and conformance with the open public meetings act otherwise known as the Sunshine Law roll call please M here Theona presid parlay pres Obby pres ftis pres swon here THS here approval of previous minutes motion second all in favor agenda first agenda resolution 26 a document certifi the update and review of the section of the Personnel policies and procedure B any questions Council resolution 27 recognize the retirement payout in 2025 any questions councel seeing none resolution 28 recognizes payout retirement payouts in January and February 2025 any questions Council C resolution 29 authorizes the implementation of a corrected action plan for the 2023 a any questions coun see resolution 30 secure an office space in the city of Pleasantville any questions Council yes when I first resolution the language questions I speak language uh relative official office and official office and the second second resolution so uh I just wanted to share that I the question I spoke to yes the extent of resolution more understood so they care satisfact explanation coun and yeah I I did speak with uh councilman that said just just as a so everyone understands how I draft resolutions and the origin of the wording um for me I look at it from the perspective one do you have a legal right to the property so I ask the question do you own it do you have a d is quable own it have be yes what is the purpose you want it because you needed office space that's it there was no other discussion about what transpired in the committee that's that's a conversation that's fled out between the body so when I'm asked to draft the resolution once I'm satisfied that it's legally enforcable then I add a preamble which is a beginning it didn't come from Council if there's always a beginning just like when I read legislation when I read statute I go to the comment section or I look at the legislative intent because it gives the background so we could have just written um wherefore the office located at 12 West Jersey um also known as the bus station shall here and after be used for Pleasantville city council people would ask the question why right so it it it's for it's to memorialize it for the population who may want to know why today and when they look at it in the future they say okay they need to have a house area for them so that and this can evolve whether you have fully equipped today or whether you have it fully equipped in six years or never it's for the sole purposes of affording the opportunity and memorializing it so no one's guessing about what took place and that you're there and that the body voted to be there because if you just decided let's just move our stuff and put a printer or a copier in there and start meeting there and this Council was no longer and the mayor was no long and the VA was no longer here we're no longer here people would wonder how you got there so it's best to memorialize it so the wording is not from the committee members saying okay please indicate XYZ it's to just give context to it an underlying purpose for which we want to do this and then whether you want to do it or not that's invested with the body and the body boots it up or boots it down than okay so excuse me with that being said there's no hours here yeah there's no hours that it's going to be we don't I mean this is the resolution for it but have hours or anything that you know anything that we're deing with it we know that council is moving in there but as far as hours or any other details there's none when is that be so through you madam council president mayor I understand you want to understand what the usage is going to be um I think that that's a policy issue that you're this resolution is solely for the purposes of establishing a location to meet and then you doc them as things evolve and you say okay we want to have it operational these days or we want to have aute printer and a computer because we can't afford it or we're meeting late at night and you know here in the hours or we're open for business from 8: to 5: whatever it is you decide because this is just saying we're going to utilize this space that's not utilized at the moment so the hours and all that stuff that's a policy issue that you don't necessarily require a resolution for every directive and every policies yeah I mean that's that's all stuff it's I think it's a situation where you have to flush it out and it will evolve with time once you're not in there yet any other questions no not at this time then resolution 31 approved to execute the DY for the communties oriented policy Services cops Grant in the amount of 1, 143,00 924 can you can you give an explanation on this grant please sure the city was awarded the cops Grant um for a period of five years and the award date is as of October 1st of 2024 and it runs through September 30th of 29 and uh this this grant covers two school resource officers and two community policing to include salary benefits pensions Social Security so um we're ready to move on Council Obby was thrilled to see that this has come finally through F because they had been waiting for some time so we're excited um councilwoman you said it's for five years yes ma'am and the entire Grant of $1.4 million um covers all the expenses of those four officers for five years I believe it should yes because um they start off as H with a recruit salary and then they move up the scale and they also are covered for health benefits and um this is not the first cops grant that the city has I understand that I thought that like hiring new police officers you know once you bring them on as a grant and they're here for five years correct then