February 4th 2025 at 6:30 p.m. is the agenda meeting February 18th 2025 at 7:00 p.m. is the regular meet uh regular meeting uh for the public we're going to go into a quick close session for a few minutes uh to discuss uh some attorney client privilege matters uh with that being said I'm going to go ahead and read the executive resolution um whereas the open public meetings act PL 1975 chapter 231 permits the exclusion of the public from a meeting in certain circumstance es whereas the township council is of the opinion that such circumstances presently exist and whereas the township Council wishes to discuss attorney client privilege affordable housing and whereas minutes will be kept and once that matter involving confidentiality of the above no longer requires confidentiality the minutes can be made public now therefore uh now therefore be it resolved by the township Council the township pacii Detroit hold that the public be excluded from its meeting motion to adjourn it 7:27 p.m. where we discussed one attorney client privilege and litigation matter dealing with the affordable housing no official action was taken copies of these minutes will be available at such time as the council determines there is no harm to the public interest thank you uh at this time I'm just going to call very very briefly uh attorney uh Mr glass just to kind of quickly explain what we discussed very quickly 30 seconds no I'm just kidding uh thank you very much um so yes so before the governing body and for the Public's uh uh for The public's information there's a resolution uh regarding affordable housing uh there is a statute that requires municipalities throughout the state to take action uh committing to the affordable housing obligations uh the numbers uh calculated by the department of Affairs um those numbers were generated in October the municipalities have had a chance to review the same uh there is a basis to review them and I don't want to say contest them but issue with some of the calculations um with one factor of the of the statutory uh one of the statutory factors the Township's affordable housing planner has reviewed that a report analysis was issued and would be provided with the resolution uh the department of Community Affairs issued uh obligations that are 138 units of present need which for Simplicity is Rehabilitation units that exist for rehabilitated for affordable housing um and 553 units of prospective need new construction which is a theoretical obligation of what how many units need to be constructed in the next round of affordable housing which is a 10-year period um through the analysis provided by the planner uh the land capacity factor which is basically the available land available developable land in the municipality in a simplified uh way of looking at it uh he's reviewed that and determined that a more appropriate a modified obligation would be 496 units uh that's not a number that would actually be constructed but that is the obligation um the municipalities have to act honor before February 3rd after which they have to transmit their resolution uh in essence file it uh so that's what the Govern body has before it and then down the road honor before June 30th the municipality would adopt a housing element and fair share plan to put the numbers into play and address the needs through adjustments um credits and otherwise uh so that's a little bit of the of what the governing body has before it and um hopefully provides an overview for the public about what is going on here and what the resolution uh addresses thank you Mr glass thank you thank you for that okay uh moving along going right into public session at this time I'd like to end a motion uh to open up the public session speak on any matter good evening kandulski uh first I would like to thank you very much for putting the ref the uh resolution for the uh climate super fund act on the agenda and I will optimistically thank you in advance for passing it second uh I would like to know if in as part of the fair share housing work that you've been doing if you use the information that was provided by the Highwoods Council and what if any effect did that have on on your numbers and what you think is you know uh your your position going to be has it helped or where do that stand is that are you done with all your questions yes okay okay yes please good evening Ed snikes with Burgess Associates uh we did use the we did look at the Highlands information um but that was that information was different than the Department of Community Affairs from the standpoint of the data sets that were referenced by the legislation of the state so therefore we will be going forward using the highlands data in order to look at adjustments something called a vacant land adjustment which is what we did in the third round to reduce our number but we'll be doing the same thing in the fourth round so we will be using the Highland data for that specific criteria we didn't want to deviate from the DCA because DCA came up with these specific analysis outlining the legislation so it was advisable for us just to use the DCA calculation you don't know can't go back no no we can't go I'm sorry can I I don't can can he tries that we got to we got to stop public session closed uh hey Nick Nick comak from Lake Kaka uh two quick questions that don't slip my mind what's going on with the trash Nets that we talked about to try to get uh to to catch all that storm water runup all that plastic and styrofoam uh that's affecting the uh uh Troy uh Meadows and uh thanks for putting the climate resolution and uh I have a question about the affordable housing uh we say vacant land but doesn't precip have a lot of land that's suitable for redevelopment so in other words we shouldn't be taking any vacant or un undeveloped undeveloped land and uh is do we have a mechanism to challenge something if we think it's inappropriate I know the njsa 5227 D has different criteria concerning environments and uh enforcement of Master plans uh like right now there's something going on in the town we have a conservation Zone and we have a nonprofit religious institution who's trying to stick 29 units six affordable in a conservation zone so I would think that's an example right there of an inappropriate proposal and uh I guess the main question would be is the town