know um when I miss something I'd like to start with the um the Lake Mary little league if y'all could come on up [Applause] so we want to um start with a proclamation from from the city whereas the Lake Mary little league a nonprofit established in 1992 to provide a safe and fun environment for instruction and competition in youth baseball and softball whereas the Lake Mary little league proudly represented Lake Mary seminal County in Central Florida through District 19 at the Little League World Series in Williamsport Pennsylvania whereas the 2024 season roster of the Lake Mary little league Allstars team included number seven Chase Anderson number eight Christopher chiad number nine lean Norton number 10 Hunter Alexander number 12 Jacob bald number 14 James ficano number 15 Liam morisy number 18 Lewis callow number 19 Landon Bono number 22 Garrett Rosen number 25 Demarcus misus and number 26 toj Alexander along with Coach Paul bald coach Kyle Bono and manager Jonathan Anderson and whereas the Lake Mary little league Allstars when their first two games then battled back through three wins in the elimination bracket to get to the championship game winning the US Little League World Series in a thrilling 10-7 defeat of Bourne Texas and whereas the Lake Mar Little League Allstar showed exceptional performance under pressure and both their win against Texas for the US championship and then their come from behind win against Chinese taipe to become the Little League World Series champions and whereas the team has been an inspiration for the community bringing them together to celebrate the team's accomplishments and winning and in sportsmanship now therefore iart Woodruff by virtue of the authority vested in me as the mayor of the city of Sanford Florida do hereby officially proclaimed August 25 2024 as Lake Mary little league Allstar day and with the city commission and residents of the city of Sanford join Central Florida and congratulating the team on to bring up Derek Daniels and Amber CLA and they have another presentation well you pretty much did our entire job I'm sorry my back is turned to you guys but what we have here come over here pear we have the Trailblazer reward that we were going to give to you guys during that show we had a show a couple of months ago I think one actually this gentleman right here remember him I can never forget the hair I got Hair Envy you can see it's working but nonetheless he showed up you guys all had practice he had practice was a trooper but we do have a Trailblazer award that we want to give everyone and I'm gonna let Amber hand a mic to you so yeah you actually all you said it wonderfully um so this is just a um Testament to your journey to Victory uh to hard work determination inspiring young athletes and fans alike you guys are really um setting the tone here for seminal County so we celebrate you um your outstanding achievements and we recognize the path that you are Paving for those for you and I believe they have a gift certificate that they have given your coach okay so again thank you congratulations um and we appreciate you coming and and sharing with [Applause] us all know as many cars as they have worked on I know they fixed my transmission when I ruined my car when I was in high school so whereas Samuel and his son-in-law James Beverly established heral and Beverly transmissions and auto repairi Virginia in 1952 and whereas Herold and Beverly transmissions and auto repair moved to its current location on 25th Street in Sanford Florida and were issued a Sanford city business license effective October 1 1959 and whereas Alvin and Don Beverly sons of James Beverly learned the family business and took over operations in 2005 where as cin Sons Nelson and Lloyd Beverly took over the ownership Reigns in 2020 becoming the fourth generation of the family to run the business and whereas Harold and Beverly have provided professional honest inde Dependable auto repair in Sanford for 65 years and whereas Harold and Beverly is part of the community giving back through support of Sanford porch Fest Sanford bab Ruth baseball the Simo County Police a Athletic League the Sanford fire department and the city of Sanford among others whereas the city of Sanford and the Sanford city commission want to join in honoring Herold and Beverly transmissions to an understanding of its many responsibilities and whereas city government off official employ share the responsibility to pass along the understanding of public services and their benefits whereas the Florida city government week offers an important opportunity for elected officials and City staff to spread the word to all citizens of Florida that they can shape and influence this branch of government and whereas the Florida League of cities and its member cities have joined together to teach citizens about municipal government through a variety of activities whereas the city of Sanford encourages all citizens city government officials and employees to recognize and celebrate Florida city government week whereas the city of Sanford encourage encourages educ educational Partnerships to ask Mr uh Tony Rondo to come down he is a decorated Marine Corps veteran and will be the keynote speaker for the city Sanford city of Sanford's 2024 Veterans Day ceremony and will be accepting the Veterans Day Proclamation tonight Mr randoo is a third generation Floridian after graduation from High School Mr randoo enlisted in the United States Marine Corps he spent his first six years as an infantry man with a six Marines and the remaining four years on active duty as a scout forward Observer with the first air Naval gunfire leaz un company Mr Rondo attended Army ranger training in 1991 and became Airborne qualified in 1993 he's a veteran of Panama and the first go four Mr Rondo continued his commitment to service as a Sanford police officer writing to ra rising to the level of Deputy Chief of Police and after 26 years in public safety Mr Rondo transitioned to the development services director with the city his responsibilities include supervision of the building and planning functions as well as code enforcement so it's sort of like two proclamations yeah whereas the United States of America and dozens of Allied countries around the world recognize November 11th as a day of remembrance a day to pay tribute to our heroes and a day to rededicate ourselves to the cause of Peace since the World War I Armistice was signed at the 11th Hour of the 11th day of the 11th month in 1918 and whereas We Gather again on November 11 to remember the countless sacrifices of all of those in our military services who fought so valiantly on the seas in the air and on foreign Shores to preserve our heritage of freedom and to show our deep appreciation for our veterans hero heroism and their immeasurable contributions to our country while advancing Peace and Freedom around the world and whereas we recognize the United States of America Remains the greatest military force in the world because of our veterans who pass the torch of Liberty from one generation to the next while enduring painful personal sacrifices to prever preserve our liberty and prosperity and whereas brave men and women of s for and our surrounding communities have answered and continue to special work session regular meeting and work session I did have a correction on the minutes that I did not send in on my comments at the end of the regular meeting I um I requested City staff look into how we can do um inspections or work with HOAs to make sure that their facilities are kept up um and it was written as followup with homeowner associations when they are building new subdivisions so I was referring to existing subdivision and what we can do to help them and the staff has already scheduled a meeting for us to discuss that okay thank you great approve second motion of second any further discussion all in favor I any opposed pass nously right when it comes to speaking before the commission to facilitate public input if you plan to speak on an item we ask you that to complete the yellow citizens form that you will find in the back and pass it um from this end of the Das public will be given an opportunity to speak on any item before the city commission during a regular meeting before the consent agenda I will ask if anyone has anything they would like to speak on during public hearings I will ask on before each motion is made during regular items if you have not completed a yellow form if you would just raise your hand when we get to that item um I will recognize you there's a 3-minute time limit for each speaker on each item except a person representing an organization presenting and presenting views during a quazi Judicial hearing citizen participation at the end of the meeting um individuals may address the commission on any topic and there is a five minute limit on citizen comments so given that is there anyone that wishes to speak on any of the items on the consent agenda see no one bring the commission to pull an item for a motion Mo to approve second a motion and second all in favor all right any opposed pass brings us to public hearings and I think we only have one that's qu additional right so and we have two so in order to conserve time I'll read the statement um just once tonight when an agenda item includes the quazi judicial process Commissioners must disclose all expar Communications including the name of the communicator and the time place and substance of the communication written Communications Commissioners investigation site visits and receipt of expert opinions must also be disclosed and made a part of the record persons guide to quazite additional proceedings has been published on the city's website and copies are available on the table uh in the chambers at which the agenda is and speaker request ones are available 2340 Cel Avenue located contiguous to the city of Sanford together with Associated right of way in accordance with the voluntary annexation provisions of section 171 044 Florida Statutes redefining the boundaries of the city of Sanford to include said property amending the boundaries of the city in accordance with the provisions of section 16631 Florida Statutes providing for findings providing for conditions directing the city clerk to record the ordinance with the clerk of the circuit court with the chief administrative office of simal County and with the Department of State providing for a legal description and a map and providing for the incorporation of that exhibit repealing all ordinances in Conflict here with providing for separability providing for non- codification and The Taking of administrative actions and providing for an effective date Mr Mayor members of the city commission City staff have reviewed the request for annexation and found