state your name and address for the record please good evening chairman and members of the board uh my name is Nancy O'Neal and I am an attorney located at 14 Proctor Avenue I'm here tonight on behalf of the applicant uh bonfilio family LLC and I am joined here tonight by Mr Paul bonfilio as well as Attorney Jerry D Ambrosio of G of D Ambrosio [Music] LLP so the bonfilio family owns a series of three Parcels along River Street specifically 100 112 and 116 River Street uh which form a large approximately half acre property uh which you can see here uh so the project composes uh of 16 River Street uh which is the yellow house on the corner uh the parking lot and also uh the beige house on the other side of that parking lot uh so approximately a year and a half ago uh the bonfilio family began work on this proposal for a residential building uh which has been changed on numerous occasions upon feedback uh and requests of the city uh so originally this proposal was for a larger uh denser apartment building uh with a majority of two bedroom units uh comp setbacks and a parking lot used exclusively uh for building residents it is important to note that this original proposal uh was for a byright project what this means is that uh the original proposal uh for a denser building I did not need zoning relief uh and upon initial uh meetings with the city planner uh the proposal was changed to accommodate uh the city's requests so first the building was moved towards the street line necessitating a front yard setback variance and second the existing uh parking lot for the nearby funeral home uh which you can see uh in the middle there was reincorporated into the plans and relocated underneath the building a necessitating a parking variance for the proposed Apartments uh and a variance as to screening width uh for a non-conformity of 6 in due to the placement of parking spaces and screening aisles and out of discussions with uh the ward counselor uh the bedroom count was also reduced uh to lower the density of the building and eliminate most of the two bedroom units so what is the proposal before the zba tonight so the proposal tonight is for a five-story 32 unit apartment building containing 28 1bedroom units and four two-bedroom units with 54 parking spaces at the ground level this parking includes 22 spaces for the adjacent funeral home as well as 32 spaces that's one: one space to unit parking for the apartments uh the building also includes uh ample setbacks with landscape screening and fencing along residential property lines so we are 18 ft uh from our neighbor to the side and about 37 ft from our neighbors to the rear both of which are compliance setbacks uh so this building has been designed and redesigned a number of times to minim neighborhood impacts and maximize parking so a community meeting was held earlier this month uh with the ward counselor and our neighbors to discuss the proposal so generally the project was uh well received though there were concerns about parking uh Building height and the apartment use uh first in terms of parking 54 spaces are planned uh the 32 Apartments would receive 32 spaces so each unit uh would have a parking space which is ample parking uh for the building as the building is located nearby several MBTA bus stops including a special frequent service route to Wonderland Station what that means is that a bus to Wonderland Station is arriving in front of the building every 15 minutes on Metropolitan Area Planning Commission studies for the city of Riv estimate that uh apartments close to public transportation in the city utilize parking at a 0.6 to1 space to unit ratio simply put not every unit nearby public transportation is using a parking space in the city so here we are providing parking at a 1:1 space to unit ratio so we are actually above uh mapc recommendations for parking by providing a space for every unit so in addition to the one: one parking for the apartments 22 spaces at the property uh which if you're looking at uh this rendering here it would be uh the parking lot uh to the right uh so in that uh parking lot 22 spaces are planned for the adjacent funeral home so currently uh the lot on the property that contains 21 spaces for the funeral home so those spaces are being retained and moved closer uh to that funeral home and instead of 21 spaces there will now be 22 spaces they're actually gaining uh a parking space as part of this proposal so we do not anticipate uh any parking impacts arising out of this building and it is important to remember here that the property is zoned as is a general business district the proposed Building height and stories are by right you are allowed by the Rivera ordinances in the general business district five stories and 50 ft that is what is proposed here an apartment use is also Allowed by right and the general business district uh so we're not seeking relief uh for the apartment apartment use either so this project in terms of size scale uh density and parking complies with city of Riv planning goals for the riv Street Corridor and the general business district as a whole the city's next stop R Master Plan finalized by the city in 2020 calls for new housing to be constructed and the general business areas along Riv street with reduced parking five-story 50ft height and increased density above and beyond the floor area ratio Allowed by W and the general business district so this proposal meets those goals though the density of the project is reduced going off of the LA Thor area ratio we are about 40% less dense than what is allowed by right and even less dense than what the city's master plan is promoting so overall this project uh is the product of a year and a half's work with a community to design a building that minimizes a butter impacts maximizes parking and features a lesser density uh than what is allowed by right uh so again out of our discussions with City officials the building was moved away from the rear rear property line and the neighbors closer to the street line uh parking was retained for the adjacent Funeral Home home use and the overall density uh and bedroom count of the building was reduced so this is a minimally impactful project with generous parking that meets City Riv planning goals for the River Street Corridor and this project also enjoys the support of several neighbors including two out of three direct Butters and