comments this evening nope there being none Engineers comments I have nothing nothing great thank you planners comments Allison we'll put you on the spot no okay attorney's comments thank you okay we're going to make a change to the agenda this evening so if you picked it up as you came in the door we certainly realize that most everybody is here and if we have anybody online and I don't know what to do you're here for the Woodmont RIT and bronze which is all the way at the end of the agenda we're moving it up to now so we're going to jump right in on that and before you start if there's anybody in the room who was not here two weeks ago just a very very brief introduction on what happens here uh we had testimony from several of the Woodmont experts two weeks ago uh went through a lot of questions from the board questions that had been raised by our Township professionals those were all responded to uh we ran late so we're coming back this evening for remaining testimony if you have questions on the testimony that you hear your opportunity to ask those questions is immediately after the expert from Woodmont has completed we have asked our questions the uh professionals have asked their questions then I'm going to throw it out to you if you have a question would' love to hear it please come up to the microphone give your name and address I'll I'll address the people in the room first and then if there's anybody who's online this evening I'll address them if you have other comments to make regarding the application uh at the conclusion of everything you can certainly raise those as I explained two weeks ago our Township attorney Mr Bardo will then need to swear you in because you would be offering testimony so that's the that's the process worked well two weeks ago but works well tonight so thank you Mr chairman uh good evening uh to you Mr chairman members of the board board professionals and the public uh my name is John ingino I'm a partner with the law firm of engino Taylor we represent the applicant in this matter Woodmont raran bronze LLC an affiliate of Woodmont properties and as you know Woodmont is seeking preliminary and final major site plan approval to facilitate a warehouse development on 40 Highway 202 and 75 orhe Corner uh the applicant owns both properties which were also known as L four and 5.01 in Block 40 on the tax map of Ro and Township we last met on May 8th and you heard extensive testimony as a chair a chair indicated from our project engineer Bill Lane uh vice president Executive Vice President and general Council of Woodmont properties Sten santola uh and also the project architect Phil Riri uh this evening we have Mr Lane uh back for the limited purpose of testifying regarding some additional landscaping and bming and the moving of the emergency access road uh we then have Mr Santa who will be called back to really discuss two things one uh will be to show the new and improved landscape plan really further Shields the building from public view uh and two to discuss the colors of the building and then our last witness who you have not heard yet from is Carl peny who will uh discuss traffic so without further Ado I'd like to bring up back Mr Lane he remains under oath yeah Mr Lane you understand you're still under oath correct yes and there's been no change to your qualifications since the last meeting correct okay the floor is yours um at the last meeting we discussed about moving the emergency access so out to war he Corner Road so what we had done was we moved it further west um over more into the uh Power Line easement so that away from we were a able to move the hot box along with it then we were able to increase the existing buffer that's out there by adding more plantings and what we had done done was uh the where the emergency access is it comes up about 3et from the road then there's a flat spot for roughly where the hot boxes and a little bit beyond there then we come up about 8 feet and that burn then sits about anywhere from s to n feet above the road and on top of that we added Landscaping this this we have an exhibit here yes why don't you first of all let's start with what you're referring to just popped up there um where do we leave off tlor on the exhibits that this will be A4 okay so we're A4 I just briefly describe what A4 is yeah this is entitled a burm exhibit and it's dated May 22nd 2024 and this shows the emergency access path out onto Vorhees Corner Road at the back corner of the building um it shows roughly the back parking lot the driveway that comes up back there and then also it shows the extension of the burm and the plantings that we're looking to do between the existing vegetation and the hot box anything further so this exhibit is the changed exhibit correct okay this was I I believe in response to board comments and questions and desire to move the emergency access road in the manner that you've done so tonight correct correct okay will those be mature trees planted like to what extent we can upsize them I mean we'll work with the landscape architect to give a a buffer that looks good from day one again we're we're up almost like an average of eight feet from the road so we already have a pretty good buffer with the with the with the BM and then we'll plant you know 8 10 12 foot trees so you had testify to understandably to the need for the emergency access and that's fine but the comments that came out was the goal was to reduce the visibility from specifically the holes on warhe Corner Road right so that by moving it the buildings are shielded you were able to bring are shielded even more even because we're able to bring the BM up and then put plantings on top of that and add the plantings there because the the emergency axis Road was further more towards the east and that kind of cut into where your visibility is beyond the where the existing vegetation is so this pushed it fur West and we're added we're able to add more vegetation to cover more of that that that building and all the way out to the corner and Mr chairman Mr stanta will be providing a couple of exhibits in that regard in a moment okay um just a little bit more granular information about the type of of planting material that you're proposing in that extended firm area is it all deciduous or is it a mix of everything well there's right now this was and again I shared this with John Morgan Thomas and he already had some a few comments and we'll add some more landscape but in this scenario here we have like 17 Evergreens there's some flowering trees there's some deciduous and then there's low lowlevel shrubs to help but yeah majority of it is is Evergreen so you have a year round screen what's the width of the emergency access 20 feet okay and uh what is the grade of it is it flat is it slope it comes up probably about a 5% okay and then flattens out and then comes into the site all right would I be able to get a copy of that for my office uh to review that yes just to check angles of approach and departure for the fire trucks okay thank you for everybody's information Mr conanan sits on the planning board he's also the fire commissioner for R Township I'd be curious John Morgan Thomas if you have some comments on the um or Reflections on the the changed buffer I really just and I think generally it's totally in the right direction I think firm I think cly conversation about all the plants are and how many my general comment was is that I thought you know kind of behind that birn there's a area you can picture a triangle that's created by that to take the existing planning extend it for the access road I think we could do a little bit more fill in there behind the birm with some even those could be smaller ICT so I did plan I did have a call lastes from the app and you know we kind of talked about there really isn't any need for any sort of disability for this business from this road so I think everybody trying to get to the point where we're just cing screen so the residential side just we're somewhat limited by the course jcpnl instrument I'd like to see if we could you know massage it a little bit I think we can actually carry some of this PL maybe all the way past that that hot box so and we will have my other General comment was is I think maybe there's some of the trees that are shown to the I guess that would be the west of the access drive and west of parking lot as much as I would like to see them there I don't think going to be able to plant those but the did provide for some additional plan around the edes of parking area it's kind of shown as a have discussion what the plants are and how big they are and I don't see any reason why Cas of planting like that why we can't plant shrubs or small trees that go up to whatever maximum is which I think is probably CH again I think it's in the right direction I just hav had chance to thank seriously and that they have a landscape architecture looking at it and I just uh hope that they uh do a good job that looks nice for the community because we don't want it to turn into like a Route testimony here this evening on that later this evening there will be testimony on the traffic okay then you'll have an opportunity to ask about those questions on that testimony okay sorry okay let me stanto you understand you're still under Roth correct I am still under oath yes and you're still the Executive Vice President general counsil for with not prop as of 5:30 this afternoon yes wonderful um so my purpose here is twofold uh first we wanted to show you um the views from vhe corner with the new planting and also to show you a couple of we made some some modifications to the exterior of the building to try and accomplish what I think everyone was thinking was why have such a dark corness and draw attention to the top of the building when we could fade it more reasonably into the sky so we'll start with A5 which is um the view of the building what we've done here and this is very similar to what you saw last week but we softened the gray and where that becomes relative this is a um um this is titled um option one Woodmont R and Redevelopment front entrance and this is make sure I have the right color yes this is the backside on Vorhees Corner Road with the burm and the trees that were just discussed we took the line off the top of the building and the softer Grays along the top I think really helped to make the building disappear and as obviously a few years pass and the trees grow um I think it'll it'll be pretty much gone um and then we asked our architect because there was some conversation about um look about our building in South Brunswick at 361 and looking at the beige I'll be very candid with you we don't like it as much but we're certainly willing to have conversation um this is the sort of beigy a little more Earth Tone um Direction A6 this is A6 right so this is option two front entrance A6 and then this would be A7 wait but that says option one the one in your hand but then that's option two so the no hold on nobody panic so this would be the option to this is the beige it's so far away and so covered with trees I can't even see the color of the building so this is beige and this is the brownish tan that you saw here along the back of the building and this one is with the lighter gray option one along the back of the building on V's Corner Road so those are the uh the images that we thought the board was most concerned about we're prepared to go in either direction or if there's other comments or thoughts um we're certainly willing to entertain those Taylor can you flip those okay so before that can we just clarify which is a 567 sure so option one option one front entrance is five correct option one Vorhees Corner Road view is six correct and then option two of the front is a seven of option seven right option two is front entrance with the beige okay and then option two is eight with the beige along vores Corner Road thank you I want that clear on the record and all both of the Vorhees Corner Road just to clarify both of these perspective images include the new planting that Mr Lane T testified to and obviously we as we add to that this will you know both of them sorry yeah go ahead and say I think we have a quorum of preferring one as an option option one okay great I think the important thing is the cornice line was heavy on the first when we here last time with that gone it really yeah does change changes the view pretty thank you for that consideration no no problem at all um I'm done if the board has any questions no board questions so anybody if you have a question M up again Mr zki and frankon breki again um I like the architectural color scheme that blends in with the sky but I was just curious a lot of times they put rooftop units on the roof so now you got this beautiful architectural color blending into the sky but now all the rooftop units are on the roof