moratorium that they voted on or didn't vote on but after they had the uh after they discussed the moratorium they moved on to another uh submittal by councilman Troy Kent and in that they're going to look at the possibility of preventing the building on Wetlands now they're going to have another meeting on that on February 11th and I think it would be incredible if we could stop building on wetlands and I would like to encourage you to get involved take part uh go to the meeting and maybe even uh come up with a they that some sort of Declaration or Proclamation uh that you support telling everyone how she lost her home home and everything she was a widow mom because of a hoarder across that Liv next to her and I have pictures that I want everyone to look at from this hoarder who has no property but he is still bringing things into the neighborhood so we have 117 homes in Sugar forest and 117 people that are paying taxes there he's does not have a home there and he's not paying taxes but he is ruining the neighborhood but this Heathers uh wanted to finish her story and this is it there is not any part of my soul that this man did cause that fire there also isn't part of my soul that believes the people of the city did enough to try to stop him you did not protect the neighborhood from this man he didn't you did not check on the families after the fire so I'm here to show you the face of someone your lack of action hurt your lacks of actions caused my girls and I to lose all trust your act lack of action cost me my home and my girls to lose what they had left of their dad by the way they were eight and N years old when their dad passed away even though oh somewhere so I'm here to begin for the people of sugar Force he is the one man who has more control over all of you so I'm I'm standing in front of you asking to do better do something before he PS more and more trash in here and ruins this neighborhood is and like I said I have pictures that I would love to show everyone what my neighborhood looks like this is what I look at every day when I walk out my front door he wants me he he he told me fire you got I know you got to address US appreciate that and by the way if you do have an extra set of those pictures if you could provide those to the court we'd appreciate that I will I'd love to see him here but he ruined so many lives because the city didn't do nothing the previous mayor I thought should have done more and I'm hoping you will take over we need a new football coach baseball coach someone that can come in and clean up what this is done I I know you're working on it I'm talking to co enforcement things are being done but you know what right now I can share pictures but I can't share the smell thanks Chuck appreciate you coming thank you thanks Chuck Kathleen thank you chck and uh Michelle Edwards good evening my name is Kathleen tarno 791 sugarcane Lane Sugar Forest I've been here twice before you're probably saying here comes that lady again um we Port Orange and sugar Forest homeowners are paying the price for inadequate storm water management decisions 30 40 years ago how could Commissioners engineers and planning not foresee the results of their decisions in a growing City what is the buildout percentage of Port Orange whatever that percentage is I urge the city to place a moratorium on all construction of all types the current Planning Commission must have discretion over Property Owners developing their properties I recall at a previous meeting a commissioner said they can't stop owners from building how can that be I have issues with the FEMA 50% rule y'all might not know this initially you think it wouldn't be a problem until you try to understand how that 50% is determined I believe the 50% is based on valua County Appraisal figure excluding land and has nothing to do with fair market value in addition they evaluate over a 5-year calendar and add together the percentages even if you got a a permit to say replace your windows which had nothing to do with the storm they count that they add them together I am very very close if I were over the 50% mandate I would be faced with elevating using FEMA or fdm em funds or selling my home to the City elevation cost the homeowners out of pockets perhaps 50 to $100,000 even if you receive the 30% additional Grant to offset out of pocket it doesn't cover the homeowner's obligation can the city reach out to the county state and federal government for female policies if I sell to the city they reduce and deduct unused flood funds many families are able to have leftover funds by doing much of the work themselves and have funds available for uncovered incidental expenses how can I duplicate my home in land size for what I receive from selling my home in addition what homeowner wants a new mortgage at 7% I tell you I don't not at my age I'm not starting over in addition if the city purchases homes they are left with open lots and lose tax dollars how can the city afford that with previously set budgets certainly the city doesn't want sugar Forest what about the vacant lot at meline and Nova is that a possibility for storm water what about the Pepper Hill project will that help sugar Forest what about storm water management and the Weir in my backyard how do I get answers to these questions again I thank you for your time I look at each of you and I truly feel in my heart that yall came and you want to help us and you want to help the P orange residents and I just implore you to please do that thank you we do we do thank you absolutely Michelle Edwards and then Jennifer Clan and and maybe Eden at the same time if you guys want to do that Michelle just before you start um so it looks like the rest of the comments are going to be pertaining to the topic of of fluide and I know several folks that are here tonight were here at the last meeting so I just wanted cuz sometimes people will talk and they they leave and they'll Miss some comments later but um if I could just for one minute so um the a lot of residents have reached out I've had some wonderful conversations in the last couple of days and a lot of folks couldn't be here tonight and I just want to acknowledge uh that they still have have reached out to us and provided some great information um I have directed the city manager to place the topic of removing uh fluoride uh as a community fluoridation program on an agenda for Council it will be March the 18th for those of you that's that's the reason I'm talking right now is I want to make sure everybody got has that date so that will be March the 18th and we will be having that as an actual agenda item for that because there definitely has been uh some new recent opinions one of which is by the Florida Surgeon General himself and uh quite a few new studies and it's a very difficult thing to talk about in 3 minutes that being said Michelle this is your three minutes so go right ahead I want to thank you all for being open-minded and listening to the information that is being brought forth tonight I was born and raised in Port Orange and take pride in being a native to this city my father worked and retired after 26 years of service with Port Orange Fri rescue and my brother also worked as a driver engineer for pfr for 10 years until passing away from cancer my family has seen firsthand the strength and Humanity we have as a community in the city I come before you tonight to address the matter of utmost important importance one that touches on the health rights and freedom of every resident in this community water fluoridation specifically I want to speak to the concerns surrounding the practice its implications for public health and the blatant disregard for informed consent when citizens are forced to consume a medical treatment they have no choice but to accept water fluoridation is often promoted as a public health measure but what is too often overlooked is the basic principle of individual rights and freedoms fluoride is a substance that when added to the public water Supply serves as a medicated treatment for dental health regardless of its levels however many residents in the city do not want or need fluoride in their drinking water and their rights to choose should not be disregarded for the sake of convenience or misguided public policy in a truly informed Society Medical Treatments are voluntary not imposed upon people without their consent fluoridating the water supply directly VI violates this principle people should have the right to make decisions about what goes into their bodies especially esally when it comes to substances that could pose health risks there are numerous studies that have raised concerns about the potential negative effects fluoridation including links to thyroid