we also submitted eight letters of support from Neighbors uh so for these reasons we would respectfully request the the requested relief is granted and we are happy to answer any questions that you may have thank you thank you seeing that this is a public hearing I'll ask if there's any proponents anyone in favor Attorney Jerry D brosio um I I will not restate what uh Nancy O'Neal just stated but I I did want to emphasize one point um the bonfilio family has been operating that funeral home for goodness 60 or 70 years now um it is an essential service in the city of Rivier um there were only two funeral homes left in the city of river um the reason I mentioned this is that when the bonfilio first came up with this plan it was ofri right they could have built it by simply getting a building permit and when they came to City Hall to get the building permit uh the building department intelligently said well wait a minute this is too much parking 54 parking spots for 32 units is out of line with what's actually being done in the city in the Greater Boston area and we'd rather have more parking available for the community have more parking available for the funeral home and as a result of that they asked Paul bonfilio who's here in the back if they would work with the city and so there were a number of things done the uh unit density was dropped by right you have Den of 1.5 it was dropped to 0.9 we went from uh all two unit uh bedrooms to only uh four of the 32 that was done voluntarily the building density was dropped voluntarily while it was a matter of right the building was moved forward closer to the sidewalk to give folks in the back more room that was done again voluntarily by Paul bonello and his family at the request of the city and then finally while Paul bonfil and family had 54 spots for the servicing of this building as a matter of right the city and honestly intelligently so said it's too much parking for 32 units we'd rather have uh at the very least 21 spots available for the community during the day and then and the funeral home when need be okay so we we instead of 21 now we have 22 we actually have an increase of one parking spot um I think it's important to remember that when looking at this site the bilios own two of the homes on the outside and those two homes are going to be demolished so the the actual parking lot that you see today is actually quite larger to the right and the left but I do I do want to point out that the bonfilio family has been here for a long time they love this community uh they live in this community and uh the reality of the situation is that uh uh they've worked with uh City Hall to build build a project that not only allows them uh to use their property but also accommodate the city hall and the neighborhood in a better way so you know I do understand when people complain and some people complained about the height but I remind everyone the Height's a matter of right there's no request for height uh the density is a matter of right there's no request for an increase in density um I remind everybody that uh the project as a whole at the beginning was done as a matter matter of right the only reason we're before this board is because of the requests to make this building more suitable for the neighborhood and to provide for more neighborhood parking that is the reason we're here today otherwise it would have been done with a simple building permit thank you any other proponents good good evening I'm Richard P 89 M Street I've lived there my whole life 61 years my family's been there around over 100 years matter of fact my father all my aunt and uncles were born on that lot the house that was on that lot before it was made of parking lot and um Paul I have full confidence that the project will be done the right way and it shouldn't end anything in the communities and fearful of anything else happening there other than that who know if anything could happen there but he's going to great neighbor and a good business man of the community and I think house or two family house I my house going to abat the the big project they want to do it I going to lose my privacy especially I has Grand kid and they can in summertime they cannot enjoy anymore the Y because 32 uh unit is a lot of people can see and I don't know who is the people you know what I mean and also they going to the construction they going to do it they take it over a year and my uh driveway is very close to the project they want to do it it's like I mean you know it's in the corner so it's close it's like touching each other and I parking a car is a commercial car they cannot be parking in the street and I want to like I mean I don't be comforable to where I parking I mean I know he say like is his property they can do whatever they want in his property but you know even if he build they has to think I pay taxes too I own my house for so many years and it's not fair for me like block all the view like my privacy is gone and it's not only one label or two or three it's like five is like 50 ft High I mean that's is my concern the traffic is already um bad I know they're going to be worse because they wants to put a um parking in their building but they coming and coming out and coming in I mean they be more traffic you know I mean to heavy traffic be more than where they are now I mean and it's not fair somebody told me a lawyer told me like if he building this big my property even going to this valuate my property and they even my neighbors my neighbors as well I mean the valuation of my property not be the same because all they building they be like for me be like nightmare I mean I want I have to keep all my windows closed during the construction because a lot of dust in um in thereby going to be in my house in my yard okay anything else or I would like to if uh I mean I request like uh to have like or to building um bares no only to bar to give me a a privacy to um you know because I mean they want to do a f but the f is not like high enough to well they can't go higher you couldn't you want a barrier you can't put up a a wall there yeah that's you're by right they have the they're not here for anything to do with height they have the right to build the fivestory building without even coming in front of the board of appeals right in front of us because of like they say the city has requested a few changes and that's what in