zoned do we have zones that we know this affordable housing is going so it would be SE Redevelopment and zones that we've established already because we to me this whole thing going on South bwick it almost sounds like they're like a spot Zone you take a a conservation area and you and you want to put affordable uh units or they're using a ploy of affordable units to get their uh apartment complex so if I made any sense and you can answer any of those questions uh I'd appreciate I forgot the second thing I was going to ask the trash it and there was something else but eh I'll think of it next time all right so well I think with uh number one with the wildlife preserves I believe four or five meetings ago uh there was supposed to be a meeting between the administration and Wildlife preserves I don't know if that's happened no there wasn't okay Mike can I'm sorry Council can speak to that they uh number excuse me some insane number that they were trying to charge us something oh yeah yeah yeah yeah so that has not been resolved yet you might remember that there was a trustee from Wildlife preserves that says that I was mistaken but I had a copy of the letter from her attorney in front of me which said that they wanted upwards of it's over a million dollars for an easement that we already have there so I sent in October I sent a copy of all of the documents they submitted a site plan I think in 2021 which their own site plan delineated our sewer easement going through two of their Lots so I think it's hard for them to argue that they didn't weren't aware of the easement so uh I'm waiting for response I sent a follow-up letter a week ago to their attorney saying hey I sent you this information back in October we'd like an answer so that's kind of where we are and then I think on number three we can't comment on any applications before the zoning board correct anyone else come on up Bob Bob excuse me Bob vanzi of Pary the climate Superfund act or CSA is a bad bill which should not be supported in a resolution by any council member for the following reasons first both the proponents and the opponents of the CSA generally agree that the bill does almost nothing to alleviate the core problem of reducing greenhouse gas emissions the one thing CSA does do is generate large amounts of tax revenue which is why I describe it as a money grab created to help balance a fiscally unsound state budget supporters will tell you that the proceeds of the CSA can only be used for qualified expenditures but the economics textbooks don't consider the fungibility of money and the resourcefulness of politicians many qualified CSA expenditures such as upgrades to Road sewers and Water Systems heating and cooling systems Etc already exist in the general budget all you have to do is designate CSA funds for some of these existing qualifying projects and then shift the money currently being used to fund them to other items in the budget or to Surplus I also describe the CSA as a backdoor tax on New Jersey residents because energy companies will simply pass along the assessment to the public renowned Economist Joe stiglet Joseph stiglets says that cannot happen because any attempt to pass the cost along to Consumers will cause them to lose market share to companies that are not being assessed there are several problems with stiglets reasoning first as stiglet say stated the CSA does not affect the Global price of oil but like other overhead items such as marketing and taxes it will affect the price of gasoline at the pump in simple terms the CSA is just another form of tax second for economic reasons the energy companies have no choice but to pass the CSA onto consumers on average fuel companies make 14 cents on every gallon of gas that is sold if the CSA is passed New Jersey will impose an estimated charge of $2 billion per year while during the same period of a year the state pumps 4.6 billion gallons of gas per year if you do the math that comes to an assessment of 44 cents per gallon which cannot possibly absor be absorbed when you only make 14 cents of profit to begin with and who are these companies not being access assessed that will exert pricing pressure if the offending companies try to pass the cost on to Consumers 38 of the largest energy companies in the world are being targeted by New York so really who is left to exert this pricing pressure next supporters of the CSA want fossil fuel companies to pay for damages caused by climate change I disagree consumers including everyone in this room have voluntarily decided to burn fossil fuel products for transportation electricity home eating cooling Etc knowing full well that in exchange for not having to live in the Stone Age there will be some damage to the environment if anyone should be blamed for fossil fuel damage to the environment it should be the public I would like to make one final comment about the CSA the state of New Jersey will be sharing some of the CSA money with politically connected municipalities now uh consider results that uh was returned by artificial intelligence when I asked on on a on a computer the question will most of the funds from the New Jersey climate super fund act be distributed to less affluent municipalities the response was seconds Sir yes the New Jersey climate super fund is designed to prioritize less affluent municipalities that have been disproportionately affected by climate change these communities often lack the resources to effectively respond to and recover from climate related changes and so on and um so basically parpy should not expect to see to receive any CSA money in summary the new time's up B okay you got it thank you Bob I appreciate your comments I'm supporting it because climate change we understand it now everybody here understands it now but for years these companies did understand it and they did not do anything for renewable energy and kept the prices of fossil fuels low we have a super fund that pays for toxins in our water we agree that polluters that pollute to clean that up it's the same thing and people we can't blame people for the only thing that they have they Henry Ford made an electric car there was electric cars a long time ago it was easier and cheaper and the big guys made a lot of money and the money will go to the municipalities and you say that there'll be tax I beg