problems neurological damage and other health complications particularly in the vulnerable populations such as children and the elderly mayor sner the US Water Systems website for which you are a water specialist selling their products references a number of these studies on these health risks I can only hope that based on your knowledge of this is that you would have the best interest of your community in mind when eliminating this toxin from our water supply it is essential that we remember our duty as public servants is to protect the rights of the people we serve we should not be imposing unwanted Medical Treatments on our citizens instead we must Empower individuals to make informed decisions about their health and provide them with the ability to choose whether or not they want to consume substances like fluide I urge you to consider the implications of water fluoridation not just from a public policy perspective but from a human one the people in the city deserve the right to inform consent they deserve the right to choose what goes into their bodies and to know that their leaders are acting in their best interest free from any conflict of interests let's work together to ensure that the residents of this city are treated with respect dignity and the fundamental rights they deserve we must remove fluoride from our water supply so that no one is forced into a medical treatment against their will thank you for your time thank you Jennifer and Eden you guys want to come up together yes welcome how are you are you going to go first this time oh come on thank you for having us again um I'm glad that you know you guys have heard from the community and are kind of changing your standpoint and putting water fluoridation on the agenda um we did recently you know realize that you were you are knowledgeable very knowledgeable about water fluoridation and how it affects community members how it affects people um and we really I'm glad to hear that you're stepping up and doing the right thing when it comes to placing it on the agenda um I actually printed out us Water Systems um information on fluoride and so I just want to read it to you guys I know you know it and I'm hoping that you're going to be our activist with getting this passed through because you can really take your group of city councilmen and really educate them on the research that's out there and also um Sean I know you with arrow research and I know that you work with populations that have issues with Alzheimer's dementia Parkinson's um I toured your company before I don't know if you remember me yeah I do so it's good to see you again and I'm also hoping that you take into consideration the research um fluoride is available out there in numerous products now the fluide that's been placed in the water is not naturally occurring it's not safe um your company's website actually says that an active ingredient in many pesticides and rdes is fluoride which is acutely more po more poisonous than lead overd leads to Serious toxic symptoms and some experts feel that water fluoridation can lead to cancer diabetes thyroid and neurological disorders that's what you deal with heart disease arthritis and osteoporosis any level is frequently undesirable um I'm just going to leave it there I'm I'm really glad to hear that you said that it's on the agenda and I'm glad that our community is stepping up and you guys are are listening I'm tiny Mr Mayor it is time to step up and do the right thing you should be fighting to protect your local community because you know the dangers of over flu radiation and you are in the position to influence others in the good way your court Approach at us Water Solutions is stated as there is nothing more rewarding than solving people's water problems very simply we make people's lives better by solving their water problems in some cases we even save people's lives by eliminating bacterial and chemical cont and their water supplies to us there is nothing better than knowing we put a smile on someone's face by solving their water problems thank you well done you thank you you thank you S I always apologize if I'm mispronouncing name Serena sorry thank you and then uh PA I'll just go with Palmer we be next welcome good evening my name is Serena sead I'm from Orman Beach and just was um um happy to hear that we have fluoride removed from our water system and uh so I'm sorry do me a favor just pull that mic up so we here you go yes we have fluide removed from our water system and we're very very happy about that and so because you a neighbor I wanted to come and help any way I could to bring awareness to the subject I'm very happy to hear it's going to be on the agenda um just a few points I wanted to point uh to uh make aware uh there is an NTC report that came out last September updated information on fluorides dangers and you can find that on the Children's Health defense website children's health healthde defense.org the key findings were that floride is a neurotoxic it increases an increased exposure it lowers the IQ by about 15% there are cognitive deficits associated with it and there is no safe level it's even found in the mother's uh inv vitro system pregnant women will have fluoride uh will be exposed to the fetus in in utro babies get larger doses of fluide than any other age group fluide needs to be on well that part's covered I was going to say it needs to be on the agenda but this poses an unreasonable risk to the public especially for the Youth so please again check out the children's health defense.org for links to dozens of peer-reviewed research reports from NTC niad and many others regarding the dangers of florid thank you thank you thank you uh Palmer I I'll Butch you the last name I'm sorry okay thank you welcome thank you go ahead hello mayor and Commissioners thank you again for for having me speak um and thank you for putting fluide on the agenda um I really believe we need to remove this toxic poison from our water supply and I pray that you guys all consider the research that I've sent um and do the right thing so as a reminder the fluoride we're dumping in the water is hydrofor cific acid it's not pharmaceutical grade sodium fluoride there's no safety studies on it um I wanted to talk briefly about a lack of choice um we currently don't have a choice we're forced to ingest this toxic w waste um recently mayor I had heard that someone had called you and um asked about what our choices are in this and you mentioned it it's not being forced on anybody but you also mentioned um you know that they could dig a well and um you know that's that's just not a good solution I think you know um a single mom on food stamps you know an apartment she she can't dig a well there's there's cost involved and I also looked up that the city Land Development code doesn't allow people to dig a well in the city so um basically um I just wanted to mention that um let's see here one second um also the Florida Patient Bill of Rights I mentioned last time 38126 does require that the patient be given informed consent risk benefit analysis and the ability to opt out um this is currently not happening from from everything I can see um with that being a state law um as well as you guys mentioned you're recognizing the state surgeon general's recommendation to remove it from all of the water so um anyway that's about it just wanted to remind you guys about the research that I sent and um hope that you guys do your homework and we can be ready for that meeting thank you thank you Palmer Tara Hill then it looks like uh there's somebody who wanted to remain anonymous so if that person knows who they are they'll be next good ter hi there I'm part of a broader effort in the State of Florida to remove hydrofluosilicic acid from the water supply um as mentioned it's supported by both Florida Surgeon General Dr L Po and the incoming Secretary of Health and Human Services Robert Kennedy Jr and further affirmed by a recent Federal Court ruling that declared water fluoridation a quote unreasonable risk to health so there's two issues here one is whether hydrofluosilicic acid is healthy and the other is informed consent we all know fluoridation including the fluoride that you get at the dentist is a medical treatment I saw you shaking your head um no when the last speaker mentioned that you had told a colleague of mine that if citizens don't want to drink the water they could just dig away well I personally believe that you said that um because I believe my colleague um and they can't obviously as you know in Port Orange digging Wells for a pable use is not a thing so that means you are inflicting a medical treatment upon the citizens of Port Orange without informed consent without any way