motion to lower the the fee to $25 yes okay yes you can I'll I'll make that I'll I'll amend my motion and I'll second that okay okay is well there's two fees there's the $100 fee for a new person and then there's the $50 fee to do the replacement so you want to set $25 across the board can we do there's three okay I just want to make sure we cover all the replacement is new right because when I put my my daughter on on the wall it you couldn't replace it it was like I had to put her in for the rank that she was at and that would be you can you need to put in the request but there you know we still have to go through that process to replace multiple at the same time and that to me seems like an opportunity to to validly say that's a lot that we're redoing that's a $100 so the initial ought to be a low Buy in at whatever rank you buy in at uh and I hate to even use the word Buy in I I I would prefer to have the fee be Z dos if if you are currently or have at any time in the past been a resident of Ido and then for people who are Ovito address or have a relation to somebody who who's here then do the 25 or or another another level of fee I that gets kind of complicated I guess we would need a mechanism yeah we would need a mechanism to determine those ovos that had a history in the past to AO what documentation are they going to provide at that point and I'm fine $50 on so my so my motion is 25 for the initial 50 for the replacement and okay one more not there was a third one that we we wanted to include U um the city employees full-time employees to be able to put their name on the plaque as well and we had that at initially at 50% of the $100 fee so if if you follow this trend you can just match recommend it to be at $25 for the city employees y yeah you know I I have an uncle on there that was in OVO one time but he was a World War II vet that landed on Omaha Beach and I thought the initial intent of this was to for people that are living here to help them establish their roots in the city and they have a place to go to honor their their veteran relatives is that still the case so if someone lives here and they have a relative that served that's part of the policy sir yes family members can be included with full-time employees as well as City residents um as part of the policy okay yep okay City residence is in Ido not inside city city resid and those with a mailing address Ino not Geneva not julot okay okay y y good we got thank you motion second all hearing ordinance number 1752 repeal and replace Land Development code Mr Hall can you read the ordinance by title only absolutely Mr Mayor ordinance number 1752 an ordinance of the city of Ido Florida amending the Land Development code of the city of Ido repealing existing articles 1 through 18 creating a new article one Preamble creating a new Article 2 Administration creating a new article 3 development agreements orders and permits creating a new article 4 zoning districts and regulations creating a new article 5 other specific uses and structures create a new article 7 non-conforming situations creating a new article 8 architectural design creating a new article nine concurrency management create a new article 10 floodways flood planes drainage and erosion create a new article 11 streets and sidewalks creating new article 12 Landscapes tree planting and buffer requirements creating new Article 13 parking create a new article 14 signs create a new Article 15 environmental preservation create a new article 16 utilities creating a new article 17 recreational facilities and Open Spaces creating a new article 18 basic definitions and interpretations providing for legislative findings and intent providing for conflicts providing for separability providing for codification providing for prescription errors and providing effective date great thank you Mr cob can you provise a brief introduction uh thank you Deputy Mayor this is a request for Council to uh adopt revisions to the city's Land Development code actually this is a rewrite of this of the city's Land Development code and uh tonight is your is the second of two required public hearings that you are you are required by State Statute to conduct you did the first public hearing and first reading of the ordinance on November the 4th uh at that meeting you had you did have some issues that you asked the staff to address before tonight and so uh the staff is going they'll be doing that they're going to come up Dr K is going to address those uh those issues here just a little bit later um my main thing tonight is that I'd like to say thank you to council to the Land Development code committee to the local planning agency to our staff to kimley Horn our consultant uh Miss Juliana is here today uh she's here in case you have any questions and everyone came together everyone put in a lot of hard work everyone put in a lot of hours in putting this code together and so I want to say thank you to them to all those to all of you for uh the great work that we've done I it's not perfect I'll say that it's not perfect but it's good it's a good work and everyone put in the they put in the time that was needed there was a lot of Spirited discussions I would even say there were a lot of disagreements uh that were that occurred but at the end of the day everyone had the same purpose and everyone had the same goals to produce the best quality product that we could so I want to say thank you to all those folks that did have a have a that worked on this project and so I'm going to turn it