what do you have for us today Mr Vasquez you may be seated yes sir uh Miss uh special magist Marcy we are here today for a as a compliance hearing which is a continuation from the uh special magistrate uh hearing that was conducted on October 24th with one of the conditions that was written in your finding a fact final order in paragraph 11 you advise the property owner to have the property vacated as he was not issued a uh Co a certificate of occupancy that he was to allow us to conduct an inspection no later than November 7th for us to confirm we conducted an inspection on November 7th and during that inspection we found the property to have a tenant still residing in one of the rear uh buildings in the back okay when was that inspection yes sir November 7th and what uh did you find yes sir that there's still a tenant residing there's a tenant residing in one of the rear buildings any other findings uh there's an extensive amount of work that was done um without a permit but you gave a issued a date for him to come into compliance for that um so what we discovered on the 7th outside of the extensive amount of work that was done without a permit was that he still had a tenant residing in one of the rear units okay okay uh I will give you a package of 12 Pages all right and I'm going to ensure the property owner receives his copy right this is 12 Pages yes sir this will be received into evidence as the city's exhibit [Music] one all right go ahead yes sir Pages 1 through 4 is a property record card showing that gray if I'm pronouncing that right or g r e i i King LLC still have ownership of 469 Franklin Street Pages five six and seven are photos of the date um when we went to the property it is the rear unit that has the tenant that has the tenant I'm residing in it so page five is just a picture of the front of the building page six is um a photo of what we observed inside again further confirming the property is um occupied page seven do we know how many occupants are in the building uh we know at least one is that number five is that one of the occupants or no sir that was staff doing the inspection okay what do we know about the [Music] occupant um from what Mr Vasquez stated that the uh tenant there is looking for a place to stay um he just has not been able to find a place reasonable um so the same thing he stated at your at the special Magistrate on October 24th which was he had one tenant residing there he just wasn't able to get him relocated so okay what else do you have for yes sir so after we completed an inspection and found that he was um not in uh compliance with uh section 11 of your order we issued an Affidavit of non-compliance which is Page 8 he was advised of this hearing today which is page nine we issued that on November 7th for today's hearing page 10 is a copy of the certified mail receipt we did not receive a green card but we did do an Affidavit of posting to ensure Mr vasque is aware of the Affidavit of non-compliance and the notice of hearing that was posted on uh November 8th page 12 is a copy of the photo post poed on the property of the six units that are on the property yes sir uh do any of them have a valid certificate of occupancy no sir no units okay all right anything else no sir I'm sorry yes sir we would like to have as a city in your ruling how however you find that today to have the administrative fee be included in your order any administrative fees be included and um to be allowed access to ensure compliance once the property is vacated by the property owner so we want to be able to have the ability to go out and inspect to ensure the property has been vacated and any administrative fees associated with this case is included in your order and how how much are the administrative fees $500 okay that is all thank you first I'm going to find that all the notices required by Statute and ordinance have been provided Mr Vasquez we'll hear from you um thank you good morning to everybody um uh post our uh previous uh meeting uh special magistrate um like we stated we were going to be open and uh we were going to uh work in complying with everything uh as we did not have the understanding of what needed to be done in this whole process and now we've we've been in constant communication and trying to work with everybody in the process so that we can comply we've we've been working in that direction uh we open the doors of the building so so they could come in uh at this point we have not six but four units it's a one main house and then three back units um we we open the doors we have been working in vacating everybody from the buildings it's just been a a quite a short notice uh we we tried to hurry so we were able to V there there were three tenants there uh we were able to vacate two and there's only one left because uh he has had a more complicated uh time uh in finding a dwelling uh space for him uh so that's the reason why he's still there um we are hoping that by next Thursday uh he hopefully has a place to stay uh and he's out of the building I offer to uh move him myself cuz he does need help he's a single gentleman uh that works two jobs uh to be there uh so we've beening to work uh we were not aware there was not a certificate of occupancy in the buildings as we purchased the buildings uh from uh a bank so uh we we they were uh re re repossessed buildings uh so we we bought them from a bank so we we were not under the under we were not deliberately trying to uh violate the law or to uh be disorderly in any way we just did not have the understanding because we purchased the building from a bank this is my my my previous property I purchased from the bank and I just moved in and so we did not know that we needed a certif a certificate of occupancy uh once we finished the meeting here we immediate I immediately went and uh talked to the permitting Department as he stated in the previous we have submitted all the paperwork for permitting uh and in what we understand was a reasonable time and they were waiting for soning uh soning I believe uh changes on November 18 uh so once zoning is cleared it's going back to the permitting department but we have been working towards getting everything in order and organized we have not