alternate number two of the planning board for a term ending December 31st 2026 and then this evening we will also be swearing Council liaison Judy Hernandez as a class three member of the planning case is being carried to the to that meeting actually I believe is our next meeting um no we have a February 3rd meeting okay so regardless uh do I have a motion to Grant the uh uh carry to February center use for meetings uh pressor training that think Feld all right I'm sorry I don't want to interrupt before you get too far but if you we're going to swear you in just so you can provide second page of the packet is the original site plans for rold when it's built with the two soccer fields the parking lot and the bathrooms that are there the the next couple pages are in color are pretty much kind of like the same thing showing you where we want to extend the fence about 15 ft on the North End uh right next to the bathrooms and put in a building that we could use for player performance prepping as well as for meetings currently we have a clubhouse that we rent from the town that we use for our board meetings we want to have our own meeting structure at Reynold similar to what the other youth organizations have at their complexes um and the final page in that document so the color pages you see here will outline what's new and what's different there is a new parking lot here but it will be gravel is what we're looking for it that tree lot over there right now about a third of it's already making of all trees because that's where the sewer and the water and electricity come into the complex um so we put traveling this way you can extend a lot for one when we're running both those fields especially during the pride tourn we do not have enough parking we end up renting Old Troy Park making deals with the church across the street and we still have people parking on the road which isn't the safest thing so we're looking to if you can make that a gravel lot I think the trees over there most of them are either at a 45° angle or already laying on the ground um so it looks like there's a lot of trees but when you walk closer both of them are not there anyway um the number of trees we want to take down for the building would only be about six trees and I think uh three or four of them are dead I'm not a tree expert but in the summertime when there these on all the other trees but these I can tell they're not doing any good to us um and then the final page is kind of like the high level breakout of what the building would look like uh from this different segments of what we're going to use for prepping in meetings and so forth any specific questions questions by members of the board chair Mr mey regard parking how many handicap spots do you have currently we have four are they paid you mentioned well yes we have about um 80 to 9 spots currently paved and I think there's four to five that are handicapped on both sides of the where the uh flag poers right there so we have that the gravel if we need to designate we could designate more I would do it in the pave side and put it on the gravel the gravel would be more like preform overflow parking more than anything else the normal weekend games that we have there we usually have enough spots to accommodate it all except if we're running backtack games on both Fields then you can use the the Overflow so we're not parking in the streets or fighting somebody from Old Troy park for parking thank you Mr Beth couple of questions um well first the uh the new gravel parking lot is there going to be a new driveway off of we would look to extend the as you're coming into the park as it is you know where the fence we put a driveway off the existing yes that's where we would look to do it we wouldn't look at except something towards the uh fenold okay and the walkway I mean maybe it's just the orientation of the building does that line up with the egress do all of them yeah we currently have the walkway that goes from one field up to the restroom for the building we would just extend that and put the ramp into the first Flor of the building okay I mean do you know what Christine do you know what the setback is in this area and then what's the setback at this building does it comply with the zoning um I do not know what the setback of the building is but for that area um side setback would be 20 ft and 50 ft from the front yard okay so question are you going to be more than 20 ft off the property line with the new building I'd have to measure that out meas from the side or from the the road from the side from from the property line it's not from the road that's we we I mean I would say yes we will be more than 20 ft because I think we have from the current fence area to the property line is about 35 4 ft and we only need to extend that fence about 10 to 15 ft all right any other questions by members of the board do our professionals have any questions um just want to would is there there be any tree clearing with the extension of the fence going toward the property line there would probably be about uh four to five trees that would have to come down the tough call on that one is when you look there to walk it there's already about four trees that are about this round that are lying on the ground um so we might not have to take out any trees cuz once we clear that that should give us enough room and then uh so you already commented on the existing circulation that's a one-way uh setup where you you pull in on this Northerly side here where you're putting the building and the drop and then and you exit further down side corrected cor just looking at that area it looks like uh I'll ask that um looks like it's not great sight to distance as you're leaving that facility um that with this tree clearing and vegetation clearing that you would clear the um the trees in the rideway just so you get a better sight distance exiting the facility I would second that having visited it today I I would agree all my years of driving through and that and even um that same clearing in the entrance it's hard to it comes up on your pretty quick and it's hard to see what that is and then also I would suggest that you add some signage um the appropriate signs like a stop sign do not enter sign that um exiting that that that uh that parking lot that Stop Bar you know painted Stop Bar and a stop sign so everyone so it's clear uh what's going on there um also I don't know I realize this this is like a a town Pro uh project I don't know if the township engineer gets involved with any review of your parking lot um or um the building with construction plans but um it probably meets the township requirement for a minor storm water which would be a dryw for the building um I'll just ask that you have that conversation with the township engineering department okay that's those are my comments uh the only thing I would follow up on is it any new lighting proposed no no um any new signs any new signs