the request to meet the C here step forth in the Florida Statutes and therefore there's a city stat recommendation the city commission approve resolution 4808 on first reading to Annex 4.87 Acres at the address of 2340 celery property being more specifically described in this ordinance providing proving for legislative findings and intent providing for assignment of the land use designation for the property providing for the adoption of maps by reference providing for severability providing for ratification of Prior acts of the city providing for conflicts providing for codification and directions to the code codifier and providing for the implementation of the statutory expedited State review process and an effective date Mr Mayor members of the city commission at its regularly scheduled meeting on October the 3rd 2024 the city's Planning and Zoning commission voted to recommend that the city commission approve ordinance number 4809 on first reading approving the amendment to the Future land use from SEMO County Suburban Estates to city of Sanford low desity residential and it is the staff's recommendation City commission approved this ordinance okay this is a public hearing do anyone wants to speak to this it see no one off I mean and Caroline Haslam with they commend for the record um just wanted to offer to answer any questions related to the complain Amendment if there are any any questions okay discussion all in favor oppos first reading of ordinance um 4801 this Ro it [Music] 481 48 4810 I'm sorry an ordinance of the city of Sanford Florida providing for the rezoning of a parcel of real property totaling approximately 4.87 acres in size located at 2340 selver Avenue and assigned Tax partial identification number 2 2919 31300 0120 000000 by the simal County property appraiser from simal County Agriculture A1 to City plan development PD map of the PD property is attached providing for findings and intent providing for the taking of implementing administrative actions providing for the adoption of a map by reference providing for conflicts providing for severability providing for non-conf and the correction of scrier errors and providing for an effective date and potential reversion Mr Mayor m city Commission the city staff have reviewed the information provided by the applicant applied professional planning analysis to the facts relating to the subject property the the city's comprehensive plan and has found the applicant to reone 4.87 acres from SEMO County a agriculture zoning classifications to the city's PD zoning in order to establish a 16 unit single family residential subdivision as inconsistent with the city's comprehensive plan and therefore staff of like to make a recommendation to the city commission so with that I bring this High Henson okay and while she's coming up this is quazite judicial so if anyone has anything to declare I did meet with the applicant on August 13th and they went over their plans with me I met with the applicant on March 12th when they were first discussing the um the project all right Eileen Hinson planning director again um before you you have the PD rezone for the celery Avenue project going to give you a little bit of background and why we're here and then let you know what recommendation I would like to request for the evening um so first it's at 2340 celery Avenue which is located on that strip of green sitting between all of our single family residential it's surrounded by Celery Key celery States celery lakes and T place um so the L use amendment that you just saw which would bring it to low density residential is compatible with that which surrounds it its current zoning is in the county and it's A1 but again as you can see everything around it is single family there is one PD which is celery lakes on the Southwest most of it is straight Zoning for single family um the future luse also ldr SF which is why we recommended the LD rsf Lan use and not the Suburban Estates you're not the Suburban Estates that it currently is in the county so some project background the applicant approached the city to expand their existing facility well over a year ago the facility had a previous seminal County approval for 14 beds as we understood it they are currently on septic and require annexation into the city to obtain sewer to expand if they were to Annex the only future lanus designations because of their surroundings and for compatibility would be Suburban Estates which it is now or low density residential single family as you saw on the maps is the more compatible Lane use so when annexed we would have to give it a zoning classification the only zoning classifications that would fall into those two land uses would be sr1 1A onea or maintaining the a zoning that it has given their intent to develop the property and the surrounding uses the single family zonings would be the more logical one however as the property has unique characteristics and the applicant has specific needs staff suggested they move forward with a plan development so um given the current comprehensive plan requirements to calculate maximum density based on pre-development conditions so that's whatever it is now not what it'll be if they mitigate not what it'll be if they change the land but pre-development conditions so our complex say we take the acreage we have now that's developable and determine how many acres so there have been multiple iterations of a master plan and we've made efforts to try and work with the applicant to deal with the existing flood plane and the current city ordinances to create a design that works the packet includes your most recent plan the design standards related to parking setbacks lot sizes and other deviations have been found to be acceptable to staff with the exception of the actual design which staff and the applicant are still working through the detail because of the flood plane that exists on site so the final design will mandate if we can't if we can't completely solidify it on the master plan the final design will mandate that no approvals for staff level can exceed whatever is adopted on the master plan if one is adopted through a reone process so go back and say that again okay so if it goes to I just without saying yes you'll approve it I was trying to say that if they get an approved master plan that goes with a PD whatever those thresholds say if it says a maximum 16 units or a minimum of so many spaces per unit or whatever each of those will have to be met when we design it if the exact layout isn't the same because we're dealing with the flood plane that's all I'm trying to communicate that they won't exceed any thresholds established on the master plan so right now though we're still working with them on this master plan because staff truly believes that the pond in the back is not sized appropriately for what needs to occur on site so like I said said the exact number of units can be used at no more than 16 depending on how the engineering works out the um the design like I said it's we're still in flux on that so the final design will mandate that nothing exceeds that master plan so here's why we're here today so due to funding deadlines at the end of November the applicant was pressed to let take these last three hearings to meet that deadline so Planning and Zoning they saw on October 3rd City commission this is the first reading October 28th and they have to have a second reading by November 18th to meet those deadlines so we took it to Planning and Zoning commission and planning zoning commission recommended To Deni to deny based on the fact that at that time three weeks ago we did not have nearly the information we have now we're still continuing to work with the applicant there were three in favor of denial based on the inconsistency with the comp plan and then there was one opposed the opposition was not based on interest to not deny but to continue the item the applicant said if we continued the item it was essentially a denial because they wouldn't meet deadlines and therefore they wouldn't proceed in time and the project would just end there so three members were absent from the yeah we were missing a few that day we were down to four so um we missed we were missing four actually because our alternate and then three members it was unexpected so that was you know that was a hardship on an in and of itself based on that hearing but they did did recommend a deny based on our staff report but the one that was in opposition of the denial was because they wanted the continuance but we couldn't do the continuance or would have denied the project so um basically the first reading before you tonight although we've found it to be generally compliant in terms of if it's going to be single family if it's going to be um for the purpose of residential uses and the layout is still in the air but the the parking space is the open space all of those we found to be generally consistent and generally compliant the staff report lays out how the project has not yet been found to meet the strict scrutiny requirement as it presents the denial that went to pnz so as it notes are we in the applicant have continued to try and have this working relationship to get to this point so since pnz in now staff and the applicant have worked out that we're going to use the 8T level the navd as it relates solely to the determin of the maximum units permitted so that gets them the 16 that their their goal was to achieve at a minimum um staff requests the ability to continue working with the applicant to confirm that data sources support the ability of the project to be constructed as proposed and although 8.0 is being used to establish the density due to recent flooding the city staff is requiring the applicant designed to an elevation that is consistent and meets our ordinance 4360 which establishes our CRS it's our flood plane ordinance and number five says that we have to determine whether additional flood Hazard data needs to be obtained from other sources or shall be developed by an applicant so our engineer has been asking for additional information they've been working with us to do it but we just aren't there yet so what I'm requesting on this um first hearing first reading listen to the applicant listen to the public he take the public hearing if you find that the only issue that may be outstanding is this flood plane issue and you know design issues that can be resolved please approve it on first reading and hopefully we can resolve all that by second reading okay so if there's an approval on first reading is the approval on first reading as presented in the agenda or do we need to change um I mean I can come back up after the public hearing we can see what you know what modifications may need to be put into it but we will definitely have to change