tried not to be compliant or we have not tried to be complicated in in this whole process so I ask you to please have that into consideration um and if there's any way that that $500 uh uh administrative fee can be waved or uh put towards another part of the process if I am if if it's possible if I am in any type of violation or if we are trying to be not Cooperative in the process I would understand it but we have been H we have opened our doors we have been working uh diligently as as diligently as we can uh toward helping remediate the situation so we have not tried to be non-compliant or we have not tried to be defiant in the whole process uh so so we ask that if whatever um mediation we can get with the city so that we can uh expedite the process of of getting everything permitted and that we are uh under law that would be uh perfect as we are trying uh to work towards in the same direction to to be in the same direction that they want us to be in so do you realize why a certificate of occupancy is important um I did not know the term too much of the certificate of occupancy until I started uh this uh process uh we I didn't know what what it was um so but so we I did not have the understanding of what is a certificate of occupancy and since the buildings were there um uh we we were just we we for in our understanding we we purchased a building from a bank and we were under and we went through different uh title search and all types of different uh processes that the bank required for us to obtain financing for the property so we were under the under we didn't have any uh we we there was no understanding that we were violating any laws or that uh we needed any additional permitting from from a from the city or to be able to occupy the building as we thought that since we had gone through the bank process that everything had been uh cleared and that everything was in order and organized for us to uh occupy the buildings um so you have made you have made some changes and done some work in these units right uh the back units mean yes yeah yeah and that's one of the units we're talking about today yes yes well Mr Vasquez one reason for a certificate of occupancy is to make sure that the building is safe for people to live in right now you have a tenant living in a building that the city does not know is safe you don't know if it's safe you you think you do the tenant doesn't know so the certificate of occupancy is not just some requirement there's a reason for it uh what efforts have you made to help the tenant find a new place um we I offered to help him move uh I the person that H the the realtor that was working with me I asked him to help in in the process I think from my understanding he's moving with one of his sons uh so that's his uh step uh to but we have been waiting uh for him to um try to uh we we didn't want to be too intrusive in the process we did not know how that we could help uh uh so we I offered whatever he needed help with um giving whatever the deposit money rent money whatever he needed so we can move him out of the building uh but people are sometimes private and we don't I didn't know what else to do um have you have you searched for a new a dwelling place for him um there's I don't know what he's uh wanting to do uh what is he looking for in the process and I I didn't I didn't uh think of uh of doing that myself so I just uh tried to send him the the realtor that usually helps me so that he could help help him and uh so I wasn't he's an adult person uh so he I thought he he might be able to uh work that situation out I wasn't trying to leave him I I offer hey if if you need a U-Haul I'll rent a U-Haul for you if you need me to help if you're moving he's a he only has basically a bed a desk and a a sofa uh there's not much to move uh because he not that's a reason why he is a little bit hard for him to move because the rent that he's paying with us uh for the space he has is is complicated to end it with utilities included is is hard for for him to get that anywhere else at this time how how much rent is he paying you H I believe it's uh [Music] 1,300 that's for how many square feet uh I would say about 500 square ft one bedroom uh one bath and that includes uh utilities and internet and everything so that's when did you tell the tenant that they had to vacate I told them that they they needed to vacate immediately oh the the same day we we got out of the hearing that same day anything else you have for us uh no uh we're trying to see if we can offer a different space for the person but I have I a private person person with my family and it would be rather uncomfortable for my wife to have somebody move into our house which we don't know especially being an adult male um you do not live in any of the buildings uh no one of the right now they told us we could not be in the buildings so we our the space is ready because my parents come over usually for Christmas or summer to be there uh but right now there there's nobody there uh so yeah well Mr Vasquez I am going to award the city today $500 administrative fee because you haven't complied it's cost the city money but there's a bigger problem that you have uh technically you should have had those buildings vacated on October 25 uh I could impose on you today a fine of $150 per day for each day between October 25 and today I haven't done the math but that's going to be a sizable amount of money what I'm going to do is I'm going to award the city an administrative fine of 500 [Music] today is November 14th if that tenant and all tenants are not out of those buildings whichever ones are occupied by no 5:00 p.m. on November 20th I'm going to impose fines commencing October 25 now if you want me to do the math on that I'll give you some idea of what that is uh it's going to be roughly I guess 25 days at $150 a day let you do the math I don't know what you have to do to help that tenant vacate but it must be done by 5:00 p.m. on November 20th where it's going to cost you a lot of [Music] money we we'll we'll work on uh hopefully getting the tenant out by by hopefully uh this this weekend and not hopefully yeah if it's not done by November 20th I will impose those Minds on you that's right