and they're like a dark brown is there any way to paint the rooftop units to blend in with the color scheme so we that was testified to at the last meeting and the goal is to not screen them but to push them interiorly into the building because the building is big enough where we can locate them in the center of the building you can't see them okay um but if screening becomes necessary that's an option thank you it's a good question thank you anyone else in the room okay so let's go to on online does anybody who has joined the meeting this evening online have a question from Mr Santa okay great again Mr Mr senel thanks for the consideration thank you looks a whole lot better thank you Mr chairman at this point in time I'd like to quote Mr car Panky pank is going to be offered as our traffic consultant don't you raise your right hand so you can get sworn in you sworn in ready okay uh we you V dud no okay why don't to describe for the board and the public the board your uh professional backgrounds include your educational background uh your place of employment your title what you do and any licenses that you possess certainly so for the record my name is Paul k peny p is in Peter eh n ke I'm vice president with Lang and engineering and environmental services I am a registered professional engineer in the state of New Jersey I've been practicing over 38 years my uh area of expertise is traffic engineering uh and I've appeared before this board uh in the past okay than Mr chairman respectfully we uh asked the board to uh acknowledge and recognize Mr Panky as an expert in traffic engineering yes okay Mr Panky please discuss the traffic aspects of this application for the board certainly so Associated uh with the application my role has been the preparation of a traffic impact study uh which was prepared and submitted with the application dated February of 2023 uh I also uh uh handled the involvement of the NJ doot access permitting associated with this application and then my role is also to coordinate with Mr Lane to uh ensure and validate his internal design and circulation uh as plans were developed uh and prepared for mission to this board uh so just uh probably touch on a few things this this evening the traffic study certainly we want to talk about trucks uh and then we'll talk about where we are with the and lastly the uh the site plan so with regard to the traffic study and for a little bit of information for the public that might not be aware of what a traffic engineer does uh a traffic impact study basically uh is a docu ment that uh pulls together uh a sampling of existing traffic flow data on the uh environs of a project that's being considered particularly focused on the the AIS but also General impacts on the adjacent roadways uh that is done by conducting traffic counts uh and sampling uh data uh on the adjacent roadways as Traffic Engineers we focus on the peak hours of the roadway way when traffic is at its highest and when additional traffic would have its greatest impacts and and how we and that's what we look to measure the traffic study goes on uh to prepare a projection of the traffic that might be anticipated uh by a development and we do that by utilizing nationally published data data that's used by all Transportation agencies and review agencies in evaluating uh the design of a project both private as well as public infrastructure projects and that's known uh as The Institute of Transportation Engineers publication trip generation which I believe is in its 11th Edition right now it's basically an accumulation of traffic counts uh that have been conducted at similar facilities whether it be retail Warehouse office uh residential and we're able to utilize that to prepare a reasonable projection as to the magnitude of traffic that might be generated uh by a devel M based upon the the size of of the project in this particular case there's quite a bit of data that's published by uh The Institute uh under the industrial uh codes uh particularly warehousing uh through the last many years uh there's been a lot of research added for various types of of warehouses so so the it data has stratified the data into different types of warehouses High Cube warehouses Cold Storage warehouses but they also uh maintain a general warehousing database uh under what's known as land use code 150 and as Traffic Engineers we find that that's generally representative of the highest data of all these different types of warehouses except for some very rare exceptions like an Amazon Pick and Pack million square foot facility that has high levels of employment uh or last mile delivery Center which is sort of a unique user and is is a relatively small specialty design facility so we use that data because it it gives us uh what I would term a conservative projection of the traffic that's coming that might be come from a facility such as as this and certainly uh in our experience it's representative of the types of tenants that might occupy this particular building so we've used that data uh in the preparation of the the traffic study uh a little bit of information that's published in the traffic study for this uh roughly 350,000 foot building we would anticipate about 49 Vehicles arriving during the morning peak hour uh and that morning peak hour defined by the traffic counts is generally occurring around 7:45 to 8:45 in the morning and that can vary a little any given day and we would expect about 62 Vehicles leaving the site in the PM peak hour it's a relatively modest amount of traffic uh for a little a little bit of information the Department of Transportation defines 100 peak hour trips as that's okay 100 peak hour trips as a a level of traffic that might be considered significant that requires analysis of particular intersection so we're below that threshold that the BT uses as a a marker uh we then need to project where we anticipate that traffic to come to and from uh and in the past we used to do that by just looking at the general roadway patterns uh but as the uh technology has progressed we now get a lot more scientific in our analysis as to how people are going to arrive and depart it from the site and we do that by using demographic data journey to work data uh the most current data available which basically tells us where people uh that work in uh the area uh generally live uh were then able to couple that information with the tools that are at everybody's disposal which is basically Google navigation and determine the quickest routs because we all know now that uh we've learned roads that we never knew existed in the past to travel to and from sight so we have relatively scientific in developing uh the the distributions uh and that was done and is act actually documented in the traffic study in the appendix to the study so all the information is in the study as to how we we we routed uh the traffic in this particular case since it's only a right turn in right turnout from Route 202 your arrival patterns are a little bit different than your department departure patterns because you need to take roadways that approach this site and get you to the right turn in and as you leave the site you might not necessarily go back the same way you came because there are other ways to get back and that is part of that analysis using the navigation technology that we use so that's do dou umented in the traffic study and the numbers that we projected are are based based upon that uh we then prepare uh future year uh projections uh and in this case we expect that uh hopefully assuming uh all approvals are completed that would be in construction next year and likely would be constructed and operating potentially by the end of 2025 so we've projected forward uh to 2025 using growth rates established by the department of transportation and all of this is just to create a representative uh projection of sampling of of the road of of the traffic that'll be on the road system for analysis purposes uh once we've done all that we then prepare an analysis the analysis is done utilizing uh programs uh that again are nationally uh accepted uh and and the methodologies that are used by all Transportation professionals and preparing those models we obtain from the Department of Transportation the current information in this particular case the two adjacent intersections bhe Corners in 202 and case Barden 202 the uh ASD designed traffic signal operations so we're able to actually use the programs that are in the controllers for those intersections and implement it Implement them into our modeling so that we can analyze the es and flows of of traffic and model the operation of the the uh the intersections and that's again all documented in the traffic study the backups in there to to review uh and has been reviewed by Mr Troutman your your traffic engineer uh the one thing I'd just like to touch on in terms of the traffic counts that we did those were initially done in uh June of 2022 schools were open when we did the counts U Mr Troutman in his review letter suggested maybe a sampling of counts to see if they still valid uh we actually had done that in April of 2023 uh after the study was prepared we did go back out and recount the intersections of 202 and VES Corner Road and 202 and case Boulevard I did provide that data to Mr Troutman uh as as I described to Mr Troutman I was uh pretty surprised usually when we do these counts you'll see a little bit of variation in this case the counil were dead on in fact they were slightly lower than the 2022 data so we really had a good sampling of what's happening on the roads in in 2022 and it really continued to 2023 without a lot of substantiative uh change uh we did that because we were coming out of covid so we figured it was worth just having that data as a recheck uh uh to the 2022 data uh so with that said uh we did prepare and document in traffic impact study and Analysis of our driveway to make sure that our driveway would operate at uh good levels of service meeting uh the standards established by the state and uh we did identify that our driveway would operate at what's known as a level of service C or or better and again for the purposes of the public because I know this board has heard endless Traffic Engineers uh basically after we do all of this analysis Traffic Engineers try to boil it down into a very simplistic rating and it's really a rating from a to F uh not any different than an old grade school report card a being good levels of service F being failing conditions the only difference is in a failing condition traffic still does get through intersections you just might be delayed in getting through that in intersection uh generally we look at levels of service c as design levels of service uh and d& are relatively acceptable levels of service uh NJ do accepts the limit of the EF range as being acceptable for a driveway uh and again we as I documented in the traffic study are finding our driveway will operate at level of service see or better during the roadway uh peak hours so our driveway will operate efficiently with regard to the two adjacent intersections again as I indicated the level of traffic that we are adding to those intersections would not be considered to be significant by the department of transportation to the point that they would be concerned that it would have any impact on the operating conditions of those intersections uh however we did analyze those because we knew the board would probably be interested in that and the board's professionals uh and uh as we would have expected basically we find that the traffic added by this project will not materially change the current experiences at that those intersections now that's not to say that those intersections uh don't have problems or I should say at least one of them case Boulevard actually operates at uh pretty good levels of service Vorhees Corner Road as everybody is aware is a rather complex intersection uh it it has a lot of Lanes on approaches a double left turn lane on Route 202 which is an unusual condition and because of the geometry the intersection operates with four distinct phases the left turns on Route 202 have a certain amount of green time and then are shut down uh the through traffic on 202 run and then uh the Northbound Wares Corner Road uh runs separately from the southbound Church Street so the intersection operates on a split phase uh design uh uh because of the geometry and the complexity of that intersection uh and because of that the do also is running a very long cycle length B based cycle length at that intersection they're running those intersections during the peak hour at 120 seconds total to cycle through all of those four phases so what that means is when the red time comes up on the side streets and Dot as they have doe throughout the state has prioritized the the the through traffic flow on 202 that