to opt out so there is no choice I'm happy to see that you're putting it on the agenda I'm happy that you are prioritizing the health and citizens of Port War um I was very surprised to learn mayor that you are a career water treatment specialist you've spent the last decade selling water filtration systems that can remove among other things fluoride you're in your website of your company has an entire section devoted to the dangers of fluoridated water why would there even be a market for fluoride removing filtration if water fluoridation is safe one of your employer slogans is either either you have a filter or you are the filter I believe poort orange citizens should not be the filter for toxic waste anymore so given that people can't just dig a well as you suggested because there's no opt out from the Municipal Water Supply and given that your financial interests depend on the consumer's need for water filtration there seems to be a potential conflict of interest there I hope that there isn't I hope that you have an unbiased science-based opinion on this that is in keeping with our Surgeon General but I do believe the citizens of Port Orange should ask themselves what could the mayor a commercial and consumer salesmen of water filtration system stand to possibly gain by keeping a dangerous neurotoxin in their Municipal Water Supply that people would need to filter another slogan of your company is we fix bad water you have the perfect opportunity to fix the bad water in Port Orange by voting to remove hydrofluosilicic acid and I hope that you do thank you thank [Applause] you welcome howdy everybody thank you for the opportunity to speak either you have a filter or you are the filter that's really good marketing I like that a lot um sunscreen that might be safe and effective for stopping skin cancer but we don't put that in the water that we drink fluoride might be safe and effective for hardening teeth I don't really know but I can tell you that it doesn't do anything when you put it in your stomach okay so is there anybody here that doesn't brush their teeth every everybody here brushes their teeth every mainstream toothpaste mouthwash has fluoride in it already and we don't swallow that we spit it out most of us I hope so um we're all getting our fluoride dose I have been filtering my water my entire adult life I don't like drinking tap water I don't think it tastes very good and we could probably make an argument too that um people aren't getting enough water in America people aren't staying hydrated they're not drinking enough pure water maybe that's because it tastes so bad um so I think that we should maybe put water in our water and make it the best tasting water that we can have without adding anything else without adding sunscreen to the water everybody gets water that's healthy and safe to drink thank you very much thank you Justin Robert and then Bernie b I believe welcome good evening Commissioners and mayor my name is Justin Robert I live at 103 South Oola in Orlando um I drove all the way over here because I got some good friends in Port Orange and I care about the people here also you know do business and visit here a lot uh I've spoke with dozens of Central Florida Mayors Commissioners council members over the last couple weeks uh a couple months actually and they've all been very open-minded ready to look at new science they've been understanding really the concept of giving people the choice I think that's what a lot of people are stressing here tonight whether we consume a medication or not um they understanding that there are different ways to get fluoride than there were 50 years ago that's why we started um and that's why we should probably stop today they're also understanding that it is not naturally occurring fluoride as we've noted going to be repetitive up here and they're listening to the state guidance that is based on a federal court case that was seven years so I know some people are saying we need more data this was a seven-year court case so I think that should definitely be looked into um and as you know or as you may not know um 13 cities and County since November have rejected the practice with more discussing it as we speak Lee County actually just voted unanimously this morning to remove it um but unfortunately um mayor I was the one that talked to you on the phone um last Friday at about 1: p.m. you did tell me that you know I asked what should people do if they don't want to be forced to drink a medication that is lowering the IQ and you did tell me you don't have to drink the water you can dig a well I said I pushed back a little I said that's a little inconsiderate come on don't lie go ahead right here all go ahead you got your three NS all right all right um I pushed back a little but the kicker was we can't dig a well we found that out um then we found out about us Water Systems this doesn't look great I don't not going to you know prove anything or accuse you of anything but it doesn't look good um I personally don't think someone should be allowed to vote on water fluoridation when you stand to gain financially from filters um bit of a conflict of interest in my opinion um I just you do have you know the ability to clear the air here I mean I don't I didn't want to do this I'm not trying to make a stink or cause drama I have great relationships with most people I call I mean we had a good conversation you've been cordial with me and nice but I don't appreciate you know seeing an email that's saying you don't know where the Dig of well came from I mean how do you know I didn't record the call I didn't because it's illegal in Florida but got you three minutes it's uh I just I just hope you can I just be honest that's all let's just do better let's do better when we know better we do better with the fluoride and let's just be honest to our residents thank you so much thank you Bernie b Bernie b welcome welcome thank you mayor and Commissioners um also thank you everyone else for already Pres presenting um all the comments facts that need to be said um I think that the biggest thing here is obviously we don't have the choice of what's going on with the fluoride in the water um I also think that if you had the choice it's at the store you can go bu byy toothpaste like was already mentioned um and again already mentioned you can have the choice to spit the toothpaste out or you can swallow it if you want which I wouldn't recommend but with the water it's being inserted there's no option to to have it not go through the filter in your body so um unfortunately I think it should be removed or fortunately I think it should be removed and um yeah that's my opinion on it thank you very much for your time thank you thank you thank [Applause] you all right council member comments may excuse me sorry my apologies sure um Amber you you it's me you're right ahead Amber welcome thank you thank you so much for the opportunity to speak um fluoridation of water could potentially have benefits but mostly just for young children with developing teeth is the young gentleman with a trump hat mentioned um actually when it's in your stomach then it gets into your bloodstream which then can come back up to the teeth and so kids with developing teeth that's kind of where water fluoridation was successful I will speak on a little bit of success right for that specific population but once you're adult and your teeth have been developed and the enamel is there and the structure of the teeth is there it doesn't work the same way um so whenever you put the fluoride in the water it's a systemic treatment which means you drink it and it gets in your bloodstream which goes all the way through your body the problem is for everyone else once your teeth are developed like this you just drink the water and there is no shown benefit for your teeth enamel the benefits of fluoride are when it's used topically which is toothpaste brushing your teeth or I remember when I was a kid and I would go to the dentist and I would always pick the bubblegum flavored fluoride you know what I mean um so that's where a lot of the research um they're actually comparing topical application instead of the systemic um which is what happens when you're adding it to the water um and then that also brings up a point of treatment so adding something to drinking water which is uh necessity to life is is water um to help with dental issues seems the equivalent to me of like the mosquito resp repellent that get sprayed in the air or those little trucks that drive by and spray my yard with my organic garden um and uh just like water's a necessity I love walking barefoot in my yard and not tracking pesticides into my house but that's besides the point and that'll