Wilson president Bernardo here Brian ack here uh Nicholas Rudolph are in attendance uh Tom and Joseph are not but we do have a quarum tonight um first up uh review and approval of the meeting minutes for October 2nd 2024 uh there any changes additions modifications I'll make a motion to approve the minutes I second all in favor I I I I I excellent uh first up on the docket here today is a notice of intent D file 061 0827 uh this is for 6:30 River Beach Boulevard uh the addition thank you uh Mr chairman members of the commission for the record brick Salvo with engineering Alliance I hear this evening on behalf of Marshall lucenta who was the owner of the applicant um I've got some supplemental package that I'd like to pass out um this isn't really new information this is all information that we've already discussed I happened to notice when I looked on the um D website tonight that they had made comments and I didn't see them when they had previously posted the file number so the the only change there's no changes to the plan they asked for a profile to be drawn that showed the relationship between the garage the flood openings um and the office and how the office is supported so you'll see that in the um thank you Rick I appreciate you addressing the comments excellent thank you I appreciate that if you wouldn't mind uh taking it through yeah so like I said um if you look over on the side on this side of the plan over here um there's a little profile that we had drawn that showed that the flood openings are they're actually within 6 inches of grade they're supposed to be within one foot of grade um the size of the flood openings um there'll be smart vent um engineered openings um it also shows the office over here um which is elevated on piles it's going to match the first floor elevation of the house okay the first floor elevation of the house is about elevation 15 the flood plane is elevation 11 it's way above the flood plane um any flood waters that were to hit these openings comes from the marsh that's why we place the openings on that side of the building yep on the north side of the so so if this Marsh were a flood in a 100-year coastal event it would have a tendency to push towards the garage flood the garage which is intended to do and then recede back towards the marsh so any deflection reflection of flood waters would be directed really back towards the marsh not impacting adjacent dwellings that are to either side um and Uphill of this the improvements that constru get constructed on this side of the dwelling which are the handicap ramp um and the mud room those are at elevation 12.4 to 12.56 so those are outside of the flood plane anyway so there's no impact of the flood plane um to those structures so we didn't add any new information we didn't change anything alls we did was provided what the D had looked for which was a profile showing the relationship to the flood openings um to the flood plane the only other piece of information um that got added in here is um they plan to resurface the driveway to the same line and grade as it is now and the same footprint it is now no change I don't even know if that needs approval but I just wanted to get it on record that they do plan to resurface the driveway in the exact same footprint that it's in now in elevation yeah there's there wouldn't be any significant changes to the existing structure or the existing driveway so we I would say that that would be a negligible um impact for this project I I think it would be a great addition to get a nice new driveway to pull down into um do any of the other Commissioners have any um questions about this about the D comments or the new addition of the profile picture that Rick has added to these drawings nope okay uh one request that I would make Rick is that the fence along in between that has been taken down be the first thing that's erected during the project um just to mitigate neighbor tensions so to speak um that would be my recommendation uh from councelor um Gino soya she she wanted me to mention that yeah I I don't think that's an issue I mean obviously where it goes up to where the New Foundation is they're going to probably want to put the New Foundation in before they erect the fence but well yeah on that but yeah if you want to add that in as a special condition um you know the privacy fence is clearly shown on the plan we have no objections to taking that as a as a condition I mean obviously you have to get the footing established for it first but I would appreciate that Rick thank you very much um uh one second okay um any questions from the audience about this before we close the hearing okay uh close the hearing for this um and I would like to put this to a vote to and um any additions just send them send them along sir thank you you as well uh next up is the notice of intent D file 061 0828 uh this is for 20 Henry Street renovating a backyard and driveway by installing permeable pavers is there someone here from that if you could come up it's all right yeah if you could turn on the mic and um just say your name and address my name is reginaldo Costa uh TWY Henry Street put all together thank you so we had an opportunity to walk this down and it was a fairly straightforward project with the addition of patio pavers um which will all be permeable surface allowing for water to infiltrate with uh the addition of some French drains and um some drainage an addition of the French Rin near the downspout of the home um yes now yes I I received that um thank you for providing the updated drawing of that does anybody else need to see a copy of that do you have other copies actually I didn't so that's okay L do you have the yeah I'm try to share it on my screen TV sharing it on The Zo thank you thank you very much yeah that is just the the stones that's going to laid on the P it's just to have an idea and while we're at it we'll uh open the hearing a little bit belated apologies thank you for bearing with us we're just getting a drawing up so we can make sure everybody has a good understanding of the project ahead were you guys able to secure all your building materials for this project good it's always been