newspapers for the township of Brockway notice was posted on the official bulle Boards of Brockway Township the township website notice was filed in the office of the Township Clerk approval of the minutes uh January 7th Township council reorganization meeting minutes can I have a motion so second please take the RO councilman Freelander yes councilman sck yes councilman Quinn yes councilman going to be a resolution uping coming um regarding uh affordable housing and our obligations so I'd like to turn the meeting over to uh Mr Dave Novak to speak about it before uh and if there's any questions for him yes before that would you uh read item put back my uh request to have usually I put them to sleep before I speak uh good evening everybody uh my name is David Novak I'm with burges Associates it's nice to see you all again um tonight we'll be speaking very briefly about the resolution before you regarding affordable housing so just as a very very brief background back on March 20th 2024 the state adopted new affordable housing legislation which basically amended the prior Fair Housing Act what that legislation did is that it got rid of what used to be called COA the Council on affordable housing and it split its duties between two different entities the DCA the Department of Community Affairs and the office administrative courts the DCA was tasked to come up with uh the Statewide and Regional need numbers for affordable housing as well as to come up with some Municipal calculations for affordable housing and I'll get to those in just a second the AOC was designated to create something called the program which sounds I know very kind of ambiguous and innocuous but uh that is basically the dispute program um so COA is gone now replaced by the DCA in the program DCA as I mentioned was uh tasked to come up with the Statewide housing need numbers as well as the municipal need numbers they released those Municipal numbers on October 18 2024 the interesting thing is that those numbers are advisory only right so the DCA has this whole worksheet it included all these data sources it comes up with these Municipal numbers but it says Hey municipality look look at our methodology use this methodology but these numbers are advisory only tell us what you think your numbers are so that's exactly what we did um and every municipality in New Jersey is obligated to do this and submit a binding resolution like the one in front of you before January 31st 2025 those Municipal need numbers are comprised of three different factors comprised of an equalized non-residential valuation factor a median household income factor and a land capacity Factor those numbers combined DCA calculated a affordable housing need of 435 affordable units for Rockway Township so we took a look at that I've actually worked with your staff as well and I have to complement your staff they were very responsive made the process a lot easier we looked at the ne non-e equalized residential valuation factors everything seemed copasetic there we looked at the median household income Factor also seems like DCA got it right there then we looked at your land capacity Factor the DC identified that there were 120 acres of developable land in Rockway Township we looked at that mapping it took a while for them to actually release that mapping we found that there was 89 Acres or so that were identified on a governmental piece of property that had no improvement value when we looked at the mapping and we looked at the arrow underneath it was pitini Arsenal uh a federal reserve and also a super fun site there were also developable lands located on houses of worship on common elements so I'm not faulting the DCA too much the DCA had a very limited amount of time to do this but what we did is that we took a very conservative approach we took out sites that we did not think met the definition of developable pursuant to the methodology that the DCA was trying to do that lowered the amount of your developable Acres from 120 acres to 15.35 n Acres when you put that back into the formula that DCA uses that ultimately reduces your obligation that we at least we think to 301 affordable units 301 affordable units so the the we I'm sorry uh 15 Acres yeah because 89 of those Acres were located on pitini Arsenal he's asking what I asked you already did yeah uh no we checked because of the income uh uh sorry it was really the non-residential valuation Factor so you can lower that obligation time to zero but because of those two other factors that you have to deal with it still keeps up yeah so the way this process works is this um every municipality has to adopt this resolution by the end of the year um after you adopt the resolution you have 48 hours to make sure that you post it on your website if you don't post it on your website within 48 Hours you lose immunity that's bad because then we can get sued by a developer any interested party will now have until February 28th to challenge this resolution if there is a challenge to this resolution and a challenge to our number the way we calculated it the program will try to settle that dispute and by legislation they have to settle it within one month by the end of March 31st I don't know how that process is going to look nobody really does Joe Burgess is a special adjudicator he works with the program he doesn't know what it's going to look like either uh I don't know how they're going to settle all these disputes within a month but that's not our concern but that's essentially the stage that we're at now the next stage after that we'll be working on a housing element in Fair Share Plan we're going to work on what's called a vacant land adjustment with that uh that's built into the resolution as well it reserves our right to do that where we look at actual vacant lands and see all right realistically what can the township accommodate in terms of affordable housing but this is that first step and that's essentially what this resolution outlines so like I said uh after this resolution would get adopted needs to be posted on the website within 48 Hours needs to get filed with the courts and then we'll see if we have any challenges by the end of February what if there is a challenge and it's not resolved in one month what happens that it's a great question I have no clue I don't know what the answer to that is um it's a big question mark throughout the state right now all right