what do you do then you keep Grant is done are you going to keep them on you're going to get we well the one of the conditions especially with the cops Grant is that once you hire them you have to keep them on yeah but U now uh in committee we meaning we we've understood that based on the uh table organization that we would e on be attrition yes that is also understood with the cops grant that that as much as possible I know it's more much more complex just State as as senior members leave and retire usually the cops Grant helps out with recruiting not the same amount but try to equal the amount of people leaving and those coming in yes sir and also to address oh sorry go ahead to to to address part of um L's concern is that we've done these grants before and we also negotiate part of the cost with school board that's the way the Grant in P okay um well once the grant is expired um I know that next month they're supposed to provide for uh a memo and I believe it has to do with this so when they sign and they passed it they would have also send it here and it'll be an opportunity to raise any concerns after the five years expire and I'm Sorry Miss nunz when you say they the school district we're supposed to go right we're supposed there is anou that's coming um next well we're already there that the it was signed by the board of U by the superintendent and then they were going to pass a resolution and our chief of police was there that day as well and I said to them that we also need that memorandum of understanding so our city council can review it and approve it as well correct they always have reimbursed Us in the past have salary and benefits resource offices but what I'm saying is look we've had two studies one we have received yet and the other one we had to stop and it kind of like everybody up here was under at least I was under the impression that they didn't want to hire any more police officers so now we're saying yes to this and getting two more police officers Grant or not we assume the liability after the 1.4 after the fifth year okay so for the next 15 or 17 years we're paying I I just want everybody sure as as folks retire the cops Grant help R plish and bring back new recruits Council me but these under this grant these officers will have to be assigned to certain areas I believe they have to be sign signed to the school and to another area what was other area specific I I do know the other area specifically the community policing and then you have the two school resource officers okay so we can um once we get the memorandum of agreement from the school district we can also look at it if things need to be changed and we make our suggestion to negotiate the back and forth as to what city's going to do in the school district Ahad coun okay Madam president thank you um three of my questions were I address but I just want to first of all say thank you to the body that negotiated this gr one of the thing but I want to question us that from tonight we should start to prepare ourselves as if C when weire tomorrow so that we can have every cross and eye daugh when it happens that is for example if V Day opens we should have in mind that we will have two or four officers that will be coming on board when the grand expires that way we will not be caught without yeah well thank you very much it was a great thing back if you want to other question yes uh as far as Jo in I know what you're saying as far as we have to pick them up but within that amount of time we would be hiring more anyway at least they're hold they're carrying the expense of that during that time no with my understanding that that there were like almost a freeze on hiring and I understand this is a grant the Grant's only for this many years five years after that and most police officers retire at 20 or 25 years whatever if they have the time and the age so even at the very least it's still 15 years I'm just saying that my thought was that they didn't want to hire anybody else now all of a sudden we want to hire that's no I get what you're saying with that but I'm just saying that while this BR is here that we have that we have to take advantage of because that amount of time we be hiring others and as far as what you were saying counc O course where they're located that's you know the school resource office driving the school but the community are usually in the business district and even that you know I understand I say that I knew there's another area Community I didn't know Community police on patrol I knew there's another area so I understand there Community Police and that's they go to the school I understand that yeah that's the community you the community U you go and the dist business district I got the toally downtown any other questions res resolution 32 requesting a six Monon extension for the new jersch Department transportation theal 2023 Municipal a grant program for the B view Franklin Avenue improvements any questions Council see resolution 33 authorizing the billing and special charges for emergency sewer work form at 36 Oakland avue Council any questions G resolution 34 authorizing to change order one increasing the amount from 3, 372,000 to 3,3 8,821 77 which is an increase of 99.5% or $313,200 payment to command Company Incorporated for the Lakes Bay Unity park at the waterfront Improvement project any questions councel I do counc um what constituted almost 10% in LED um C I don't know if there was a prior engineer who was managing the project prior to C so a year ago they were told to look into the unity Park and they did they looked at the contract what was bided out the materials um