leadership that we have for those who are behind me I'm thankful that they're willing to step up for each person that's here whether they're an employ of the city there's directors there's superintendent there are people here father that are making decisions that impact our city and I'm grateful for them I'm grateful they're willing to do that and Lord in these uncertain times that bring questions to us Lord I pray a special amount of wisdom for the people that are leading tonight Lord I pray that you'd help us to separate which side of the aisle it might be on I pray that You' $100,000 um from the original po like what what are they asking us for that we didn't cover in the original uh purchase order 4848 CU that's that's a big increase correct um the original po was just an emergency po to get them started it was for they are doing the um paperwork currently for Hurricane Milton was that that last one and so um it's going to end up costing um a quite bit more to get all that paperwork done so we knew that it was going to approximately be 150 but you just did that to put it in place okay I just wanted to know like if we're doing purchase orders why wouldn't we already know what it is got it thank you so much Cindy you're welcome I I know I've asked this before I'm sorry we feel that this is necessary that to pay somebody else to do this this paperwork yeah it helps us to get reimbursed yeah we do not have the staff to do that to do all the paperwork that FEMA requests thank federal government paperwork and P does reimburse us for this cost as well at least 75% of it 75% okay all right thank you okay item J item J is regarding the golf cart and I'm not uh don't have questions actually about the golf cart part of it it's more of an eene question Jennifer but you can you could stay um we don't have it's it's the procedure we we you you can't do golf cart registration on citizen serve what what our process and help me understand it is you have to come to City Hall fill out the application then the application has to be somewhat approved then you have to set up for a police officer to come out and inspect the golf golf cart then you get sent a sticker is that how that works I think this um the golf cart registration Roundup is to streamline the process for residents so they can come and get the registration get their annual registration sticker just like you do your car now and um and we'll have a log so be able to contact them uh going forward so it's it's truly a process Improvement for golf cart registration golf cart Guru is here who's the golf it's actually it's more it's definitely more than one it's a team team Approach at Sanford PD Oh I thought it was Mr Todd I'm I'm saying not not only just for this Roundup but I'm which the Roundup is great I think that that's good and it's an opportunity to do that but I'm saying we don't have another streamlined system to where you could uh do your registration online submit your photos and then it it's approved and you mail you out one it just seems like a long tedious process just to get a golf cart um a a a sticker for a golf cart right I I would agree with your assessment that the process seems overly burdensome commissioner when the when the process was initiated uh there were multiple hands in the pot I won't speak as to the inspection process that's conducted by the the police department traditionally however what I would tell you is that one of the reasons the process got so convoluted is that my department wasn't taking payments that utilities accepts those payments and so what would happen is my information on licensing person would take an application that person would have to be walked down to customer service reps and utilities then we would have to get a police officer or a Community Service Officer to inspect the card and it it is overly laborious and and so we've been working with the police department to to streamline that process has to be fixed one of the things that we've done immediately is you no longer have to come upstairs to get an application you can go right to utilities but when the Breezeway expansion program is complete it's going to be a One-Stop shop uh that person is going to be able to come into the uh City Hall the information licensing person is going to be right there the payment uh portal is going to be right there and the Community Service Officer is going to be right you know the next uh step over so uh in terms of One-Stop shopping the problem is going to be rectified uh with respect to your question about doing it completely online that's going to take some more conversations between Chief Smith probably myself okay and other stakeholders in the in the process I don't think the inspection process is going to be able to be sufficiently done in that manner but I don't know that that's true okay well I'm not expert in it I just when I was looking at it on the agenda I just thought about it and I was like what what's why did we take such a long process on on Just for of getting a golf cart um registered when we do so much on citizen serve it seemed like it could be an easier process but I know that there are steps and reason why you do that I'm just questioning it right understand completely can can I ask Jenner for a question please um so uh this item is is uh pretty quickly happening um do we make an exception for City events that we don't make exception for on private events this is within the 30-day window right um it it is it is I I would say that the registration is being done um uh by the police department is being done on city property it's utilizing the the overhang literally at the senior center right so whether or not it's um inviting the public at large to utilize a space for something other than what it's being utilized for is because they would come there anyway so well I I just I much like the discussion earlier of uh of uh whether or not we should be able to have a venue if we're going to have a policy uh that that uh you know I don't want to mention any names but event XYZ didn't apply in time didn't come before us in time can't have event XYZ I think we need to hold ourselves to the same standard is my only concern uh so uh I I don't have a problem with this with this event tonight I just I want us to make sure that we are uh we're following our own rules but there are certain special circumstances for example when we had the whole issues with the uh Martin Zimmerman issues the commission had to think quickly and change you know locations for our our meetings and and and have public open spaces and stuff like that that didn't require the 90 days we there are that was City commission business that wasn't a special event for me but I'm saying I'm saying if if we're going to have special event permits uh and and have standards I just want us all to be following the same standard Commissioners mayor uh the reason why we have had a short turnaround is because there was an issue with regards to getting the stickers and what we wanted to make sure was is that the rodeo is going to give us an opportunity to get the as many people taken care of with the stickers as we possibly can in a quick quickly quick and timely manner uh the stickers are had to change because we made a decision that we're going to change the colors of them so that it reflects for the officers and the Code Enforcement Officers as well that we can see the difference between year to year to year and because we are waiting for the stickers to finally come in we got with uh uh P Parks and Rec and asked if we could do this as a special circumstance one so that we could get the uh the citizens taken care of and get these stickers taken care of and so we wouldn't have people driving around with expired stickers yeah because we're we're already behind the eight ball I understand that and that's the reason why we were in this manner that we asked for special circumstances so that we can get the citizens taken care of and and and I'm I'm not trying to be difficult I just I just want us to be cognizant of of of holding people's feet to the fire let's hold our feet to the fire as well that's all understood thank you sir and I see your point but I think depending on what the event is it's okay that I mean the people that are on the C committee are the people doing the event so I think there's I think there's a little bit different Nuance there well this brings to mind a previous uh argument I've had where I think some of these events aren't so special and they shouldn't even be on our agenda but that's a different discussion but I think this qualifies again as why is this before us yeah I think we need to talk about what if there's a way we can streamline that especially things that happen on your own property that don't impact that so that can be a discussion for another time this event clearly this Stanford PD could have done this on their property on our property the only reason we brought it before you was literally for the public notice and because because it affects so many of your constituents and new growth of of golf any discussion sorry oh okay um I we we talked about this before but I just want to clarification um when we go into the actual ordinance on item E and F it's kind of left wide open and I want to read uh number F not withstanding the general provisions of this section it is prohibited and unlawful for a city employee to record a photograph any any other City employee as directed unless directed to do so by supervisory Authority to me that's kind of left wide open um let's just let's just say you're having a uh I I attended the Public Works Community I mean I mean the Public Works um can't think of what it was the Roundup or whatever and other employees were recording all of the activities is that then unlawful because those employees did not get permission from each employee to be recorded does there have to be written um you know documentation that says I attended this event when we have the bowling events uh City staff takes pictures it goes onto our um our shared drive is it now unlawful because those city employees did not give permission to be recorded Ed or photos taken well that would have been done with supervisory Authority though because it would have been a city function or the like like a retirement ceremony or or something like that okay but this this that provision which is was in the original ordinance it's meant to deal with circumstances such as one that actually occurred years and years and years ago was when an employee surreptitiously recorded a conversation with another employee to to prove some point and it was proven by the way but thought recall but uh that was not done with supervisory Authority and the employees should be be able to act normally without being filmed or recorded okay so if both employees give consent technically it's still not legal because they haven't had their supervisor's permission I agree with that okay I just want to clarify well that sounds like something we'd want to change I'm not so sure about that I mean not in this city but there H there have been situations where in other cities where a couple of employees might want to to photograph a situation in a certain context to make somebody look less than good I've seen that type of thing so unless unless