fire department building department Conservation Commission Health Department professor's office engineering Division cpdc and members and Associate members of the board of appeals as well as the two-car garage that's on the lot is it's attached to the house through Breezeway um I would like to expand the size of the garage and add a second level um I've done a test dig on the foundation it is not reusable it's only goes down 20 in and it's block and it's cracked um so um I would like permission to build one on the same footprint and extend it back and if you notice on the plot plan as I get farther back because of the way the lot line goes I actually get farther away from the lot line so I'm think I'm only like in away versus towards the front and only 13 ft which is about you know just under I think it's just under 2 ft um it won't be exceeding the C lot line or anything like that and it's still going to be attached now through an enclosed briway okay great uh thank you um anything BR about this no um just like no new nonform I'm extending it backwards and upwards uh it's going to be two stories instead of one story but sounds good um anyone on the board have any thoughts or questions yeah go ahead okay I was just going to ask what you you said it's a two-story structure is there going to be is it going to be open above or is it going to be Second Story what is intended for the Second Story uh an office cuz both my wife and I work at home um and a new bedroom and a bathroom Okay um I have a question just you are not increasing the non-conformity but but you are extending in that it's going to be a longer not going to go past the current non-conformity it's going to stay within the same footprint right but more a longer wall is going to be non-conforming than currently exists so my question is since you can't use the existing Foundation anyway and you're going to be basically starting fresh why can't you just move it over a little bit into the Breezeway area or make it narrower so as to solve the non-conformity I mean of course I that can happen I might like to maintain the size of the the structure um we are in that space where you're going into the Breezeway now it's not just an hour Breezy we're kind of making a mudro which is going to extend into the garage space which if we bring that over it's going to right now there's there's stairs and the inside of the Breezeway there'll be stairs to enter the garage and then there'll also be a CL like a Coke closet and that's going to extend quite a bit into the footprint of the garage and if we lose almost 2 feet off of that of overall space which is more than 2 ft of interior space then that's going to be tight okay for parking a car yes any else questions for your Frank or no I'm good I was going to ask the same question okay um sounds good yeah guess ium remember of the public have any questions or comments or something help a comment I it sounds reasonable I'm we're coming for you guys next one trying to get a feel for how it all goes okay no it sounds like a very reasonable project oh I see okay yeah um cool that sounds good um yeah I don't see any issu this really I think it's a Val not to make it narrow parking there yeah addition all that and I mean I'll just note that you know in terms of the standard what whether it's not substantially more detrimental to the neighborhood than currently that neighborhood I observed has several houses around you that did similar sort of my neighbor across the street built a beautiful yeah Edition just like it they actually changed their driveway on the other side cuz they live in a corner it was difficult to do that right um and it it came out beautiful so in for that reason I I assume they're not non-conforming anyway in the first place but because there are similar additions in the neighborhood you know I conclude that it's not substantially more detrimental in fact it fits in even better than it does now so for the most part so so I don't really have an issue with it great uh motion for this I will unless somebody else wants to go ahead all right all right I move to Grant the petitioner uh David L Eric Lance a um special permit under what section under Section 7.2 of the bylaws and 7 sorry 7.3.2 7.0 and 73 to um expand the um garage or or um actually build a new garage structure on the existing footprint and then extending it further back in accordance with the um plans that he submitted as part of his application thank you the plot plan prepared by John D Sullivan thei um of wber mass dated December 17th 2024 um the special permit is subject to the following conditions number one the per petitioner shall submit to the building inspector a certified plot plan of the proposed construction and proposed Foundation plans prior to the issuance of a foundation permit for the work two the petitioner final construction plans for the new structure shall be submitted to the building inspector along with an asilt Foundation plan prior to the issuance of a building permit number three as built plan showing the completed construction shall be submitted to the building inspector immediately after the work is completed and prior to the issuance of the documents second second all in favor right all set all set yeah okay thank you have a good night thank you involved mentioned a lot of you too a lot of the laws upold uhhuh so when they're non-conforming they're kind of you we can continue to be non conform but someone who's conforming to become non-conform that's needing a variance yeah the non-conform but hot with hot Sho right exactly the rule the standards are just really different and in the the specific bylaw for for something that's already nonconform says that they can you know extend or change the non-conformance including you know this guy who's basically doubling it really as long as it's not substantially detrimental to the neighborhood let's say this gentleman had a one garage and two car garage that I probably would had a problem yeah when it's when it's ex when it's drastic I think i' have cuz I mean the one the one car garage if that already infringed upon the side setback then the two-car garage would have practically gone to looking at the dimensions if we if we told them to squ uh move it towards the house get rid of the breezeways and then add it inside you need minimum 9 ft like a parking lot but in a garage right the wall and other cars we yeah so I don't know if you know if you look at the zoning like when we said the sections of the zoning BOS if we look in there that'll have a lot of this stuff explain that's what I've been reading okay yeah yeah there's really I mean the zoning BOS there's a lot of them but there's like four or five we we go back to all the time you know so I think the simplest way that I look at like special permits I'm very just taking a while is like a special permit is something that not making worse versus like if variant you're actually making something worse like if a step back was going backwards and he made instead of it being like the 14.1 went to like 13 then that would be variance because worse yeah but it's there's a lot in there and it's crazy yeah well variances I mean s always used to say you know we you know he used to there's very very specific criteria in bylaw remember you know he always used to just go through each the criteria which I suppose one of us will have to start doing but they're they're supposed to be really really hard to get um and very rarely given by Design cuz otherwise you just throw out you know if you keep relaxing fting is very strict on and some other town like they don't care and they just they kind of hit out like I haven't met a town yet no of the board but in medf I needed Avance for 2T of a corner of my building that we built MH I mean they did say why can't you just cut the building in the corner right