so I'm sorry I don't know how you want you speak well you're next thank you council president um first of all excellent report um it was very good U I didn't get a chance to read the the read one we sent today but I read the original one I don't know if there was anything we just corrected a type on page 27 or so um and the reason we did a report that long is because we don't know what that process is going to look like so we're wondering if they're going to even have time to bring people to testify in front of the program if not at least they'll have a map that shows you know what's actually going on with these sites and I think that'll be a big help sure and um yeah I saw a while ago when they released the numbers to 435 units if it was in the The Star Ledger or one of the papers and everything and you know when you look throughout moris County and throughout our area you know our numbers were actually pretty low compared to some of these other ones I was I was very happy when I saw that and then with this new number that you're coming up with the 301 um do you think actually be something that we'll have a shot at the 301 like yeah I mean it's a it's a i that's that's our goal right so we took a fairly conservative approach um you know I think every site that we identified as not being developable we have a decent reason for uh either a it's already developed it's pck atiny Arsenal uh I think maybe there was one site that had Minds on it that we were able to exclude during the last round from a vacant land adjustment because of the M shafts on there so I think we took a pretty conservative approach with this now anybody can challenge the number and technically they can challenge the number even if we accept the dca's number so um we're still open for that but that's uh something that's supposed to be taken care of by the program and what's the time frame on the on the units like yeah great question years what's what's it yeah that's a great question I should have said that up front so this obligation is between the years 2025 and 2035 okay so essentially what the DCA is telling us is that we need to produce this many units over the next 10 years 10 years thank you so just a couple questions did when when we did our plan analysis did we take into account other towns that pay their taxes to rock away so like portions of Dober Warton Boot and things like that no um no I don't think so the equalized non-e equalized rent I'm sorry the equalized non-residential valuation factor is only based on the valuation of the property located in Rockway Township but since they pay their taxes to Rockaway would and we I guess maintain those lands I mean would we be able to look at space in those areas in terms of removing them or in terms of building there using them for for space like I think of botin I mean there's a decent part of botin right that that pays their taxes here I mean I live in Dover you know we pay our taxes here so I'm a Rockway resident does it look does it look at mailing address or no no it just looks at within the municipality yeah but we should take a look at again if they're paying taxes to Rocka away and we're maintaining that in police response and things like that could but I so I think only those values of properties actually located within Rockway Township like block and lot numbers assigned to Rockway Township listen I'm just thinking just no I understand what about um County Land within the township of Rocka where there where they are building affordable housing does that count for our number so they actually included a portion of the county property on what is that Mount Mount Pleasant yeah uh Mount uh Mount Pleasant leading toward the mall right yeah yeah I'm talking about that land so when they put in those affordable houses does that come off of our uh 301 so they actually counted a portion of that property as the developable we took that out because it is developed so they were trying to the DCA analysis actually included that in our land capacity Factor right we took that land out because we said it's already developed um they properly saw an improvement value of zero or a tax code that didn't line up to something right so we take credit for those units in the past um if they were to ever develop additional units there we would take additional credits for that but we're not counting that as something that's raising Our obligation because we figure that's already developed land and when we identify Lane we say okay we're gonna we're going to do that what is the mechanism to start building there we make it uh so if it is something on like County property we'd probably enter an agreement with the county um you know uh I know they had reached out maybe a year or two ago I don't think it went anywhere about building something there uh typically we would you know work in conjunction with them uh maybe do a courtesy Hearing in front of the planning board for other sites that are not publicly owned say privately owned property uh we would address sites in the housing plan and then we would come up with draft zoning ordinances in the housing plan that we would later Implement so that would either be a rezoning of the site or an overlay Zone that would allow for a different development option that would allow for multif family with that 20% set aside for affordable house and then what solicit out to builders the the builders would be responsible for that yes okay yeah and then are those areas they pay taxes right the same at a lower rate or at the same rate as oh they would pay uh if it's an inclusionary development so like a moris common or what do they call themselves that Rock Point uh yeah they would pay taxes and then last question sorry um is there any my question is there any consideration for how this could possibly increase the population of the schools uh is there any consideration locally absolutely uh is there any consider consideration by the state no um you know when you do zone for multif family and when the multif family does get built typically you are going to see increase in population including School population okay not something that the state really cares about unfortunately right when it comes to the legislation okay yeah uh it I mean that sewer systems Water Systems they just and regards to affordable housing they just look at the number okay sorry Jack okay uh so did we take out the brown fields that uh we