sorry signs signs yeah oh well besides besides what we had got planned on it but we will I mean it only makes sense we're not putting big sign if that's true or enough the only sign we would put on would either be the parking sign the the entrance or directional type sign in yes or sponsored that would be on the net or sign like that we're not putting Billboards up um and I guess the other part is the consistency with the master plan which I will go over a bit of um so looking at the master plan and the goals um goal six is to develop enhance and connect parks and open space amenities to ensure that all residents have access to passive and active recreational assets that oh come on sorry um uh so it's a passive and active recreational assets that enable a range of activities um improvements to the soccer field would of course be consistent with that um further goes into a policy statement that in planning for new and significantly improved recreational facilities careful consideration must be given to addressing demonstrated recreational needs of the community as well as the ongoing maintenance needs generated by improvements um and the township should incorporate input from its advisory open space committee as well as neighborhood Representatives um and as appropriate the township should coordinate with private sector to enhance access to open space amenities so was there any input from any of those um open space committee or neighborhood or no no current I don't know what we've done in the past obviously U but currently it was just with us and our organization you did mention to the town the mayor the business trainer what we were looking to do and that's how we're here tonight um we do just that if anyone does know the soccer club is responsible for the maintenance of the fields of the property we handle everything that from the grass the seeding the parking everything there is handled by us um we yeah we have a couple more goals within the master plan that uh so is also to ensure that Township has adequate Municipal facilities and resources um service the needs of people living working and visiting which believe a stock club would do um and also specifically in regards to open space and Recreations under the strategies and recommendations is to maximize the value and utility of the existing system of parks and open space throughout pipany um and adds the system as resources and opportunities permit uh to improve communication an Outreach process for parks and activities um and one of the recommendations is to improve signage for Parks um such as wayfinding signs like we discussed before so I would say based on this information also with uh recognizing on the future land use map this area is a recreation and open space area which is intended to promote maintenance operation of property for public Parklands whether it's passive or um Reg ational that this project would be consistent with the master plan what's what's the legal status of this property is is is this rented by the ppan soccer club is it we have a currently we have a lease with the town that runs through 2037 and it started back I'd have to dig back the original when it started 25 years ago yeah I was going to say mrir probably remembers when it first started and we went through a couple of 10 year plus 10 years and then the last one was about uh I think 2018 or 2013 I think was the last time we put it on like a 25 year take okay so it's Town land that is leas of money because I I you know I was there with part Troy East when I built their Clubhouse m in the middle of the of the project and it it's a fairly substantial capital expenditure of the club so I'm just you know if the town in 2037 decides we don't want you know we want somebody else to come in well hopefully that does not happen I understand but I'm I'm just but it's a but it is a risk we ring to take I mean we have it makes sense it's it's it's more than time for us to do this from what we've been trying to do yep any other questions um I would just ask that I'm sure you're already in you're already working with the township they're already on board for this project but just continue the communication with the township make sure that everything that you're doing um with construction is approved with all the township departments and yep the whole paring understood are there any members of the public who wish to ask questions of this witness on this testimony at this engineer and the engineer said because the township Engineers mentioned because we uh my engineer on the plans put in um over 100 cubic yards of soil that's been moved we have to apply for a major soil moving permit uh so that's why I'm here uh we sent out the uh certified uh notices to our neighbors uh got the registered list from the taxor office uh posted the notice in the Daily Record um my contractor couldn't come he did uh write me a memo to you off um four trucks will be used to move 10 of soil uh time this will take place will be between 9:30 and 2 p.m. the soil will be delivered to 17 contractors way tuxedo New York the path that will be taken to cedo New York to avoid any schools is as follows uh leave putting Stone Road left onto Union Hill then right onto Zeke Road and then left onto Miller the road will take us onto Route 10 East which will then follow our destination to tuxedo New York um this is the same path there's like a whole new construction development going over there by pting Stone developers so it's the same path that those trucks are taking um that's it um any question I have questions from members of the board just could you repeat that was the information that you needed to provide so that was good uh you went through it kind of fast so U what what was the quantity of number of trucks and the Quan material that you mentioned uh four trucks will be used to move 10 to 12 loads of soil okay 12 12 truck loads and approximate dates that you're going to be doing this work uh I'm hoping before my daughter graduates 8th grade because that's what she wants a big pool party but it depends on you know all the PO and yeah and okay and then you gave the rot um I'm sure you have the town Engineers uh comment letter where his comment six he notes that you'll have um 11,17 Square ft of new impervious coverage and that you'll need to address storm water and this must be to submit it your design for that must be submitted and reviewed by yeah so as office sorry yes as this application process is happening my engineer was already talking to their engineer and uh he already developed new plans for that storm water um remediate that okay site plan with C variance for a maintenance yard this is carried from November 18th 2024 we effectively have the same board are there any members that did not hear the first hearing I heard it and then I signed a certification that I heard and I went to the site today excellent so everybody is eligible yes good sir hi good evening uh mark rosberg from