over to Dr kareah she's going to address the issues that were raised at your first public hearing once she's done we would ask we recommend that you conduct a public hearing and then adopt ordinance number 1752 good evening mayor deputy mayor council members um so as Mr cob just mentioned um on November the 4th we discussed uh three items that we brought to your attention and uh we just want to show that um we followed um city council's um Direction so the first one is was about um including bars or uh expanding where bars Standalone bars would be permissible in the city City so now the code reflects that it will be permissible in C2 in all the zonings related to the target areas which are the downtown neighborhood downtown core Central Avenue um uh mitel hammock Corridor Marketplace and Gateway um West so in all those districts bars will be a permissible use by right so that was the and that is reflected in page 64 of the code the second one was can you change the slide thank you um it's the bonus um section for structured parking so we just um tweaked the language um for also city council direction to say that in single used uh residential projects then the parking um to be able to be eligible to the 50% uh bonus they would have to provide 25% above the minimum required um um parking spaces for mix Shi development then it's 25% of the of the project of the um minimum required um they do not have to go above to be eligible to the 50% and the 50% if they if they have less um uh parking available to the public then we would adjust the um the bonus accordingly so that is the language that um was reflected in the code and the final one is um um it's about the projecting signs and um um we had a discussion here and city council decided to confirm the ldcc and the LPA Direction uh and recommendation which was to um have um the projecting sign projected 3 ft from the wall and um have one projecting sign per building facade and there was no limited to the maximum only limited to the maximum sign area of the building which is um the calculation is um 2 and2 square ft po linear foot of the U building facade up to 200 square ft so I just wanted to show the three you know discussions that we had um were now are now reflected in the code and the recommendation um the final slide is to for Council to conduct a public hearing and adopt um ordinance 1752 I would like also to um join um Mr Cobb and thanking everybody that was involved and and also affirming that the passionate discussions that we had you know during all the meetings um the aim was really to get the best code possible um to you know the residents of Aid to the city so and I'm available to answer any questions that you may have any questions think we're good thank you okay we will open this up with a public hearing I have no written request to speak is there anybody in attendance that wishes to speak on the subject yes sir I think you know the drill step shank uh 112 Boardwalk Avenue Avo Florida 32765 I just want to say thank you to staff um probably I was at least half of the spirited discussion part of at the Land Development uh code committee itself probably was 90% uh when we got together uh LPA was kind of stunned and we were going that wasn't even like nothing going on and they were kind of like wow that was a real you know sp there was a lot of discussion we like that was nothing um staff put a ton of work for us um for everybody really but they really came uh the consultant who really again they put up with us in many ways too um um there were a lot of differing opinions that I think worked out and like I said in the end um almost everything between the Land Development code committee and the LPA uh almost everything uh was unanimously agreed upon uh so that showed that even those Spirit of discussions uh came together and came to an agreement that yeah this is like Mr cob said it's not perfect but that's what we you know came together and said this is a a good procedure to work forward with so thank you all like I said I want to thank staff especially um because I said they put in tons and tons of work and then had to deal with us thank you great thank you is there anybody else who wishes to speak I will if I could I will agree with Mr shank it was a very spirited meeting uh I will confess that it's probably I believe that's his middle name if if if it's not the most it's very close to the most Spirited One I've been involved with in in my career so but my my thanks to the committee they did an awesome job they put in a lot of time I was I was much more than I expected from the Land Development code committee ordinarily to look at and make a few comments but uh our committee really took this to heart and they did the homework they did the time and and you know they they are well staff the question staff did a great job but the Comm committee I was been impressed like I said it was Lively but it was fun to participate in no question about it great thank you okay see nobody wishes to speak uh further on this subject we will close a public comment what is a pleasure of councel I'll make a motion to approve ordinance number 1752 second all have a motion a second any discussion i' just like to thank staff and and the consultants and um members of the LPA and and the development Co committee for putting this all together and working so hard on all this and making it to my last meeting so I was able to approve it after all this time so no I concur I'm excited to have a upto-date living document that is our LDC code