you can have if you're the if if you come in at the beginning of red a long wait till that green that light goes green again and that's what's happening out there today uh that being said the the biome of traffic that we will add to that intersection predominantly on the route 202 approaches will not change uh the delays that are experienced will not really change or be perceptible to motorists traveling through that through the intersections uh and that's the same at at case uh case Boulevard can I can I interrupt you done a lot of talking I want to give you a chance to take a breath here okay that bhe going to section is a mess we all know that right does the dot look at your estimated counts and against how the traffic flow is set up today and pass judgment on whether the current uh lighting time sets I don't know what the right words are uh that they are still valid correct very you described it it's a very complex so so in this won't take a whole lot to jam it up more so in this particular case since we're well below the threshold that dot considers uh to be a level that they would be concerned with they don't even they don't even believe the intersection needs to be studied from their standpoint uh because they know it's not going to change the operations of of that intersection uh and and to give you a little bit of order of magnitude uh in comp you know comparatively those intersections right now VES Corner Road and 202 during the peak hours are accommodating over 3,500 vehicles per hour it's a high level of traffic this project will add during those peak hours less than 50 vehicles uh when you distribute it and then compare it to that 3,500 plus Vehicles it it really doesn't move the needle it doesn't really change the operations that's one of the reasons why dot uh doesn't doesn't uh look at that and the timing of the intersections like I said unfortunately or fortunately depending upon your Viewpoint is prioritized to the 202 approaches because do looks to move traffic regionally uh to the uh disadvantage of the local traffic and and that's consistent throughout the state there is also a uh a coordination system out here so that also affects how these signals are timed and how much time they can give to the side streets so this particular intersection is actually coordinated uh with the intersection 20231 and Road uh that's the master intersection so it's it's tied to progress traffic through the circle uh and through this intersection so that all comes into play when do decides how to time these intersections and whether to touch these intersections and that's factored into our analysis just while you're on that intersection in your traffic report you do make a a note that um a minor shift in the green time from Route 202 to the Bo's Corner Center Road right away phase would improve operations at the stady intersection correct if if the department would consider uh at the would have to be at the request of the municipality they're not going to pay attention to a private owner uh they would consider potentially uh a retiming uh they won't they won't balance the intersection in other words they won't take a lot of time from 202 uh but with a request with backup data and you'd be prepared to assist the town if they wish to put together such a request we may be able to request a consideration of some additional GRE time in this particular case what we were seeing particularly in the morning peek hour uh the Vorhees Corner Road Northbound approach is probably the most in need of some additional green time to process it but uh there is a process to to request the dot to consider that uh what'll control that is the progression the the coordination system because the only allow a certain percentage degradation of that progression uh but the data is in the report it can be pulled from the report and prepared and provided and submitted through the township to this to the state for consideration thank you talk about the circle for a minute and how you and the dot evaluated the impact on the circle and I'm specifically talking about southbound 202 because the trucks will need to enter that very fine Circle make a left turn and cross over two lanes while other traffic is going right we've all seen how many accidents right there so how is that being evaluated because to me and I'm not a truck driver that just seems like an awful lot of maneuvering in a short bit of space again the the volume of traffic being added is not rising to the level that the dot has raised that or would raise that as a concern uh you know they designed that intersection and it was built I don't know what was about 15 years ago now uh and they designed it to accommodate these movements and in their view uh what they designed and what they intended to happen are probably two different things but but this project will really not Chang the The Experience there again the level of traffic we would be adding there uh uh if you compare that that's probably handling over 5,000 vehicles per hour uh given the magnitude of w31 and 202 so the few vehic we're adding to that it's just not going to change the experience of that intersection and again I'm not here to tell you everything's Rosy and good the problems that are there are there we're just not going to uh aggravate them or change what the current experien is at that intersection uh but let's let's move into trucks because obviously trucks is a concern uh and I know the residents behind me and the residential neighbors that are going to be the neighbors of this development are concerned uh with their streets and whether or not uh trucks will start to use their streets uh and there's a few things to talk about there there's basically I would say three controls uh one that's the applicants two that's legislative that uh address the truck traffic from the applicant standpoint our control and and uh I think our prior Witnesses Mr Santo and M elain have really discussed what has been developed and the town itself obviously putting together the Redevelopment plan is the design of the project and the design of the project provides only the access from 202 uh and the the address of the facility on 202 so all trucks our truck terminal access uh our address in navigation is rout Route 202 so that's the control that the applicant has the other two controls uh are one Statewide uh you may or may not be aware with regard to uh truck requirements uh so the date about 10 years ago uh when when the federal government uh required that o trucks have to have reasonable access to the roadway system uh like many other states adopted legislation so in this case the state adopted legislation 16 colon 32 entitled truck access what that legislation legislation establishes is the legal routes that truckers must adhere to in traveling to and from destinations uh in the state and those right routes are the National designated Network which would be the state the interstate highway system uh and then as you move locally uh it is the new it's the what they call the New Jersey Access Network so the New Jersey Access Network as made up by the legislation involves All State highways with with some very limited exceptions I think we 29 Down and Trenton is one of them and all 500 series County Roads uh and with some very limited exceptions to 600 series Road in the South uh southeast of the state what what that means with the turn regard to this site is under the state legislation truckers are required to stay on Route 202 as the destination original destination point of this site is on Route 202 so they have to use route to or two uh V Corner Road is a 600 series road so it is not permitted to be used uh By Truckers case Boulevard is a local Road and is not permitted to be used under the under the act so in effect if you're coming from the west and south areas 31 route 202 or your travel routes if you're coming from the north it's 202 and you have to go down to the the circle you can't use case Boulevard to go around to warhe the only way that a truck could do that is if we actually had a driveway on bges road that was an active driveway and address then a trucker is allowed to deviate from the N from the state access to go to a local road to go to a point of origin or destination for instance a Mayflower tractor trailer delivering or going to a home or permitted to deviate uh the deliveries to the cafeteria at the middle school if it's a tractor trailer or permitted to deviate but then they must return to the national network by the and or the uh the the New Jersey Access Network by the most direct route so in this case uh all our trucks are restricted to the highway the last mechanism is actually in the hands of the township and the mayor actually mentioned it at the last meeting it's an act by Township Council uh basically uh under Administrative Code uh I believe I have the the site 40676 and what that Administrative Code does is it allows uh a municipality to designate truck routes and once they've designated reasonable truck routes on on M roadways they can then actually post uh uh weight restricted roadways four ton roadways so for instance uh once the township was done identifying appropriate truck routes they could actually then post case Boulevard uh for no no vehicles over 4 tons uh I think the mayor also correctly indicated that County Roads would have to be coordinated with the county and certainly with the state there is a process there but the tool is there and I think I I read the mayor to say that uh they're actually proceeding along those lines so basically it's an affirmative process by the town to reasonably recognize that they have to have truck routes on their roads and and you do that by considering where the trucks need to go too you set those routes confirm them with the county and state and then you have the proactive ability to start looking at roads of concern and put actual truck restrictions so there are three mechanisms uh in this particular case uh that control the truck traffic uh so we would anticipate right off the bat since our aess is on 202 only that the trucks will be uh utilizing uh2 so I think that was a an important in piece of information because I know that is a concern it's a concern on many uh municipalities or Warehouse development that we've been doing throughout the state uh lastly is is the site plan and uh the the access so it is a Redevelopment we do have an existing access to the old uh bren's PW site uh we are reconstructing and slightly shifting that driveway the existing driveway really doesn't meet current standards so we really couldn't Salvage it it actually has a little bit of an acute back angle to it which isn't uh which isn't a good design so the application uh to the state is correcting uh the geometry of that right turn in right turnout to meet current state standards for the accommodation of the types of vehicles and even including trucks that will enter and exit the site the driveway has a 90° uh alignment directly in so the skew has been eliminated uh in the design and then associated with the design of the driveway this project will be widening along the Route 202 Frontage to put a full shoulder in to the dot design standards uh and then lastly uh whether it ever gets used or not the state requested that we install sidewalk along the frontage so we'll be installing sidewalk along our Frontage uh so that permit and design is uh fairly complete we we're expecting our permits uh any any day now uh so uh work that through the state and we expect that to be permitted and approved and it will create a safe uh driveway to current standards with good site distances with a full shoulder along the the frontage of the site does that expansion does that constitute a whole new Lane lack of a better description because I know it's not a deceleration or acceleration Lane but does it give the trucks an additional Lane so that the flow on the two Northbound LAN is not imp the state doesn't stripe these as Axel desel L they certainly generally are used to to to shift off the road and and slide in uh it is a 10- foot wide Lane which is the state standard for shoulder uh but that that creates the geometry and the safety along the frontage uh again it's controlled by by the state design manual uh so that's what we we are meeting just a question though to clarify that a little bit more how many if how many um trucks can be accommodated in that turning lane it's not it's not a turning lane so truck would still enter from the through Lane but would like we all do on a shoulder could peel off onto it a little bit early uh but it's not strip for and shoulders are not fully intended for uh Axel and Diesel Lings they just provided there for safety emergency and for a little more ease of geometry to make the turns of that's okay so then then it's kind of meant to operate like one vehicle at a time one truck entering