United States of America and to the rep for it stands one nation indivisible liy and justice for all thank you Madame Clark I believe we have one item on the agenda for this evening let's do call First okay uh roll call of the members of the committee Council greo SAA here here councelor H here here councelor Haro here here councel McKenna here here and chairwoman Kelly here here Quorum is present one we have one item on the agenda tonight Madam clerk that is a motion presented by councilors Haro and Areno that the city council ordered to a public hearing the following ordinance for the purpose of increasing safety by expanding recreational opportunities for young people an ordinance further amending chapter 2.57 Parks and Recreation Department of the revised ordinances of the city R thank you councilor Madam chair thank you so much for your time and thank you for getting this onto the agenda um so councelor jenzo and I uh and actually some of our the colleagues here on the DI uh have been working and talking with um with folks in the community and as well as Administration officials around our deficient uh well about supporting the mission of um of the parks and recck department and how we can en hand that um so that there's a good um so that we can continue to improve on already and an already great program that we run um the services that the residents are receiving and when and how they're receiving it and um you know I'll preface that by saying that um you know we're all very proud of all the work that gets done by our city officials uh and administration officials um and so this motion it's been a while dust off your notes from a few months ago but this motion uh attempts to do a few things and I can do a brief overview of it and then I'm going to propose based on some conversations that I've had with colleagues and administration officials um some amendments here um so the ordinance um would set aside set aside a bunch of definitions related to Parks and Rec to free play or organic play as we refer to it here um and then it gives the director additional duty uh additional powers and duties or defines some of the powers he already has and duties he already has um and then gives them additional power to do a few other things um it touches Upon A commission that's already an ordinance here in the city of river um that is a parks and right commission um and it allows for lights to continue to be on so that kids can play and their families can can can um can use the public space that we have I had some conversations with uh director HOSA from The Parks of ir who again I'm very grateful for uh taking my call and and talking to me about this earlier uh and he we spoke about some of the things like keeping the lights on and using some techn additional technology and he can correct me if I wrong I know he's here um using some additional technology to allow residents to interface with the Department in a way that's more efficient uh and then after those conversations um so so with those conversations in mind some conversations I've had with Co some colleagues uh I'd like to propose two amendments the first amendment is that we I would like to b b bifurcate uh in section four of the proposed ordinance uh and I'd like to put that into a separate motion that can continue to live in this committee um which is the section that revamps are already established um parks and commission which I believe uh exists already uh I think we want to get it have a few more conversations about that um or have here at this Das have more conversations about that potentially at the council as a whole um so that's one piece that I'd like so that's the first motion to amend Madam chair um and then that's it that's actually I was wrong it's just the one so yeah so um I thought we had done this in the past but in section five uh it's supposed to read 90 days um from enactment yeah as opposed to September 24th um or hold on so so supposed to June is supposed to say 60 days and then 90 days but if not maybe that could be a second amendment um actually um let me correct that I think it's uh 90 and 120 days thank you madam chair any other counsil ising wishing to speak councilor C Leandro thank you madam chairwoman um I just had a couple of questions about the commission I I haven't had a chance to look over the ordinance so forgive me if these are listed in there but the the commission is it uh is is it advisory will it have decision-making Powers will there be a stien and do we know the number of members that are listed in the ordinance through you madam chair to council yarmo or Council Areno yeah so um I I know that um we changed the composition of the Commission in this section um we don't if there if it it doesn't change the STP in whatever is already set in the ordinance we don't touch any of that um it just changes the composition I think it goes to uh it it goes to a different structure uh I think I'd have to look at the revised ordinance I should pull it up on my phone but um it's cited in there I believe I can take a look while councelor Areno speaks councilor Areno thank you very much uh Madame chairwoman thank you uh members of the subcommittee uh just to answer your question uh president candre there is no stien um it's a completely voluntary uh commission and I'm the co-sponsor with Council Haro on this um motion I think the most important thing that you could do this evening is form or reform the par commission it's a completely Advisory Board it takes No Authority away from the director or anyone there uh it works basically the same as the Elder