European homes had an issue with their court reporter unfortunately we've had an accident um so they they asked to continue this I do not have a date on that on their letter they actually she stated that they're going to if Jeffrey wants to read the letter I can't yeah read the letter i or if you just want to read the letter into the record okay so I read it or if you would like me to don't you do that you read it read it in you want do you want me to or yes okay okay dear dear Miss vaugh as you're aware this office represents European homes LLC the applicant and condu connection with its application to the township of Ron planning board the board as you are aware the applicant the applicant application is currently on the board's meeting agenda tonight for consideration of a completeness wave with regard to the required completion of aquafer testing as we have yet to receive the memorandum reference in your email of December 6 and the applicant's court reporter advised that she was injured over the weekend and is no longer available the applicant has determined to withdraw its request for a completeness waiver and will complete oer testing accordingly to avoid any any further delay in light of the above kindly remove this matter from tonight's agenda Thank you very truly yours car a kazinsky Esquire okay but you didn't stay a date to continue it to no it's with it's it's withdrawn so there is no hearing now they're going to comply with the completeness yes so this won't be deemed complete until they tonight's hearing was just for you guys to deem it complete it's not a complete application she was seeking a waiver of the TRC determination that an aquifer test was necessary okay they didn't want to do what the TRC said they should do so in essence the appeal was to come here and ask for the waiver and now they they decided to fully comply so there's no need for you to weigh in at this point yeah typically a completeness hearing is not usually done okay looks like she learned to listen to her we wanted that was that was a long debate on the aquafer yeah so Jeff kept pursuing that good we we pursued it the TRC meeting quite honestly I my recommendation would have been that that such a critical component I don't know I don't know how you could wave that me really what we said like I would have never first first I would have never filed an application for like seeking a waiver of that because it's it's Elemental for development it really is so they've complied to do that is what we getting corre writing it's in writing yeah okay great thank you with respect to Joseph and Despina mcti this is a minor subdivision they had their attorney Robin Wright Esquire from Lanza and Lanza LLP had sent us a letter asking us to continue this to January 22nd 2025 I'm happy to read it into the record that's what's needed Dear Miss Fawn this is again from Robin D Wright Esquire this firm represents Joseph and despa mcdel the applicant in connection with the lot line adjustment application pending before the board we hereby request that the application be carried to January 22nd 2025 to give us the opportunity to address the board Engineers memo the applicant consents to extending the time for the board to act upon the pending application to February 28th 2025 last one so are we making the announcement that they're going to be carried to January 22nd 2025 without the need for further notice okay and then the late breaking news this afternoon was New Jersey conservation Foundation Mr Torell I'm gonna ask you to kind of give us a summary yeah we had a instrumental brief um discussion this afternoon regarding the status the application there were various concerns expressed from different members of the group regarding the lateness of the submission uh what the submission purported to be um uh a reference by the applicant that they were going to have a planner address some of the bulk variance relief but there was no written submission really what that was going to be uh I reviewed the advertisement for the application um had some concerns with the um validity of the notice that was published in light of um the direction that they were going in so the suggestion to the attorney was to um really inoculate any challenge to the extent that there's any approvals granted it was my strong recommendation that the application be Ren noticed and I expressed with him some of the points of concern that I had with respect to what I saw as deficiencies and then reminded him of um this board's commitment to not receiving things last minute that that we don't operate that way and we need to see things in writing in advance so that things can be properly digested both by the members as well as the professionals so that it can provide for a meaningful hearing and I respectfully suggested they might want to take this opportunity up the application you know before it's it's relisted so that's where we left okay that's great so then does the application because it was listed for a public hearing tonight what do we I I expressly told the applicant that we would not be announcing a new date okay that they would have to start the Nova and and re advertise a and a new date and I explained to him that because I'm a conflict attorney that I would need to confer with boards secretary and and myself in terms of mutual availability to get this on the docket I suggested a date tonight I don't know whether we're gonna I it looks like we could uh pencil them in for the reorg meeting so that's January 8th but again they would have to Reen notice and that notice has to be sufficient and if and if you know that's not going to work um the 22nd I have a comp so then unfor fortunately they would have to go into February but they're really asking for January so I would be surprised that there's some funding issues that are time sensitive so hopefully they can get their ducks in order and come in for the eth if we offer that yeah usually we don't have any uh public hearings on the night of the reorganization meeting we will have two that evening one is Flemington concrete that that will be confirmed by them but that's been the discussion right there yes we were just talking about it and then the other will be New Jersey conservation foundation so it'll be a busy night okay yeah exactly