else so so they um looked at everything that was put out to bid and it took them almost a year to create this change order as they were inspecting what was being installed what was not being what was not paid what needs to be removed and this the unity Park is funded by D with a grant of here we go Unity park has a grand amount of $2,715 th000 and there's a forgivable loan that comes along with it for $78,000 so so it's a total of 3 3,423 th000 and the in increase sounds more is because we have an additional U funding that went into this project and this this is is uh 782,000 what was the need what was the additional $300 some th000 what was the cause of needing that $300 some th000 well the engineer seeing had put together the change order as to what it was and there were items that came off that were not needed so that should decrease well the original the it started the increase the order the change order started out at 391,000 then it took them a year to get it to where it's at today that the increase is overall 33,6 $21 so it was over the 9.5 originally but I'm asking you if if you if you say we're going to build a house for $50,000 and then you come back and say wait we looked at something else and it's now $55,000 which is the same kind of 10% what precipitated the increase you're saying they took things off that increase not an increase right they took things off they saw things that were paid um I have it here I'm not in I all I understand that it change $313,000 the the yes if you want the details of it I I'll you because it's and it's not the money it's a it says the contract amount and final payment to command company that's not CM me it says final payment now first of all that Park should have been open last year it was due to be open in the spring of last year and it wasn't because there was an issue correct so if you're saying to me the issue that precipitated the park not being open on time is what's causing that I could May me but you don't know and I why don't we take this until we get theing information M VA um you may not have it in front of you but you do know because it was discussed with CM me at the commit at the committee meeting there were um I know that all I know that in the past there were some issues that had to deal with pilings um and I didn't get into the details of everything that happened that precipitated a that increased to the contract of command Cod who's working on it for the additional $313,000 okay so if if you're saying that it's like maybe the pilings which we know they needed to add to it then this is a final payment we're going to give them this money and what do we have to say today is February 3rd the par is the Park open tomorrow is it ready to go no Park is um they're anticipating to have an opening may may may okay so do we know everything is is going to be ready in May and if it's not the Splash Pad isn't ready who do we go to if you've given them the final payment I'm not giving them any final that's I that's what this is it says final payment iting there I think it's a misstatement there well then this needs to be pulled and brought back properly because it says contract amount and final payment to command company for the Lakes Bay Unity park at Waterfront Improvement project so if it's not a final payment then let's table this and bring it back with the all the information that I'm asking and to take out final payment out of then we do that okay I'm sorry it's up to the rest of the committee to well my understanding is that is the resolution is just stating what the final payment is going to be as a result of the change order we don't pay until the job was done that's not it that's what we should that's not what it says but it doesn't it doesn't say what you're saying either coun woman go ahead yeah I just I hear the concern and when we look at resolutions just like the one we talked about before where I said there was a preamble just so you know the only thing that's legally binding is when it says now therefore be a resolved everything else is giving a background so this doesn't even have it in the body so if in fact it's not a final payment and it's not in the body it's very easily modifiable by taking it out of the title because that's the only place that it is is in the title it's not in the body at all so if if if that's the only concern that it says final and you want to make sure we're not bound and I agree if it's not the final payment or we don't know it's the final payment or whatever it is I I don't know because I'm not involved in this project then you don't want to have the word there um well maybe you do want to have the word but it doesn't it's not meaningful it's just a title so but you know if you want to be clear you can take it out if that's if that makes a difference to you because it's not you don't want to have any more pays clearly but well what makes the difference to me is nobody is able to tell me to enunciate what the change order is for not a clearcut reason what this change order is for you're authorizing a payment of $313,000 saying that it's final payment and not one person can say what it is absolutely for that's why it needs to be tabled it needs to have more information this resolution needs to be Rewritten with final payment taken out and a real instruction and comprehensive reason for a almost 10% increase in a change that nobody can say this isn't my resolution but typically I understand it's your I'm just say table it's sometimes there's backup that's attached in ex zibit A or B to give some context to what it is maybe that they if business administrator has that I don't know I have an