probably never change but I really truly think a much better use of the money for that's being allocated for fluoridation of water would be for public education um because you can't out fluoride a bad diet full of sugar and acidic Foods um and there would be money much worth um educating the public on how they can improve their dental hygiene without adding fluoride to the water the only question that I have is what is the reason for not taking it out of public drinking water because I feel like systemic treatment with a synthetic neurotoxic substance that can't be regulated by dose seems to pose a much larger risk 26 seconds all right here we go cliffnotes versions um surprisingly through research I was shocked to find that fluoride even administered in a small dose starting AT3 parts per million which is well below um the like recommendations they have can affect thyroid function the skeletal system and the reproductive system which was absolutely shocking to me um that there's a potential that that can be causing infertility issues which that issue is rampant in the United States thank you thank [Applause] you did good to get a lot in there in three minutes Amber job council member comments we're going to start with Mr Green um I just got a couple I uh just want to let let the guys know that again I went out to the to the landfill at Sugar forest and and met with some of the residents out there and looked at that and just um to let you guys know that we we are it is a priority and and it is a it is a major Focus for us uh be patient but at the same time just bear with us because you know obviously everything's got to be done within within the laws and the rules and but it but it is a priority um with that I went out and visited a couple of flood areas this this past week and I met with Mrs tarno in her house and a couple of these things and and that 50% rule is pretty scary when when it's all said and done because they're taking a fiveyear average plus if you pulled a permit to replace a window doesn't seem quite Fair um but uh at the same time I just want people like Mrs Taro to know that that we do care 100% anything else no I'm good Sean so uh I to went through sugar Forest to see firsthand what you guys are living with there and and I'm just uh you know it's a shame that you're having to deal with that I know that this staff and this attorney here is doing everything they can to expedite it's it's courts and and laws and they're hard and uh so but uh you know we're not turning a blind eye to it that's for sure and we appreciate you coming out and sharing that with us and I appreciate all the comments I've Reed in reference to the concerns with fluoride um this a Hot Topic throughout the the country and uh we're going to we're going to give we're going to allow everyone to vet it out and put it on the agenda so I'm thrilled to hear that tonight um so outside of that just you know we want to want to hear what your comments are it's really important this is your city we just got appointed by you to help direct it but your your information is very helpful and uh and and I appreciate it for that's it counc with grubs well the first thing I want to do um is we have a large presence in the back back there that we've had not many seen before uh if y'all all every one of y'all with badges back there come back over here and be recognized for a second I know I put you on the spot and y'all don't like that forward for a second he has no idea how much I know you guys don't like that all you're going to hate me later but it's but it's worthy it's worthy it's worthy normally we have I was going to say assistant chief Proctor you got to come down too you got to come down normally we have one officer standing in the back and today we have five and it it goes a long ways and not saying this but I want to recognize all of you for the jobs and the tireless jobs y'all do for the city keeping us protected and safe so thank you very much now let it be that because I have to drive home and you guys will be out there looking for me so thank you saying that we we have U sugar Forest on hand and law enforcement comes out they do their due diligence and then also dealing with code enforcement does their due diligence and ultimately it gets into we have to go through the turny um nightmare and the wheels turn so slowly and and and it it it's it's horrible that you have to go through this process and I have no other words saying other than it's horrible um Mr Jones Is there an update dealing with a timeline I I don't have a timeline um I can just tell you that you know we we have filed the action in both cases so you guys authorized Us in December to move forward with taking legal action to in essence force a sale through foreclosure of the leans that are already existing in both cases those those have been filed we're going to pursue them aggressively and and get to the end as soon as we can okay all right so in legal ease it's in the process I hate saying it that way but that's where we are but something was brought up tonight um and and Chuck I have to uh say that you brought it up and I'm going to say it so um as the process goes and the the properties are being acquired um and that area there there's four pieces of property is as we look at that Wayne is there a possibility that those properties maybe with engineering can be helping with the drainage in that area since that is one of the low points to help that Community out that we tie that together and if we have to buy one or two properties to make it work is that a possibility that we can look at that in future we'd be happy to look at with the property owners it's it's going to be up to them to what they want to do with their property so we would have one but the other three we had had some of the property owners expressed interest in rebuilding I had a question from one of the other council members about the zoning in the area so there there might be an amendment to the zoning if somebody chose to put duplex or single family house in there but we would be happy to work with the owners on whatever I don't want to say we would go make them do that it's we would work with them on on whatever choice they they want whether they don't want the property anymore and would would like it to go into that situation or if they would rather rebuild but we will work with them on whatever Direction they go okay can I make them yeah I'm sorry we can't you speak from the my PO but get with me later I'll give you a card contact me directly that way we can have further discussions with this for that Community we know and and since day one when I took over up here it was handed sugar Forest and I it just sounds the wrong way of saying handed sugar Forest but it's what I was given as this is where you are and how are we going to fix this and I'm like learning with you guys and whatever the potential may be we're open ears and it's getting those open ears to gather that information to see what we can do amongst Council and the city up here to get it right so please get with me later so I can give you the the numbers um let's see here um as far as flation goes we have March 18th is going on the agenda um I would ask those as far as on Council there is a ton of information out there from the Department of Health um Department of Health has put their stance uh on a single uh email that's out there but it's also depends on who's in charge of the department Health at time um you can go back a few years uh previous to the Surgeon General and you'll see a completely flipped version um it gets very very muddy uh looking at one way versus another and I'm not in a stance of saying which way I'll vote what I'm saying is is there's a lot of educational material out there CDC has a lot of it also so please take a look at everything when when you're reading it um it's it's mindboggling that we've gotten to this position of dealing with uh the question of fluoridation whether or not it should be in the water or not in the water you know 30 40 years ago it was a yes now it's a no but that's the science science does change and it changes the opinions of whether or not something needs to be there or not so all I ask is that my fellow councilmen take a look at all sources when you go to find and get the education on it um it's a lot of read that's all I'm gonna say that's it yep Mr Foley that's it yeah I know just laughed when you talked about water and said it was kind of a muddy discussion started laughing at muddy water now I I appreciate everybody from being here from all over the state concerns about residents drinking water here in Port Orange um you know I've gotten a lot of emails lot of phone calls I've talked to some people got more