unless two employees are told go out and film while you repair this or plant that or paint that they shouldn't be doing it I agree with that but I agree with what commissioner Britain is saying as well because nowadays you go to an event and sometimes without thinking you might just want to take a picture with somebody else and now you're faced with her and everybody's filming everybody's filming I I mean I guess I'm arguing point just for Devil's Advocate sake that's I guess you would think you if you were out doing some work and you noticed something like something that was wrong and you filmed it that would be with assumed supervisory Authority because you're supposed to document something that's wrong or something that's not constructed correctly or something that needs to be done later but for employees to to go out and just say we're going to cause this we're going to create a a a document a filming of an event the way we want to Stage it maybe without a supervisory purpose a authorized purpose as Allowed by a supervisor that could cause problems but the the the overall goal that section was to address the situation which occurred where an an employee was basically recording events because he wanted to prove something that was going on in his Department I wouldn't make sense to add something say you cannot do that if you have malicious intent because that would be subject to interpretation I'm sorry say I was just thinking if you added cannot do so with malicious intent but that itself is open to interpretation malicious intent is proving somebody's state of mind which right my wife's been trying to do that for years and she can't what I mean basically I mean the whole thing is about I mean filming and keeping um documents and stuff that you expect to be private right that's right well that the public would expect you to keep private right the city to keep private credit card account numbers credit card details stuff like that I mean if you're at a City Event City Event in the ter terms of an employee event do you have an expectation that that's private okay one thing that's one thing that is all very much protected these days are utility plans and Facilities okay so let's assume two employees use the utility department two employees say let's film this uh facility this system this whatever well they should not be doing that unless supervisory Authority is said to do that because that is supposed to be protected right but I think the question and correct me if I'm wrong commissioner Brittain is if we're at the um the awards the the city Awards thing and I'm filming my coworker going up and getting their certificate is that technically is that allowed I guess you don't have written documented supervisory Authority but I suppose you would also have assumed because that's normally done I guess either the way that'd be INR but I I see your point but I think that's that's the gist of your question that's what I'm asking especially because section three says then the the city manager or design ha is hereby authorized to implement the provisions of this ordinance and take any necessary administrative actions to bring it to to effect so I just if we're going to say that yes we're approving this I don't think it should be left that wide open because that that's too much like commissioner uh Thomas say there's too much interpretation that's there there's a lot of recording that happens here um I I know that sometimes guys go down in the the holes and they record it just for their safety if some if a manhole you know um the the pressure goes up or whatever to to cover themselves but they haven't necessarily asked their supervisor uh for that and this says in enf that that is unlawful and enf is not talking specifically about these protected facilities is it it's just a general it's General it's intended for employes not to be recorded one another unless there's a valid purpose basically and if you say valid purpose well that that's a problem too because that's in the eye of the beholder I suppose that's why what's the most objective thing supervisory Authority First yeah that again right so as long as it's not another employee it's okay well that's the whole point of this or and the whole point of this ordinance is to protect information and other things that are that need to be protected uh even though the general rule is you can film anything in a public space that's the whole point they're trying to make it so that you you can't film in certain areas you can't record in certain areas right and I get that and that was explained at the last meeting we when we um when we approved it on the first reading but after going over it again it's F that's got me trip tripped up because we talk about City employee versus City employee again I know that we have you know um important records and and everything else and that's why I was saying okay you know when it was explained to me why we had to do it but digging deeper into that that is left wide open and the only way I could see to constrain that wide openness would be to say that those activities are not allowed when engaged in operational activity because that's the point it's not in a celebratory activity such as a retirement ceremony or a a birthday party or anything like that or or in an event that Lisa older would like to use as a you know positive Facebook post on a city on a city uh well that was another scenario I was thinking of that means we can't detailed strategies and techniques for resolving development impacts for this project they have they've been working with us for months so um this one is they've done everything that they need to for us to know that it can go forward it's just going to be a matter of when they build to make sure that everything can be done at that time because there's so many projects in the the pipeline right now that it's all going to depend on who goes first and you know what it looks like when the time comes to build so but in terms of entitlements we have the capacity we have what we need at this point but of planning um Chris is going to give me a powerp I hope okay so tonight we're going to address an appeal by Mr Michael Williams for property that's at 251 Sanford Avenue yes okay so some basic property information the property is owned by Michael Williams Enterprise Corp doing business as Michael Williams Tires repairs and sales the property information its own General commercial with a l use of General commercial and the application before you was brought forth because the applicant submitted a letter for zoning verification to determine um whether or not the property was approved for uses such as temporary RV parking Auto Service uses and the expansion of the automobile sales area beyond that which was previously approved on a prior conditional use so in terms of Land Development regulations schedule B permitted uses outlines what's permitted and not permitted as of right and conditional use and those prohibited with each of the zoning districts this is Zone General commercial so on the screen I've included the vehicular uses and Industrial uses what's required and all of the vehicular uses in General commercial with the exception of vehicle rental which has five cars or less so I removed that from the vehicle uses and then the industrial uses any wholesale and storage uh indoor andoor outdoor in General commercial requires conditional use so this property in September of 1995 the punning and Zoning commission approved a conditional use to establish auto dealer sales with an Associated site plan defining an area in which the motor vehicles could be displayed in January of 2011 an administrative approval of a minor conditional use was then submitted for vehicle accessory sales and installation subject to a development order number 111 that development order was never executed it had a series of conditions in it but the prior company never executed it therefore it doesn't stand and it's no longer um a valid approval so as it shows up there in November of 95 a site plan was approved per the pnz approval for Auto Sales it's a pretty old site plan but to add some enhancement to it you can see where the car lot display area was allowed in red and then all the area in green is supposed to be Landscaping trees Hedges as approved on this site plan it's we've come a long way with our site plan since the mid 90s but this gives you an idea of what was approved for um him to be able to do car lot so the permitted uses for the property as its own General commercial they're permitted to do the uses that are permitted by right in General commercial subject to the site meeting the necessary improvements for any given use so if it's a restaurant it needs enough parking for restaurant or if it's a drive-thru it has to have the stocking distance any element that's approved on a General commercial use permitted by right has to be developed to meet that need the property is permitted to do vehicle deal or sales subject to meeting the 1995 site plan which we just saw it's not super detailed but it does show certain elements that have to be there at this time no other uses are approved for the site um Mr Williams when he acquired the site back in 2017 requested a zoning verification letter to determine what he was allowed and not allowed and it clearly states in this letter um that in September of 95 he was permitted to do the auto dealer sales there are no other uses permitted as listed on this so the actions that have taken on taken place on the site since this was approved since acquiring the property the property owners proceeded with expanding the uses on the property as well as failing to maintain the improvements that were required by the site plan it includes adding additional improvements without appropriate building and site permits actions taken by the owner have led to code enforcement action including but not limited to sections that were cited in schedule B and schedule e and then the code enforcement action led the owner to request an administrative determination on permitted uses and the denial development order that it's being appealed tonight so just for a little bit of like site recognition on the site this is the code enforcement photos are on the left on the right hand side is some stuff that was pulled from the Google aerial and street view as you can see the cars are lined up along the RightWay where the green space is supposed to be and on the bottom there were a series of tires and everything that was clearly captured by Google Street View so it's not in compliance with the approvals that are on file with the city so the applicant has submitted a request to appeal um I've put it in there basically he says he's been paying his his business tax receipts for seven years for Auto Sales tire sales and auto repairs unfortunately the state has preempted our department from being able to say that someone can or cannot pay a business tax receipt regardless of the use that they're saying they're going to do they still need zoning approval and they still need to meet all the requirements of Our Land Development regulations to operate a business um as part of the applicant's letters of appeal he's noted several other sites that are in violation and sites that have things that he doesn't have