current c c r RN um I I just like to see it scaled down um if this was by right first of all I re does meet the 40 a so it isn't really by right when they need variances especially three of them but where they are asking for variances to the city requesting that by right they can put more by right they can build but not not under the 48 cuz we meet that we can't say no we can say no more variant this is a project he that's what he wrote in the paper 4B project no that's what the advertisement says a zoning act 40 a it's not 40b but the zoning act they have the right to come in front of us right no I know that but he's asking under the 40a for the MBTA and he's saying that a bus can't even get down the street now I'm confused on what you're saying about 48 with the well that was the advertisement in the paper he's asking for three variances and it's under 48 he's asking for right yeah it's right here that's correct so what I'm saying is it isn't by right under 48 because we meets the requirements of 4A we we we're there already we have enough housing on MTA is my point um I'm not trying to say no don't build they they both were born and raise and R I'm still confused about your thing it we they're not buy right under 40 they 48 is is it's is way they're coming in front of us this doesn't have to do with oh okay maybe I'm confused yeah different but the variance is they got to stop because the quality of life in the city R Street in that area you can't get down um just startop building under the variances stop giving variances without needing a variance if we don't give them a variance they have the right to build more we're asking for a variance to keep parking for the funeral home he doesn't meet the the building if he doesn't have to have parking for the funeral home he can take this and build and not have parking for the funeral home right so there's a give and take here're ask way for years so no it hasn't been that way you have Park all over for for the bigger funerals they don't even fit in that parking lot but you have a parking lot there now yeah by right they can take and build there and have any parking so one of the concessions is for them to keep parking for the funeral keep giving out variances for parking and people have no where to park that's the bottom line you keep giving variances out for parking you give it out for setbacks a ladder truck is not going to pull behind a building there I really don't believe they're going to fit they're going to stop on on Rivier Street and it's going to stop every MBTA bus coming and every car coming down but that would happen in the house that would happen if the house next door needed a fire engine right but not 32 units you got 32 people that possibly could call for a medical unit this is the point why can't we scale it down to like you know a small units you know that's all I'm asking for you guys are up here like okay okay okay ma'am there's a lot of negotiation going on there's a lot of negotiation going on that this man had to to make for the city I know that I know that and you know what the was very good to both of them men very good they they have thriving businesses in the city of R they've been around a long time they they started off very small and now they're pretty big so just get back to the city a little and stop asking for variances that's all do it without them so let him have 54 parking spaces on wait wait wait wait listen listen let them have a building that's large with 54 parking spaces no parking spaces for the funeral feral home and you and you live there right now they already didn't have the parking for the funeral home there's 21 spaces I've been to many funer but you 35 years ago there wasn't right so now they have them you don't want them to take away from Away by building the building anyway they're not taking them away they're there ma'am you're confused there 22 spaces believe I am there's 22 spaces being allocated for the funeral home m there's 21 now there's 22 being allocated where how many are there now when they built the building 21 be underneath underneath it yes okay all right there's 22 spaces that's what we're fighting for and that's what we're getting they're not taking away spaces they're giving them they technically don't have to have any yeah it's just the variances I'm just asking you to like chill out I want you to understand that they I have there's 21 spaces now on that open lck mhm and there's a huge building going up around the corner and there's 22 spaces that they have to keep under that building for the funeral home I'll believe it when I see it well you're going to see you I appreciate it okay but you are going to see that that's the confusing part that people aren't hearing about it is happening they're going to keep spaces there for the funeral home yeah that was one of the big concerns that stopped them almost a year ago to do this let's just face that nobody in the city has has one car for a household we got two three four ma'am you're not looking at the beach I live on the beach and people don't have a lot of I lived on the beach I know I had to leave the beach yeah but there's there's a lot of spaces that are available in some of the buildings down at the beach I I I live there I watch it I know it okay anyone else in opposition that was Bonnie any I would like to speak but if anyone else would like to speak you Kelly uh is on record 99 Derby Road in opposition of uh this project and I'll ask the question there was um to the attorney this is just for clarification there is 281 bedrooms four of them that have an appearance of a uh a bedroom so to eliminate that appearance um as we discussed that the closet the walk-in closet there that the door could be moved to the common area and not in that room that eliminates any question of that becoming a bedroom that's been agreed upon correct okay that was her that was one of the concerns and I believe now that's corrected um I have to speak on this one real quick the parking issue there currently 21 spots there let me 54 after this so okay so okay this has been a long process going forward for this AP land there was many many disingenuous things put on public media saying that there's going to be no parking um this project could go there and we stopped it from going there right away to have 54 spaces and to have a a project made and eliminate any parle any um parking for