it before second reading for some things I'm just not sure why yet so I don't know if you want staff to just take that like we'll come up with Direction at the end what to do with it but I suggest that we just hold the public hearing and see what the public has to say because it is a site that sits between all sorts of residential and I don't want to Discount anyone's voice okay thank you any questions before she steps away all right okay right s good evening Carn hlam again um first I just want want to thank staff they have been a great partner working with us um having this type of information at the sort of engineering level when you come through at an annexation at comp plan is um it's a little bit unusual so we're we have really struggled to get the information um this early in the process and so they have been incredibly helpful with us working with us um in order to make everything happen as soon as possible um essentially what we are asking of course due to our funding deadlines is for the commission to approve this on first reading based on the 16 dwelling units um we believe and intend approve that the 16 dwelling units um reflects the building acreage and the density which is consistent not only with the jpa but the policies related to the flood plane and compensation and um should that not uh bear out we are willing to go to um lesser units based on that amount so um we would like to ask for a maximum of 16 uh dwelling units and we are happy with any conditions of approval that might limit it um during the engineering um phase so um essentially the conceptual plan we believe with a 16 dwelling units um as you can see it um provides for open space and parking and the level of service and buffering I thought this one showed it but for some reason it doesn't can I ask a question while we're before we get any further explain to me the funding deadline is that Federal funding yes so we have I I am not a funding expert but we have a Litany of um uh applications that we have that are um state and federal can she she can answer them more specifically sorry that is not my area Alison CL um oh sorry uh 420 Snug Harbor Drive merid Island Florida 32953 um basically the funding deadlines that we're referring to is we already have an application to the federal Home Loan Bank for a million doll grant that will receive so far it looks like we will be funded and it will receive approval in November conditioned on uh proving uh zoning that will develop what we want the other application that we're applying for is due November 21st and that is for about 7 million in change and Grant and Loan funding to the Florida Housing Finance Corporation and that is again its deadline is November 21st and we need zoning at that time to be able to move forward with that application if we don't have it we will lose the million dollars it looks like we will be funded for and not be able to get at least half a million of it because this year is the first time they've ever offered a million dollar Grant from the federal Home Loan Bank so we're that's why we're asking for this first reading to be approved allow us to go forward and continue with staff they've been great to work with and I really appreciate them as Carolyn mentioned we um there's a little bit more with the zoning and flood plane we have to work out but we have no doubt that we can do that before your next reading and you'll see the final plan at that time and it'll be very very very close to the one that you see if anything it would move the duplexes a little bit further away from the pond and expand the pond as um Miss Henson mentioned thank you so much thank you so we um believe that the proposed development is not only a good fit for the neighborhood um but also you could see on the prior Slide the elevations are varied and they're very interesting um it provides a variety of configurations and makes for a very compatible and consistent development um and we ask that the city commission approve on first reading the um zoning ordinance before you tonight we're happy to work with staff and get the plan that will be substantially similar that the things that we're working out are in relation to you know the size of the pond and whatnot so um it's of course possible that there would be less units on the plan but it would not be possible that there would be more units on the plan so if there were any changes it would essentially be a larger Pond and sort of a a change in in the location um we have a number of people with our applicant team that are here to answer any technical questions not only related to funding but if there's any flood plane or any of those types of questions we we have somebody here that will be able to answer that okay okay thank you mayor yeah excuse me I apologize before we go to public um comment because I was confused if we were just talking about flood plan am I allowed to ask Eileen a question um before public comment regarding the traffic sure okay Eileen can I have you back I'm sorry yes ma'am okay so two of my biggest concerns is the the flood plane and the traffic and I'm looking at Mike's cash email to you can you explain to me what he's talking about when he said he reviewed the project um Lane for widening and he said that he would usually recommend it but hold on let me go back over this normally I would require a right and left turn Lanes uh but the proximity to bristen Avenue makes a left turn problematic and so he's saying that uh I do not want a right turn taper but I would be willing to forgo the left turn what do you mean I'm willing to forego like is is is it e either required or not when it comes to Road improvements on public roads I do defer to the public works department if they feel that it's more problematic than it is to have like to get than it is to have then obviously they that's what Mike's email is saying um it's typically a standard requirement but there are only 16 units so um but we do recognize that that might be an issue I don't know that an issue as much as it is a requirement like he typically requires it so um but given that it is 16 units the traffic generated is going to be minimal and then the um the I guess occupant of the homes they're intended to gear toward a population that's not going to be driving a lot okay but it is very close to bristen yes can can we get the um didn't we have an aerial earlier that showed all of the developments all the way on both sides yeah I have a question get back probably on my power point I don't know if it's on Chris's thing but it might have been on this the PowerPoint that said where it was located so like the second page 16 16 duplexes no no no they're eight duplexes two right eight duplexes um single family the low density residential single family in the compant says single family only on indiv idual Lots the building code allows for one and two family to be as a single family by recognition so they're going to do two family on each lot totaling 16 units and so um and how many how many residents would be housed in each unit it'll vary and so um the the the the rate UPS is men only but the yeah I thought yeah the the occupancy of the structures as long as they meet comp plan requirements we don't have anything I realize that I still can't ask the question e i okay I'm just really curious because what I see here is um is um kind of the renderings of what's presented don't don't seem like what's presented it seems a little I'll save that for later okay so so their entrance is is that Briston right below them it is isn't it yeah yeah because that s relat yeah okay right next to Tusa [Music] yeah it's only got one in one in one out one in one out that's it onto onto Briston no on I mean onto celery excuse me yeah it's a single C which is like every other every other one almost every other subdivision has one in one out yep okay right any other questions for miss this point what yeah do you want um the applicant to come answer your question Comm man I was just real curious as to exactly what the use is going to be so because we are proposing homes there is a variety of laws that go into who and who you can and cannot have go in so right now the facility is male specific the new um homes would not be we would have to follow a Litany of you know state and federal laws we can't you know discriminate against people so there would be women that would live there um we as a as a whole they they specify a type of population that the organization supports but because of federal housing laws we can't discriminate against other people so they're but I can't we can't specifically say who would be living here so we have to follow those laws so where is the current facility it is towards the front essentially like when you when you first come into the property instead of all behind it is sort of like vacant there's a a a Circle Drive and the facility is like essentially looks like a single family home yeah it's been there my whole life it was the originally it was the um Calvin's house they live right there and there and there's 14 beds in the um we have a a special exception from the 1980s um from the county to for the facility you would never know it and this is this is a a managed Mental Health Community currently yes currently yes well it has actually vacant now right the yeah it it closed down so but this managed mental he um it yes but it there the people that would live there have would have to um would not have to be specific to the program we'd have to follow whatever you know Federal housing laws there there are um but yes the people who have needs would be man there would be management for their needs yes and to answer the traffic question we we have to follow the the same traffic generation rates as single family home homes do so our our traffic is essentially 16 units it's not dependent on who will live there right so we follow the same exact traffic generation rates that every other 16 um unit development would have to follow which was reviewed by staff okay and my understanding was is essentially it's it's individual rental units correct so who's going in is is someone rents this unit correct right okay yes and there will be different Siz units so there could potentially be single individuals there could potentially be families that there's you know whatever whoever applies and you know meets the government sub government subsidized so no it's not Section 8 um no it's not Section 8 but people with extreme mental illness how do how do how is is there rent not subsidized somehow how I mean yeah no there's not all rental these are these are correct would all be rental even though we would plat it would be um owned by the same person and rented essentially like a build to rent type subdivision that you've I assume seen plenty of these days okay thank