so um I know a lot of work went into this and and again thank you to our LDC committee staff and our consultant here it is pretty impressive to get that many people together and come to an end conclusion that's a working document that we have so thank you for your hard work Council M Britton I agree and thank you staff and the LPA and and land uh development code group uh appreciate all your hard work and you know I'm glad we finally got this document out M mayor could anybody in the room who was on the ldcc or LPA stand up real quick I know there's two of them don't three oh thank you you guys did not know what you were signing up for I bet I heard that the hours uh just they skyrocketed thank you for sticking with it guys um it was a great thing being up here and we had like the multiple choice thing like LPA says this ldcc says this after all this discussion what do you guys think well you did all the hard work getting us down to the multiple choices to make so thank you for that and for giving your input um at the end of the day there there are things I think everybody would like to see have come out just a little bit differently so if we can all come to consensus on those we can over time tweak this to be even better but I think it's a really good starting point and I'm so excited to have the rules set so we can start to build back everything that's been knocked down along 426 so having this done yeah I was kind of annoyed that this was getting delayed but since the road was delayed in a manner of speaking it hasn't harmed anything so we are going to have this done before the road and can hit the ground running with building back so glad to have this done great thank you again I reate to staff what a great job we appreciate the Consultants work here uh obviously the Land Development code committee and the LPA um it's a lot of work and we do appreciate it uh that was very important it's been a long time coming uh to get that you know re renewed and out so appreciate everybody's effort on that 1753 amending CH chapter 34 fire pension trust fund Mr cob I actually Deputy Mayor I'd like to have Mr Hall read by title only Mr Hall read by title only absolutely ordinance number 1753 an ordinance of the city of obido Florida amending chapter 34 pensions and retirement article three firefighters pension trust fund amending section 34-7 member contributions lowering the member contribution from 7 to 6% amending section 3473 benefit amounts and eligibility permitting retirement after 25 years of ser service regardless of age providing for implementing administrative actions providing for a savings provision providing for conflicts separability codification as well as correction of scripter errors and an effective date great thank you Mr Cobb uh thank you Deputy Mayor these uh these proposed amendments to the code of ordinances are the result of our negotiations our last the last negotiations with the fire Union the approved contract each of these changes to the retirement uh retirement criteria those are all addressed in the contract so these proposed amendments are to implement what we approved in the contract and so we request that the council uh scheduled public you're continuing to do um I just you know I it's kind of Bittersweet but it was it's time for me to to kind of move on and do other things so I really appreciate it and thank you all so much thank you appreciate your your service eight years I mean it's that's a lot of time we do appreciate that okay I am up next uh Mr Wyatt do we ever get with the county about these papers uh at OVO Boulevard and uh Lake Jessup because it is a county project I know it's not us and then we have ones in Franklin street that are ours and they're all won it's technically a DOT project managed by the county okay and they there's a um a consultant who's actually managing it Ford Dot and the county and they're inspectors are the one who out there and actually during the last meeting Mr Zuber was up here with his concern I was emailing the um project manager and he sent out his inspectors to look at it and they've looked at it I haven't heard any negative reports they will be the final Arbiter of whether it passes uh muster or not as far as ADA compliance but as I said before if it passes ADA compliance it's going to go through they're they're the is there someone that Mr Zuber can talk to because I mean I I know he thinks you we should be taken care of but as you said to I can give him the contact information for the project manager he can speak with them directly if you could give that information to them that may be helpful sure once it's done is there a some sort of overlay matter something we could put over that uh as a walkway uh to get rid of the tripping hazards I'm not familiar with one and there shouldn't be any tripping hazards when they're done okay so yeah if you give that information to them that I think that' be helpful sure okay can do thank you and then uh Miss St gave me a little update on the sidewalks for uh for live o she was saying I guess you guys got three I guess was two contractors but one's out of business the other one says he's too busy so yes so we have two contractors under a specific sidewalk contract one of them apparently has gone out of business left us with one we're currently trying to get we've talked to Mr hall waiting on a response um if we can get the who was the third uh contractor on that list if see if we can get we have to come back to council and get approval but move them so that they're