to differ because we are being taxed an average person in the next few years they expect will be $65,000 per household those taxes come to us when we have to make these repairs to storm water floods everything that's going on besides the stuff that you don't understand not that you don't understand that we don't understand when somebody gets sick somebody has lung cancer somebody has osma and COPD and all these things are just part of that so I we disagree on this but I just wanted to point some of those things out it's I think really important that the big polluters start taking responsibility I'm not worried about Exxon just like dup you know and love canal and all those things before in the past if you're polluting you got to clean it up plain and simple not we're not going to okay we're not going to go back and forth I know I understand and I appreciate we we can we can talk you and I but and I think stiglets was was correct in his his report yeah I have a a different perspective and it's always good to hear both sides of an argument I I am not in support of um this resolution uh I'll um keep a lot of my comments about why it was just added along with some other resolutions in in my Council report which I really do not like but uh you know I think the best way to promote a social goal is allowing Market forces to determine the most cost effective way uh for companies to meet their emission goals and I think that's what cap and trade currently does it provides uh a financial incentive for companies to hit their emission goals while allowing them economic flexibility and I think the message that I constantly hear from businesses whether they're small or large in New Jersey or at least in Pary uh is that they are over regulated they over they are over taxed and they deal with too many mandates that is causing them to pack up and leave the state so um I you know do not also like using the power of government to Target and punish companies because they are not aligned with a particular social goal of uh of um whoever happens to be in charge so well that's going to change in the next few years so I'm glad at the state level we might be taking care of what's going to happen nationally is all those mandates are going out the window so if we on the state level if the municipalities like P can get some funding for the these issues I think it's fine because Captain trade hasn't been working and I also all that stuff was working we would be using these fuels mayor um did you get a chance to reach out to the league of municipalities um right we did yes but haven't responded back yet oh good so okay I'm going to be checking uh tomorrow with the president of the leag so I think maybe we could consider pulling it I would like do not to pull it from the agenda please my name is Jack Reyes I'm a member of the participating Board of Education My Views are my own as a as a private citizen and do not NE necessarily reflect the views of the board of education on January 8th I attended one of four Statewide hearings of the school funding Reform Act uh the hearing I attended was in Somerville New Jersey about 60 people were in attendance most of whom were from Northern and central New Jersey school districts there was a mix of Board of Education members superintendents and other administrators as well as some concerned citizens it was a learning experience for me to hear some of the problems school districts have many raised the same issues and suggestions as we did attending a meeting with so many other districts and attendance made me thankful that this Administration has managed its budgets as well as they have many school districts have been impacted far more harshly than parity none of them raised the issue of Pilots which indicated the towns are not pursuing a pilot strategy despite the absence of Pilots several districts have had to make Draconian Cuts in teachers and and other Personnel along with increasing class sizes one school district mentioned a teacher headcount reduction of 27 teachers and it wasn't an exceptionally large District it was much smaller than parity other districts have had smaller Cuts if not for delays in the opening of 1515 Route 10 which was for which was projected for late 2024 there would already be an influx of over 200 students in parity Schools Littleton Brook and parity Hills while we have the physical space in the school district there while the physical space exists new teachers and support Personnel would have to be hired or class sizes would have to be increased this will only exacerbate budget strange for the next school year which is 2025 2026 before the June primary the town should be aware of the additional cost of educating students on pilot projects and the absence of Revenue to hire the necessary additional teachers and and support Personnel the only other option is to radically increase class size and we had a taste last year of parents reactions to just the possibility of increased class sizes and it was not very welcome thank you seeing no one was done tonight but I do want to bring up resolution 2025 - 038 creating a mount War subcommittee to assist the township addressing the affordable housing issues and the two members are from the planning board and that's the chairman Tom denmore and class three member Jennifer Smith who will be um you know meeting with us uh when you I guess call for meeting uh on January 8th I had the incredible privileg of accepting a $11,000 donation check for the P food pantry and I want to thank um Unity Bank Deval bot the manager of Unity Bank and lake kwath and Carman Sado the business development um when I got there I have to tell you that that check's going to go a long way um our food pantry was not not depleted but it was very low so I thank them so very much for you know um helping out for sitting here also on Saturday January 11th I was joined by the owners G uh VJ Joi and AE josi general manager of nesle catham Mones the assistant general manager esper Navaro we held the living coming for the rebranding of H owned sester sweets Homewood Sweets located at 61 in Bas Parkway joining me were council president Paul kifi Jr Council vice president Frank neg and council member Justin Mella so I thank you guys for being there also I had a meeting with the LPA that's the lake P peoples of Americans Association