email here the biggest changes reflected on these change orders are a three-unit bathroom trailer and the necessary utilities for it all structural design and piles to install the Band Shell in the Pavilion structures well with that being said I wanted I want to add to that when you say no one can explain to you I don't have it in front of me and we talked about so many let me finish so we talked about so much that day and it was numbers everywhere that day so I don't have it in front of me and I'm quite sure the committee members do not have it in front of and I'm not on the committee so I don't I mean I already know that that's the issue but but um Madam ba doesn't have it in front of her I'm saying just said she just said the bathrooms have been there we've we've had those bathrooms on the plan those those we're mayor they're adding more let's put it in here you have a piece of paper I don't have a piece of paper we're supposed to make clear and concise and informed decisions and this is not can can you go over there one more time excuse me can you go over there one more time to add that was discuss I wasn't on the committee you guys might know and the just said she doesn't know what no I didn't wait hold on I did not say that I said I said I don't have it in this is part of the document anyway of the change order since the construction initiated there has been a number of additions to the project throughout 2023 and 2024 this attachment change order document has been in the works for a while and resulted in a lot of back and forth with the contractor command code the biggest changes reflected on this change order are a three-unit bathroom trailer and and the necessary utilities for an all structural design and piles to install the band shell and the Pavilion structure the lateral being the prim Prim AR reason for the delays previously discussed through 2024 as a quick update both of the structures are now installed and the site work has resumed okay so pull it and at the next meeting on February 19th or whatever have that piece of paper included in the work in the change order that's all I'm asking for does anyone else have any questions no so please resolution 35 all can I go back while I be removing final from the title or what did you all I was say remove anyone else be and attach that document as exist it is part of I have it you to is part of my resolution and forgive me every Council Works a little bit different usually we in my previous work present the resolution but I would also have the attachment to it but again this is has been a big project going on for a while so resolution 35 authorizing a notice to proceed to City Engineers for advertisement of construction and bid Award of Grants awarded by the New Jersey Department of trans a any questions councel seeing none resolution 36 approve the transfer appropriation reserves for year 2025 any questions counselor see none next because in the audit report it's got to be done by February 10 well they've done an extension to March uh the local Finance notice that was issued for um introduction of budgets it's been extended uh like to March 28th or March 30 2025 and who's doing the budget are you because you're not the we don't have a CFO so who's doing well part of my responsibility as a engine is to to be involved in the process I'm already um one of the reasons why we're doing also the transfers tonight is once this transfer is done uh the auditor is going to come in and do um get reports that he needs to do the UN audited financial statement and with that is how we can also introduce our budget and does like DCA know that we don't have a CFO I mean who did you go to to extend this did you put it in writing that you wanted to extend the budget deadline no I did not that comes through finance that comes from the division of local government services who promate the rules and they said that we could have an extension I'm just asking no no you no you can ask everybody says the 10 that's okay there's a local yes is a local Finance notice um if you want to Google it New Jersey DCA division of local government services I do not know the exact number of the local Finance notice that shares um to all municipalities and um counties the extension they typically give last Satur before last the new elected eled office of training and it was announced that the extension was St I just find it I just questioned it because it says February 10th we don't have the CFO so I was just wondering where uh on our city center project we have uh first uh Washington Avenue uh planning board approved a PL we're ready to submit the final and uh finish the project expansion of uh that property 1000 Washington Avenue with the two uh the manufacturing facility for our training manufacturing training and uh aquaponics Greenhouse uh we buil our first tiny home on the wheel um so we like you guys to plan to come and visit what we done with the personing uh now is a ideal Institute of Technology we're also approved by Department of Education to offer uh financial aid from January 2025 so we're running a scholarship campaign for a Pleasantville City members so they're going to be able to graduate without any debt and ideal offers 32 college credit in a partnership at sent universally so I just wanted to share and we're also ready to submit a paperwork for demolition for a main and Washington City Center project uh we have a bank approved the financing so as soon as the the next meeting or whenever the city okay we're going to ready to move so thank you so much thanks so next I'm going have um Sheriff Don he's going to give us an update on the um immigration