a area of concern for most folks all right there we are so my I guess one of my questions is are you going to still maintain the ejection pump that is at the I don't know if we made that clear if you were going to remove that or in lie of just a drain at the you know catch Basin at the bottom of your down spout or you going to keep the ejection pump from the backyard no that's not the intention intention is the make the the the French drainers see if they be able to get because the the the pave itself so it's going to absorb the the water going to the ground so um the water is not going to run as used to be on the ASA right now so that's the plan so okay the back of it was just something to help to kill the water out of the property no that's I appreciate that um moving water off your property is always a cause for concern but um adding the drains I think will mitigate the water very nicely for your property and especially adding the two that you did on the left side of your property and the one in the back there it will definitely help considerably um any questions from the commission about this okay any questions from the audience about this project CH I just have a question yes so at the corner if we go back with the picture so you will have a the French train that will capture pretty much the gutter coming that's where the gutter is the location at that corner where you have 5 S next to the deck that's that's where the M the gutter is and the the intention is for the water to go into the French R hold pretty much okay the reason I ask I'm trying to avoid any water like going into Ena and then after the construction and if they start complaining about water going into the property and the only thing that has changed is this I just want to make sure no water goes into into a neighbor yeah so now they water is coming to my we we have the opposite problem in this situation they got to string the water to my problem oh okay because they got doesn't have the make the water go to another way I got you they got to string the water to my property oh okay so if you remember the grade on the existing properties abing yours were considerably higher around 12 in or so on the left side and probably about 18 to 15 in on the right side uh from what I observed but yeah he has quite the opposite problem I just want to make sure after this is done is no higher than theirs and then they complain and they yeah okay that's fine as you know you suggest so that Chang the plan as was before so I appreciate that um and thank you for making that accommodation um any more questions good um so I'd like to open it up to the audience if they have any questions about this no okay hearing none I'm going to close the hearing and um seeing how this is going to make an um impact for your property by being able to retain water this will help your neighbors as well and hopefully you'll be able notice of intent D file 061 0830 uh this is R Mass owner LLC uh 5 49 and 51 Lee Burbank Highway uh proposed construction of a technology warehouse and site improvements good evening gentlemen good evening wouldn't mind uh stating your name for the record hi my name is Chris roller um I am with the applicant of the project and so this is for which address this is 49 and 51 Le Burbank both yeah this the they l it up into one D file number great great well thank you for your time this evening commission um as I said my name is Chris on behalf of the applicant and we're here today to present um our notice of intent filing um our technical experts and Consultants Nick and Scott will have a nice presentation prepared today um but I just wanted to appreciate you know thank you for your time and um for the site visit last weekend thank you yeah and thank you for um accommodating the hoopla on Molen Highway that was that was very interesting I'm sure the Irving guys are going to be talking about that for a little while no harm no foul all good absolutely thank you I just want to reiterate the fact that we appreciate you coming out and risking your lives on the highway to to come out on Saturday so I think it was well worthwhile so absolutely SC so we filed a notice intent for this project it's a 26 and2 Acre Site it's an existing Bol petroleum storage tanks pipes infrastructure and access driveways so the site's fully Disturbed with either paved compacted gravel surfaces and there's really no buffer areas or Landscaping as you saw out there there pretty much Stone and Grading right to the the edge of the well so this is an aial aerial view of the existing conditions as you're all well aware there's you know tanks out there access Drive pave driveways um Wetland resource areas are kind of in the northeast corner of the site the proposed project consists of a 267,000 ft technology Warehouse building we'll install perimeter erosion controls and Inlet protection throughout construction and maintain until areas are fully stabilized there loading docks parking access driveways utility improvements and a new storm water management system which we can discuss in in a few minutes um with a discharge across the street to exist in Chelsea Creek there significant landscape improvements consisting of 3 and a half acres of added landscaped area and some Wetland buffer areas and site Frontage areas that will be landscaped so as you see the area in yellow there's a pond and area of bordering vegetative Wetland kind of that purple line is the 100 foot buffer zone and the blue is the area which is land subject to Coastal storm Flowage so as you see the proposed building is outside of of and mostly outside of the buffer zone we do have some impacts associated with portions of the parking lot um access routes and Paving within the the 100 foot buffer zone and some grading work within Lup to flooding so this is kind of a detailed sheet of the proposed project um mostly related to storm water so the storm water on the site will be collected routed through deep some catch basins water quality unit into underground infiltration underground um systems that will be pumped across as we indicated at Saturday's site visit that will be pumped across the street and discharged within the same