scheduled for the rest of the week um it it was enough so that I started just asking friends residents people I see every day and uh i' I've noticed a trend that the people who don't care don't care and the ones who care don't want it um so I I remain pretty open mind to the subject I'm glad there's an agenda item about it be looking forward to hearing presentations uh as to what we have I was actually happy I I asked the city manager for a lot of information and you know from what I what I've learned is ours is significantly lower than the maximum is allowed anyway we're we're well beneath that we're about a third of that according to the information he gave me but um I'll be looking forward to having a full conversation like I said I remain very open-minded to to changing it I one of the people who doesn't have a preference um no one in my family seems to have a preference so um with that being said something important tonight on the cassen agenda I want to say thank you to everyone all the citizens on the echo Grant board that was awesome they were able to get that passed um that's going to include a lot of playground equipment uh here at city center and that is awesome I also want to say thank you to our County Council because while it was recommended by the echo board it has to be approved by county and I was very thankful for those who supported that I'll be having lunch with uh councilman Reinhardt tomorrow I'll make sure to thank him in person um he's been a huge advocate for Port Orange and I appreciate his friendship and his leader ship for us at the county level for a lot of things um and then uh I also just want to say uh to Kathleen who oh she left all right um on storm water I was happy at lunch Wayne gave me a little bit of a preview of the storm water master plan from his view of it and I can't wait for the next couple weeks to get to see more of that and as far as code enforcement I I want this to be the shortest story possible because I don't want to make the night any longer than it has to be I I can't tell you guys how how frustrating it is I'm so sorry you're going through it I I can't imagine because I've had issues in my neighborhood we had a guy who passed away and his house no one seemed to know who owned it and the grass went from as high as a grasshopper to a dog to a small child and so on and so forth and it took literally months before we could just get grass cut so I can't imagine how much more of an issue it is when you have the situation that you guys have um I I hate that you feel let down by by the city and by you know Council up here I know that as expressed in her letter I can assure you it is not the goal of me and I don't believe it is the goal of any of my counterparts for anything like this to take any longer than it's possible but as everyone knows the State of Florida has some very very Pro owner acts uh rights and laws and we have to work within their rules we are the football team and they are the NFL they make the rules they call they throw the flags and unfortunately on this one we have to abide by those rules and it is third and long but I'm very proud staff's working really hard on it and I know that we will get results it just it takes far too much time as is the case with a lot of things in government so anything else that'll be it sir all right just a couple things for me as a as a as a note um but I did want to to honor his memory um and mention a law enforcement icon from buia County Major Terry Sanders who's a retired busha County Sheriff's deputy unfortunately passed away over the weekend uh Terry was a friend of mine he was a mentor almost five decades in law enforcement service he started with the Port Orange Police Department he was our first ever can9 officer in the city of Port Orange way back in in the 70s when I was in elementary school and uh but wrote me a ticket in the 80s yeah well the guy the guy did it all and um it's not out yet but when it is out it's my intent to read his obituary it is a permanent record of the city of Port ore he he didn't he worked the majority of his career for the W County Sheriff's Office but when I tell you that he always took care of Port Orange he was always helping us out if you needed something you just called Terry you didn't have to say who it was you just you just called him and um he was always there for the residence of Port Orange and when I say the guy did it everything in law enforcement horseback Aviation K9 Motors unit this guy covered the gamut in law enforcement and never a nicer guy and a lot of people may not know who he who who he was as a law enforcement officer but he also if you've been around in our area for quite some time he also was the person who owned a place in Samsula called Barnyard Friends which was was an incredible place to take children um and and let them be exposed to farm animals uh that didn't exist anywhere around here and uh and so thoughts and prayers are are with him and his family and he will he will most definitely be missed but um a great guy so I just wanted to mention that Chuck again I want to thank you for for finishing up Heather Heather's story I appreciate that um that's that's a hard thing was hard you had her back I I just want to make a plea I think I think Kathleen may've already left Kathleen already she already left yes sir if I I know with everything that's been going on in Sugar Forest a lot of the neighbors now have become closer than ever and which is it's sad that it takes something like that for that to occur I've said this a couple of times and maybe you're the guy so I'm going to put something on your shoulders man but I'm going to tell you if you guys could ever get your HOA back together you guys used to have a phenomenal homeowners association I was born and raised in this area Lance can attest to it some of the others can attest to it but you know back back in the 80s that that neighborhood which is a gym of a neighborhood it was a it was just everything was manicured had a great look in the whole nine yards and for somehow some way for some reason the HOA got disbanded and and I don't know what it would take but the reason I say that is because there are other elements of the subdivision like common area properties that aren't really being maintained a small retention area things like that and that's why those HOAs are so vitally important to the to the topic you spoke of tonight I will tell you that had you guys had a functioning HOA my HOA took a person's house and they did it quick and so HOAs for whatever reason they have a different legal path that they can pursue and and it's it's pretty quick and it works um we we we are frustrated with that you know that you've talked to every single one of us I I said before the meeting tonight Chuck give me a legal reason or a legal idea that we're not using to try to expedite this and his comment back to me was well I got some ideas they're just probably not going to be legal so but we're with you and and and and as the City attorney can attest the city manager can attest we are going to get you guys there as fast as we can through that legal process that we have to follow by the way code enforcement police departments all of them can tell you the same thing they are very frustrated as well they there's a lot of other things that they want to put their attention to and they're frustrated that they don't always have the path that the law allows for things to happen quicker it's the same it's it's very similar to the you hear people talk about law enforcement by the time I arrest somebody and finish their paperwork they're already back out and that really does happen so I can just assure you on behalf of code enforcement and police departments they they want that cleaned up as bad as everybody else in this room trust me uh and hope you guys never ever have to deal with it but I do appreciate your uh consistency and staying on top of that um I just want to make a couple of brief comments about the fluoride thing I don't want to get too deep into it because we are going to have this agenda item when when Port Orange started fluoridating in the water I was 12 years old I started working in the water industry for a company it is not my company I started working in the water industry after I retired from law enforcement I work in an industry that sells water treatment options as hard as you may find it to believe there are people who want to filter certain things out of water but we'll specifically say I don't want it to take my fluoride out okay so for whatever that's worth the that is a real thing and that exists that being said the company I work for is a national company I extremely extremely rare and unusual that I get a call for any of those