good evening Madam mayor council all in attendance I'm Joe Tokyo daho I'm the sheriff of L County so I'm here to speak to you about immigration recent updates a lot of concern as you can see Atlantic City had an issue today uh in front of this Senator's office so we want to try to head some of this off and I'm open to any questions you may have about the agency while I'm here um I'll start with immigration basically there are 37 agents for immigration in the entire state of New Jersey the state Sheriff's Association which I'm proud to say I'm an executive board member of had them come and speak to us so we could get some clarification and what their ideologies and philosophies and plan was so there's a lot of fear out here in the community and I want to say to you that this affects my own household my better half is Hispanic I have Hispanic children I speak the language the Carona family at a very young age took me in when my father was sick and raised me this is personal to me as well but I'm here to deliver the message for mice all the rumors you hear about Duncan Donuts and being there being here they're untrue the head agent in for the state of New Jersey is also Hispanic and I spoke with her at a very fulfilled conversation with her so they have no intention of arresting people on the street or stopping people or Sanctuary state were forbidden by law to enter into schools enter into homes enter into businesses and they told me that it's not un they know there are 10 no less than 10 wanted fugitives now what does that mean you have to be wanted for ice to pick you up keep in mind we don't have the opportunity here to arrest people if we don't have the officers to do it right so they're going to rely on outside agencies when that comes now that's what the sheriff's office is about if an outside agency calls us we come however it has to be lawful or I will not come my policy in this state is not allow us to to effectuate arrests of anybody who's illegal or otherwise in this country without having a criminal arrest warrant I want to say that again the average person has nothing to fear now I'm also a realist could that change maybe down the road but as of today that's what we have I am meeting with the assignment judge for this County Judge blee tomorrow and staff along with Sheriff Nolan from Kate May County to decipher the law on this and to go over to make sure everybody has a clear and concise understanding of where we are but I can tell you what ice told me and that's exactly what they told me keep in mind 378 for the entire State there's a lot of rumors there was rumors about Puerto Ricans being picked up Puerto Ricans are citizens of this country they're citizens at Birth now they were picked up in New York because they were in and co-mingled with gangs from South and Central America and they were also wanted for crimes in this country that's why they were arrested not because they were Puerto Rican but because they were were wanted for crimes this is where we're at folks and my my message to the Spanish community at whole is don't let people play you with the fear know the law know the reality of it know where we are you have opportunities and there will be from what I'm told opportunities to apply for citizenship based on your status how long you've been here are you employed that's all coming it has we cannot depending upon what study you go by there's no way that we could remove 11 to 18 million people from this country it's not even thinkable they're engrained in our culture and our society and DACA kids they don't know anything but this country right they're part of this country uh other than that there's really not much to report because not much is going on there were ice agents in hton yesterday in a building that was totally lived in every resident in that building was not properly documented not one was taken out because none of them were the two people they were looking for for warrants serious crimes and my message is if you escape tyranny as if somebody comes from another country why would you want it to follow you here and why would you allow the people you escaped to live among you and do the same thing here that they did in your country you wanted to escape from the sheriff's department will arrest based on warrant and warrant Omen I open to any questions or comments or thoughts that you may have but that's our stance uh I want to thank you very much um for giving those words of assurance one of the things this uh action as a chieve is to create panic in the minds of people yes I am privileged to serve on the board of directors of people from Liberia in Canada Mexico United States and we had a meeting with the secretary of state from Liberia today and the Ambassador and they were also in panic mode looking up to us to see what guidance we can provide my question is are you open Bes sence here to just entertain a little Zoom meeting with community South Jersey that I just suffered from these rumor that are flying all around are you open for such a meeting we absolutely open to that and I can say to you that I've been contacted by several local attorneys and several activists if you will from the Hispanic community and I'm meeting with several of them tomorrow we have on our staff so you know we are in close contact with the Spanish Community Center in Atlantic City the director of that also is an employee of the sheriff's office in our healthc care workers program sitting on this council is one of our people that does chaplain work for the Sheriff's Office listen if anybody knows my family my family is vanilla chocolate strawberry banana and we are