the will law firm and I represent M maner Associates uh as you know this uh application has been carried from November 18th no maners just for a refresh uh is an 1100 unit apartment can you please pull the microphone I'm sorry sorry uh n manner Associates is an 1100 unit apartment complex and this is the maintenance yard that has been used for uh that uh complex for the past 40 years uh we have uh Incorporated and made changes uh based on recommendations from uh the board uh from our last meeting um uh with revised plans uh now including uh construction of a small retaining wall drainage improvements a fence landscaping and a reorganization of the operation of the maintenance area and other incidental improvements uh in our revised plans uh and we've Incorporated both what board what we believe your concerns were and I did actually speak with uh neighboring uh neighbors who came and uh spoke with me and I Incorporated those concerns uh I believe uh in our new revised plan so with me tonight uh is Mr Dipple who will continue uh with our application and Mr Dipple was previously sworn and he's still under oath today thank you micophone okay I I put up on the easel uh the revised plans that were submitted it's entitled preliminary and final site plan n Gardens Property Maintenance area and this is a continuation of course of that property maintenance area if anyone wasn't here uh what you see on the cover page SE co1 is this maroon red area and that is the entire complex of n Gardens with the 118 uh uh Garden style apartments and we're referring to an existing maintenance area which is on the North side along uh null road and it abuts an R5 residential zone so that area is being used currently as a just a maintenance area for the entire 1100 unit complex and it has been used that way um for about 40 years um by the estimate of people who uh are on the project team um so again I'm just going to kind of go back and start from scratch so sheet CO2 was our just 200 foot property owners and quite a few of them sheet CO3 is entitled existing conditions and demolition plan and here you see the maintenance area it is just east of an existing one of one of the Gard apartment buildings and a parking lot and then immediately to the east of that is Lot 8 which is a single family residential uh use um n road is on the top of the page and we'll say for the purposes of tonight that North is generally to the top of the page and and South is to the bottom uh West and East uh so if you were to go there today you would just see a fenced in area uh I was there tonight I've been there a number of times there's not a lot of activity there uh tonight at all not a lot of things that are stored there I should say uh there was a small pile of stone and there are um I counted four large dumpsters there and everything else has essentially been removed as we testified to last time that there were some old uh smaller dumpsters that um uh that had uh been damaged and decayed a little bit and they were going to be removed um by you know by my observation they have been removed and there were Witnesses of witnessed uh some appliances that were there they have been removed and some other material uh so it's kind of an open area it's a little bit overgrown um it's got a chain length fence around it and and that's about it so as I move on to sheet co4 um I have a depiction of uh this this plant is entitled site and land Landscaping plan I have depicted now what we are proposing so we listen to the board Mr rord um uh spoke with some of um some of the neighbors even even at the at the last meeting and we came up with a plan that we think tries to at least satisfy all parties involved and that is again the the general reorganization of that area so we're showing dumpsters now we're showing six of them uh there are four there uh tonight I think I counted four I think some of the photographs show four um there was a time that there were three when the survey was done we are showing six those dumpsters are used for um cleaning out Apartments a lot of times the residents will move out and just leave all their belongings there so that goes into the dumpster if they're doing some interior construction that goes in the dumpster like a bathroom or something like that that goes in the dumpster and then seasonally with long clippings and leaves and things like that in the summer and the fall that also often goes in the dumpster so we're estimating about six dumpsters and they would be stored on the south end of this maintenance area on the North End of the maintenance area um the applicant would like to continue to use that as a masonry area so a a local Mason uses that area to do work on the facility itself so there is stone work there is brick work curb work things like that and often that material stored there with some of the equipment that that individual uses in order to make these repairs so that North End is proposed to remain as the main masonry uh storage area and work area um within this within this property and then along the east side you would have material stockpiles and those material stockpiles would be organized um with block so that that can be picked up and moved we're not exactly sure how many but again just a general kind of reorganization of the area another thing I should point point out is that we have a small area over on the West Side entitled temporary material staging area and that would be for things like appliances it does often happen that a refrigerator needs to be stored somewhere they they do break and they take them here and then uh according to you know my discussions with maintenance Personnel they stay there for a very short amount of time there is someone who comes and picks up the appliances and recycles the appliances but again the idea here would we would would be that we would store them closer to the gate away from the residential areas they wouldn't be scattered throughout they wouldn't have an opportunity to remain there if someone missed them or if they were behind something uh that would be stored right up there in the front uh if you don't mind I I kind of I kind of forgot that I I did a colored version of this sheet co4 so I'm going to I'm going to call this exhibit I think we're A1 I don't think we presented we did have one last time we had two last time so this will be exhibit A3 sorry so this is A3 and today's date is 13205 and it is entitled sight and Landscaping plan sheet co4 and it is dated 12264 and I we just dropped a little bit of color on here and we tried to show show the location of the existing trees which would remain and then some additional vegetation so um so on this color diagram you can see the dumpsters here in this yellow color there are six of them you can see the material stockpile that I described uh it's a little bit difficult to see that material storage area and then the North End would be the maintenance area for the Mason we would propose to put