to discuss improvements around Lake barany that are the responsibility of the township so there will be a coordination between the township and the LPA also I met with f pharmaceutical last week um it was a meeting that I had with him um when I first came back as mayor cuz they added on an addition to their um building and um I have to tell you firing has been a great addition to the township very involved in the high schools with the science technology engineering mathematics mathematics and that's the St program um as you know we've been getting a lot of onee breaks excuse me I got try this call water main breaks and part SI I want to thank the water department the men uh that go out there and repair that so we can have our water and all that stuff they've been doing a fantastic job also I would like to take a a great thankful thanks to the blue collar workers thank you Michael um for this past Noom I was out there on Sunday night and I have to tell you non-stop Around the Clock got a lot of Kudos from the residents uh thanking you for all the hard work that you've done um and that's that's really important I keept our s our road safe our emergency vehicles were able to get through so you know we can't really do much without without them out there protecting us so thank you once again also on a very sad note I want to um to pass into Mr Joseph Jan senior who was an icon in P sippy as you know we have a ballpark named after janon field a lot of the beautification that you see in town was instrumented through him over the years that he was the prox forcy director um and we I thank him wholeheartedly he will be greatly missed also um the only thing I want to add here is I I know Jackie said you want to a school funding Reform Act meeting I'd like to know if you want as a resident or a board of education member cuz you know I don't know if you can just continue to do come up here and say I'm not up here as a board of education member here as a resident and I'm going to say it every time you come up because you're a board of education member no matter how you Dice it and slice it that's what you are and you represent the way of Education that's what you do so if you okay if you don't represent them then I guess you're not a Bo member so when they keep coming up to say that it's kind of comical because you either wear the you wear the badge or you don't wear the badge so with that being said I guess you want there as a board of education member correct all right that's good and you report it back as a resident that doesn't make sense to me but okay anyway but thank you uh council president for giving me this opportunity thank you counc councel okay I'll just have to say I don't have a a report per se but I just want to let people know and people that are listening and watching the video that the pori environmental advisory committee meets on the 2nd Wednesday at 6:30 at the library and the traffic advisory committee meets on Thursday at 7 the third Thursday at 7 and they're open to the public and we'd love to have the public come to the meetings that's it anyone else yeah I'll go I I would just like to before I get into my report um you know I recall that the Township Clerk said sent out a very strong email about preventing the constant Edition last minute editions to our agenda especially on the day of a council meeting so you know there I walked into three or four new resolutions that weren't on that didn't have a chance to review the public probably didn't have a chance to review so I want to insist and ask council president that we follow that practice because I just don't think it's right by the public um and it's really disheartening to walk into resolutions that were were I am not prepared for but in any event um you know I'd like to uh congratulate the uh Paran Regional ice hockey team for their 0 shutout against Mars Catholic um they did a great uh toy drive for uh kids in the the Pediatric unit uh so it was good to see them doing something really great for other kids that are in need um completely agree uh with our Blue Collar you know emphasizing the the good job our blue collar workers did uh in pting stone I know they did a fantastic job with um the the plowing and the salting up there so we greatly appreciate it um you know I've been hearing a lot of comments about you know North beverick and the the streetcape I'm not casting stones at anybody um but is there anything that we can do whenever we're having uh road work done where roads are being dug up the repeat repaving like it was with Baldwin from third- party contractors tends to be you know not as uh good um as we would like it to be is there any way that we can you know make some changes there um I think that would be great uh and the last you know thing that that I'll that I'll end on um is on the the Board of Education audit you know what the the statuses um well I did listen to the December 19th Board of Education meeting uh I wasn't at it because my wife went into labor that day but uh I did uh I did listen to it and from from that meeting I heard it was you know their audit was completed early uh they have no internal control problems and about 5 months ago there was this huge rush to spend about $188,000 on doing the audit so I would just like an update on it how much have we spent what's been found when the data is going to be released to the public that's all I have oh I'd just like to address your first couple things um first off the Clos session tonight was a matter of doing business we were told there's a deadline and that this needed to be done I was not going to put the town at liability make it us liable when we're not going to have another council meeting prior to this vote needing to be done so I wasn't going to leave the town out to dry and put us at risk of losing our immunity um so that's why that this this was added no I'm sure I'm not saying you shouldn't put things on that are of utmost importance but if something like that is so important to us and that would be the consequence of not adding it you know we got our agenda on Friday you know why wasn't it added beforehand we had a three we had a three-day weekend we had a holiday in there and we also had a major storm too so no I understand but we received our agenda before all this right right we didn't have today was the