Acres parcel on 110 South State Ro 19 the request change the existing zoning from General commercial C1 to intensive commercial C2 the property is currently Within in the city limits of Alaska the site of the former Woodies barbecue restro this is a corner lot founded by St John's Avenue to the North and South State Road 19 to the east surrounding Parcels include both C1 and C2 zonings the future land use is designated commercial the parcel is proposed to develop with a drive a FiOS for the Bank of America for Section 94-1 149 7 bank and financial institutions with drive and facilities are permitted in the C2 zoning District but not in the C1 public notice was issued by the city including the legal advertisements in the PAC Daily News property postings and mail notices people owners Property Owners within 100 ft of the subject proper the request meets all the standards for resoning set forth in the code and therefore the staff recommends approval the applicant is present there is MCL drive and 6200 St John's Avenue you gonna throw that one at us yeah okay before I start verification here package that you have was since the report was written the applicant has submitted addressing some of the issues that I have pointed out in the report we have a copy of the things that were submitted to us that the cl has and this later submitt by the applicant address some of the concerns that I have and some of the conditions so when it comes to the recommendation for approval uh I will rele some of the conditions that it is in your St report than as you pointed out Mr chair this is a an application for a plan unit development and they're two combined Parcels uh with total 31 Acres one parcel is the one that fronts St Johns Avenue and it's 6.67 acres and the other part of is front te ml Drive is 2433 Acres if you remember this item was in front of you for annexation for a p Amendment and for about a couple months ago uh since I went to the city commission which recently approved that request for the annexation the future line use and the resoning the parcel is now reson to residential three with an overlay plan unit development uh the the applicant intends to develop this Parcels uh as I said supply unit development with up to 248 uh town home dwelling units which yields at a maximum density of eight units per acre uh we have reviewed the Pud again the standard that is set for in the code that is section 94 233 and based on our review of each of these standard which inside of the STA report uh we are recommending that you have indication the that request we approv that you recommend this to the city commission consideration and an action in the staff recommendation like I said before I have attached U certain condition of approval but since then they have resolved those issues the first one is the site plan submitted the first condition was that the S site plan uh submitted should include provision for open space the applicant since then has submitted an open space plan that satisfies the requirement for the standard in of a PUD the second item the site plan request that depicts the location of any and all underground Utility Systems atness that have to be be overground I have to show how going to be screen that has not been submitted yet and that will state as a condition that had to be satisfied before it goes to the planning to the city commission back up and say that again please I'm sorry yeah there's a requirement in the in the standard for the Pud that all utility have to be underground yes sir but there are some appes that are above ground and those required to be screen okay s plan submit had hasn't showed that yet okay so that have to be put uh satisfied before it goes to the city commission condition number three that the requirement for a parking site plan depicting the location that require number of parking spaces and the loading spaces that has been satisfied that has submitted uh a s planine indicating the the number of parking spaces and the location of those parking basis so that's been satisfied that been satisfied three has been satisfied correct number four the condition was that the applicant must be legal opinion by attorney representing the applicant as to the right of the application I mean of the applicant to establish Covenant and restrictions on the land that has not been submitted yet so that condition will stay condition number five traffic study was submitted and it was praed by license engineer in Florida as required so that condition has been satisfied condition number six we wanted to have more details about the facing and the applicant has then submitted that site plan indicating the two phases of the project so that condition has been satisfied the last one was uh we have required a recreation to be depicted in the S plan is and I have to clarify this is not a requirement of the Pud standard however we believe that a developer of this nature with so many units it required Recreation areas uh 248 units you know it's going to be a lot of children so we need spaces for the children and the applicant has then uh submitted a site plan indic at at least two Recreation areas so that condition also been satisfied so to summarize staffs recommend approval subject to two conditions condition number one would be the site plan sh the pick location of any and all underground Utility Systems a pance that will be overgrown and how they will be properly screened and condition number two applicant must submit legal opinion by attorney represented the applicant as to the right of the applicant to establish covenants and restrictions on the land I have also have to point it out that there is a requirement of UniFi control on this land for the Pud and that condition had to be satisfied by the City attorney we have to be satisfied to the uh satisfaction of the City attorney and they've been working with the City attorney that issue and I believe it's going to be satisfied before we go to the city commission so the next phase for this eval will be to go to the city Commission on December 12th for the first hearing and then will require a second hearing it will be in January and after that have to go through the process of obtaining a bill and permits and most likely a plat will be submitted at that time and that concludes by my code requires as far as a certain size tree to be saved if it's possible for it to be save or mitigate or mitigated for which we will do as well um so now I don't we're working with Janet Whitman to work through our plan and see where she can do some of that the landscape sheets that you have seen um are a minimum plan right now that she has put on the site yeah so we're not going to get anything extra there then besides the minimum well that's not necessarily true our hope is to be able to save certain areas of you know trees that are existing because the southern portion of the property of the of the South parcel was a Timber business so a lot of those trees have already been timbered um the North Parcel we plan on trying to keep there's a lot there's a rather large area near where the lift station is in Northern pond in those areas that we intend on saving some of that because of that reason but all of this is still to be negotiated between the city and know with the p well yes I mean to be frank yes however I do know that right now we're working on that tree survey with etm to work through those details to try to salvage some of those areas and then once we finalize that tree