gravel down throughout the entire area there is gravel there today it's a little bit sparse in places over time it is probably worn away with some of the circulation that has gone on uh in that area but that would be all new compacted gravel we would also level this area out a bit and we would achieve that by putting in a small segmental block retaining wall along the northeast corner of that maintenance area that wall would get no more than 3 ft High which would just be about 6 in higher than this Des at its highest point and that will be here in the right hand corner we're proposing drainage so we would be able to pick up some of that runoff in case because everything slopes from west to east in the general direction of those residences that's just the way the land runs the way n Road slopes everything slopes from west to east so we would pick up and put an inlet there and there's an inlet out in n Road and we would connect that Inlet to n road to provide some drainage we would also provide a uh a fence um it's a uh what do they call that a box sorry I forgot the name of it it's a um board- on board fence uh shadow box I'm sorry fence so it would be a wooden fence that would go around the maintenance area and the shadow box is is a good alternative we think here because if it ever got bumped it ever got damaged it would damage the inside and it could be repaired before it broke through and damag the outside so the shadow box is very good it's an opaque fence um you can kind of see through it if you look at the right angle but uh it's a typical I'm sure everyone has seen that and I think there's a detail my plant set of a shadow box fence um I think those are the uh some of the general improvements so I forgot the Landscaping so we're providing 11 uh Arbor vites along the east side between the residence and the maintenance area and three uh red Maples along n Road and all of the areas around that maintenance area would be cleaned up it is overgrown um it it could definitely use a little maintenance some of the trees would be cleaned up there's some Vines and everything that are on the tree so in general I think the applicant wants to uh uh clean this area organize this area and and make it a nice feature um but it is it is necessary to the operation so I think I think that's all I had any questions of your client um no I think uh we rest as far as this that story unless there are questions Bo well Mr kiano I'm going to ask if you have questions of this yeah I have questions but I also have some comments or recommendations um so like thank you for clarifying what that area was uh where you have the appliance storage again it it just sounds like this area over time has gotten you know messy and uh materials left there and equipment I think the effort should be made to kind of quantify areas so that it helps it stay organized almost like a closet organization you know TR trying to get it organized so with that said most of my comments kind of are in that vein in order to keep it neat over time also to give any um U some direction and some assistance if there's any kind of compliance issues to quantify these areas say for example um if the storage of these appliances are all over the yard I think you should I think the plan should be revised to identify the area call it out and then delineate the area in some way and I'm not looking to make it uh super expensive but uh either by some kind of fence or some other kind of way you're delineating the stockpile area or even a concrete pad uh for the appliance area um that's not listed in my my comment letter but I I in the same vein um you noticed on our comment 8 um you're going to be doing unloading and loading of the rolloff containers that's going to be subject to beating up that gravel area again we suggest and very typical for use of rolloff containers concrete PS I I I will try to address that and that is a it's a large area there are a lot of them um and there is slope to the property um they are on gravel right now and I think we'd like to make a go of that I think um your planner did note that we would need to yet another variance for uh lot coverage I concur with that I mean the site was built in a different era when lot coverage wasn't maybe you know such a thing and uh so there's a lot of impervious coverage out there however they're on gravel now we don't really see any erosion or anything like that we would maintain it but I don't know if it would be completely organized with within that concrete pad um but I think I I've really tried to achieve exactly that is to compartmentalize where things would go and we looked at it systematically so we put the material here along the east side so that as Vehicles come in in and they pick up stone or they pick up whatever it is that they're storing and it may not be I depict 1 2 3 4 five stockpile areas just depending on what materials might be there I should also say um and I noticed from the photographs I mean there might be a few things in the photographs but it's never been the case that and and maybe I overemphasize the appliances and in fact speaking with the maintenance Personnel tonight they're go they're not really planning to the appliances here however if down the road you know hey we had a busted refrigerator and we need a place to just put it the guy's going to come and pick it up tomorrow morning that's really what we're referring to they don't stay there in none of the visits that I've been there had there been look did it appear that a appliance had been there for a long time there was clearly an appliance there one time that I came and the maintenance Personnel said these pi picking it up tomorrow morning we do not leave the appliances here in this area so uh there was some Machinery there that is gone there was some the small dumpsters that were broken that was gone you can see in the photograph that the refrigerators are stacked up they're organized in an area so someone could pick them up and I'm referring to your letter of September 3rd uh and it is on page three um and it's the top photograph that that's what I have observed is a number of appliance just organized ready to be picked up and you can see that you know there's no weeds growing through them there's nothing that looks like it's been there for a long time um so what we planned to do was just to organize that there so he could come and pick it up I don't know if I I understand the suggestion that off fence there but um but I think that's it's really just that short amount of time um so that being said I think we are achieving exactly that it's the masonry area the material area the dumpster area and again we were sensitive to the location of things compared to the residential by moving things away from that residential area okay and that that was just my first question could you go through our January 10th our last week's comment letter engineering comment starting with comment three how you are addressing