okay sir yes so it's uh Wednesday November 20th 20th at 5 pm. okay um and as I said and I was really transparent with the city as to the whole process um I've been trying to uh communicate everything that we've been doing and how we've been looking for uh to complete the process um but we have been transparent we have not hidden anything um we like we explained to the city we were able to vacate two of the people that were there we're just missing one person and the the whole process we were not never trying to be uh evade the process we are just trying to understand that these are real like this these are I know I know these are people and they have situations and we're trying to help and we're trying to comply with everybody they were able to see the conditions of the property and and the quality of the construction and everything we did and and we were act we actually upgraded the property so the windows that were there now they have impact grade build because we bought everything from Home Depot and everything was and then the other thing was sighting and so whatever upgrade we did it was a of better quality than what was there um I always say people sometimes hey I want a new building and I'm I'm like I rather have old buildings because I know they can withstand three hurricanes in a year than have new buildings that I've seen what happens and they get flooded and everything else happens so so we are going to work into comply Hope by Wednesday we are working we we will do our best to have that tenant out of there um if if we need to help them and maybe pay for a hotel or something that that might be an option and and we'll try to work with him to yeah and I have offered my personal physical help in the moving process to everybody and especially him as well you may have to find him another place and you may even have to pay for it but I suspect it's going to be cheaper than the fines that you're going to be subject to if you don't I'm sure the city appreciates the cooperation but you've created a problem for yourself and for the city and it's up to you to solve it okay sir thank you I was I was hoping that what I did was not creating a problem I was hoping to be creating a solution especially with the prop as as from what the property from what I acquired and what it is right now and also providing uh shelter for for people um I that's the way I saw it I was not trying to create a problem I was actually trying to create a solution and living is the the cost of living right now especially of housing is really expensive and for me $1,300 sounds like a lot but it's way more um if when people go outside and they see what housing is housing expense is right now it's it's crazy so we were trying to provide a a good a safer space turn an ugly space into something better and something that would make the area you could go around the area and you're going to see that and I'm not trying the nicest looking house there is is is that one and we were that that's something that creates value to the community and it also uh uh uplifts the person that are around to sometime including improve uh their their housing situation and it gives them a motivation hey now this nice property is here now I if I put money into my property it'll make it look nicer and and it makes the community better a nice house helps uh improve the quality of living around them and that's what we were trying to accomplish so we were not trying to create a problem and I excuse myself if we did and let's not forget that also makes money for your llc at at $1,300 per 500 square ft uh your LLC stands to make a fair amount of income from this with that uh income potential com some responsibilities there there is a mortgage on the property at this point I am honestly not been making money on the property as I stated before uh the purpose of this property is for my parents retirement they come my mom is a school principal 30 years and she makes $40,000 a year uh and I'm sure that's going to go down once she retires she's 65 67 right now so this and and again I bought this property during covid it took us four years to renovate it wasn't like we just and my LLC it sounds like a big Corporation I'm not a big Corporation it's just me and my wife and the reason we open in LLC is because that was the process to be able to uh obtain a construction loan so that we could fix this property and we could put money into it that that was the only reason the bank would not loan us as a give us a personal loan for this property it they required us to open an LLC so that we could uh acquire the property if you go to the owners of the LLC it's Karen PES which is my wife and And Me David Vasquez there's not is not a big Corporation and I I can bring my financials there's $30,000 in a bank account that's our savings we're a family with four kids uh so it's not we're not printing money it's it's uh we're trying to make it for get ready for retirement my parents retirement and my retirement uh some people they get to an elder stage in life and they have not prepared I live with my grandparents for for a while so my my grandfather taught me how to try to work and towards getting uh fixed for retirement and not having to necessarily uh struggle okay well I understand all that yes uh the when you get the written order it will award the city the $500 that must be paid by the last day of the month which I think is November actually be November 29th you'll pay that upstairs at the annex next door uh but uh I suggest you get busy we will uh will that would when would I receive that uh notice so I can go pay uh this it'll be mailed to you probably within a couple of days you'll have it I think they have the wrong the city has the wrong mailing address uh well give me the give me me the one correct one uh yes they could mail it uh to uh they could probably mail it to 469 East Franklin Street East East Franklin Street so the property East Franklin Street [Music] oo and the zip there 32 765 all right that's 469 East Franklin Street yes o 32765 the the mortgage in the property right now is about $5,000 a little bit so we're not really making that much money so we're we're we're underwater right now for quite a bit all right you'll get this