kind of things from residents of Port Orange so if people want to make like there's some kind of a conflict of interest I don't know how that's any different if I worked at Home Depot Lowe's or anywhere else that sells products that are pertinent to that that being said as far as the particular issue itself I will tell you that I've been elected four times to the city council okay it has never ever been something that residents have made as a um a topic of a campaign you know it's not it's it's not something that when we're out campaigning a lot of these guys just campaign they probably can attest to that so it's not an issue that the community by and large it says you know well what's your stance on fluoridation you know usually it's what can you do about the traffic on dun Lon you know can we get some more playgrounds you know different things like that but it's important and I agree that it's an important um I I commented to one resident uh recently I said I said yeah because they had asked and I said yeah Port Orange has Port Orange has been through the fluoridation discussion and and honestly I said it may be somebody in this room I said it was just a few years ago well it wasn't just a few years ago I went back and looked it was actually quite some time ago it was 2016 I believe so so it is time it is time um there is lots of new research there's lots of new information and I will tell you that the amount of people residents of Port Orange which is where I put my most of my weight that's who I want to hear from my residents that I represent because I don't represent myself folks I don't represent myself there are plenty of times that I take a side and I represent residents in something that personally may not be what I think is best but it's what the constituents want it's What the residents want happens all the time all of us will be that way um but that being said I will say that a lot more residents have this concern now and a lot more of them want to talk about it it is extremely difficult and I appreciate I know you guys probably don't think so but we appreciate when you guys take three minutes of your time to come and stand up here it's not easy most people don't want to talk in public we appreciate it 3 minutes is not a lot of time I had a ation last night with an incredible resident very well spoken passionate respectful her conversation with me lasted 51 minutes my point to that is that it's very difficult for you guys to come up here and say what you want to say in three minutes we get that so I encourage you March 18th this is going to be a discussion um reach out to us have a one-on-one conversation with us email us if you have time to email us you don't want to that's fine you want to just come up here and say I want fluoride out I want fluoride in whatever that's fine too but but I get that the three Bs thing is a very tough thing but just know that we are all available um we I did I we did find that some people who had been saying they were emailing me were sending things to the wrong email and also emails were going to a junk folder we have there is a new email for the mayor position it is mayor Port dor.org it's on the cards out there if anybody wants to get a copy of that so make sure it's going to that email um so so that we're we we are getting that um anyway enough on that I look forward to hearing all that I will tell you um some folks mentioned it tonight that may still be here about specific studies I think you might have mentioned one um s send us the links to the studies and the email those to us um I I looked at some of the newest studies recently man it's going to take some time some of some of those studies you look at are 200 one of them I think was 800 pages long so and and I'm not so sure that I'm that I've I'm qualified or I have the background to to even understand a lot of that stuff but that being said if there is a study or something or a brief or a summary you know by all means please send that to us we we will get that we will take that into consider ation and then like I said I think uh I think I think it's due I think it's due for for our Council to to have that as an agenda item and uh we'll have some good discussion and I'm sure there will be folks that will favor keeping floration and and and obviously a considerable amount but would like to see uh Community fluoridation come to an end so anyhow that's enough on that uh I don't have anything else for that so moving on to City attorney comments nothing for you tonight nothing you don't want to correct us on anything we said wrong no okay didn't have that much time no city manager I just wanted to briefly touch on the budget calendar that's coming up we've talked to a couple of you and Robin's going to be getting in touch with you on the schedule we're I've already started the early meetings with the department heads going forward and we're looking like we did last year the the capital projects is what we usually do first the major projects and this year most of them are are well known so we have the early Park spawn projects that will be coming forward the storm water projects that will come as the first phases of the master plan some of which are already underway the meline Pepper Hill project the the uh project at Cambridge as as well as something for Sleepy Hollow so these will be moving forward in the process as well as the utility projects that you've heard about the big filter and things so there's not going to be anything tremendously surprising to you that we were trying to be more methodical and bring these big projects forward like that so we're looking that item will probably be instead of a standalone Workshop it'll be part of the council meeting either the second one in May or the first one in June like we did last year so we'll go through Capital there we're looking to do a workshop at the end of June possibly June 24 for the whole budget so the last two years we've done it in July it was more typical to do it in June it gives you a little bit more time to absorb the budget this year there'll be less moving of things around so it's going to be more standard if that's where we paid for gas last year that's we're going to pay for it this year so you'll be able to do more year-to-year comparisons but if we get that to you at the end of June that gives you a full month if everything if everybody's comfortable if we if we reach a good point we can do Max millage as part of the regular council meeting in July we will probably set one of the Tuesdays after that as a backup just in case you something comes up and you want to spend more time on that so we we'll have the clerk's office staff get with you and make sure the the calendars work for everybody we'll print that and get it out but I just wanted to make sure you you had heard that tonight going forward if that worked for you we're also about ready to start we have negotiations with the fire and the nage General employees unions full contracts getting ready to get underway so we'll probably be having meetings with you on that in the next month or two has everybody had a chance to get scheduled up with the city manager and staff on kimley Horns we have we have everybody one council member on the storm water master plan and then we would have a discussion in March on that more like a public meeting to explain what the projects are okay and do we do we have a date yet certain for that we do not we're going to wait and see how your meetings go with them first to see okay how you we want to talk about format and everything when you're talking with I got you perfect anything else that's it all right board appointments interviews and reports environmental Advisory Board the famous Christine Cunningham famous or inFAMOUS I'm sorry famous or inFAMOUS what should we go with oh we should go with Infamous I think it lasts longer right on um mayor and Council hello um me standing here means that I am still the chair congratulations well yeah it wasn't supposed to go that way but you know I just love what I do so um we had uh three things that we discussed one was um a tree in Countryside that that um is going to die and part of our job is to um discuss whether that tree should be mitigated um mitigating mean either you pay into the tree bank or you plant more trees it's that simple uh we have a Forester who recommended that we don't uh that we do support the wave uh to wave the mitigation is a tree on private property no it's in a roadway it kind of it goes over the roadway and it's a problem uh where it can be harmful to the public okay yeah got it got it and so it will come down it is going to die got it um and he said there's no chance so we support that you'll get that report it's hard when