those sites are based on their own Merit and what's before you tonight doesn't have bearing on what other sites have gotten approved or not approved so the substance of the appeal is that the applicant has not provided competent and substantial evidence to prove entitlements for the following uses which would be temporary RV parking uses and other outdoor storage vehicular accessory sales and service and other vehicular uses as well as expansion of the automobile sales area and Associated improvements without revised approvals in his application the applicant did provide photographs and arguments about other sites that were not his own to provide evidence for his actions but this appeal is to determine whether or not the order denying the uses on the subject real property at 2501 Sanford Avenue is to be upheld or overturned not what other sites are doing if those sites are reported in compliance with State statutes and found to be in the city and in violation appropriate action can be taken so at this point the actions to be taken they need to stop further activities uses and site improvements that have not been approved bring the property back into compliance with approved plans and uses or obtain additional approvals to expand the use or development on the property and all future use and improvements on the property shall be compliant with the code of ordinances the Land Development regulations and the comprehensive plan so in conclusion the presentation has been specifically focused on the subject property not to Discount any other assertions suggestions made by the property owner but to ensure that the commission has been provided only the necessary information to take an appropriate action on this appeal so if through this process it's determined that other sites may require code enforcement action they will be managed as required by code and state statute and based on the information submitted and the actions having taken place on the property to date City staff recommends and requests that the city commission deny the appeal and affirm the development the denial development order any question not right now by chance do we have pictures from when because I remember when there was the little edge around the edges of the property do we have any I can pull street view stuff we can look at previous Aerials it'll clearly show where that green space was and there were trees there's also um Google Street View goes all the way back to like 2013 2015 2017 and it clear clearly shows the trees and the hedges that were there okay so if we need to pull them we can pull them all right thank you other questions okay Mr Williams furthermore listen I'm the pictures that I gave her what she's talking about about other people s honestly it doesn't matter because at the end of the day before I purchased the property I came up here I got a letter being proved approv to do what I'm doing if you look at you were the commissioner of that area at the time when I purchased that property you know you've been in Sanford long as I have it's always been a dealership it's always been Auto Repair even Simo County actually was a gas station well it's always ever since it uh stopped being a gas station it's always been a dealership and there and auto rep and on the Simo County website it's also listed as Auto Repair so I've never had any problems and my thing is this the things that she's talking about about this site plan I never saw it ever this the first time when they came to me about that six years later that I ever even heard anything about any of that so all I did was show her other pictures and far as you know they keep bringing up my RV I mean I'm licensed I'm a licensed dealer I'm licensed to sell RVs and vehicles and you know and they keep pushing about this RV the the paluchi downtown got three RVs in the back of their building Mr bonapart and this guy signed off on the letter giving them permission to live in an RV I don't live in an RV I live in a 4,000 foot house and I'm licensed to have mine and you harassing me and you got these people down here running on the lakefront like it's a RV park I mean to me that's you know what I'm saying I I really don't want to go there all I want to be able to do is just do my business and not be bothered I mean I don't bother anybody I haven't done nothing to nobody and then like all of a sudden it's like you know I don't know if I was struggling maybe you know it would make people happy I I don't get it you know what I'm saying I I haven't bothered nobody so I gave them pictures you got people that's got dealerships tires all Outdoors they approved these people to do dealership no pavement no Landscaping as a matter of fact nobody around me got Landscaping so I got to be the only one on the block that's got to get Landscaping I've had five hurricanes since I bought that property so as far as they keep talking about grass and trees and all that I never saw that sight plan what she's talking about so you can't come to me seven years later and and then all of a sudden shove something down my throat talking about what the other people did when I came to purchase the property I asked what needed to be done and I got my approval and I went on to do my business so the place has always been Auto Repair so now all of a sudden because I purchased it it's not zone for auto repair no more pull up your phone look it up right now I mean I don't get it it's to me it's like you know I'm just being harassed honestly and you know I know you know people get paid they need to do something for they check you know so that's fine if you harass me a little bit but just let me go on about my business now what what I do need y'all to do is allow me to put a toe Boo at the corner right there San FR new 25th Street what if I could put a little toll plaza up get some fees from the Cars passing by I need some more money help me out okay okay but honestly so I'm not here to argue with nobody I don't want to go through all this man listen I'm the quietest person on the planet i' I've been drugged in here I keep trying to figure out why I'm in here it's like somebody got a bone to pick with me but you know they keep saying about my RV I'm licensed to sell RVs now you got these guys down here well maybe I need to get on Mr bonart and this guy team so they can sign off on on all these other issues they bother me about like that's that's total harassment right there I mean you drive out of here go down here right in front of the hospital these people got three RVs I'm licensed to have mine okay there's a difference between being licensed to sell an RV and having property that is zoned to have RVs on it is that correct okay huh so that's the difference for one of the difference huh what um come on man make make that makes sense so I'm licensed okay so mine is for sale what you would that make you happy I mean that come on man that's that's being petty let me let me finish wait okay so what what does it take for him to be able to con continue the auto repair and tires well but so now you want to put me out of business basically come on man y'all can find something better to do with your time man I mean this hold on please I'm trying to help you here all right okay so what do you mean there's not enough space to do that okay thank you can I ask you a question has any body complain about my business to y'all y'all just come up and y'all making all this up nobody have come to you the question is whether it meets the requirements or not okay so in the Land Development regulation Schedule E has minimum lot size and minimum Frontage requirements for auto sales or Auto Sales with repair repair separately and then the accessory sales of tires does not have any so if he has Auto Sales and auto repair meaning actual work on the vehicles besides just accessory sales of tires or alarm systems things like that that's an accessory sales and installation that's a different use but the repair and the auto together is required to have I believe an acre of property and 100 ft of linear Frontage I don't know that he has that because he hasn't applied and I don't have the surveys and I don't have an actual site plan showing that he can meet the requirements because he's never applied okay but wait but okay so that was originally a gas station with a service Bay right and he came through the conditional use process so is that taken into consideration and the conditional use process the use that he had has been replaced with a new I'm talking about the when the building was built it doesn't anymore because it's no longer it's a non-conforming use that's no longer in use so but a a gas station is service if he were a gas station not a repair facility our definitions have changed obviously in the decade since it was built so Auto Repair he could do without sales sales he could do without Auto Repair I don't know the overall size of the property and the frontage to be able to tell you whether or not he meets the requirements for both okay it's just it's I mean it's been that way for in excess of 10 years that we have requirements for Auto Sales to make sure that they're not you know putting the quarter acre sites with auto dealer and Auto Sales and outdoor storage and I mean we as as a team you know for the city of Sanford to make the automob dealer the automobile dealer that we're along 792 Sanford Avenue we went through all that process to to improve those sites and we have definitely you know minimized our number of repair and sales facilities along those corridors okay all right questions yeah um because I'm looking at a bunch of dates and the information might be here but I don't want to go through all of this so okay so I'm seeing like 1995 a lot and then 2011 okay um let's bring it up closer when was the last time what when was the most current time do you know or um Mr Rondo knows that that you gave the information to Mr um Williams regarding um the development order no well he's been up many times over the years I it's always been verbal and over the-counter so I don't have specific dates for you but I do know that the letter that I showed Chris can you pull back up the PowerPoint um the letter that I included in here I truncated it I took out the signature block but I was the one to write the letter in 2017 and it is on file and it did go to Mr Williams per his request this is a requested letter we don't generate these unless an applicant or owner asks for one okay so you say in 2017 right in 2017 Mr Williams asked for this letter it specifically says auto dealer sales it doesn't say anything about Tire changes it doesn't say anything about um repair it just says that any change or expansion in use or modifications to the site or structure may require a new conditional use for said modifications okay excuse me continue I okay and then um so with that afterward in 2011 I believe it was romano and Sons owned the property they came forth they wanted to do the tire sales at the location it was approved but they never did the followup that they were supposed to do mhm it had six months to get it done they didn't get it done the approval has lapsed they were informed of this romano and Sons they were the previous owner so okay um when Mr Williams took ownership it had been six years since that happened okay