connected to the same discharge Point into the Chelsea Creek so there'll be some significant storm water improvements from this project as well as significant uh landscape improvements associated with this project um this is a kind of the landscape rendering as you can see the area is in green we've got some plantings along the the pond in the rear and some restoration occurring in that area so there'll be some significant improvements to the buffer zone and there's some significant improvements to the the frontage even though it's you know portions of it with are within lands the coastal storm Flowage but there's some significant landscaped features in the front so about three and a 3 and a half acres of land Cape improvements over the existing conditions so that's a pretty good summary of the the proposed project we'd be happy to answer any specific questions if the commission has any when do you believe that this will be completed so we are aiming to start demolition of the existing tanks and and pipelines and infrastructure in the next month or so um we're aiming to complete the building by q127 2 okay so you got some you got some time there all right it's a tricky site to yeah yeah um have you come across [Music] any problems uh concerning that is the D have mentioned any kind of Wells or uh contamination on the site or anything like that no um you know the site you would think would be fairly contaminated um but we've been able to triage the existing problems and and resolve most of those particularly on that phase one site so you know phase one to the north for all intents and purposes we've resolved yeah that was most of the open environmental issues and you know the remaining rtn should be closed call it with the next 6 months or so I I just remember that the other Global site had had quite a few problems over there yeah and I just want to make sure that I I didn't I know I didn't ask it during the site visit but that was something that was a concern of mine after I left I just kind of yeah listen achieving regulatory closure for open environmental issues is really important to us um so we're doing you know temporary solutions and permanent solutions to close those open rtns and then on top of that we're essentially capping the site by raising it above the 20 70 100-year flood plane so you know the site will be leveled capped with clean fill and then you know landscaped in such a way that you know that source of environmental pollution um or perceived environmental pollution will no longer exist okay um any other questions you mentioned about the the water treatment that you're trying to install is that how is that going to be maintained like uh someone be doing like routine maintenance on on that system or how how he operates so we can understand it bit more yeah Nick scolly from VHB um so there's there's access ports in those and there's an onm plan associated with this so there's regular cleaning of the deep sump hooded catch basins and the water quality units so ideally that catches all the sediment and every and pollutants before it gets into that subsurface system um but then that's that has access ports and whatnot to and has a uh routine inspection and cleaning if it gets to a certain point how often you planning to do that maintenance or or is something it's every 3 years I believe for sediments depending on how much you collect and I believe it's uh yearly for oil um debris or oily debris that would be caught in that um vortexing type tank correct yeah and I think the sections are done by annually so this is something already being being done pretty much yeah these are best man management practices for um any kind of colle catch Basin for storm Water Management Systems okay operations okay which I'm sure you don't want to have to replace a storm water management system like that that it's probably a pretty extensive price tag or replacement cost associated with that so um I don't have any other questions about the storm water management system the the only thing I would just make sure it's stay on top of it the the especially with that Highway area that you a lot of opportunity to catch oily debris and sediment and run off from the road um especially you know once you get it first set up so just be mindful of that yeah and with um with our Meep approvals we obviously have uh a MK out permit for the driveway connection so we are going through um we're Millan overlaying this Frontage there is a a little widening of of 1A to get an acceleration deceleration Lane in here mhm and with that they've asked us to do some storm water management improvements uh on 1A new catch Bas and sumps um so did you have a pumping system to get it on through the other side or did you did they not ask about that um it'll be all gravity fed to the other side so their their system stays contained m so we're we're fixing their system uh sort of cleaning it upgrading it uh ours is going to be pumped so we have been through that that's part of that uh access permit that we have with them um probably but it but it will be pumped it's it's mimicking the existing condition today okay any other questions are you Excavating or any dirt Mo movement I I assume right my point is just if we make sure that um erosion control that that we we don't want to um contaminate the the water since is very close to the water so it can impact the Wild Life and so that's to answer your question so we we there's a plan sheet on here for storm water management so there'll be perimeter erosion controls and then uh Inlet protection as well and you know construction access you know Tire scrubbers so that will be installed maintained throughout the construction until the area is completely stabilized and where's over maker we're going to have the Construction general law okay sounds good to me um any other questions from the audience all right we will open and close at the same time make a one swift movement there um thank you hearing no more questions uh I'd like to and considering all of the stringent practices that you will be adhering to while you are constructing and deconstructing and constructing um I see no reason why we shouldn't approve