we have to say that and we've only had to say that twice we've had other issues where we had people come uh and tell us their tree story and we recommended that they pay the mitigation and and um they did after it was dropped 50% by the council that did not go over well with the committee that was my strong voice back to being nice um adopt a storm drain everybody wants to help and when we have our storms and we are out there watching that water which is supposed to stay in place but it does not move through our neighborhoods our storm drains are the s of capture um I don't know about any of you but I sit at the at the lights and I look at all the storm drains around the city and everybody should be doing that well we have storm drains in all our neighborhoods and they're of all different Siz of shapes and and some are small some are large some are stopped up some are useless and everywhere you go we have it's understandable why we have issue I live next to Sugar Forest so I am very very acutely aware of everything that they're saying however we do have um things that people can do to help uh we can go out and we can make sure our storm dreams are cleared before the storm rarely is there a storm that comes here that we don't know about we're not like Palm Coast that has blue ice fall or ice falling from the sky we know when our stuff is coming um so there's a program called adopt a storm dream and they are working on it in Daytona and I actually am the one that brought it there as well and uh they have been very active in uh integrating the the internet and GIS programs and so on and our uh staff has gone and met with them so we're bringing this to Port Orange and we are 100% behind this we want to be part of the training of of and educating our community and how to get people to sign up to be in their Community to adopt their drains before a storm comes clean it out after safely get the the the branches and whatever is in the front of their storm drains away so it will all be put together by the city um safety liability everything will be addressed and training will be the part that is really going to help our city move move forward but also um um have our citizens help us and then our um our plant giveaway is going to take place in the fall it is going to be uh food or native bushes not trees this time because we want to um support edible bushes and so what the process is going to be is we're going to give them away at the fall at the Fall Festival starting July you can sign up to get the bushes that you can have two if you sign up and you're Port Orange resident or one if you just come up to the table and and and get one so starting in July all it'll be put out to the city uh to the residents how to contact me and we will uh order the bushes and give them out at the Fall Festival okay any questions I went looked at that tree and again it's unfortunate but and and I've dealt with some similar situation in Orman because it's labeled historic and when they're label historic it falls under a different category and the rules are a lot stronger um but we voted on that tonight to approve that per the recommendation of your board okay the other I want to ask you about that storm drain adopt is is there anything in there as far as instructional about not blowing debris and lawn clippings down in your store drains and that's a lot that's what you're allowed to do that that's what fills the ponds yes the ponds get smaller every time somebody blows their leaves and their grass clippings down a storm drain that's what I think we need to educate as well is stop blowing garbage cuz it's ultimately stays in the pond it rots in the pond and it fills the pond and there's less volume yeah and it doesn't fil down the ort of the pond is to filter down to the oer the other thing that's very difficult for a lot of people to understand is a lot of the storm drains they see are part of closed captured systems that were built in the 70s and 80s yes that water doesn't go anywhere it was designed that way some of those some of those neighborhoods that's how it was designed and there and there isn't any infrastructure to do that because they're built right so you know sometimes when they see that but but to to your credit you are you are right clearing them is good the the other hard part is that goes along with those drains is typically in those neighborhoods where there are those storm drains that are part of a close capture system the streets themselves were designed to be the storm water retention so a lot of times people will call and say my streets flood when it rains because that's how back in the 1970s and 80s it was designed to do that with the hope the the home doesn't flood but the street does so right a lot of neighborhoods they don't even have a a single retention on and at that time when we talk about if you actually walk through neighborhoods and you know when you're driving you don't see anything when you ride your bike you see some but when you walk that is where you get a true visual of why things happen if you're walking up um meline um you can tell exactly which way the water is going to flow it's not you just stand still and you can see that well every neighborhood you can see that well if you're looking down and you see what is at the end what's receiving the water that's where you have to focus on the issue now you're supposed to keep the water where you it is that's the idea back in the 70s I lived here since the middle 80s okay we had many lots that were just trees and it absorbed the piece of property that uh is on Nova and and meline big acreage over there if you if you walk and like I do with my dogs okay you see the water sitting in there it's doing its job and that's why regardless of what committee you're on whether you're on you know the city state uh or or County you are focusing on that water being put somewhere where it's safe and not harming the homes but it doesn't it just will not function unless we are all involved and we're a community guys got anything else for you said and and I know this is dealing with code you said grass clippings and blowing of clippings down drains is actually statute so I just want to repeat that of what she's already said is that everybody understands you know you have somebody that is derck every time you watch your neighbor I'm not saying report your neighbor but sooner or later we got to stop this you know and time you make a phone call and they come out it's already done everybody's got a phone today well it's not it's not just the the citizens or the homeowners I'm brave therefore if I see that happening I will go and find the management and I have done that to two businesses in Port Orange I did it at one Daytona because they were out there putting it right down the drain and um I that's not going to happen and and they one Daytona and and I it was so big that they need to know what was happening and they came out they said we had no idea now they know the two businesses they now know and the response was oh I know exactly who it was or you do do you okay that's not you know we we have to not just watch our our homes but we must watch our businesses CU they're bigger true good good thanks for all you do thank you thank you very much have a good night regular agenda item 17 first read of ordinance number 2025 d06 that's your Quee an ordinance of the city of Port Orange bu County Florida amending chapter 2 Article 1 to establish a new section 2-5 designating the City attorney as the city's registered agent for purposes of accepting service of original process providing for codification providing for repeal of conflicting ordinances providing for separability and an effective date move to approve ordinance number 20 25-6 and a second Mr City attorney why don't you present just s surmise with this by the way an ordinance I appreciate yeah well go ahead yeah you don't you don't have to receive service anymore so uh you know this has always been a practice of the city that um you know the mayor's been served and then you know it comes to me anyway immediately to the city attorney's office within 24 hours what they did uh the state law changed and it kind of expanded upon the scope of who can be served in the city that's problematic for us because then you know we got to track down who got served which at some point if you miss you know the top two or three it could be just any person at City Hall and that's just not an acceptable way for us to conduct business um these uh service of process comes with uh set deadlines to respond uh we need to know about it as soon as uh as soon as it happens so we can start working to to uh prepare those responses so it it just makes sense for us to to operate as the the