and the letter he got doesn't even reference repair or tire sales it just says you have auto dealer sales any change would require potentially a new conditional use and he asked for that this letter I would have to pull the as400 files from you know but this is not something we generate unless asked by an applicant got and there's a fee to obtain this letter as well understand okay and I just want to make sure okay so it says based on City Records no sign copy of the development order was ever received nor was an application for an engineering plan ever submitted by the property owner um through the city as required and Mr Williams was I'm just clarifying he was notified that he needed to have the uh application and Engineering to the city because that had long since expired when he purchased the property okay so what was he what was the information given to Mr Williams that stated that's it right there this letter right here that says you can do automobile dealer sales and any change would require potential new condition Le right so he did not disclose that there would be anything else but what what is here right we this is a letter we wrote to him so he said what can I do on the property this is a zoning verification letter and this is it clearly states that those are your permitted uses excuse I don't me to cut off but Len so they just drug me before the special magistrat twice telling me that I wasn't even liced to sell cars this guy twice they they know I wasn't even legal to sell cars there all of a sudden I can sell a car one minute I can one minute I can't then they said oh you can't have outdoor storage I had a big old 55t semi I got rid of my semi because they told me I couldn't have tires stored Outdoors but then we did at the meeting and then the special magistrate asked them well what would he need to be able to store tires outdoors and it be okay if he had a container something then they say yeah after I go get rid of $20,000 I'm saying this is I uncal for and this guy knows twice they drug me to the special magistrate now you can find a letter but when we went to the magistr none of this existed Mr Williams this guy is our director Mr Tony Rondo okay first and then second I'm clearly reading in the letter it says any change or expansion hold on I never hold on I'm reading here it says any change sir or expansion in use or modification to this site or structure may require a new conditional use that's there in clear writing sir I never got that letter what regardless did they say the sky is yellow I never saw it this guy they just drug me before the special magistrate and told me that that didn't even exist you could go pull up the recording so they started telling me I'm being fine for selling cars now all of a sudden I can sell cars and they a letter I never saw that letter I don't care what that letter say I never saw it was I've been a six years going on this my seventh year there doing everything that I'm doing Tires auto repair Auto Sales now just because this grown a little that's what has gotten everybody bother me and that's all I can see so I'm just telling you I've been there doing everything that I'm doing I've been paying my tax receipt and I keep my place clean and don't B nobody and people don't have nothing else to do but just come trying to wck what somebody doing I don't get it like this ain't how business supposed to work and then you're harassing me I mean I mean no I know what I'm going to do next I I I'm G to let y'all do what you do but I'm telling you now see I'm I was not going to do all this I was not but I'm going to get T news I'm going down here to these RV I'm going show them my letters I'm just going to all this I'm going to hire me an attorney because you're wasting my time I've been through the special magistrate twice I said you know you know I'm not going to do all that so now I'm just go Facebook live I'm going to make noise if you want me to make noise I can make noise I try to keep my cool but like you harassing my business you harassing me this ain't cool so I'm not no dumb who don't know what know what I'm saying handle me like no idiot because right now back and forth and my time is valuable so I've been druged to the special magist now you talking about taking away for sir that's enough okay taking my Frey my like we need to continue the meeting sir was the um the site plan from the original development order would that have been um recorded no no no it's just on file in the office also ask this did he did he get did was he sent to the magistrate and said that he wasn't able to sell a car that's no sir that was not the issue at all that that was not brought up um and and as to the issue of harassment I think I should speak to it you'll recall that about about a year ago uh the owner of the property of where Angel's food is located was brought Mr Bill kersa was brought before you that's how all of this started we were brought to the area about complaints of of the illegal storage uh at the time Angels had a uh container vehicle parked illegally in the back of their establishment and what was supposed to be a Swale we took action on that and as you know that when our Code Enforcement Officers go into an area to look at one complaint they kind of do a sweep of the area to look for additional similar complaints and and that's how this gets initiated that's how it's brought to our attention so this was never an issue of whether or not you can sell cars we have a record through Google Street View I just checked it very quickly that the landscape and the trees existed as recently as 2020 and with respect to the three RV is not that it's gerain to the situation it it's really should not be considered in this particular denial or approval however I would mention that those three RVs in questions that belong down to ethnos have been there since the 90s with the approval of not Mr bonapart not Tony Rondo but the commission they sure sir let him finish so to make a long story short uh sometime that those approvals did transition from the commission uh to the executive branch of city government Mr bonart made those decisions and uh it's potentially a vested rights issue now that's where we are they have electric uh and I would speak to the 25th Street situation uh this is not an RV sales issue this is hooked to Electric hooked to water uh clearly there are signs of habitation however uh Mr Williams contends that uh it's his children that are staying in it you they stay there after school regardless of who's staying in it someone's staying in it it's not an RV that's for sale it's being used' got that and B sign okay sir sir sir can you please sit down you so they can and this in the letter I put it in the notes and all of y'all should have it their letter give these people permission to live in an RV and now that is not the issue so so the first issue the first thing that he would need to take care of is to put the landscape back that was removed after 2020 you said it appears to be there as recently as 2020 mayor okay so he' need to remove that and then he could apply for a conditional use for the what type of repair is he doing I don't know what what what kind of what type of repairs do you do do you only do tires or do you do other repairs I do I do buy here pay here I sell tires I put tires on my customer cars I fix the cars that's making payments if if the cars ain't running they don't pay me so we do tires I sell to the public as well so if you come in and need an auto repair if we can do it we do it and I've been doing the same thing there for six seven years and now all of a sudden this come up but what I'm telling you I'm going to have somebody to pull the notes because he's saying tonight that he never said that I wasn't able to sell Autos there and everything is recorded in these meetings I want to have it all pulled back up but I'm saying y need to stop that I think it's childish and I really think like you know like I almost feel like you playing on my intell Mr Williams we trying to get all the information sir timeable so ours you bring me in at least be honest I mean don't come you know with that child stuff one minute you say something then you come back and now you not being productive anymore Mr Mayor I think it's at this point that you need to just uh make a decision because it's not going anywhere that's one last question so if he brings the site back into compliance what what is the easiest path for an approval for the The Limited Auto Repair his best first step is to do a pre-application conference with staff to which he can submit a site plan showing how he meets the requirements and schedule each and how he can make the site meet the requirements for the rest of the ldr in terms of parking space for display area for storage of whatever Vehicles may or may not be in the process of repair and see what staff returns to him during that preapplication it's doesn't cost him anything except for him putting together the plan in order to request and I know that he's done pre applications for things before but yielded nothing but that's his best bet okay because my mind it's always it had at least one I think a two bays for repair always so but in doing the conditional use they may limit the number of vehicles he can have on site they may limit the you know that he can't have outdoor storage while the cars are being repaired no more than so many and that's something that he'll have to comply with if those are results of the conditional use okay thank um my only concern concern is and I is just just like the notification if he wasn't if he wasn't notified that he needed to have all of that especially if the Bays had already been there and and I can understand because I've heard that from other businesses it's just the lack of knowledge you not being aware that you have to have that but if he was notified of that and he's gone through the special magistrate and stuff like that then hey by all means it's it's what the city you know we're going to follow the the guidelines of the city I just want to make sure that our businesses are notified of what they have to have and not being punished because they are not aware of of of certain things because our our businesses are specialized in those things that they do not specialized in government you understand what I'm saying so that that's the reason why I was asking for all of the dates was Mr Williams notified of this because if you're just trying to get one thing through you didn't you don't know then okay well if I want to add something else I have to do this have to go through through that that's all I want to know is was he notified of this and I'm pretty sure if you've gone through the special magistrate or whatnot I get what I'm saying I'm just trying to get clarification all right district so I'll go ahead but I just want to make sure I'm I'm I'm making sure I know what I'm rejecting and it's rejecting the appeal relating to the property so what happens after this before I say I move to approve or not what what's next steps what am what is the actual Den nowal help me understand that well he needs to bring the property back into compliance which would mean add the landscaping and and then okay sir that's between you and the person that sold it to you then no I