you all right thanks um Ellen O Conor good evening and thank you for giving me the opportunity to speak tonight my name is Ellen o' Conor I live at 10:32 Oak Point Circle in Apopka and um I am the CEO of the applicant Dave's house um together with Sanford's incredible hardworking staff we have worked for the past nine months as Eileen mentioned um to submit this PD application we are proud to offer low density low impact plan that continues to address water concerns which we've talked about a little bit and you'll hear more about which we know is a priority for all of sford and also to commit to continuing our work with uh your entire team as Eileen stated as we address and finalize the plans as you heard from staff we continue to make engineering revisions to our site plan including flood plan issues that issue is largely why we ended up with a technical Denial in the uh for the PD from our Planning and Zoning meeting on October 3rd since then we have worked with the city of Sanford staff toward a continued resolution and we are gratified to appear here tonight before you with the provisional recommendation um for approval from the the city staff our plan also addresses storm water and well not from this but you can see at the back of the property that there is a large retention Pond as well as plenty of undeveloped Green Space toward the front there and around the units um the the retention Pond will be beautifully landscaped but most important it will function to capture storm water runoff the this is in complete compliance with all water regulations we understand that these are matters that will be further worked out through the full Engineering Process which comes later in the in the planning process and we as we move towards site preparation and then construction we are committed to any further engineering that the city or St John's Water Management District may require of us including flood plane requirements or storm water retention so we you know we just want to emphasize that we have worked very cooperatively with the staff and we will continue to do that to make sure the best results and closing we will be good low impact neighbors and our beautiful single family homes are a perfect infill for this small parcel on Cel Avenue I would like to thank the city team for their hard work and cooperation and working with us we look look forward to joining your community and respectfully ask for your favorable consideration for this application thank you thank you Elena Norman good evening my name is Elena Norman and I live at 7718 Hidden Ivy Court in Orlando Florida 2819 and it's my privilege to serve as the board of the president um the president of the board of directors for Dave's house which is the applicant I'm so proud to speak in favor of our application and to share how carefully we have worked to bring this proposal forward and I'd like to Echo a few of the points you've heard already this evening in addition to working with the dedicated staff to address the water concerns of Sanford city staff we have also taken great care to be a good neighbor since our community meeting at the Millennium Middle School earlier this year we've actually scaled back our plans from an original design of 13 homes to eight that is a 40% reduction in density but with no reduction in our storm water retention Pond our site retains the border of foliage along our property lines and our setbacks are all in compliance with your city regulations our setbacks are compatible with the neighborhoods on either side of this parcel and although not required by city code our site plan Embraces design principles that will help us to be a good neighbor for example we will use responsible lighting design features like low glare lighting directing overheadlight to the ground not toward the sky or to our neighbors to create minimal impact on our neighbors our plan includes a Community Center building and adjacent parking this building will be located at the very front of the property along the celery Avenue border leaving the entire rest of the property a single family the exact zoning of the neighborhoods on both sides of our property and finally the single family homes are designed to be visually appealing but efficient allowing for a lower density use of the property and adding high quality to family housing from layout and design to to design Aesthetics this is an application that Samford can be proud of thank you for this opportunity to speak to you all and to respectfully ask for your support this evening we appreciate it thank I have a couple of other questions that um and not necessarily for for you in particular probably more for the director um and um because I I I I I need to have you know just just a real feel for these people in in this project so um so as I was reading here um single family residential subdivisions currently the property houses the friends the friends of family organization established in 1989 it is a licensed long-term residential facility for adult men with mental illness and so um and and look I get it people you know we we have several manage managed you know um apartment complex is you know one in particular for homeless and and the majority of of of homeless that are you know chronically homeless also have some mental illness so I get adult men with mental illness but what I am Cur just curious about because of the area this is in you know what what are your criteria on on on adult men with mental illness do you take registered sex if offenders people with with histories of violence I mean how how I I I you know that that's the kind of thing I'm con I'm concerned about because this is right smack dab in the middle of a residential area um with children walking to school right and I hate to ask the question I see nobody's happy me asking it with the look on your face but you know I just want to know I mean you know are there registered sex offenders in in the building are there people that have had a history of violence and um etc etc hi Alison culford again I think I can whoops sorry I'm a little taller than Ellen not much I know it's not a comfortable microne I'm sorry I can speak louder but I think I think you can hear me to answer your question this community would be similar to any other Rental Community you're going to have a third party property management company that's going to require a background check there will be no violent offenders at the property they will have to do some income qualification to make sure they can pay their rent and so you're basically looking at a community that will meet any other affordable or not even affordable any other apartment is the word I was looking for apartment community where you will have to have all of those things in place so they will go through a background check they will go through a criminal history and there will be no violent offenders nothing like that um if anything is loud it would be you know misdemeanor type things like um tickets or things like that for if they drove or something like that is that particularly a residential treatment facility no no ma'am not at all no not at all this is a this is an independent living community and no it's not a treatment it and as um Carolyn thank you as Carolyn mentioned you know we have to app we have to comply with fair housing and all the other laws that every other Rental Community has to apply you know qualify for so no to answer that question no this is independent living they can work they can drive they can do whatever they need to do thank you so yeah it really shouldn't be any stigma to it it's just what's needed for housing and as carollyn has otherwise mentioned hope that helps thank you awesome and I just wanted to expand on the you know family of friends was there at that site for more than 25 years so um 35 so um the the the fact that these this organization after quite a rich history being part of this community has donated the land to Dave's house with the confidence that we will execute you know a new um a new opportunity for people who are ready for independent living and um that land is very valuable and it was donated to us directly and we plan to Steward it um very professionally and in in cooperation with our neighbors and the city so just wanted to affirm that we're very serious about executing this very high quality and and make sure that it's consistent with the neighborhood thank you um Adam Schwarz good evening my name is Adam Schwarz and I reside at 704 Terrace Boulevard Orlando Florida I'm a member of the board for Dave's house who is the applicant this evening I want to thank you so much for the chance for uh me to speak with you and to Echo the remarks of my colleagues in commending you and the city staff for your service together you've helped Sanford build on its Century old roots to become a popular and thriving Community for families and business businesses including Sanford signature downtown historic district the success of Sanford is really something to be proud of and a big part of why we were so excited to acquire our Acres of property on celery Avenue as you've heard working with your city planners engineers and land and water experts we've really lived and breathed this project since January of this year in addition to working to comply with all city of Sanford planning and zoning regulations our site design is in compliance with the city's joint planning agreement with County this jpa actually led us to a lower density design I hope we've made it clear that we are keenly aware of how important it is to manage water that is precisely the issue we've been working through including at the Planning and Zoning commission and we are so grateful for the diligent work of your staff in helping us to address storm water and flood plane design our final engineered design will have plenty of open Green Space which also benefits groundwater Movement we loved meeting our neighbors at our Millennium Middle School community meeting recently and have continued to be engaged and responsive to the follow-up contact which you've heard about we look forward to building on this track record of communication and accountability and to being great neighbors once full engineering is complete our application for eight two family homes will comply with all city of Sanford codes and regulations including density parking Water Management site layout including setbacks and Zoning I am proud to support this application and very humbly ask for your support as well thank you so much thank you Tammy agnini hello okay this is happening um great to see everybody this evening um my name is Tammy anini residing at 918 South palow Avenue in Sanford I'm here to voice my full support for this project as a former board member of family of friends I only recently um like in