city's registered agent and receive that service of process on behalf of the city yeah makes I mean makes a ton of sense I I I got to imagine 96 97% of all municipalities in the State of Florida are strong city manager form of government which means the mayor and the elected body isn't at City Hall Monday through Friday 8: to5 so when those documents need to be served it's much more appropriate to have it being done the city attorneys office unless anybody wants to be sued yeah you guys welcome good evening thank you guys for your time did you want me to go ahead and I'm just going to tell you I'm already disappointed that you didn't bring the exhibit with you we can see this Unfortunately they are not here yet they're actually waiting on your guys is approval before they they're brought here it would it would have been cool to meet Tom Brady what's that see what you did there see what I did there yeah the goat got it oh good evening uh my name is Officer Fox I am with the Port Orange Animal Control uh I am here this evening to request your approval for a species waiver um it's in reference to our city ordinance code 102 that has a limitation on the number of animals a person can have and the uh exact species that a person can have as well um so Adrian litowitz um has recently moved to uh Port Orange Florida uh in Fall the fall of last year um she um is moving in with her brother who is the owner of 668 Herbert Street um she has two Nigerian dwarf goats um they are each 70 pounds and 2 and 1/2 years old um Miller is a white hair with brown spots and brown eyes and and Dill has black hair and blue eyes um there will be no other animals on the property so it will just be the two goats um Diller and Mill um are her beloved pets so where most people enjoy the companionship of a cat and her dog um Miss let Swit prefers the companionship of her goats um the conditions of the confinement uh so I did an inspection of the property um the containment the fence is welded steel panels that are 5 and 1/2 ft tall um and she has a lock to prevent Escape uh there will be regular maintenance of the yard to ensure that the yard stays clear of feces um the property is half of an acre uh it is owned um by her brother and they will live in a 20t x 40t enclosure in the back corner of the property uh the impact to the surrounding uh property in the residents uh there appears to be none um I did interview each of the surrounding residents um of the community uh no one had any concerns um or objections to having the goats uh in fact we had a couple that were pretty excited that there could potentially be some goats nearby um nuisance and disturbance that's also um a low concern um they are pretty quiet they're non-aggressive and relatively odor odorless uh they tend to sleep in the Sun or eat from the hay feeders uh the yard like I stated will be maintaining clear fees and debris um um Miller and Dill appear to be happy and healthy uh they're both neutered and um have no upper incizors in their mouth um they are full size um at 70 lbs um which is the size of an average mediumsized dog um they have remained up to date on all Veterinary recommended shots and um will be required for the necessary of their lifespan um they are up to date on their vaccines and received a phys physical exam in September of 2024 um they also are microchipped um and then as I stated previously I inspected the enclosure um on October 4th just to make sure everything looked appropriate um there is no HOA in that neighborhood um so there's no concerns for the HOA and then these are uh the animals in in question so that is all just ask for your guys' vote excellent job on your presentation thank you um and you you know you've now gone down in history as the first animal control officer of the city of P orange to present on Nigerian dwarf Coast keep that in mind qu question for you um and and I and I one of the things I appreciate the most is that you went and spoke to all the surrounding neighbors right those are the ones that are going to be impacted the most should should there be maybe this is for the City attorney to weigh in on but should there be something that we haven't thought of that materializes and it does become a nuisance that exceeds the bounds of this this particular area can if Council makes the decision to approve this tonight can that be revoked yeah with with your approval you actually have some conditions uh for that type of thing happening and then a reconsideration so if you want to if there is a motion to approve uh if you'll just accept the conditions as presented by our Animal Control all right questions read no I we're in America as long as what you're doing isn't bothering somebody else I think you should be allowed to do it if it becomes a new since starts to bother your neighbors then becomes a problem but otherwise free country Al Fox you said that uh these are the only two animals that they have yes sir but under the limitations they can have up to 10 to 12 so can they as well make sure they can't come back and add 10 more to that th this is only being considered for those two animals okay all right ction Council green I got a couple questions in in concerns so I mean I'm looking at the list of species that we're allowed to have so that guy could have a horse right if you're in a property that zoned for a within the city so so so there's certain animals that are allowed in certain zoning so we're talking about just a single family home you got it yes is why this exception would be so by creating this and the five factors that we are to consider does this now mean that we are now going to have to maintain and constantly watch this property to make sure that this is being adhered to because it sounds to me like we're getting ready to be into the maintenance business of somebody's animals you don't go by and check on people's dogs and cats but we're going to have to go by and check on this guy's goats is that what we're going to do as part of this condition because that's how I'm reading it I gota I I mean if that is something that is part of your guys's condition we we can do regular inspections um we do have have another approved species within the city um a couple years ago we brought forth a pig so we do have a pig that was approved um we haven't had any issues with the pig there's been no nuisance complaints hasn't gotten out we haven't um been uh called to you know a loose pig running in the city um from them so uh we're under the impression and and hope that there wouldn't be any nuisance is issues um with the fact that she's got the welded steel panels they're 5 and 1/2 ft tall it's too tall for the goats to be able to get over she keeps it locked um she didn't have any issues with them getting off of her property back in Delaware so the hope would be that there wouldn't be any issues here however if you guys would like to set a stipulation or something I have no issues so I mean if something happened and they were running down Herbert Street this this this agreement would be null and void is that what if that were to happen if they became a nuisance we could come back to council with the stipulation you guys are putting in and you'd have the right to revoke that permission so obviously if there's go running down the road we know where they came from and we know who to complain to but it's going to be more of a reactive monitoring if we get complaints we're going to go there we're not necessarily driving by every day to make sure the goats are in pin but okay we know where they are we know if we need to check on them and obviously people complain or the goat on a roof somewhere we we know what we need to do okay and we can see them from the street too I don't know if that helps but when you do drive down Herbert you can see the full enclosure right there it is on the back side but you can see it when you drive you can still see if they're you know in the and that sort of thing okay thank councilman vice mayor maybe actually uh Eric Sanders is now the chair of the TP he's inherited that through a series of uh elections and term limits and etc etc but otherwise it's just pretty much first of the year stuff I want to say thank you to my TPO counterparts as you may have noticed during our consent agenda we have a couple of things um which included the um sidewalks on Willow Run those are things that we have assistance with uh funding through the TP and things of that nature so I want to say thank you to everyone there for all their hard work um I'll be at my executive committee meeting tomorrow and uh just happy to keep being a part of that board so it's always great to feel like you're able to bring money back to Port Orange outst stand you good job anything else