came down here before I bought it and I asked them about everything that they doing there now all of a sudden this letter pop up but I filled out a paper uh my intended use for that property I put everything on there what I'm doing now and now all of sudden we don't see thater but we got this one that I never saw okay needs to be back brought back into compliance that's what that's back into compliance and if he a curring fees um wouldn't his original business license say what it was for well this real quick there's no such that's a misnomer there's no such thing as a business license you're paying a local business tax okay that's all it is it's the payment of a tax like Eileen mentioned specify what the business is doesn't matter the state you could I could get a license for just well not there's certain things that require require proof that you're licensed like an attorney or a doctor but other things I could I could go pay a license for repair Auto Repair I have it's a tax it's a pure payment of a it's a pure payment of a tax nothing more land use can't even be checked the attorney general has said local government stay out of it just take the money and that's all there is to it it's payment of a tax in in layman's terms what Mr Groot is saying is that we have to take the business tax regardless of what they are uh what they're applying for however we put a disclaimer at the bottom of our business tax receipts that specifically says that the acceptance of your tax is not approval for the use that it must apply with all of city codes and Land Development regulations all right commissioner Breton you want to continue yeah I move to deny the appeal and affirm the denial development order and the decision of the administrative official is there a second second discuss I affirm to deny the appeal that I means I'm I'm holding up what City staff State and I would say if it's back in compliance and he were and this appeal was to be able to continue to use those bays in a reasonable manner my vote would be to allow that I agree with that okay but we need to get to that point to be able to do that right nobody's trying to stop yeah business or development just trying to make sure we do it right that's all okay any other discussion all in favor I I any opposed pass un answer who was the second on that one please me all right that brings us to citizen participation if there's anyone in the audience that's wishes to speak to anything not on the agenda they right leave somebody walk me out to my my okay then I would like to um make a brief change in or small change in the agenda and move item m to the beginning of other items so that uh our friend here doesn't have to sit through a through L is that all right with y'all yes okay so item M impact Feed Department deferment yes Mr Mayor members of the city commission City staff is requesting City commission consider an application for impact fee deferred for payment in the amount of $1 128,129 paletto Avenue okay I I'm unclear on one thing are we able to defer the entire 128 or are we only deferring 36 I will defer to to uh the City attorney on that front mayor I I believe and and Mr Groot and I met uh at length this morning I believe what the commission deems to be the appropriate action is something we can accomplish internally administratively but I will defer to Mr Groot on his differentiation because I I think it has Merit But to answer your question uh we can get to wherever the commission determines we need to be okay it's my opinion that under the codes which this deferent is allowed the maximum amount is 3978 why can't we defer the the other amount there's no provision for it we're deferring of the of utility impact fees with connection fees um there's and if you do do something outside the code then you set up yourself for why not sort of jeopardize the entire code and you also set yourself up for if not if him why not me and there's also covenants in the FD loan documents that you'll adhere to your code so that's that's those are the issues and Cindy I you got two different answers yep and I have third uh and and mayor if if I suggest and it's the pleasure of the commission uh if we can introduce this topic gauge the commission's uh uh valuation of working with the the applicant on this matter I I think there are some solutions but if if if that's your your pleasure we can uh start by introducing the project and getting the applicant up here and the applicant and I did speak a few hours ago uh he has asked that he he speak to this actual uh matter so all right because I my I don't have a problem deferring it and if our code needs to be changed to allow us to defer it I would say we need we should change the code unless somebody is going to tell me there's some reason you know you need that that impact fee at the beginning like we're going to spend it by the time CE right right okay so however you want to proceed okay so uh briefly Brady lard Economic Development Department uh I will give you a little bit of history on this project uh most of you uh know the applicant and and coincidentally and and probably of much value was there's a project that this gentleman and his team uh completed uh about a block uh East uh of this site but about a year ago and in in full disclosure I I reached out very early in my tenure here to Mr Matthews as a representative Trafford Holdings and quite frankly said hey what can we do to get this project moving uh at that point in time uh the conversation was uh as expected to me anyway that hey Brady I want to build it you want us to build it but there are shifting Sands as far as uh the capital markets and and the market at large uh at that time we did not have this uh conversation on the U deferral or potential deferral of impact fees but we agreed to hey let's figure out a way to get this project moving forward um the San Leon is the project I mentioned earlier the San Leon is a beautiful project uh on the corner of second and Sanford Avenue for any of you that have been by there uh at uh at the outset of that project uh the similar uh uh if not same ownership group did not make uh a request to defer impact fees although they contemplated it market conditions lending rates things of that nature uh didn't uh require them at that point to do it so fast forwarding is our conversation matured and and Mr Matthews will tell you I called him a number of times a week trying to get this project vertical that's that's what the economic development Department's uh goal is to do so as those conversations started to mature we did talk about uh the potential for deferral of impact fees uh Mr Matthews proposed it and I said Dan that is something that in my tenure we have not done yet but I do know that there are uh availabilities of of such relief I love the fact that quite frankly Commissioners I don't consider this an incentive uh it's it's a revenue neutral uh opportunity to facilitate a project happening um and I I will let Mr Matthews speak to his uh uh business plan and uh business partnership's uh uh perspective on this matter but uh I will say to answer your question uh Mr Mayor I I would not dispute what Mr Groot says that there are some uh Bond Covenant issues related to it but he and I did speak about some alternative methods to again keep this a revenue neutral um uh motivator for going vertical um fast forwarding to today if if you haven't driven by the site I know commissioner Britain you do all the time as you as well mayor but the majority of the commission probably has seen this this is a project that is fenced off ready for construction um so with that I'd like to uh introduce Mr Matthews on behalf of ownership uh have him discuss some of the uh items that I've just listed but then also have the opportunity to talk about some of the uh creative ways I I think we can uh all leave with um one a great project to a great corporate partner and three a project that benefits the citizens in city of sford so with that Mr Matthews good evening um Mr Mayor commission members um this isn't the first time you've seen me up here pitching for this project um uh you've already awarded me and I um the tax rebate equal to five years yeah all right okay well no we really we really appreciate it okay I mean so and what I'm say and also the CRA has has awarded US1 $100,000 construction Grant provided we can get construction started by the 1 of March um and we're grateful for the city's support um uh this honestly the city support has been instrumental to getting us this far given all the stuff that's happened in the last couple years and the markets with regard to interest rates and with regard to materials and all that type of thing um I also like to to um thank up front Brady lard Pamela Lynch and um Tony Rondo who have helped keep us going forward and I we really appreciate it I really appreciate it personally um and I also want to say before we get into it I understand that um any additional incentives I.E the deferment of impact fees and other fees um that I'm seeking here tonight are completely at the discretion of the commission so I'm here unbended knee for this one um before I get to the uh legal basis of my request I would like to clarify exactly what I'm requesting um I looking back on the application it wasn't made completely clear certainly it wasn't reflected accurately in the in the staff memo I'm looking for four things one is uh a deferment of the police fire and Recreation impact fees which come out to about $32,000 imposed under the city's unified um uh impact fee ordinance second I'm looking for um deferral of the water and sewer impact fees about $96,000 imposed by um article 10 of chapter uh was it chapter 102 on utilities thirdly I'm looking for deferral of water and sewer connection fees imposed um in article six of chapter 10 uh 102 which includes the the meter setting fees and the tap charges and fourth I'm looking for deferral of building permit fees of about $50,000 I would note that we have already paid a site development permit fee of about $122,000 um uh so the total amount that we'd be seeking deferral on is about $177,000 plus whatever those uh those tap charges are tap into sewer um uh in addition to um that we will be paying the county $260,000 in Impact fees so this this project is about $10 million and we're going to have impact fees in excess of $450,000 between the county and the city so nearly 5% of the total project costs are devoted to fees and the and and um uh other charges to the the county and the city um I want to emphasize we're not asking for a reduction of any any of these fees we're just asking that um we we will pay 100% of these fees um in any event but we're just asking that the these uh fees be deferred until the issuance of a CO okay now um just to come to Mr groot's uh point in um in the staff memo what is the legal basis uh for the city to Grant the incentives requested um and you probably know this better than I at this point but there are at least four different economic development incentives um in the city ordinances uh three of them appear in Article Five of chapter 2 which deals with Administration and and also includes the section on economic development and there's also um an article in um oh excuse me a provision in article six of chapter 98 on taxation which deals with ad valorum uh relief um and additionally uh which was cited in my application and referred to in the in the staff memo there is a a section which specifically authorizes deferral of the police fire and Recreation um impact fees but what I want to direct your attention to tonight is something different than that um the commission also has available to it a much broader more General basis for awarding economic incentives and specifically I would like to direct your attention to division one of Article Five of chapter 2 um um which uh is entitled Economic Development incentive program um I've never applied for this one previously but uh let me just uh read some excerpts from that from that um from that division and um you can read the whole thing like but I just want to for the sake of time just want to pull out some of the parts that I'm relying on it says the city may enter into agreements to participate with commercial developers in the establishment or expansion of new or existing uh Commercial Business the city commission shall based upon consideration of adorm tax base expansion determine the type and amount of Economic Development incentive program assistance granted the economic uh de velopment assist and I'm jumping down so if you're reading along you're probably falling behind uh the economic development incentive program is available to qualified commercial commercial developers to expand the city's tax B tax base and or increase the number of jobs available in the city and the last section of that that I would like to point to is the section 2. 