at a time would you anticipate truck stacking up on 202 so that's yeah so that's one of the things that do does look at is the internal circulation and certainly we've looked at it and Mr Lane looked at it so there is nothing that's impeding trucks from free freely flowing into this site there is no gate immediately in the truck ports are well into the site so trucks will be able to easily ESS uh the state highway and move into the site and then as they decelerate uh and and those movements are no different than we make into gas stations and shopping centers every day you make the turn you slow you come into the site but the geometry in this case provides ample space for those trucks to move freely in and out of the site there are no points of conflict within the uh the immediate vicinity of the uh the driveway and then that goes to the internal circulation uh Mr Lane did talk to it at the last meeting I can affirm that I did look with Mr Lane on the design of the internal circulation uh he has properly designed it to fully accommodate a fire truck circulation around the entire building the geometry easily accommodates that and also uh the accommodation for the movement of the trucks into out of the truck ports is appropriate meets current standards uh and will accommodate those those movements so the site is is welld designed there's nothing unique to the design of this site it's a proven design it's the standard that's used generally uh you know Countrywide in the design of these types of uh facilities uh so from from that standpoint I you know in my opinion uh you know we've designed uh we we've got a well-designed site we've got a safe access produced the permit when when provided by do uh and we intend to construct to those do stand standards uh to provide for safe and efficient access into and out of this site uh the the only other thing I has to mention is the emergency access that's been talked about uh that's really there in case for some reason there's a blockage on 202 or or at our driveway internally otherwise it'll probably never get used a clarification point on when you talked about the three uh controls for truck movement um when you mentioned the Statewide truck access requirements um where the state and the county established legal routes what's the enforcement mechanism if somebody doesn't follow them yes my H I'm I'm not a police officer I don't know if any of the board members are but my understanding of the enforcement is State Police uh can enforce them without question without probable cause uh my understanding is also local police have the ability to enforce them with what's known as probable cause so in other words if a police officer followed a truck taking a route down case and B's Corner uh he's got probable cuse to then enforce so it is enforcable on the local level that is my understanding again I'm not law enforcement but that's my understanding as a law the difference State Police don't have have probable cause local police have to have observed the the uh the site the the uh uh violation to provide a citation and is it a similar enforcement mechanism for the if when the municipality goes forward and identifies truck routes that that is our plan in having the truck safety is that we would provide police enforcement that's our intention but that's the tra I'm just getting the applicant to get it on the record but that's the normal enforcement mechanism that's correct yes they are they are laws so they once their ordinances are established by the town they are enforceable and I believe we have in our Redevelopment agreement that the leasing uh the those that are leasing the space would be held in the lease to ensure that truck traffic does not go on the prohibited roads that is correct and and we'll also stipulate that to that as a condition of approval as well is there any testimony to The Jug Handle at case and 202 and what the dot results of that were uh again the levels of service at that intersection are better than bores Corner as you're probably aware and again our impacts at that location really didn't change the operation we also uh checked the geometry of that intersection ran turning templates through it it's a well-designed intersection and it can accommodate the types of vehicles that uh would travel through it and I would defer Mr trout to uh provide any opinion that he has with regard to that also so that you don't anticipate any conflicts with school buses that might be accessing that Jug Handle to go right and trucks trying to make the left nothing unusual other than you know the the the normal rules of the road you have to follow the stop signs you have to turn when you have a gap uh trucks are not unique from that standpoint and any employe that works here has to do what we do every day follow the rules of the world and the like so there's nothing unusual at that intersection that causes me c that there's a a safety concern J did you want to say something yeah I would just uh affirm what Mr peny said about case Boulevard that was one of my concerns so I went out and inspected yeah just for everybody's information gentleman who's speaking is Mr Jay Troutman who is our traffic engineer for R rwn thank you uh one of my concerns was the design of that Jug Handle at case Boulevard um in a lot of areas of the State uh The Jug handles are older in age smaller not anticipated to handle Trucking in this case you have a a newer design that was installed that that's a fairly new inter section that that complies with the the most recent dot roadway design manual and anticipates larger vehicles in the design so the the the level of trucking through that Jug Handle meaning how many trucks per cycle of the signal is very low it's going to be a couple of trucks in an entire peak hour you would expect only one per cycle and that geometry can accommodate uh that type of activity and in your report you actually mentioned um you were going off of their June 2022 report but I did hear they redid the report in April of 2023 so did you have a chance to review that and incorporate that into your findings yes uh Mr peny did send that uh data table to me after the last hearing and uh he is correct that um the counts are basically identical so we can confirm that the the count thata in the traffic study uh is accurate okay and I appreciate doing the recount because the time of the original study was June 21 which was a day after schools let out so it did not accommodate the busing so I appreciate doing the recount I'm pretty sure that it was the last day of school but I'll defer to you we were we were struggling to get it in I know why we had to redo it I think that's probably a large part of the concern is school buses sure Crossing that intersection where buses trucks are trying to turn sure it is a concerned Statewide nationally we always concerned that anything else Jay in your report uh I guess we could just cover my memo since that wasn't addressed uh during the direct um what we do is we verify the accuracy of the traffic counts we verif ify the accuracy of the traffic projections for the site um proper methodology was followed for those items uh I I did uh add in as an attachment to my memo uh what what maybe a 24-hour cycle would look like at this type of Warehouse if they were operating on a 24-hour cycle which may not happen but they're allowed to do that so I did attach um a chart showing you know every hour of the day how many trucks how many cars and you can see for this size of a warehouse um the overnight is uh is very light which has been our personal experience doing data sampling at these types of sites as well um it's my opinion that the it trip rates that were used in the analysis are on the higher end of what you would typically see when you actually go count these warehouses the reason for that is is that the more modern warehouses uh have a high level of Automation and less headcount and it tends to to keep the the the actual numbers lower than it so the it projections are a good conservative um number to use in the analysis there was a comparison in the report showing uh that this development is not undiff from what used to operate as the manufacturing facility it's a similar level of traffic impact as if the bronze site were operating as it did years ago as a manufacturing facility um just a question on the on the shoulder uh you said you're proposing a 10 foot wide shoulder correct and and the existing shoulder I guess is narrower than that it varies but it's six to eight feet okay so that that that that will help with the with the um efficiency of trucks leaving the roadway just to have that larger inside shoulder to make that that turn a little smoother uh and also we just requested um if they could do a truck turn plan I know Mr Lane's going to do a plan for the fire truck on bhe Corner Road if we could also have a a plan just showing the the truck turns in the in the loading area we provide that on the approval we've looked at that yes and then I guess finally uh regarding Vorhees Corner Road uh I would like to have the township submit a retiming request to do if you look at the volumes in the report it it seems like uh 4E Corner Road approach versus Church they're relatively even volume in the peak hour but for some reason warhe Corner Road gets a lot less green time than church so I think that's that's a problem with the do's current timing even if we didn't steal time from 202 maybe just shifting a second from Church the Vorhees and maybe getting a second from 202 as well will help the Vorhees Corner approach that's the one that seems to be congested um and and I would like to have the township request that with Mr panky's information his report has all the existing timing charts in the appendix and you can see the bores Corner Road Green time is is a lot lower so I think that's something that we should at least request to be corrected yeah and what what we've done in we've done that in the past uh on past applications and other municipalities what I would uh propose is we would actually assist in preparing a letter that would go under the township uh engineer we would pull the data from the traffic report instead of just provide the traffic report focus in on the the traffic counts and the the existing timing directive and make a specific recommendation with the backup analysis uh as to the timing we'd like to see implemented that way we're giving the data to dot in a form format that they're used to seeing it focused on the request uh so we could work as a condition of approval to prepare that uh and provide that information that would be very helpful thank you okay thank you J any other questions from the board from Mr peny no Jersey I have a question you always talk about the circle at case if your truck is going South it's going to have to pass Circle South on 202 it's going to have to go past the circle on case go down and take the Circle pass Kohls to turn around and get on North 202 is that Circle capable of handling trucks I've seen trucks flip over there before the the circle itself has been designed it was designed by do 15 years ago to accommodate that movement of vehicles yes uh that doesn't mean that accidents don't occur or but that's not the one at case that's the one further down it's to to make the U-turn you need to go down to the Flemington Circle yes the 31222 circle okay I just because that one seems tighter than case thank you yeah that's that's the question I had asked earlier because it's a it's complex Circle correct I was talking abouton I can't comment on how they got it wrong all right Joel throne for Road um excuse me I didn't hear you let me spell it t h r o n e I moved out here in ' 87 and moving out here uh has really been a blessing but when I first traveled um I taught a Verona and I coached a Verona High School I taught that guy I haven't seen him since I don't know conrat but you need to ask a question I'm sorry I question it would it would take me 42 minutes as a drive okay now I would leave at 5:30 in the morning and I would return 9:00 at night I coach three different sports now now I retired in 212 that last year it was take me an hour and 15 minutes in the morning to get in and back so one of the things that I see is that the traffic has you have to ask the traffic the question is H from what you were saying that how is this going to impact on the traffic within our Our Town itself so so certainly any development or Redevelopment is going to generate traffic uh you know the property is an existing privately owned property and it will generate traffic and add traffic uh the the results of our analysis show that our driveway which is the important part of this will operate safely in terms of impacts as we move away from the site the two the two first critical intersections are case and B's corner and our analysis of those intersections show