them or what your game plan is and then the board can I'm sorry I I'm not in receipt of the letter I I can what was the date of the letter it came in uh Friday the 10th or was sent out I don't I'm willing basically um it's going to take a little time uh basically um our comment was we like what you did or the attempt to for what you're doing with the plantings is a step in the right direction we this board we like to have the township Forester involved um there's a lot of invasive species along the frontage and also along um the sidey yard um I noted that you're saving some of the um mature trees that really are good trees um so I would recommend that you uh coordinate with the p Forester for any kind of recommendations of trees to be removed or remain and then if he needs you to supplement your planting plan by a tree uh a few trees um to make it you know to improve the planting plan because there are a lot of like you mentioned Vine and invasive species out there which is which is really junk trees um so that was my first comment the other one next comment four is more of housekeeping um with the regard of actual site plan uh we noted that you kind of Revis the parking that that's what was uh needed to be done uh you note that there's 2 there were 21 spaces to be reduced to 18 we count 17 don't I don't have an issue but you should have the plan updated uh if if that is in fact the case and also kind of right where your pencil is on the south southern portion all the way down there is a noted as an existing handicap space there okay um we'll want you to do your homework on there to see if that space if you need that for your handicap space count for for the complex and for for the buildings and that space doesn't have an aisle so it's non- compliant so we're not saying you need to keep it but we're saying it it's non compliant what it is so that that's our next comment comment four uh comment five is more going back to keeping the place neat and also giving the uh any kind of Code Enforcement a little bit of more uh um Power to be able to kind of enforce the neatness of it and it's regarding the the dumpsters um again it's you kind of address that there's six dumpsters there and we're looking at them if they're all lined up like that um you you don't have access to at least the ones on the the Far East Side because they're blocked by the stock pile I'm just curious on that well I I agree and I I think this is again a general area they could could push back a little bit they could turn a little bit maybe we only do four material stock piles we're not entirely sure it's it's this this area has been kind of uh the use of it has changed a little bit kind of season to season it changes day to day season to season so you know if someone brings a load of stone for a job that stone gets used up and then it's gone and then are you able to do the operation showing with five dumpsters I know dumpsters come pretty quickly if you need a replacement dumpster when we you know obviously just trying toat it up yeah we would and I I want to apologize for the record I I don't have a copy of your comments and I if I could get a copy and I certainly will uh address those I I didn't mean to uh um but if only five could fit in that area comfortably and I mean if that's the preference we certainly these are my recommendations I defer to the board if they if you think that's uh required or need it as part of the application again we think that the concrete pads are appropriate again it identifies an area it keeps it it keeps it need of the concrete patch of the dumster locations also um we talked about the trees already that was my comment uh nine um can I just ask it when as far as the Landscaping I know there's the the natural landscaping that's there while while uh it does create a buffer so I mean we would try to save as much as possible just for the Aesthetics of you know and add to it obviously take up the vines that's killing I agree with your approach of the the aror body and and putting that SM I think that's going to go a long way in neing up that area and screening that area I just um just take it one more step further and have the township Forester involved for his recommendation sure and you you I think I think you treat the number of trees you have is generally what uh what's what's going to be needed out there it's just you left a couple of trees that are that are ra you know that are uh invasive trees so the Forester is best to give some guidance on that um and then our comment we had a comment would you didn't have you don't have about uh we like the idea that you you're regrading the site we like the idea that you're putting the board on board fence we like the idea that you're putting the low retaining wall there and the heavy screening planted screen scening of I'm thinking it's a mature treat height of the great giant Arbor VY of 20 to 30 ft is is that what your PL calls work mature height yeah um that that all makes sense um you have a storm inlet at the northeast corner there we don't have issue with that we see that it's graded that way but our comment letter is that you uh look into this further especially sitting this is all gravel and it may get torn up you got to have a high probability of sediment going into that line so some kind of drainage Improvement to uh trap or capture sediment or some kind of all you know modification of that um you can work with our office on on what what we think would be appropriate um that's generally my comments and recommendations uh to the board Christine do you have any um so one of the variances that required that hasn't been addressed yet is that the minimum landcape with when you're buting a residential lot so that lot on the right side needs to be 20 ft and you have 12 can we make the maintenance yard smaller and eliminate that variance I I I think we're getting into the functionality of it um I mean there there is I know when we talked last time it it started out being about 200 by 100 and I know the comment was it's it's it's awful large but we just shrunk it you know by a fair amount in both directions and now if you recall we did comply with the uh front yard setback at least put the fence at that location which it is currently a lot closer to null road so We Shrunk it in that direction um and I should just say that with the dumpsters and there are there are typically four out there and the request was six and it looks like we might be doing five um but the material storage stockpile really needs maneuverability in order to get in there and then we have the dumpsters in the storage area so I I I look at it I observe it I would say that um I think that the arbor the 12T for the arbor and preserving the trees um provides a necessary buffer although if the code says 20 I understand that but I I don't know if these Arbor V would really fill that area so we would just end up with that space um I I think this I think this provides an