can't build on those are the ones that are over by RNs Strauss across from Lakeland bus oh yeah none of those property none of were included by uh yeah none of that's included not no not that I remember seeing no um and then the cap site wasn't included by the and all of the Highland stuff that's a good question too yeah the preservation does not get counted towards our obligation either so that gets pulled out of the total buildable numbers also exactly yes and the M shafts and all that yes yeah we took out a site that had confirmed M shafts on there right um that was also a site that we eliminated from our vacant landage last year uh the legislation or at least the DCA analysis did not specifically include M shafts and also didn't include contaminated sites but during the league of municipalities that question had been asked and they said basically present the information so that's what we did yeah and going through this all all these years with the COA the numbers always change so I'm praying that your number gets a little bit lower but it looks good thank you thank you quick one dat what um for low-income housing what's the the salary for the people to be eligible it's a good question I'm gonna look on my phone for that I promise I'm not texting a friend no that's fine depends on family uh so that's dictated by the regional income limits I can give you the percentages but that's not going to be helpful enough all right so these are the income limits for affordable housing so we are located in region two that includes Essex moris Union Warren County essentially what they do is that they split up households based on household size so let's just assume for a sake of argument a three person household uh the median income for our region for a three person household is $116,400 the income qualification will be $93,900 for a lowincome household 58,221 and for a very lowincome household $ 34,9 42 those were the 2024 income limits it's all based on a percentage of median income whether it's developed as a a single home Community low income or multif family low income is it all being sold or can they be rented it could be either one so a lot of the affordable units that are getting built today are for rent uh the reason being it's very very hard to qualify for a mortgage for affordable housing right so a lot of the products that we see at least for affordable units are rental uh sometimes there is a mix in terms of the market rate units might be for sale and the affordable units are for rent and sometimes they'll have a different management company for that but either way those income limits would be the same as well as the breakdown of bedroom distribution as well as income distribution so you need a certain number of moderates certain number of very low and certain number of low for everyone that's building for everyone that's Building inclusionary Development or even if it's 100% affordable for family they still should be following that um that distribution set by the state no percentages okay so when there's a rental you're already establishing the rent typically that would be handled by the administrative agent there is a Formula online you can try to follow it's pretty complicated to use uh I have mixed success with it because you need to have like a lot of the background information or utilities included but yeah those rents would be dictated by whatever that formula is okay and usually set by the administrative agent yeah they show that sometimes in the newspapers yeah yeah yep exactly yeah any other important thing too um speaking of rental and for sale units uh for a lot of towns through New Jersey there require a 15% set aside for rental units and 20% for market rate units I'm sorry I'm sorry for for sale units um since we're located in the highlands region we require 20% across the board so if somebody's coming forward with a rental project or a for sale project we're requiring a 20% set aside no matter what thank you okay so you may have missed it but based upon the low the moderate all of that right that 301 and we're just going to use that number because if you put it into the universe Jonathan it happens um we're going to take that number you're saying that there's a formula to dictate how many have to fall within each one or we determine like who determines how many AB in terms of breakdown of yeah absolutely yeah so uh good example would be good example would be if there's a site plan application submitted say everything goes well they accept our number we zone for a site somebody submits an application um when I do the review for that application I will review the affordable housing distribution and make sure that they're following that formula for bedroom distribution and the income distribution is something that we put into a resolution typically as well so um you know for Rock Point for cry Park uh lenar all of those are dictated by resolutions that establish the affordable housing set aside requirements so if there's an application that's submitted and they're only proposing you know say they require 20 affordable units and they're only proposing 20 one-bedroom units when I get the review I'm going to say that you can't do that that's against state law and it's against our ordinance as well so we make sure that the bedroom distribution is set for each application that's submitted uh then when they get approved and they start marketing those units then the administrative agent that's typically um I forget who we use is it is it P okay so we typically use patan Associates as our administrative agent so those developers need to consult with patan Associates to work on the um marketing of those units to make sure that a they're marketing correctly and B they're getting the right income limits as well for each of those units too so it's it's usually handled we' like to handle it on an application by application basis Jack sorry one more now would we have to come back and redo our master plan with this so that's going to be the next deadline there you go that's actually a very good Segway and I have the date written down so the next deadline that we're gonna have to deal with is uh drafting a new housing element and fair share plan we actually I know one more thing one more thing we uh we actually just got a proposal back from the Highlands Today I think so the highlands my th yeah sorry um act surprise when Allison says it again uh the