Affairs uh commission um a group of residents and can come forward uh they can give their uh views on what programs they would like to see um and I think it'll just make the whole process healthier um I know last meeting we kind of got on the subject of how light the light should stay on and and the meeting kind of degenerated I think those are great um things to to bring up in front of the commission uh the city council doesn't have to decide on lights and and things of that nature a city counselor uh could certainly appear before the commission with some concerns they have in the neighborhood um like again strictly advisory make the whole process and the and the whole department healthier um and and I think um it would go a long way I sent out an email to everyone on the board I was discussing this back in 2019 when I was the superintendent of Public Works I brought it up then at the time I was a member uh along with El Baker but there were only two of us so we we could never have a viable meeting um and I like I say I think this would would make the the department and Community input just uh just make the whole process healthier thank you Council McKenna thank you Mrs chairman um could I through you to Paula jenio um are there problems uh to make it healthier and to put it um in front of a board to make a decision it's not healthy well the board wouldn't be making a suggest it would be making a suggestion not a decision it's the same thing as the uh the uh senior citizen Department there's there's a board of Elders there that bring suggestions to the director uh Miss Peta and um you know that there's no decision making it's it's purely uh purely advisory it's it's no in no way overruling anybody in the city um it wouldn't hurt the director pre uh no director hofo I would believe would just be making suggestions I it's like I say it's in no way uh authoritative they they can't render a decision they can make a suggestion okay thank you Council Gina sooya thank thank you I can't vote for this and my reason being is to me I think it undermines what Michael Hanah HOSA does and he does a lot for the city and he does a lot for the pox and rexs so I cannot vote for this thank you any other members of the public wishing to speak any other counsil is wishing to speak to speak from the chair gr I just have one question um I understand there are two amendments so we'll be voting on this um ordinance as amended however the section five which I did um speak to attorney capes about because of those um characteristics that are listed there we are deleting that or omitting that section as of now from the ordinance is that also an amendment I'm sorry section 4 section four right yeah so uh if I understand correctly are you asking me of section four is that in is that going to be included in the amended ordinance right now no no we're bifa so we'd just be creating you're you're going to Omit that correct yeah the what I'd like to will and if I can ask through to the clerk um what I like the will of the of this committee would be to create essentially a separate motion here and put that aside got it area like still keep it as a motion but a standalone motion so we're almost we almost have three amendments then right because that'll be one and then you have uh an amendment in section five five Y and then was there something else you were change that was it no I mentioned two but it was actually only once yes perfect okay thank you I don't know how that would work procedurally but I hand it off to them just yeah just exactly how you coun it so keep yeah you're going to keep section four in committee and report everything else out except section five as amended with days could we take a roll call Madam clerk yeah you could do the so the amendments are as follows section four is hereby removed from the ordinance and kept as a separate motion okay and section five is going to read as follows the director must present the regulation set forth under this chapter by no later than 90 days from the date of enactment of said ordinance and regulations must be approved by the commission amendments to previously approved regulations under this chapter may only be offered by the director the commission must approve the regulations set forth by the director no later than 12 days from submitt the regulations will go into effect four months after approval by the commission all those amendments yes uh can we take a roll call vote roll call on those amendments councel Gino SAA no no councel h no no councel Haro yes yes counc Kelly no no and councilor McKenna no no the motion to amend fails this concludes different I know what discuss anything it could still remain committee unamended it could the committee different things but right now amendments just failed that's all yeah all of them together this ordinance as presented is still on the floor in Comm so it's up to the committee to decide what to do with it from this point oh just motion for favorable report this hasn't gone to a public hearing yet oh so Mo for a public hearing Council has asked to motion to recommend that the city council that the report of can we take a roll call vote on that shall the Parks and Recreation subcommittee offer to recommend to the full city council to order the proposed ordinance to a public hearing councel greo SAA no no councelor h no no councel Haro yes yes councel Kelly I mean sorry um chair Council McKenna no no and chairwoman McKenna chair moan Kelly CH I'm sorry no chair chairwoman Kelly voting no uh that motion failed by Council Harry okay so that will remain in committee and we