this and I would call for a motion to approve um this notice of intent cheer I would absolutely agree with you with the amount of attention that they're going to have with oil tanks and everything that uh they'll be a lot of eyes on everything you literally do so I don't see any reason why we shouldn't so I'll make a motion to approve the noi excellent second well just stay right there uh notice of intent deep file number 061 0829 uh from the same owner and this is on the opposite side of the highway uh and this is a proposed demolition of the existing buildings and Associated site work open the here good evening again just with a record Scott Morrison from VHB Wetland scientist so again um we filed a notice of intent for across the street 96 and 186a uh lee burn Bank Highway that particular project consists of demolition of the existing buildings removal of the infrastructure over there essentially get the area pad ready for future development um as part of that the existing site's about 10 acres it's an existing petroleum distribution Terminal Warehouse build building piping related infrastructure and access driveways so the entire 10 acres is fully Disturbed paved or compacted gravel surfaces so this is an overall existing you know aerial view as you can see the Chelsea rivers to the north there's a small area of salt marsh area bordering vegetated Wetland some Coastal Bank um and obviously land subject to Coastal storm Flowage across throughout the entire site so again the proposals to to remove the existing buildings all the above ground infrastructure piping all that material remove that be temporary stabilized with crushed stone you know back fill any of the foundation areas stabilize that erosion controls will be installed prior to construction so there'll be perimeter erosion controls Inlet prot protection the existing storm water will be maintained throughout this construction and the storm water you you know erosion controls uh will be maintained until such time the areas proposed for redevelopment we expect that to likely come back with a new notice of intent within a month or two for the development but this kind of gives them the ability to get started on the demolition work which is time consuming so that's the proposal for this particular side of the site I'd be happy to answer questions and again thank you to the commission for coming out on Saturday so I know that you'll have erosion controls in place until the site is scheduled for something um what can you get a little more specific what you're going to use for erosion controls considering that we have areas of critical environmental concern adjacent um the possibility of water surging in and and all sorts of other fun stuff that can happen there inclement weather washing it into the um adjacent areas so I'd just be curious to if you could go a little more in depth yeah so we've got the perimeter erosion controls consisting of silt fence and straw Waddles silt socks silt socks okay um so that will be around the perimeter of the property mhm Inlet protection so you'll have silt sacks within the catch basins so that any water that goes through there will be filtered as it goes through those catch basins and then routed through the existing storm water system out to the Chelsea River uh what about for the surface where you take down buildings I know there's a considerable amount of asphalt concrete all through the site and the areas that and you also have the um the storage F uh was is it Ocean Air on the other side of you guys are you leaving the foundation of the Ocean Air building or you taking that out that all comes out and they'll put my understand they'll they'll install like a you know back fill it with Crush Stone compact it so that you've got a compact level surface of those areas will allow some filtration okay probably not 100% infiltration but you'll have so so basically the plan for any exposed uh foundations where you pull out you'll be putting in 3/4 cresant stone or something similar to that say something similar yeah that yeah something very similar to that so all ABC material will be hauled off site and then you know we'll bring in you know clean or virgin material to back fill those foundations okay you know the exact you know size of that material is TBD um but 3/4 in 1 in something in that you know ballpark yeah I just don't want a a dirt pile exactly that can just be blowing all over the place I can only imagine the complaints that we would get from the morning traffic alone uh with with the cars that zip through that area so I just want to make sure that the area is going to be definitively stabilized until such time as it is developed yeah absolutely excellent bacon site is never good for anybody so you know we're trying to avoid that no it's at least you're taking the structures down so you know vagrants or other opportunistic squatters aren't coming in yeah taking advantage of that so um absolutely absolutely is right so any other questions no I just want to ech what what the chair said about the erosion control just making sure when it rains that no none of that dirt is going into the into the water it's going to impact the um sea life so that that's very for me is very critical that so we can protect that at the same time when when it's sunning like this these days that it hasn't rained for a long time the dust is is gets wind and it's going into the water that that can impact also so we can implement the yeah the proper it's a good point thanks for bringing that up and I I would just add that you know during demolition we'll have um misting you know dust bosses on site to you know control that and um you know our our discharge of storm water for this piece of property has suspended solid regulations that we need to meet and all sorts of you know other regulatory contaminant measures so you know we're going to follow those protocols to a t um yeah I appreciate that they're right right than guys thank you um and then I'm I'm sure until development occurs you'll have a routine inspection for the silt socks and fences and all of that as well um and i' be I'd love for you to provide that as well just your frequency things