first day back at work we had a holiday yesterday what my point is if something is so important to be added to the agenda should be added the time that the council receives the agenda so we have the time to talk to our constituents review what's being added and if something is so important to be added it it should just be sent to us at the time we receive the agenda that's my point well regarding that Justin I have to disagree with with you it's a matter of doing business when things come up to put them on the agenda sometimes things don't come up until the last meeting I'm sure you have two Board of Education members here that can attest that they have addendums at every single meeting that things weren't on the original agenda it happens things come up so you can wait for an extra two weeks or you can bring them up we don't have to vote on them sometimes or you don't have to approve them if you don't agree with them but we all know what's going on here and and we all we all know that things come up it's it's a matter of doing business it happens I I don't agree that we should have to wait an extra two or 4 weeks if it comes up it should be put on the agenda and we should get here a little early to read the agenda I know I do I know council president kifi does and we have questions we ask people but my personal opinion is it's a matter of business doing business it happens and that's just part of you know being in the township or Board of Education which does the same thing because I was part of that for many years and we did the same thing there and regarding other items in town uh I'd like to congratulate Nick bronzino who was made the executive director and they took the interm uh title off um Nick you you deserve it you're you're a great person you've reached out to a lot of different uh people in town that are running other organizations to try to partner with them and do a lot of good things for the town listening to you in the meetings um I'm sure Jack can attest to it you seem like you have a lot of great ideas and we are really excited to have you in that position we're excited to work with you I know you're doing some work now thanks to myself and Jack with the schools um that you're going to be doing some uh some artwork on the walls I'm really excited to see some of that artwork and some of the other things the schools are going to do all the different art classes I'm very excited to see that I'm sure the board of education is and I'm sure the residents will like it as well um regarding uh the library I really have not had any uh recent meeting but we have a meeting coming up and I'll report on that in the next meeting and regarding the great job that the blue collar workers did it was just amazing um I I go to other towns I drive to other towns on my way to work and no towns are even close to what we we our guys do in this town you guys are phenomenal I thank you for the great uh dedication and loyalty you have and uh you guys in my opinion is second t n and you're awesome so I want to thank you for that let me I'll just add to that so when I went to the gym this morning it was one degree with a a real feel of minus5 and guess who came around my house two hours later sanitation department collecting the garbage in that kind of weather so thank you yeah did you get an extra workout lifting your garbage giving it to them I don't have to give it to them they they lift it themselves we we have come and lift our guards Township attorney hey Township attorney uh no report this evening council president business administrator thank you council president um so uh just going to add on to the the accolades for the public workers and thank you for the job you did during you know a heavy snowstorm and incredibly cold weather that you continue to do um it's exemplary work U um under extraordinary circumstances and it is appreciated as as you can tell um wanted to also talk about the affordable housing resolution that is on there um it basically you know thank you to Dustin who uh is our affordable housing and our Redevelopment Council and Ed who is our uh uh Township planner and you know focusing more on uh affordable housing right now and cannabis too um uh thank you for all your your good and hard work over the last couple of uh weeks and months on this issue and your continued work over the next couple of months until the June 30th deadline uh uh to to uh present our plan um this me this resolution was necessary because uh there is a January 30th deadline that we had to meet um we are accepting or we're committing uh to 138 um uh present need number that DCA told us was our number and we're committing to 496 units um it's a 10% reduction of their 553 number that they said that we uh uh needed to uh uh fulfill um there's I'm not going to go into the whole report into everything that was been talked about but there's uh three different categories that can that were that made up the numbers that DCA came up with uh Ed and Dustin focused on one of the categories uh where there were some issues and they uh identified those issues and we have a better number and now the next with the plan uh there's a possibility of making that number uh a little bit uh more possible for us uh we'll see as we go through it and the highlands data will be used uh uh for that portion of it um also wanted to uh uh mention with as far as cannabis goes uh we had HED to have the zoning portion of it on for this meeting for introduction it will be on for the next meeting we had two uh entities that were uh approved back in 2022 we had to uh uh make sure that they fit in with the zoning of this so it just you know a small little complication that came up that really wasn't that small um we just want to make sure we're doing it right so that should be ready for the next meeting uh the other thing uh that's on here is uh an item on the agenda was um uh the changing of or accepting the extension of our budget deadline DCA and local Finance board this year um uh has allowed for an extension of uh the deadlines usually it's pretty much done every year um on a case-by Case basis this year they want you to if you're going to accept uh uh the extended deadlines to do it through the governing body so the governing body is involved and so members of the public have an understanding of it so we should be uh