adequate buffer between the residential right now they have backto back fences the the resident over on Lot 8 has a fence and this fence backs right up against it and it's functioning and I know there's some concern and this was to try to address that but at taking another 8T away from it seems Seems like a lot well I I think this concern is still there about you know containing um the materials I was also out there today there were I believe four dumpsters like you said there were also um tires on the outside of the maintenance area a blue tarp over I don't know what um a couple of drums that look like they've been there quite a while um so what you're providing here is certainly an improvement over what's out there now um but again it it it's a large area um when we're talking about masonry work I understand there's some mixing and whatnot but doesn't most of it occur at the site where the buildings going on well he uh now I haven't observed them there I have been to the site when it is essentially full they have a lot of material there was a lot of brick that was there there was a lot of stone that was there there was a concrete mixer there there were pallets of um the the cement that is used to make the concrete so that was all there and kind of organized and spread out so we're asking for that rectangle in order to you know allow that individual to continue to do that I think the mixer was there so you need your sand your stone the cement maybe water you know whatever whatever they may have uh and then and then this was the area where they stored the stone I don't think that they bring all the stone there in one shot because you know maybe there's only so much you can do in a day and no I understand there needs to be a separate storage area from where the actually going on so I think that's kind of what we look at and estimate could I say that if I spoke to this individual we could shrink it a little bit I I'm not entirely sure you know if that if that's true I just I'm I'm just getting back to the buffer I think your point is can we push it another eight feet and I'm just saying I believe that the buffer that is proposed with the arborite is adequate to buffer out this area and you have a retaining wall and a 6ot high fence so if you can see through the trees you then would see the fence and then beyond that because right now it's a chain link fence it's all overgrown no it's I'm sorry it's a board on board broken fence in some places chain link in other places okay um also if I could just address it's also used during the summer for uh for landscaping for mulch for leaves uh and it's the only empty area to that you know for the 1,00 apartment so it's not like we're going to just you know uh close down a park a parking area in front of people's buildings and you know store mulch or store you know this is understand and different to the building supplies it's also uh you know during the summer as well used for landscaping material storage and use um and as far as the stockpile containment um and actual the stock piles how how tall do we anticipate those to be just just really maybe a couple of blocks high they're typically um I I'm going to say no more than about three feet they don't they don't they wouldn't exceed the height of the fence essentially I would say typically just 3T just enough that the the machine can back up against it or or push the material and use it as a bit of a back stop in order to lift it up so what kind of Machinery is used to deliver just just like a small loader and you know like there there was one in the photograph that was here but just a small loader in order to pick it up and maneuver it and carry it I mean people call them a back it may not have the actual back ho but that's that's the kind of machine we're looking at Bobcat type of no they they could be a little bit larger I don't know the job and I think it depends on the job you know if it's a if it's a big job and they're really doing something where they really need a whole lot of Machinery but we made it 12 ft wide so that's that's adequate and the loader would be narrower than that typically 8 ft wide so um so we made it 12 ft wide and there there was like yeah there was a picture in the engineering letter of one that was there I think it had been there a little too long so that that has been removed but um that piece of machinery would be what we're talking about so what would be in those sand and yeah Stone well it's seasonal not salt yeah I don't think they store Salt out there no that's done by another company that just comes and does that but um you you heard mulch Stone from time to time um there is Stone out there today there's a small pile of stone that would likely go there would help out provide that back stop um you know mulch other materials it may it may not be five like it may be four maybe three I whatever we think we need Mr Matthew you look like you want to ask a question yeah on that Mason those masonry walls where you're storing where you have these stock PS how far off of the fence will those will those structures be uh they look like they're about 5T I just placed them out far enough that they wouldn't move and hit the fence okay so the area behind them is more or less dead area in that area yes but there's other things that are going on here and over here yeah but at least at a minimum you could take that area and put grass there but wouldn't I also then have to push them five more feet in like in other words I'm trying to keep them so they don't hit the fence and break the fence I didn't say you to move the fence well I'm I'm trying to get at what what your comment is I'm sorry no the point is the area behind those walls yes there's no good reason to make that gravel uh we brought the we brought the gravel right up to give it up against the back to the wall to just give it a place to stop that's all I mean could we make that grass I suppose yes we we could even if if it pleases the the it's dead area there's nothing you can do yeah we wanted to delineate the space was the request that we we gave our engineer to delineate so this way it's all just not one big okay mess in the yard and if it's your preference to bring the Landscaping up to the back of the wall you know I I I don't think we would have an objection that well for another reason right I mean it cuts down on a impervious surface I know gravel it's somewhat impious but it's not 100% perious like grass would be and it at least will give us a more of a visual buffer at least behind those behind those uh uh masony enclosures yeah I I I see no objection I'm sorry I I thought you were getting at the moving everything backward no no I'm sorry so this area here I think we're referring to perhaps just making that Gras yeah I mean to the point that you're supposed to have 20 ft we are it is you are seeking various relief technically from us for that I know it's a pre-existing condition we we wouldn't have an