365 about the agreement on that it says if the applicant meets the requirements for economic development incentive assistance then the city may enter into an agreement to provide Economic Development incentives and so basically this is the broadest type of um uh uh authorization for the city to enter into an economic development assistance agreement so my my position is is that while there is a specific reference in one article in chapter 98 about you know police and um police and fire and Recreation impact fees you actually have something much more powerful in this other section which allows you to provide anything I mean if you read the full the totality of that statute you can lend money you can provide other types of support but um basically the only requirement is that you you have the funds available to do it and since this is pretty much revenue neutral that's not an issue and then that the other requirement is that it be reduced to writing as an agreement um um uh I would so what I would like to do based on that provision is to request that the the commission exercise its discretion and defer the projects um the the fees that I referred to before the four categories of fees and in connection with build building um building and uh excuse me impact and building fees with uh until such time as the co is issued um and I'm not sure what discussion will be so I'd like to reserve a little time to re to rebut anything that comes up other than that but I think it's a pretty simple position that um as when you look at the um the this uh economic assistance provision thank you okay so let me ask you a question about that because I'm I'm pulling it up and it appears to be based on job creation well it has two two segments it says either you you consider the the the increase to add vorum tax the taxes collected they add valm tax value and or creating 20 additional jobs or 15 additional jobs whatever the number is um I guess it's 10 10 additional jobs so and then when you go down farther it repeats that same kind of provision it says consider the the impact on ADV valarm taxes and or the additional uh employment in the city I mean this project will create additional employment in the city but since we don't have any um leases for commercial tenants yet I can't really tell you exactly what that impact will be but there will be a positive impact in that regard what is your estimate well we um for the the um based on the San Leon experience there are 10 10 employees not all full-time at the fox at foxtail coffee so that's probably that's at least seven or eight and we have four times the amount of of commercial space so I'm thinking that you can probably count on you know 30 to 40 employees there are you count are there any employees for the apartments aren't there employees there uh there are no employees there we have we will have a a private management company that already exists and they don't they don't operate on site okay yeah [Music] okay so I'm still not clear on what we can and can't do well based upon what we want comment on that based upon the argument that was just made first of all you're expanding the application which that's that's something that you you consider doing I suppose but under the program that was just cited and I'm going to play Finance director for a second it says subject to the availability of funds so if you were to do what is being asked to do which is toer the payment of that additional 140,000 beyond the the 31 32 then You' have to encumber take some funds and encumber them while you deferred the payment so you could defer it for a period of time and then require the payments to unencumber those fund Cindy I'm playing Finance director am I going down the right you'd have to encumber the fund so that $140,000 more you'd have to take them somewhere encumber it for payment for those connection fees water and utility fees and building permit fees put them in the in encumbered status and then unencumber them when the payments came in payment is made so Cindy yes Cindy because I can't see Cindy there um so that would be like we're just on the um the reserves thing we would just say you know 140,000 reserved for whatever just like we we do now for if we um set money aside for a project that we want to do in the future we want to make sure it's still there okay all right you might want to do that for a Time certain so you don't wait a CEO gr and I talked about this that the Project's abandoned you never get the CO that is correct mayor uh and and Mr Matthews and I didn't have an opportunity to discuss that but a doomsday scenario would be potentially okay we're going to defer defer uh Mr Matthews impact fees uh without a Time certain uh and the project for some reason does not occur so I think Mr Matthews would be amable to some sort of I I think we were talking construction of 14 months 18 months but could work with him on that but uh I I appreciate that cynth as well because as as Lonnie's comments got distilled and and Mr Matthews and I discussed this that is is the type of uh um fix that we would look at and again I I do want to stress though one point of uh contention with Mr Matthews one I I could not think of a more U suitable project for downtown this will be a phenomenal addition to both our residential and our retail uh inventory downtown I am inescapably um convinced that this is a revenue neutral uh situation on the deferral impact fees but uh the addition of of waving were we waving or deferring those building impact fees just for clarification Mr okay so I I think in the first iteration you had said the the waving or maybe I misunderstood but as long as that's the case then then the encumbrance of those fees as well uh would be something we would work with Cynthia and and the city manager with but I did want to clarify that that as long as this remains Revenue neutral uh there are no uh objections from my department uh and certainly uh supported that consideration I have one question okay um so you know just to to clarify I'm hearing defer not eliminate and um I believe that it will be a great return on the city's investment and Mr Matthews has a proven track record for the city of Sanford from everything from timeliness on out but you said something about 170k and I'm just confused about it because you were said you were asking for several different things and we're approving the 128 so I just want to clarify what you're exactly talking about yeah he added some something about tap fees to the water okay yeah there there are four the the the there's four elements the two are listed in the in the staff memo and the the third one what are the the tapping fees and the and the um uh sewer connection fees and then uh the fourth one is uh deferring the building permit fee itself which is about $50,000 in this case Okay so tonight we're you're asking for us not to approve the 128 but in a sum of about 170k about 177,000 plus whatever the tapping fees are that includes the building permit fees yeah yeah that 177 includes the the $50,000 building permit I get that I just wanted clarification on what we were actually doing okay I question Mr Mayor so in that case what what I would propose if the commission decides to uh take that or a similar course of action is a an amount of deferral not to exceed and safely could we call that $180,000 Mr Matthews okay okay that that's what I would suggest on that front uh Mr Matthews yes first Kudos on the research you've done and the job that you did putting all this information together because I know you pretty done a pretty good job of explaining why you are doing this the fact that it's Urban infill just reaches my heart here I love the fact that we're trying to build up within the city so and and like commissioner Britain said you've got a proven track record um if you did not I think you're also asking for this now because you expect interest rates to go up so it would just cost more later if we don't do this now well if every dollar that I can defer is a dollar I don't have to borrow until later and so that that's the the motivator here okay so so yes it has an direct economic impact on the the finances of the project and the cost of building the project okay thank you any other questions before I ask a couple other staff members no sir all right um on the Water and Sewer connection fees is there any downside to deferring those Mr Ronda you're next good evening mayor commission Brent Johnson Public Works and utilities director um with respect to the um the other fees I would leave that up to the Senate attorney as to whether or not that's appro but with respect to uh the meter sets and sewer taps I would much rather that fee get paid because those are materials in the ground um versus some of the other things which are just a waiver of fees for review and staff time but um those um actually include materials that we would have to actually install in the ground so I'd feel more comfortable having that paid for but as far as um the impact fees I don't have a problem with that as long as the City attorney has no issue all right and I don't know which one of you are going to answer this question when in terms of the development do the water and sewer connections get made well that's up to him when he needs it um but when he does need it I would prefer that he go ahead and pay for that fee that's a fairly minimal fee uh compared to what he's requesting be deferred um but I would rather have that fee paid like I said that's up to him when that get when that happens um he lead he okay he takes lead on that of what I where I was going is the city actually has to put money out for that yes sir correct that's in addition to that 96,000 