the last two years became fully aware of the valuable work they've been doing on celer Avenue was completely under the radar including um about 10 years ago when alfs were a Hot Topic they still didn't come up so they were just doing their thing out there on 5 acres and um doing good work and now they're seeking a new and slightly different use for their property while I do understand the original request was denied by pnz I believe that the updates and revised calculations bring this proposal into a position that warrants approval the surrounding developments have limited the property's use but I think this property this project represents an infill development that is completely ideal and a way to make the highest and best use of the space for the property owners as a real estate professional I seen no negative impact on the surrounding area as long as the property remains wellmaintained after completion the small footprint development has a much smaller impact than other potential Alternatives potentially throughout this process I've seen this team um sorry I prepare a statement because you guys know how I go off the cuff sometimes throughout this process I've seen this team research and carefully plan and then adjust their plans responding to Citizen feed back at their c meeting and they were very careful to always keep in mind what was best for Sanford citizens the city of Sanford after you know hopefully being annexed which they were um their nearby neighbors and their clients I've met the principles involved and they have greatly impressed me with their integrity dedication and professionalism the more I learn about Dave's house the more I feel confident endorsing your unanimous approval this is truly a highquality organization perfectly suited to take on a project like this thank you okay I have a couple of requests I'm not sure if there for this item or not John McKay did you want to speak on this item no okay and cendy Fenty did you want to speak on this item no okay right is there anyone else in the audience wish to speak on this item okay what okay yes come on you can come to the podium Please Mr Mayor members and the commission you may notice that Chris has been coming up to the podum no you can speak on both no you can speak on this item and on something else and so I will have the time around but you can see you cannot see the timer how you guys doing good my name is John M I stay at 352 Fairfield drive over here off in celery lakes and I you know I'm also a mental health professional medically retired you know out of Chicago Illinois and I find deep concern with this year because I see children all day going back and forth to that school off of um by in 25th whatever that is I've only been a resident of this town for 16 months so you know and I've attended a meeting a couple of weeks ago which was my first so I feel I might be up here you know visiting you guys a lot because I am concerned about the community that I live in but I think that this thing here needs to be looked at a little more carefully for the safety of our children that's all I wanted to say okay because with mental health issues everything come with it everything so let's consider that thank okay thank you than okay is there anyone else from the audience wishes to speak on the side does did the applicant want to wrap up or give any closing statement okay gentlemen just spoke on is that okay um we have had Dave's houses for over years now in multiple markets these are people who are ready for Independent Living um this it this housing is going to be available for people with disabilities so there's these same people are living probably in our surrounding area already one in 20 people have a mental illness in our community so um we find we've had a great track record of our current homes we have six homes in the Orlando area and they are integrated into in into single family residential communities they and they are living amongst the neighbors and it's been a very successful program we have case managers that are working with the residents we also have a great partnership with Spire our health partner who I'm sure you're all familiar with on Second Street um they have been our long-term partner in this program so um all I can say is that the track record that we have um makes us feel very confident that we can take the success that we've had in the Orlando area and in the Fairfax Virginia area and bring that to to seal County because these are people that are living probably in your community already but that we're offering an affordable quality solution for them so I hope that you'll consider that yes and I'm confident in that too thank you all right Miss Henson I'll just stand like this put in the mic whatever um so now that you've heard the public hearing staff still stands with the request to recommend approval on the first reading um we do feel that some design requirements are still necessary as to the Amendments on the staff report itself we don't have any conditions before you because we had recommend denial so what I'm putting forth is that we will come forward with a list of what we would feel as conditions that are appropriate if we make our if we may it from here to what we need to bring you a recommendation of approval before that's that next hearing okay is that okay okay this the part I'm uncomfortable with that this is not normally the way we do things I you know comtable approving it well well it's going to come to a second reading it'll it'll all be complete by the second reading right we approve things denied right we approve things on first reading for discussion or for modification based on all kinds of actions by this commission so that's all I'm asking for so that they don't lose the opportunity because if it's if it doesn't get approved today or if it gets continued today for us to work with them they lose the opportunity so I would like to hold that opportunity open provide them the ability to continue to work with staff staff will bring a final plan and a final list of conditions for second reading okay and in general when we go from first to second reading things can get more restrictive they just can't get less restrictive is that generally the case correct so and that's this would be as dense or as impactful as anything that could be approved on next reading the unit number shouldn't change the design criteria shouldn't change it's more the layout if we change anything and we may just come back with a recommendation that'll last us flexibility on that layout in the long run but we want to make sure that that the flood plane numbers we've been working with them on and then the general design criteria are found to be acceptable and consistent with the comp plan before recommending approval on second reading okay um mayor if I may just another consideration is that there can't be any substantive changes to the ordinance that would require a change in the title that would start the process of of advertisement over again and Public public publishing um Al so we'll make our best efforts to not have any substantive changes in the ordance OR approval all right I do see one more person in the back that I think wants to speak ma'am I have some questions for I okay go ahead and ask while she's coming up okay so Eileen I have a question about the vegetation the um I'm I'm reading that it's not required to have a fence but neither does the other subdivisions that are next to it correct single family on single family does not require any buffers or anything like that it's just backyard to Backyard backyard to backyard so how much how much so no buffer no it's as if you were in the same single family subdivision but in this case there's actually a ditch on each side isn't there yeah there's there's some there's some there's some natural barriers that will occur but basically they would just need to meet rear yard set backs and and how how how much is that how how how wide is that typical rear yard seac is between 15 and 20 ft depending the drainage easements are 25 feet on one side and 27 feet on the other side and those eement I think are on the adjacent properties not on their property okay so are there any plans for well you said there's a ditch there is the does the ditch go the entire length of that parcel yes okay well that brings up an interesting point then that commissioner U Britain was was just asking about so so if if if the appearance is that it's just part of the other subdivisions well it's not necessarily that that's the appearance it's just if you build one subdivision that's single family next to another subdivision the single family there's no buffer separations required most subdivisions do they put up a fence or they put up a divider or but it's not required because if it's no different than being in the same subdivision and having backtack set back right but from a design perspective is that going to be an odd look you know if it's if it sticks between two single family subdivisions that are of a certain Style with this strip down the middle it doesn't I mean it's no different than going through older neighborhoods that have just infilled over time and I don't think you I guess some of the houses in the other developments would be able to see through the vegetation and maybe see some of the houses but you're not going to see these they're so far back from from Cel Avenue you're not going to see them yeah I mean they may get a little closer to celery Avenue as we work on the making sure that the storm and the flood elements are met but yeah they're the way they've got it designed it's very far back on the left side of the property the like if you look at the site plan on the left side of the property you've got a whole track of land that's actually not their you can see there's no houses and no community center on it that's actually owned by someone else so only on the east side of it um we have uh NTS homes which is another Housing Development that's on celery um but it has like um an entryway and a name will this have the same thing will it be saying Dave's house at at the entryway do you know that I don't know I mean a signage we have signage for regular residential subdivisions that it would have to comply with and we have no saying what the name of Any Given subdivision is as long as it's 911 compliant um will it have the the the name will it have the name of the okay I have I I have no objection to it um I've lived in in Sanford 42 years and when I met with the two applicants um and they were explaining to me where it was I did not know because I mean I I lived off of BR bristen for 12 years and I I've never seen anything coming in and out of that so there was never any issues whatsoever it was just basically just minding their own business um I just wanted to know