culturally Diversified I have 29 grandchildren Basin Robbins doesn't have as many flavors as I do and I'm proud of that so I say to you all and I say to the entire country you should live as my family does because we appreciate each other's culture we love each other and we don't have these issues so we must quell the fear-mongers as a group it's your obligation to counsel to quell that fear not to incite or allow somebody to incite it it's my job as Sheriff to give calm to people and let them know we're only enforcing the law good people need to be here good people need to work and we need to come together we need to be more Godly actually but I'll say even though most people want we need to be more God Cel I was going to ask you also about the churches because a lot of the churches Al a lot of members are not going to church for the same reason but since you answered everything already um I appreciate your words and uh if I be also you can let me know when it's going to be where that Mee is going to be at I join that we let you know brother okay I appreciate just let city council now we are at the beckon call of every community in this County I will not share to you the reason we were here in this city this weekend but we were here at the request of your police chief that's up for her to share that with counsel I sent three detectives and a sergeant here to assist you we assist the police departments in this County we augment and we support we're not here to replace them simply to assist you and we want you to know that I just want yes mayor have question mayor I want to thank you for coming take time to come because this morning there was um someone had excited a lot of fear saying there was going to be a March in year president he said there was going to be a March and pleasant Bill and this something that wasn't be pleasant so once I made a couple of phone calls I found out that it was more or less just informative March that was done today in Atlantic City to let everyone know that we didn't have the residence if you know like you said it's impossible to send everyone back but if they weren't here what we would go through as far as work related and all that yes ma'am and that was peaceful right yes ma'am and we have a couple of people here that want to come and have a mini town hall or something just to you know inform everyone and ease everyone's mind and as I talked to you a couple weeks ago I like you still come yes ma'am we'll be happy to come we're always here for you when you need us that's our job and I will say you I have a vested interest in Pleasantville mayor you know I I Remodel and sell houses from Pleasantville did so before it was popular and I love this this town has tons of possibilities it's great town thank you for last weekend that' very so I thank you any other questions anybody may have feel free ma' Sheriff G is it yes ma'am Sheriff G you can call me Tokyo Joe ma'am I'm proud of my nice to meet you pleasure ma'am um so here's my question and I don't want to get into the weeds or anything but just a clarification I I can infer based on what you've said um and just by way of background I did accompany a prior sheriff sheriff bernick in the stake County about five years ago when the current Administration was in office to ISA work and they were seeking an agreement with the state county to cooperate so is it accurate in saying that Atlanta County has not entered into an agreement with them to cooperate I'll bring you a little bit closer closer to to the facts Kate May County signed went into the bill of 287g are you familiar with that has to do look it up it's number 287g it involves immigration and what we do so it was stopped by a higher court and until that decision is rendered sheriffs in the state can no longer can no longer move forward in a a Direction with ice until that's resolved and that is not resolved nor is it close to being resolved okay you know but keep in mind the community should keep in mind we should never hide a bad element in our community yeah we should bring that forth because that's what reflects on the entire one person can make a community look bad and that's not the case we all know that right if you have if you hide somebody who's wanted for some heinous crime your family could be next so could you so we don't want that but we're not seeking out we're not allowed to and federal funds will be withdrawn under the present rule wellow so yes I know right where you're heading with that I'm not saying a word I I that's why that's why it went back to five years ago was probably more like six or seven and that's you know no it's it's it's until this case has been resolved in a higher Court we're not moving an any and I would imagine listen I'm about safety and law enforcement that's what I'm always been about and I don't want to see our officers get hurt or in dangered but they're not they're not coming in looking for anybody other than the criminals that's that's that's an issue we notify your town just so you know when we're in town there warrant arrests for that reason because we don't want any confusion somebody saw some of our people and they thought they were ice it was the warrant that Vis so I can assure you I is not coming if it changes I'll be back well that wasn't really the question it wasn't about you affirmatively going out and executing or or seeking out is there an agreement it was you answered that and and I haven't been with I was first assistant County counsil with county of B and I represented Sher berck so this was going back before 2018 maybe it was 19 18 177 um the question was and what we were asked to do and we