objection to that and I'll incorporate we'll incorporate that and and uh with your comments okay other members of the board have questions on this witness on this testimony Mr stanel um I'm just trying to see that my eyes are not working that well right now what what is the actual measurements of the uh masary yard section this just just these oh oh that I'm sorry let me let me get my scale big I have um it's about 90 ft it's about 80 by 50 80 by 50 80 by 50 yeah so I mean I mean generally you know on an I mean how how much masonary work is actually occurring at the facility you're it's the only maintenance yard in the for the entire project so it varies during the time of the year different what what needs to be done if a lot of apartments are being you know renovated you know they are constant well Mas and renovation like I two different things I I should say that a lot of this stuff has to come in and be loaded and there may be a vehicle that may sit here if that worker has they don't use one of the parking places but they want to bring their stuff in they may bring a pickup truck or something in a small truck and just kind of put it right there while they load and unload or or do some of the work and then back it out there are there is definitely loaders and machinery and then a truck comes in I understand the yard and the dumpsters I get I get that I'm just really kind of scrutinizing the masonary area because I mean I look at other Garden Apartments in town right and I mean that's a big yard well it's also for the equipment maintenance equipment we also keep there as well is it is it your is it yes so so there's snow removal for snow removal so there's plows and stuff that be stored there but no like like so it's a third party Mason I guess it's coming in there like no nobody's storing like equipment there like like is there going to be like like what I'm saying is is there going to be cases where that that's completely empty and then there may be days that there may be some stuff there or is there just stuff going to be there 247 365 in that yard was empty today it's it's it's our equipment sometimes it's in use sometimes it's actually at different parts of the development but it's it's uh it's all your equipment okay I should say if you went there today there's almost nothing there today just I I did see a pile of stone as I look to my left there was a pile of stone there I don't know what they're currently doing um but concrete doesn't cure well in the winter so this is really not you know concrete time um but in the summer maybe they save some of those projects for when concrete will cure better um I have been out there when I first was called out to the site it was full and it was larger um this area used to extend further toward n Road and there was quite a bit of masonry material there there there are also forms you know the planks were there the first time I was there so there was a lot of wood laid out as form work I you know so I I don't I'm not a Mason but I I I I definitely say that they had a lot of of material and Equipment the first time I was there and there's none there tonight I I have a question um so for the stockpile area you said that that could be a flexible area but could we have a set width for the outside walls of the stockpile area just so our so our plans on in the township records can be referenced with some sort of accuracy that this looks like about 60 ft in length and then you can decide how to divy up the individual Corrals but have a set width of of that area especially since you agreed to put a grass area behind it and we want to be able to make sure that that is complied with is that would that be agreeable to set the width of that stockpile area I think we could tabulate how much area we're going to dedicate for for that portion of the yard okay and then for the temporary material staging area for appliances is there a way to if you're not going to put a concrete pad could you is there paint that you could use or some other way to delineate the area so then people know where to put the things and if someone's new they're not going to just put it wherever I I think the applicant is making the promise that they really if if any of this material shows up it is stored away from the resident so it's if you look at the pictures some of it's here some of it's there the idea the applicants trying to keep it away it is gravel so I don't know if the the paint would work on the on the ground but um I think that's what we're trying to say is that we're going to keep it away and it's only going to stay there for a short amount of time so designating the exact area if the zoning officer were to show up and refrigerators over here that's a clear violation of what we're saying and what we're conveying to the board is that we get it and we want to keep it away but again it's very shortterm very temporary Okay but well at least for the plan sakes could you put some sort of dimension on I can put a dimension yeah it may it may get a little bigger I just than this plan I just want to make sure I get enough room so we're not in violation if we step out of that area just a little bit but that's that's what we're trying to convey to the board is that it it does occur on this site and we're trying to keep it away from the resident we we listen to what they said I mean there's no harm in I mean just putting a chain link Corral around it we're going to try to delineate the area so we won't take into so it's kind of like some way to you know obviously we're not going to put it in front of the stock pile brows because that'll block but that was the goal we're trying to rather than just have it a free-for-all open yard we're trying to delineate areas and we'll incorporate no but if you have if you have like a chain link Corral there you know and let's just say it starts to fill up the dimensions that you've delineated to us right then the chain link Corral is going to make it very obvious that somebody needs to come and remove it remove stuff versus nothing there we try to we'll try to delineate an area and and had it uh incorporate that any other questions by members of the board on this testimony Mr deiro yeah at the last meeting we had a number of ATT tenants that were here very emotional very upset with um this area and I don't see them here tonight so I'm I'm assuming this presentation was made to them too or something similar to this the the the presentation that we made in November uh uh what we did is we incorporate what we tried to do today uh as we incorporated the comments that we received in November I did speak to uh one of the most vocal uh neighbors that had written uh and and listed their conc conerns I spoke to him I got a copy of that and we tried to incorporate it um I we I have not you know we didn't receive the the January 10th comments to the board from the engineer uh we W in CC but we will certainly um you know take these comments and try to uh