available so we have multiple contractors there's also another option we have which is we have seven um small construction project contractors where we can bid it out and try and get them to get a price on it as well so we two options both are taking longer than planned so that's be better if you had somebody that specializes it and that's a bigger group that could probably tackle it maybe typically you'd want a larger contractor because that's a long a long stretch of roadway yeah so I should say sidewalk not roadway um but that's our current current plan okay all right and then there was the resident that sent the email in about the the intersection of Lockwood in 426 and I know you were saying that we're 90% through the design process of the of the arm and the signal no that the entire intersection including the Mast arms that entire design is about 90% completed once we're done we're going to hand it off to the county and they have a budget this current physical year to construct that's right because we were only going to do the design of it and then the county was going to take over as far as building it yes sir that's correct okay y great no I appreciate that yes sir thank you sir yes sir also want to thank our our veterans again again thank you guys for each service it was a great tribute uh that we had last Monday um I was able to bring my dad over uh and U it's a it's a good good thing and again we appreciate your guys service and all that you guys have have done for our country so and thank you for coming in and speaking up you know and and uh hopefully we get a good resolution I'm glad we got some to your point we needed some standard operating procedures really kind of to lay out how how people qualify and I think that's that's good that we got that so happy about that and again Mr poock thank you very much for all your your effort I have enjoyed it um I've learned a lot from you good and bad but uh uh you'll definitely be remembered so but thank you very appreciate the the vote of confidence uh this is my 10th term and I'll I'll just say that I do the best I can I'm not perfect and none of us are but we do work hard up here and uh we do the very best do have a question for uh Mr Wyatt back there and I think he's going to know my theme so our road has finally started construction which is super exciting uh so McKinnon is moving along so if you haven't been out there um there might be another way out of my neighborhood soon but the questions that have arrived from work starting um we have the timeline online that is going to end in August but I know we had spoken that the road portion would open before that is that still the case or I don't really know the construction timeline again I will be absolutely honest with you I don't know um I will have to talk to Mr uran he's the PM um for that construction project okay I would anticipate that I would think they'd be doing the the um the ditch piping first and then the last starting with yeah I mean um so I would think the would come last to be honest with you but I will get it I'll get confirmation and let you know okay yeah if we could get a timeline on that that would be good yep okay thank you I think my next question is for Mr Bon so the Landscaping out oo on the park I know we talked about that like a year ago I think and if I remember correctly we got a contracting company to kind of take that over is that correct we did like the right of way yes we've serviced um due to shortage of Staff we brought in a landscaping company and we've since switched over to um Ultimate Image so I guess my question is like all the little RightWay sections throughout M they don't look great they they look pretty bad so if we're Contracting them out how do we fix that I guess we recently had some irrigation repairs okay um we had major outages um multiple um wires were nicked um we had um down um valves um control boxes that need to be replaced so we've since corrected 95% of that okay um even near Starbucks we've actually started replacing some of the Landscaping as we speak actually last week and we're starting to go through Center Lake Lane and and correcting all the the tips of the of the pockets okay so it's on our radar it's not it's it's actually already started there were actually employees today that were actually planting like a small grass uh plants in their with their Public Works I believe it's LA and they're going through like all of it because I know like you're right I see all the irrigation lines out and it's not looking great and I've had some and we'll be adding mulch to those areas um updating the tips within budget if we are tapping out on budget we may request some additional funds is that not included in their contract to up it's in our budget we have planting material in our budget um they maintain it but we have to provide the uh the service to update it we can request a proposal from Ultimate Image um but sometimes we try to do it in-house um okay of and on so but there's a plan and we're going to try to get it tackled by the end of this fiscal year okay as long as it's on your radar that's good so thank you you're December 2nd Monday at 6 o00 6 o'clock or 6:30 6:30 6:30 all right the agenda says 6 all right and then Monday to 16th will be 2024 at 6:30 regular session are are we still planning on having that meeting on the 16th yes sir we are yes make it a short one is that no we're doing the Santa run the week prior right all right so it does 9 yes 9 through to 13th got it all right all right anything