it might be a con not it's not a concern but most people drive into certain subdivisions just being nosy or looking for homes or whatnot like celery I I might go into celery lak celery keys I don't go into new tribes Mission because I know that it's a Housing Development so just that's why I was asking about the the residential name I'm still concerned about that turn the the right turn let me ask one more question about it okay so when you're on celery and you're turning into uh celery keys or celery Estates there is it's widen so that you don't hold up traffic right there we're saying at this particular subdivision parcel what have you there will not be that so it is a possibility that traffic could be held up right before Briston to to turn in to the left or to the right or should be any issue if you're going to the left but there is no widening right there is that what Mike is saying I thought Mike was saying there was a taper but not a lane but um I don't know if you Mr engineer Larry can come George Mr poller can um speak to the turnl if you have a question about the turnl okay yes Larry poller rce consultant 617 arv Drive ultimat Springs I'm the engineer of record um I worked with my cash on this and the code requires that you do a right turn lane and a left turn lane in into the site there's not enough right away nor is there enough room to put in a right turn lane so we went down to a right taper which is more than safe to go into the project as far as a left turn in there is no RightWay on that other property that's south of us that we do not own there's not enough RightWay so if we wanted to do a Centerline wiing or left or right there's no reason no way to do it plus it would have to be about 300 ft long so that there's absolutely no room to do it okay it's based on the speed limit that's out there the design speed okay I'm just a little concerned we have so much development happening on on celery and then Briston now is the cut through to come back to downtown especially because Millennium Middle School and Midway Elementary School is there and so the traffic is it gets very high around 3 4:00 and all of those subdivisions have the buses that comes and they stop traffic and then I think between 2 and 4 traffic goes from 45 to 20 mph because of the buses so that's what my concern is not what's going in there that's the reason why district one has an issue is the concern about the traffic that's there well I'll give a little more description um we are dedicating 25 foot in the front for the new Trail that's going through as well okay and through discussions with my cash that is probably going to help in future for the widening but if you look South there right near where the cursor is there's culs that go underneath the the road there and those are from the old tiles when this actually they grew celery out here so that's when they have the ditch there's also very large culs on the north for that ditch as well so for them to widen this road to make it useful for turn Lanes anywhere around Briston is going to be a very large effort and Mike said that's not going to happen for quite a while okay and now right across from it we do have another residential property that has been there forever I think that one is up for sale now um we don't forese there being any issues with residential being right there because it's one it's not a subdivision it's one residential house on the corner we didn't see any any issues with that thank you if you can zoom in it's on it's on the street I was trying to find out the total T the total daily traffic count for you as well as Peak counts so that kind of give you an idea of how many but it is only 16 units so it's it's pretty minimum got it all right anything else from the senson all right thank you no thank you right ma'am okay I work for a nonprofit with a lot of kids so I'm wobbling hi but uh I just wanted to chime chime in on this my name is Felicia go ahead Felicia McLoud the community calls me Lady Rain McLoud I live at 362 Cabana vew way I'm I'm the CEO of tnm the new music movement and I'm here to represent the organization um I I just wanted to chime in on this because I need to because I have um gone through a lot of treatment for mental illness and I I am not ashamed and I just wanted to chime in that if there are people who are getting treatment and help for their mental illness they are less threat than probably my beautiful house on caban view you know my neighborhood people who get treatment get treatment they're getting help if they get to the point where they can live independently that means they've gone through a process and that process is a very hard process to do it's hard for some of us to even get up and admit that we need some help okay but these men are going through treatment they're going through a process and I think there's different levels of mental illness and there's probably different levels of danger in everybody's neighborhood because I got a neighbor I I wonder about but but anyway so I feel like I understand the vibe in the room and I just kind of wanted to speak to that understand that these are men I understand as soon as we hear men crazy crazy men okay that's it but I feel like this is much deeper than that because this is a good program I've heard of your program before and I know that these people are working with these people they're working and so when you have somebody who's healthy enough to be working I think they're probably safer than anybody else's community at the end of the day I just want to say okay thank you okay so is there anyone else in the audience wishes speak to the site I have another question okay for I'm so sorry who for Eileen okay okay yes ma'am so my concern now is about the ditch right so I'm reading that the ditch long Celery Key is platted as a part of the subdivision but the HOA may have concerns celery Keys may have concerns about the the ditch we is the ditch supposed to be to assist celery keys and not for the new subdivision or okay I'm trying to find out if we would have additional flooding issues if that the water runoff goes into the ditch when it's supposed to be for the Celery Key subdivision the whole reason for why we have sort of the pause in making sure that we don't straight Rec recommend approval on the project is because we are verifying that all the storm water and all of the flood plane will meet and exceed requirements on site okay so it should not negatively impact anything around it and it may actually positively impact if we get it designed correctly okay thank but those ditches they don't preexisted the subdivisions they serve the Farms across the street right the cow Farms if it I mean I don't know if you need additional or if that's I'm just read I'm just going by what I'm reading and I'm asking the question the ditches aren't really for any subdivision they've been in existence they just help flow the water out of the area so but in terms of sites independently they are required to be designed to meet all pre-water requirements so we are working with the engineer and the whole team to make sure that the design that comes out in the end and doesn't negatively around it doesn't negatively impact any of the properties around it and if anything it'll positively impact by helping with some of that drainage and flood plan work right if if if I'm looking at the the map there and it looks like we have two other Retention Ponds yeah those are the large ones that are in those other the two in the yeah those two and then we're going to put another one back there right that's to help with that flood plane compensation so it doesn't go into the home okay and that makes me nervous the water is already there because it is flood plan all they're doing is making sure that any improvements that they make on site does not leave anything does not create anything that wasn't already um being maintained on site so those ponds compensate for any impervious those ponds compensate for any dirt moving we have a requirement of what's called cup for cup if you have a flood plane area and you move a cup worth of dirt over here you have to move a cup worth of dirt so that you never that you never change that amount that's on site okay I I'm I'm going to come to you and ask some additional questions just for a better understanding before we get this approved because I don't want something like what happened to um with Lily Court um I I get real concerned about the the ponds I know it's different Chris I just want better understanding thank you okay yeah we have our engineering staff as well Prince Bates has been working very diligently with their their team as making sure that everything that we do for this project because the last thing we want to do is build a new subdivision whether it be two homes or 100 homes that any one of them becomes vulnerable to flooding right obviously it's on the lake there is that that possibility no matter what you could get another E and you can get something worse than that however we are going to design it to the best of our ability to ensure that both this property and anything that's immediately surrounding it is not negatively impacted by the change okay I isn't our goal ultimately to get rid of all these ditches to to to be able to have every every one of these neighborhoods connected into a a sour system um you know I I know that um there have always been a lot of issues with ditches in the community I know the community of goldboro um Francis Oliver for years and years was on a on a a mission to get get rid of dit ditches because of the sanding water the mosquitoes the fact that people pour trash in them the occasional body ends up in them um isn't that overall part of our City's plan to get rid of what are you murking about it's true it's that's true isn't our plan to get to to get everyone on storm water at some point and be rid of ditches you know ditches aren't necessarily a positive thing those those are County ditches those are count dit most of the ditches in our area are maintained by simal County very few of them are City ditches okay um when we can and when we redevelop we often will pipe ditches but open ditches convey a lot of water and when you put a pip in the ground it constricts how much water it can convey so it's it's calculated as to what works best for conveyance depending on speed and volume and slopes and all of that okay thank you I was just curious because I know on and off ditches come up and but they do they serve a purpose and as as long as they're maintained they can be you know a positive for drainage it's just it's maintenance it's all about maintenance all right thank you I'm going to close the public hearing and let's see if we can get to the same as B and it should be for $327,000 as detailed in the operation expense budget proposed amendment table okay so just to make sure we have it right do we have a motion to approve the um Amendment to the operating expense budget for 2425 and second all in favor I any oppos pass answer all right thank you um resolution 3306 yes Mr Mayor members of the city commission this is a resolution that's been to you before it is a resolution uh to revise utility rates fees and charges in the Water waste water and reclaim water system the one correction is in the amendment it talks about the adjustment of 8.11% when that should be 6% and that's an increase of the water of 3.11% for SE and a 3. 