that we're really not going to change the operating characteristics As you move further away the tra traffic starts to dissipate further so yes there will be additional traffic a car here additional couple cars there but overall it's not going to this site is not going to perceptibly change that's not to say that we're are not a growth economy and the traffic's not going to continue to grow uh it is going to continue to to grow as we experience that's why we look at you know the yearly growths of 1% 2% this is actually part of that growth okay with that being said there are other warehouses that have just come into town or neighboring towns has their impact or their uh flow has that been calculated with what you're doing what you're saying that we're going to uh face in these coming years so they're they're they're addressed in the general growth rate established by the department representative of continued Economic Development and growth so those growth rates were established by the department on a yearly basis based upon an evaluation of traffic characteristics in the area which is reflective of the economic development particular area so uh those growth rates are established regionally throughout the state so that's why we rely on the Department's information to look at that other development that's in aocc so that's been reflected in the traffic study so it was decided regionally not specifically for R Township that's correct the site specific is is this traffic study for this development uh uh for the board's uh consideration of the safety of the driveway okay now if your truck is coming out is leaving um the site and it wishes to go back towards the circle how would that truck progress it would it would go up to case Boulevard and use the drug handle and the traffic signal to return to the South I thought J case Boulevard was not going to be used by the The Jug Handle can be used to return to Route 202 you can make a left from The Jug Handle returns to 202 what you can't do is make a right and go down case Boulevard CL the Middle School Down's Corner Road or Old York Road or raville Road and as far as the enforcement of all this you had mentioned that before that the state police uh would be uh the enforcers of it but that would be kind of ludicrous wouldn't it uh the trucks would go wherever they wherever they went like I live off of Dory dils and I see trucks coming big trucks coming down that street all the time um if I call the police what are they going to do by the time they get there it's all already at Fade to complete but um I'm just worried very much about the especially in SE warhe and case and how many accidents are there compared to the rest of the town I think that's something we have to keep in mind thank you thank you johi Yi 129 Locust Court I want to Comm men you on providing some valuable information regards to that state law I think that's going to prove helpful moving forward for the township committee uh in regards to the two intersections that you were speaking of and the circle we have any information or data in regards to whether they're accident PR location areas we haven't pulled accident uh specifically Access Data all you know our experiences all intersections obviously have an accident history signals generally experience rear end accidents the circle has a little bit of a different type of a uh performance to it generally what we're seeing at these multigame roundabouts is more side side swipe type accidents uh those are the types of things we expect to see uh and unfortunately they do okay those are traffic engineer have that data uh I I did not uh get the crash data for the two intersections um I am familiar with the the crashes at the Flemington Circle um I do some work in Flemington burrow as well and I have had a chance since that's under Flemington burough jurisdiction to see uh the crashes that occur there okay uh for each Corner in case Boulevard do we have the crash data uh since that was brought up uh where the schools located I'm only bringing these issues up for safety liability and concern of uh protection of our Township yeah that information would be available from the police department if we were to do a request I do not have the num okay and if they are AC prone locations uh will we work with the state in improving the the location to make it safer being that we're having additional truck traffic and as this surveys indicated it's high volume of traffic at forast corner in 202 have we worked with the state uh you have mentioned timing the traffic signal devices yes we we could uh request that that from the police department and if there was anything we wanted to bring to the state's attention um I I'm not aware of any uh crash pattern there that would need correcting just from my experience you know using these intersections on a regular basis I haven't seen any unusual crash pattern uh that what I would want to alert the state about okay I think it's five accidents or more at a specific uh intersection redeem an action of prom location in regard to the police department there they short step for the growth that's occurring in Ron Township uh so uh I would encourage the township committee maybe to explore with all this growth in the truck traffic in hunterton county and Somerset County Waring County being a a warehouse Paradise moving forward uh I would I would suggest maybe developing a traffic safety Bureau this year we conducted a fire safety study and a police safety study on our agenda we will be conducting a traffic safety study it will be inclusive of your request to look at where the accident prone intersections are we would have to and will coordinate with County where they are County Roads state where they are State Etc um but Our intention is to ensure a design where truck traffic is well identified policed and adhered to in addition to ensuring ongoing traffic in general safety for our community so we recognize this and um you know these studies take time um but we are intending to do a comprehensive plan like that not just specific to this development and the impact but for our entire Community um and we've also been working with our chief to talk about design and needs on the police department to ensure that we are in line with the growth of our community and that's why we did the police safety study um so we have things that haven't been formally announced but are in the plans thank you mayor uh do you know when that study will be completed I do not have a timing on when it'll be done um okay I'd love it to be yesterday but as you know hopefully it'll be done before this Warehouse is built uh in regards to the question uh uh may I call you Donna uh Donna had in regards to enforcement uh I think once the township adopts the ordinances Town ordinances uh and this traffic study reveals that we're going to have a traffic safety Bureau uh the local police department would uh enforce those ordinances Municipal roads Bee Boulevard okay thank you thank you sir John McCay 122 Featherbed Lane Clemington New Jersey my question is sp your last m a k y all one word no capital K it's Scottish not Irish hold it [Music] again I don't holdy against you well my mother was IR the question I have is we do these traffic studies and we have two things we have Theory and reality Theory says won't be traffic jaam reality is I'm sitting in a traffic jam I want to know in in this traffic study whether there's a differentiation between cars and trucks there is how many trucks went through this traffic study it's it's it's calculated in the traffic data the detail I don't have that but yes when we do the traffic counts we differentiate trucks and when we do our modeling we actually reflect the the truck percentages because there's a calculation that's incorporated into the analysis that adjusts for the different characteristics of acceleration and movement of trucks so that is reflected you should be a well the the thing that gets me is you know we see traff truck traffic now and you're basically saying to us residents that this is not going to impact truck traffic on the highway at all no that's not what I said I did say we will be adding traffic any project any development of private land is going to develop uh some some traffic flow in this case a warehouse will generate trucks we talked about that what I did say is the trucks are oriented to 202 uh and there are existing trucks on 22 so it is additive but that's been reflected in our modeling and Analysis uh in the impact analysis so I can tell you from their table and their report that the majority are passenger vehicles as opposed to tractor trailers um right now they are in their future generation estimate table for the site itself correct correct so how actually how many are going to be leaving or entering they're only going to be able to go north right when they leave when they leave the site they have to make the right out of the site we we would look at somewhere between 5 to 10 Vehicles exiting an hour uh throughout the course of business periods so as an example in their table it's four tractor trucks entering during the am peak hours as an example again I said the in reality thank you sir in the back with the excuse me sir we're gonna there you go thank you Joan fonte i n f n t one M way um I'm just trying to look at the numbers so we're saying there's four on the average of four trucks entering during peak hours during the morning during the morning so I mean the I'm just looking and and I I became an expert on this in the last uh 24 hours so bear with me a second so the it has a thou a warehouse space being 1,000 square foot using a half 0.5 truck trips to 1.5 truck trips per thousand square feet is that still accurate yeah the for this particular it depends on whether it's peak hours or daily projections uh that's on a 24-hour period I know 24 hours but it's probably not going to be 24 yeah so so so so if this was a 24-hour facility you'd be looking at somewhere between 100 to 125 trucks throughout the course of the day entering and exiting 18 hour period again you're looking at that 5 to 10 trucks per hour so potentially entering all right so I'm I think it's the lower end is 10 but I I don't want to argue because you're the expert and I'm not but the point is if it's if it's 10 um and we're saying that I guess it's a number thing and all I'm trying to figure out I don't know if you have the numbers or not but it's a math problem so if we're sitting and let's just say it's seven seven trucks an hour what does that what does that do and an intersection as a 1202 phase with a truck that takes 25 seconds to go from Z to 40 and we have eight of them lined up yeah at every hour so that's modeled into the the analysis uh really when when you're comparing you know five five six S 8 10 trucks to 3500 trucks traveling through the inter cars or Vehicles traveling through the intersection it really doesn't change it basically trucks in terms of factors are I believe it's like two and a half has has has the equivalent of about two and a half cars in terms of its impact and acceleration uh based upon uh the methodologies that have been prepared nationally okay so then we know who the who the um occupants of the warehouse are going to be it it is a speculative uh development we we know that the building is generally attractive to a certain type of tency single-sided building uh you know certain amount of dock doors really doesn't factor into it but uh in general the data we use is reflective of the types of tenants most of these tenants have very similar characteristics uh they generally have one two or three shifts shifts usually start you know 4 5 6 in the morning run to Mid switch over to an evening uh you usually have an administrative shift that's coming in typical work hours 95 business office so that's what you generally see in these types of uh I'm I'm like consider more about the the actual the content so looking going back to it data it could be on the lower end of 0.5 per truck truck trips per hour to 1.5 it's on the 1.5 side you're talking 500 trucks I'm going I'm going to say this because I think I said this at the beginning of the last hearing if if if a governing body has deemed something a permitted use within the township and under this ordinance this applicant is a permitted use case law in the state of New Jersey does not allow us to deny an application because it's putting more traffic into the roadway system that's fine I just want to make that clear the only the only burden an applicant has is to prove that they are going to design the warehouse Ingress and egress safely and levels of service and this Engineers has indicated its level of service C so unless there's something with regard to health or safety that's going to jump out at us and catch the attention of Mr Troutman our traffic engineer and nothing so far has