that's a separate item that was not in the letter right right yeah our connection Fe would estimate that the amount of those fees would be 68,000 bucks okay all right and then Mr randoo any impact on your department if we defer building permit oh c l Commissioners mayor this is a decision for you to make I would tell you that you know Services have been rendered or being rendered uh we're going to have to do a you know a cost benefit analysis to determine whether or not recouping those fees is proper but I would tell you reflexively I have no objection to what's been proposed here this evening okay any other questions for okay sir in terms of what proposed here this evening the agreement that's in the packets can have be modified yeah I'm thinking he would what's been proposed right in word verbally not the in the P have is modified it does get recorded it does run with the land it will be an incumbrance on the property so okay anybody so we're agreeing that he will pay the water and sewer 68,000 well that's what I'm going to suggest so we'll defer the rest but I want to check on what the timeline is for what are we talking about for timeline and so impact fees police fire and was Recreation included in the calculation because I didn't see it in the packet Recreation impact fees are included in the 32,000 okay so we're deferring those to co correct hearing yes okay so those would go to co um water and sewer impact fees would be deferred we were talking about time certain what time are saying I think he was talking about setting a or what Brady had suggested was a an 18-month window you know at the end of 18 months whether you have the co or not that's the deadline for making the payment which is acceptable to me of course and contingent upon the uh Reserve encumbrance that we mentioned with and sendy you're okay with 18 months okay and then and the building permit fees would be at Co to get the CO okay correct all right and then uh mayor importantly to exclude the actual fees and and cost related to meter sets right and and connections yeah okay and so now God I thought it was 400 and the demolition of the other one it's what we get for using licensed contractors we could get it done a lot cheaper the cost of the modular building was more than anticipated and so just almost a little bit just off off topic this is what it it would actually cost if another organization was doing something like this may we should Habitat to do it Christopher Smith project planner um this is the state contract cost for which is basically a piggyback on the state contract cost for the Triple wi unit they have various units that you can purchase but this right here is a triple and so this is almost half the price of what the actual unit cost the the site work site work can be quite expensive you have engineering and permitting you have you have to do we have to run the water from around the north side of the building to get to there we have to recut the asphalt and add Taps to get into that sewer manhole that's sitting right there um and then the electricals coming out of the electrical room at West Side which we have the capability and capacity we have to do a new panel and new conduit run plus it also includes a 1in empty conduit for a spectrum cable or our cable not Spectrum excuse me so we can provide internet connection to the unit uh one good thing is we do not have to really do any site work on the site because we're sitting on top of uh the pay parking in the back the anticipated goals when we purchase the Westside additional land in the back for 7.9 Acres there we'll have additional parking that'll make up for any of these lost of six faes in West okay so my reason for asking this was is because we've done a lot of uh haven't had a lot of discussion and conversation with the Goldsboro Museum and if it cost this much they have a very limited budget and so I it doesn't seem realistic okay y not that I'm against this at all I'm just saying if that's this cost how will they but and and the truly sad thing is if they had talked to us before they submitted their Grant application this would have been match and they would have gotten a million dollars okay no further question just it's okay it's uh you know we saw we bought the triple white that at Mayfair basically the same the same size and it has gone up $120,000 since you put that one in again cost have estimated but and regardless of what happens with the museum site this is in my mind this is a much better situation for front porch oh I agree well it also will help west side the museum because now she doesn't have to accommodate the the this will impact of the remaining fiscal year this be estimated to be 81,000 will be funded with the sources that you see there this is to allow a public works training supervisor full-time position any questions Russ to allow a public works training supervisor come on clarify that for me so we have one on duty and they're not fulltime and we're making them fulltime what's this um first of all um I believe there's a um a correction that needs to be made in the item if I'm not mistaken this is actually a new position is that correct Cindy okay so this is not a reclass this is a new position and so what we do now we currently offer CDL training um to city employees and we put a lot of people through that program and so what this is is this is creating a position for that CD trainer but in addition to uh training City staff or on um getting their CDL license or commercial driver's license which is CDL uh in addition to training them uh to get that license that person will also be in charge of doing safety programs doing monthly safety trainings um and um uh putting on uh safety workshops for for employees is this necessary especially because we have other vacant uh positions I don't know how this is NE if we have an approved it in our original budget why is a crew leader for training necessary at $81,000 right now well I think 81,000 includes benefit I don't think that's the salary I think that's including benefits but um like I said that's so if we were to have somebody come in and train our staff on CDLs the benefit is that person trains them they'll retrain them and then they'll give them another refresher uh We've looked that um the cost benefit analysis and to bring somebody in to do that training uh would be significantly um more than having someone in-house Do It um I think On Any Given year the number that we came up with um was well over that $80,000 if we brought somebody in just to train for CDL and we still don't get the other safety component of that having them do safety uh workshops and and safety training yeah the state changed requirements for CDL license in terms of training where we used to do it we would be very expensive to do as we used to but we're keeping this position would be onone so it would still cost us more than $81,000 eventually because you it's $81,000 2025 and 2026 and 2027 so we're looking at millions of dollars I don't see because this isn't a reclassify this is a new position and I don't see the need for that at that amount and we didn't look at that when we did our 2024 2025 budget my my understanding of reading this is we have to pay this to for the drivers annually or repeatedly it's not a a one-time fee to get your CDL no it's a one-time fee okay to get the cdl is a onetime fee you have to renew your license like you normally do any other driver's license but uh to get it as a one-time fee okay but you have a person who's doing all this now and has gone through all this training and they're going to presumably be in this new position which means their old Position will be vacant correct then you're going to eliminate that position no that position will be filled that's an actual storm water forming position he actually takes time away from um his storm water crew leader position to do the training um so there's a very good chance that uh if we don't have this position he could step down from he's doing the co training as a courtesy to the city he's a licensed certified CDL trainer so there's a very good chance that if uh we don't create this position then we lose uh that person to do CDL training can we do both of those jobs with one and a half people I wish there was a way and quite naturally we knew that um you know just simply training for CDL wasn't going to be a a full-time all day everyday position that's why we coupled it with safety training um as you all know we do uh safety incentives and bonuses which Public Works and utilities has not gotten I believe in the last two or three years so it' be a good opportunity to to train our guys on safety um more consistently which we haven't done uh in Prior years um not just for the sake of getting the bonus just so that we're safer as a city and that's just you know every accident that we can reduce that's less money that we're paying out as a city so how many employees per year do you project would have to go through the CD that I don't know it depends on how many employees want to do it that are currently here it depends on how many new hires we get that need it uh as a requirement for their job it varies I really couldn't answer that question I can tell you in the last class that he did I believe he had five or six and he still has a few that are waiting on him to do a a class currently which uh I think is two or three and then there's a refresher there's someone who's taking the class and is having a hard time time passing and so he's going to do do a repeat class with him so I see right now off the top of my head maybe four or five waiting we had a difficult time enough just trying to get just trying to to to balance the budget trying to give raises I I I don't I don't I don't I don't necessarily understand that however I'm not the director so I don't know what the actual need is in it but when we were looking at the bigger picture this wasn't I mean we're too close to the budget that just we just approved I think that that should have been brought in then we should have been knowing about the the um CDL just for training purposes if it if if if this crew leader was doing something in addition to that then I you know dual or something but I I I not comfortable with that when we were so pressed with the budget that we just approved like literally scratching off stuff we cannot afford to do and then to be able to say boom $81,000 and not $81,000 this year but the next year and the year after that I mean I I don't understand it and this is not enough information for me to say I approve it Mr Johnson yes ma'am when you arrived at the 81,000 and the title training supervisor this person is going to be actually supervising people or well put that aside for a minute right pretend that there is nobody involved in assuming this position that you just decided that you needed this function how did you arrive at calling it a supervisor and how did you arrive at the salary okay um like I said I don't believe I believe the salary includes benefits I don't think that's just the salary and Cindy can correct me if I'm wrong but um whether we termed IT training supervisor or coordinator uh the fact remains that based on their skill sets based on what it is that they would be performing um we determine that that's the um uh a