further that's good one of the handouts at the last meeting it showed from the some of the apartments looking into that yard the mess that was in the yard and and I don't see any of those people here tonight so I'm assuming what you proposed I satisfied them when they would be here complaining again tonight if if if if I may the the um it's it was a single family homes on the border that had C that in my understanding were the ones who uh who had objection and who wanted improvements made uh to the rear of their property so they don't see and it's yeah there were some of them but there were some of your tenants too that can see through your gate you have you have tenants to the west of that gate mm and there was a photograph from the tenants location looking into that area I remember that photograph what we tried to do is improve the fencing improve lands improve the area so you know they're not looking at what they were this is this is much better than when you when you were here last time okay well thank you and we're willing to uh make it work okay I have actually a couple of questions and it actually gets to what Mr Deo was talking about is is somehow I missed a little bit of the discussion of the buffering that would occur on the west uh on the west side of the uh area in question mhm yes I see Greenery along that on that depiction I don't see any of that on the other depictions so that those are existing trees those are existing trees right so we estimate yes to remain and I think that's important because um that this is this is has multi it's two stories I believe looking out and trying to keep that existing tree canopy is what we're intending to do along front now we've already agreed to speak to the township arborist or Forester I'm sorry and see if anything can be approved upon if they say well that's that tree is dying or it's dead or it's invasive or whatever we have to take it down we we would uh the applicant is willing to enhance that area again but I think nothing beats the existing tree Camp okay so You' be willing to replace any trees that have to have to come down I I I can speak with the applicant but we're we've agreed to work with the Forester to to improve the plan all right the the other thing is and and maybe I missed it but in on co6 in your application you show a stabilized Construction entrance yes is that to remain or is that just for the construction period no that's that's for construction on co6 I have a soil erosion and Sedum control plan so this disturbance equates to more than 5,000 square ft in fact it's about 21,000 Square ft almost 22 so we would require an a uh certification from um the uh moris County Soil Conservation District and that would be required but that would be removed to answer your question so once all the work is done that would go away that would yes okay I'm just I just wanted to know these things uh I think that answers my questions any other members of the board have questions on this this time are there any members of the public who continuation until and uh assuming you give us a continuation of any time that might or tolling of any time that might come up sure um in February Nora what do we have available checking I get you on March 3D I think that would be um agreeable I don't I I'd rather I'd rather incorporate uh I do I do see the engineer took his time and in making uh comments and and suggestions and and I would like the opportunity to address them and incorporate them in our revised plan so uh March 3rd um would be agreeable if the board approved that do I have a motion to continue this case until March 3rd just be to appoint our firm to do the investigation to determine if the area indeed qualifies in need of Redevelopment this is the shopping center sort of just across the street where the movie theater is is it what the theater yes it is that whole property it does not include the McDonald's um but it does include the shopping center the the movie theater the movie shoing yes it's a whole area into the back so everything except McDonald's and the uh think the the gas the the uh propane propane is next of that the propane property part of that I don't know if it's part of that but it's right next to it um let see if I can figure that out real quick for you who's requesting that brickmore oh oh the council is yeah I know that who's request of the council I guess brick bricks or whoever this developer is you speak came to the council and it was put on the agenda what do they want to do I don't Miss Hernandez do you have any uh thoughts from well I voted yes on Council it came to us kind of abruptly and I voted yes because there is no harm in having the planning board look at it and do their due diligence for a need of Redevelopment having said that now how do we go for it I've only been on that that side of it for this and now on the other side of it so as far as the process um assuming the uh plan board tonight folks to do the study or assign the study um I will complete a Redevelopment study in uh compliance with the local housing Redevelopment law to determine whether or not this property qualifies for redevelopment under the law once that's done the state comes back to this board they'll vote on it ref referred back to council with have a public hearing with a public hearing yes and Council will vote on it also then determine whether or not it indeed meets the criteria um assuming it does meet the criteria The Next Step would be to do a Redevelopment plan and decide what potentially could be here on this property yeah so many steps yeah so I have a question because it seems like we've had a lot of them before so now that I'm sitting here on the planning I want to ask sure how did we get some I mean it seems like it's a little stringent in to designate that am I incorrect in thinking that um there are eight different criteria we can look at and typically um a property that qualifies is going to qualify for more than one so it could be due to the state of it you know you've seen the movie The I think is you know it it has a certain um amount of vacancy and time of vacancy that would be one um you know the the structures could be problematic we've seen a few where they're just unsafe um so there are a variety of reasons okay okay yeah and and the study that Christine's office will prepare will outline will review the entire property and say why the property meets one of those criteria or not and then the board reviews it and makes hears from the public and makes a decision thank you I look forward to seeing that part of it any other questions by members of the board of our planner is this a public hearing public would be invited to ask questions or not at this at this time this is just a vote to designate um AR to prepare the study right yeah all right so all we're doing in this meeting is exactly what our attorney just said we were asking AR to look into whether this is an area that is qualifies to be in need