caught his attention all of the questions about how many trucks on the roadway are really from our standpoint Al irrelevant we can't take that into consideration it's just beyond our purview as a planning board all right well then that's the law well I'm just saying from the standpoint of how many trucks are you know realistically so what that means is we could have 500 trucks a day a th000 square foot can accommodate that much foot and the board will weigh the testimony of Mr Panky as your traffic engineer expert in making its decision and also consider the testimony of Mr Troutman as as our expert in determining whether the applicant has met it's burden concerning uh safe safe traffic Ingress degress emergency access things of that nature and of course they have to go to the state of New Jersey we don't have control over a state highway they got they got to get state permits from New Jersey on the state decides whether their their design after looking at their data meets the state do requirement we don't we don't do that understood thank you and just just for the record I understand the concern and the numbers uh you know over the last 15 years in Industrial Development Warehouse development has been one of the top things we've done as Traffic Engineers our D databases are strong uh I would advise the board there's no no way you're going to see that kind of truck traffic at this site this building just is not set up for that the standards we use are probably not High land what you're going to say okay sir my name is Andy sat last name is spelled as S as in Sierra double A as in Alpha and t as in Tango I resided for Woodside Lane in the Woodside Farms development across from jpk middle school and my wife and I have been uh Township residents uh for 33 years now Mr chairman planning board guests from Woodmont and Associated consultants and members of the public my Fe has there been any traffic impact study on Route 31 only because I anticipate a lot of track truck traffic coming from the West on 78 East taking that exit to 31 South having to deal with two choke points when two lanes become one um maybe 100 ft or so before Stop and Shop and just after uh the high school now I I can't remember whether making the left is allowed on Church Street to go on 202 is that allowed today yes okay so so the truck Clos are double trailers or tandem trailers allowed on our roads you know I've seen fex with two two trailers and I've seen it in New Jersey I assume that's allowed uh FedEx has short tandems not the double tandems the double the big double tandems the 48 foot back to back they're not permitted on the New Jersey network uh they actually have the drop on the national network however the short ones are equivalent to the largest truck that's permitted aren so you probably seen uh the combination 2525 226 pops yeah correct what you would see from the LTL providers like out s you'll see s have two pups or FedEx Two Pups running in okay sorry yeah um what you're talking about is two 26 foot 25 to 26 foot pups they'll be in Tandem and you'll see those from a FedEx a UPS you'll see those even mail trucks will be will be on the interstate highways but as you talked about the you there's legislation on what's interstate and intrastate and the state the state rules are different Christine Todd Whitman tried to do something with that several years ago to eliminate doubles in interstate commerce on 31 and was ruled down by the uh federal government so yeah there's very specific rules and if you look at the signs you'll see the blue Interstate like a 78 is different than a route nine which is I believe a circle or so he talked about New Jersey Network they are like a little badge with a number in it versus a circle with a number in it versus the blue Interstate numbers so each one of those is regulated by a different governing body and each one of those has very specific rules and regulations you could probably explain a lot more about it so I go back to my first question was is there traffic excuse me U allergies was there a traffic in place study done on 31 we have not extended to 31 by the time we reach 31 the dis the traffic is well dissipated think thinking of traffic coming from the West on interstate 78 heading east and they need to get to the warehouse for sure they'll take that 31 sub they're not going to go all the way to 287 and try to pick up 202 from there correct there will be some traffic that comes down 31 yes okay uh do you think it's worthwhile to do a study on that again the traffic for this site is so dissipated by the time it reaches 31 in other words we've spread traffic in so many different directions no it's not going to have an impact okay now my next question is the anticipated increase in war and roads today if you look at uh the Jack handle case buard you know if you're heading uh to to North and you want to get back on South you notice the amount of potholes there are that little stretch of road across to or two as soon as the township fix a pothole and another one pops up it's like trying to fix a dam you're just sticking boring um well that's a state road yeah 202 is a state road so they would have to repair 202 specifically same for County Roads the county is responsible for it but in regard to your question related to the safety study or traffic Route study in 31 that's why we are going to do a comprehensive Community traffic study to make sure that we design desate within our Township the desired and safest routes for trucks to move through town as oppos you know we can't control when they have a destination um but we will make sure that we do all signage all enforcement and everything we can with the outcome of that study to address what you've already brought up and I don't know why we never widen 31 okay then other thing I'm not trying to split here you know the Old River Road there today they truck traffic question you have this as I'm just giving an example get to testify about any at the end I you come up and say your PE okay I appreciate thank you for the feedback thank you sir Frank breski um the traffic engineer gave us a lot of information um I always believe that there's a problem you should not just bring up the problem but maybe bring a solution my problem is we're just talking about the area the general facility again you need to ask a question I'm gonna ask of the engineer so so so there's we're talking about the general area of the facility and in your statement you said that tractor trailers far of secondary roads uh tractor trailers shouldn't be on them because there's some sort of state law that should be enforced by the police department or Ron Township I guess so really you have no control once you what you build your facility I don't know if it's a SPEC Building whether you are directly going to be the owners and operators but once it's built these truck drivers are all going to be contracted and the problem is that you brought up that it's Township's problem to handle handle any viol ations so my proposal to you is let's put some cameras at your expense on board heast Corner Road so the the police department can monitor it and if they do see any tractor trailers leaving that facility going down warhe Corner Road then the police will have there's not there's no way they're going to have a police officer sitting there on bhe Corner Road everyday monitoring your facility so you could be a good neighbor and you could put some camer on bhe Cor road because what's happening is the trucks the trucks we can legally require them to do that well but I'm I'm asking them I'm not requiring he asked them whether they want to do that I'm asking them if they could be good neighbors and do that because and what happens is the trucks are the TR we're we're making a $150,000 Community benefit uh donation uh for things like this that that may come up that the township can use as its discretion and that may be one of the things that the township would like to do with the with the donation because what's happening is I'm just bringing this to your attention because you're focused on just the problem in the immediate vicinity but we're starting to have truck traffic my neighbor not testifying against you need to ask a question ask question so so what's happening when you're building your facility the the trucks AR going to go up 202 all the ways to Somerville and go all the ways back to Hillsboro belme they're going to start taking the truck drivers and you don't have any control over it the truck drivers are going to start going down Amo road going through a residen you need to ask a question okay and and the point being is I'm just requesting that sir you be a good can I ask you to hold this because you're testifying and we need you to be sworn in and you'll have ample opportunity to do this later this evening right now you really just need to ask Mr P question I guess the proposal was that I asked that if they would do something and be a good neighbor and put some sort of monitoring system to help the rton Township police because so that that's my was my proposal question thank you yeah just just a one clarification I think is important this lady right up front you've been waiting for a while yeah go just a just the clarification so this isn't just an Enforcement issue of a regulation these regulations are known by the commercial industry the truck drivers they you know this is this is part of what they do every day they're aware of the laws you know like us were licensed driver they're licensed driver they know their truck restrictions they don't want citations they want to follow the laws they don't want to be in residential neighborhoods they don't want to be trying to turn around in somebody's driveways so it's not just this is the LW I'm pointing to it's your problem to enforce it it's it's an obligation of the drivers themselves and they do follow those uh and when you see trucks on local Road a lot of times it's because they have an origin in destination and they have a right to be there uh whether they're making a delivery or someplace on a short route okay yes ma'am Joan how eight was Nikki Court um back to my question that I asked like an hour ago um any consideration um any appeal to the state I don't know how it go uh for a traffic light so that trucks could go make a left if they're coming down and going north um any consideration for a traffic light there so traffic lights are uh approved by the state and or any public agency based upon what's known as a need or warrant as well as the regulations by the jurisdiction emcy in this case our driveway uh would nowhere's near fall within the required warrants to uh need a traffic signal uh nor uh with the requirements that the state do has established in terms of traffic signals facing and allow Interruption would NJ do consider a traffic signal at a small commercial driver like this so in other words we couldn't put a traffic light there even if we wanted that's correct okay or could we permit left terms so you're saying that it would absolutely be no they wouldn't consider it no no we say I think I think the testimony was that we wouldn't be allowed to do it correct correct the the only thing we are permitted here was a right in right out drive okay because that certainly would help the circle problem um any consideration for a traffic light at the corner of Reading Road and voice Corner Road we haven't considered that now is that something that could be considered that might help the flow of traffic down to that intersection and honestly when you're at reading you're sitting there and you're trying to make a left on the boys Corner Road sometimes you're taking your life in your hands because you've got to go across two lanes of traffic in order to make that left and people are flying down that hill but I think it's out of scope for what the application is yeah but they're going to add traffic to that road maybe um can you restrict the weight of the trucks I'm asking for a friend he wanted me to ask this no no they they're they're restricted by the size length wheelbase and and and weights of the trucks are restricted by the state of New Jersey so with that okay and how about uh double axle can you restrict that again the of the truck is restricted by the okay um the other I I don't know I guess this isn't really a question for him but uh I've lived here since 88 born and raised in hunon County um I've seen many trucks blow through uh red lights at the intersection where Chipotle is I've been sitting there to go across 202 I even saw one truck have to in testifying we can't do that until later on then everyone gets to come up and okay I do that all right just a lot of concerns thank you thank you good evening Richard Caris N River Road Carris k a r um two big questions uh I'm sorry I missed the last meeting but my first question is you're Pro building a 350,000 