of that nature I think we are providing the commission with monthly reports okay for phase one so you know we're happy to continue that for both phases in fact I would appreciate that thank you inspections that sort of thing yep absolutely um you you've definitely bitten off a lot with the these three sites and it's it's nice to see it developed or Start begin to get developed as well and um I definitely think that is going to be an improvement for that area especially um yeah not not so much not so much um anyways so very welcome any more questions from the commission yeah if I may add um if a phase doesn't move forward we probably going to request a more permanent stabilization of of the site so it's not just a dust bowl just something to think about yeah fair enough that would definitely be something we would certainly consider if they hit a snag so to speak uh but we'll definitely be in touch we'll probably make some site visits just to make sure things are all square um any more questions uh any questions from the audience about this project okay close the hearing thank you very much genten thank you we appreciate it appreciate it okay um seeing how this is just a demolition and a precursor to development and that they are going to be taking are exercising all best management practices for this site until such time I would say that this would be something that the commission would approve and I would call for a motion to approve this notice of intent I'll make a motion to approve the noi second second all in favor hiuse um thank you very much for your time thank you very welcome Chris um next up a notice of intent D file number 0610 8 31 uh this is for 12 per lav and this is a proposed permeable retaining wall around the yard uh to protect the home basement and surrounding areas and this is also going to to include a few other additions Cobblestone walkway to the ground on the right side of the home uh Garden area will be repaired and I believe we discussed removal of all of the uh permeable surfaces in the backyard as well uh is there representative from this project here today no this is uh 12 per lav no okay um anyways uh the majority of the commission was available for this site visit um this was in response to a order an enforcement order where they were beginning construction of a non-permeable wall around their property and trying to put concrete on where they are proposing to put pavers instead and since then they have partnered with an engineering company um to provide them with a plan a more definitive plan to comply with the Wetland protection act uh they are adjacent to a marsh area an area of critical environmental concern uh they are also in the flood plane and it is definitely a considerable upgrade for what they initially had done to the property and this is a pretty considerable project so I'd like to open the hearing um and allow for any of the Commissioners if you have any questions about the site nope um since we don't have a representative here um I'm going to have I'm going to go ahead and continue it so that they can come and make a formal presentation to us so that we have on record what they are exactly going to do but uh as far as I'm concerned this is definitely an improvement um not a detriment to the environment at this point um so we'll continue this till next time uh is that it um and then folks from 55 Sagamore Street are here um I sent out a letter this last week about a visitation I had to the property owners who had done unpermitted work at their property they had installed permeable pavers as shown on the screen here um yeah yes and then they've also added Cris Stone on the rear end of the property behind the shed behind the shed and then the property next door is completely cstone but the what they're looking for is um well my recommendation to the commission is that they have the contractor produce um drawings of what was done how deep um they excavated to put on the pavers and actually see whether they are permeable I I can't tell I don't know how close the the joints have to be for it to be permeable I definitely oh go ahead sorry you sorry and I guess like that's just the first step and then if they're not permeable we can um propose some Alternatives like cutting part of the the papers and uh I I definitely think that we need to schedule a site visit to take a look so that the Commissioners can get a better understanding of what has been done already um I definitely don't want to go the enforcement route I think that that is unnecessary you have certainly put in something that is going to enhance um instead of becoming a detriment um if as far as the Wetland protection act is concerned so I think that we will have to certainly have a site visit and then this will probably be a notice of intent after the fact to avoid any penalties or um and just to also have a record of the work that you've done on the property as well um so I think that that would just make sense to have a site visit so we could see it and then we can get you filed with a notice of intent and we can make this official um if the commission agrees I'd like to make sure we schedule a site visit for this okay okay so we did we did have some in enforcement today actually um it was an interesting uh enforcements this was for uh notice of intent that we approved for 29 putam uh they were outside of the scope of their uh notice of intent and they were Excavating instead of just resurfacing and it got a little ugly but uh needless to say I think that we are all uh going to have to go out there again and address this issue and make sure that our order of conditions is upheld if not we might have to go another route with this but uh that is the enfor only enforcement I have at this m at this time we did have some site visits uh this weekend this past weekend um 20 Henry Street 12 prolab the both Lee Burbank Highway sites um which proved to be very fruitful it was a Brisk day but it was it was definitely worth it um at this time I'd like to open it up to any open discussion for the Commissioners or our agent okay uh I'd like to thank you all for your time and thank you for attending we'll be in touch about