highlands is helping to fund 25,000 of this housing plan which is always nice uh but that'll be the next thing we have to do is prepare a new housing element and fair share plan I've already started working in the background data for it so hopefully we'll be able to hit the ground and run it just helps to know what our number is going to be so we know what they actually plann for thank you for your time of course thank you councilman U referred to the issue with the additional schooling resources that are going to most likely be required for this affordable housing and given that the the referendum that's currently in pause that's going to require a tax increase when we're adding more affordable hous housing units is probably going to require another tax increase so I do implore the council to really think about this think how it's going to impact uh residents because if we're going to have two tax hikes it's it's going to drive people away from the town uh some other things I've been researching so some of the other towns that do have this affordable housing obligation such as Denville foren Park and monville they join together uh they call themselves The Local leaders for responsible planning um is Rockaway going to be joining uh that group there is strength and numbers uh also besides income are there any other criteria that are required for the affordable housing um I I think that's something that I would want to know other people in Rockaway want to know who their neighbors are going to be and then something I didn't hear in the presentation is it it and it sounds like it's still up in the air but I could be wrong because I was trying to make sense of it uh where exactly the new housing is going to be built when it's going to be built and lastly um how many regular units are you allowed to build thank you is there anybody else from the public that wishes to speak name and address Donna marce zinsky one lak Shore Drive my question would be again the referendum right but it used to be that the builders would have to set aside some funding for schools in expansion is that still the case or did that stop because that used to be law so this way it wasn't such a burdensome thing you know and especially with low-income housing I was in low income hous housing I know it's necessary you know so I'm Pro affordable housing but yeah also as a taxpayer owning a home right now I know it's it's really a burden if the developer isn't responsible for these schools and expansions so thank you thanks anyone else okay uh okay uh moving on to reports uh again I'm going to ask talked to Allison she is going to talk to the water Department to find out why this guy has no water for two days and uh she'll get back to me and I can get back to the resident all right thank you they had their reorganization meeting the new president is Dr Aaron tomasini the new vice president and Mrs Noel and Anderson um they swore in two new board members um Miss Jamila torn and Miss Jackie Richards in um the superintendent had noted that the referendum is I guess on some sort of hold uh the EPA I think don't hold me to that if that's the actual Department D thank you Adam um is uh has some issues with a few things so that is not moving along smoothly um but also uh the Megan slam wanted me to send over my thanks again to the administration and I think specifically the tax office everyone at the Town Halls always she said just wonderful and fantastic and they get her everything she needs and then some so she genuinely appreciates it and uh Dr Corbett also mentioned he really appreciates that he can just pick up the phone and they had an issue with one of their guys at KDM and the town guys went over and plowed the lot and everything was awesome so again they just really appreciate the the bridges that we have between the municipality and the school district so I thank you for that the next board meeting is actually tomorrow evening 7:30 copin middle school and then I just I want to again just thank all of the D guys the police department the Rave alerts that have gone out the weather like councilman sacket said it's very cold check on your neighbors um help them out but again I think we really need to give these uh gentlemen and ladies a a big thank you they do a fantastic job in Rock way Township uh I was actually drove into another town today and I and my truck slid in the snowy parking lot so again not here it was not fantastic but this one was so thank you so much again that's all I have uh yeah I just want to uh Echo that message I was out late on Sunday during the storm it was like 9 9:30 um the the uh the DPW guys were I was on Fleetwood and they had working in like teams one would push and then the next one would go and the road was awesome and as soon as I hit the county road you know uh Mount Hope like I was all over the place so our roads were better than the counties so that was awesome and then the only other thing uh m p I just want to when it come to your report just an update on uh budget books and and when we're looking at that Mr chono President is your mic working yeah how's that yeah better had to straighten it out okay um as I started to say we can conducted uh by the request of the council Administration our annual Oprah inventory which refers to the number of Oprah requests handled uh by the clerk's office uh the oer winner this year in terms of the individual requestor trophy uh was once again Mr Kelly uh who has filed uh six request for 2024 for those of of you who are worse at M than I am which is probably knowing that's at a better than once a week rate uh I wouldn't attempt to count up for you literally the hundreds of hours of the clerk's offices time uh other staff and other departments depending upon the nature of the request uh the time that we spend and occasionally special councils spend with Oprah requests uh which probably in the aggregate is tens of thousands of dollars each year uh so that's all I have to say and then if you promise not to throw me out I'll pass the microphone I'll uh Reserve making the decision how many years running is he our champion for trophies Mr Mayor thank you council president um first I just want to address some of your questions I think um I talked about it with the engineer and the planner and I think the joining the lawsuit wouldn't necessarily benefit the township um it doesn't seem like a winnable lawsuit um with the