ft Warehouse are there any other warehouses of that size in New Jersey or nearby that have one entrance and one exit that are on Lane roads sir this is the traffic testimony so you get to ask questions of the traffic engineer okay on traffic thank you okay yes sir good evening Russell Baldwin three banon Way Flemington Aron Township um I couldn't hear real well from the back of the room earlier but I thought in the beginning of your statements you said during morning rush hour from 7:30 to 8:30 there'd be 50 trucks coming through our there would be 50 Vehicles there' be about four trucks 50 there would be 50 entering Vehicles during that morning peak hour for which is projected to be trucks 50 additional vehicles or is that 50 including current traffic well that's that's 50 generated by this project specifically and only four would be tractor trailer that's correct what would the other vehicles be step Vans and so forth employees cars just employees I know you said you're doing this on spec um are you targeting any type of client to be preferred in here not not's he's not the uh well it's leading to traffic it's leading to his traffic statements before he's not your study did your study take into consideration an Amazon distribution center if they were to move in and the higher volume I expect they would generate so so the type of building uh is considered in the traffic study and Amazon distribution center which I mentioned earlier are generally two three times the size of this and have multiple of the amount of parking because they're heavy employees so this building would not be conducive or attractive they're also doing smaller facilities now for more local distribution there so this might fit their need for that there there are buildings in the Amazon Logistics chains that are normal warehouses there are their distribute there are their large Pick and Pack facilities and then they have specialty centers uh which are their last mile delivery but those are generally designed differently are generally in the 100 to 150,000 foot range and are designed to load uh what you see coming to your front door every day this the so we would not expect this to be a distribution we wouldn't expect this to be that for them Walmart or Target r i I think we'd be back to this board with the revisioning the design okay um did you do a traffic impact study for 24 hours a day I assume it's a 24 hour facility yeah so as Traffic Engineers as I testified earlier our key is to look at the peak hours because that's when the traffic is highest on the roadway and when the additive traffic would have a measurable impact in general other times of the day the the ambient traffic is lower and the results are uh less uh impactful but still impactful to some extent there's still traffic Genera so we just keep adding on and on until we get good luck that's the bottom line you didn't do 31 with any consideration so trucks making a left turn coming down Church Street up to 202 that take probably they' probably be the only vehicle to make a left turn during one green light especially if it get shorten to accommodate the other direction and if you get there's trucks that go through there now and I've been behind them has taken me a second light to to get through but the only vehicle to get through this will only compound that situation I presume sorry please ask a question about that that that was an implied question Sor that was an implied question okay sorry so would this just compound that situation as I indicated our analysis shows we would not perceptibly change that operation and as I also testified to and affirmed uh that doesn't mean that those delays aren't are are not experienced on those side streets they definitely show up in our analysis okay thank you thank you sir anyone else yes mono hi Susan Parry 15 cren Drive R in Township hear you Susan Parry p a r r y um I was wondering is there any kind of gate to go into the facility from at the driveway no uh there may be ultimately a security fence at the truck Port itself but that wouldn't but not at the entrance would correct so the flow of trucks will be smooth as opposed to what we have on Johanna Farms Road where they back up five six seven at a time and we can't get around the traffic to go home correct there's nothing to laying the vehicle from exiting 20 so there should be no backup of vehicles correct okay that was my biggest concern because we have such a major issue and nobody does anything about it and I did hear you say it was going to be a 10- foot shoulder correct so they're going to increase the shoulder so that trucks can flow a little bit better correct and you know they work really good for cars to well hopefully the cars aren't going around trucks that way okay thank you there's no one there is okay we're gonna have to take a break here in a minute excuse me John REI on Reading Road re e d y um on table three in the traffic study is that existing today 70 cars are going in per hour that's presently occurring at the site uh Table Three are you sure that's table three or I think it was thought it was Table Three the existing are you looking are you look were you looking at uh table two which provided oh Table Three yes I see that on page nine yeah so what we did is we provided a theoretical projection as to what uh the bronze powder manufacturing facility uh likely generated when it was fully operational versus what this facility would gener yes and and when was the last time it was fully operational that was years ago okay so that's not today that's not presently occurring no it's not presently occurring that's where the buildings have been removed okay so saying it's just interesting that using that projection that's not the current traffic that's happening there that's correct and then to the mayor um the valuable information from the comprehens comprehensive study can this be you know approval on this wait until that valuable information it's fully studied for the whole Township no because this planning board is looking at this particular application and within the guidelines and I'll defer to legal as well to give the legal language around it but essentially the traffic study that we're looking to do covers the entire Township but we can't predicate approval for this applicant based on an outcome of a CommunityWide study if I'm yeah I'm I'm gonna I'm gonna read again guy that actually writes this book is the Zoning Board of adjustment attorney here John drill in ring Township this kind of the B that we look at so uh I'm going to read something that I reiterated again and Mr drill notes at section 23-9 the 2024 Edition quote note however that a planning board has no authority to deny a site plan because if it's anticipated detrimental impact on off track traffic conditions planning for traffic patterns is an exercise of the zoning power vested in the governing body the planning board may go no further than to condition approval on one improvements to ontract entrances and exits so that's why we've heard testimony from both their engineer and the traffic engineer as to the design of the Ingress and egress to Route 202 and also the emergency access and the second thing we could consider is under section 42 of the municipal land use law contributions to off track improvements made necessary by the on track development that's the only other thing we we can consider um and the cases cited are pbrr Enterprises versus South Brunswick Tennis Club Associates versus the planning board and as I mentioned before Duncan Donuts of New Jersey versus the uh Township of North Brunswick again so this board's jurisdiction is extremely limited whether they throw more traffic on or whether it's detrimental it's a permitted use we don't take that into consideration say Ingress and egress to the site and we we look at levels of of service in this case level of service C so I just want to reiterate that because we have an extremely limited power of review in deciding this application on traffic considerations my my final question is maybe to possibly Mr tropman or the traffic expert is it typical to use years ago for these projections just just curious if that's typical you know practice so in this particular particular case we just provided that projection for informational purposes it has no bearing on the results or the analysis we prepared uh we just knew the site was developed we knew that it generated traffic so we provided it for information in the traffic study and goes no further than that and as you testified that was years ago correct okay thank you we're going to take a break for 10 minutes and so we'll pick this up at Road and we're Township question what's upell last b a r n i c k l i have a a question for the two Traffic Engineers you're both using the it land use code 150 uh and I'm seeing a significant disparity between the distribution that you gave us Mr TR versus the numbers that we're seeing in table one um we're seeing at least for the week day peak hour we're seeing seven trucks per hour and it looks like we're seeing 12 in your distribution and then significantly fewer passengers you're looking at about 67 total Rush and uh for past veh you're looking at about 26 wondering how do we reconcile I think I can answer that and Mr Tran can can jump on that the the database that's established on the percentage breakdown throughout the day is is a little bit separated from the more focused peak hour data in it so it provides more of a generalized uh distribution throughout the day as Mr tropman testified earlier we generally use that to sort of understand the pattern throughout the day but the peak hour data is more focused in the it data so we use that specifically for the analysis okay all right one more question in terms of distribution we we know that this is weekday we understand that there's any traffic on the weekends certain distribution to that uh generally there's you know there's no restriction for 7-Day uh operation it's not it's not typical it depends upon the particular user usually when there's weekend activity it's low shifts uh continuing to operate but it's not it's not generally focused as heavy as the weekday so the weekends usually is not a high but we don't have any projections in terms of foras no because because in general any any weekend activity will will generally be off peak to when the the roadways Peak on Saturdays and Sundays which are midday and if you have your normal ships it usually doesn't that thank you very much thank you sir okay I do not believe we have any more questions thank Mr Mr py I do not have any further Witnesses yes I will got Dennis I have a few questions uh just going back to my letter from April 9th and I suppose these will probably be best directed towards Mr Lane that would be in uh the corner of the building um we I I have no I don't mean to interrupt you and you certainly ask the questions we had stipulated that we will comply with all of the items set forth in your letter and and so we will do that if you want to go through them you you can but we will comply with all the items in your letter we've been through them and and they're all fine that that saves me a bunch of time um just the one question that I had then that's kind of outstanding on the plants two hydrants are called out specifically with labels two appear is um symbols I just wanted to confirm that those were rton Township like to commend the P board for doing a fine job the last uh two sessions and uh like to welcome our new neighbors uh R to Township uh We've identified some concerns over the last two meetings uh primarily safety quality of life issues and uh some liability issues in regards to uh possible traffic uh crash dats and fatalities uh the CEO I mentioned last uh meeting that uh he would possibly explore putting up a sign no right turns on the case Boulevard and that should be our primary concern case Boulevard I know we have an entire Township but right now we're focused on case Boulevard with jpk School uh at the peak hours uh between 2:30 and 4:00 cars are stacked up a long case Boulevard waiting to pick up their children uh which means they're in the roadway the shoulders not wide enough to accommodate them uh we need to get the crash data from case Boulevard and B's corner uh there's students and children that cross at that intersection going to Concord Ridge Sun Ridge and other developments in that area uh I know it's not mandated that a traffic guard uh a crossing guard be placed there because you have a traffic light but all it's going to take us one fatality if a truck should uh God forbid uh where any person gets injured at that intersection uh so there's intersections in question that we should be concerned about and hopefully we'll work with the dot uh if that's required to make them safer uh taking a look at the Circle once again I I I'll avoid the circle