sufficient pay grade for them to be at so like I said regardless of the title with the supervisor or coordinator um what have you um we decided that that was a a safe pay grade for them to be in based on their skill sets or the required skill sets joh like Mr BR said why wasn't that put in when we did the budget so that is something that we were contemplating we were actually looking into that as a part of the budget as um uh you heard before from our rais consultant this is one of the biggest we had one of the biggest Capital programs we ever had in the city so we were kind of focused on that and we were looking at this as an option but we also wanted to look at the cost benefit of it so we put together numbers but unfortunately we weren't able to put all the information together in time to submit as a part of the budget but we have been working with Finance for quite a while to qu finance and HR to to include it but we just weren't able to pull it together quickly enough because we were kind of focused on some other things during the budget process can I just ask a quick question what can I ask a quick question yeah in the fiscal statement it states it's going to be funded through storm water water and general funds so is this person going to be for streets storm water and utilities yes this will be spread out they they're they're training uh all the different divisions all the different departments um and so anybody even if parks and wck needed someone to come through the CDL program um they would come through us but that position will be funded out of multiple divisions within Public Works and utilities but see it's the possibility that's getting me it's not saying okay the city of Sanford provides this and then Simo county is sending their employees through here and we have 10 available positions And from the month of January to June they go through this process and that's what that person will be doing it is based on maybe somebody might need a CDL or maybe someone that had a CDL is no longer here or moved on it's not enough Assurance for it to be almost a million dollar including fringe benefits for me a million dollar a million I mean not a million dollars $100,000 but I'm saying you know what I'm saying $100,000 if it was a million doll I was going to apply for that position okay M Mr and most of the time it's included as a part of their probation period they have to get it within that probation period Well I'm sorry you you uh you also said something I want to emphasize um there are certain departments that have not qualified for the safety incentive award the last couple years which also is costing us in risk management and automobile insurance fees yes sir this position is going to do safety awareness training Etc to hopefully accomplish that and save the city dollars other ways that is the plan yes sir but I mean we do safety lunch we I that that's not that's not making a break in the bank because I mean you can get a paper cut and lose the safety incentive well if you're admin you could put yeah I'm just saying I mean so but I mean I mean the city manager's office can lose their safety incentive if they've had to go you know I bump my knee and you know I got to go report it to HR so that's not going to make a break I again I'm not against it right because there's a lot of things that we do out in the field like trench safety and and confined Spas training uh and things like that that honestly we I we honestly don't do it right now um so it'd be a great benefit to us to be able to offer that training lock out T out um just a lot of different uh safety programs that we don't have okay I say we either move forward with it or somebody move to continue so they can bring us back more information if you think that to continue to bring back um more information um just regarding the number of actual employees that this will be servicing um throughout the year I just need members of the city commission the city um HR and risk management director has provided you the um information that Mr group prepared pertaining to the City attorney so if you could please get to her by the end of the business day on Thursday so we can go ahead and start the process that's all than nope all right um you know when I talked about ml I I should have also said what a great event the whole weekend was um I think that parade was probably the best MLK parade we've had um on Tuesday the peace and Justice Institute did what they call a table talk which is similar to sford speaks but it's not specific to sford or the REI um and had over 50 people come to Hopper Academy and talk about history and um growing up in neighborhoods and differences in neighborhoods um and it was a a really good event with a really good mix of people um Nikki was there do you agree with me good mix of people yes um and so we're starting the skate the Locust Avenue skate is coming back correct yes we're going to do that it's going to be an event um and along the same lines um the REI is working to schedule a Sanford speaks through the mayor's youth Council which will be at seol High School in April um and they will be pulling kids from from classes to to have a conversation I think they're doing two sessions so um I think that program is um doing well and getting out into the public and getting people talking uh commissioner Thomas anything uh I agree with that this uh table talks was oh that's right you were there too sorry very informative and uh I learned a lot again I could listened to Julia Wright Brunson talk for years that woman is full of knowledge um as the mayor said I attended the newly elected officials training and uh that definitely filled in some gaps for me I look forward to an advanced session of that um also I know that we do at the beginning have prayers or somebody speaks at the beginning of each meeting and I believe that we invite people from all different faiths to that uh didn't seem to me at least on all the meetings that I've attended that we're getting enough diversity in that I don't know if I can contribute to it or if we all find people ourselves and give them to commissioner Wiggins who seems to be the man when it comes to that no problem no problem okay we'll do thank you that's all I have okay commissioner wi as you stated uh again great job with MLK Jr uh steering committee the activity they had last week was uh was awesome well week before last and then uh also picnic project my partners my brothers we uh this past Friday we able to bless uh about 70 more families and so we did that on uh Friday and then they were with me on Saturday so we did almost almost 200 families with groceries so once and twice a week you guys like I said if you know anybody that's in need picnic project even if we're not giving it out throughout the community they do it at the church so just let let us know that's it all right commissioner brenon um Mr Mayor and members of the commission I just want to um make a statement I begged I begged the citizens of district one to put me into this position I knocked on doors I asked for money and I am going to do my absolute best to serve those people and I know that you know the members of this Das may not understand everything that I am trying to do but because I am in a very active District I am going to be very transparent in 2025 that is why I'm asking for meetings to be recorded that's why I will be making more of a social media presence in in district one in the past I have done so much behind the scenes that it's not seen I want to give an example commissioner wigin has his community events that's wonderful the public uh the community um uh meetings and this the feedings and stuff like that district one is a lot of behind closed doors I need my constituents to know exactly what their commissioner is doing on their behalf also I want to make sure that I'm transparent so that it does not look like an attack on our city manager when I bring forth issues whether it be at an evaluation or brought to this di I am also covering myself because it's not always how what you say but how you say it and that is why I am asking for to not have a one onone privately but for it to be recorded after speaking with legal counsel I know that I need to give Mr bonapart the respect and the option to say yes commissioner I will allow for a recording or not and if not I will do my 101's via email because I believe in being transparent in that I am a very good commissioner I will not go another day without showing that that being said I have a couple concerns regarding district one it's almost February and the reefs are still up on the poles so I don't know how long we've done that I used to think by the end of January those are already down but I'm still seeing the Christmas reefs up there um also walking up the stairs uh the hallway our roof has been fixed for months now I don't know why we still have that huge stain in the middle of the floor let's do better on our presentation I'm not that might be a work order that's out there but that does not look good especially heading towards the administration office um I have uh been having pre- meetings with City staff and the city manager and those have been going very well I have requested that so that we don't waste taxpayers time meeting just to meet having these meetings prior to with staff hashing out everything is being very helpful for when I bring the residents business owners to the table so we can actually get something accomplished I will not be meeting just to meet this year um just to let the city manager know and the commission know I will be requesting a work session with economic development with our Merchants we had one earlier this year it turned more into a complaints complaint session um Mr Mayor you attended that as well I would like for us to schedule one in the future maybe on a Monday I don't think Brady is here but on there you goady on a Monday when it is not as busy for our Merchants so that we can actually get something productive done they can hear from us and then we can see what it is that we can do for the future of 2025 2026 I believe we have phenomenal staff here especially in our Economic Development Department and so I just want to make sure that we're able to to be prod Ive and our our last little work session we didn't really get that we were limited on time and we spent most of that time complaining about the city instead of actually getting some things done um and I let me make sure you know what and I think that is it other than saying kudos to um the MLK just like everyone else said and that concludes the district one report commissioner Bon when would you like to have that meeting with businesses um I will get with Brady okay regarding that um I want to give the businesses enough time to do that I don't want to schedule it for February um I would like to say March that way we can make sure that all of the merchants might be able to attend and then also I spoke about it in the work session but I want to put it on your list if if you didn't have it I would like to have that um meeting with commissioner Wiggins regarding the picnic project um to talk more about the homelessness and how we can streamline those servic if you can get with the cleric to schedule it we'll do that all right then we're Jed