11% in increase in reclaim water there is a 2% that the city commission will be the city staff will be coming to the city commission for for a uh justification for a state revolving fund loan but at this point while the material before you says additional adjustment additional 8.11% increase for water that should be an additional 6.11% for water okay so this gets us back to the rate adjustment that had been shared with the public and that we have discussed at two I think two previous meetings that is correct okay all right without the additional 2% so and there may be an additional 2% coming because we've got to be able to fund um the uh evolving fund loan to make sure we can access the cash for the treatment of one4 dioxane which is way more complicated than I can try to explain off the cut and the City attorney has apped that we cannot vote on that 2% without a 30-day hearing so that's why you have what you have before you minus the 2% okay okay and um I'd like to say although I'm very concerned about the matter I did have a meeting with Mr Johnson and Mr Maru and um can't think of your name and Sean and and Sean and we we we met and went into detail and explain the the reason being and made it easier for me to explain to my constituents of why this is necessary move to approve second motion a second any further discussion yeah I I had stated publicly I wouldn't vote for it and after meeting individually with him and thinking about it I probably I probably should never have opened my mouth and said that because I have changed my mind I am going to go ahead and vote for it begrudgingly but I think it's got to be done well and and I would say there were so many years we um we skimped on on funding the utilities departments and in the last 10 maybe 20 years we have finally started catching up um to go backwards again just puts us back where people said we don't want you to be and despite the fact that I would rather not raise rates um well I think it's what we have to do to keep the system going as a previously mentioned uh in previous under previous leadership this city was ran under a Band-Aid approach uh and unfortunately we've been uh left with some catchup and uh and this is just part of that so it will set us up for the future to ask you guys to at least review what the problem is look at it okay take a careful look at it for and support her all right right shantel's justtin until has been a really it's been a Saving Grace a place of Peace for me and happiness and um I've been supporting her for quite a long time ever since when she was across the street at um fat rats you guys know that right yes when the streets were all Cobble when you were doing the cobblestones I was there crossing the dirt and got dirt in my shoes and whatnot so I want to remind you guys that when um this meeting started before it started we started with God right there was a prayer I was here for the prayer all right and he exists so I need you all to collectively if there's someone on your team that is not supporting doing the right thing you need to challenge them and do the right thing okay because there are some missing links in this issue and it needs to be addressed I come from far to tell you this and that's what I have to uh excuse me after hearing about the you know the Foreclosure of the property and hearing about what was presented to you guys for you to vote on and then what was presented to the court being two separate things you guys was misled you know and I hate to you know be repetitive but you guys really need to take another look at what was told to you you know what I mean because it's not in the same paperwork you know you guys was told something in in Spanish and they took it to the court in Japanese you know what I mean and um I wish I would have spoke on that water thing because when that guy said it was $85 or something a month it's just me and my brother and we're paying $160 something dollars a month for water it's crazy crazy all this reclaim and recycled and these three different water bills you guys got it's absurd man it's absurd that's all I'm going to say to that for now thank you thank you Lady Rain McLoud okay I am Lady Rain McLoud CEO of tnm the new music movement Inc uh a company that is here in Sanford we've been here now four years we're in nonprofit at 501c3 the board on it has a student the student goes to seminal and she is a law student and she has given me several questions to ask you and I thought I better get my butt over here because she's very fiery um Miss McLoud public comment is time to make your comments but it's not a question or answer session or a discussion time for discussion so you're welcome to make comments but there's oh okay I thought this was a she said ask these questions of you guys well okay so I'll I'll just write I I'll write that's what I would have did I would have just wrote I never come to these meetings and I don't even know how they work honestly I write to you guys when I when I want to say something he know but anyway uh I think the concern with us is because our mission is based upon making sure that people who create music have someplace to work um and so losing one of those venues is a a very big concern for us um as an organization that's first also we are concerned about black owned or minority owned and woman-owned businesses and the sustainability of those in Sanford um and how they're kind of closing at a rapid rate um so that those that's another one of our concerns and there were some questions that these youth would like to ask and I will present those questions to you in another format um because I I try to you know keep them going and they got me today because I don't do these meetings and they kind of got me back so I'm here um so I think that if there's it the issues that I heard that were presented to me even though they were presented to me with all this energy is that there's a lot of confusion on if things were done correctly administratively uh concerning this company and there's a lot of questions on if the city cares at all about maintaining companies that have some age with them uh companies that are uh minority owned companies that are woman owned and what what you guys are doing to make sure that those places stand there's also an energy that's going on in the conversation that the city might just you know not care who buys what property for what reason and all of this the conspiracy theories are flying like you know they're like firecrackers in the room okay and so what I want to do is I want to Quil some of those things I I I believe Mr woodr and I have come to really like you I have come to like you miss I don't want to say it wrong Miss Patty sure Patty call me Pat Miss Patty I'm glad I came so I could see you before you left um so I just wanted to bring up our concerns as an organization um and hopefully I can submit these questions to you in another way and I want to say that if there's something going on if these things are true which you know we have to find that out but if if if it's true what I'm hearing um it's it's deep concern I think when the guy said somebody was speaking one language in one place and another language in another place that's kind of what I saw too when all of this paperwork was flyed in front of me um so I think it would be a good thing for you guys to look at it just so it doesn't come back up in another way and doesn't ignite a whole bunch of mess in the community because really we don't need any more mess we got enough mess so that's my statement about that thank you as you've indicated that there are concerns of an administrative matter please feel free to address them to me um there's concerns about if notices were given um in the first place if if the city is even able to show that notices were provided um anything deing administratively please feel free to share with me uh there's there's concerns that notices were not provided I think he mean to meet with you yeah I think he mean he would like he would like for you to meet with him or speak with him later oh Oh I thought you were asking me now okay okay okay miscommunication okay all right he would be happy to sit down and and um Mr Bart's our city manager would be happy to down okay and and talk to you as as city manager and and and maybe bring you up up to up to speed yeah yeah which is a nice par Park Mr boner course um the Commissioners have the ability to answer rather they want to go forward with the Foreclosure knowing it started with information they got that was not correct so they based their decision on what was said and not what was on paper so I guess again the the question is if you would um look at the facts versus what someone says and then make a decision because the information you got prior is what you base your decision on but the information you got was incorrect and so now seeing the information and being a part of the record you can now make a new decision and of course that can happen at any time and so that's why I come up trying to reiterate that um it is counsel it's been recused from four judges because it's not correct and um again what you've heard and what's on paper is very different and so I just again just come up here to say that and perhaps you'll put us in some work time work session of course I've written you Mr bonapart and yet to had a reply but Commissioner reports commissioner Britton thank you Mr Mayor um uh I'd like to reiterate what the mayor said um first of all thank you to the members of the community who take the time to come and speak during uh speak to leadership during the public comment period we thank you for being concerned in involved citizens um regarding certain matters if we've been advised by Le legal counsel not to speak uh I personally from um district one will not respond via email direct messages or one-on-one conversations respectfully um I would like to say congratulations to Mr bonapart and commissioner wi Wiggins who were both nominated and received uh the emerald government award for black excellence in Simo County um also thank you again to our phenomenal Parks and Recreation who did a wonderful job at uh the Fantastic event um it