uh getting a little too old that's a little scary that Circle for me uh but uh yeah our concerns are like I said liability safety and uh moving forward uh declining property values if the trucks end up utilizing case Boulevard and I know mayor and I appreciate your concern uh you're going to do that study hopefully it will be uh coordinated with the warehouse development and by 2025 we will have uh things in place uh for an also an educ ation campaign uh with the drivers possibly provide them with the education and with traffic enforcement with the new study the traffic safety Bureau which I would strongly suggest we move towards that direction because we're growing we 25,000 people I think uh were scheduled have pretty soon so long cry from that gentleman when we moved in 30 years ago 35 years ago so I'm happy to see that you're planning for the future and the master plan is calling for that so thank you for the job that you're all doing and your service to the community thank you Mr yuzi thank you Mr demoski Franky again um I'm not a traffic engineer and I know the the sight's there and you're talking about the sight specific uh traffic at the within the general area but we're all members of the community and traffic impacts all of us especially safety that's my biggest concern orhe corny Road was cornfields the traffic engineer says 40 mil hour is safe on this road then there's homes built in schools and the traffic engineer says what is still safe then there's a bicycle pay and 40 is still safe to me just being a lay person not an engineer it doesn't make sense because the community is changing but nobody's evaluating the safety aspect and my biggest concern is the gentleman said that it's really up to the township if the truck drivers violate the law because once a truck leaves a property they have no accountability the township has the accountability the police have the accountability and on bhe corter road right now when you get to the Ender War e Corner Road and you hit Old York Road there's a problem there and I've seen tractor trailers come down Old York Road to avoid this traffic on 202 uh my neighbor Andor Dil said that has nothing to do with this project but there's tractor trailers navigating through through Dory fils it's a country road winding road but nobody re-evaluates the speed limit if the township re-evaluates the speed limit it becomes a hinder for the trucks to use those routes because right now no truck's going to leave Clemington and go to Somerville and drive all the ways back to hillsbor they're going to leave facilities they're going to go down warhe Corner Road down AMR Road they're coming from Pennsylvania they want to avoid the circle they're coming down old YK road but nobody's evaluating the engineers aren't re-evaluating the the traffic safety of these roads so do I have a problem with their project no do I think the building looks great yes but they're telling you we ain't responsible for the trucks after they leave our site you're responsible you're responsible for Public Safety and the police are but there's not going to be any policemen sitting there all day long waiting to see if a truck is on those roads so that's my concern as a a a Township C citizen that there there should be a concern on the Township's part as far as how to reevaluate the road safety to cut down on a traffic cuz if I'm a trucker and that speed limits 25 or 30 I might go it ain't it ain't conducive to me to go that way it's inconvenient so that's how I feel about it don't have a problem with the project but I just want to bring to your attention because I think you're so focused on the immediate site that somehow you know we don't always see the peripheral problems that are Genera so that's all I have to say thank you for your time and I appreciate it and the building looks great plus discussing traffic issues when you can't do anything well we I I I I read the case and said we we we can we we have to make sure there's safe Ingress Andress and levels of of service they also have to go to the state of New Jersey Department of Transportation to get permits from the the state and they need to do that so we are addressing traffic within the purs of our power as a planning impact study done on what this Warehouse is going to do well let me answer that because I think we had testimony at the last hearing that uh they have to make sure that the site's clean and they've hired a licensed site for mediation professional and what that person does and he's licensed by the state of New Jersey it just can't be any engineer you got to pass a lot of these complicated tests he's going to submit all this data down to D to make sure the contamination at the property is is is cleaned up so in that regard yes uh the site will be addressed from an environmental standpoint but nothing has to be addressed with the fact that it's going to create a lot of pollution well we haven't had testimony that it is going to create a lot of solution well the union concerned sciencetist say it does they say that the uh tractor trailer actually flute the air to the point where it it really affects young people and older people and I'm older I got to work but it they did do a study saying that warehouses actually are conducive to this problem so I just thought maybe it should be something to be concerned about that's all thank you thank you okay again let me go to folks who board the board's professionals and the public for your attention to this application and for your professionalism which is greatly appreciated uh the public should know this and I say this as a former planning board member myself in my own town that uh you're all volunteers who uh do the job out of love of community that you you serve and and we appreciate that um and thanks for your volunteerism and commitment uh without going through the detail that I did at the Inception of this hearing suffice it to say that there have been this has been a very long public process uh not just this hearing but the Redevelopment process it's been a very long and very public process in which there have been many actions that have been taken by the township governing body in this board to accomplish the community objective of transforming this obsolete manufacturing use site into a beneficial and productive use for the community something that will attract private investment to provide a quality commercial rable and other community benefits and working in the spirit of partnership between the redeveloper the applicant and the community we are confident that we're achieving those objectives we've submitted an as of right application uh we've worked cooperatively with with the board to accommodate issues of concern raised during this hearing and the applicants uh professionals will continue to work with the board's Professionals in that regard in terms of resolution compliance plan changes and the like and it's testified to by Mr stanta and is set forth in the Redevelopment agreement which is in exhibit A1 the applicant has agreed to provide the township with additional benefits which include things like no development on lot 5.1 uh the applicant is donating 55 Acres closest to the school to be used by the community as the township deems best uh as Mr stanta said there's an application to subdivide the parcel that will be filed shortly uh there is appropriate buffering around the adjoining School in the church uh the only access from VES road is emergency access all Ingress and egress of commercial vehicles to the site will be via Route 202 and the applicant is donating $150,000 to the township uh for the Redevelopment agreement uh for things that the township could use in in its its discretion whether it be cameras or other things so from our perspective this is a model for how the Redevelopment process uh and including this hearing process is supposed to work with the redeveloper and the community working together to bring about highquality projects such as this for Mutual benefit for the township uh and for uh the redevelopers and and applicants and Property Owners so we're asking the board to grant our application which is for preliminary and major site plan approval uh for the application before the board uh there are of course various conditions that have been agreed to by the applicant which will be set forth uh in thanks okay next up on the agenda this evening [Music] I'm sure okay next up on our agenda this evening uh we have the amend we were all provided a rather lengthy document that was the output of a major project with Jessica and members chairman Vice chairman a labor of love sure many members of the board of adjustment as well and Jessica's not here with us this evening but we have the document it was all presented to the township committee they've referred it back to us and yes and Alison kopsco is here tonight representing Jess cwell our planner so why don't you do a again just we've been through this a million times but it's sent over to us by the township committee and so looking to find that it's not inconsistent with with the master uh plan and and uh you've looked into that so yes we have uh let me know if I'm loud enough so um as has been mentioned uh this is the result of several months of work updating the Township's ordinances um really that just to sum up 100 Pages really quickly um the changes really are intended to just clarify and some definitions and really just modernize a lot of the language making it a lot easier to follow from the Township's perspective as well as well as the Public's perspective um some of the highlights uh standards for accessory dwelling units and outdoor dining uh updating some of the standards to be consistent with state regulations clarifying what's expect expected to be uh shown on site plans and conditions for home occupations and outdoor dining um and although pretty extensive the changes ultimately don't result in any major inconsistencies with the Township's master plan goals and objectives uh for land use specifically uh which broadly include limiting growth to the existing sewer school and roadway capacities uh recognizing historical land uses and growth within certain areas um and as I mentioned these changes are mostly just to modernize and clarify the Township's ordinances good thank you so it is not inconsistent with the master plan that's our findings yes and we need to report that approve that and report that is thator report the township committee finding that this planning board reviewed proposed ordinance number 24-12 and found it not to be inconsistent with the master so move second just there were no edits I feel like I missed the whole conversation there were no edits you guys had sokowski yes okay thank you next up we have the board of adjustment 202 three annual report that they provide to US every year so nothing we're actually uh required to do on that it's just a courtesy they do send it to the the township committee but it's just for your edification and reading pleasure and they are busy and we have some members of the planning board who Vice chairwoman appr you you certainly help out James Miller you certainly help out uh they're busy you're not they're busy yeah you're not kidding yeah that's for sure so good go ahead yeah one of notes is actually what can you say this into a microphone please apartment they received a lot of applications and one one of their suggestions was for for that to be somewhat permitted and that was accommodated in the new um revision to ordinance so you're saying we might see a reduction in what the board of adjustment needs to hear because of the changes perh yes yes one one of the many goals yes that would be Rel I was going to say do we we need to take any further action but it sounds like we have most definitely okay next up are the minutes from the March 27th 2024 Meeting those were provided by Taylor to all of Yan's work to get through Woodmont bronze and I know the on behalf of the township committee we've been you know working very aggressively to find the right balance for this specific Redevelopment um that you know addresses the needs to accommodate land owners but also um ensure the Integrity to the character of our Township so um we feel like we did our part and I can certainly speak on behalf of the planning board you all did your part and so I just wanted to thank everyone the professionals and the board here for for all the hard work to get us here and I thought the public was very good and very respectful you have a good citizenry here some other towns I've been in well we were prepared for it but I think you're right you're right yeah thank you it could have been a lot worse and thanks to you for speaking up at both of these meetings on what you're doing at the committee level on the safety addressing Mr dey's comments but and and more the whole community yeah on safety and there's