DCA and the time and money we would spend to be part of it so we thought the more prudent thing was to you know question the formula right and that's we did how we low the number um we can't require Builders to do things for the schools so we can't do that um I think we could in the past but we can anym um and in terms of the the the number units all those things we wouldn't know any of that until a developer buys the land or develops the land and submits their plans for review and then we would know and have a better idea of that so that's where we're at and I'll I'll continue to keep Dr Corbin informed so he's aware um and it's and it's kind of um you know outside that it's it's out of our hands the principal lawsuits brought by other groups of towns have already been dismissed by the court yeah um and I do believe uh councilman Quinn will check with Al but I know he sent the message out that there was a water main break that wasn't addressed right away because there guys were plowing I think I think I I think I saw somewhere I don't know maybe that was a dream but I'm pretty sure I got an email from him saying that so that might be why um but it leads to I again I would just ask council members um if you have inquiries questions feedback please direct it um through Lisa's office you know through the business administrator it's very important helps us keep track of what our department heads are doing what their employees are doing um to make sure we're not doing double work we're not getting multiple inquiries to different people so you know again I would just ask for that courtesy from all the council members um and then in just in terms of my report um we did have a planning board meeting not much happened um married somebody this past month and tonight gab blood and I want to compliment we had four Township employees there um giving blood tonight that I saw so there might be more um and I want to thank um Eileen Horwitz and Michael ly for he's running these events you know not just for the white metal aake but for the Border community and collecting blood I mean there were you know a couple of dozen people there while I was there so kudos to them and for what they do for the community that's my report thank you council president m p yes um as far as the budget's concerned um just wanted to let every everyone know this year I'm going to be sending it out electronically so that you can um follow along on your tablets I'll have it as one PDF file with the page numbers and we should be able to get through it without having to prepare actual paper budget book save some trees um I have I'm just about complete with um getting ready to submit the budget to the mayor we have a meeting scheduled for next Friday a week from Friday and um as soon as I get through that meeting with mayor Joe we will um I will be assembling that PDF file for you and I hope to get that out within the first week of February so that you'll have a month to review it before we meet that Saturday forget the date I think it's the 8th of March um so that's the budget um our Auditors were here last week and we're just wrapping up closing up the year end so that I'll have um final financial statement figures for um year end I'm again hoping by the end of this week if not early next week um I will also be reviewing the water and sewer rates they have been reviewed every year but I think this year may be a time to consider um looking at possibly raising them but I'll review that again with the mayor I'm going to review it with um alen the um and Brian shatzel and then present it to the mayor and then ultimately to the council and that's my report um just I I have it down as the 15th okay so of March yeah so it's a month and a half we up in six weeks oh and also again it makes Mr Brooks happy so mission accomplished and as always please if you have questions if something that we want to be a part of um I do believe that a large majority of the application for affordable housing is based on income um but it is a lengthy application um you can access it online through the township or you could contact us and we could help facilitate so you can see what the application looks like and as Dave Novak was saying the next step would be to work on that housing element and fair share plan which basically lays out the road map of how we would possibly attempt to meet the 301 and like Lisa and uh Dave said we did get a grant from the Highland Council of $25,000 help us with that so that's it Chief good evening council president members of the council as far as the police dep Department we would like to thank Al and his crew as well uh when they're out there working hard that makes an incredible difference for the officers that are working during those storm events to be able to effectively uh get to the places they need to be uh to help the citizens in the township so we we really appreciate their efforts as far as the monthly report I had given you a yearly report at the last meeting uh December's activity as far as calls for service Andor activity or entries in the cad were 3,43 motor vehicle crashes 132 motor vehicle encounters 371 domestic violence incidents 10 228 fire medical or 911 calls adult arrest five DWI is three 69 alarm response is 11 community policing entries 167 residential commercial or school property checks and assist other agencies 16 and 174 motor vehicle summonses were issued and that's my report just uh what is community policing Ur that might be uh any event so for example exle things that we do throughout the year whether it's the library Festival whether it's got itur Mr tabi thank you council president uh just one quick item uh in collaboration with mayor Jackson the division of Health uh did make application for a New Jersey healthy Town designation uh this is assigned by the New Jersey Healthcare Institute and consistent with the mayor's Wellness campaign Statewide um it's basically represents our efforts to promote healthy living and wellbeing in the town um right now we're striving for a healthy Town upand cominging designation so perhaps by the league of municipalities conference in November of this year uh we maybe we'll get invited to present some of our uh model practices and we've had a few um and and credit to Britney Burnstein no surprise here as our program development specialist and Outreach coordinator for taking the lead on this for the division thank