was beautiful weather um everything went well and our residents were extremely happy so thank you all for that um I would like to know Mr bonapart when the restrooms in Artisan Square would be open do we have a date yet there are some electrical issues I think uh Robert Brent Brian pass the bu no actually it is a project that's being run out of Public Works um as the city manager uh stated we are um uh waiting on some electrical work to be done um before we okay so here's here's the issue um the uh historic trust I attended their meeting and to let it be known I'm also on the tour for the Holiday Tour of Homes uh we need to have restrooms um we they're expecting 5 to 1,000 uh people to be coming into downtown um and this is via their ticket sales um it's very popular um the the meeting place the beginning place is at the Museum and the restroom is it does not work as well and Brig um has has stated that there has been issues in the past and so we talked about whether the bathroom would be available at Artis Square um if not I would like to ask the commission if I could use uh money I don't know if that's for a public purpose though because it would be at the Museum to have a portable toilet there yes so why do they need it the museum and not the Welcome Center because the Welcome Center is actually closer when they start the walk well that's that's how the trust is doing it they're do uh Bri is doing a presentation and it all has to do with the historic homes and stuff so can we also whether we do money or not can we also have the Welcome Center bathrooms open um yes but being that it's on a Saturday there's all I mean those bathrooms are already overwhelmed because we have visitors it's going to be in December our uh our holiday shopping that's why I was asking if our restrooms would be open in Artis Square then I would say okay you know maybe we could direct them to th those restrooms but if not I would really like to have uh yes um restroom the rest if if if the restroom facility is not completed in time is there any reason why the city can't have a portal poty place of there by the and just so I'm clear we're talking about an event in December Museum to do put in the grass on the when is the event date again December 7th oh I'll talk to staff I mean we'll we'll make a concerted effort to try and make it happen I mean that's we have plenty of time it's a minor electrical issue so um yeah it's it's not a major electrical problem or issue that we're having so um I'll I'll see what I can do move that along okay um I'm I'm really concerned about it too as well because if the museum is the the the location and we're they're going to have the trolley they will have the um uh golf carts and whatnot that is a lot of people to be I how how many restrooms do the um does the museum have one or is it two men's and a women a boys yeah boys and a girls um so I don't know if that's a lot on the facility I don't know if we have maintenance there or whatnot but um that that's just an issue so um I I guess we still have time so if you can get me that I'll get you an answer before the end of the week on the time commission from district one recognizing the awards I think it's important to point out that she too was a nominee and being a nominee is important thank you and there was a wasn't Nikki a nominee n commissioner again um again um last week my food giveaway in partnership with picnic project we blessed the 60 flux families with groceries uh my community meeting uh next month you know I normally have the 43s of each month but uh next month it in in December both will be on the third Thursday because of the holidays so we'll do it um November 21st and then we'll do a Thanksgiving meal afterwards I have numerous uh groups that partner with me in the last few years we fed over two 200 plus folks um and then in December again we'll do it that third Thursday there and that'll be on the 19th uh last year we did a little under uh 900 gifts for the kids so this year we looking to go over about 12 1300 gifts um we're looking forward to that anybody any guys you guys that's up here want to come out there and help out y'all always more than welcome to come on out and um I want to get approval from the board uh with a top kids Christian Academy for 125 bucks um donating uh some pumpkins they had an event last week so I want to get approval from you guys on that public purpose yes there a second was there a First well I take what he said is the motion okay second okay all in fire department than I ever was before if that was even possible um I'd like to thank Mr bonapart for being there for me and helping uh bridge the gap on some situations that I had at HCA um he is uh he's a wonderful man and friend and I I do appreciate uh I I do appreciate his efforts as well um I thank a Patty as we call her in our house uh for being there for me and my family um I thank Lisa Jones I don't thank Jerry solivan but uh I have had time to make it out in the parts and Robert uh the the new uh court and parking lot at leap Moore is wonderful uh the proper gate is up and it's wonderful uh the playground that Grove you is wonderful and I thank you and your staff for all your hard work you do um I do and I did think I reached out to Chief Perkins um we we have uh some some folks that like to hang out in our parks that are doing things that are not kidfriendly family friendly uh I don't want to ask that the police department be more proactive in our park but maybe maybe a visit here and there might might just make some people go elsewhere to participate in their uh debauchery oh gosh this sounds interesting um and so I I would really appreciate if we if we maybe uh you know if we're going to eat eat in our patrol cars or or or do some paperwork maybe maybe we do them in some of our parking lots of our Parks if possible um and I think presence uh is is always a deterrent um so uh I believe that's everything probably forgotten something and if I forgot to thank you personally or mention what you've done for me uh it's not it's not for lack of uh being grateful um so I love you all and it's great to be back doesn't mean I'll be here every meeting I have a long ways to go still U but but as some doctors have said I I've made a heck of a lot of progress in a little over a month um great and uh I in occupational therapy speech therapy physical therapy and a ton of doctor appointments and uh I appreciate all the help uh all of you have given my family and I and uh thank you commissioner just so that it's clear welcome back we're glad to see you back and glad to see that you take care of your health and we will see you as you're able thank you absolutely commiss manahy so um I I addressed the two things that I had to address um at the work session I just want to say I'm glad to see I'm glad to see um Patrick back congratulations to all of our both nominees and winners um for the emerald award yall sure look pretty in your emerald green gowns I love that color um and um I guess next next week next month is my last full meeting right because because December December I only am here for the first part of the meeting till after the swearing in right W try we were trying to get clarification on that earlier I'll have to look into that and what you and I read and I read uh ordinance and the ordinance says it's in the charter and the charter says it's in the ordinance oh so I'm not sure when we'll get that that and let you know do anybody remember when they were sworn then that's what with me in December yeah yeah I came December but uh well you moved over right the same night so it wasn't like yeah yeah that was kind of a weird thing that's right if I remember correctly of course my when I was sworn in the first time um the only time I would there would have been someone else here unfortunately the commissioner had died right um which is uh so special but if I remember if I remember correctly from from um commissioner Wiggins commissioner McCart we come to the work session and then we open the meeting do the prayer Etc The Pledge and then the first thing you do is swear in the new person and then I leave and the you after you thank me profusely hold we have we have to you a gift I T it you said you didn't want any present I don't want any but I'm going to after you thank me profusely and then you give me at least 15 minutes to make a speech Yes we have give her a cat God knows the timer doesn't go up to 15 minutes so that's all that's all I have okay so we'll that get clarified um okay I have a couple of things um and I'll send you copies of this I won't read the whole thing but um the sheriff from offat County sent a letter Thanking us for letting them borrow Chief mcneel um I do want to read one paragraph the thoroughness with which he handled the incident not only medicated immediate risk but also provided us with valuable insights into our processes the suggestions and information have already proven helpful in strengthening our procedures moving forward what happened so this is when we sent him up to help after Hurricane Helen Helen he deoy County to help them with emergency LA County where Florida Florida Florida okay the hurricane before the last hurricane yeah got it okay so he had to come back for no got it Mr May Mr Mayor members of the city commission um Chief mcne had a conflict and that's why he had asked to be excused and I excused him from this meeting but I certainly appreciate it being recognized that's another example where uh you have City staff and in this case chief mcneel that goes outside of the city to assist other jurisdictions and with that gain's experience for them to bring back to the city of Stanford um and I will also send this whole email um but basically I got an email from a resident that as hurricane Milton was bearing down his water line um broke and he had to call after hours to come out and after hours the next day during Hurricane prep and specifically called out Randy Jackson Eric Williams and cifford Lowry for um their work and expertise and how um appreciative he was that they were there and um um helping him out um congratulations um Recreation Department on fantastic it was fantastic fantastic fantastic it was really good um and the hay bale is adorable the state of the city is Wednesday Wednesday we have the state of the city at Civic Center um don't forget city manager evaluations are due by the 31st okay so please get those in because I would like to get that um state of the city is when Wednesday Wednesday this Wednesday this Wednesday it was moved because of the storm it was originally two weeks ago I thought it already happened yeah yeah okay so yeah they moved it because of the storm are there still tickets we can find you a seat city has a table they can find you a seat do you have like one