the funeral home I questioned the traffic from the funeral home and if you can if people go to Bon fals right now there's only one room for funerals there used to be two so now they can only have one funeral at a time there's not two funerals going on so that number one lessens traffic and lessens the vehicles going there and I thank him for doing that because that was a great thing that he did by just keeping one funeral at a time the other thing was that I know it was hard for them to fight it that they did not want to give up all of the the um the spaces we have one space per unit which is above what's been going on in the city um and he made that concession for us and he made the concession to keep 22 spaces under that pel for people to use the open space and to have in for funeral services I want to make that clear because everybody said he's taking away all of the parking that is not the case it's clear on on his plans that there will be 22 spaces for use of the funeral home I want to make that very clear because that was one of the biggest things that you're reading on Facebook and how this man he's making money and you know any businessman he could do that as a he could done done this property as a matter already a year ago and no questions asked by anybody I'm sorry we put you through the this long process but I am so happy that you kept the 22 spaces cuz that was one of the biggest contentions of people in the neighborhood is and for you to to now lessen your services to only one room that's even I'm I'm grateful for that if there's anyone else that wish to speak if you want to counselor if you oh yes councelor Kelly wanted to the statement right into the record so as these 281 bedroom units will also include dens it's not all it's that there was four that included a room it will be extremely easy to convert the dens into a second bedroom for rental properties the den could then easily be converted into a bedroom simply by Framing a closet if these rental units are true one-bedroom units they should be precluded from having dens or other rooms which can be most likely used into Den so again we stop the closet in that that room that could be used as an office could be used as a sitting area the one the number one thing is you got to get certificates of vent PE when you move people in these cannot be changed to two bedrooms right they're being voted on for one bedrooms they cannot change that they'd have to come in front of the Border appeals that have to go in front of site plan review and do a whole process so to to put at ease we even asked to have the door for that walk-in closet change to the to the Carmen area versus that Den office study whatever you want to call it counselor welcome to the chamber thank you councelor Angela Gino SAA W five um okay after months and months and months of negotiation this could have been built by right I I know people do not believe that but it could have been built by right and it would have been much bigger of a size than it is today it started off as all two-bedroom units and I went back and forth back and forth with Paul um and the attorney we couldn't have all two bedroom units on Rivier street that would create traffic not only that we would have a serious parking issue so after negotiations we decided on 28 one bedroom units and four two-bedroom units and those four two-bedrooms were because they're the corner units and they're much bigger so they had to be two bedroom units Paul has come to me and he's he was really concerned about his neighbors so I originally got a bunch of letters that was opposed to this project but after our community meeting that we held um people came around and actually two of them are in this room tonight they came around and they changed their minds and you know realized what he is trying to give back Paul has been a staple in this community for many many years his whole family has um again I was dead opposed to this building thinking of how big it was going to be but he stayed at the five story level he's not getting a variance for that the variance that the variances that he is getting a Varian just for clarification you're not speaking in opposition I'm not I'm I'm speaking I was in opposition but I'm right now I'm trying to get the best I can I'm the counselor I'm just speaking as a counselor public it's public hearing proponents are not are opponents I I'm I'm okay with it okay okay um he's worked extremely hard at trying to give us everything that we wanted the city asked for the uh front setback variant so we could have the open space for the back so the residents didn't have to have the building on top of them he went around to the residents and he spoke to most of them um he's trying to appease what they are what they need to make it okay for them one particular residents that I was concerned about who is extremely ill he is making sure that she is going to be okay with what is what what's being built there he's asked for a um the city has asked him to have the variance for the the cars um most of the buildings that are being built in Rivier which I I don't agree with do not have any parking this one here is going to have 32 parking spaces which is huge for the city of river for for somebody to be building and actually give us one to one also the other um the other thing is we still going to have the 22 parking spaces for the funeral po which is very very important for the city of Riviera considering you know all all the funerals that are being held there and you know we do have um many cars as far as traffic is concerned I asked for policing um during the construction which Paul has agreed to um I don't think much traffic will come in and out of the apartment building as people are thinking it's not going to be 32 cars coming in coming out at once or going in at once maybe once every half an hour you might see a car here a car there it's nothing different than I nothing different than other cars coming from other cities um going through I'm I'm happy he's going to give us that robust Landscaping in the back as well as the um fencing to benefit the neighbors just as long as the neighbors are happy then I'm happy and um after that meeting I feel comfortable with most of the neighbors that were opponents that have ch changed their minds and become proponents and um that is where I stand right now thank you thank you any members wish to
